“According to Migration Policy Institute estimates, potentially 3,338,000 aliens would be able to qualify for conditional lawful status under H.R.3440, which leads to permanent resident status, and chain migration would make the number much larger.

Moreover, chain migration would make it possible for the DREAMers to pass on legal status and a path to citizenship to the parents who brought them to the United States in violation of our laws, which is sure to be unacceptable to many Republicans.

The chain migration issue does not just apply to a DREAM Act. If it is allowed to block passage of a DREAM Act, it is likely to become an obstacle to every legalization program from now on, and for most undocumented immigrants, there is not going to be another way to obtain lawful permanent resident status.”

I’m far removed from the days when I had a sense of what’s happening on the Hill. So, if Nolan says that the Dems will have to give on family migration for Dreamers to cut a deal to save them in a GOP-controlled Congress in a Trump presidency, maybe that’s true. Gotta do what you have to do to save lives and preserve America’s future.

But, I do know something about the bogus term “chain migration” It’s a pejorative term coined by restrictionists to further their racial and ethnic agenda.

Chain migration is simply legal family migration, a process that has been ongoing for at least half a century and has done nothing but good things for America. Of course, it makes sense to give preferred treatment to those with family already in the U.S. Of course, having family here helps folks adjust, prosper, and contribute. It’s a win-win. Studies by groups not associated with a restrictionist agenda confirm that.

Moreover, unlike the folks pushing the restrictionist agenda, I actually have seen first-hand the highly positive results of family-based legal immigration for years in Immigration Court. It brings really great folks into our society and allows them to contribute fully to the success of America, and particularly our local communities.

If we want more skills-based immigration, that’s also a good idea. But, that doesn’t require a corresponding cut in family immigration. Immigration is good for America. It’s not a “zero-sum game,” although restrictionists would like us to think so.

The GOP position on parents of Dreamers is absurd. Those folks are already here and contributing to our society and our communities. Many have been here for decades. They are not going anywhere notwithstanding the rhetoric of the restrictionists and the Trump Administration. Other than picking on Dreamers once they become citizens, what could we as a country possibly gain by such an absurd and punitive measure directed against productive long term residents?

I think it is worth considering what pushing for unnecessary and harmful restrictions on family migration says about the real motivations of today’s GOP and its apologists.

“The Trump administration is drafting a new policy to quickly deport more than 150,000 child migrants from Central America who arrived alone in the U.S. illegally, creating a new class of undocumented migrants.

The Department of Justice and Homeland Security is drawing up a policy proposal in a series of memos, according to two sources with knowledge of the internal debate who spoke to the Miami Herald.

As it stands, the plan would allow for teens and children who arrived in the U.S. illegally by themselves to be put on a fast track to deportation when they turn 18. Most of these children have traveled thousands of miles alone from Central American countries, including Honduras, El Salvador, and Guatemala, to escape violence and poverty.

The policy wouldn’t allow the teens to plead their case before an immigration judge.

The discussions follow controversy within the government about Deferred Action for Childhood Arrivals program, known as DACA, a program implemented by Barack Obama, which protects children brought to the country illegally by their parents from deportation.

Speaking about the new policy plans, a former U.S. Justice Department official told the Herald, “The concern is that most people at DOJ know this will likely be viewed as illegal and do not want to have to defend this in court if they can avoid it.”

Current law “doesn’t give the administration a lot of flexibility with how to deal with unaccompanied children,” said a U.S. official familiar with the internal debate about the policy. “This administration still has its hands somewhat tied with what it can do with that population,” that person said.

The new policy around unaccompanied children is part of the Attorney General’s efforts to avoid creating a another protected group of illegal immigrants like those under DACA, the Herald’s sources said.

The arrival of unaccompanied children and families from Central America peaked in 2014. In the year between October 1, 2013 and September 30, 2014 U.S. Customs and Border Protection (CBP) says it encountered 67,339 unaccompanied children.

At the height of the influx in June 2014, 27,000 people, including unaccompanied children and families, crossed the U.S.-Mexico border. Three months later the number dropped below 5,000 following crackdowns by the U.S. and Mexico governments.

More than 150,000 children have been referred by Homeland Security to the Office of Refugee Resettlement since that time. The program cares for unaccompanied children after they are caught at the border by officials and either places them in shelters, with sponsors, or relatives in the U.S.

About 63 percent and 73 percent of the unaccompanied youth who arrive at the border are between 15 and 17 years old, making a large group of those who are in the U.S vulnerable to deportation if the administration moves ahead with the policy.

“For a growing population of migrants deported from Mexico and the United States to Central America, the conditions upon return typically are worse than when they left, setting up a revolving-door cycle of migration, deportation, and remigration,” according to the nonprofit Migration Policy Institute. The group advocates better programs to reintegrate those who are deported to their home country.

If the Trump administration decides to move ahead with the policy proposal it will it will likely meet similar opposition to Trump’s travel ban on people coming to the U.S. from six Muslim-majority nations. Elements of the ban have been blocked by federal courts and a legal case against the policy will be heard in the U.S. Supreme Court this fall.

The new policy on unaccompanied minors could be blocked by the courts almost immediately, said Leon Fresco, the former head of the Office of Immigration Litigation at the Justice Department during the Obama administration.

The question is, Fresco said, “whether the administration wants to add this to the travel ban, sanctuary cities, Byrne Jag grants, and DACA repeal to the issues they would want the Supreme Court to have to decide this year.”

These kids clearly are entitled to full and fair hearings before U.S. Immigration Judges with full rights of appeal. So, whatever Gonzo Apocalypto has up his sleeve must be clearly illegal.

DOJ career lawyers probably realize that their law licenses, and perhaps their individual freedom, could be at stake for participating in such an illegal operation. It would be nice to think that Sessions could also be held accountable under the law. But, as a high-ranking Government official, he’s likely to escape liability under the current Supreme Court rulings. Besides, Trump (or Pence) would probably pardon him anyway in the tradition of his fellow racist xenophobe “Racist Joe.”

ADMINISTRATION TRASHES RULE OF LAW, DENIES DUE PROCESS AT U.S. SOUTHERN BORDER!

“U.S. immigration officials have a long history of overstepping the boundaries of their legal authority and violating the constitutional and other legal rights of migrants at the Southwest border. Allegations of abuse throughout the apprehension, detention, and deportation process are not new; immigrant rights organizations and media outlets have reported on those violations for years.

Deportations in the Dark: Lack of Process and Information in the Removal of Mexican Migrants, a new report released by the American Immigration Council, is the most recent effort to document such violations. The report shows the extent to which U.S. immigration officials prevent migrants in their custody from accessing critical information and processes, which in many cases jeopardizes their chances to access various forms of immigration relief. Specifically, the report examines whether U.S. immigration agents properly inform migrants of their rights, actively obstruct their ability to exercise these rights, coerce or intimidate migrants in their custody, or neglect to provide removal documents to migrants at the time of repatriation.

The study is the result of a collaboration between the Council and the Mexico-based Binational Defense and Advocacy Program (in Spanish, Programa de Defensa e Incidencia Binacional, or PDIB), a Mexican human rights initiative established in 2010 to document abuses perpetrated against repatriated Mexican immigrants during their time in the United States. With staff currently located in three different sites—Nogales, Sonora; Nuevo Laredo, Tamaulipas; and Ciudad Juárez, Chihuahua—PDIB interviews migrants upon deportation to Mexico on an ongoing basis.

Based on new survey data (600 interviews) collected by PDIB between August 2016 and April 2017 and testimonies gathered between August 2016 and May 2017, the study found that migrants are frequently deprived of legally required information, told they cannot contact their consulates, compelled to sign documents they cannot read or understand, threatened with protracted detention, and blocked from applying for asylum and other legal claims.

For example, half of the respondents who signed repatriation documents reported that they were not allowed to read the documents before they signed them; 57.6 percent did not receive their repatriation documents; 43.5 percent were not advised of their right to contact their consulate; more than half (55.7 percent) were not asked if they feared returning home.

This report is perhaps the first attempt to systematically analyze the prevalence of denied access to critical information among migrants in U.S. custody. Some of the issues highlighted here, however, have been raised by advocates and been subject to litigation in the past. One concrete example is the case of immigration agents misleading migrants into waiving their right to a removal hearing by signing for voluntary return.

When immigration authorities deprive migrants of critical information regarding their rights or the opportunity to exercise them, migrants may face unjust deportation and lose the ability to ever seek legal admission or apply for asylum in the future. As the U.S. government promises to institute a new level of immigration enforcement, the behavioral patterns of U.S. immigration authorities highlighted in this report are a source of concern.“

This is what Jeff “Gonzo Apocalypto” Sessions’s disingenuous claims about the “Rule of Law” really mean. And, for EOIR to post on its website DOJ propaganda about how ramming through more final orders of removal, many without full due process because individuals were given not given legally sufficient notice of their hearings, were effectively denied their right to counsel, were denied the opportunity to gather documentation necessary for their cases, or were coerced into withdrawing claims or waiving appeals, has something to do with the Imigration Courts’ mission is simply more proof that the current system has become a disgraceful mockery of justice.

America needs an independent Article I Immigration Court, now!

NEWSWEEK: How The Trump Administration’s Wrong-Headed Policies Threaten To Turn Silicon Valley Into The “Next Detroit!”

D“The end of the 1960s turned out to be Detroit’s apex. In the early 1970s, dubious U.S. economic and foreign policy led to disaster when the Middle East OPEC nations initiated an oil embargo. Gas became scarce and expensive, and Detroit was caught focusing on the wrong products—ostentatious gas-guzzlers—at the wrong time, giving Japanese makers of small cars an opening in the U.S. market. Pulitzer Prize–winning auto historian Joseph White wrote about two fateful mistakes that made things worse. First, “Detroit underestimated the competition,” he said. The likes of Toyota and Honda had become much more adept than industry executives realized. Second, the U.S. companies “handled failure better than success.” Detroit’s decades of triumph set up the hubris, waste and bad practices that came to haunt it.

From there, it was a short trip to loss of market leadership, layoffs, plant closings and a city that fell into a desperate decline.Think that could never happen to Silicon Valley? Like 1970s Detroit, Silicon Valley seems to be handling success rather badly. Look at the twisted mess at Uber and the culture wars tearing at Google’s guts. Insanely high valuations of private companies are starting to look like a perilous pyramid scheme Bernie Madoff might admire. High costs and ever-worsening congestion are making the San Francisco Bay Area nearly unlivable for all but the superrich. At the same time, much of U.S. tech is underestimating the competition, particularly from China and the European Union.Making it all worse, the Trump administration seems to be doing everything it can to help shove Silicon Valley off its pedestal. Trump’s policies on trade, immigration and investment are giving competing nations openings to steal important chunks of Silicon Valley’s global leadership, lure away talent and divert capital to other rising tech centers—even France. (You know, the country President George W. Bush once said doesn’t even “have a word for entrepreneur .”)

Most damaging of all may be the policies of the Trump administration, which has been implementing or proposing one policy after another that puts the industry at a competitive disadvantage.Earlier this year, the president initiated a review of H-1B visas for foreign workers, which tech companies rely on to bring in talent. More recently, the Trump administration delayed —and may kill—the International Entrepreneur Rule, which would make it easier for foreign company founders to bring their startups to the U.S. “At a time when countries around the world are doing all they can to attract and retain talented individuals to come to their shores to build and grow innovative companies, the Trump administration is signaling its intent to do the exact opposite,” said Bobby Franklin, president and CEO of the National Venture Capital Association.And in early September, Trump said he will end the Deferred Action for Childhood Arrivals program, which has allowed undocumented immigrants who were brought to the U.S. as children to stay. Now, they may be deported. Some are valuable employees of tech companies. Microsoft pledged to pay the legal expenses of any employees who face deportation as DACA ends. Microsoft President Brad Smith called Trump’s decision “a big step back for our entire country,” and the industry worries that it will further discourage talented foreigners from coming to the U.S.Other countries have started pursuing international talent like sharks circling surfers at dusk. “I myself hope that many of these engineers will come to China to work for us,” said Robin Li, CEO of Chinese tech giant Baidu. Canada’s minister of innovation, Navdeep Bains, launched a recruitment program, saying, “We want to be open to people.” French President Emmanuel Macron announced that tech talent can “find in France a second homeland.”Even more detrimental to U.S. tech are two other Trump decisions: pulling out of the Paris climate accord and dumping the Trans-Pacific Partnership (TPP) agreement on trade with Asia.”

As this interview shows, this problem has been building steadily under the past three Administrations. However, the “gonzo enforcement” policies of the Trump Administration, combined with “ADR” (“Aimless Docket Reschuffling”) caused by poorly planned, and in many cases unneeded, details of Immigration Judges from backlogged “home dockets” to obscure detention centers along the Southern Border in response to Trump’s Executive Orders on enforcement, made worse by constant threats to mindlessly throw DACA individuals and TPS holders into the already overwhelmed system have greatly and unnecessarily aggravated an already bad situation.

Judge Marks points out that nearly 40% of the current U.S. Immigration Judiciary, including all of the most experienced judges, are eligible or nearly eligible to retire. That would mean a whopping 140 new Immigration Judge hires in a short period of time in addition to filling the current approximately 50 vacancies and any other positions that might become available. That adds up to approximately 200 new judicial vacancies, not counting any additional positions that Congress might provide.

No Administration has been able to competently hire that many new judges using a proper merit selection process. Indeed, the last Administration, using a system that could hardly be viewed as ”merit based,” took an astounding average of nearly two years to fill a vacancy on the U.S. Immigration Court! That’s amazing considering that these are administrative judges who do not require Senate confirmation.

The total unsuitability of the U.S. Justice Department to be administering the U.S. Immigration Courts has been demonstrated not only in terns of misuse of the courts for politicized law enforcement objectives, but also in terms of poor planning and stunningly incompetent judicial administration.

We need an independent Article I U.S. Immigration Court, and we need it now!

“Like most Midwestern cities, this one is losing its native population. It’s becoming less appealing to the people born and raised there, who have their sights set on warmer states in the South and West.

But as locals move out, immigrants are moving in.

Rockford has manufacturing and aerospace jobs, and help-wanted fliers are taped inside the windows of storefronts. It’s a short drive from Milwaukee, Madison and Chicago. Housing is affordable. There are Buddhist temples and a mosque, and tight-knit immigrant communities that praise Rockford to friends and families overseas who are looking to settle in America.

For these reasons, among others, the city’s immigrant population grew by 64 percent from 2000 to 2015, according to U.S. Census data, helping to mitigate a net population loss of about 10,000 people between 2010 and 2016.

Rockford is emblematic of a larger trend that’s happening at a time when the country is torn over the issue of immigration. In more than 40 Midwestern cities, immigrants are a lifeline, bucking the pattern of population loss and revitalizing an aging workforce. In the last 15 years, immigrants accounted for 37 percent of the growth of Midwestern metropolitan areas — defined as a city and its surrounding suburbs. That’s a significant contribution for a region that has experienced the slowest growth in the nation.

In larger cities like Chicago, population loss is greater and the influx of immigrants isn’t having the same impact as in smaller Midwestern cities. Chicago and its suburbs lost 19,570 residents in 2016 — the most of any major city in the country.

Immigrants tend to settle in ethnic neighborhoods in larger cities, and have a more difficult time assimilating. Demographers predict that immigrants will likely keep fueling the populations of quieter, midsize cities like Rockford, where some say it’s easier to adjust to American life.

“I think in Rockford, you can be part of America,” said Sunil Puri, a Rockford businessman who moved there from India in the 1970s. “The middle class, in the middle part of the country, in Midwestern America.”

Like most Midwestern cities, this one is losing its native population. It’s becoming less appealing to the people born and raised there, who have their sights set on warmer states in the South and West.

But as locals move out, immigrants are moving in.

Immigrants can’t fully make up for population losses across the Midwest communities, but without them, cities and towns would be far worse off, demographers say.

The number of people born in the U.S. has declined since 2000 in about one-third of Midwestern metropolitan areas, according to a report compiled by Chicago demographer Rob Paral in May for the Chicago Council on Global Affairs. Another third of the cities have grown slowly — by less than 7 percent while the nation as a whole grew by 14 percent during that same time.

While immigrants made up 7.8 percent of Midwestern metropolitan areas in 2000, that number rose to 9.7 percent by 2015. The areas with the most foreign born people continue to be traditional gateway cities like Chicago, Minneapolis and Detroit. But in areas less-known for their immigrant communities, like Rockford, Iowa City, Bloomington, Ind., Wichita, Kan., Lincoln, Neb., and Grand Rapids, Mich., immigrants are starting to make up nearly 10 percent of the population.

In towns large and small across Indiana and Wisconsin, the trend is noticeable, according to people surveyed by the Tribune. They say their neighborhoods are diversifying, and they can count a number of newer, immigrant-owned restaurants or businesses they’ve visited. In Rockford, most residents believe the city to be welcoming to immigrants, and say instances of discrimination are generally rare. They also say they’ve noticed an effect on the economy.

“From an economic standpoint, we’re seeing the impact the immigrant population has on our city,” said Mayor Tom McNamara. “It’s pretty dramatic. Foreign-born residents are starting businesses at a more frequent rate.”

Still, Rockford’s home county, Winnebago, voted for President Donald Trump, who promised to reduce illegal immigration and has proposed policies since taking office to do so. Last month, Trump embraced legislation that would dramatically reduce legal immigration and shift toward a system that prioritizes merit and skills over family ties.

Because foreign-born people are a key component of Midwestern cities, Paral said, policies that curtail immigration put their population growth at risk.

“In light of Trump’s policies, anything that hurts cities is bad for the Midwest, because we have a lot of cities back on their heels (after) population loss,” Paral said.”

Wow! Just think how great America could become if we had an Administration that ditched the White Nationalist, racist, xenophobic agenda and instead worked to develop a sane immigration policy that actually advanced our national interests? That would include legalization, significantly expanded opportunities for legal immigration (and not just for English-speaking PHDs — forget the xenophobic, White Nationalist “RAISE Act” built on the premise that immigraton is bad and has to be reduced or “offset” – hogwash!), more enforcement of wage and hour laws, and concentrating immigraton enforcement resources on “bad guys” rather than folks who are here to hep us prosper and move forward.

Also, what would it be like to have an electorate where more folks voted their own and their country’s best interests, instead of voting their biases, fears, and erroneous beliefs (like, perhaps undocumented migrants should get in a nonexistent “line,” or that immigration is bad for American workers, or that migrants don’t want to assimilate and be part of the community).

Our daughter Anna and her family live just over the state line from Rockford in Beloit, WI. Migrants of all types are helping to revive what had been a “down and out” former manufacturing center. In other words, they are an important part of the “Beloit Proud” movement that is making Beloit a better place to live.

The Trump Administration and in particular “Gonzo Apocalypto” Sessions are getting in the way of progress. Pretty ironic for an Administration that claims to want to reduce government regulation and intrusions on American businesses and communities, while actually building an expensive and counterproductive internal police force in the guise of immigration enforcement.

“JEROME, IDAHO —In the Magic Valley of southern Idaho, milk is money.

Over 400,000 cows reside in this area, where the miracle of modern irrigation from the Snake River fed pioneer farming. Bovines now outnumber humans by more than two to one. Workers in rubber boots pull long shifts feeding livestock, clearing mountains of manure and extracting millions of pounds of milk all day, every day, all year, on ranches tucked into the rock and sagebrush-studded landscape. Sleek silver tankers filled with milk barrel down Interstate 84 toward dairy processing plants, among them one owned by Chobani, which opened the world’s biggest yogurt factory five years ago just down the road in Twin Falls. Since 2000, milk production has doubled in Idaho, providing the state with $10.4 billion in direct sales, according to University of Idaho economists. Chobani’s gleaming $750 million, cream-colored plant is just one of the many big businesses linked to Idaho’s voluminous milk production, now around third- or fourth-largest among states.

In short, the Magic Valley’s dairy boom is a contemporary rural American success story—the kind that President Donald Trump railed as a candidate is too often missing across the country. Unemployment here was less than 3 percent this summer, about as good as it gets, and optimism should be high. Yet on dairy farms, among both owners and workers, a sense of dread hangs in the dry southern Idaho air.

Dairy farmers lean heavily Republican in this deeply red state of only 1.7 million people, where 88 percent of the voting-age population are non-Hispanic whites. But in the age of Donald Trump—who won Idaho handily —even the farmers who supported the new president fear their businesses are about to run headlong into a harsh political reality. They’re frightened that Trump’s aggressive deportation policies will soon start to pick off or push away the mostly Hispanic immigrants who do the gritty work that Americans aren’t interested in doing. Many of these workers are probably undocumented, farmers acknowledge, yet they’re the sturdy backbone of a surging industry. Here in the Magic Valley, the farmers’ perspective is starkly different from the president’s claim that undocumented workers “compete directly against vulnerable American workers.”

And the farmers’ view is pitting them against a vocal contingent of neighbors who’ve responded both to Trump’s rhetoric and far-right media that has targeted immigrants as a threat. Southern Idaho, in fact, became a flashpoint for xenophobia this past year when outlets like Breitbart and InfoWars, seized on false reports about Muslim refugees—accusing them of gang rapes and the spread of fatal diseases like tuberculosis—and turned the remote area into an anti-immigrant cause celebre. But locally, it’s starting to sink in that Trump’s vows to oust undocumented workers—whom he claims are a drain on the economy—could actually kick the legs out from under the “Made in America” model the Magic Valley exemplifies.

Idaho dairy industry representatives estimate that between 85 to 90 percent of on-site dairy workers in the state are foreign-born. The U.S. Department of Labor and other estimates suggest that nearly half to 70 percent of all U.S. farm laborers are undocumented—certainly enough to shut down many of the milk pumps here if workers are ousted as a result of Trump’s policies.

That’s why farmers’ groups have for years pushed Congress, unsuccessfully, to make it possible for them to legally employ immigrants they say are desperately needed. Prospects don’t look any rosier now. In recent months, anti-immigrant rhetoric has only grown more vitriolic, and Trump supporters—including some here—are expecting the president to follow through on campaign promises and deport more people.

Those who understand the dairy business here fear that a political solution won’t materialize before it’s too late, if ever. And that means businesses could struggle due to labor shortages and plummeting production.

“The dairy industry is a big money maker. But without workers, without somebody that’s going to be there 12 hours a day, milking your cows, getting dirty, there’s no business,” said Shannon Pérez, a non-Hispanic Anglo, as people here say, who’s worked on dairy and calf ranches. She’s already watched helplessly as her own family was split by deportation.”

For those of us who have worked in the field of immigration for decades, it is hardly surprising that policies driven by White Nationalism, xenophobia, and just plain old racism and meanness would hurt a wide and diverse swarth of Americans, including many of those same misguided souls who ignored the facts and voted Trump into office.

We need to screen the undocumented folks who are here now, remove those who are criminals or engaging in socially destructive conduct, and give some type of legal status to the rest. Then, we need to significantly expand the number of legal immigrants we accept each year to more closely match market demand, save more lives of those fleeing harm, harness the energy, skills, and talents that will allow us to prosper and lead in the future, and make future immigration enforcement rational, efficient, and effective (by not wasting time arresting, detaining, and deporting those who actually are here to help us).

Folks like Jeff Sessions are pushing an irrational program that if it actually were achievable (which is isn’t) would cripple and perhaps destroy both the economy and the social fabric of our great nation.

It’s time for the majority of “rationalists” (regardless of party affiliation) to band together and defeat the attack of a well-organized minority that is out to harm our country and endanger our future.

BRET STEPHENS IN NYT: Right Finally Getting The Trump They Deserve!

“Who are the “cuckservatives” now?

I use the epithet — “cuck” is short for cuckold — since it’s the one Trump’s most vociferous supporters hurled at mainstream Republicans they accused of caving in to the moral bullying of liberals, especially on the subjects of race and immigration.

But now it’s the president who is doing exactly that, making the case for DACA beneficiaries in terms his base most condemns: as “good, educated and accomplished young people who have jobs, some serving in the military” and who don’t deserve to be thrown out of the country simply because their parents brought them to the United States as children. It’s the kind of thing Nancy Pelosi — or, worse, John McCain — might say.

It’s also the kind of thing that could make for a successful presidency, if only Trump could follow his pragmatic instinct, banish his inner Steve Bannon and shelve the worst promises of his candidacy, as he already has with his threats to exit NATO.

Next steps could include pairing an infrastructure bill with tax reform, eliminating budget sequestration and the debt ceiling, restoring funding to the State Department and cutting it to the United Nations, and saving the nuclear power industry through deregulation and federal subsidies — in the name of combating climate change.

But Trump’s move toward the Democrats on DACA — just as his earlier move toward them on the debt ceiling — isn’t about pragmatism. It’s not even about the plasticity of his convictions.

It’s about his addiction to betrayal, his contempt for those who bend their knee to him, his disdain for “losers” (especially when they’re on his side) and his desperate need to be admired by those who despise him most simply because they have the wit to see through him. This is a presidency whose defining feature isn’t ideology, much less policy. It’s neurosis.

In other words, there is no “pivot” at work in the presidency, in the mold of Arnold Schwarzenegger’s leftward turn during his governorship of California. There’s a mood swing.

That might comfort the Trump true believers who fear their president is abandoning them. It shouldn’t: He feels about as much loyalty toward them and their convictions as he’s felt toward his several wives. Remember that, as recently as 2012, he denounced Mitt Romney for an excessively harsh attitude toward immigrants, calling the Massachusetts governor’s policy of self-deportation “crazy” and a turnoff to “everybody who is inspired to come into this country.”

All of this is fun, since it’s always delightful to see blowhards and bigots get their comeuppance at the hands of their idol. The ideologues of the right are left to make do with their jester and his antics. I hope they have a sense of humor about it.

But there’s also a lesson for conservatives who mistook Trump’s bluster for seriousness. Not least among the conservative “Never Trump” objections to the candidate is that he would be a disaster to the Republican Party — not just because his beliefs, such as they were, were anathema to the party’s best traditions, but because at heart he was a destructive opportunist with no core convictions beyond his own immediate advantage.

The president’s newfound good sense on DACA is good news for the country, provided it lasts. Nobody should count on it whipping any sense into those conservatives who fell for him, also known as cucks.”

The latest issue of Action Comics No. 987 contains a scalding scene: A white supremacist, fed up with a company that just laid him off, decides to load up his machine gun and kill the undocumented workers he believes took his job. Luckily, in the nick of time, Superman arrives to shield the would-be victims from a storm of bullets:

Superman then subdues the shooter, telling him that he needs to take more personal responsibility and to rethink his homicidal tendencies. He also tells the police officers who respond to the incident to see to it that the shooter’s intended victims are safe:

Given the violent events that took place in Charlottesville, Virginia, last month, including a domestic terror attack that killed Heather Heyer, as well as the recent national conversation over the Trump administration’s stance on DACA, it’s easy to see how the plot of Action Comics No. 987 could feel like a knee-jerk reaction and parallel to reality. But in reality, comic book issues and arcs — including this one, which was written by Dan Jurgens and illustrated by artists Viktor Bogdanovic, inkers Jonathan Glapion and Jay Leisten, and colorist Mike Spicer — are planned well in advance.

Still, the action of preventing a mass murder, which seems in line with Superman’s moral compass, hasn’t come without controversy. Fox News has a column calling the Man of Steel a “propaganda tool for the defenders of illegal aliens,” and the right-wing website Breitbart derided him as “Social Justice Supes.”

Their argument is that comic book writers and artists have inserted a pro–illegal immigrant agenda into their comics, and that it’s part of a larger trend of politicizing comic books.

But there are a couple of things to note about the issue.

The first is that the “undocumented workers” designation in Action Comics No. 987 comes from the homicidal white supremacist — an unreliable narrator. It could be interpreted that he’s shooting at the workers at his company who aren’t white because he’s stereotyping and projecting his bigotry onto them.

Another facet of this issue is that in the universe of the comic, similar violent outbursts and anger are happening worldwide. Vaccines are being stolen, animals are being poached, workplaces are being shot up, prison riots are taking place — and Superman is struggling to figure out why it’s all erupting at once. The thwarted workplace shooting is part of a bigger arc that involves the idea that the “common good” has been dissolved, and there’s a villain responsible for it (the issue has a giant reveal at the end).

Perhaps the most entertaining aspect of any conversation bemoaning Superman’s lifesaving actions is the failure to realize that Superman himself is a literal alien immigrant who grew up in America. Superman’s creators, Jerry Siegel and Joe Shuster, are the children of Jewish immigrants.

And Superman has always stood up for the justice of all Americans, as he did in this 1950s poster:

“If you hear anybody talk against a schoolmate or anyone else because of his religion, race or national origin — don’t wait: tell him that kind of talk is un-American,” Superman says in the scene on the poster.

This week’s issue of Action Comics, despite the outcry against it, seems to be following that credo.

WHAT DO YOU CALL SOMEONE WHO ENJOYS INFLICTING GRATUITOUS PAIN AND SUFFERING ON VULNERABLE PEOPLE? — Jeff Sessions

“THE BIG IDEA: Photographers caught a giddy Jeff Sessions cracking a satisfied smile last week as he prepared to announce that 690,000 undocumented immigrants who had been brought into the United States as minors would no longer be shielded from deportation. The Deferred Action for Childhood Arrivals program “is being rescinded,” the attorney general declared in the first line of his statement. “There is nothing compassionate about the failure to enforce immigration laws. … Failure to enforce the laws in the past has put our nation at risk of crime, violence and even terrorism. … The effect of this unilateral executive amnesty, among other things, contributed to a surge of unaccompanied minors on the southern border that yielded terrible humanitarian consequences. It also denied jobs to hundreds of thousands of Americans by allowing those same jobs to go to illegal aliens.” Fact checkers called these and other claims Sessions made about the immigrants known as “dreamers” dubious or outright false. Perhaps that’s why he didn’t take questions afterward. Regardless, the speech was widely covered as a triumph for the nation’s chief law enforcement officer and a sign that he was out of President Trump’s doghouse. Not only did Sessions get the outcome he wanted; he also got to deliver the news from the Justice Department briefing room. Trump’s DACA decision last week seemed to validate Sessions’s decision to slog on through the summer even after being frozen out of the inner circle. From interviews to tweets, Trump repeatedly attacked his attorney general throughout July as “weak” and “beleaguered.” The main reason Sessions chose to put up with indignities that might cause most people to quit was because he believed he could make a difference on immigration policy. That has always been his signature issue and animated his two decades in the Senate.

— But it took less than 10 days for Trump to once again undercut Sessions. The president on Thursday signaled his embrace of granting permanent legal status to these “dreamers” as part of a deal with Democrats that he said is close to being finalized. He also acknowledged that he’s not going to make a deal to save DACA contingent on getting funding for the wall he wants to build along the U.S.-Mexico border.

Discussing the exact same group of people that Sessions painted with such a sinister brush one week earlier, Trump tweeted yesterday: “Does anybody really want to throw out good, educated and accomplished young people who have jobs, some serving in the military? Really!” Trump tweeted yesterday. “They have been in our country for many years through no fault of their own — brought in by parents at young age.”

Quite simply, Jeff “Gonzo Apocalypto” Sessions is a poor excuse for a human being and a disgrace to the U.S. Department of Justice. What kind of person is motivated by a desire to destroy our society by hurting fine American young people and smearing them with lies and innuendo?

But, let’s not forget who empowered his message of hate and fear by appointing him, and who “blew by” his long record of racial problems while silencing the opposition that told truth. And, a special “shout out” should go to those who voted to put this intentionally divisive Administration in office and to the unapologetically racially challenged white GOP voters of Alabama who elected this leftover of the Jim Crow era time and time again.

Jeff Sessions does not represent the values of the majority of Americans. We must get it together at the ballot box to insure that he (and those like him) never again happen to us and to our country!

Under Pressure From Federal Court, DHS Might Extend Key DACA Deadline!

“The Department of Homeland Security is “actively considering” delaying a looming deadline for so called-Dreamers to renew their status under the Deferred Action for Childhood Arrivals, a Justice Department attorney said at a court hearing Thursday, according to attendees and a government official.

Deputy Assistant Attorney General Brett Shumate cited the hurricanes that recently hit Texas, Florida and nearby states as grounds for the potential delay to the Oct. 5 deadline, while noting that no final decision had been made, an official said.

Word of the possible delay came as a federal judge signaled that he might postpone the cut-off date unless the Trump administration acted first, attendees at a Thursday court hearing said.

During the session, in federal court in Brooklyn, U.S. District Court Judge Nicholas Garaufis repeatedly labeled the deadline “arbitrary” and said he saw little harm in pushing it back, according to advocates.

“He focused quite a bit on the October 5 deadline and called it arbitrary,” said David Chen, a Yale law student helping litigate the issue, “and said essentially that so many people who are DACA recipients would face quite a lot of harm and experience quite a lot of chaos if they were unable to renew by the deadline.”

The Trump administration announced last week that it was winding down the Obama-era program known DACA, a mechanism used to give quasi-legal status and work permits to about 800,000 undocumented foreigners who arrived in the U.S. as children.

Homeland security officials announced that people whose work permits are set to expire between Sept. 5, 2017, and March 5 of next year must submit a renewal application by Oct. 5 to receive another two-year permit. After March 5, no more DACA permits will be granted, leading to a two-year phase-out of the program, officials said.”

NY TIMES: Trump Actually Fired Jeff Sessions Over Mueller Appointment — Pence & Others Talked Unglued Prez Out Of Accepting Resignation! — Trump’s Intent To Obstruct Russia Investigation Clear If Report Accurate!

“WASHINGTON — Shortly after learning in May that a special counsel had been appointed to investigate links between his campaign associates and Russia, President Trump berated Attorney General Jeff Sessions in an Oval Office meeting and said he should resign, according to current and former administration officials and others briefed on the matter.

The president blamed the appointment of the special counsel, Robert S. Mueller III, on Mr. Sessions’s decision to recuse himself from the Justice Department’s Russia investigation — a move Mr. Trump believes was the moment his administration effectively lost control over the inquiry. Accusing Mr. Sessions of “disloyalty,” Mr. Trump unleashed a string of insults on his attorney general.

Ashen and emotional, Mr. Sessions told the president he would quit and sent a resignation letter to the White House, according to four people who were told details of the meeting. Mr. Sessions would later tell associates that the demeaning way the president addressed him was the most humiliating experience in decades of public life.

The Oval Office meeting, details of which have not previously been reported, shows the intensity of Mr. Trump’s emotions as the Russia investigation gained steam and how he appeared to immediately see Mr. Mueller’s appointment as a looming problem for his administration. It also illustrates the depth of antipathy Mr. Trump has had for Mr. Sessions — one of his earliest campaign supporters — and how the president interprets “disloyalty” within his circle of advisers.

Mr. Trump ended up rejecting Mr. Sessions’s May resignation letter after senior members of his administration argued that dismissing the attorney general would only create more problems for a president who had already fired an F.B.I. director and a national security adviser. Mr. Trump once again, in July, told aides he wanted to remove Mr. Sessions, but for a second time didn’t take action.

The president relented, and eventually returned the resignation letter to Mr. Sessions — with a handwritten response on it.

For Mr. Sessions, the aggressiveness with which Mr. Trump has sought his removal was a blow. The son of a general store owner in a small town in Alabama, Mr. Sessions had long wanted to be the nation’s top federal law enforcement official or to serve in another top law enforcement or judicial post. He earned a reputation in the Senate as someone tough on immigration, and was the first senator to back Mr. Trump in the presidential campaign.

But their relationship began to deteriorate little more than a month after Mr. Trump was sworn in as president, after Mr. Sessions’s announcement that he was recusing himself from the Russia inquiry caught Mr. Trump by surprise.

The president spent months stewing about the recusal. In a July 19 interview with The Times, Mr. Trump said he never would have appointed Mr. Sessions to be attorney general if he knew he was going to recuse himself from the Russia investigation. Mr. Trump called the decision “very unfair to the president.”

Days after the Times interview, Mr. Trump told aides he wanted to replace Mr. Sessions. Some of the president’s aides, not sure if Mr. Trump really wanted the attorney general gone or was just working through his anger, were able to delay the firing until the president’s anger passed.

But Mr. Trump continued his public attacks in the days that followed, including taking to Twitter to call him “weak” — a word that is among the harshest criticisms in Mr. Trump’s arsenal.

Administration officials and some of Mr. Trump’s outside advisers have puzzled at Mr. Sessions’s decision to stay on. But people close to Mr. Sessions said that he did not leave because he had a chance to have an impact on what he sees as a defining issue of his career: curtailing legal and illegal immigration.

In recent weeks, he has spearheaded the effort to undo what he believed to be the Obama administration’s dangerously lenient immigration policies, including the Deferred Action of Childhood Arrivals program.

Mr. Sessions had no illusions about converting Mr. Trump to his side of the argument — Mr. Trump remains deeply ambivalent — and he had no illusions about repairing a damaged relationship he had once regarded as a friendship. But he told people he felt he had successfully pushed the president toward ending the Obama immigration policy, and thought it had given him increased leverage in the West Wing.

The president agreed to terminate the program, and on Sept. 5 Mr. Sessions stood alone at a lectern — a moment that seemed to be a significant victory for the attorney general.

But his satisfaction was fleeting. Mr. Trump quickly undercut Mr. Sessions in a tweet by saying he would reconsider whether or not to end the program, leading the attorney general to tell allies that he was frustrated that the president had muddled months of work leading to the announcement of the new policy.

On Wednesday evening, Democrats announced they had reached a deal with the president to quickly extend protections for young undocumented immigrants.

On Thursday morning, taking a vastly different position from the one Mr. Sessions had announced, the president tweeted about the need for protections for people brought here “through no fault of their own.”

I’m not in favor of publicly humiliating any human being, even Jeff Sessions. But, my sympathy is tempered by Sessions’s willingness to lie and humiliate migrants, Hispanics, African Americans, and members of the LGBTQ community, among others, in pursuit of his obscene White Nationalist agenda. In other words, to pick on the most vulnerable members of our society, rather than using the laws to protect them and advance the cause of justice, including social justice (a concept that Sessions has never grasped).

Trump’s reasons for firing Sessions were unethical and wrong. But, Sessions is already the worst and least qualified Attorney General in modern history. When he finally departs the Department of Justice, of his own volition or otherwise, it will be a relief to all Americans who believe in the Constitution and a diverse, humane, inclusive society. The only question is whether the damage that Sessions is doing at Justice and to the Department’s credibility can ever be repaired after the debacle of his tenure finally ends.

THE HILL: N. RAPPAPORT SUGGESTS LEGISLATIVE SOLUTIONS FOR LONG-TERM “TPSers!”

“The Temporary Protected Status program (TPS) provides refuge in the United States to more than 300,000 aliens from a total of 13 countries: El Salvador, Guinea, Haiti, Honduras, Liberia, Nepal, Nicaragua, Sierra Leone, Somalia, Sudan, South Sudan, Syria, and Yemen.

They are supposed to leave when it is safe for them to return to their own countries, but it can take many years for conditions in their countries to improve. The need for TPS can last for decades.

It does not include a path to permanent resident status, but should aliens who have lived in the United States for decades be required to leave when their TPS is terminated?

Rep. Zoe Lofgren (D-Calif.) says that at some point they have been here so long that they should be allowed to remain permanently: “There should be some rational way to transition people who have been here for a long time … who because of the length of their stay have basically become valued members of our community.”

An alien is free to apply for other types of immigration status while he has TPS.

So, should congress make permanent resident status available to TPS aliens when conditions in their countries keep them here an exceptionally long time?

I agree with Lofgren that at some point, TPS aliens have been living here so long that it no longer makes sense to send them back to their own countries.

The best solution would be to change the TPS provisions to make some form of permanent status available when aliens are forced to remain for exceptionally long times because conditions in their countries do not improve, but that might not be possible.

One of the TPS provisions imposes a limitation on consideration in the Senate of legislation to adjust the status of aliens who have TPS. It provides that it shall not be in order in the Senate to consider any bill or amendment that provides for adjustment to lawful temporary or permanent resident status for TPS aliens, or has the effect of amending the TPS provisions in any other way.

This restriction can be waived or suspended with an affirmative vote from three-fifths of the senators, which is known as a “supermajority vote.”

But there is an alternative that would not require changing the TPS provisions.

The Registry legalization program, which was established in 1929, makes lawful permanent resident status available to qualified aliens who entered the United States before January 1, 1972; have resided in the United States continuously since such entry; and have good moral character.

An update of the registry cutoff point is long overdue. It has not been changed since it was set at 1972, by the Immigration Reform and Control Act of 1986 (IRCA).

The change would apply to all undocumented aliens who can meet the eligibility requirements.”

Read Nolan’s complete article, which contains a very succinct and helpful explanation of TPS which I omitted above, over at The Hill.

I think that Nolan has hit it on the head here! There is virtue in using existing administrative processes to deal with new issues. And, as he points out, “Registry” is there for the taking, and it’s been 30 years since it was updated!

Recollection: Understandably, we didn’t see very many “Registry” cases during my tenure at the Arlington Immigration Court (2003-16). But the rare ones we did receive always received “waivers” of the “no business at lunch rule” because they always involved such interesting human stories. I never came across one myself. But, I think that my colleagues who did always felt like they had discovered a “nugget of gold” in the least expected place! It would also help the Immigration Courts because most of the Registry cases (like the TPS cases) could be adjudicated over at USCIS, thereby reducing “docket pressure.” Bring back Registry! Yea Nolan!

“DREAM DEAL” DESCENDS INTO TYPICAL TRUMP CHAOS WITHIN 24 HOURS! — Who REALLY Knows What’s On His Mind?

“WASHINGTON ― President Donald Trump gave a series of conflicting statements on Thursday about how he hopes to deal with young undocumented immigrants who came to the U.S. as children, muddying the waters over whether he will support their bid to gain eventual citizenship and whether he will demand a border wall in exchange.

Trump’s comments, made both to reporters and on Twitter, came after leading Democrats in Congress said they had reached an informal deal with the president on legislation to help so-called Dreamers, or undocumented young people who entered the country as children.

Last week, Trump put the fates of hundreds of thousands of Dreamers up in the air by rescinding the Deferred Action for Childhood Arrivals program, which granted two-year work permits and deportation relief.

Senate Minority Leader Chuck Schumer (D-N.Y.) and House Minority Leader Nancy Pelosi (D-Calif.) said on Wednesday that they had reached an agreement with Trump to tie measures to grant Dreamers legal status to border security measures, but not to a wall. They said Trump had made clear he would continue to demand a wall, and that they had told him they would oppose it.

Trump denied that a deal had been made, although he initially did not dispute key details of what the Democrats had said. But later, he said Dreamers’ fates would be tied to the construction of a border wall, even if it’s not part of legislation that addresses Dreamers.

“We have to be sure the wall isn’t obstructed, because without the wall, I wouldn’t do anything. … It doesn’t have to be here but they can’t obstruct the wall if it’s in a budget or anything else,” Trump told reporters in Florida, according to a pool report.

He added that he would “only do it if we get extreme security, not only surveillance but everything that goes with surveillance,” Trump said. “If there’s not a wall, we’re doing nothing.”

The president also created more confusion by suggesting that he might not support allowing Dreamers to eventually gain citizenship. That would destroy any hope of a deal with Democrats, who want Trump to support the Dream Act, which would allow undocumented young people who came to the U.S. as children to eventually become citizens.

“We’re not looking at citizenship,” he said. “We’re not looking at amnesty. We’re looking at allowing people to stay here.”

That doesn’t necessarily preclude eventually supporting Dream Act-style measures, however. The bill would not grant citizenship immediately; it would allow Dreamers to gain legal status that would make them eligible for eventual citizenship ― so there’s potential that Trump could eventually back such measures and still claim they were not the “amnesty” he opposes.

Earlier on Thursday, Trump said in a series of tweets that any deal on Dreamers would be contingent on “massive border security,” although he didn’t specify that it had to include a wall. He added that the wall is “already under construction in the form of new renovation of old and existing fences and walls” and would proceed.”

DEAL OR NO DEAL? — You Can’t Tell With “The Donald” — But He Didn’t Really Deny That Something Is “In Play” With The Dems!

“President Donald Trump denied on Thursday that he had made a firm agreement with Democrats on immigration, but did not dispute key details from the deal ― namely, that protection for young undocumented immigrants wouldn’t be tied to his long-promised U.S.-Mexico border wall.

In a series of tweets on Thursday, Trump said that any deal on Dreamers ― undocumented immigrants who came to the U.S. as children ― would be contingent on “massive border security,” but did not specifically say it had to be the wall.

He later said that the wall is “already under construction in the form of new renovation of old and existing fences and walls” and would proceed.

Trump also told reporters outside the White House on Thursday that “the wall will come later.” Asked if he favors amnesty, the president replied that “the word is DACA.”

The president also seemed to throw cold water on concerns that he wanted to deport beneficiaries of the Deferred Action for Childhood Arrivals or DACA program, which the administration decided earlier this month to end.

Trump’s Thursday comments followed a dinner he held the previous evening with House Democratic Leader Nancy Pelosi (Calif.) and Senate Democratic Leader Chuck Schumer (N.Y.). Following the meeting, they announced that the president agreed to a border security plan that would offer protections to the 800,000 Dreamers, and that the wall was not part of the deal.

Pelosi and Schumer released a statement Thursday clarifying their announcement from the night before, confirming that no final deal had been put in place.

Yet they added, “While both sides agreed that the wall would not be any part of this agreement, the President made clear he intends to pursue it at a later time, and we made clear we would continue to oppose it.”

Many of Trump’s staunchest supporters, including Fox News Host Sean Hannity and conservative commentator Ann Coulter, quickly lashed out at reports that president seemed to be softening his stance on immigration.

White House Press Secretary Sarah Huckabee Sanders later tweeted that “excluding the wall was certainly not agreed to,” but a spokesman for Schumer shot back that, while the wall wasn’t dead yet, it wasn’t part of this deal specifically.

You know you’re on the right track, Mr. President, when you are being criticized by racist, national embarrassments Ann Coulter, Sean Hannity, and Rep. Steve King (R-IA) (how come the GOP hasn’t banished this guy for his unapologetically racist and xenophobic views? — Yeah, he has a Constitutional right to spout his poisonous lies on and off the floor of Congress, and the folks in his Congressional District have a right to elect him to publicly represent their racism, lack of decency, and lack of judgment. — But, that doesn’t entitle him to membership in one of our two major political parties.)

And ignoring the rancid input of AG Jeff Sessions and his White Nationalist clone Stephen Miller on anything touching on immigration or national security would also be wise. Just see where this “Demonic Duo” is going and head the other way as fast as you can.

Along with Bannon, Sessions and Miller are at home on the wrong side of history, particularly racial and migration history. The President already got bad legal advice, based on bogus ideological reasoning, from Sessions in terminating DACA. Now he is having to put distance between himself and the markedly xenophobic anti-DACA narrative that Gonzo set forth when gleefully announcing an end to DACA and cheerfully throwing 800,000 American lives into turmoil. What a guy!
