“Trump administration officials announced this past week that the government would terminate provisional residency permits for about 200,000 Salvadorans next year. The decision is part of President Trump’s “America first” agenda, restricting the rights of immigrants in order to protect U.S. workers. But, as previous immigration experiments demonstrate, the policy will not aid American workers. And it certainly won’t make Salvadorans pack their bags. Trump’s order is likely to have the opposite effects.

President George W. Bush granted Salvadorans temporary protected status (TPS) after devastating earthquakes hit El Salvador in 2001. He and President Barack Obama repeatedly extended the status. Beyond its humanitarian impact, TPS provides significant economic benefits. It doesn’t give applicants access to any federal welfare — so there are few costs — but it does grant the legal right to work. And Salvadorans with TPS work at very high rates: Eighty-eight percent participate in the labor force, compared with 63 percent of all Americans.

Legal employment has helped Salvadorans achieve a relatively high standard of living. The median household income for Salvadorans with TPS is $50,000, higher than the roughly $36,000 for unauthorized immigrants. Their higher wages, combined with the lack of public benefits, has been a big win for U.S. taxpayers.

Canceling TPS will make it illegal for these Salvadorans to work, but it’s unlikely to force them home. In 1990, President George H.W. Bush granted TPS to some 185,000 Salvadorans during the country’s civil war, and when President Bill Clinton canceled their status in 1996, few returned. Deportations rose only slightly, and many Salvadorans just worked illegally until 2001.

At this point, 28 years since the original TPS designation and 17 years since the subsequent one, the incentives to stay will be too large for any mass migration back to El Salvador. Trump can try to drive them out with immigration raids and increased deportations, as other presidents have tried, but the highest percentage of unauthorized immigrants deported in a given year is 2.1 percent — three times the amount this administration deported in 2017.

Losing the legal right to work doesn’t prevent immigrants from finding jobs. They can use fake or borrowed documents from U.S. citizen family members, or employers can pay them off the books. Illegal employment, however, pays less than legal employment — employers compensate for taking the risk of hiring someone who may be here illegally.”

I can make a strong argument that Salvadoran, Haitian, and Honduran TPS are some of the most successful and humane Immigration programs in US history. In contrast to asylum adjudication, TPS adjudications cost the Government peanuts. And, the processing fees for periodic renewals of work authorization actually make money for the Government.

TPSers are overwhelmingly law-abiding, industrious, and because of their legal work authorization they pay taxes. Many TPSers work in essential industries like construction where there are not equally qualified “native born American workers” readily available to replace them. Many have US Citizen children and they have integrated into their communities. In my experience, while the majority would like to have a “path to citizenship” they aren’t aggressively agitating for one. Almost all are grateful just for the chance TPS gives them to remain with their families in the communities they call home and to work legally to support their families.

Thus, TPSers contribute much to the US and ask little in return. Their continuing presence here is in no way a “problem.”

In a rational political climate, extending TPS while offering some type of permanent status to TPSers through legislation would be a “no brainer.”  Indeed, a generation or so ago, US enacted a great program called NACARA, which offered Nicaraguans, Salvadorans, and Guatemalan a way of staying permanently and eventually becoming citizens. The program was immensely successful at a minimal administrative cost to the Government.

But, today we have a White Nationalist Administration and an increasingly White Nationalist restrictionist GOP interested more in dumping on Hispanics and Blacks through a bogus “merit based” immigration agenda than they are in doing what’s best for America.

Bier’s right. the Salvadorans aren’t going anywhere. But the Administration and the GOP restrictionists appears fixed on driving them “underground” at great cost to the TPSers and to America. They are likely to remain underground until we have “regime change” and saner heads eventually prevail.

THE HILL: NOLAN SAYS THAT ANY DREAMER LEGISLATION MUST BE “FULLY VETTED!”

It seems somewhat hypocritical for Schumer and Pelosi to be urging the passage of a DREAM Act without going through the regular order: They have expressed outrage in the past when the Republicans have resorted to such tactics.

For instance, when Republicans tried to rush the Graham-Cassidy healthcare bill through the Senate to repeal the Affordable Care Actwithout going through the regular order, Schumer made the following statement on the floor of the Senate:

There is no regular order here. There are no bipartisan, public hearings on the Graham-Cassidy bill. … [I]t’s the same backroom, one-party sham of a legislative process that ultimately brought the other bill down. A contrived, 11th hour hearing on block grants in the Homeland Security Committee — a committee with such limited jurisdiction over healthcare matters — does not even come close to suggesting regular order.

And when House Speaker Paul Ryan (R-Wis.) abandoned the pledge he had made to return to regular order, Pelosi responded with an angry press statement claiming that, “It has long been clear that regular order is not as important to republicans as protecting their special interest agenda.”

The nonpartisan Congressional Budget Officeestimates the DREAM Act would make legal status available to 3.4 million undocumented aliens and would increase national budget deficits by $25.9 billion over the 2018-2027 period.

The Immigration Reform and Control Act of 1986 established the largest legalization program we have ever had, and it only legalized 2.7 million aliens.

The extreme generosity of the DREAM Act of 2017 is unfair to the American citizens and Lawful Permanent Residents who have unconscionably long waits to be reunited with alien family members. As of November 2017, there were 4 million aliens with approved family-based visa petitions on the visa waiting list.

Congress needs to pass a bill to help alien children who were brought here illegally by their parents, but it should be a bill that has gone through the checks and balances of the legislative process.”

The parallel between “Graham-Cassidy,” which was in fact a GOP backroom effort that totally excluded Dems from the process, and the Dream Act appears strained. Nonpartisan Dream Act negotiations are currently going on and have been for some time. Indeed, since the Dems are in the minority in both Houses, they will need some bipartisan GOP support to pass Dreamer relief. Moreover, unlike Graham-Cassidy, various versions of the Dream Act have been around and debated for years. Indeed, various bills at one time had majority support in both Houses, but GOP restrictionist maneuvering blocked them from becoming law.

The Dems had to face down some “rebellions’ from their base for going back on their word and voting to temporarily fund the USG over the Holidays. I don’t see how they can “kick the can” on the Dreamers down the road any more without some serious backlash from their own base. That’s particularly true now that the unnecessary and unwise termination of TPS for El Salvador has sowed yet more fear and unease in the immigrant and Hispanic communities.

As I’ve pointed out before, because of the “Bakuninist Wing” of the GOP, Trump isn’t going to get any type of budget without some Democratic support. Once he gets a budget, that need for “bipartisanship” might well disappear overnight. So, now is the time for the Dems to use their “leverage.”

As other commentators have noted, at one time additional border fencing was basically a “nonpartisan no-brainer.” But, by turning “The Wall” into a White Nationalist racist anti-Hispanic symbol, Trump basically has “poisoned the well” for the Democrats. Nevertheless, there might be room for some additional fencing that the Dems could characterize as “less than The Wall” while Trump could claim victory to his base. The Dems also could give on border equipment and technology as well as more administrative and legal personnel for DHS. Beyond that, the pickings are slim.

But, the GOP leaders and Trump don’t have lots of options either. They will be hard pressed to come up with a budget that satisfies Trump while still gaining sufficient support from the Bakuninists. Then, there is the problem that the budget apparently will require 60 votes in the Senate. That means that the GOP has to do at least something akin to a bipartisan deal. I’ve certainly been wrong before, but I don’t see Nolan’s idea as something the Dems can buy at this time.

I have no problem with also giving relief to family members waiting in line to immigrate. It’s not a “zero sum game” as the restrictions try to portray it. We could clearly take in more legal immigrants now and in the future; clearly we should have been doing so in the past, in which case we wouldn’t have approximately 10 million productive residents living here without legal status. But, that probably will have to await some type of overall Immigration Reform that’s unlikely to be accomplished as long as guys like Jeff Sessions, Steven Miller, and Sen. Tom Cotton are “driving the train” for the GOP on immigration.

So, stay tuned, we’ll see how this all plays out.

Ten years ago, a family arrived in the Bronx from Yaoundé, Cameroon, not speaking a word of English. This Christmas, they are celebrating a feat that would be impressive for any family: Three of the family’s five daughters have been accepted to Ivy League universities.

In a year in which our nativist president would have you believe that immigrants are, at best, a job-stealing drain and at worst, criminals, rapists and people with AIDS, these three remarkable sisters are worth paying attention to. Not just because they are inspiring — they are — but because they are far better ambassadors for this country and exponents of its ideals than the 45th president.

“We brought the girls to this country because there are better opportunities here,” says Flore Kengmeni, their mother, who works as a nurse. “I don’t know of another country where you can try hard, work hard and get somewhere. Where you are given the opportunity to fulfill your potential.”

“This country is built on immigrants,” Francois de Paul Silatchom, their father, a professor of economics at SUNY, starts to say, before his middle daughter, Ella, a sophomore at Yale, interjects: “Our experience as a family is what America is.”

That experience is marked by hard work, optimism, resilience and a persistent sense of gratitude even to have the opportunity.

All three girls admit it wasn’t easy. They recall sitting in class during their first year in America and not understanding what their teachers and classmates were saying. They remember being made fun of, but not really knowing why.

“Everyone spoke so fast and I guess we speak that fast now, too,” says Xaviera, the youngest of the three, who was accepted to Harvard earlier this month.

They turned to books for guidance. Their parents got the girls library cards and made reading mandatory — “Education is the most valuable asset,” the parents say repeatedly when we meet. The sisters were encouraged to read broadly, from “The Magic School Bus” to “Harry Potter,” and they practiced English as a family in their two-bedroom apartment in the Bronx’s Pelham Parkway neighborhood.

By the end of their first year at their local public schools, the girls had learned enough English to take the state exams, and were excelling in their classes. But their parents were alarmed that they were finishing their homework during the school day and coming home bored. They asked teachers to assign their daughters more homework. But even that wasn’t enough.

“Something was wrong,” Mr. de Paul Silatchom says. “I started looking for schools that would challenge them and keep them busy. At a school fair, we learned about Democracy Prep.”

At Democracy Prep, a public charter school in Harlem where I met them one recent afternoon, the day begins at 7:45 a.m. and ends at 5 p.m. Longer school days, many argue, allow teachers to spend more time on subjects other than math and English, and keep students out of trouble.

Through the school’s Korean language program, the sisters were exposed to a culture completely different from their own, which sparked an interest in global affairs for all of them. Civics is a core part of the school’s curriculum, which Xaviera says showed her that, “Regardless of how disadvantaged you are in society, you have an advantage if you understand how our system of government works.”

“I learned so much here,” Ella says of the school. “And between that and our parents, my work ethic — our work ethic — really developed. Our parents required us to do an extracurricular, so sports or choir or whatever and that was for after 5 o’clock. That was normal for us.”

When the oldest, Chris, now a junior at Dartmouth, got into the college in 2014, friends and family were elated, but her parents made it clear that the work wasn’t over.

“The night I got into Dartmouth, Mom asked me, ‘Have you done the dishes?’ Getting in was exciting and I knew she was proud, but it was just a regular day,” Chris says.

“They haven’t ‘arrived,’ as people like to say, just because they are into Ivy League schools,” Mr. de Paul Silatchom says. “It’s a good start and a platform of opportunity.”

When speaking, the sisters transition seamlessly between New York-accented English and French, their first language. The irony that they landed at a school called Democracy Prep after immigrating from one of the world’s least democratic countries is not lost on them.

It’s something they’ve spent a lot of time thinking about as President Trump has rolled out various cruel immigration policies, from his proposed travel ban to, in September, rescinding the Deferred Action for Childhood Arrivals, or DACA — an Obama-era program that protected the country’s approximately 800,000 undocumented youth raised in the country from being deported.

“It’s scary to see because this is not the country we know,” says Chris, who along with her sisters, became an American citizen in 2016. “America at its core is principled on immigrants. We came to this country to improve our futures and I feel as American as anyone born here.”

“These girls are more American than Cameroonian,” their mother says. “Can you imagine being undocumented? We were very lucky,” Xaviera adds.

Watching videos of immigration agents separating families in recent months has been particularly difficult for Ms. Kengmeni and Mr. de Paul Silatchom. “I can’t imagine what it’s been like for these children who go to school in the morning knowing they might come home at the end of the day to no parents,” Ms. Kengmeni says.

This year, Christmas break involves running around to pack for Chris’s semester abroad and attending three Christmas Masses, but the family is grateful to be all together, even if it’s for just a few days. They know they are the lucky ones.

Forty percent of Fortune 500 companies were founded or co-founded by immigrants or the children of immigrants. Watching Ella, Chris and Xaviera, I’d bet good money that they will join those ranks of these world-class leaders. But the question I find myself asking as I leave their school: Who are the young women the Trump administration is currently keeping out?

“WASHINGTON — Late to his own meeting and waving a sheet of numbers, President Trump stormed into the Oval Office one day in June, plainly enraged.

Five months before, Mr. Trump had dispatched federal officers to the nation’s airports to stop travelers from several Muslim countries from entering the United States in a dramatic demonstration of how he would deliver on his campaign promise to fortify the nation’s borders.

But so many foreigners had flooded into the country since January, he vented to his national security team, that it was making a mockery of his pledge. Friends were calling to say he looked like a fool, Mr. Trump said.

According to six officials who attended or were briefed about the meeting, Mr. Trump then began reading aloud from the document, which his domestic policy adviser, Stephen Miller, had given him just before the meeting. The document listed how many immigrants had received visas to enter the United States in 2017.

More than 2,500 were from Afghanistan, a terrorist haven, the president complained.

Haiti had sent 15,000 people. They “all have AIDS,” he grumbled, according to one person who attended the meeting and another person who was briefed about it by a different person who was there.

Forty thousand had come from Nigeria, Mr. Trump added. Once they had seen the United States, they would never “go back to their huts” in Africa, recalled the two officials, who asked for anonymity to discuss a sensitive conversation in the Oval Office.

As the meeting continued, John F. Kelly, then the secretary of homeland security, and Rex W. Tillerson, the secretary of state, tried to interject, explaining that many were short-term travelers making one-time visits. But as the president continued, Mr. Kelly and Mr. Miller turned their ire on Mr. Tillerson, blaming him for the influx of foreigners and prompting the secretary of state to throw up his arms in frustration. If he was so bad at his job, maybe he should stop issuing visas altogether, Mr. Tillerson fired back.

Tempers flared and Mr. Kelly asked that the room be cleared of staff members. But even after the door to the Oval Office was closed, aides could still hear the president berating his most senior advisers.

Sarah Huckabee Sanders, the White House press secretary, denied on Saturday morning that Mr. Trump had made derogatory statements about immigrants during the meeting.

“General Kelly, General McMaster, Secretary Tillerson, Secretary Nielsen and all other senior staff actually in the meeting deny these outrageous claims,” she said, referring to the current White House chief of staff, the national security adviser and the secretaries of state and homeland security. “It’s both sad and telling The New York Times would print the lies of their anonymous ‘sources’ anyway.”

While the White House did not deny the overall description of the meeting, officials strenuously insisted that Mr. Trump never used the words “AIDS” or “huts” to describe people from any country. Several participants in the meeting told Times reporters that they did not recall the president using those words and did not think he had, but the two officials who described the comments found them so noteworthy that they related them to others at the time.

The meeting in June reflects Mr. Trump’s visceral approach to an issue that defined his campaign and has indelibly shaped the first year of his presidency.

How We Reported This Story

The Times conducted over three dozen interviews with current and former administration officials, lawmakers and others close to the process.

Seizing on immigration as the cause of countless social and economic problems, Mr. Trump entered office with an agenda of symbolic but incompletely thought-out goals, the product not of rigorous policy debate but of emotionally charged personal interactions and an instinct for tapping into the nativist views of white working-class Americans.

Like many of his initiatives, his effort to change American immigration policy has been executed through a disorderly and dysfunctional process that sought from the start to defy the bureaucracy charged with enforcing it, according to interviews with three dozen current and former administration officials, lawmakers and others close to the process, many of whom spoke on the condition of anonymity to detail private interactions.

But while Mr. Trump has been repeatedly frustrated by the limits of his power, his efforts to remake decades of immigration policy have gained increasing momentum as the White House became more disciplined and adept at either ignoring or undercutting the entrenched opposition of many parts of the government. The resulting changes have had far-reaching consequences, not only for the immigrants who have sought to make a new home in this country, but also for the United States’ image in the world.

“We have taken a giant steamliner barreling full speed,” Mr. Miller said in a recent interview. “Slowed it, stopped it, begun to turn it around and started sailing in the other direction.”

It is an assessment shared ruefully by Mr. Trump’s harshest critics, who see a darker view of the past year. Frank Sharry, the executive director of America’s Voice, a pro-immigration group, argues that the president’s immigration agenda is motivated by racism.

“He’s basically saying, ‘You people of color coming to America seeking the American dream are a threat to the white people,’” said Mr. Sharry, an outspoken critic of the president. “He’s come into office with an aggressive strategy of trying to reverse the demographic changes underway in America.”

Even as the administration was engaged in a court battle over the travel ban, it began to turn its attention to another way of tightening the border — by limiting the number of refugees admitted each year to the United States. And if there was one “deep state” stronghold of Obama holdovers that Mr. Trump and his allies suspected of undermining them on immigration, it was the State Department, which administers the refugee program.

At the department’s Bureau of Population, Refugees and Migration, there was a sense of foreboding about a president who had once warned that any refugee might be a “Trojan horse” or part of a “terrorist army.”

Mr. Trump had already used the travel ban to cut the number of allowable refugees admitted to the United States in 2017 to 50,000, a fraction of the 110,000 set by Mr. Obama. Now, Mr. Trump would have to decide the level for 2018.

At an April meeting with top officials from the bureau in the West Wing’s Roosevelt Room, Mr. Miller cited statistics from the restrictionist Center for Immigration Studies that indicated that resettling refugees in the United States was far costlier than helping them in their own region.

Mr. Miller was visibly displeased, according to people present, when State Department officials pushed back, citing another study that found refugees to be a net benefit to the economy. He called the contention absurd and said it was exactly the wrong kind of thinking.

But the travel ban had been a lesson for Mr. Trump and his aides on the dangers of dictating a major policy change without involving the people who enforce it. This time, instead of shutting out those officials, they worked to tightly control the process.

In previous years, State Department officials had recommended a refugee level to the president. Now, Mr. Miller told officials the number would be determined by the Department of Homeland Security under a new policy that treated the issue as a security matter, not a diplomatic one.

When he got word that the Office of Refugee Resettlement had drafted a 55-page report showing that refugees were a net positive to the economy, Mr. Miller swiftly intervened, requesting a meeting to discuss it. The study never made it to the White House; it was shelved in favor of a three-page list of all the federal assistance programs that refugees used.

At the United Nations General Assembly in September, Mr. Trump cited the Center for Immigration Studies report, arguing that it was more cost-effective to keep refugees out than to bring them into the United States.

“Uncontrolled migration,” Mr. Trump declared, “is deeply unfair to both the sending and receiving countries.”

As the new year approached, officials began considering a plan to separate parents from their children when families are caught entering the country illegally, a move that immigrant groups called draconian.

At times, though, Mr. Trump has shown an openness to a different approach. In private discussions, he returns periodically to the idea of a “comprehensive immigration” compromise, though aides have warned him against using the phrase because it is seen by his core supporters as code for amnesty. During a fall dinner with Democratic leaders, Mr. Trump explored the possibility of a bargain to legalize Dreamers in exchange for border security.

Mr. Trump even told Republicans recently that he wanted to think bigger, envisioning a deal early next year that would include a wall, protection for Dreamers, work permits for their parents, a shift to merit-based immigration with tougher work site enforcement, and ultimately, legal status for some undocumented immigrants.

The idea would prevent Dreamers from sponsoring the parents who brought them illegally for citizenship, limiting what Mr. Trump refers to as “chain migration.”

“He wants to make a deal,” said Mr. Graham, who spoke with Mr. Trump about the issue last week. “He wants to fix the entire system.”

Yet publicly, Mr. Trump has only employed the absolutist language that defined his campaign and has dominated his presidency.

After an Uzbek immigrant was arrested on suspicion of plowing a truck into a bicycle path in Lower Manhattan in October, killing eight people, the president seized on the episode.

Privately, in the Oval Office, the president expressed disbelief about the visa program that had admitted the suspect, confiding to a group of visiting senators that it was yet another piece of evidence that the United States’ immigration policies were “a joke.”

Even after a year of progress toward a country sealed off from foreign threats, the president still viewed the immigration system as plagued by complacency.

“We’re so politically correct,” he complained to reporters in the cabinet room, “that we’re afraid to do anything.”

Disturbing for sure, but unfortunately not particularly surprising for those of us who have watched the Administration roll out its toxic, ill-informed immigration policies. Perhaps ironically, while the immigration issue has certainly allowed Trump to capture and control the GOP, polls show that his extreme restrictionist, xenophobic views on immigration are generally out of line with the majority of Americans (although not necessarily the majority of GOP voters).

“Republicans prepping letter to Ryan urging DACA fix

Dozens of House Republicans are preparing a letter to Speaker Paul Ryan urging a fix for young undocumented immigrants by the end of the year, adding pressure to high-stakes government funding discussions that could hinge on such a deal, according to three sources familiar with the matter.

The letter, organized by Virginia Rep. Scott Taylor, already has signatories numbering in the 20s, according to a source familiar with the letter, and could reach into the 30s by the time it is sent. Taylor’s office did not immediately respond to a request for comment.

Congressional Hispanic Caucus Chairwoman Michelle Lujan Grisham, a Democrat, revealed the work on the letter in a pen-and-pad session with reporters Thursday on Capitol Hill.

Two other GOP sources confirmed the letter’s development to CNN.

Grisham characterized the letter as “telling Ryan, ‘You’ve got to fix this. You’ve got nine days. What is your plan, what is your path?'”

The “nine days” refers to the December 8 deadline to fund the government. Democrats have said if Republicans need their votes to pass a government funding bill, which they have in the past, then they need to resolve the situation for the Deferred Action for Childhood Arrivals program, which President Donald Trump is ending by the end of the year.

Some Republicans, including Senate Majority Whip John Cornyn, have said any DACA deal should not be included in year-end spending legislation. They have not ruled out, though, the possibility of timing a vote on a DACA deal with one on spending legislation.

Grisham referenced a Democratic-led discharge petition to force a vote on one legislative proposal, the Dream Act, which two Republicans have signed and which needs only 22 more members to support it to force a vote on the floor, though the letter does not threaten that its signatories will back the bill, according to one of the sources.

The letter’s signatories include members who have long pushed for a DACA fix and some who have been less vocal.

According to one of the GOP sources, the letter tells Ryan that the group would like DACA resolved this year and warns that while they agree a legislative solution should include border security, it should not contain measures sought by members like Virginia Rep. Bob Goodlatte and the White House. Some of those measures include cuts or changes to overall legal immigration, mandatory workforce verification and hardline enforcement measures.

The letter has come together quickly, just this week, and is being teed up for release Friday.”

At least some modest reason for optimism on the “DACA Front.” It’s also refreshing and encouraging to learn that there are a significant number of responsible Republican legislators who don’t necessarily “by into” the false narrative being peddled by Trump, Goodlatte, Perdue, Cotton, Sessions, Miller and other GOP restrictionists about the need to “offset” the Dreamers or decrease (the worst possible course of action) legal immigration avenues into the United States.

SURPRISE: Dreamer “Agreement” Coming Apart — Trump’s Position Unclear!

“First and foremost,” Iowa Sen. Chuck Grassley, the chairman of the committee, said in his opening remarks, “any potential deal on DACA has to include robust border security, and by that, I don’t mean a wall.”

This was the quote that garnered the most coverage and inspired some optimistic tea leaf reading. If congressional Republicans weren’t going to insist on a border wall as part of a deal to protect Dreamers, as per the “deal” Democratic leaders struck with President Trump last month, then a Dreamer-saving compromise would be much more assured.

But the wall isn’t shaping up to be the problem. The problem is what Grassley brought up a few seconds later.

“Second, and equally as important as robust border security,” he said, “we’ve got to make sure any deal includes meaningful interior enforcement.”

This is a development that Dreamers themselves have been concerned about since Democrats announced they would engage with the president to find a replacement for DACA. As the New York Times reported over the weekend, Dreamers fear that their “own long-term safety might be secured only in exchange for an increased threat of deportation for their undocumented parents and friends who do not qualify for such protections under the program.” The latest version of the DREAM Act could secure green cards for 1.5 million people. But if such a deal increases the likelihood of deportation for the vast majority of the nation’s roughly 11 million undocumented immigrants, it’s not exactly a feel-good trade.

The problem with making any handshake agreement with Trump, as House Minority Leader Nancy Pelosi and Senate Minority Leader Chuck Schumer did last month, is that he will most likely change his mind once he finds himself in a roomful of different people with different demands. That meeting took place Monday night, when Trump hosted a dinner with congressional Republicans who expect much more out of a DACA deal. Trump surely wanted to win that room, too.

The agreement Trump made with Schumer and Pelosi—so they thought—would have been to pass the DREAM Act in exchange for non-wall border security measures. You know, drones and lasers and radar gizmos and stuff. But according to Arkansas Sen. Tom Cotton, an immigration hawk who was at the dinner on Monday night, “the president was very clear” that any deal should only pertain to those Dreamers who “have a DACA permit today,” a significantly lower number than the amount that would be covered under the DREAM Act, and that “it ought to include some kind of enhanced measures, whether it’s on the border or interior enforcement or what have you.” As Georgia Sen. David Perdue, a fellow immigration hawk who’s co-sponsored a bill with Cotton to reduce legal immigration, told me Tuesday, it was clear that any Dreamer deal he’d be willing to support would encompass “enforcement” on both the border and the interior.

Ratcheting up the deportation apparatus to a new level is not what congressional Democrats signed up for when they engaged President Trump in finding a DACA replacement.

Connecticut Sen. Chris Murphy told me Tuesday that an insistence on ramped-up interior enforcement would be “a problem” for his caucus. “I’m not sure that you can get much tougher interior enforcement than you have today,” he said, “as we’re watching pretty arbitrary deportations happen all across our country.” When I asked Hawaii Sen. Mazie Hirono what would constitute a bridge too far for Democrats, she said any give-and-take needs to be kept “in proportion.” As she pointed out, Republicans are starting to ask for all of the border security and interior enforcement measures included in the failed 2013 comprehensive immigration bill, in exchange for far fewer of that bill’s protections for undocumented immigrants. “I think, as [Illinois Democratic Sen.] Dick Durbin says, that is way too much,” Hirono told me.”

Dreamer relief should be a “no-brainer.” But, the GOP appears to be looking for ways to “tank” it, perhaps because Trump had the audacity to speak to the Dems first. Also, the GOP’s restrictionist views are out of line with the majority of Americans and with nearly all credible immigration experts. Yet, the minority restrictionist position is immensely popular with the GOP’s White Nationalist, xenophobic, racist “base.” And today’s GOP is so beholden to that base that they won’t work with the Dems on reasonable immigration proposals.

If anything should be clear at this point it’s that giving DHS more enforcement personnel at present is close to insane. The waste, incompetence, and gratuitous cruelty in the current DHS enforcement operations are astounding. Until existing personnel are used and deployed in a rational, efficient, and honest manner, there is simply no case for more.

Don’t know how this will come out. Perhaps, the parties are just jockeying for position and playing to their respective bases. But, it could turn ugly for both the Dreamers and for America.

Warren Buffett has been very outspoken in recent years about America and its amazing economic story. Not only does Buffett feel that immigrants have led us to where we are today, but he also thinks that immigrants are an essential component of our country’s future success.

Here’s what Warren Buffett thinks of immigrants
In a nutshell, Buffett feels that immigrants (including undocumented ones) have been and continue to be a key part of our prosperity — not a part of the problem. “This country has been blessed by immigrants,” Buffett said in February at Columbia University. “You can take them from any country you want, and they’ve come here and they found something that unleashed the potential that the place that they left did not, and we’re the product of it.”

Referring to Albert Einstein and Leo Szilard, both of whom were immigrants themselves, Buffett said, “If it hadn’t been for those two immigrants, who knows whether we’d be sitting in this room.”

In his most recent letter to Berkshire Hathaway’s (NYSE:BRK-A) (NYSE:BRK-B) shareholders, Buffett specifically mentioned immigrants as one of the major components of America’s success story. “From a standing start 240 years ago — a span of time less than triple my days on earth — Americans have combined human ingenuity, a market system, a tide of talented and ambitious immigrants, and the rule of law to deliver abundance beyond any dreams of our forefathers.”

On a pathway to citizenship
Buffett is an outspoken Democrat who actively campaigned for Hillary Clinton during the 2016 presidential race. So it shouldn’t come as too much of a surprise that Buffett doesn’t want to deport millions of illegal immigrants who are currently in the United States.

In a 2015 interview with Fox Business, Buffett said

People should be able to earn citizenship who are here. You know, I do not think we should deport millions of people. So, I think we should have a real path to citizenship.

Buffett was then asked specifically about the DREAM Act and its 800,000 minors who are in the country illegally and now face an uncertain future after the end of DACA, from the perspective of a successful American businessman. Buffett replied:

It is a question of being a human being not really a businessman. Immigrants came, our forefathers came as immigrants, they got here anyway they could. And who knows what I would have done if I were in some terrible situation in a country and wanted to come here…a great percentage of them are good citizens. I would have a path to citizenship for them, I would not send them back.

 

On immigration policy and reform
As we all know, the immigration debate has been going on for a long time. And Buffett’s stance hasn’t changed much over the past several years. In a 2013 interview with ABC’s This Week, Buffett said:

I think we should have a more logical immigration policy. It would mean we would attract a lot of people, but we would attract the people we want to attract in particular — in terms of education, tens or hundreds of thousands of people. We enhance their talents and have them stick around here.

Buffett went on to say that any reform package should “certainly offer [undocumented immigrants] the chance to become citizens,” and one main reason for doing so would be to deepen the talent pool of the labor force.

Buffett’s stance on immigration in a nutshell
Warren Buffett believes that allowing immigrants who are already in the country to stay and pursue citizenship is not only the right thing to do, but is essential to America’s continued economic prosperity. Buffett certainly sees the need for immigration reform, as most Americans of all political affiliations do, but wants to encourage and simplify the legal pathways to immigration.”

Buffet speaks simple truth: Immigrants, both documented and undocumented are not threats, but rather are a necessary ingredient for America’s greatness. We need to bring law-abiding undocumented individuals into our society in some type of legal, work authorized status. We also need substantial across the board increases in legal immigration, so that in the future the immigrants we need can come through the legal system (or wait in a realistic line) rather than coming through an underground system and working and living in the shadows.

The lies, misrepresentations, and false narratives being peddled by Trump, Sessions, Bannon, Miller, Kobach, Cotton, Perdue, King, Goodlatte, Labrador, the so called “Freedom” Caucus, and the rest of their White Nationalist restrictionist cronies are a path to national disaster. Removing existing non-criminal migrants who happen to be working here in undocumented status is a colossal waste of limited Government resources that actually hurts our country in numerous ways.

Time to stand up against the restrictionist, White Nationalist, xenophobic, anti-American blather. Demand that your Congressional representatives back sane, humane immigration reform that takes care of those already here and recognizes their great contributions while appropriately and significantly expanding future legal immigration opportunities so that we don’t keep repreating our mistakes over and over.

Let’s be honest about it. If the time, money, and resources that the U.S. Government is currently spending on the counterproductive aspects of immigration enforcement and inhumane immigration detention were shifted into constructive areas, there would be no “disaster relief crisis” in Puerto Rico and the Virgin Islands right now, and we’d have more money to spend on heath care, job training and retraining, infrastructure, addressing the opioid crisis, and many more legitimate national priorities!

JENNIFER RUBIN IN WASHPOST: “Trump’s Most Evil Act” — “an act of uncommon cowardice.”

“First, let’s not think Trump — who invites cops to abuse suspects, who thinks ex-sheriff Joe Arpaio was “doing his job” when denying others their constitutional rights and who issued the Muslim ban — cares about the Constitution (any of the “twelve” articles). Trump says, “We love the dreamers. … We think the dreamers are terrific.” But in fact he loves the applause he derives from his cultist followers more than anything. Otherwise he’d go to the mat to defend the dreamers and secure their legal status.

. . . .

No, if Trump cancels DACA, it will be one more attempt to endear himself to his shrinking base with the only thing that truly energizes the dead-enders: vengeance fueled by white grievance. And it will also be an act of uncommon cowardice. (“Should Trump move forward with this decision, he would effectively be buying time and punting responsibility to Congress to determine the fate of the Dreamers,” writes The Post.) Dumping it into the lap of the hapless Congress, he can try evading responsibility for the deportation of nearly 800,000 young people who were brought here as children, 91 percent of whom are working. (And if by chance Congress should save DACA, it will be Trump who is the villain and they the saviors, an odd political choice for a president who cares not one wit about the party.)

As for Congress, House Speaker Paul Ryan, who talks about sparing the dreamers, will be sorely tested to overcome the objections of the hard-line anti-immigrant voices in his conference. Does he have the nerve to bring to the floor a bill that lacks majority support among Republicans? Tie it to a must-pass bill (e.g., Harvey funding, the debt ceiling, funding for the government)? In the Senate, will opportunistic right-wingers such as Sen. Tom Cotton (R-Ark.) grandstand, perhaps filibustering a measure into order to out-Trump Trump?

However this turns out, the GOP under Trump has defined itself as the white grievance party — bluntly, a party fueled by concocted white resentment aimed at minorities. Of all the actions Trump has taken, none has been as cruel, thoughtless or divisive as deporting hundreds of thousands of young people who’ve done nothing but go to school, work hard and present themselves to the government.

The party of Lincoln has become the party of Charlottesville, Arpaio, DACA repeal and the Muslim ban. Embodying the very worst sentiments and driven by irrational anger, it deserves not defense but extinction.”

“Cowardice” is the hallmark of an Administration that glories in picking on and bullying the poor, the most vulnerable, minorities of all types, and even our foreign allies whose help and support we need. And, the GOP has firmly established itself as the party of cowards.

Trump’s glaring character flaws, naked prejudices, and obvious unsuitability for office, by nature of lack of knowledge, lack of experience, and lack of Presidential temperament, have been out there on display for all to see since the day he announced his candidacy. Yet, notwithstanding some “tisk-tisking” by a few “old timers,” the GOP again and again has in the end united behind Trump and his divisive agenda, preferring to flounder around attempting to govern within its own unruly caucus rather than reaching across the aisle to the Democrats (who, after all, did get the majority of the Presidential votes cast) to form a “union of the middle” to govern the country in a responsible, bi-partisan manner in the absence of Executive competence.

Yes, that would mean sacrificing large parts of the rightist “GOP agenda” in favor of saving the country from Trump’s excesses. But, it’s pretty clear by now that the “GOP agenda” is not going to be enacted into law any time soon anyway. So, why not just do something decent for a change and see how it plays out?

NOLAN RAPPAPORT IN THE HILL: RAISE ACT COULD BE AN OPPORTUNITY FOR DREAMERS!

“Senators Tom Cotton (R-Ark.) and David Perdue (R-Ga.) recently introduced a revised version of the bill addressing legal immigration into the United States, the Reforming American Immigration for a Strong Economy (RAISE) Act.  It is supposed to spur economic growth and raise working Americans’ wages by giving priority to the best-skilled immigrants from around the world and reducing overall immigration by half.

Supporters include President Donald Trump, Attorney General Jeff Sessions, House Judiciary Committee Chairman Bob Goodlatte, andActing Secretary of Homeland Security Elaine Duke.

Nevertheless, it will not reach the president’s desk without support from influential Democratic congressmen, which will be difficult to get and won’t be free.
According to Representative Luis V. Gutierrez (D-Ill.), the RAISE Act “and the bear hug by the Bannon/Kelly/Trump White House — betrays the deep animosity towards legal immigration that has become the central, unifying tenet of the Republican Party.”

Suggestions for a compromise.

The main price for Gutierrez’s support would be to establish a DREAM Act program that would be based on an appropriate merit-based point system.

The number of undocumented aliens who might benefit from a dream act can range from 2.5 to 3.3 million.  It isn’t likely that an agreement will be reached if Gutierrez insists on a number in that range.

Concessions have to be made to achieve an acceptable compromise, and allowing termination of the Visa Waiver Program would be a reasonable choice.  An alternative would be to keep the program as is but distribute the visas on a merit point system instead of using a lottery.

The refugee provision is problematic, but the president has sole authority to determine the number of admissions and the current president supports the 50,000 cap. The Democrats will try to eliminate this cap or raise it if they can’t eliminate it, but this should not be a deal breaker if the other issues are worked out satisfactorily.

The restrictions on family-based immigration, however, are another matter.  They should be modified.  Cotton and Purdue doomed their bill to failure with these provisions.  They hurt constituents on both sides of the aisle.

Moreover, they do not make any sense.  What does national interest mean if the family-unification needs of citizens and legal permanent residents don’t count?

Some advocates strongly opposes the point system because they think it fails to take into account the needs of U.S. businesses, but their concern is based on the point criterion in the current version of the RAISE Act, which has not been subjected to any hearings or markups yet.  If the senators and Gutierrez cannot work out a compromise that protects the needs of U.S. businesses, there will be plenty of time to make additional changes.

This isn’t just about moving these bills through congress.  According to recent Gallup polls, “Americans view Congress relatively poorly, with job approval ratings of the institution below 30% since October 2009.”

And the current Republican-controlled congress is not turning this around.  Reaching an agreement with the Democrats on an immigration reform bill that includes a DREAM Act legalization program would be a good place to start.”

N. RAPPAPORT IN THE HILL: DEMS’ DREAMER BILL OFFERS FALSE HOPE!

“Late last month, Congressman Luis Gutiérrez (D-Ill.), introduced the American Hope Act, H.R. 3591, with 116 co-sponsors, all Democrats.

The bill would provide conditional permanent resident status for undocumented aliens who were brought to the U.S. before their 18th birthday, which would permit them to live and work here legally for three years and put them on a path to Legal Permanent Resident status and citizenship.

Such bills are referred to as “DREAM Acts,” an acronym for “Development, Relief, and Education for Alien Minors Act.”

It might be more accurate, however, to call this bill “The False Hope Act.”

Bills to provide lawful status for undocumented aliens who were brought here as children have been pending in Congress since 2001, and we are yet to see one enacted legislatively, rather than by executive action.  And this one was introduced by Democrats in a Republican-controlled Congress.  Moreover, it is out of step with President Donald Trump’s policies on legal immigration.

Why hasn’t a DREAM Act bill been enacted?  

No one knows for sure.  I think it is due mainly to the fact that the number of undocumented aliens who would benefit from such legislation could get quite large.  Also, the fact that they are innocent of wrongdoing with respect to being here unlawfully does not make it in our national interest to let them stay.  This is particularly problematic with respect to the American Hope Act.  Section 4 of this bill includes a waiver that applies to some serious criminal exclusion grounds.

Although estimates for the number of undocumented aliens who could be impacted are not available yet for the American Hope Act, they are available for similar bills that were introduced this year, the Recognizing America’s Children Act, H.R. 1468, and the Dream Act of 2017, S. 1615.

The Migration Policy Institute estimates that potentially 2,504,000 aliens would be able to meet the minimum age at arrival and years of residence thresholds for the House bill and 3,338,000 for the Senate bill.  However, some of them would need to complete educational requirements before they could apply.

Trump is supporting a revised version of the RAISE Act which would reduce the annual number of legal immigrants from one million to 500,000 over the next decade.  It does not seem likely therefore that he will be receptive to a program that would make a very substantial increase in the number of legal immigrants.

Not merit-based.

The American Hope Act would treat all immigrant youth who were brought here as children the same, regardless of educational level, military service, or work history.  Gutiérrez said in a press release, “We are not picking good immigrants versus bad immigrants or deserving versus undeserving, we are working to defend those who live among us and should have a place in our society.”

This is inconsistent with the skills-based point system in the revised version of the RAISE Act that Trump is supporting.  It would prioritize immigrants who are most likely to succeed in the United States and expand the economy.  Points would be based on factors such as education, English-language ability, age, and achievements.

Thus, Democrats’ American Hope Act as presently written is very likely to suffer the same fate as the other DREAM Acts.

Success requires a fresh, new approach, and the approach taken by the revised RAISE Act might work by basing eligibility on national interest instead of on a desire to help the immigrants.  Certainly, it would be more likely to get Trump’s support.”

I agree with Nolan insofar as any immigration bill sponsored by
Democrats at present is DOA. On the other hand, I doubt that the RAISE Act will pass either. There aren’t enough votes in the GOP caucus to pass any type of meaningful immigration reform without some help from the Democrats.

So, it doesn’t hurt for the Democrats to start laying down some specific “markers” for some future negotiations on immigration reform. Also, while it might not happen in my liftetime, history suggests that the Democrats are no more permanently “dead” as a party than the GOP was after the first Obama election and Democratic surge into power in the Executive and Legislative Branches.

The last time Democrats were in power, the Latino/Hispanic voters who had helped put them there were treated as largely non-existent. Indeed, the Obama Administration ran the U.S. Immigration Courts largely as if they were an extension of the Bush Administration, giving the advocacy community the cold shoulder, enacting zero reforms, and pitching a “near shutout” on outside appointments to the Immigration Court and the BIA over which they had total control.

The next time Democrats come into power, it would be wise of the groups that will help put them there to insist on the types of specific reforms and improvements that the Democrats are now articulating in “can’t pass” legislative proposals. And, in addition to doing something for Dreamers and other migrants who are contributing to our society, meaningful Immigration Court reform to remove it from Executive Branch control needs to be high on the list. Realistically, that’s probably going to require some bipartisan cooperation, participation, and support.

I also disagree with Nolan’s suggestion that it would not be in the national interest to let “Dreamers” stay. Of course, it would be strongly in our national interest to fully incorporate these fine young folks into our society so that they could achieve their full potential and we could get the full benefit of their talents, skills, and courage.

I had a steady stream of DACA applicants coming through my court in Arlington. Sure, some of them had problems, and DHS did a good job of weeding those folks out and/or revoking status if problems arose. But, the overwhelming majority were fine young people who either already were making significant contributions to our society or who were well positioned to do so in the future. Indeed, they were indistinguishable from their siblings and classsmates who had the good fortune to be born in the U.S., except perhaps that they often had to work a little harder and show a little more drive to overcome some of the inaccurate negative stereotypes about undocumented migrants and some of the disabilities imposed on them.

The government doesn’t make this easy. But now, emboldened by President Donald Trump’s anti-immigrant stance, two Republican senators want to make it almost impossible.

Sens. Tom Cotton (R-Ark.) and David Perdue (R-Ga.) introduced a bill on Tuesday that would bar immigrants from bringing almost anyone but their spouses and minor children to the U.S. Latino and Asian Americans, who are more likely to be recent immigrants with family living abroad, would be disproportionately affected by this change.

The bill would also eliminate diversity visas, which many recent African immigrants rely on to get to the U.S., and cap refugee resettlement at 50,000 people per year. The bill doesn’t affect the millions of Irish, German and Italian Americans whose families came to the U.S. in earlier waves of immigration and no longer have close relatives abroad.

The new GOP “family values?” Would we even be having this discussion if most recent immigrants were “white guys” from Canada, Australia, and the UK? My guess is no. It’s not about protecting American workers. The GOP doesn’t give a hoot about them. That’s why they are anti-union, anti-minimum wage, anti-universal health care, anti-safety net, anti-Medicare, anti-consumer protection, anti-financial regulation, anti-pension, anti-equal pay for equal work, anti-environment, anti-science, anti-public workers, anti-education and anti just about everything that doesn’t directly or indirectly help their fat cat friends get fatter and their business buddies get bigger — more profits, more money for upper management, more tax breaks for the rich, less money, fewer benefits, and no chance at a comfortable retirement for workers. No, something else is at work here.
