“The Trump administration on Tuesday sought to allay growing fears among immigrant communities over wide-ranging new directives to ramp up enforcement against illegal immigrants, insisting the measures are not intended to produce “mass deportations.”

Federal officials cautioned that many of the changes detailed in a pair of memos from Homeland Security Secretary John F. Kelly will take time to implement because of costs and logistical challenges and that border patrol agents and immigration officers will use their expanded powers with care and discretion.

Yet the official public rollout of Kelly’s directives, first disclosed in media reports over the weekend, was met with outrage from immigrant rights advocates over concerns the new policies will result in widespread abuses as authorities attempt to fulfill President Trump’s goals of tightening border control.

Trump took a hard line against illegal immigration during his campaign, at times suggesting he would seek to create a nationwide “deportation force” to expel as many of the nation’s estimated 11 million unauthorized immigrants as possible.

In a conference call with reporters, a senior Department of Homeland Security official moved to avert what he called a “sense of panic” among immigrant communities.”

Summary: Duh! So, we roll out this big new program in the first 35 days of the new Administration to great fanfare. But, nobody considered the resource and funding implications with Congress. So, it’s much ado about nothing (for now). But, don’t you dare lie about all the great things we’ve already accomplished. Watch for the biased media falsely claiming that it’s all smoke and mirrors or that we’re already rounding up some of the folks we said we’d deport. We mean what we say, but we’re not actually doing what we said we’d do. What kind of fools would panic about that?

The Atlantic: The Eternal Wall — Even Two Terms Might Not Be Enough To Complete “Trump’s Folly!”

“The construction of a massive wall along the border of the United States and Mexico is one of President Donald Trump’s central campaign promises. And it’s a promise he intends to keep.

Within days of taking the oath of office in January, Trump began laying the groundwork for the construction of a series of walls and fences that would span some 1,250 miles along the border. On Monday, the Department of Homeland Security issued a memo outlining its commitment to “begin planning, design, construction and maintenance of a wall” to deter and prevent illegal entry into the United States. The memo follows an executive order in which Trump called for the wall’s “immediate construction.”

But how immediately can Trump’s wall be built?

One of the latest estimates, from an internal Department of Homeland Security report obtained by Reuters, is that the wall will take three-and-a-half years to build. The agency is aiming to seal the border in three phases of construction of fences and walls, completing its work by the end of 2020, Reuters reported.
But that estimate is almost certainly too ambitious, and for a few reasons. First and foremost, there’s the fact that Congress still has to approve the bulk of the money for a project that is likely to cost tens of billions of dollars, according to several estimates.

Even if lawmakers approved that kind of cash this week, the wall almost certainly wouldn’t be complete by the end of Trump’s first term—or even a potential second term. The “iron law” of infrastructural megaprojects, according to a paper by Bent Flyvbjerg published in the Project Management Journal in 2014, is that they will go “over budget, over time, over and over again.”

This is obviously the case in projects where everything that can go wrong seemingly does (think: Boston’s infamous Big Dig highway project). But even for well-managed megaprojects, building major infrastructure always seems to take longer than estimates suggest. Sometimes that’s because a time estimate only pertains to the actual construction—not the time leading up to it, says Andrew Natsios, the director of the Scowcroft Institute of International Affairs at Texas A&M University.”

President Trump Takes Very Nuanced Approach To DACA Retention — See The Video Clip From CNN

In the above video clip, President Trump takes a (perhaps surprisingly) very nuanced approach to the DACA kids. He realizes that most of them are wonderful and will do great things for America. He also sees the parallel with his own children and grandchildren.

I was encouraged that he appears to be listening to his own “better angels” here, rather than just to some of the “immigration hard-liners” surrounding him at the White House.  And, he very correctly points out that one of the things he must do is sell his solution to Congress, including many members of his own party who might be skeptics.

Don’t know how this eventually will play out. But, overall, this shows a reflective side of the President that we don’t often see showcased or tweeted. Well worth the couple of minutes it takes to view.

BREAKING: DHS Releases Final Border Enforcement Memos — Get “Fact Sheet” & All The Links You Need Here!

Enforcing the law. Under this executive order, with extremely limited exceptions, DHS will not exempt classes or categories of removal aliens from potential enforcement. All of those in violation of the immigration laws may be subject to enforcement proceedings, up to and including removal from the United States. The guidance makes clear, however, that ICE should prioritize several categories of removable aliens who have committed crimes, beginning with those convicted of a criminal offense.

Establishing policies regarding the apprehension and detention of aliens. U.S. Customs and Border Protection (CBP) and U.S. Immigration and Customs Enforcement (ICE) will release aliens from custody only under limited circumstances, such as when removing them from the country, when an alien obtains an order granting relief by statute, when it is determined that the alien is a U.S. citizen, legal permanent resident, refugee, or asylee, or that the alien holds another protected status, when an arriving alien has been found to have a credible fear of persecution or torture and the alien satisfactorily establishes his identity and that he is not a security or flight risk, or when otherwise required to do so by statute or order by a competent judicial or administrative authority.

Hiring more CBP agents and officers. CBP will immediately begin the process of hiring 5,000 additional Border Patrol agents, as well as 500 Air & Marine agents and officers, while ensuring consistency in training and standards.

Identifying and quantifying sources of aid to Mexico. The President has directed the heads of all executive departments to identify and quantify all sources of direct and indirect federal aid or assistance to the government of Mexico. DHS will identify all sources of aid for each of the last five fiscal years.

Expansion of the 287(g) program in the border region. Section 287(g) of the INA authorizes written agreements with a state or political subdivision to authorize qualified officers or employees to perform the functions of an immigration officer. Empowering state and local law enforcement agencies to assist in the enforcement of federal immigration law is critical to an effective enforcement strategy, and CBP and ICE will work with interested and eligible jurisdictions.

Commissioning a comprehensive study of border security. DHS will conduct a comprehensive study of the security of the southern border (air, land, and maritime) to identify vulnerabilities and provide recommendations to enhance border security. This will include all aspects of the current border security environment, including the availability of federal and state resources to develop and implement an effective border security strategy that will achieve complete operational control of the border.

Constructing and funding a border wall. DHS will immediately identify and allocate all sources of available funding for the planning, design, construction, and maintenance of a wall, including the attendant lighting, technology (including sensors), as well as patrol and access roads, and develop requirements for total ownership cost of this project.

Expanding expedited removal. The DHS Secretary has the authority to apply expedited removal provisions to aliens who have not been admitted or paroled into the United States, who are inadmissible, and who have been continuously physically present in the United States for the two-year period immediately prior to the determination of their inadmissibility, so that such aliens are immediately removed unless the alien is an unaccompanied minor, intends to apply for asylum or has a fear of persecution or torture in their home country, or claims to have lawful immigration status. To date, expedited removal has been exercised only for aliens encountered within 100 air miles of the border and 14 days of entry, and aliens who arrived in the United States by sea other than at a port of entry. The Department will publish in the Federal Register a new Notice Designating Aliens Subject to Expedited Removal Under Section 235(b)(1)(a)(iii) of the Immigration and Nationality Act that expands the category of aliens

subject to expedited removal to the extent the DHS Secretary determines is appropriate, and CBP and ICE are directed to conform the use of expedited removal procedures to the designations made in this notice upon its publication.

Returning aliens to contiguous countries. When aliens apprehended do not pose a risk of a subsequent illegal entry, returning them to the foreign contiguous territory from which they arrived, pending the outcome of removal proceedings, saves DHS detention and adjudication resources for other priority aliens. CBP and ICE personnel shall, to the extent lawful, appropriate and reasonably practicable, return such aliens to such territories pending their hearings.

Enhancing Asylum Referrals and Credible Fear Determinations. U.S. Citizenship and Immigration Services (USCIS) officers will conduct credible fear interviews in a manner that allows the interviewing officer to elicit all relevant information from the alien as is necessary to make a legally sufficient determination. USCIS will also increase the operational capacity of the Fraud Detection and National Security Directorate.

Allocating resources and personnel to the southern border for detention of aliens and adjudication of claims. CBP and ICE will allocate available resources to expand detention capabilities and capacities at or near the border with Mexico to the greatest extent practicable. CBP will focus on short-term detention of 72 hours or less; ICE will focus on all other detention capabilities.

Properly using parole authority. Parole into the United States will be used sparingly and only in cases where, after careful consideration of the circumstances, parole is needed because of demonstrated urgent humanitarian reasons or significant public benefit.

Notwithstanding other more general implementation guidance, and pending further review by the Secretary and further guidance from the Director of ICE, the ICE policy directive with respect to parole for certain arriving aliens found to have a credible fear of persecution or torture shall remain in full force and effect.

Processing and treatment of unaccompanied alien minors encountered at the border. CBP, ICE, and USCIS will establish standardized review procedures to confirm that alien children who are initially determined to be unaccompanied alien children continue to fall within the statutory definition when being considered for the legal protections afforded to such children as they go through the removal process.

Putting into place accountability measures to protect alien children from exploitation and prevent abuses of immigration laws. The smuggling or trafficking of alien children into the United States puts those children at grave risk of violence and sexual exploitation. CBP and ICE will ensure the proper enforcement of our immigration laws against those who facilitate such smuggling or trafficking.

Prioritizing criminal prosecutions for immigration offenses committed at the border. To counter the ongoing threat to the security of the southern border, the directors of the Joint Task Forces- West, -East, and -Investigations, as well as the ICE-led Border Enforcement Security Task Forces (BESTs), are directed to plan and implement enhanced counter- network operations directed at disrupting transnational criminal organizations, focused on those involved in human smuggling.

Public Reporting of Border Apprehensions Data. In order to promote transparency, CBP and ICE will develop a standardized method for public reporting of

statistical data regarding aliens apprehended at or near the border for violating the immigration law.”

Supremes Hear Case Today On Cross-Border Application Of U.S. Constitution!

“The gun was fired in the United States. The bullet stopped 60 feet away in Mexico — tragically, in the head of a 15-year-old boy named Sergio Adrián Hernández Güereca.

Border patrol agent Jesus Mesa Jr. pulled the trigger that day six years ago in the wide concrete culvert that separates El Paso from Juarez, Mexico. On Tuesday, the Supreme Court will consider whether the Constitution gives Hernández’s parents the right to sue Mesa in American courts for killing their son.

The case comes amid a time of increasing tension and controversy over how this country polices the daily churn along the border, where essential international commerce takes place alongside narcotics trafficking and human smuggling.

Courts have struggled to deal with the national security and foreign policy implications of the case, and the Supreme Court’s precedents.

If Hernández had been killed inside the United States, then the case could proceed. Or if he had been a U.S. citizen, it would not have mattered that Mesa was on one side of the border and he was on the other.

But the courts so far in Hernández’s case have said the Constitution does not reach across the border — even 60 feet — to give rights to those without a previous connection to the United States.”

The case is Hernandez v. Mesa, and either way the Court decides, it’s likely to play an important role in the effort to enhance U.S. border enforcement.

NYT Editorial Blasts Trump Administration’s Anti-Immigrant Fear Mongering!

In an Editorial that first appeared on Feb. 18, 2017, the NY Times wrote:

“Another DACA recipient, Daniela Vargas of Jackson, Miss., barricades herself in her home after agents detain her father and brother. A mother of four, Jeanette Vizguerra, seeks refuge, alone, in a Denver church basement. A group of Latino men leaving a church-run homeless shelter near Alexandria, Va., are surrounded by a dozen immigration agents who question them, scan their fingerprints and arrest at least two of them. [Emphasis Added.]

President Trump’s defenders say the arrest numbers from Immigration and Customs Enforcement are comparable to those under President Barack Obama, an energetic deporter-in-chief. That may be true, for the moment, but the context is vastly different. Mr. Trump’s campaign pledges, his flurry of immigration-related executive orders, including his ban on certain travelers from Muslim countries, have a common thread. They reflect his abandonment of discretion, of common sense, his rejection of sound law-enforcement priorities that stress public safety and respect for the Constitution.

They prioritize fear instead.

ICE and the Border Patrol under Mr. Obama were ordered to focus on arresting serious criminals and national-security risks. Mr. Trump has removed those restraints in the name of bolstering his “deportation force.” He wants to triple the number of ICE agents. He wants to revive federal agreements to deputize state and local police officers as immigration officers. He wants to increase the number of detention beds and spur the boom in private prisons.

This vision is the one Donald Trump began outlining at the start of his campaign, when he slandered an entire country, Mexico, as an exporter of rapists and drug criminals, and an entire faith, Islam, as a global nest of murderers. This is the currency of the Trump aides Stephen Bannon and Stephen Miller, who have brought the world of the alt-right, with its white nationalist strain, into the White House.

Where could the demonizing and dehumanizing of the foreign born lead but to a whiter America? You have heard the lies from Mr. Trump: that immigrants pose a threat, when they are a boon. That murders are up, when they are down. That refugees flow unimpeded into the country, when they are the most meticulously vetted people to cross our borders. That immigrants and refugees are terrorists, when they are the ones being terrorized.

For those who would resist the administration, there is much to do, and not a lot of time. Congress is not a check. Democrats there are outnumbered, speaking out but waging symbolic resistance for now. Republicans are mostly split between avoiding the subject and cheering on Mr. Trump.”

On a personal note, the “church shelter incident” involved the Rising Hope Mission Church in the Alexandria area of Fairfax, Co., VA. This church is devoted to meeting the needs of the most vulnerable in our community and is a mission outreach project funded by local United Methodist Churches, including the Beverley Hills Community United Methodist Church to which my wife and I belong. Among other things, Rising Hope serves as a hypothermia shelter, and actions like this by ICE serve to discourage individuals from seeking potentially life-saving assistance.

Looks like everything is a “priority,” almost everyone will be detained, and DHS Assistant Chief Counsel won’t be offering PD or other negotiated “deals” except in extraordinary situations.

It’s not even clear from this whether the ACCs will still have authority to “waive appeal” in cases where the DHS loses. If not, that means that the BIA could also be overwhelmed with marginal DHS appeals.

While one of the memos notes the 534,000 Immigration Court backlog, there is a total disconnect in putting all these new priorities into Immigration Court without any plan for dealing with the 534,000 already there. (Most folks already here arrived at least two years ago, so even the greater use of expedited removal will leave hundreds of thousands of potential new filings for the Immigration Courts.)

When everything is a priority, nothing is a priority! Looks to me like another ill-conceived, “built to fail,” scheme.  Over time, these plans are likely to be taken apart by the Article III Courts, bit by bit, piece by piece, until we have total chaos in the immigration enforcement system. Haste makes waste.

After 20 Years In The U.S., Denver Mother Of Three Faces Removal

“DENVER — In the basement of a white stone church here on Tuesday night, Jeanette Vizguerra gathered up her three youngest children, slipped them into pajamas and asked herself perhaps the hardest question of her life.

Should she present herself to the immigration authorities Wednesday morning for a scheduled check-in, risking deportation?

Or should she stay in the church, one of the few places federal agents do not go, almost surely resigning herself to months or years trapped inside?

“Tonight, I have to think,” Ms. Vizguerra said. “Because I promised my children — and it was a promise — that it was going to be very difficult to remove me from this country. I have already fought so long to be here; now is not the time to give up.”

It has been a difficult week for Ms. Vizguerra, 45, one of millions of undocumented immigrants contending with an uncertain future in the Trump administration. After she was convicted several years ago of using fake documents, Ms. Vizguerra, who has spent 20 years working in the United States, was ordered out of the country. But she was granted at least five postponements of deportation, and in December, her lawyer, Hans Meyer, asked for another.

Nothing happened. She was due for a regular check-in at the local office of Immigration and Customs Enforcement on Wednesday, and as the day crept closer, Ms. Vizguerra realized the possibility that she could be whisked onto a plane and separated from her three American-born children: Zury, 6, Roberto, 10, and Luna, 12.”

Meet Presidential Senior Adviser Stephen Miller, The Man Behind President Trump’s Immigration Policies!

Rosalind S. Helderman writes in a front-page article in today’s Washington Post:

“After attending Trump’s inauguration, Jared Taylor, another high-profile white nationalist, posted a piece to his website in which he wrote that Trump is “not a racially conscious white man” but that there “are men close to him — Steve Bannon, Jeff Sessions, Stephen Miller — who may have a clearer understanding of race, and their influence could grow.”

In an interview, Taylor said he was “speculating” and that he has not met or spoken with Miller.

Miller said he has “profound objections” to the views advanced by Taylor and Spencer, saying: “I condemn this rancid ideology.”

Elder, who is black, said he has never heard Miller speak of Spencer or Taylor or express what he considers racist views.

Instead, Elder said, Miller believes as he does: “Race and racism are no longer major problems in America. This is the fairest majority-white country in the world. If you work hard and make good decisions, you’ll be fine.”

Miller said that his views at the time were best summed up in a 2005 column in the Santa Monica Mirror, titled “My Dream for the End of Racism,” in which he argued that Americans should focus on how far the country has come in overcoming such prejudice. “No one claims that racism is extinct — but it is endangered,” he wrote. “And if we are to entirely extract this venom of prejudice from the United States, I proclaim Americanism to be the key.”
Focusing on “multiculturalism,” he wrote, has had the effect of keeping different groups separate.

Miller’s White House role is in many ways a departure for an activist who has mostly seen himself as representing an oppressed political minority. Now he holds the power, helping to drive the government while working steps from the Oval Office.

Bitner said he wonders how Miller’s tactics will translate.

“I don’t think he’s had the opportunity to practice this,” he said. “These are all outsiders, many of them people who have been vocal minorities. How do you transition from there to governing?”

Summary: White guy is born into a well-to-do family in Southern California. Leads life of privilege and opportunity. Goes to diverse high school and is offended that Mexican Americans and other fellow students of different backgrounds are unwilling to accept the status quo and also want their “piece of the pie.” Voluntarily adopts borderline racist, white supremacist philosophy that converts him into a “persecuted minority” within his own privileged class. Like former boss and mentor Attorney General Jeff Sessions, bristles with righteous self-indignation when anyone has the gall to accuse him of sharing the noxious philosophies of those who have consistently applauded and felt empowered by his rise. Now holds position of power in government he basically despises where he can actively shove his extreme and divisive philosophy down the collective throats of the majority of Americans who don’t share his negative outlook. I suppose that it’s an overall positive for the American political system and its freedom of expression that even a self-created “philosophical minority” like Miller can find success.

“WASHINGTON, Feb 9 (Reuters) – President Donald Trump’s “wall” along the U.S.-Mexico border would be a series of fences and walls that would cost as much as $21.6 billion, and take more than three years to construct, based on a U.S. Department of Homeland Security internal report seen by Reuters on Thursday.

The report’s estimated price-tag is much higher than a $12-billion figure cited by Trump in his campaign and estimates as high as $15 billion from Republican House Speaker Paul Ryan and Senate Majority Leader Mitch McConnell.

The report is expected to be presented to Department of Homeland Security (DHS) Secretary John Kelly in coming days, although the administration will not necessarily take actions it recommends.

The plan lays out what it would take to seal the border in three phases of construction of fences and walls covering just over 1,250 miles (2,000 km) by the end of 2020.”

CBS News: “Overloaded U.S. immigration courts a ‘recipe for disaster'”

“President Donald Trump is taking what he portrays as a hard-nosed approach to undocumented immigrants, issuing an order this week to boost the number of U.S. border patrol agents and to build detention centers.

But what happens when a federal push to ramp up arrests and deportations hits a severely backlogged federal court system?

“It’s a recipe for a due process disaster,” said Omar Jadwat, an attorney and director of the Immigrant Rights Project at the ACLU. Already, he pointed out, there are “large, large numbers of caseloads” in immigration court, and Mr. Trump’s directives threaten to greatly increase the number of people caught in the system, he said.

Just how backlogged is the system for adjudicating deportations and related legal matters? America’s immigration courts are now handling a record-breaking level of cases, with more than 533,000 cases currently pending, according to Syracuse University’s TRAC, a data gathering site that tracks the federal government’s enforcement activities. That figure is more than double the number when Mr. Obama took office in 2009.

As a result, immigrants awaiting their day in court face an average wait time of 678 days, or close to two years.
Immigrant rights advocates say the backlog is likely to worsen, citing Mr. Trump’s order on Wednesday to hire 5,000 additional border patrol agents while also enacting a freeze on government hiring. Whether the U.S. Justice Department, which oversees the immigration courts, will be able to add judges given the hiring freeze isn’t clear.

A spokeswoman from the DOJ’s Executive Office for Immigration Review said the agency is awaiting “further guidance” regarding the hiring freeze from the Office of Management and Budget and the Office of Personnel Management. In the meantime, she said, the agency “will continue, without pause, to protect the nation with the available resources it has today.”

The situation is likely to get much worse in the U.S. Immigration Courts.  Obviously, due process is not going to be a high priority for this Administration.  And, while the Executive Orders can be read to give Attorney General Jeff Sessions authority to continue hiring Immigration Judges, filling the 75 or so currently vacant positions won’t begin to address the Immigration Courts’ workload problems.

Then, there are the questions of space and support staff. One of the reasons more vacancies haven’t been filled to date is that many Immigration Courts (for example, the U.S. Immigration Court in Arlington, VA) have simply run out of space for additional judges and staff.

The parent agency of the Immigration Courts, “EOIR,” is counting on being allowed to continue with expansion plans currently underway.  But, even if Attorney General Sessions goes forward with those plans, that space won’t be ready until later in 2017, and that’s highly optimistic.

This does not seem like an Administration that will be willing to wait for the current lengthy highly bureaucratic hiring system to operate or for new Immigration Judges to be trained and “brought up to speed.”  So various “gimmicks” to speed hiring, truncate training, and push the Administration’s “priority cases” — likely to be hundreds of thousands of additional cases — through the Immigration Courts and the Board of Immigration Appeals at breakneck speed.

Consequently, the whole “due process mess” eventually is likely to be thrown into the U.S. Courts of Appeals where “final orders of removal” are reviewed by Article III Judges with lifetime tenure, rather than by administrative judges appointed and supervised by the Attorney General.

Forbes: “Don’t Mess Around With Slim” — Has Trump Bitten Off More Than He Can Chew In Provoking Economic/Trade Confrontation With Mexico?

“At the press conference, Slim was flanked by two of his sons and a son-in-law and holding Trump’s books “Great Again” and “The Art of The Deal.” Slim called the American President a “great negotiator” who knows how to take advantage of weak adversaries.

Slim praised the Mexican President for calling Trump’s bluff and said that the outpouring of support for Peña Nieto showed Trump that Mexico is united to face the challenge.

This week’s unusual public showdown with Mexico–a friendly nation closely linked to the U.S. by geography, trade, culture and history—plunged U.S.-Mexico relations to a new low.

But in an apparent effort to cool tensions, Trump and Peña Nieto spoke for an hour by phone on Friday. The Mexican president’s office said in a statement that the two presidents, “agreed for now to not speak publicly about” the wall. Slim said the call between the leaders was a result of Mexico standing up to Trump. He suggested they should talk more and tweet less.

“Lack of unity brought Mexico five wars and four losses of territory. We learned that lesson. We have always been stronger united. We have to negotiate with Trump from a position of strength, without anger or submission. It will be a difficult and hard negotiation,” Mexico’s richest man said.

Slim said the “best wall” to prevent Mexicans from going North would be investment that creates job opportunities in Mexico.

Slim’s call for unity comes a week after a Mexican poll gave Slim the highest percentage approval among Mexican public figures as the best qualified person to face Trump. With his popularity approaching single digits, most Mexicans see Peña Nieto as politically too weak to stand up to Trump.”

While Slim no longer holds the title of “World’s Richest Person” (that’s Bill Gates at $84.2 billion) his #6 ranking and $50 billion net worth is not too shabby and still makes hm the richest person in Latin America. Slim makes President Trump, who weighed in at a distant #502 with a mere $3.7 billion net worth, look like a “loser” by comparison.  Trump’s economic sword rattling has also helped Slim become the most popular man in Mexico and the one most Mexicans would choose to “do battle” with Trump at the negotiating table.

Politico Maggie: Former State Department Coordinator For International Terrorism Ambassador Daniel Benjamin Says Trump’s Unjustified Actions Threaten National Security, Diminish U.S. As A Nation!

With his executive action suspending the admission of refugees to the United States and temporarily halting the entry of citizens from a variety of Muslim countries, President Donald Trump made a quick down payment on a key campaign promise. He also set the U.S. on a disastrous course—one that threatens to weaken our national security and diminish American global leadership.

The order signed on Friday calls for a temporary ban on visas for individuals from Iran, Iraq, Syria, Sudan, Libya, Yemen and Somalia; a 120-day suspension of the resettlement of all refugees; and an indefinite ban on the resettlement of Syrian refugees.
It is hard to find any real basis for this action. During the campaign, Trump made frequent, unfounded claims that we have a “dysfunctional immigration system” and that unknown people are pouring through our borders. But over the past decade and a half, U.S. immigration enforcement has improved vastly to the point where it bears scant resemblance to the system whose vulnerabilities were exposed on 9/11. Travelers from all over the world are screened three or more times, with their names run through databases that draw on staggering amounts of intelligence and law enforcement information. The process flags all manner of misdeeds or suspicious information.

We should also expect the order to anger Muslim partners around the world. Shutting the door on Iraqis, on whom we are relying in the ground fight against ISIL, isn’t going to help in that ongoing conflict. As one Iraqi asked on CBS news last night, “How is this our fault? … We are the victims. In fact, American ISIS fighters have come here.” At a moment when U.S. influence in the region is at a low ebb, and Russia, Iran and Turkey are collaborating in Syria and excluding the U.S., the American president should be concerned with building goodwill, not eroding it.

Beyond sending a negative message to Muslims around the world, the decision to stop resettlement of Syrian refugees bespeaks a meanness of spirit that is completely at odds with American values. Indeed, it’s almost unimaginable that today anyone would need to cite Emma Lazarus’s sonnet on the pedestal of the Statue of Liberty as a testament to what the nation has stood for, but perhaps things are just that upside down. Although Europe has a problem with uncontrollable surges of migrants, including many from Syria, the U.S. does not, nor has there been a case of Syrian extremists plotting violence here.

In fact, there is so much scrutiny of Syrian refugees that the federal bureaucracy, unprompted by any unwelcome incident, is reinvestigating several dozen Syrians who were admitted to the country even though their vetting was incomplete. (The errors were first discovered in 2015 and corrected last year.) And yet, despite that record, the Trump administration is determined to punish further the victims of the worst humanitarian crisis since World War II.

Pretty much anyone but Trump might see the post-election period, when the pressure of the political horse race is gone, as a moment for American leadership. Migration threatens the viability of the European Union as well as the political stability of American allies such as Jordan, Turkey and others. Even beyond Syria, political turmoil and failing economies are driving migrants to leave their homes for safer, more prosperous countries.

The only way to deal with this genuinely global phenomenon is with a mixture of economic assistance to improve prospects in countries from which people are migrating and an international effort to apportion and resettle those who genuinely can’t go back—which would require the U.S. to resettle substantially more refugees than it was before Trump halved the number for the coming year. Of course, it’s not surprising that America’s least philanthropic billionaire—whose name is on scores of buildings used to make profits but on no university edifices, museums or concert halls—wants to pull up the ladder that so many have used over centuries to escape to a better life. And given that his “America First” slogan evidently means giving little or nothing to anyone else, it’s impossible to imagine Trump showing the farsightedness to supply urgent development assistance or to drive a solution for this catastrophe—actions that would bolster U.S. national security in the longrun.

Does it need to be said again? Great countries don’t behave this way.”
