The Department of Health and Human Services (HHS) Office of Inspector General (OIG)’s new report found the Trump administration’s policy changes in 2018 exacerbated the mental health needs of “unaccompanied alien children” in their custody. The unaccompanied alien children in this study are overwhelmingly asylum seekers from Central America. No one should be surprised that the OIG found two particular policies — separating children from their parents and prolonging the time children are in custody — are especially harmful to the children’s mental health.

Researchers, mental health professionals and policymakers have known for years that refugee children are likely to have experienced traumas that challenge their mental health. Studies in the United States and in Europe have established that asylum-seeking children and adolescents are likely to have post-traumatic stress symptoms, anxiety, depression and externalizing behaviors.  Given that the escape of many of these Central American children was prompted by violence and deprivation in their home countries, they certainly are at high risk of developing mental disorders.

Last year I wrote that the Trump administration “knew it would cause lasting harm, and still took children from parents.” In July 2018, Jonathan White, the former deputy director of children’s programs in the HHS Office of Refugee Resettlement (ORR), testified to Congress that he had warned administration officials, early in the discussions to ramp up the zero tolerance toward asylum seekers, about the harm such policies pose to children. White argued that the separation of children from parents entails “significant risk of harm to children” as well as “psychological injury.” But administration officials overruled White.

The policy of family separation happens less frequently now; the Department of Homeland Security (DHS) reported that 911 children were taken from their asylum-seeking parents in the year after the June 26, 2018, court order to stop the practice. About 30 children whom DHS took from their parents during the peak of the policy in 2018 still remain separated from their parents. The new OIG report documents the deleterious effects this policy has had on the mental health of these children.

The House Committee on Oversight and Reform in July released a report of their investigation of the child-separation policy. The committee’s set of findings on how long children were held in custody is among the deeply troubling results — and not just because they found evidence the administration violated federal law on how long DHS can hold a child in detention. After DHS transferred custody to ORR, the committee reports that “records show that children of all ages were held in ORR custody for extensive periods of time.” The average was 90 days, with some children in ORR custody for more than 18 months.

When the committee’s findings are overlaid on the OIG study, the picture of the extensive damage to children’s mental health becomes even sharper. More precisely, the other policy the OIG found that was especially damaging to asylum-seeking children is the practice of prolonging the time children are in custody. “Facilities reported that children with longer stays experienced more stress, anxiety, and behavioral issues, which staff had to manage. Some children who did not initially exhibit mental health or behavioral issues began reacting negatively as their stays grew longer.”

If you are thinking that these compelling, thorough reports are prompting an end to this human tragedy — enter stage right the new DHS rule for the “Apprehension, Processing, Care and Custody of Alien Minors and Unaccompanied Alien Children.” This regulation takes aim at the 1997 court-ordered consent decree, known as the Flores settlement, that limits the detention of children and set standards for their care. Among other things, the new rule would allow DHS to indefinitely detain migrant families, including those arriving to seek asylum. Administration officials assured that they would provide high standards for the care of children. The official press release stated “all children in the Government’s care will be universally treated with dignity, respect and special concern, in concert with American values and faithful to the intent of the settlement.”

However, the new rule eliminates the requirement that facilities holding families with children be state-licensed facilities. DHS would be responsible for licensing the family detention centers. Given the reports this summer of squalid conditions at facilities overseen by DHS, including a scathing “management alert” report by DHS’s Office of Inspector General, a new policy of prolonged detention of families and children seeking asylum is frightful. Attorneys general representing 20 states have sued to stop the policy change.

Two wrongs don’t make a right — but they do make a place in this administration’s immigration policies.

Astoundingly, we’re seeing an institutional failure of our democratic republic that took more than two centuries to build in a little more than two years of Trump’s lawless authoritarian rule.  

Trump might not be the brightest bulb in the pack, but he has proved to have amazing talent for exploiting democracy’s weaknesses and co-opting and “weaponizing” supposedly democratic institutions to further his plan of destroying them completely. Lots of supposedly smart guys out there these days sucking up and doing his bidding.

When a 2-year-old Guatemalan boy had trouble staying silent in an immigration courtroom, the judge pointed his finger at him.

“I have a very big dog in my office, and if you don’t be quiet, he will come out and bite you,” the judge, V. Stuart Couch, a former Marine, yelled at the toddler in a 2016 hearing, according to a formal complaint shared by the Charlotte Center for Legal Advocacy and first reported this week by Mother Jones.

“Do you want him to bite you?” Couch asked.

The boy, his mom and their advocate were all soon sobbing. Couch later acknowledged that he “did not handle the situation properly,” according to the judge who investigated the complaint, Deepali Nadkarni.

Clearly, Couch didn’t have a child’s well-being in mind on that day. But ignoring the welfare of our young is a day-to-day problem in America, where our children are falling behind those in other wealthy countries.

On Thursday, 10 Democratic presidential candidates will debate. It would be a natural opportunity to provoke a national conversation on the subject. But a question about child poverty hasn’t been asked at a presidential debate in 20 years, not since a Republican primary debate in 1999, according to the Children’s Defense Fund.

Presidential candidates have been asked about the World Series, about cursing in movies, even about flag lapel pins more recently than they have been questioned about child poverty. We’ve had 147 presidential debates in a row without a single question on the topic (here’s a petition calling for more questions on the issue). I hope Thursday’s debate won’t be the 148th.

UNICEF says America ranks No. 37 among countries in well-being of children, and Save the Children puts the United States at No. 36. European countries dominate the top places.

American infants at last count were 76 percent more likely to die in their first year than children in other advanced countries, according to an article last year in the journal Health Affairs. We would save the lives of 20,000 American children each year if we could just achieve the same child mortality rates as the rest of the rich world.

Couch is one of America’s worst judges. One might therefore fairly ask why he recently was “rewarded” for his bias, unprofessionalism, and documented poor performance when Trump Sycophant Barr “elevated” him to the appellate bench? Perhaps, so he can abuse more women and children across the country?

But, as the Supremes and the GOP have decided to endorse and encourage child abuse, the question is whether the Dems can get it together to end the abuse before it’s too late for America and the world.

Child abusers like Trump, Couch, Barr, and the gang over at DHS are used to getting away with it. They are encouraged by a do nothing Congress, complicit Federal Judges, and a Trump base that has declared war on traditional American values and human decency. But, the consequences of their misconduct, and the unwillingness of the US political and legal system to stand up for children, won’t end well in the long run.

In the meantime, remember the names of the abusers and their enablers, some of them serving in our highest court and as GOP Senators and Representatives.

A CYNIC, says a character in one of Oscar Wilde’s novels, is someone who knows the price of everything and the value of nothing. If that’s true, then the debate over the state of labor in the United States these days is awash in cynicism — or maybe it could just be called plain old hypocrisy. And in truth, it’s not so much a debate as a shouting match, largely over the inflamed issue of immigration.

Most of the noise comes from restrictionists, encouraged and shamelessly egged on, for the first time in memory, by a president of the United States. Such people recite figures they have assembled regarding the costs of immigration: its effects on wages, government spending and, of course, our “culture,” which some might take as a cover word for race or ethnicity or religion. But a lot of these compilations are questionable, both in their origins and their conclusions.

And beyond that, there is a great contradiction in such reasoning: It fails to take account of the work immigrants do in this country — the fruits of their labor, which are shared by the entire society. The skylines of metropolitan areas such as ours have been transformed over the past quarter-century by new construction, with immigrants providing a considerable share of the labor. Many of our hospitals, clinics, day-care centers, hotels, homes for the elderly and other institutions could not exist without immigrant employees, who made up about 17 percent of this country’s workforce in 2018, according to a government report.

A quarter of immigrants, in turn, are thought to be unauthorized. Although they are regularly slandered — by the president, among others — as a source of crime and as living off the dole, they are, for the most part, as law-abiding as the general population and are eligible for few government benefits. Not many people with personal knowledge of the matter would question their work ethic. Their labors in farm and field help feed the country; replacing them there would be a daunting task. They serve in some of the most demanding and often unpleasant jobs in our society: slaughtering animals, working long hours outdoors in punishing heat and cold, caring for the elderly, sick and mentally ill, cleaning four or five homes a day.

Strangely enough, this sort of thing is rarely discussed in any serious way on the cable outlets and social media. There is much in the way of insult and calumny toward impoverished immigrants (they “make our country poorer and dirtier,” said one popular TV opinionizer) but little constructive thought on how this country, with a static and aging native population and a tightening labor market, can continue to prosper without a reasonable amount of immigration.

Although unauthorized immigrants are routinely demonized by some in Congress and the media, there is a sizable part of the country, perhaps a majority, that does not consider their presence here to be criminal, that in fact sympathizes with them. There aren’t many other kinds of lawbreakers of whom that can be said. The recent immigration raid on agricultural processing plants in Mississippi, in which nearly 700 workers were rounded up, brought forth a wave of help and support for the workers and their families from people around the country, including churches and neighbors in Mississippi.

Practical and intelligent proposals are being made for dealing with the problems of immigration and work. But nothing can be done unless more of this country pays attention to the realities in working America in the coming election year and not to the dark maundering of demagogic doomsayers.

Largely what I’ve been saying all along on “Courtside.” The solution to the largely manufactured “immigration crisis” is staring us in the face. 

Legalize those already in the labor force, so that they can be fully protected from exploitation by minimum wage, wage and hour, and OSHA laws, and reach their full economic potential in our society (which would also maximize tax revenues and Social Security contributions). 

Then, provide many more legal immigration opportunities for workers and families, both permanent and temporary, to keep America great and prevent us from suffering the type of economic stagnation that has hit Japan and other “low immigration” countries.

The main things standing in the way of such rational and practical solutions are Trump and the hard core GOP restrictionists who prop him up.

Sadly, it also appears that some, not all, within the massive DHS bureaucracy have become invested in cruel and futile immigration enforcement which requires endless taxpayer money and bodies to maintain its cycle of inevitable, yet sometimes politically advantageous, “enforcement-only” failures.

A Timeline of the Trump Administration’s Efforts to End Asylum

United States law enshrines the protections of the international Refugee Convention, drafted in the wake of the horrors of World War II. The law provides that any person “physically present in the United States or who arrives in the United States … irrespective of such alien’s status, may apply for asylum….”1 Since President Trump’s inauguration, the federal government has unleashed relentless attacks on the United States asylum system and those who seek safety on our shores. Internal memos have revealed these efforts to be concerted, organized, and implemented toward the goal of ending asylum in the United States as we know it.2 This timeline highlights the major events comprising the administration’s assault on asylum seekers.

July 2019

Asylum Ban 2.03 (barring migrants who cross through another country prior to arriving at the U.S. border from asylum eligibility)

√ The administration published an Interim Final Rule banning all people, including children, who have traveled through another country to reach the United States from applying for asylum.

√ Status: The rule is partially in effect and partially blocked. A federal district court judge in California issued a Temporary Restraining Order on July 16, 2019 in California in East Bay Sanctuary Covenant et al. v Trump, finding the ban to likely violate the asylum provisions of U.S. federal law and raising concerns regarding the administration’s failure to allow for notice-and- comment rulemaking.4 The government appealed to the U.S. Circuit Court of Appeals for the Ninth Circuit, which kept the injunction in place only with regard to the geographic region covered by the Ninth Circuit (California and Arizona) and allowed the government to implement the rule across the rest of the southern border. On August 26th, the government

petitioned the Supreme Court to intervene and allow implementation of the rule nationwide during the remainder of the litigation. That petition remains pending.5

All undocumented immigrants in the interior become targets for arrests and deportation through new Interim Final Rule expanding procedures that expedite deportation6

√ Pursuant to another major regulatory change implemented as an Interim Final Rule, any undocumented individual who cannot prove to have been continuously present in the U.S. for at least two years can be placed in a fast-track deportation process, without the opportunity to plead their case in front of an immigration judge or get the help of an attorney.7 Expedited removal proceedings do allow individuals to seek referral to an immigration court proceeding to seek asylum, but the program has been consistently criticized for officers’ failure to identify legitimate asylum seekers, resulting in the return of many to harm.8

√ Status: Because of its issuance as an Interim Final Rule, the expansion of expedited removal is already in place. A lawsuit challenging this inhumane rule was filed on August 6, 2019.9

Attorney General Barr certifies yet another case to himself and further diminishes grounds of asylum – Matter of L-E-A-10

√ Attorney General Barr reversed yet another BIA decision, this time strictly limiting asylum eligibility for individuals targeted and harmed due to their family membership.11

√ Status: This ruling effectively limits, or in some cases eliminates, the possibility of even presenting a claim for asylum for individuals who are fleeing harm on the basis of their membership in a particular family.

New pilot program gives border patrol officers the authority to conduct credible fear interviews12

√ Stephen Miller has been promoting the implementation and expansion of a pilot program that would allow CBP officers, rather than trained asylum officer working under USCIS supervision, to conduct credible fear interviews. Requiring asylum seekers, recently arrived and fleeing fresh trauma, to articulate their fear of return to uniformed CBP officers will certainly mean that many asylum seekers will be forcibly returned to harm and death.

√ Status: Unclear when this proposal will be formally implemented. Mark Morgan, Acting Chief of CBP, testified to Congress in July 2019 that CBP officers are currently undergoing training in order to conduct these types of interviews.13

The administration √ announces it has reached a deal with Guatemala to

halt the flow of Central American migrants to the U.S.14

In July the U.S. government announced it had reached an agreement with the government of Guatemala. Although the details are uncertain, the administration seems to consider the agreement to set the stage for a “safe third country” agreement that would require all asylum seekers arriving at the southern border who passed through Guatemala, other than Guatemalans, to be transferred to Guatemala to present an asylum claim there. The announcement of the agreement has prompted widespread condemnation in both countries, as it appears to constitute a back-door sealing of the southern border to asylum in the U.S. and would likely prompt an unmitigated political and humanitarian crisis in Guatemala, one of the most dangerous countries in the world.15

√ Status: Unclear whether or when the regulations and agreements necessary to implement the agreement will be finalized.

May 2019

USCIS issues a memo16 √ attempting to undercut protections provided to unaccompanied children during the asylum process

The memo undermines the few but essential protections provided to unaccompanied children in their asylum proceedings, including exemption from the one-year filing deadline and non-adversarial asylum interviews with an asylum officer, by requiring immigration adjudicators to continually re-adjudicate a child’s designation as unaccompanied.17 These new procedures undoubtedly impact children’s ability to effectively access their right to asylum by stripping away protections specifically designed to reflect the vulnerability of children who arrive at a border alone.

√ Status: The memo became effective June 30, 2019. In August 2019, a federal district court issued a Temporary Restraining Order prohibiting USCIS’s implementation of the memo.18

The White House releases a memo calling for regulations that would

A Surge Of Immigration Judges Are Expected To Handle The Cases Of Thousands Forced To Wait In Mexico

A 10-month-old boy, whose family fled violence in El Salvador, waits in a tent in Tijuana, Mexico, for an immigration court hearing in the US.

Department of Homeland Security officials expect about 150 immigration judges from across the US will be selected to handle cases involving asylum-seekers forced to remain in Mexico while their cases proceed, according to a source with knowledge of the matter, a massive potential increase in assignments that threatens to overwhelm an already struggling court system.  

Around a dozen judges currently presiding over courts in San Diego and El Paso, Texas, handle the cases of people referred under Migration Protection Protocols, the controversial Trump administration policy forcing asylum-seekers to remain in Mexico as their cases move through the immigration system. While the cases can take months or years to be scheduled, the number of individuals included in the program has expanded to more than 35,000, according to figures obtained by BuzzFeed News.

The Trump administration hopes to change that by soon opening facilities along the border to handle the cases. Officials plan to open two border courts in Texas — in Laredo and Brownsville — by the middle of September, in which they will hear up to 20 cases per day, according to a government briefing document obtained by BuzzFeed News. A DHS spokesperson said the date the facilities would open was still to be determined.

On Tuesday, Rep. Lucille Roybal-Allard, who chairs the House DHS Appropriations Subcommittee, revealed in a letter that the agency had plans to transfer $155 million in federal disaster funds to Immigration and Customs Enforcement to help fund the new facilities.

The cases heard at the border are expected to be conducted primarily via video teleconferencing, allowing for more judges across the country to be brought into the process. Assistants, working on contract, will help organize the hearings by taking roll call, send case documents to judges in other locations, and operate the video systems, according to a separate DHS planning document obtained by BuzzFeed News.

Judges assigned these cases could be forced to delay other asylum and deportation hearings that had already been scheduled, causing a ripple effect and further growing an already bloated court backlog of hundreds of thousands of cases.

“Once again immigration judges from courts across the country will have to push their home court dockets aside to preside televideo at border courts,” said one immigration court official who could not speak publicly on the matter. “This will wreak havoc on court dockets across the country.”

At a San Diego court that has presided over many “Remain in Mexico” cases for months, judges have been told to prioritize the hearings over others, according to a source with knowledge of the change. As a result, some immigrants who have waited for months or years for their previously scheduled cases will likely have their hearings delayed.

“The prioritization of MPP cases will place a huge burden on the immigration courts,” said a DOJ official involved with immigration matters. “Additionally, the postponement of previously scheduled cases will cause the backlog to grow even more, as the completion of these cases will be further delayed for months or even years.”

Rebecca Jamil, a former immigration judge under the Trump administration, said that the cases on judge’s dockets don’t go away when they are assigned new cases.

“Those families have been waiting for years to have their cases heard, and now will wait another two or three years, and due process is denied by the delay — evidence becomes stale, witnesses die, country conditions change,” she said.

The Department of Justice, which oversees the Executive Office for Immigration Review, which manages the nation’s immigration courts, is prepared to meet the demands from the DHS on any hearings, an agency spokesperson said.

The potential changes come as data revealed by Syracuse University indicates that asylum-seekers forced to wait in Mexico rarely have legal representation; just 1% of individuals are accompanied by attorneys at their hearings.

The Remain in Mexico program is one of the few hardline Trump immigration policies that has thus far survived a court injunction. While a federal court judge in San Francisco blocked the policy earlier this year, a 9th Circuit Court of Appeals panel allowed it to continue as a legal challenge works its way through the court process.

Asylum-seekers who were returned to Mexico under the Trump administration have faced consequences of remaining there, according to advocacy group Human Rights First. The group found more than 100 cases of people returned under the program alleging rapes, kidnappings, sexual exploitation, or assault, according to a report released this month.

This is the result of the complete abdication of duty by the Ninth Circuit in Innovation Law Lab v. McAleenan, that lifted a proper, life-saving U.S. District Court injunction and allowed the Administration’s patently illegal and immoral “Kill ‘Em in Mexico Program” to proceed.

The solution:  There is no such thing as a “fair” asylum denial under this program. Yes, not everyone meets the criteria. But, everyone is entitled to a fair chance to present a claim, free from duress, coercion, and biased judging, which is not happening. 

Advocates must flood the Ninth Circuit and the other border circuits with petitions for review and other types of court actions forcing these complicit Article III “Ivory Tower Judges,” who believe they have removed themselves from the fray, with the human carnage resulting from their gross dereliction of duty to enforce the statutory and Constitutional rights of asylum seekers.

The disgusting and spineless performance of the Article IIIs in light of the Administration’s bogus, illegal actions to “deter” legitimate asylum seekers is nothing short of a national disgrace. If not corrected, it will rightfully tarnish the reputation of the Federal Courts and the individual judges involved for generations to come.

A string of directives from President Donald Trump’s Justice Department that have reduced the authority of immigration judges and limited their control of their courtrooms has given new urgency to calls for a complete overhaul of the immigration courts.

Those courts now exist within the Justice Department and answer to the attorney general. Proposals for Congress to exercise its constitutional powers and create separate, independent immigration courts have long been dismissed as costly pipe dreams. But under Trump, judges and others in the court system say they are facing an unprecedented effort to restrain due process and politicize the courts with the president’s hard line on immigrants and demands for deportations.

“It’s time for the Department of Justice and the immigration courts to get a divorce,” said Jeremy McKinney, an attorney who is a vice-president of the American Immigration Lawyers Association.

In a letter in July, the immigration lawyers joined the American Bar Association, the Federal Bar Association and the immigration judges’ union to call on Congress to “establish an independent court system that can guarantee a fair day in court.” The idea is percolating in the Democratic presidential contests, with three candidates—Julián Castro, Beto O’Rourke and Sen. Elizabeth Warren—presenting specific plans. Another candidate, Sen. Kirsten Gillibrand, drafted a bill last year to make the change.

The chairman of the House Judiciary Committee, Rep. Jerrold Nadler, a Democrat from New York, said he will hold hearings on the proposals this fall. There is little chance such a plan would have traction in the Republican-controlled Senate.

Under the proposals, the immigration courts would become a stand-alone agency that would not be run or controlled by outside officials, with the goal of insulating judges from political pressure by any administration.

Department of Justice officials say they are working on a fast track to modernize courts that have been relegated to institutional backwaters. They oppose any plan to separate the courts, saying it would create a bureaucratic and legal morass that would do little to resolve massive backlogs and other chronic problems.

The costs and logistical hurdles “would be monumental and would likely delay pending cases even further,” said Kathryn Mattingly, a Justice Department spokeswoman. The proposals present “significant shortcomings, without any countervailing positive equities,” she said.

But several judges, including three who spoke anonymously because they are not authorized to make public statements, said the Trump administration has pushed the courts too far. The latest salvo emerged from a thicket of legal language in a rule issued Monday by the Justice Department. In a major change, it gives the official in charge of running the courts, who is not a sitting judge, the last word in appeals of some immigration cases. It also gave that official—the director of the Executive Office for Immigration Review, the formal name of the immigration court agency—expanded power to set broadly-defined “policy” for the courts.

The judges’ union reacted with alarm. Judge Ashley Tabaddor, president of the National Association of Immigration Judges, said the rule “removes any semblance of an independent, non-political court system.”

The judges’ association was already reeling after receiving what amounted to a declaration of war on Aug. 9, when the Justice Department filed a decertification petition that would bar judges, who are department employees, from being represented by the union.

Former Attorney General Jeff Sessions used his authority extensively, eliminating judges’ ability to close deportation cases and narrowing the path to asylum for migrant families from Central America fleeing domestic abuse, gang violence and cutthroat cartels. In a recent decision, Attorney General William Barr went further to deny families asylum, overruling long-standing opinions by judges.

Late last year the current director of the courts, James McHenry, under pressure from the White House, ordered judges in 10 busy courts to give priority to cases of families seeking asylum, pushing those cases to the front of their dockets while postponing others. Many judges are frustrated with the “rocket dockets,” finding that they deny many immigrants time to prepare for hearings while unreasonably delaying other cases, further stretching out backlogs.

In recent months McHenry, citing budget constraints, began to limit the availability of language interpreters for initial hearings, where judges see immigrants who speak many different languages. Translators have been replaced with videos providing boilerplate explanations of an immigrant’s rights. Judges said the videos are befuddling to immigrants in their first encounter with the court, and take away time for judges to address each person individually.

What really antagonized many judges was the imposition of quotas for finishing cases, tied to their performance reviews. Since last October, judges must complete at least 700 cases a year, with less than 15 percent of decisions being sent back to them by appeals courts. Time limits were set for many other decisions.

To remind judges of their standing, Justice officials designed a speedometer that sits on judges’ computer screens, with green marking numbers of decisions that meet the metrics and stoplight red indicating where they are lagging.

“So you sit down and you see that dashboard staring at you, updated every day, and you have 50 motions on your desk to decide whether to continue a case,” said Denise Noonan Slavin, who retired as an immigration judge in March after 24 years on the bench. The metrics, she said, inevitably discourage judges from granting more time for cases, even if an immigrant presents a valid argument.

“If judges get into that red, they can lose their job,” Slavin said.

Most proposals to reconfigure the courts would have Congress act under Article One of the Constitution. The courts would become a separate agency governed by judges, but would remain within the executive branch. There is no appetite for the vast costs and litigation it would take to move the courts to the federal judiciary.

Reformers cite the example of the tax court, which Congress set up in 1969 to have independent judges deciding federal tax disputes, taking them out of the grip of the Internal Revenue Service. Similarly, Judy Perry Martinez, president of the American Bar Association, said in an interview that the immigration courts cannot be fully impartial while they are subordinate to the attorney general, the nation’s top prosecutor.

The Federal Bar Association, which has written a model bill for the transformation, insists it would not be as daunting as it sounds. The bill is drafted “with the idea of simply lifting the courts,” and their budget, out of the Justice Department, said Elizabeth Stevens, chair of the organization’s immigration law section. Under this plan, the courts would remain in existing facilities and current judges would continue to serve for four years before being re-appointed by Senate-confirmed appeals judges to serve in the new system.

Proponents have a harder time explaining how the transition would avoid even more of a bureaucratic sinkhole than existing courts, where the backlog stands at more than 930,000 cases. But Slavin said independent judges would take back their ability to manage cases efficiently, which she said micromanagement under Trump had eroded.

Advocates have few illusions that Trump and a Congress locked in immigration feuds will address their complaints soon. But they want to get the issue on the election year agenda, contending that Democrats and some judicial conservatives among Republicans could vote for an eventual bill.

The Justice Department can be expected to resist. But McKinney, from the lawyers association, said that with the sense of siege in the courts, “Suddenly something that was a dream or a theory is becoming something that could become a reality.”

Also, the 975,298 “docketed” cases in the backlog (according to TRAC, as of 07-31-19) DOES NOT include most of the approximately 330,000 “Administratively Closed” cases that Sessions and Barr have idiotically tried to “force” back on the already-backlogged dockets. This week, the Fourth Circuit “called out” this illegal nonsense by emphatically rejecting Sessions’s scofflaw ruling in Matter of Castro-Tum, 27 I&N Dec. 271 (AG 2018). It’s past time for the Article III Courts to do their duty, put this patently unconstitutional mess out of its misery, and appoint a “Special Master” to restore at least some semblance of Due Process, fundamental fairness, impartiality, quasi-judicial independence, and competent court management to this system pending Congressional reforms to comply with the Constitution.

Most important: judicial intervention might save some human lives that will otherwise be lost as a result of the “malicious incompetence” with which the Trump Administration regularly has abused the “captive” U.S. Immigration Courts.

The Trump Administration’s Court-Packing Scheme Fills Immigration Appeals Board With Hardliners

In his first six years as an immigration judge in New York and Atlanta, from 1993 to 1999, William Cassidy rejected more asylum seekers than any judge in the nation. A few years ago,Earle Wilson overtook Cassidy as the harshest asylum judge on the Atlanta court, which has long been considered one of the toughest immigration courts in the country.

Now both men have been elevated to the Board of Immigration Appeals, which often has the final say over whether immigrants are deported, as part of a court-packing scheme by the Trump administration that is likely to make it even more difficult for migrants fleeing persecution to gain asylum.

Between 2013 and 2018, the average immigration judge in the country approved about 45 percent of asylum claims. The sixjudges newly promoted to the board have all approved fewer than 20 percent. Cassidy granted 4.2 percent of asylum claims. Another appointee, Stuart Couch, approved 7.9 percent. For Wilson, the figure was just 1.9 percent. 

Paul Schmidt, who chaired the Board of Immigration of Appeals from 1995 to 2001, says the administration’s goal is to build a “deportation railway” in which cases move through the system as quickly as possible and then get “rubber-stamped by the Board.”

Until last year, the board had 17 members. The Trump administration expanded the board to 21 members, arguing it was necessary to handle an increase in appeals. That has allowed Attorney General William Barr to fill the panel with immigration hardliners. It’s reminiscent of President Franklin Roosevelt’s ill-fated 1937 effort to overcome Supreme Court resistance to the New Deal by adding up to six additional justices—only immigration courts are part of the Justice Department, giving the department the power to expand the Board and fill the new openings with judges sympathetic to the administration’s immigration crackdown.

The promotions of the six judges this month, first reported by the San Francisco Chronicle, are part of an intensifying effort to reshape immigration courts. Earlier this month, the Justice Department moved to eliminate the immigration judges’ union, which has been highly critical of the administration’s policies. On Monday, a regulation took effect that gives the head of the immigration courts, a political appointee, the power to decide appeals if judges do not hear them quickly enough. A rule that gives board members more authority to summarily deny appeals without issuing a full opinion takes effect on Tuesday. 

Lawyers who have appeared before Cassidy, Couch, and Wilson say all three have intense tempers. All of them had many of their asylum denials reversed by the Board of Immigration Appeals. Now they’ll be the ones deciding those appeals. (The Justice Department’s Executive Office for Immigration Review, which oversees the immigration court system, did not respond to a request to comment on details in this story.)

Cassidy is most associated with his decision to deport Mark Lyttle, a US citizen who did not speak Spanish, to Mexico during a mass deportation hearing. One Georgia attorney I spoke to blamed Immigration and Customs Enforcement for Lyttle’s removal, but Lyttle asserted that he told Cassidy twice about his US citizenship.

Glenn Fogle, an Atlanta immigration attorney, concluded in 2001, “You could have Anne Frank in front of him and he would say it was implausible that she could have hidden in the house for years and not be caught.” Now he says his feelings about Cassidy haven’t changed. He described a recent case in which Cassidy rejected a Congolese client who said he had scars on his back from being persecuted in his home country. Cassidy, presiding via an aging video system, asked the man to lift up his shirt and show the scars, then said he couldn’t see them. “Judge, how on earth could you see anything with this video?” Fogle recalls asking. Cassidy denied the asylum claim, noting in his decision that he couldn’t observe the scars.

Peter Isbister, a senior attorney with the Southern Poverty Law Center, says Cassidy sometimes writes orders denying bond requests while Isbister is still opening his argument. If he tries to finish, Cassidy can get frustrated and say something like, “You can take it up with the board. We’re done!”

In 2010, Cassidy had an asylum denial overturned because he had written the ruling before the hearing even began. The next year, Cassidy sat down in another judge’s courtroom in his judicial robe. In what one observer described as a “surreal” scene, Cassidy then raised his hand and told how the judge how the case should be handled. Assistant Chief Immigration Judge Deepali Nadkarni admonished Cassidy for his “inappropriate conduct.” In 2016, Cassidy compared an immigrant arriving at the border to “a person coming to your home in a Halloween mask, waving a knife dripping with blood.”

Cassidy and Couch have both suggested that asylum seekers are dishonest and trying to scam their way into the country. A Charlotte immigration attorney, who requested anonymity because Couch is now handling appeals, heard Couch say he believes 85 percent of asylum seekers are lying, that 10 percent are telling the truth but not eligible for protection, and that 5 percent are both honest and eligible for asylum. Couch is also skeptical of lawyers. When an out-of-state lawyer couldn’t make it to a hearing because of a funeral, Couch called the funeral home to verify the claim, according to the Charlotte attorney. 

In 2004, Couch, then a military prosecutor, attracted widespread attention for refusing to prosecute a Guantanamo detainee because he had been tortured. But as an immigration judge, Couch has almost always ruled against people who say they’ve been persecuted. He is best known among immigration attorneys for his 2015 decision to deny asylum to a woman who said she had been repeatedly physically and sexually abused by her ex-husband. One year later, the Board of Immigration Appeals overturned Couch’s ruling and ordered him to grant her asylum. But Couch again declined to do so. The case gained prominence when Jeff Sessions, then the attorney general, used it to issue a sweeping precedent that made it much harder for asylum seekers to claim domestic violence as a reason for asylum. (Couch isn’t uniformly anti-immigration—Jeremy McKinney, a North Carolina attorney and the vice president of the American Immigration Lawyers Association, saw him lobby North Carolina Sen. Thom Tillis to greatly expand Central Americans’ access to temporary visas—but has a narrow view of who qualifies for asylum.)

Wilson has the highest asylum denial rate of the six new appointees. His most notable habit is leaning back in his chair while respondents are testifying and closing his eyes so that it looks like he’s sleeping. In one case, according to an observer from Emory University’s law school, Wilson leaned back with his eyes closed for 23 minutes as an asylum seeker described the murder of her parents and siblings. 

Like the others, Wilson has often been overturned by the appeals board he is now a part of. In one case, he ruled against a victim of domestic violence partly on the grounds that she had been able leave her abuser and reach the United States. “We disagree,” the Board decided. “Although the respondent did ultimately come to the United States to escape her abuser, by definition, any person applying for asylum in the United States has fled the harm that they experienced.”

Under the regulation that goes into effect Tuesday, Board members will have more authority to summarily deny appeals without providing any justification. Charles Kuck, an Atlanta attorney and former president of the American Immigration Lawyers Associations, expects that to lead to an assembly-line system like the one that existed under the George W. Bush administration, when Board members sometimes issued more than 50 decisions a day.

Two decades later, one Cassidy case still sticks with Fogle. His client was a former Ethiopian government official. As he was telling his story, Fogle remembers, Cassidy jumped up, turned off the court’s audio recorder, and yelled, “Bullshit!” His client insisted he was telling the truth.

Fogle says it was among the most unprofessional behavior he has ever seen from a judge. “I’ve been around,” he says. “I will never forget that.” He adds, “That’s the guy that’s going to be adjudicating appeals from other immigration judges.

Put another way, even under the view set forth by Justice Gorsuch in Kisor, the Attorney General’s interpretation would amount to a failure of proof because the evidence—that is, Castro- Tum—comes too late in the game.

In sum, the result is that 8 C.F.R. §§ 1003.10(b) and 1003.1(d)(1)(ii) unambiguously confer upon IJs and the BIA the general authority to administratively close cases such that the BIA’s decision should be vacated and remanded.

A huge victory for the “New Due Process Army.” The “Roundtable of Former Immigration Judges” actually filed an amicus brief before Sessions in Castro-Tum raising many of the points found determinative by the Fourth Circuit.  Our brief was, of course, ignored by  “Gonzo,” who undoubtedly had already drafted his decision along the lines dictated to him by some restrictionist interest group.

Finally, an Article III Court  “gets” how the DOJ under the Trump Administration is promoting “Aimless Docket Reshuffling” (“ADR”) in an attempt to build the backlog, destroy the system, blame the victims (respondents and their, largely pro bono, attorneys), and dishonestly call upon GOP Legislators to mount a pernicious attack on constitutional Due Process by statute!  

The idea that adding 330,000 cases to the already backlogged Immigration Courts was legally required or a good policy idea clearly is a piece of White Nationalist restrictionist propaganda promoted by corrupt public officials like Miller, Sessions, and Barr.   

With the Democrats in control of the House, there is no way that Congress will eliminate “Administrative Closing” by statute. And, while the DOJ under the sycophantic Barr might try to change the regulation, this decision makes it very clear that there is no rational basis for doing so. Therefore, any future regulation change is likely to be tied up in litigation in the Article III Courts for years, adding to the confusion and ADR, as well as threatening to immobilize the Article III Courts. 

Unless the Article III Courts want their dockets to be totally swamped with immigration appeals, the answer is to end this unconstitutional system administered by an Attorney General clearly unfit to act in a quasi-judicial capacity and place the Immigration Courts under a court-appointed independent “Special Master” to insure fairness, impartiality, and other aspects of Due Process until Congress fixes the glaring Constitutional defect by creating an independent U.S. Immigration Court outside of the DOJ.

OCCUPATIONAL AND physical therapists. Religious workers. Plant operators. Railway personnel. Construction workers. Maintenance and repair workers. Firefighters. Social workers. Nurses. Funeral workers. Truckers. That’s only a brief sampling of the jobs in the United States for which there are severe shortages of available employees, and way more openings than applicants.

A recent article in The Post detailed the heartbreaking effects of a drastic deficit in just one employment category — home health aides — in just one state, Maine, which has the nation’s second-highest percentage of people over age 65 . They and their relatives who cannot afford private home health aides (who charge roughly $50 an hour) are suffering. Nursing homes, similarly, are closing for want of workers. Even attempts to lure employees by raising wages have hit a brick wall; there simply aren’t enough job applicants in the state nor, apparently, enough people willing to move there.

Maine’s problems in that regard will soon be a national epidemic. Within a decade or so, at least a fifth of the population in roughly 28 states will be 65 or older. The effects of aging baby boomers will be compounded by a national fertility rate that has fallen to its lowest level in nearly five decades. That means younger people will not be available to replenish the ranks of older workers as they retire.

A rational immigration system, one that meets the labor market’s demands for workers in an array of skill categories and income levels, is the obvious antidote to chronic and predictable labor deficits. Unfortunately, the Trump administration, heedless of the pleas of employers, has implemented and proposed measures whose effect will deepen existing and future shortages. And it has done so even as the unemployment rate, now 3.7 percent, continues to bump along at near-historic lows.

A policy announced by the administration this month would impede large numbers of low-income legal immigrants from remaining in the United States, or coming in the first place, if they are judged likely to use public benefits to which they are entitled, including noncash ones such as housing subsidies and health care. The impact would be a dramatic reduction in newcomers, and in existing immigrants eligible to become legal permanent residents, or green-card holders, the final step before full citizenship. By targeting low-income and low-skilled migrants, the rule would perpetuate severe worker shortages in a variety of sectors.

Earlier this year, the administration unveiled a blueprint for legal immigration that, in a reversal, maintained overall levels of immigrants. That recognized that slashing immigration is a recipe for economic decline. However, the Trump plan, by favoring educated, skilled English speakers with strong earnings prospects over relatives of current residents, ignored the reality that retail, landscaping, food processing and dozens of other industries rely on relatively low-skilled labor — and are desperate for workers.

President Trump has leveraged nativist policies to his political advantage. He has been indifferent to their corrosive long-term economic impact. Far from making America great again, the president’s policies are likely to transform the United States into a second Japan, where an aging population and barriers to immigration have sapped the dynamism and prospects of what was once one of the world’s most dynamic economies.

One reason our current immigration system is failing is that it has ignored market forces both in the U.S. and in sending countries.  

That’s particular true with what we consider “manual labor” (which usually takes skills that most Americans either lack or have no interest in developing).

Working with market forces, rather than futilely trying to override or reverse them, would be a win-win-win. It would benefit the migrants, our country, and would greatly reduce the amount of time and money we waste on  cruel, controversial, legally questionable, and ultimately ineffective “civil enforcement” of unrealistic and unworkable restrictive immigration laws.

Even now, what if we welcomed qualified asylum seekers, screened and processed them rapidly for legal status, and worked with NGOs and states like Maine to place them in localities where their skills could be put to immediate use or they could be trained to make critical contributions to our society’s needs while improving their own situations?

Indeed, Maine already has an outstanding record of welcoming refugees and asylum seekers. Notwithstanding initial climate and cultural differences, an amazing number of forced migrants from Africa have resettled in Maine and contributed to their communities and the state’s well-being, as well as adapted to the “Maine way of life.” It’s a process of give and take integration that enriches both the immigrants and the communities in which they settle.

In a Post profile over the weekend, White House senior policy adviser and de facto immigration czar Stephen Miller explained why he cares so much about immigration policy:

“Immigration is an issue that affects all others,” Miller said, speaking in structured paragraphs. “Immigration affects our health-care system. Immigration affects our education system. Immigration affects our public safety, it affects our national security, it affects our economy and our financial system. It touches upon everything, but the goal is to create an immigration system that enhances the vibrancy, the unity, the togetherness and the strength of our society.”

Miller is right: Immigration does touch all those realms. Though perhaps not in quite the way he suggests.

For instance, immigration affects our health-care system in many ways — including by supplying it with talent.

In fact immigrants are overrepresented in the health industry. About 16.6 percent of the health industry is foreign-born, 13.7 percent of the U.S. population overall. A whopping 29.1 percent of physicians are foreign-born, according to a recent analysis of Census Bureau data published in the Journal of the American Medical Association. Immigrants also are overrepresented among dentists (23.7 percent); pharmacists (20.3 percent); registered nurses (16 percent); and nursing, psychiatric and home health aides (23.1 percent).

Immigration also plays an important role in our education system. International students, who generally pay full freight, have helpedkeep public universities afloat even as state legislatures have slashed their budgets. Their tuition dollars help schools cross-subsidize in-state students. Immigrants also have populated the STEM study programs that Americans show little interest in, especially at the graduate level — where many of those same immigrant students help educate American undergrads.

Here’s the share of students in a selection of STEM graduate programs who are in the United States on temporary visas, according to the National Science Foundation’s Science & Engineering Indicators 2018 report. Note that this measure likely understates the fraction of students who are foreign-born, as it does not include those who are permanent residents or naturalized citizens.

As for the relationship between immigration and public safety, the data suggest you might conclude that greater immigration leads to greater public safety.

At least, a study of immigration and crime trends across 200 metropolitan areas over four decades found that “immigration is consistently linked to decreases in violent (e.g., murder) and property (e.g., burglary) crime throughout the time period.” Other studies have found a similar relationship between the two trends. We don’t know that the link is actually causal, of course, but we do have evidence thatundocumented immigrants commit (non-immigration-related) crimes at lower rates than do native-born Americans.

With respect to national security, Miller might do well to remember that immigrants serve in our military. As of 2018, there were 527,000 foreign-born veterans, according to a Migration Policy Institute analysis of Census Bureau data. About 1.9 million veterans are the U.S.-born children of immigrants.

Some of those noncitizen military members with in-demand skills were expecting that their service would expedite their naturalization process, under a program launched in 2008 called Military Accessions Vital to the National Interest. However, changes in recent years, under first the Obama administration and then under Trump, have effectively frozen that program.

What about our economy?

There’s a lot to be said about how immigrants contribute to the economy, including through high rates of entrepreneurship. For example, immigrants have started more than half of the United States’ start-up companies valued at $1 billion or more, according to a National Foundation for American Policy study. They start lots of smaller companies, too, at much higher rates than native-born Americans, according to data from the Kauffman Foundation.

Without immigration, the U.S. working-age population would be falling, which would weigh on economic growth. (Just look at Japan’s struggles). And as I’ve written elsewhere:

There’s reason to believe that new immigrants may depress wages for earlier waves of immigrants who have similar skill sets. However, recent studies suggest that immigration (both authorized and unauthorized) actually boosts labor force participation rates, productivity and wages and reduces unemployment rates for native-born American workers, whose skills these immigrants tend to complement.

But don’t these people drain the public coffers?

Immigrants, including undocumented immigrants, pay taxes — taxes that fund government benefits that in many cases they are not legally eligible to collect.

A report from the National Academies of Sciences, Engineering, and Medicine found that the net fiscal impact of first-generation immigrants, compared to otherwise similar natives, is positive at the federal level and negative at the state and local levels. That’s due mostly to the costs of educating their children. When their children grow up, though, they are “among the strongest economic and fiscal contributors in the U.S. population, contributing more in taxes than either their parents or the rest of the native-born population.” In other words, by the second generation, immigrants are net-positive for government budgets at all levels.

What about the most destitute immigrants who come here, though? Surely they’re sucking the government dry!

Nope.

An internal government report commissioned by Trump found that refugees brought in $63 billion more in tax revenue over the past decade than they cost the government. Finding those results inconvenient, the administration suppressed them, though they were ultimately leaked to the New York Times last year.

So by all means, Miller, please remind the public that immigration has consequences for the broad policy landscape. But remembering the directionality of those consequences seems pretty important, too.

Catherine’s wonderful article would have fit well within the readings for the Bjorklunden Seminar that Professor Jenn Esperanza and I did earlier this month. Basically, those who oppose and demean immigrants have forgotten that we are all immigrants, we are all very similar, and without immigrants there would be no America.

No, our country isn’t “full” by any means and no, the “quality” of recent immigrants hasn’t “dropped off.” If anything, we are more dependent on the skills, hard work, and loyalty (sometimes hard to fathom, considering how they are treated) of recent immigrants, both documented and undocumented, than at any time in our history since the founding.

Unlike Miller, “Cooch Cooch,” Pence, Trump himself, and the other political hacks charged with making immigration policy these days, I actually spent years dealing face to face with migrants of all types, races, religions, backgrounds, and situations in performing my duties as a U.S. Immigration Judge. Contrary to the false narratives promoted by the “Millers of the world,” most of them wanted just three things 1) the chance to live a relatively safe and stable life; 2) an opportunity to use their skills to support themselves and others; and 3) a better future for their children.

That’s largely what I wanted out of life and accurately describes the aspirations of probably 90%+ of the people I have known as I move into my seventh decade of life.

I don’t know what entitles folks like Trump, Miller, and their followers to demean and dehumanize the contributions of other humans who are just as, or in many cases more, worthy as they are – simply because they didn’t have the same fortune of birth or circumstances.

Undoubtedly, there is somewhere out there a point at which admitting larger numbers of refugees and other types of immigrants would be counterproductive, at least for our country, if not for the migrants themselves. Even then, there might still be moral and religious arguments for helping our fellow men even when it ceases to demonstrably benefit our economy and our society.

But, the factual and moral bankruptcy of the “case for fewer immigrants” put forth by Trump, Miller, and the White Nationalists shows that whatever that “magic number’” might be, it’s multiples of the number of legal immigrants we are admitting at present. That’s why Trump, Miller, and the White Nationalists don’t want to have the real national dialogue that we should be engaging in: How do we expand our current refugee and legal immigrant admission systems to more realistically reflect the market forces that cause migration, and how do we as a country put ourselves in the best position to benefit from the ongoing phenomenon of human migration?

The longer we screw around with and are diverted by the racist myths of the Trumps and Millers, the longer it will take us to get around to the hard work of addressing immigration issues in a smart, humane, and realistic way that benefits the immigrants, our country, and humanity as a whole.

BJORKLUNDEN REPORT, PART I: “American Immigration: A Legal, Cultural, & Historical Approach to Understanding the Complex and Controversial Issues Dominating Our National Dialogue”

 

I had the pleasure of co-teaching this course with my good friend Professor Jennifer Esperanza of the Beloit College Anthropology Department. The venue was Lawrence University’s amazing Northern Campus, known as Bjorklunden, on the wildly beautiful shores of Lake Michigan in Door County, Wisconsin, from August 4-9, 2019. This was a “derivative” of an immigration component of a summer session of Jenn’s class for undergraduates at Beloit. This time we had a group of 15 enthusiastic, well-informed post graduate students from a variety of professional backgrounds.

 

Here’s what we set out to achieve:

 

 

 Class Description:

All Americans are products of immigration. Even Native Americans were massively affected by the waves of European, involuntary African-American, Asian, and Hispanic migration. Are we a nation of immigrants or a nation that fears immigration? Should we welcome refugees or shun them as potential terrorists? Do we favor family members or workers? Rocket scientists or maids and landscapers? Build a wall or a welcome center? Get behind some of the divisive rhetoric and enter the dialogue in this participatory class that will give you a chance to “learn and do” in a group setting. Be part of a team designing and explaining your own immigration system.

Class Objectives:

  • _Understand how we got here;
  • _Understand current U.S. immigration system and how it is supposed to work;
  • _Learn more about the various lived experiences of immigrants and refugees through their personal stories and ethnographic accounts
  • _Develop tools to become a participant in the ongoing debate about the future of American immigration;
  • _Get to know a great group of people, enjoy Door County, and have some fun in and out of class

 

 

Here are our “five major themes:”

 

Day 1: An Introduction to Immigration (From the Top Down and the Bottom Up)

Highlight: Getting the “immigration histories” of the participants

 

Day 2:  Labor Migration: Push/Pull Factors

Highlight: Stories and examples of the “hard-work culture” created by various groups of hard-working immigrants to the U.S. both documented and undocumented with a particular emphasis on the culture created by Hispanic restaurant workers

Day 3: “Making Home”

Highlight: Watching and discussing NPR broadcast on German immigrants in rural Wisconsin which related directly to the family histories of many of us in the class (including me)

 Jenn and I thank you for joining us. We’ve had our “Last Supper” and our “Final Breakfast” here at beautiful Bjorklunden. That means that our time together is ending.

 In five days, we have completed a journey that began on Monday with hunter-gatherers in Africa thousands of years ago, and ends inside today’s headlines about ripping apart families in Mississippi and trying to develop better approaches to refugees: individuals who are an integral part of the human migration story as old as man, and who will not be stopped by walls, prison cells, removals, or cruel, inhuman, and degrading treatment or rhetoric from our so-called “leaders.” On the way, we wound through our own rich immigration heritages and personal stories about how migration issues continue to shape our lives, including, of course, bringing this wonderful group together in the first place.

 Jenn shared with you some very personal stories about her own family’s recent immigration experiences and how it shaped, and continues to mold her own life and future.  I introduced you, at least briefly, to a key part of my own life, the U.S. Immigration Court, the retail level of our immigration system, where “the rubber meets the road” and where the maliciously incompetent actions of unqualified politicos have created “Aimless Docket Reshuffling” and made a bad joke out of the precious Constitutional right to Due Process under law for all in the U.S. regardless of status or means of arrival.

 Our lively class discussions have not been “merely academic,” but real and practical.  We have discussed real life scenarios literally “ripped from today’s headlines,” involving real people and real human dilemmas, including the challenges facing those whose job it is to ensure that justice is served.  Although this class is done, the learning, the intense human drama, and the “living theater” of American immigration will continue.

 Jenn and I have enjoyed working with all of you over this week. The past five days have certainly been a high point for us this summer.

 We have communicated our shared values of fairness, scholarship, timeliness, respect, and teamwork!  And, we hope that our ability to bond and bridge generational, age, academic, gender, professional, cultural, and geographic gaps to bring you this learning experience has served as a “living example” of how those shared values play out in “real life.”

 For me and others like me, our “time on the stage” is winding down. Others, like Jenn and Chuck, are still very much engaged in the production. Still others, like Mary’s inspiring grandchildren, Jenn’s boys, and my eight grandchildren, are “waiting in the wings” to take the stage and assume their full roles in the ongoing drama of human history.

 Our hope and challenge for each of you is that no matter where you are in the process of lifelong learning and doing, you will reach your full potential as informed, caring, and compassionate human beings, and that you will continue to strive to make our world a better place!  We also hope that something that you have learned in this class will make a positive difference in your life or the life of someone you care about.

 Thanks again for inviting us into your lives, engaging, participating, and sharing. Journey forth safely, good luck, and may you do great things in all phases of life!

Thanks again to Mark Breseman (LU ’78), Executive Director; Kim Eckstein, Operations Manager; Alex Baldschun, Assistant Director; Jeff Campbell, Head Chef; Mark Franks, General Maintenance Mechanic; Lynda Pietruszka, Staff Assistant/Weekend Program Manager, and, of course, the amazing, brilliant, personable, and talented LU student staff at Bjorklunden for taking care of our every need and making everything work.

The student staff basically runs the place from an operational standpoint. While many universities brag about their hotel and hospitality management programs, as far as I could see the student staff at Lawrence was getting great “hands on” experience and training in hospitality management from the ground up. How do I know? Well, in the “corporate phase” of my career, I represented some of the largest international hotels and hospitality corporations in the world. The “hands on” training that these students were getting appeared to be very comparable to those of well-known hotel management programs and just the type of skills that major hotel chains are always looking for in their executives and managers.

Special thanks to Alex and Kim, for emergency copying and technical services; to Kim for showing me the only “Level 2” Electric Vehicle Charger in Bailey’s Harbor (I’ve recommended that as a proudly eco-friendly institution Lawrence install Level 2 EV Chargers and dedicated plugs for Level 1 EV Chargers in convenient locations on both the Appleton and Northern Campuses); to Jeff for giving me tasty vegan options for every meal; and to Lynda and Mark Franks for their general cheerfulness and  “can do” attitude. I also appreciate the student staff who resided on my corridor for putting up with my constant whistling.

Finally, thanks to my good friend and professional teaching colleague Professor Jenn Esperanza of Beloit College (who also happens to be “best buds” with my daughter Anna and her husband Daniel, a fellow Professor at Beloit College) for undertaking this adventure together and being willing to share so much of her very moving and relatively recent personal experiences with immigration and being part of the “American success story.” Jenn and I appreciated the enthusiastic participation of all the members of our group and their signing up for our class.

A CONCEPTUAL PROPOSAL FOR AN AUXILIARY IMMIGRATION JUDICIARY

Drawing on our judicial expertise gained over decades of working in both Federal and State judicial system, we respectfully set forth a concept for those working in the legislative, political, legal, and judicial systems to use and further develop to promote better, fairer, and more efficient judicial decision-making and to make better use of existing and future judicial resources both in and outside the U.S. Immigration Court system.

To save time, and since neither of us purports to be a legislative draftsperson, instead of submitting a “draft bill,” or the “outline” of such a bill, we advance an idea and the conceptual and practical justifications for it for your consideration and future use in drafting actual legislation.

 

No knowledgeable individual thinks the current dysfunctional U.S. Immigration Court system can continue without imploding. Just feeding more new, permanent Immigration Judges into an unfair and broken system actually is making things worse as well as outrageously wasting our taxpayer money at a time when deficits are skyrocketing.

 

All too many newly hired Immigration Judges appear to be neither the best qualified to be judges nor, even if qualified on paper, properly trained in how to deliver “full due process with efficiency” under the immigration laws and in strict compliance with the Due Process Clause of our Constitution.

 

On the other hand, many retired judges from other Federal and State systems have proven expertise and track records that would allow a competent judicial administrator (there are, to our knowledge, NONE of these currently in DOJ or EOIR) to determine if they are suitable for emergency service and how they could best be trained to effectively and efficiently use their skills as “Auxiliary Immigration Judges” to augment the current and future Immigration Judiciary. 

 

Moreover, since most retired Federal and State judges already have adequate pensions or other means of support, asking them to volunteer to serve on the basis of limited compensation, or even just reimbursement for out of pocket expenses, would not be unreasonable.

 

We are offering this idea as a way in which those of us with lifetime legal and judicial expertise can use it to improve the delivery of justice in America; it is not intended as a means of enriching or offering alternative full-time employment to current retired judges, from any system.

 

To name just a few areas of “low hanging fruit,” we believe that:

 

      Most bonds;

      Initial “Master Calendars” (arraignments);

      Master Calendar scheduling for Individual Hearings;

      Motions Calendars;

      “Status” Calendars;

      Stipulated Final Order and Withdrawal Calendars;

      Individual Hearings on Cancellation of Removal for long-time lawful and unlawful residents;

      Uncontested Adjustments of Status and other types of equitable waivers; and

      Voluntary Departure as the sole application cases

 

have elements in common with most other types of judicial work.

 

Using Auxiliary Judges for such cases would allow those judges, from any Federal or State system, with sound work records, that is, those with impeccable reputations for fairness, professionalism, judicial efficiency, and impartiality, to handle these types of immigration adjudications with a modest amount of additional training and in close consultation and cooperation with the sitting Immigration Judges in a particular location.

 

In this respect, our emphasis would always be on aiding existing, sitting U.S. Immigration Judges, in cooperation with them and at their request, in the ways those sitting judges deem most helpful, fair, and effective.

 

It would never be on fulfilling inappropriate and unethical “production quotas,” numerical goals, or pandering to interests who want to use the judicial system to fulfill political or law enforcement objectives inconsistent with Due Process, fundamental fairness, or sound judicial administration.

 

We do not propose that “Auxiliary Judges” ever work directly for or under the supervision of non-judicial political officials as is now, disturbingly, the case in our Immigration Court System. Indeed, the current unwarranted attack on the independence and professionalism of Immigration Judges by unqualified political officials seeking to “decertify” the Immigration Judges’ professional association, the National Association of Immigration Judges, is a prime example of the type of counterproductive activity in which “Auxiliary Judges” should never be allowed to participate, in any way.

 

By contrast with the types of more straightforward judicial work described above as potential “low hanging fruit,” Asylum Cases, Withholding of Removal Cases, and applications for protection under the Convention Against Torture involve complex legal and factual issues. These are matters that should NOT be delegated to retired judges from other fields.

 

Indeed, one huge advantage of our proposal is that it would allow existing and future Immigration Judges to spend adequate time (a contested fair hearing on any of these aforementioned protection matters would take a well-trained judge 3-4 hours, minimum) on these types of cases and to receive more and better training on how to fairly and timely adjudicate, consistent with Constitutional Due Process, claims for protection under these laws and International Conventions.

 

Of course, there would be some administrative costs involved with training and maintaining a list of those willing to serve as “Auxiliary Immigration Judges.” But, they pale in relation to the costs of continuing to throw new permanent positions into a badly broken and dysfunctional system.

 

Indeed, some, such as the ABA Commission on Immigration, have observed that additional Immigration Judge hiring under current conditions has demonstrably been a waste of taxpayer money that has actually made the system worse and further impaired the delivery of Due Process to those vulnerable individuals whose lives depend on fair, professional, and efficient administration of Due Process and fundamental fairness in our Immigration Courts.

 

Sadly, we surmise that significant amounts of the “assembly line (in)justice” currently being encouraged and delivered to represented individuals in today’s Immigration Courts will eventually have to be re-adjudicated by orders of the Article III reviewing courts because of legal and/or factual errors. The only reason we don’t include unrepresented individuals in our equation is that these, unfortunately, are often “railroaded” out of our country without realistic access to the Article III Courts.

 

As lawyers with a combined 90 years of experience working in State and Federal justice systems, as prosecutors, judges, private litigators, educators, and government officials, at both the national and local level, we cannot in good conscience watch the continued deterioration of justice in the Immigration Courts while constructive ideas for improvements and efficiency and fairness are ignored or left unaddressed.

 

The concept of using retired State and Federal Judges outside the Immigration System to do certain types of cases to augment justice and relieve the incredible stress on full time Immigration Judges, in times of emergency or workload surges, without all the problems inherent in the current hiring of permanent judges by the DOJ, easily could be incorporated into one of the “Independent Article I Immigration Court” bills being advocated and advanced by groups such as the ABA, FBA, AILA, and the National Association of Immigration Judges (“NAIJ”).

 

The current system is dying before our eyes. We need to “pull out all the stops,” consider “every potential concept,” and utilize “positive professional creativity” (the antithesis of the negative energy devoted to cruel and counterproductive “gimmicks” and outright illegal actions) designed to enhance, rather than denigrate, Due Process, fundamental fairness, and judicial efficiency without sacrificing quality.

 

It is in that spirit that we respectfully request those involved in legislative reform of our Immigration Court system to consider incorporating our concept of an “Auxiliary Immigration Judiciary” into overall legislative proposals for positive reform of the Immigration Courts now being advanced by all of the leading voices in the field.

The violent attack yesterday in El Paso in which 22 people lost their lives and more than 24 others were injured evokes two starkly divergent views of El Paso, the first held by most of its residents and those who know it well, and the second championed by extremist politicians, media sources, and hate groups. The latter describe El Paso and other border communities as dangerous and crime-ridden places, victimized by “invaders” from undesirable countries.

Just five days ago, Beto O’Rourke outlined a different vision of this community, writing in The Hill that that El Paso might (instead) be considered the nation’s future Ellis Island; that is, a symbol of hope for the world. The Ellis Island language may have come from a 2012 gathering in El Paso of border residents (most from El Paso) from different sectors – public officials, law enforcement, faith communities, business people, the press, and others – who were offended by how their communities had been characterized in the national immigration debate and wanted to articulate a richer, more truthful narrative of their communities. “If nothing else,” they later wrote presciently, “we could all agree on this point. There is a prevailing narrative about the US border and it is false and it is dangerous to border communities.”

These border residents recognized the problems in their communities, some of which they attributed to ill-considered federal immigration enforcement policies and the vilification of immigrants.  El Pasoans have generously welcomed newcomers throughout their history, particularly in recent months. In a report published by the Border Network for Human Rights titled “The New Ellis Island: Visions from the Border for the Future of America,” they described El Paso as a safe, family-oriented, creative and culturally rich community that benefitted from its diversity and bi-national identity, and that could serve as a model for other American communities in an increasingly inter-connected world.

As Professor Josiah Heyman of the University of Texas in El Paso later wrote in the Journal on Migration and Human Security:

These border residents viewed their region as a set of human communities with rights, capacities, and valuable insights and knowledge … They saw the border region as the key transportation and brokerage zone of the emerging, integrated North American economy. In their view, the bilingual, bicultural, and binational skills that characterize border residents form part of a wider border culture that embraces diversity and engenders creativity. Under this vision the border region is not an empty enforcement zone, but is part of the national community and its residents should enjoy the same constitutional and human rights as other US residents.

They also enunciated a prophetic view of their communities:

We imagine a border that is no longer characterized by walls, migrant deaths, illegality, human and drug trafficking, and violence in all of its forms. We see a place of opportunity and encounter.  We see a place of pilgrimage where – like Ellis Island – residents and visitors can remember their family histories of crossing over, living as “strangers,” and struggling for a foothold in their new country. We imagine a region which, 50 years from today, serves as a symbol of hope for border communities throughout the world. We picture a border that crosses, but does not divide families and communities. We see a border of faith communities converted by their own core values and beliefs. We envision a gathering place for God’s scattered children, where residents and visitors in all their diversity can work together to build the human family. We hope, pray, and vow to work for such a border.

Yesterday’s hate crime attacked this community, its perpetrator reportedly angered by the “Hispanic invasion of Texas” and seeking to prevent “cultural and ethnic replacement” in a region settled by Spanish speaking persons in the mid-17th century and by native peoples in 40 AD.In a statement on the shootings, Bishop Mark J. Seitz of the Diocese of El Paso wrote:

Once again in our nation we see the face of evil. We see the effects of a mind possessed by hatred. We see the effects of the sinful and insipid conviction that some of us are better than others of us because of race, religion, language or nationality.

Bishop Seitz also lauded the borderlands for demonstrating to “the world that generosity, compassion and human dignity are more powerful than the forces of division.”

In announcing a faith vigil last night in response to the shooting, an inter-faith alliancewrote:

Today we stand in horror and shock at the devastating loss of life and heartless attack on our border community. Tomorrow we will mourn, dry tears, offer our sacrifice of prayer and brace ourselves for the work ahead. Because even now the borderlands will stick together and the borderlands will stand together.

As many have remarked, El Paso is a resilient and special American community, but has too long been the victim of hateful and dangerous rhetoric.  Its residents deserve the nation’s solidarity and respect, particularly at this sad time.

Interesting to compare the statements of a real leader like Don Kerwin, who exercises moral authority, with the vapid and disingenuous statements of immoral White Nationalist hate purveyors like Trump and most of his GOP stooges (including, of course, “Super Stooge” Mike Pence).

Trump might have yielded to his campaign advisers’ suggestions that he “cool it” until the bodies are buried. Since “ego is everything, and winning is ego” in Trump-land, he apparently deemed it worth the supreme sacrifice of knocking off the hate tweets and lie streams for a few hours.

But, I guarantee that it won’t be long before Trump is once again throwing around knowingly false racist narratives and “hate bombs” directed at migrants, Hispanic Americans, African Americans, other minorities, and Democrats, with the GOP looking the other way, nodding approval, or, in too many cases, actually joining in or attempting to defend the indefensible. This is a party whose sorry and cowardly actions and policies are inconsistent with the continuation of America as a democratic republic. It deserves to be voted out of existence and consigned to the “dustbin of history.” Whether or not that actually happens, and when, is ultimately up to the American voters.

I have been an immigration lawyer dedicated to fairness and due process for immigrants my entire career. In 2015, convinced that my 18 years of experience as an advocate would make me a good immigration judge, I applied for the job.

Most immigration judges are former attorneys from the chief counsel’s office of U.S. Immigration and Customs Enforcement, former assistant U.S. attorneys or former attorneys from other federal government agencies. Former advocates are appointed less frequently, but I believed in the importance of having judges from varied backgrounds on the bench and therefore applied.

I made it through the application and vetting process and was appointed to the bench in September 2017. I resigned this March because I could no longer in good conscience work as an immigration judge in the Trump administration.

I knew when I joined the bench that there would be frustrations, as immigration courts are governed by the Justice Department and lack the independence of other courts in the federal judicial system. But nothing prepared me for the unprecedented, unfair and unworkable policies the Trump administration imposed on the courts and the immigration process.

I believed it was my job to ensure that all people who appeared before me understood their rights and had the opportunity to fully present their cases. I found the job fulfilling when I was hearing cases. I enjoyed learning about the lives of people from all over the world and analyzing complex legal issues. It was also heartbreaking. I heard stories of horrific violence, terror and pain. I was moved by the struggles and resolve of those who leave everything behind to seek safety and refuge, those who dedicate their lives to caring for family members, and those who overcome incredible obstacles to make a better future for themselves and their families.

In 2018, Atty. Gen. Jeff Sessions and the director of the Executive Office for Immigration Review, which oversees the immigration courts, began imposing quotas and performance metrics that affected the day-to-day function and independence of the judges. We were notified that all judges were expected to complete 700 cases a year to receive a satisfactory performance review. EOIR also published performance metrics for the judges that established specific timelines for adjudication of cases and motions.

During a conference of immigration judges in June 2018, agency leadership informed us that the quota policy would go into effect in October. Sessions, during his keynote speech at the conference, announced that he would be issuing his decision in the case of Matter of A-B-, which dealt with asylum claims based on domestic violence. His decision to prohibit grants of asylum for victims of domestic violence and persecution perpetrated by other nongovernment actors was announced later that day. I left the conference extremely demoralized.

My colleagues and I felt the impact of the case quotas on our ability to render correct and well-reasoned decisions. My calendar was fully booked with cases through 2021. The judges in San Francisco, where I served, were told we could not schedule any cases in 2022 until our calendars showed that three cases were scheduled every day through the end of 2021.

This meant that the judges were forced to schedule at least two cases in one time slot (there being two slots a day) — regardless of whether it was possible to hear two cases in such a short time frame or whether this would allow a judge to consider fully the merits of each case, which often involved determining life or death issues.

This was the way to push us to complete 700 cases a year. Failure to hit the quota would also result in failing to meet other performance metrics. In August 2018, Sessions also issued a decision limiting continuances of cases in immigration court.

Shortly after we were told to hear three cases a day, we were also told we could not schedule interpreters for two different languages in each of the morning or afternoon sessions. We were told we needed to match languages or pair English-language cases with other languages, though we had no tools to assist us in coordinating languages.

The impact of these administrative policies, while bad on judges’ morale and workloads, was worse for the immigrants appearing at court. The pressure to complete cases made me less patient and less able to uphold the constitutional protections required to properly adjudicate cases.

In addition to these policies, the Trump administration announced several new policy changes to limit the rights of noncitizens to apply for asylum. One was the “Remain in Mexico” policy, which required asylum applicants to stay in Mexico while awaiting their court hearings. Another was the administration’s attempt to eliminate eligibility for asylum for individuals who did not present themselves at a port of entry while simultaneously preventing asylum seekers from being processed at the ports of entry.

In November 2018, the EOIR director issued a memorandum to push through cases of “family units” on a fast track. These cases continue to be docketed and heard on an expedited basis. This policy prevents indigent noncitizens from having adequate time to secure counsel or evidence to support their cases. And it often leads to individuals being ordered removed without a hearing because clerical errors caused hearing notices to be sent to incorrect addresses.

As more policies were issued, it became clear that this administration’s attack on immigrants and the independence and functioning of the immigration courts would only get worse.

As I expected, the attacks continued. Since I resigned, the Department of Homeland Security has expanded expedited removal. Recently, EOIR began using a video to comply with federal regulations requiring that all noncitizens be advised of their rights and responsibilities in court. The video, which replaces in-person interpreters, will inevitably cause confusion and make it far harder for individuals to defend themselves.

Just last week, Atty. Gen. William Barr issued a decision that largely eliminates asylum eligibility for those facing persecution because of family ties. This ruling could affect thousands of legitimate asylum seekers fleeing violence in Mexico and Central American countries, as well as other parts of the world.

I expect the Trump administration’s relentless attacks against immigrants and the immigration system to continue. The way to limit the damage is to establish an independent immigration court that is outside the Justice Department. Until that happens, the immigration courts will be subject to the politics driving the administration rather than the principles of justice immigration judges are sworn to uphold.

2020 Democratic presidential candidate and New York Sen. Kirsten Gillibrandintroduced a bill Wednesday that would provide immigrants with an attorney as they seek asylum or other legal protections in the US as the Trump administration has been dramatically limiting the ability of Central American migrants to claim asylum.

Immigrants, for example, have the right to counsel and may hire a lawyer themselves, but unlike in the criminal justice system, representation is not guaranteed.

Under Gillibrand’s proposed bill, legal counsel would be required for eligible groups facing removal proceedings — including children, individuals with disabilities, victims of abuse, torture, and violence, and individuals at or below 200% of the federal poverty level.

The Funding Attorneys for Indigent Removal (FAIR) Proceedings Act “would ensure that some of the most vulnerable individuals in this process can be represented by an attorney,” Gillibrand said in a statement Friday.

“This would not only guarantee a more humane way to process asylum claims and other legal protections, but it would improve the efficiency of our immigration courts and help our country do a much better job of managing our immigration system,” Gillibrand said.

She accused the Trump administration of being “far too willing to fast-track deportation cases even when people have credible claims to asylum.”

Democratic Reps. Donald McEachin from Virginia and Zoe Lofgren from California have introduced a House companion to Gillibrand’s bill. Sens. Cory Booker and Bernie Sanders, two other 2020 Democratic presidential hopefuls, and Richard Blumenthal have also signed onto the Senate bill as co-sponsors.

The Trump administration has worked to limit immigration and toughen the US asylum process amid overcrowded conditions at border facilities and a spike in apprehensions at the US-Mexico border over the recent months.

Last month, the departments of Justice and Homeland Security also rolled out an interim rule that would prohibit migrants who have resided or “transited en route” in a third country from seeking asylum in the US, therefore barring migrants from Central America traveling through Mexico from being able to claim asylum and as a result, drastically limiting who’s eligible for asylum.

A federal judge blocked the asylum rulefrom going into effect, deeming it “likely invalid because it is inconsistent with the existing asylum laws.”

The Trump administration also moved to expanda procedure to speed up deportations to include undocumented immigrants anywhere in the US who cannot prove they’ve lived in the country continuously for two years or more.

The notice, filed in the Federal Register on July 22, casts a wider net of undocumented immigrants subject to the fast-track deportation procedure known as “expedited removal” which allows immigration authorities to remove an individual without a hearing before an immigration judge. The American Civil Liberties Union has said it will sue to block the policy.

Competent lawyers have been beating the Trump Administration like a drum on immigration issues. That’s why corrupt officials like Trump, Barr, Miller, “Big Mac With Lies,” and “Cooch Cooch” are so desperate to railroad asylum applicants out of the country while unlawfully denying them access to even the limited number of pro bono lawyers available under current law.

The Federal Courts have also “tanked” on their constitutional duty to insure Due Process by requiring appointed counsel in immigration cases, something that should make the entire Article III judiciary hang their collective heads in shame. The Federal Courts have also been “asleep at the switch” by allowing the Trump Administration to use inhumane coercive detention in obscure places and other gimmicks intentionally designed to defeat asylum applicants’ right to counsel of their own choosing.
