SURPRISE: Dreamer “Agreement” Coming Apart — Trump’s Position Unclear!

http://www.slate.com/articles/news_and_politics/politics/2017/10/trump_s_dreamer_deal_is_falling_apart.html

Jim Newell reports for Slate:

“First and foremost,” Iowa Sen. Chuck Grassley, the chairman of the committee, said in his opening remarks, “any potential deal on DACA has to include robust border security, and by that, I don’t mean a wall.”

This was the quote that garnered the most coverage and inspired some optimistic tea leaf reading. If congressional Republicans weren’t going to insist on a border wall as part of a deal to protect Dreamers, as per the “deal” Democratic leaders struck with President Trump last month, then a Dreamer-saving compromise would be much more assured.

But the wall isn’t shaping up to be the problem. The problem is what Grassley brought up a few seconds later.

“Second, and equally as important as robust border security,” he said, “we’ve got to make sure any deal includes meaningful interior enforcement.”

This is a development that Dreamers themselves have been concerned about since Democrats announced they would engage with the president to find a replacement for DACA. As the New York Times reported over the weekend, Dreamers fear that their “own long-term safety might be secured only in exchange for an increased threat of deportation for their undocumented parents and friends who do not qualify for such protections under the program.” The latest version of the DREAM Act could secure green cards for 1.5 million people. But if such a deal increases the likelihood of deportation for the vast majority of the nation’s roughly 11 million undocumented immigrants, it’s not exactly a feel-good trade.

The problem with making any handshake agreement with Trump, as House Minority Leader Nancy Pelosi and Senate Minority Leader Chuck Schumer did last month, is that he will most likely change his mind once he finds himself in a roomful of different people with different demands. That meeting took place Monday night, when Trump hosted a dinner with congressional Republicans who expect much more out of a DACA deal. Trump surely wanted to win that room, too.

The agreement Trump made with Schumer and Pelosi—so they thought—would have been to pass the DREAM Act in exchange for non-wall border security measures. You know, drones and lasers and radar gizmos and stuff. But according to Arkansas Sen. Tom Cotton, an immigration hawk who was at the dinner on Monday night, “the president was very clear” that any deal should only pertain to those Dreamers who “have a DACA permit today,” a significantly lower number than the amount that would be covered under the DREAM Act, and that “it ought to include some kind of enhanced measures, whether it’s on the border or interior enforcement or what have you.” As Georgia Sen. David Perdue, a fellow immigration hawk who’s co-sponsored a bill with Cotton to reduce legal immigration, told me Tuesday, it was clear that any Dreamer deal he’d be willing to support would encompass “enforcement” on both the border and the interior.

Ratcheting up the deportation apparatus to a new level is not what congressional Democrats signed up for when they engaged President Trump in finding a DACA replacement.

Connecticut Sen. Chris Murphy told me Tuesday that an insistence on ramped-up interior enforcement would be “a problem” for his caucus. “I’m not sure that you can get much tougher interior enforcement than you have today,” he said, “as we’re watching pretty arbitrary deportations happen all across our country.” When I asked Hawaii Sen. Mazie Hirono what would constitute a bridge too far for Democrats, she said any give-and-take needs to be kept “in proportion.” As she pointed out, Republicans are starting to ask for all of the border security and interior enforcement measures included in the failed 2013 comprehensive immigration bill, in exchange for far fewer of that bill’s protections for undocumented immigrants. “I think, as [Illinois Democratic Sen.] Dick Durbin says, that is way too much,” Hirono told me.”

Dreamer relief should be a “no-brainer.” But, the GOP appears to be looking for ways to “tank” it, perhaps because Trump had the audacity to speak to the Dems first. Also, the GOP’s restrictionist views are out of line with the majority of Americans and with nearly all credible immigration experts. Yet, the minority restrictionist position is immensely popular with the GOP’s White Nationalist, xenophobic, racist “base.” And today’s GOP is so beholden to that base that they won’t work with the Dems on reasonable immigration proposals.

If anything should be clear at this point it’s that giving DHS more enforcement personnel at present is close to insane. The waste, incompetence, and gratuitous cruelty in the current DHS enforcement operations are astounding. Until existing personnel are used and deployed in a rational, efficient, and honest manner, there is simply no case for more.

Don’t know how this will come out. Perhaps, the parties are just jockeying for position and playing to their respective bases. But, it could turn ugly for both the Dreamers and for America.

TAL KOPAN FOR CNN: SENATE HEARING WITH ADMINISTRATION ON DACA SOWS CONFUSION! — Only One Thing Clear: Sen. Pat Leahy (D-VT) Knows That Sessions’s White Nationalist Narrative On Dreamers Is A Lie — And, He’s Anxious To Have A Crack At “Gonzo-Apocalypto” Under Oath!

http://www.cnn.com/2017/10/03/politics/daca-hearing-lawmakers-frustrated/index.html

Tal reports:

There were other tense exchanges as well, including from the former top Democrat on the committee, Vermont Sen. Pat Leahy, who especially took issue with the Justice Department representative. At the outset of the hearing Chairman Chuck Grassley noted that DOJ had not submitted written testimony for the hearing, and acting Assistant Attorney General Chad Readler, of the civil division, said he was limited in speaking outside of what was already public because of ongoing lawsuits over the administration’s termination of DACA.

Leahy pressed Readler on Attorney General Jeff Sessions’ letter about the rescission of DACA, which suggested lax immigration enforcement was responsible for crime, violence and even terrorism.
“Can you provide this committee with any examples of Dreamers being involved in terror activity? … You don’t have to give me hundreds, just give me one!” Leahy said, raising his voice.
“I’m not aware of any examples,” Readler said.
“Neither is the attorney general when he said that,” Leahy said.
After further back-and-forth about what Sessions meant, Readler noted he would be testifying before this committee himself this month.
“He’s taken longer than any attorney general since I’ve been here, but I’ve only been here 42 years,” Leahy said.

Under questioning from Republican Sen. Lindsey Graham, of South Carolina, who has co-sponsored Durbin’s bill, the DHS officials did say they supported a pathway to citizenship for DACA-eligible individuals in an eventual solution — and said they were largely the type of people the US should want.
“They’re a benefit to the country as are many immigrants coming in,” Dougherty said. “They are a valuable contribution to our society, we need to regularize their status through legislative means.”
He also said DHS did not support the notion of creating a permanent visa status that would never allow people to be naturalized — saying the White House would be of the same mind.
“I think creating second-class citizens or people who are never able to naturalize is not a good model,” Dougherty said, adding “I do” when asked if he thinks the President agrees.”

Pretty obvious why Gonzo would rather spend his time  spreading lies and bogus, alarmist narratives about American young people and immigrant communities rather than facing Sen. Leahy under oath.

THE GRIFTERS: Party Of Liars — GOP Tax Plan Proposes To Loot America For the Rich, Limit Government Services For Everyone Else, & Leave Future Generations To Pay The Price — Not Surprisingly, They Lie About It And Assume That Non-Fat-Cat Supporters Are Too Dumb Or Biased to Figure It Out! — Fact Checker Gives GOP Politicos Coveted “Four Pinocchios!”

https://www.washingtonpost.com/news/fact-checker/wp/2017/09/29/trump-aides-sell-tax-plan-with-pinocchio-laden-claims/

Glenn Kessler writes for the “Fact Checker” in the Washington Post.

The wealthy are not getting a tax cut under our plan.”
— Gary Cohn, director of the White House Economic Council, in an interview on ABC’s “Good Morning America,” Sept. 28, 2017

“The numbers are about a trillion and a half to the baseline. But more importantly, it’s a trillion dollars to policy, which is the right way of looking at it. We think there will be $2 trillion of growth. So we think this tax plan will cut down the deficits by a trillion dollars.”
— Treasury Secretary Steve Mnuchin, in an interview on Fox News, Sept. 28

In selling President Trump’s tax plan, his aides have resorted to making strikingly misleading statements to defend it.

At the moment, there are few details about the tax plan, only broad strokes. That makes it easier for the administration to make big claims as analysts scramble to try to make sense of the plan’s possible impact. That will be much harder once an actual tax bill is written and the details can be analyzed in depth.

In the meantime, we have a pair of Four-Pinocchio claims that are worth highlighting.

‘The wealthy are not getting a tax cut under our plan’

The Trump tax plan drops the top bracket from 39.6 to 35 percent, and allows for the possibility of a 25 percent top rate through a pass-through entity. It presumably would also eliminate a 3.8 percent Obamacare tax on investment income that hits only upper-income taxpayers.

So, on its face, this is a ridiculous statement to make for any plan that includes reductions in tax rates. That’s because federal income taxes are paid mostly by the wealthy. So when you cut income tax rates, it results in lots of dollars for the wealthiest taxpayers.

According to Treasury Department data, the top 10 percent of income earners in 2016 paid 80 percent of individual income taxes. The top 20 percent paid 94.8 percent. The top 0.1 percent paid an astonishing 24.5 percent of taxes.

In 2014, the latest year Internal Revenue Service data is available, just the top 400 taxpayers — with $127 billion of income — paid $29.4 billion in income taxes, or more than 2 percent of all income taxes. That’s more than the bottom 70 percent of taxpayers combined.

In other words, the vast majority of American taxpayers pay little or nothing in income taxes; they instead mostly pay payroll taxes such as Social Security and Medicare. So it really strains credulity for administration officials such as Cohn to say the wealthy will not get a tax cut.

The wealthy pay most of the taxes, so unless the tax plan specifically leaves them untouched — which Trump’s plan does not — they will get big tax cuts. This is why distributional tables often look so lopsided when tax rates are reduced. The administration has suggested that another, higher rate level might be added, presumably so the distributional tables won’t look so ugly, but right now the plan calls for a significant reduction in the top rate.

Besides a reduction in the top tax rate, the tax plan would eliminate the alternative minimum tax (AMT). That in theory should be a boon for the wealthy as well, although it increasingly has snared families in the upper middle class, especially if they live in high-tax states or have many children.

The administration has called for eliminating the itemized deduction for state and local taxes, as well as the personal/dependent exemptions, which are key add-ons when calculating the AMT. (If those items were eliminated from the AMT, the number of tax filers facing the AMT would drop by 95 percent, according to the Joint Committee of Taxation.)

So it’s possible that for many people it would be a wash, or even a net loser, depending on whether a tax filer lives in a state with high taxes. According to JCT, the AMT is paid by 36 percent of returns with income of between $200,000 and $500,000, nearly 55 percent between $500,000 and $1 million, and nearly 18 percent above $1 million.

Still, in 2014, the top 400 taxpayers paid nearly $700 million because of the alternative minimum tax, nearly 2.5 percent of the total. The one recent tax return of President Trump that has leaked — for 2005 — shows his tax bill increased $31 million because of the AMT.

Finally, the tax plan calls for eliminating the estate tax, although it is unclear on whether any tax would be required when someone dies. Currently, the estate tax is estimated to affect only about 5,500 estates out of nearly 3 million estates because as much as $11 million can be shielded from taxation.

In theory, assets would be subject to capital gains tax instead, which could actually affect more people, but that has not been specified in the administration’s tax outline. If the administration also eliminates the gift tax and does not tax capital gains at death, some income earned by the wealthy may never be taxed.

“We strongly believe the final tax bill will not cut taxes for the wealthy as a class — but there is no way to solve for every single individual in the country,” a White House official said.

‘We think this tax plan will cut down the deficits by a trillion dollars’

Mnuchin made this statement in response to an observation that the nonpartisan Committee for a Responsible Federal Budget has estimated the tax plan would reduce revenue by $2.2 trillion over 10 years. (Including additional interest on the debt, CRFB estimated the deficit would increase by $2.7 trillion.) He argued that instead there would be an additional $2 trillion in revenue from economic growth, resulting in a $1 trillion reduction in the deficit.

Cohn, briefing reporters at the White House a few hours later, offered a different estimate: “We know that 1 percent change in GDP will add $3 trillion back. So if they’re right, we’re only going to pay down $800 billion of the deficit. I’ll live with a $800 billion paydown.”

It’s a little odd that Mnuchin is anticipating $2 trillion in revenue and Cohn is anticipating $3 trillion in revenue. But these are both very rosy estimates of the impact of a tax cut in economic growth. No serious economist believes that a tax cut boosts economic growth so much that the tax cut pays for itself.

The Congressional Budget Office, under Douglas Holtz-Eakin, a Republican, in 2005 estimated that a 10 percent reduction in federal income tax rates would have macroeconomic feedbacks of between 15 and 30 percent. In other words, a $1 trillion tax cut might yield $150 billion to $300 billion in additional revenue. That still means a reduction in revenue of as much as $700 billion.

“The big problem is that there is no fully specified plan,” Holtz-Eakin said. “Without one, you can’t gauge the growth or know the budget cost. I’m broadly sympathetic to the framework, but it is a start, not the finish.”

As Holtz-Eakin put it earlier this year in an opinion column for The Washington Post: “Proposing trillions of dollars in tax cuts and then casually asserting that such a plan would ‘pay for itself with growth’ … is detached from empirical reality.”

Indeed, contrary to popular perception, even Ronald Reagan predicted revenue would fall as a result of his big 1981 tax cut that reduced tax rates. That is shown in Reagan administration and Congressional Budget Office scores of the Reagan tax plan reproduced in a 2011 article for Tax Notes by Bruce Bartlett, who helped craft the 1981 tax cut as a congressional aide at the time. The estimates turned out to be wrong because the 1981-1982 recession was deeper than expected and inflation fell more rapidly than expected, so Reagan boosted taxes just one year after his tax cut.

William A. Niskanen, chairman of Reagan’s Council of Economic Advisors, co-wrote a paper in 1996 that defended Reagan’s economic record but also said it was “an enduring myth” that Reagan officials believed tax cuts would pay for themselves. “This was nonsense from day one, because the credible evidence overwhelmingly indicates that revenue feedbacks from tax cuts is 35 cents per dollar, at most,” Niskanen wrote, noting that “the Reagan administration never assumed that the tax cuts would pay for themselves.”

A Treasury Department study on the impact of tax bills since 1940, first released in 2006 and later updated, found that the 1981 tax cut reduced revenue by $208 billion in its first four years. George W. Bush’s 2001 tax cut — also a rate cut — led to a revenue loss of $91 billion, over four years, the Treasury paper calculated. (The figures are rendered in constant 2012 dollars.)

Both the Reagan and Bush tax cuts came during periods of economic stress, which is certainly not the case now. So there is less room now for a big swing upward in the economy, especially with the country’s aging workforce.

The Treasury Department did not respond to a query for an explanation of Mnuchin’s math. But frankly it is irresponsible for a treasury secretary to claim a certain amount of growth or revenue without even producing the details of a plan, as the details determine the impact on the economy.

The Pinocchio Test

Though the details of the tax plan are sparse, both Cohn and Mnuchin made statements that are simply false. Of course the wealthy will do well under the tax cut, even if certain deductions are eliminated, and it’s silly to pretend otherwise. And it’s a fantasy to claim that the tax cut will pay for itself — and even reduce the deficit — especially in an economy that already has low unemployment and a booming stock market.

Four Pinocchios is getting into “Jeff Sessions’s territory!”

But, I can see that they were richly deserved. I watched Steve “Munchkin” Mnuchkin on “Meet the Press” with Churck Todd this AM.  It was appalling!

Munchkin lied about Puerto Rico, lied about the tax plan, and then lied and tried to cover up his own responsibility for trying to get a “freebie” at taxpayer expense for his honeymoon. The idea that there was any “national security” reason for the Munchkin keeping in touch with the White House is preposterous.

Indeed the very idea that Munchkin would have any role in national security other than making sure the checks don’t bounce is prima facie ridiculous. And, if he did, that’s what secure facilities in the CIA part of the nearest U.S. Embassy are for. Or for that matter, that’s what subordinates in the Trasure Department are for. Gotta believe that every once and awhile spooks have to make secure communications with Washington.

When confronted by Todd with his obvious lies and cover-ups, Munchkin just kept on spewing whoppers. Finally, Todd gave up, thanked him, and let the record speak for itself.

“Warren Buffett on Immigration Reform: Buffett feels that immigrants (including undocumented ones) have been and continue to be a key part of our prosperity — not a part of the problem.“

https://www.fool.com/investing/2017/09/29/warren-buffett-on-immigration-reform.aspx

Matthew Frankel reports for The Motley Fool:

“Immigration reform has been a hot-button issue long before President Trump pledged to build a wall along our border. And while there’s certainly an argument to be made that we need to do a better job of controlling illegal immigration, there’s also a strong case to be made that immigrants are a big driving force behind America’s growth — past, present, and future.

Warren Buffett has been very outspoken in recent years about America and its amazing economic story. Not only does Buffett feel that immigrants have led us to where we are today, but he also thinks that immigrants are an essential component of our country’s future success.

Here’s what Warren Buffett thinks of immigrants
In a nutshell, Buffett feels that immigrants (including undocumented ones) have been and continue to be a key part of our prosperity — not a part of the problem. “This country has been blessed by immigrants,” Buffett said in February at Columbia University. “You can take them from any country you want, and they’ve come here and they found something that unleashed the potential that the place that they left did not, and we’re the product of it.”

Referring to Albert Einstein and Leo Szilard, both of whom were immigrants themselves, Buffett said, “If it hadn’t been for those two immigrants, who knows whether we’d be sitting in this room.”

In his most recent letter to Berkshire Hathaway’s (NYSE:BRK-A) (NYSE:BRK-B) shareholders, Buffett specifically mentioned immigrants as one of the major components of America’s success story. “From a standing start 240 years ago — a span of time less than triple my days on earth — Americans have combined human ingenuity, a market system, a tide of talented and ambitious immigrants, and the rule of law to deliver abundance beyond any dreams of our forefathers.”

On a pathway to citizenship
Buffett is an outspoken Democrat who actively campaigned for Hillary Clinton during the 2016 presidential race. So it shouldn’t come as too much of a surprise that Buffett doesn’t want to deport millions of illegal immigrants who are currently in the United States.

In a 2015 interview with Fox Business, Buffett said

People should be able to earn citizenship who are here. You know, I do not think we should deport millions of people. So, I think we should have a real path to citizenship.

Buffett was then asked specifically about the DREAM Act and its 800,000 minors who are in the country illegally and now face an uncertain future after the end of DACA, from the perspective of a successful American businessman. Buffett replied:

It is a question of being a human being not really a businessman. Immigrants came, our forefathers came as immigrants, they got here anyway they could. And who knows what I would have done if I were in some terrible situation in a country and wanted to come here…a great percentage of them are good citizens. I would have a path to citizenship for them, I would not send them back.

On immigration policy and reform
As we all know, the immigration debate has been going on for a long time. And Buffett’s stance hasn’t changed much over the past several years. In a 2013 interview with ABC’s This Week, Buffett said:

I think we should have a more logical immigration policy. It would mean we would attract a lot of people, but we would attract the people we want to attract in particular — in terms of education, tens or hundreds of thousands of people. We enhance their talents and have them stick around here.

Buffett went on to say that any reform package should “certainly offer [undocumented immigrants] the chance to become citizens,” and one main reason for doing so would be to deepen the talent pool of the labor force.

Buffett’s stance on immigration in a nutshell
Warren Buffett believes that allowing immigrants who are already in the country to stay and pursue citizenship is not only the right thing to do, but is essential to America’s continued economic prosperity. Buffett certainly sees the need for immigration reform, as most Americans of all political affiliations do, but wants to encourage and simplify the legal pathways to immigration.”

******************************************

Buffet speaks simple truth: Immigrants, both documented and undocumented are not threats, but rather are a necessary ingredient for America’s greatness. We need to bring law-abiding undocumented individuals into our society in some type of legal, work authorized status. We also need substantial across the board increases in legal immigration, so that in the future the immigrants we need can come through the legal system (or wait in a realistic line) rather than coming through an underground system and working and living in the shadows.

The lies, misrepresentations, and false narratives being peddled by Trump, Sessions, Bannon, Miller, Kobach, Cotton, Perdue, King, Goodlatte, Labrador, the so called “Freedom” Caucus, and the rest of their White Nationalist restrictionist cronies are a path to national disaster. Removing existing non-criminal migrants who happen to be working here in undocumented status is a colossal waste of limited Government resources that actually hurts our country in numerous ways.

Time to stand up against the restrictionist, White Nationalist, xenophobic, anti-American blather. Demand that your Congressional representatives back sane, humane immigration reform that takes care of those already here and recognizes their great contributions while appropriately and significantly expanding future legal immigration opportunities so that we don’t keep repreating our mistakes over and over.

Let’s be honest about it. If the time, money, and resources that the U.S. Government is currently spending on the counterproductive aspects of immigration enforcement and inhumane immigration detention were shifted into constructive areas, there would be no “disaster relief crisis” in Puerto Rico and the Virgin Islands right now, and we’d have more money to spend on heath care, job training and retraining, infrastructure, addressing the opioid crisis, and many more legitimate national priorities!

INSIDE THE AMERICAN GULAG: New Suit Alleges Abuse Of Pregnant Detainees BY DHS!

“When Jennye Pagoada Lopez arrived at the U.S. border post of San Ysidro in July seeking political asylum, she showed agents ultrasound images of her pregnancy and told them she was bleeding and needed immediate medical attention.

But instead of taking her to the hospital, they detained her for more than a day before transferring her to the Otay Mesa Detention Center in San Diego.

It took two days to get a medical exam. Four days after that, she was informed that she had a miscarriage.

That was the account she gave in a sworn declaration to her lawyers.

“I was neglected, subjected to abusive conditions and denied medical treatment when requested,” she testified.

Pagoada is among ten women whose testimony was included in a complaint filed this week against the U.S. Department of Homeland Security by seven rights groups accusing immigration officials of improperly detaining pregnant women and failing to provide them with adequate medical care.

The complaint — made to the department’s inspector general and civil rights officer — alleges that the women suffered physical and psychological harm and asks the department to investigate the cases and report on what steps immigration authorities will take to enforce its policies on the detention and treatment of pregnant women.

“We are gravely concerned with the agency’s failure to abide by its own policy against detaining pregnant women, the detention conditions that have been reported by pregnant women in various detention facilities across the country, and the lack of quality medical care provided to women who are pregnant or have suffered miscarriages while in custody,” the complaint said.”

The American Gulag intends to demean, dehumanize, demoralize, and discourage migrants like Jenny Pagoda Lopez.

But, the reality is that Lopez and others like her come out as human, brave, and courageous.

The truth is that all Americans are demeaned and dehumanized by unnecessary immigraton detention. It is a stain on our humanity, our professed values, and our national conscience that will not easily be washed away.

“AYATOLLAH ROY” Preaches A Gospel Of Hate & Bigotry That Jesus Would Never Regognize

Michael Gerson writes in the Washington Post:

“The strongest objection to Moore’s hardness and harshness is theological. On the consistent evidence of Jesus’ ministry, what public attitude did he condemn the most? He stood against people who talked constantly of the law, who thought they were especially virtuous, who enjoyed scolding people, who judged others without tenderness and understanding. He was at constant war with the self-righteous and took the side of the social outcasts they condemned.

Now we see the return of the Pharisee.”

NEW POLL: Majority Of Americans Want DACA, Don’t Like Trump’s “Gonzo” Enforcement, DON’T Believe That Legal Immigration Should Be Drastically Cut, Reject Wall! — Want Border Security & Enforcement Of Employer Sanctions!

http://www.langerresearch.com/wp-content/uploads/1191a4DACAandImmigration.pdf

“Americans Back DACA by a Huge Margin. A vast 86 percent of Americans support a right to residency for undocumented immigrants who arrived in the United States as children, with support crossing the political spectrum. Two-thirds back a deal to enact such legislation in tandem with higher funding for border control. Possibly in light of Donald Trump’s decision to phase out the Deferred Action for Childhood Arrivals program, disapproval of his handling of immigration overall reaches 62 percent in this ABC News/Washington Post poll. Just 35 percent approve. Additional hurdles for Trump are his demand for a wall on the U.S. border with Mexico – again 62 percent oppose it – and substantial concerns about his immigration enforcement policies. Americans were asked whether they support “a program that allows undocumented immigrants to stay in the United States if they arrived here as a child, completed high school or military service and have not been convicted of a serious crime,” all elements of DACA, established by Barack Obama by executive order in 2012. Support spans demographic groups, including three-quarters of Republicans and conservatives, 86 and 87 percent of independents and moderates and 97 and 96 percent of Democrats and liberals.”

**********************************

Read the complete summary of the ABC News/Washington Post Poll at the link.

While all polls, particularly those on immigration, must be looked at with some circumspection, these are great numbers to keep in mind when faced with the constant bogus claims from Trump Administration and GOP Congressional restrictionists that they are somehow representing the “national will” or “the people’s voice” with their out of touch policies and proposals.

Interestingly, one enforcement initiative that got widespread support was enforcing existing employer sanctions laws, something that neither GOP nor Democratic Administrations has been willing to do over the past three decades since they were in acted in 1986.

Nor does their Trump Administration appear to be putting any emphasis on this program. And, it’s easy to see why. Employer sanctions would involve going after U.S. businesses, some of the same folks who helped put Trump and the GOP in power. Some of them like the current system, which keeps many needed workers marginalized and dependent, so they can be exploited.

Perhaps more important, going after U.S.employers doesn’t do anything for the Trump/GOP racist base. Much better to sack up some decent productive Hispanic workers and count it as “law enforcement.” That’s what the racist xenophobes like to see.

DEAN KEVIN JOHNSON PREVIEWS JENNINGS V. RODRIGUEZ (INDEFINITE PREHEARING IMMIGRATION DETENTION) OA IN SCOTUS BLOG

http://www.scotusblog.com/2017/09/argument-preview-constitutionality-mandatory-lengthy-immigrant-detention-without-bond-hearing/

Dean Johnson writes:

“Detention as a tool of immigration enforcement has increased dramatically following immigration reforms enacted in 1996. Two Supreme Court cases at the dawn of the new millennium offered contrasting approaches to the review of decisions of the U.S. government to detain immigrants. In 2001, in Zadvydas v. Davis, the Supreme Court interpreted an immigration statute to require judicial review of a detention decision because “to permit[] indefinite detention of an alien would cause a serious constitutional problem.” Just two years later, the court in Demore v. Kim invoked the “plenary power” doctrine – something exceptional to immigration law and inconsistent with modern constitutional law – to immunize from review a provision of the immigration statute requiring detention of immigrants awaiting removal based on a crime.

How the Supreme Court reconciles these dueling decisions will no doubt determine the outcome in Jennings v. Rodriguez. This case involves the question whether immigrants, like virtually any U.S. citizen placed in criminal or civil detention, must be guaranteed a bond hearing and possible release from custody. Relying on Zadvydas v. Davis, the U.S. Court of Appeals for the 9th Circuit affirmed a district court injunction that avoided “a serious constitutional problem” by requiring bond hearings every six months for immigrant detainees. The court of appeals further mandated that, in order to continue to detain an immigrant, the government must prove that the noncitizen poses a flight risk or a danger to public safety.”

****************************************

Read the rest of Dean Johnson’s analysis at the link.

This is huge in human rights. A “W” for the Administration, which many observers view as likely with the advent of Justice Gorsuch, will essentially “Green Light” the Trump-Sessions-Miller plan to construct the “New American Gulag.” The Gulag’s “prisoners” will be noncriminal migrants (many of them women fleeing violence in the Northern Triangle) whose only “crime” is to assert their rights for due process and justice under our laws.

The concept that migrants have rights is something that sticks in the craws of the White Nationalists. So, punishing them for asserting their rights (with an objective of coercing them into giving up their rights and leaving “voluntarily”) is the next best thing to denying them entirely (which the Administration routinely does whenever it thinks it can get away with it — and the Article IIIs have largely, but not entirely, been asleep at the switch here).

And, make no mistake about it, as study after study has shown, the “conditions of civil detention” in the Gulag are substandard. So much so that in the last Administration DHS’s own study committee actually recommended an end to private immigration detention contracts and a phasing out of so-called “family detention.” The response of the Trump White Nationalists: ignore the facts and double down on the inhumanity.

Based on recent news reports, DHS immigration detainees die at a rate of approximately one per month.  And many more suffer life changing and life threatening medical and psychiatric conditions while in detention. Just “collateral damage” in “Gonzo speak.”

Immigration detainees are often held without bond or with bonds that are so unrealistically high that they effectively amount to no bond. And, in many cases (like the one here) they are denied even minimal access to a U.S. Immigration Judge to have the reasons for detention reviewed.

Plus, as I reported recently, across the nation DHS is refusing to negotiate bonds for those eligible. They are also appealing Immigration Judge decisions to release migrants on bond pending hearings, apparently without any regard to the merits of the IJ’s decision. In other words, DHS is abusing the immigration appeals system for the purpose of harassing migrants who won’t agree to waive their rights to a due process hearing and depart!

Also, as I pointed out, in the “no real due process” world of  the U.S. Immigration Courts, the DHS prosecutors can unilaterally block release of a migrant on bond pending appeal. In most cases this means that the individual remains in detention until the Immigration Judge completes the “merits hearing.” At that point the BIA determines that the DHS bond appeal is “moot” and dismisses it without ever reaching the merits. Just another bogus “production” statistic generated by EOIR!

Oh, and by the way, contrary to “Gonzo” Session’s false and misleading rhetoric on so-called “Sanctuary Cities,” one of the things jurisdictions that rationally choose to limit cooperation with DHS enforcement to those with significant criminal records are doing is protecting their law-abiding, productive migrant residents and migrant communities from the patent abuses of  the “American Gulag.” “Gonzo policies” predictably drive reasonable people to take protective actions.

But, some day, the bureaucrats, complicit judges (particularly life-tenured Article III Judges, like the Supremes), reactionary legislators who turn their backs on human suffering, and misguided voters who have allowed this human rights travesty to be perpetrated on American soil will be held accountable, by the forces of history if nothing else.

RACIST MILLER, GOP XENOPHOBES SEEK TO UNDERMINE “DREAMER DEAL” WITH RESTRICTIONIST, WHITE NATIONALIST AGENDA!

https://www.washingtonpost.com/powerpost/growing-list-of-conservative-demands-threatens-bipartisan-deal-on-dreamers/2017/09/26/a3df3ba8-a23a-11e7-b14f-f41773cd5a14_story.html

Mike DeBonis reports in the Washington Post:

“An emerging list of conservative demands is threatening to derail the fledgling bipartisan effort to preserve the Obama administration program protecting from deportation 690,000 illegal immigrants brought to the United States as children.

President Trump discussed the outlines of a potential deal to protect those covered by the Deferred Action for Childhood Arrivals program with Democratic congressional leaders at a White House dinner this month. The tentative deal would couple permanent protections for those immigrants with improved border security.

But key conservative Republicans in the House and Senate are coalescing around a broader suite of policies as a condition of backing a deal, and that has Democrats and moderate Republicans warning that the current, fragile consensus could quickly break apart.

In the Senate, James Lankford (R-Okla.) and Thom Tillis (R-N.C.) introduced a conservative alternative this week to the Dream Act, a bipartisan bill that has some moderate Republican support and that Democrats want to pass as part of any deal with Trump.

[Trump, top Democrats agree to work on deal to save ‘dreamers’ from deportation]

The Lankford-Tillis bill, known as the Succeed Act, sets out a more onerous path to legal status for the immigrants in question, and it includes provisions barring them from taking advantage of existing laws that allow legal immigrants to petition authorities to allow foreign relatives to come to the United States.

Critics say those laws foster “chain migration,” inflating the amount of legal immigration. Eliminating the possibility of petitioning on behalf of relatives abroad is among another set of policies that House conservatives are pursuing on a separate track.

Key White House officials, including senior adviser Stephen Miller, have worked with members of the hard-right House Freedom Caucus and other Republican lawmakers to hone a list of policy demands that go beyond the border security provisions on which Democrats have signaled they are willing to negotiate.

It is unclear to what extent Trump himself will support these provisions as part of the effort to negotiate a solution for “dreamers,” as the childhood arrivals are known. But the proposals are gaining adherents among some of the president’s strongest backers in Congress.

[Trump administration announces end of immigration protection program for ‘dreamers’]

Rep. Mark Meadows (R-N.C.), the Freedom Caucus chairman, said in an interview this week that a working list of policies that conservatives may demand includes ending the “chain migration” laws; mandating that employers use E-Verify, an online federal system to determine people’s eligibility to work in the United States; stepping up enforcement against those overstaying legitimate visas; and limiting protections for those who seek asylum at U.S. borders.”

These toxic dudes never miss a chance to push their White Nationalist anti-American agenda. Frankly, we don’t need to plow more resources into already perfectly adequate border security, and there is certainly no need for more immigration agents who have so little to do now that they can squander time busting law-abiding American residents, guarding their agency bosses, staking out hospitals and courthouses, and screwing up already out of control Immigration Court dockets. Where’s the accountability for efficient and rational use of resources? But, those could be trade-offs that the Dems could make to save the Dreamers. (Honestly, given some of the other garbage the GOP has put out there, funding “The Wall” seems like the least harmful of the trade-offs in human terms. Money gets wasted, America looks foolish, but nobody gets hurt and it won’t tank our economy like the restrictionist agenda on legal immigration would).

But, the hard core xenophobic White Nationalist agenda being pushed by Miller, the “Freedom” Caucus, and other restrictionists out to limit legal immigration, deny due process, and make a mockery out of our legal and moral obligations to refugees — No Way! The Dems would have to “Just Say No.”

The “Ace in the Hole” for the Dems:  There is neither the ability nor the moral willingness on the part of the majority of decent Americans to deport 800,000 American young people. They might end up “hanging in limbo” till some future date when responsible government once again gains the upper hand over the “wrecking crew.”

THE HILL: N. RAPPAPORT ON WHAT IT WILL TAKE TO CLOSE THE DEAL ON DREAMERS

http://thehill.com/opinion/immigration/352155-if-democrats-insist-on-chain-migration-theyll-kill-the-dream-act

Nolan writes:

“According to Migration Policy Institute estimates, potentially 3,338,000 aliens would be able to qualify for conditional lawful status under H.R.3440, which leads to permanent resident status, and chain migration would make the number much larger.

Moreover, chain migration would make it possible for the DREAMers to pass on legal status and a path to citizenship to the parents who brought them to the United States in violation of our laws, which is sure to be unacceptable to many Republicans.

The chain migration issue does not just apply to a DREAM Act. If it is allowed to block passage of a DREAM Act, it is likely to become an obstacle to every legalization program from now on, and for most undocumented immigrants, there is not going to be another way to obtain lawful permanent resident status.”

*****************************

Read Nolan’s complete analysis over at The Hill at the link.

I’m far removed from the days when I had a sense of what’s happening on the Hill. So, if Nolan says that the Dems will have to give on family migration for  Dreamers to cut a deal to save them in a GOP-controlled Congress in a Trump presidency, maybe that’s true. Gotta do what you have to do to save lives and preserve America’s future.

But, I do know something about the bogus term “chain migration” It’s a pejorative term coined by restrictionists to further their racial and ethnic agenda.

Chain migration is simply legal family migration, a process that has been ongoing for at least half a century and has done nothing but good things for America. Of course, it makes sense to give preferred treatment to those with family already in the U.S. Of course, having family here helps folks adjust, prosper, and contribute. It’s a win-win. Studies by groups not associated with a restrictionist agenda confirm that.

Moreover, unlike the folks pushing the restrictionist agenda, I actually have seen first-hand the highly positive results of family-based legal immigration for years in Immigration Court. It brings really great folks into our society and allows them to contribute fully to the success of America, and particularly our local communities.

If we want more skills-based immigration, that’s also a good idea. But, that doesn’t require a corresponding cut in family immigration. Immigration is good for America. It’s not a “zero-sum game,” although restrictionists would like us to think so.

The GOP position on parents of Dreamers is absurd. Those folks are already here and contributing to our society and our communities. Many have been here for decades. They are not going anywhere notwithstanding the rhetoric of the restrictionists and the Trump Administration. Other than picking on Dreamers once they become citizens, what could we as a country possibly gain by such an absurd and punitive measure directed against productive long term residents?

I think it is worth considering what pushing for unnecessary and harmful restrictions on family migration says about the real motivations of today’s GOP and its apologists.

THE LIARS ON THE HILL: Spurred By Trump’s Example, GOP Legislators and Politicos In Washington Have Taken Outright Lying And Knowingly Spreading False Narratives To A New Level

Dave Leonhardt writes in “Opinion Today” at the NYT:

“First, health care: Here’s a giveway about how bad the new Senate health care bill is: Bill Cassidy, one of its authors, keeps trying to sell it by telling untruths.
“The relatively new phenomenon of just ‘up is down’ lying about your bill’s impacts is jarring,” says Loren Adler of the USC-Brookings-Schaeffer Initiative on Health Policy.
Most egregiously, Cassidy is claiming that the bill would not ultimately deprive sick people of health insurance. That’s false, as NPR calmly explained when Cassidy said otherwise.
In fact, the bill — known as Graham-Cassidy — would free states to remove insurance protections for people with pre-existing conditions. Without those protections, insurers could price such people out of the market.

If you get cancer (or even have a family history of it) or your child is born with a birth defect — among many, many other health issues — you could find yourself unable to buy insurance. Without insurance, you could be denied crucial treatments. In a tangible way, Graham-Cassidy would harm millions of Americans.
Aviva Aron-Dine and Sarah Kliff have both written good explainers on this issue. As Kliff notes, “There is literally no analysis” to support Cassidy’s claim that the bill would expand the number of insured.
Jimmy Kimmel, the country’s most unexpected health wonk, has urged Cassidy to stop “jamming this horrible bill down our throats.”

Insurers came out against the bill yesterday, joining doctors, hospitals, AARP, patient advocates, multiple governors and others.
Meanwhile, Republican leaders are trying to win the vote of Lisa Murkowski — one of three Republican senators who voted against a previous Obamacare repeal bill, in July — by funneling money to Alaska.
In the least surprising development of all, President Trump is now repeating Cassidy’s falsehoods.
The last word on health care this morning goes to Nicholas Bagley of the University of Michigan. “Graham-Cassidy is a brazen effort to block any level of government, state or federal, from achieving near-universal coverage,” he writes. “That’s what the debate is about. Everything else is just noise.”

Read Leonhardt’s entire piece with working links to his sources and citations at this link:

https://www.nytimes.com/newsletters/2017/09/21/opinion-today?nlid=79213886

And Leonhardt is by no means the only one blowing the whistle on the GOP’s latest War on America. Among many others, the Washington Post’s “Fact Checker” awarded Senator Cassidy “Three Pinocchios” for his false claims about coverage:

“Regular readers of The Fact Checker know that the burden of proof falls on the person making the claim. Cassidy has provided little evidence to support his claim of more coverage, except that innovation would flourish and help bring down costs and expand coverage. That’s certainly possible, but it would be more plausible if his proposal did not slash funding to such an extent.

Kimmel’s claim that 30 million fewer Americans will have insurance may be a high-end estimate. But already, in 2019, CBO calculations suggest at least 15 million fewer Americans would have insurance once the individual and employer mandates are repealed. Much of that decline might be by choice, but Cassidy insists the gap will be filled and then exceeded in 10 years. Unlike Cassidy, no prominent health-care analyst is willing to venture a guess on coverage levels — but the consensus is that his funding formula makes his claim all but impossible to achieve.

Given the lack of coverage estimates by the CBO or other health-care experts, Cassidy’s claim does not quite rise to Four Pinocchios. But it certainly merits a Three.

Three Pinocchios”

Here’s a link to the complete analysis by the Post’s Glenn Kessler:

GOP’S WAR ON AMERICA REVS UP — NEW HEALTH CARE PROPOSAL IS THE WORST EVER! — LESS CARE, MORE UNINSURED!

Paige Winfield Cunningham reports for the Washington Post:

“Sen. Bill Cassidy (R-La.) is pushing a health-care bill that could get a Senate vote in the next two weeks.
A dealbreaker in July may not be a dealbreaker in September.

The latest Obamacare overhaul bill gaining steam on Capitol Hill slashes health-care spending more deeply and would likely cover fewer people than a July bill that failed precisely because of such concerns. What’s different now is the sense of urgency senators are bringing to their effort to roll back the Affordable Care Act, with only a dozen days remaining before the legislative vehicle they’re using expires.

The political prospects for the bill, offered by Sens. Bill Cassidy (R-La.) and Lindsey O. Graham (R-S.C.), seemed to be improving by the hour Monday. A key Republican governor, Arizona’s Doug Ducey, signaled support for the legislation, and some moderate senators whose votes are crucial have either signed onto the bill or at least haven’t ruled it out yet. Ducey opposed the Senate leadership’s Better Care Reconciliation Act — which was defeated in July — and his opposition heavily influenced the decision by Sen. John McCain (R-Ariz.) not to back that measure.

Worries over steep Medicaid cuts and how many people could potentially lose protections or their health coverage altogether drove the GOP effort into a ditch at the end of July, when BCRA failed by seven votes.

It’s hard to see how the Cassidy-Graham plan resolves those concerns. In many cases, it could make them even more acute. The Congressional Budget Office has said it will release a “preliminary assessment” of the measure next week, which will provide some information on its effects on the budget. But the CBO said it would be “at least several weeks” before it can estimate whether people would lose insurance and whether premiums would spike.

The measure would actually cut federal health-care spending even more than BCRA, and aim the cuts more directly at states that expanded Medicaid under the Affordable Care Act. It was the governors and senators from those states who were most deeply worried about Medicaid cuts to begin with.”

ALWAYS A PRETTY SAFE BET: “Jeff Sessions is wrong,” Says Sen. Lindsey Graham (R-SC) — (Actually, Sessions Lied And Smeared Some All-American Young People In The Process, But Why Split Hairs?)

http://www.politico.com/story/2017/09/06/daca-dreamers-reaction-lindsey-graham-242370?cid=apn

Louis Nelson reports in Politico:

“Attorney General Jeff Sessions’ assertion Tuesday that so-called Dreamers have taken jobs away from American citizens is “wrong,” Sen. Lindsey Graham declared Wednesday morning, pushing back against his former Senate colleague and calling for compassion from Congress.

“Jeff Sessions is wrong. These kids are not taking jobs from American citizens, they’re part of our country,” Graham (R-S.C.) told NBC’s “Today” show, rebutting Sessions’ assertion from the previous day. “They’re fully employed for the most part, they’re in school, they will add great value. The president is right to want to have a heart for these kids.”

The attorney general’s comment about Dreamers, undocumented immigrants who were brought to the U.S. as children, came during his announcement that the Trump administration will rescind DACA, a program that offers work permits to Dreamers and protects them from deportation. Sessions, known as a hawk on immigration issues during his Senate tenure, blamed the program for hurting American job-seekers and for creating a “humanitarian crisis” on the U.S.-Mexico border.”

SLATE: “Jeff Sessions Spews Nativist Lies While Explaining Why Trump Is Killing DACA!”

http://www.slate.com/blogs/the_slatest/2017/09/05/sessions_daca_speech_was_full_of_nativist_lies.html

Mark Joseph Stern writes:

“Many Republicans have made clear in recent weeks that they favor the basic policy DACA enshrined, and merely oppose its executive implementation. Sessions, who helped persuade Trump to kill the program, is not one of those Republicans. In his remarks, he directly denounced the very idea of granting any kind of amnesty to undocumented individuals brought to the U.S. as children through no fault of their own. At the heart of his speech were two lies, straight from Breitbart, explaining why DACA must end:

The effect of this unilateral executive amnesty, among other things, contributed to a surge of unaccompanied minors on the southern border that yielded terrible humanitarian consequences. It also denied jobs to hundreds of thousands of Americans by allowing those same jobs to go to illegal aliens.

Let’s examine these falsehoods in turn.

First: Sessions claimed that DACA “contributed to a surge of unaccompanied minors on the southern border.” This allegation, often touted by far-right xenophobes, is false. A study published in International Migration, a peer-reviewed academic journal, found that the surge in unaccompanied minors actually began in 2008. (DACA was announced in 2012.) The authors pointed to a host of factors contributing to this phenomenon, including escalating gang violence in Central America, as well as drug cartels’ willingness to target and recruit children in Mexico. But the study found that DACA was not one of these factors. Its authors concluded that “the claim that DACA is responsible for the increase in the flow of unaccompanied alien children is not supported by the data.”

Even without the study, it should be obvious that DACA played no role in this surge of unaccompanied minors because the theory itself makes no sense. Undocumented children who arrived in the United States following DACA’s implementation would not qualify for the program. Only those individuals who “have continuously resided in the United States since June 15, 2007” and “were physically present in the United States on June 15, 2012” could receive DACA status. Why would parents send their children to the U.S. to participate in a program in which they are not legally permitted to participate?

Second: Sessions alleged that DACA has “denied jobs to hundreds of thousands of Americans by allowing those same jobs to go to illegal aliens.” This line is obviously drawn from the false narrative that immigrants steal jobs from American citizens. There is no actual evidence that DACA recipients have taken jobs from any Americans, let alone “hundreds of thousands.” There is, however, strong evidence that killing DACA will significantly damage the economy—a fact that Sessions conveniently omitted from his speech.

Once DACA is fully rescinded, its former recipients will lose their work permits (and thus their jobs) and face possible deportation. According to the left-leaning Center for American Progress, about 30,000 people will lose their jobs each month as their DACA status expires. The loss of these workers could reduce the national GDP by $280 billion to $433 billion over the next decade. According to estimates by the libertarian Cato Institute, DACA’s demise will cost employers $2 billion and the federal government $60 billion. Trump’s decision to end DACA isn’t a job-saver; it’s a job-killer.

Toward the end of his speech, Sessions praised the RAISE Act, a Republican-backed bill that would tightly curtail immigration into the U.S. Sessions claimed the act would “produce enormous benefits for our country.” In reality, the measure marks an effort to return America to an older immigration regime that locked out racial and ethnic minorities. Sessions has praised the 1924 law that created this regime—a law whose chief author declared that his act was meant to end “indiscriminate acceptance of all races.” On Tuesday, Sessions revived this principle in slightly more polite language.

The attorney general’s utterly gratuitous defamation of young Latino immigrants tells you everything you need to know about the decision to kill DACA. Before Tuesday, the Trump administration seemed eager to frame its DACA decision as respect for constitutional separation of powers: Congress, it insisted, not the president, must set immigration policy. But after Sessions’ speech, it is difficult to view this move as anything other than an attempt to implement the white nationalism that Trump and Sessions campaigned on.”

It shouldn’t be news by now that “Gonzo Apocalypto” is a lifelong racist and White Nationalist totally unfit to serve as Attorney General. That’s what Liz Warren and others said during the confirmation process when Sessions’s GOP “fellow travelers” were so eager to brush over his un-American record and his anti-American views.

Latinos, Asians, Blacks, Jews and other American minorities need to unite with those of us who don’t want a return to the “Jim Crow” American South of the earlier 20th Century (which spawned the likes of Sessions and where the white GOP population is still racially and culturally tone deaf) behind some good candidates, get out the vote, and throw the White Nationalists and their GOP enablers and apologists (guys like Mitch McConnell, Paul Ryan, and most of the rest of the today’s GOP legislators who take responsibility for nothing while encouraging the Trump Administration’s outrageous conduct by refusing to join with Congressional Democrats to “just say no'”) out of office at the ballot box.  Otherwise, there won’t be an America in the future.
