JENNIFER RUBIN IN WASHPOST: “Trump’s Most Evil Act” — “an act of uncommon cowardice.”

Rubin writes in her “Right Turn” column:

“First, let’s not think Trump — who invites cops to abuse suspects, who thinks ex-sheriff Joe Arpaio was “doing his job” when denying others their constitutional rights and who issued the Muslim ban — cares about the Constitution (any of the “twelve” articles). Trump says, “We love the dreamers. … We think the dreamers are terrific.” But in fact he loves the applause he derives from his cultist followers more than anything. Otherwise he’d go to the mat to defend the dreamers and secure their legal status.

. . . .

No, if Trump cancels DACA, it will be one more attempt to endear himself to his shrinking base with the only thing that truly energizes the dead-enders: vengeance fueled by white grievance. And it will also be an act of uncommon cowardice. (“Should Trump move forward with this decision, he would effectively be buying time and punting responsibility to Congress to determine the fate of the Dreamers,” writes The Post.) Dumping it into the lap of the hapless Congress, he can try evading responsibility for the deportation of nearly 800,000 young people who were brought here as children, 91 percent of whom are working. (And if by chance Congress should save DACA, it will be Trump who is the villain and they the saviors, an odd political choice for a president who cares not one wit about the party.)

As for Congress, House Speaker Paul Ryan, who talks about sparing the dreamers, will be sorely tested to overcome the objections of the hard-line anti-immigrant voices in his conference. Does he have the nerve to bring to the floor a bill that lacks majority support among Republicans? Tie it to a must-pass bill (e.g., Harvey funding, the debt ceiling, funding for the government)? In the Senate, will opportunistic right-wingers such as Sen. Tom Cotton (R-Ark.) grandstand, perhaps filibustering a measure into order to out-Trump Trump?

However this turns out, the GOP under Trump has defined itself as the white grievance party — bluntly, a party fueled by concocted white resentment aimed at minorities. Of all the actions Trump has taken, none has been as cruel, thoughtless or divisive as deporting hundreds of thousands of young people who’ve done nothing but go to school, work hard and present themselves to the government.

The party of Lincoln has become the party of Charlottesville, Arpaio, DACA repeal and the Muslim ban. Embodying the very worst sentiments and driven by irrational anger, it deserves not defense but extinction.”

“Cowardice” is the hallmark of an Administration that glories in picking on and bullying the poor, the most vulnerable, minorities of all types, and even our foreign allies whose help and support we need. And, the GOP has firmly established itself as the party of cowards.

Trump’s glaring character flaws, naked prejudices, and obvious unsuitability for office, by nature of lack of knowledge, lack of experience, and lack of Presidential temperament, have been out there on display for all to see since the day he announced his candidacy. Yet, notwithstanding some “tisk-tisking” by a few “old timers,” the GOP again and again has in the end united behind Trump and his divisive agenda, preferring to flounder around attempting to govern within its own unruly caucus rather than reaching across the aisle to the Democrats (who, after all, did get the majority of the Presidential votes cast) to form a “union of the middle” to govern the country in a responsible, bi-partisan manner in the absence of Executive competence.

Yes, that would mean sacrificing large parts of the rightist “GOP agenda” in favor of saving the country from Trump’s excesses. But, it’s pretty clear by now that the “GOP agenda” is not going to be enacted into law any time soon anyway. So, why not just do something decent for a change and see how it plays out?

SPORTS: FEEL GOOD STORY OF THE WEEKEND: Behind “Mini-Cam,” Howard Bison Pull Off Biggest Upset In NCAA FB History — Visiting 45-Point Underdogs From DC Stun UNLV 43-40 In Sin City!

He was speaking matter-of-factly, in a cramped office, before an early-season practice. He hadn’t even been named the school’s starter yet, although he was confident that moment would arrive. But Newton seemed absurdly certain that his new school — which he selected after not getting offers from any Power-5 programs — was ready to take off, and soon.

Newton later became the starter, and his first game went far beyond any rational preseason rhetoric. The Bison, 40-some point underdogs at UNLV, pulled off one of the biggest upsets in the history of the sport late Saturday night, a 43-40 road win in Coach Mike London’s first game that will completely upend all expectations at the D.C. school.

Longtime Vegas analyst RJ Bell said Howard’s win was the biggest upset in college football history, noting that a $100 bet on the Bison to win outright would have paid out an astounding $55,000. The Associated Press confirmed that it was indeed the largest upset in college football history based on point spreads, topping Stanford’s win over USC as a 40-point underdog in 2007. And Howard was actually paid $600,000 for the honor of beating UNLV, according to USA Today, which reported that “Howard had to arrange for its band and cheerleaders to arrive in Las Vegas by noon the day before the game to participate in various events” to receive the full guarantee.”

DERELICTION OF DUTY! — Sessions’s DOJ Is MIA In Vindicating Public’s Constitutional Rights To Freedom From Police Brutality — State Of IL Forced To Do Feds’ Job For Them!

The Washington Post says in an editorial today:

“IN JANUARY, an investigation by the Justice Department found that the Chicago Police Department routinely used excessive force against the city’s residents, often along racial lines and without accountability. That report recommended federal court oversight of the Chicago police to prevent further abuses. Now, almost nine months later, a federal judge is set to begin supervising the process of reforming Chicago’s police.

But the city of Chicago won’t be working with the Justice Department. Instead, it’s Illinois Attorney General Lisa Madigan who is bringing the lawsuit to begin negotiations on a federal court decree for police oversight.

The state of Illinois is filling the hole left by Attorney General Jeff Sessions, under whose leadership the Justice Department pulled back from its agreement to negotiate with Chicago to find a mutually agreeable model for court supervision of the city’s police. After months, nothing came of Chicago Mayor Rahm Emanuel’s efforts to find a solution with the Justice Department outside the courts. Now, Mr. Emanuel — who has been reluctant to embrace judicial oversight of Chicago police — has pledged to partner with Ms. Madigan to achieve reform under the watchful eye of a judge.

Chicago is one of several cities left behind by Mr. Sessions’s emphasis on fighting crime over working with unsettled police departments in need of reform — as if protecting civil rights and public safety were somehow incompatible. Two months into his time as attorney general, Mr. Sessions issued a memorandum directing his deputies to review oversight agreements reached by the Obama administration with police departments found to have systematically violated civil rights. The Justice Department then tried to delay an agreement finalized by Obama officials from going into effect in Baltimore, over the objections of the police department itself — only to be rebuked by the judge who gave the reform plan his approval. And recently, the department’s Community Oriented Policing Services Office (COPS) has reportedly failed to provide assessments requested by at least seven local police departments that reached out for help with reform.”

Get this! While Gonzo Apocalypto is out spreading his knowingly false narrative about how nannies, gardeners, drywallers, carpenters, health care workers, fast food workers, students, soccer players, and emergency response personnel are threats to the public safety (not surprisingly, a tough sell in many diverse communities that depend on migrant labor and ethnic community participation without regard to legal status) and misusing statistics and anecdotes to support the Trump Administration’s bogus case that local police need tanks and other combat type military equipment to protect the public, the real law enforcement duties of the DOJ are going by the board. Nowhere is this more true than in the area of civil rights and voting rights, where the DOJ is actually working with some states and localities to undermine Americans’ constitutional rights. But, the Department’s “turn back the clock” approach to drug enforcement, prison reform, sentencing reform, forensic science, and community policing is also “built to fail” and deserves censure.

Then, there is the massive failure of justice in the overwhelmed U.S. Immigration Courts. Rather than setting forth a rational plan to restore due process and functionality by reducing dockets, providing more and better training for judges, hiring additional law clerks, closing down “kangaroo courts” in detention centers, giving judges control of individual dockets, implementing statutory contempt authority for judges, establishing a merit-based hiring system that promotes a diverse judiciary, putting resources into technology including e-filing, and making EOIR functionally independent from the DOJ’s political influence and the President’s immigration enforcement initiatives, Sessions has sent a “just peddle faster” message to Immigration Courts that are already peddling so fast that they are careening out of control. The DOJ’s handling of the U.S. Immigration Courts is a national disgrace that will come back to haunt the entire justice system unless or until Coongress or the Article III Courts call a halt!

And Jeff “Gonzo Apocalypto” Sessions is a key part of the problems that his White Nationalist agenda can never solve and, indeed, will continue to aggravate while he holds office.

Lizandro Claros Saravia was supposed to be at college in North Carolina by now. At soccer practice. At the library.

Instead, the 19-year-old soccer star from Germantown, Md., is hundreds of miles away, in a sweltering Central American nation he barely recognizes and sometimes fears.

U.S. immigration officials swiftly deported him and his older brother, Diego, on Aug. 2, days after Lizandro told them during a routine check-in that he had a scholarship to attend Louisburg College.

“I don’t know what we’re going to do,” Lizandro, his gaze flat, said in an interview here last week as he and his brother waited to pick up their 83-year-old grandfather — who had been visiting the United States on a visa when his grandsons were deported — from the airport. “I feel like in this country, I don’t have a future.”

The expulsion of the brothers, both of whom graduated from Quince Orchard High School in Gaithersburg and neither of whom had been accused of any wrongdoing once in the United States, outraged Democratic lawmakers and advocates for immigrants, as well as their teachers, friends and teammates.

Lizandro and Diego, now 22, used fraudulent visas and passports to come to the United States in 2009 and reunite with their family; some of whom were also here illegally. Lizandro was 10, according to Immigration and Customs Enforcement; his brother was 14.

They were ordered deported in 2012 and granted a stay in 2013. Two subsequent requests for stays were denied. But with their clean records and high school diplomas, the brothers were not a priority for deportation under the Obama administration.

Under President Trump, however, the “handcuffs” are off, in the words of ICE Acting Director Thomas Homan. Anyone in violation of immigration law can be targeted for deportation. Officials say that they want to reduce the United States’s population of undocumented immigrants, currently about 11 million, and dissuade would-be migrants from making the illegal, and sometimes deadly, journey north.

Critics say that the Trump administration’s approach is robbing the United States of talented and dedicated immigrants, and endangering Americanized young people by sending them to their now-unfamiliar homelands without their families.

Rep. John Delaney (D-Md.) blasted ICE for deporting the brothers to El Salvador, which he called one of the “most violent countries in the world.” Montgomery County Executive Isiah Leggett (D) said “ICE should be ashamed of itself.”

Lizandro’s teammates at the Bethesda Soccer Club — he calls them his “brothers” — have taken up a collection in hopes of helping him someday realize his dream to become the first in his family to earn a college degree.

The brothers say they miss everyone from their lives in Maryland, especially their parents and two siblings, friends and the staff at the Guapo’s — a restaurant where they had family dinners — just off I-270 in Gaithersburg. They don’t go out much now because they don’t think it is safe.

Instead, they stay in their new home, a pair of neighboring dwellings that Lizandro and Diego share with their aunts and uncle in a village of roughly 1,000 people outside of Jucuapa. Last year, Reuters cited that city as a place where the coffin-making business has taken off, partly fueled by the high homicide rates.

The rules are that Lizandro and his brother stay in constant touch with their aunts and uncle, unless they all travel somewhere together. At night, they sleep in one of their aunt’s houses, with bars on the windows and guard dogs at the door.

The brothers say they are trying to blend into their new country, but they clearly stand out. At the airport this week, they towered over the crowd, dressed as if they’d been plucked from an American shopping mall.

Diego wore a T-shirt emblazoned with the initials “USA.” Lizandro wore Top-Siders, shorts and a shirt decorated with tiny sunglasses. He speaks English better than Spanish. He wouldn’t recognize the president of El Salvador if he saw him on the street.

“To be honest, I don’t feel good being here,” he said. “People are looking at me different. . . . All my friends from when I was young, they barely know me now.”

Asked about the possibility of going to college in El Salvador, Lizandro said, “I don’t know if I can do that here. It’s hard to go from the bottom all the way to the top again.”

If there is any good news here, it’s that “ordinary folks” in American communities are being exposed to and personally affected by the wastefulness and mindless cruelty of the current U.S. immigration laws. Hopefully, at some point in the future, this will result in the individuals who advocate, perpetuate, and maintain this system (in some cases actually trying to make it even worse) being tossed from office and replaced with more rational legislators and executives who have both human decency and America’s long term best interests in mind. Perhaps not likely in my lifetime. But, eventually, if the U.S. is to survive, it must happen.

“MIAMI — In the seven months since Thomas Homan was appointed to carry out President Trump’s promises to crack down on undocumented immigrants living in the U.S., he has been accused of abusing that power by targeting undocumented immigrants without criminal records.

So far, the data seems to back up those accusations, with the percentage of undocumented immigrants without a criminal record arrested by Immigration and Customs Enforcement (ICE) agents increasing each month, from 18% in January to 30% in June.

But Homan, a 33-year law enforcement veteran who has worked along the southern border and is now the acting director of ICE, doesn’t shy away from those numbers. In fact, he said they’re only the start.

“You’re going to continue to see an increase in that,” Homan told USA TODAY during a visit to Miami on Wednesday.

Homan has become the public face of Trump’s efforts to crack down on illegal immigration, a central theme of his presidential campaign and one of the few areas where he’s been able to make wholesale changes without any help from Congress.

Under President Obama, ICE agents were directed to focus their arrests on undocumented immigrants who had been convicted of serious crimes, were members of gangs or posed a national security threat.

Trump and his Department of Homeland Security have vastly expanded that pool, ordering agents to focus on undocumented immigrants who have only been charged with crimes and allowing them to arrest any undocumented immigrant they happen to encounter.

ICE agents are also targeting undocumented immigrants who have been ordered removed from the country by a federal judge — a group that the Obama administration largely left alone. And they’re targeting people who have illegally entered the country more than once, which raises their actions to a felony.”

Using that new metric, Homan said 95% of the 80,000 undocumented immigrants they’ve arrested so far fall under their newly-defined “priority” categories.

“That’s pretty close to perfect execution of the policies,” Homan said. “The numbers speak for themselves.”

As noted in both the USA Today article and Sacchetti’s article, criminal deportations are actually down under the Trump/Homan regime. Overall removals are also down, The difference has been made up by deporting non-criminals. Most of these are good folks, contributing to America, many with jobs providing services we need, and with U.S. families who depend on them. They are being sent to some of the most dangerous countries in the world.

Picking up many of them up took no particular skill or effort; they voluntarily showed up for periodic check-ins with DHS, were taken into custody, and removed with no rationale, other than “because we can.” For others, “due process” consisted of “final orders” issued “in absentia,” perhaps with no notice or other legal defects.

And, the only reason Homan and his minions have been able to achieve 95% of the goals, was by a mindless redefining of the “priorities” to include virtually anyone. That’s a rather lame definition of “success,” even by DHS terms.

Sure, the real problem here is Congress and the failure to enact reasonable immigration reform combined with the voters who put Trump’s xenophobic regime in power. But, that doesn’t necessarily give a “free pass” to guys like Homan who have the knowledge and experience, but fail to use it to stand up for human decency and the best interests of our country.

WASHINGTON POST: VOTING RIGHTS ARE THE CIVIL RIGHTS ISSUE OF OUR AGE — AS USUAL, JEFF SESSIONS IS SQUARELY ON THE WRONG SIDE OF HISTORY!

“Yet even if all 1,500 Confederate symbols across the country were removed overnight by some sudden supernatural force, the pernicious crusade to roll back voting rights would continue apace, with voters of color suffering its effects disproportionately. Pushing back hard against those who would purge voter rolls, demand forms of voter ID that many Americans don’t possess, and limit times and venues for voting — this should be a paramount cause for the Trump era.

In statehouse after statehouse where Republicans hold majorities, the playbook is well established, and the tactics are becoming increasingly aggressive.

Mr. Trump’s voter fraud commission is at the vanguard of this crusade, and the fix is in. Its vice chairman, Kris Kobach, is the nation’s most determined, litigious and resourceful champion of voter suppression. Under his tutelage, the commission is likely to recommend measures whose effect will be that new obstacles to voting would be taken up in state legislatures. Millions of voters are at risk of disenfranchisement from this effort, and the knock-on effects of such a mass act of disempowerment are dizzying.

 

The events in Charlottesville and the president’s apologia for the right-wing extremists there should mobilize anyone passionate about civil rights. There would be no better target for their energies than the clear and present danger to the most fundamental right in any democracy: the vote.”

HISTORY: CONFEDERATE MONUMENTS HAVE LITTLE TO DO WITH THE REAL HISTORY OF THE CIVIL WAR (IN FACT, THEY WERE EXPRESSLY INTENDED TO DISTORT HISTORY) BUT LOTS TO DO WITH PROMOTING WHITE SUPREMACY!

Two very powerful stories in today’s Washington Post Outlook Section make that point.

In the first, Karen Finney, journalist and bi-racial descendent of General Lee:

“I always fiercely disagreed with my grandmother’s take. I loved her, but recognized that she simply couldn’t face the truth — the dramatically different, and all too real stories of brutal tyranny, courageously endured, during Reconstruction and the Jim Crow South that I learned from my father, his family and my own experience.

No telling of Lee’s story, however complicated, can be separated from the leading role he played in a grievous chapter of American history. That part — and the decisions by Charlottesville’s city council, New Orleans’s mayor, Baltimore’s mayor and Lexington, Kentucky’s mayor to remove Confederate statues from public spaces — isn’t complicated. The general was as cruel a slave owner as any other and fought to defend a society based on the brutal enslavement of black people that, had it persisted until today, would have included me. His cause wasn’t righteous, then or now. He’s my ancestor, but as far as I’m concerned, his statues can’t come down soon enough.

The revisionist version of his story attached to the hundreds of Confederate monuments around the country (not just in the South) is part of the most effective rebranding campaign ever implemented. Like the Lee statue at the center of the tragic, deadly violence in Charlottesville on Saturday, many, if not most, of these monuments were built — not in the immediate aftermath of the Civil War — but decades later, in the 20th century. They were erected to advance a dishonest history that claimed the war was about states’ rights and the preservation of a way of life, and to obscure the real cause at the root of the conflict: the perpetuation of white supremacy and economic hegemony through the enslavement and violent suppression of African Americans. It’s propaganda that has exploited fear, and sown division and hate, in a conscious effort to obscure our shared humanity for more than 150 years.”

In the second, Professor Karen L. Cox of UNC-Charlotte points out that: “White supremacy is the whole point of confederate statutes:”

“While Confederate monuments honor their white heroes, they do not always rely on the true history of what took place between 1861 and 1865. Nor was that their intent. Rather, they served to rehabilitate white men — not as the losers of a war but, as a monument in Charlotte states, preservers of “the Anglo-Saxon civilization of the South.”

Today’s defenders of Confederate monuments are either unaware of the historical context or do not care. Like generations of whites before them, they are more invested in the mythology that has attached itself to these sentinels of white supremacy, because it serves their cause.”

“But Trump’s behavior shows, unfortunately, how right I was two weeks ago when I wrote that he’s making a classic business mistake — by surrounding himself with flunkies who kiss up to him and by not listening to the handful of strong subordinates whom he’s appointed.

If you’re a competent chief executive, you try to surround yourself with competent subordinates who don’t shrink from telling you when they think you’re wrong. You put them in a room and let them duke it out. And if you’re smart, you pay attention to what they say, because you’re secure enough to realize that they may know more about certain things than you do.

As we’ve seen from Charlottesville, Trump isn’t remotely like that.

As a business columnist, I know that I’m expected to write how some CEOs bailed on two presidential advisory committees that Trump created. And how Trump, true to form, disbanded the committees and embarrassed the CEOs who had stood by him, just so he could claim to get the last word.

But when it comes to analyzing the big picture, which is what I’m trying to do here, the advisory committees debacle isn’t even a rounding error. What really matters is that Trump is exhibiting the same behavior that led businesses he controlled into six Chapter 11 bankruptcies (which is why I call him Donald 66 Trump) as his casino-real estate empire collapsed in the 1980s and 1990s.

But that’s just business. What makes me truly angry about Donald 66 — who, like me, has Jewish children and grandchildren — is that he can’t be bothered to defend his own family. Unbelievable, isn’t it? But true.

It’s inconceivable to me that Trump, whose daughter Ivanka joined the Jewish people, married a Jew and has produced three Jewish grandchildren, can’t bring himself to tweet (let alone say) that he has a problem with a crowd chanting “Jew will not replace us.” Or with them chanting “Heil, Trump”— the Nazi salute — while wearing Trump gear.

What is wrong with this man? You can argue politics and taxes and health care and other bones of contention 100 different ways. But for God’s sake — pun intended — Trump isn’t even defending members of his own family, two of whom are among his closest advisers, against religious bigotry.

I’m especially sensitive to this because I’m an American who’s Jewish. Please note that “American” comes first; I loathe identity politics. Trump and I are from the same generation. I know, as Trump must know, what the Nazis were about. One of the many reasons that I love this country is that without America, I think the Nazis would have won World War II and murdered every Jew on Earth.

 

It’s one thing for Trump to use “America First” — a phrase that evokes 1930s Nazi sympathizers like Charles Lindbergh (a onetime aviation hero) and Father Charles Coughlin (the “radio priest” from Royal Oak, Mich., who spewed hate, was finally silenced by the pope, and whose Shrine of the Little Flower I passed twice daily during my first year at the Detroit Free Press). I’ll give Trump the benefit of the doubt on that one, and say he didn’t know what “America First” evoked before he started using it.

But for Trump to not tweet that he doesn’t want to see “heil” and “Trump” in the same sentence? To not come to the defense of the Jewish members of his family? Or the Jews among his presidential appointees? What the hell is wrong with this man?

The best thing I’ve read since Charlottesville erupted was what Sen. Orrin G. Hatch (R-Utah) said. To wit, “My brother didn’t give his life fighting Hitler for Nazi ideas to go unchallenged.” That’s exactly right. And my late father-in-law, who was a total mensch, didn’t spend five of the prime years of his life in the Seabees for Nazi ideals to go unchallenged. Nor did the millions of other Americans who took up arms to defend our country against overwhelming evil.

 

The Charlottesville counter-demonstrators were fools who fell into the demonstrators’ trap. (That’s one thing that Trump has gotten right. As the saying goes, “Even a blind pig can find an acorn.”)

But the counter-demonstrators, however foolish and out of control, aren’t remotely equivalent to swastika-toting provocateurs and Ku Klux Klan Kreeps demonizing blacks and Jews and immigrants, praising Hitler’s evil crew and by implication demeaning the Americans who fought to subdue the Nazi menace.

To return to sports analogies, you deal with these trolls by using what the late Muhammad Ali called “rope a dope” strategy. You let them march, you don’t physically confront them, you don’t help them get the attention they crave, you let them punch themselves into exhaustion. No harm, no foul, no mainstream publicity. They’re publicized by the Daily Stormer, today’s iteration of the Nazis’ anti-Semitic Der Sturmer newspaper? Who cares? Let it go.

 

At this point, unfortunately, I don’t think Donald 66 can change enough to become a competent chief executive instead of a faux CEO, even if he wants to. But maybe he can learn to be a decent father and grandfather, and stand up for his kids and grandkids. We need a lot more from him than that, but I’ll take what little I can get.”

“The Justice Department under Attorney General Jeff Sessions has effectively blocked the Drug Enforcement Administration from taking action on more than two dozen requests to grow marijuana to use in research, one of a number of areas in which the anti-drug agency is at odds with the Trump administration, U.S. officials familiar with the matter said.

A year ago, the DEA began accepting applications to grow more marijuana for research, and as of this month it had 25 proposals to consider. But DEA officials said they need the Justice Department’s approval to move forward. So far, the department has not been willing to provide it.

“They’re sitting on it,” said one law enforcement official familiar with the matter. “They just will not act on these things.”

As a result, said one senior DEA official, “the Justice Department has effectively shut down this program to increase research registrations.’’

DEA spokesman Rusty Payne said the agency “has always been in favor of enhanced research for controlled substances such as marijuana.’’

The standoff is the latest example of the nation’s premier narcotics enforcement agency finding itself in disagreement with the new administration. While President Trump and Sessions have vowed a crackdown on drugs and violent crime, DEA officials have publicly and privately questioned some of the administration’s statements and goals.

Late last month, acting DEA administrator Chuck Rosenberg wrote in an email to staff members that Trump had “condoned police misconduct” in remarking to officers on Long Island that they need not protect suspects’ heads when putting them into police vehicles. The acting administrator said he was writing his employees “because we have an obligation to speak out when something is wrong.” After public criticism, White House officials said the president was joking.

DEA officials say Sessions and his Justice Department have pressed the agency for action specifically on MS-13 despite warnings from Rosenberg and others at the DEA that the gang, which draws Central American teenagers for most of its recruits, is not one of the biggest players when it comes to distributing and selling narcotics.

Mexican cartels, DEA officials have warned, will use any gang to sell their drugs, and DEA leaders have directed those in their field offices to focus on the biggest threat in their particular geographic area. In many parts of the country, MS-13 simply does not pose a major criminal or drug-dealing threat compared with other groups, these officials said.

The officials spoke on the condition of anonymity because they could face professional consequences for candidly describing the internal disputes.

“Mexican cartels, Mexican transnational organizations are the greatest criminal threat to the United States,” Payne, the DEA spokesman, said. “There’s no other group currently positioned to challenge them. Whenever drug investigations that we do involve MS-13, we respond, but right now the No. 1 drug threat in the U.S. is the Mexican cartels.’’

“On Wednesday, in response to Sessions’s latest comments, Emanuel invoked the controversy that has enveloped the White House over President Trump’s responses to the violence that erupted in Charlottesville this past weekend.

“In a week in which the Trump administration is being forced to answer questions about ­neo-Nazis, white supremacists, and the KKK, they could not have picked a worse time to resume their attack on the immigrants who see America as a beacon of hope,” Emanuel said in a statement. “Chicago will continue to stand up proudly as a welcoming city, and we will not cave to the Trump administration’s pressure because they are wrong morally, wrong factually and wrong legally.”

While Sessions attacked Chicago, he praised Miami-Dade County for “complying with federal immigration law.”

“Americans — all Americans — have a right to full and equal protection under law,” Sessions said. “No one understands this better than the Cuban Americans here in Miami-Dade. . . . They understand that no single person — whether a dictator or a mayor — should determine whose rights are protected and whose are not.”

Sessions said that the county’s homicides were a third of what they were in the 1980s. But, according to the county’s police statistics, murders, rapes and assaults are up in Miami-Dade from where they were at this point last year.

Chicago has also been combating a surge in violent crime, an issue that Trump repeatedly cited during his presidential campaign and since taking office. The city had 762 homicides in 2016, more than the combined total reported by New York and Los Angeles, the only two American cities with larger populations.

There have been 428 murders in Chicago so far this year, down from 440 at the same point in 2016, according to police data. The city has also seen 1,811 shootings, down from 2,149 at this time a year ago, the data show.

Trump has been critical of the response by officials in Chicago, saying that “they’re not doing the job” and suggesting in a television interview this year that perhaps the police were being “overly politically correct.”

Sessions took aim at a city that federal officials have pledged to help. Police have pointed to illegal guns and gang activity as explanations for the increase in crime and have called for harsher sentencing for people convicted of gun crimes. In June, Chicago police and federal authorities announced a new partnership aimed at cracking down on illegal guns.

The top police official in Chicago sharply disputed Sessions’s comments seemingly connecting the violent-crime increase with illegal immigration.

“I have said it before and I will say it again, undocumented immigrants are not driving violence in Chicago and that’s why I want our officers focused on community policing and not trying to be the immigration police,” Eddie Johnson, the Chicago police superintendent, said in a statement.

Rather than helping combat crime, Johnson said, “the federal government’s plans will hamper community policing and undermine the work our men and women have done to reduce shootings by 16 percent so far this year.”

“IN GRAPPLING with its worst epidemic of homicides in years, Chicago faces no more critical task than repairing frayed relations between its beleaguered police force and the communities it serves. Now the Trump administration, more eager to advance its anti-illegal- immigration agenda than to combat violent crime, is throwing up obstacles that will make it more difficult for Chicago and other localities to get a grip on the problems they confront.

After a federal court blocked the administration’s crusade to punish so-called sanctuary cities such as Chicago by withholding an array of federal funds, the Justice Department has renewed the effort in a more targeted way, declaring that localities that refuse to cooperate with deportation agents are ineligible for a specific grant program for police departments.

If that sounds illogical, it’s because it is. Despite President Trump’s assertions to the contrary, there is no evidence that illegal immigration has contributed to Chicago’s murder spree. Eddie Johnson, the city’s police superintendent, said “the vast majority” of Chicago’s violent crime “is committed by homegrown people,” while illegal immigrants are a “nominal” factor. And while the city does prohibit cooperation with federal deportation agents in most instances, it makes exceptions for convicted and charged felons, as well as suspected gang members.

Nonetheless, Attorney General Jeff Sessions justifies barring the federal grants to Chicago — thereby impeding its ability to buy crime-fighting gear such as police cars, SWAT equipment and radios — by falsely linking the Windy City’s homicide rate with its sanctuary policies. “The city’s leaders cannot follow some laws and ignore others and reasonably expect this horrific situation to improve,” he said.”

“Five years ago this week, when I was secretary of Homeland Security, we began accepting the first Deferred Action for Childhood Arrivals (DACA) applications from “dreamers” who had been brought to this country without documentation when they were children. I will never forget that day: Tens of thousands of some of the best and brightest young people in our country applied to the program and celebrated their ability to live, work and learn in the only nation most of them had ever known.

Since that time, nearly 800,000 dreamers have gone through the rigorous application process and received DACA’s protections against deportation, including more than 100,000 who have had their applications renewed by the Trump administration.

Today, however, our nation’s dreamers face an uncertain future. Ten Republican state attorneys general are threatening to sue President Trump if he does not repeal DACA by Sept. 5. Worse, it seems unlikely that Attorney General Jeff Sessions will defend the program. During his Senate confirmation hearing, he said it “would certainly be constitutional” to eliminate DACA.

Five years ago when DACA was established, I said, “Our nation’s immigration laws must be enforced in a firm and sensible manner, but they are not designed to be blindly enforced. Nor are they designed to remove productive young people to countries where they may not have lived or even speak the language.” For the past five years, these young dreamers have proven that, when given the opportunity to contribute, they exceed expectations. It is time to unlock the full potential of these exceptional young people by making these protections permanent.”

PRESIDENT TRUMP vowed to deport “bad hombres” — undocumented immigrants with criminal records whose presence in this country is an unquestioned burden and menace. Instead, his administration has been content to seize and expel a teenage soccer star and his brother in suburban Maryland; a mother of three in Michigan who had spent 20 years in the United States; and, now in detention pending removal, a 43-year-old janitor at MIT whose three small children are U.S. citizens and whose mother, a permanent resident, planned to sponsor him for a green card next year.

None of them had criminal records. Both the Michigan mother and the MIT janitor ran their own businesses, paying taxes and contributing to the economy. All had active, honorable lives deeply entwined with their communities. Deporting them is not only inhumane but also senseless.

So why do it? Possibly, Immigration and Customs Enforcement is simply plucking the low-hanging fruit that crosses agents’ path. Possibly, the agency is trying to please the boss in the Oval Office by juicing deportation numbers with the easiest targets of opportunity.”

HERE IS what President Trump said Saturday about the violence in Charlottesville sparked by a demonstration of white nationalists, neo-Nazis and Ku Klux Klan members:

We condemn in the strongest possible terms this egregious display of hatred, bigotry and violence on many sides. On many sides.

Here is what a presidential president would have said:“The violence Friday and Saturday in Charlottesville, Va., is a tragedy and an unacceptable, impermissible assault on American values. It is an assault, specifically, on the ideals we cherish most in a pluralistic democracy — tolerance, peaceable coexistence and diversity.

“The events were triggered by individuals who embrace and extol hatred. Racists, neo-Nazis, Ku Klux Klan members and their sympathizers — these are the extremists who fomented the violence in Charlottesville, and whose views all Americans must condemn and reject.

“To wink at racism or to condone it through silence, or false moral equivalence, or elision, as some do, is no better and no more acceptable than racism itself. Just as we can justly identify radical Islamic terrorism when we see it, and call it out, so can we all see the racists in Charlottesville, and understand that they are anathema in our society, which depends so centrally on mutual respect.

“Under whatever labels and using whatever code words — ‘heritage,’ ‘tradition,’ ‘nationalism’ — the idea that whites or any other ethnic, national or racial group is superior to another is not acceptable. Americans should not excuse, and I as president will not countenance, fringe elements in our society who peddle such anti-American ideas. While they have deep and noxious roots in our history, they must not be given any quarter nor any license today.

“Nor will we accept acts of domestic terrorism perpetrated by such elements. If, as appears to be the case, the vehicle that plowed into the counterprotesters on Saturday in Charlottesville did so intentionally, the driver should be prosecuted to the full extent of the law. The American system of justice must and will treat a terrorist who is Christian or Buddhist or Hindu or anything else just as it treats a terrorist who is Muslim — just as it treated those who perpetrated the Boston Marathon bombing in 2013.

“We may all have pressing and legitimate questions about how the violence in Charlottesville unfolded — and whether it could have been prevented. There will be time in coming days to delve further into those matters, and demand answers. In the meantime, I stand ready to provide any and all resources from the federal government to ensure there will be no recurrence of such violence in Virginia or elsewhere. Let us keep the victims of this terrible tragedy in our thoughts and prayers, and keep faith that the values enshrined in our Constitution and laws will prevail against those who would desecrate our democracy.”

President Trump has vowed to swiftly deport “bad hombres” from the United States, but the latest deportation statistics show that slightly fewer criminals were expelled in June than when he took office.

In January, federal immigration officials deported 9,913 criminals. After a slight uptick under Trump, expulsions sank to 9,600 criminals in June.

Mostly deportations have remained lower than in past years under the Obama administration. From January to June, Immigration and Customs Enforcement deported 61,370 criminals, down from 70,603 during the same period last year.

During the election, Trump vowed to target criminals for deportation and warned that they were “going out fast.” Later, he suggested he would try to find a solution for the “terrific people” who never committed any crimes, and would first deport 2 million to 3 million criminals.

But analysts say he is unlikely to hit those targets. Since January, immigration officials have deported more than 105,000 immigrants, 42 percent of whom had never committed any crime.

Last year, a total of 121,170 people were deported during the same period, and a similar percentage had no criminal records.

John Sandweg, the former acting director of Immigration and Customs Enforcement, said part of the reason for the decline is that illegal border crossings have plunged since Trump took office pledging to build a “big, beautiful” wall and crack down on illegal immigration. Immigrants caught at the border accounted for a significant share of deportations under the Obama administration.

 

Another factor, however, is that immigration officials are arresting more people who never committed any crime — some 4,100 immigrants in June, more than double the number in January — clogging the already backlogged immigration courts and making it harder to focus on criminals.

Immigration and Customs Enforcement released the deportation figures, which the Post had requested, late Thursday, two days after the Justice Department announced that immigration courts ordered 57,069 people to leave the United States from February to July, a nearly 31 percent increase over the previous year.

However, Justice officials have not said how many of the immigrants ordered deported were actually in custody — or if their whereabouts are even known. Every year scores of immigrants are ordered deported in absentia, meaning they did not attend their hearings and could not immediately be deported.

The deportation figures come as the Trump administration is fighting with dozens of state and local officials nationwide over their refusal to help deport immigrants, and as the administration is attempting to reduce legal and illegal immigration.”

It appears that many of the increased removal orders touted by DOJ/EOIR earlier this week might have been “in absentia” orders, issued without full due process hearings and all too often based on incorrect addresses or defective notices. Some of those orders turn out to be unenforceable. Many others require hearings to be reopened once the defects in notice or reasons for failure to appear are documented. But, since there wild inconsistencies among U.S. Immigration Judges in reopening in absentia cases, “jacking up” in absentia orders inevitably produces arbitrary justice.

The article also indicates that the Administration’s mindless overloading of already overwhelmed U.S. Immigration Courts with cases of non-criminal migrants has actually inhibited the courts’ ability to concentrate on criminals.

Taxpayer money is being squandered on “dumb” enforcement and a “captive court system” that no longer functions as a provider of fairness, due process, and justice. How long will legislators and Article III judges continue to be complicit in this facade of justice?
