and inability was compounded when the BIA discounted country condition reports which, when combined with Rosales’s testimony about the particular circumstances of his case, were sufficient to support the IJ’s finding that the police in Guerrero would be unable to protect Rosales from persecution by organized crime.

The BIA committed further error by concluding that the IJ’s finding that Rosales did not report threats by organized crime to the police refuted the IJ’s ultimate finding of inability. The BIA both ignored our precedent stating that a failure to report a crime does not undermine an assertion of inability if a report would have been futile, and failed to consider evidence in the record that would support a finding of futility, thereby misapplying the clear error standard. Moreover, in another misapplication of the clear error standard, the BIA incorrectly concluded that the IJ’s inability finding was clearly erroneous because the Mexican government’s failure to protect Rosales was indistinguishable from the struggles of any government to combat crime, when the record before the IJ supported a finding that it was distinguishable.

Because of these errors, we grant Rosales’s petition and remand to the BIA for further proceedings consistent with this opinion. See I.N.S. v. Ventura, 537 U.S. 12, 16-17 (2002) (per curiam) (holding that remand to the BIA is generally the appropriate remedy when the BIA commits a legal error).

So ordered.

  • Nice to see a Circuit Court, particularly a fairly conservative one like the First Circuit, take strong stand against the nonsense and mockery of Due Process and justice going on at EOIR under Sessions;
  • Expect more of these in the future as the “Just Find A Way To Deny & Deport” initiative by the xenophobic, scofflaw AG goes into high gear at EOIR;
  • Quite contrary to everything Sessions has been saying, which completely ignores the lessons of the Supreme Court’s decision in INS v. Cardoza Fonseca, asylum law is supposed to be interpreted and applied generously in favor of those seeking life saving protection;
  • This case illustrates the importance of dissent at the BIA, as the First Circuit basically adopted the correct interpretation of the law and facts set forth by a dissenting (female) BIA Appellate Immigration Judge;
  • This also shows the importance of full three-judge review by the BIA on asylum cases, rather than single judge panels or summary denials;
  • The number of fundamental errors committed by the BIA panel majority in reversing this asylum grant and the persistence of the DOJ in advancing untenable legal positions before the Court of Appeals is simply appalling, even if consistent with Session’s own lack of scholarship and total disrespect for fundamental fairness to respondents in Immigration Court;
  • This case also highlights a chronic problem in EOIR asylum adjudication: conflating “willingness to protect” with “ability to protect.”  Too many Immigration Judges and BIA Appellate Judges seize on ineffective efforts by local police, cosmetic improvements by governments, and failure to seek (largely useless and perhaps actually harmful) police assistance to find that there has been “no failure of state protection;”
  • That’s exactly what Sessions himself did in his fundamentally flawed opinion in Matter of A-B-. He encouraged judges to conflate ineffective efforts to protect with actual ability to protect. And, his comparison of how domestic violence is policed and prosecuted in the United States with El Salvador’s pathetic efforts in behalf of domestic violence victims was simply preposterous;
  • This decision also addresses another chronic problem at EOIR: judges “cherry picking” the record and particularly Department of State Country Reports for the information supporting a denial, even though the record taken as a whole  lends support to the respondent’s claim;
  • Once again, how would any unrepresented applicant make the kind of potentially winning asylum case presented by this respondent with the assistance of counsel? When are Courts of Appeals finally going to state the obvious: proceeding to adjudicate an asylum claim by an unrepresented respondent is a per se denial of Due Process!
  • This case should be taken as a message that Immigration Judges and BIA panels following the misguided Sessions’ dicta on “unwilling or unable to protect,” rather than applying the correct standards set forth by most Circuits are going to be getting lots of “do overs” from the Circuit Courts;
  • How could anybody justify “speeding up” a system with this many fundamental (and life-threatening) flaws to begin with? Under Sessions, EOIR is on track to becomes veritable “reversible error factory” — as well as a “Death Railroad!”

The Department of Justice, under Attorney General Jeff Sessions, is drafting a plan that would totally overhaul asylum policy in the United States.

Under the plan, people would be barred from getting asylum if they came into the US between ports of entry and were prosecuted for illegal entry. It would also add presumptions that would make it extremely difficult for Central Americans to qualify for asylum, and codify — in an even more restrictive form — an opinion written by Sessions in June that attempted to restrict asylum for victims of domestic and gang violence.

Vox has confirmed that the regulation is in the process of being evaluated, and has seen a copy of a draft of the regulation.

When the regulation is ready, it will be published in the Federal Register as a notice of proposed rulemaking, with 90 days for the public to comment before it’s enacted as a final regulation.

The version Vox saw may change before it’s finalized, or even before the proposal is published in the Federal Register. (The Department of Justice declined to comment.)

But as it exists now, the proposal is a sweeping and thorough revamp of asylum — tightening the screws throughout the asylum process.

One source familiar with the asylum process but not authorized to speak on the record described the proposed changes as “the most severe restrictions on asylum since at least 1965” — when the law that created the current legal immigration system was passed — and “possibly even further back.”

The Immigration and Nationality Act gives the attorney general, along with the Department of Homeland Security, discretion over asylum standards — saying that the government “may grant asylum” to an applicant who they determine meets the definition of a refugee. But the proposed regulation would make it nearly impossible for Central Americans, including families, to earn the government’s approval.

It would eliminate the path that thousands of Central Americans, including families, take every month to seek asylum in the US: entering between ports of entry and presenting themselves to Border Patrol agents. It would make it all but impossible for victims of domestic or gang violence to qualify for asylum — going even further than a June decision from Sessions that sought to limit asylum access for those groups. It would create a presumption against Central Americans who travel through Mexico on their way to the US.

Anyone convicted of entering the US illegally would become ineligible for asylum

What happens under current policy: Under the Trump administration’s “zero tolerance” initiative, all migrants who cross between ports of entry and are apprehended by Border Patrol are supposed to be criminally prosecuted for illegal entry.

That arrest can delay a person’s claim of asylum, but it doesn’t derail it. An asylum-seeker may not get their initial screening interview, which determines whether they’ll be allowed to file an asylum application and get a hearing, until after they’ve been prosecuted and convicted. And they definitely won’t get approved for asylum before their criminal conviction.

But the conviction for illegal entry doesn’t affect the asylum claim; as Customs and Border Protection puts it, the two are on “parallel tracks.”

What would happen under the new plan: The proposed regulation would bar anyone from getting asylum if they’d been convicted of illegal entry or illegal reentry. That means people who asked for asylum when they were apprehended at the border, but were prosecuted first, would get denied asylum.

In effect, under this new regulation, combined with the zero-tolerance prosecution initiative, no one would be able to come to the US and get asylum unless they presented themselves at a port of entry. Many asylum-seekers simply don’t have that option. Smugglers often prevent asylum-seekers from using official ports of entry, and many of those who do come to ports of entry are being forced to wait days or weeks, after being told there’s no room to process them right now. And asylum-seekers who come to ports of entry are often required to stay in immigration detention without bond until their case is complete.

The administration would almost certainly get sued over this provision if it ended up included in the finalized regulation. The Department of Justice (DOJ) has the power to bar people from getting asylum (or other forms of relief from deportation) if they’ve committed “particularly serious crimes.” While there’s no definition of seriousness in the law, lawyers and immigration advocates would likely challenge the idea that illegal entry, a misdemeanor, is “particularly serious.”

But even if that provision is struck down or eliminated by the courts, another proposal in the draft regulation could have much the same effect. It would instruct immigration judges to consider how the asylum-seeker got into the US, and treat it as a significant factor in whether or not to grant asylum (since asylum-seekers have to show they deserve “favorable discretion” from the judge). So even if people who crossed between ports of entry weren’t officially banned from getting asylum, they would have a very hard time winning their cases in practice.

If adopted, the regulation, combined with the zero tolerance initiative, would allow the administration to set up assembly-line justice for asylum seekers, including families, entering the US. People who entered between official ports would be held by the Department of Homeland Security, prosecuted for illegal entry, convicted, then have their asylum applications denied and get deported.

While the Trump administration is currently trying to win the power to detain families for more than 20 days, if this regulation were enacted, they might not even need to. They could deny most asylum claims and deport the claimants within that time.

Victims of domestic or gang violence would be all but banned from asylum

What happens under current policy: US law limits asylum to people who are persecuted because of their race, religion, political opinions, nationality, or membership in a particular social group.

The government has been wrestling for decades with that last classification what exactly counts as a “particular social group”? — and with whether someone is “persecuted” if they’re victimized by someone other than the government. These questions are key to the fate of many of the Central Americans (including children and families) who have come to the US to seek asylum in recent years, many of whom are claiming asylum based on domestic violence or gang victimization in their home countries.

In June, with a sweeping ruling overturning a case from the Board of Immigration Appeals, Sessions attempted to narrow the circumstances in which someone fleeing domestic or gang violence could qualify for asylum in the US — saying that, generally, victims of domestic or gang violence wouldn’t be eligible for asylum based on their victimization.

As I reported last week, though, US Citizenship and Immigration Services (USCIS) has been cautious in implementing Sessions’s opinion. Most notably, while Sessions decreed that his ruling overturned any precedent that contradicted it, USCIS only told asylum officers to stop using the one precedent decision Sessions explicitly named as moot.

It looks like the DOJ may be trying to use regulation to accomplish the same goal — with even narrower definitions of “persecuted” and “particular social group.”

What would happen under the plan: The proposed regulation would add several restrictions to what could constitute a particular social group: a family, for example, wouldn’t be a social group unless the family had a visible national presence. Interpersonal violence or crime victimization, similarly, wouldn’t be the basis for social group membership unless they were happening on a national scale. Having been recruited by a gang would be explicitly prohibited as grounds for an asylum claim.

To qualify for asylum, an applicant would have to show that the people who persecuted her were also persecuting others on the same basis. Human-rights lawyers worry this could disqualify many legitimate asylum claims. One lawyer raises the example of a gay man in Russia who suffers a violent homophobic attack: Under the proposal, “this would not be persecution on account of sexual orientation unless you could prove that these attackers had previously persecuted other gay men.”

An asylum-seeker would be required to provide an exact definition of her “particular social group” when she was applying for asylum. And she wouldn’t be allowed to appeal a denial, or reopen a claim, on the basis of any group she hadn’t originally named.

It’s extremely difficult for anyone other than a trained immigration lawyer to know exactly what does and doesn’t count as a particular social group eligible for asylum. Under the proposed regulation, however, an asylum-seeker who didn’t know the precise nature of the basis for her persecution would be assumed to not really be a victim of persecution at all.

This standard wouldn’t just apply to final approvals or denials of asylum. The initial step for an asylee is what’s called a “credible fear” screening, during which an asylum officer decides whether the person has a credible fear of going back to their home country. The proposed rule would tighten standards for those, too.

Immigration lawyers and border advocates were already extremely concerned that Sessions’s May ruling would cause asylum officers to radically hike the standards for passing the screening interview (though the USCIS memo posted by Vox suggests that might not be the case just yet). If this regulation were finalized, however, it seems very possible that many people who are currently given the opportunity to apply for asylum would be turned away before they got the chance.

Central Americans would be penalized for not seeking asylum in Mexico

What happens under current policy: Many asylum seekers are Central Americans who come through Mexico to seek asylum in the US. The US is not allowed to simply turn them back and force them to seek asylum in Mexico instead. (The Trump administration is trying to get Mexico to sign a “safe third country” agreement that would allow them to do this, but Mexico appears unenthusiastic.) But the proposed regulation would make it a lot easier to deny their asylum claims based on not having sought asylum in Mexico first.

What would happen under the plan: Under the proposed rule, the government would generally withhold “favorable discretion” (and, therefore, deny the asylum claim) for anyone who had spent more than two weeks in another country en route to the US without seeking asylum there, or who had traveled through more than one country on the way to the US.

Many Central Americans, especially if they take the train through Mexico or travel on foot, take more than two weeks to travel through Mexico. And asylum-seekers from Honduras and El Salvador cross through Guatemala and Mexico to get to the US — meaning that they would almost certainly not earn the “favorable discretion” required to get their asylum claim approved.

Tightening the screws on the entire asylum process

The proposed regulation is extremely broad, with a lot more provisions — all of which would make it much harder for people to seek and get asylum. Some of the remaining ideas in the proposed draft include:

Limiting appeals for asylum-seekers who fail their screening interviews. Under current law, if an asylum-seeker fails her initial “credible fear” interview with an asylum officer, she can appeal for a judge to review her claim with fresh eyes — ignoring the fact that the asylum officer hadn’t found it a credible claim. Under the proposed regulation, judges would only be able to approve a credible-fear claim on appeal if there was clear evidence that the asylum officer had screwed up.

Rejecting incomplete applications first and letting them get completed later. Instead of returning incomplete asylum applications to the applicant and asking her to complete it, the government would reject the application. The applicant would still have 60 days to complete and resubmit the application before it was officially denied, but it’s not clear how applicants would be told about that — or whether they’d read beyond the word “rejected.”

Allowing judges to put evidence into the record on their own. The proposal would allow immigration judges considering asylum cases to unilaterally insert any information from credible sources into the record (as long as both the prosecutor and defense were informed). This provision would make it much easier for judges to insert information claiming that an asylum-seeker’s home country isn’t as dangerous for him as he claims — since asylum cases often hinge on whether there’s anywhere safe in the home country the asylum-seeker could live instead of the US.

Immigrants could be barred from asylum based on traffic offenses… In addition to the new prohibitions on asylum for immigration-specific crimes, the regulation would ban any applicant who’d been convicted of two or three misdemeanors (depending on what they were) from getting asylum.

This would have the biggest impact on unauthorized immigrants living in the US who get arrested and put in deportation proceedings, but ask for asylum to avert their deportation. (Under asylum law, someone can ask for asylum at any point within their first year of living in the US.)

In immigration policy, traffic offenses like driving without a license often don’t count as misdemeanors because in many states unauthorized immigrants aren’t allowed to get licenses. But the draft regulation makes clear that if driving without a license is a misdemeanor in the jurisdiction in question, it counts toward ineligibility.

…and blue states can’t fix eligibility by expunging immigrants’ records. Some Democratic state officials (most notably Gov. Jerry Brown in California) have started to use the pardon power to clear the criminal records of immigrants facing deportation. This regulation would do an end-run around that strategy.

Convictions that had been expunged or otherwise modified after the fact would still count as convictions if there was any evidence that the criminal record had been altered for immigration purposes. In other words, if Brown tried to expunge a record to make someone eligible for asylum, the fact that that’s why he did it would prevent it from stopping their deportation.

RESTRICTIONIST IMMIGRATION POLICIES HIT LOCAL CRAB INDUSTRIES!

Crab crisis: Md. seafood industry loses 40 percent of workforce in visa lottery

Maryland’s seafood industry is in crisis: Nearly half of the Eastern Shore’s crab houses have no workers to pick the meat sold in restaurants and supermarkets.

They failed to get visas for their mostly Mexican workforce, including many women who have been coming north to Maryland for crab season for as long as two decades. The Trump administration for the first time awarded them this year in a lottery, instead of on a first-come, first-served basis.

“This is going to cause the price of crabmeat to go out of sight,” said Harry Phillips, owner of Russell Hall Seafood on Hooper’s Island. “There’s not going to be hardly any Maryland crabmeat. . . . It looks like it’s a matter of time before they’re going to shut all of us down.”

Visa shortages have been a perennial issue for the crab industry since the last generations of Eastern Shore women who once picked crabmeat aged out of the tedious seasonal work. In the 1980s, crab houses started bringing workers from Mexico through a program that lets them live and work in the United States during the warmer months and then return to Mexico in the winter, when watermen are prohibited from crabbing.

But crab house owners say these are the most dire circumstances they have faced. They hope federal immigration officials issue more visas in response to skyrocketing demand for seasonal foreign workers. But if they have to compete in another lottery, they say, they worry there won’t be enough workers to fill their facilities.

“Companies that have been relying on this system for 25 years suddenly have no workers,” said Bill Sieling, director of the Chesapeake Bay Seafood Industries Association. “It’s totally unfair and irrational, really.”

The crisis is hitting just as crab season begins. Watermen were allowed to start dropping crab pots into the Chesapeake and its tributaries on April 1, but with cold weather through the month, crabs were slow to emerge from hibernation.

As temperatures rise, this year’s crop of crustaceans is now emerging.

It’s unclear whether or how quickly the problem could be resolved or what effect it could have on crab prices this year. Many of the crabs sold in Maryland come from the Carolinas and Louisiana, and some meat comes from Asia and Venezuela. But a premium is placed on local meat, with a state program called True Blue to identify and market Maryland crabs.

Crab processors theorized that a drastically reduced supply from a shortage of workers could send the price of picked meat skyrocketing. But it could lower the price of steamed crabs, flooding the market with many of the female and undersize crabs that would otherwise get picked.

“We need these processing plants to keep the market running smooth,” said Bryan Hall of G.W. Hall and Sons on Hooper’s Island.

G.W. Hall was able to get the 30 visas it applied for, but Hall says he doesn’t feel fortunate.

“I got them, but I don’t feel right having them,” he said. “It’s not right for me to have them and my fellow people who I deal with not to have them. They depend on them just as much as I do, and they’ve got families to feed just as much as I do.”

Maryland’s 20 licensed crab processors typically employ some 500 foreign workers each season, from April to November, through the H-2B visa program, Sieling said. The visas are for seasonal workers in nonagricultural jobs. Pickers are paid by the pound of meat they produce, and the most productive ones make up to $500 a week.

“Nobody wants to do manual labor anymore,” Sieling said. “It’s just a very, very tight labor market right now, particularly in industries that are seasonal.”

But in February, Sieling said, applications for about 200 of those visas were denied. That leaves women used to making an annual pilgrimage to Maryland stuck at home, with limited options to feed their families.

“Our families depend on us, and going to the United States is the best option because here in Mexico it is very difficult to find a job, and apart from that, you face the risk of so much crime,” Anayeni Chavarria Ponce, a crab picker from the Mexican state of Hidalgo, said via text message in Spanish. “Not to mention you can’t reach a salary even to buy the basics.”

Federal labor officials said there was “unprecedented” demand for H-2B visas in January. They received applications for 81,000 foreign workers when only 33,000 visas were available for work from April through September. The visas have become increasingly desirable over the past five years as overall U.S. unemployment falls.

In the second part of a two-step visa application process, U.S. Citizenship and Immigration Services received applications to bring some 47,000 workers into the United States for that six-month period. Because there were so many requests, officials decided to award visas by lottery.

Congress included a provision in the $1.3 trillion spending plan it approved in March that authorizes federal immigration officials to issue more H-2B visas. The crab industry is expecting a lottery for 15,000 more to be announced sometime this month. But a spokesman for the federal immigration agency said he had no information about whether or how many new visas might be permitted.

Maryland Gov. Larry Hogan (R) requested that the federal government “take immediate action” to raise the visa cap in a recent letter to the secretaries of homeland security and labor.

“Many of these businesses operate in rural parts of our state and have relied on guest workers for decades,” he wrote. “They will be forced to shut their doors or start importing crab meat if this issue is not addressed immediately.”

The industry has been in a position of begging for mercy in the past, often to powerful former senator Barbara A. Mikulski. The senior Democrat intervened in the early 2000s when northern ski resorts and Florida landscapers were scooping up visas before Maryland crab houses had a chance to apply. She championed a change that divided the annual 66,000-visa allowance into two semiannual allotments.

Now, businesses are asking President Trump for help, in the hope that the guest worker program doesn’t get lost in the administration’s efforts to tighten immigration policies.

“This is not an immigration issue,” said Morgan Tolley, general manager of A.E. Phillips & Son on Hooper’s Island. “They come here, abide by rules, they pay their state and federal taxes, their social security taxes, and they send the majority of their money home to support their family. They are a very important part of our local economies.”

Tolley said he supports the president and trusts that he has businesses’ interests at heart, but Tolley is skeptical and disappointed with the administration’s changes to the visa program.

“I voted for Donald Trump, and I’d vote for President Trump again,” he said. “But I think in small rural towns in America, we’re getting the short end of the stick on labor.”

Waterside communities such as Hooper’s Island are left hoping this visa scare, like others, will pass — and not be the final blow to their industry.

“Nobody’s ever been closed down,” Harry Phillips said. “No doubt there’s been some threats and there’s been some times we’ve been a little late getting them. But we’ve always gotten them.”

And, the truth is that picking crabs is actually skilled work that arrogant, out of touch, White GOP politicos couldn’t actually do very well. Kelly last year when he was homeland security secretary, was widely regarded as so callous and such a radical departure from historical practice that it was unthinkable for any U.S. government.

If only.

In fact, not only has the idea of systematically separating undocumented children and parents gained currency among top officials determined to turn the tide on illegal entry, it’s already happening with increasing frequency. The Department of Homeland Security insists it has not adopted the practice as a matter of official policy — despite White House pressure to do so — but administration officials acknowledge that hundreds of children, including scores younger than 4, have been taken from their parents in the past few months.

By now it’s clear that there are few red lines President Trump is unwilling to cross in his crusade to rid the United States of undocumented immigrants. For Mr. Trump, having washed his hands of the “dreamers” — young migrants, most in their 20s, raised and educated in the United States after being brought here as children — it’s hardly a moral leap to inflict lasting psychological damage on younger children by taking them from their parents if it will further his goal of combating illegal immigration.

As reported by The Post’s Maria Sacchetti, top immigration and border officials have recommended that all parents who enter the country illegally with their children be detained and prosecuted, meaning the automatic separation of minors, who cannot legally be held in jails or detention centers designed for adults. Until recently, that was extremely uncommon; most parents who crossed the border with children would be released pending an immigration court hearing, or, in some cases, detained together in a facility designed for families. Prosecuting parents for illegal entry, a misdemeanor under federal law, has been exceedingly rare — specifically because of the harm it would cause blameless children.

In addition, many of the parents who would be prosecuted are eligible under U.S. law to seek and be granted asylum. That’s hardly a stretch for migrants from El Salvador and Honduras, beset by drug cartels, gang violence, domestic abuse and some of the world’s highest homicide rates. In the last three months of 2017, more than two-thirds of the 30,000 asylum seekers crossed into the country illegally — and it is far-fetched to exempt from prosecution only those who announce themselves as asylum seekers at legal ports of entry, as Homeland Security officials propose. Are desperate, impoverished people fleeing violence to be penalized because they enter the United States in the wrong place?

The United States has a legitimate interest in deterring illegal border-crossing. It is within its rights to detain and deport individuals and families who fail to make a persuasive case for asylum. But to splinter families and traumatize children in the name of frightening away migrants, many of whom may have a legitimate asylum claim, is not just heartless. It is beyond the pale for a civilized country.

The American president, a former real estate mogul, does not want Byron Garcia in the United States. But the Honduran teenager was too busy building his own hotel empire this week to worry much about that.

Vermont Avenue and Connecticut Avenue were his. Now he was looking to move up-market.

The mini-Monopoly board on the dusty floor of the migrant shelter was small, but it fit well in the small space beside the tents. His older sister, Carolina, rolled a 2 and landed on Oriental Avenue.

“That’ll be $500,” said Garcia, 15, gleefully extending his hand. “I love this game!”

Garcia is coming to America on Sunday. Or maybe not. His mother, Orfa Marin, 33, isn’t sure it will be a good day to walk up to the border crossing and tell a U.S. officer that her family needs asylum. She knows President Trump wants to stop them.

Marin and her three children are among the 300 or so remaining members of the migrant caravan who have arrived here at the end of a month-long geographic and political odyssey, a trip that has piqued Trump’s Twitter anger and opened new cracks in U.S.-Mexico relations.

The organizers of the caravan say they are planning to hold a rally Sunday at Friendship Park, the international park where a 15-foot border fence splits the beach. From there, activists and attorneys plan to lead a group of the migrants to the U.S. port of entry at San Ysidro, Calif., where they will approach U.S. Customs and Border Protection officers and formally request asylum.

Trump has ordered U.S. soldiers to deploy and Homeland Security officials to block the migrants. But the diminished version of the caravan that has arrived here, mostly women and children, has only underscored its meekness.

The families are drained after weeks of travel, coughing children and pinto beans. They have crowded here into shelters in the city’s squalid north end, where the sidewalks are smeared with dog droppings and skimpily dressed women hand out drink promotions among the strip clubs and brothels. The tall American border fence is two blocks away.

Children play on the sidewalks outside the shelters, the boredom broken whenever a car with donations arrives to drop off clothes and toys.

Central Americans migrants in Mexico have long been treated as a kind of renewable natural resource, ripe for exploitation by thieves, predators and politicians. The geopolitical importance attached to this particular group was a sign to many here that the U.S. president had recognized an opportunity, too.

“We’re not terrorists or bad people,” Marin said.

Regardless of its size, Trump officials have measured this caravan in symbolic terms, as an egregious example of the “loophole” they want to shut and an immigration system whose generosity is being abused, they say, by hundreds of thousands of Central Americas trying to dupe it.

“These people have no option but to seek refuge in another country, and they have every right to seek asylum, they have decided to face the consequences and to be strong in demanding what is their right,” said Leonard Olsen, 26, a law student and one of several caravan organizers from the United States. Years-long wait lists, bewildering legal arguments, an extended stay in detention — you can experience it all in the Waiting Game, a newsgame that simulates the experience of trying to seek asylum in the United States. The game was created by ProPublica, Playmatics and WNYC. Based on the true stories of real asylum-seekers, this interactive portal allows users to follow in the footsteps of five people fleeing persecution and trying to take refuge in America.

The process can be exhausting and feel arbitrary – and as you’ll find in the game, it involves a lot of waiting. Once asylum-seekers reach America, they must condense complex and often traumatic stories into short, digestible narratives they will tell again and again. Their  lives often depend on their ability to convince a judge that they are in danger. Judicial decisions are so inconsistent across the country, success in complicated cases can  come down to geography and luck — in New York City only 17 percent of asylum cases are denied in immigration court; in Atlanta, 94 percent are. Increasingly, many asylum-seekers are held in detention for months or even years while going through the system. The immigration detention system costs more than $2 billion per year to maintain.

The Trump administration has tried to reframe the asylum system as a national security threat and a magnet for illegal immigration. Attorney General Jeff Sessions characterizes the American asylum process as “subject to rampant abuse” and “overloaded with fake claims.” He has aimed recent reforms at expediting asylum adjudications to speed up deportations and at making it more difficult for certain groups to qualify for protection, such as Central Americans who claim to fear gender-based violence or gang persecution.

The narrative that the system is overrun with fraud has long been pushed by groups that favor limiting immigration overall. They point to some 37 percent of asylum-seekers who annually miss their immigration hearings as evidence that people without legitimate fears of persecution game the system. They argue that allowing asylum-seekers to obtain work permits while they wait for a decision on their cases — which sometimes takes years — incentivizes baseless claims.

But another picture emerged when ProPublica spoke with more than 20 experts and stakeholders who study and work in the asylum system, including lawyers, immigration judges, historians, policy experts, an asylum officer, a former border patrol agent and a former ICE prosecutor.

When asked about changes to the system they’d like to see, many suggested providing asylum-seekers with better access to lawyers to support due process, expanding the definition of a refugee to cover modern-day conflicts,providing more resources to help the system process claims in a timely manner, and improving judicial independence by moving immigration courts out of the Department of Justice.

Most acknowledged some level of asylum-claim abuse exists. “In any system, of course, there are going to be some bad actors and some weaknesses people seek to exploit,” said Doris Meissner, the former commissioner of the U.S. Immigration and Naturalization Service from 1993 to 2000.

But they also argued for the importance of protecting and improving a national program that has provided refuge to hundreds of thousands of people. “If you are going to make a mistake in the immigration area, make this mistake,” said Bill Hing, director of the University of San Francisco’s Immigration and Deportation Defense Clinic. “Protect people that may not need protecting, but don’t make the mistake of not protecting people who need it.”

Victor Manjarrez, a former border patrol agent from the 1980s until 2011, said he had seen human smuggling networks exploit the border over the years, but also many people who genuinely needed help.

“We have a system that’s not perfect, but is designed to take refugees. That is the beauty of it,” he said. “It has a lot of issues, but we have something in place that is designed to be compassionate. And that’s why we have such a big political debate about this.”

Getting refuge often depends on getting the right:

  • Border Patrol Agent an Asylum Officer to even get into the system;
  • Lawyer;
  • Local Immigration Court;
  • Immigration Judge;
  • DHS Assistant Chief Counsel;
  • BIA Panel;
  • U.S. Court of Appeals jurisdiction;
  • U.S. Court of Appeals Panel;
  • Luck.

If something goes wrong anywhere along this line, your case could “go South,” even if it’s very meritorious.

I also agree with Professor Hing that given the UNHCR guidance that asylum applicants ought to be given “the benefit of the doubt,” the generous standard for asylum established by the Supremes in INS v. Cardoza-Fonseca and implemented by the BIA in Matter of Mogharrabi, and the often irreversible nature of wrongful removals to persecution, the system should be designed to “error on the side of the applicant.”

Indeed, one of the things that DHS in my experience does well is detecting and prosecuting systemic asylum fraud. While a few individuals probably do get away with tricking the system, most “professional fraudsters” and their clients eventually are caught and brought to justice, most often in criminal court. Most of these are discovered not by “tough laws” or what happens in Immigration Court, but by more normal criminal investigative techniques: undercover agents, tips from informants, and “disgruntled employees or clients” who “blow the whistle” in return for more lenient treatment for themselves.

Wow! As those of you who read “Courtside” on a regular basis know, I’m a HUGE FAN of Tal’s timely, incisive, concise, and highly accessible reporting. I feature it on a regular basis. I’ve also seen her do a great job on TV and video. But, until now, I didn’t know about her skills as a photojournalist. Tal can do it all!
Also, as my colleague Judge and Super-Blogger Jeffrey Chase pointed out in one of his recent comments on this blog, pictures play an essential role in understanding the immigration saga in America.
Been there, done that in my career. Takes me back to the long past days of riding three wheelers, helicopters, Patrol Cars, looking through infrared night scopes, and even accompanying foot patrol during my days in the “Legacy INS General Counsel’s Office.” (Most often on the border south of San Diego.) We actually took the Trial Attorneys and some of the Assistant U.S. Attorneys prosecuting our cases with us to show them what it was really like at the “ground level.”
Actually doesn’t look all that much different decades later. What is painfully clear is that walls, fences, helicopters, detectors, unrealistically harsh and restrictive laws, and more detention centers (the “New American Gulag”) will never, ever “seal” our borders as some immigration hard-liners insist is possible.
At best, we can control, channel, and regulate the flow of migrants, but not halt it entirely. Human migration was taking place long before the U.S. became a nation, and I daresay that it will continue as long as there are humans left on earth. To think that walls, troops, concentration camps, harsh laws, and prisons are going to halt it completely is a mixture of arrogance and ignorance.
So, rather than pouring  more money down the drain on the same “strategies” that have been failing for decades, a “smart” border control policy would involve:
  • More realistic and generous interpretations of our refugee and asylum laws that should include most of those fleeing for their lives from the Northern Triangle;
  • A much larger and more “market based” legal immigration system for permanent and temporary migrants that would meet the legitimate needs of U.S. employers and our economy while making it attractive for most prospective workers and employers to use the legal visa system rather than the “black market” of undocumented entry;
  • A larger and more robust refugee processing program for Northern Triangle refugees so most would be screened and documented outside the U.S.;
  • Cooperation with the UNHCR and other stable countries in the Western Hemisphere to distribute the flow of long-term and temporary refugees in an equitable manner that will help both the refugees and the receiving countries;
  • Working with and investing in Mexico and Northern Triangle countries to address and correct the conditions that create migration flows to the Southern Border.
  • Providing lawyers for asylum applicants who present themselves at the Southern Border so that their claims for protection  (which actually go beyond asylum and include protection under the Convention Against Torture) can be fairly, correctly, and efficiently determined in an orderly manner in accordance with Due Process.

No, it’s unlikely to happen in my lifetime. But, I hope that future generations, including the members of the “New Due Process Army,” will find themselves in a position to abandon past mistakes, and develop the smart, wise, generous, humane, realistic, and effective immigration and refugee policies that we need to keep our “nation of immigrants” viable and vitalized for centuries to come. Until then, we’re probably going to have to watch folks repeat variations of the same painful mistakes over and over.

Attempted border crossings surged in March

The number of migrants trying to illegally cross into the US at the Mexico border spiked dramatically in March, according to numbers released Wednesday as President Donald Trump announced he was sending National Guard troops to the southern border.

It will take a few months to determine if the spike turns into a full-blown surge similar to a migrant crisis that occurred in 2014, but the increase marked a turn for the administration, which a year ago was touting historically low numbers as the “Trump effect” and is now using the statistics as the reason it needs aggressive new immigration enforcement authorities.

The number of people either caught trying to cross the southern border or rejected for admission increased 37% from February into March, a sudden rise in figures that had been holding relatively steady. The increase was driven especially by a jump in the number of people apprehended trying to cross illegally. The number of families and unaccompanied children trying to come into the US increased at a higher rate than the general population.

Last month’s numbers were three times those of March 2017, when crossings were at their lowest in two decades of records.

That year also defied the usual trend in March, when crossings historically increase as weather improves. In 2013 and 2014, a summer surge of migrants, and especially child migrants, caused a crisis of overcrowding at detention centers and humanitarian concerns. The March uptick lagged those years by several thousand, and numbers in April and May will be key to determining whether the increase marks a trend or a one-off development.

A senior administration official had told reporters on a call Wednesday announcing Trump’s move to send National Guard troops to the border that the numbers were up substantially, using them as a data point in what the President called a “crisis” at the southern border in his memo authorizing troops to be deployed. The monthly numbers were released that evening, slightly ahead of schedule.

Standing at the White House podium Wednesday afternoon, Homeland Security Secretary Kirstjen Nielsen noted the historic drop in border crossings that happened in the first few months when Trump took office, calling it the “Trump effect” and touting the work the administration had done on immigration since.

But the numbers by fall had caught up with levels in the last several years under the Obama administration, and Nielsen cited the same statistics Wednesday that the department once cited as proof of its success as the reason more steps were necessary.

“When the President took office, the traffickers, smugglers, TCOs and the illegal aliens that serve as their currency paused to see what our border enforcement efforts would look like and if we could follow through on the deportation and removal,” Nielsen said. “While we have been apprehending aliens at the border with historic efficiency, these illicit smuggling groups saw that our ability to actually remove those who come here illegally did not keep pace. They saw that there were loopholes they could exploit.”

Illegal migration is driven by a number of elements, including what are known as push and pull factors. The administration has been aggressively targeting what it says are pull factors: perceptions that they argue attract immigrants to the US because they believe they will be able to stay. It has discussed the push factors less often, however: the violent and impoverished conditions in Central America that send migrants north out of desperation.

Having stupidly turned down the obvious “Dreamers for Wall” deal that almost anyone else could and would have cut, Trump is desperate to show his base at least some “progress” (or more accurately “regress’)  on the border.

The facts are: 1) there’s no border crisis; 2) the only immigration crisis is that Trump, Sessions and the GOP restrictionists keep perpetuating failed immigration policies; 3) we’re effectively at full employment; 4) the current so-called “undocumented” population is overwhelmingly law-abiding; 5) immigration, both legal and undocumented, has been an essential driving force behold America’s continuing economic success; 6) the border is as well controlled as it ever has been or likely ever will be; 7)  DHS Enforcement is so grossly overstaffed and the so-called “criminal alien” population is so small that ICE and CBP agents have little legitimate law enforcement work to do and consequently have turned to “busting” gardeners, maids, roofers, nannies, students, kids, and a wide range of other counterproductive activities to justify their continued existence.

We don’t need more immigration enforcement. What we do need is smarter immigration enforcement. But with biased xenophobes like Trump, Sessions, Miller, Nielsen, and Homan running the show we’re not going to get that without some much-needed “regime change.”

Wake up America! Harm to the most vulnerable among us is harm to all! We can diminish ourselves as a nation, but that won’t stop human migration!

MATÍAS ROMERO, Mexico — With a sarcastic half-smile, Nikolle Contreras, 27, surveyed her fellow members of the Central American caravan, which President Trump has called dangerous and has used as a justification to send troops to the border.

More than 1,000 people, mostly women and children, waited patiently on Wednesday in the shade of trees and makeshift shelters in a rundown sports complex in this Mexican town, about 600 miles south of the border. They were tired, having slept and eaten poorly for more than a week. All were facing an uncertain future.

“Imagine that!” said Ms. Contreras, a Honduran factory worker hoping to apply for asylum in the United States. “So many problems he has to solve and he gets involved with this caravan!”

The migrants, most of them Hondurans, left the southern Mexican border city of Tapachula on March 25 and for days traveled north en masse — by foot, hitchhiking and on the tops of trains — as they fled violence and poverty in their homelands and sought a better life elsewhere.

This sort of collective migration has become something of an annual event around Easter week, and a way for advocates to draw more attention to the plight of migrants.

But this particular caravan caught the attention of Mr. Trump, apparently after he heard about it on Fox News. In a Twitter tirade that began Sunday, he conjured up hordes of dangerous migrants surging toward the border. He demanded that Mexican officials halt the group, suggesting that otherwise he would make them pay dearly in trade negotiations or aid cuts.

Mr. Trump even boasted that his threat had forced Mexico’s government to halt and disperse the caravan participants. But there was no evidence of that on Wednesday.

Irineo Mujica, Mexico director of People Without Borders, an advocacy group that is coordinating the caravan, called Mr. Trump’s Twitter attacks and promise of a militarized border “campaign craziness.”

“There are 300 kids and 400 women,” he said. “Babies with bibs and milk bottles, not armaments. How much of a threat can they be?”

The group, organizers and advocates said, represented a regional humanitarian problem, not a security crisis for the United States, as Mr. Trump has suggested.

“What he’s attacking is a supremely vulnerable population,” said Gina Garibo, projects coordinator in Mexico for People Without Borders.

In response to Mr. Trump’s tweets and his plans to militarize the border, the Mexican Senate unanimously passed a nonbinding statement on Wednesday urging President Enrique Peña Nieto to suspend cooperation with the United States on immigration and security matters — “as long as President Donald Trump does not conduct himself with the civility and respect that the Mexican people deserve.”

Caravan organizers also said their intent was never to storm the border, especially not with a caravan of this size. While the original plan included the possibility of escorting the caravan to the northern border of Mexico, organizers had expected the group to mostly dissolve by the time it had reached Mexico City.

There has never been any doubt that folks like Trump, Sessions, Miller, Nielsen have nothing but contempt for the truth, laws, and human life. But, they also think that the American people are pretty stupid to fall for the “fantasyland claptrap” that they throw out to drum up support for their racist restrictionist ambitions.

Although you’ll never hear it from the disingenuous Trumpsters, individuals arriving at our borders have a legal right to apply for asylum guaranteed by both U.S. and international law. Most of the “law-breaking” involves the actions of the Trump DHS. By refusing to properly process asylum applicants at legal ports of entry, the Administration actually encourages illegal entry and the use of smugglers.

The only real “crisis” at the Southern border is a humanitarian one that this and past Administrations have had key roles in creating through failed immigration and foreign policies. Without better, smarter government, we’re bound to deep repeating the same mistakes.

President Donald Trump will sign a proclamation directing agencies deploy the National Guard to the southwest border, Homeland Secretary Kirstjen Nielsen announced Wednesday.

“The President has directed that the Department of Defense and the Department of Homeland Security work together with our governors to deploy the National Guard to our southwest border,” Nielsen said at the White House.

The formal move follows days of public fuming by Trump about immigration policy, during which he has tweeted about immigration legislation in Congress, a caravan of migrants making its way through Mexico and what he calls weak border laws.

Since the passage of the government spending package for the year — which included $1.6 billion for border security but only a few dozen miles of new border barrier construction and a nearly equal amount of replacement fencing — Trump has been critical of Congress for denying him more money. Trump privately floated the idea of funding construction of a southern border wall through the US military budget in conversations with advisers, two sources confirmed to CNN last week — a plan that faces likely insurmountable obstacles in Congress.

Sending National Guard troops to the border is not unprecedented. Both of Trump’s predecessors also did so, though the moves were criticized for being costly and of limited effectiveness.

US law limits what the troops can actually do. Federal law prohibits the military from being used to enforce laws, meaning troops cannot actually participate in immigration enforcement. In the past, they’ve served support roles like training, construction and intelligence gathering.

From 2006-2008, President George W. Bush deployed 6,000 guardsmen to Southern border states, costing $1.2 billion and assisting with 11.7% of total apprehensions at the border and 9.4% of marijuana seized in that time.

From 2010-2012, President Barack Obama sent 1,200 guardsmen to the border to the tune of more than $110 million, and they assisted with 5.9% of the total apprehensions and 2.6% of the marijuana seizures on the border.

How Trump’s policies could worsen the migration issue he says he wants to solve

President Donald Trump in recent days has decried “weak” US border laws that he says leave the US vulnerable to unfettered immigration — but some of his policies could have the effect of worsening a Central American migrant crisis.

Even as the Department of Homeland Security says the southern border “is more difficult to illegally cross today than ever before,” Trump has stepped up his hardline immigration rhetoric, calling on the US military to guard the US-Mexico border until his long-promised wall is complete. He’s hammered Mexico and other countries for policies that he says are disadvantageous to the US and that send unsavory individuals into the country.

But experts say the President has been pursuing other policies that could substantially harm Central America — and in doing so, he risks creating conditions that generate the exact kind of mass exodus north that he talks about wanting to solve.

Immigration is driven by what are called push and pull factors. The US has been seeking aggressive immigration powers to cut down on what they say are pull factors — the perception that immigrants can live illegally with impunity in the US. But those very policies could affect push factors — the conditions of poverty and violence that drive immigrants elsewhere out of desperation.

“The US sort of talks out of both sides of its mouth,” said Eric Olson, a Latin America expert at the nonpartisan Wilson Center.

“If you’re investing in the region to address the drivers of migration and at the same time pursuing a policy of large-scale deportation, or at least potentially large-scale deportation, and you’re creating more obstacles for people leaving the region for reasons like violence and so on, you’re really creating more instability, not less instability.”

I’ve been saying for some time now that Trump is pursuing facially “hard-line” policies that are proven failures. Indeed, that forced migration from Central America is a phenomenon that spans four decades and six different Administrations with varying degrees of  “same old, same old” would suggest to rational leadership that a different approach is required.

Contrary to Trump’s oft-made bogus claim, his is not the first Administration to try a “close the border, detain and deter” policy.  Beginning with Reagan, every Administration has tried largely the same thing (although perhaps without some of the inflammatory and outright racist rhetoric favored by the Trumpsters) and all have failed. I know because I’ve been involved in some aspect of trying to implement those failed policies in at least four of those Administrations, two GOP and two Democrat.

That’s why the trend of migration from the Northern Triangle continues and will continue and fester until we get some enlightened leadership that 1) correctly applies our refugee and protection laws in the generous humanitarian spirit they were intended; and 2) recognizes and starts to deal effectively with the “push” issues in the sending countries.

Contrary to the false narrative spread by current Administration, most Central American refugees that I encountered personally during my career would have preferred to remain in their home countries, if political and country conditions had permitted it. Indeed, many were forced by targeted violence to give up promising careers, studies, or businesses to flee for their lives to the U.S. Here, they often had to perform “entry-level” work to support themselves unless and until they achieved some type of legal status (often TPS , asylum, withholding of removal, CAT relief, Special Immigrant Juvenile (“SIJ”) status, or a green card under NACARA).

Of course, many were denied protection despite having very credible, well-documented fears of harm because they didn’t fit the intentionally restrictive asylum criteria engineered by the BIA over several Administrations largely as a result of political pressure on the system to be “unwelcoming” to Central American migrants.  Some of those who returned were killed or disappeared;  others were tortured or attacked again and forced to flee second or third times, now bearing the scars or injuries to prove their cases — only as “prior deportees” they were no longer eligible for asylum but had to accept withholding of removal or CAT deferral.

Nobody in this Administration, and sadly relatively few in Congress and among the public, are willing to deal honestly with the phenomenon of Central American migration and the “push factors” that will never, ever be controlled by more restrictive laws, more violations of statutory, Constitutional, and international rights, inhumane and life-threatening detention , and racist rhetoric. Nor will it be stopped by any bogus “Wall.”

As I’ve said before, “We can diminish ourselves as a nation, but that won’t stop human migration!” If only someone would listen!

YUP, TRUMP’S RIGHT: They’re Laughing In Mexico, But It’s At Trump’s Immigration Lunacy!

In a three-tweet salvo Sunday morning, Trump decried recent struggles with congressional Democrats to reach a deal that would legalize the status of millions of “dreamers” — undocumented immigrants who were brought to this country as children.

“Border Patrol Agents are not allowed to properly do their job at the Border because of ridiculous liberal (Democrat) laws like Catch & Release,” Trump said in his first tweet. “Getting more dangerous. ‘Caravans’ coming. Republicans must go to Nuclear Option to pass tough laws NOW. NO MORE DACA DEAL!”

DACA refers to the Obama-era Deferred Action for Childhood Arrivals program, which Trump ended in the fall. The program had allowed dreamers to live in the country without fear of deportation.

Trump, a self-proclaimed “Fox & Friends” fan, appears to have fired off the tweets in response to a segment on the program in the morning (at least the National Border Patrol Council sees a connection, it claimed in a post afterward).

Why are they moving in a caravan?

The Fox News opinion segment was in response to a BuzzFeed report on Friday that more than a thousand Central Americans, primarily from Honduras, were winding their way up through Mexico to the U.S. border on a nearly month-long trip that began March 25. These migrants are looking to seek asylum from criminal elements back home or slip into the United States undetected.

Moving in a large group is expected to blunt the efforts of criminal gangs and cartels known to isolate and later rob immigrants, many of whom bring large sums of money to make the long journey north through Mexico. The caravan organizers, Pueblos Sin Fronteras, or People Without Borders, appeared to have concluded that it is safer for these people to travel together.

That trip can be deadly as people find their way along various routes that go directly north to Texas, northwest to Arizona or along the coast to California.

Just about every route is more than a thousand miles long and is canvassed by robbers and corrupt police who shake down the immigrants, who have little access to legal recourse. A network of commercial locomotives is veined throughout Mexico in a 1,450-mile cannonball run. Migrants ride on top of the trains, occasionally falling off and breaking bones or suffering severe dehydration.

Members of the caravan said they would attempt to ride the trains, but in 2014, more guards and trains moving faster through stations made it more difficult for migrants to catch rides.

Migrants have many names for the trains, such as “El tren de los desconocidos” (the train of the unknowns) and “El tren de la muerte” (the train of death).

But its most common name is “La Bestia”: the Beast.

What is Mexico doing about the flow of migrants?

“Mexico is doing very little, if not NOTHING, at stopping people from flowing into Mexico through their Southern Border, and then into the U.S. They laugh at our dumb immigration laws. They must stop the big drug and people flows, or I will stop their cash cow, NAFTA. NEED WALL!” Trump said in his second tweet.

Mexico is doing something — with the help of the United States. Hundreds of millions of dollars in aid flow to Mexico every year, including funds for strengthening its border with Guatemala, where migrants generally cross.

Billions in additional spending authorized by President Barack Obama in 2014 was prompted by thousands of unaccompanied minors arriving on the U.S.-Mexico border, mostly Central Americans fleeing horrific crime waves and economic crises in Honduras, El Salvador and Guatemala. About 300,000 migrants were detained by Mexican authorities in the next two years.

The caravan began in Tapachula, BuzzFeed reported, nestled just on the other side of the border, and no authorities in Mexico appear to have stopped it as of Friday.

What is Trump doing about it?

Trump’s proposals to reduce aid to Mexico would raise the possibility that the country would be less able to stem flows of migrants and drugs coming across its border.

The president has been caught in a contradiction of policy on the border before.

The budget for the U.S. Coast Guard stayed flat in 2018 despite spending increases across the Pentagon (the Coast Guard falls under the Department of Homeland Security). But the service seizes three times as much cocaine moving by sea as what U.S. agencies intercept at border checkpoints, putting a dent into Trump’s argument that a border wall would dry up the supply of hard drugs in the United States.

Trump has been more focused on DACA and the border wall lately. He has suggested that the program may be the reason the caravan has massed.

“These big flows of people are all trying to take advantage of DACA. They want in on the act!” Trump said in a tweet.

He later said outside a church before Easter services Sunday: “A lot of people are coming in because they want to take advantage of DACA. They had a great chance. The Democrats blew it.”

But that description of DACA appears to misrepresent the program’s intent, which was to provide protection for immigrants who were brought to the United States illegally as children. The adults in the caravan wouldn’t qualify for DACA. White House press secretary Sarah Huckabee Sanders did not respond to a request for comment on the matter.

“I asked some of the migrants on the caravan what they thought about Trump saying they were going to the US for DACA,” BuzzFeed reporter Adolfo Flores tweeted Sunday. “Some laughed and others said they thought (correctly) they wouldn’t qualify.”

Flores reported Friday afternoon that the caravan had gone more than 200 miles northwest in less than a week, crossing into the Mexican state of Oaxaca.

Trump, Sessions, Miller, Homan, Nielsen and the rest of the White Nationalist cabal live in their own parallel universe where bias, hate, racism, xenophobia, lies, fears, cowardice, and political manipulation block out any rays of truth or reason.  It’s certainly bad for our country to have such distorted, divisive, dishonest, and incompetent leadership. But, it’s a fact of life that the rest of us just have to deal with if we want to live in the present moment and try to prevent future disasters.

Undoubtedly, the Trump Administration’s inhumane and short-sighted policies will inflict some unnecessary pain and hardship on individuals who otherwise would be our friends and become loyal and productive members of our society. But, it’s unlikely that any of Trump’s blustering or the Administration’s “Gonzo” immigration enforcement policies and “Alice in Wonderland” pronouncements will have much lasting effect on migration patterns except, perhaps, to increase the number of people living in the United States without documents by artificially shutting down some of the existing paths that encourage individuals to come forward and obtain documentation or to enter the U.S. through the legal system in the first place. As with so much that this Administration is doing, it will be left for future generations to clean up the mess.

Wow, if these pathetic Dudes who supposedly govern us are this afraid of a few ragtag scared refugees moving north, what would they do in the face of a real army, a real invasion, and a real danger to our country? There wouldn’t be enough desks in Washington for them all to hide under!

“HAPPY EASTER” — Trump Mocks Christian Values — Trump’s Easter Message Full Of Hate, Vitriol, Racism, Lies, & Ignorance — Now Targeting Dreamers!

PALM BEACH, Fla. — President Trump spent his Easter morning here on an anti-immigrant tirade, declaring Sunday that there would be no deal to legalize the status of undocumented immigrants known as “dreamers” and threatening to exit the North American Free Trade Agreement unless Mexico increases border security.

Trump thrust the future of millions of undocumented immigrants who were brought to the United States as children into peril by promising “NO MORE DACA DEAL,” and he directed congressional Republicans to pass tough anti-immigration legislation.

An hour after he wished Americans a “HAPPY EASTER,” Trump fired off three tweets in which he vented, sometimes in all caps, about immigration laws he derided as “ridiculous” and “dumb” and about border enforcement he deemed dangerously lax.

In his first of the immigration-related tweets, Trump wrote, “Border Patrol Agents are not allowed to properly do their job at the Border because of ridiculous liberal (Democrat) laws like Catch & Release. Getting more dangerous. ‘Caravans’ coming. Republicans must go to Nuclear Option to pass tough laws NOW. NO MORE DACA DEAL!”

 It was Trump who last fall canceled the Deferred Action for Childhood Arrivals program, which was begun in the Obama administration to provide temporary protection to dreamers.

The president added, “Mexico has got to help us at the border. . . . They flow right through Mexico; they send them into the United States. It can’t happen that way anymore.”

President Trump’s position on DACA has taken several twists and turns over the years.

Trump in the past has promised to show “great heart” in dealing with DACA. In his comments Sunday, he appeared to be confused about the rules of the program. To qualify, immigrants must have lived in the United States since 2007, have arrived in the country before age 16 and have been younger than 31 on June 15, 2012. No one arriving in the country after that date is eligible.

After canceling DACA, Trump said he would like to reach a deal with Congress to protect dreamers from deportation in exchange for funding to build his long-promised wall at the U.S.-Mexico border. The president, however, went on to reject immigration proposals from congressional Democrats in recent months.

“Catch and release” is not a law, but shorthand for immigration officials freeing up detention center space by allowing immigrants to remain at large if they are not seen as security risks. The Trump administration has frequently claimed that the policy ended when the new president took office.

But detention centers have continued releasing low-risk immigrants, as the backlog of immigration court cases reaches the hundreds of thousands. On March 5, Attorney General Jeff Sessions informed immigration court judges that they could rule against asylum seekers without full hearings, which conservatives see as a way, in the long term, to open more space in detention centers.

Trump — who has spent his time in Palm Beach hanging out with family, playing golf with friends and watching television — may have tweeted in response to commentary on Fox News Channel, which he is known to view regularly.

“Fox & Friends” aired a segment earlier on Sunday morning about Central American migrants traveling through Mexico en route to the United States. It carried the headline: “CARAVAN OF ILLEGAL IMMIGRANTS HEADED TO U.S.”

Trump’s Sunday comments may have been mere musings by an impassioned “Fox & Friends” viewer and may not signal a substantive shift in administration policies. Still, White House officials have long said Trump’s tweets are official presidential statements, and he has been known to use Twitter to preview formal policy pronouncements.

Trump sent his tweets on the fourth and final day of his vacation in Palm Beach, Fla., where he has been staying at his private Mar-a-Lago Club with a small coterie of aides. White House Chief of Staff John F. Kelly did not travel with him, but senior policy adviser Stephen Miller, a proponent of hard-line immigration policies, has been with Trump.

The president also has been spotted spending time — both over dinner Friday at Mar-a-Lago and on Saturday at the nearby Trump International Golf Club — with Fox host Sean Hannity. An outspoken immigration hard-liner, Hannity is a Trump booster and informal presidential adviser, in addition to hosting a radio show and prime-time Fox show.

Trump’s tweets baffled some Democrats, who had seen the president distinguish between DACA recipients and other immigrants who are in the country illegally.

“Time and time again, the president has walked away from bipartisan proposals that are exactly what he asked for,” said Drew Hammill, a spokesman for House Speaker Nancy Pelosi (D-Calif.). “When an agreement to protect the Dreamers is reached, it will be despite this president rather than with his leadership.”

Rep. Don Beyer (D-Va.) said on Twitter that Trump had once again revealed a racial animus behind his immigration policy. “The mask of deceptions and lies with which Trump has tried to gaslight the country for months just fell away: ‘no more DACA deal.’ ” Beyer tweeted. “His true position was always anti-immigrant.”

Rep. Luis V. Gutiérrez (D-Ill.), a leading advocate for a DACA deal in the House, tweeted that Trump had “demonstrated his complete ignorance” on immigration policy.

“Everyone who qualifies for DACA must show they lived in US almost 11 years ago,” he wrote. “Apparently every day is April Fool’s Day at White House.”

Conservative reaction to the tweets was relatively muted, and no Republican member of Congress had a comment or statement Sunday afternoon. At Breitbart, the tweets were reported as Trump refusing to “negotiate a deal between the GOP establishment and Democrats,” in “a return to his ‘America First’ immigration agenda.”

On Facebook, the conservative author Ann Coulter, who had condemned Trump for not securing border wall funding so far this year, urged the president to show and not tell.

“Try to get a message to the commander in chief for that wall,” she wrote.

But some Republicans joined the chorus of criticism. Ohio Gov. John Kasich, a GOP primary opponent of Trump in 2016 and possibly again in 2020, tweeted in response: “A true leader preserves & offers hope, doesn’t take hope from innocent children who call America home. Remember, today is Easter Sunday. #DACA #Hope”

Rep. Ileana Ros-Lehtinen (R-Fla.), a supporter of immigration reform who represents Miami and is retiring this year, took a sarcastic approach: “Such a strong message of love and new beginnings from @realDonaldTrump on Easter Sunday.”

By calling for Republicans to use the “Nuclear Option” to pass tough immigration measures, Trump seemed to urge a parliamentary procedure by which Senate Republicans could pass legislation with a simple majority of 51 votes as opposed to the 60-vote majority required to end debate and bring a vote to the floor.

But in mid-February, just 36 of the Senate’s 51 Republicans backed an immigration bill that mirrored White House demands. Congressional negotiations on DACA stalled just weeks later, when the Supreme Court upheld a decision that prevented the Trump administration from denying new program renewals.

The court’s move effectively nixed a March 6 deadline that the administration had set for ending DACA. Before leaving for Easter recess, Congress passed an omnibus spending bill with no DACA fix, even though advocates saw that as the best must-pass vehicle for one.

Trump lashed out at Mexico in his second of the three tweets Sunday. He threatened to “stop” NAFTA unless Mexican authorities do more to secure the border with the United States.

Trump wrote: “Mexico is doing very little, if not NOTHING, at stopping people from flowing into Mexico through their Southern Border, and then into the U.S. They laugh at our dumb immigration laws. They must stop the big drug and people flows, or I will stop their cash cow, NAFTA. NEED WALL!”

Trump’s tweets come amid tense negotiations over NAFTA between his administration and that of Mexican President Enrique Peña Nieto. A call between the two men in February became testy after Trump refused to publicly affirm Peña Nieto’s position that Mexico will not pay for the wall’s construction, leading the Mexican leader to cancel a planned visit to Washington.

STEVE VLADECK: How U.S. Courts Undermine Our Constitution — A Constitution Without Remedy For Violations Is An Empty Document!

For all of the attention that we pay to our constitutional rights, we devote stunningly little attention to the more legalistic — but no less important — topic of how those rights are enforced. And as a largely unnoticed rulinglast week by the full United States Court of Appeals for the Fifth Circuit demonstrates, the Supreme Court has quietly made it all but impossible for most victims of constitutional violations by the federal government to obtain relief.

Not only is this development antithetical to the core purpose of having an independent judiciary, but it will almost certainly lead to more unconstitutional conduct by even the most well-meaning federal officers, who, in most cases, no longer have to seriously worry about the specter of judicial review.

The case that the New Orleans-based federal appeals court ruled on involved the fatal cross-border shooting of an unarmed 15-year-old Mexican national on Mexican soil by a United States Border Patrol agent standing on American soil. The family of the victim, Sergio Hernández, sued the responsible agent, Jesus Mesa, claiming that the shooting was unprovoked and violated the teenager’s rights under the Fourth and Fifth Amendments. Whether the Constitution protects a foreign national standing on foreign soil in a case like this is an interesting and still-open question. But rather than resolving that issue, the Court of Appeals held, by a 13-2 vote, that it didn’t matter; even if the shooting violated clearly established constitutional rights, the majority concluded, the federal courts should not recognize a remedy of damages for fear of intruding upon the legislative and executive branches of government.

That’s a troubling conclusion, because government officers like Agent Mesa will have less of a reason to worry about the constitutional rights of those with whom they interact. But at a deeper level, our constitutional rights aren’t worth all that much if there’s no mechanism for enforcing them. One can only hope that sometime soon the Supreme Court comes to its senses and agrees.

I decried the Fifth Circuit’s dereliction of duty in a recent blog focusing on the much more persuasively reasoned and powerful dissent by Judge Edward Prado.  But, only one of his other 14 black-robed Ivory Towerists were willing to join Judge Prado, step up to the plate, and defend our constitutional rights. What kind of folks and jurists are getting these lifetime sinecures just to avoid controversy and not to stand up for what’s right?

Yup. Today it’s just some Mexican kid (who also happened to be a human being and someone’s son) who was shot by the Border Patrol. But, tomorrow it might be your son or daughter or you yourself whose rights are violated. And, who is going to step up and vindicate your constitutional rights? Certainly not the 13 judges of the Fifth Circuit majority in Hernandez v. Mesa who looked for and found ways to avoid their collective duty to uphold our Constitution.

As thousands of Central American families arrived at the U.S.-Mexico border asking for asylum in 2014, human rights organizations raised alarms about asylum seekers’ treatment by Customs and Border Protection officials. But these organizations were not the only ones expressing concern—asylum officers within U.S. Citizenship and Immigration Services also raised alarms about CBP misbehavior.

A new Freedom of Information Act lawsuit hopes to reveal how asylum officials’ repeated concerns about CBP officer misconduct were left unaddressed. The lawsuit, filed by Human Rights Watch and Nixon Peabody LLP, seeks information about such misbehavior, including hundreds of reports that CBP failed to properly screen asylum seekers.

This lawsuit comes after Human Rights Watch, along with the American Immigration Council, filed a FOIA request asking for records of complaints made by officers in USCIS’s Asylum Division. The lawsuit asks USCIS to turn over all records of complaints about CBP misconduct from 2006 to 2015, arguing that the agency violated FOIA by failing to provide requested key documents following the original request. These documents included a spreadsheet where asylum officers purportedly documented hundreds of instances of “problematic Border Patrol practices.”

CBP officers at ports of entry and along the U.S. border are generally the first to encounter newly arriving asylum seekers. When asylum seekers express a fear of returning to their home country to a CBP officer, the officer is required to refer them to an asylum officer with USCIS for an interview. The asylum officer decides whether the asylum seeker has a “credible fear” of persecution, a determination which allows the asylum seeker to pursue an asylum case in immigration court.

Because these credible fear interviews occur after an asylum seeker has already been processed by CBP officers at the border or ports of entry, asylum officers are able to ask about any encounters with CBP. The limited records USCIS offered in response to the FOIA show that asylum officers often had serious concerns about the behavior of its sister agency.

The documents produced to date demonstrate how grave the problem is:

  1. One email from an asylum officer to a supervisor expresses a belief that there are “significant issues in how some Border Patrol officers are screening individuals.”
  2. A second email discusses an incident where “CBP mocked a transgender woman for hours and refused to record her fear” of returning to her home country. These internal reports of CBP abuse match the reports of many asylum seekers who encountered abuse at the hands of CBP officers during the same time period.
  3. A third email from an asylum officer expressed concerns that an asylum seeker was coerced into withdrawing his request for asylum, with the officer writing that: “What is especially disturbing about this is that … the record indicates that [the asylum seeker] has been subjected to harassment, intimidation, and physical mistreatment by CBP upon his recent entry into the United States, and this mistreatment. . . affected his decision to dissolve his case.”

Records of CBP’s mistreatment of asylum seekers is especially important as the numbers of asylum-seekers at the border continue to rise. Last year, groups sued CBP, alleging a pattern or practice of unlawfully turning away asylum seekers who arrived at ports of entry and requested asylum. In light of CBP’s own inadequate complaint system, this new lawsuit could substantiate the many reports of the agency’s misconduct.

Both Judge Jeffrey Chase and I have “roasted” in prior blogs the BIA’s disingenuous and “clearly erroneous greenlighting” of Border Patrol statements in Matter of J-C-H-F, 27 I&N Dec. 211 (BIA 2018). Quite contrary to the BIA’s unjustified “head in the sand” presumption of regularity given these flawed statements, there is clear public evidence, compiled over more than a decade, that such statements should be considered “presumptively unreliable.”

In addition to addressing the elements of the bogus “test” enunciated by the BIA in J-C-H-F- what should advocates do to fight this type of clearly biased, largely “fact free,” unwarranted pro-DHS decision-making by the BIA?

  • First, as Jeffrey and I have pointed out, get the publicly available reports of the U.S. Commission on International Religious Freedom (“USCIRF”) which show that glaring errors in accuracy and reliability raised as long ago as 2006 remained unaddressed as of 2016.
  • Second, use the additional materials cited in the above article to show how DHS has suppressed its own internal documents establishing the unreliability of the Border Patrol statements.
  • Third, get in touch with Human Rights Watch and the American Immigration Council to see if any additional FOIA materials have been made available which establish unreliability.
  • Fourth, ask someone from Human Rights Watch about a database I have heard they are establishing to provide “hard evidence” to challenge the reliability of Border Patrol statements.

In the “Age of Sessions,” I wouldn’t hold my breath for the “captive” BIA to recede from its travesty in J-C-H-F-. That’s why it’s critically important for advocates to do a great job of “setting the record straight” in the Courts of Appeals.

But, to do that, evidence challenging the Border Patrol statements must be offered at the trial stage before the Immigration Judge. Documenting and exposing the BIA’s disingenuous decision-making will also undermine the BIA’s overall credibility before the Courts of Appeals and perhaps eventually lead to a reversal of the unjustified “Chevron deference” the Board currently receives.

Today’s Board masquerades as a deliberative “expert tribunal” that neither publicly deliberates nor possesses any obvious expertise — a situation aggravated because nobody who works for the biased White Nationalist xenophobe Jeff Sessions can legitimately be considered “unbiased” or “impartial” when it comes to adjudication of migrants rights. Don’t forget, even if the BIA rules in the respondent’s favor, something that happens less and less these days, each an every BIA decision is subject to an inappropriate “certification and reversal” process by Sessions that he has shown little hesitation in invoking recently.

How can a respondent receive a “fair hearing” from a “court” where the Government’s leading enforcement figure holds all the cards? Obviously, he or she can’t! You can help make a record that eventually should force the “Article III’s” to shut down this “caricature of American justice.”
