WASHINGTON, DC – On July 2, 2019, Attorney General (AG) Barr published a final rule, further expanding his authority to reshape immigration law. The rule was issued in a highly unusual manner by resurrecting an old proposed regulation from 11 years ago and making it final within 60 days without any opportunity for public comment.

AILA President Marketa Lindt said, “This regulation exemplifies why the immigration courts should not be housed under the Department of Justice (DOJ). Under this administration, the AG has already utilized the certification power in an unprecedented manner to unilaterally strip immigration judges of basic operational authorities, interfere with judicial independence, and even attempt to rewrite asylum and detention laws. The American legal system is designed with fundamental procedural protections, such as briefing by the parties, to ensure the decision maker-here the AG-hears all points of view before deciding an important case. This new rule, however, authorizes the AG to singlehandedly designate Board of Immigration Appeals (Board) decisions as precedent – and do so literally overnight bypassing the necessary legal procedures and without any checks and balances.”

AILA Executive Director Benjamin Johnson added, “This is the most aggressive effort to unify control over the immigration courts in 20 years; I have never seen an administration claw back a discarded rule like this in order to further assert its power. The scope of this power grab could be immense. This rule attempts to shield decisions issued by the Board – including decisions for which the Board didn’t even bother to write an opinion – from federal court review and tries to force the U.S. Courts of Appeals to presume that the Board reviewed all the available information and claims made by the parties even if there’s nothing to show the Board did so. Simply put, the AG will have more power with less oversight, and immigrants’ right to appeal to the federal courts will be far more limited. This attack on the judicial branch proves further that our nation urgently needs an independent immigration court system separate from the Department of Justice. Nothing less will suffice.”

Every Court of Appeals Judge who signs off on one of these constitutionally defective removal orders produced by EOIR, an illegitimate “court” that functions without either fundamental fairness or impartiality under procedures that no such judge would accept if applied to them or their loved ones, should hang his or her head in shame.

Once the Trump nightmare is over, courage and integrity to stand up against Government overreach should be the touchstone for all future Article III judicial appointments. No more “go along to get along” Federal Judges at any level of the system! The Judicial Branch was actually conceived and established as a protector of liberty and justice against tyranny, not as an enabler of, and apologist for, “abuses by the Crown” (or in this case, “the Clown”).

What kind of “judge” stands by and watches while empowered cowards like Trump and Barr unconstitutionally “beat up” on America’s most vulnerable who seek only the basic justice and fairness that our Constitution supposedly guarantees to “all persons.” Judges who allow the dehumanization and “de-personification” of others, in others words “Dred Scottification,” might someday find themselves and those they actually care about becoming “Dred Scott” by their dereliction of duty!

WASHINGTON, DC – On April 16, 2019, Attorney General William Barr issued a decision in Matter of M-S- in which he determined that asylum seekers who establish a credible fear of persecution and will be placed in removal proceedings are not eligible for an individualized determination of their custody status before the immigration court.

AILA Treasurer Jeremy McKinney stated, “With this decision, the Attorney General is unilaterally depriving asylum seekers of their right to a bond hearing in front of an immigration judge despite the fact they have passed a credible fear interview administered by a USCIS asylum officer. By overturning Matter of X-K, which provided for an independent review of the government’s justification to detain someone, the Attorney General is sweeping aside 14 years of standing Board of Immigration Appeals precedent that the courts and DHS have long implemented. This is a devastating blow to those seeking protection from persecution at the U.S. border, since far more will be held in detention. This decision further expands mandatory and prolonged detention of people who are neither dangerous nor flight risks, practices which are constitutionally suspect and a waste of taxpayer money. This administration is using detention as a sword against both due process and the humanitarian principles our nation was founded upon.”

AILA Executive Director Benjamin Johnson added, “While Matter of M-S- will not take effect for 90 days, the impact of Attorney General Barr’s decision, along with the other decisions issued by his immediate predecessors on asylum and the nation’s immigration courts, cannot be overstated. With full control over the immigration court system, the Attorney General is not only rewriting asylum and detention law but also stripping judges of the most basic operational authorities and judicial independence. Asylum seekers arriving at the southern border can be processed in an orderly way while also being provided with thorough and fair review of their asylum cases. To accomplish that, the immigration courts must be allowed to operate as courts, not puppets of the Attorney General. Without delay Congress should create an Article One immigration court system, separate from the Department of Justice to counteract the political machinations of the administration.”

There is no end to this Administration’s campaign of unrelenting cruelty toward asylum seekers. Even lack of ability to carry out their morbid fascination with creating the “New American Gulag” —-  this time targeting individuals who actually have established a “credible fear” of persecution — doesn’t deter their inhumanity. It’s likely to face Constitutional obstacles, at least in the lower Federal Courts.

AILA gets it right. It would be possible to fairly process asylum seekers with additional trained Asylum Officers (not Border Patrol Officers masquerading as Asylum Officers) through an independent Article I Immigration Court System committed to fairly and efficiently applying asylum laws. Lawyers are an essential part of the equation.

We should stop confusing families seeking asylum with “security threats.” Indeed, the obsession with those who present no real threat to our country actually detracts from efforts to combat real threats — drug smugglers and human traffickers. Those require undercover and anti-smuggling investigative techniques that have little to do with individuals and families turning themselves in at or near the border to apply for asylum or building physical barriers (although a modest building program could be part of a rational border security package).

True “Border Security” doesn’t require harsh, demeaning, or unfair treatment of asylum seekers, nor does it involve huge walls or more immigration prisons. A fairly administered asylum system along with targeting of smugglers and other criminals and more attention to the root causes of the migration would actually enhance real border security along with Due Process and adherence to the rule of law.

WASHINGTON, DC – On August 16, the Attorney General of the United States issued a precedent-setting decision, Matter of L-A-B-R, that limits the discretion of immigration judges to grant continuances. By restricting the court’s use of a vital docketing tool, the decision further erodes judicial independence and will pressure judges to deny more continuances at the expense of due process.

AILA President Anastasia Tonello responded, “With yesterday’s decision, the Attorney General has tightened the vise on immigration judges even further by interfering with an important case management tool that judges use to ensure cases are resolved fairly and justly. Every day, people who are eligible for relief must come before the immigration court and request a continuance until U.S. Citizenship and Immigration Services (USCIS) is able to make a decision. People who are eligible for permanent residence based on marriage to a U.S. citizen, or for protection as cooperating victims of a serious crime, may be deported unjustly if the judge is blocked from granting them a continuance. Justice cannot be dispensed on an assembly line, but Matter of L-A-B-R- seeks to do just that by pressuring judges to deny continuances and move cases rapidly through the system without due regard for potential relief.”

AILA Executive Director Benjamin Johnson stated, “While playing the role of both prosecutor and judge, the Attorney General continues to perpetuate the false narrative that immigrants are to blame for the long-standing inefficiencies that plague the immigration court system while rewriting our nation’s immigration laws. This decision is especially troubling because it will penalize people for something they simply cannot control: the notoriously lengthy USCIS processing times. Matter of L-A-B-R- is yet another reason why Congress must pass legislation establishing the immigration court as an Article I court separate from the Justice Department. Until Congress acts, the Attorney General will continue to encroach upon the independence of the courts, forcing judges to order people removed without a fair process. Congress must stop the administration from turning immigration courts into yet another enforcement agency.”

“Once again, the Attorney General cites flawed facts to castigate the immigration bar for the significant case backlog and inefficiencies in our immigration court system,” said Benjamin Johnson, AILA Executive Director. “He blames immigration attorneys for seeking case continuances, disregarding the fact that continuances are also routinely requested by counsel for the government, or are issued unilaterally by the court for administrative reasons. In fact, although the report cited by the Attorney General indicates an 18% increase in continuances requested by respondents, that same report found a 54% increase in continuances requested by the Department of Homeland Security (DHS), and a 33% increase in ‘Operational-related’ continuances. That said, continuances are often a necessary means to ensure due process is afforded in removal proceedings. The number one reason a continuance is requested by a respondent is to find counsel. Other reasons include securing and authenticating documentary evidence from foreign countries, or to locating critical witnesses. And when the government refuses to share information from a client’s immigration file and instead makes them go through the lengthy process of a Freedom of Information/Privacy Act request, a continuance is often a client’s only lifeline to justice. For the AG to blame immigration lawyers for imagined trespasses is both malicious and wrong. We will not let that misinformation pass without setting the record straight.

“The immigration court backlog is a function of years and years of government spending on enforcement without a commensurate investment in court resources. Our nation would be better served if the immigration courts were an independent judiciary, free from the auspices of the Department of Justice, where every immigrant has access to counsel. Immigration court is not small claims court or traffic court; each decision has the potential to tear apart families or keep them together, to destroy businesses or build our economy, to send someone back to certain death, or bring hope for a new and better life. Immigration judges should make those decisions with all information at hand, without any undue influence or arbitrary case completion requirements. That is a goal we can all work toward.”

Sure matches my observations from the latter part of my career at the U.S. immigration Court in Arlington, VA!

Probably 75% of the cases on my “Non-Detained Docket” were there NOT at the request of a respondent or his or her attorney. No, they were “mass transferred and continued” to my docket unilaterally by EOIR to fulfill “Border Priorities” established by the DOJ during the Obama Administration as an adjunct to changing DHS Enforcement priorities.

And, these weren’t “short continuances” to find a lawyer or prepare an application as might be requested by a respondent or a private bar lawyer. NO, these were “Merits Hearing” cases that had often been set for late 2016 or 2017 hearings before one of my colleagues, only to be “continued” by EOIR to my docket for dates many additional years in the future. Indeed, many of these cases were unilaterally removed by EOIR from “Individual Dockets” and “orbited” to my “Master Calendars” (arraignments) years in the future — indeed years after I would be retired. That’s because my docket was already completely full for several years when this chapter of ADR started.

And the same was true for my colleague Judge Lawrence O. Burman. Indeed, at the time I retired, Judge Burman and I were the ONLY judges hearing “nonpriority, non-detained cases” — even though those cases were BY FAR the majority of cases on the Arlington Court Docket. And, to make things worse, my “replacement” retired at the end of 2016 thus resulting in a whole new “round” of ADR. 

Talk about ADR driven by incompetent administration and improper political meddling from the DOJ. And, from everything “Gonzo” has said and I have heard about what’s happening at EOIR, such impropriety has become “normalized” under the Trump Administration.

No court system can run efficiently and fairly when the perceived interests of one of the parties are elevated over fairness, Due Process, equal justice, and reaching correct decisions under the law. No court system can run efficiently and fairly when control over day-to-day dockets is stripped from the local US Immigration Judges and Court Administrators and hijacked by officials in Washington and Falls Church driven by political performance objectives  not by practical knowledge and day-to-day considerations of how to construct and run a docket for maximum fairness and efficiency under local conditions (the most important of which is the an adequate number of pro bono lawyers to represent respondents).

NO OTHER MAJOR COURT SYSTEM IN AMERICA OPERATES THE WAY EOIR DOES! THAT SHOULD TELL US SOMETHING!

So, why is “Gonzo Apocalypto” being allowed to get away with misrepresenting the facts and intentionally running the Immigration Court system for the perceived benefit of one of the parties and against the interests of the other? There is a simple term for such conduct: Ethical Misconduct. Usually, it results in the loss or suspension of the offender’s license to practice law. Why is Gonzo above accountability?

NBC 4 DC: White Supremacists Target AILA National HQ in Downtown DC!

“Two members of a white supremacist group hung a banner decrying the “Dreamer” movement outside the American Immigration Lawyers Association office in D.C. Saturday.

Surveillance video shows two men hanging a large banner outside the office on G Street NW in broad daylight.

“They stood in the windowsills and they put a sign up over the doorway,” said Kenneth Thomas, who witnessed the men hanging the banner.

The sign read, “We Are Your Dreamers No Amnesty Identity Evropa.”

Identity Evropa is a white supremacist group “focused on the preservation of ‘white American culture’ and promoting white European identity,” according to the Anti Defamation League.

“There was a gentleman across the street who hollered at them who said, you know, ‘Nazi, nazi, fascist’ whatever,” Thomas said.

The two men then ran away.

News4 spoke with the witness who yelled at the men by phone. He did not want to be identified but said the incident shocked and angered him.

“It’s a scary time right now. I think that they might have the expectation that they’re not going to face any consequences,” he told News4.

D.C. police are investigating the incident as a possible hate crime.

Ben Johnson, the executive director of the American Immigration Lawyers Association, said the organization is saddened but undeterred by the banner.

“It’s important work that’s, you know, the constitution commands us to do and we’re not gonna give up on doing that. We’ve got a long, proud history as a nation of immigrants and we’re proud to be part of that,” Johnson said.

“Dreamers” refers to the hundreds of thousands of young immigrants who had been given a deportation reprieve under former President Barack Obama’s Deferred Action for Childhood Arrivals, also known as DACA.

President Trump ended the program in September and has told lawmakers his hardline immigration priorities, including the wall, must be approved if he is to go along with protecting the young immigrants from deportation.
