Bain “screamed” at the lawyer for more than five minutes, mimicked her voice, called her “several disrespectful names,” said she was “unprofessional” and refused to allow a recess…”

Surprisingly, and sadly, Judge Quynh V. Bain is one of my former colleagues at the U.S. Immigration Court in Arlington, Virginia. The Arlington Immigration Court generally has had a well-deserved reputation for fairness, professionalism, respect, teamwork, and unfailing courtesy. In other words, it’s always been a court where lawyers on both sides enjoy practicing. Indeed, it often serves as a “training court” for student attorneys, interns, new Assistant Chief Counsel, and newly appointed U.S. Immigration Judges. So, I’d have to assume that this was an aberration in the context of Arlington.

Nevertheless, given the high stress levels that U.S. Immigration Judges are already working under, the plans of Attorney General Jeff “Gonzo Apocalypto” Sessions to “torque up” the pressure on Immigration Judges to turn our final orders of removal without much, if any regard, for due process, the counter-pressure from the U.S. Courts of Appeals for Immigration Courts to function like “real” courts, the many newly appointed inexperienced Immigration Judges, and the lack of meaningful training for Immigration Judges, I would expect such incidents to increase in the future. Just another reason why it’s past time for an independent Article I U.S. immigration Court!

Changing to the topic of Law360, one of my favorite “immigration beat” reporters, Allissa Wickham (a/k/a the fabulous “AWick”) tells me that she has left Law360 for a “new gig” with HBO, working on a show featuring Wyatt Cenac (formerly of the “Daily Show”). The show is scheduled to air this spring. SO-CALLED “SANCTUARY CITY” NEW YORK SEES AMAZING DROP IN CRIME! — Maybe Gonzo Should Stop Lobbing Anti-Immigrant Grenades & Study What Actually Works!

“It would have seemed unbelievable in 1990, when there were 2,245 killings in New York City, but as of Wednesday there have been just 286 in the city this year — the lowest since reliable records have been kept.

In fact, crime has fallen in New York City in each of the major felony categories — murder and manslaughter, rape, assault, robbery, burglary, grand larceny, and car thefts — to a total of 94,806 as of Sunday, well below the previous record low of 101,716 set last year.

If the trend holds just a few more days, this year’s homicide total will be under the city’s previous low of 333 in 2014, and crime will have declined for 27 straight years, to levels that police officials have said are the lowest since the 1950s. The numbers, when taken together, portray a city of 8.5 million people growing safer even as the police, under Mayor Bill de Blasio, use less deadly force, make fewer arrests and scale back controversial practices like stopping and frisking thousands of people on the streets.

“There is no denying that the arc is truly exceptional in the unbroken streak of declining crime,” said William J. Bratton, who retired from his second stint as police commissioner last year.

But officials see one area of concern: an uptick in reports of rapes toward the end of the year. The increase, which officials said included a higher-than-normal number of attacks that occurred more than one year ago, coincided with the publication of accusations against powerful men like Harvey Weinstein, which gave rise to the #MeToo movementencouraging victims to come forward. City police officials have said they believed news coverage played a role in the spike in reports, though they also credited their own efforts combating domestic violence with encouraging victims to speak up.

And while rapes were down from last year by one, to 1,417, misdemeanor sex crimes — a catchall for various types of misconduct that includes groping — ticked up 9.3 percent to 3,585 so far.

The lower homicide numbers are still preliminary — and include one announced on Wednesday night — but they jibe with large drops in killings in major cities like Chicago and Detroit, while contrasting with sizable increases in killings in smaller cities like Charlotte and Baltimore.

The city today is a far cry from what it was when Mr. Bratton arrived in 1990 to become the head of the then-separate Transit Police. Not only were there 2,245 killings that year, but there were more than 527,000 major felony crimes and more than 5,000 people shot. Shootings have plunged to 774 so far this year, well below last year’s record low of 998. And for the first time, fewer than 1,000 people have been hurt by gunfire: 917 as of Sunday.

The continued declines are a boon to Mr. de Blasio, a Democrat elected on promises of police reform — promises that prompted warnings of mayhem to come by his opponents in 2013. But the opposite has happened, putting him on stronger footing as he pivots to a second term with a Police Department transformed to exercise greater restraint as it focuses on building trust in the city’s neighborhoods.

Franklin E. Zimring, a professor at University of California, Berkeley, School of Law, said the downturn was an “astounding achievement,” but it raised another question: How long and low will crime fall?

“We don’t know when we’ve exhausted the possibilities of urban crime decline, and we won’t know unless and until New York scrapes bottom,” said Mr. Zimring, who analyzed the first 20 years of New York’s historic crime reduction and expounded on it in a book.

Mr. de Blasio and the police commissioner, James P. O’Neill, credit recent drops in crime to the Police Department’s emphasis on going after the relatively small groups of people — mostly gangs and repeat offenders — believed to be responsible for most crime, while also building relationships in communities where trust has been strained.

Mr. Bratton applauded political support for the police from the mayor, who provided funding for investments in officer hiring, training, equipment and overdose-reversal drugs.

One of the results is that police officers are using deadly force less often. As of Dec. 20, police officers intentionally fired their service guns in 23 encounters, a record low, down from 37 in 2016. The Police Department said officers were relying more on stun guns, which were used 491 times through November, compared with 474 times during the same period in 2016. More than 15,000 officers have been trained how to use them.

But criminologists differ about the cause of the continued declines. Mr. Zimring said that while better policing accounted for much of the decline in crime since 1990, it was no longer a primary driver. New York is “tiptoeing” toward a 90 percent crime decline for reasons that remain “utterly mysterious,” he said.

More broadly, research suggests that crime trends are closely tied to economic conditions. Interest rates, inflation and unemployment are among the macro-level factors influencing crime, according to James Austin, the president of the JFA Institute, a criminal justice policy nonprofit.

“What the Fed does will have more of an impact than any sentencing or police reforms,” Mr. Austin said.

The reductions in New York are a part of what the Brennan Center for Justice expects will be a 2.7-percent decline in crime rates and 5.6-percent drop in murder rates across the country’s largest cities. After record-high bloodshed last year, killings in Chicago have declined 15 percent.

Through August, rape was down in New York City 7 percent compared with last year, but a small increase in September was followed by spikes in October and November. The New York Times first published accusations against Mr. Weinstein on Oct. 5.

Reports of rapes that had occurred in a previous year, meanwhile, were up almost 12 percent through November. In response, the Police Department is adding investigators to its Special Victims Unit and hasmodernized the techniques detectives use to investigate claims.

“We can’t answer definitively” what is driving the rise, Commissioner O’Neill told reporters at a crime briefing this month. “At least I can’t. But we’re seeing people coming forward and having faith in the N.Y.P.D. And that’s what we want to happen.”

Whatever the reason for New York’s crime reductions, the statistics do not capture the complete picture of public safety. Some crimes are not represented fully or at all: acts of domestic violence, sexual assaults, identity thefts, hate crimes, and shootings that don’t result in injuries or damage.

In some cases, the data annotates horrible crimes: an ISIS-inspired truck rampage on a Manhattan bike lane on Halloween that left eight people dead; the ambush killing of a police officer, Miosotis Familia, 48, who was shot in the head on July 4 while sitting in her R.V.-style command post in the Bronx; the death of Timothy Caughman, 66, a black man, at the hands of a sword-wielding white supremacist on March 20.

Increasingly, officers are receiving calls to help people in emotional crises. The police responded to 157,000 such calls in 2016. But only 7,000 officers have received crisis intervention training for handling those situations.

While most police encounters are resolved without officers resorting to deadly force, fatal police shootings of people in emotional distress — including Dwayne Jeune on July 31 in Brooklyn and Miguel Richards on Sept. 6 in the Bronx — have drawn scrutiny. A police sergeant, Hugh Barry, was indicted on murder charges in May for the fatal on-duty shooting of a mentally ill woman, Deborah Danner, in October 2016. His trial is scheduled to begin in January.”

Dec 28 Lawyer Files Disciplinary Complaint Against Chief Immigration Judge
On December 22, New York attorney Bryan S. Johnson filed a complaint with the Assistant Chief Immigration Judge for Conduct and Professionalism against Chief Immigration Judge MaryBeth Keller. The basis for the complaint was the Chief Judge’s issuance of guidelines to immigration judges on the handling of cases involving juveniles, including unaccompanied children (OPPM 17-03, Dec. 20, 2017). In that directive, Judge Keller instructed immigration judges that in spite of the sympathetic factors involved in children’s cases, “judges must remain neutral and impartial when adjudicating juvenile cases and shall not display any appearance of impropriety when presiding over such cases.” The complaint argues that such directive instructs immigration judges to violate federal statute, specifically the Trafficking Victims Protection Reauthorization Act (“TVPRA”), which requires the Attorney General to train immigration judges to “work with unaccompanied alien children, including identifying children who are victims of severe forms of trafficking in persons, and children for whom asylum or special immigrant relief may be appropriate.” 8 U.S.C. § 1232(e).

Instructing judges to “remain neutral and impartial,” while open to interpretation, will be perceived by many as requiring passivity. As one senior judge explained to me when I was new to the bench, judges should consider themselves blank slates and only consider what the parties have chosen to write on that slate. However, exceptions exist. In a precedent decision issued 20 years ago, the BIA held that in asylum cases in which the parties have not presented enough evidence to provide an adequate record, immigration judges should themselves present country condition evidence into the record. The Board cited favorably to the UNHCR Handbook on Procedures and Criteria for Determining Refugee Status which defines the role of the adjudicator as to “ensure that the applicant presents his case as fully as possible and with all available evidence.” Matter of S-M-J-, 21 I&N Dec. 722, 729 (BIA 1997). Decided by a BIA that possessed some brilliant minds and courage, the Board in S-M-J- established that there are times that an immigration judge must not remain neutral when doing so will deny an asylum seeker justice.

Ten years later, the Chief Immigration Judge issued guidance to immigration judges handling juvenile cases to take a proactive approach, due to the vulnerability of the child respondents. It bears noting that the 2007 guidelines were issued under a Republican administration. Obviously, a neutral, passive approach by the judge will not ensure a fair hearing where the two parties involved are the Department of Homeland Security, represented in court by one of its attorneys, and a young (and possibly unrepresented) child. In such circumstances, the judge must to some degree advocate for the child to “ensure that the applicant presents his case as fully as possible and with all available evidence,” to use the language of S-M-J-. In response to this need, EOIR created special juvenile dockets, and provided specialized training to the immigration judges chosen to preside over them. In 2008, Congress passed the TVPRA, the statute relied upon by attorney Johnson in his complaint. In 2013, EOIR created an Assistant Chief Immigration Judge position specifically dedicated to “vulnerable populations.”

EOIR has the additional opportunity to create a more level playing field by assigning counsel to all unrepresented juveniles appearing in immigration court. Yet the agency strongly opposed this solution in a class-action lawsuit filed by advocacy groups (including the ACLU and the Northwest Immigrant Rights Project), J.E.F.M. v. Lynch. The U.S. Court of Appeals for the Ninth Circuit dismissed the case last year, finding that the court lacked jurisdiction to decide the issue. However, the court’s majority opinion emphasized that it was not ruling on the merits of the claim, and in a concurring opinion, two of the three judges on the case’s panel acknowledged that “thousands of children are left to thread their way alone through the labarynthine maze of immigration laws, which, without hyperbole, ‘have been termed second only to the Internal Revenue Code in complexity.’” The judges continued that “given the onslaught of cases involving unaccompanied minors, there is only so much the most dedicated and judicious immigration judges…can do.” The court called on Congress and the Executive branch to take action to provide government-funded counsel to all children appearing in immigration court. The judges concluded that “to give meaning to “Equal Justice Under Law,” the tag line engraved in the U.S. Supreme Court building, to ensure the fair and effective administration of our immigration justice system, and to protect the interests of children who must struggle through that system, the problem demands action now.”

Democratic lawmakers have introduced draft legislation, entitled the Fair Day in Court for Kids Act, that would remedy this situation. Versions of the bill went nowhere in 2016; a 2017 version sponsored by Rep. Zoe Lofgren (D-Cal.) and 31 co-sponsors was introduced on April 6, 2017 and has made no progress since. The website GovTrack.us states that the bill has a 3 percent chance of being enacted. In the meantime, the Chief Immigration Judge’s latest memo signals a move in the opposite direction under the present administration. Last week, the Trump administration confirmed that it is considering a policy of separating children from their parents upon arrival at the U.S. border. While the administration claims that the policy is designed to discourage Central Americans from making the dangerous journey north, it ignores the fact that those making such journey are refugees fleeing the threat of death in what has become one of the most violent and dangerous regions in the world.

The administration has not explained what alternatives exist to parents seeking to save their children from being murdered and raped by violent gangs, including MS-13, whose members Trump himself has referred to as “animals.” As reported by the New York Post, Trump stated during a speech last July in Long Island, NY of MS-13 members: “They kidnap. They extort. They rape and they rob. They prey on children. They stomp on their victims. They beat them with clubs. They slash them with machete. They stab them with knives.” It would therefore seem that the current administration should be seeking to do everything in its power to provide children fleeing the above-described treatment to have their claims for asylum considered as fully and fairly as possible. Restoring the 2007 guidelines, respecting the TVPRA requirements, refusing to separate children from their parents, and providing counsel at government expense to unrepresented children would all be welcome steps towards that goal.

I appreciate Judge Chase’s kind reference to Matter of S-M-J-, 21 I&N Dec. 722 (BIA 1997). I was on the en banc BIA that decided S-M-J-. (Yes, unlike now, most precedents were issued en banc, so that each Appellate Judge was required to take a public vote on the outcome. Something known as “transparency and accountability” that has disappeared from today’s BIA.)

Forget all the legal gobbledygook in the “Keller Memorandum.” Here’s what a straightforward policy from an Attorney General actually committed to upholding the Constitution and the “Rule of Law” might look like:

  • The first duty of a Judge is to insure Constitutional Due Process for each individual coming before the court.
  • A Judge should not conduct a merits hearing for any unrepresented child, including any individual the Judge reasonably believes to be a child.
  • The Judge and all court personnel should work cooperatively with nongovernmental organizations, bar associations, legal services groups, and community officials to insure that cases involving children are placed on the docket and scheduled in a manner that insures representation in each case
  • When in doubt, a Judge should always act in a manner that maximizes Due Process protections for each individual coming before the court.

“The Trump administration is considering measures to halt a surge of Central American families and unaccompanied minors coming across the Mexican border, including a proposal to separate parents from their children, according to officials with knowledge of the plans.

These measures, described on the condition of anonymity because they have not been publicly disclosed, would also crack down on migrants living in the United States illegally who send for their children. That aspect of the effort would use data collected by the Department of Health and Human Services (HHS) to target parents for deportation after they attempt to regain custody of their children from government shelters.

The Department of Homeland Security (DHS) has previously considered some of these proposals, but there is renewed urgency within the administration to address an abrupt reversal of what had been a sharp decline in illegal immigration since Trump took office in January.

In November, U.S. agents took into custody 7,018 families, or “family units,” along the border with Mexico, a 45 percent increase over the previous month, the latest  DHS statistics show. The number of “unaccompanied alien children,” or UAC, was up ­­26 percent.

Children’s shelters operated by HHS are at maximum capacity or “dangerously close to it,” an official from the agency said. Overall, the number of migrants detained last month along the Mexico border, 39,006, was the highest monthly total since Trump became president, according to DHS figures.

The proposals, which have been presented for approval to new DHS Secretary Kirstjen Nielsen, were developed by career officials at Immigration and Customs Enforcement (ICE) and other DHS agencies, administration officials said.

Tyler Houlton, a DHS spokesman, confirmed the agency has “reviewed procedural, policy, regulatory and legislative changes” to deter migrants. Without giving further details, he said some of the measures “have been approved,” and DHS is working with other federal agencies “to implement them in the near future.”

“The administration is committed to using all legal tools at its disposal to secure our nation’s borders, and as a result we are continuing to review additional policy options,” Houlton said.

The most contentious ­proposal — to separate families in detention — would keep adults in federal custody while sending their children to HHS shelters. This was floated in March by then-Secretary of Homeland Security John F. Kelly, who is now White House chief of staff. He told CNN at the time that the children would be “well cared for as we deal with their parents.”

Kelly did not move forward with the plan, in part because of the backlash it triggered, administration officials said, and also because illegal migration had plunged to historic lows.

Trump administration officials described the measures as unpalatable but necessarily tough policy options to discourage Central American families from embarking on the long, dangerous journey to the border — or hiring smugglers to bring their children north.

Migrants from El Salvador, Guatemala and Honduras represent the largest share of families and children taken into U.S. custody along the border, with many telling border agents that they fear for their lives if sent back to their home countries. The three nations, known as the “Northern Triangle” of Central America, are crippled by gang violence and homicide rates that are among the world’s highest.

Trump administration officials say Central American migrants and the paid smugglers who bring them to the border shamelessly exploit Americans’ compassion, entering the United States illegally and gaming the asylum process.

If a migrant’s stated fear of being sent home is considered “credible,” they enter an asylum process that may take years to adjudicate, and the flood of such petitions in recent years has worsened the backlog of more than 600,000 cases pending in U.S. immigration courts.

Asylum seekers are typically issued work permits while they wait for the process to play out, and when their rejected appeals are exhausted, they often ignore court orders to leave the United States, choosing to remain in the country illegally.

The Trump administration wants to significantly expand immigration detention capacity, and hire more judges and expedite asylum cases to stop migrants from taking advantage of “loopholes” in the asylum process.

The proposal to separate parents from their children is viewed by the agency as a more immediate tool to halt the latest border surge.

DHS has three family detention centers — two in Texas, one in Pennsylvania — with about 2,200 beds available. But legal restrictions on its ability to detain children mean that families are typically given a court date and released from detention not long after they arrive. In November, the three detention centers reached their highest occupancy levels for the year, and they remain near maximum capacity, officials said.

“The parents that would undertake this perilous journey to the United States would be less likely to do it if they knew they would be separated from their kids,” said Andrew R. Arthur, a resident fellow at the Center for Immigration Studies, which seeks to reduce immigration. A former U.S. immigration judge and Republican congressional policy staffer, he called it “a reasonable step to take.”

“It might seem heartless, but it’s more heartless to give them the illusion they’re going to be able to enter the United States freely by hiring a smuggler to come here, because the dangers associated with smuggling along the southwest border are real,” Arthur said.

The unaccompanied minors are typically seeking to reunite with a parent already living illegally in the United States. By law, migrants under age 18 who arrived without a parent must be turned over to HHS within 72 hours of being taken into DHS custody. The shelters where they are housed are designed to be more like boarding schools than grim detention centers.

The minors are placed in the care and custody of the Office of Refugee Resettlement at HHS’s Administration for Children and Families (ACF), which seeks to identify an adult sponsor who can take custody of them.

The process takes about six weeks on average, HHS officials say. “It’s a little-known fact that over half of those who enter illegally are placed with a parent already in the United States,” ACF spokesman Kenneth Wolfe said.

The parents, or any other adult seeking to take custody of a child, must submit to an extensive background check that includes information about their immigration status. But administration officials say that information is neither checked against DHS biometric data nor shared with ICE for potential enforcement purposes. The new DHS proposals under consideration would change that.

If children are forcefully separated from their mothers and fathers, or if parents know they could be arrested or targeted for trying to reunite with their children, migrant advocates say the U.S. government will be inflicting “devastating” trauma on families fleeing Central America because they feel their lives are at risk.

“These measures will only drive families who are vulnerable to exploitation further into the hands of traffickers and smugglers,” said Greg Chen, director of government relations of the American Immigration Lawyers Association.

“These are families that have no other choice for their survival,” he said.”

We could absorb all of the “good guys” fleeing from gang violence in the Northern Triangle without any long-term adverse effects; in fact, it would likely help us prosper as a nation, and would be far more “cost-effective” than the various failing “strategies” we now employ, and have employed in the past, in a vain and counterproductive attempt to prevent the inevitable.

I wouldn’t necessarily give everyone a “Green Card” right off the bat. But, we should have a vastly expanded TPS program for the Northern Triangle, keeping open the possibility of eventually issuing everyone who wants to stay and who has demonstrated payment of taxes (something that even native born GOP rich guys, and most notably the Trumpster himself, hate to do) and no serious crimes to eventually qualify for the Green Card.

NEW EOIR MEMO ENCOURAGES IMMIGRATION JUDGES TO DUMP ON UNACCOMPANIED CHILDREN (“UACS”) – “When In Doubt, Kick ‘em Out” New Motto Of Gonzo’s “Captive Courts!” — We’ve Come A Long Way From “Guaranteeing Fairness And Due Process For All” In A Short Time!

Responding to several recent “hate speeches” by Attorney General Jeff “Gonzo Apocalypto” Sessions, EOIR issued a new memorandum basically telling U.S. immigration Judges to revise their thinking and look for any way possible to “shaft” unaccompanied minors fleeing for their lives and asserting claims for protection under U.S. laws.

However, because it is drafted in dense bureaucratic doublespeak with a just a touch of “lip service” to the law, I will give you the “high points” as they would appear to most Immigration Judges:

  • The Attorney General hates UACS, and so should you if you want to keep your job.
  • While this Administration works on its announced plans to strip UACS of all statutory and Constitutional rights, you must always look for ways to effectively eliminate such “false rights” administratively in advance of any changes in the law.
  • Always look for ways to find that someone previously determined by DHS or the ORR to be a “UAC” is no longer, or never should have been, entitled to UAC benefits. 
  • The “best interests of the child” should NOT be an important consideration in an Immigration Court proceeding involving a UAC. 
  • Conversely, the “best interests of the Administration” should generally be given conclusive weight. 
  • Never let considerations of human empathy, misplaced kindness, false compassion, common sense, decency, or any other human emotion lead you to give a break or the benefit of the doubt to a UAC.  
  • Is is permissible, however, to create a false sense of informality and friendliness in your courtroom, so long as it doesn’t result in a grant of any type of protection or relief to the UAC. (Indeed, lulling a UAC into a false sense of comfort or security can be an effective strategy for insuring that he or she will not attempt to find a lawyer and will sign away or waive any rights.)
  • Remember that no matter how young, immature, discombobulated, confused, inarticulate, traumatized, or scared a UAC might be, he or she is NEVER entitled to appointed counsel or to any meaningful help from you in stating or supporting a claim for protection.
  • While all DHS requests should generally be treated as “priorities,” the only request from a UAC or his or her representative that should receive “priority” consideration is a request for immediate voluntary departure from the US. (You should never hesitate to grant such a request even if it appears to be the product of duress or against the UAC’s best interests.)
  • A good way to overcome the unfortunate tendency of some reviewing courts to find testimony of UACS “credible”” is to conclude that even if credible and facially sufficient to establish a claim for relief, the UAC’S testimony is “too generalized” or “not sufficiently detailed” (or any other kind of meaningless legal jargon you might come up with) to satisfy the “burden of proof” for protection.
  • Your main responsibility as an Immigration Judge, and the one for which you will be held accountable, is to ferret out and report fraud, not to insure fairness or due process for the UAC.
  • In discharging your duties as an Immigration Judge, you must always give primacy to the enforcement priorities of the Administration (including the overriding objective of deterrence and how it is advanced by REMOVAl orders, not relief) and the DHS over any legal claims advanced by a UAC. 
  • You should presume that all UACS and particularly any with “dirty” attorneys representing them are “fraudsters” unless and until otherwise established beyond a reasonable doubt. 
  • While it is permissible to present yourself to the public, and particularly to any reviewing courts Congressional, or media representatives as a “judge of a full due process court,” for all other purposes, you should always remember that you are a mere subordinate of the Attorney General, sworn to carry out his policies, and never, under any circumstances, should you consider yourself to be a “real judge” exercising independent judgement.
  • If you have any questions about this memorandum, please consult your ACIJ (who is specially trained to help you maximize final removals orders) rather than your conscience.
  • Remember: “When In Doubt, Kick ‘Em Out!”

There was a time in the (seemingly now distant) past when children and other vulnerable individuals were considered appropriate for “special humanitarian consideration,” and treatment. Now, they are “special targets” for Gonzo and his White Nationalist storm troopers: “Fish in a barrel,” “easy numbers, “low hanging fruit,” “roadkill.”

I was particularly impressed (not necessarily favorably) by the straightforward exhortation for the Immigration Court to establish itself as perhaps the only court in the America where the widely accepted principle of “the best interests of the child” is specifically to be given short shrift.

On the other hand, you should think about the possibility that some day you’ll get the question “What did you do during Trump’s War on America, Mommy (or Daddy)?” Do you really want to say:  “I stood by and watched Gonzo Apocalypto abuse, harm, and in some cases kill, helpless children?” We all have choices to make!

GONZO’S WORLD: JUDICIAL REBELLION – Less Than One Year Into Gonzo’s Reign at The DOJ, One of America’s Most Conservative Judiciaries Seeks Protection From His Plans to Politicize The U.S Immigration Courts!

“In a little noted, but quite extraordinary move, the National Association of Immigration Judges (“NAIJ”) has asked Congress to protect its members (Immigration Judges) from the Trump Administration (their employer). The reason? The Trump Administration is seeking to “evaluate judges’ performance based on numerical measures or production quotas.” According to NAIJ, “If EOIR is successful in tying case completion quotas to judge performance evaluations, it could be the death knell for judicial independence in the Immigration Courts.” “Judges can face potential termination for good faith legal decisions of which their supervisors do not approve.”

EOIR is developing a more efficient way to adjudicate cases (and it comes with a free drink!).

Let’s start with a bit of background. NAIJ is a voluntary organization of United States Immigration Judges. It also is the recognized representative of Immigration Judges for collective bargaining purposes(in other words, the IJs’ union): “Our mission is to promote the independence of Immigration Judges and enhance the professionalism, dignity, and efficiency of the Immigration Courts, which are the trial-level tribunals where removal proceedings initiated by the Department of Homeland Security are conducted.”

According to NAIJ, the most important regulation governing IJ decision-making is 8 C.F.R. § 1003.10(b). This regulation requires that immigration judges exercise judicial independence. Specifically, “in deciding the individual cases before them, and subject to the applicable governing standards, immigration judges shall exercise their independent judgment and discretion and may take any action consistent with their authorities under the Act and regulations that is appropriate and necessary for the disposition of such cases.” 8 C.F.R. §1 003.10(b).

Up until now, IJs were exempted from quantitative performance evaluations. According to NAIJ, “The basis for this exemption was rooted in the notion that ratings created an inherent risk of actual or perceived influence by supervisors on the work of judges, with the potential of improperly affecting the outcome of cases.”

The Trump Administration is now moving to change the way it evaluates IJs. The main reason for the change is the Administration’s goal of reducing the very-large backlog of cases in Immigration Court (currently, there are about 640,000 pending cases). The Executive Office for Immigration Review (EOIR – the office that administers the nation’s Immigration Courts) recently announced a plan to “transform[] its institutional culture to emphasize the importance of completing cases.” In other words, EOIR will judge its judges based–at least in part–on the number of cases completed.

NAIJ has called this development “alarming” and a threat to judicial independence. Why? Because when judges are forced to complete a certain number of cases, they may be unable to devote the necessary time to each case. As a result, the ability to make proper, well-thought-out decisions will suffer.

This is already a problem in Immigration Court. One IJ famously quipped that his job involved adjudicating death penalty cases in a traffic court setting. And so pushing judges to do more cases in less time will potentially impact the alien’s due process rights, and the integrity of our Immigration Courts.

NAIJ has long believed that the system needs a “structural overhaul” and has advocated for converting the Immigration Courts into Article I courts. Article I refers to the first article in the U.S. Constitution, the section on legislative (i.e., Congressional) powers. The idea is that Congress would establish an independent immigration court, much like it created a tax court and a court of veterans appeal. Such a court would be independent of the Executive Branch–the branch of government tasked with enforcing immigration law (currently, IJs are employees of the Department of Justice, a part of the Executive Branch).

NAIJ recognizes that creating Article I immigration courts “may not be feasible right now,” but it nevertheless urges Congress to protect the nation’s IJs from the new Trump Administration policy:

Congress can… easily and swiftly resolve this problem through a simple amendment to the civil service statute on performance reviews. Recognizing that performance evaluations are antithetical to judicial independence, Congress exempted Administrative Law Judges (ALJs) from performance appraisals and ratings by including them in the list of occupations exempt from performance reviews in 5 U.S.C. § 4301(2)(D). This provision lists ALJs as one of eight categories (A through H) of employees who are excluded from the requirement of performance appraisals and ratings. To provide that same exemption to Immigration Judges, all that would be needed is an amendment to 5 U.S.C. § 4301(2), which would add a new paragraph (I) listing Immigration Judges in that list of exempt employees.

The fact that IJs themselves are concerned about the Administration’s move is worrying. The Immigration Judges I know are conscientious and take their jobs very seriously (in contrast to the Trump Administration, which seems utterly lacking in seriousness). If EOIR is making it more difficult for IJs to do their duty, as they understand it, then something is clearly wrong.

Perhaps the IJs’ concerns are overblown. Maybe EOIR will implement the new case completion standards in a way that does not damage judicial independence or due process. But given the Administration’s track record in general, and the inexperienced acting director appointed to head EOIR, it’s difficult to have much confidence in the new policy. Since Congress is unlikely to act on NAIJ’s request for protection, I suppose we will see soon enough how these changes affect the Immigration Courts.

Finally, in my opinion, EOIR has largely misdiagnosed the problem. While some delay may be caused by IJs kicking the can down the road, or by aliens “playing” the system, most delay is systematic–it is caused by reshuffling Administration priorities, which affect how DHS and DOJ schedule cases. I doubt that imposing numerical quotas on IJs will do much to improve the situation. Other solutions–facilitating pre-trial conferences, reforming the Master Calendar system, better use of technology, imposition of costs, premium processing for certain applicants–might be more effective. Everyone agrees that reducing the backlog is a worthy goal, but case completion requirements are probably not the best way to achieve that end.”

“Extraordinary” to be sure! Folks, this isn’t the Ninth Circuit or even the Seventh, Second, or Fourth Circuit, all of which from time to time have “stood tall” for the Due Process rights of migrants.
For those unfamiliar with the process, the U.S. immigration Court is a “captive Administrative Court” functioning as part of the U.S. Department of Justice (“DOJ”) rather as an independent judiciary established under Article III or Article I of the U.S. Constitution.
For the past 17 years, the DOJ (with the exception of an ill-fated move by the Bush II Administration to hand out Immigration Judgeships as political rewards to their faithful) has gone out of its way to insure that those selected as Immigration Judges have a record demonstrating a “commitment to achieving agency priorities.” Translated from bureaucratese, that means that they understand the DHS immigration enforcement objectives and will not “rock the boat” by expanding or recognizing any new rights for migrants unless given permission to do so by the DOJ or DHS.
Not surprisingly, this has resulted in a judiciary where the overwhelming number of new U.S, immigration Judges appointed since 2000 — nearly 90% — come from “safe” government backgrounds, primarily from the DHS. Moreover, no “Appellate Immigration Judge” (or, “Board Member”) at the BIA has been appointed directly from outside the U.S. Government since the pre-21st Century “Schmidt Era” at the BIA. (For “EOIR trivia buffs,” the last two outside appointments to the BIA in 2000 were the late Hon. Juan P. Osuna and the Hon. Cecelia M. Expenoza who was exiled along with me and others during the “Ashcroft Purge” of 2003.)
So, we’re dealing with a basically conservative, government-oriented judiciary of  “non-boat rockers” who mostly achieved and retained their present judicial positions by “knowing and doing what the boss wanted” and making sure that any “deviations” were within limits that would be tolerated.
Yes, it’s OK to grant some asylum cases, particularly from Africa or the Middle East, over DHS objections; but “watch out” if you start granting lots of asylum to folks from the Northern Triangle or Mexico for whom the big “NOT WELCOME SIGN” has been hung out by the last three Administrations, or if you accept any new “particular social groups” which Administrations tend to view with fearful eyes as potentially “opening the floodgates” of protection to those who sorely need and can easily access it (in other words, to those whom the Geneva Refugee Convention actually was intended to protect.)
So, this isn’t a judiciary that normally would be expected to “buck the system.” Indeed, although the world has probably never been worse for refugees since World War II, the Immigration Courts seem to have inexplicably but dutifully reduced asylum grants since the clearly xenophobic, anti-refugee, and anti-asylum Trump Administration assumed office and Gonzo began delivering his anti-asylum, anti-lawyer, anti-immigrant rants.
Therefore, the threat to the limited judicial independence that U.S. Immigration Judges possess under the regulations (which haven’t prevented occasional “reassignments” for ideological or political reasons in the past) has to be presumed both real and immediate to prompt this group to take the risky action of publicly seeking protection. After all, Gonzo could potentially “retaliate” by further limiting the judges’ authority, further jacking up the already astronomically high stress levels under which the judges operate, or “reassigning” “unreliable” judges to more mundane or unattractive positions within the DOJ (sometimes known as “hallwalker” positions).
It’s definitely a further sign of an unhealthy judicial system on the verge of collapse. Before that happens, and 650,000+ additional cases spew forth into other parts of our justice system, it would be wise of Congress to make at least some immediate reforms to preserve independence and due process within the U.S. immigration Courts.
I also agree with Jason that attorneys and respondents are not the major problem driving uncontrolled backlogs in the U.S. immigration Courts. No, it’s all about “Aimless Docket Reshuffling” (“ADR”) generated by EOIR itself at the behest of its political handlers at the DOJ.
But, I don’t agree with Jason’s statement that EOIR has merely “misdiagnosed” the problem. No, EOIR and DOJ know exactly what the problem is, because they created it (egged on, no doubt by DHS and sometimes the White House).
Gonzo and EOIR are intentionally misrepresenting and misusing data to hide the truth about how screwed up the system has become because of the DOJ’s toxic combination of administrative incompetence with improper political and enforcement motives. In other words, DOJ is attempting to cover up its own “fraud, waste, and abuse” of public funds.
Even worse, and more reprehensible, Gonzo is attempting disingenuously to shift the blame to respondents and their overworked attorneys who are more often than not the actual victims of the scam being pulled off by the DOJ as part of the Trump Administration’s xenophobic, White Nationalist campaign to reduce the precious rights of asylum seekers and others. We can’t let him get away with it!

It took Abigail Bautista less than a month of living in Langley Park to learn that her new neighborhood in Maryland had its own set of laws, written not in statutes but in gang graffiti and blood.

The Guatemalan mother of five was pushing a cart of merchandise along University Boulevard one winter morning in late 2012 when three young men approached.

“Do you know who we are?” one asked her in Spanish.

Bautista shook her head.

“We are La Mara Salvatrucha,” he said. “And here, there are rules.”

Pay $60 “rent” per week or there would be trouble, he said. Undocumented and afraid of being deported if she went to police, Bautista began handing over the cash.

She had heard of the international street gang growing up in Central America, where MS-13, as it’s known, controls cities through brutality and corruption. But she had lived for the better part of a decade in the United States without crossing its path.

Now, she realized, she’d unwittingly moved into MS-13 territory a mere seven miles from the White House.

As the gang has grown in strength in recent years, so has its sway over communities across the country. From Boston to Northern Virginia to Houston, a string of grisly MS-13 murders has highlighted its resurgence, drawing a response from the White House.

“One by one, we’re liberating our American towns,” President Trump said this summer in Long Island, where MS-13 has been linked to more than a dozen recent killings.

Left out of Trump’s speeches, however, is the fact that most of the gang’s victims are not Americans but undocumented immigrants like Bautista. And when it comes to the gang’s infamous motto of “kill, rape, control,” it’s the third — enforced daily through extortion and intimidation — that defines life for some immigrants in places such as Langley Park.

“They are preying on the communities that they are living in,” said Michael McElhenny, a supervisory special agent for the FBI in Maryland.

More than a decade after a string of MS-13 killings shook the heavily Latino neighborhood, Langley Park is still struggling to shake off the gang’s influence. Despite aggressive policing, the area continues to be plagued by MS-13 drug dealing, prostitution, robbery, extortion and murder, according to court records and interviews with residents, activists, prosecutors and gang experts, as well as local and federal law enforcement officials.

Federal authorities say the racketeering case and two other recent MS-13 indictments show they are serious about again dismantling the gang in Maryland. But Bautista won’t be satisfied until authorities lock up the man she suspects of leading MS-13 in Langley Park.

Two weeks after her son’s body was found, and a few days before his vigil, she said, a letter was slipped under her door.

“If you keep talking, there will be consequences,” it warned in childlike handwriting, according to Bautista.

It was signed, she said, by the roofer.

One thing is clear: The gang problem isn’t going to be “solved” by having having clueless, anti-Hispanic, White Guys like Trump and Sessions uttering threats against the entire immigrant community from Washington.

No, the irony is that prosecutions and deportations, although they might rack up impressive statistics, really don’t bother gangs much. Gangs control big chunks of the prisons, both in the US and, even moreso, in the Northern Triangle. To some extent, a prison sentence is just a “temporary work reassignment.”

And, deportations: well that’s actually how the MS-13 grew, when the US deported LA gang members to El Salvador during the Reagan Administration without thinking about how to deal with the long term problem — how they would grow to control and terrorize the places to which they were being deported.

It doesn‘t take a “rocket scientist” (just someone smarter and less racist than Trump and Sessions) to figure out that the overheated anti-immigrant rhetoric that lumps gang members with generally law abiding workers and asylum applicants is a “made to order” recruitment tool for the MS-13 and other gangs.

”Trump and Sessions don’t respect you and don’t want you in America. They don’t even like the ‘good’ immigrants, so don’t waste your time on the false ‘American Dream.’ We’re you’re ‘REAL’ family that isn’t afraid of Trump, and will give you power, respect, and control, as long as you remain loyal to us. What’s Trump got to offer Hispanic youth?”

Reducing gang violence will require a nuanced, time consuming, labor intensive multi-cultural approach that:

  • Treats Hispanic youth, documented and undocumented, with respect and shows them they are valued by society;
  • Provides positive role models from the Hispanic community;
  • Gives youth viable alternatives to gangs;
  • Gains the trust of all members of the Hispanic community, whether documented or not;
  • Involves bilingualism, more Hispanic police officers, and potentially dangerous undocover operations in the community;
  • Recognizes and deals with the problems of gang control in US prisons;
  • Deals with the difficult question of what happens when we deport gang members back to the Norther Triangle.

With respect to the latter point, if we merely send U.S. gang members back to terrorize communities in the Northern Triangle, that will lead more terrorized community members to flee to the U.S. The cycle will continue.

The Trump Administration’s ham-handed immigration policies taken from the “White Nationalist restrictionist playbook” will likely only exaberrate the problem of gangs and gang violence in the long run.

“More than a thousand children are counting on Nora Sándigo to become their guardian if their undocumented parents are deported. How many of those promises will she now have to keep?

Because she didn’t know what to tell her children, she tried not to tell them anything. When they asked where their father was, she gave flimsy excuses: Yes, he came home last night, but he left while you were still asleep. He’s working late, he’s working early, he just stepped out, he’ll be back soon. “You just missed him,” she found herself repeating.

The strategy worked, for a few days at least, with the youngest three. They were all under 5 and were used to the world going about its strange business without them. But then there was Kelly. She was 8 and sharp-eyed, a good student who preferred English to Spanish and wanted to someday be a doctor, or maybe a gymnast, and who had watched a presidential candidate on television say he wanted to send people back to Mexico, where both her parents grew up.

Kelly came home from school one day in October last year and demanded to know where her father was. Because his construction job started so early in the morning, Javier was usually the first home. That was part of how he and Kelly’s mother, T., fell in love. They boarded in the same house more than a decade ago, when she was 19 and freshly arrived in South Florida, having followed her sister from their small village in southern Mexico. T., who is being identified by her first initial to shield her identity, quit school after sixth grade. She helped her parents plant corn and beans but dreamed of something better for herself and her infant son; she decided to leave him in her mother’s care and support him from afar. Javier was from the same region, and because he finished work early, he cooked for her while she was still out in the Florida sun. The food was delicious and tasted like home. Soon they were a couple, and then Kelly was born, and her father, who fainted with anxiety in the birthing room, adored her, and she adored him back.

“He’s late from work,” T. told her daughter.

But Kelly wasn’t having it. Before heading to school that morning, she saw uniformed men come to the door and ask her mother for her father’s passport; she heard her mother on the phone, asking what had happened, what to do. “Don’t lie to me,” Kelly said, and started to cry. “Where did they take him? What did he do?”

By now T. knew. One of her first phone calls was to an immigrant advocate and former refugee named Nora Sándigo, who, in this poor area south of Miami, was the most powerful person in many people’s worlds: She knew lawyers, county commissioners, even members of Congress. After T. called her, Sándigo quickly discovered that Javier had been detained by the Department of Homeland Security. T. didn’t tell Kelly the details she had learned from Sándigo, or from Javier, when he was finally able to make a brief call. That they arrested him just a few yards away from their home, as he stood waiting for his ride to work. That now he was on the edge of the Everglades, in a gray-and-tan detention center adjacent to a state prison, a half-hour’s drive away, a distance that, for T., had suddenly become unbridgeable. “He was arrested,” she told Kelly, simply. “We have no papers to be here, like you do.”

“Will they take me, too?” Kelly asked. She didn’t know what papers her mother was talking about, what this thing was that she had and her parents didn’t.

T. didn’t tell her daughter the other reason she called Sándigo. Across South Florida, T. knew, undocumented parents of citizen children were preparing for possible deportation by signing power-of-attorney forms that allowed Sándigo to step in should their own parenthood be interrupted by a surprise visit from Immigration and Customs Enforcement, or ICE. If they were taken away, at least Norita, as they called her, could provide stability while the family sorted out what to do; she could also sign forms on their children’s behalf at school, or at the hospital, or in federal court.

Sándigo’s responsibilities extended to many hundreds of children, and were growing all the time. Parents, some of whom had never met her in person, were desperate for any solution. Her qualifications were simple. She was compassionate. She was willing. And, like their children, she was a United States citizen.

For years, T. never felt the need for such an extreme contingency plan. Now she was thinking of adding her own children to Sándigo’s list. “Imagine if they detained me too,” she said after Javier was gone. She couldn’t envision taking her American children with her to Mexico, where she “wouldn’t be able to give them education, shoes, clothes,” and where they would be separated from their friends and lives and ambitions, from the only home they had ever known. But what would happen if they stayed behind, with no parents left to care for them?

There’s a common misconception that having a citizen child — a so-called anchor baby — allows undocumented parents to gain legal status in the United States. In fact, parents of citizen children are deported annually by the tens of thousands, according to ICE’s own reports to Congress. Randy Capps, a demographer with the Migration Policy Institute, estimates that as many as a quarter of the people deported from the United States interior (who are counted separately from those deported at a border) are the parents of American children. Though immigration law prioritizes family connections, including legal status for the family members of Americans who petition on their behalf, children are the exception. They cannot, by law, petition for anyone until they turn 21 — by which time, of course, they won’t need their parents nearly as much.

Families like Kelly’s are known as “mixed status” — a reminder that the way we talk about immigration, with clear lines of legality separating groups of people, is often a fantasy. The reality is a world of families with separate legal statuses but intertwined fates. More than four million American children are estimated to have a parent in the country illegally. If deported, those parents face a difficult choice: Take their children to a country they do not know, whose language they may not speak and one that lacks the security and opportunities they have in the United States; or leave them behind, dividing the family. Courts have regularly responded to the argument that a parent’s deportation will deny a child, as one lawyer put it, “the right which she has as an American citizen to continue to reside in the United States,” with the counterargument that such children are not, in fact, deprived, because they retain the right to stay in their country and the right to live with their parents — just not both at the same time. “That’s what I call a choiceless choice,” says David B. Thronson, a professor at the Michigan State University College of Law, who helped found the Immigration Law Clinic.

But it’s a choice that’s familiar to millions of families, including Sándigo’s. “I lived that,” she said one day when I met her at her office in the suburbs of Miami, a one-story stucco house that serves as the headquarters of the Nora Sándigo Children Foundation. When she was 16, her parents sent her away from Nicaragua to escape the violence of its civil war; her family, she says, was targeted for opposing the Sandinistas. “I feel like I am one of those kids,” she continued, “because I came with the same problem. I had my father and mother, but I was an orphan without them. Separate from their parents, they become orphans, like me.” She remembers sobbing as she watched the country of her birth recede from the plane window.

When she left Nicaragua, Sándigo went to Venezuela, then France, “trying to get something legal,” and in 1988 finally ended up in the United States, where the organization that helped her settle here offered her a job working with other refugees from Central America and advocating for their asylum. The Nicaraguan Adjustment and Central American Relief Act was passed in 1997. In Miami, she helped other immigrants with paperwork and resettlement matters, like looking for apartments or jobs. She also started a business of small nursing homes, which, along with a plant nursery, helps cover her foundation’s bills. She never went back to Nicaragua, not even when her father was dying. He told her to stay in the United States and be safe. It was her country now, he said.

As Sándigo’s reputation grew, it became common for strangers in Miami’s immigrant communities to seek her out, asking for help; the requests opened Sándigo’s eyes to the depth of people’s need. She remembers bringing six towels to a woman with five children, who was shocked at the abundance: “So many!”

One call, in 2006, was for a new kind of assistance: A Peruvian woman, whom Sándigo had never met, was being held in a detention center, and she wanted to give Sándigo power of attorney to make decisions about her children’s care. (Unlike full legal guardianship, which is conferred by a court, power-of-attorney forms don’t involve a transfer of parental rights.) Others in the center had warned her that if she didn’t do something, she might lose her children to the child welfare system. Sándigo doesn’t know why the woman thought of her, but she felt honored, and obligated, by her trust: “When she called she had the papers signed and notarized already in my name.”

The Peruvian woman’s children never called on Sándigo, but word of what she had done got out. In 2009, a brother and sister, ages 9 and 11, showed up at Sándigo’s door with their uncle; their mother, they said, was in detention, and they weren’t going to eat until she was released. Sándigo remembers the oldest, Cecia, now a student at Georgetown University, saying, “We’ll stay with you,” to which she replied, “But this is an office, baby.” Still, she made a place for them. Jerryann, one of Sándigo’s two biological daughters, recalled: “You were like, ‘Oh, they’re going to stay the night.’ And then one night became forever.” The children moved in — they ended up staying for six years — the case attracted a lot of publicity and soon there was a steady stream of requests. “That gave the perception to the people, probably, that I was accepting the power of attorney from everyone in the same situation,” Sándigo said.

Many of the people who contacted Sándigo wanted only a temporary backup, a documented adult whom their kids could call in the moment of crisis to avoid ending up in the child-welfare system. According to an ICE spokeswoman, “ICE is committed to ensuring that the agency’s immigration-enforcement activities, including detention and removal, do not unnecessarily disrupt the parental rights of alien parents and legal guardians of minor children.” But navigating the immigration and child-welfare systems simultaneously can be difficult. Emily Butera, a senior policy adviser at the Women’s Refugee Commission, told me that many parents have come to believe that they will lose their rights automatically: “We’ve started explicitly saying to people, ‘Your children are not the property of the U.S. government.’ ”

Other parents planned for their children to stay with their undocumented friends or relatives, but wanted Sándigo to sign papers or fill official roles that they couldn’t. Still others hoped that their children would live with her, maybe for the remainder of their childhoods — something Sándigo wasn’t promising and worried that people assumed she was. But still, she never said no. When people came to her looking for help, Sándigo found it impossible to deny them. The numbers grew into the dozens, and then to the hundreds. “We never planned this,” Sándigo said one day. “It was planned by nobody. It just came.”

Two days later, nine adults and 36 children gathered at Sándigo’s house to pack into three rented vans for the 18-hour drive to Washington. T. tried to find space under a seat for a stroller — she was bringing all four daughters — while Sándigo stood in front of local news cameras, speaking in Spanish. “How can they be American citizens if in their own country they’re treated so harshly?” she asked. Kelly wandered into the frame, and Sándigo pointed to her: “Her father was deported,” she said. “It’s very hard.” Kelly noticed the cameras turning to her and darted away. “We hope they’ll listen to these American children,” T.’s sister told Telemundo.

Finally, space was found for all the diaper bags and suitcases and gallons of frozen milk. The kids lined up for a group photo around an American flag. The plan was to drive through the night, a challenge with so few licensable drivers among the adults. The vans pulled out past a small lineup of news cameras.

A few minutes later, they were back. Sándigo had gotten a call from the only English-language station to respond to her news release: The cameraman was running late. Sándigo agreed to redo the exit scene. “For us, the English news is the most important,” she said. Its viewers were the ones whom she most wanted to hear from the children, their fellow citizens.

Kelly and the others dutifully spilled out of the van into the sunshine. Valerie, in her native, teenage English, told the new camera the same things she’d told the others in Spanish: about missing her parents, about how hard it was. She was proud that she’d finally learned to talk about them without crying.

Then the children all climbed back inside for another try at reaching their nation’s capital.

The cameraman stood in the empty street for a long time, watching them disappear.”

Meanwhile, over at Newsweek reports on how, led by Chief Scofflaw Jeff “Gonzo Apocalyoto” Sessions, the Trump Administration continues its assault on our Constitution, women, Latinos, immigrants, and the REAL rule of law by attempting to force immigrant teenagers to carry pregnancies to term against their will:

“The Trump administration is attempting to block two young undocumented immigrant women in federal custody from obtaining an abortion, prompting the American Civil Liberties Union to head back to court today.

The two women, known to the court as Jane Roe and Jane Poe, requested to have an abortion. The Office of Refugee Resettlement refused their request.

The organization says this refusal, which has become common under Trump, shouldn’t be acceptable. The administration has been requiring these young women to go to religiously affiliated “Crisis Pregnancy Centers” that require patients to “have a medically unnecessary sonogram” and urges them to carry their pregnancy.

This case comes after the recent “Jane Doe” case in which the civil rights group stepped in and helped another immigrant receive the care she requested.

“We’ve already stopped the Trump administration from blocking one young woman’s abortion,” Brigitte Amiri, senior staff attorney with the ACLU Reproductive Freedom Project, said in a press release. “But the Trump administration is relentless in its cruelty, blocking abortion access for the most marginalized people in our country.”

The Jane Doe case was the first major abortion battle under Trump, in which a 17-year-old came to the U.S. from Central America in September. She was detained and learned that she was pregnant. When she was at the government-funded shelter, she attempted to get an abortion but the government didn’t allow it. That was the first undocumented immigrant abortion case the ACLU took to the court to fight the Trump administration.

According to a previous report by Newsweek, The ACLU told the court that the Trump administration unlawfully barred Jane Doe from having an abortion for a month. The court agreed with the ACLU and Jane obtained an abortion the next day, but the fight is still on between the group’s lawyers and the Trump administration.

After winning in court and receiving her abortion, Jane Doe said in a statement that she came to the U.S. for a better life.

“No one should be shamed for making the right decision for themselves,” she said in a statement released by the ACLU on October 25. “I would not tell any other girl in my situation what they should do. That decision is hers and hers alone.”

Immigrants detained at four large centers used by Immigration and Customs Enforcement are subject to inhumane treatment, given insufficient hygiene supplies and medical care, and provided potentially unsafe food, according to a federal report.

The “concerns” about the treatment of detained immigrants in facilities in California, Georgia, New Jersey and New Mexico is summarized in a report issued by the Inspector General’s Office of the Department of Homeland Security.

As NPR’s Joel Rose reports,

“The findings are similar to those of outside groups that have alleged ‘extensive’ human rights abuses at ICE detention centers.

“The inspector general’s report comes as the Trump administration is asking Congress for funding to expand the immigration detention system.

“ICE says some of its existing facilities are short-staffed. And the acting director has agreed to the report’s recommendations.”

The report was based on inspections of five detention facilities, four of which failed to meet certain federal standards, although “not every problem was present in all of them.”

The report summarized the results of the inspections:

“Upon entering some facilities, detainees were housed incorrectly based on their criminal history. Further, in violation of standards, all detainees entering one facility were strip searched. Available language services were not always used to facilitate communication with detainees. Some facility staff reportedly deterred detainees from filing grievances and did not thoroughly document resolution of grievances. Staff did not always treat detainees respectfully and professionally, and some facilities may have misused segregation. Finally, we observed potentially unsafe and unhealthy detention conditions.

Detainees … reported long waits for provision of medical care, poor conditions in bathrooms and insufficient hygiene supplies. OIG inspectors also observed expired, moldy, and spoiled foods in the kitchen in four facilities.”

The report also recommends that ICE improve its oversight of detention facility management and operations. In an official response, ICE concurred with the findings and promised to strengthen oversight and improve overall conditions.

Critics of President Trump’s immigration policies say the findings are not new as they predate the current administration.

A 2015 report by the National Immigrant Justice Center questioned ICE’s ability to oversee the detention centers it uses.

In a statement on the 2017 report, the Center’s Executive Director Mary Meg McCarthy said:

“ICE’s inability to provide for the safety and health of the tens of thousands of immigrants in its custody has been documented for years. Today, we are calling on Congress to demand accountability and drastically reduce ICE’s detention budget.

“While the Inspector General’s report provides documentation of extensive abuses, its remedy is incredibly insufficient: it directs ICE field office directors to review the areas of concern. We know from earlier directives that ICE’s internal review processes fail to generate meaningful change.”

The Women’s Refugee Commission said the report is consistent with what the organization and its partners have “documented for years” from visits to ICE detention facilities as well as with research it has conducted over 20 years. Katharina Obser, senior program officer at WRC said in a statement:

“This week’s OIG report spells out what WRC and our partners have documented for years, making clear the critical need for greater oversight and reform. Instead, the  Trump administration is intent on lowering or eliminating standards for immigration detention – putting detainees’ lives at risk – all while promising to ramp up detentionon a grand scale. As Congress continues to debate DHS FY 18 appropriations, the OIG’s findings show that now is not the time to expand a detention system that ICE is not capable of effectively and safely running. Detention must be reduced and, where needed, humane alternatives to detention, implemented in its place.”

Three years ago, the Department of Homeland Security Inspector General’s office reported on a series of unannounced visits to detention centers for unaccompanied children. The inquiry found evidence of inadequate food, temperature control problems and inconsistent employee-to-detainee ratios.”

These are hardly “new” developments! So, why are Sessions and his DHS “stooges” “doubling down” on detention of non-crimninal aliens in private facilities, rather than fixing these  life-threatening, unconstitutional conditions first. Sounds like clear Civil Rights violations to me. Why isn’t the DOJ’s Civil Rights Division “all over this like a cheap suit?” The answer to that is pretty obvious: They would have to prosecute  their boss for knowingly creating and furthering these conditions. All part of his “Gonzo deterrence strategy.” What if it were a member of YOUR family being held in inhumane conditions like these?
The solution?” Simple:  Let the non-dangerous immigrants (about 98% of them) out; put Sessions, Nielsen, Homan, and Miller in prison until the problems are fixed. Now THAT would finally be a use of detention that would have some real and appropriate deterrent value!
The true “rule of law” won’t be “restored” to America until “Gonzo” Sessions is removed from office.

  • Get a lawyer.
  • Make sure lawyer is real & reputable.
    • Confirm bar admission and check complaints online.
    • Firm website should confirm that immigration is a primary area of practice.
    • Google published immigration cases and check results.
  • Get it in writing.
    • In a language you understand.
  • If it’s too good to be true, it probably isn’t.
  • Play to tell the truth.
    • With lawyer, court, DHS.
  • Keep your appointments with your lawyer.
    • Time is money – YOUR money!
    • Lawyer needs complete and accurate information to help.
  • Show up for all Immigration Court hearings at least 30 minutes early.
    • Failing to appear (“FTA”) is the worst possible thing you can do in Immigration Court.
    • FTA = Final Order of Removal = Arrest, Detention & Immediate Removal = YOU become “low hanging fruit” for DHS’s “jacked up” removal goals!
  • Dress the part.
    • No cutoffs, t-shirts, flip-flops, halter-tops, crop tops, underwear showing, muscle shirts, flashy distracting jewelry, “rainbow hair,” shirts with (particularly political) slogans, baseball caps in Immigration Court.
    • Dress as you would to go to the funeral of someone you respected.
  • Avoid the “Big Five:”
    • Alcohol
    • Drugs
    • Domestic violence
    • Gangs
    • Driving violations of all types.
      • OWLs can be a problem and eventually turn into felonies in Virginia!
      • That’s what busses, trains, friends, co-workers, bikes, and strong legs are for.
    • Keep all documents – originals and at least one copy.
      • Never give away originals (unless the judge requires it) or your only copy of a document.
    • Pay taxes.
    • Stay in school or keep employed.
    • Ask questions.
      • Insist on an explanation that you understand in a language you understand.
    • Don’t sign anything you don’t understand.
      • Make sure everything has been translated for you.
    • Comply with all court orders.
    • Use available resources:
      • Internet
      • 1-800 number
      • Immigration Court Practice Manual (“ICPM”) (online).
    • Don’t forget family and friends.
      • They can be some of your best resources.

“Cruz Mendez, 30, made this trip in reverse when she was 18 years old, skipping her high school graduation to flee a neighborhood man who had harassed her in San Salvador. She was detained at the U.S.-Mexico border, released and allowed to join her brother in Virginia. Two months later, an immigration judge in Texas ordered her deported. Cruz Mendez says she never knew about the hearing.

In Fairfax, she was crowned beauty queen at a local Salvadoran festival and met Rene Bermudez, a hazel-eyed laborer who worked construction.

Steve was born in 2007, Danyca in 2012.

Late in 2013, police stopped Cruz Mendez for failing to turn on the lights on her minivan and charged her with driving without a license, an arrest that alerted federal agents to her old deportation order.

While President Barack Obama deported high numbers of undocumented immigrants during parts of his tenure, parents of American citizens with little to no criminal record were not priorities for expulsion. So officials released Cruz Mendez with orders to stay out of trouble and check in with them once a year.

But under President Trump, who campaigned on a promise to crack down on illegal immigration, anyone here without papers can be expelled.

Interior deportations — of people already living in the United States, as opposed to those caught crossing the border — have risen 37 percent since Trump took office. Deportation arrests of non-criminals such as Cruz Mendez — many, like her, with children who were born in this country and are U.S. citizens — surged past 31,000 from inauguration to the end of September, triple the same period last year.

On the May morning when she was scheduled for her yearly check-in, Cruz Mendez lingered in the apartment, which she’d decorated with family photographs, Danyca’s art projects and Steve’s citizen-of-the-month award from elementary school.

She considered the possibility of skipping the check-in, aware of other longtime immigrants who had been deported after similar appointments. But she could not fathom life as a fugitive. Worried, Bermudez warned her that she was going to be late.

“Why are you trying to turn me over so fast?” Cruz Mendez snapped in Spanish.

She eventually walked into the immigration agency’s Fairfax office, accompanied by advocates and loved ones. Agents took her into custody as her supporters shouted.

For a month, her husband and lawyers fought to free her. Steve tried, too, writing letters to Immigration and Customs Enforcement that were full of pleas and questions.

“Plz don’t deport my mom,” one of the letters said.

Who will take me to the doctor, the dentist? Who will take care of me and my sister? Who will I live with?

It didn’t work. On June 14, they sent her back. Bermudez and the kids filled a giant cardboard box with her dresses and shoes, pots and pans, and placed it by the front door, waiting for a courier to take it away.

‘How can I go?’
Deportations can shatter a family or a marriage. In one study of the aftermath of six immigration raids, family income dropped an average of 70 percent. Another study, of U.S.-born Latino children, found that those whose parents had been detained or deported experienced significantly higher post-traumatic stress disorder symptoms than their peers.

“That child’s more likely to be poor. They’re more likely to be depend on public benefits,” said Randy Capps, U.S. research director for the Migration Policy Institute. “And then psychologically, you just don’t know. There could be an immediate impact; it could be a long time before that psychological impact shows up.”

In the Falls Church apartment, Steve and Danyca cried all the time after Cruz Mendez was deported. No one wanted to eat.

THE GHOST OF CHRISTMAS FUTURE

What kind of country abuses its youth  — our hope for the future —  this way? What kind of county wastes its human capital and potential in this manner? What kind of country empowers leaders who are intentionally cruel, immoral, dishonest, and stupid? What kind of country intentionally turns valued friends and positive contributors into potential disgruntled enemies?

This is the way that a once great nation transforms itself into an “overstuffed banana republic!”

But, it’s not yet too late to change the grim vision of “Christmas Future” being promoted by Trump, Sessions, Kelly, Homan, Bannon, Miller, and their cronies. We can resist the horrible policies of the Trump Administration in the courts of law and the courts of public opinion! Ultimately, totally unqualified officials like Trump, Sessions, and their White Nationalist cronies — who are plotting the end of America as we know it — can be defeated at the ballot box and removed from office.

But, there will come a “point of no return” when the damage done by these corrupt individuals and their enablers (both willing and unwitting) cannot be undone! Are we as smart, human, and capable of leaving behind selfishness and embracing decency and human kindness as Ebineezer Scrooge? Or will the Ghost prove to be the Prophet in this version of the Christmas Carol?

does not establish changed circumstances. Accordingly, we grant the petition for review, vacate the BIA’s order, and remand the case to the BIA for further consideration in light of this opinion.”

This is a very important decision for asylum applicants in the Fourth Circuit, as this situation arises frequently in Immigration Court.

With three well-reasoned Circuit decisions already in the books, why is the BIA holding out for a discredited rationale? How many individuals who weren’t fortunate enough to have Ben Winograd or an equally talented lawyer argue for them in the Court of Appeals have already been wrongfully removed under the BIA’s discredited rationale? Where’s the BIA precedent adopting this rationale and making it binding on IJ’s nationwide before more individuals are wrongfully removed? How is this “through teamwork and innovation being the world’s best administrative tribunal guaranteeing fairness and due process for all?”

The answer to the latter question is sadly obvious. While the BIA’s problems predated his tenure, the attitude of Attorney General Jeff Sessions, as demonstrated in his recent pronouncement on so-called “Immigration Court efficiency” elevates “false efficiency,” speed, and cranking out removals above fundamental fairness and Due Process. Why have an elaborate administrative court system that doesn’t put Due Process first and foremost as “real” (non-captive) courts generally do? Why not just send all removal cases to U.S. District Judges and Magistrate Judges who make Due Process and fairness “job one” and aren’t preoccupied with “jacking up” removal statistics to please political bosses?

And, I’d like to see how far the DHS/Sessions’s (they are pretty much the same these days) boneheaded, arrogant, unrealistic, and wasteful “no PD” policy would get in a “real” court system where widespread, reasonable, and prudent use of PD by prosecutors is understood and accepted as an essential part of fairness, efficiency, and responsible use of publicly-funded judicial resources. Indeed, in some of my past “off the record” conversations with Article III Judges, they were absolutely flabbergasted to discover the unwillingness of DHS to meaningfully exercise “PD” in the pre-Obama era and to learn that at DHS the “cops,” rather than the prosecutors were responsible for setting PD policies!

IMMIGRATION, AGRIBUSINESS, & THE AMERICAN SMALL CITY — A Complex Dialogue!

“FREMONT, Nebraska—The past few years in this Nebraska town of 26,000 have been unusually fraught. “My neighbor is on the City Council. His wife does not wave to me,” explained John Wiegert, as he made his way to a political meeting at the public library this summer. “I could be on fire in the front yard, and she wouldn’t put me out with a garden hose.” Doug Wittmann, who had organized the get-together, wore a blue polo branded with his organization, a Tea Party–influenced group called Win It Back. “We’re divided in this country; we’re divided in this community,” Wittmann told me. “And a house divided against itself cannot stand.” Twenty minutes later, the City Council president, Scott Schaller, wearily addressed the gathering: “It seems like we’ve disagreed on more issues lately, over the past year, than we’ve ever disagreed on.”

A few dozen Fremont residents were crowded into a library meeting room to discuss the Costco chicken plant, a $300 million facility that broke ground this summer and will, starting in 2019, slaughter and ship nearly 400,000 birds a day, all raised by local farmers on strict contracts. The meeting was about eminent domain, but the plant had come to stand for much more than that. Its arrival had split this quadrant of the state along lines that defy traditional two-party politics. In favor is the pro-growth business and political elite, immigration-friendly liberals, and a considerably quieter contingent of Latino residents. Opposed is a curious coalition of aging nativists, good-government advocates, environmentalists, and advocates for workers’ rights.

When complete, the Fremont plant will enable Costco to control poultry production all the way from fertilization to the spits upon which rotisserie chickens will glisten in the chain’s hundreds of locations in the Western United States. Costco says the economic impact of the Fremont plant, hatchery, and feed mill will be $1.2 billion each year, adding more than 1 percent to Nebraska’s gross domestic product. It will transform Fremont, where as many as 1,000 new workers could buy their groceries and educate their children, and the surrounding region, where hundreds of chicken barns will sprout in the fields like mushrooms after the rain.

The battle over the Costco plant has served as a coda for a long war over the way the meat business—Fremont’s Hormel hog plant is the nation’s largest producer of Spam—has changed the town’s identity through the arrival of Latino workers and their families, who now number about 4,000 here. Fremont is the only city in the country that has successfully made it illegal to rent a house to an unauthorized immigrant. The ordinance failed in the City Council in 2008, passed in a referendum in 2010, was overturned by a district court judge in 2012, and was upheld by a circuit court in 2013. Fremont reaffirmed the ordinance in a second referendum in 2014, with 60 percent of voters in favor. Years of raucous debate split families and neighbors, inspired acts of vandalism, brought media attention from far afield, and drove hundreds of Latino residents to leave. Since the second referendum, the city has held an uneasy peace over the ordinance, which goes largely unenforced. Many Latinos who left have returned. But the City Council still sets aside budget money for the possibility they will wind up back in court. A similar, ultimately overturned ordinance cost a Dallas suburb $6 million in legal fees.

The themes that characterized that saga in Fremont resonate across dozens of Midwestern towns—Austin, Minnesota; Storm Lake, Iowa; Garden City, Kansas—where just about the only job and population growth in the past two decades has come from the meatpacking industry and the immigrant workers it attracts. Meat has remained invulnerable to the outsourcing that devastated Rust Belt manufacturing towns. In fact, deregulation and factory farming have brought on a meat boom, bringing good news to towns like these: more young people, more downtown businesses, and related jobs in law, finance, and health care. This is especially visible in places like Schuyler, Nebraska, a small city west of Fremont that’s now more than 70 percent Hispanic. “People had to make a decision: Embrace change or get rid of it,” said Susan Jacobus, a Fremont city councilor who moved recently from Schuyler. “And if you get rid of it, it’s going to cost you your town.”

The Costco plant will bring tax dollars and local spending from hundreds of new arrivals. But it will also reshape the environment of eastern Nebraska, with fertilizer from 500 chicken barns dumping nitrates and phosphates into the water supply of cities downstream. And the work itself, if history is any guide, will be low-paying, dangerous, and difficult. There’s a reason native-born whites don’t work in meat plants anymore.

Supporters of the housing ordinance claimed to defend law and order—they had no problem with legal immigrants, they often said—but they also complained about hearing Spanish spoken in the supermarket and worried about the burden that even legal immigrants placed on Fremont’s schools and social services. They didn’t see why Fremont had to change. If the ordinance was their defiant rebuke to the plants, the packers, and the politicians, the approval of the Costco plant was the opposite: proof that their world was indeed changing beyond their control.

Three years after affirming what may be the most anti-immigrant housing law in the country, Fremont is welcoming a plant that is all but certain to bring hundreds more immigrant and refugee families to town. The city’s political class, which by and large opposed the ordinance, considers this a no-brainer. Unlike many rural communities, Fremont’s population has not declined, in part because it’s now 15 percent Latino. But it is older than the state and the country: Nearly 20 percent of the population is 65 and older. “There’s some people that, regardless of what you do, it’s change, and they don’t want change, period,” said Fremont Mayor Scott Getzschman, who has helped approve the facility. “There’s nothing you can do to make them feel this is the right thing for Fremont.” But, he insists, there is no alternative. “You have to continue to grow, or you die.”

WASHINGTON POST EDITORIAL RIPS TRUMP/SESSIONS “GONZO” IMMIGRATION AGENDA AS “ANTI-AMERICAN!”– White Nationalist Inspired Restrictionism Is Suppressing The Real Dialogue We Should Be Having!

THE TRUMP administration likes to justify its multi-front crusade against immigration and immigrants as a revival of the rule of law, or a recalibration of the rules to favor disadvantaged American workers. In fact, it is largely a resurrection of xenophobia that coincides with a spike, nearly 50 years in the making, in the number of foreign-born residents living in the United States.

“For decades,” Attorney General Jeff Sessions said in a speech in October, “the American people have been begging and pleading . . . for an immigration system that’s lawful and serves the national interest. Now we have a president who supports that.”

Mr. Sessions’s claims are specious. An embrace of legality is not the driving force behind the president’s decision to slash the admission of refugees to levels unseen in nearly 40 years. It is not what compelled Mr. Trump to endorse Republican legislation that would cut the annual allotment of green cards by a half-million, mainly by barring relatives of existing legal permanent residents of the United States. It is not why the Pentagon has considered ending a recruitment program that put skilled foreigners on a fast track for citizenship if they served in this country’s armed forces. And it is not why the administration favors ending the so-called diversity visa lottery program, under which immigrants are admitted from nations underrepresented in other programs.

Those programs were all legally enacted and, by and large, carried out in compliance with the law. The animating force in targeting them, as the administration is now doing, is an effort to turn back the tide of foreigners in our midst and exorcise what the president evidently sees as the demon of diversity.

The administration’s goal is not to reshape America’s immigration policy but to prune immigration itself. While Mr. Trump backs a GOP plan that would give preference to immigrants with skills rather than family connections in the United States, the effect would be not simply to shift the mix while maintaining the current level of legal immigration but to drastically reduce overall numbers of admissions.”

Unfortunately, Mr. Trump has poisoned the debate on immigration so thoroughly that he has twisted the frame through which many Americans see the issue. His slurs — labeling Mexican immigrants as rapists and Muslim immigrants as terrorists — form the context from which the administration’s policies arise. They are affronts to U.S. tradition and values.

They’re also an assault on what Mr. Sessions refers to as “the national interest” and specifically the United States’ economic well-being. Legions of employers dependent on immigrant workers, especially to fill low-skilled jobs for which native-born Americans are too well educated and in short supply, will be harmed by choking off the flow of immigrant labor. With unemployment at a 16-year low and approaching levels unseen in a half-century, the Trump policies threaten to sap the economy by depriving it of the energy of striving newcomers who have fueled this nation’s ambitions since its founding.

It is within the president’s discretion to intensify efforts at deportation, though the humanitarian price — in shattered communities and families, including those whose children, born in this country, are Americans — is high. It is reasonable to take steps to tighten border security, though with illegal crossings already at a 40-year low and the Border Patrol’s staffing having already been doubled since the George W. Bush administration, a significant new investment along those lines faces the risk of diminishing returns. The administration may arguably have had a valid legal basis for ending the Obama-era program granting deportation protection for “dreamers” — undocumented immigrants who entered the country as children, often brought by their parents — though only a smallish minority of Americans believes they should be removed from this country.

But what value, other than sheer bigotry, is served by reducing the resettlement of refugees in the United States at a time when the number of displaced people worldwide has soared to staggering levels? In a country founded and in many respects shaped by refugees — a country that has resettled some 3 million refugees since 1980, more than any other nation — why does the Trump administration insist on turning its back on them now, when some 17 million people have been displaced from their homes across international borders around the world due to conflict or persecution, the highest number in a quarter-century?

It is clearly jarring to some Americans that the foreign-born portion of the overall population has nearly tripled since 1970. Many communities, towns and cities have been transformed culturally and socially by that surge, about a third of which was driven by illegal immigrants.

In some places, local government budgets have strained to provide services for immigrants, particularly public education, and the economic dislocation felt by many working-class Americans is a fact. But that dislocation is not mostly caused by immigrants. The United States is a more prosperous place today than it was before the surge in immigration, and immigrants have fed that prosperity — by helping to harvest America’s crops, build its cities, care for its young and elderly, and found some of its most buoyant companies.

. . . .The Trump administration’s crusade against immigration and immigrants is not just a quest to diminish the influence of the “other”; it is an assault on the nation’s future and prospects.”

This is largely (not entirely — I believe that there is a sound legal basis for continuing DACA, for example) what I’ve been saying all along:

  • Jeff Sessions is a bigoted, xenophobic, anti-American scofflaw whose disingenuous, self-righteous claims to be restoring the “Rule of Law” (that would be the “Jim Crow laws” of Sessions’s Alabama past) are totally outrageous;
  • The real purpose of the Administration’s xenophobic program is to divide and weaken America  by stirring up racial, religious, and ethnic animosities;
  • The “Gonzo,” arbitrary interior enforcement program serves no useful purpose other than playing to the “biases of the base” and the wishes of some (not all) disgruntled immigration enforcement agents for unbridled authority;
  • Our xenophobic anti-immigrant rhetoric and policies are costing us leadership and respect on the world scene (just this weekend, the Administration withdrew from the UN Global Migration Pact);
  • Our past strength as a nation and our future success and prosperity is based on immigration (and, the US clearly has benefitted from BOTH legal and “extra-legal” migration);
  • The Trump Administrations’s rhetoric and actions are preventing us from having the serious discussion we need: how we can better regulate (not cut off, diminish, or eliminate) future legal migration of all types to serve our national interest (and to be more “in tune” with “market realities” that drive much immigration), reflect our humanitarian values and the legitimate needs of current and future migrants, and encourage use of our legal immigration system, thereby diminishing the incentives for extra-legal migration.

As long as U.S. immigration policy remains in the hands of White Nationalist xenophobes like Trump, Sessions, Miller, and Bannon (yes, Stevie “Vlad the Lenin” has vacated his perch in the West Wing, but he continues to pull strings through his White Nationalist disciples Sessions and Miller and to stir the pot through his alt-right “news” apparatus Breitbart News) we won’t get the constructive dialogue and the humane, realistic “immigration reform” that we really  need. In other words, under current leadership, the real “Rule of Law” will continue to be diminished.
