“The inspector general for the Department of Homeland Security has criticized several immigration detention facilities for having spoiled and moldy food and inadequate medical care, and for inappropriate treatment of detainees, such as locking down a detainee for sharing coffee and interfering with Muslims’ prayer times.

Acting Inspector General John V. Kelly, who took over Dec. 1, said the watchdog agency identified problems at four detention centers during recent, unannounced visits to five facilities. The Dec. 11 report , released Thursday, said the flaws “undermine the protection of detainees’ rights, their humane treatment, and the provision of a safe and healthy environment.”

“Staff did not always treat detainees respectfully and professionally, and some facilities may have misused segregation,” the report found, adding that observers found “potentially unsafe and unhealthy detention conditions.”

Immigration and Customs Enforcement jails tens of thousands of immigrants for civil immigration violations, holding them until they are deported or released in the United States. The jails are not supposed to be punitive, according to the report.

ICE concurred with the inspector general’s findings and said it is taking action to fix the problems, some of which have already been addressed.

“Based on multi-layered, rigorous inspections and oversight programs, ICE is confident in conditions and high standards of care at its detention facilities,” the agency said in a statement. “To ensure the safety and well-being of those in our custody, we work regularly with contracted consultants and a variety of external stakeholders to review and improve detention conditions at ICE facilities.”

The Office of Inspector General said it launched the surprise inspections after receiving complaints from immigrant advocacy groups and on its hotline about treatment of detainees. The inspectors also interviewed staff members and detainees and examined records.

Advocates for immigrants said the report reaffirmed their long-standing calls for the detention facilities to be closed. Advocates have complained about reports of physical and sexual assaults, deaths in detention and other concerns for years under past presidents — and say their worries are increasing under President Trump.

Trump has pledged to dramatically increase deportations and is seeking congressional approval for more than 51,000 detention beds this fiscal year, up from about 30,000 under President Barack Obama.

Trump’s pick for the permanent director of ICE, Thomas D. Homan, previously ran the ICE detention system.

“The realities documented by the OIG inspectors, and many more, are endemic to the entire detention system,” Mary Small, policy director at Detention Watch Network, a nonprofit group that monitors immigration detention, said in a statement. “ICE has proven time and time again to be incapable of meeting basic standards for humane treatment.”

In a statement, Azadeh Shahshahani, legal and advocacy director of Project South, in Atlanta, cited the death in May of Jean ­Jimenez-Joseph.­ The 27-year-old Panamanian national was held in solitary confinement for 19 days at the Stewart Detention Center in rural Georgia, according to Project South.

Shahshahani said his death “should have served as a final wake-up call and resulted in the immediate closure of the facility.”

“Almost half of Americans believe that corruption is pervasive in the White House under President Trump, a sharp increase over last year, according to a new survey. Americans now see Trump and his top officials as the most corrupt public officials in government, despite his campaign pledge to drain the swamp.

A new report out Tuesday compiled by Transparency International, the leading nonprofit organization tracking corruption worldwide, shows Americans have significantly lost faith that their government is ably fighting corruption, compared to last year. Overall, Washington-based government institutions are viewed by Americans are more corrupt than those outside the Beltway, the report found. But the Trump White House tops the list.

According to the group’s 2017 U.S. Corruption Barometer, 44 percent of respondents said that most or all of the officials in the office of the president are corrupt, up from 38 percent at the end of Obama’s second term.

Members of Congress are seen as the second most corrupt group of government officials of the nine categories in the survey, with 38 percent of Americans viewing them as mostly or all corrupt. After that, Americans perceive corruption as pervasive in non-White House government officials, business executives, local officials and business leaders in decreasing proportions. Only 16 percent of respondents viewed judges and magistrates as mostly or all corrupt, according to the data.

Meanwhile, 69 percent of respondents said the U.S. government is fighting corruption “fairly badly” or “very badly,” up from 51 percent in 2016. More than half of respondents said people don’t report corruption due to fear of retaliation.

Transparency International defines corruption as “the abuse of entrusted power for private gain.” Key issues within that definition include the influence of wealthy individuals over government, “pay for play” politics, revolving doors between government and corporate entities and the abuse of the financial system by elites.

The perception of Trump and his top officials as being corrupt is easy to understand. Trump and his family have scores of well-documented conflicts of interest they have dealt with in an opaque manner. Meanwhile, Trump’s failure to divest fully from his businesses, combined with his failure to release his tax returns, has fueled suspicions.

The phone survey, performed by the company Efficience3, included interviews of 1,005 randomly selected Americans in October and November. The data were weighted to be demographically representative of all American adults by age, race, gender, urbanization, social grade and ethnicity.

Zoe Reiter, Transparency International’s U.S. representative, said that the study was meant to form a basis for understanding how government is failing to uphold high anti-corruption standards and provide a call to action for Americans to respond. She pointed out that 74 percent of respondents said they believed ordinary people still can make a difference.

“The good news is a majority of Americans feel empowered to fight corruption,” she said. “Since our elected officials are failing to deliver, we need to figure out a way to push them much harder to take these issues more seriously.”

There is some disconnect here, because some of the folks who now are concerned about corruption voted for Trump and the GOP, despite more than ample public evidence of his endemic dishonesty, congenital lying, incompetence, and general immorality. Garbage in — garbage out!

“The broader dysfunction in America’s immigration system remains largely unchanged. Federal immigration courts are grappling with a backlog of some 600,000 cases, an epic logjam. The administration wants to more than double the number of the 300 or so immigration judges, but that will take time. And its recent moves to evaluate judges based on the speed with which they handle dockets that typically exceed 2,000 cases, rather than on fair adjudication, is a recipe for assembly-line injustice.

Mr. Trump’s campaign bluster on deportation was detached from reality. He said he’d quickly deport 2 million or 3 million criminal illegal immigrants, but unless he’s counting parking scofflaws and jaywalkers, he won’t find that many “bad hombres” on the loose. In fact, legal and illegal immigrants are much less likely to end up in jail than U.S. citizens, according to a study by the Cato Institute.

The president’s sound and fury on deportation signify little. He has intensified arrests, disrupting settled and productive lives, families and communities — but to what end? Only an overhaul of America’s broken immigration system offers the prospect of a more lasting fix.”

The Post also points out the damage caused by Trump’s racist “bad hombres” rabble rousing and the largely bogus nature of the Administration’s claims to be removing “dangerous criminals.” No, the latter would require some professionalism and real law enforcement skills. The majority of American voters who did not want the Trump debacle in the first place still have the power to use the system to eventually restore decency, reasonableness, compassion, and integrity to American Government and to send the “Trump White Nationalist carpetbaggers” packing. “The number of people caught trying to sneak over the border from Mexico has fallen to the lowest level in 46 years, according to Department of Homeland Security statistics released Tuesday that offer the first comprehensive look at how immigration enforcement is changing under the Trump administration.

During the government’s 2017 fiscal year, which ended Sept. 30, U.S. border agents made 310,531 arrests, a decline of 24 percent from the previous year and the fewest overall since 1971.

The figures show a sharp drop in apprehensions immediately after President Trump’s election win, possibly reflecting the deterrent effect of his rhetoric on would-be border crossers; starting in May, the number of people taken into custody began increasing again.

Arrests of foreigners living illegally in the United States have surged under Trump. Immigration and Customs Enforcement officers made 110,568 such arrests between inauguration and the end of September, according to the figures published Tuesday, a 42 percent increase over the same period during the previous year.

Tom Homan, ICE’s temporary director and Trump’s nominee to lead the agency, praised the president and gave a vigorous defense of ICE’s more aggressive approach.

“This president, like him or love him, is doing the right thing,” Homan told reporters at a news conference in Washington, accompanied by the heads of the U.S. Border Patrol and Citizenship and Immigration Services.

“A 45-year low in border crossings? That’s not a coincidence,” Homan said. “That’s based on this president and his belief and letting the men and women of ICE and the Border Patrol do their job.”

Trump’s sweeping promises to crack down on illegal immigration fueled his presidential campaign and are at the center of his most ambitious domestic policy proposals, including construction of a wall along the border with Mexico.

Asked whether such a barrier was justifiable given its high cost and the decline in illegal immigration, DHS officials endorsed the president’s plan.

“In this society, we use walls and fences to protect things. It shouldn’t be different on the border,” said Ronald Vitiello, chief of the Border Patrol.

Apprehensions by Border Patrol agents peaked at more than 1.6 million in 2000 and began falling substantially after 2008. The previous low point was 331,333 arrests, during fiscal 2015. Experts have attributed the decline to tougher U.S. enforcement, improving job prospects in Mexico and long-term demographic changes that have driven down the country’s birthrate.

Still, the drop in border arrests is among the sharpest year-to-year changes on record, one that only casts more doubt on the wisdom of building a border wall, said Doris Meissner, senior fellow at the Migration Policy Institute, a Washington think tank.

“It’s a throwback response to yesterday’s problems,” she said, arguing that the money would be better spent addressing what accounts for a growing share of illegal migration: families with children fleeing rampant violence and dismal poverty in Central America.

Border agents took more than 75,000 “family units,” classified as at least one child and a related adult, into custody during fiscal 2017. But the number of unaccompanied minors fell 31 percent, to 41,435.”

And, the best part: we won’t have to worry about any of that burdensome, nasty “globalism” and the unfair burden of global leadership! That’s because the Chinese, Indians, Canadians, Mexicans, and Europeans will be in charge of the world economy and the Ruskies will control world politics. So we can enjoy our little White Nationalist enclave modeled on post-revolutionary Cuba — life in the 1950’s preserved forever! Save those “Classic ’57 Chevies!”

Kinda sorry I won’t be here to enjoy it! But, then again, I already lived through the real 1950’s once — Cold War, Jim Crow, segregation, anti-semitism, racial covenants, no women doctors, lawyers, or execs, African Americans only welcome on the football fields and basketball courts of a few Northern colleges! Boy, it was great! But, not sure I want  to do it again, even to experience the pure, unadulterated joy of having “my Milwaukee Braves” win the 1957 World Series (before fleeing to Atlanta)!

On the flip side, at Homan’s “record pace” of “law enforcement,” he and his minions will have every single undocumented American resident removed from the U.S by 2080 — that’s if no more arrive in the interim. And, the really great thing — they and those around them (including U.S. citizen kids and family members) will be living in fear every moment for the next six decades! Now, that’s something of which we can be truly proud! Of course, this all assumes that the North Koreans don’t nuke us and the rest of the world out of existence first!

LA TIMES: ICE DRAGNET SNARES US CITIZENS — Quick To Arrest, Slow To Release — The “Crime” Of Being Latino & Born In Mexico — How Would YOU Prove U.S. Citizenship If The ICEMEN Cometh?

“Sergio Carrillo had already been handcuffed in the Home Depot parking lot when an officer wearing a Homeland Security uniform appeared.

“Homeland Security?” Carrillo asked. “What do you want with me?”

Ignoring Carrillo’s demands for an explanation, the officer ordered the 39-year-old taken to a federal detention facility in downtown Los Angeles for people believed to be in the country illegally.

“You’re making a big mistake,” Carrillo recalled saying from the back seat to the officers driving him. “I am a U.S. citizen.”

The arrest last year was the start of a perplexing and frightening ordeal for Carrillo, who said in an interview with The Times that immigration officials scoffed at his repeated claims of citizenship and instead opened a case against him in immigration court to have him deported. It would take four days for government officials to concede their mistake and release Carrillo.

The case, say civil rights attorneys and other critics of the country’s immigration enforcement system, highlights broader problems with how people are targeted for deportation. They argue databases used by immigration officials to determine who is and isn’t in the country legally are beset by outdated and inaccurate information that leads to an unknown number of U.S. citizens being detained each year.

Since 2002, Immigration and Customs Enforcement has wrongly identified at least 2,840 United States citizens as possibly eligible for deportation, and at least 214 of them were taken into custody for some period of time, according to ICE records analyzed by the Transactional Records Access Clearinghouse at Syracuse University.

Because ICE in January stopped releasing data on those it takes into custody, it is impossible to know how many citizens have been caught up in the aggressive push to increase arrests and deportations being carried out under President Trump.

In one such case, Guadalupe Plascencia complained that she was transferred from San Bernardino County jail to ICE custody in March despite having become a citizen two decades earlier. The 59-year-old hairdresser said she was released only when her daughter showed ICE agents her passport.

On Wednesday, attorneys for Carrillo announced a settlement deal in which the government will pay him $20,000 to resolve a civil lawsuit he filed over the arrest.

ICE officials could not be immediately reached Wednesday.”

If you read the complete story, you will see that even after learning of their likely mistake, ICE was in no hurry to correct it. In fact, it appears that but for the intervention of his lawyer, this individual might well have remained in detention and been scheduled for a removal hearing before an Immigration Judge. At no point does in this article does it appear that ICE was in any way apologetic for its mistake. Indeed, it took a civil lawsuit and a $20,000 settlement to get any satisfaction.

What if this U.S. citizen had been an “Anglo” dressed in a business suit? Would he have been treated the same way by ICE? I doubt it.

As I have pointed out before, Trump, Sessions, Miller and their White Nationalist cronies are in the process of constructing an internal security police force using ICE as the spearhead. Today, their targets are mostly people of color — be they migrants, legal immigrants, refugees, or U.S. citizens — and most in the “Anglo Community” seem happy to ignore what’s really happening to their neighbors and in their communities.

But, the “Day of the Anglos” might still come. After all, there is a long list of Americans who are not entitled to full legal protections according to “Jeff’s Law:” LGBTQ individuals, reporters, liberal counter demonstrators, those who challenge police brutality, voters in gerrymandered districts, women who want to exercise their Constitutional right to an abortion, non-Christians, etc. Who is going to speak up for YOUR rights if your Government won’t?

According to DHS propaganda, the “hard-line” policies of the Trump Administration have resulted in spectacularly diminished illegal border crossings and are discouraging individuals from coming here or staying under our legal system. As I’ve observed, some immigration agents have so little “real” law enforcement work to do that they can take time to engage in such “enforcement overkill” as staking out a kid’s hospital room or arresting and deporting working parents of U.S. citizens and local soccer stars who have no serious criminal records.

So, with everything under control, why does the Trump Administration need 15,000 additional immigration agents, a Border Wall, and an expanded private immigration detention Gulag? What’s the “ultimate purpose” here? Who’s going to speak up for YOUR legal rights when the Trumpsters show up at your door to take them away?

“For more than five hours, Attorney General Jeff Sessions sat in a hearing room on Capitol Hill this month, fending off inquiries on Washington’s two favorite topics: President Trump and Russia.

But legislators spent little time asking Sessions about the dramatic and controversial changes in policy he has made since taking over the top law enforcement job in the United States nine months ago.

From his crackdown on illegal immigration to his reversal of Obama administration policies on criminal justice and policing, Sessions is methodically reshaping the Justice Department to reflect his nationalist ideology and hard-line views — moves drawing comparatively less public scrutiny than the ongoing investigations into whether the Trump campaign coordinated with the Kremlin.

Sessions has implemented a new charging and sentencing policy that calls for prosecutors to pursue the most serious charges possible, even if that might mean minority defendants face stiff, mandatory minimum penalties. He has defended the president’s travel ban and tried to strip funding from cities with policies he considers too friendly toward undocumented immigrants.

Sessions has even adjusted the department’s legal stances in cases involving voting rights and lesbian, gay, bisexual and transgender issues in a way that advocates warn might disenfranchise poor minorities and give certain religious people a license to discriminate.

Supporters and critics say the attorney general has been among the most effective of the Cabinet secretaries — implementing Trump’s conservative policy agenda even as the president publicly and privately toys with firing him over his decision to recuse himself from the Russia case.

In meetings with top Justice Department officials about terrorist suspects, Sessions often has a particular question: Where is the person from? When officials tell him a suspect was born and lives in the United States, he typically has a follow-up: To what country does his family trace its lineage?

While there are reasons to want to know that information, some officials familiar with the inquiries said the questions struck them as revealing that Sessions harbors an innate suspicion about people from certain ethnic and religious backgrounds.

Sarah Isgur Flores, a Justice Department spokeswoman, said in a statement, “The Attorney General asks lots of relevant questions in these classified briefings.”

Sessions, unlike past attorneys general, has been especially aggressive on immigration. He served as the public face of the administration’s rolling back of a program that granted a reprieve from deportation to people who had come here without documentation as children, and he directed federal prosecutors to make illegal-immigration cases a higher priority. The attorney general has long held the view that the United States should even reduce the number of those immigrating here legally.

In an interview with Breitbart News in 2015, then-Sen. Sessions (R-Ala.) spoke favorably of a 1924 law that excluded all immigrants from Asia and set strict caps on others.

“When the numbers reached about this high in 1924, the president and Congress changed the policy and it slowed down immigration significantly,” Sessions said. “We then assimilated through 1965 and created really the solid middle class of America, with assimilated immigrants, and it was good for America.”

Vanita Gupta, the head of the Justice Department’s civil rights division in the Obama administration who now works as chief executive of the Leadership Conference on Civil and Human Rights, said Sessions seems to harbor an “unwillingness to recognize the history of this country is rooted in immigration.”

“On issue after issue, it’s very easy to see what his worldview is of what this country is and who belongs in this country,” she said, adding that his view is “distinctly anti-immigrant.”

Those on the other side of the aisle, however, say they welcome the changes Sessions has made at the Justice Department.

Jessica Vaughan, director of policy studies for the Center for Immigration Studies, which advocates for moderating levels of immigration, said she would give the attorney general an “A-plus” for his work in the area, especially for his crackdown on “sanctuary cities,” his push to hire more immigration judges and his focus on the MS-13 gang.

“He was able to hit the ground running because he has so much expertise already in immigration enforcement and related public safety issues and the constitutional issues, so he’s accomplished a lot in a very short time,” Vaughan said.”

Immigrants, refugees, immigration advocates, and career civil servants involved in immigration at the DOJ seems to be “star-crossed.” After decades of relative indifference to the importance of immigration, an Attorney General finally shows up  who makes it his highest priority.

Only problem is that he’s a committed xenophobe and White Nationalist whose largely false and exaggerated narrative on immigration comes right from the alt-right restrictionist playbook and harks back to the Jim Crow era of the American South — only this time with Hispanics and Muslims as the primary targets.

In any “normal” American business, obsession with tracing back lineage of someone’s family would be prima facie evidence of prohibited “national origins discrimination.” But, for Gonzo, it’s just another day at the office.

Notwithstanding his less than stellar performances before Congress and that he’s fallen off Trump’s “A-Team” (notwithstanding probably doing more to deconstruct the Constitution and “Good Government” than any other cabinet officer), he’s unlikely to be going anywhere soon. So the damage will continue to add up for the foreseeable future. It’s not like Senator Liz Warren and others didn’t try to warn America about this dude!

GONZO’S WORLD: “MINISTRY OF INJUSTICE” — How Gonzo Is Successfully Draining Justice From The Department Of Justice

“The Russia investigation may be undercutting Attorney General Jeff Sessions’ credibility, but it has not undermined his efforts to take the U.S. Justice Department back in time.

The time Sessions wants to go back to features an unforgiving system of mass incarceration that disproportionately targets people of color in a legal structure too often stacked against them.

To do this, the attorney general has issued a slew of policy rollbacks — unfortunate for a Justice Department that was only incrementally making progress toward equal justice under President Barack Obama and Attorney General Eric Holder.

In this sense, Sessions’ Justice Department might be the most effective unit of the Trump administration. If Trumpism’s goal is, at least in, part to destroy the progress achieved under the Obama administration, Sessions’ scorecard so far outstrips his GOP colleagues in the Cabinet and former colleagues in the Senate.

In March, for example, the nation’s top law enforcement officer visited St. Louis, next-door to Ferguson, ground zero for the Black Lives Matter movement. Sessions was in St. Louis talking about crime initiatives but also seeming to criticize one of the most useful tools for documenting police brutality: civilian cell phone videos. The choice of venue could not have been a coincidence. By focusing on “targeted police killings,” he deflected attention from the challenges now confronting law enforcement.

In fact, Sessions has had little to say on how the Justice Department might address matters of police brutality, much less on the matter of Black Lives Mattering. Instead, he has mostly showcased President Donald Trump’s belief that strong policing and incarceration are key to maintaining law and civil order.

It is as if Sessions’ Justice Department is operating on a set of alternative facts. Because the statistics are well known: Whites and blacks use and sell drugs at roughly the same rates, and African Americans make up roughly 13 percent of the U.S. population. Yet law enforcement records are remarkably different for each demographic. According to Human Rights Watch: “Black adults are more than two-and-a-half times as likely as white adults to be arrested for drug possession. In 2014, Black adults accounted for just 14 percent of those who used drugs in the previous year but close to a third of those arrested for drug possession.” In many states, a felony conviction also means losing the right to vote.

It is as if Sessions’ Justice Department is operating on a set of alternative facts.

Sessions looks eager to re-open the “war on drugs” — or, more appropriately, the war on poor people who use drugs. No available metric on this decades-long war shows any significant success in limiting access to drugs in the United States or in reducing addiction to controlled substances.

What the “war on drugs” has been good at is: stigmatizing poor people afflicted with the disease of addiction; profiling black and brown folks and arresting them at rates exponentially greater than their white counterparts; and creating revenue streams for the Prison Industrial Complex.

Sessions’ success will be key if Trump wants to make good on his law-and-order promises.

Sadly, it is working. The Justice Department is slowly transforming into an injustice department right before our eyes.

Mass incarceration, its impact on families and communities and the often racially biased ways in which its policies operate is still one of the most pressing human rights issues of our time. It’s a shame that, in the era of Trump, we are unable to effectively address the challenges we face.

THANKSGIVING 🦃🏈🍺🍽🍁SHOULD REMIND US OF OUR REFUGEE ORIGINS — But Trump & His White Nationalist Gang Have Distorted The Message!

“For the Pilgrims, there was certainly a lot to be grateful for. Their radical brand of Puritanism, identified as “Separatism” because of its disavowal of the Church of England, left them vulnerable to fines, imprisonment and persecution in their home country. They spent more than a decade in exile in what is now the Netherlands, but suffered financially and feared they would be in danger if the political winds in the continent started blowing in a different direction. The preceding and following years in European history present a litany of religious massacres and pogroms.

So they set sail aboard a couple of ships, including one famously named the Mayflower, as early modern refugees seeking a better life in a different part of the world. President Barack Obama summoned that simple aspiration two Thanksgivings ago, when the mood in his country was decidedly hostile to the plight of Syrian refugees.

“Nearly four centuries after the Mayflower set sail, the world is still full of pilgrims — men and women who want nothing more than the chance for a safer, better future for themselves and their families,” said Obama in 2015. “What makes America America is that we offer that chance. We turn Lady Liberty’s light to the world, and widen our circle of concern to say that all God’s children are worthy of our compassion and care. That’s part of what makes this the greatest country on Earth.”

Obama’s successor, President Trump, doesn’t quite seem to agree. He grandstands on a nationalist platform that looks darkly upon migrants and has sought to stanch the already thin flow of refugees into the United States. His erstwhile ideologue, Stephen K. Bannon, recently declared the United States is not a “nation of immigrants” — as the popular saying goes — but a “nation of citizens.”

That rhetoric shadowed Trump’s remarks at the traditional annual White House turkey pardoning ritual on Tuesday. “This Thursday, as we give thanks for our cherished loved ones, let us also renew our bonds of trust, loyalty and affection between our fellow citizens as members of a proud national family of Americans,” Trump said.

For the American right wing, the Thanksgiving story offers a different parable that has nothing to do with refugees. For decades, conservatives argued that a shift in farming practices toward private plots and away from communal farming was what saved the embattled Massachusetts colony from extinction. “So began the American recoil from collectivism,” noted Washington Post columnist George Will in 2006 in a piece that linked Thanksgiving to “the ascent of individualism.”

Whatever the case, of course, there’s no happy ending for the indigenous people who attended the first Thanksgiving feast, bearing five deer hunted for the occasion. Contact with Europeans before the Pilgrims’ arrival had already led to smallpox eradicating whole communities. The years that followed would complete their dispossession and disappearance.

Strangely, at a time when the American far right decries the existential threat posed by refugees with supposedly fundamentalist religious convictions, they have no problem aligning with the country’s original migrants.“

I absolutely agree with Tharoor that the Pilgrims fit squarely within today’s legal definition of “refugee.” Indeed, I granted a number of similar “religiously based” cases to Christians, Muslims, and other “20th and 21st Century Pilgrims.”

But, I can imagine someone like Jeff Sessions and some of the judges who work for him finding that the harm feared by the Pilgrims was “mere discrimination, not persecution;” or that it was “primarily economically, rather than religiously or politically motivated;” or that the Pilgrims were “firmly resettled” in the Netherlands. As one of my former BIA judicial colleagues used to say, there are lots of ways to deny asylum once you decide that’s the result you want.

We are, always have been, and always will be a “nation of refugees,” and there is nothing that the Trump-Sessions-Bannon-Miller White Nationalist crowd ultimately can do to change that.

But, among other things, I’m very thankful that I’m not a refugee in their world today.

“President Trump’s vision of a “big, beautiful” wall along the Mexican border may never be realized, and almost certainly not as a 2,000-mile physical structure spanning sea to sea.

But in a systematic and less visible way, his administration is following a blueprint to reduce the number of foreigners living in the United States those who are undocumented and those here legallyand overhaul the U.S. immigration system for generations to come.

Across agencies and programs, federal officials are wielding executive authority to assemble a bureaucratic wall that could be more effective than any concrete and metal one. While some actions have drawn widespread attention, others have been put in place more quietly.

The administration has moved to slash the number of refugees, accelerate deportations and terminate the provisional residency of more than a million people, among other measures. On Monday, the Department of Homeland Security said nearly 60,000 Haitians allowed to stay in the United States after a devastating 2010 earthquake have until July 2019 to leave or obtain another form of legal status.

Even as they fight court orders seeking to halt parts of Trump’s immigration agenda, Sessions, White House senior adviser Stephen Miller and other key players are finding ways to shrink the immigration system. Miller was an aide to Sessions before both men joined the administration; in less than a year, their immigration policy prescriptions have moved from the realm of think-tank wish lists to White House executive orders.

In October, the White House — in a plan led by Miller — said it had conducted a “bottom-up review of all immigration policies” and found “dangerous loopholes, outdated laws, and easily exploited vulnerabilities in our immigration system — current policies that are harming our country and our communities.”

Trump’s tough talk alone appears to be one of the administration’s best bulwarks: Illegal crossings along the border with Mexico have plunged to their lowest level in 45 years, and U.S. agents are catching a far greater share of those attempting to sneak in. Applications for H-1B skilled visas and new foreign-student enrollment have also declined.

William Frey, a demographer at the Brookings Institution, said that until now U.S. immigration rates have largely spared the country from the challenges facing advanced industrial nations such as Japan and Germany that can’t replace aging workers fast enough. By slashing immigration, Frey said, the country could end up with labor shortages and other workforce issues.

But although some of Trump’s most fervent supporters see curbing immigration as a way to turn back the United States’ rapid racial and ethnic transformation, Frey said it is an unrealistic goal. By 2020, census projections show minorities will account for more than half of the under-18 U.S. population, because of higher birthrates in nonwhite populations. And by 2026, the number of whites is projected to begin declining in absolute numbers, he said, as deaths exceed births.

“You can slow the rate of Latino and Asian immigration, but it won’t make the population whiter,” Frey said. “It will just become less white at a slower pace.”

Trump continues to insist his administration will build a border wall, despite exorbitant cost projections and senior DHS officials saying a 2,000-mile structure is impractical. His supporters say they admire the president for plowing ahead in his overhaul efforts and see a historic, generational shift underway.

“There is more than one way to get to the goal,” Dane said. “Legislative solutions are all great, but clearly the administration has done things behind the scenes. . . . The results have been dramatic.”

“AYATOLLAH ROY” APPARENTLY CAUGHT WITH HIS PANTS DOWN (LITERALLY) AS GOP REMAINS LARGELY IN DENIAL!

“So President Trump, Senate Majority Leader Mitch McConnell (Ky.) and fellow Republicans think Roy Moore, the GOP Senate nominee from Alabama, should quit his Senate run only “if these allegations are true.”

If true? Four women, on the record in The Post, say Moore, when he was in his 30s, tried to date them as teens, and one of the women says he had sexual contact with her when she was 14 and he was 32. Perhaps Republicans expect video and DNA evidence from 1979 magically to emerge, or a confession by Moore? (He denies the allegations.) More likely they are just dodging so that they can stick with Moore and keep the seat Republican — even if it means having an alleged pedophile join their caucus.

By comparison, there was more integrity in the defense of Moore offered by Alabama State Auditor Jim Zeigler, who told the Washington Examiner that, even if true, “there’s just nothing immoral or illegal here.” Indeed there’s biblical precedent for Moore’s alleged behavior.

“Take Joseph and Mary,” Zeigler said. “Mary was a teenager and Joseph was an adult carpenter. They became parents of Jesus.”

 

Jumpin’ Jehoshaphat!

Let us take seriously Zeigler’s justification, which is consistent with Moore’s view that “God’s laws are always superior to man’s laws,” and the Bible stands above the Constitution and other piddling laws of man. It is true that the Bible does not say “thou shalt not strip to thine tighty whities and kiss a 14-year-old and touch her through her bra and underpants.” The Bible also does not specifically prohibit colluding with the Russians, accepting emoluments, money laundering or conspiracy against the United States. So Moore, and for that matter President Trump and his administration, has nothing to worry about.

But if we are to accept the Bible literally as the legal standard (and not, say, age-of-consent laws), we will also have to accept as legal certain other activities in 21st-century America, including:

Sacrificing as a burnt offering your young son (Genesis 22:2) or your daughter, if she comes out of the doors of your house to meet you (Judges 11:30-1, 34-5).

 

Having rebellious children stoned to death by all the men of the city (Deuteronomy 21:18-21).

Purchasing slaves (Leviticus 25:44-46), selling your daughter as a slave (Exodus 21:7-8) and making sure they submit to their masters, even cruel ones (1 Peter 2:18).

Executing pagan priests on their own altars and burning their bones (2 Kings 23:20-25).

Cutting off the hand of a woman if she grabs the penis of a man who is fighting with her husband (Deuteronomy 25:11-12).

There’s no allegation of sexual intercourse, he said, and “Roy Moore fell in love with one of the younger women.” That would be his wife, Kayla, who Zeigler says is 14 years his junior and whom he was dating around that time.

You don’t need a judge and jury, Republicans, to determine that there was something icky going on or that there is something dangerous in having as a senator a man who places God’s law over man’s — and then interprets God’s laws to suit himself.“

WASHPOST: TRUMP’S ANTI-IMMIGRANT WHITE NATIONALIST HYSTERIA & UNJUSTIFIED ATTACKS ON OTHERS DIMINISHES OUR COUNTRY AND MAKES US LESS SAFE!

Three Editorials in today’s Washington Post emphasize the extremely counterproductive nature of Trump’s response to the NY terrorist attack.

First, on his inappropriate attempt to blame immigrants for the incident:

“IN LOWER MANHATTAN on Tuesday, not far from the memorial to the 9/11 attack on the World Trade Center, eight people were killed and 12 injured when a man espousing fidelity to the Islamic State drove a rented pickup down a busy bike path along the Hudson River. “It was gruesome. It was grisly. It was surreal,” one witness said of bicyclists and pedestrians being mowed down. The attack on innocent people enjoying a fine autumn day was a chilling reminder of the persistent threat posed to the United States by Islamist extremists — and their ingenuity in finding ways to commit murder.

Some small comfort can be taken in the fact that in the 16 years since the fall of the twin towers, improvements in protecting the homeland and fighting terrorism abroad have lessened the terrorists’ strength to strike and improved our ability to respond. The quick actions of police and other first responders during Tuesday’s tragedy should be applauded. So must the resilience and strength of the people of New York City, who made clear they will not be cowed by fear.

Far less inspiring — indeed, downright dispiriting — was the reaction of President Trump. In a series of tweets that apparently were informed (a word we use loosely) by his viewing of “Fox & Friends,” Mr. Trump went on a harangue about immigration and attacked Senate Minority Leader Charles E. Schumer (D-N.Y.). On Wednesday, Mr. Trump signaled he might upend the judicial process by declaring the suspected attacker an enemy combatant to be shipped off to the Guantanamo Bay prison; federal terrorism charges filed against him later in the day likely would foreclose that from happening. Note that the White House wouldn’t discuss gun control after last month’s mass shooting in Las Vegas, on the grounds that it would politicize a tragedy, but it had no problem launching partisan attacks following a terrorist strike that ought to unify all Americans. Note also, as The Post’s Philip Bump pointed out, that Mr. Trump is quick to jump to conclusions when there are incidents involving immigrants but is far more circumspect when nonimmigrants are involved.

What’s really needed from the Trump administration is not blame-shifting but a serious attempt to investigate and learn from this latest attack. Were others involved or aware of the alleged plans dating back a year that went into the attack? Are authorities right in their initial assessment that the suspect became “radicalized domestically” while living in the United States? Were signals missed when he appeared on the radar of law enforcement in connection with the investigations of other suspects? The 29-year-old, authorities said, allegedly “followed almost exactly to a T” instructions that the Islamic State has put out on its social-media channels on how to carry out attacks. So what can be done to detect and deter other would-be followers?

Among those killed Tuesday were five Argentines who were part of a group of school friends who traveled to New York to celebrate the 30th anniversary of their high school graduation. It was their dream trip to a city known for being open and generous and diverse. Those are the traits that make America great; to undermine them in response to Tuesday’s attack only plays into the hands of terrorists.”

“PRESIDENT TRUMP, ever prone to seek out scapegoats, fastened on a new target in the wake of the terrorist attack in New York: the state’s senior Democratic senator, along with a 27-year-old visa program that offers applicants from dozens of countries a shot at immigrating to the United States.

Mr. Trump singled out Sen. Charles E. Schumer, who, in 1990, sponsored the diversity visa program, through which the alleged attacker in New York, Sayfullo Saipov, is reported to have immigrated to the United States from his native Uzbekistan. In a tweet, the president derided the program as “a Chuck Schumer beauty.”

Never mind that Mr. Schumer’s legislation establishing the program attracted bipartisan support; or that it was signed into law by President George H.W. Bush, a Republican; or even that Mr. Schumer himself unsuccessfully bargained to end the program, in 2013, in return for a bill granting legal residence to millions of undocumented immigrants already in the United States. Neither the facts nor the normal political imperative to avoid partisanship in the wake of a terrorist attack appeared to move Mr. Trump.

His tweet made it appear that his overriding interest in an assault allegedly backed by the Islamic State is to use it to assail immigration — in this instance, a legal program whose beneficiaries represent a speck in the overall number of immigrants. Managed by the State Department since 1995, the program now grants up to 50,000 visas annually, via a random lottery, to citizens of dozens of countries who would otherwise be mostly overlooked in the annual influx of green-card recipients. In recent years, many of the winners have been from Africa and Eastern Europe.

Having reaped political advantage as a candidate in vilifying illegal immigrants, Mr. Trump has set his sights in office on legal migrants, including refugees, from a handful of mostly Muslim countries, whom he’d like Americans to see as an undifferentiated mass of potentially violent interlopers. Gradually, he is chipping away at what was once a national consensus that immigrants are a critical source of vitality, invention and international appeal.

Like almost any immigration program, the diversity visa lottery is imperfect and susceptible to abuse. The fortunate winners, who represent less than 1 percent of those who have applied annually in recent years, are not uniformly equipped to thrive in this country; many lack an education beyond high school. As Mr. Saipov may turn out to prove, even the extensive vetting required of all who immigrate through the program does not provide an ironclad guarantee that it is impervious to applicants who might seek to harm the United States.

The lottery program might be improved. Still, the fact that more than 11 million people applied for it in fiscal 2016 reflects the magnetic appeal the United States continues to exert around the world. Satisfying a small fraction of that demand, through the lottery or some other legal means, is a powerful tool of public diplomacy in countries whose citizens might otherwise have no hope of coming here.”

“Asked about the suspect Wednesday, President Trump called him an “animal.” Prompted to say whether he thought Saipov should be sent to the detention facility at Guantanamo Bay, Cuba, Trump said, sure, he’d consider it. Later, at Wednesday’s White House press briefing, Sarah Huckabee Sanders said flatly that the White House considered the suspect an “enemy combatant.”

The president also said yesterday that the American justice system (presumably including his own Justice Department) is a “joke” and a “laughingstock.” He further opined, “We also have to come up with punishment that’s far quicker and far greater than the punishment these animals are getting right now,” Trump said. Thankfully, the Justice Department, like the Pentagon, has learned when to ignore Trump. On Wednesday, Saipov was charged in federal court. By Thursday morning, Trump was backing off his support for sending Saipov to Guantanamo. Once again, the ignorant president shot from the hip and had to creep back to reality.

Just how harmful were Trump’s statements? It is reprehensible for the president to defame our justice system, which is not a “joke” nor a “laughingstock” but the envy of the world. Moreover, in the terrorist context, it has proved remarkably efficient in trying and convicting terrorists, and then handing out maximum punishments. The surviving Boston Marathon bombing defendant was convicted in just this way and sentenced to death.

Having spent a professional lifetime working on immigration and refugee issues, I can confirm that Trump and his GOP “restrictionist cronies” like Sessions, Miller, and Bannon have managed to transform what used to be “a national consensus that immigrants [and particularly refugees] are a critical source of vitality, invention and international appeal” into a highly partisan and racially-charged attack on the national origins and futures of some of our most productive citizens and residents — those who far more than Trump or his cronies are likely to help us in building a better, safer future for all Americans.

Having worked on all sides of our U.S. Justice System, served as an administrative judge on the trial and appellate levels for more than 21 years, listened to and/or read thousands of accounts of what made people leave their “home countries,” and studied in detail the reasons why some failing countries are “senders” of talented migrants and others, like the U.S., are fortunate enough to be on the “receiving” end, I can say unequivocally that the fairness of our justice system and the overall honsety and integrity of civil servants in the U.S. Government are the primary differences between the “sending” and “receiving” countries, like ours.

As I have observed before, Trump and his cronies are launching what is basically a “Third-World autocratic attack” on our Constitution and our democratic institutions. If they succeed, the immigration “problem” might eventually be “solved” because nobody will want to come here any more. How many people risked their lives trying to get into the former Soviet Union?
Donald Trump, his cronies, and his enablers are and will remain a much greater threat to our safety and Constitutional institutions than any foreign terrorist could ever be. We ignore his dangerous and fundamentally un-American rants at our own peril!

“With eyes wide open, Mike Pence eagerly auditioned for the role as Donald Trump’s poodle. Now comfortably leashed, he deserves the degradations that he seems too sycophantic to recognize as such. He did Trump’s adolescent bidding with last Sunday’s preplanned virtue pageant of scripted indignation — his flight from the predictable sight of players kneeling during the national anthem at a football game. No unblinkered observer can still cling to the hope that Pence has the inclination, never mind the capacity, to restrain, never mind educate, the man who elevated him to his current glory. Pence is a reminder that no one can have sustained transactions with Trump without becoming too soiled for subsequent scrubbing.

A man who interviewed for the position Pence captured, Sen. Bob Corker (R-Tenn.), is making amends for saying supportive things about Trump. In 2016, for example, he said he was “repulsed” by people trying to transform the Republican National Convention from a merely ratifying body into a deliberative body for the purpose of preventing what has come to pass. Until recently, Corker, an admirable man and talented legislator, has been, like many other people, prevented by his normality from fathoming Trump’s abnormality. Now Corker says what could have been said two years ago about Trump’s unfitness.

The axiom that “Hell is truth seen too late” is mistaken; damnation deservedly comes to those who tardily speak truth that has long been patent. Perhaps there shall be a bedraggled parade of repentant Republicans resembling those supine American communists who, after Stalin imposed totalitarianism, spawned the gulag, engineered the Ukraine famine, launched the Great Terror and orchestrated the show trials, were theatrically disillusioned by his collaboration with Hitler: You, sir, have gone too far.

Trump’s energy, unleavened by intellect and untethered to principle, serves only his sovereign instinct to pander to those who adore him as much as he does. Unshakably smitten, they are impervious to the Everest of evidence that he disdains them as a basket of gullibles. He understands that his unremitting coarseness satisfies their unpolitical agenda of smashing crockery, even though his self-indulgent floundering precludes fulfillment of the promises he flippantly made to assuage their sense of being disdained. He gives his gullibles not governance by tantrum, but tantrum as governance.

With Trump turning and turning in a widening gyre, his crusade to make America great again is increasingly dominated by people who explicitly repudiate America’s premises. The faux nationalists of the “alt-right” and their fellow travelers such as Stephen K. Bannon, although fixated on protecting the United States from imported goods, have imported the blood-and-soil ethno-tribalism that stains the continental European right. In “Answering the Alt-Right” in National Affairs quarterly, Ramon Lopez, a University of Chicago PhD candidate in political philosophy, demonstrates how Trump’s election has brought back to the public stage ideas that a post-Lincoln America had slowly but determinedly expunged. They were rejected because they are incompatible with an open society that takes its bearing from the Declaration of Independence’s doctrine of natural rights.

With their version of the identity politics practiced by progressives, alt-right theorists hold that the tribalism to which people are prone should not be transcended but celebrated. As Lopez explains, the alt-right sees society as inevitably “a zero-sum contest among fundamentally competing identity groups.” Hence the alt-right is explicitly an alternative to Lincoln’s affirmation of the Founders’ vision. They saw America as cohesive because of a shared creed. The alt-right must regard Lincoln as not merely mistaken but absurd in describing America as a creedal nation dedicated to a “proposition.” The alt-right insists that real nationhood requires cultural homogeneity rooted in durable ethnic identities. This is the alt-right’s alternative foundation for the nation Lincoln said was founded on the principle that all people are, by nature, equal.

Trump is, of course, innocent of this (or any other) systemic thinking. However, within the ambit of his vast, brutish carelessness are some people with sinister agendas and anti-constitutional impulses. Stephen Miller, Bannon’s White House residue and Trump’s enfant terrible,recently said that “in sending our [tax reform] proposal to the tax-writing committees, we will include instructions to ensure all low- and middle-income households are protected.” So, Congress will be instructed by Trump’s 32-year-old acolyte who also says the president’s national security powers “will not be questioned.” We await the response of congressional Republicans, who did so little to stop Trump’s ascent and then so much to normalize him.”

Leave it to Trump and his White Nationalist gang to have me agreeing with George Will, something that rarely happened in the pre-Trump era. But, the folks who perpetrated this mess are our fellow citizens who voted for Trump notwithstanding his clearly established philosophy of sowing and pandering to hate, incompetence, and his glaring unsuitability for any public office. And, too many of those “core supporters” are still out there, coarsely and ignorantly screaming their approval for an Administration that is destroying America, and endangering the lives, rights, and human dignity of many of their fellow Americans, one day at a time.

“When rapid immigration and terrorist attacks occur simultaneously — and the terrorists belong to the same ethnic or religious group as the new immigrants — the combination of fear and xenophobia can be dangerous and destructive. In much of Europe, fear of jihadists (who pose a genuine security threat) and animosity toward refugees (who generally do not) have been conflated in a way that allows far-right populists to seize on Islamic State attacks as a pretext to shut the doors to desperate refugees, many of whom are themselves fleeing the Islamic State, and to engage in blatant discrimination against Muslim fellow citizens.

But this isn’t happening only in European countries. In recent years, anti-immigration rhetoric and nativist policies have become the new normal in liberal democracies from Europe to the United States. Legitimate debates about immigration policy and preventing extremism have been eclipsed by an obsessive focus on Muslims that paints them as an immutable civilizational enemy that is fundamentally incompatible with Western democratic values.

Yet despite the breathless warnings of impending Islamic conquest sounded by alarmist writers and pandering politicians, the risk of Islamization of the West has been greatly exaggerated. Islamists are not on the verge of seizing power in any advanced Western democracy or even winning significant political influence at the polls.

The same cannot be said of white nationalists, who today are on the march from Charlottesville, Va., to Dresden, Germany. As an ideology, white nationalism poses a significantly greater threat to Western democracies; its proponents and sympathizers have proved, historically and recently, that they can win a sizable share of the vote — as they did this year in France, Germany and the Netherlands — and even win power, as they have in the United States.

Far-right leaders are correct that immigration creates problems; what they miss is that they are the primary problem. The greatest threat to liberal democracies does not come from immigrants and refugees but from the backlash against them by those on the inside who are exploiting fear of outsiders to chip away at the values and institutions that make our societies liberal.

Anti-Semitic and xenophobic movements did not disappear from Europe after the liberation of Auschwitz, just as white supremacist groups have lurked beneath the surface of American politics ever since the Emancipation Proclamation. What has changed is that these groups have now been stirred from their slumber by savvy politicians seeking to stoke anger toward immigrants, refugees and racial minorities for their own benefit. Leaders from Donald Trump to France’s Marine Le Pen have validated the worldview of these groups, implicitly or explicitly encouraging them to promote their hateful opinions openly. As a result, ideas that were once marginal have now gone mainstream.”

“I never expected to speak the phrase: “As Mississippi goes, so goes the federal government.” But when it comes to demeaning and disempowering LGBT, it is now apropos.

The self-righteous drive to make others suffer for not living Evangelical beliefs appears to be unstoppable with Trump in power and with Sessions as his henchman for civil rights. They are taking their cues from the Deep South and particularly Mississippi.

Mississippi is the national leader on religiously-motivated discrimination against LGBT and generating divisiveness on these issues, as I discussed here.

Mississippi continues to aspire to fomenting the most discrimination against LGBT with HB 1523, which explicitly permits business owners to refuse service to LGBT for religious reasons. The trial court correctly held that it was unconstitutional and issued a preliminary injunction.

In June, the Fifth Circuit let the law go into effect, holding that the challengers lacked standing. On further review, the Fifth Circuit refused to vacate the ruling, which let the law stand. Now perhaps it goes to the Supreme Court.

Its sponsors put it into place so that Evangelicals can legally exclude LGBT from the marketplace. They say it’s about their “religious liberty,” by which they mean not the right to observe their own practices, but rather their supposed right to judge and condemn others before doing business with them.

The whole anti-LGBT project is so unbelievably hypocritical: they aren’t fighting to bar liars, adulterers, rapists, or pedophiles from their businesses, all of whom who violate plain biblical commands.

What they are engineering is lives without having to associate with “those people.” One can only hope that good, old-fashioned profit motives enrich those businesses that provide service to LGBT and put out of business those who prefer the Jim Crow life.

Trump Administration Follows Mississippi’s Lead

Now, Attorney General Jeff Sessions has piled onto this administration’s obsession with humiliating and harming transgender Americans here and here with a new document interpreting federal law to require accommodation of those in the government who believe LGBT are sinful.

That’s right, the drive is to accommodate the ones who cannot tolerate those who aren’t like them. This is all about deconstructing the LGBT civil rights the Obama administration put into place as discussed here and here.

For good measure, the administration is also rolling back protections intended to ensure LGBT are not discriminated against in long-term care facilities. (The administration also went after women’s rights to contraception as fellow columnist Joanna Grossman explains, again an issue where it is in lock step with Evangelical lobbyists.)

Where Did This Intolerance Come From?

The push to inflict exclusion and suffering on LGBT for religious reasons owes its origins to the working out of the Religious Freedom Restoration Act in American culture. Whether you have read Hegel or Calvin, this is what happens when you put into place a “right” that has no natural limit.

The religious lobbyists, including knowing conservatives and some truly naïve liberals, backed this benighted law in 1993. It was declared unconstitutional in 1997 in Boerne v. Flores, because it was so far removed from anything that the First Amendment had ever required .

What was unleashed with this federal statute, which morphed into state laws and later federal law, was a theory that the default position for religious liberty should be that a religious believer has a right to overcome any law that burdens religiously-motivated conduct.

Many laws exist to protect the vulnerable. When religious believers seize a “right” to trump the law, they in effect hurt the vulnerable. That is true here.

This power grab—particularly by religious organizations who believe in imprinting their beliefs on the culture—paved the way for the depraved arguments now being made for “religious liberty” that amount to exclusion and harm to an entire category of citizens defined solely by their sexual orientation. They have falsely claimed the mantle of victimhood while making victims of others.

The powerful choose the labels and the vulnerable suffer. If you have not seen this power maneuver elsewhere in history or in the Trump Administration’s dealings with race, you are not paying attention.

While the Evangelical right wages a bogus war against the non-existent “Sharia law in America,” the real threat to our freedoms, our Constitution, and the rule of law is posed by these very same right wingers. Led by folks like Gonzo who have moved from the “wacko fringe” to positions of power, they are forcing their false interpretation of Christianity down the throats of the rest of us who don’t share their “Gospel of Hate & Intolerance.”

From a theological standpoint (after all, it is Sunday), Jesus’s ministry was not to the rich, powerful, rulers, or Pharisees enforcing the Jewish Law; no, Jesus’s ministry was one of love, compassion, forgiveness, and eternal hope  for the outsiders, the outcasts, the poor, and the “rejected” of Jewish and Roman society. If Jesus were among us today, he would much more likely be found “rubbing shoulders” and preaching to the gay community or the undocumented than he would wandering the halls of Jeff Sessions’s Department of (In)Justice.
