As Sasha Polakow-Suransky, the author of “Go Back to Where You Came From: The Backlash Against Immigration and the Fate of Western Democracy,” warns in The New York Review of Books:

Liberal democracies are better equipped than authoritarian states to grapple with the inevitable conflicts that arise in diverse societies, including the threat of terrorist violence. But they also contain the seeds of their own destruction: if they fail to deal with these challenges and allow xenophobic populists to hijack the public debate, then the votes of frustrated and disaffected citizens will increasingly go to the anti-immigrant right, societies will become less open, nativist parties will grow more powerful, and racist rhetoric that promotes a narrow and exclusionary sense of national identity will be legitimized.

The threat to democracy posed by the current outbreak of populist nationalism has become a matter of concern for both scholars and ordinary citizens. The central topic at a conference at Yale earlier this month was “How Do Democracies Fall Apart,” and the subject will be taken up again in November at a Stanford conference called “Global Populisms: A Threat to Democracy?

I contacted several of the participants at the Yale gathering and was struck by their anxiety over the future prospects of democratic governance.

One of the most insightful was Adam Przeworski, a political scientist at N.Y.U., who has written, but not yet published, his own analysis of current events under the title “What’s Happening.”

First and foremost, Przeworski stresses,

there is nothing “undemocratic” about the electoral victory of Donald Trump or the rise of anti-establishment parties in Europe.

These parties and candidates, he points out:

Do not advocate replacing elections by some other way of selecting rulers. They are ugly — most people view racism and xenophobia as ugly — but these parties do campaign under the slogan of returning to ‘the people’ the power usurped by elites, which they see as strengthening democracy. In the words of a Trump advertisement, “Our movement is about replacing a failed and corrupt political establishment with a new government controlled by you, the American people.”

In support of Przeworski’s argument, it is clear that the success of the Trump campaign in winning the Republican nomination was the result of a classic democratic insurgency: the Republican electorate’s rejection of its party’s establishment.

The danger in the United States, in Przeworski’s view, is the possibility that the Trump administration will use the power of the presidency to undermine the procedures and institutions essential to the operation of democracy:

That the incumbent administration would intimidate hostile media and create a propaganda machine of its own, that it would politicize the security agencies, that it would harass political opponents, that it would use state power to reward sympathetic private firms, that it would selectively enforce laws, that it would provoke foreign conflicts to monger fear, that it would rig elections.

Przeworski believes that

such a scenario would not be unprecedented. The United States has a long history of waves of political repression: the “Red Scare” of 1917-20, the internment of Japanese citizens during World War II, the McCarthy period, the Nixon presidency.

Along similar lines, Anna Grzymala-Busse, a political scientist at Stanford, replied by email to my inquiry:

My big worry is not simply that formal institutions have been eroded, but that the informal norms that underpin them are even more important and even more fragile. Norms of transparency, conflict of interest, civil discourse, respect for the opposition and freedom of the press, and equal treatment of citizens are all consistently undermined, and without these the formal institutions become brittle.

Trump, in Grzymala-Busse’s assessment, “articulates a classic populist message that we see in Europe: the elite establishment is a collusive cartel uninterested in the problems of ‘the people,’” and, she continued, he has begun to follow the path of European populist leaders:

Much of Trump’s language and actions are also familiar: there is a standard authoritarian populist template, developed in Hungary and faithfully followed in Poland and in Turkey: first, go after the courts, then the media, then the civil society, churches, universities.

The attacks on the courts, media and universities

are not simply the ravings of a lunatic, but an established strategy for undermining democratic oversight and discrediting the opposition.

Paul Waldman, writing in The Washington Post on Oct, 17, summed up Trump’s approach to veracity and to reality itself:

Trump takes his own particular combination of ignorance, bluster and malice, and sets it off like a nuclear bomb of misinformation. The fallout spreads throughout the country, and no volume of corrections and fact checks can stop it. It wasn’t even part of a thought-out strategy, just a loathsome impulse that found its way out of the president’s mouth to spread far and wide.

Trump’s recklessness is disturbing enough on its own. But what makes it especially threatening is that much of the public — well beyond the 40 percent of the electorate that has shown itself to be unshakable in its devotion to the president — seems to be slowly accommodating itself to its daily dose of the Trump reality show, accepting the rhetorical violence that Trump inflicts on basic standards of truth as the new normal.”

WHITE NATIONALISM (NOT ISLAMIC TERRORISM) IS THE BIGGEST THREAT TO WESTERN CIVILIZATION!

“When rapid immigration and terrorist attacks occur simultaneously — and the terrorists belong to the same ethnic or religious group as the new immigrants — the combination of fear and xenophobia can be dangerous and destructive. In much of Europe, fear of jihadists (who pose a genuine security threat) and animosity toward refugees (who generally do not) have been conflated in a way that allows far-right populists to seize on Islamic State attacks as a pretext to shut the doors to desperate refugees, many of whom are themselves fleeing the Islamic State, and to engage in blatant discrimination against Muslim fellow citizens.

But this isn’t happening only in European countries. In recent years, anti-immigration rhetoric and nativist policies have become the new normal in liberal democracies from Europe to the United States. Legitimate debates about immigration policy and preventing extremism have been eclipsed by an obsessive focus on Muslims that paints them as an immutable civilizational enemy that is fundamentally incompatible with Western democratic values.

Yet despite the breathless warnings of impending Islamic conquest sounded by alarmist writers and pandering politicians, the risk of Islamization of the West has been greatly exaggerated. Islamists are not on the verge of seizing power in any advanced Western democracy or even winning significant political influence at the polls.

The same cannot be said of white nationalists, who today are on the march from Charlottesville, Va., to Dresden, Germany. As an ideology, white nationalism poses a significantly greater threat to Western democracies; its proponents and sympathizers have proved, historically and recently, that they can win a sizable share of the vote — as they did this year in France, Germany and the Netherlands — and even win power, as they have in the United States.

Far-right leaders are correct that immigration creates problems; what they miss is that they are the primary problem. The greatest threat to liberal democracies does not come from immigrants and refugees but from the backlash against them by those on the inside who are exploiting fear of outsiders to chip away at the values and institutions that make our societies liberal.

Anti-Semitic and xenophobic movements did not disappear from Europe after the liberation of Auschwitz, just as white supremacist groups have lurked beneath the surface of American politics ever since the Emancipation Proclamation. What has changed is that these groups have now been stirred from their slumber by savvy politicians seeking to stoke anger toward immigrants, refugees and racial minorities for their own benefit. Leaders from Donald Trump to France’s Marine Le Pen have validated the worldview of these groups, implicitly or explicitly encouraging them to promote their hateful opinions openly. As a result, ideas that were once marginal have now gone mainstream.”

DREAMER UPDATE: N. Rappaport Says 47 Mi. Of “Trump‘s Wall” Is An Acceptable Price For Dems To Pay To Save “Dreamers” — CNN’S Tal Kopan Says GOP House Might Go With Own “Dreamer Bill” (Once Again) Excluding Dems!

Nolan writes in The Hill:

“Realistically, it is not going to be possible to work with Trump on a permanent DACA program without providing the funds he needs to at least start the construction of his wall, but this does not have to be a deal breaker.

Get him started with funding to complete the last 47 miles of the border fencing that was mandated by the Secure Fence Act of 2006, which was passed in the Senate 80 to 19. The yeas included current Senate party leaders Mitch McConnell (R-Ky.) Schumer and former Senators Barack Obama (D-Ill.) and Hillary Clinton (D-N.Y.).

As amended by section 564 of the Consolidated Appropriations Act, 2008, it requires DHS to “construct reinforced fencing along not less than 700 miles of the southwest border where fencing would be most practical and effective.”  DHS only completed 653 miles of the authorized fencing.

Finishing this project would give Trump a chance to show what he can do and provide a reliable basis for estimating the cost of a wall along the entire length of the Southwest border.

The alternative to finding a compromise is to abandon the tentative agreement and let the Democrats continue their endless stream of complaints about Trump, which won’t improve Congress’ approval ratings or save any of the DACA participants from being deported.”

I basically agree with what Nolan has said above. While recognizing the emotional and political difficulties behind the Democrats giving on any “Wall Issue,” 47 miles of fencing in return for saving the lives and futures of nearly one million American young people is a reasonable trade-off. Unlike a “Full Wall,” the 47 miles has some bipartisan historical precedent and might be at least somewhat helpful to the Border Patrol in securing the border. Trump has to get something out of this for his “base” to offset their qualms about a “Dreamer Deal.” And the Democrats still reserve their right to “dig in” on other “Wall Issues” that won’t be going away as long as Trump is President. Plenty of room for the Democrats to posture to their base in the future, plus take credit for saving the Dreamers.

I think the Democrats should include as many Dreamers in the bill as possible. Since these residents are good for America, the more that are included the better for all of us. I would also reject inserting any “points system” into the process. That’s a bad idea (part of the “restrictionist agenda”) that Democrats should emphatically reject. I had all sorts of folks come though my courtroom in my thirteen years on the bench. I’d never say that the doctors, teachers, and computer scientists were “better” or “more valuable” for America than the bricklayers, landscapers, taxi drivers, maids, and sandwich artists. They are all contributing in important ways. The elitist “point system’ is simply another part of the bogus white restrictionist agenda.

I can’t agree with Nolan that there is anything that the Democrats can realistically do with Trump’s White Nationalist “wish list” on larger immigration reform. It’s a toxic and offensive compendium of truly reprehensible measures that will either diminish the legal and human rights of  the most vulnerable migrants or send America in a totally wrong direction by restricting legal immigration at a time when it should be expanded. Just nothing there that’s realistic or morally acceptable, as you might expect when White Nationalists like Sessions, Miller, and Banning get their hands on immigration policy.

Although clearly outnumbered at present, the Democrats do have two “Trump Cards” in their hand.

First, no matter how much cruel, inhumane, and wasteful “Gonzo” enforcement the Trump-Sessions-Homan crowd does, they won’t be able to make much of a dent in the 10-11 million population of undocumented workers during the Trump Administration, be that four or eight years. That means most of those folks aren’t going anywhere. It’s just a question of whether they work legally and pay taxes or work under the table where most of them probably won’t be able to pay taxes. So the issue will still be around, looking for a more constructive solution whenever “Trumpism” finally ends.

Second, no amount of Gonzo restrictionism can stop additional needed foreign workers from coming in the future as long as there 1) is an adequate supply, and 2) are U.S. industries that demand their services — and there clearly will continue to be. Employer sanctions won’t stop undocumented migration. We’ve already proved that. About the most the restrictionists can do is change the cost equation, making the cost of importing documented and undocumented workers more expensive to U.S. employers while enriching and enlarging international human smuggling operations. Restrictionists are international smuggling cartels’ “best friends,” at least up to a point.

It is, however, possible, that legal immigration restrictions enacted into law could eventually raise the costs of obtaining foreign labor, both documented and undocumented, to the point where it becomes “not cost-effective.” The cost of legal foreign labor would simply become too great and the supply too small. Meanwhile, over on the undocumented side, workers would have to pay smugglers more than they could anticipate making by working in the U.S.; there would come a point when it would not be cost-effective for U.S. employers to raise wages for undocumented workers any further.

At that point, the U.S. agriculture, tourism, hospitality, and entertainment industries, as well as other service industries heavily dependent on legal and undocumented foreign labor would start to disappear. They would soon be joined by technology, education, and other “STEM type” industries that need more qualified legal foreign labor than the restrictionists would be willing to provide. At that point, the country would go into economic free-fall, entirely attributable to the GOP restrictionists. The Democrats could come back into power, and eventually restore economic order with the necessary sane expansion of legal immigration opportunities.

It’s certainly a scenario that most Americans should want to avoid. But, as long as our government is controlled by restrictionists with overriding racial and political motivations, rather than by those searching for the “common good,” successful immigration reform might well be out of reach. And no “White Nationalist Manifestos” such as the Trump White House just issued are going to change that.

Meanwhile, over at CNN, Tal Kopan reports on the House GOP’s “own plan” for a “non-bi-partisan” Dreamer Bill, which, of course, would be DOA in the Senate.

Tal writes:

“Washington (CNN)A key House Republican involved in immigration negotiations said Wednesday that he expects his chamber will pass a bill with only GOP votes — and would include some version of a border wall — even as Democrats dismiss the idea that such a deal could reach the President’s desk.

Texas Rep. John Carter is a member of the House Republican immigration working group set up by House Speaker Paul Ryan to figure out a path forward for the Deferred Action for Childhood Arrivals program, an Obama-era policy that protected young undocumented immigrants brought to the US as children from deportation, which President Donald Trump has decided to end.
Carter told reporters in the Capitol that he expects what comes out of those meetings to be Republican-only and to include at least something for Trump’s controversial border wall.
“I think we will have a wall factor in the bill and I don’t think we will get a single Democrat vote,” Carter said about the discussions.
Democrats have said any wall funding would be a nonstarter for negotiations, and Trump has suggested he’d consider separating the wall from the debate, though the White House has said it’s a priority.

Carter declined to talk about the internal deliberations of the group, but said, “we are trying to come up with solutions which will not only be good for the DACA people but will also be good for America.”
Sources familiar with the workings of the group, which includes Republicans from across the spectrum of ideology in the party, say that while the group has been meeting and discussions are happening among members, the rough outline of a deal has yet to form.
Republicans may aspire to be able to use its House majority to pass the bill but will almost certainly lose some members over any legalization of DACA recipients, and could lose more moderates or conservatives depending on how a deal takes shape. For any bill to pass the Senate, it will need Democratic votes to clear the 60-vote filibuster threshold.
When Trump announced in early September he was ending DACA, Ryan created the group to attempt to gain consensus on the thorny issue. Trump urged Congress to act and protect DACA recipients, but has also called for border security and immigration enforcement with it. Sunday night, the White House released a laundry list of conservative immigration principles that House Minority Leader Nancy Pelosi on Wednesday dismissed as “trash” and coming from a place of “darkness and cruelty.”
Trump created a six-month window for Congress to act by offering DACA permits that expire before March 5 one month to renew for a fresh two years, postponing any DACA expirations until March.
On Wednesday, the Department of Homeland Security said it was still finalizing numbers but that at least 86% of those DACA recipients eligible to renew had applications in by the October 5 deadline. Roughly 132,000 of the 154,000 eligible recipients had applied, spokesman David Lapan said, but that could leave thousands of recipients losing protections before March.
As for the strategy of the House to pass a Republican-only bill, Carter acknowledged that there was a concern the group’s proposal couldn’t pass the Senate but said the other chamber needs “to get their work done” and he hoped both the House and Senate could hammer out a final compromise.
But Pelosi criticized the strategy when asked by CNN what she thought of Carter’s comments.
“That would not be a good idea,” Pelosi said. “Why would they go to such a place? It is really, again, another act of cruelty if they want to diminish a bill in such a way. And they still have to win in the Senate.”
California Democratic Rep. Zoe Lofgren, a longtime key House Democrat on any immigration policy, said that no serious negotiations have occurred between parties and moving forward alone would be Republicans’ prerogative but not necessarily successful.
“I like (Carter), I have no idea what they’re looking at, and if we were really having negotiations, we would be talking to each other,” Lofgren told CNN. “If they have the votes to pass something, they have the capacity to do that. How they get 60 votes in the Senate, who knows.”

“When people arrive at the border seeking asylum from persecution, the United States gives them the benefit of the doubt. As long as they can show there’s a “significant possibility” that they deserve protection, they’re allowed to stay and make their case to an immigration judge. President Donald Trump and Republicans in Congress want to change that.

On Sunday, the Trump administration demanded that Congress overhaul the US asylum system as part of any legislation to protect the nearly 700,000 undocumented immigrants known as Dreamers from deportation. The White House’s asylum proposal, laid out in nine bullet-pointed items as part of the broader immigration plan, appears to be modeled on the Asylum Reform and Border Protection Act, a bill that Republicans on the House Judiciary Committee approved in July. The bill, which has not been passed by the full House, would make it easier for the Department of Homeland Security to quickly reject asylum claims and force most asylum seekers to remain in detention while their cases are decided. The overall effect would be to transform a system for protecting persecuted people, created in the wake of World War II, into a much more adversarial process.  

At a hearing in July, Rep. Zoe Lofgren (D-Calif.) warned that the GOP proposal would “all but destroy the US asylum system.” Now Trump is trying to fold those changes into a deal to protect the Dreamers—undocumented immigrants who came to the country as children—who were previously covered by Barack Obama’s Deferred Action for Childhood Arrivals program.

Eleanor Acer, an expert on refugees at the advocacy group Human Rights First, saidin a statement Monday that Trump’s demands will “block those fleeing persecution and violence from even applying for asylum, and punish those who seek protection by preventing their release from immigration detention facilities and jails.”

But Republicans like Rep. Bob Goodlatte (R-Va.) argue that asylum reform is needed to address “pervasive” fraud, such as false claims of persecution. Asylum claims from the “Northern Triangle” countries of Guatemala, El Salvador, and Honduras have been a major focus for Republicans. Between 2013 and 2015, there were more asylum claims from the Northern Triangle, which has been terrorized by MS-13 and other gangs, than in the previous 15 years combined. A 2015 report from the Government Accountability Office found that the United States has “limited capabilities to detect asylum fraud.” But the scope of the problem is not known. Leah Chavla, a program officer at the Women’s Refugee Commission, says going after fraud is misguided in light of the many checks and balances that are already in place. 

The real “fraudsters” here are the GOP restrictionists, led by folks like Goodlatte, Miller, and Sessions, trying to fob off their knowingly false and contrived narrative on America. Shame!

Second, the current system intentionally denies lawyers to the respondents in detention in obscure locations along the Southern Border, specifically selected to make it difficult for individuals to exercise their rights. Raising the standards would virtually guarantee rejection of all such asylum seekers without any hearing at all. The standard for having asylum granted is supposed to be a generous “well-founded fear” (in other words, a 10% chance or a “reasonable chance”). In fact, however, DHS and EOIR often fail to honor the existing legal standards. Forcing unrepresented individuals in detention with no chance to gather evidence to establish that it is “more likely than not” that they would be granted asylum is a ridiculous travesty of justice.

Third, access to lawyers, not detention, is the most cost-effective way to secure appearance at Immigration Court hearings. Individuals who are able to obtain lawyers, in other words those who actually understand what is happening, have a relatively low rate of “failure to appear.” In fact, a long-term study by the American Immigration Council shows that 95% of minors represented by counsel appear for their hearings as opposed to approximately 67% for those who are unrepresented. Rather than curtailment of rights or expensive and inhumane detention, the best way of insure that all asylum applicants appear for their scheduled hearings and receive full due process would be to insure that the hearings take place in areas with adequate supplies of pro bono and “low bono” counsel and that hearings are scheduled in a predictable manner that does not intentionally outstrip the capabilities of the pro bono bar.

Fourth, a rational response to fraud concerns would be building better fraud detection programs within DHS, rather than denying vulnerable individuals their statutory and constitutional rights. What would a better system look like:  more traditional law enforcement tools, like undercover operations, use of informants to infiltrate smuggling operations, and much better intelligence on the operations of human trafficking rings. And, there’s plenty of resources to do it. DHS just lacks the ability and/or the motivation. Many of the resources now wasted on “gonzo” interior enforcement and mindless detention — sacking up janitors and maids for deportation and detaining rape victims applying for asylum — could be “redeployed” to meaningful, although more challenging, law enforcement activities aimed at rationally addressing the fraud problem rather than using it as a bogus excuse to harm the vulnerable.

Fifth, Goodlatte’s whole premise of fraud among Southern Border asylum applications is highly illogical. Most of the Southern Border asylum claims involve some variant of so-called “particular social groups” or “PSGs,” But, the entire immigration adjudication system at all levels has traditionally been biased against just such claims. and, it is particularly biased against such claims from Central America. PSG claims from Central America receive “strict scrutiny’ at every level of the asylum system! No fraudster in his or her right mind would go to the trouble of “dummying up” a PSG claim which will likely be rejected. No, if you’re going to the trouble of committing fraud, you’d fabricate a “political or religious activist or supporter claim”  of the type that are much more routinely granted across the board.

Don’t let Trump, Miller, Sessions, Goodlatte, and their band of shameless GOP xenophobes get away with destroying our precious asylum system! Resist now! Resist forever! Stand up for Due Process, or eventually YOU won’t any at all! Some Dude once said “as you did it to one of the least of these my brothers, you did it to me.” While arrogant folks like the restrictionists obviously don’t believe that, it’s still good advice.

“Washington (CNN)Even as the Trump administration is asking Congress to approve a tough overhaul of the nation’s immigration laws, the Department of Homeland Security is also quietly exploring ways it could transform the US immigration system on its own.

The department has been examining a range of subtle modifications to immigration policies that could have major consequences, including limiting protections for unaccompanied minors who come to the US illegally, expanding the use of speedy deportation proceedings, and tightening visa programs in ways that could limit legal immigration to the US, according to multiple sources familiar with the plans.
None of the policies being explored are finalized, according to the sources, and are in various stages of development. Any of them could change or fall by the wayside. Some of them are also included at least in part in the wish list of immigration priorities that President Donald Trump sent to Congress this week, and it’s unclear whether the administration will wait to see the results of negotiations over the future of the Deferred Action for Childhood Arrivals (DACA) program that President Donald Trump has chosen to end.

Still, the proposals under consideration illustrate the extent to which the administration could attempt to dramatically change immigration in the US through unilateral executive action.
“Do you think Obama did a lot? That’s my answer,” said one former DHS official when asked how transformative the change could be. “They could do quite a bit.”
DACA itself was an example of how former President Barack Obama, frustrated with congressional inaction, sought to use executive authority to take action on immigration, putting in place the program to protect young undocumented immigrations brought to the US as children from deportation in 2012.
But the administration is now exploring rolling back more Obama-era policies, and changing even older systems.
DHS did not respond to a request for comment about the policies being explored or its process.
Targeting protections for unaccompanied minors
One effort underway is exploring what can be done about unaccompanied children (UACs), a category of undocumented immigrants who are caught illegally crossing the border into the US, are under age 18, and are not accompanied or met by a parent or guardian in the US. Those UACs, by law and legal settlement, are handed over to the Department of Health and Human Services for settling in the US, given protections from expedited removal proceedings and given special opportunities to pursue asylum cases in the US.
DHS and the Department of Justice have been exploring options to tighten the protections for UACs, including no longer considering them UACs if they’re reunited with parents or guardians in the US by HHS or once they turn 18.

In a previously unreported memo, obtained by CNN, the general counsel of the Executive Office of Immigration Review, which manages the nation’s immigration courts, wrote in a legal opinion that the administration would be able to decide a UAC was no longer eligible for protections — a sea change in the way the 2008 law granting those protections has been interpreted.
The Trump administration has portrayed the UAC protections as a loophole in the law that can be exploited by gangs, though experts have testified before Congress that the minors under the program are more likely to be victimized by gangs in the US due to a lack of a support network than to be gang members. The administration also has sought to crack down on parents who pay smugglers to bring their children into the US illegally, even to escape dangerous situations in Central America.
The White House also asked Congress to amend the 2008 law to restrict UAC protections.
In previously unreported comments made last month at a security conference in Washington, acting Immigration and Customs Enforcement Director Tom Homan said that ICE is actively looking at the adults HHS places UACs with, and if they are in the US illegally, they will be processed for deportation — and if a smuggler was paid, they could be prosecuted for human trafficking.

“You cannot hide in the shadows, you can’t be an illegal alien in the United States, have your undocumented child smuggled at the hands of a criminal organization, and stay in the shadows,” Homan said. “We’re going to put the parents in proceedings, immigration proceedings, at a minimum. … Is that cruel? I don’t think so. Because if that child is really escaping fear and persecution, he’s going to stand in front of an immigration judge to plead his case, his parents should be standing shoulder to shoulder with him. I call that parenting.”
DHS is also continuing to weigh its options to expand the use of expedited removal more generally — a speedier process of deportation that bypasses a lengthy court process in particular cases — as authorized by Trump’s January executive order on immigration.
Legal immigration tightening
Other efforts in the works include ways to tighten legal avenues to come to the US.
Two policies being looked at are the subject of litigation in the DC Circuit court — work authorizations for spouses of high-skilled visa holders and an expansion of a program that allows STEM students to stay in the US an extra two years for training.
Both policies were challenged in the courts, and now the administration is considering whether to roll them back.
On the spousal authorizations, DHS told the court as much in a filing last month, asking for extra time for the DHS review to finish.
That filing points to a DHS review of “all” of the agency’s immigration policies, citing the President’s Executive Order to “buy American and hire American.”
“Executive Order 13,788 is an intervening event necessitating careful, considered review of all of DHS’s immigration policies to ensure that the interests of US workers are being protected,” the attorneys wrote, citing the order’s instructions to create new rules, if necessary, “to protect the interests of United States workers in the administration of our immigration system.”

DHS has also moved to tighten asylum claim credibility thresholds, and is exploring asking Congress for more authority to do so. Another target is reportedly cultural exchange visas, which according to The Wall Street Journal are also under scrutiny after the “hire American” order.
Further unilateral moves wouldn’t even require policy changes, immigration attorneys fear. Attorneys who represent immigration clients fear that simply by slowing down the visa process, DHS could substantially decrease the number of immigrants admitted to the United States. US Citizenship and Immigration Services announced this summer it would begin requiring interviews for all green card applicants on employment and refugee grounds, and that it would roll out required interviews for other categories over time, adding a substantial and potentially lengthy hurdle to achieving legal permanent residency.
“If the wait time for naturalizations increases by three months, USCIS can naturalize 25% fewer people per year, which would mean millions of people over a four-year period,” said Leon Fresco, an immigration attorney and former Obama administration DOJ official. “Even without a policy change, the administration (can accomplish) dramatic reductions to legal immigration through increases in processing times and taking a hawkish approach to finding reasons for denials of immigration applications.”
DHS pointed CNN to statistics showing no increase in the rate of denials of immigration applications, though the backlog of pending applications has grown steadily over the past two years.

Sources familiar with the inner workings of DHS describe an environment where political appointees and policy staff with strongly held opinions circulate ideas that sometimes reach the press before front office and secretarial staff are even aware of the discussions.
While political appointees and career officials are not described as butting heads, some of policy ideas do end up moderated by career employees on practical grounds. One source also described some employees of USCIS, which administers DACA, as getting emotional when the plan was made to end the program.
“Once it gets to a senior level, there are pretty robust discussions,” another source familiar said. “And once it gets to that level there are folks with ideas, and then folks who have been around for a while who say, ‘That won’t work.'”
Those competing ideas are then ultimately decided on by the secretary and high-level decision makers, though sources say political appointees are sometimes in a position to have influence over what information flows to the front office and top officials.
“The secretary and the decision makers end up with that (dynamic),” the source said.”

It took three tries to gain asylum, three times paying smugglers to take her on the dangerous journey across the border; finally in August, a judge blocked her deportation under an international treaty typically used to give criminal snitches sanctuary for their cooperation. But even that didn’t end things: The Trump administration made her wait in jail nearly a month before agreeing to not appeal her case.

How does that happen in a civilized society?”

This illustrates the ugly results of immigration policies pushed by Trump, Sessions, Miller, and tone deaf GOP Legislators like Rep. Bob Goodlatte.  They are part of the outrageous Trump Immigration ”Deform” Program drafted by Miller. And this unholy and inhumane group seeks to make things even worse for scared asylum applicants like this. They should be held morally accountable for their behavior, even if they can’t be held legally responsible for the gross abuses of human rights they promote. They seek to turn the U.S. legal system into a major human rights violator. And, it’s not that some of these practices didn’t originate during the Obama Administration. Trump and his White Nationalist cronies have just tripled down on pre-existing abuses.

In fact, many of the women being imprisoned in the American Gulag then turned away are either entitled to asylum or would be if the DOJ-controlled BIA had not intentionally distorted asylum law to deny them protection. In any event, almost all of them should be offered protection under the mandatory Convention Against Torture. TPS or some other form of prosecutorial discretion would also be potential solutions.

But, sending young women back to be tortured and raped, the Trump Administration’s “solution,” is not acceptable.

NYT: DAVID LEONHARDT CALLS OUT “BOBBY THE CORK!” — “Put Up Or Shut Up!” — And, While You’re At It, Bobby, How About Accepting Some Responsibility For The Trump Debacle?

“All talk. A United States senator went on CNBC to explain that while Donald Trump may be an unorthodox politician, “there’s a lot of evolution that is taking place, and I think you’re already seeing that.”
To everyone who argued that Trump was unfit for the presidency, the senator had a ready answer: “My advice would be to chill for a while,” he said. “My sense is that a lot of people who have been resisting will become more comfortable.”
The senator was Bob Corker of Tennessee, and he was speaking on the show “Squawk Box” in May 2016. Today, of course, Corker has become Trump’s newest enemy, saying that the president is “on the path to World War III” and that the White House has become “an adult day care center.”
So what is Senator Corker’s responsibility now, given the crucial role that he and other eminent Republicans played in making Trump seem normal enough to win the presidency? James Fallows answers that question in The Atlantic. “Talk is better than nothing,” Fallows writes, “but action is what counts.”
As chairman of the Senate Foreign Relations Committee, Corker has the ability to hold hearings about the threat Trump poses to the country and the world, Fallows notes. Michelle Goldberg of The Times writes that Congress can also bar “the president from launching a nuclear first strike without a congressional declaration of war.”
I’ll add to that list: Corker and other senators can bring Trump’s legislative agenda to a complete halt until he begins acting more responsibly. No talk of a tax cut until he stops talking of nuclear war. Even the most ardent tax cutter should be willing to make that trade.
The reality that Corker has described — with an out-of-control president — is chilling. Trump, as Fallows puts it, is “irrational, ill-informed, impulsive, unfit for command, and increasingly a danger to the country and the world.”
It’s not enough to merely withhold support from Trump or to criticize him. Members of Congress have an unmatched ability to prevent damage by this president. Those members, like Corker, who ushered Trump into power by describing a man who doesn’t exist, bear a particular burden.”

Neither acting on their criticisms of Trump nor accepting responsibility are in the GOP’s tool box. Nor has the GOP shown the slightest interest or ability to govern in a bipartisan manner for the national interest.

The modern GOP is a toxic and motley collection of rich guys, xenophobes, war-mongers, theologues, racists, White Nationalists, science deniers, anti-intellectuals, and anarchists each apparently vying to be more selfish and irresponsible than the next. Where was “Bobby the Cork” when Trump and the GOP were planning to destroy Americans’ health care and tank insurance markets to reward fat cats with undeserved and unneeded tax breaks? He was right there on the Trump-GOP-Turtle “Destroy America Because We Promised To Do It Bandwagon.” Talk is cheap — responsible action is something else.  I’ll believe it when I see it coming from “Bobby the Cork” and his GOP fellow travelers!

In encourage you to go over to The Hill at the above link and read Nolan’s complete article. As always, whether you agree with Nolan or not, his articles are always thought-provoking and timely. Nolan is definitely a “player” in the immigration dialogue! (And, frankly, by going over to The Hill, Nolan gets a few more “hits” which give him a few more “hard-earned nickels” in his pockets. Gotta help out my fellow retirees!)

I can agree with Nolan’s bottom line:

“It would be better to help undocumented aliens by working on comprehensive immigration reform legislation that meets essential political needs of both parties.”

The challenge will be figuring out what those points might be. So far, the GOP “Wish List” is basically an “incendiary White Nationalist screed” drafted by notorious racist xenophobe Stephen Miller (probably with backing from Sessions and certainly incorporating parts of Steve Bannon’s alt-right White Nationalist world view) that contains virtually nothing that any Democrat, or indeed any decent person, could agree with. Indeed, the very involvement of Miller in the legislative process is a “gut punch” to Democrats and whatever “moderate GOP” legislators remain.

What are some “smart enforcement” moves that Democrats could agree with: more funding for DHS/ICE technology; improvements in hiring and training for DHS enforcement personnel; U.S. Immigration Court reforms;  more attorneys and support (including paralegal support) for the ICE Legal Program; more funding for “Know Your Rights” presentations in Detention Centers.

But more agents for “gonzo enforcement,” more money for immigration prisons (a/k/a the “American Gulag”), and, most disgustingly, picking on and targeting scared, vulnerable kids seeking protection from harm in Central America by stripping them of their already meager due process protections: NO WAY!

Although “The Wall” is a money wasting folly with lots of negative racial and foreign policy implications, it probably comes down to a “victory” that Democrats could give to Trump and the GOP without actually hurting any human beings, violating any overriding principles of human rights law, or diminishing Constitutional Due process. It also inflicts less long-term damage on America than a racially-oriented “point system” or a totally disastrous and wrong-headed decrease in legal immigration when the country needs the total opposite, a significant increase in legal immigration opportunities, including those for so-called “unskilled labor.”

While this GOP Congress will never agree to such an increase — and therefore workable “Immigration Reform” will continue to elude them — the Democrats need to “hold the line” at current levels until such time as Americans can use the ballot box to achieve a Congress more cognizant of the actual long-term needs of the majority of Americans.

“(CNN)In the end, Donald Trump finally pushed Sen. Bob Corker to the point of exasperation, frustration and exhaustion felt by vast numbers of Americans who despair of the President’s behavior. “It’s a shame the White House has become an adult day care center,” tweeted Corker, referring to his fellow Republican as if he needs constant minding. “Someone obviously missed their shift this morning.”

Corker was provoked by early Sunday morning statements from Trump. who said, via Twitter, “Senator Bob Corker ‘begged’ me to endorse him for re-election in Tennessee, I said ‘NO’ and he dropped out (said he could not win without my endorsement).” Trump also said Corker asked to become secretary of state but, “I said ‘NO THANKS.'” He also said Corker “didn’t have the guts” to seek re-election in 2018.
The capital letters suggest the tweets came straight from the President. He loves capital letters. But the timing and content are more important indicators of authenticity. Trump’s social media outbursts are more vivid on weekends, when he’s likely home alone.
And true Trump tweets resonate with a tone — “guts” and “begged me” are classics — that makes it seem like he doesn’t quite understand where he is, or what is required of him. (Never mind that Corker’s chief of staff, Todd Womack, challenged Trump’s account of the facts: “The President called Sen. Corker on Monday afternoon and asked him to reconsider his decision not to seek re-election and reaffirmed that he would have endorsed him, as he has said many times.”)
The fact that Trump could conduct stream-of-consciousness carping from the confines of the same White House that had been occupied by the likes of Lincoln, FDR and Ronald Reagan suggests that he may not be aware of his surroundings. As he tweets about TV shows, we can see that his mind is too often fixed on matters beneath a president. And when he does focus on something important, like national security, he indulges in silliness about the “Rocket Man” (Kim Jong Un) or praises himself: “Wow, Senator Luther Strange picked up a lot of additional support since my endorsement.”
Despite the President’s “Wow,” Alabama’s Sen. Strange wound up losing a GOP primary to Roy Moore.  A religious extremist who was twice forced to step down from the Alabama Supreme Court, Moore had called homosexuality “evil,” insisted Muslim Rep. Keith Ellison should not be permitted to serve in Congress and suggested the attacks of 9/11 could have been God’s punishment for American sinfulness.    
The prospect of serving with Moore may have helped Corker reach his decision to retire as of 2018, but his concern about Trump predates the Alabama primary. In August, Corker was obviously appalled by Trump’s response to a white supremacist march in Charlottesville, when he said among the torch-bearing neo-Nazis there were some “very fine” people.
Corker considered these words and concluded, “The President has not yet been able to demonstrate the stability nor some of the competence that he needs to demonstrate in order to be successful.”
Just days ago, Corker stood up for Secretary of State Rex Tillerson, who had reportedly called Trump a “moron” and was trying to demonstrate his loyalty to the President. “I see what’s happening here,” said Corker.  “I deal with people throughout the administration and (Tillerson), from my perspective, is in an incredibly frustrating place, where, as I watch, OK, and I can watch very closely on many occasions, I mean you know, he ends up being, not being supported in the way I would hope a secretary of state would be supported. That’s just from my vantage point.” He suggested that Tillerson, along with Defense Secretary James Mattis and White House Chief of Staff John Kelly, were keeping the United States from tumbling into “chaos.”
Frustration with Trump can be heard across the nation as leaders who hoped the President would set aside his rage and self-centeredness in the service of the country are met, instead, by the same old Donald Trump. No more thoughtful than he was as a TV game show host and no more reliable than when he was a salesman practicing “truthful hyperbole,” Trump makes much of the world cringe as he fails to achieve his agenda at home and undercuts his own secretary of state abroad.
With Trump in a cycle of saying and doing destructive and disruptive things unbecoming the leader of the free world,  Corker seems to be suffering from the sort of burnout experienced by those who care for senior relatives.

Here his evocation of “adult care” is more meaningful than the senator may even know. Adult day care is as much a service for the friends and family of those with dementia and other disabling conditions as it is for those who attend programs. The respite they receive when experts take over for a few hours makes it possible to continue with the burden of caregiving.
In the case of President Trump, the parallel with adults in care includes, also, the sad reality that someone who is supposed to be strong and capable is, instead, in need of supervision. It’s hard to begrudge Corker his decision to escape dealing with a president in this condition by not running for re-election. But as a member of the Republican Party, he’s one of the few who have the standing to get through to the man, and thus it seems like he’s taking the easy way out while leaving more of the work to the rest of us.  We’re burned out, too.

In re Khan, 26 I&N Dec. 797 (2016), holds that IJs have only such powers as have been delegated and that the power to waive an alien’s inadmissibility during proceedings seeking U visas is not among them. The Third Circuit has agreed with that conclusion. Sunday v. Attorney General, 832 F.3d 211 (3d Cir. 2016). We must decide in this case whether to follow Sunday and Khan.
Delegation from the Attorney General to immigration judges is a matter of regulation, and arguably pertinent reg‐ ulations are scattered through Title 8 of the Code of Federal Regulations. The BIA in Khan observed, correctly, that the panel in LDG had not mentioned 8 C.F.R. §§235.2(d), 1235.2(d), which omit any delegation to IJs of the power to waive an alien’s admissibility. And that’s true, for those regu‐ lations concern the powers of District Directors rather than the powers of IJs. The principal regulation that does cover IJs’ authority is 8 C.F.R. §1003.10, which provides in part:
(a) Appointment. The immigration judges are attorneys whom the Attorney General appoints as administrative judges within the Office of the Chief Immigration Judge to conduct specified classes of proceedings, including hearings under section 240 of the [Immigration and Nationality] Act. Immigration judges shall act as the Attorney General’s delegates in the cases that come be‐ fore them.
(b) Powers and duties. In conducting hearings under section 240 of the Act and such other proceedings the Attorney General may assign to them, immigration judges shall exercise the powers and duties delegated to them by the Act and by the Attorney General through regulation. In deciding the individual cases be‐ fore them, and subject to the applicable governing standards, immigration judges shall exercise their independent judgment and discretion and may take any action consistent with their au‐ thorities under the Act and regulations that is appropriate and necessary for the disposition of such cases. Immigration judges shall administer oaths, receive evidence, and interrogate, exam‐ ine, and cross‐examine aliens and any witnesses. Subject to §§ 1003.35 and 1287.4 of this chapter, they may issue administra‐ tive subpoenas for the attendance of witnesses and the presenta‐ tion of evidence. In all cases, immigration judges shall seek to re‐ solve the questions before them in a timely and impartial man‐ ner consistent with the Act and regulations.

The Attorney General’s brief in this court observes that §1003.10(b) does not delegate to IJs any power to waive an alien’s inadmissibility. Sure enough, it doesn’t. But §1003.10(a) does. It says that “[i]mmigration judges shall act as the Attorney General’s delegates in the cases that come before them.” This sounds like a declaration that IJs may ex‐ ercise all of the Attorney General’s powers “in the cases that come before them”, unless some other regulation limits that general delegation. The BIA in Khan did not identify any provision that subtracts from the delegation in §1003.10(a). Nor did the Third Circuit in Sunday. Indeed, neither the BIA nor the Third Circuit cited §1003.10(a). We therefore adhere to the view of LDG that IJs may exercise the Attorney Gen‐ eral’s powers over immigration.”

In the end, of course, the respondent didn’t win much. The 7th Circuit remanded the case to the BIA to “exercise Chevron authority” on the question of whether the Attorney General himself has been stripped of authority to grant these waivers by the legislation that established the DHS as a separate entity.

But, we already know the answer to that question. The BIA has no desire to exercise jurisdiction over this waiver. Indeed, to do so, could turn out to be “career threatening” if you work for notorious xenophobe Jeff Sessions.

Moreover, even before the advent of Sessions, the BIA abandoned any pretense of  impartiality in exercising Chevron jurisdiction. The BIA usually looks for the interpretation least favorable to the respondent, that of the DHS, and adopts that as it “preferred interpretation.”  To do otherwise could hamper any Administration’s efforts to achieve enforcement objectives, thereby endangering the BIA as an institution. Moreover, agreeing with the private litigant in a published decision could undermine the efforts of the DOJ’s Office of Immigration Litigation to facilitate successful defense of petitions for review removal orders in the Article III Courts.

If this sounds like a strange scenario for a supposedly fair, impartial, and unbiased “court” to adopt, that’s because it is! The BIA is there primarily to slap a “patina of due process” on removal orders without really interfering with the DHS’s “removal railroad.” And that’s useful because of Chevron and the ability of  OIL and the DOJ to disingenuously claim that respondents receive “full due process” from the Immigration Courts and the BIA and that Article III Courts, therefore, ought not to worry themselves about the results. And, in a surprising number of cases, the Article IIIs oblige. They don’t want to be stuck having to redo tens of thousands of mass produced BIA appeals.

So, what’s not to like about this system? The Attorney General gets his wholly owned courts to churn out removal orders that look fair (but really aren’t in many cases). The BIA Appellate Judges get to keep their high paying jobs in the Falls Church Tower without having to personally “face up” to the poor folks they are railroading out of the country to places where their lives and futures are in danger. OIL gets to buttress its narrow readings of immigration statutes against immigrants with so-called “court decisions” from the BIA that really aren’t really decisions by independent decision makers. The DHS gets lots of removal orders to keep the “Enforcer In Chief” happy, plus they gain leverage to use against any U.S. Immigration Judge who keeps ruling in favor of respondents. “We’ll just take you to the BIA and get it reversed.”  The Article IIIs get to largely avoid moral or legal responsibility for this facade of fairness and due process. Out of sight (which folks are when they get removed), out of mind. We’re just “deferring” to the BIA. Don’t blame us! And, don’t forget Congress! They get to pretend like none of this is happening and claim they are “solving” the problem just by throwing a few more positions and a little more money at EOIR. No need for meaningful oversight into the charade of due process in the U.S. Immigration Courts. And, there are a few guys over on the GOP side of the Hill who hate immigrants and despise due process as much as Sessions does. They undoubtedly see this as a model for the entire U.S. justice system, or better yet, have lots of ideas on how to avoid the Immigration Courts entirely and make the “removal railway” run even faster.

The only folks who aren’t served are the poor folks looking to the U.S. Immigration Courts as courts of last resort to save their lives, preserve their futures, or at least listen sympathetically to their case for remaining. Some of these poor fools actually believe all they stuff about Americans being fair and humane. Those guys were really discombobulated when I had to tell them that while I had absolutely no doubt that some very ”bad things” were going to happen to them upon return, that just doesn’t matter to the U.S. legal system. While I sometimes had the unenviable task of “telling it like it is,” the BIA, the DOJ, and the Federal Courts really couldn’t care less if migrants end up getting killed, raped, or maimed upon return or if their families in the U.S. have to go on welfare. There’s just no place for them in our system.

The other folks who might not come out so well are the rest of America — the non-xenophobes. Most Americans aren’t actually xenophobes in the Trump-Sessions-MIller-Bannon-GOP Restrictionist tradition. While those of us who know what’s happening might be powerless to stop it, we can document it for future generations. We’re making a record.

In the age of information, none of this is going away or going to be swept under an “eternal carpet.” Someday there will be a “day or recokening” for our descendants, just like the one for those of us whose current privilege was built on enslaved African American labor and its many benefits as well as by a century of “Jim Crow” laws which siphoned off African American Citizens’ Constitutional rights and human dignity and conferred them instead on undeserving white folks in both the South and the North.

We have certainly demonstrated that we can be “tone deaf” to both the motivations and the actual effects of our current broken immigration policies. Indeed, there can be no better evidence of that than the election of Trump and empowerment of his xenophobe racist cronies like Sessions and Miller.

But, in the end, we won’t escape the judgement of history, nor will they. The ugliness of our current immigration policies and practices, and the “false debate” about them (there, in fact is no legitimate case for the “restrictionist agenda” — just a racial and cultural one), might be buried in a barrage of alt-right media and “Sessions bogus law and fact free pronouncements.” But, someday, those are going to look just as “legit’ as Conferederate broadsides or the racially hateful rhetoric of Jefferson Davis do today outside the membership of various hate groups and the alt-right.

In selling President Trump’s tax plan, his aides have resorted to making strikingly misleading statements to defend it.

At the moment, there are few details about the tax plan, only broad strokes. That makes it easier for the administration to make big claims as analysts scramble to try to make sense of the plan’s possible impact. That will be much harder once an actual tax bill is written and the details can be analyzed in depth.

In the meantime, we have a pair of Four-Pinocchio claims that are worth highlighting.

 

‘The wealthy are not getting a tax cut under our plan’

The Trump tax plan drops the top bracket from 39.6 to 35 percent, and allows for the possibility of a 25 percent top rate through a pass-through entity. It presumably would also eliminate a 3.8 percent Obamacare tax on investment income that hits only upper-income taxpayers.

So, on its face, this is a ridiculous statement to make for any plan that includes reductions in tax rates. That’s because federal income taxes are paid mostly by the wealthy. So when you cut income tax rates, it results in lots of dollars for the wealthiest taxpayers.

According to Treasury Department data, the top 10 percent of income earners in 2016 paid 80 percent of individual income taxes. The top 20 percent paid 94.8 percent. The top 0.1 percent paid an astonishing 24.5 percent of taxes.

In 2014, the latest year Internal Revenue Service data is available, just the top 400 taxpayers — with $127 billion of income — paid $29.4 billion in income taxes, or more than 2 percent of all income taxes. That’s more than the bottom 70 percent of taxpayers combined.

 

In other words, the vast majority of American taxpayers pay little or nothing in income taxes; they instead mostly pay payroll taxes such as Social Security and Medicare. So it really strains credulity for administration officials such as Cohn to say the wealthy will not get a tax cut.

The wealthy pay most of the taxes, so unless the tax plan specifically leaves them untouched — which Trump’s plan does not — they will get big tax cuts. This is why distributional tables often look so lopsided when tax rates are reduced. The administration has suggested that another, higher rate level might be added, presumably so the distributional tables won’t look so ugly, but right now the plan calls for a significant reduction in the top rate.

Besides a reduction in the top tax rate, the tax plan would eliminate the alternative minimum tax (AMT). That in theory should be a boon for the wealthy as well, although it increasingly has snared families in the upper middle class, especially if they live in high-tax states or have many children.

 

The administration has called for eliminating the itemized deduction for state and local taxes, as well as the personal/dependent exemptions, which are key add-ons when calculating the AMT. (If those items were eliminated from the AMT, the number of tax filers facing the AMT would drop by 95 percent, according to the Joint Committee of Taxation.)

So it’s possible that for many people it would be a wash, or even a net loser, depending on whether a tax filer lives in a state with high taxes. According to JCT, the AMT is paid by 36 percent of returns with income of between $200,000 and $500,000, nearly 55 percent between $500,000 and $1 million, and nearly 18 percent above $1 million.

Still, in 2014, the top 400 taxpayers paid nearly $700 million because of the alternative minimum tax, nearly 2.5 percent of the total. The one recent tax return of President Trump that has leaked — for 2005 — shows his tax bill increased $31 million because of the AMT.

Finally, the tax plan calls for eliminating the estate tax, although it is unclear on whether any tax would be required when someone dies. Currently, the estate tax is estimated to affect only about 5,500 estates out of nearly 3 million estates because as much as $11 million can be shielded from taxation.

 

In theory, assets would be subject to capital gains tax instead, which could actually affect more people, but that has not been specified in the administration’s tax outline. If the administration also eliminates the gift tax and does not tax capital gains at death, some income earned by the wealthy may never be taxed.

“We strongly believe the final tax bill will not cut taxes for the wealthy as a class — but there is no way to solve for every single individual in the country,” a White House official said.

‘We think this tax plan will cut down the deficits by a trillion dollars’

Mnuchin made this statement in response to an observation that the nonpartisan Committee for a Responsible Federal Budget has estimated the tax plan would reduce revenue by $2.2 trillion over 10 years. (Including additional interest on the debt, CRFB estimated the deficit would increase by $2.7 trillion.) He argued that instead there would be an additional $2 trillion in revenue from economic growth, resulting in a $1 trillion reduction in the deficit.

Cohn, briefing reporters at the White House a few hours later, offered a different estimate: “We know that 1 percent change in GDP will add $3 trillion back. So if they’re right, we’re only going to pay down $800 billion of the deficit. I’ll live with a $800 billion paydown.”

It’s a little odd that Mnuchin is anticipating $2 trillion in revenue and Cohn is anticipating $3 trillion in revenue. But these are both very rosy estimates of the impact of a tax cut in economic growth. No serious economist believes that a tax cut boosts economic growth so much that the tax cut pays for itself.

The Congressional Budget Office, under Douglas Holtz-Eakin, a Republican, in 2005 estimated that a 10 percent reduction in federal income tax rates would have macroeconomic feedbacks of between 15 and 30 percent. In other words, a $1 trillion tax cut might yield $150 billion to $300 billion in additional revenue. That still means a reduction in revenue of as much as $700 billion.

“The big problem is that there is no fully specified plan,” Holtz-Eakin said. “Without one, you can’t gauge the growth or know the budget cost. I’m broadly sympathetic to the framework, but it is a start, not the finish.”

As Holtz-Eakin put it earlier this year in an opinion column for The Washington Post: “Proposing trillions of dollars in tax cuts and then casually asserting that such a plan would ‘pay for itself with growth’ … is detached from empirical reality.”

Indeed, contrary to popular perception, even Ronald Reagan predicted revenue would fall as a result of his big 1981 tax cut that reduced tax rates. That is shown in Reagan administration and Congressional Budget Office scores of the Reagan tax plan reproduced in a 2011 article for Tax Notes by Bruce Bartlett, who helped craft the 1981 tax cut as a congressional aide at the time. The estimates turned out to be wrong because the 1981-1982 recession was deeper than expected and inflation fell more rapidly than expected, so Reagan boosted taxes just one year after his tax cut.

William A. Niskanen, chairman of Reagan’s Council of Economic Advisors, co-wrote a paper in 1996 that defended Reagan’s economic record but also said it was “an enduring myth” that Reagan officials believed tax cuts would pay for themselves. “This was nonsense from day one, because the credible evidence overwhelmingly indicates that revenue feedbacks from tax cuts is 35 cents per dollar, at most,” Niskanen wrote, noting that “the Reagan administration never assumed that the tax cuts would pay for themselves.”

A Treasury Department study on the impact of tax bills since 1940, first released in 2006 and later updated, found that the 1981 tax cut reduced revenue by $208 billion in its first four years. George W. Bush’s 2001 tax cut — also a rate cut — led to a revenue loss of $91 billion, over four years, the Treasury paper calculated. (The figures are rendered in constant 2012 dollars.)

Both the Reagan and Bush tax cuts came during periods of economic stress, which is certainly not the case now. So there is less room now for a big swing upward in the economy, especially with the country’s aging workforce.

The Treasury Department did not respond to a query for an explanation of Mnuchin’s math. But frankly it is irresponsible for a treasury secretary to claim a certain amount of growth or revenue without even producing the details of a plan, as the details determine the impact on the economy.

The Pinocchio Test

Though the details of the tax plan are sparse, both Cohn and Mnuchin made statements that are simply false. Of course the wealthy will do well under the tax cut, even if certain deductions are eliminated, and it’s silly to pretend otherwise. And it’s a fantasy to claim that the tax cut will pay for itself — and even reduce the deficit — especially in an economy that already has low unemployment and a booming stock market.

Four Pinocchios is getting into “Jeff Sessions’s territory!”

But, I can see that they were richly deserved. I watched Steve “Munchkin” Mnuchkin on “Meet the Press” with Churck Todd this AM.  It was appalling!

Munchkin lied about Puerto Rico, lied about the tax plan, and then lied and tried to cover up his own responsibility for trying to get a “freebie” at taxpayer expense for his honeymoon. The idea that there was any “national security” reason for the Munchkin keeping in touch with the White House is preposterous.

Indeed the very idea that Munchkin would have any role in national security other than making sure the checks don’t bounce is prima facie ridiculous. And, if he did, that’s what secure facilities in the CIA part of the nearest U.S. Embassy are for. Or for that matter, that’s what subordinates in the Trasure Department are for. Gotta believe that every once and awhile spooks have to make secure communications with Washington.

“Immigration reform has been a hot-button issue long before President Trump pledged to build a wall along our border. And while there’s certainly an argument to be made that we need to do a better job of controlling illegal immigration, there’s also a strong case to be made that immigrants are a big driving force behind America’s growth — past, present, and future.

Warren Buffett has been very outspoken in recent years about America and its amazing economic story. Not only does Buffett feel that immigrants have led us to where we are today, but he also thinks that immigrants are an essential component of our country’s future success.

Here’s what Warren Buffett thinks of immigrants
In a nutshell, Buffett feels that immigrants (including undocumented ones) have been and continue to be a key part of our prosperity — not a part of the problem. “This country has been blessed by immigrants,” Buffett said in February at Columbia University. “You can take them from any country you want, and they’ve come here and they found something that unleashed the potential that the place that they left did not, and we’re the product of it.”

Referring to Albert Einstein and Leo Szilard, both of whom were immigrants themselves, Buffett said, “If it hadn’t been for those two immigrants, who knows whether we’d be sitting in this room.”

In his most recent letter to Berkshire Hathaway’s (NYSE:BRK-A) (NYSE:BRK-B) shareholders, Buffett specifically mentioned immigrants as one of the major components of America’s success story. “From a standing start 240 years ago — a span of time less than triple my days on earth — Americans have combined human ingenuity, a market system, a tide of talented and ambitious immigrants, and the rule of law to deliver abundance beyond any dreams of our forefathers.”

On a pathway to citizenship
Buffett is an outspoken Democrat who actively campaigned for Hillary Clinton during the 2016 presidential race. So it shouldn’t come as too much of a surprise that Buffett doesn’t want to deport millions of illegal immigrants who are currently in the United States.

In a 2015 interview with Fox Business, Buffett said

People should be able to earn citizenship who are here. You know, I do not think we should deport millions of people. So, I think we should have a real path to citizenship.

Buffett was then asked specifically about the DREAM Act and its 800,000 minors who are in the country illegally and now face an uncertain future after the end of DACA, from the perspective of a successful American businessman. Buffett replied:

It is a question of being a human being not really a businessman. Immigrants came, our forefathers came as immigrants, they got here anyway they could. And who knows what I would have done if I were in some terrible situation in a country and wanted to come here…a great percentage of them are good citizens. I would have a path to citizenship for them, I would not send them back.

 

On immigration policy and reform
As we all know, the immigration debate has been going on for a long time. And Buffett’s stance hasn’t changed much over the past several years. In a 2013 interview with ABC’s This Week, Buffett said:

I think we should have a more logical immigration policy. It would mean we would attract a lot of people, but we would attract the people we want to attract in particular — in terms of education, tens or hundreds of thousands of people. We enhance their talents and have them stick around here.

Buffett went on to say that any reform package should “certainly offer [undocumented immigrants] the chance to become citizens,” and one main reason for doing so would be to deepen the talent pool of the labor force.

Buffett’s stance on immigration in a nutshell
Warren Buffett believes that allowing immigrants who are already in the country to stay and pursue citizenship is not only the right thing to do, but is essential to America’s continued economic prosperity. Buffett certainly sees the need for immigration reform, as most Americans of all political affiliations do, but wants to encourage and simplify the legal pathways to immigration.”

Buffet speaks simple truth: Immigrants, both documented and undocumented are not threats, but rather are a necessary ingredient for America’s greatness. We need to bring law-abiding undocumented individuals into our society in some type of legal, work authorized status. We also need substantial across the board increases in legal immigration, so that in the future the immigrants we need can come through the legal system (or wait in a realistic line) rather than coming through an underground system and working and living in the shadows.

The lies, misrepresentations, and false narratives being peddled by Trump, Sessions, Bannon, Miller, Kobach, Cotton, Perdue, King, Goodlatte, Labrador, the so called “Freedom” Caucus, and the rest of their White Nationalist restrictionist cronies are a path to national disaster. Removing existing non-criminal migrants who happen to be working here in undocumented status is a colossal waste of limited Government resources that actually hurts our country in numerous ways.

Time to stand up against the restrictionist, White Nationalist, xenophobic, anti-American blather. Demand that your Congressional representatives back sane, humane immigration reform that takes care of those already here and recognizes their great contributions while appropriately and significantly expanding future legal immigration opportunities so that we don’t keep repreating our mistakes over and over.

Let’s be honest about it. If the time, money, and resources that the U.S. Government is currently spending on the counterproductive aspects of immigration enforcement and inhumane immigration detention were shifted into constructive areas, there would be no “disaster relief crisis” in Puerto Rico and the Virgin Islands right now, and we’d have more money to spend on heath care, job training and retraining, infrastructure, addressing the opioid crisis, and many more legitimate national priorities!

INSIDE THE AMERICAN GULAG: New Suit Alleges Abuse Of Pregnant Detainees BY DHS!

“When Jennye Pagoada Lopez arrived at the U.S. border post of San Ysidro in July seeking political asylum, she showed agents ultrasound images of her pregnancy and told them she was bleeding and needed immediate medical attention.

But instead of taking her to the hospital, they detained her for more than a day before transferring her to the Otay Mesa Detention Center in San Diego.

It took two days to get a medical exam. Four days after that, she was informed that she had a miscarriage.

That was the account she gave in a sworn declaration to her lawyers.

 

“I was neglected, subjected to abusive conditions and denied medical treatment when requested,” she testified.

Pagoada is among ten women whose testimony was included in a complaint filed this week against the U.S. Department of Homeland Security by seven rights groups accusing immigration officials of improperly detaining pregnant women and failing to provide them with adequate medical care.

The complaint — made to the department’s inspector general and civil rights officer — alleges that the women suffered physical and psychological harm and asks the department to investigate the cases and report on what steps immigration authorities will take to enforce its policies on the detention and treatment of pregnant women.

“We are gravely concerned with the agency’s failure to abide by its own policy against detaining pregnant women, the detention conditions that have been reported by pregnant women in various detention facilities across the country, and the lack of quality medical care provided to women who are pregnant or have suffered miscarriages while in custody,” the complaint said.”

“Americans Back DACA by a Huge Margin. A vast 86 percent of Americans support a right to residency for undocumented immigrants who arrived in the United States as children, with support crossing the political spectrum. Two-thirds back a deal to enact such legislation in tandem with higher funding for border control. Possibly in light of Donald Trump’s decision to phase out the Deferred Action for Childhood Arrivals program, disapproval of his handling of immigration overall reaches 62 percent in this ABC News/Washington Post poll. Just 35 percent approve. Additional hurdles for Trump are his demand for a wall on the U.S. border with Mexico – again 62 percent oppose it – and substantial concerns about his immigration enforcement policies. While all polls, particularly those on immigration, must be looked at with some circumspection, these are great numbers to keep in mind when faced with the constant bogus claims from Trump Administration and GOP Congressional restrictionists that they are somehow representing the “national will” or “the people’s voice” with their out of touch policies and proposals.

Interestingly, one enforcement initiative that got widespread support was enforcing existing employer sanctions laws, something that neither GOP nor Democratic Administrations has been willing to do over the past three decades since they were in acted in 1986.

Nor does their Trump Administration appear to be putting any emphasis on this program. And, it’s easy to see why. Employer sanctions would involve going after U.S. businesses, some of the same folks who helped put Trump and the GOP in power. Some of them like the current system, which keeps many needed workers marginalized and dependent, so they can be exploited.

Perhaps more important, going after U.S.employers doesn’t do anything for the Trump/GOP racist base. Much better to sack up some decent productive Hispanic workers and count it as “law enforcement.” That’s what the racist xenophobes like to see.

“Detention as a tool of immigration enforcement has increased dramatically following immigration reforms enacted in 1996. Two Supreme Court cases at the dawn of the new millennium offered contrasting approaches to the review of decisions of the U.S. government to detain immigrants. In 2001, in Zadvydas v. Davis, the Supreme Court interpreted an immigration statute to require judicial review of a detention decision because “to permit[] indefinite detention of an alien would cause a serious constitutional problem.” Just two years later, the court in Demore v. Kim invoked the “plenary power” doctrine – something exceptional to immigration law and inconsistent with modern constitutional law – to immunize from review a provision of the immigration statute requiring detention of immigrants awaiting removal based on a crime.

How the Supreme Court reconciles these dueling decisions will no doubt determine the outcome in Jennings v. Rodriguez. This case involves the question whether immigrants, like virtually any U.S. citizen placed in criminal or civil detention, must be guaranteed a bond hearing and possible release from custody. Relying on Zadvydas v. Davis, the U.S. Court of Appeals for the 9th Circuit affirmed a district court injunction that avoided “a serious constitutional problem” by requiring bond hearings every six months for immigrant detainees. The court of appeals further mandated that, in order to continue to detain an immigrant, the government must prove that the noncitizen poses a flight risk or a danger to public safety.”

This is huge in human rights. A “W” for the Administration, which many observers view as likely with the advent of Justice Gorsuch, will essentially “Green Light” the Trump-Sessions-Miller plan to construct the “New American Gulag.” The Gulag’s “prisoners” will be noncriminal migrants (many of them women fleeing violence in the Northern Triangle) whose only “crime” is to assert their rights for due process and justice under our laws.

The concept that migrants have rights is something that sticks in the craws of the White Nationalists. So, punishing them for asserting their rights (with an objective of coercing them into giving up their rights and leaving “voluntarily”) is the next best thing to denying them entirely (which the Administration routinely does whenever it thinks it can get away with it — and the Article IIIs have largely, but not entirely, been asleep at the switch here).

And, make no mistake about it, as study after study has shown, the “conditions of civil detention” in the Gulag are substandard. So much so that in the last Administration DHS’s own study committee actually recommended an end to private immigration detention contracts and a phasing out of so-called “family detention.” The response of the Trump White Nationalists: ignore the facts and double down on the inhumanity.

Based on recent news reports, DHS immigration detainees die at a rate of approximately one per month.  And many more suffer life changing and life threatening medical and psychiatric conditions while in detention. Just “collateral damage” in “Gonzo speak.”

Immigration detainees are often held without bond or with bonds that are so unrealistically high that they effectively amount to no bond. And, in many cases (like the one here) they are denied even minimal access to a U.S. Immigration Judge to have the reasons for detention reviewed.

Plus, as I reported recently, across the nation DHS is refusing to negotiate bonds for those eligible. They are also appealing Immigration Judge decisions to release migrants on bond pending hearings, apparently without any regard to the merits of the IJ’s decision. In other words, DHS is abusing the immigration appeals system for the purpose of harassing migrants who won’t agree to waive their rights to a due process hearing and depart!

Also, as I pointed out, in the “no real due process” world of  the U.S. Immigration Courts, the DHS prosecutors can unilaterally block release of a migrant on bond pending appeal. In most cases this means that the individual remains in detention until the Immigration Judge completes the “merits hearing.” At that point the BIA determines that the DHS bond appeal is “moot” and dismisses it without ever reaching the merits. Just another bogus “production” statistic generated by EOIR!

Oh, and by the way, contrary to “Gonzo” Session’s false and misleading rhetoric on so-called “Sanctuary Cities,” one of the things jurisdictions that rationally choose to limit cooperation with DHS enforcement to those with significant criminal records are doing is protecting their law-abiding, productive migrant residents and migrant communities from the patent abuses of  the “American Gulag.” “Gonzo policies” predictably drive reasonable people to take protective actions.

But, some day, the bureaucrats, complicit judges (particularly life-tenured Article III Judges, like the Supremes), reactionary legislators who turn their backs on human suffering, and misguided voters who have allowed this human rights travesty to be perpetrated on American soil will be held accountable, by the forces of history if nothing else.
