It began with a desperate request for water and a Walmart employee’s suspicions about a tractor-trailer parked outside. That led officials on Sunday to discover at least 39 people packed into a sweltering trailer, several of them on the verge of death — their skin hot to the touch, their hearts dangerously racing — and eight men already dead. Another would die later at a hospital.

Authorities think they found an immigrant smuggling operation just 2½ hours from the Mexican border that ended in what San Antonio Police Chief William McManus described as a “horrific tragedy.” The victims, as young as 15, appeared to have been loaded like cargo into a trailer without working air conditioning during the height of the Texas summer. It was unknown how long they had been in the trailer or where their journey started, but 30 of the victims were taken to area hospitals and 17 had life-threatening injuries. Federal authorities said the victims were “undocumented aliens.”

Reyna Torres, consul of Mexico, confirmed in Spanish that Mexican nationals are among those dead and in the hospitals and said the consulate is interviewing the survivors.

City Fire Chief Charles Hood said some of the victims appeared to have suffered severe heatstroke, with heart rates soaring over 130 beats per minute. In the worst cases, Hood said, “a lot of them are going to have some irreversible brain damage.”

Even more people were thought to have been inside the trailer before help arrived, police said. Survivors at six area hospitals told investigators that up to 100 individuals were originally in the tractor-trailer.

Walmart surveillance video showed cars stopping and picking up people as they exited the back of the trailer. But suspicions were not raised until an employee noticed a disoriented person, who asked for water. The employee then called police, authorities said. Then, a chaotic scene unfolded outside the Walmart on the city’s southwest side, as ambulances and police cars arrived and people were carried away, leaving behind shoes and personal belongings strewn across the asphalt and trailer floor.

The truck’s driver, identified as James M. Bradley, 60, of Clearwater, Fla., has been arrested and is expected to be charged Monday morning, said the U.S. attorney’s office for the Western District of Texas.

The grisly discovery in San Antonio comes as the Trump administration is calling on Congress to increase funding for border security and to expand the wall on the southern border with Mexico.

It also illuminates the extreme risks immigrants face as they attempt to elude border agents in the searing summer heat. Some try to slip through legal checkpoints undetected, while others sneak illegally across the border. Often, they are fleeing violence and poverty in Latin America, advocates say.

Many have died attempting to enter the United States, drowning in the Rio Grande, lost in the desolate ranch lands of south Texas, or collapsing from exhaustion in the Arizona desert.

Two weeks ago, Houston police discovered 12 immigrants, including a girl, who had been locked for hours inside a sweltering box truck in a parking lot, banging for someone to rescue them. Three people were arrested. A Harris County prosecutor said the migrants were at imminent risk of death.

In May, border agents discovered 18 immigrants locked in a refrigerated produce truck, with the temperature set at 51 degrees. Passengers were from Latin America and Kosovo.

One of the deadliest smuggling operations occurred in 2003, when 19 people died after being discovered in an insulated trailer abandoned at a truck stop in Victoria, Tex. The truck driver in that case, Tyrone M. Williams, was sentenced to nearly 34 years in prison.

Later Sunday, moments after Mass ended at the historic San Fernando Cathedral, two dozen people held a gathering in Main Plaza to show their support for immigrants. A handful of people made speeches­ and said prayers in Spanish and English, using a megaphone, to a crowd of about 50 people. Children played in the splash pads nearby while adults wandered in and out of the crowd, many taking photographs and videos.

“Hold your family extra tight tonight,” said Barbie Hurtado, the statewide organizer for ­RAICES, which organized the event, “and keep the people that lost their lives in your thoughts, in your prayers.”

Rep. Joaquin Castro (D-Tex.), a San Antonio native, addressed attendees at the end of the hour-long service.

“This represents a symptom of a broken immigration system that Congress, of which I am a part, has had the chance to fix but has not,” he said. “That’s a colossal failure that has a human cost.”

Another San Antonio native, Debbie Leal-Herrera, 55, said she was in town visiting from New Mexico this week and wanted to come to the plaza because “it touches­ me as a Hispanic.”

Leal-Herrera, an elementary school teacher, said she knows several people who have immigrated to the United States illegally and has taught many students whose parents are undocumented.

“It reminds me of how much we truly take for granted,” she said. “What a beautiful gift it is to be an American.”

Advocates for immigrants in Texas are still reeling from the recent passage of the tough new immigration law, set to take effect Sept. 1. The deaths marked yet another blow.

Maria Victoria De la Cruz, who is originally from Mexico, publicly urged federal officials not to deport the immigrants who were found Sunday.

“As an immigrant, I feel destroyed,” she told the group in Spanish. “It’s not fair to return them to the place they have fled.”

During the vigil, a somber group quietly approached the consul from Mexico to ask about a relative. Juan Jose Castillo, who said he is from the Mexican state of Zacatecas but lives in the United States, said he was relieved that his 44-year-old brother was among the survivors.

“He came out of necessity,” Castillo said in Spanish. “It’s very bad.”

One way of saving some lives: reform the immigration system to 1) allow more individuals to immigrate legally, and 2) provide full due process adjudications of asylum and other claims for protection under U.S. law, with reasonable access to counsel and no detention unless required by individualized circumstances, to individuals who present themselves at the border. This would encourage individuals who seek to to migrate to or seek refuge in the U.S. to do so in an orderly fashion, with complete screening, through our legal system.

Militarizing the border and creating a detention empire might or might not reduce undocumented migration in the long run. But three things are certain: 1) smuggling fees will go up; 2) methods used by smugglers will become more risky; and 3) more individuals will die attempting to enter the U.S.

Read the full opinion at the link. It’s short. Three things stand out.

First, the Respondent’s credible testimony clearly established a plausible claim for CAT relief. If he gets representation, he will be able to show that the authorities in El Salvador do often cooperate with gangs and that the government is willfully blind to the many instances of torture of citizens by gangs. The Asylum Officer’s incorrect analysis along with that by the Immigration Judge show a fundamental misunderstanding of CAT law and the reasonable fear process. How does an Immigration Court system faced with such glaring problems eliminate training and the guidance provided through the former Benchbook?

Second, the 9th Circuit highlights the Byzantine nature of the regulations in this area.  How many unrepresented individuals who been treated in this unfair manner are hustled out of the country because they can’t figure out how to get meaningful review?

Third, this decision shows that there might well be ways to penetrate the general unwillingress of Appellate Courts to review the gross miscarriages of justice and denials of due process going on every day in the expedited removal process which is administered by the DHS and inadequately reviewed by the Immigration Judges. Once they take a look, they will be appalled at what they find!

TROUBLE FOR SIJS IN VIRGINIA? Court Of Appeals Says No Jurisdiction to Make SIJ Findings — Canales v. Torres Orellana

Although I was involved, in one of my prior incarnations, in the initial phases of SIJ legislation, I am currently not enough of an expert to say what the exact effect of this ruling will be in future SIJ cases in Virginia. It doesn’t sound good. During my tenure in the Arlington Immigration Court, I took many Virginia cases off the docket after an SIJ petition was granted by USCIS. Perhaps someone who has more expertise in SIJs can comment or point readers to a practice advisory on the impact of this case.

NEW SUIT IN CAL. ALLEGES THAT DHS FLOUTS ASYLUM LAW AT BORDER!

“Border agents are systematically intimidating and turning away asylum seekers at the US–Mexico border, a lawsuit filed on Wednesday alleges.

The federal class-action lawsuit filed in US District Court in California by immigrant rights groups alleges that US Customs and Border Protection agents have told migrants that “Donald Trump just signed new laws saying there is no asylum for anyone.” They have also allegedly coerced asylum seekers into signing forms abandoning their claims by threatening to take their children away.

“CBP’s illegal conduct is occurring as a humanitarian crisis drives vulnerable people experiencing persecution in their home countries to seek refugee protection in the United States,” the complaint states.

CBP said in a statement that it does not comment on pending litigation.

One of the plaintiffs, identified as Abigail Doe in the complaint, is a Mexican native with two children under the age of 10. She attempted to flee Mexico after the cartels threatened to kill her family.

She arrived in Tijuana with her two kids and approached border agents at the San Ysidro point of entry. The lawsuit states CBP agents coerced her into recanting her fear of staying in Mexico and signing a form withdrawing her application for admission to the US.

Abigail Doe and other women in the lawsuit said they were told by agents that if they continued to pursue their asylum claims they would be separated from their children.

“As a result of this coercion, the form falsely states that [Abigail Doe] and her children were unable to access the asylum process and were forced to return to Tijuana, where they remain in fear for their lives,” the lawsuit states.

Another woman, identified as Dinora Doe from Honduras, presented herself to US border authorities after her and her 18-year-old daughter were threatened and repeatedly raped by MS-13 gang members. The complaint accuses CBP officials of misinforming Dinora Doe of her rights under US law, and denying her the chance to apply for asylum.

The lawsuit also names Al Otro Lado, a legal aid organization that helps migrants on both sides of the border, as a plaintiff because it has allegedly been forced to divert significant resources to counteract CBP’s actions.”

“Yolanda already knows what it feels like to leave a child behind.

She left three in her native Guatemala just over two decades ago. “I had to decide so quickly,” she told me. “My husband had already crossed. My mother told me to go, to send money back to them, and that the children would follow when they were old enough.” They were 16 months, 7, and 9. Twenty-one years later, she’s still waiting.

 

Since she came to America, Yolanda has had another daughter. She’s 8 years old, and she has autism, which makes the struggle to establish an ordinary American life even harder. And then there’s the fact that, like more than 11 million other people in America, Yolanda is an undocumented immigrant. While her status has always been insecure, the risks it posed always seemed like an abstraction, and her community in Staten Island seemed to be mostly on her side. Then Donald Trump was elected president, and the incendiary rhetoric about immigrant communities that he had used on the campaign trail became an almost unbelievable reality. Suddenly, the future is as painful for Yolanda to contemplate as the past.

“My biggest fear,” she said through a translator, as we sat across from each other in a small office at El Centro del Inmigrante, a community-based educational organization and worker center in the Port Richmond neighborhood of Staten Island, “is that I’ll be deported and my daughter will have to stay here. I have nobody to leave her with. But I’m also afraid of having to bring her back to a country where they won’t have any of the services she needs.”

The prospect of leaving her daughter behind is especially frightening because of her autism. “I have to monitor her constantly. I help her with everything she does. I tie her shoes, feed her. She sleeps with me. No one’s going to do that the way I do. Who would ever be able to take my place?”

The political transformation that forced such questions to the front of Yolanda’s mind began almost as soon as Trump came into office. An executive order signed in January mandated the detention of any undocumented person with or without a criminal record, just so long as he or she “pose[s] a risk to national security” in the thoroughly undefined “judgment of an immigration officer.” It also authorized the hiring of an additional 10,000 ICE agents. Meanwhile, those already in place seemed to interpret their role differently right away. In the first three months of 2017, the Washington Post reported, ICE arrested 5,441 undocumented immigrants without criminal records; in the same period last year, the number was less than half of that. And last Friday ICE announced what it called a “surge initiative,” a program to arrest immigrant parents who hire smugglers to bring their children to join them. Immigration advocates call the program “unimaginably cruel.”

In her community in Staten Island, which once seemed to Yolanda like a haven, the national picture seems to be encroaching with disturbing speed. In February, five Mexican immigrants in the borough were picked up in ICE raids, part of a wider sweep across New York City that led to a total of 41 arrests. In June, ICE arrested a teenager in New York State on the day of his senior prom. In this new climate, undocumented parents are panicking: flooding El Centro’s offices, desperate for information, trying to understand what Trump’s promise to deport as many undocumented immigrants as possible will mean for them. El Centro is scrambling to respond to the overwhelming new demand for its services, setting up workshops to help parents better understand their options, helping frightened parents apply for the services for their U.S.-born children, and providing up-to-date information on new enforcement measures. “We’ve been around since 1997,” said Favio Ramirez-Caminatti, the nonprofit’s executive director. “We’ve never seen a situation like this.”

“The MS-13 gang member filmed the killing with a cellphone, barking out orders and narrating as fellow gang members set upon the 15-year-old girl with a knife and a large wooden stake in a suburban Virginia park, an FBI agent testified Monday.

The green-light to kill Damaris A. Reyes Rivas had come from the transnational gang’s leadership in El Salvador, payback for her alleged role in luring another MS-13 member to his death a week earlier, the FBI agent told a Fairfax County judge.

But it was 17-year-old Jose Cerrato who allegedly helped orchestrate the killing, part of a plan to send the video back to those MS-13 leaders as proof of his willingness to carry out orders, the agent testified. It’s unclear if the video was ever sent, but the FBI agent testified Cerrato soon earned a promotion within the ranks of the gang for his role in the slaying.

The testimony by FBI special agent Fernando Uribe came during a hearing in Fairfax County juvenile court in which a judge certified that Cerrato would face murder, abduction and gang participation charges as an adult.”

9th Circuit Upholds Judge Gee’s Order Requiring Bond Hearings For Children! — Flores v. Sessions!

“Minors who enter the U.S. without permission must be given a court hearing to determine whether they can be released, a federal appeals court panel decided unanimously Wednesday.

A three-judge panel of the U.S. 9th Circuit Court of Appeals said immigration authorities continue to be bound by a 1997 lawsuit settlement that guaranteed court hearings for minor immigrants, set standards for their detention and established a policy in favor of their release.

Following that settlement, Congress passed two laws dealing with unaccompanied minor immigrants. The federal government argued those laws replaced the settlement and revoked the right to bond hearings.

The 9th Circuit disagreed.

“In the absence of such hearings, these children are held in bureaucratic limbo, left to rely upon the [government’s] alleged benevolence and opaque decision making,” Judge Stephen Reinhardt, a Carter appointee, wrote for the court.

The settlement of Flores vs. Janet Reno required that juveniles detained near the border or elsewhere without a parent must be given bond hearings.

The hearings gave minors the right to a lawyer, an opportunity to learn and challenge government evidence against them and the right to contest being locked up, the panel said.

The 9th Circuit cited evidence that the government has been holding minors for months or even years without hearings, even when parents are nearby and can care for them.

Among them was a boy identified only as Hector, who was detained in California at the age of 15 for 480 days, mostly in a locked facility in Yolo County. The ruling did not say why Hector was picked up.

In a declaration, Hector described the Yolo County facility as a prison, where minors were locked in cells at night to sleep on cement benches with mattresses.

During 16 months there, Hector was not given a lawyer or an explanation about why he was being held even though his mother in Los Angeles was seeking his release, the 9th Circuit said.

Without any explanation, the federal government released Hector in December “into the custody of the person who had been advocating for his freedom all along — his mother,” Reinhardt wrote.

The court cited evidence that some juveniles have agreed to deportation rather than face continued incarceration without their families.

“Unaccompanied minors today face an impossible choice between what is, in effect, indefinite detention in prison, and agreeing to their own removal and possible persecution” in their native countries, Reinhardt wrote.

The ruling upheld a decision by Los Angeles-based U.S. Dist. Judge Dolly M. Gee, an Obama appointee.

The government may appeal the panel’s decision to a larger 9th Circuit panel or to the U.S. Supreme Court.

Lawyers in the case could not be reached for comment.”

DHS MISTREATS KIDS: U.S. District Judge Dolly Gee Finds That DHS Has Blown Off Her Prior Orders & Continues To Mistreat Children In Detention!

“Despite being among some of the most vulnerable, children seeking asylum in the United States often fare the worst. Upon entering the United States, children are often detained for extended periods in violation of a long-standing agreement known as the Flores settlement.

The Flores agreement essentially acts as a contract between the government and children held in immigration custody. On Tuesday, a federal district court judge ruled once again that the government is failing to meet its obligations to children held in immigration custody.

The court found a number of violations, including holding children too long in detention, in substandard conditions, and in non-licensed facilities. In addition, the court ruled that the government is required to look at each child’s case individually to determine whether release from custody is appropriate—the government may not rely on any blanket standard to avoid the responsibility of assessing each case individually.

The Flores agreement is a nationwide settlement reached in 1997. In this settlement, the government agreed that children taken into immigration custody would be placed in the “least restrictive setting appropriate to [their] age and special needs” and would be released “without unnecessary delay,” preferably to a parent. The settlement also requires that if a child is not released to a parent, adult relative, or an appropriate guardian, children must be placed in non-secure facilities licensed for the care of dependent children within five days of apprehension.

Two years ago, the Center for Human Rights and Constitutional Law (CHRCL), on behalf of immigrant children, brought suit to enforce the Flores settlement. In July and August of 2015, U.S. District Court Judge Dolly M. Gee said the government must apply the settlement to all minors, including those detained with family members. Tuesday’s order from Judge Gee outlines the particular ways in which the government is in breach of the Flores settlement and how the court seeks to ensure compliance going forward.”

“Along the border, the impacts of Trump’s immigration policies are visible everywhere: At the river, the number of people crossing into the United States has plummeted. At the detention facilities, fewer people are being detained. And at the McAllen bus station — a place where ICE has released more than 30,000 families since 2014, sometimes hundreds a day — the number of people coming in each day is sometimes down to just an overwhelmed man and his only child, with tickets that will take them 1,700 miles and 46 hours north to live with a relative in Cleveland.

“Look at the dresses,” Sandra says as the bus passes a clothing store.

Miguel looks instead at her. She must be tired, he thinks. Or at least hungry. He reaches for a bag carrying the only food they have for the trip. It had been given to them not by ICE, but by a stranger at the bus station. She had run up to them just before they boarded and passed them the bag, which was full of snacks and sandwiches. Miguel hands a sandwich to Sandra. She takes a bite. He does not know who the stranger was, only that she seemed to be in a hurry, and now there are seven sandwiches left and 46 hours to go.

In the months since Trump took office, the sign-in sheet had fewer names with each passing week. For a time, the respite center staff wondered if the families would stop being released completely. “Under my administration,” Trump had said during his campaign, “anyone who illegally crosses the border will be detained until they are removed out of our country.” He railed against the very policy that had allowed the families to come here: a policy critics have long called “catch and release.” It was a routine developed for ICE and Border Patrol to handle the overwhelming number of parents and children, mostly from Central America, crossing the border to ask for asylum. Each released family would be allowed to go live with their relatives in the United States, as long as they appeared at the check-ins and court dates that would eventually determine whether they would be deported.

On his sixth day in office, Trump issued an executive order declaring the “termination” of catch and release. It has not been as simple as that declaration, though; there are laws and judicial orders in place that limit how long ICE can detain children, and in most cases, when a child is released, at least one of their parents is, too.

For the time being, catch and release was still happening, and Gabriela was still showing up at work every day, never knowing if it would be the one when the surge of people returns, or another when so few people cross the border, no families show up at the respite center at all.”

We use “catch and release,” a sport fishing term to refer to the lives and futures of real human beings like this. And by all accounts, including my own observations, immigration detention is something that can be highly coercive, intentionally demoralizing, and expensive.

A HUMAN LIFE IS A TERRIBLE THING TO WASTE! — BUT, THAT’S EXACTLY WHAT OUR CURRENT PROGRAM OF DEPORTATIONS TO GUATEMALA IS DOING!

“On a recent Wednesday, 75 Guatemalans disembarked from one of three charter flights, all full of deportees from the United States, scheduled that day. The group was led into a hangar, where authorities gave them a perfunctory welcome: a hello, a snack and bus fare to wherever they were headed.

The Guatemalan government’s relationship to the deportees ended there. Considering them a burden, even an embarrassment, the Guatemalan state and society are unable and unwilling to assist the thousands of migrants being sent back home.

Reintegrating them is no doubt a challenge. But so is doing nothing. And Guatemala and the United States have far more to gain by harnessing the economic, social and political capital these migrants bring back with them.

One reason Guatemala doesn’t do much with deportees is the widespread belief that they won’t stay for long.

On a recent visit to the country, I heard businessmen, public officials and community activists insist that Donald Trump and his wall would not intimidate aspiring migrants. But migrants aren’t wasting time, either. As a community leader told me, “Everyone is saying that they better rush now before Mr. Trump finishes his wall.”

In fact, many Guatemalans want the migrants to go back. Their return spells an end to remittances that constitute about 10 percent of the country’s gross domestic product. And returning migrants are flooding an already depressed job sector, where three-quarters of the labor force works off the books.

Not surprisingly, returning migrants aren’t particularly liked. Guatemalans figure they were sent home for breaking the law; those with tattoos are ostracized, assumed to belong to a violent street gang. Employers won’t hire them, and passers-by glance away.

Of course, such treatment becomes a self-fulfilling prophecy. Denying migrants the assistance to reintegrate economically and socially will just make the country’s problems worse.

Marginalized individuals often join street gangs in a search to belong, and drug gangs and human traffickers recruit returning migrants. They know how to get across the border; many have lived in communities where gangs and organized crime fester; and they are the Guatemalans most familiar with the United States.

While it’s true that some migrants will head back north, many have no interest. One man I know, whose remittances were used to set up a T-shirt factory that employs his 10 children in his village, is heading home for good. Older returnees, especially those who have squirreled away enough money to survive, no longer feel pulled toward the United States.

Categorizing all deportees as criminals is equally misleading. Whereas a minority are felons, many more committed misdemeanors, and the majority are guilty only of crossing the border illegally and working without a permit.

Indeed, many migrants represent an untapped resource. Most left their countries as unskilled peasants, yet through resourcefulness and hard work in the United States they acquired a diverse set of professional skills and rose through the ranks.

During my visit, I encountered bricklayers and carpenters who undertook sophisticated home renovation projects, professional landscapers who worked on golf courses, a leather craftsman who oversaw a briefcase-making business and a young sushi chef who spoke fluent English and even rudimentary Japanese. They are eager to put their skills to work in Guatemala, either by opening their own businesses or by finding a private-sector partner.

For starters, the government should provide credit and, for those in the construction and tourism industries, ease cumbersome certification requirements so that they can ply their trade immediately. It could also develop a returnee-specific “linked in” program, where returning migrants would advertise their skills, connected to an effort to match them with businesses committed to diversifying and modernizing the Guatemalan economy.

Inasmuch as the migrants could help stabilize the Central American region, the United States could also benefit from the skills of deportees. The Alliance for Prosperity, which the American government has provided funds for, aims to curb migration by alleviating poverty, lawlessness and violence. Among other things, it fosters international, public and private investments in education, health care and vocational training — goals that skilled returning migrants can help achieve.”

Our short-sighted policies, unwillingness to invest wisely in the futures of foreign countries (beyond military and law enforcement aid), and apparent inability to look for different approaches (beyond just arrest, detain, and deport, arrest, detain, and deport) virtually guarantees a continuation of the cycle of illegal entries, reentries, and expensive, resource intensive immigration enforcement. Walls, fences, more detention centers, more DHS agents, and, yes, even more U.S. Immigration Judges are not going to solve this problem.

THE NEW YORKER: Bureaucratic Delays Impede Due Process In U.S. Immigration Court!

“In April, Attorney General Jeff Sessions travelled to Nogales, Arizona, to make an announcement. “This is the Trump era,” he said. “The lawlessness, the abdication of the duty to enforce our immigrations laws, and the catch-and-release practices of old are over.” While his tone was harsh, and many of the proposals he outlined were hostile to immigrants, he detailed one idea that even some of his critics support: the hiring of more immigration judges.

U.S. immigration courts are facing a backlog of over half a million cases—and each one, on average, takes almost two years to close. These delays mean that everyone from asylum seekers to green-card holders faces extended stays in detention while awaiting rulings. Speaking about the problem, one immigration judge recently told the Times, “The courts as a whole lose credibility.”

Much of the backlog can be traced back to the Obama Administration, when spending on immigration enforcement went up, while Congress dramatically limited funds for hiring more judges. The number of pending cases grew from a hundred and sixty-seven thousand, in 2008, to five hundred and sixty thousand, in 2017, according to the Transactional Records Access Clearinghouse. The broader trend, though, goes back farther. Since the creation of the Department of Homeland Security, in 2002, the increase in resources allocated for border security and immigration policing has always significantly outpaced funding for the courts. (Immigration courts are part of the Department of Justice.) As more and more people have been arrested, detained, and ordered deported, the courts have remained understaffed and underfunded. “We’ve always been an afterthought,” Dana Leigh Marks, the president of the National Association of Immigration Judges, told me.

Roughly three hundred judges nationwide are responsible for the entire immigration caseload, and hiring is slow—filling a vacancy typically tak

es about two years, according to the Government Accountability Office. In Nogales, Sessions said that he would try to streamline the hiring process. But until that happens the Administration has been relocating judges to areas where they’re deemed most necessary. “We have already surged twenty-five immigration judges to detention centers along the border,” Sessions said, as if talking about military troop levels.”

To state the obvious, a court should be run as an independent court system, not a bureaucratic agency within a highly politicized Executive Department like the DOJ. (If you ever wondered whether the DOJ was politicized, recent events should make it clear that it is.)

And, Jeff, these are judges, not troops; and the individuals are not an “invading army,” just mostly ordinary folks seeking refuge, due process, and fair treatment under our laws and the Constitution. Remember, it’s not an immigration crisis; it’s a crisis involving the steady degradation of due process within the U.S. Immigration Court system.

NYT SATIRE: Bret Stephens Says Only Mass Deportation (Of “So-Called ‘Real Americans'”) Can Make America Really Great!

“In the matter of immigration, mark this conservative columnist down as strongly pro-deportation. The United States has too many people who don’t work hard, don’t believe in God, don’t contribute much to society and don’t appreciate the greatness of the American system.

They need to return whence they came.

I speak of Americans whose families have been in this country for a few generations. Complacent, entitled and often shockingly ignorant on basic points of American law and history, they are the stagnant pool in which our national prospects risk drowning.

On point after point, America’s nonimmigrants are failing our country. Crime? A study by the Cato Institute notes that nonimmigrants are incarcerated at nearly twice the rate of illegal immigrants, and at more than three times the rate of legal ones.

Educational achievement? Just 17 percent of the finalists in the 2016 Intel Science Talent Search — often called the “Junior Nobel Prize” — were the children of United States-born parents. At the Rochester Institute of Technology, just 9.5 percent of graduate students in electrical engineering were nonimmigrants.

Religious piety — especially of the Christian variety? More illegal immigrants identify as Christian (83 percent) than do Americans (70.6 percent), a fact right-wing immigration restrictionists might ponder as they bemoan declines in church attendance.

Business creation? Nonimmigrants start businesses at half the rate of immigrants, and accounted for fewer than half the companies started in Silicon Valley between 1995 and 2005. Overall, the share of nonimmigrant entrepreneurs fell by more than 10 percentage points between 1995 and 2008, according to a Harvard Business Review study.

Nor does the case against nonimmigrants end there. The rate of out-of-wedlock births for United States-born mothers exceeds the rate for foreign-born moms, 42 percent to 33 percent. The rate of delinquency and criminality among nonimmigrant teens considerably exceeds that of their immigrant peers. A recent report by the Sentencing Project also finds evidence that the fewer immigrants there are in a neighborhood, the likelier it is to be unsafe.

And then there’s the all-important issue of demographics. The race for the future is ultimately a race for people — healthy, working-age, fertile people — and our nonimmigrants fail us here, too. “The increase in the overall number of U.S. births, from 3.74 million in 1970 to 4.0 million in 2014, is due entirely to births to foreign-born mothers,” reports the Pew Research Center. Without these immigrant moms, the United States would be faced with the same demographic death spiral that now confronts Japan.

Bottom line: So-called real Americans are screwing up America. Maybe they should leave, so that we can replace them with new and better ones: newcomers who are more appreciative of what the United States has to offer, more ambitious for themselves and their children, and more willing to sacrifice for the future. In other words, just the kind of people we used to be — when “we” had just come off the boat.”

Beyond the inhumanity of toying with people’s lives this way, there’s also the shortsightedness of it. We do not usually find happiness by driving away those who would love us. Businesses do not often prosper by firing their better employees and discouraging job applications. So how does America become great again by berating and evicting its most energetic, enterprising, law-abiding, job-creating, idea-generating, self-multiplying and God-fearing people?

Because I’m the child of immigrants and grew up abroad, I have always thought of the United States as a country that belongs first to its newcomers — the people who strain hardest to become a part of it because they realize that it’s precious; and who do the most to remake it so that our ideas, and our appeal, may stay fresh.

That used to be a cliché, but in the Age of Trump it needs to be explained all over again. We’re a country of immigrants — by and for them, too. Americans who don’t get it should get out.”

“The increasing MS-13 violence has become a flash point in a national debate over immigration. President Trump and Attorney General Jeff Sessions have vowed to eradicate the gang, while immigrant advocates say the young people are being scapegoated to further an anti-immigrant agenda.

Danny’s case illustrates just how difficult the balance between compassion and safety can be. Was he a child who needed help? Or a gang member who shouldn’t have been here?

“Do you close the doors to all law-abiding folks who just want to be here and make a better life . . . and in the process keep out the handful who are going to wreak havoc on our community?” asked one federal prosecutor, who is not permitted to speak publicly and has handled numerous MS-13 cases. “Or do you open the doors and you let in good folks and some bad along with the good?”

Not So Fast, My Friends! — Border Intrusions Increase In May N/W/S Administration’s (Perhaps Premature) “Victory Dance!”

Stephen Dinan reports in the Washington Times:

“Illegal immigration across the southwest border appears to have jumped 27 percent in May, according to numbers released this week by Homeland Security, breaking a three-month streak of declines under President Trump and suggesting that the slump in migrants has bottomed out.

The Border Patrol nabbed 14,535 illegal immigrants in the southwest last month, up from just 11,129 in April. Analysts said that the number of people caught is a rough measure of the overall flow of people trying to sneak in.

The number of illegal immigrants showing up at ports of entry without authorization also ticked up, from 4,649 to 5,432.

U.S. Customs and Border Protection, the agency that oversees the Border Patrol and the ports of entry, acknowledged the increase in crossings, but attributed it to “a seasonal uptick.”

CBP said it “expects the uptick to continue” through the summer months.

The numbers suggest that while Mr. Trump appears to have changed the calculations of many border crossers, there’s still a segment of the population — particularly among Central Americans — determined to make the journey.

Agents usually record an uptick from April to May, but the jump this year is the largest on record.

 

Still, it’s by far the lowest May total on record. For example, May 2016 saw more than 40,000 illegal immigrants caught at the border.

Illegal immigration from Cuba and Haiti had been a problem last year, but had dipped under the final months of President Obama and again under Mr. Trump.

Now, Cubans appear to be surging again, while Haitians remain low.

Two other special categories of migrants — unaccompanied minors and families traveling together — also saw increases last month, rising from a combined 2,117 nabbed by the Border Patrol in April to 3,070 in May.”

We should also keep in mind that according to other recent reports, the largest flow of asylum applicants is now from Venezuela. Most of them are middle class and business-oriented individuals who already have visas enabling them to enter the U.S. legally. Once admitted, they can apply for asylum at any time during the first year following entry. Such individuals would not show up in any of the border or port of entry statistics.

  1. I. INTRODUCTION

 

 

Good evening. Thank you so much for inviting me to speak at this wonderful event. I’m honored to be here. The PIRC is a terrific organization that provides critical legal services to the most vulnerable during one of the most difficult periods in our recent history.

 

The York area has a well-established tradition of humanitarian generosity and support for the most needy that was highlighted during the Golden Venture episode and described in the book Snakehead. I learned today that PIRC was formed to respond to the needs of the Golden Venture detainees. The U.S. Immigration Court in York has one of the highest representation rates for detained individuals in the nation, over 50%.

 

By contrast, the Arlington Immigration Court, where I used to sit, and the Baltimore Immigration Court had detained representation rates of around 20% and 10% respectively. And, it’s even worse in other parts of the country.

 

Back in February, I had the pleasure of working with your amazing Executive Director, Mary Studzinski, at a group session directed at improving training for non-attorney representatives authorized to practice before the U.S. Immigration Courts and the Board of Immigration Appeals. We bonded instantly. That’s “human bonding” rather than “immigration bonding,” of course. Mary’s kinetic energy, practical knowledge, tremendous dedication, and incisive contributions to the group were simply stunning. I must admit, I thought she was the Managing Attorney of the organization until she explained her role to me. You are so fortunate to have of someone who cares so deeply about your mission leading you. Mary is just what America needs right now.

 

Speaking of what America needs, I of course want to be the first to congratulate the five extraordinary individuals and two groups we are honoring tonight with well-deserved “Light of Liberty” Awards. Your energy, knowledge, and willingness to give of yourselves to others is making a much needed positive difference in this community and in our world. Each of you is indeed changing the course of history for the better. And, I’m pleased to announce that I have bestowed on each of tonight’s award recipients the rank of “General” in the “New Due Process Army. “

 

And, of course, thanks again to our great sponsors, mentioned by Mary, for supporting PIRCV and tonight’s awards.

 

II. THE DUE PROCESS CRISIS IN IMMIGRATON COURT

 

As most of you in this room probably recognize, there is no “immigration crisis” in America today. What we have is a series of potentially solvable problems involving immigration that have been allowed to grow and fester by politicians and political officials over many years.

 

But, there is a real crisis involving immigration: the attack on due process in our U.S. Immigration Courts that have brought them to the brink of collapse. I’m going to tell you seven things impeding the delivery of due process in Immigration Court that should be of grave concern to you and to all other Americans who care about our justice system and our value of fundamental fairness.

 

First, political officials in the last three Administrations have hijacked the noble mission of the U.S. Immigration Courts. That vision, which I helped develop in the late 1990s, is to “be the world’s best administrative tribunals guaranteeing fairness and due process for all.”

 

Instead, the Department of Justice’s ever-changing priorities, aimless docket reshuffling, and morbid fascination with increased immigration detention as a means of deterrence have turned the Immigration Court system back into a tool of DHS enforcement. Obviously, it is past time for an independent U.S. Immigration Court to be established outside the Executive Branch.

 

Second, there simply are not enough pro bono and low bono attorneys and authorized representatives available to assist all the individuals who need representation in Immigration Court. As I mentioned, this problem is particularly acute in detention courts. We know that representation makes a huge difference. Represented individuals succeed at rates four to five times greater than unrepresented individuals.

 

There have been a number of studies documenting the substandard conditions in immigration detention, particularly those run by private contractors, which in some cases prove deadly or debilitating. Some of these studies have recommended that immigration detention be sharply reduced and that so-called “family detention” be discontinued immediately.

 

A rational response might have been to develop creative alternatives to detention, and to work closely with and support efforts to insure access to legal representation for all individuals in Removal Proceedings. Instead, the response of the current Administration has been to “double down” on detention, by promising to detain all undocumented arrivals and to create a new “American Gulag” of detention centers, most privately run, along our southern border, where access to attorneys and self-help resources is limited to non-existent.

 

Third, the Immigration Courts have an overwhelming caseload. Largely as a result of “aimless docket reshuffling” by Administrations of both parties, the courts’ backlog has now reached an astounding 600,000 cases, with no end in sight. Since 2009, the number of cases pending before the Immigration Courts has tripled, while court resources have languished.

 

The Administration’s detention priorities and essentially random DHS enforcement program are like running express trains at full throttle into an existing train wreck without any discernable plan for clearing the track!” You can read about it in my article in the latest edition of The Federal Lawyer.

 

Fourth, the immigration system relies far too much on detention. The theory is that detention, particularly under poor conditions with no access to lawyers, family, or friends, will “grind down individuals” so that they abandon their claims and take final orders or depart voluntarily. As they return to their countries and relate their unhappy experiences with the U.S. justice system, that supposedly will “deter” other individuals from coming.

 

Although there has been a downturn in border apprehensions since the Administration took office, there is little empirical evidence that such deterrence strategies will be effective in stopping undocumented migration in the long run. In any event, use of detention, as a primary deterrent for non-criminals who are asserting their statutory right to a hearing and their constitutional right to due process is highly inappropriate. Immigration detention is also expensive, and questions have been raised about the procedures used for awarding some of the contracts.

 

Fifth, we need an appellate court, the Board of Immigration Appeals, that functions like a real court not a high-volume service center. Over the past decade and one-half, the Board has taken an overly restrictive view of asylum law that fails to fulfill the generous requirements of the Supreme Court’s landmark decision in Cardoza-Fonseca and the Board’s own precedent in Matter of Mogharrabi. The Board has also failed to take a strong stand for respondents’ due process rights in Immigration Court.

 

Largely as a result of the Board’s failure to assert positive leadership, there is a tremendous discrepancy in asylum grant rates – so-called refugee roulette.” Overall grant rates have inexplicably been falling. Some courts such as Atlanta, Charlotte, and some other major non-detained courts have ludicrously low asylum grant rates, thereby suggesting a system skewed, perhaps intentionally, against asylum seekers. Perhaps not coincidentally, the Board has become totally “government-dominated” with no member appointed from the private sector this century.

 

Sixth, the DOJ selection process for Immigration Judges and BIA Members has become both incredibly ponderous and totally one-sided. According to a recent GAO study, it takes on the average nearly two years to fill an Immigration Judge position. No wonder there are scores of vacancies and an unmanageable backlog!

 

And, it’s not that the results of this glacial process produce a representative immigration judiciary. During the Obama Administration, approximately 88% of the Immigration Judge appointments came directly from government backgrounds. In other words, private sector expertise has been almost totally excluded from the 21st Century immigration judiciary.

 

Seventh, and finally, the Immigration Courts need e-filing NOW! Without it, the courts are condemned to “files in the aisles,” misplaced filings, lost exhibits, and exorbitant courier charges. Also, because of the absence of e-filing, the public receives a level of service disturbingly below that of any other major court system. That gives the Immigration Courts an “amateur night” aura totally inconsistent with the dignity of the process, the critical importance of the mission, and the expertise, hard work, and dedication of the judges and court staff who make up our court.

 

III. ACTION PLAN

 

Keep these thoughts in mind. Sadly, based on actions to date, I have little hope that Attorney General Sessions will support due process reforms or an independent U.S. Immigration Court, although it would be in his best interests as well as those of our country if he did. However, eventually our opportunity will come. When it does, those of us who believe in the primary importance of constitutional due process must be ready with concrete reforms.

 

So, do we abandon all hope? No, of course not!   Because there are hundreds of newer lawyers out there who are former Arlington JLCs, interns, my former students, and those who have practiced before the Arlington Immigration Court.

           

They form what I call the “New Due Process Army!” And, while my time on the battlefield is winding down, they are just beginning the fight! They will keep at it for years, decades, or generations — whatever it takes to force the U.S. immigration judicial system to live up to its promise of “guaranteeing fairness and due process for all!”

           

What can you do to get involved now? The overriding due process need is for competent representation of individuals claiming asylum and/or facing removal from the United States. Currently, there are not nearly enough pro bono lawyers to insure that everyone in Immigration Court gets represented.

          

And the situation is getting worse. With the Administration’s expansion of so-called “expedited removal,” lawyers are needed at earlier points in the process to insure that those with defenses or plausible claims for relief even get into the Immigration Court process, rather than being summarily removed with little, if any, recourse.

 

Additionally, given the pressure that the Administration is likely to exert through the Department of Justice to “move” cases quickly through the Immigration Court system with little regard for due process and fundamental fairness, resort to the Article III Courts to require fair proceedings and an unbiased application of the laws becomes even more essential. Litigation in the U.S. District and Appellate Courts has turned out to be effective in forcing systemic change. However, virtually no unrepresented individual is going to be capable of getting to the Court of Appeals, let alone prevailing on a claim.

 

Obviously, the PIRC is a fantastic way to contribute to assertively protecting the due process rights of migrants. Internships and JLC positions at the Immigration Courts are also ways for law students and recent law grads to contribute to due process while learning.

 

As mentioned earlier, Mary and I have been working with groups looking for ways to expand the “accredited representative” program, which allows properly trained and certified individuals who are not lawyers to handle cases before the DHS and the Immigration Courts while working for certain nonprofit community organizations, on either a staff or volunteer basis. The “accredited representative” program is also an outstanding opportunity for retired individuals, like professors, teachers, and others who are not lawyers but who can qualify to provide pro bono representation in Immigration Court to needy migrants thorough properly recognized religious and community organizations.

 

Even if you are a lawyer not practicing immigration law, there are many outstanding opportunities to contribute by taking pro bono cases. Indeed, in my experience in Arlington, “big law” firms were some of the major contributors to highly effective pro bono representation. It was also great “hands on” experience for those seeking to hone their litigation skills.

           

Those of you with language and teaching skills can help out in English Language Learning programs for migrants. I have observed first hand that the better that individuals understand the language and culture of the US, the more successful they are in navigating our Immigration Court system and both assisting, and when necessary, challenging their representatives to perform at the highest levels. In other words, they are in a better position to be “informed consumers” of legal services.

           

Another critical area for focus is funding of nonprofit community-based organizations, like PIRC, and religious groups that assist migrants for little or no charge. Never has the need for such services been greater.

 

Many of these organizations receive at least some government funding for outreach efforts. We have already seen how the President has directed the DHS to “defund” outreach efforts and use the money instead for a program to assist victims of crimes committed by undocumented individuals.

 

Undoubtedly, with the huge emphases on military expansion and immigration enforcement, to the exclusion of other important programs, virtually all forms of funding for outreach efforts to migrants are likely to disappear in the very near future. Those who care about helping others will have to make up the deficit. So, at giving time, remember your community nonprofit organizations that are assisting foreign nationals.

 

Finally, as an informed voter and participant in our political process, you can advance the cause of Immigration Court reform and due process. For the last 16 years politicians of both parties have largely stood by and watched the unfolding due process disaster in the U.S. Immigration Courts without doing anything about it, and in some cases actually making it worse.

 

The notion that Immigration Court reform must be part of so-called “comprehensive immigration reform” is simply wrong. The Immigration Courts can and must be fixed sooner rather than later, regardless of what happens with overall immigration reform. It’s time to let your Senators and Representatives know that we need due process reforms in the Immigration Courts as one of our highest national priorities.

 

Folks, the U.S Immigration Court system is on the verge of collapse. And, there is every reason to believe that the misguided “enforce and detain to the max” policies being pursued by this Administration will drive the Immigration Courts over the edge. When that happens, a large chunk of the entire American justice system and the due process guarantees that make American great and different from most of the rest of the world will go down with it.

IV. CONCLUSION

 

In conclusion, I have shared with you the U.S. Immigration Court’s noble due process vision and the ways it currently is being undermined and disregarded. I have also shared with you some of my ideas for effective court reforms that would achieve the due process vision and how you can become involved in improving the process. Now is the time to take a stand for fundamental fairness! Join the New Due Process Army! Due process forever!
