“President Trump was asked at his recent press conference with Prime Minister Trudeau if he is confident that America’s northern border is secure. He replied, “Can never be totally confident.”

According to the U.S. Geological Survey, the length of the International Boundary line on the U.S.-Canadian border, excluding Alaska, is approximately 3,987 miles (land and water). The length of the Alaska-Canada border adds 1,538 miles, making the total length of the U.S. border with Canada 5,525 miles. This is almost three times the length of the U.S.-Mexican border, which is only 1,933 miles (land and water).

Yet, according to Dean Mandel, a Border Patrol Agent who testified at a Senate Hearing, in February of 2016, of the 21,000 Agents in the Border Patrol, only 2,100 were assigned to the Northern border.

On the Southern border, we had one Agent for every linear mile, and they were made more effective by the entire infrastructure of fencing, cameras, air support, and sensors. On the Northern border, we only had one agent for every 13.5 miles and they had much less of this infrastructure.

Moreover, it will not be long before many of the 40,081 Syrian refugees are eligible for Canadian citizenship, and Canadian citizens do not have to have visas to enter the United States.

The United States government has paid much less attention to securing the Canadian border than it has to securing the border with Mexico. Canada’s acceptance of more than 40,000 Syrian refugees could be a catalyst to changing that policy.”

“Homeland Security Secretary John F. Kelly has signed sweeping new guidelines that empower federal authorities to more aggressively detain and deport illegal immigrants inside the United States and at the border.

In a pair of memos, Kelly offered more detail on plans for the agency to hire thousands of additional enforcement agents, expand the pool of immigrants who are prioritized for removal, speed up deportation hearings and enlist local law enforcement to help make arrests.

The new directives would supersede nearly all of those issued under previous administrations, Kelly said, including measures from President Barack Obama aimed at focusing deportations exclusively on hardened criminals and those with terrorist ties.

The memos don’t overturn one important directive from the Obama administration: a program called Deferred Action for Childhood Arrivals that has provided work permits to more than 750,000 immigrants who came to the country illegally as children.”

Looks like everything is a “priority,” almost everyone will be detained, and DHS Assistant Chief Counsel won’t be offering PD or other negotiated “deals” except in extraordinary situations.

It’s not even clear from this whether the ACCs will still have authority to “waive appeal” in cases where the DHS loses. If not, that means that the BIA could also be overwhelmed with marginal DHS appeals.

While one of the memos notes the 534,000 Immigration Court backlog, there is a total disconnect in putting all these new priorities into Immigration Court without any plan for dealing with the 534,000 already there. (Most folks already here arrived at least two years ago, so even the greater use of expedited removal will leave hundreds of thousands of potential new filings for the Immigration Courts.)

When everything is a priority, nothing is a priority! Looks to me like another ill-conceived, “built to fail,” scheme.  Over time, these plans are likely to be taken apart by the Article III Courts, bit by bit, piece by piece, until we have total chaos in the immigration enforcement system. Haste makes waste.

DHS Officers Cheer President Trump’s Enforcement Initiatives!

“WASHINGTON ― When Donald Trump won the presidency in November, Shawn Moran’s border patrol colleagues high-fived and hugged each other.

“There was a real sense that we were going to be able to do our jobs again,” said Moran, vice president at National Border Patrol Council. “That turned out to be true.”

Border Patrol and Immigrations and Customs Enforcement agents complained for years that then-President Barack Obama constrained their ability to fulfill their mission. Trump campaigned on a promise that he would unleash them — and vowed to make large-scale deportation of undocumented immigrants a priority. This won Trump the endorsement of Moran’s group, which represents Border Patrol agents, and the National ICE Council, a union that represents ICE officers.

Now, Moran said, the president is keeping his promise. Immigrant rights advocates, who were horrified at a multi-state deportation effort that swept up more than 680 people last week, agreed.”

Pursuant to Federal Rule of Civil Procedure 65, the Court orders that:

a) respondents shall permit lawyers access to all legal permanent residents being detained at Dulles International Airport;

b) respondents are forbidden from removing petitioners—lawful permanent residents at Dulles International Airport—for a period of 7 days from the issuance of this Order.

Seems pretty straightforward.  Lawful permanent residents (“green card holders”) returning from abroad are entitled to full Removal Hearings before a U.S. Immigration Judge at which the DHS bears the burden of establishing removability by clear and convincing evidence.  They are also entitled to representation by counsel of their own choosing (at no expense to the Government) in such a hearing.  Therefore, it’s hard to understand the the basis for the apparent DHS claim that they could detain and remove a returning green card holder without a hearing and without allowing him or her access to a lawyer.  But, I’ve read and heard reports from local attorneys saying that DHS CBP officials at Dulles International Airport have been slow to comply or resisted complying with Judge Brinkema’s very clear order.

I’ve never personally met Judge Brinkema, who sits in the U.S. District Court a few blocks from our home in Alexandria. But, I’m familiar with her work. Occasionally, one of my custody/bond decisions from the Arlington Immigration Court ended up before her for judicial review by habeas corpus. Sometimes she upheld my decision, sometimes not.

On several occasions, she ordered me to conduct immediate individualized custody hearings for detained individuals notwithstanding BIA precedent to the contrary. I always complied immediately, just as she had ordered. The DHS Arlington Chief Counsel also got on board. Judge Brinkema wasn’t someone you wanted to “mess around with.”

Unlike U.S. Immigration Judges, who were given statutory contempt of court powers by the Congress, only to have that authority withheld by the U.S. Dept. of Justice over three Administrations, Democratic and Republican, Judge Brinkema has authority to hold individuals, including U.S. Government officials, in contempt of court for disobeying her orders. And, I never had the impression that she would be reluctant to do that when necessary.

Additionally, failure to comply with court orders can result in large attorney fee awards against the Government under the Equal Access to Justice Act. If the reports of non-compliance are true, it seems that DHS and their lawyers are “playing with fire” here.

Remember guys, this isn’t Immigration Court. Article III Judges have life tenure, and they don’t work for the President. He’s just another party to them.
