No institution welcomes scrutiny. Maintaining internal cohesion and operational focus demands informational boundaries against the rest of the world. This wish deserves respect, but not automatic submission, especially when matters of vast public consequence are at stake.

That’s why news media take it as a duty to ignore organizational secrecy rules — except when disclosure would cause unwarranted harm — and insist that public awareness must outweigh institutional convenience. A document leaked from most any federal agency that upended longstanding policy would unquestionably be legitimate news, even if it was preliminary, even if exposure would gum up a cozy internal process, even if the leak broke agency rules.

But not when it comes to the Supreme Court.

Of all our governmental institutions, it is unique in the awe and deference with which our news media, for all their endless claims to seek truth aggressively, treat it.

To be sure, secrecy has a place in the judicial system. Grand juries, for example, are prosecutorial contrivances where untested evidence is presented and people suspected of wrongdoing have weak adversarial protections. Damaging the innocent by publicizing unrebutted claims is a strong possibility. Secrecy makes sense.

But the issue here is altogether different. The leak was of a 98-page draft opinion with 118 footnotes, not a filched personal email or the secondhand account of an overheard chat. It was deeply researched and carefully composed and was distributed internally nearly three months ago, and it signals a major change in an explosive area of public policy. Publishing it doesn’t endanger national security and puts no innocent lives at risk.

So should the Supreme Court, virtually alone among core public institutions, be entitled to say, “We’ll show it to you when we’re ready for you to see it?”

At best, that exceptionalist claim rests on a carefully nurtured myth of the court as a scholarly sanctuary in which big questions of public purpose are engaged through reflection, historical inquiry and quiet, reasoned debate, a process of ripening that must take place behind the sealed doors of an intellectual greenhouse.

That fiction lost credibility a long time ago, at least for anybody who was paying attention in the year 2000 when the court, with the flimsiest of pretexts, awarded the presidency to the candidate with fewer votes but of the same party as its majority.

Indeed, what standards of accountability govern the court? Its members serve life terms free from disciplinary oversight. To get aboard, nominees routinely lie before Congress — about their personal behavior and their judicial philosophy — rendering the Senate’s authority to approve candidates meaningless. Serving justices are not held to any discernible standard of independence. Their right to rule on matters in which close family have personal stakes, or on which they have clear prior leanings, is completely unregulated.

And then there’s the recent sharp increase in furtive rulings reached off-season without full briefing or oral argument — known as the shadow docket — which has further narrowed the window of public visibility. Last summer the court issued 11 such rulings, up from three in 2016, in a slapdash and opaque workaround beloved of the conservative majority that produces jurisprudence that “every day becomes more unreasoned, inconsistent, and impossible to defend,” as dissenting liberal Justice Elena Kagan said.

Perhaps the Roe leak will inaugurate a new era for the court. Maybe there will be more impertinent reporting that exposes the reasoning, bargaining, trade-offs and personal dynamics that drive constitutional lawmaking at the highest levels. Rather than something to be dreaded, such transparency would leave us all better informed and more fully empowered to play the role the system prescribes for us — to shape our collective future.

Trump has brought impunity to the highest office in the land, wielding a wrecking ball to the most precious windowpane of all – American democracy.

The message? A president can obstruct special counsels’ investigations of his wrongdoing, push foreign officials to dig up dirt on political rivals, fire inspectors general who find corruption, order the entire executive branch to refuse congressional subpoenas, flood the Internet with fake information about his opponents, refuse to release his tax returns, accuse the press of being “fake media” and “enemies of the people”, and make money off his presidency.

And he can get away with it. Almost half of the electorate will even vote for his reelection.

A president can also lie about the results of an election without a shred of evidence – and yet, according to polls, be believed by the vast majority of those who voted for him.

Trump’s recent pardons have broken double-pane windows.

Not only has he shattered the norm for presidential pardons – usually granted because of a petitioner’s good conduct after conviction and service of sentence – but he’s pardoned people who themselves shattered windows. By pardoning them, he has rendered them unaccountable for their acts.

They include aides convicted of lying to the FBI and threatening potential witnesses in order to protect him; his son-in-law’s father, who pleaded guilty to tax evasion, witness tampering, illegal campaign contributions, and lying to the Federal Election Commission; Blackwater security guards convicted of murdering Iraqi civilians, including women and children; Border Patrol agents convicted of assaulting or shooting unarmed suspects; and Republican lawmakers and their aides found guilty of fraud, obstruction of justice and campaign finance violations.

It’s not simply the size of the broken window that undermines standards, according to Wilson and Kelling. It’s the willingness of society to look the other way. If no one is held accountable, norms collapse.

Trump may face a barrage of lawsuits when he leaves office, possibly including criminal charges. But it’s unlikely he’ll go to jail. Presidential immunity or a self-pardon will protect him. Prosecutorial discretion would almost certainly argue against indictment, in any event. No former president has ever been convicted of a crime. The mere possibility of a criminal trial for Trump would ignite a partisan brawl across the nation.

Congress may try to limit the power of future presidents – strengthening congressional oversight, fortifying the independence of inspectors general, demanding more financial disclosure, increasing penalties on presidential aides who break laws, restricting the pardon process, and so on.

But Congress – a co-equal branch of government under the Constitution – cannot rein in rogue presidents. And the courts don’t want to weigh in on political questions.

The appalling reality is that Trump may get away with it. And in getting away with it he will have changed and degraded the norms governing American presidents. The giant windows he’s broken are invitations to a future president to break even more.

Nothing will correct this unless or until an overwhelming majority of Americans recognize and condemn what has occurred.

As I have mentioned, the lack of accountability could be a problem for the Biden-Harris Administration. And, 74 million voters who pulled the lever for an overtly corrupt, anti-American, racist, clown is an even bigger obstacle to the future of our nation. 

On the other hand, although he was a “minority President” from the git go, Trump had nothing but contempt for the majority of us who didn’t favor his maliciously incompetent and divisive policies; he completely disregarded both truth and the common good. 

Biden and Harris start with something that Trump never had — the support of a clear majority of 7 million plus voters. So, if they govern wisely, humanely, and in the public interest they could succeed in saving our nation from the 74 million who joined Trump’s war against American democracy. And despite their short-signtedness and intransigence, the 74 million and their families in Trumpland will get the benefits of better government in the public interest. Sometimes, you have to save folks in spite of themselves.   

If the policies of decency, honesty, courage, and governing in the public interest work, it could create a longer-term governing majority. If not, it will still be worth a shot at saving our democracy. Another Administration of Trump and his minority minions would be the end of our democracy anyway —  the majority of us have little to lose by giving it our best shot with the Biden Harris Team!

AMERICA’S “MASS ATROCITY” — Professor Kate Cronin-Furman Says Don’t Kid Yourself About What The Trump Administration Is Doing In Your Name & How “Ordinary Civil Servants” Carry Out The Unthinkable & Unacceptable!

The debate over whether “concentration camps” is the right term for migrant detention centers on the southern border has drawn long-overdue attention to the American government’s dehumanizing treatment of defenseless children. A pediatrician who visited in June said the centers could be compared to “torture facilities.” Having studied mass atrocities for over a decade, I agree.

At least seven migrant children have died in United States custody since last year. The details reported by lawyers who visited a Customs and Border Protection facility in Clint, Tex., in June were shocking: children who had not bathed in weeks, toddlers without diapers, sick babies being cared for by other children. As a human rights lawyer and then as a political scientist, I have spoken to the victims of some of the worst things that human beings have ever done to each other, in places ranging from Cambodia to the Democratic Republic of the Congo to Sri Lanka. What’s happening at the border doesn’t match the scale of these horrors, but if, as appears to be the case, these harsh conditions have been intentionally inflicted on children as part a broader plan to deter others from migrating, then it meets the definition of a mass atrocity: a deliberate, systematic attack on civilians. And like past atrocities, it is being committed by a complex organizational structure made up of people at all different levels of involvement.

Thinking of what’s happening in this way gives us a repertoire of tools with which to fight the abuses, beyond the usual exhortations to call our representatives and donate to border charities.

Those of us who want to stop what’s happening need to think about all the different individuals playing a role in the systematic mistreatment of migrant children and how we can get them to stop participating. We should focus most on those who have less of a personal commitment to the abusive policies that are being carried out.

Testimony from trials and truth commissions has revealed that many atrocity perpetrators think of what they’re doing as they would think of any other day job. While the leaders who order atrocities may be acting out of strongly held ideological beliefs or political survival concerns, the so-called “foot soldiers” and the middle men and women are often just there for the paycheck.

This lack of personal investment means that these participants in atrocities can be much more susceptible to pressure than national leaders. Specifically, they are sensitive to social pressure, which has been shown to have played a huge role in atrocity commission and desistance in the Holocaust, Rwanda and elsewhere. The campaign to stop the abuses at the border should exploit this sensitivity and put social pressure on those involved in enforcing the Trump administration’s immigration policies.

Here is what that might look like:

The identities of the individual Customs and Border Protection agents who are physically separating children from their families and staffing the detention centers are not undiscoverable. Immigration lawyers have agent names; journalists reporting at the border have names, photos and even videos. These agents’ actions should be publicized, particularly in their home communities.

This is not an argument for doxxing — it’s about exposure of their participation in atrocities to audiences whose opinion they care about. The knowledge, for instance, that when you go to church on Sunday, your entire congregation will have seen you on TV ripping a child out of her father’s arms is a serious social cost to bear. The desire to avoid this kind of social shame may be enough to persuade some agents to quit and may hinder the recruitment of replacements. For those who won’t (or can’t) quit, it may induce them to treat the vulnerable individuals under their control more humanely. In Denmark during World War II, for instance, strong social pressure, including from the churches, contributed to the refusal of the country to comply with Nazi orders to deport its Jewish citizens.

The midlevel functionaries who make the system run are not as visibly involved in the “dirty work,” but there are still clear potential reputational consequences that could change their incentives. The lawyer who stood up in court to try to parse the meaning of “safe and sanitary” conditions — suggesting that this requirement might not include toothbrushes and soap for the children in border patrol custody if they were there for a “shorter term” stay — passed an ethics exam to be admitted to the bar. Similar to the way the American Medical Association has made it clear that its members must not participate in torture, the American Bar Association should signal that anyone who defends the border patrol’s mistreatment of children will not be considered a member in good standing of the legal profession. This will deter the participation of some, if only out of concern over their future career prospects.

The individuals running detention centers are arguably directly responsible for torture, which could trigger a number of consequences at the international level. Activists should partner with human rights organizations to bring these abuses before international bodies like the United Nations Human Rights Council. They should lobby for human rights investigations, for other governments to deny entry visas to those involved in the abuses, or even for the initiation of torture prosecutions in foreign courts. For someone who is “just following orders,” the prospect of being internationally shamed as a rights abuser and being unable to travel freely may be significant enough to persuade them to stop participating.

When those directly involved in atrocities can’t be swayed, their enablers are often more responsive. For-profit companies are supplying food and other material goods to the detention centers. Boycotts against them and their parent entities may persuade them to stop doing so. Employees of these companies can follow the example of Wayfair workers, who organized a walkout on Wednesday in protest of their company’s sale of furniture to the contractor outfitting the detention centers. Finally, anyone can support existing divestment campaigns to pressure financial institutions to end their support of immigration abuses.

Many Americans have been asking each other “But what can we DO?” The answer is that we call these abuses mass atrocities and use the tool kit this label offers us to fight them. So far, mobilization against what’s happening on the border has mostly followed standard political activism scripts: raising public awareness, organizing protests, phoning our congressional representatives. These efforts are critical, but they aren’t enough. Children are suffering and dying. The fastest way to stop it is to make sure everyone who is responsible faces consequences.

Trump administration scandals surely must be examined by the new Democratic-controlled House, which intends to take its constitutional obligations seriously, in contrast with the GOP House majority. But congressional oversight should be about more than scandals: Equally important is to probe the policy disasters (as numerous as the ethical lapses), both to hold the executive branch accountable and to help formulate appropriate legislation. The border situation is a prime example.

The Post reports:

A day after U.S. agents fired tear gas to repel migrants breaking through the border fence in Southern California, Homeland Security officials defended the use of force and their decision to close the country’s busiest port of entry, saying they expect additional confrontations and shutdowns.

Facing dismal conditions in Mexico and long waits for the chance to request asylum in the United States, thousands of Central American migrants are becoming more agitated, and officials see no quick resolution to the tensions that erupted Sunday. …

On Monday, critics of the Trump administration denounced border agents’ use of force on groups that included families with children, but U.S. officials praised what they called “quick and effective action” against crowds of stone-slinging young men who pried open the border fence at multiple locations to squeeze through.

Like the family separation debacle, this is a crisis of the Trump administration’s own making. Sending the military (with threats to use force on civilians), threatening to “close the border” and attempting to issue a blanket denial of asylum (halted by the courts) have all created a sense of panic:

The migrants who participated in Sunday’s border rush were a minority among the 5,000 or so Central Americans who have arrived in caravan groups to Tijuana in recent weeks hoping to enter the United States. Critics of the administration’s hard-line response have insisted that members of the caravan groups would exercise their legal right to seek asylum at U.S. border crossings. But with more than 4,000 people on a wait list to approach the border crossing, and U.S. immigration authorities insisting that they have the capacity to process just 60 to 100 asylum seekers per day, frustration has been welling at the camp where migrants are sleeping in tents and enduring long lines for food.

Instead of sending troops and making unconstitutional threats, the Trump administration should be dispatching an army of judges to consider the asylum applications — and working with Central American governments to address the conditions that force their citizens to flee.

Rather than accept responsibility for their own bad decision-making, the Trump administration falsely accuses the Obama administration of practicing the same inhumane family separation policy. (The Post’s fact checkers find: “It’s not the first time [President] Trump tries to minimize the scope of his family separations at the border by claiming that President Barack Obama had the same policy. This claim and its variations have been roundly debunked. We gave them Four Pinocchios in June. … There is simply no comparison between Trump’s family separation policy and the border enforcement actions taken by the Obama and George W. Bush administrations.”)

‘We come in peace’: Central American migrants’ uncertain future

A full congressional investigation is essential to answer the most basic questions:

  • Who issued the zero-tolerance policy, and who approved it?
  • What discussion/consideration of the ensuing family separations was undertaken?
  • What basis is there for the administration’s assertions that there are “Middle Eastern” people and criminals in the caravan? (“It has almost nothing but supposition to show the public. Many of the caravan members are women and children fleeing violence in their home countries or seeking economic opportunity in the United States. They hardly fit Trump’s description of ‘very tough people’ rushing the border.”)
  • Where are the “stone-cold criminals” Trump keeps claiming are part of the caravan, and why wouldn’t they be rejected through the normal asylum evaluation process?
  • Against whom did U.S. agents lob tear gas?

Aside from debunking a host of false claims by the Trump administration and anti-immigrant zealots, the hearings ideally should produce legislation that at a bare minimum permanently bans family separations, allocates funds for border security and for immigration judges (even Sen. Ted Cruz, a Texas Republican, supports that), gives protection to the dreamers and supports aid to Central American countries from which migrants are fleeing.

In short, Congress needs to do its job, instead of acting as a cheerleader for Trump’s racist, hysterical rhetoric.

“Once again, the Attorney General cites flawed facts to castigate the immigration bar for the significant case backlog and inefficiencies in our immigration court system,” said Benjamin Johnson, AILA Executive Director. “He blames immigration attorneys for seeking case continuances, disregarding the fact that continuances are also routinely requested by counsel for the government, or are issued unilaterally by the court for administrative reasons. In fact, although the report cited by the Attorney General indicates an 18% increase in continuances requested by respondents, that same report found a 54% increase in continuances requested by the Department of Homeland Security (DHS), and a 33% increase in ‘Operational-related’ continuances. That said, continuances are often a necessary means to ensure due process is afforded in removal proceedings. The number one reason a continuance is requested by a respondent is to find counsel. Other reasons include securing and authenticating documentary evidence from foreign countries, or to locating critical witnesses. And when the government refuses to share information from a client’s immigration file and instead makes them go through the lengthy process of a Freedom of Information/Privacy Act request, a continuance is often a client’s only lifeline to justice. For the AG to blame immigration lawyers for imagined trespasses is both malicious and wrong. We will not let that misinformation pass without setting the record straight.

“The immigration court backlog is a function of years and years of government spending on enforcement without a commensurate investment in court resources. Our nation would be better served if the immigration courts were an independent judiciary, free from the auspices of the Department of Justice, where every immigrant has access to counsel. Immigration court is not small claims court or traffic court; each decision has the potential to tear apart families or keep them together, to destroy businesses or build our economy, to send someone back to certain death, or bring hope for a new and better life. Immigration judges should make those decisions with all information at hand, without any undue influence or arbitrary case completion requirements. That is a goal we can all work toward.”

Sure matches my observations from the latter part of my career at the U.S. immigration Court in Arlington, VA!

Probably 75% of the cases on my “Non-Detained Docket” were there NOT at the request of a respondent or his or her attorney. No, they were “mass transferred and continued” to my docket unilaterally by EOIR to fulfill “Border Priorities” established by the DOJ during the Obama Administration as an adjunct to changing DHS Enforcement priorities.

And, these weren’t “short continuances” to find a lawyer or prepare an application as might be requested by a respondent or a private bar lawyer. NO, these were “Merits Hearing” cases that had often been set for late 2016 or 2017 hearings before one of my colleagues, only to be “continued” by EOIR to my docket for dates many additional years in the future. Indeed, many of these cases were unilaterally removed by EOIR from “Individual Dockets” and “orbited” to my “Master Calendars” (arraignments) years in the future — indeed years after I would be retired. That’s because my docket was already completely full for several years when this chapter of ADR started.

And the same was true for my colleague Judge Lawrence O. Burman. Indeed, at the time I retired, Judge Burman and I were the ONLY judges hearing “nonpriority, non-detained cases” — even though those cases were BY FAR the majority of cases on the Arlington Court Docket. And, to make things worse, my “replacement” retired at the end of 2016 thus resulting in a whole new “round” of ADR. 

Talk about ADR driven by incompetent administration and improper political meddling from the DOJ. And, from everything “Gonzo” has said and I have heard about what’s happening at EOIR, such impropriety has become “normalized” under the Trump Administration.

No court system can run efficiently and fairly when the perceived interests of one of the parties are elevated over fairness, Due Process, equal justice, and reaching correct decisions under the law. No court system can run efficiently and fairly when control over day-to-day dockets is stripped from the local US Immigration Judges and Court Administrators and hijacked by officials in Washington and Falls Church driven by political performance objectives  not by practical knowledge and day-to-day considerations of how to construct and run a docket for maximum fairness and efficiency under local conditions (the most important of which is the an adequate number of pro bono lawyers to represent respondents).

NO OTHER MAJOR COURT SYSTEM IN AMERICA OPERATES THE WAY EOIR DOES! THAT SHOULD TELL US SOMETHING!

So, why is “Gonzo Apocalypto” being allowed to get away with misrepresenting the facts and intentionally running the Immigration Court system for the perceived benefit of one of the parties and against the interests of the other? There is a simple term for such conduct: Ethical Misconduct. Usually, it results in the loss or suspension of the offender’s license to practice law. Why is Gonzo above accountability?
