“(CNN)House Speaker Paul Ryan on Friday gave a major boost to legislative efforts to preserve protections for young undocumented immigrants — and urged President Donald Trump to not tear up the program.

Trump told reporters Friday he was still mulling the decision.
Responding to a question about Deferred Action for Childhood Arrivals, or DACA, on his hometown radio station WCLO in Janesville, Wisconsin, Ryan said Congress was working on a legislative fix to preserve the program.
“I actually don’t think he should do that,” Ryan said of Trump’s consideration of terminating the program. “I believe that this is something that Congress has to fix.”

Ryan’s statement offers the most public support by anyone in the Republican congressional leadership for some sort of legislation to protect the “Dreamers” under DACA.
The popular Obama administration program — which gives protections from deportation to undocumented immigrants that were brought to the US as children to work or study — has long been targeted by Republicans as an overreach of executive authority.
Nevertheless, a number of moderate Republicans alongside Democrats support the program and have offered legislation that would make the protections permanent.

Ryan, who worked on comprehensive immigration reform before he became part of House leadership, endorsed that approach in the interview.
“President (Barack) Obama does not have the authority to do what he did … we’ve made that very clear,” Ryan said in the radio interview. “Having said all of that, there are people who are in limbo. These are kids who know no other country, who were brought here by their parents and don’t know another home. And so I really do believe there that there needs to be a legislative solution.”
Trump’s decision
Asked whether he’s made a decision on DACA, Trump said: “Sometime today, maybe over the weekend.”
“We love the Dreamers,” he said.
The Trump administration has been discussing for weeks what to do about DACA, responding to the deadline on an ultimatum issued by 10 state attorneys general, led by Texas. The threat: Sunset DACA by September 5 or the states will try to end it in court.
Discussions have heated up this week as officials have met to chart a path forward. While a decision had been possible Friday, and one source familiar had believed a decision was pending Friday morning, by midday, sources familiar with the deliberations did not expect a decision before the weekend.
Parts of the Department of Homeland Security, which administers DACA, have been told to prepare for a decision but have not been given any potential details of what a decision may be.

Sources inside and outside the administration said the White House continues to explore buying itself time and is also considering allowing the attorneys general to proceed with their threat.
That course of action could potentially remove pressure from the White House, where the President has promised to act with “heart” on the matter and give Congress time to pass a legislative fix, and one source said it was under consideration.
Any action by the President to sunset DACA would put immediate pressure on Congress to act, something the White House and a senior congressional source recognize would be a challenge with many other pressing priorities at the moment, from Harvey relief to the debt ceiling to government spending. A go-slow approach on DACA is preferred, the congressional source added.
Big congressional boost
Ryan has long been sympathetic to the plight of Dreamers. At a CNN town hall at the beginning of the year, Ryan was asked by a young woman protected under DACA whether he wanted her deported. He said he was working with the Trump administration and seeking a “humane solution.”
“What we have to do is find a way to ensure that you can get right with the law,” the speaker told the young woman.
But until now, leadership has not helped the push by moderate Republicans to advance legislation to do so. Four different options have been introduced in Congress, including two bipartisan solutions led by Sens. Lindsey Graham, a South Carolina Republican, and Dick Durbin, an Illinois Democrat. Another proposal from Florida Republican Rep. Carlos Curbelo has entirely Republican support and is expected to be introduced in a similar form in the Senate by North Carolina Republican Thom Tillis.
In addition to Ryan’s endorsement, another conservative boost on Friday came from Utah Sen. Orrin Hatch, a staunch conservative who has in the past supported immigration reform.
“I’ve urged the President not to rescind DACA, an action that would further complicate a system in serious need of a permanent, legislative solution,” Hatch said in a statement. “Like the President, I’ve long advocated for tougher enforcement of our existing immigration laws. But we also need a workable, permanent solution for individuals who entered our country unlawfully as children through no fault of their own and who have built their lives here. And that solution must come from Congress.”
Colorado Rep. Mike Coffman, a moderate Republican, announced on Thursday he would try to force a vote on one of the bipartisan bills when Congress returns next week through what’s known as a discharge petition, which would require a majority of House members to sign on to work. The speaker’s office had no comment on that effort.”

“The leaders of Amazon, Microsoft and Starbucks joined other corporate executives in asking President Donald Trump to keep in place a program that shields from deportation young people who came to the U.S. illegally as children.

The Deferred Action for Childhood Arrivals (DACA) program, which protects about 800,000 “Dreamers,” is said to be a target for repeal as Republican attorneys general threaten to sue to push the Trump administration to carry out the president’s hard-line pledges on immigration.

 

Supporters of the program, including Washington Gov. Jay Inslee, came to its defense this week, urging the White House to keep DACA intact. Those ranks swelled with hundreds of corporate executives, lawyers and other organizations who made largely economic arguments in a separate open letter.

“Dreamers are vital to the future of our companies and our economy,” the letter said. Signatories include Amazon.com chief executive Jeff Bezos, Microsoft CEO Satya Nadella, and Starbucks boss Kevin Johnson.”

“The backlog of cases in US immigration courts has continued to worsen amid the Trump administration’s border crackdown, new statistics show.

As of the end of July, there were 617,527 cases pending in immigration courts. It’s the first time this number has crossed the 600,000 mark, according to information released on Thursday by the Transactional Records Action Clearinghouse, or TRAC, a research center at Syracuse University that tracks US government data.

The immigration court system, which is an arm of the US Department of Justice, has been grappling with growing caseloads for years. Immigration judges and lawyers have reported case delays stretching years out. But the latest numbers show a large jump in 2017. When Trump took office in January, there were approximately 540,000 pending cases.

“It is still overwhelming to the immigration judges,” said Judge Dana Leigh Marks, an immigration judge in San Francisco and president of the National Association of Immigration Judges. “The levels of caseload are higher than we’ve ever seen before.”

As of Aug. 14, there were 334 immigration judges nationwide — 54 have been hired since Trump took office. The office is authorized by Congress to have 384 judges. Marks said that a large number of judges are eligible to retire, which could cut into any progress that DOJ makes in hiring new judges. New judges also don’t move as quickly as experienced ones, she said.

Under a Jan. 25 executive order on immigration enforcement, the Justice Department said in August that it had mobilized more than 100 immigration judges to hear cases at Department of Homeland Security detention facilities, either in-person or by video teleconferencing. Between Feb. 1 and July 31, immigration judges had issued nearly 28 percent more deportation orders as compared to the same time period last year, DOJ said.

Marks said that immigration judges had been warning officials about the backlog for years, and would continue to do so.

“The canaries in the coal mine are still gasping for air,” she said.”

The DOJ is: clueless. planless, incompetent, and totally unqualified to manage a system of the size and importance of the current US Immigration Court consistently with due process. Systemically, knowingly running a system that engages in Aimless Docket Reshuffling (“ADR”), puts long pending cases that can be tried at the end of the line (many years out), while engaging in unnecessary detention and hustling more recent arrivals through without a reasonable chance to obtain representation or present their claims for relief, indeed sometimes without any hearings at all, is already a “default” on due process. Greater reliance on already outdated and overwhelmed “televideo court equipment” will further compromise due process. Even now, as most Immigration Judges and attorneys who have to use EOIR Televideo courts will tell you, the system is NQRFPT (“Not Quite Ready For Prime Time”).  Jamming more cases into it is asking for a complete breakdown.

I’m actually somewhat surprised that no group has found a way to bring a class action seeking to shut down the entire Immigration Court System and the DHS Administrative Removal System until improvements are made so that they comply with due process.  Sort of like the litigation that eventually required some prison systems to come into compliance with constitutional norms. In some cases, this is even worse than prisons, since many individuals in immigration detention haven’t been convicted of any crimes; they are just asserting their statutory and constitutional rights to have a fair adjudication of their ability to remain in the US.

Also, how is a system that treats its own judges as “canaries gasping for breath in the coal mine” going to deliver on due process for those individuals expecting it from those same judges? It isn’t.

And Congress should not get off the hook either. This problem has been growing very publicly for years over several Administrations while Congress has failed to deliver on proposals for an independent US Immigration Court that have been kicking around for more than a decade!

None of the DOJ’s statements deal with the real solution here: use of prosecutorial discretion “PD” on a widespread basis to resolve most of these cases and take them off the Immigration Courts’ docket. That needs to be followed by serious negotiations with Congress for: 1) a realistic legalization program, 2) an increase in legal immigration to put our immigration laws more in line with the actual market conditions that are bringing, and will continue to bring, more immigrant workers to the US, and an independent Immigration Court where the capacity to adjudicate cases consistently with due process is a primary consideration in both DHS’s deciding how many cases to place on the docket and how individual judges manage their individual dockets. That’s simply making changes to bring the Immigration Court system and the immigration laws into line with the rest of the U.S. legal system and our overall needs to maintain and administer a much more robust and inclusive legal immigration system that wouldn’t waste money on impractical walls and on “gonzo” immigration enforcement ands unnecessary detention.

I love Jeffrey’s clear, concise, practical analysis of complex issues!

The Patel case raises a recurring issue: How can a supposedly “expert” tribunal obviously hurrying to produce final orders of removal for the Administration’s deportation machine (thereby, probably not coincidentally, insuring their own job security) keep ignoring clear statutory and constitutional rights of individuals as well as their own precedents and those of Courts of Appeals? Unfortunately, the situation is likely to get worse before it gets better.

The Administration has announced that it’s looking for ways to deal with the backlog not by any rational means, but by ramming still more cases through the already overloaded system. Although the DOJ mouths “due process” that’s not true. As long as we have “gonzo enforcement” with hundreds of thousands of cases on the Immigration Courts’ dockets that should be settled out of court through grants of relief or prosecutorial discretion, there will continue to be insurmountable backlogs. And, as long as the Immigration Courts are part of the Executive Branch, lacking true judicial independence to put a stop to some of the more outrageous ICE and DOJ policies and practices, the problem will not be solved. Due process can’t be put on an assembly line. The only questions are if and when the Article III Courts will put a stop to the due process travesty in the Immigration Courts.  Or will they adopt the EOIR approach and “go along to get along.” Clearly, the Administration is banking on the latter.

I also note that the 8th Circuit is “hardly the 9th Circuit or even the 7th or 2d Circuits.”  Indeed, the 8th routinely defers to the BIA. Many critics say that the 8th gives the BIA far too much deference. So, when the 8th Circuit starts finding gaping holes in the BIA’s approach to due process in Immigration Court, we know that “we’ve got trouble, right here in River City.”

“AUSTIN, Texas ― A federal judge on Wednesday blocked most of a state immigration crackdown two days before it was set to go into effect on Sept. 1, offering a major victory for opponents as a tropical storm ravages the state and local officials struggle to assure immigrants it’s safe to seek help.
U.S. District Judge Orlando Garcia issued an injunction that prevents Texas Senate Bill 4 from being implemented while a lawsuit challenging the law winds its way through the federal courts. The ruling marks a victory for immigrant rights groups and several local governments ― including those of Austin, Houston, San Antonio and El Cenizo ― that argued the law unconstitutionally requires police to do the work of federal authorities and would lead to racial profiling.
“There is overwhelming evidence by local officials, including local law enforcement, that SB 4 will erode public trust and make many communities and neighborhoods less safe,” Garcia wrote in his order. “There is also ample evidence that localities will suffer adverse economic consequences which, in turn, harm the State of Texas.”
The judge added that the legislature “is free to ignore the pleas of city and county officials, along with local police departments, who are in the trenches and neighborhoods enforcing the law on a daily and continuing basis” and can disregard their “reservoir of knowledge and experience.”
“The Court cannot and does not second guess the Legislature,” Garcia wrote. “However, the State may not exercise its authority in a manner that violates the United States Constitution.”
The injunction isn’t a total victory for SB 4 opponents. The ruling allows a provision of the law to take effect authorizing police to ask about the immigration status of those they stop, which Garcia said could in theory be applied in a way that does not violate the Constitution.
Texas Attorney General Ken Paxton, a Republican, said in a statement he was confident federal courts will ultimately find the law constitutional and allow the state to implement it in full, despite the injunction.
“Senate Bill 4 was passed by the Texas Legislature to set a statewide policy of cooperation with federal immigration authorities enforcing our nation’s immigration laws,” Paxton said. “Texas has the sovereign authority and responsibility to protect the safety and welfare of its citizens.”

(31 Aug 2017) The latest available case-by-case court records show that as of the end of July 2017, the Immigration Court’s backlog continued to rise , reaching an all-time high of 617,527. For the first time, individuals with pending cases from El Salvador surpassed the numbers from Mexico in the court’s pending workload. There were a total of 134,645 pending cases involving citizens of El Salvador, edging past the 134,467 cases involving individuals from Mexico. In third place, with 102,532 pending cases were citizens from Guatemala.California continued to have the largest backlog with 115,991 cases pending at its court locations. Texas was second with 99,749 pending cases, followed by New York with 84,429. Both California and New York are continuing to see rising court backlogs. In contrast, court locations in Texas saw a small decline in July.

JEFFREY SACHS ON CNN: GOVERNMENT BY “ABBOTT & COSTELLO” — In Texas, It’s All Bigger, Including The Jerks!

“(CNN)It’s important to politicize Hurricane Harvey. Not politics in the sense of political parties, or politics to win elections. Politics to protect America.

The priority in the next hours and days is to save lives and reduce suffering, without hesitation and without question of costs or politics. But then must come the reckoning.

Once the immediate crisis ends, the governor of Texas, Greg Abbott, should resign with an apology to his state and his country. Then the Texas delegation in Congress should make a public confession. They have lied to their constituents for too long, expecting the rest of America to keep bailing them out.
The reason is this. Texas politics aims to bring profits to the oil and gas industry, but it does this at high cost and dire threat to Texas residents and the American people.
Hurricane Harvey was a foreseeable disaster. Indeed, a massive hurricane strike on Houston, followed by massive flooding, was widely anticipated.
But Houston is an oil town, and the American oil industry has been enemy No. 1 of climate truth and climate preparedness. Most oil companies and Texas politicians see nothing, say nothing, do nothing. Even worse, they hide the truth, and then beg for help as needed. Gov. Abbott has played this game one disaster too many.

Abbott, for example, was the governor to sign a new law in 2015 that prevents cities and municipalities in Texas from setting their own regulations that might rein in oil and gas drilling activities. On his watch, Texas supported withdrawal from the Paris Climate Agreement.
Over many years, he has raked in millions in campaign contributions from the oil industry, including in his former role as Texas attorney general, where he sued the Environmental Protection Agency repeatedly over rules designed to curb carbon emissions.
And the state, under Abbott’s direction, has taken no significant steps toward flood protection, despite the recognized risks of a mega-hurricane and flood.
The problem is not about his crisis management this week. I can’t judge that. It’s about his long-standing relentless opposition to environmental protection, including his blind eye to global warming and the grave dangers it poses.
The Texas Tribune and ProPublica published a 2016 award-winning report on “Hell or High Water,” explaining why Houston is a “sitting duck for the next big hurricane.” In 2015, Inside Climate News wrote that “as weather extremes like flooding batter Texas, its refusal to prepare for an even more volatile climate leaves residents at risk, experts say.”
On June 16 of this year, citing the city’s widening concrete sprawl and deaths from flooding in recent years, the UK Guardian wrote that “Houston fears climate change will cause catastrophic flooding: It’s not if, it’s when.”

So, what has been the policy response in Houston and Texas more generally in terms of prevention, resilience, and preparedness? Almost nothing until disaster hits. Then the response is to ask for federal bailouts.
In other words, Texas is the moral hazard state.
Here is what has not happened: There has been little or no effort at zoning protection to keep development clear of floodplains; little or no offshore and onshore infrastructure for flood protection; no discernible heed paid to the scientific evidence and indeed the growing practical experience of catastrophic flood risks; and of course, relentless, pervasive climate change denial, the mother’s milk of Texas politics.
So, here’s the deal. Those of us elsewhere in the US also suffering from flooding and other disasters from warming temperatures, rising sea levels, and more intense storms (such as New Yorkers who are still rebuilding from 2012 Hurricane Sandy) want truth from Texas politicians and the oil industry.
We are bearing the costs of your lies. We are tired of it. More importantly, we are in pain and solidarity with the good people of Houston who are losing lives, homes, and livelihoods because of your lies.

Gov. Abbott, we would like to bid you a political adieu. Perhaps you can devote your time to rebuilding Houston and taking night classes in climate science. Senators Ted Cruz and John Cornyn, you will soon be asking us for money to help Texas.
My answer will be yes, if you stop spewing lies about climate dangers, agree to put US and Texas policy under the guidance of climate science, back measures to lower carbon emissions and stay in the Paris Climate Agreement. Then, of course, let’s help your constituents to rebuild.
And to ExxonMobil, Chevron, Koch Industries, ConocoPhillips, Halliburton, and other oil giants doing your business in Texas: You put up the first $25 billion in Houston disaster relief. Call it compensation for your emissions. Tell the truth about growing climate threats. Then, as citizens seeking the common good, we will match your stake.”

The “common good” is something that never crosses the collective so-called “minds” of Texas’s corrupt GOP pols. They are all bought and paid for by “Big Oil” and other fat cats. And, they are busy picking on Blacks, Hispanics, refugees, migrants, children, the poor, gays, Muslims, Dreamers, etc.

So, not for the first time, it’s for the rest of us taxpayers to bail out Texas. (But, don’t think that will earn the support of hypocrites like Cruz & Co. the next time we might be in need — they are cruel, ignorant, and selfish because — well, because they can be and get away with it). THE HILL: NOLAN’S PROPOSAL FOR AVOIDING A SHUTDOWN, SAVING DREAMERS, & GIVING TRUMP SOME WALL!

“Despite the difficulty of the task, give Trump a chance to show what he can do. This can be done by properly funding the existing border security legislation.

Provide Trump with the funding needed to finish the southwest border fencing project mandated by the bipartisan Secure Fence Act of 2006.

The Secure Fence Act was passed in the Senate 80 to 19. The yeas included current Senate party leaders Mitch McConnell (R-Ky.) and Charles Schumer (D-N.Y.) and former Senators Barack Obama (D-Ill.) and Hillary Clinton (D-N.Y.).

It mandated 850 miles of fencing along the southwest border, but as amended by section 564 of the Consolidated Appropriations Act, 2008, it just requires DHS to “construct reinforced fencing along not less than 700 miles of the southwest border where fencing would be most practical and effective.”

DHS has constructed just 653 miles of fencing.

When Trump has completed the last 47 miles of this project, he will be able to show Congress the kind of wall he wants for the rest of the border and provide a reliable estimate of what it would cost.

To incentivize Trump to accept this alternative, Congress should assist him with his border security efforts by weakening the “job magnet,” the fact that undocumented aliens generally come here to find employment.

Congress tried to eliminate this magnet with an employer sanctions program in the Immigration Reform and Control Act of 1986 (IRCA), but it has been more than 30 years since the program was established and it still has not been fully implemented.

According to a report by Georgetown’s Institute for the Study of International Migration, unscrupulous employers “knowingly hire unauthorized workers to exploit their labor.” For instance, they “pay salaries in cash, failing to pay their share of social security taxes.”

The Department of Labor (DOL) enforces labor laws that curb such abuses without regard to employee immigration status, e.g., the Fair Labor Standards Act, which mandates minimum wages, overtime pay, youth employment, and other standards for all employees.

Congress can provide Trump with the funding DOL needs for a nationwide campaign to stop the exploitation of employees in industries known to hire undocumented aliens. This would weaken the job magnet and reduce the number of illegal border crossings.

But the president isn’t the only player congressional Republicans need to persuade to accept a compromise. To prevent a government shutdown (and fund Trump’s border wall), they will also need Democrats. What may be enough to persuade them is protecting an Obama-era immigration program.

On June 15, 2012, President Barack Obama established a program to offer temporary lawful status to undocumented aliens who were brought here as children, the Deferred Action for Childhood Arrivals (DACA) program.

The application process required them to admit alienage and concede unlawful presence, and to provide their addresses, which makes it easy for them to be arrested and deported.

In a June 2017 letter, state attorney generals asked U.S. Attorney General Jeff Sessions to terminate DACA. If he does not do it, they will amend a pending lawsuit in a Federal District Court to include a challenge to DACA.

The administration apparently does not intend to defend DACA in court if it is included in the lawsuit. Moreover, recent media reports indicate that Trump is likely to rescind the program.

The Democrats might be more receptive to the measures I have proposed if they are offered a separate bill that would protect DACA participants from deportation if the program is terminated.

Nothing good will come from a showdown between Trump and the Senate over funding his wall. They need to prevent that from happening.”

Nolan writes in his latest article:

“The Immigration Reform and Control Act of 1986 established a legalization program for undocumented aliens already in the United States and created employer sanctions to discourage employers from hiring undocumented aliens in the future.

That was 30 years ago, and the program still has not been fully implemented. It might be better to let the Department of Labor (DOL) deal with the job magnet.

Many American employers hire undocumented foreign workers because it is easy to exploit them. DOL enforces federal labor laws that were enacted to curb such abuses, such as the Fair Labor Standards Act which established a minimum wage, overtime pay, and other employment standards.

With additional funding, DOL could mount a large-scale, nationwide campaign to stop the exploitation of employees in industries known to hire large numbers of undocumented aliens, without basing the fines on the immigration status of the employees.

In contrast with Trump, President Obama focused his immigration enforcement program on aliens who had been convicted of serious crimes, had been caught near the border after an illegal entry, or had returned unlawfully after being deported.

Once an undocumented alien had succeeded in reaching the interior of the country, he was “home free.” It was extremely unlikely that he would be deported unless he was convicted of a serious crime. This was a powerful incentive to find a way to get past security measures on the border.

No deportable alien is safe from deportation under Trump’s enforcement policies.

This produced results very quickly. In April 2017, CBP reported a sharp decline in the number of aliens apprehended while making illegal crossings.

But Trump has to implement his enforcement policies to keep the magnet from coming back and he could benefit from implementing expedited removal proceedings.

As of the June 2017, the immigrant court’s backlog was 610,524 cases. This severely limited efforts to remove deportable aliens.

President Trump finessed his way around this problem by expanding the use of expedited removal proceedings in his Executive Order, Border Security and Immigration Enforcement Improvements.

In expedited removal proceedings, which are conducted by immigration officers, an alien who lacks proper documentation or has committed fraud or a willful misrepresentation to enter the country, and has not been physically present for two years, can be deported without a hearing before an immigration judge, unless he establishes a credible fear of persecution.

Trump needs funding to be able to carry out a large-scale, nationwide program of expedited removal proceedings.

These measures would reduce the number of people trying to make illegal crossings, making border security much easier to achieve, even without his promised wall.”

I agree with Nolan and many in Congress that the border wall will be an ineffective waste of money. And, in the liteny of Trump lies, it has become clear that “Mexico will pay” is just another whopper.

I also agree with Nolan that more funding for Fair Labor Standards Act enforcement is a good idea. However, the Trump Administration is moving the other way on all regulatory enforcement except immigration.

I would oppose funding for expedited removal. I believe it is a clear denial of due process, particularly as carried out by this Administration. I recognize that to date most Federal Courts have taken a “head in the sand” approach to the serious constitutional issues raised by expedited removal.  But, I think that as Trump pushes the envelope the courts will eventually have to face up to the total lack of due process and safeguards in the current system.

In any event, whether expedited removal is unconstitutional or not, it’s bad policy. It should be rescinded, not expanded.

Lizandro Claros Saravia was supposed to be at college in North Carolina by now. At soccer practice. At the library.

Instead, the 19-year-old soccer star from Germantown, Md., is hundreds of miles away, in a sweltering Central American nation he barely recognizes and sometimes fears.

U.S. immigration officials swiftly deported him and his older brother, Diego, on Aug. 2, days after Lizandro told them during a routine check-in that he had a scholarship to attend Louisburg College.

“I don’t know what we’re going to do,” Lizandro, his gaze flat, said in an interview here last week as he and his brother waited to pick up their 83-year-old grandfather — who had been visiting the United States on a visa when his grandsons were deported — from the airport. “I feel like in this country, I don’t have a future.”

The expulsion of the brothers, both of whom graduated from Quince Orchard High School in Gaithersburg and neither of whom had been accused of any wrongdoing once in the United States, outraged Democratic lawmakers and advocates for immigrants, as well as their teachers, friends and teammates.

Lizandro and Diego, now 22, used fraudulent visas and passports to come to the United States in 2009 and reunite with their family; some of whom were also here illegally. Lizandro was 10, according to Immigration and Customs Enforcement; his brother was 14.

They were ordered deported in 2012 and granted a stay in 2013. Two subsequent requests for stays were denied. But with their clean records and high school diplomas, the brothers were not a priority for deportation under the Obama administration.

Under President Trump, however, the “handcuffs” are off, in the words of ICE Acting Director Thomas Homan. Anyone in violation of immigration law can be targeted for deportation. Officials say that they want to reduce the United States’s population of undocumented immigrants, currently about 11 million, and dissuade would-be migrants from making the illegal, and sometimes deadly, journey north.

Critics say that the Trump administration’s approach is robbing the United States of talented and dedicated immigrants, and endangering Americanized young people by sending them to their now-unfamiliar homelands without their families.

Rep. John Delaney (D-Md.) blasted ICE for deporting the brothers to El Salvador, which he called one of the “most violent countries in the world.” Montgomery County Executive Isiah Leggett (D) said “ICE should be ashamed of itself.”

Lizandro’s teammates at the Bethesda Soccer Club — he calls them his “brothers” — have taken up a collection in hopes of helping him someday realize his dream to become the first in his family to earn a college degree.

The brothers say they miss everyone from their lives in Maryland, especially their parents and two siblings, friends and the staff at the Guapo’s — a restaurant where they had family dinners — just off I-270 in Gaithersburg. They don’t go out much now because they don’t think it is safe.

Instead, they stay in their new home, a pair of neighboring dwellings that Lizandro and Diego share with their aunts and uncle in a village of roughly 1,000 people outside of Jucuapa. Last year, Reuters cited that city as a place where the coffin-making business has taken off, partly fueled by the high homicide rates.

The rules are that Lizandro and his brother stay in constant touch with their aunts and uncle, unless they all travel somewhere together. At night, they sleep in one of their aunt’s houses, with bars on the windows and guard dogs at the door.

The brothers say they are trying to blend into their new country, but they clearly stand out. At the airport this week, they towered over the crowd, dressed as if they’d been plucked from an American shopping mall.

Diego wore a T-shirt emblazoned with the initials “USA.” Lizandro wore Top-Siders, shorts and a shirt decorated with tiny sunglasses. He speaks English better than Spanish. He wouldn’t recognize the president of El Salvador if he saw him on the street.

“To be honest, I don’t feel good being here,” he said. “People are looking at me different. . . . All my friends from when I was young, they barely know me now.”

Asked about the possibility of going to college in El Salvador, Lizandro said, “I don’t know if I can do that here. It’s hard to go from the bottom all the way to the top again.”

If there is any good news here, it’s that “ordinary folks” in American communities are being exposed to and personally affected by the wastefulness and mindless cruelty of the current U.S. immigration laws. Hopefully, at some point in the future, this will result in the individuals who advocate, perpetuate, and maintain this system (in some cases actually trying to make it even worse) being tossed from office and replaced with more rational legislators and executives who have both human decency and America’s long term best interests in mind. Perhaps not likely in my lifetime. But, eventually, if the U.S. is to survive, it must happen.

“MIAMI — In the seven months since Thomas Homan was appointed to carry out President Trump’s promises to crack down on undocumented immigrants living in the U.S., he has been accused of abusing that power by targeting undocumented immigrants without criminal records.

So far, the data seems to back up those accusations, with the percentage of undocumented immigrants without a criminal record arrested by Immigration and Customs Enforcement (ICE) agents increasing each month, from 18% in January to 30% in June.

But Homan, a 33-year law enforcement veteran who has worked along the southern border and is now the acting director of ICE, doesn’t shy away from those numbers. In fact, he said they’re only the start.

“You’re going to continue to see an increase in that,” Homan told USA TODAY during a visit to Miami on Wednesday.

Homan has become the public face of Trump’s efforts to crack down on illegal immigration, a central theme of his presidential campaign and one of the few areas where he’s been able to make wholesale changes without any help from Congress.

Under President Obama, ICE agents were directed to focus their arrests on undocumented immigrants who had been convicted of serious crimes, were members of gangs or posed a national security threat.

Trump and his Department of Homeland Security have vastly expanded that pool, ordering agents to focus on undocumented immigrants who have only been charged with crimes and allowing them to arrest any undocumented immigrant they happen to encounter.

ICE agents are also targeting undocumented immigrants who have been ordered removed from the country by a federal judge — a group that the Obama administration largely left alone. And they’re targeting people who have illegally entered the country more than once, which raises their actions to a felony.”

Using that new metric, Homan said 95% of the 80,000 undocumented immigrants they’ve arrested so far fall under their newly-defined “priority” categories.

“That’s pretty close to perfect execution of the policies,” Homan said. “The numbers speak for themselves.”

As noted in both the USA Today article and Sacchetti’s article, criminal deportations are actually down under the Trump/Homan regime. Overall removals are also down, The difference has been made up by deporting non-criminals. Most of these are good folks, contributing to America, many with jobs providing services we need, and with U.S. families who depend on them. They are being sent to some of the most dangerous countries in the world.

Picking up many of them up took no particular skill or effort; they voluntarily showed up for periodic check-ins with DHS, were taken into custody, and removed with no rationale, other than “because we can.” For others, “due process” consisted of “final orders” issued “in absentia,” perhaps with no notice or other legal defects.

And, the only reason Homan and his minions have been able to achieve 95% of the goals, was by a mindless redefining of the “priorities” to include virtually anyone. That’s a rather lame definition of “success,” even by DHS terms.

Sure, the real problem here is Congress and the failure to enact reasonable immigration reform combined with the voters who put Trump’s xenophobic regime in power. But, that doesn’t necessarily give a “free pass” to guys like Homan who have the knowledge and experience, but fail to use it to stand up for human decency and the best interests of our country.

“Yet even if all 1,500 Confederate symbols across the country were removed overnight by some sudden supernatural force, the pernicious crusade to roll back voting rights would continue apace, with voters of color suffering its effects disproportionately. Pushing back hard against those who would purge voter rolls, demand forms of voter ID that many Americans don’t possess, and limit times and venues for voting — this should be a paramount cause for the Trump era.

In statehouse after statehouse where Republicans hold majorities, the playbook is well established, and the tactics are becoming increasingly aggressive.

Mr. Trump’s voter fraud commission is at the vanguard of this crusade, and the fix is in. Its vice chairman, Kris Kobach, is the nation’s most determined, litigious and resourceful champion of voter suppression. Under his tutelage, the commission is likely to recommend measures whose effect will be that new obstacles to voting would be taken up in state legislatures. Millions of voters are at risk of disenfranchisement from this effort, and the knock-on effects of such a mass act of disempowerment are dizzying.

 

The events in Charlottesville and the president’s apologia for the right-wing extremists there should mobilize anyone passionate about civil rights. There would be no better target for their energies than the clear and present danger to the most fundamental right in any democracy: the vote.”

“It takes approximately 30 seconds to send a tweet. A half hour to draft and release a statement. And the shelf life of both is only marginally longer. We should not commend Republican party elected officials who claim outrage on social media at Trump’s remarks, often without daring to mention his name. The phony claimed outrage becomes dangerous if it convinces anyone that there is a distinction between Trump’s abhorrent comments and the Republican Party agenda.

The lesson from Charlottesville is not how dangerous the neo-Nazis are. It is the unmasking of the Republican party leadership. In the wake of last weekend’s horror and tragedy, let us finally, finally rip off the veneer that Trump’s affinity for white supremacy is distinct from the Republican agenda of voter suppression, renewed mass incarceration and the expulsion of immigrants.

There is a direct link between Trump’s comments this week and those policies, so where is the outrage about the latter? Where are the Republican leaders denouncing voter suppression as racist, un-American and dangerous? Where are the Republican leaders who are willing to call out the wink (and the direct endorsement) from President Trump to the white supremacists and acknowledge their own party’s record and stance on issues important to people of color as the real problem for our country?

Words mean nothing if the Republican agenda doesn’t change. Governors and state legislatures were so quick to embrace people of color in order to avoid the impression, they too share Trump’s supreme affinity for the white race. But if they don’t stand up for them they are not indirectly, but directly enabling the agenda of those same racists that Republican members were so quick to condemn via Twitter.

Gerrymandering, strict voter ID laws, felon disenfranchisement are all aimed at one outcome: a voting class that is predominantly white, and in turn majority Republican.

 

The white supremacist chant of, “you will not replace us,” could easily and accurately be the slogan for these Republican politicians. Their policies will achieve the same racial outcome as Jim Crow – the disenfranchisement and marginalization of people of color.

It is a sad day when more CEOs take action by leaving and shutting down Trump’s Strategy and Policy Forum, and Manufacturing Council, than elected officials take action leaving Trump’s “election integrity” commission.

Businessman are acting more responsive to their customers than politicians are to their voters. At the end of the day, which presidential council is more dangerous? Which most embodies the exact ideology that Trump spewed on Monday? A group of businessmen coming together to talk jobs or a group of elected officials coming together to disenfranchise voters of color?

Anyone still sitting on the voter suppression commission is enabling Trump’s agenda and that of the white Nazi militia that stormed Charlottesville to celebrate a time when the law enforced white supremacy.

If Republican lawmakers want to distinguish themselves from Trump’s comments, they need to do more than type out 144 characters on their phone. They need to take a hard look at their party’s agenda.”

I’ve noticed the clear pattern going back to the beginning of the campaign: Trump says or does something totally outrageous; GOP leaders disassociate themselves and claim it doesn’t represent the “real” GOP (whatever that might be); shortly thereafter the same folks go back to supporting Trump and the GOP agenda directed at insuring White control. Nobody switches party, resigns in protest, or tells voters how incompetent and dangerous Trump is. Indeed, these guys are scared silly that they will actually turn off Trump’s White Nationalist base that insures them power even though it’s been many years since they racked up a majority of the popular vote in a national election. Trump then goes on to the next outrage, and the process repeats itself.

Someday, the majority of American voters might actually get a Government that represents their interests rather than those of a White Nationalist minority. But, not any time soon if the GOP can prevent it. So far, they are doing a bang up job of it.

“The president and attorney general have vowed to crack down on illegal immigration, and the new directive could help move cases through the system at a faster clip. Most immigration lawyers agree that the overloaded courts are a major issue. But they fear the end result will be more deportations as judges use the wide discretion afforded to them to curtail continuances. The Immigration and Nationality Act doesn’t establish a right to a continuance in immigration proceedings, Keller’s letter notes. They’re largely governed by a federal regulation which says that an “immigration judge may grant a motion for continuance for good cause shown.”

Immigration lawyers often rely heavily on continuances for their prep work because immigration law grants limited formal discovery rights. Unlike in criminal cases, in which the prosecution is generally required to turn over evidence to the defense, immigration lawyers often have to file a Freedom of Information Act request to find out what the government has on their client. These can take months to process.

“If their priority is speed, we all know that sounds really good, to be more efficient, but usually due process takes a hit when your focus is efficiency,” says Andrew Nietor, an immigration attorney based in San Diego. “By the time we are able to connect with our clients, that first court appearance might be the day after we meet somebody, so we haven’t had the opportunity to do the investigation and do the research. And up until several months ago, it was standard to give immigration attorneys at least one continuance for what they call attorney preparation. Now it’s not standard anymore.”

The Justice Department’s guidance says that “the appropriate use of continuances serves to protect due process, which Immigration Judges must safeguard above all,” and notes that “it remains general policy that at least one continuance should be granted” for immigrants to obtain legal counsel.

But the memo is more skeptical about continuances for attorney preparation. “Although continuances to allow recently retained counsel to become familiar with a case prior to the scheduling of an individual merits hearing are common,” it says, “subsequent requests for preparation time should be reviewed carefully.”

It remains to be seen if this careful review will streamline the ponderous system or add another difficulty for the harried lawyers and hundreds of thousands of immigrants trying to work their way through it. For Jeronimo, it may have been decisive. In mid-August, the judge found that the defense didn’t adequately prove Jeronimo’s deportation would harm his young daughter and gave him 45 days to voluntarily leave the United States. Now Jeronimo must decide whether to appeal his case. But he’s been held in a detention center in Georgia since March, and his lawyers worry that he has lost hope. He may soon be headed back to Mexico, five months after he was picked up at a traffic stop in North Carolina.”

OK, let’s have a reality check here. The tremendous backlog is NOT caused by giving respondents time to find an attorney in an already overwhelmed system or by giving those overworked and under-compensated private attorneys time to adequately prepare their clients’ cases.

No, it’s caused by two things both within the control of the Government. The first is the abuse of the system, actively encouraged by this Administration, for cases of individuals who are law abiding members of the U.S. community, helping our nation prosper, who either should be granted relief outside the Immigrant Court process, or whose cases should be taken off the docket by the reasonable use of prosecutorial discretion (something that the Trump Administration eliminated while outrageously calling it a “return to the rule of law” — nothing of the sort — it’s a return to docket insanity enhanced by intentional cruelty).

Your tax dollars actually pay for the wasteful and counterproductive abuses being encouraged by the Trump Administration! Eventually, Congress will have to find a solution that allows all or most of these folks to stay. But, mindlessly shoving them onto already overwhelmed Immigration Court dockets is not that solution.

The second major cause is even more invidious: Aimless Docket Reshuffling (“ADR”) by the Government! The problematic continuances being given in this system — those of many months, or even many years — are forced upon Immigration Judges by EOIR and the DOJ, usually without any meaningful input from either the sitting Immigration Judges or the affected public. Immigration Judges are required to accommodate politically-motivated “changes in priorities” and wasteful transfer of Immigration Judges wth full dockets (which then must be reset, usually to the end of the docket, sometimes to another Immigration Judge) to other locations, often in detention centers, to support enforcement goals without any concern whatsoever for due process for the individuals before the court or the proper administration of justice within the U.S. Immigration Court system.

There is only one real cure for this problem: removal of the U.S. Immigration Courts from the highly politicized U.S. Department of Justice to an independent Article I Court structure that will focus  on due process foremost, and efficient, but fair, court administration. But, until then, it’s up to the press to expose what’s really happening here and to the Article III Courts to call a halt to this travesty.

The “heroes” of the U.S. Immigration Court system, dedicated NGOs and attorneys, many of them acting without compensation or with minimal compensation, are under attack by this Administration and the DOJ. Their imaginary transgression is to insist on a fair day in court for individuals trying to assert their constitutional right to a fair hearing. They are being scapegoated for problems that the U.S. Government has caused, aggravated, and failed to fix, over several Administrations.

The DOJ is creating a knowingly false narrative to cover up their failure to deliver due process in the U.S. Immigration Courts and to shift the blame to the victims and their representatives. A simple term for that is “fraud.”

If we allow this to happen, everyone will be complicit in an assault not only on American values but also on the U.S. Constitution itself, and the due process it is supposed to guarantee for all. If it disappears for the most vulnerable in our society, don’t expect it to be there in the future when you or those around you might need due process of law. And, when you don’t get due process, you should also expect the Government to blame you for their failure.

President Trump’s recent call for overhauling the legal immigration system suffers from serious racial implications and violations of basic family values. Earlier this month he endorsed the Reforming American Immigration for a Strong Economy (RAISE) Act, which would eliminate all family reunification categories beyond spouses and minor children of U.S. citizens and lawful permanent residents (reducing the age limit for minor children from 21 to 18), and would lower capped family categories from 226,000 green cards presently to 88,000. The prime relatives targeted for elimination are siblings of U.S. citizens and adult children of citizens and lawful residents. The diversity immigration lottery program, which grants 50,000 green cards to immigrants from low-admission countries, also would be terminated. The RAISE Act is essentially the Asian, Latino, and African Exclusion Act of 2017. Why? Because the biggest users of family immigration categories are Asians and Latinos, and the biggest beneficiaries of the diversity lottery are Africans.

The RAISE Act is an elitist point system that favors those with post-secondary STEM degrees (science, technology, engineering, or mathematics), extraordinary achievement (Nobel laureates and Olympic medalists), $1.35 to $1.8 million to invest, and high English proficiency. However, it fails to connect prospective immigrants with job openings and makes incorrect assumptions about family immigrants.

Promoting family reunification has been a major feature of immigration policy for decades. Prior to 1965, permitting spouses of U.S. citizens, relatives of lawful permanent residents, and even siblings of U.S. citizens to immigrate were important aspects of the immigration selection system. Since the 1965 reforms, family reunification has been the major cornerstone of the immigration admission system. Those reforms, extended in 1976, allowed twenty thousand immigrant visas for every country. Of the worldwide numerical limits, about 80 percent were specified for “preference” relatives of citizens and lawful permanent residents, and an unlimited number was available to immediate relatives of U.S. citizens. The unlimited immediate relative category included spouses, parents of adult citizens, and minor, unmarried children of citizens. The family preference categories were established for adult, unmarried sons and daughters of citizens, spouses and unmarried children of lawful permanent resident aliens, married children of citizens, and siblings of citizens. Two other preferences (expanded in 1990) were established for employment-based immigration.

Asian and Latino immigration came to dominate these immigration categories. The nations with large numbers of descendants in the United States in 1965, i.e., western Europe, were expected to benefit the most from a kinship-based system. But gradually, by using the family categories and the labor employment route, Asians built a family base from which to use the kinship categories more and more. By the late 1980s, virtually 90 percent of all immigration to the United States – including Asian immigration – was through the kinship categories. And by the 1990s, the vast majority of these immigrants were from Asia and Latin America. The top countries of origin of authorized immigrants to the United States today include Mexico, China, India, the Philippines, the Dominican Republic, Vietnam, and El Salvador.

As Asian and Latin immigrants began to dominate the family-based immigration system in the 1970s and 1980s, somehow the preference for family reunification made less sense to some policymakers. Since the early 1980s, attacking kinship categories – especially the sibling category – has become a political sport played every few years. Often the complaint is based on arguments such as we should be bringing in skilled immigrants, a point system would be better, and in the case of the sibling category, brothers and sisters are not part of the “nuclear” family. Proposals to eliminate or reduce family immigration were led by Senator Alan Simpson throughout the 1980s, Congressman Bruce Morrison in 1990, and Senator Simpson and Congressman Lamar Smith in 1996. As prelude to the RAISE Act, the Senate actually passed S.744 in 2013 that would have eliminated family categories and installed a point system in exchange for a legalization program for undocumented immigrants.

Pitting so-called “merit-based” visas in opposition to family visas implies that family immigration represents the soft side of immigration while point-based immigration is more about being tough and strategic. The wrongheadedness of that suggestion is that family immigration has served our country well even from a purely economic perspective. The country needs workers with all levels of skill, and family immigration provides many of the needed workers.

A concern that the current system raises for some policymakers is based on their belief that the vast majority of immigrants who enter in kinship categories are working class or low-skilled. They wonder whether this is good for the country. Interestingly enough, many immigrants who enter in the sibling category actually are highly skilled. The vast majority of family immigrants are working age, who arrive anxious to work and ready to put their time and sweat into the job. But beyond that oversight by the complainants, what we know about the country and its general need for workers in the short and long terms is instructive.

The Wharton School of Business projects that the RAISE Act would actually lead to less economic growth and fewer jobs. Job losses would emerge because domestic workers will not fill all the jobs that current types of immigrant workers would have filled. In the long run, per capita GDP would dip. Furthermore, in the Bureau of Labor Statistics’s forecast of large-growth occupations, most jobs require only short- or moderate-term on-the-job training, suggesting lower skilled immigrants could contribute to meeting the demand for these types of jobs.

The economic data on today’s kinship immigrants are favorable for the country. The entry of low-skilled as well as high-skilled immigrants leads to faster economic growth by increasing the size of the market, thereby boosting productivity, investment, and technological practice. Technological advances are made by many immigrants who are neither well-educated nor well-paid. Moreover, many kinship-based immigrants open new businesses that employ natives as well as other immigrants; this is important because small businesses are now the most important source of new jobs in the United States. The current family-centered system results in designers, business leaders, investors, and Silicon Valley–type engineers. And much of the flexibility available to American entrepreneurs in experimenting with risky labor-intensive business ventures is afforded by the presence of low-wage immigrant workers. In short, kinship immigrants contribute greatly to this country’s vitality and growth, beyond the psychological benefits to family members who are able to reunite.

The preamble to the Universal Declaration of Human Rights highlights the unity of the family as the “foundation of freedom, justice and peace in the world” for good reason. Our families make us whole. Our families define us as human beings. Our families are at the center of our most treasured values. Our families make the nation strong.

Unhappily, America has a sad history of using bogus arguments about the economy and protecting American labor to justify racist immigration acts.  Among other things, the Chinese Exclusion Act was supposed to protect the U.S. against the adverse effects of “coolie labor.”

I find it remarkable that those pushing the RASE Act are so ready to damage American families, the fabric of our society, and our economy in a futile attempt to achieve their White Nationalist vision.
