“Attorney General Jeff Sessions did not reveal meetings with Russian officials when he applied for his security clearance to serve as the nation’s highest-ranking law enforcement official.

Sessions came under fire earlier this year for not disclosing to the Senate Judiciary Committee during his confirmation hearing that, as the senator from Alabama, he met twice with Russian Ambassador Sergey Kislyak during the presidential election when he was also serving as an adviser to the president. In March, Sessions recused himself from investigations related to the 2016 presidential campaign after The Washington Post reported the two meetings.

That same information was omitted from Sessions’s security clearance form, which is known as an SF-86, as first reported Wednesday night by CNN.

“As a United States senator, the attorney general met hundreds — if not thousands — of foreign dignitaries and their staff,” said Justice Department spokesman Ian Prior. “In filling out the SF-86 form, the Attorney General’s staff consulted with those familiar with the process, as well as the FBI investigator handling the background check, and was instructed not to list meetings with foreign dignitaries and their staff connected with his Senate activities.”

“The law enforcement investigation into possible coordination between Russia and the Trump campaign has identified a current White House official as a significant person of interest, showing that the probe is reaching into the highest levels of government, according to people familiar with the matter.

The senior White House adviser under scrutiny by investigators is someone close to the president, according to these people, who would not further identify the official.

The revelation comes as the investigation appears to be entering a more overtly active phase, with investigators shifting from work that has remained largely hidden from the public to conducting interviews and using a grand jury to issue subpoenas. The intensity of the probe is expected to accelerate in the coming weeks, the people said.

The sources emphasized that investigators remain keenly interested in people who previously wielded influence in the Trump campaign and administration but are no longer part of it, including former national security adviser Michael Flynn and former campaign chairman Paul Manafort.

Flynn resigned in February after disclosures that he had lied to administration officials about his contacts with Russian Ambassador Sergey Kislyak. Current administration officials who have acknowledged contacts with Russian officials include President Trump’s son-in-law, Jared Kushner, as well as Attorney General Jeff Sessions and Secretary of State Rex Tikkerson.”

“Trump’s alleged screw-up with the Russians reveals yet again what we have learned many times in the last four months: The successful operation of our government assumes a minimally competent Chief Executive that we now lack. Everyone else in the executive branch can be disciplined or fired or worse when they screw up by, say, revealing classified information or lying about some important public policy issue. But the President cannot be fired; we are stuck with him for 3 1/2 more years unless he is impeached, which remains a long-shot.

The president is a vainglorious clown trying to act like a world-historical figure and revealing himself to be a bad salesman. His staff lacks both the competence and the ability to rein him in. And now he has gone from puzzling allied nations to alienating them.

BREAKING: Bannon Ousted From NSC In Reorg Pushed By Gen. McMaster!

“WASHINGTON — President Trump reshuffled his national security organization on Wednesday, removing his chief strategist, Stephen K. Bannon, from a top policy-making committee and restoring senior military and intelligence officials who had been downgraded when he first came into office.

The shift was orchestrated by Lt. Gen. H.R. McMaster, who was tapped as Mr. Trump’s national security adviser after the resignation of Michael T. Flynn, who stepped down in February after being caught misleading Vice President Mike Pence and other White House officials about his contacts with Russia’s ambassador.

General McMaster inherited an organizational scheme for the National Security Council that stirred protests because of Mr. Bannon’s role. The original setup made Mr. Bannon, the former chairman of Breitbart News, a member of the principals committee that typically includes cabinet-level officials like the vice president, secretary of state and defense secretary. The original order also made the chairman of the Joint Chiefs of Staff and the director of national intelligence only occasional participants as issues demanded.

Critics said Mr. Bannon’s presence in a national security policy-making structure risked politicizing foreign policy.
A new order issued by Mr. Trump, dated Tuesday and made public on Wednesday, removes Mr. Bannon from the principals committee, restores the chairman of the Joint Chiefs and intelligence director and also adds the energy secretary, C.I.A. director and United Nations ambassador.

A senior White House official presented the move as a logical evolution, not a setback for Mr. Bannon. He had originally been put on the principals committee to keep an eye on Mr. Flynn and to “de-operationalize” the N.S.C. after the Obama administration, this official said on condition of anonymity to discuss internal dynamics. This official said that process had been completed.

But the reorganization seemed a clear victory for General McMaster as he struggles to assert control over national security. In addition to the changing membership of the principals committee, the new order also puts the Homeland Security Council under General McMaster rather than making it a separate entity, as Mr. Trump’s original order had done.”

Yeah sure, this was a “logical evolution.” Just like having Bannon on the NSC and the “chairman of the Joint Chiefs and intelligence director and also adds the energy secretary, C.I.A. director and United Nations ambassador” originally not on the NSC made any sense.  Plus, the idea that “logic” drives decisions emanating from the Trump White House is, in and of itself, “not credible.”

Still, America and the world can sleep better tonight knowing that Steve Bannon is no longer on the NSC.

“Trump’s Authoritarian Vision”

“In a way, Trump represents a culmination of trends that have been years in the making.

Conservative talk radio hosts have long blasted federal judges as “activists” and regulators as meddlers in the economy, while advancing the myth of rampant election fraud. And gridlock in Washington has led previous presidents to try new ways to circumvent the checks on their power — witness President George W. Bush’s use of signing statements to invalidate parts of bills Congress passed, and President Obama’s aggressive use of executive orders when lawmakers balked at his proposals.

What’s uniquely threatening about Trump’s approach, though, is how many fronts he’s opened in this struggle for power and the vehemence with which he seeks to undermine the institutions that don’t go along.

It’s one thing to complain about a judicial decision or to argue for less regulation, but to the extent that Trump weakens public trust in essential institutions like the courts and the media, he undermines faith in democracy and in the system and processes that make it work.
Trump betrays no sense for the president’s place among the myriad of institutions in the continuum of governance. He seems willing to violate long-established political norms without a second thought, and he cavalierly rejects the civility and deference that allow the system to run smoothly. He sees himself as not merely a force for change, but as a wrecking ball.

Will Congress act as a check on Trump’s worst impulses as he moves forward? One test is the House and Senate intelligence committees’ investigation into Russia’s meddling in the presidential election; lawmakers need to muster the courage to follow the trail wherever it leads. Can the courts stand up to Trump? Already, several federal judges have issued rulings against the president’s travel ban. And although Trump has railed against the decisions, he has obeyed them.

None of these institutions are eager to cede authority to the White House and they won’t do so without a fight. It would be unrealistic to suggest that America’s most basic democratic institutions are in imminent jeopardy.

But we should not view them as invulnerable either. Remember that Trump’s verbal assaults are directed at the public, and are designed to chip away at people’s confidence in these institutions and deprive them of their validity. When a dispute arises, whose actions are you going to consider legitimate? Whom are you going to trust? That’s why the public has to be wary of Trump’s attacks on the courts, the “deep state,” the “swamp.” We can’t afford to be talked into losing our faith in the forces that protect us from an imperial presidency.

“This would be a good time to do something about the red menace of Vladimir Putin’s Russia. Instead, we’re talking about the Red Raiders of Texas Tech.

FBI Director James B. Comey, testifying Monday about his agency’s investigation into Russia’s attempt to tilt the 2016 election to Donald Trump, explained why it was “a fairly easy judgment” that Trump was Putin’s favored candidate: “Putin hated Secretary Clinton so much that the flip side of that coin was he had a clear preference for the person running against the person he hated so much.”

But Rep. K. Michael Conaway (R-Tex.), a senior member of the House Intelligence Committee, was having none of it. “Yeah, that logic might work on Saturday afternoon when my wife’s Red Raiders are playing the Texas Longhorns.” Conaway doubted such reasoning “all the rest of the time.”
So, Putin wanted Hillary Clinton to lose but didn’t want Trump? Maybe he was for Gary Johnson?

Comey tried to be patient. “Whoever the Red Raiders are playing, you want the Red Raiders to win,” he explained. “By definition, you want their opponent to lose.”
Conaway was fourth and long. He scrambled to formulate another question, then punted: “Well, let me finish up then.”

Comey’s testimony confirmed what was widely suspected: The FBI is investigating whether the president’s campaign colluded with a powerful American adversary in an attempt to swing the election. But instead of being shaken from complacency and uniting to make sure this never happens again, the Republican majority on the House Intelligence Committee mounted a reflexive defense of Trump.

The partisan response made it plain that there will be no serious congressional investigation of the Russia election outrage, nor any major repercussions for Russia. We were attacked by Russia — about this there is no doubt — and we’re too paralyzed by politics to respond.

Trump, whose claim that President Barack Obama wiretapped Trump Tower was dismissed by Comey on Monday, continued to fire his weapons of mass distraction Monday morning, tweeting about ties between Clinton and Russia and claiming “the real story” is who leaked classified information.
This is to be expected from Trump. The disheartening part was that most Republicans on the panel, which is supposed to investigate Trump, instead slavishly echoed his excuses.”

The transformation of the GOP is an interesting experience for baby boomers like me who grew up in the 1950s when the GOP saw a “Red under every bed.”

But, times have changed. Although Putin is a KGB vet and seems to remain wedded to their brutal methods of eliminating opposition, suppressing dissent, and “messing with the heads of the West,” some folks seem to be too busy fretting about the imagined threat to our national security from Syrian refugee children to want any serious inquiry or accounting for what Putin and the Russians are up to in the U.S.

“The ninth week of Donald Trump’s presidency began with the F.B.I. director calling him a liar.

The director, the very complicated James Comey, didn’t use the L-word in his congressional testimony Monday. Comey serves at the pleasure of the president, after all. But his meaning was clear as could be. Trump has repeatedly accused Barack Obama of wiretapping his phones, and Comey explained there is “no information that supports” the claim.

I’ve previously argued that not every untruth deserves to be branded with the L-word, because it implies intent and somebody can state an untruth without doing so knowingly. George W. Bush didn’t lie when he said Iraq had weapons of mass destruction, and Obama didn’t lie when he said people who liked their current health insurance could keep it. They made careless statements that proved false (and they deserved much of the criticism they got).

But the current president of the United States lies. He lies in ways that no American politician ever has before. He has lied about — among many other things — Obama’s birthplace, John F. Kennedy’s assassination, Sept. 11, the Iraq War, ISIS, NATO, military veterans, Mexican immigrants, Muslim immigrants, anti-Semitic attacks, the unemployment rate, the murder rate, the Electoral College, voter fraud and his groping of women.

He tells so many untruths that it’s time to leave behind the textual parsing over which are unwitting and which are deliberate — as well as the condescending notion that most of Trump’s supporters enjoy his lies.

Trump sets out to deceive people. As he has put it, “I play to people’s fantasies.”

Caveat emptor: When Donald Trump says something happened, it should not change anyone’s estimation of whether the event actually happened. Maybe it did, maybe it didn’t. His claim doesn’t change the odds.

Which brings us to Russia.”

“At least two sets of internal data that have been available to the Trump administration — but that have never been publicized — appear to undercut the government’s argument for a travel ban that it had hoped would take effect Thursday, according to several officials familiar with the documents.

One internal report, titled “Most Foreign-Born US-Based Violent Extremists Radicalized After Entering Homeland,” analyzed roughly 90 cases involving suspected or confirmed foreign-born terrorists, finding that most of them probably embraced extremist ideology after they arrived in the United States, not before.

Another report, drawn on classified FBI data, has been used by the Trump administration to bolster its claims that refugees pose a risk of terrorism. But the figures that are the basis for that report undermine a key premise of the travel ban, with most of the suspects cited in the report coming from countries unaffected by President Trump’s executive order, according to officials familiar with the report.”

BREAKING: Sessions In Hot Water Over Failure To Disclose Contacts With Russian Ambassador — Administration Tries To Deflect Controversy!

“Attorney General Jeff Sessions met twice last year with the top Russian diplomat in Washington whose interactions with former Trump national security adviser Mike Flynn led to Flynn’s firing, according to the Justice Department.

Sessions did not mention either meeting during his confirmation hearings when he said he knew of no contacts between Trump surrogates and Russians. A Justice official said Sessions didn’t mislead senators during his confirmation.
The Washington Post first reported on Sessions’ meetings with the official. Sergey Kislyak, the Russian ambassador, is considered by US intelligence to be one of Russia’s top spies and spy-recruiters in Washington, according to current and former senior US government officials.

Sessions met with Kislyak twice, in July on the sidelines of the Republican convention, and in September in his office when Sessions was a member of the Senate Armed Services committee. Sessions was an early Trump backer and regular surrogate for him as a candidate.
Attorney General Sessions responded swiftly Wednesday, strongly stating that he never discussed campaign-related issues with anyone from Russia.
“I never met with any Russian officials to discuss issues of the campaign,” he said in a statement. “I have no idea what this allegation is about. It is false.”

Key Democratic lawmakers immediately called for Sessions’ resignation after the news broke.
House Minority Leader Nancy Pelosi characterized Sessions’ comments in his confirmation “apparent perjury,” and said the attorney general should resign.
Kislyak’s potential proximity to Russian spying is one reason why Flynn’s interactions with him, and Flynn’s failure to disclose what he discussed with Kislyak, raised concerns among intelligence officials.
In his confirmation hearing to become attorney general, Sessions was asked about Russia and he responded at the time that he “did not have communications with the Russians.”

Sessions’ spokeswoman Sarah Isgur Flores said there was nothing “misleading about his answer” to Congress because the Alabama Republican “was asked during the hearing about communications between Russia and the Trump campaign — not about meetings he took as a senator and a member of the Armed Services Committee.”

Minnesota Democrat Sen. Al Franken, who asked Sessions about Russia at the confirmation hearing, said if the reports of Sessions’ contacts with Kislyak were true then Sessions’ response was “at best misleading.”
“It’s clearer than ever now that the attorney general cannot, in good faith, oversee an investigation at the Department of Justice and the FBI of the Trump-Russia connection, and he must recuse himself immediately,” Franken said.”

Although somewhat lost in the shuffle, in another controversial move, on Tuesday, Attorney General Sessions announced another major shift on civil rights policy. He said that the DOJ would drop pending investigations of unwarranted violence and violations of civil rights by local police. By giving local police a free hand, Sessions said that he expected that poor and minority  individuals living in high crime areas would be “safe, happier.” Sessions’s actions were met by skepticism from many civil rights advocates and African American community leaders.

UPDATE FROM CNN:  Top GOP Reps Chaffetz and McCarthy Call For Sessions To Recuse!

“The revelation prompted key Democrats to call for Sessions’ resignation and led two top Republicans to call on him to recuse himself from Trump-Russia inquiries.
Rep. Jason Chaffetz, the Republican chairman of the House Oversight Committee, said Sessions should “clarify his testimony,” while House Majority Leader Rep. Kevin McCarthy, in an interview with MSNBC, said Sessions should not participate in such investigations for “the trust of the American people.”

Meanwhile, Sen. Al Franken, D-Minnesota, told CNN’s “New Day” that Sessions’ testimony in January was “extremely misleading.”

“Senior policy adviser Stephen Miller said President Trump’s revised travel ban will have “mostly minor technical differences” from the iteration frozen by the courts, and Americans would see “the same basic policy outcome for the country.”

That is not what the Justice Department has promised. And legal analysts say it might not go far enough to allay the judiciary’s concerns.

A senior White House official said Wednesday that Trump will issue a revised executive order on immigration next week, as the administration is working to make sure the implementation goes smoothly. Trump had said previously that the order would come this week. Neither the president nor his top advisers have detailed exactly what the new order will entail. Miller’s comments on Fox News, while vague, seem to suggest the changes might not be substantive. And that could hurt the administration’s bid to lift the court-imposed suspension on the ban, analysts said.

“If you’re trying to moot out litigation, which is to say, ‘Look, this litigation is no longer necessary,’ it is very bad to say our intent here is to engage in the prohibited outcome,” said Leon Fresco, who worked in the office of immigration litigation in President Barack Obama’s Justice Department.”

“Opponents of President Trump’s travel ban have one big advantage — the Trump White House. If not for the confusion, lack of staffing (nary a deputy, let alone an undersecretary or assistant secretary, has been named in national security-related departments), organizational disarray, policy differences or all of the above, the administration might have put together on its first try a legally enforceable executive order. It might by now even have come up with a new executive order, thanks to a road map provided by the 9th Circuit. However, the rollout has been pushed back to next week.

Understand that if this is such a matter of urgent concern, the president would have had his advisers working around the clock on this (not transgender bathroom assignments, plans to deport non-criminal illegal immigrants or haggling with Mexican officials over a wall that Trump insists they pay for). In fact, since the point of the ban is to initiate a review of our vetting procedures, you’d think that the Homeland Security Department would already have come up with its proposed “extreme vetting” recommendations.

Meanwhile, the president and his staff continue to provide legal ammunition to opponents of the ban. On Tuesday, senior adviser Stephen Miller in a Fox News interview boldly declared, “Fundamentally, you’re still going to have the same basic policy outcome for the country, but you’re going to be responsive to a lot of very technical issues that were brought up by the court.” Just to remind the courts of the administration’s arrogance, Miller proclaimed that there was nothing wrong with the first order.

“By saying that the policy effects of the new travel ban will be essentially the same as those of the travel ban that so many federal judges found constitutionally suspect, Miller is effectively inviting federal courts to suspend the new one as well, given that the religiously discriminatory history of the ban can’t be ignored, much less erased, simply by purporting to start over again,” Supreme Court litigator and professor Larry Tribe tells me. “If, as I am told, the new ban is a more artfully disguised version of [an] anti-Muslim measure, without explicit preferences for religious minorities in Muslim-majority countries (i.e., for Christians) written into the very text of the ban, then some judges might be less inclined to issue a temporary restraining order, but most federal judges would be savvy enough to recognize that they are being treated to a masquerade.”

“Washington (CNN)President Donald Trump has assigned the Department of Homeland Security, working with the Justice Department, to help build the legal case for its temporary travel ban on individuals from seven countries, a senior White House official tells CNN.

Other Trump administration sources tell CNN that this is an assignment that has caused concern among some administration intelligence officials, who see the White House charge as the politicization of intelligence — the notion of a conclusion in search of evidence to support it after being blocked by the courts. Still others in the intelligence community disagree with the conclusion and are finding their work disparaged by their own department.
“DHS and DOJ are working on an intelligence report that will demonstrate that the security threat for these seven countries is substantial and that these seven countries have all been exporters of terrorism into the United States,” the senior White House official told CNN. “The situation has gotten more dangerous in recent years, and more broadly, the refugee program has been a major incubator for terrorism.”

The report was requested in light of the Ninth Circuit Court of Appeals’ conclusion that the Trump administration “has pointed to no evidence that any alien from any of the countries named in the order has perpetrated a terrorist attack in the United States.” The seven counties are Iraq, Iran, Libya, Somalia, Sudan, Syria and Yemen.
The senior White House official said the desire to bolster the legal and public case that these seven countries pose a threat is a work in progress and as of now, it’s not clear if DHS and DOJ will offer separate reports or a joint report.
One of the ways the White House hopes to make its case is by using a more expansive definition of terrorist activity than has been used by other government agencies in the past. The senior White House official said he expects the report about the threat from individuals the seven countries to include not just those terrorist attacks that have been carried out causing loss of innocent American life, but also those that have resulted in injuries, as well as investigations into and convictions for the crimes of a host of terrorism-related actions, including attempting to join or provide support for a terrorist organization.
The White House did not offer an on-the-record comment for this story despite numerous requests.

Asked about the report Thursday on “The Lead,” Rep. Dan Donovan, R-New York, emphasized that the intelligence community be nonpartisan.
“They should take data, take information, shouldn’t interpret it in a political way and provide the President the information he needs to make decisions to protect our country,” he said.
Also commenting on the report was Richard Haass, the president of the Council on Foreign Relations, who acknowledged that he hadn’t seen the specifics but “it looks wrong to me.”
“We ought to be doing the intel first, then set the policy and in large part based upon the intelligence,” Haass said. “If these reports are true, it’s yet another example where this administration is having real trouble ing a functional relationship with the intelligence community.”

I was never a “line litigator.” But, I was involved in defending and prosecuting thousands of cases during the “Legacy INS Phase” of my career. I also participated in thousands more cases as an appellate and trial judge during the last 21 years at EOIR.

One of my jobs in providing litigation assistance as the Deputy General Counsel of the INS was to make sure my “institutional clients” did not comment on pending cases. Such comments both unnecessarily antagonized the judges hearing the cases and, on occasion, when folks didn’t heed my instructions, completely “tanked” our positions by giving our opponents new arguments.

As a sitting judge, I can guarantee that one of the least successful approaches was for a lawyer to insult my intelligence or integrity and then turn around and ask me to help out his or her client. Sure, in the end, I had to separate the law from the lawyer and do the right thing. But, it certainly interfered with the effectiveness of the lawyer’s communication and made it more difficult for me to get to the substance of his or her client’s case.

And, one thing that certainly infuriated all judges, including me, was for a lawyer to represent one thing in court and then have his or her client do something else. It made me lose confidence in the lawyer’s reliability and integrity and his or her ability to control and speak for the client. I can remember “chewing out” several lawyers at Master Calendar for misrepresenting facts or law to me in their briefs or oral arguments.

It appears that the Trump Administration’s combination of arrogance, ignorance, and disrespect for the court system and the role of judges is undermining both their credibility and the credibility of the Department of Justice career lawyers whose job is to represent them over and over again before most of the same judges. Once a judge loses faith in the credibility of a lawyer and/or her or his client, “bad things will happen” and they do.
