“Trump’s appearance with the senators came as the White House moved to elevate immigration back to the political forefront after the president suffered a major defeat when the Senate narrowly rejected his push to repeal the Affordable Care Act. The president made a speech last Friday on Long Island in which he pushed Congress to devote more resources to fighting illegal immigration, including transnational gangs.

The event on Wednesday illustrated the president’s efforts to broaden his push to reform border control laws beyond illegal immigration. Trump called the changes to legal immigration necessary to protect American workers, including racial minorities, from rising competition for lower-paid jobs.

“Among those who have been hit hardest in recent years are immigrants and minority workers competing for jobs against brand new arrivals,” Trump said. “It has not been fair to our people, our citizens and our workers.”

But the bill’s prospects are dim in the Senate, where Republicans hold a narrow majority and would have difficulty getting 60 votes to prevent a filibuster. The legislation is expected to face fierce resistance from congressional Democrats and immigrant rights groups and opposition from business leaders and some moderate Republicans in states with large immigrant populations.

Opponents of slashing immigration levels said immigrants help boost the economy and that studies have shown they commit crimes at lower levels than do native-born Americans.

“This is just a fundamental restructuring of our immigration system which has huge implications for the future,” said Kevin Appleby, the senior director of international migration policy for the Center for Migration Studies. “This is part of a broader strategy by this administration to rid the country of low-skilled immigrants they don’t favor in favor of immigrants in their image.”

Other critics said the Raise Act, which maintains the annual cap for employment-based green cards at the current level of 140,000, would not increase skilled immigration and could make it more difficult for employers to hire the workers they need. And they noted that Canada and Australia admit more than twice the number of immigrants to their countries as the United States does currently when judged as a percentage of their overall population levels.

“Just because you have a PhD doesn’t mean you’re necessarily more valuable to the U.S. economy,” said Stuart Anderson, executive director of the National Foundation for American Policy. “The best indication of whether a person is employable is if someone wants to hire them.”

Alex Nowrasteh, an immigration policy analyst at the CATO Institute, wrote in a blog that the bill “would do nothing to boost skilled immigration and it will only increase the proportion of employment-based green cards by cutting other green cards. Saying otherwise is grossly deceptive marketing.”

Groups that favor stricter immigration policies hailed the legislation as a step in the right direction. Roy Beck, president of NumbersUSA, said the Raise Act “will do more than any other action to fulfill President Trump’s promises as a candidate to create an immigration system that puts the interests of American workers first.”

TRUMP ADMINISTRATION’S WAR ON AMERICA — Proposals To Restrict Student Visas & Reduce Legal Immigration Will Hurt Economy, National Standing

These articles from today’s Washington Post highlight three “gonzo” immigration proposals driven by the Trump Administration’s white nationalist agenda.

First, the proposal to require nonimmigrant students in the U.S. to apply for annual extensions of stay would roll back the “duration of status program” for students — arguably the single best and most mutually beneficial efficiency move in the history of INS/USCIS. It would also create chaos in student visa programs that not only keep many colleges and universities financially viable, but also fuel American innovation and technological advances in the STEM fields.

Second, proposals to make visa issuance a law enforcement function within the DHS would lead to chaos in the visa issuing program and probably will result in retaliation by other friendly nations. Visas are part of the foreign commerce of the U.S., not a domestic law enforcement program.

Finally, proposals to reduce legal immigration and further restrict legal opportunities for unskilled workers would deprive the U.S. of workers at a time when the growing economy needs them the most. This short-sighted policy would likely lead to the same type of economic stagnation that has plagued EU countries and Japan over the past several decades.

“Today is World Refugee Day, a day to commemorate the strength, perseverance, and courage of displaced people around the world. Over 65 million people worldwide are forcibly displaced from their homes, the highest number since World War II. Turkey alone has accepted nearly 3 millionrefugees from Syria.

In our current political climate, some consider refugees a security threat and a drain on national resources. But America benefits economically, socially, and morally by accepting more refugees.

A new study by the National Bureau of Economic Research shows that after six years in the United States, refugees work at higher rates than citizens. A similar 2016 study by the Tent Foundationfound that refugees fill gaps in the labor market, work harder to learn skills and languages than economic migrants, and have a “dynamic” impact on growth.

The myth that refugees drain a nation’s economic resources is false. Yes, refugees initially require a substantial resettlement cost (approximately $15,000), and often initially need welfare services. However, after eight years in the United States, refugees receive welfare at the same rate as U.S. citizens with similar education and language skills. Over a 20-year period, refugees in the U.S. pay an average of $21,000 more in taxes than the initial cost of resettling them. In fact, a study by Texas A&M professor Kalena Cortes shows that over time, refugees tend to out-earn other immigrants and add more value to the economy than the initial cost of resettling them. For example, Vietnamese-Americans, many of whom arrived as refugees, tend to be more financially stable and more employed than the average American, and therefore less likely to need welfare benefits.

Refugees play a key role in creating new jobs and raising overall wages. This is in part because they are more likely than other groups to open small businesses, creating new jobs rather than taking old ones. For example, refugees were a major factor in stabilizing the economy of Utica, NY, because they filled important gaps in the labor force and created greater economic demand for goods.Even when refugees do low-skilled work, they do not displace American workers. A study by scientists at the University of California, Davis and the University of Copenhagen found that an influx of low-wage immigrant labor tends to raise wages for everyone.

Refugees also contribute tremendously to innovation and growth. Examples of famous refugees or children of refugees who have advanced U.S. culture and knowledge include Marc Chagall, Gloria Estefan, Madeleine Albright, Henry Kissinger, Enrico Fermi, Steve Jobs, and Albert Einstein.

That history is in jeopardy. President Trump issued an executive order in March slashing refugee admissions from 110,000 to 50,000 this year and temporarily suspends all refugee admissions. That order, which federal courts have temporarily blocked, insults our history and our legacy. We have a precedent of being welcoming and gracious. That precedent is not just rooted in altruism; accepting refugees is good for America. It’s time to step up and embrace our history of welcoming people fleeing persecution around the world. As a country, we have an economic and moral imperative to be what we once promised we would be: a refuge for the world’s huddled masses, yearning to breathe free.”

Sorry, Steve & Aaron. Truth, values, morality, and simple human decency play no role in this debate. Refugees are foreigners, many with different religions, other cultures, other languages, and non-white skins (we wouldn’t seriously be having this debate if all refugees were white, English speaking, Christians from, say, Australia, Canada, the UK, and New Zealand). So in the world of Trump, his Xenophobic (and sometimes also racist) followers, and their GOP “fellow travelers” that’s all you need to know.

It’s not really about making America Great or keeping us safe; it’s about building political power by stoking xenophobia and unjustified resentment. And, the target is by no means just refugees and other migrants. No, it’s also about ginning up resentment against American citizens of Hispanic, Black, Arabic, and to some extent Asian American descent. Not coincidentally, these ethnic groups often are thought to vote more for Democrats than the GOP.

“Philosophy majors spend their college years pondering deep questions, such as: What is the meaning of life? Do we have free will? And what job am I going to get with this degree after graduation?

It turns out the last question isn’t hard to answer: Just about anything.

The idea that philosophy majors aren’t prepared for professional careers “is a little bit of a myth, to be honest,” said Thomas Holden, chair of the philosophy department at the University of California at Santa Barbara. “Philosophy is not about sages sitting on mountaintops speculating about the cosmos.”

Graduates in philosophy inhabit Wall Street corner offices, roam the oak-paneled halls of the Supreme Court and reign over boardrooms in Silicon Valley.

Interest in the major has risen steadily in the past three decades. Although totals have dipped slightly in recent years, federal education data shows the number of students who received bachelor’s degrees in philosophy has doubled since 1987, peaking at 7,926 graduates in 2013.”

Gee whiz! Who would ever have thought that teaching sound reasoning, critical analysis, effective argument, skillful defense of ideas, and creative problem solving skills could be useful in the “real” world? Certainly not the many politicos and supposed educational and business wonks who trash the liberal arts and glorify “trade school” education for everyone.

The world is a rapidly changing place.  And, folks who learn how to think, solve problems, and maintain a big picture perspective usually have the flexibility to “reinvent” themselves as necessary, even as their technical knowledge and skills become outdated or obsolete. And, intellectual curiosity and engagement are things that help outside the workplace or when things at work get rough. Critical thinking and creative problem solving are just as important for good mechanics, carpenters, plumbers, and brick masons as they are for chief execs, scientists, doctors, and lawyers.

Yesterday, I dropped by to see my good friend and colleague (and contributor to immigrationcourtside.com, http://immigrationcourtside.com/2017/06/19/the-hill-professor-andy-schoenholtz-of-georgetown-law-on-why-americans-should-be-grateful-to-the-9th-circuit-for-upholding-the-rule-of-law-against-executive-overreach/)  at Georgetown Law, Professor Andy Schoenholtz. I caught him “red-handed” perusing a tome of Immanuel Kant. He tried to cover up by claiming that he was just “cleaning out his bookcase.” But, of course, we know the truth (to the extent, of course, that absolute truth can ever be “known’).

No wonder Schoenholtz has accomplished so much in the real world as well as the academic world!

“President Trump’s proposal to shift towards a “merit-based” immigration system would upend an approach that has existed for half a century.

Since the 1960s, the United States’ immigration system has largely based entry on family ties, giving preference to those with relatives who are citizens. But in his first address to a joint session of Congress in February, Donald Trump proposed moving away from that policy, focusing instead on an immigration system that would prioritize high-skilled immigrants.

Trump and his advisors have argued that the current levels of immigration harm American workers by lowering wages and preventing assimilation. A merit-based system, restrictionist advocates believe, would help lower immigration rates and ensure that the immigrants who do come are high-skilled workers who never need public assistance. “The current, outdated system depresses wages for our poorest workers, and puts great pressure on taxpayers,” Trump said in his speech to Congress.

While the president has yet to offer details, a merit-based system would pose its own challenges to economic prosperity. Critics believe that  a merit-based system that prioritizes high-skilled workers could hurt the economy by harming industries that rely on low-skill immigrant labor, and that fears that immigrants are not assimilating or are overly reliant on the social safety net are overblown.

The first example of the U.S. establishing qualifications for new immigrants was in 1917, when the government imposed a literacy test on those seeking to enter the country. In the 1960s, Congress lifted restrictions that heavily curtailed immigration from non-European nations, and reshaped the immigration system toward prioritizing admission of close relatives of immigrants already living in the United States. The overwhelming majority of immigrants are now admitted through that family-preference system, which significantly changed the ethnic composition of U.S. immigrant population by admitting more Latin American and Asian immigrants.

In 2015, for example, of the more than one million legal permanent residents admitted, “44 percent were immediate relatives of U.S. citizens, [and] 20 percent entered through a family-sponsored preference,” according to the Migration Policy Institute, a nonpartisan think tank. Only 14 percent of those admitted came through a job-based preference. The “merit-based” immigration system, in theory, would increase the latter figure, as it would prioritize those who are highly educated and therefore considered more employable.

Such a policy would likely limit the supply of low-skilled workers, and might allow the administration to filter which immigrants it chooses to admit. And a merit-based immigration system could also help realize a longtime conservative policy goal—a reduction in the number of immigrants admitted overall.

Some Republican lawmakers have already pushed for legislation that would limit legal immigration. Last month, Republican Senators Tom Cotton and David Perdue introduced legislation that would cut the number of immigrants legally admitted to the United States in half. It would do so in part by limiting the number of family members immigrants can sponsor for citizenship, a policy long sought by immigration restrictionist groups.

Dan Stein, the president of the Federation for American Immigration Reform, which supports curtailing immigration, said a merit-based approach could reduce the flow of immigrants coming into the United States. “The merit-system is also a surrogate for moving away from a system that the country doesn’t really get to control and regulate how many come in every year and who they are because of chain migration, the family-preference system,” Stein said, adding that a points system would be one part of the whole.

Nevertheless, assessing “merit” is difficult. A system that deliberately excluded low-skilled workers might raise labor costs in industries that rely on those workers, increasing prices for consumers but boosting wages for workers.”

“WASHINGTON—President Donald Trump has suggested he might find a way to cut the number of coveted H-1B visas awarded to outsourcing firms. But the companies appear to be heading in that direction all on their own, amid technological changes.

Outsourcers’ use of H-1B visas, which are reserved for highly skilled foreign workers, fell last year, before Mr. Trump won the Republican presidential nomination, new data show. The slide occurred alongside increasing criticism of the firms’ business model.

Mr. Trump has criticized the lottery that is now used, where companies all have equal chances at the scarce visas, and signed an executive order directing a review of the program. The order called for changes that would ensure visas are awarded to “the most skilled and the highest paid” applicants, to avoid crowding out American workers.

Six of the seven prominent Indian-based outsourcing companies that do work in the U.S. received fewer H-1B visas in 2016 than they did in 2015, and as a group their numbers dropped 37%, according to a new analysis by the National Foundation for American Policy, a think tank that backs increasing the total number of H-1B visas available. Most outsourcers based in the U.S. and elsewhere also saw declines.

For instance, H-1B visas awarded to India’s biggest outsourcer by revenue, Tata Consultancy Services Ltd., plummeted by 56% to 2,040 last year from 4,674 in 2015. For Wipro Ltd, another major Indian firm, the number also dropped by more than half to 1,474 from 3,079 in 2015.

Other research from previous years shows that the use of H-1Bs by individual outsourcing companies peaked in 2012 and 2013, sliding ever since. Many expect that the number of visas given to outsourcers will decline again for 2017, but those numbers aren’t yet available.

Meanwhile, the number of visas awarded to some large U.S. technology firms, who have a different business model and compete with outsourcers for visas, increased last year. Amazon.com Inc., Microsoft Corp., Alphabet Inc.’s Google and Apple Inc. all received more visas than they did in 2015, the new data show. Such companies typically use the visas to recruit employees with rare skills that attract higher wages than staff employed by outsourcers, and have come under less criticism.

Each year, 85,000 H-1B visas are available, and for the last several years they have been awarded by lottery conducted in April because of overwhelming demand.

Following this year’s lottery, Mr. Trump criticized the process and suggested more visas should go to high-paid jobs as opposed to a lottery where each application has equal chance. Because many outsourcing jobs are paid the minimum required to comply with certain rules—around $60,000 a year—many interpreted Mr. Trump’s comments as a warning to the outsourcers and a possible boon to big tech companies that pay high salaries.”

They say US companies must be required to document their searches to fill positions with American workers. Employers must pay prevailing wages and be prevented from subcontracting or outsourcing H-1B jobs.
Reform advocates are pushing for a system of government enforcement and oversight of the H-1B regulations, not one that is reliant on whistleblowers to expose abuse.
Technology is here to stay. And it is changing at warp speed. The demand for smart talent is not going away. That’s why even the biggest critics of H-1B are the most ardent backers of reform, not elimination.
What I hear them saying is the system ought to work the way it used to, when my father obtained an H-1 visa. He was hired for a job he was uniquely qualified for, and he was compensated with a decent wage.
No one wants to see Americans lose their jobs unfairly, and if my father were still alive, I know he’d be troubled by what I learned about the current H-1B program.
I also know he would be heartened to see that some of the most ardent backers of visa reform are Indian Americans. After all, we are the ones who have most reaped the rewards of H-1B.”

Several thoughts. I was very critical, and still am, of House Immigration Subcommittee GOP Members for starting off with controversial, “in your face,” and unneeded enforcement-only bills. See http://wp.me/p8eeJm-Qw
Why not instead start with something bipartisan that would be good for America, like H-1B reform. Chairman Grassley in the Senate has expressed strong interest in reforming the H-1B category to eliminate abuses. And, it appears that most major U.S. employers who use H-1Bs also see the need for reform to preserve and improve the program.
Additionally, things like investment visa “EB-5” reform also appear likely to attract support from both sides of the aisle in both houses.
A second thought, why don’t U.S. companies, particularly those started or run by immigrants, which use H-1Bs start the reforms now. “Reverse” the process. Use highly talented H-1B workers to train U.S. workers, particularly in places where the economic rebound has not yet reached, for whatever reason.
For example, in a recent blog dealt with the situation in the small city of Gillette, WY. http://wp.me/p8eeJm-UY  The folks seemed nice, optimistic, and interested in a brighter future for their community. But, with or without Trump and his environment-busting policies, coal mining as a way of life is on the way out. I can’t imagine that too many of the younger generation are hanging around places like Gillette.
Why not go in and establish some tech centers using H-1Bs as trainers. Sure, working on a computer in an office isn’t everyone’s cup of tea. I get that. But, it is something that can be done from anywhere.
And, the costs of doing business, at least initially, are likely to be less in a place like Gillette. Increased economic activity brings with it other needs: buildings, houses, markets, auto dealers, repair shops, HVAC technicians, public servants, schools, teachers, etc. So, there could be something for everyone, even those who don’t want to work at a desk all day.
Maybe, it’s time for those who want immigration reform to stop talking and whining and start doing. Things that demonstrably work and help folks out build their own bases of support. That’s better than trying to convince folks with statistics and pie charts!
