“The Trump administration on Tuesday sought to allay growing fears among immigrant communities over wide-ranging new directives to ramp up enforcement against illegal immigrants, insisting the measures are not intended to produce “mass deportations.”

Federal officials cautioned that many of the changes detailed in a pair of memos from Homeland Security Secretary John F. Kelly will take time to implement because of costs and logistical challenges and that border patrol agents and immigration officers will use their expanded powers with care and discretion.

Yet the official public rollout of Kelly’s directives, first disclosed in media reports over the weekend, was met with outrage from immigrant rights advocates over concerns the new policies will result in widespread abuses as authorities attempt to fulfill President Trump’s goals of tightening border control.

Trump took a hard line against illegal immigration during his campaign, at times suggesting he would seek to create a nationwide “deportation force” to expel as many of the nation’s estimated 11 million unauthorized immigrants as possible.

In a conference call with reporters, a senior Department of Homeland Security official moved to avert what he called a “sense of panic” among immigrant communities.”

Summary: Duh! So, we roll out this big new program in the first 35 days of the new Administration to great fanfare. But, nobody considered the resource and funding implications with Congress. So, it’s much ado about nothing (for now). But, don’t you dare lie about all the great things we’ve already accomplished. Watch for the biased media falsely claiming that it’s all smoke and mirrors or that we’re already rounding up some of the folks we said we’d deport. BREAKING: DHS Releases Final Border Enforcement Memos — Get “Fact Sheet” & All The Links You Need Here!

Actions

Enforcing the law. Under this executive order, with extremely limited exceptions, DHS will not exempt classes or categories of removal aliens from potential enforcement. All of those in violation of the immigration laws may be subject to enforcement proceedings, up to and including removal from the United States. The guidance makes clear, however, that ICE should prioritize several categories of removable aliens who have committed crimes, beginning with those convicted of a criminal offense.

Establishing policies regarding the apprehension and detention of aliens. U.S. Customs and Border Protection (CBP) and U.S. Immigration and Customs Enforcement (ICE) will release aliens from custody only under limited circumstances, such as when removing them from the country, when an alien obtains an order granting relief by statute, when it is determined that the alien is a U.S. citizen, legal permanent resident, refugee, or asylee, or that the alien holds another protected status, when an arriving alien has been found to have a credible fear of persecution or torture and the alien satisfactorily establishes his identity and that he is not a security or flight risk, or when otherwise required to do so by statute or order by a competent judicial or administrative authority.

Hiring more CBP agents and officers. CBP will immediately begin the process of hiring 5,000 additional Border Patrol agents, as well as 500 Air & Marine agents and officers, while ensuring consistency in training and standards.

Identifying and quantifying sources of aid to Mexico. The President has directed the heads of all executive departments to identify and quantify all sources of direct and indirect federal aid or assistance to the government of Mexico. DHS will identify all sources of aid for each of the last five fiscal years.

Expansion of the 287(g) program in the border region. Section 287(g) of the INA authorizes written agreements with a state or political subdivision to authorize qualified officers or employees to perform the functions of an immigration officer. Empowering state and local law enforcement agencies to assist in the enforcement of federal immigration law is critical to an effective enforcement strategy, and CBP and ICE will work with interested and eligible jurisdictions.

Commissioning a comprehensive study of border security. DHS will conduct a comprehensive study of the security of the southern border (air, land, and maritime) to identify vulnerabilities and provide recommendations to enhance border security. This will include all aspects of the current border security environment, including the availability of federal and state resources to develop and implement an effective border security strategy that will achieve complete operational control of the border.

Constructing and funding a border wall. DHS will immediately identify and allocate all sources of available funding for the planning, design, construction, and maintenance of a wall, including the attendant lighting, technology (including sensors), as well as patrol and access roads, and develop requirements for total ownership cost of this project.

Expanding expedited removal. The DHS Secretary has the authority to apply expedited removal provisions to aliens who have not been admitted or paroled into the United States, who are inadmissible, and who have been continuously physically present in the United States for the two-year period immediately prior to the determination of their inadmissibility, so that such aliens are immediately removed unless the alien is an unaccompanied minor, intends to apply for asylum or has a fear of persecution or torture in their home country, or claims to have lawful immigration status. To date, expedited removal has been exercised only for aliens encountered within 100 air miles of the border and 14 days of entry, and aliens who arrived in the United States by sea other than at a port of entry. The Department will publish in the Federal Register a new Notice Designating Aliens Subject to Expedited Removal Under Section 235(b)(1)(a)(iii) of the Immigration and Nationality Act that expands the category of aliens

subject to expedited removal to the extent the DHS Secretary determines is appropriate, and CBP and ICE are directed to conform the use of expedited removal procedures to the designations made in this notice upon its publication.

Returning aliens to contiguous countries. When aliens apprehended do not pose a risk of a subsequent illegal entry, returning them to the foreign contiguous territory from which they arrived, pending the outcome of removal proceedings, saves DHS detention and adjudication resources for other priority aliens. CBP and ICE personnel shall, to the extent lawful, appropriate and reasonably practicable, return such aliens to such territories pending their hearings.

Enhancing Asylum Referrals and Credible Fear Determinations. U.S. Citizenship and Immigration Services (USCIS) officers will conduct credible fear interviews in a manner that allows the interviewing officer to elicit all relevant information from the alien as is necessary to make a legally sufficient determination. USCIS will also increase the operational capacity of the Fraud Detection and National Security Directorate.

Allocating resources and personnel to the southern border for detention of aliens and adjudication of claims. CBP and ICE will allocate available resources to expand detention capabilities and capacities at or near the border with Mexico to the greatest extent practicable. CBP will focus on short-term detention of 72 hours or less; ICE will focus on all other detention capabilities.

Properly using parole authority. Parole into the United States will be used sparingly and only in cases where, after careful consideration of the circumstances, parole is needed because of demonstrated urgent humanitarian reasons or significant public benefit.

Notwithstanding other more general implementation guidance, and pending further review by the Secretary and further guidance from the Director of ICE, the ICE policy directive with respect to parole for certain arriving aliens found to have a credible fear of persecution or torture shall remain in full force and effect.

Processing and treatment of unaccompanied alien minors encountered at the border. CBP, ICE, and USCIS will establish standardized review procedures to confirm that alien children who are initially determined to be unaccompanied alien children continue to fall within the statutory definition when being considered for the legal protections afforded to such children as they go through the removal process.

Putting into place accountability measures to protect alien children from exploitation and prevent abuses of immigration laws. The smuggling or trafficking of alien children into the United States puts those children at grave risk of violence and sexual exploitation. CBP and ICE will ensure the proper enforcement of our immigration laws against those who facilitate such smuggling or trafficking.

Prioritizing criminal prosecutions for immigration offenses committed at the border. To counter the ongoing threat to the security of the southern border, the directors of the Joint Task Forces- West, -East, and -Investigations, as well as the ICE-led Border Enforcement Security Task Forces (BESTs), are directed to plan and implement enhanced counter- network operations directed at disrupting transnational criminal organizations, focused on those involved in human smuggling.

Public Reporting of Border Apprehensions Data. In order to promote transparency, CBP and ICE will develop a standardized method for public reporting of

statistical data regarding aliens apprehended at or near the border for violating the immigration law.”

NYT Editorial Blasts Trump Administration’s Anti-Immigrant Fear Mongering!

In an Editorial that first appeared on Feb. 18, 2017, the NY Times wrote:

“Another DACA recipient, Daniela Vargas of Jackson, Miss., barricades herself in her home after agents detain her father and brother. A mother of four, Jeanette Vizguerra, seeks refuge, alone, in a Denver church basement. A group of Latino men leaving a church-run homeless shelter near Alexandria, Va., are surrounded by a dozen immigration agents who question them, scan their fingerprints and arrest at least two of them. [Emphasis Added.]

President Trump’s defenders say the arrest numbers from Immigration and Customs Enforcement are comparable to those under President Barack Obama, an energetic deporter-in-chief. That may be true, for the moment, but the context is vastly different. Mr. Trump’s campaign pledges, his flurry of immigration-related executive orders, including his ban on certain travelers from Muslim countries, have a common thread. They reflect his abandonment of discretion, of common sense, his rejection of sound law-enforcement priorities that stress public safety and respect for the Constitution.

They prioritize fear instead.

ICE and the Border Patrol under Mr. Obama were ordered to focus on arresting serious criminals and national-security risks. Mr. Trump has removed those restraints in the name of bolstering his “deportation force.” He wants to triple the number of ICE agents. He wants to revive federal agreements to deputize state and local police officers as immigration officers. He wants to increase the number of detention beds and spur the boom in private prisons.

This vision is the one Donald Trump began outlining at the start of his campaign, when he slandered an entire country, Mexico, as an exporter of rapists and drug criminals, and an entire faith, Islam, as a global nest of murderers. This is the currency of the Trump aides Stephen Bannon and Stephen Miller, who have brought the world of the alt-right, with its white nationalist strain, into the White House.

Where could the demonizing and dehumanizing of the foreign born lead but to a whiter America? You have heard the lies from Mr. Trump: that immigrants pose a threat, when they are a boon. That murders are up, when they are down. That refugees flow unimpeded into the country, when they are the most meticulously vetted people to cross our borders. That immigrants and refugees are terrorists, when they are the ones being terrorized.

For those who would resist the administration, there is much to do, and not a lot of time. Congress is not a check. Democrats there are outnumbered, speaking out but waging symbolic resistance for now. Republicans are mostly split between avoiding the subject and cheering on Mr. Trump.”

On a personal note, the “church shelter incident” involved the Rising Hope Mission Church in the Alexandria area of Fairfax, Co., VA. This church is devoted to meeting the needs of the most vulnerable in our community and is a mission outreach project funded by local United Methodist Churches, including the Beverley Hills Community United Methodist Church to which my wife and I belong. Among other things, Rising Hope serves as a hypothermia shelter, and actions like this by ICE serve to discourage individuals from seeking potentially life-saving assistance.

The new directives would supersede nearly all of those issued under previous administrations, Kelly said, including measures from President Barack Obama aimed at focusing deportations exclusively on hardened criminals and those with terrorist ties.

Looks like everything is a “priority,” almost everyone will be detained, and DHS Assistant Chief Counsel won’t be offering PD or other negotiated “deals” except in extraordinary situations.

It’s not even clear from this whether the ACCs will still have authority to “waive appeal” in cases where the DHS loses. If not, that means that the BIA could also be overwhelmed with marginal DHS appeals.

While one of the memos notes the 534,000 Immigration Court backlog, there is a total disconnect in putting all these new priorities into Immigration Court without any plan for dealing with the 534,000 already there. (Most folks already here arrived at least two years ago, so even the greater use of expedited removal will leave hundreds of thousands of potential new filings for the Immigration Courts.)

When everything is a priority, nothing is a priority! Looks to me like another ill-conceived, “built to fail,” scheme.  Over time, these plans are likely to be taken apart by the Article III Courts, bit by bit, piece by piece, until we have total chaos in the immigration enforcement system. Haste makes waste.

“The Trump administration’s attempts to translate the president’s hard-line campaign rhetoric on immigration into reality have run into two major roadblocks: the complexity of reshaping a sprawling immigration system and a president who has not been clear about how he wants to change it.

In his first four weeks in office, President Trump has sought to use his executive powers to punch through Washington’s legislative and bureaucratic hurdles and make quick progress on pledges to crack down on illegal immigrants and tighten border control.

But Trump has been vague about his goals and how to achieve them and his aides have struggled to interpret his orders.

The resulting turmoil has included a successful legal challenge halting his immigration travel ban, fears among congressional Republicans over the White House’s more extreme measures and widespread anxiety among immigrant communities across the country.

The latest flash point erupted Friday over reports that the Department of Homeland Security was considering mobilizing 100,000 National Guard troops to help round up millions of unauthorized immigrants in 11 states, including some such as Colorado and Oregon far from the southern border.

President Trump said at a press conference Thursday that deciding the fate of illegal immigrants brought to the U.S. as children is “one of the most difficult subjects I have.” (Jabin Botsford/The Washington Post)”

It’s not difficult for anyone who understands the complex field of immigration to see that when you surround yourself with tone-deaf advisors like Jeff Sessions, Steve Bannon, Stephen Miller, Kris Kobach, and Rep. Steve King your immigration policies are headed straight onto the rocks, where they likely will remain aground for the rest of the Administration.

So, you’re President Donald Trump. You want to make an impact in immigration, and also have everybody love what you’re doing to “make America great.”

Then, why not sit down with some Republicans who have thought carefully about the issue, like, for example: House Speaker Paul Ryan, Senator John McCain, Senator Lindsey Graham, Senator Jeff Flake, Congresswoman Illeana Ros-Lehtinen, Senator Marco Rubio, the Koch Brothers, former U.S. Solicitor General Ted Olson, and Ohio Governor John Kasich? Also, it would be a good idea to reach across the aisle and speak with folks like Senate Minority Leader Chuck Schumer, Senator Dick Durban, Senator Bernie Sanders, House Minority Leader Nancy Pelosi, and Representative Henry Cuellar who have worked thoughtfully on immigration issues. And, why not invite DHS Secretary John Kelly, Secretary of State Rex Tillerson, Defense Secretary James Mattis, Labor Secretary Alex Acosta (assuming confirmation), and, of course, Vice President Mike Pence to the table too?

Think about how refugees, legal immigrants, and those who are already here and in our workforce can be melded in the best way possible to tap America’s full potential, create meaningful opportunities for all Americans, increase productivity and innovation, and combat the looming problem of future labor shortages. Also, consider how a more realistic, expanded legal immigration system could be a critical tool for discouraging illegal migration, maintaining control of our borders, and insuring national security without over-investing in the (usually ineffective and always expensive) quasi-militarization of our borders.

As one of my colleagues used to tell me when I got going too fast, “Relax, it’s a marathon not a sprint.” There is still plenty of time for President Trump to get the immigration issue right for America. But, it’s not going to happen unless he expands his circle of advisers to include those with a more positive and realistic view of  immigration’s essential role in making America great.

Immigration Raids Net 680

“Immigration authorities last week arrested 680 people who were in the United States illegally, Homeland Security Secretary John F. Kelly said in a statement Monday.

The raids in at least a dozen states, which marked the Trump administration’s first large-scale crackdown on people living in the United States illegally, set off a wave of panic and protest in immigrant communities over the weekend and sparked questions from immigration advocates as to whether the arrestees posed legitimate threats to public safety.

DHS, which overseas U.S. Immigration and Customs Enforcement (ICE), said Monday that approximately 75 percent of those arrested were “criminal aliens,” including some who had been convicted of crimes such as homicide, sexual assault of a minor and drug trafficking.

Asked to provide further clarification, a DHS official confirmed that the term “criminal aliens” includes anyone who had entered the United States illegally or overstayed or violated the terms of a visa. There are an estimated 11 million people in the United States who fit that profile.

ICE declined to provide the names and locations of those who were detained in the raids, nor would the agency say how many of the 680 people had committed serious crimes.

Field offices in Los Angeles, San Antonio, Chicago, Atlanta and New York City released a total of 15 examples of people ICE took into custody last week, including one who was a “self-admitted MS-13 gang member” and one who was wanted for murder and attempted murder in Mexico. Seven had prior convictions for sexual assault or for lewd or indecent acts with a child, and three, including the gang member, had convictions for drug trafficking or distribution.

ICE carried out the arrests in New York, California, Illinois, Texas, Missouri, Kansas, Georgia, North Carolina, South Carolina, Kentucky, Indiana and Wisconsin. Of those, about a quarter had no prior convictions.

ICE has characterized the raids as routine, but immigrant rights groups said the actions were out of the ordinary and that most of those swept up were not dangerous. They said ICE also handled the detentions — which activists described as playing out in homes, on the side of the road and outside workplaces — differently from how the agency had in the latter years of the Obama administration, and accused the government of sowing fear among the immigrant ­community.

“This is not normal,” Sulma Arias, field director for the Center for Community Change, said in a teleconference with reporters Monday, calling it a “horrific overreach that will destroy families and undermine the American Dream for thousands.”

There still seems to be confusion as to whether these were “business as usual” by DHS or the result of the Trump Administration’s Executive Orders cracking down on so-called “criminal aliens.” Perhaps, it doesn’t really make any difference. Whatever it’s called, it’s the “new normal.”

“An appeals court pressed a Justice Department lawyer Tuesday on whether President Donald Trump’s executive order on immigration is discriminatory, while also pushing an attorney for the two states fighting the order to explain how it could be unconstitutional to bar entry of people from terror-prone countries, the Justice Department lawyer arguing on behalf of the administration, urged the appeals court to remove a lower-court injunction on the order, arguing that the court shouldn’t second-guess the president’s judgment when it came to a question of national security.

The executive order, Mr. Flentje told a three-judge panel of the San Francisco-based Ninth U.S. Circuit Court of Appeals, struck a balance between security concerns and the practice of allowing people to enter the country.

“The president struck that balance, and the district court’s order has upset that balance,” he said. “This is a traditional national security judgment that is assigned to the political branches and the president and the court’s order immediately altered that.’’

The oral arguments on whether to reinstate some, all, or none of President Donald Trump’s executive order on immigration represented a crucial test in the fast-moving legal battle over White House efforts to restrict entry into the U.S. The Jan. 27 order suspended U.S. entry for visitors from seven predominantly Muslim countries for at least 90 days, froze the entire U.S. refugee program for four months and indefinitely banned refugees from Syria. The administration argues the action was needed to keep terrorists from domestic soil.

The president weighed in on Twitter on Wednesday morning: “If the U.S. does not win this case as it so obviously should, we can never have the security and safety to which we are entitled. Politics!”

The legal clash, which is also playing out in other courts around the country, represents a remarkable test of the powers of a new president determined to act quickly and aggressively to follow up on his campaign promises. Mr. Trump, who promised repeatedly on the campaign trail to tighten what he called lax immigration policies, issued his executive order a week after taking office, generating widespread protests as well as plaudits and setting off an immediate debate over the extent of executive branch authority.”

This one still seems “too close to call.”  There are substantial arguments on both sides. Courts generally do not like to interfere with the authority of the President in the fields of immigration, national security and foreign policy. On the other hand, appellate courts are usually very reluctant to interfere with trial court proceedings at the very preliminary TRO stage. While this might eventually end up in the Supreme Court, as most commentators assume, I’m skeptical it will go there any time soon, given the Supreme’s current short-handed configuration.

WSJ: Tension Between Gen. Kelly & White House As DHS Secretary Resisted Effort To Appoint Kris Kobach As Deputy Secretary!

“WASHINGTON—Homeland Security Secretary John Kelly has clashed with the White House over staffing and other decisions in recent days, people familiar with the matter said, leaving the agency without a second-in-command as it tried to institute a new travel ban during a chaotic weekend at the nation’s airports.

When President Donald Trump selected Mr. Kelly, the pick won broad support from Republicans and Democrats in part because they believed the retired Marine general would be willing to speak up and challenge Mr. Trump.

That tension didn’t take long to materialize. Mr. Kelly hasn’t been able to name the deputy he wants at the agency, people familiar with the matter said, and he fought off attempts by the White House to put Kris Kobach, the Kansas secretary of state known as a hard-liner on immigration, into the position.
Mr. Kelly was also frustrated at not knowing the details of the travel ban earlier, so he could prepare his agency to respond, according to people familiar with the matter. Mr. Trump signed the executive order that created the ban late Friday afternoon. Mr. Kelly was only informed of the details that day as he was traveling to Washington, even though he had pressed the White House for days to share with him the final language, the people said.”

According to the article, President Trump has now decided to nominate Elaine Duke, a former Bush Administration official, to the #2 job at DHS. Have to wonder how long Kelly, a former Marine and a reputed “straight shooter” (in more ways than one) will last in “the circus.”

Accordingly, absent the receipt of significant derogatory information indicating a serious threat to public safety and welfare, lawful permanent resident status will be a dispositive factor in our case-by-case determinations.

According to Chuck Todd on “Meet The Press” this AM, the DHS opposed the inclusion of “green card holders” in the EO, but their objections apparently were ignored by the Trump WH staff who did the drafting (without much thought or consultation, it appears).

I must admit to hoping that Gen. Kelly at DHS and Gen. Mattis at DOD would be the “adults in the room” on some of these issues. The problem might be that they aren’t “in  the room” when the decisions are made.

With guys like Steve Bannon, Kris Kobach and Stephen Miller, with well- established track records of poor judgement and divisiveness (and that’s putting it charitably) mis-advising Trump on immigration, it’s likely to be an uphill climb for anyone purporting to be the voice of reason and sound judgment. And, I’m certainly not trying to give Trump a pass here; he selected and empowered this  team of  spectacularly unqualified senior advisors.

“President Trump on Wednesday signed two executive orders on immigration, including one that directs federal agencies to begin construction of a wall on the border with Mexico, his signature campaign promise.

Trump signed the actions during a visit to the Department of Homeland Security (DHS) as his aides met in the White House with two top Mexican cabinet officials.

“A nation without borders is not a nation,” Trump said during a speech at DHS headquarters. “Beginning today, the United States of America gets back control of its borders.”

The president said his directive “will save thousands of lives, millions of jobs, and billions and billions of dollars.”

One of the orders signed by Trump calls for the construction of “a large physical barrier on the southern border,” according to White House press secretary Sean Spicer.

The other order deals with immigration enforcement and ends the “catch and release” policy that quickly returned border crossers back to Mexico instead of arresting and processing them for deportation. The policy was a fixture of the Bush administration and was later reinstated on an informal basis by former President Barack Obama.

“Federal agents are going to unapologetically enforce the law, no ifs, ands or buts,” Spicer said.

The immigration actions also seek to withhold visas from countries to make sure they take back people in the U.S. illegally who are found to have broken U.S. laws. It would also strip federal grants from “sanctuary” cities and states that do not enforce federal immigration laws.

“We’re going to strip federal grant money from the sanctuary states and cities that harbor illegal immigrants,” Spicer said.”

“President Trump signed a pair of executive actions Wednesday to begin ramping up immigration enforcement, including a new border wall with Mexico, vowing that construction on his chief campaign pledge would begin in months.

In an appearance at the Department of Homeland Security, Trump kicked off the rollout of a series of directives aimed at clamping down on the estimated 11 million immigrants living illegally in the United States. Aides said more directives could come later this week, including new restrictions on refugees and immigrants from Muslim-majority countries.

The presidential directives signed Wednesday aim to create more detention centers, add more federal border control agents and withhold federal funds to cities that do not comply with federal immigration laws, Trump aides said.

“We are going to restore the rule of law in the United States,” Trump said, addressing DHS employees after signing the orders. “Beginning today the United State gets control of its borders.”

Government statistics bear this out. The number of immigrants claiming fear of persecution or torture in their home countries is on the rise, and so are the findings that those claims are credible. In order to be considered for asylum by an immigration judge, immigrants first have to go through a “credible fear” screening, in which an asylum officer determines whether the claims they are making have a “significant possibility” of holding up in court.

More than 70% of those who claimed credible fear in the 2016 fiscal year hailed from El Salvador, Honduras, and Guatemala, places beset by rampant violence.

Under US law, individuals who are found to have credible fear have the right to due process to determine the validity of their claims in the court. But US authorities don’t always take Central American immigrants’ fears seriously, studies suggest. One, released by the American Immigration Lawyers Association in 2016, found that not all border patrol agents are asking immigrants if they’re afraid to return to their country, as they are required to do. Other agents refuse to believe them, per the report, which is based on immigrant testimony documented by the group. Another 2016 analysis, by the US Commission on International Religious Freedom, a government advisory body, noted, “outright skepticism, if not hostility, toward asylum claims” by certain officers, among other practices that may be resulting in deportations of refugees with a legitimate right to stay.

A US Customs and Border Protection (CBP) spokesman said the agency “strives to treat every person we encounter with dignity and respect.” Anyone with concerns about the treatment doled out by its officers can call the agency, he added.”

“The Obama administration’s response has already run up against the law. For example, several courts have shot down the government’s arguments and efforts to justify the detention of children and families while their cases wait to be resolved—a policy meant to convince would-be immigrants to stay home.

On Jan. 13, a coalition of immigrant rights groups filed a formal complaint with the Department of Homeland Security’s Office for Civil Rights and Civil Liberties accusing CBP officers of turning back people requesting asylum at ports of entry along the US-Mexico border. In what the groups called an “alarming new trend,” the officers have allegedly been telling immigrants that they can’t enter the country without a visa— contrary to US law—and referring them to Mexican immigration authorities.

Trump has framed his border policy as a choice between enforcing existing laws against illegal immigration or skirting them. But the decision facing US leaders is rather more complicated: Should the US continue providing refuge to those who are unfairly persecuted in their home countries?

If Americans are unwilling to do that, perhaps it’s time to do away with the nation’s asylum laws—and remove the famous poem at the base of the Statue of Liberty welcoming the world’s “huddled masses yearning to breathe free.”

Recently retired immigration judge Paul Wickham Schmidt put it this way: “We like to advertise ourselves as a beacon of liberty and justice; it’s time we acted that way.”

In my view, Ana Campoy provides a remarkably clear and well-documented analysis of why the Obama Administration’s “get tough” border policies have failed, and why the Trump Administration would be wise to take a more “nuanced” approach that recognizes our obligation to provide due process and protection under our laws to individuals fleeing from the Northern Triangle.

As incoming DHS Secretary Gen. John Kelly has recognized, this problem can’t be solved just by (even more) enhanced enforcement on our end.  It will require addressing the systemic problems in the sending countries of the Northern Triangle, which certainly have most of the characteristics of “failed states,” as well as working with other stable democratic nations in the Americas to fashion meaningful protections, inside or outside the asylum system, for those who are likely to face torture, death, or other types of clear human rights abuses if returned to the Northern Triangle at present.

It’s not an easy problem to solve, and there are no “silver bullets.”  But, we know what doesn’t work.  So, it sure seems like it would be a good idea to try  different approaches (and I don’t mean repealing asylum protections as Ana, somewhat facetiously suggests near the end of her article).

Washington Post: U.S. & Mexican Officials Allegedly Flout U.S. Asylum Law (And International Treaties) At Southern Border!

“I am fleeing my country,” the policeman later recalled telling the guards, explaining that he had survived two attempts on his life. “I am being persecuted in a matter of life and death.”

The policeman said he was told he needed to see Mexican immigration authorities, who would put him on a waiting list to make his case to U.S. officials. But Mexican authorities refused to add him to the list, the policeman said, and he has been stuck in northern Mexico.

The Guatemalan is one of hundreds or perhaps thousands of foreigners who have been blocked in recent months from reaching U.S. asylum officials along the border, according to accounts from migrants and immigration lawyers and advocates.

The details of their cases vary. At the U.S. border crossing between Tijuana and San Diego, numerous asylum seekers from Central America and Mexico have been referred to Mexican authorities for an appointment with U.S. officials — but Mexican authorities often turn them down, according to migrants and immigration lawyers. In other places, migrants have been told by U.S. border agents that the daily quota for asylum cases has been reached or that a visa is required for asylum seekers, a statement that runs contrary to law, immigration advocates say.”

The law is very clear: “Any alien who is physically present in the United States or who arrives in the United States (whether or not at a designated port of arrival and including an alien who is brought to the United States after having been interdicted in international or United States waters), irrespective of such alien’s status, may apply for asylum . . . .”   8 U.S.C. 1158(a).

Also, without getting too much into the particular facts, it appears that the former Guatemalan policeman described in the quote above could have a strong case for asylum under the BIA’s long-standing precedent decision Matter of Fuentes, 19 I&N Dec. 658 (BIA 1988), finding that “former policeman” could potentially be a “particular social group” for asylum purposes.

Part of the problem here is that the U.S. does not have a meaningful “overseas refugee program” for the Northern Triangle. If the present, quite restrictive, program were expanded in both numbers and scope, and if the processing were more timely, more people would probably apply and be screened abroad, rather than coming directly to the border to apply.  The U.S. could actually do Northern Triangle refugee processing in Mexico.

Additionally, the U.S. could encourage the Mexican Government to establish a program of temporary protection, similar to our “Temporary Protected Status,” so that individuals from the Northern Triangle who faced death or danger upon return could remain in Mexico even if the did not satisfy all of the technical requirements for refugee status.

Moreover, like the U.S., Mexico is a signatory to the U.N. Convention and Protocol on Refugees, but apparently has not done a particularly effective job of carrying it out.  Why not work with the Mexican Government not just on law enforcement initiatives, but also on training adjudicators to provide fair hearings to individuals seeking protection under the Convention?

It might also be possible to work with other “stable” democratic governments in the Americas to share the distribution of those from the Northern Triangle who need protection.

Last, but certainly not least, as the incoming Secretary of Homeland Security, Gen. John Kelly, has suggested, it is important for a more permanent solution to work with governments in the Northern Triangle to provide stability and the rule of law in those “sending countries.”

We know that just throwing more money, personnel, walls, sensors, helicopters, detention centers, moats, etc. at the problem won’t effectively address the continuing flow of “desperate people fleeing  desperate circumstances.”  And, as our law provides, whether they come to our borders and turn themselves in or enter, legally or illegally, they actually have a right to seek asylum in the United States.

Isn’t it time to try some “smart strategies,” rather than just doubling down on the same old “enforcement only” approaches that have failed in the past and will continue to do so in the future?

WSJ Editorial: Keep DACA, Can DAPA — Half Right Is Better Than All Wrong — But, Why Not Do The “Smart” Thing And Keep Them Both?

“Donald Trump will have a busy first day repealing President Obama’s executive orders, and here’s a suggestion to lighten the work load and win some goodwill in the bargain: Don’t revoke the Deferred Action for Childhood Arrivals immigration order.

DACA is the 2012 order granting temporary safe harbor for illegal immigrants who arrived as minors with their parents. That order is distinct from the 2014 Deferred Action for Parents of Americans (DAPA) order, which exempts from deportation some four million illegal immigrants.

Mr. Trump should repeal DAPA, a sweeping usurpation of Congress’s power to write immigration laws. The Fifth Circuit Court of Appeals blocked DAPA at the request of 26 states, and the Supreme Court voted 4-4 to uphold the injunction. DAPA was among Mr. Obama’s most cynical executive actions, at once poisoning the chances for serious immigration reform while trying to pit minorities against Republicans for political purposes.

DACA is also an executive action, but its repeal now would harm innocent men and women. The order is limited to children brought illegally to the U.S. before the age of 16 who are attending school or have graduated, and who have continuously resided in the U.S. since at least 2007. About 741,000 immigrants have applied for DACA’s reprieve, which lets them obtain work permits that must be renewed after two years for a nontrivial fee of $465.

DACA applicants must undergo background checks, and they cannot have a felony or serious misdemeanor record. They can’t collect federal benefits or vote. DACA essentially offers the right to work and pay taxes in the U.S., and many applicants have served in the military. If DACA is repealed, Homeland Security’s tracking will end as tens of thousands slip into the shadows to avoid deportation to “home” countries where they are strangers.

The Fifth Circuit dismissed a legal challenge to DACA by Kansas Secretary of State Kris Kobach for lack of standing. We’d prefer if Congress codified DACA, and a bipartisan coalition of Senators wants to do so. This could be included if legislation moves this year to tighten immigration enforcement.

The main issue is fairness, as Mr. Trump has recognized. He told Time magazine in December that these young illegals were “brought here at a very young age. They’ve worked here, they’ve gone to school here.” He added that “they’re in never-never land because they don’t know what’s going to happen” and “on a humanitarian basis, it’s a very tough situation.” He’s right, which is why we hope he’s willing to forbear on DACA while a legislative solution can be worked out.

No one doubts Mr. Trump’s resolve to reduce illegal immigration, and repealing DAPA would honor that campaign promise. But minors brought to the U.S. illegally aren’t responsible for that decision. Giving them a deportation reprieve would show that Mr. Trump’s immigration policy is aimed at enforcing the law, not at punishing minorities or any ethnic group. We can’t think of another early decision that would send a comparable message of inclusion and largeness of presidential spirit.”

I agree on DACA, disagree on DAPA.  The reasons for going forward and implementing the DAPA program are almost as strong as for retaining DACA.

DAPA’s proposed beneficiaries — parents of U.S. citizens and green card holders — probably aren’t going to be removed anyway under the DHS priorities as initially described by soon to be DHS Secretary Gen. John Kelly.  They need to be taken off overcrowded Immigration Court dockets if the Trump Administration wants to pursue its version of “criminal removal” as a priority (although I note that this is essentially the same priority as the Obama Administration had).  Instead of just leaving the DAPA folks “in limbo,” why not get them registered, documented, checked for criminal record, working legally, and make it easier for them to pay taxes, without handing out green cards or any other type of permanent status?  It would be good for America.
