I received this from a practitioner in response my earlier post about Garland’s ongoing scheduling and due process fiasco @ EOIR:
Glad you wrote this. It has been so hard. I am working 7 days a week and feel like I am losing my mind. Hopefully they start making changes, because how this is currently going is just not sustainable. Many of the Judges are not granting the continuances or making you go to the IH and giving you a hard time about it. Multiple Judges told me a month or even less notice was “plenty of time.” O boy!

I couldn’t even believe how an immigration judge talked to me today about a few documents that were untimely filed because I had 20 individual hearings in October and oh pneumonia that wasn’t getting better with antibiotics. The most amazing thing about it was that it was DHS who requested a continuance because they still didn’t have my client’s file – we were ready to go forward. I can’t stand that place anymore. At least a lot of my cases got transferred to the new courts.
As my friend Judge Wayne Iskra used to say, “This system is broken!” It’s actually getting worse under Garland. No way that he and any of the “faux liberal” imposters surrounding him (Monaco, Gupta, Clarke, Prelogar) would practice under these circumstances. It’s a clueless “Dem elite” that needs to be held accountable for their grotesque, totally unnecessary mismanagement of EOIR. Sorry this happened to you Ellennita! It’s no consolation, but dedicated practitioners across the country are being subjected to the same unconstitutional, unethical, abuse by Garland and his incompetent minions! I’ve pointed out before that many, probably the majority, of unnecessary delays in Immigration Court can be attributed to EOIR or DHS!
