In President Trump’s many vocal pronouncements about stopping illegal immigration, one solution he promoted during the campaign has been conspicuously missing — a requirement that employers check whether workers are legal.

Eight states require nearly all employers to use the federal government’s online E-Verify tool for new hires, but efforts to expand the mandate to all states have stalled, despite polls showing widespread support and studies showing that it reduces unauthorized workers.

The campaign for a national mandate has withered amid what appears to be a more pressing problem — a historic labor shortage that has businesses across the country desperate for workers at restaurants, on farms and in other low-wage jobs.

The urgency around that shortage was clear at a congressional hearing last week when senators pressed Homeland Security Secretary Kirstjen Nielsen on additional visas for seasonal foreign workers.

“There’s not one manufacturing plant in Wisconsin, not one dairy farm, not one resort that can hire enough people,” said Sen. Ron Johnson (R-Wis.), chairman of the Homeland Security and Governmental Affairs Committee.

With the unemployment rate at a 17-year low and the Trump administration cracking down on foreign workers, lawmakers are reluctant to champion a measure that could exacerbate the labor shortage and hurt business constituents — even one that is popular among a broad swath of Americans.

House Republicans are forging ahead with a debate over the future of young undocumented immigrants who arrived in the United States as children, but the fate of an E-Verify provision remains in limbo.

Despite his administration’s “Hire American” stance, Trump and the GOP leadership have gone quiet on mandating E-Verify, draining momentum from a top policy goal of grass-roots Republicans.

Two problems that I can see:

  • The Trump/GOP bogus position that we don’t need more immigrant labor, which would point toward a program both a) legalizing undocumented workers already here; and 2) expanding (not contracting) future legal immigration opportunities;
  • “E-Verify” depends heavily on timely action by USCIS to grant extensions of stay and renew work authorizations. But, under Trump, Cissna, Nielsen, and Sessions, USCIS has eliminated customer service to both migrants and U.S. employers from their mission and joined the “mindless enforcement bureaucracy.”
  • When immigration policy decisions are based on bias and prejudice rather than facts, bad things are going to happen. Whatever might be done to fix our broken immigration system is highly unlikely to happen under the Trump White Nationalists.

“President Trump’s proposal to cut legal immigration rates would delay the date that white Americans become a minority of the population by as few as one or as many as five additional years, according to an analysis by The Washington Post.

The plan, released by the White House last month, would scale back a program that allows people residing in the United States to sponsor family members living abroad for green cards, and would eliminate the “diversity visa program” that benefits immigrants in countries with historically low levels of migration to the United States. Together, the changes would disproportionately affect immigrants from Latin America and Africa.

The Census Bureau projects that minority groups will outnumber non-Hispanic whites in the United States in 2044. The Post’s analysis projects that, were Trump’s plan to be carried out, the date would be between 2045 and 2049, depending on how parts of it are implemented.

(The Post’s methodology for estimating the annual impact of Trump’s proposed cuts is explained in more detail at the bottom of this story. Projecting this far into the future entails certain assumptions that could alter the range, but demographic experts said The Post’s approach was reasonable.)

All told, the proposal could cut off entry for more than 20 million legal immigrants over the next four decades. The change could have profound effects on the size of the U.S. population and its composition, altering projections for economic growth and the age of the nation’s workforce, as well as shaping its politics and culture, demographers and immigration experts say.

“By greatly slashing the number of Hispanic and black African immigrants entering America, this proposal would reshape the future United States. Decades ahead, many fewer of us would be nonwhite or have nonwhite people in our families,” said Michael Clemens, an economist at the Center for Global Development, a think tank that has been critical of the proposal. “Selectively blocking immigrant groups changes who America is. This is the biggest attempt in a century to do that.”

“The inability of a Republican Congress and a Republican president to repeal Obamacare, or even just dial it back, is yet the latest demonstration that Republicans simply aren’t ready to govern.

The facile explanation for this is the unresolved division, within the party, between its radical tea party populist wing and its more moderate, business-friendly establishment wing. But the bigger issue is that the party’s elected politicians are unwilling to make the trade-offs that are the essence of what governing is about.

On health care, for example, they promised to lower premiums but refused to embrace any of the three approaches that could accomplish that: increase co-payments and deductibles; squeeze the incomes of doctors, hospitals and drug companies; or finance more of the country’s health care through higher taxes.

. . . .

As a group, they have demonstrated a breathtaking lack of policy knowledge and sophistication, a stubborn disregard for intellectual honesty, lousy political instincts and a broken moral compass. Their leaders have forgotten what it means to lead, if they ever knew, while their backbenchers don’t have a clue of what it takes to be constructive followers. If there were a bankruptcy code for politics, it’s safe to say the Republicans would be in Chapter 11.

This complete abdication of governing responsibility was confirmed Tuesday when the party’s nominal leader, President Trump, announced to the country, “I think we are probably in that position where we will just let Obamacare fail. … I can tell you the Republicans are not going to own it.”

Even Sen. Shelly Caputo, the reliably party-line toting Republican from West Virginia, was moved to distance herself from that cynical win-at-any-cost strategy. “I did not come to Washington to hurt people,” she said.

“It’s almost an embarrassment being an American citizen traveling around the world … listening to the stupid s‑‑‑ we have to deal with in this country,” Jamie Dimon, the chairman of JPMorgan Chase, said in an unguarded moment last week. Dimon was quick to add, reflexively, that it wasn’t a Republican or a Democratic issue, but he knows better than that. Republicans were handed a golden opportunity to govern and they have blown it. This one is on them.”

“Refugees have been at the center of a political maelstrom, accused of everything from terrorism to being a drain on taxpayers — prompting President Trump, in one of his first official acts, to suspend the country’s four-decade old refugee resettlement program.

But a new study shows that refugees end up paying more in taxes than they receive in welfare benefits after just eight years of living in this country.

By the time refugees who entered the U.S. as adults have been here for 20 years, they will have paid, on average, $21,000 more in taxes to all levels of government than they received in benefits over that time span, according to a working paper released Monday by the National Bureau of Economic Research that examined the economic and social outcomes of refugees in the U.S.

“There was a lot of rhetoric saying these people cost too much, but we didn’t actually know what that number was,” said William N. Evans, an economist at the University of Notre Dame who co-authored the paper.

Trump, in his January executive order temporarily barring refugees from entering the country, had directed the State Department to study the long-term costs of the refugee admissions program to federal, state and local governments.”

“President Trump plans to sign an executive order in Wisconsin on Tuesday that the White House says will make it harder for tech companies to replace American workers with cheaper foreign labor, and will strengthen rules barring foreign contractors from bidding on government projects, according to senior administration officials.

The officials, in a background call with reporters, said Trump will direct the Departments of Labor, Justice, State and Homeland Security to crack down on fraud and abuse in guest-worker programs by issuing new immigration rules.

The president will also direct the Department of Commerce to review federal procurement rules and trade agreements with a view to putting American firms at an advantage when it comes to winning contracts.

The officials pitched the twin directives as benefiting working- and middle-class Americans who have suffered for too long under unfair trade and immigration rules.

“This is the policy that ensures no one gets left behind in America anymore — that we protect our industry from unfair competition, favor the products produced by our fellow citizens and make certain that when jobs open those jobs are given to American workers first,” the White House said in a statement.

It was not immediately clear how much the administration could accomplish without cooperation from Congress.

“Sweeping changes are going to require congressional action,” said Lynden Melmed, an immigration attorney who had served as U.S. Citizenship and Immigration Services chief counsel within the Department of Homeland Security under President George W. Bush.

However, industry experts said Trump’s executive order was a good first step to protecting the U.S. defense industrial base, and U.S. firms that do business with the federal government.

“It’s one of the few presidential exertions in recent time, that holds out the hope of saving U.S. industrial jobs,” said Loren Thompson, a defense industry consultant and the chief operating officer of the Lexington Institute in Arlington.”

Land Grab — DOJ “Lawyers Up” To Seize Private Property From Trump Supporters Along S. Border — Wall Trumps Property Rights!

“It’s going to be time consuming and costly,” said Tony Martinez, an attorney who is mayor of the border town of Brownsville, Tex. “From a political perspective, you have a lot of rich landowners who were his supporters.”

Trump, in his recent budget proposal, is calling for the addition of 20 Justice Department attorneys to “pursue federal efforts to obtain the land and holdings necessary to secure the southwest border.” The Justice Department would not expand upon the details. Of the department’s 11,000 attorneys, fewer than 20 currently work in land acquisition. Trump’s budget would double that.

The battle has been fought before. The last wave of eminent domain cases over southern border properties dates back to the 2006 Secure Fence Act authorizing President George W. Bush to erect 700 miles of fencing.

Of the roughly 400 condemnation cases stemming from that era, about 90 remain open a decade later, according to the Justice Department. Nearly all are in the Rio Grande Valley in southwest Texas.

The U.S. government has already spent $78 million compensating private landowners for 600 tracts of property for the construction of the existing pedestrian and vehicle fence, according to Customs and Border Protection. The agency estimates that it will spend another $21 million in real estate expenses associated with the remaining condemnation cases — not including approximately $4 million in Justice Department litigation costs.

“It’s not like if you build a wall your problem is gone,” Barnard said. “We need more boots on the ground. More boats, more sensors, more drones that would be more efficient and more productive.”

It remains an open question how much sympathy Trump would have for Barnard’s situation — or that of any other private landowner standing in the way of Trump’s wall.

As a developer, Trump has wielded the power of eminent domain to make way for his properties. In Scotland, he pursued compulsory purchase to force neighbors out of their homes for the Trump International Golf Links near Aberdeen. When that didn’t work, he built a five-foot-tall wooden fence — then tried to make his neighbors pay for it.

Trump also famously tried seizing the property of an elderly Atlantic City widow to make way for a limousine parking lot for his hotel and casino. He has a consistent history supporting the use of eminent domain and praised the 2005 Supreme Court decision — denounced widely by conservatives — that said the government could force property owners to sell their land to make way for private economic developments that benefit the public.

“I happen to agree with it 100 percent,” Trump said during a 2005 Fox News interview. “If you have a person living in an area that’s not even necessarily a good area, and … government wants to build a tremendous economic development, where a lot of people are going to be put to work and … create thousands upon thousands of jobs and beautification and lots of other things, I think it happens to be good.”

Duh, I thought conservatives had this “thing” about private property and government intrusions.

My prediction:  Trump will long be gone, and they will still be litigating, negotiating, and wrangling  over the right of way. And, as with many such “eminent domain” projects, by the time the government actually spends the time, money, and loss of good will to obtain the property, the original project will have long become obsolete (as this one in fact already is) and will be consigned to the dustbin, thus making the entire exercise a costly “wild goose chase.” Talk about waste, fraud, and abuse!

“Immigrants are part of the U.S. economy,” Roblero said, in Spanish, via Facebook Messenger. “Now I’m under house arrest. I haven’t left to see any of my coworkers, the restaurant is closed and I can’t work.”

Thus far, few restaurants have suffered the scale of the raids that Agave did. But in cities across America, restaurants, bars and hotels are bracing themselves for the possibility of further enforcement action under the Trump administration. On Thursday, restaurants in several major cities — including José Andrés’s Jaleo, Oyamel and Zaytinya in D.C. — shut down or cut service to demonstrate how much their businesses would suffer without immigrants.

That has been devastating to the families of the employees, Valladares said, particularly those with young children. Many of the families fear being split up if their relatives are deported. They’re also having trouble buying food and paying rent while their primary breadwinners await immigration hearings; Cosecha is now providing for many of those needs. Only one of Mucino’s restaurants, the taco joint La Divina, is open and in need of employees.

On a recent Wednesday evening, the phone at La Divina was answered by a 21-year-old college student named Drew Smith. He was hired after the raids, he said, to replace a cashier who had been arrested, along with several new cooks who, early on, didn’t even know where to source ingredients. Smith loves La Divina: The people are nice, the tacos are good, and it “feels like working in Mexico,” he said.
“But it seems like less people come to the restaurant now,” he added. “I think there’s a perception that the tacos are different.”

“Working-class whites are the biggest beneficiaries of federal poverty-reduction programs, even though blacks and Hispanics have substantially higher rates of poverty, according to a new study to be released Thursday by the Center on Budget and Policy Priorities.

Government assistance and tax credits lifted 6.2 million working-class whites out of poverty in 2014, more than any other racial or ethnic demographic. Half of all working-age adults without college degrees lifted out of poverty by safety-net programs are white; nearly a quarter are black and a fifth are Hispanic.”

This is a demographic that went for President Trump in significant numbers, but which likely would be hurt by some of the reductions and eliminations of these programs generally favored by the GOP.
