“IN GRAPPLING with its worst epidemic of homicides in years, Chicago faces no more critical task than repairing frayed relations between its beleaguered police force and the communities it serves. Now the Trump administration, more eager to advance its anti-illegal- immigration agenda than to combat violent crime, is throwing up obstacles that will make it more difficult for Chicago and other localities to get a grip on the problems they confront.

After a federal court blocked the administration’s crusade to punish so-called sanctuary cities such as Chicago by withholding an array of federal funds, the Justice Department has renewed the effort in a more targeted way, declaring that localities that refuse to cooperate with deportation agents are ineligible for a specific grant program for police departments.

If that sounds illogical, it’s because it is. Despite President Trump’s assertions to the contrary, there is no evidence that illegal immigration has contributed to Chicago’s murder spree. Eddie Johnson, the city’s police superintendent, said “the vast majority” of Chicago’s violent crime “is committed by homegrown people,” while illegal immigrants are a “nominal” factor. And while the city does prohibit cooperation with federal deportation agents in most instances, it makes exceptions for convicted and charged felons, as well as suspected gang members.

Nonetheless, Attorney General Jeff Sessions justifies barring the federal grants to Chicago — thereby impeding its ability to buy crime-fighting gear such as police cars, SWAT equipment and radios — by falsely linking the Windy City’s homicide rate with its sanctuary policies. “The city’s leaders cannot follow some laws and ignore others and reasonably expect this horrific situation to improve,” he said.”

“Texas can’t use its current voter maps in the upcoming congressional midterm elections after a panel of federal judges ruled districts approved by state Republican lawmakers illegally discriminate against Hispanic and black voters.

The three-judge panel in San Antonio gave the state three days to say if and when the Texas Legislature will fix the congressional map, which the judges concluded still carried the discriminatory taint of districts lawmakers originally drew in 2011 with the intent to squelch rising Latino voting strength.

If Texas doesn’t intend to correct biased districts, the court will hold a hearing to solicit advice before redrawing the map on its own, the panel said Tuesday.”

President Trump on Tuesday said that counterprotesters at a white supremacist rally in Charlottesville over the weekend acted violently and should share the blame for the mayhem that left a woman dead and many others injured. The president also defended those protesting the removal of a Robert E. Lee statue.

In a testy exchange with reporters at Trump Tower, the president called the events on Saturday a “horrible thing to watch,” but he emphasized that both sides of the clashes contributed to the violence.

Not surprising, since his earlier insincere follow-up statement in which he singled out racist and White Supremacist groups by name appeared to be “read from cue cards” probably written out for him by Ivanka. But, eventually his “White Nationalist rage” always boils over, and he goes on the attack, revealing once again just how unqualified he was and remains for the high office to which he was elected.

Very similar to the Travel Ban and the Comey firing when he couldn’t stick to the script that some of his advisers had prepared for him.

VOX: THINK TRUMP IS GOING TO KEEP HIS PROMISE TO CRACK DOWN ON WHITE SUPREMACISTS? — NOT LIKELY, THEY ARE A KEY PART OF HIS “BASE!”

“The president of the United States finally condemned white supremacist violence in Charlottesville on Monday, two days after an initial statement that blamed “both sides” for violence largely instigated by far-right activists (including a car attack on counterprotesters that killed one person and injured 19).

But the only part of his remarks that appeared to promise that he was devoting not just words, but action, to the problem of right-wing extremism in America — “We will spare no resource in fighting so that every American child can grow up free from violence and fear” — was actually the most hollow.

On Saturday, too, Trump promised to get to the root of the problem: “We want to get the situation straightened out in Charlottesville, and we want to study it. And we want to see what we’re doing wrong as a country where things like this can happen.” The problem is that his administration has already indicated that it thinks it knows the answers to these problems. It’s cut funding for outreach to counter white supremacism, while pushing punitive “law and order” responses to civil unrest.

Trump’s willingness to explicitly say that white supremacism is bad (even if it’s only offered in response to criticism) is worth at least something — it’s a nod in the direction that white supremacism is an ideology that ought to be ostracized. But his administration’s actions threaten to undermine any value in countering white supremacism that Trump’s rhetoric might have had.

The Trump administration has systematically rejected efforts to counter right-wing violence

Barely a week after President Trump was inaugurated, rumors began to swirl that he was going to change the name of the federal “Countering Violent Extremism” task force, located in the Department of Homeland Security, to “Countering Islamic Extremism” — and that the task force would accordingly “no longer target groups such as white supremacists who have also carried out bombings and shootings in the United States.”

The task force’s name hasn’t changed. But its function has. After a review of grants provided by the task force, the Trump administration preserved most of the grants (which involved Islamic communities) — but killed a $400,000 grant to Life After Hate, a group that attempts to “deradicalize” young men drawn to white supremacism.

It’s not that the Trump administration didn’t have evidence that right-wing extremism was a potential problem for public safety. According to Foreign Policy, the Department of Homeland Security and the FBI issued a report on May 10 called “White Supremacist Extremism Poses Persistent Threat of Lethal Violence,” which noted that white supremacists “were responsible for 49 homicides in 26 attacks from 2000 to 2016 … more than any other domestic extremist movement.”

But among conservatives skeptical of “identity politics,” there’s been a longstanding resistance to any government warnings about far-right extremist groups. When the Department of Homeland Security published a report in 2009 warning of increased racist extremism after the election of President Obama, the backlash was so intense that the department had to formally retract the report.

There’s been a similar turn away from community engagement and toward punitiveness on other fronts. Under Homeland Security Secretary John Kelly (who’s now White House chief of staff), Trump administration officials were indifferent or hostile to concerns that aggressive immigration enforcement might be discouraging victims of crime from reporting to police. Under Attorney General Jeff Sessions, the Department of Justice has stopped supporting legal “consent decrees” between police departments and local governments to rebuild public trust, while Sessions himself has advocated for a return to maximal punitiveness in criminal punishment and explained that African-American communities need to do a better job of trusting police to protect them.

In both his initial statement Saturday and his remarks Monday, President Trump presented the violence in Charlottesville as primarily a problem of social disorder — something that more and better policing, and more public trust in policing, could solve. It’s an old theme for Trump; “law and order” has been the theme of some of his biggest public moments on the campaign trail and as president. According to the Daily Beast’s Asawin Suebsaeng, Trump was particularly insistent that his Saturday statement on Charlottesville adhere to a “law and order” theme, because he remembered it fondly from the campaign.

Trump may see “law and order” as the solution to everything because it reminds him of his electoral success. Other members of his administration see it as the solution to everything because they believe the fundamental problem is “social disorder,” not racism or white supremacism.

Trump’s willingness to criticize white supremacists by name is welcome and important. But if his administration has already decided what caused the problems in Charlottesville over the weekend, it’s hard to imagine that their attempts to “spare no expense” will get to the root of the problem — and won’t end up targeting the same nonwhite Americans and immigrants that the white nationalists themselves wish to intimidate.”

I also think the Lind’s observations about Jeff Sessions are “spot on.” I have read other commentators suggest that because Sessions is such a “law and order guy” he can be trusted to prosecute the Charlottesville gang to the fullest extent of the law. That might well be true in this particular case. Clearly, Sessions is someone who historically has and continues to get his jollies from throwing folks in jails of all sorts (unless he can seek the death penalty which excites him even more).

But, Sessions has spent a career on the wrong side of racial history and hung around with immigration restrictionists and White Nationalists like Bannon and Steven Miller (who actually worked for him). He has wasted no time in essentially dismantling the Civil Rights enforcement mechanisms at the DOJ and turning the resources to looking for ways that whites can use civil rights laws for their advantage and to keep blacks and other minorities in their respective places. Further, he shows neither respect for nor acknowledgement of the tremendous achievements of American migrants, both legal and undocumented. In plain terms, he has faithfully carried out key elements of Trump’s White Nationalist agenda, to the delight of white supremacists and racists. And, it’s certainly not like Sessions isn’t aware of how his actions “play” in both the white and non-white communities.

Sessions is far too compromised ever to be an “honest broker” in combating white supremacists and racial hatred in the United States. Even if he throws the Charlottesville perpetrators in jail and throws away the key, he’ll never be credible as a defender of decency, tolerance, and civil rights in the face of White Nationalism or its first cousin white supremacism.

JASON DZUBOW IN THE ASYLUMIST: TRUMP’S 101 YEAR PLAN FOR REMOVALS! — “Malevolence tempered by incompetence!”

“Joseph Stalin and Mao Zedong had their five-year plans. Nikita Khrushchev had his seven-year plan. And now President Trump has a 101-year plan. That’s how long it will take to deport the country’s 11 million undocumented residents if current trends continue.

The most recent statistics on case completions in Immigration Court show that the Trump Administration has issued an average of 8,996 removal (deportation) orders per month between February and June 2017 (and 11,000,000 divided by 8,996 cases/month = 1,222.8 months, or 101.9 years). That’s up from 6,913 during the same period last year, but still well-below the peak period during the early days of the Obama Administration, when courts were issuing 13,500 removal orders each month.

Of course, the Trump Administration has indicated that it wants to ramp up deportations, and to that end, the Executive Office for Immigration Review or EOIR–the office that oversees the nation’s Immigration Courts–plans to hire more Immigration Judges (“IJs”). Indeed, Jefferson Beauregard Sessions, the Attorney General (at least for now) announced that EOIR would hire 50 more judges this year and 75 next year.

Assuming EOIR can find 125 new IJs, and also assuming that no currently-serving judges retire (a big assumption given that something like 50% of our country’s IJs are eligible to retire), then EOIR will go from 250 IJs to 375. So instead of 101 years to deport the nation’s 11 million undocumented residents, it will only take 68 years (assuming that no new people enter the U.S. illegally or overstay their visas, and assuming my math is correct–more big assumptions).

But frankly, I’m doubtful that 68 years–or even 101 years–is realistic. It’s partly that more people are entering the population of “illegals” all the time, and so even as the government chips away at the 11,000,000 figure, more people are joining that club, so to speak. Worse, from the federal government’s point of view, there is not enough of a national consensus to deport so many people, and there is significant legal resistance to Mr. Trump’s immigration agenda.

In addition to all this, there is the Trump Administration’s modus operandi, which is best characterized as malevolence tempered by incompetence. One statistic buried in the recent deportation numbers illustrates this point. In March 2017, judges issued 10,110 removal orders. A few months later, in June, judges issued 8,919 removal orders.

This means that the number of deportation orders dropped by 1,191 or about 11.8%. How can this be? In a word: Incompetence (I suppose if I wanted to be more generous—which I don’t—I could say, Inexperience). The Trump Administration has no idea how to run the government and their failure in the immigration realm is but one example.

There are at least a couple ways the Administration’s incompetence has manifested itself at EOIR.

One is in the distribution of judges. It makes sense to send IJs where they are needed. But that’s not exactly what is happening. Maybe it’s just opening night jitters for the new leadership at EOIR. Maybe they’ll find their feet and get organized. But so far, it seems EOIR is sending judges to the border, where they are underutilized. While this may have the appearance of action (which may be good enough for this Administration), the effect—as revealed in the statistical data—is that fewer people are actually being deported.

As I wrote previously, the new Acting Director of EOIR has essentially no management experience, and it’s still unclear whether he is receiving the support he needs, or whether his leadership team has the institutional memory to navigate the EOIR bureaucracy. Perhaps this is part of the reason for the inefficient use of judicial resources.

Another reason may be that shifting judges around is not as easy as moving pieces on a chess board. The IJs have families, homes, and ties to their communities. Not to mention a union to protect them (or try to protect them) from management. And it doesn’t help that many Immigration Courts are located in places that you wouldn’t really want to live, if you had a choice. So getting judges to where you need them, and keeping them there for long enough to make a difference, is not so easy.

A second way the Trump Administration has sabotaged itself is related to prosecutorial discretion or PD. In the pre-Trump era, DHS attorneys (the “prosecutors” in Immigration Court) had discretion to administratively close cases that were not a priority. This allowed DHS to focus on people who they wanted to deport: Criminals, human rights abusers, people perceived as a threat to national security. In other words, “Bad Hombres.” Now, PD is essentially gone. By the end of the Obama Administration, 2,400 cases per month were being closed through PD. Since President Trump came to office, the average is less than 100 PD cases per month. The result was predictable: DHS can’t prioritize cases and IJs are having a harder time managing their dockets. In essence, if everyone is a deportation priority, no one is a deportation priority.

Perhaps the Trump Administration hopes to “fix” these problems by making it easier to deport people. The Administration has floated the idea of reducing due process protections for non-citizens. Specifically, they are considering expanding the use of expedited removal, which is a way to bypass Immigration Courts for certain aliens who have been in the U.S. for less than 90 days. But most of the 11 million undocumented immigrants have been here much longer than that, and so they would not be affected. Also, expansion of expedited removal would presumably trigger legal challenges, which may make it difficult to implement.

Another “fix” is to prevent people from coming here in the first place. Build the wall. Deny visas to people overseas. Scare potential immigrants so they stay away. Illegally turn away asylum seekers at the border. Certainly, all this will reduce the number of people coming to America. But the cost will be high. Foreign tourists, students, and business people add many billions to our economy. Foreign scholars, scientists, artists, and other immigrants contribute to our country’s strength. Whether the U.S. is willing to forfeit the benefits of the global economy in order to restrict some people from coming or staying here unlawfully, I do not know. But the forces driving migration are powerful, and so I have real doubts that Mr. Trump’s efforts will have more than a marginal impact, especially over the long run. And even if he could stop the flow entirely, it still leaves 11 million people who are already here.

There is an obvious alternative to Mr. Trump’s plan. Instead of wasting billions of dollars, harming our economy, and ripping millions of families apart, why not move towards a broad legalization for those who are here? Focus on deporting criminals and other “bad hombres,” and leave hard-working immigrants in peace. Sadly, this is not the path we are on. And so, sometime in 2118, perhaps our country will finally say adieu to its last undocumented resident.”

“Five years ago this week, when I was secretary of Homeland Security, we began accepting the first Deferred Action for Childhood Arrivals (DACA) applications from “dreamers” who had been brought to this country without documentation when they were children. I will never forget that day: Tens of thousands of some of the best and brightest young people in our country applied to the program and celebrated their ability to live, work and learn in the only nation most of them had ever known.

Since that time, nearly 800,000 dreamers have gone through the rigorous application process and received DACA’s protections against deportation, including more than 100,000 who have had their applications renewed by the Trump administration.

Today, however, our nation’s dreamers face an uncertain future. Ten Republican state attorneys general are threatening to sue President Trump if he does not repeal DACA by Sept. 5. Worse, it seems unlikely that Attorney General Jeff Sessions will defend the program. During his Senate confirmation hearing, he said it “would certainly be constitutional” to eliminate DACA.

Five years ago when DACA was established, I said, “Our nation’s immigration laws must be enforced in a firm and sensible manner, but they are not designed to be blindly enforced. Nor are they designed to remove productive young people to countries where they may not have lived or even speak the language.” For the past five years, these young dreamers have proven that, when given the opportunity to contribute, they exceed expectations. It is time to unlock the full potential of these exceptional young people by making these protections permanent.”

PRESIDENT TRUMP vowed to deport “bad hombres” — undocumented immigrants with criminal records whose presence in this country is an unquestioned burden and menace. Instead, his administration has been content to seize and expel a teenage soccer star and his brother in suburban Maryland; a mother of three in Michigan who had spent 20 years in the United States; and, now in detention pending removal, a 43-year-old janitor at MIT whose three small children are U.S. citizens and whose mother, a permanent resident, planned to sponsor him for a green card next year.

None of them had criminal records. Both the Michigan mother and the MIT janitor ran their own businesses, paying taxes and contributing to the economy. All had active, honorable lives deeply entwined with their communities. Deporting them is not only inhumane but also senseless.

So why do it? Possibly, Immigration and Customs Enforcement is simply plucking the low-hanging fruit that crosses agents’ path. Possibly, the agency is trying to please the boss in the Oval Office by juicing deportation numbers with the easiest targets of opportunity.”

HERE IS what President Trump said Saturday about the violence in Charlottesville sparked by a demonstration of white nationalists, neo-Nazis and Ku Klux Klan members:

We condemn in the strongest possible terms this egregious display of hatred, bigotry and violence on many sides. On many sides.

Here is what a presidential president would have said:“The violence Friday and Saturday in Charlottesville, Va., is a tragedy and an unacceptable, impermissible assault on American values. It is an assault, specifically, on the ideals we cherish most in a pluralistic democracy — tolerance, peaceable coexistence and diversity.

“The events were triggered by individuals who embrace and extol hatred. Racists, neo-Nazis, Ku Klux Klan members and their sympathizers — these are the extremists who fomented the violence in Charlottesville, and whose views all Americans must condemn and reject.

“To wink at racism or to condone it through silence, or false moral equivalence, or elision, as some do, is no better and no more acceptable than racism itself. Just as we can justly identify radical Islamic terrorism when we see it, and call it out, so can we all see the racists in Charlottesville, and understand that they are anathema in our society, which depends so centrally on mutual respect.

“Under whatever labels and using whatever code words — ‘heritage,’ ‘tradition,’ ‘nationalism’ — the idea that whites or any other ethnic, national or racial group is superior to another is not acceptable. Americans should not excuse, and I as president will not countenance, fringe elements in our society who peddle such anti-American ideas. While they have deep and noxious roots in our history, they must not be given any quarter nor any license today.

“Nor will we accept acts of domestic terrorism perpetrated by such elements. If, as appears to be the case, the vehicle that plowed into the counterprotesters on Saturday in Charlottesville did so intentionally, the driver should be prosecuted to the full extent of the law. The American system of justice must and will treat a terrorist who is Christian or Buddhist or Hindu or anything else just as it treats a terrorist who is Muslim — just as it treated those who perpetrated the Boston Marathon bombing in 2013.

“We may all have pressing and legitimate questions about how the violence in Charlottesville unfolded — and whether it could have been prevented. There will be time in coming days to delve further into those matters, and demand answers. In the meantime, I stand ready to provide any and all resources from the federal government to ensure there will be no recurrence of such violence in Virginia or elsewhere. Let us keep the victims of this terrible tragedy in our thoughts and prayers, and keep faith that the values enshrined in our Constitution and laws will prevail against those who would desecrate our democracy.”

It might not be Presidential, but it’s what you’d expect from a President who has unabashed White Nationalists among his closest advisers and in a key cabinet position. It’s also what you would expect from someone who has spent the last several years pandering to White Supremacists, who now feel “at home” in today’s GOP, bigots, and racists, and whose own career shows little sensitivity to decency, values, or toleration.

President Trump has vowed to swiftly deport “bad hombres” from the United States, but the latest deportation statistics show that slightly fewer criminals were expelled in June than when he took office.

In January, federal immigration officials deported 9,913 criminals. After a slight uptick under Trump, expulsions sank to 9,600 criminals in June.

Mostly deportations have remained lower than in past years under the Obama administration. From January to June, Immigration and Customs Enforcement deported 61,370 criminals, down from 70,603 during the same period last year.

During the election, Trump vowed to target criminals for deportation and warned that they were “going out fast.” Later, he suggested he would try to find a solution for the “terrific people” who never committed any crimes, and would first deport 2 million to 3 million criminals.

But analysts say he is unlikely to hit those targets. Since January, immigration officials have deported more than 105,000 immigrants, 42 percent of whom had never committed any crime.

Last year, a total of 121,170 people were deported during the same period, and a similar percentage had no criminal records.

John Sandweg, the former acting director of Immigration and Customs Enforcement, said part of the reason for the decline is that illegal border crossings have plunged since Trump took office pledging to build a “big, beautiful” wall and crack down on illegal immigration. Immigrants caught at the border accounted for a significant share of deportations under the Obama administration.

 

Another factor, however, is that immigration officials are arresting more people who never committed any crime — some 4,100 immigrants in June, more than double the number in January — clogging the already backlogged immigration courts and making it harder to focus on criminals.

Immigration and Customs Enforcement released the deportation figures, which the Post had requested, late Thursday, two days after the Justice Department announced that immigration courts ordered 57,069 people to leave the United States from February to July, a nearly 31 percent increase over the previous year.

However, Justice officials have not said how many of the immigrants ordered deported were actually in custody — or if their whereabouts are even known. Every year scores of immigrants are ordered deported in absentia, meaning they did not attend their hearings and could not immediately be deported.

The deportation figures come as the Trump administration is fighting with dozens of state and local officials nationwide over their refusal to help deport immigrants, and as the administration is attempting to reduce legal and illegal immigration.”

It appears that many of the increased removal orders touted by DOJ/EOIR earlier this week might have been “in absentia” orders, issued without full due process hearings and all too often based on incorrect addresses or defective notices. Some of those orders turn out to be unenforceable. Many others require hearings to be reopened once the defects in notice or reasons for failure to appear are documented. But, since there wild inconsistencies among U.S. Immigration Judges in reopening in absentia cases, “jacking up” in absentia orders inevitably produces arbitrary justice.

The article also indicates that the Administration’s mindless overloading of already overwhelmed U.S. Immigration Courts with cases of non-criminal migrants has actually inhibited the courts’ ability to concentrate on criminals.

Taxpayer money is being squandered on “dumb” enforcement and a “captive court system” that no longer functions as a provider of fairness, due process, and justice. How long will legislators and Article III judges continue to be complicit in this facade of justice?

“NORMALIZING” THE ABSURD: While EOIR Touts Its Performance As Part Of Trump’s Removal Machine, Disingenuously Equating Removals With “Rule of Law,” The Ongoing Assault On Due Process In U.S. Immigration Courts Continues Unabated — Read The Latest SPLC Complaint About The Judges In The Stewart Detention Facility!

What if the U.S. Supreme Court proudly announced that as part of President Trump’s initiative to deregulate it had struck down 30% more regulations since Trump took office? What if the U.S. Court of Appeals for the Second Circuit announced that as part of the Administrations’s War on Drugs they had reassigned more U.S. District Judges to pretrial detention facilities and had produced 30% more convictions and 40% longer sentences for drug offenders than under the previous Administration. Might raise some eyebrows! Might show a lack of independence and due process in the Courts and lead one to believe that at least some U.S. Judges were betraying their duties to act impartially and their oaths to uphold the U.S. Constitution.

But yesterday, in truly remarkable press release, America’s largest court system, the United States Immigration Court proudly announced that they had joined the President’s xenophobic crusade against foreign nationals by assigning more Immigration Judges to railroad out of the country individuals detained, mostly without counsel, in remote locations along the Southern Border. EOIR touted that over 90% of the individuals in detention facilities lost their cases and were ordered removed from the U.S. (although as anyone familiar with the system knows, many of these individuals are refugees who have succeeded at rates of 43% to 56% on their claims over the past five fiscal years). To add insult to injury, EOIR had the audacity to caption its press release “Return to Rule of Law in Trump Administration!”

Return to Rule of Law in Trump Administration Marked by Increase in Key Immigration Statistics

The Executive Office of Immigration Review today released data on orders of removal, voluntary departures, and final decisions for the first six months of the Trump Administration.

 

The data released for Feb. 1, 2017 – July 31, 2017 is as follows:

 

  • Total Orders of Removal [1]: 49,983
    • Up 27.8 percent over the same time period in 2016 (39,113)

 

  • Total Orders of Removal and Voluntary Departures [2]: 57,069
    • Up 30.9 percent over the same time period in 2016 (43,595)

 

  • Total Final Decisions [3]: 73,127
    • Up 14.5 percent over the same time period in 2016 (63,850)

 

Pursuant to President Trump’s Jan. 25 Executive Order, “Border Security and Immigration Enforcement Improvements,” the Department of Justice mobilized over one hundred existing Immigration Judges to Department of Homeland Security (DHS) detention facilities across the country. Over 90 percent of these cases have resulted in orders requiring aliens to depart or be removed from the United States. The Justice Department has also hired 54 additional Immigration Judges since President Trump took office, and continues to hire new Immigration Judges each month.

 

In addition to carrying out the President’s Executive Order, the Justice Department is also reviewing internal practices, procedures, and technology in order to identify ways in which it can further enhance Immigration Judges’ productivity without compromising due process.

 

[1] An “order of removal” by an Immigration Judge results in the removal of an illegal alien from the United States by the Department of Homeland Security.

[2] Under an order of “voluntary departure”, an illegal alien agrees to voluntarily depart the United States by a certain date. If the illegal alien does not depart, the order automatically converts to an order of removal.

Yet, the absurdity of something that once purported to be a “court system” dedicated to guaranteeing “fairness and due process for all,” becoming part of the Administration’s border enforcement machine, stomping on the due process rights of those it was supposed to protect, went largely unnoticed in the media.

But, wait a minute, it gets worse! Recently, the widely respected journalist Julia Preston, now writing for the Marshall Project, told us how U.S. Immigration Judges in Charlotte, NC mock due process and fairness for asylum seekers.

Now, the Southern Poverty Law Center (“SPLC”) details how, notwithstanding previous complaints, eyewitnesses have documented the attack on fundamental fairness and due process by U.S. Immigration Judges at the DHS Stewart Detention Facility (why would “real judges” be operating out of a DHS Detention Facility?). Here’s a summary of the report from SPLC:

SPLC DEMANDS DEPARTMENT OF JUSTICE TAKE ACTION AGAINST IMMIGRATION JUDGES VIOLATING DETAINEES’ CONSTITUTIONAL RIGHTS

Some judges at the Stewart Immigration Court in Georgia routinely break the rules of professional conduct and continue to violate the constitutional rights of detainees – failures that require action, including the possible removal of one judge from the bench, according to a complaint the SPLC lodged with the U.S. Justice Department’s Executive Office for Immigration Review (EOIR) today.

The complaint, which comes almost a year after the SPLC and Human Rights First notified the agency about the judges, describes how they fail to explain basic legal information to immigrants, or even demonstrate the necessary dignity and courtesy the rules of conduct require.

The complaint notes that after one man told a judge that he had grown up in the United States, the judge said that if he were truly an American, he “should be speaking English, not Spanish.” The findings come after the SPLC spent a month observing the hearings of 436 people.

The federal agency has claimed that it initiated discussions with the judges after the initial complaint was filed in late August 2016, but the SPLC’s courtroom observers and its experience representing detainees continue to uncover issues at the court, which is inside the privately operated Stewart Detention Center in rural Lumpkin, Georgia.

“The people appearing before this court are already being held at the Stewart Detention Center, often far from their family and friends,” said Dan Werner, director of the SPLC’s Southeast Immigrant Freedom Initiative, which represents immigrants detained at Stewart. “They are scared and unsure of their rights when they go before judges whose behavior gives no assurance that they’ll receive a fair hearing. In fact, their behavior makes a mockery of the legal system.”

The SPLC’s courtroom observers found a number of issues, including judges failing to provide interpretation services for the entire court proceeding. They also failed to provide rationales for their decisions, provide written notification about future proceedings to the detainees, or grant routine procedural motions.

The complaint describes how Judge Saundra Arrington stands out for her lack of professionalism and hostility toward immigrant detainees – behavior warranting reprimand, suspension or even removal from the bench, according to the complaint.

Arrington, who goes by the last name Dempsey but is referred to as Arrington in EOIR records, began hearings with one immigrant by prejudicially noting he had a “huge criminal history,” comprised of nine convictions for driving without a license over 15 years. It was Arrington who told a detainee that he should speak English if he grew up in the United States and believed he was American.

She also refused to allow two attorneys appear on behalf of an immigrant, stating that there may be “one lawyer per case” despite attorneys explaining they had filed the necessary paperwork. Two attorneys, however, were allowed to appear on behalf of Immigration and Customs Enforcement Office of Chief Counsel.

Judge Dan Trimble, according to the complaint, denied bond for a detainee without looking at the bond motion. He also rarely refers detainees to the detention center’s “Legal Orientation Program,” which provides information about court proceedings and offers assistance.

“The Department of Justice must take action to stop this behavior that is undermining the legal system,” said Laura Rivera, SPLC staff attorney. “Every day that this behavior is allowed to continue is a day dozens of people have their rights denied.”

The SPLC launched the Southeast Immigrant Freedom Initiative (SIFI) at the detention center earlier this year to provide free legal representation to immigrants who have been detained and are facing deportation proceedings.

A recent national study found that between 2007 and 2012, only 6 percent of detainees at the Stewart Detention Center were represented by counsel – far below the national representation rate of 37 percent, according to the SPLC complaint. Immigrants with counsel are approximately 20 times more likely to succeed in their cases.

Beginning this month, SIFI will expand to other detention centers throughout the Southeast. When fully implemented, it will be the largest detention center-based deportation defense project in the country.

In other words, under pressure from the Trump Administration and the Sessions DOJ, some EOIR employees have disregarded their duty to the U.S. Constitution to provide due process for vulnerable migrants in Removal Proceedings. “The Justice Department has reversed its position in a high-profile voting case in Ohio, siding with the state in its effort to purge thousands of people from its rolls for not voting in recent elections.

The move is part of a broader campaign by the Trump administration to support restrictions on who is eligible to vote, a radical change in philosophy from the previous Justice Department, which sued a number of states over voting laws that it deemed discriminatory against minorities.

In a court filing late Monday, Justice Department attorneys took the opposite position from the Obama administration in a case that involves Ohio’s removal last year of tens of thousands of inactive voters from its voting rolls.

In their brief, government lawyers say they reconsidered the Ohio vote-purging issue after the “change in Administrations,” and they argue that the state’s actions are legal under federal law. The case is headed next to the Supreme Court.

Ohio’s procedure allows the state to purge voters who meet certain criteria for being inactive. If a voter has not cast a ballot in two years, the person is sent a notice asking them to confirm their registration. If the voter does not respond and does not cast a ballot over the next four years, the person is removed from the rolls.

The Trump administration has signaled in other ways that it intends to back added requirements for voters as part of a crackdown on alleged fraud.

President Trump in May created an advisory commission on election integrity that has been tasked with determining the extent of illegal voting. The president earlier made the baseless allegation that illegal voting cost him the popular vote against Democrat Hillary Clinton in the 2016 presidential election.

The commission’s only notable act so far has been to request massive amounts of voter data from the states, a move that has provoked lawsuits accusing the panel of breaching Americans’ privacy.

The case in Ohio is not the first time the Justice Department has reversed course in a major legal battle over voting rights. In February, shortly after Jeff Sessions became attorney general, the department dropped its position in a long-running case that argued Texas intended to discriminate against minorities when it passed a strict voter-ID law.

The Texas law, passed in 2011, required that voters present certain forms of identification, such as a driver’s license or a weapons permit, but the state did not allow other forms, including IDs issued by colleges. Critics said these restrictions targeted voters, such as young people and minorities, who are more likely to vote Democratic. A number of courts found the Texas law to be unconstitutional, and a federal court in April found that the Texas legislature intentionally discriminated against black and Hispanic voters.

Voting rights advocates said the Justice Department’s action on Ohio represented a major change in direction for the U.S. government’s stance on access to the polls.

The move “signals the broader agenda of the administration to roll back voter rights in this country,” said Vanita Gupta, former head of the Justice Department’s civil rights division under President Barack Obama and now president of the Leadership Conference on Civil and Human Rights.”

During Sessions’s Senate Confirmation, Senator Liz Warren, Senator Corey Booker, Members of the Congressional Black Caucus, and my friend and former DOJ Civil Rights Attorney Jerry Hebert, among others, tried to tell the Committee and the Senators that Sessions was the same White Nationalist/racially challenged individual he had been back when he was properly rejected for a U.S. District Judge position. They were “tuned out.”

Sessions took umbrage, and then lied under oath to the Committee when he claimed to be a staunch defender of civil rights and someone who would separate his political positions as a Republican Senator from Alabama (a state with a disgraceful history of racial bias) from his new responsibilities as Attorney General for all Americans. That would include people of color, LGBT Individuals, immigrants, both legal and undocumented, women, and even Democrats. But, he’s the “same ol’ Jeff” just like his critics said he would be. And the carnage to the American justice system that he is creating probably won’t be repaired any time soon.

“This week the Republican senators Tom Cotton of Arkansas and David Perdue of Georgia introduced a bill that they said would cut legal immigration to the United States by 50 percent. They are right about that, but nearly everything else that they have said about their bill is false or misleading.

The senators, whose bill is endorsed by President Trump, argue that America is experiencing abnormally high immigration; that these immigrants are hurting American wages; and that their bill would prioritize skilled immigrants, the way Canada does, thus making the United States more competitive internationally. These talking points are pure fiction.

They have justified this drastic cut in immigration by stating that the bill will, as they put it in February when announcing an earlier version, bring “legal immigration levels” back down to “their historical norms.” But the senators fail to consider the impact of population growth. A million immigrants to the United States in 2017 isn’t equivalent to the same number in 1900, when there were a quarter as many Americans.

Controlling for population, today’s immigration rate is nearly 30 percent below its historical average. If their bill becomes law, the rate would fall to about 60 percent below average. With few exceptions, the only years with such a low immigration rate were during the world wars and the Great Depression. Surely, these are not the “norms” to which the senators seek to return.

Senator Cotton is trying to connect a slow increase in the immigration rate in recent decades to declining wages for Americans without a college degree, implying that low-skilled workers are facing more competition for jobs than in earlier years. But this correlation is spurious, because it ignores the size of the overall labor pool.

Rather than cutting immigration, Congress should raise the employment-based quotas, which it has not adjusted since 1990 — when the United States had some 77 million fewer people and the economy was half the size it is now. A smart reform would double green cards and peg future work visas to economic growth, responding to market forces rather than political whims.

Smart reforms, however, require that Congress first understand the basic facts: America has not seen a deluge of immigration. Low-skilled American-born workers have not faced more competition for jobs. Other countries accept more immigrants per capita. Until these facts penetrate the halls of the Capitol, the immigration debate will continue to be mired in ignorant proposals like this.

Raising legal immigration to more realistic levels, consistent with market forces, would also facilitate “smart” law enforcement. Fewer needed workers would have to come “outside” the system. Once there is a realistic “line” the threat of being “sent to the end of the line” or even taken out of “the line” would become more effective in deterring unauthorized entries. Immigration enforcement could concentrate on a fewer number of folks trying to evade the system, rather than, as is the case now, concentrating largely on “busting” those who are coming to take jobs that play a constructive and expansive role in the American economy.

The workforce age individuals within the 10 –11 million undocumented individuals here now are almost all working in jobs that help support the American economy. Indeed, removing them all tomorrow would “tank” many American businesses and likely send the entire economy into a tailspin. Legalizing them would insure that they all pay takes and prevent them from being exploited by unscrupulous employers.

Legalization + more legal immigration is a “win-win” for America and its workers of all types and statuses.

In an Editorial today, the NY Times was equally unimpressed with the Trump/GOP proposal for cutting immigration, calling it “senseless:”

“The issue of immigration in America is volatile and complex and thus vulnerable to seductive promises. This bill falls into that category. Its central premise — that it would help American workers — is false. It’s true that an influx of workers can cause short-term disruptions to the labor market, but the impact on the wages of native workers over a period of 10 years or more is “very small,” according to a comprehensive National Academies of Sciences, Engineering and Medicine reportpublished last year.

Moreover, as studies have repeatedly shown, immigration boosts productivity and economic growth; restricting it would have the opposite effect. Growth is determined by the changes in productivity — how much each worker produces — and the size of the work force. Productivity in recent decades has been growing more slowly than in the past for reasons that economists do not fully understand. The labor force is also growing slowly as baby boomers retire. Restricting immigration would reinforce both trends.

Mr. Trump and the senators behind this bill seem to believe that immigrants who are admitted to America because they have family ties possess few skills and are of little value to the country. That’s simply not so. About 41 percent of legal immigrants, the large majority of whom are relatives of citizens, have at least a bachelor’s degree, according to a 2015 Pew Research Center report.

Hostility to immigration was a pillar of Mr. Trump’s presidential campaign, and he has surrounded himself with like-minded officials, so it’s no surprise that he likes this bill. But it is a bridge too far for Republicans like Senators Lindsey Graham of South Carolina and Ron Johnson of Wisconsin, which makes it unlikely to go anywhere. The right approach to immigration reform would be bipartisan and comprehensive. It would include stronger enforcement, better worker protections and a pathway to citizenship for the country’s 11 million unauthorized immigrants.

A Quinnipiac poll released last week showed the president’s job approval ratings at a new low, even among demographic groups that make up his base. About 61 percent of voters disapproved of the way Mr. Trump was doing his job, including half of whites without a college degree. Mr. Trump’s recent messages opposing transgender people in the armed forces and encouraging aggressive behavior by the police have been seen as efforts to recapture that base. His support for this immigration bill is more of the same.”

“WASHINGTON — When the federal government banned the use of farmworkers from Mexico in 1964, California’s tomato growers did not enlist Americans to harvest the fragile crop. They replaced the lost workers with tomato-picking machines.

The Trump administration on Wednesday embraced a proposal to sharply reduce legal immigration, which it said would preserve jobs and lead to higher wages — the same argument advanced by the Kennedy and Johnson administrations half a century ago.

But economists say the tomato story and a host of related evidence show that there is no clear connection between less immigration and more jobs for Americans. Rather, the prevailing view among economists is that immigration increases economic growth, improving the lives of the immigrants and the lives of the people who are already here.

“The average American worker is more likely to lose than to gain from immigration restrictions,” said Giovanni Peri, an economist at the University of California, Davis.

The Trump administration is proposing sharp reductions in the number of skilled and unskilled workers who are allowed to become permanent residents, halving annual immigration from the current level of roughly one million people a year.

“This legislation demonstrates our compassion for struggling American families who deserve an immigration system that puts their needs first,” President Trump said.

The proposal revives elements of President George W. Bush’s effort to rewrite federal immigration law in 2007, and it appears no more likely to succeed. It already has drawn sharp opposition from Democrats and from some Senate Republicans.

Economists say that skilled immigrant workers are clearly good for the American economy. The United States could import computers; if it instead imports computer engineers, the money they earn is taxed and spent in the United States. Moreover, some of those engineers invent new products — or even entirely new technologies.

The administration says it still wants high-skilled workers, and it has described the cuts as targeted at low-skilled immigrants. It would still issue roughly 140,000 merit-based green cards each year, while sharply reducing the number of people admitted as family members of current residents.

But about one-third of those family members who received green cards since 2000 had college degrees, Mr. Peri said. “People have an outdated image” of legal immigration, he said. “It’s mostly Asian, Indian, Chinese people who are coming to do mid- and high-level professional jobs.”

George J. Borjas, the Harvard immigration economist whose work is the only evidence that the administration has cited as justifying its proposals, said in an interview on Wednesday that there was no economic justification for reducing skilled immigration.

“That is a political decision,” he said. “That is not an economic decision.”

Most studies put the negative impact on low-skilled wages closer to zero, Mr. Peri said.

One key reason is that immigrants often work in jobs that exist only because of the availability of cheap labor. Picking tomatoes is a good example. California farmers in the 1950s and early ’60s relied on Mexican workers even though machines were already available. In 1964, 97 percent of California tomatoes were picked by hand.

The United States let farmers hire Mexican workers on seasonal permits, a program that began as a response to labor shortages during World War II. By the early 1960s, the program was politically untenable. “It is adversely affecting the wages, working conditions, and employment opportunities of our own agricultural workers,” President John F. Kennedy declared in 1962. President Lyndon B. Johnson ended the program in 1964.

By 1966, 90 percent of California tomatoes were being picked by machines.

“The story that ‘when labor supplies go down, wages go up’ is a cartoon,” said Michael A. Clemens, an economist at the Center for Global Development who has studied the end of the Mexican guest-worker program, which was known as the Bracero program.

Similarly, in the present day, some American dairy farmers warn that the nation needs to continue importing farm workers or it will end up importing milk.

Low-skilled immigration can also provide a boost to the rest of the economy.

A 2011 study found that high-skilled women were more likely to work in cities with high levels of immigrants, because families could pay for child care or elder care.

The National Academy of Sciences made an ambitious effort to assess the bottom line in 2016. It concluded that the average immigrant cost state and local governments about $1,600 a year from 2011 to 2013 — but the children and grandchildren of immigrants paid far more in taxes than they consumed in public services.

More broadly, the report concluded that immigration benefited the economy.

A recent analysis by economists at JPMorgan Chase concluded that halting immigration completely would reduce annual economic growth by 0.3 percent.

The Trump administration’s immigration proposal would also change the rules for merit-based immigration. It wants to create a point system that would give higher priority to applicants based on factors including age, job skills and the ability to speak English.

Canada and Australia use similar points-based systems to pick immigrants.

Some economists argue that it would be better to just let the market make decisions, for example, by using a system like the H-1B visa program that allows companies to request permission for workers to come to the United States on a temporary basis.

Also, Mr. Clemens said that points-based systems tended to prioritize education. That might not be advantageous to the economy when in fact employers also need workers with fewer skills. He noted that the Commerce Department has projected that demand for workers without a college education will significantly outstrip the growth of the working-age population.

“It’s a political myth that the principal need is for high-skilled workers,” he said.”

“President Trump’s plan for an aggressive hiring surge of 15,000 Border Patrol and immigration personnel to help keep out undocumented immigrants is unrealistic — and the Department of Homeland Security has not made a case for it, the agency’s watchdog says.

A report released this week by the DHS inspector general concludes that based on its rigorous screening requirement for law enforcement jobs and the relatively high rate of attrition among Border Patrol agents, Homeland Security would have to vet 750,000 applicants to find 5,000 qualified personnel.

In addition, to hire the 10,000 Immigration and Customs Enforcement (ICE) agents the president called for in executive orders he issued in his first days in office, a pool of 500,000 candidates would need to apply, auditors found.

The report calls into question whether DHS officials even need 15,000 new hires to target undocumented immigrants. Agency leaders have done such poor planning for what their workforce should look like, with an understaffed, poorly trained human resources operation, that they cannot justify thousands of new employees, the report says.

“Neither [U.S. Customs and Border Protection] nor [ICE] could provide complete data to support the operational need or deployment strategies for the additional 15,000 agents and officers,” the report by the office of Inspector General John Roth said.

DHS officials told auditors that they are still three to four years from getting a system in place that will be able to tell them how many new personnel they need and where to deploy them.

“Without comprehensive staffing models, operational needs analyses, and deployment strategies, CBP and ICE will not be able to identify clearly the correct number and type of employees required, what positions must be filled, or where to deploy those employees,” the report said.

Trump promised on the campaign trail to vastly beef up enforcement against undocumented immigrants with a new border wall, a surge in agents to help seal off the Southwest border with Mexico and a “deportation force” to arrest people in the country illegally. The 15,000 new front-line employees would come with almost 9,600 more technical and support staff, the report said.”
