This is the lie of every talking head that praises building a wall but adds, with all faux sincerity, that they have “no problem with legal immigrants.” Almost half of the people shuttled through assembly line deportation hearings actually fit within legal immigration protections, but the complexity of the system — not to mention language barriers — make them victims of the bureaucracy.

If that projection is correct, NYIFUP cases result in immigrant victories 48 percent of the time. As Oren Root, director of the Vera Institute’s Center for Immigration and Justice, puts it, that means that of every 12 immigrants who are winning at Varick Street right now, 11 would have been deported without a lawyer.

That finding challenges a widely held assumption about immigration court: that most immigrants who go through it don’t qualify for the types of protection that Congress has laid out for particularly compelling cases. The Vera finding implies that, in fact, many immigrants do deserve relief as Congress and the executive branch have established it — but that hundreds of thousands of them have been deported without getting the chance to pursue those claims.

New York’s program has inspired 12 more cities to adopt the program. It’s put up or shut up time for the Department of Justice — if they’re really committed to proving some undocumented migrant is in violation of the law, then stand up and make that case in court.

I think Patrice has hit the nail on the head. Sessions, Miller, Bannon and the White Nationalist crowd are biased bullies picking on the most vulnerable and disadvantaged. Like all bullies, they have absolutely no desire to compete fairly on a level playing field.

The Vera report confirms what many of us involved in the field have been saying for years: a significant portion of those going through Immigration Court, probably 50% or more are entitled to be in the US. Without lawyers, such individuals have little or no chance of making and succeeding on claims that would allow them to stay. Since at least one-third of individuals (and a much higher percentage of detained individuals) are unrepresented, we are unlawfully removing tens of thousands of individuals each year, in violation of due process. And nothing aggravates this unfairness more than unnecessary detention (in other words, the majority of immigration detention which involves individuals who are not criminals, security threats, or threats to abscond if they are represented and understand the system).

A competent and conscientious Attoyney General would work cooperatively with private bar groups, NGOs, and localities to solve the representation crisis and drastically reduce the use of expensive and inhumane immigration detention. But, Sessions is moving in exactly the opposite direction, in violation of constitutional principles of due process, practical efficiency, and basic human decency.

O CANADA: TRUMP POLICIES AID CANADIAN LOBSTERMEN AT THE EXPENSE OF MAINE! — CANADA BRACES FOR INFLUX OF “TPSers” FLEEING US!

“When Americans think about lobster, Maine often comes to mind. But Nova Scotia has emerged as a fierce competitor in exporting lobsters, particularly to Europe. Last year, American lobstermen sold only slightly more to Europe than their Canadian counterparts.
That balance could soon shift given the Canadian-European trade pact, which eliminated an 8 percent European tariff on live lobster when it went into effect in September. Tariffs on frozen and processed Canadian lobster will be phased out in the next three to five years as part of the agreement.
The elimination of European tariffs is “the single most challenging issue” for the American lobster industry, said Annie Tselikis, the executive director of the Maine Lobster Dealers’ Association, which represents companies that buy lobster from Maine fishermen. “This trade agreement does give Canada a huge leg up in the European marketplace,” she said.
Ms. Tselikis said the pact was encouraging American companies to invest in new facilities in Canada to qualify for the lower European tariff.
“If the argument is you’re not going to develop this trade policy because you’re worried about outsourcing jobs — well, here we are, potentially outsourcing jobs due to an absence of trade policy,” she said.”

Meanwhile, Alan Freeman reports in the Washington Post that the Trump Administration might be on the verge of  driving tens of thousands of American residents with useful job skills over our Northern Border:

“OTTAWA — In late October, starkly worded warning signs began appearing on the Canadian border with New York state and Vermont aimed at discouraging would-be asylum seekers fleeing the United States.

“Stop. It is illegal to cross the border here or any place other than a Port of Entry. You will be arrested and detained if you cross here.”

“Not everyone is eligible to make an asylum claim,” reads a second sign. “Claiming asylum is not a free ticket into Canada.”

As the Trump administration signals that it may soon remove the Temporary Protected Status designation from more than 300,000 Central Americans and Haitians, threatening them with deportation, Canadian officials are bracing for a new wave of asylum seekers flooding over the border.

Already this week, acting U.S. Homeland Security Secretary Elaine Duke announced she was lifting protected status for 2,500 Nicaraguans, effective January 2019. And while she extended the same protection for 57,000 Hondurans until July 2018, she warned that protection may end at that time.

The U.S. government decided to protect both groups from deportation following the devastation wrought by Hurricane Mitch in 1999, and the measures were repeatedly renewed until this year. Duke said the original conditions justifying that protection “no longer exist.” Canada and its immigrant-friendly policies may be seen as a viable alternative for those reluctant to return to their countries of origin.

Just last week, the government published a three-year plan aimed at accepting almost 1 million immigrants as permanent residents, with a clear bias toward economic migrants, who will make up 58 percent of the total. The balance will be shared between family and refugee classes.

 

Public reaction to the plan, which will see intake grow steadily from 300,000 in 2017 to 310,000 in 2018, 330,000 in 2019 and 340,000 in 2020, has been generally positive with many of the critics, including the government’s own council of economic advisers, saying Canada should be accepting even more immigrants.

Canada has an increasingly diverse population, with visible minorities making up 22.3 percent of the population in 2016, according to recently released census figures, compared with just 4.7 percent in 1981. By 2036, visible minorities are expected to make up 33 percent of the population.

“Canada is probably the best country in the world to be an immigrant because we give immigrants a chance to climb the ladder to success,” said Kareem El-Assal, senior research manager at the Conference Board of Canada, a think tank, where he specializes in immigration.

Assal said Canada’s immigration system works in part because the Canadian government helps newcomers integrate through language, skills and job training at a cost of almost a billion dollars a year. Furthermore, immigrants benefit from Canada’s universal health-care system and its good public education and reasonably priced universities.

Public opinion surveys continue to show that Canadians are pro-migration. A survey by the Environics Institute last spring showed that 72 percent of respondents agreed that “overall, migration has a positive impact on the economy.” Yet in the same survey, 54 percent said that “too many immigrants do not accept Canadian values.”

As for those border warning signs, Fortin, the union leader, says that asylum seekers are reading them and then crossing the border anyway.

“It doesn’t seem to have a very big dissuasive effect,” he said.”

Maine needs all the economic help it can get. And, I had lots of successful “TPSers” pass through my courtroom in Arlington. Good folks, industrious with useful job skills in the types of positions that we need but most Americans don’t want to do: child care, home health care, roofing, drywalling, cleaning, washing, making beds, waiting on tables, brewing coffee, making sandwiches, landscaping, pouring concrete, building things, meat processing, running convenience stores, etc. And, the vast majority had kids who were US citizens or in the DACA program. Our loss is likely to be Canada’s gain. The concept that there are lots of Native-born Americans out there (at a time of effectively full employment) waiting to take these jobs is a restrictionist fairy tale. But, if and when these folks leave, Americans who depend on them for essential services (like child care and Home improve,wants, for example, or restaurant and hotel owners) are going to find themselves out of luck.

So far, overall incompetence has saved us from the full adverse effects of Trump’s “Make America (Not So) Great” policies. But, if they ever do go into full effect, it will be bad for most Americans, including those gullible enough to have voted for Trump.

Could Trump actually believe that the ex-KGB operative is insulted by the accusation he pulled off a masterful plot, at very little cost, to tip the scales in an American presidential election and get the candidate of his choice? Certainly, Trump is not only gullible but also running scared as special counsel Robert S. Mueller III breathes down his neck.

“Despite the Trump administration’s repeated attempts to frame illegal immigration as a threat to public safety, the poll also found an overwhelming majority believe that people without legal residency help revitalize cities as opposed to increasing crime.

The survey results, poll analysts and policy experts said, reflect ongoing trends in California, where through the decades the public has tended to support immigrants in the country illegally, even when federal or state political leaders have stoked anti-immigrant sentiment to rally their bases.

“We have seen this in California forever,” said Jill Darling, the survey director for the Center for Economic and Social Research at USC. “People, including Republicans, have been more supportive of immigrants and reform, even to the point of supporting a path to citizenship, more so than Republican leadership.”

Most poll participants also expressed positive perceptions of people without legal residency in the country.

Nearly 63% of people surveyed said they believed immigrants without legal status strengthened the economy, as opposed to roughly 38% who said they took away jobs. Sixty-six percent said immigrants in the country illegally helped revitalize cities, and about 34% — including more than 72% of Republicans — believed they increased crime.

Policy experts said the poll results reflect the explosive growth of Latinos, Asians and other minority communities that tend to lean Democratic. California’s families are so diverse, they said, that nearly everyone knows someone who came to the country as an immigrant — legally or illegally.

It also reflects a shift away from the “us-versus-them” rhetoric that damaged the Republican brand in the 1990s, political consultants and immigration policy experts said. During that time, Gov. Pete Wilson was criticized for using footage of people running across the border to dramatize the problem of illegal immigration, and voters passed propositions to bar immigrants in the country illegally from public benefits, outlaw affirmative action programs and teach only English in schools.

That “no longer reflects our reality,” said Mindy Romero, director of the California Civic Engagement Project. “In a state like California, immigrants are us.”

Andrew Medina, state policy manager for Asian Americans Advancing Justice, said he wasn’t surprised by the results of the poll — or by the approval among California residents for the sanctuary state law. A study released in February by the Public Policy Institute of California found that a solid majority of Californians believe the state and local governments should make their own policies and take action to protect the rights of immigrants who are here illegally.

The final language of the sanctuary state law was the result of months of tough negotiations among Gov. Jerry Brown, Senate leader and bill author Kevin de León (D-Los Angeles), and law enforcement officials.

It will largely prohibit state and local law enforcement agencies from holding or sharing information about people with federal immigration agents unless those individuals have been convicted of one or more offenses from a list of 800 crimes outlined in a 2013 state law.

Federal immigration authorities still will be able to work with state corrections officials — a key concession Brown had demanded — and will be able to enter county jails to question immigrants. But the state attorney general’s office will be required to publish guidelines and training recommendations to limit immigration agents’ access to personal information.

“It is positive that these polls show that there is support for immigrant communities, and it is especially positive in this era,” Medina said.

Still, Romero advised caution.

“Discrimination against immigrants is very real and a danger,” she said, pointing to anti-immigrant rhetoric at the national level. “I think we can’t rest on a changing landscape in California and just assume that things will continue to be more receptive and open.”

Greetings. Since President Trump assumed office, the Secure Communities program has been promoted as essential to implement this administration’s agenda for ramped up deportations. The agency contends that “Secure Communities has proven to be one of ICE’s most important tools for identifying and removing criminal aliens as well as repeat immigration violators.”

However, analyses of the agency’s own internal records document that the use of detainers under this program is not living up to these claims. For example, according to the latest available ICE data only about 2.5 percent of so-called Secure Communities removals were connected to the use of detainers sent to local law enforcement agencies. When compared with ICE removals from all sources, this component made up an even smaller proportion – less than 1 percent of all ICE removals.

Furthermore, the number of convicted criminals that ICE claims to have deported through this program under the Trump administration is four times higher than what the evidence shows has actually happened.

The results of stepped up enforcement appear quite small so far. By July 2017 there were only 529 additional Secure Communities removals of individuals convicted of crimes as compared with removals under President Obama. For those convicted of serious crimes, the average monthly change was just 128 more individuals. And few of these appear to have involved the use of ICE detainers.

These statistics current through July 2017 were compiled from ICE internal records obtained by the Transactional Records Access Clearinghouse (TRAC) at Syracuse University in response to a series of Freedom of Information Act (FOIA) requests, following lawsuits that TRAC’s co-directors filed against the agency.

GONZO’S WORLD: CNN: GONZO TAKING HEAT FOR ATTEMPT TO “WHITEWASH” RUSSIA INVOLVEMENT DURING SENATE TESTIMONY!

“Washington (CNN)Attorney General Jeff Sessions is once again under scrutiny on Capitol Hill regarding his candor about Russia and the Trump campaign amid revelations that he rejected a suggestion to convene a meeting between Russian President Vladimir Putin and Donald Trump last year.

According to court filings unsealed this week, Trump campaign foreign policy adviser George Papadopoulos suggested at a March 2016 meeting that he could use his connections to set up a meeting between Putin and Trump with the then-GOP candidate’s national security team. An Instagram picture on Trump’s account shows Sessions attended the meeting at which Papadopoulos made the suggestion.
After Trump declined to rule out the idea, Sessions weighed in and rejected the proposed meeting, according to a person who attended.
But Sessions, who was a top surrogate for Trump during the campaign, did not disclose these discussions despite a persistent set of questions from Democrats and some Republicans about Russia during multiple hearings on Capitol Hill. The new information is renewing attention to how forthcoming Sessions has been with Congress.
There is interest from Democrats on both the Senate intelligence and judiciary committees for Sessions to formally clarify his remarks made before both committees given what’s now known about his interactions with Papadopoulos, a Senate aide told CNN. The source said the request for clarification could take several forms, such as having Sessions testify again or submitting a clarification in writing, but that has not yet been determined.

The Justice Department did not comment.
But a source familiar with Sessions’ thinking pointed out that others in the room recall that Sessions “shut down” talk of a Putin meeting and that Papadopoulos “didn’t have a lot of credibility.” The conversation moved on to other topics and Papadopoulos did not leave a “lasting impression” with Sessions, the source said.
The source added that Sessions “has no clear recollection” of Papadopoulos and any further interactions with him, even though two were seated next to each other at a second meeting of Trump’s foreign policy team at the Capitol Hill Club steps from the House.
“The attorney general has been entirely truthful and consistent on this matter,” the source said, referring to Sessions’ testimony before Congress where he rejected the notion of meetings and interactions with Russians during the campaign season.
At his Senate confirmation hearing in January, Sessions denied any contacts with Russian officials during the presidential campaign. He later acknowledged that he met then-Russian ambassador to the US Sergey Kislyak twice during the campaign. He also testified that he was “not aware” of anyone affiliated with the Trump campaign communicating with the Russians.
Sessions testified in June that he wasn’t aware of any conversations between “anyone connected to the Trump campaign” and Russians about “any type of interference with any campaign or election in the United States.”
He also testified that he does not remember meeting Kislyak during a VIP reception before an April 2016 campaign event at the Mayflower Hotel, though he acknowledged Kislyak was in the room. Also there were Trump and his son-in-law and White House senior adviser Jared Kushner. In testimony submitted to Capitol Hill investigators, Kushner said he “shook hands” and “exchanged brief pleasantries” with Kislyak.
Asked under oath at a Senate hearing last month if he believed Trump campaign surrogates had communications with Russians, Sessions replied, “I did not and I’m not aware of anyone else that did, and I don’t believe it happened.”
It is a crime to lie under oath to Congress. Sessions says that his answers were truthful because his meetings with Kislyak weren’t specifically about the campaign. At least two Democratic members of the Senate judiciary committee, Al Franken of Minnesota and Patrick Leahy of Vermont, have asked the FBI to investigate whether Sessions committed perjury during his confirmation hearings.
At the Senate judiciary hearing last month, Sen. Lindsey Graham, a South Carolina Republican, asked Sessions: “Did anybody in the campaign, did you ever overhear a conversation between you and anybody on the campaign who talked about meeting with the Russians?”
Sessions replied, “I have not seen anything that would indicate collusion with the Russians to impact the campaign.”
On Wednesday, Democrats said Sessions needs to clarify his comments.
“I was very troubled by Attorney General Sessions comments overall,” said Sen. Ron Wyden, a Democrat on the Senate intelligence committee.

As I’ve noted before, Sessions’s laughable account of how he “told the truth” during his Senate testimony doesn’t pass the “straight face test’ — it would be found “incredible” in almost any of the U.S. Immigration Courts he administers. He, Trump, and other campaign officials are obviously struggling to keep their various versions of the story straight.

Given the problems he’s already had, and the widespread interest in the Russia investigation, one might have thought than an “Attorney General of ordinary prudence” would check the records before once again making the “no contact” (“except the ones I didn’t mention previously that you already discovered”)  statement under oath. That might well have brought to light the photograph of him with George Papadopoulos which appears with the full article at the above link. And that might have “refreshed” his memory as to what transpired at the meeting. Or, he might have asked other attendees at the meeting for their recollection of whether Russia was discussed.

Gonzo has no trouble rattling off bogus positions and misleading statistics prepared for him by restrictionist organizations in his quest to smear and discredit migrants, immigrants, Latinos, lawyers, and others. But, when it comes to the very recent matter of Russia and  the Trump Campaign (which, after all, occurred within the last two years, not at some point in ancient history) his memory seems to fail him on a regular basis.

“Preparation begins now. Tend to the basics: Get registered, get others registered, and get educated on how to vote because voter suppression is running amok, especially in the South. Get information about the elections and the candidates. And don’t pass up any contest.

State legislature and gubernatorial races are just as important as elected jobs in Washington. And don’t buy the argument that your vote doesn’t count if you happen to live in a voting area where your party is outnumbered.

The December Alabama ballot doesn’t carry Trump’s name, but consider Senate GOP nominee Roy Moore as a stand-in for the president. That ought to be reason enough for the 26 percent of Alabama residents who are black to flock to the polls.

Likewise, a Trump proxy is running for Republican governor of Virginia this year under the name Ed Gillespie.

In the 2018 Senate races, Trump doubles can be found with Republicans Ted Cruz in Texas and Roger Wicker in Mississippi. The three, as opponents of progressive government policies, are closer than two pages in a book.

 

Want to speak back to Trump and tell him how you feel? Get out and vote in places such as Alabama, Virginia, California, Wisconsin, Texas and Mississippi, where Trump surrogates are on the ballot. Let the president know you are out there.

The midterm 2018 elections can be Judgment Day for Trump. And dress rehearsal for 2020.

Fume and fuss, talk back to the television, kick the can, call Trump names, vent to your heart’s content. All that changes nothing. Also probably ruins your health.

What can make a difference? The ballot. Vote, vote, vote.”

“The power to pardon is an executive prerogative of mercy, not of judicial record-keeping,” she wrote. “The Court found Defendant guilty of criminal contempt. The President issued the pardon. Defendant accepted. The pardon undoubtedly spared defendant from any punishment that might otherwise have been imposed. It did not, however, revise the historical facts of this case.”

“(CNN)In the end, Donald Trump finally pushed Sen. Bob Corker to the point of exasperation, frustration and exhaustion felt by vast numbers of Americans who despair of the President’s behavior. “It’s a shame the White House has become an adult day care center,” tweeted Corker, referring to his fellow Republican as if he needs constant minding. “Someone obviously missed their shift this morning.”

Corker was provoked by early Sunday morning statements from Trump. who said, via Twitter, “Senator Bob Corker ‘begged’ me to endorse him for re-election in Tennessee, I said ‘NO’ and he dropped out (said he could not win without my endorsement).” Trump also said Corker asked to become secretary of state but, “I said ‘NO THANKS.'” He also said Corker “didn’t have the guts” to seek re-election in 2018.
The capital letters suggest the tweets came straight from the President. He loves capital letters. But the timing and content are more important indicators of authenticity. Trump’s social media outbursts are more vivid on weekends, when he’s likely home alone.
And true Trump tweets resonate with a tone — “guts” and “begged me” are classics — that makes it seem like he doesn’t quite understand where he is, or what is required of him. (Never mind that Corker’s chief of staff, Todd Womack, challenged Trump’s account of the facts: “The President called Sen. Corker on Monday afternoon and asked him to reconsider his decision not to seek re-election and reaffirmed that he would have endorsed him, as he has said many times.”)
The fact that Trump could conduct stream-of-consciousness carping from the confines of the same White House that had been occupied by the likes of Lincoln, FDR and Ronald Reagan suggests that he may not be aware of his surroundings. As he tweets about TV shows, we can see that his mind is too often fixed on matters beneath a president. And when he does focus on something important, like national security, he indulges in silliness about the “Rocket Man” (Kim Jong Un) or praises himself: “Wow, Senator Luther Strange picked up a lot of additional support since my endorsement.”
Despite the President’s “Wow,” Alabama’s Sen. Strange wound up losing a GOP primary to Roy Moore.  A religious extremist who was twice forced to step down from the Alabama Supreme Court, Moore had called homosexuality “evil,” insisted Muslim Rep. Keith Ellison should not be permitted to serve in Congress and suggested the attacks of 9/11 could have been God’s punishment for American sinfulness.    
The prospect of serving with Moore may have helped Corker reach his decision to retire as of 2018, but his concern about Trump predates the Alabama primary. In August, Corker was obviously appalled by Trump’s response to a white supremacist march in Charlottesville, when he said among the torch-bearing neo-Nazis there were some “very fine” people.
Corker considered these words and concluded, “The President has not yet been able to demonstrate the stability nor some of the competence that he needs to demonstrate in order to be successful.”
Just days ago, Corker stood up for Secretary of State Rex Tillerson, who had reportedly called Trump a “moron” and was trying to demonstrate his loyalty to the President. “I see what’s happening here,” said Corker.  “I deal with people throughout the administration and (Tillerson), from my perspective, is in an incredibly frustrating place, where, as I watch, OK, and I can watch very closely on many occasions, I mean you know, he ends up being, not being supported in the way I would hope a secretary of state would be supported. That’s just from my vantage point.” He suggested that Tillerson, along with Defense Secretary James Mattis and White House Chief of Staff John Kelly, were keeping the United States from tumbling into “chaos.”
Frustration with Trump can be heard across the nation as leaders who hoped the President would set aside his rage and self-centeredness in the service of the country are met, instead, by the same old Donald Trump. No more thoughtful than he was as a TV game show host and no more reliable than when he was a salesman practicing “truthful hyperbole,” Trump makes much of the world cringe as he fails to achieve his agenda at home and undercuts his own secretary of state abroad.
With Trump in a cycle of saying and doing destructive and disruptive things unbecoming the leader of the free world,  Corker seems to be suffering from the sort of burnout experienced by those who care for senior relatives.

Here his evocation of “adult care” is more meaningful than the senator may even know. Adult day care is as much a service for the friends and family of those with dementia and other disabling conditions as it is for those who attend programs. The respite they receive when experts take over for a few hours makes it possible to continue with the burden of caregiving.
In the case of President Trump, the parallel with adults in care includes, also, the sad reality that someone who is supposed to be strong and capable is, instead, in need of supervision. It’s hard to begrudge Corker his decision to escape dealing with a president in this condition by not running for re-election. But as a member of the Republican Party, he’s one of the few who have the standing to get through to the man, and thus it seems like he’s taking the easy way out while leaving more of the work to the rest of us.  We’re burned out, too.

Vice President Mike Pence walked out of Sunday’s NFL game between the Indianapolis Colts and the San Francisco 49ers as several 49ers players knelt in protest during a rendition of the national anthem.

“While everyone is entitled to their own opinions, I don’t think it’s too much to ask NFL players to respect our Flag and our National Anthem,” Pence wrote on Twitter minutes after leaving the game in Indianapolis, Indiana.

Following the example of former San Francisco 49ers quarterback Colin Kaepernick, NFL players around the country have knelt during renditions of the national anthem in order to protest against police brutality and racial injustice directed towards black Americans.

More than a hundred NFL players from several football teams kneeled or held arms in solidarity earlier this month after President Donald Trump called NFL players who kneel during the anthem “sons of bitches.” He later insisted his criticism of the NFL had “nothing” to do with race.

Trump said on Sunday that he asked Pence to leave the stadium in Indianapolis if any players knelt during the national anthem, an extremely likely event given the number of players on the 49ers team who kneel during the anthem before every game.

The president’s revelation suggested the White House orchestrated the walk out on purpose, raising questions about the cost of Pence’s brief trip to Indianapolis. The vice president flew there from Las Vegas, where he visited the victims and families of last week’s horrific shooting. He is now flying back West for a stop in California.

“Wait. This was orchestrated to make a point? That’s not an inexpensive thing to do,” tweeted Sen. Brian Schatz (D-Hawaii) on Sunday.

Many people have commented that Pence’s action came off as publicity stunt, including San Francisco 49ers’ Eric Reid, who was one of the first players to kneel alongside Kaepernick in 2016. Reid told reporters that the three-year-old photo of Pence at a Colts game in 2014 was the last he had heard of the vice president attending a game.

“So this looks like a PR stunt to me,” Reid told a pool of reporters on Sunday. “He knew our team has had the most players protest. He knew that we were probably going to do it again. This is what systemic oppression looks like. A man with power comes to the game, tweets a couple of things out and leaves the game with an attempt to thwart our efforts. Based on the information I have, that’s the assumption I’ve made.”

“Immigration reform has been a hot-button issue long before President Trump pledged to build a wall along our border. And while there’s certainly an argument to be made that we need to do a better job of controlling illegal immigration, there’s also a strong case to be made that immigrants are a big driving force behind America’s growth — past, present, and future.

Warren Buffett has been very outspoken in recent years about America and its amazing economic story. Not only does Buffett feel that immigrants have led us to where we are today, but he also thinks that immigrants are an essential component of our country’s future success.

Here’s what Warren Buffett thinks of immigrants
In a nutshell, Buffett feels that immigrants (including undocumented ones) have been and continue to be a key part of our prosperity — not a part of the problem. “This country has been blessed by immigrants,” Buffett said in February at Columbia University. “You can take them from any country you want, and they’ve come here and they found something that unleashed the potential that the place that they left did not, and we’re the product of it.”

Referring to Albert Einstein and Leo Szilard, both of whom were immigrants themselves, Buffett said, “If it hadn’t been for those two immigrants, who knows whether we’d be sitting in this room.”

In his most recent letter to Berkshire Hathaway’s (NYSE:BRK-A) (NYSE:BRK-B) shareholders, Buffett specifically mentioned immigrants as one of the major components of America’s success story. “From a standing start 240 years ago — a span of time less than triple my days on earth — Americans have combined human ingenuity, a market system, a tide of talented and ambitious immigrants, and the rule of law to deliver abundance beyond any dreams of our forefathers.”

On a pathway to citizenship
Buffett is an outspoken Democrat who actively campaigned for Hillary Clinton during the 2016 presidential race. So it shouldn’t come as too much of a surprise that Buffett doesn’t want to deport millions of illegal immigrants who are currently in the United States.

In a 2015 interview with Fox Business, Buffett said

People should be able to earn citizenship who are here. You know, I do not think we should deport millions of people. So, I think we should have a real path to citizenship.

Buffett was then asked specifically about the DREAM Act and its 800,000 minors who are in the country illegally and now face an uncertain future after the end of DACA, from the perspective of a successful American businessman. Buffett replied:

It is a question of being a human being not really a businessman. Immigrants came, our forefathers came as immigrants, they got here anyway they could. And who knows what I would have done if I were in some terrible situation in a country and wanted to come here…a great percentage of them are good citizens. I would have a path to citizenship for them, I would not send them back.

 

On immigration policy and reform
As we all know, the immigration debate has been going on for a long time. And Buffett’s stance hasn’t changed much over the past several years. In a 2013 interview with ABC’s This Week, Buffett said:

I think we should have a more logical immigration policy. It would mean we would attract a lot of people, but we would attract the people we want to attract in particular — in terms of education, tens or hundreds of thousands of people. We enhance their talents and have them stick around here.

Buffett went on to say that any reform package should “certainly offer [undocumented immigrants] the chance to become citizens,” and one main reason for doing so would be to deepen the talent pool of the labor force.

Buffett’s stance on immigration in a nutshell
Warren Buffett believes that allowing immigrants who are already in the country to stay and pursue citizenship is not only the right thing to do, but is essential to America’s continued economic prosperity. Buffett certainly sees the need for immigration reform, as most Americans of all political affiliations do, but wants to encourage and simplify the legal pathways to immigration.”

Buffet speaks simple truth: Immigrants, both documented and undocumented are not threats, but rather are a necessary ingredient for America’s greatness. We need to bring law-abiding undocumented individuals into our society in some type of legal, work authorized status. We also need substantial across the board increases in legal immigration, so that in the future the immigrants we need can come through the legal system (or wait in a realistic line) rather than coming through an underground system and working and living in the shadows.

The lies, misrepresentations, and false narratives being peddled by Trump, Sessions, Bannon, Miller, Kobach, Cotton, Perdue, King, Goodlatte, Labrador, the so called “Freedom” Caucus, and the rest of their White Nationalist restrictionist cronies are a path to national disaster. Removing existing non-criminal migrants who happen to be working here in undocumented status is a colossal waste of limited Government resources that actually hurts our country in numerous ways.

Time to stand up against the restrictionist, White Nationalist, xenophobic, anti-American blather. Demand that your Congressional representatives back sane, humane immigration reform that takes care of those already here and recognizes their great contributions while appropriately and significantly expanding future legal immigration opportunities so that we don’t keep repreating our mistakes over and over.

Let’s be honest about it. If the time, money, and resources that the U.S. Government is currently spending on the counterproductive aspects of immigration enforcement and inhumane immigration detention were shifted into constructive areas, there would be no “disaster relief crisis” in Puerto Rico and the Virgin Islands right now, and we’d have more money to spend on heath care, job training and retraining, infrastructure, addressing the opioid crisis, and many more legitimate national priorities!

GONZO’S WORLD: “Eggshell” Attorney General Is A Parody Of The First Amendment!

“Having seen the Sessions DOJ prosecute someone for laughing at Jeff Sessions, it’s hardly surprising that he wants a First Amendment that celebrates the robust criticism of everyone but himself. Watching Sessions’ DOJ going after private Facebook information for anti-Trump activists, it’s hardly surprising that these much-vaunted free speech protections flow in the direction of Trump officials and away from Trump dissenters. It is, nevertheless, somewhat more surprising to see that the burgeoning theory that conservatives deserve free speech protections, and liberals deserve none, is becoming yet another normalized part of this abnormal administration. After all, if you cannot even see anyone from the opposing side, you certainly have no reason to hear their voices. And what was most striking about Sessions’ rousing performance at Georgetown is that he didn’t seem to even notice or concede that an opposing side exists. This has very real practical effects for his DOJ and for our rule of law.

Read, for example, the work of my friend Garrett Epps on the stunning DOJ brief filed in the Masterpiece Cakeshop v. Colorado Civil Rights Commission “religious baker” case to be heard at the Supreme Court this fall. The Justice Department evinces no solicitude at all for the injuries of anyone but the Christian baker at issue, the one who seeks not to be compelled to make a wedding cake for a gay couple. Sessions’ Department of Justice, for instance, argues that Colorado hadn’t yet acknowledged the rights of marriage equality at the time of the cake incident, so the fact that such equality is now a constitutional right should not even be considered. It’s a hard case, as Epps notes. But it’s vastly easier if you simply pretend away the interests of the other side. For this DOJ, there is nobody else on the radar. Nobody else exists.

When talking about the First Amendment and the brutal and challenging clash of diverse opinions, a big part of that is the obligation to listen to ideas that might be uncomfortable or even painful to hear. But that relationship presupposes that we can see or acknowledge that there are speakers on the other side. More and more, it feels as though the Trump administration’s aperture has narrowed to the point where someone can espouse First Amendment values while viewing genuine opponents as wholly other, foreign, and not even worth giving the chance to respond. This is the framing for the NFL protests (Trump has free speech rights, the players do not) and the framing for Sessions’ speech about student speech.

There’s little doubt that Jeff Sessions meant it when he importuned the students before him to stand up for free speech and to spend their law school careers refining their own views in opposition to conflicting ideas. But it’s far from clear that he realized how absurd it was to say those things at an event that excluded faculty and students with different viewpoints. Admonishing law students to spend their time testing their pre-existing views against alternate ideas while engaging in almost daily acts of punishing and suppressing speech and expression of alternate ideas is insane. I’m not sure that the sparking, hotly contested debates between people who hate marriage equality and the people who really, really hate marriage equality is the sort of dispute Justices Jackson and Brandeis were thinking about.

And what is terrifying is the possibility that Sessions truly believes that people with different viewpoints don’t even exist anymore in any tangible application. These dissenters are all just enemies of the state. They are no more real to him than ghosts. More and more, Sessions is constructing a Justice Department in which the other side is just noise to him, not speech. And if you cannot even see protesters and political dissidents, it’s hardly a surprise that you cannot hear them either.”

I have to admit that it’s great to be retired, outside the repressively paranoid atmosphere of the DOJ (and that was before the reign of Gonzo began), and able to exercise my right to free speech again.

Sessions is enthusiastic about defending the right to promote hate speech, religious zealotry, and homophobia, all things in which he and his alt-right cronies fervently believe. But, when it comes to defending the rights of Blacks, Hispanics, immigrants, and the rest of us to protest, or in the case of Blacks and Hispanics to even exercise their voting rights, not so much.

Gonzo’s career has been built on disingenuously promoting bias, racial inequality, xenophobia, homophobia, intolerance, and white privilege in the name of a Constitution that it’s hard to believe he’s ever read much less understands or follows. Other than Trump, Bannon, or Miller, I can’t imagine anyone less qualified than Gonzo to pontificate about the First Amendment, or indeed any portion of the U.S. Constitution other than, perhaps, the Second Amendment which apparently is the only part of the Constitution they have ever heard about down in Ol’ Bammy.

WASHPOST: Voter Fraud Is Not a Threat, But Kris Kobach is Both A Fraud & A Threat To Our Democracy!

The Editorial Board writes:

“Aha, says Mr. Kobach, writing at Breitbart, the right-wing website, “now there’s proof” of fraud: “It seems that they never were bona fide residents of the State.”

In fact, when New Hampshire Public Radio examined the data earlier this year, it found that more than two-thirds of 5,900 day-of-election registrants who had out-of-state driver’s licenses lived in college towns, indicating most were students voting perfectly legally. Again, on most of the state’s biggest residential campuses, a majority of students — usually a sizable majority — are from out of state. That’s true at the University of New Hampshire, Dartmouth College, Keene State College, Franklin Pierce University and others.

 

It’s also true at Saint Anselm College in Manchester, N.H., where on Tuesday Mr. Kobach attempted to defend his baseless claim at a meeting of the Presidential Advisory Commission on Election Integrity. Under fire for his tendentious claims, which he used to cast doubt on the narrow victories in New Hampshire of Hillary Clinton and now-Sen. Maggie Hassan, both Democrats, he said: “Until further research is done, we will never know the answer regarding the legitimacy of this particular election.”

That’s Mr. Kobach at his most insidious, using innuendo, but never actual evidence, to impugn and subvert American democracy.”

Kobach is a long-standing racist, White Nationalist, and xenophobe whose mission is to promote a primarily anti-Hispanic agenda that includes suppressing the votes not only of Hispanics but of other minorities and the poor because he and his cronies deem them to be “unsuitable” for the franchise. What greater proof of unsuitability can there be than that many of the foregoing are thought to vote for Democrats.

Kobach is out to insure that a minority of White Nationalists and their GOP “fellow travelers” (which would be virtually every other GOP pol and voter who consistently refuse to stand up and expose Kobach’s charade) maintain control over the rest of us in the majority. And no lie, fabrication, or misrepresentation is too low for him to go.

But, in the end, it’s the GOP electorate (particularly in Kansas), President Trump, and the “establishment” GOP pols (like Mitt Romney and Mike Pence) who have enabled this toxic anti-American dude. The rest of us need to come up with a strategy to “retire” Kobach to the fringes of alt-right “fake radio” where he belongs. He certainly is totally undeserving of a voice on the national political scene.
