WASHINGTON (Reuters) – President Donald Trump’s administration asked the U.S. Supreme Court on Monday to allow it to end a program introduced by former President Barack Obama that protects thousands of young immigrants who live in the United States without legal status.

The day before congressional elections in which Trump’s harsh anti-immigration rhetoric has taken center stage, the administration urged the justices to throw out three lower court rulings that blocked Trump’s plan to wind down the Deferred Action for Childhood Arrivals (DACA) program.

The policy has shielded from deportation immigrants dubbed “Dreamers” and given them work permits, though not a path to citizenship.

In a court filing, Solicitor General Noel Francisco said the original DACA policy was introduced by Obama administration officials “even though existing laws provided them no ability to do so.” Now, it is lawful for the Department of Homeland Security to change course, he added.

“It is plainly within DHS’s authority to set the nation’s immigration enforcement priorities and to end the discretionary DACA policy,” Francisco said.

The Justice Department’s move was unusually aggressive in terms of procedure, asking the justices to take action even before intermediate federal appeals courts have ruled on the three lower court rulings. The administration says a final ruling is urgently needed.

If the Supreme Court, which has a 5-4 conservative majority, agrees to hear the case, a ruling would likely come before the end of June.

Poll: Voter enthusiasm surges among U.S. Hispanics

Trump and his conservative political allies have made his hard-line policies toward immigration a key issue ahead of Tuesday’s midterm elections that will determine if his fellow Republicans maintain control of Congress.

The Trump administration has argued that Obama exceeded his constitutional powers when he bypassed Congress and created DACA, which offers protections to roughly 700,000 young adults, mostly Hispanics.

The administration is contesting three different district court rulings from judges in California, New York and the District of Columbia that told the administration to continue processing renewals of existing DACA applications while litigation over the legality of Trump’s action is resolved.

The Administration shows its utter contempt for the Third Branch in two ways:

  • First, by essentially demanding to skip appealing the District Court orders to the Courts of Appeals, as all other litigants are required to do, they are expressing their contempt for the proper role of the Courts of Appeals;
  • Second, by publicly indicating that they “own” the Supremes and can get them to short-Circuit the system and do their bidding on demand.

A prudent Court would send Trump packing. Indeed, there is no reason whatsoever to allow the Government to circumvent the legal system here. Given that there are already 750,000 cases in Immigration Court, the 800,000 “Dreamers” aren’t going anywhere. Clearly, the Administration’s claim of “urgency” is totally bogus. Moreover, given the sympathetic circumstances of the Dreamers, there is no reason for the Court to rush on this one. It remains something that Congress eventually will have to solve, no matter how much they might want to avoid doing so.

We’ll see how this one plays out. It will tell us lots about the wisdom, integrity, and courage of the Supremes in the age of Trump.

Since the early days of his campaign, from his proposal to build a wall along the Mexican border to his discredited committee on voter fraud, President Trump has declared war on America’s changing demography. His administration has followed through on that strategy with a proposal to add a question to the 2020 census asking about citizenship. If the question remains on the form, millions of households, particularly Hispanic and Asian-American, could skip the census, leading to an overrepresentation of white Americans during this once-a-decade count.

Six lawsuits seeking to remove the proposed question are moving through the federal courts, with the first trial likely to take place this fall.

If it is added to the census form, the citizenship question will distort our understanding of who resides in the country. What this selective underenumeration will not do is make America’s growing racial minority populations disappear. The losers from this undercount include members of Mr. Trump’s older white base, who will suffer from lost investments in a younger generation, whose successes and contributions to the economy will be necessary to keep America great.

The demographic trends make this plain. America’s white population is growing tepidly because of substantial declines among younger whites. Since 2000, the white population under the age of 18 has shrunk by seven million, and declines are projected among white 20-somethings and 30-somethings over the next two decades and beyond. This is a result of both low fertility rates among young whites and modest white immigration — a trend that is not likely to change despite Mr. Trump’s wish for more immigrants from Norway.

The likely source of future gains among the nation’s population of children, teenagers and young working adults is minorities — Hispanics, Asians, blacks and others — most of whom are born in the United States.

Indeed, the only part of the white population that is growing appreciably is older people, the same group to whom Mr. Trump is appealing. Thanks to aging baby boomers, the older retirement-age white population will grow by one-third over the next 15 years and, with it, the need for the government to support Social Security, Medicare, hospitals and the like. Revenue for these programs will have to come from the younger minority population. If the census does not accurately count this population, then all the services that support children and future workers, such as public education, Head Start, the Children’s Health Insurance Program and Medicaid, will be shortchanged.

Although the slowly growing, rapidly aging white population will be accurately counted, the fast-growing minority school-age and young adult populations that represent the nation’s future will not get their due — demographically, politically or economically.

An in-house Census Bureau analysis based on 2010 survey data found that the inclusion of a citizenship question reduced the response rate among households that have at least one noncitizen individual. While 7 percent of United States residents are themselves noncitizens, 14 percent live in households that include one or more noncitizens. The latter figure rises to 46 percent among all Hispanics and to 45 percent among Asian-Americans, compared with just 8 percent among blacks and 3 percent among whites.

Let’s assume that one in three people in Hispanic and Asian noncitizen households refuses to answer the census. If that’s the case, the Hispanic share of the United States population would drop by 2.1 percentage points (from 17.3 to 15.2 percent) and the total white population share would rise by 2.2 percentage points (from 62 to 64.2 percent).

This imbalance would influence congressional reapportionment, hurting large, immigrant-heavy states. It will also shape how congressional and state legislative districts are drawn, favoring rural and small areas at the expense of large metropolitan areas, since noncitizen households are far more prevalent in the latter.

The underenumeration of racial minorities would also misallocate billions of dollars in state and federal funds for housing assistance, job training, community development and a variety of social services that should be distributed on the basis of census counts. It would provide a faulty framework for surveys that will inform thousands of policy and business decisions, such as where to locate schools, hospitals, employment sites or retail establishments catering to different population groups, over the next decade.

Through his rhetoric and actions, Mr. Trump stands for keeping America white, appealing to his base by implicitly promising to preserve the racial status quo. But Mr. Trump’s supporters, and the country in general, must not ignore the generational dependency between older whites and younger minorities. Forcing an inaccurate accounting of who resides in the nation will have long-term negative consequences for everyone.

All day and night they listened to the wailing of hungry children.

Here, in a freezing immigration detention facility somewhere in the Rio Grande valley of south Texas, adults and children alike were fainting from dehydration and lack of food.

Sleep was almost impossible; the lights were left on, they had just a thin metallic sheet to protect against the cold and there was nothing to lie down on but the hard floor.

This is the account of Rafael and Kimberly Martinez, who, with their three-year-old daughter, had made the dangerous trek from their home on the Caribbean coast of Honduras to the US border to ask for political asylum.

“The conditions were horrible, everything was filthy and there was no air circulating,” Kimberly Martinez told the Guardian of the five days the family spent cooped up in one facility they – like tens of thousands before them – referred to as “la hielera”: the icebox. Her husband added: “It’s as though they wanted to drain every positive feeling out of us.”

They knew, from following the news, that their ordeal of escaping gang violence back home and trekking across desert terrain at the height of summer would not end when they reached the United States.

What they did not expect, though, were days of hunger, separation and verbal abuse that they said they endured at the hands of federal immigration officials.

‘Caged up like animals’

All they were given to eat, they said, were half-frozen bologna sandwiches, served at 10 in the morning, five in the afternoon and two in the morning, and single sugar cookies for their daughter. What water they were given had a strong chlorine taste – a common complaint – and upset their stomachs.

The Martinezes (not their real name) were among dozens of asylum-seekers the Guardian interviewed in the border city of McAllen recently after they secured their provisional release from federal custody – with black electronic monitors fastened tightly around their ankles – and just before they continued their journeys by bus to the homes of US-based sponsors to await court hearings on their statuses.

The Guardian sat in with a team of volunteer doctors and nurses administering emergency medical care and listened as family after family gave jarringly consistent accounts of what they described as grim conditions in a variety of border detention facilities – conditions that have grown only grimmer since the advent of Donald Trump’s “zero tolerance” immigration policies.

Officials said the allegations made by families about their experiences in detention did not equate with what they knew to be common practice and they insisted detainees were treated with dignity and respect.

The “hieleras”, or iceboxes, asylum-seekers said, were overcrowded, unhygienic, and prone to outbreaks of vomiting, diarrhea, respiratory infections and other communicable diseases. Many complained about the cruelty of guards, who they said would yell at children, taunt detainees with promises of food that never materialized and kick people who did not wake up when they were expected to.

At regular intervals, day and night, the Martinezes, and many others, said guards would come banging on the walls and doors and demand that they present themselves for roll call.

If they talked too loudly, or if children were crying, the guards would threaten to turn the air temperature down further. When the Martinezes gathered with fellow detainees to sing hymns and lift their spirits a little, the guards would taunt them, or ask aggressively: “Why did you bother coming here? Why didn’t you stay in your country?”

“Many of these agents were Latinos, like us, but they were people without morals,” Rafael Martinez said, his voice choking with tears. “There we were, caged up like animals, and they were laughing at us.”

If any other country treated vulnerable individuals seeking to exercise their legal rights to claim refuge under the Geneva Convention in this way we would call it just what it is — extreme cruel and inhuman treatment amounting to torture. Yet, somehow, the architects of this abhorrent, racist, wasteful, and dehumanizing system — Trump, Sessions, Miller, Nielsen, and others — remain free and largely unaccountable.

They even have the absolute audacity to whine and complain when Federal Courts occasionally call them out for their gross contempt for the law and Constitution and force them to take corrective action — which they do grudgingly, disrespectfully, without apology, and ineffectively.

Just today, “Gonzo Apocalypto” was sputtering about Federal Courts issuing nationwide injunctions against some of his corrupt, illegal, unconstitutional, and immoral practices. What a totally disingenuous jerk! I don’t remember Ol’ Gonzo complaining when a single Federal Judge in Texas, Judge Hanen, tanked Obama’s “DAPA” program that would have helped hundreds of thousands of deserving parents of US citizens and green card holders (and also helped reduce the Immigration Court backlog). Heck, Gonzo even tried to use that decision as the bogus justification for terminating DACA, a step that even Judge Hanen is not very anxious to take. Unlike Gonzo, Judge Hanen at least understands that DACA individuals have substantial equities in the United States that Congress would be wise to recognize through legislation.

Undoubtedly, there is a need for some detention of dangerous individuals or some so-called “flight risks” pending the completion of immigration proceedings. But, it is only a minuscule fraction of the number now being unnecessarily and wastefully detained.

And, there is seldom any reason whatsoever for detaining women and children who have passed the credible fear process and seek asylum. Work with the private bar to get them represented, help them understand the system, including their obligations to appear at court and when summoned by DHS, and work with the U.S. Immigration Judges, the private bar, and the DHS Offices of Chief Counsel to get these cases scheduled in a reasonable manner.

For every case that DHS seeks “priority processing,” they should be required to offer prosecutorial discretion or “PD” to a “lower priority” case. That would eliminate the current Government practice of “Aimless Docket Reshuffling” (“ADR”), keep the court backlogs from growing out of control, and insure timely and fair processing of recent arrivals. The DHS would also be “incentivized” to agree or stipulate to well-documented, clearly grantable asylum cases, as they are supposed to do. That’s how the system could and should work pending enactment of more comprehensive immigration reform.

Additionally, individuals who satisfy “credible fear” should be offered an opportunity to apply first to the USCIS Asylum Office, before the case is sent to Immigration Court, since that office would already have a “preliminary workup” of the case.

There are lots of ways of improving this system and making it work better for the asylum applicants, their lawyers, and the DHS. But, they aren’t going to happen as long as irresponsible, biased, ethically and morally challenged  “White Nationalist” officials such as Trump, Sessions, & Nielsen are in charge.

Texas judge says he’ll likely kill DACA — but not yet

Washington (CNN)A federal judge on Friday hinted he will likely invalidate the Deferred Action for Childhood Arrivals program in the future — but for now the program can continue to operate.

The ruling was an unexpected, albeit temporary, reprieve for the program, which President Donald Trump opted to end almost exactly a year ago.
Texas-based District Judge Andrew Hanen wrote Friday that he believes DACA is likely illegal and ultimately will fail to survive a challenge before his court. DACA is an Obama-era program that protects young undocumented immigrants who came to the US as children from deportation.
But despite that — and despite finding that the continuation of DACA could harm the eight states and two governors who challenged the program — Hanen decided not to issue a ruling that would have immediately blocked DACA’s continuation.
Since Trump sought to end DACA last September, the program’s future has been in doubt. Members of Congress largely say they want to preserve the program legislatively, but have failed to pass anything in two opportunities to do so. In the meantime, three federal courts have sustained the program.
While Hanen rebuffed the red states’ request to end DACA immediately, his inclination to invalidate the program eventually contributes to what experts expect to be a fast track to the Supreme Court in the coming year.
Hanen said that there were two issues that required him to deny the request to immediately halt the program: One was timeliness. He found that because Texas and its coalition of states waited more than five years after the implementation of DACA, even as it challenged a related program, to file this suit, that it lost some of its ability to claim damages were immediately harmful and thus required an immediate response.
In addition, Hanen ruled that though the states could prove they were harmed by the continuation of DACA, mainly in costs of benefits to recipients, the potential consequences of ending DACA immediately were more harmful.
Three federal judges have blocked the administration from ending DACA as it tried to do last September, ordering the Department of Homeland Security to continue renewing permits under the program.
But Hanen was widely expected to be unfavorable to DACA, as he had previously prevented a similar, expanded program from ever going into effect under the Obama administration.
The new case challenging the DACA program, instituted in 2012, drew heavily from that decision Hanen made on the 2014 expansion of the program and creation of a similar program for undocumented parents of Americans.
Hanen said in his Friday ruling that he largely agreed, and DACA was likely to be illegal under the same reasoning as that expansion.
But one major difference prevented him from immediately halting the program — the fact that it was already in effect.
“Here, the egg has been scrambled,” Hanen wrote. “To try to put it back in the shell with only a preliminary injunction record, and perhaps at great risk to many, does not make sense nor serve the best interests of this country.”
But in his 117-page decision, Hanen was clear that he did not intend his ruling to be interpreted as good news for the future of DACA, at least long term.
He said the popularity of the program was not relevant to whether it had been legally created — the crux of the challenge to it.
“DACA is a popular program and one that Conress should consider saving,” Hanen wrote. Nevertheless, “this court will not succumb to the temptation to set aside legal principles and to substitute its judgment in lieu of legislative action. If the nation truly wants to have a DACA program, it is up to Congress to say so.”
Texas Attorney General Ken Paxton, who led the challenge to DACA, hailed the ruling in a statement, despite it being an interim loss in court.
“We’re now very confident that DACA will soon meet the same fate as the Obama-era Deferred Action for Parents of Americans program, which the courts blocked after I led another state coalition challenging its constitutionality,” Paxton said. “Our lawsuit is vital to restoring the rule of law to our nation’s immigration system.”
Hanen’s ruling Friday defuses the threat to DACA for some time. In a separate order, Hanen took the unusual step of making it possible to appeal his denial of an immediate halt to the program, and gave the parties three weeks to figure out next steps before the case moves to its next phase.
The Department of Justice declined to defend DACA in the lawsuit, but did ask Hanen to limit the effect of any ruling he may have issued.
Spokesman Devin O’Malley said in a statement that Hanen had agreed DACA is unlawful, “as the Justice Department has consistently argued,” and said the department was “pleased” with the decision.
In the administration’s stead, DACA was defended by the pro-immigrant advocacy and legal organization MALDEF and the state of New Jersey.
In a statement Friday, MALDEF hailed the ruling but noted it still believes DACA to be legal.
“While MALDEF continues to disagree adamantly with the judge’s views on the legality of DACA under the Administrative Procedures Act (APA), and on whether the state of Texas even has standing — as required by the Constitution — to challenge DACA, today’s court decision appropriately leaves DACA in place with respect to over 100,000 Texans and hundreds of thousands of others nationwide,” said Thomas A. Saenz, president and general counsel of MALDEF.

It’s not clear to me that Judge Hanen can kill the program even if he finds it illegal, given the contrary findings and injunctions already in effect from several other U.S. District Judges.  Indeed, there are several cases already pending in the DC Circuit and the Ninth Circuit that cold moot the whole issue. It’s the kind of mess we get into when Congress abdicates its duty to legislate.

Omarosa Manigault Newman — who once declared that “every critic, every detractor will have to bow down to President Trump” — evolved from mentee to frenemy to antagonist before her nonstop media blitz promoting her new post-White House tell-all, during which she’s touted the existence of a recording of Trump using the n-word. It’s all sent the White House scrambling, with the president tweetingMonday that “I don’t have that word in my vocabulary, and never have.” Press secretary Sarah Huckabee Sanders told reporters Tuesday she “can’t guarantee” Americans will never hear audio of Trump using the slur.

It doesn’t matter.

Trump is a racist. That doesn’t hinge on whether he uttered one particular epithet, no matter how ugly it is. It’s about the totality of his presidency, and after 18 months you can see his racial animus throughout his policy initiatives whether you hear it on tape or not.

Over the course of his career, well before he took office, Trump’s antipathy toward people of color has been plainly evident. In the ’70s, his real estate company was the subject of a federal investigation that found his employees had secretly marked the paperwork of minority apartment rental applicants with codes such as “C” for “colored.” After black and Latino teenagers were charged with sexually assaulting a white woman in Central Park, he took out full-page ads in New York City newspapers calling for the return of the death penalty. He never backtracked or apologized when the teenagers’ convictions were overturned. He championed birtherism, and wouldn’t disavow the conspiracy theory that President Barack Obama was born in Kenya until the end of his 2016 presidential campaign. As president, he’s targeted African American athletes for criticism, whether it’s ranting, “Get that son of a bitch off the field,” in reference to professional football players silently protesting police brutality or tweeting that:

Calling African American Rep. Maxine Waters (D-Calif.) a “low IQ person” is now a routine bit at his political rallies. He was quoted referring to Haiti, El Salvador and various African nations as “shithole” countries. He announced his campaign in 2015 by referring to Mexican immigrants as “rapists.” Later that year, he called for the United States to implement a “total and complete” Muslim ban.

After taking office, he hired xenophobes such as Stephen Miller — an architect of the ban, whose hostility toward immigrants is so stark, and hypocritical, that his uncle excoriated him this week in an essay for Politico Magazine, writing of Miller and Trump that “they repeat the insults and false accusations of earlier generations against these refugees to make them seem less than human.”

I could go on. The point is that Trump’s view of nonwhites is out in the open. As Slate’s Christina Cauterucci notes, there’s every reason “to believe that an n-word tape wouldn’t torpedo Trump’s presidency”; there’s no indication his supporters “will turn against him because he used a racial slur.” Trump’s words and deeds over time have demonstrated his racism — it doesn’t hinge on being outed, Paula Deen-style, by a tape of him using the word. Racism hardly ever does.

I’m not saying it would be okay for Trump to use any variation of the n-word — in jest, in anger, singing along to the lyrics of a song, with or without the hard “R.” But the feverish speculation about whether he ever deployed the term wrongly implies that a verdict on his racist character turns on its use. What matters more about Trump are the positions he’s taken and the policy choices he’s made that harm communities of color. In his first year as president, Trump evolved from mere interpersonal racist to racist enabler when he proclaimed there were “very fine people, on both sides” when white supremacists and anti-racist protesters converged in Charlottesville last year. Jeff Sessions, a senator from Alabama who, three decades ago, was denieda federal judgeship by the Republican-controlled Senate Judiciary Committee over concerns that he was a racist, was installed by Trump as attorney general.

Since assuming that role, Sessions has worked to undermine consent decrees meant to restrain racially abusive police departments and explicitly articulated the administration’s intent to use family separation to deter immigration. The Department of Education, under Secretary Betsy DeVos, is dismissing hundreds of civil rights complaints, supposedly in the name of efficiency. Trump hired Manigault Newman as a liaison to black constituent groups based on their reality TV relationship and, according to him, her willingness to say “GREAT things” about him, despite almost universal criticism of her appointment and subsequent work by African American Republicans and Democrats.

Being a racist — which entails belief in a fixed racial hierarchy and the power to act upon that belief in commerce, government or social spaces — is not now, and never has been, about one word or one slip of the tongue. It is about the ability of those in power to use public and private resources to enforce a racial hierarchy, whether that means having black people arrested for sitting in Starbucks, refusing to hire or promote qualified black job applicants or staffing a presidential administration with people who tolerate or encourage white nationalists. Trump’s statements and his approach to governance suggest he believes in a set racial hierarchy, and the possible existence of a hyped tape doesn’t change that. So far, and as far as I know, no one’s produced audio of white nationalist participants in last Sunday’s Unite the Right 2 rally in Washington using the n-word. Presumably, by the logic of some Trump defenders, that would mean there’s no proof they’re racist, either.

If American public discourse on race continues to revolve around a game of “gotcha,” with sentiments and smoking guns, divorced from an acknowledgment of how racists use their power, we won’t make any progress, during this administration or any other.

Johnson states a simple truth that some don’t want to acknowledge. But, racist anti-immigrant, anti-Muslim, anti-refugee, anti-Mexican American, xenophobic “dog whistles” were at the heart of Trump’s campaign and remain at the heart of his policies, particularly on immigration, refugees, and law enforcement.

Does that mean that the majority of Americans who don’t endorse racism don’t need to deal with the fact that Trump is President and that Sessions and Miller are exercising outsized control over our justice system? Or that today’s Trumpist GOP isn’t your grandparents’ GOP (in my case, my parents’ GOP) and, although they might occasionally mutter a few insincere “tisk, tisk’s,” are firmly committed to enabling Trump and his racist policies including, of course, voter disenfranchisement. Of course not. Just think of how African-Americans, Hispanics, and liberals had to deal in practical terms with Southern political power in the age of Jim Crow (which is basically the “Age of Jeff Sessions”).

But, it is essential for us to know and acknowledge who and what we are dealing with and not to let political expediency totally obscure the harsh truth. Trump is a racist. And, that sad but true fact will continue to influence all of his policies for as long as he remains in office. Indeed, “Exhibit 1,” is the failure of the GOP to achieve “no-brainer” Dreamer protection over the last two years and the stubborn insistence of Sessions and others in the GOP to keep tying up our courts with bogus attempts to terminate already limited protections for those who aren’t going anywhere in the first place.

If my nephew’s ideas on immigration had been in force a century ago, our family would have been wiped out.

Let me tell you a story about Stephen Miller and chain migration.

It begins at the turn of the 20th century in a dirt-floor shack in the village of Antopol, a shtetl of subsistence farmers in what is now Belarus. Beset by violent anti-Jewish pogroms and forced childhood conscription in the Czar’s army, the patriarch of the shack, Wolf-Leib Glosser, fled a village where his forebears had lived for centuries and took his chances in America.

He set foot on Ellis Island on January 7, 1903, with $8 to his name. Though fluent in Polish, Russian, and Yiddish he understood no English. An elder son, Nathan, soon followed. By street corner peddling and sweat-shop toil Wolf-Leib and Nathan sent enough money home to pay off debts and buy the immediate family’s passage to America in 1906. That group included young Sam Glosser, who with his family settled in the western Pennsylvania city of Johnstown, a booming coal and steel town that was a magnet for other hard-working immigrants. The Glosser family quickly progressed from selling goods from a horse and wagon to owning a haberdashery in Johnstown run by Nathan and Wolf-Leib to a chain of supermarkets and discount department stores run by my grandfather, Sam, and the next generation of Glossers, including my dad, Izzy. It was big enough to be listed on the AMEX stock exchange and employed thousands of people over time. In the span of some 80 years and five decades, this family emerged from poverty in a hostile country to become a prosperous, educated clan of merchants, scholars, professionals, and, most important, American citizens.

What does this classically American tale have to do with Stephen Miller? Well, Izzy Glosser, is his maternal grandfather, and Stephen’s mother, Miriam, is my sister.

I have watched with dismay and increasing horror as my nephew, who is an educated man and well aware of his heritage, has become the architect of immigration policies that repudiate the very foundation of our family’s life in this country.

I shudder at the thought of what would have become of the Glossers had the same policies Stephen so coolly espouses— the travel ban, the radical decrease in refugees, the separation of children from their parents, and even talk of limitingcitizenship for legal immigrants— been in effect when Wolf-Leib made his desperate bid for freedom. The Glossers came to the U.S. just a few years before the fear and prejudice of the “America First” nativists of the day closed U.S. borders to Jewish refugees. Had Wolf-Leib waited, his family would likely have been murdered by the Nazis along with all but seven of the 2,000 Jews who remained in Antopol. I would encourage Stephen to ask himself if the chanting, torch-bearing Nazis of Charlottesville, whose support his boss seems to court so cavalierly, do not envision a similar fate for him.

Like other immigrants, our family’s welcome to the USA was not always a warm one, but we largely had the protection of the law, there was no state sponsored violence against us, no kidnapping of our male children, and we enjoyed good relations with our neighbors. True, Jews were excluded from many occupations, couldn’t buy homes in some towns, couldn’t join certain organizations or attend certain schools or universities, but life was good. As in past generations there were hate mongers who regarded the most recent groups of poor immigrants as scum, rapists, gangsters, drunks and terrorists, but largely the Glosser family was left alone to live our lives and build the American dream. Children were born, synagogues founded, and we thrived. This was the miracle of America.

Acting for so long in the theater of right wing politics, Stephen and Trump may have become numb to the resultant human tragedy and blind to the hypocrisy of their policy decisions. After all, Stephen’s is not the only family with a chain immigration story in the Trump administration. Trump’s grandfather is reported to have been a German migrant on the run from military conscription to a new life in the USA and his mother fled the poverty of rural Scotland for the economic possibilities of New York City. (Trump’s in-laws just became citizens on the strength of his wife’s own citizenship.)

These facts are important not only for their grim historical irony but because vulnerable people are being hurt. They are real people, not the ghoulish caricatures portrayed by Trump. When confronted by the deaths and suffering of thousands our senses are overwhelmed, and the victims become statistics rather than people. I meet these statistics one at a time through my volunteer service as a neuropsychologist for HIAS (formerly the Hebrew Immigrant Aid Society), the global non-profit agency that protects refugees and helped my family more than 100 years ago. I will share the story of one such man I have met in the hope that my nephew might recognize elements of our shared heritage.

In the early 2000s, Joseph (not his real name) was conscripted at the age of 14 to be a soldier in Eritrea and sent to a remote desert military camp. Officers there discovered a Bible under his pillow which aroused their suspicion that he might belong to a foreign evangelical sect that would claim his loyalty and sap his will to fight. Joseph was actually a member of the state-approved Coptic church but was nonetheless immediately subjected to torture. “They smashed my face into the ground, tied my hands and feet together behind my back, stomped on me, and hung me from a tree by my bonds while they beat me with batons for the others to see.”

Joseph was tortured for 20 consecutive days before being taken to a military prison and crammed into a dark unventilated cell with 36 other men, little food and no proper hygiene. Some died, and in time Joseph was stricken with dysentery. When he was too weak to stand he was taken to a civilian clinic where he was fed by the medical staff. Upon regaining his strength he escaped to a nearby road where a sympathetic driver took him north through the night to a camp in Sudan where he joined other refugees. Joseph was on the first leg of a journey that would cover thousands of miles and almost 10 years.

Before Donald Trump had started his political ascent promulgating the false story that Barack Obama was a foreign-born Muslim, while my nephew, Stephen, was famously recovering from the hardships of his high school cafeteria in Santa Monica, Joseph was a child on his own in Sudan in fear of being deported back to Eritrea to face execution for desertion. He worked any job he could get, saved his money and made his way through Sudan. He endured arrest and extortion in Libya. He returned to Sudan, then kept moving to Dubai, Brazil, and eventually to a southern border crossing into Texas, where he sought asylum. In all of the countries he traveled through during his ordeal, he was vulnerable, exploited and his status was “illegal.” But in the United States he had a chance to acquire the protection of a documented immigrant.

Today, at 30, Joseph lives in Pennsylvania and has a wife and child. He is a smart, warm, humble man of great character who is grateful for every day of his freedom and safety. He bears emotional scars from not seeing his parents or siblings since he was 14. He still trembles, cries and struggles for breath when describing his torture, and he bears physical scars as well. He hopes to become a citizen, return to work and make his contribution to America. His story, though unique in its particulars, is by no means unusual. I have met Central Americans fleeing corrupt governments, violence and criminal extortion; a Yemeni woman unable to return to her war-ravaged home country and fearing sexual mutilation if she goes back to her Saudi husband; and an escaped kidnap-bride from central Asia.

President Trump wants to make us believe that these desperate migrants are an existential threat to the United States; the most powerful nation in world history and a nation made strong by immigrants. Trump and my nephew both know their immigrant and refugee roots. Yet, they repeat the insults and false accusations of earlier generations against these refugees to make them seem less than human. Trump publicly parades the grieving families of people hurt or killed by migrants, just as the early Nazis dredged up Jewish criminals to frighten and enrage their political base to justify persecution of all Jews. Almost every American family has an immigration story of its own based on flight from war, poverty, famine, persecution, fear or hopelessness. These immigrants became the workers, entrepreneurs, scientists and soldiers of America.

Most damning is the administration’s evident intent to make policy that specifically disadvantages people based on their ethnicity, country of origin, and religion. No matter what opinion is held about immigration, any government that specifically enacts law or policy on that basis must be recognized as a threat to all of us. Laws bereft of justice are the gateway to tyranny. Today others may be the target, but tomorrow it might just as easily be you or me. History will be the judge, but in the meanwhile the normalization of these policies is rapidly eroding the collective conscience of America. Immigration reform is a complex issue that will require compassion and wisdom to bring the nation to a just solution, but the politicians who have based their political and professional identity on ethnic demonization and exclusion cannot be trusted to do so. As free Americans, and the descendants of immigrants and refugees, we have the obligation to exercise our conscience by voting for candidates who will stand up for our highest national values and not succumb to our lowest fears.

THE HILL: NOLAN COMMENTS ON RISING IMMIGRATION COURT BACKLOG!

In the first two quarters of fiscal 2018, the immigration court only completed 92,009 cases. At this rate, the immigration court will have completed only 184,000 cases when fiscal 2018 ends on Sept. 30.

Even if DHS stopped arresting deportable aliens, it would take the immigration court four years to eliminate its backlog.

Attorney General Jeff Sessions is clarifying asylum eligibility requirementsto make it easier to screen out aliens who do not have a legitimate persecution claim, but this will just slow down the rate at which the backlog increases. It won’t reduce it.

To reduce the backlog, Trump will have to pull aliens from the immigration court’s backlog and put them in expedited removal proceedings, and presumably this is why he is planning to expand the use of expedited removal proceedings.

In January, Trump instructed the DHS to apply expedited removal proceedings to the fullest extent of the law. This would extend it to include undocumented aliens who were not admitted or paroled into the United States and cannot prove that they have been here for two years.

It will be extremely difficult to help aliens who are caught up in this expansion. Congress has severely limited federal court jurisdiction over expedited removal proceedings.

The courts cannot consider expedited removal orders on a petition for review.

Review is available in habeas corpus proceedings, but it is limited to determinations of whether the petitioner is an alien; whether his removal has been ordered in expedited removal proceedings; and whether he has been lawfully admitted for permanent residence, or has been granted refugee or asylum status.

Other provisions permit challenges to the constitutionality of the system and its implementing regulations, and claims that the written policies and procedures issued under it are in violation of law. These challenges must be brought in the U.S. District Court for the District of Columbia within 60 days of when the challenged policy or procedure is implemented.

The expansion should greatly reduce the backlog, but it will not eliminate it. Too many of the aliens in removal proceedings have been physically present for two years.

Trump will need a legalization program to finish the job, but he has shown a willingness to work with the Democrats on legalization. But will they work with him?

  • Even assuming that the vastly expanded use of expedited removal were upheld by the Article III Courts (I think it’s unconstitutional), cases couldn’t be “pulled from the backlog.” The Immigration Court backlog is made up almost entirely of cases where the individuals have already been here more than two years. Thus, expedited removal wouldn’t apply.
  • Interesting that notwithstanding the attention given to immigration, the DHS hasn’t gotten around to publishing the necessary regulatory change to expand expedited removal. That might suggest that “cooler, smarter heads” within DHS might actually be pointing out why that would be stupid.
  • The real “take away” here is that under Sessions’s gross mismanagement of the Immigration Courts more Immigration Judges produce fewer completed cases and more backlog. Basically, what I had predicted. And that’s with all sorts of pressure to churn out orders, cutting Due Process, unnecessary wasteful coercive detention, “aimless docket reshuffling,” some politicized personnel actions, and other “pedal faster gimmicks” by Sessions. 
  • What that really shows is that Immigration Court cases are difficult cases and that even with Sessions’s shameless gaming of the system against migrants, Due Process has a certain largely irreducible minimum time for hearings.
  • Given that, increasing so-called “expedited removal” to reduce the existing backlog clearly would be irrational and present severe Constitutional difficulties under the Due Process clause.
  • Like it or not, a substantial legalization program combined with an independent Article I Immigration Court, more rational DHS enforcement priorities, and a healthy dose of prosecutorial discretion is the only way of getting the Immigration Courts back on track.
  • And, while I’ve said before that Democrats bear a fair share of the blame for the current Immigration Court dysfunction, Sessions has certainly made it immeasurably worse; the current barrier to reasonable immigration reform is clearly Trump and the GOP restrictionists, not the Democrats.
  • Indeed, the Trump-led GOP’s inability to accomplish the “no brainer” of DACA relief shows that it’s going to take “regime change” to solve this problem.
  • That means that things are likely to continue to get worse before they improve — that is, unless the Article IIIs step in and take control of the Immigration Courts away from Sessions as an act of Constitutional self-preservation.
  • Drastic action? Sure. Likely? Maybe not. But, the Article IIIs might eventually have to do it, since Sessions’s scofflaw actions on immigration are starting to run the entire Article III system into the ground, just like he is destroying the Immigration Courts.

The last legalization program was established by the Immigration Reform and Control Act of 1986, more than 30 years ago. The Democrats claim that this is because the Republicans won’t cooperate, but that isn’t true.

The Democrats could have established a legalization program without Republican cooperation during the first two years of Barack Obama’s administration. From January 2009 to January 2011, they had a majority in the House, and until Scott Brown’s special election in 2010, there were enough Democratic senators to overcome a filibuster.

And they could establish one now if they really wanted to.

Trump is willing to support legalization for 1.8 million aliens in the DACAprogram if the Democrats accept the three conditions in his framework on immigration reform and border security.

Trump wants to end chain migration. This should not be a deal-breaker if the legalization program were to be established by expanding the availability of Special Immigrant Juveniles (SIJ) status to include DACA participants, which could restrict the end of chain migration to them as opposed to ending it for everyone.

SIJ provisions state, “no natural parent or prior adoptive parent of any alien provided special immigrant status under this subparagraph shall thereafter, by virtue of such parentage, be accorded any right, privilege, or status under this Act.”

I’ve suggested this possibility before.

Trump also wants a wall along the border with Mexico, which would make it more difficult for parents to make illegal crossings with their young children in the future. Adults may be able to climb over a wall 20 or 30 feet high, but young children can’t.

The other condition is to terminate the Diversity Visa Program (DVP).

The Democrats have been willing to end the DVP in the past.  Sen. Chuck Schumer’s (D-N.Y.) Gang of Eight bill would have repealed it in 2013 if it had been enacted.

The problem seems to be that legalization isn’t very important to the Democrats.

I have also made a similar observation that during the first two years of the Obama Administration, Democrats could have solved what have become the three most pressing problems on the domestic front:

  • Legalization;
  • Dreamer relief; and
  • An independent U.S. Immigration Court.

Our country and the good folks caught up the in current system are paying the price every day for these failures. But, past is past. The important thing is not to make the same mistakes again if and when the Democrats and whatever “moderate” Republicans still remain get a chance to act.

Liberal democracy has enjoyed much better days. Vladimir Putin has entrenched authoritarian rule and is firmly in charge of a resurgent Russia. In global influence, China may have surpassed the United States, and Chinese president Xi Jinping is now empowered to remain in office indefinitely. In light of recent turns toward authoritarianism in Turkey, Poland, Hungary, and the Philippines, there is widespread talk of a “democratic recession.” In the United States, President Donald Trump may not be sufficiently committed to constitutional principles of democratic government.

In such a time, we might be tempted to try to learn something from earlier turns toward authoritarianism, particularly the triumphant rise of the Nazis in Germany in the 1930s. The problem is that Nazism was so horrifying and so barbaric that for many people in nations where authoritarianism is now achieving a foothold, it is hard to see parallels between Hitler’s regime and their own governments. Many accounts of the Nazi period depict a barely imaginable series of events, a nation gone mad. That makes it easy to take comfort in the thought that it can’t happen again.

But some depictions of Hitler’s rise are more intimate and personal. They focus less on well-known leaders, significant events, state propaganda, murders, and war, and more on the details of individual lives. They help explain how people can not only participate in dreadful things but also stand by quietly and live fairly ordinary days in the midst of them. They offer lessons for people who now live with genuine horrors, and also for those to whom horrors may never come but who live in nations where democratic practices and norms are under severe pressure.

Milton Mayer’s 1955 classic They Thought They Were Free, recently republished with an afterword by the Cambridge historian Richard J. Evans, was one of the first accounts of ordinary life under Nazism. Dotted with humor and written with an improbably light touch, it provides a jarring contrast with Sebastian Haffner’s devastating, unfinished 1939 memoir, Defying Hitler, which gives a moment-by-moment, you-are-there feeling to Hitler’s rise. (The manuscript was discovered by Haffner’s son after the author’s death and published in 2000 in Germany, where it became an immediate sensation.)* A much broader perspective comes from Konrad Jarausch’s Broken Lives, an effort to reconstruct the experience of Germans across the entire twentieth century. What distinguishes the three books is their sense of intimacy. They do not focus on historic figures making transformative decisions. They explore how ordinary people attempted to navigate their lives under terrible conditions.

Haffner’s real name was Raimund Pretzel. (He used a pseudonym so as not to endanger his family while in exile in England.) He was a journalist, not a historian or political theorist, but he interrupts his riveting narrative to tackle a broad question: “What is history, and where does it take place?” He objects that most works of history give “the impression that no more than a few dozen people are involved, who happen to be ‘at the helm of the ship of state’ and whose deeds and decisions form what is called history.” In his view, that’s wrong. What matters are “we anonymous others” who are not just “pawns in the chess game,” because the “most powerful dictators, ministers, and generals are powerless against the simultaneous mass decisions taken individually and almost unconsciously by the population at large.” Haffner insists on the importance of investigating “some very peculiar, very revealing, mental processes and experiences,” involving “the private lives, emotions and thoughts of individual Germans.”

Mayer had the same aim. An American journalist of German descent, he tried to meet with Hitler in 1935. He failed, but he did travel widely in Nazi Germany. Stunned to discover a mass movement rather than a tyranny of a diabolical few, he concluded that his real interest was not in Hitler but in people like himself, to whom “something had happened that had not (or at least not yet) happened to me and my fellow-countrymen.” In 1951, he returned to Germany to find out what had made Nazism possible.

In They Thought They Were Free, Mayer decided to focus on ten people, different in many respects but with one characteristic in common: they had all been members of the Nazi Party. Eventually they agreed to talk, accepting his explanation that he hoped to enable the people of his nation to have a better understanding of Germany. Mayer was truthful about that and about nearly everything else. But he did not tell them that he was a Jew.

In the late 1930s—the period that most interested Mayer—his subjects were working as a janitor, a soldier, a cabinetmaker, an office manager, a baker, a bill collector, an inspector, a high school teacher, and a police officer. One had been a high school student. All were male. None of them occupied positions of leadership or influence. All of them referred to themselves as “wir kleine Leute, we little people.” They lived in Marburg, a university town on the river Lahn, not far from Frankfurt.

Mayer talked with them over the course of a year, under informal conditions—coffee, meals, and long, relaxed evenings. He became friends with each (and throughout he refers to them as such). As he put it, with evident surprise, “I liked them. I couldn’t help it.” They could be ironic, funny, and self-deprecating. Most of them enjoyed a joke that originated in Nazi Germany: “What is an Aryan? An Aryan is a man who is tall like Hitler, blond like Goebbels, and lithe like Göring.” They also could be wise. Speaking of the views of ordinary people under Hitler, one of them asked:

Opposition? How would anybody know? How would anybody know what somebody else opposes or doesn’t oppose? That a man says he opposes or doesn’t oppose depends upon the circumstances, where, and when, and to whom, and just how he says it. And then you must still guess why he says what he says.

When Mayer returned home, he was afraid for his own country. He felt “that it was not German Man that I had met, but Man,” and that under the right conditions, he could well have turned out as his German friends did. He learned that Nazism took over Germany not “by subversion from within, but with a whoop and a holler.” Many Germans “wanted it; they got it; and they liked it.”

Mayer’s most stunning conclusion is that with one partial exception (the teacher), none of his subjects “saw Nazism as we—you and I—saw it in any respect.” Where most of us understand Nazism as a form of tyranny, Mayer’s subjects “did not know before 1933 that Nazism was evil. They did not know between 1933 and 1945 that it was evil. And they do not know it now.” Seven years after the war, they looked back on the period from 1933 to 1939 as the best time of their lives.

Mayer suggests that even when tyrannical governments do horrific things, outsiders tend to exaggerate their effects on the actual experiences of most citizens, who focus on their own lives and “the sights which meet them in their daily rounds.” Nazism made things better for the people Mayer interviewed, not (as many think) because it restored some lost national pride but because it improved daily life. Germans had jobs and better housing. They were able to vacation in Norway or Spain through the “Strength Through Joy” program. Fewer people were hungry or cold, and the sick were more likely to receive treatment. The blessings of the New Order, as it was called, seemed to be enjoyed by “everybody.”

As a historical footnote, I crossed paths with Cass Sunstein at the DOJ during the Carter Administration in 1980-81, when he was an attorney in the Office of Legal Counsel and I was the Acting General Counsel/Deputy General Counsel of the “Legacy INS.” About all I remember is that: 1) he was brilliant, 2) he wrote really well; 3) everyone had him pegged as among “the most likely to succeed;” and 4) we both had lots, lots more hair then.

I agree with pretty much everything Sunstein says. Except for one major point. I don’t think “it can happen here.” It is happening here!

Cass says “Thus far, President Trump has been more bark than bite.” Really! With all due respect, that seems like a view directly from the “Ivory Tower.” 

Ask U.S. citizens children whose parents have been deported for no rational reason without any consideration of what will happen to those left behind; ask those children intentionally abused and probably damaged for life by the likes of Jeff Sessions; ask communities that have been terrorized by the Homan-led “ICE Gestapo” that strikes terror, performs few if any “real” law enforcement functions these days, while insuring that whole segments of the population are “easy marks” for crime and abuse; ask women and children refugees from Central American who are essentially being railroaded back to the “death camps” from which they fled by the noxious White Nationalist racists Trump, Miller, & Sessions, with the assistance of morally vapid sycophants like Nielsen and Kelly, without even the semblance of due process; ask Dreamers who are slurred by the  always disingenuous Sessions while being held as hostages by Trump, and hung out to dry by the GOP Congress; ask the kids and families being held in the “New American Gulag” established by Sessions — combined with his intentional distortion of asylum law, they are basically being held in concentration camps waiting to be shipped off to death camps in the Northern Triangle! And we haven’t even gotten to Sessions’s absolutely outrageous, lawless, unconstitutional, and totally immoral plan to rewrite asylum law so that nobody who needs protection actually gets it! Or how about not taking any Syrian refugees, even though they are dying in refugee camps awaiting resettlement every day. Just because the actual deaths, rapes, torture, US-caused human trafficking, and other unspeakable abuses take place outside our national boundaries doesn’t mean that we aren’t just as responsible for them as the fat & happy Burghers of the Third Reich!

I wrote about Sunstein’s timely, yet totally disturbing, article in  my response to a comment from my good friend, colleague, and fellow member of the “Gang of Retired Immigration Judges,”  Judge Gus Villageliu in response to one of his “right on”  comments today.  Here’s what I said:

There is a great article by Professor Cass Sunstein about the parallels between Nazism and Trumpism. The key: Germans who supported Hitler were fat, happy, and satisfied with their lives under Nazism and were willfully indifferent to the torture and suffering of their fellow human beings. They happily accepted the Nazi propaganda that Jews were either traitors or had voluntarily left the country after being fairly compensated for their property. Even after the war, some ordinary Germans looked back on the 1933-39 era of Nazi rule as the best time of their lives.

Another key observation by Sunstein: resistance is never futile and every individual act of resistance, no matter how small or insignificant it might seem at the time, is important. The little acts and persistence add up over time.

In my view, they also establish an important record for historians and future generations. I want my grandchildren, great-grandchildren, and great-great-grandchildren to know where I stood in the era of Trump, Sessions, Miller & the rest of the White Nationalist neo-Nazis and their utterly disgusting perversion of Western Judeo-Christian values!

Due Process, tolerance, courage, standing up for the less fortunate, and recognizing the human rights and dignity of every person are eternal values that are always worth fighting for!

Join the New Due Process Army. Resist the White Nationalist Regime every step of the way. Force “go along to get along” courts (like the Supremes) to face up to the horrible immorality of their appeasement of the cruel, inhuman, and illegal actions of the Trump Administration. Write the historical record that even the Trumpsters and their followers won’t be able to escape so that we might never, ever again have a Neo-Nazi revival like the Trump Administration!

TRUMP TREATS KIDS AS HUMAN PAWNS IN UGLY POLITICAL CHESS GAME – Administration’s Continued Spreading Of False Narrative On Migration Makes Continuing Migration Outside of Legal System Inevitable!

President Trump has calculated that he will gain political leverage in congressional negotiations by continuing to enforce a policy he claims to hate — separating immigrant parents from their young children at the southern border, according to White House officials.

On Friday, Trump suggested he would not change the policy unless Democrats agreed to his other immigration demands, which include funding a border wall, tightening the rules for border enforcement and curbing legal entry. He also is intent on pushing members of his party to vote for a compromise measure that would achieve those long-standing priorities.

Trump’s public acknowledgment that he was willing to let the policy continue as he pursued his political goals came as the president once again blamed Democrats for a policy enacted and touted by his own administration.

“The Democrats are forcing the breakup of families at the Border with their horrible and cruel legislative agenda,” he tweeted. After listing his demands in any immigration bill, he added, “Go for it! WIN!”

The attempt to gain advantage from a practice the American Academy of Pediatrics describes as causing children “irreparable harm” sets up a high-stakes gambit for Trump, whose political career has long benefited from harsh rhetoric on immigration.

Democrats have latched onto the issue and vowed to fight in the court of public opinion, with leaders planning trips to the border to highlight the stories of separated families, already the focus of news media attention. Democratic candidates running for vulnerable Republican seats also have begun to make the harsh treatment of children a centerpiece of their campaigns.

The policy has cracked Trump’s usually united conservative base, with a wide array of religious leaders and groups denouncing it. The U.S. Conference of Catholic Bishops and the Southern Baptist Convention issued statements critical of the practice.

The Rev. Samuel Rodriguez, who delivered a prayer at Trump’s inauguration, signed a letter calling the practice “horrible.” Pastor Franklin Graham of Samaritan’s Purse, a vocal supporter of the president’s who has brushed aside past Trump controversies, called it “terrible” and “disgraceful.”

Besides increasing the odds of a broader immigration bill, senior Trump strategists believe that the child separation policy will deter the flow of migrant families across the border. Nearly 2,000 immigrant children were separated from parents during six weeks in April and May, according to the Department of Homeland Security. The figure is the only one released by the goverment.

“The president has told folks that in lieu of the laws being fixed, he wants to use the enforcement mechanisms that we have,” a White House official said. “The thinking in the building is to force people to the table.”

Trump reinforced that notion Friday morning at the White House when he suggested Democrats alone had the power to alter the policy.

“I hate the children being taken away,” Trump said.

The president used a similar strategy last year as he sought to gain approval for his immigration demands by using the lure of protection for young immigrants brought to the United States as children. That effort, which ran counter to Trump’s earlier promise to sign a bipartisan bill protecting the young immigrants, foundered in Congress.

The current policy resulted from a decision made in April by Attorney General Jeff Sessions to prosecute all migrants who cross the border, including those with young children. Those migrants had avoided detention during the administrations of George W. Bush and Barack Obama. Because of a 1997 court settlement that bars children from being imprisoned with parents, Justice Department officials now say they have no choice but to isolate the children.

Sessions and White House press secretary Sarah Huckabee Sanders have defended the policy as a sound, and biblical, decision to enforce the law.

“The previous administration wouldn’t prosecute illegal aliens who entered the country with children,” Sessions said Thursday in Fort Wayne, Ind., citing biblical advice to follow laws. “It was de facto open borders.”

The biblical underpinnings have been challenged by religious leaders.

“There’s definitely a groundswell of opposition from virtually every corner of the Christian community,” said Russell Moore, president of the Ethics and Religious Liberty Commission of the Southern Baptist Convention. “People are able to understand immediately the drive of parents to protect their child and to understand the horror of splitting up vulnerable children from their parents.”

Yet several key Trump administration officials support the family separation policy, including Chief of Staff John F. Kelly, Homeland Security Secretary Kirstjen Nielsen and senior adviser Stephen Miller, a vocal supporter of stricter immigration laws.

Some senior officials think Democrats will be pressured by the policy to cut an immigration deal.

“If they aren’t going to cooperate, we are going to look to utilize the laws as hard as we can,” said a second White House official.

Others have argued that the main benefit of the policy is deterrence. Miller has said internally that the child separations will bring the numbers down at the border, a goal that Trump wants to achieve. Miller and Marc Short, the White House director of legislative affairs, have argued that immigration legislation is unlikely to pass this summer, officials said.

“The side effect of zero tolerance is that fewer people will come up illegally, and fewer minors would be put in danger,” said a third senior administration official. “What is more dangerous to a minor, the 4,000-mile journey to America or the short-term detention of their parents?”

So, the choice is ““What is more dangerous to a minor, the 4,000-mile journey to America or the short-term detention of their parents?” Not really!

The real choices are 1) a dangerous 4,000 mile journey to a place where you might be able to save your life and that of your loved ones; or 2) the much more dangerous option of remaining in a place where you will likely be beaten, raped, extorted, tortured, impressed against your will, or killed by gangs, who are not just “street criminals” (as falsely portrayed by Sessions and other restrictionists) but who exercise quasi-governmental authority with the knowing acquiescence of the recognized governments. 

Realistically, folks are going to opt for #1. We could recognize them as refugees; screen them abroad to weed out gang members and criminals and to take the danger out of the 4,000 mile journey; work with the UNHCR and other countries to distribute the flow; open more paths to legal immigration for those who want to leave but might not fit easily within the refugee definition; and encourage those who still arrive at our borders without documents seeking protection to go to a port of entry where they will be treated respectfully, humanely, and be given a prompt but full opportunity to present their cases for protection with access to counsel in a system that satisfies all the requirements of Constitutional Due Process, with the additional understanding that if they lose they will have to return to their home country.

Alternatively, we could double down on our current failed policies of detention, deterrence, and lawless and immoral Governmental behavior; send the message that folks shouldn’t bother using our legal system because it’s a fraud that has intentionally been fixed against them; encourage the use of smugglers who will charge ever higher fees for developing new and more dangerous means of entry; and send the message that if folks rally want to survive, they should pay a smuggler to get them into the interior of our country where they have at least a fighting chance of blending in, hiding out from immigration enforcement, behaving themselves, and working hard until they are caught and removed, die, conditions improve and they leave voluntarily for their country of origin, or we finally give them some type of legal recognition.

My first alternative could likely be established and operated for a fraction of what we are now spending on failed immigration enforcement, useless and unnecessarily cruel detention, unnecessary criminal prosecutions, and a broken Immigration Court system.

Plus, at a time of low birth rate and low unemployment, it would give us a significant economic boost by bringing a highly motivated, hard-working, family oriented, and appreciative workforce into our society. It might also inspire other stable democratic nations to join us in an effort to save lives (which also happens to fit in well with religious values), resettle individuals, and, over time, address the horrible situation in the Northern Triangle that is creating this flow.

Alternative two, which is basically a variation on what we already are doing, will guarantee a continuing “black market flow”of migrants, some of whom will be apprehended and removed at significant financial and societal costs, while most will continue to live in an underground society, subject to exploitation by unscrupulous employers and law enforcement, underutilizing their skills, and not being given the opportunity to integrate fully into our society.

The thing we will not be able to do is to halt human migration solely by law enforcement actions taken at “our end” of the chain. That is, unless we wish to establish a “Stalinist type state” that is so grim and repressive that nobody wants to come any more. 

Kids as human pawns. Child abuse as policy. Dreamers as hostages. Jesus told us to do it. It’s the Democrats fault. I really hate to let Jeff abuse children, but I have no choice. Refugee women fleeing gang controlled states reduced to human scum who should just accept their beatings and rape and get in the non-existent line for legal immigration that we want to eliminate. That is, if they actually live long enough to get in the non-existent line, which is unlikely. Biased judges cheering the chance to sign death warrants for the most vulnerable among us. Courts clogged with refugees being prosecuted for seeking refuge while being pressured by seizure of their children into giving up rights.

Once again, I’ve been proved right: We are actively diminishing ourselves as a nation every day; but, it isn’t stopping, and won’t in the long run stop, human migration. Sure, there is a natural ebb and flow that responds in some minor ways to our futile attempts to stop it. Sort of like throwing up man-made sand bars to stop beach erosion. Works for a few months or even years, but eventually the inevitable forces of nature win out. It sure seems to me that it would be smarter to work with the flow of the river and turn it to our advantage, rather than trying to make it reverse course — an exercise in futility that only serves to diminish the humanity of each of us.

Aminta Cifuentes suffered weekly beatings at the hands of her husband. He broke her nose, burned her with paint thinner and raped her.

She called the police in her native Guatemala several times but was told they could not interfere in a domestic matter, according to a court ruling. When Cifuentes’s husband hit her in the head, leaving her bloody, police came to the home but refused to arrest him. He threatened to kill her if she called authorities again.

So in 2005, Cifuentes fled to the United States. “If I had stayed there, he would have killed me,” she told the Arizona Republic.

And after nearly a decade of waiting on an appeal, Cifuentes was granted asylum. The 2014 landmark decision by the Board of Immigration Appeals set the precedent that women fleeing domestic violence were eligible to apply for asylum. It established clarity in a long-running debate over whether asylum can be granted on the basis of violence perpetrated in the “private” sphere, according to Karen Musalo, director for the Center for Gender & Refugee Studies at the University of California Hastings College of the Law.

But on Monday, Attorney General Jeff Sessions overturned the precedent set in Cifuentes’s case, deciding that victims of domestic abuse and gang violence generally will not qualify for asylum under federal law. (Unlike the federal courts established under Article III of the Constitution, the immigration court system is part of the Justice Department.)

For critics, including former immigration judges, the unilateral decision undoes decades of carefully deliberated legal progress. For gender studies experts, such as Musalo, the move “basically throws us back to the Dark Ages, when we didn’t recognize that women’s rights were human rights.”

“If we say in the year 2018 that a woman has been beaten almost to death in a country that accepts that as almost the norm, and that we as a civilized society can deny her protection and send her to her death?” Musalo said. “I don’t see this as just an immigration issue … I see this as a women’s rights issue.”

A group of 15 retired immigration judges and former members of the Board of Immigration Appeals wrote a letter in response to Sessions’s decision, calling it an “affront to the rule of law.”

The Cifuentes case, they wrote, “was the culmination of a 15 year process” through the immigration courts and Board of Immigration Appeals. The issue was certified by three attorneys general, one Democrat and two Republican. The private bar and law enforcement agencies, including the Department of Homeland Security, agreed with the final determination, the former judges wrote. The decision was also supported by asylum protections under international refugee treaties, they said.

“For reasons understood only by himself, the Attorney General today erased an important legal development that was universally agreed to be correct,” the former judges wrote.

Courts and attorneys general have debated the definition of a “particular social group” since the mid-1990s, according to Musalo.

“It took the refugee area a while to catch up with the human rights area of law,” Musalo said.

A series of cases led up to the Cifuentes decision. In 1996, the Board of Immigration Appeals established that women fleeing gender-based persecution could be eligible for asylum in the United States. The case, known as Matter of Kasinga, centered on a teenager who fled her home in Togo to escape female genital cutting and a forced polygamous marriage. Musalo was lead attorney in the case, which held that fear of female genital cutting could be used as a basis for asylum.

“Fundamentally the principle was the same,” as the one at stake in Sessions’s ruling, Musalo said. Female genital cutting, like domestic violence in the broader sense, generally takes place in the “private” sphere, inflicted behind closed doors by relatives of victims.

Musalo also represented Rody Alvarado, a Guatemalan woman who fled extreme domestic abuse and, in 2009, won an important asylum case after a 14-year legal fight. Her victory broke ground for other women seeking asylum on the basis of domestic violence.

Then, after years of incremental decisions, the Board of Immigration Appeals published its first precedent-setting opinion in the 2014 Cifuentes case, known as Matter of A-R-C-G.

“I actually thought that finally we had made some progress,” Musalo said. Although the impact wasn’t quite as pronounced as many experts had hoped, it was a step for women fleeing gender-based violence in Latin America and other parts of the world.

Now, Musalo says, Sessions is trying to undo all that and is doing so at a particularly monumental time for gender equality in the United States and worldwide.

“We’ve gone too far in society with the MeToo movement and all of the other advances in women’s rights to accept this principle,” Musalo said.

“It shows that there are these deeply entrenched attitudes toward gender and gender equality,” she added. “There are always those forces that are sort of the dying gasp of wanting to hold on to the way things were.”

Paul Wickham Schmidt, a retired immigration judge and former chairman of the Board of Immigration Appeals, wrote on his blog that Sessions sought to encourage immigration judges to “just find a way to say no as quickly as possible.” (Schmidt authored the decision in the Kasinga case extending asylum protection to victims of female genital mutilation.)

Sessions’s ruling is “likely to speed up the ‘deportation railway,’ ” Schmidt wrote. But it will also encourage immigration judges to “cut corners, and avoid having to analyze the entire case,” he argued.

“Sessions is likely to end up with sloppy work and lots of Circuit Court remands for ‘do overs,’ ” Schmidt wrote. “At a minimum, that’s going to add to the already out of control Immigration Court backlog.”

Picking on our most vulnerable and denying them hard-earned legal protections that had been gained incrementally over the years. Certainly, can’t get much lower than that!

Whether you agree with Sessions’s reasoning or not, nobody should cheer or minimize the misfortune of others as Sessions does! The only difference between Sessions or any Immigration Judge and a refugee applicant is luck. Not merit! I’ve met many refugees, and never found one who wanted to be a refugee or even thought they would have to become a refugee.

An Attorney General who lacks fundamental integrity, human values, and empathy does not belong at the head of this important judicial system.

In my career, I’ve probably had to return or sign off on returning more individuals to countries where they didn’t want to go than anybody involved in the current debate. Some were good guys we just couldn’t fit into a badly flawed and overly restrictive system; a few were bad guys who deserved to go; some, in between. But, I never gloried in, celebrated, or minimized anyone’s suffering, removal, or misfortune.  Different views are one thing; overt bias and lack of empathy is another.

Attorney General Jeff Sessions’ decision on asylum seekers is 30 pages long.

Advocates and many judges say that the decision is extraordinary, not only because the attorney general took steps to overrule the court’s’ prior rulings, but because the decision that victims of certain kinds of violence can qualify for asylum has been previously reviewed over the course of decades.

A group of 15 former immigration judges signed a letter on June 11 calling the decision “an affront to the rule of law.” They point out that the decision Sessions overturned, a precedent cited in the “Matter of A-B-” decision that he was reviewing, had been certified by three attorney generals before him: one Democrat and two Republicans.

“For reasons understood only by himself, the Attorney General today erased an important legal development that was universally agreed to be correct,” the letter says. “Today we are deeply disappointed that our country will no longer offer legal protection to women seeking refuge from terrible forms of domestic violence from which their home countries are unable or unwilling to protect them.”

In his decision, Sessions said “private criminal activity,” specifically being a victim of domestic violence, does not qualify migrants for asylum. Rather, victims have to show each time that they are part of some distinct social group (a category in international and US law that allows people to qualify for refugee status) and were harmed because they are part of that group — and not for “personal reasons.”

Sessions said US law “does not provide redress for all misfortune. It applies when persecution arises on the account of membership in a protected group and the victim may not find protection except by taking refuge in another country.”

“Generally, claims by aliens pertaining to domestic violence or gang violence perpetrated by non-government actors will not qualify for asylum,” the decision reads. In a footnote, he also says that few of these cases would merit even being heard by judges in the first place because they would not pass the threshold of “credible fear.”

But attorney Karen Musalo says every case has to be decided individually. Muslao is the director of the Center for Gender and Refugee Studies at the UC Hastings College of the Law and has been representing women in immigration hearings for decades. She is concerned that some asylum officers will see this decision as a directive to turn people away from seeing a judge. “That’s patently wrong,” she says.

US Citizenship and Immigration Services, the agency that conducts initial screenings for asylum cases (known as “credible fear interviews”) did not respond to a request for information about how the decision might change the work they do.

Musalo’s is among the attorneys representing A-B-, a Salvadoran woman identified only by her initials in court filings, whose case Sessions reviewed. Her center was part of a group that submitted a brief of over 700 pages in the case; that brief was not cited in Sessions’ decision. The brief reviewed impunity in El Salvador, for example, for those who commit violence against women and also had specific evidence about A-B- and how local police failed to protect her from domestic violence.

“What’s surprising is how deficient and flawed his understanding of the law and his reasoning is. The way he pronounces how certain concepts in refugee law should be understood and interpreted is sort of breath-taking,” says Musalo. “He was reaching for a result, so he was willing to distort legal principles and ignored the facts.”

To Musalo, this case is about more than asylum, though. She says it’s a surprising, damaging twist in the broader #MeToo movement. Sessions is “trying to turn back the clock on how we conceptualize protections for women and other individual,” she says. “In the bigger picture of ending violence against women, that’s just not an acceptable position for our country to take and we’re going to do everything we can to reverse that.”

That includes monitoring cases in the system now and making appeals in federal courts, which could overturn Sessions’ decision. Congress, Musalo says, could also take action.

Because Sessions controls the immigration courts, which are administrative courts that are part of the Department of Justice rather than part of the judiciary branch, immigration judges will have to follow his precedent in determining who qualifies for asylum. District court and other federal judges

Ashley Tabaddor, an immigration judge and president of the National Association of Immigration Judges, said she was troubled by Sessions’ lack of explanation for why he intervened in this particular case.

The attorney general’s ability to “exercise veto power in our decision-making is an indication of why the court needs true independence” from the Justice Department, Tabaddor told the New York Times.

Immigration judge Dana Leigh Marks, the immigration judges association past president, says the group has been advocating for such independence for years.

“We have a political boss. The attorney general is our boss and political considerations allow him, under the current structure, to take certain cases from the Board of Immigration Appeals and to choose to rule on those cases in order to set policy and precedent,” she says. “Our organization for years has been arguing that … there’s a major flaw in this structure, that immigration courts are places where life and death cases are being heard.”

Therefore, she adds, they should be structured “like a traditional court.”

Sessions’ decision will have immediate implications for domestic violence victims currently seeking asylum in the US.

Naomi, who asked to be identified by a pseudonym because her case is pending in New York, is from Honduras. Her former boyfriend there threw hot oil at her, but hit her 4-year-old son instead. The boyfriend threatened them with a gun — she fled, ultimately coming to the US where she has some family. She told us that she tried to get the police to help, but they wouldn’t.

Naomi’s attorney, Heather Axford with Central American Legal Assistance in Brooklyn, said they might need to try a new argument to keep her client in the US.

“We need to come up with new ways to define a particular social group, we need to explore the possibility of when the facts lend themselves to a political opinion claim, and we need to make claims under the Convention Against Torture,” she told WNYC Monday. The US signed and ratified the Convention Against Torture in 1994.

Mary Hansel, deputy director of the International Human Rights Clinic at Loyola Law School in Los Angeles, says the Sessions decision goes against US human rights obligations.

“An evolving body of international legal authorities indicates that a state’s failure to protect individuals (whether citizens or asylum seekers) from domestic violence may actually amount to torture or cruel, inhuman or degrading treatment,” Hansel writes in an email to PRI. In international human rights law, states need to protect individuals from harm. “Essentially, when women are forced to endure domestic violence without adequate redress, states are on the hook for allowing this to happen,”

Naomi’s story is horrific, but it is not unusual for women desperate to escape these situations to flee to the US. Many of these women had a high bar for winning an asylum case to begin with. They have to provide evidence that they were persecuted and documents to support their case. Sometimes, lawyers call expert witnesses to explain what is happening in their country of origin. Language barriers, lack of access to lawyers, contending with trauma and often being in detention during proceedings also contribute to making their cases exceptionally difficult.

Sessions’ decision will make it even harder.

In justifying tighter standards, Sessions often claims that there is fraud in the system and that asylum seekers have an easy time arguing their cases.

“We’ve had situations in which a person comes to the United States and says they are a victim of domestic violence, therefore they are entitled to enter the United States” Sessions told Phoenix radio station KTAR in May. “Well, that’s obviously false, but some judges have gone along with that.”

Unlike other court proceedings, immigrants who do not have or cannot afford attorneys are not guaranteed legal counsel. There are no public defenders in immigration court. And just 20 percent of those seeking asylum are represented by attorneys, according to a report by the Transactional Records Access Clearinghouse at Syracuse University.

The Trump administration has taken several steps to clear the 700,000 cases pending in immigration court.  At the end of May, Sessions instituted a quota system for immigration judges, requiring them to decide 700 cases each year and have fewer than 15 percent of cases be overturned on appeal.

Marks told NPR that the quota could hurt judicial independence. “The last thing on a judge’s mind should be pressure that you’re disappointing your boss or, even worse, risking discipline because you are not working fast enough,” she said.

According to TRAC, the courts decided more than 30,000 cases in the 2017 fiscal year compared to about 22,000 in 2016. Some 61.8 percent of these cases were denied; the agency does not report how many of the claims were due to domestic or gang violence, or for other reasons. For people from Central America, the denial rate is 75 to 80 percent. Ninety percent of those who don’t have attorneys lose their cases.

How the attorney general is abusing a rarely used provision to rewrite legal precedent.

On Monday, Attorney General Jeff Sessions told a group of immigration judges that while they are responsible for “ensur[ing] that our immigration system operates in a manner that is consistent with the laws,” Congress alone is responsible for rewriting those laws. Sessions then announced that he would be issuing a unilateral decision regarding asylum cases later in the day, a decision he told the judges would “provide more clarity” and help them “rule consistently and fairly.” The decision in Matter of A-B-, which came down shortly after his remarks, reverses asylum protections for victims of domestic violence and other persecution.

During his speech Sessions framed his decision in Matter of A-B- as a “correct interpretation of the law” that “advances the original intent” of our immigration statute. As a matter of law, Sessions’ decision is disturbing. It’s also alarming that this case ended up in front of the attorney general to begin with. Sessions is abusing a rarely used provision to rewrite our immigration laws—a function the attorney general himself said should be reserved for Congress. His zealous self-referral of immigration cases has been devastatingly effective. Sessions is quietly gutting immigration law, and there’s nothing stopping him from continuing to use this loophole to implement more vindictive changes.

Normally, an immigration judge is the first to hear and decide an immigration case. If the case is appealed, it goes in front of the Board of Immigration Appeals before being heard by a federal circuit court. In a peculiarity of immigration law, however, the attorney general is permitted to pluck cases straight from the Board of Immigration Appeals for personal review and adjudication. Sessions, who was famously denied a federal judgeship in 1986 because of accusations that he’d made racist comments, now seems to be indulging a lingering judicial fantasy by exploiting this provision to the fullest. Since January 2018, Sessions has referred four immigration cases to himself for adjudication, putting him on track to be one of the most prolific users of the self-referral provision since 1956, when attorneys general stopped regularly reviewing and affirming BIA cases. By comparison, Eric Holder and Loretta Lynch certified a total four cases between them during the Obama administration.

Sessions is not using these cases to resolve novel legal issues or to ease the workload of DHS attorneys or immigration judges. Instead, he is using the self-referral mechanism to adjudicate cases that have the most potential to limit the number of people granted legal status in the United States, and he’s disregarding the procedural requirements set up to control immigration appeals in the process.

A close look at the Matter of A-B- case shows exactly how far out of bounds Sessions is willing to go. Matter of A-B- began when Ms. A-B- arrived in the United States from El Salvador seeking asylum. Ms. A-B- had been the victim of extreme brutality at the hands of her husband in El Salvador, including violent attacks and threats on her life. The local police did nothing to protect her. When it became clear it was only a matter of time before her husband tried to hurt her again, Ms. A-B- fled to the United States. Upon her arrival at the U.S. border, Ms. A-B- was detained in Charlotte, North Carolina. Her asylum case was set to be heard by Judge Stuart Couch, a notoriously asylum-averse judge who is especially resentful of claims based on domestic violence.

During her trial, Ms. A-B- testified about the persecution she’d faced at the hands of her husband and provided additional evidence to corroborate her claims. Despite the extensive evidence, Judge Couch found Ms. A-B-’s story was not credible and rejected her asylum claim. Ms. A-B- then appealed her case to the BIA. There, the board unanimously found that Ms. A-B-’s testimony was in fact credible and that she met the requirements for asylum. Per their protocol, the BIA did not grant Ms. A-B- asylum itself but rather sent the case back down to Judge Couch, who was tasked with performing the required background checks on Ms. A-B- and then issuing a grant of asylum in accordance with their decision.

Judge Couch, however, did not issue Ms. A-B- a grant of asylum, even after the Department of Homeland Security completed her background checks. Instead, he improperly tried to send the case back to the BIA without issuing a new decision, apparently because he was personally unconvinced of the “legal validity” of asylum claims based on domestic violence. Before the BIA touched the case again, Attorney General Sessions decided he ought to adjudicate it himself.

After taking the case, Sessions asked for amicus briefs on the question of “whether … being a victim of private criminal activity constitutes a cognizable ‘particular social group’ for purposes of an application for asylum.” The question of whether private criminal activity like domestic violence can in some instances lead to a grant of asylum had not been at issue in Matter of A-B-. The issue raised in Ms. A-B-’s case was whether her claims were credible, not whether asylum was available for victims of private criminal activity. In fact, persecution at the hand of a private actor who the government cannot or will not control is contemplated in the asylum statute itself and has been recognized as a grounds for asylum for decades. The question of whether domestic violence could sometimes warrant asylum also appeared to be firmly settled in a 2014 case known as Matter of A-R-C-G-.

The question the attorney general was seeking to answer was actually so settled that the Department of Homeland Security, the agency responsible for prosecuting immigration cases, submitted a timid brief to Sessions politely suggesting that he reconsider his decision to take on this case. “This matter does not appear to be in the best posture for the Attorney General’s review,” its brief argued, before outright acknowledging that the question of whether private criminal activity can form the basis of an asylum claim had already been clearly answered by the BIA. The attorney general, despite his alleged desire to simplify the jobs of immigration prosecutors and judges, ignored DHS’s concerns and denied the agency’s motion. “[BIA] precedent,” Sessions wrote in his denial, “does not bind my ultimate decision in this matter.” Sessions, in short, was going to rewrite asylum law whether DHS liked it or not.

Sessions not only ignored DHS concerns about the case but, as 16 former immigration judges pointed out in their amicus brief, trampled over several crucial procedural requirements in his zeal to shut off asylum eligibility for vulnerable women. First, he failed to require Couch, the original presiding judge, to make a final decision before sending the case back to the BIA. The regulations controlling immigration appeals allow an immigration judge to send a case to the BIA only after a decision has been issued by the original judge. Next, Sessions failed to wait for the BIA to adjudicate the case before snapping it up for his personal analysis. Even if Judge Couch hadn’t improperly sent the case back to the BIA, Sessions was obligated to wait for the BIA to decide the case before intervening. The self-referral provision permits the attorney general to review BIA decisions, not cases that are merely awaiting adjudication.

Finally, and perhaps most tellingly, the question Sessions sought to answer in this case, namely “whether … being a victim of private criminal activity constitutes a cognizable ‘particular social group’ for purposes of an application for asylum” was not a question considered by any court in Matter of A-B-. Rather, it was one Sessions seemingly lifted directly from hardline immigration restrictionists, knowing that the answer had the potential to all but eliminate domestic violence–based asylum claims.

On June 11, after receiving 11 amicus briefs in support of asylum-seekers like Ms. A-B- and only one against, the attorney general ruled that private activity is not grounds for asylum, including in cases of domestic violence. Ms. A-B-’s case, in Sessions’ hands, became a vehicle by which to rewrite our asylum laws without waiting on Congress.

The attorney general’s other self-referred decisions are likewise plagued by questionable procedure. In Matter of E-F-H-L-, Sessions seized on a case from 2014 as an opportunity undo the longstanding requirement that asylum applicants be given the opportunity for a hearing. Like in Matter of A-B-, Sessions did procedural somersaults to insert himself into Matter of E-F-H-L-, using a recent decision by the immigration judge in the case to close the proceedings without deciding the asylum claim as grounds to toss out the original BIA ruling on the right to a hearing. Without so much as a single phone call to Congress, Sessions effectively rescinded the requirement that asylum seekers are entitled to full hearings. He also mandated that the judge reopen Mr. E-F-H-L-’s case years after he thought he was safe from deportation.

In Matter of Castro-Tum, a case Sessions referred to himself in January, he used his powers to make life more difficult for both immigrants and immigration judges by banning the use of “administrative closure” in removal proceedings. Administrative closure allowed immigration judges to choose to take cases off their dockets, indefinitely pausing removal proceedings. In Matter of Castro-Tum, Sessions made a new rule that sharply curtails the use of the practice and allows DHS prosecutors to ask that judges reschedule old closed cases. The result? The potential deportation of more than 350,000 immigrants whose cases were previously closed. In addition, judges now have so many hearings on their dockets that they are scheduling trials in 2020.

As CLINIC, an immigration advocacy group, pointed out, Sessions appeared be using his decision in Matter of Castro-Tum to improperly develop a new rule on when judges can administratively close immigration cases. Normally, such a new rule would need to go through a fraught bureaucratic process under the Administrative Procedures Act before being implemented. Instead of going through that lengthy process, however, Sessions simply decreed the new rule in his decision, bypassing all the usual procedural requirements.

The cases that Sessions has chosen to decide and the procedural leaps he’s taken to adjudicate them show that his goal is to ensure that fewer people are permitted to remain in the United States, Congress be damned. So far, his plan seems to be working. As a result of Sessions’ decision in Matter of A-B-, thousands of women—including many of the women who are currently detained after having their children torn from their arms at our border—will be shut out of asylum proceedings and deported to their countries of origin to await death at the hands of their abusers.

While Sessions’ decisions trump BIA precedent, they do not override precedent set by the federal circuit courts on immigration matters, much of which contradicts the findings he’s made in his decisions. While immigration attorneys are scrambling to protect their clients with creative new advocacy strategies, the only real way to stop Sessions’ massacre is to listen to him when he says Congress needs to fix our immigration laws. In doing so, the legislative branch could not only revise our immigration system to offer meaningful paths to legal status for those currently shut out of the system, but could eliminate the needless attorney general review provision altogether and force Sessions to keep his hands out of immigration case law.

Sessions’s shameless abuses of our Constitution, Due Process, fundamental fairness, the true rule of law, international standards, common morality, and basic human values are beyond astounding.

I agree with Bea that this requires a legislative solution to 1) establish once and for all that gender based asylum fits squarely within the “particular social group” definition; and 2) establish a U.S. Immigration Court that is independent of the Executive Branch.

A few problems, though:

  • Not going to happen while the GOP is in control of all branches of Government. They can’t even get a “no brainer” like DACA relief done. Trump and his White Nationalist brigade including Sessions are now firmly in control.
  • If you don’t win elections, you don’t get to set the agenda. Trump’s popularity has consistently been below 50%. Yet the majority who want to preserve American Democracy and human decency have let the minority control the agenda. If good folks aren’t motivated to vote, the country will continue its descent into the abyss.
  • No more Obama Administrations, at least on immigration. The Dreamer fiasco, the implosion of the Immigration Courts, and the need for gender protections to be written into asylum law were all very well-known problems when Obama and the Dems swept into office with a brief, yet significant, veto proof Congress. The legislative fix was hardly rocket science. Yet, Obama’s leadership failed, his Cabinet was somewhere between weak and incompetent on immigration, and the Dems on the Hill diddled. As a result “Dreamers” have been left to dangle in the wind — a bargaining chip for the restrictionist agenda; children are being abused on a daily basis as a matter of official policy under Sessions; women and children are being returned to death and torture; and the U.S. Immigration Courts have abandoned Due Process and are imploding in their role as a “junior Border Patrol.” Political incompetence and malfeasance have “real life consequences.” And, they aren’t pretty!

There have been some bright spots for the Dems in recent races. But, the November outcome is still totally up for grabs. If the Trump led GOP continues its stranglehold on all branches of Government, not only will children suffer and women die, but there might not be enough of American Democracy left to save by 2020.

Get out the vote! Remove the kakistocracy!

The massive asylum changes Jeff Sessions tucked into the footnotes

When Attorney General Jeff Sessions ruled that domestic violence and gang victims are not likely to qualify for asylum in the US, he undercut potentially tens of thousands of claims each year for people seeking protection.

But in a footnote of his ruling, Sessions also telegraphed a desire for more sweeping, immediate reinterpretations of US asylum law that could result in turning people away at the border before they ever see a judge.

Sessions wrote that since “generally” asylum claims on the basis of domestic or gang violence “will not qualify for asylum,” few claims will meet the “credible fear” standard in an initial screening as to whether an immigrant can pursue their claim before a judge. That means asylum seekers may end up being turned back at the border, a major change from current practice.

“When you put it all together, this is his grand scheme to just close any possibility for people seeking protection — legally — to claim that protection that they can under the law,” said Ur Jaddou, a former chief counsel at US Citizenship and Immigration Services now at immigration advocacy group America’s Voice. “He’s looking at every possible way to end it. And he’s done it one after the other.”

The Trump administration has focused on asylum claims — a legal way to stay in the US under domestic and international law — characterizing them as a “loophole” in the system. The problem, they say, is many claims are unsuccessful, but in the meantime as immigrants wait out a lengthy court process, they are allowed to live and work in the US and build lives there, leading some to go into hiding.

I strongly recommend that you go on over to CNN at the link to read Tal’s amazing and incisive analysis of Jeff Sessions’s insidious plan to destroy US protection laws and undermine our entire Constitutional system of justice to further his obscene White Nationalist agenda.

For those of you who read “Courtside” on a regular basis, it’s no secret that I’m a “Charter Member” of the “Tal Kopan Fan Club.” I have total admiration for her amazing work ethic, ability to understand and simplify one of the most complex subjects in US law and politics, and to turn out such tightly written, gobbledygook free copy on a regular basis.

In my view, even for a superstar like Tal, this is one of her “best ever” articles, and one that every American interested in saving lives, preserving our refugee and asylum laws, retaining our Constitutional system of Due Process, and remaining a nation of “values rather than men” in light of a totally unprincipled attack by an Attorney General unqualified for office should read and digest Tal’s analysis!

How disingenuous a scofflaw is Jeff Sessions? As Tal mentions, in FN 8 of Matter of A-B-, Sessions takes aim at the well-established principle of asylum law that “family” is a qualifying “particular social group.”

Now, lets hear what a “real” Article III Court, one not bound to a restrictionist White Nationalist anti-asylum agenda, and where they judges don’t work for Jeff Sessions, has to say about “family” as a particular social group:”

The INA does not expressly define the term “particular social group,” but we have recently considered its meaning. See Lizama v. Holder, 629 F.3d 440 (4th Cir. 2011).4 We there concluded that Chevron deference should be accorded to the BIA’s long-standing interpretation of “particular social group” as “a group of persons all of whom share a common, immutable characteristic,” Matter of Acosta, 19 I. & N. Dec. 211, 233 (BIA 1985), overruled on other grounds by Matter of Mogharrabi, 19 I. & N. Dec. 439 (BIA 1987). See Lizama, 629 F.3d at 447. This “immutability” test, first articulated in the BIA’s seminal Acosta case, requires that group members share a characteristic that “the members of the group either cannot change, or should not be required to change because it is fundamental to their individual identities or consciences.” 19 I. & N. Dec. at 233.

The Crespins’ proposed group satisfies this test. Acosta itself identifies “kinship ties” as paradigmatically immutable, see id., and the BIA has since affirmed that family bonds are innate and unchangeable. See In re C-A, 23 I. & N. Dec. 951, 959 (BIA 2006); In re H-, 21 I. & N. Dec. 337, 342 (BIA 1996) (accepting “clan membership” as a particular social

group because it was “inextricably linked to family ties”). Accordingly, every circuit to have considered the question has held that family ties can provide a basis for asylum. See Al-Ghorbani v. Holder, 585 F.3d 980, 995 (6th Cir.2009); Ayele v. Holder, 564 F.3d 862, 869 (7th Cir.2009); Jie Lin v. Ashcroft, 377 F.3d 1014, 1028 (9th Cir.2004); Gebremichael v. INS, 10 F.3d 28, 36 (1st Cir.1993). We agree; the family provides “a prototypical example of a `particular social group.'” Sanchez-Trujillo v. INS, 801 F.2d 1571, 1576 (9th Cir. 1986).

The BIA committed legal error by concluding to the contrary. That error flowed from the fact that, as the Government concedes, the BIA’s removal order rejected a group different from that which the Crespins proposed. The BIA concluded that “those who actively oppose gangs in El Salvador by agreeing to be prosecutorial witnesses” does not constitute a cognizable social group. But the Crespins did not so contend. Rather, they maintained, and continue to maintain, that family members of those witnesses constitute such a group. The BIA later essentially admitted this error, acknowledging in its denial of Crespin’s motion to reconsider that it does “not dispute that family membership can give rise to membership in a particular social group under certain circumstances.” The BIA nonetheless affirmed its original order, asserting that the Crespins’ proposed social group was insufficiently “particular[ ]” because “anyone who testified against MS-13, as well as all of their family members, would potentially be included.” Again the BIA inaccurately characterized the Crespins’ proposed social group. Indeed, the Crespins’ proposed group excludes persons who merely testify against MS-13; the Crespins’ group instead encompasses only the relatives of such witnesses, testifying against MS-13, who suffer persecution on account of their family ties. The BIA never explained why this group stretches beyond the bounds of particularity.

Moreover, the precedent on which the BIA relied requires only that “the group have particular and well-defined boundaries” such that it constitutes a “discrete class of persons.” Matter of S-E-G-, 24 I. & N. Dec. 579, 582, 584 (BIA 2008). The family unit—centered here around the relationship between an uncle and his nephew—possesses boundaries that are at least as “particular and well-defined” as other groups whose members have qualified for asylum. See, e.g., Urbina-Mejia v. Holder, 597 F.3d 360, 365-66 (6th Cir.2010) (former gang members); Tapiero de Orejuela v. Gonzales, 423 F.3d 666, 672 (7th Cir.2005) (“the educated, landowning class of cattle farmers”); Safaie v. INS, 25 F.3d 636, 640 (8th Cir.1994) (“Iranian women who advocate women’s rights or who oppose Iranian customs relating to dress and behavior”), superseded by statute on other grounds, Illegal Immigration Reform and Immigrant Responsibility Act of 1996, Pub.L. No. 104-208, 110 Stat. 3009, as recognized in Rife v. Ashcroft, 374 F.3d 606, 614 (8th Cir.2004).

Finally, the BIA opined that the proposed group lacked the requisite “social visibility” of a particular social group. This was also error.5 Indeed, the BIA itself has previously stated that “[s]ocial

groups based on innate characteristics such as … family relationship are generally easily recognizable and understood by others to constitute social groups.” In re C-A, 23 I. & N. Dec. at 959. In fact, we can conceive of few groups more readily identifiable than the family. See Sanchez-Trujillo, 801 F.2d at 1576. This holds particularly true for Crespin’s family, given that Crespin and his uncle publicly cooperated with the prosecution of their relative’s murder.

In sum, the BIA’s conclusion that Crespin failed to demonstrate his membership in a “particular social group” was manifestly contrary to law.

Crespin-Valladares v. Holder, 632 F.3d 117, 124-26 (4th Cir. 2011).

Outrageously, Sessions is suggesting taking a position that has been held by the Article III Courts to be “manifestly contrary to law.” Could there be a clearer example of a “scofflaw?”

And, lets not forget the cause for which Sessions is prostituting himself and the law. Contrary to Sessions’s suggestion that these are just ordinary folks seeking a better life, he is actually proposing to summarily remove mostly women and children who face a specific, very real chance of rape, torture, beatings, and death because of their position, gender, and resistance to the forces perpetrating persecution in El Salvador who are closely aligned with or operate largely with impunity from  the Government, in fact if not in the mythical version that Sessions portrays.

In plain terms, Jeff Sessions is advocating that we pass a potential “death sentence” on the most vulnerable among us without giving them a fair hearing or actually considering the many ways in which protections laws could be used to save their lives. Even if Sessions were legally correct (which he certainly isn’t) removing basically defenseless individuals to places where they face such a deadly future would be both cowardly and highly immoral.

Finally, as I have pointed out before, the real plan here, which will go into effect almost immediately, is to have USCIS Asylum, Officers and Immigration Judges who now are all considered “partners” in the enforcement mechanism by Sessions,  deny almost all “credible fear” claims based on Sessions’s yet untested decision in Matter of A-B-. Therefore, unless the Article III Courts decide to enforce the Due Process Clause of the Constitution, a duty which to date they have fairly consistently shirked in connection with the “credible fear process,” most current and future arrivals will be shipped out without any access to the hearing process at all — in other words, without even a veneer of fairness, impartiality, and Due Process.

Advocates had better get busy with a better plan to get the illegal aspects of the “deportation express” before the Article IIIs. Otherwise, vulnerable women and children are going to be condemned to death and /or torture with no process at all! Think we’re not witnessing the “decline and fall” of our republic.  Guess again!

What have we come to as a nation when a corrupt and biased individual like Sessions purports to “speak for America?”

House DACA deal in final stages: ‘Crossing the Ts’

Republican negotiations on a House immigration bill that would fix the Deferred Action for Childhood Arrivals program are in the final stages, key lawmakers said as they left a secretive meeting in the House basement on Wednesday.

Both moderates and conservatives are coming together on an outline of a bill brought on by weeks of negotiations behind closed doors, as leadership brought the two wings of the party together to avert rebellions on both sides.

After a breakthrough agreement on how to proceed Tuesday — and arm twisting by leadership — that cut off moderates’ efforts to buck leadership control of the floor, talks Wednesday centered around hammering out the details of the policy itself.

The progress in negotiations sets the stage for votes on immigration on the House floor next week, which will include a vote on a conservative proposal that is not believed to have the support to pass and a separate compromise being written that will stem from the negotiations currently in progress.

Though the bills’ fates are still unclear and it’s possible neither passes the House — let alone moves in the Senate — the prospect of Republicans having a debate and vote on the political third rail of immigration on the House floor the summer before midterm elections was unthinkable just months ago.

“We’re just doing the cleanup stuff from the negotiations that (Reps) Raul (Labrador) and Carlos (Curbelo) did yesterday,” said conservative Freedom Caucus Chairman Mark Meadows as he left member negotiations Wednesday. “So we’re just trying to dot our I’s and cross our T’s.”

“We’re just about there,” Curbelo said. “I think we’ll definitely see text this week.”

What’s in it

CNN has obtained a draft from a source close to the negotiations of the outline lawmakers are working from to write the bill, which, when described to Curbelo, was confirmed as largely still what they’re working on minus a few “details filled in.” The broader GOP conference was briefed on the toplines of the bill in a Wednesday morning meeting.

Sounds to me like another wasteful “legislative charade” on the way from the GOP. The only “Dreamer bill” that actually could pass both houses would be one pushed by a bipartisan group of legislators. But, GOP leadership has no interest in such a solution, nor does Trump.

Therefore, I predict that Dreamers will continue to “twist in the wind” while the Federal Courts ruminate about their fate.

House DACA talks prepare to enter new high-stakes stage

A rebellion by moderate House Republicans to force an immigration vote is widely expected to succeed this week, pushing members in at least one chamber of Congress to address one of the most hot-button topics in American politics months before the midterm elections and against the wishes of GOP leadership.

The final congressional signatures are likely to be added to a proposal in the next 36 hours that would bypass the wishes of House Speaker Paul Ryan and his deputies and ensure moderates a vote on immigration later this month.

But there’s a catch.

Moderates say they will continue to negotiate with party leadership and conservatives — even if they get enough support to force their own vote — in hopes that a different, Republican-only immigration deal can spare the party leaders from an embarrassing and free-wheeling debate on the floor expected to benefit a bipartisan deal heavily supported by Democrats, while still delivering the immigration vote moderates need.

The House Republican infighting on this issue highlights how divisive immigration is to Republicans in Congress, particularly on questions of whether to support a pathway to citizenship for some undocumented immigrants as well as what to pair with it beyond a border wall, including substantial changes to the legal immigration system. The fight has also tested the power of leadership keeping moderates and conservatives at the negotiating table for weeks even while progress has seemed slow to nonexistent.

But as for staving off at least one key development, leadership’s time appears to be up.

The fireworks are expected to begin Tuesday. That’s the day members of the House return to Washington from the weekend and thus can physically sign a discharge petition, a rarely used and rarely successful House procedural maneuver that forces a vote on a bill (or in this case a series of bills) if half of House members sign on. It is also the last day the petition’s organizers believe they have to get all the signatures if they want to hold the series of immigration votes before the end of the month.

Woman’s forced labor for Salvadoran guerillas means she must leave US, court rules

She was kidnapped by Salvadoran guerillas three decades ago, watched her husband be killed and forced to cook and clean for the militants. Now she can’t stay in the US.

The main appellate body of the immigration courts issued a divided opinion Wednesday with broad implications, finding that a woman from El Salvador is ineligible for status in the US because her 1990 abduction and forced labor amount to “material support” of a terrorist organization.

According to the court documents, the woman was kidnapped by the guerillas in El Salvador and made to do the cooking and cleaning “under threat of death.” She was also “forced to witness her husband, a sergeant in the Salvadoran Army, dig his own grave before being killed.”

Nevertheless, the 2-1 opinion holds that the woman’s coerced duties for the group constituted “material support” for a terrorist organization, and thus made her ineligible to be granted asylum or have her deportation order canceled in the US — though a lower court judge had ruled she would otherwise be eligible for such relief. The woman first came to the US illegally in 1991 but gained Temporary Protected Status — which is granted to countries that suffer natural disasters and other mass problems and was afforded to El Salvador for decades.

But she left the US and tried to return in 2004, when the government began deportation proceedings against her. Wednesday’s decision is the product of years of litigation regarding her case in the immigration courts — a judicial body for immigration-related claims run by the Justice Department.

Writing for the majority, Board of Immigration Appeals Judge Roger Pauley ruled that “material support” can be virtually anything that is provided to a terrorist organization that supports their overall mission that they would otherwise would need to seek somewhere else.

“In fact, no court has held that the kind of support an alien provides, if related to promoting the goals of a terrorist organization, is exempt from the material support bar, and we discern no basis to import such a limitation,” Pauley wrote.

Pauley also concluded there was no exception for support given “under duress” under US law and the actions do not need to be “voluntary.”

Dissenting board member and Judge Linda Wendtland blasted the court’s interpretation, pointing out the relevant statute lists a number of examples of “material support” like offering safe houses, transportation, funds and other tangible furtherance of their mission.

“I cannot conclude that the menial and incidental tasks that the respondent performed — as a slave — for Salvadoran guerrillas, including cooking, cleaning, and washing clothes, are of ‘the same class’ as the enumerated forms of assistance set forth in the statute,” Wendtland wrote. “Under the majority’s strained interpretation, providing a glass of water to a thirsty individual who happened to belong to a terrorist organization would constitute material support of that organization, because the individual otherwise would have needed to obtain water from another source.”

For the decision to be overturned, the woman in the case would have to appeal to a federal circuit court or succeed in persuading Attorney General Jeff Sessions — who serves as a functional one-man Supreme Court of the immigration courts — to intervene.

Judge slaps Sessions, feds over ‘sanctuary cities’

A federal judge has once again rebuked the administration’s efforts to pressure so-called sanctuary cities, going further than any to date in using a recent Supreme Court decision to rule an existing federal law unconstitutional.

The ruling Wednesday from Judge Michael Baylson, a George W. Bush appointee, thus far applies only to his district in the Philadelphia area, but it could lay the groundwork for even more rulings that further limit what the administration can do to punish sanctuary cities — a key priority of the administration.

The decision relies, in part, on a May ruling from the Supreme Court on state gambling laws.

Baylson had already blocked the Justice Department from imposing new conditions on federal law enforcement grants that Philadelphia has received in the past, limiting his November ruling to the city, which had challenged the move by Attorney General Jeff Sessions. A federal judge in Chicago also has already blocked the new conditions nationwide, a ruling that was upheld in April by an appeals court. The effort from Sessions to impose the conditions had been an attempt to punish sanctuary cities after a federal judge in California had blocked the administration from pursuing broader funding threats.

House GOP immigration negotiations continue ahead of key Thursday meeting

House Republicans are bracing for a two-hour conference meeting Thursday morning on immigration, which could determine the fate of moderate members’ efforts to force a vote on several immigration bills.

“I think a lot of it hangs on that meeting tomorrow,” said Rep. Mia Love, R-Utah, who has signed a  House procedural maneuver — known as a discharge petition — that allows lawmakers to bypass leadership and force a vote on the floor if they can get a majority of members to sign on.

Ahead of that consequential gathering, the key leaders on the moderate and conservative sides of the issue were huddling with party leadership in Speaker Paul Ryan’s effort in hopes of reaching a consensus that could be presented to their colleagues in the morning.

On their way to the Wednesday meeting and earlier in the day, negotiators expressed optimism but were still far apart on the issue of establishing citizenship for recipients of the Deferred Action for Childhood Arrivals program.

Nolan writes in The Hill:

President Bill Clinton’s 1995 State of the Union included the following remarks:

“All Americans, not only in the states most heavily affected, but in every place in this country, are rightly disturbed by the large numbers of illegal aliens entering our country. The jobs they hold might otherwise be held by citizens or legal immigrants. The public service they use impose burdens on our taxpayers.”

“We are a nation of immigrants. But we are also a nation of laws. It is wrong and ultimately self-defeating for a nation of immigrants to permit the kind of abuse of our immigration laws we have seen in recent years, and we must do more to stop it.”

Clinton is not the only Democrat who has spoken out against illegal immigration. The Republicans provide a number of examples in a blog they posted recently: “The Democrat Hard Left Turn on Illegal Immigration.”

 

  • In 1993, then-Senator Harry Reid (D-Nev.), said, “When it comes to enforcing laws against illegal immigration, we have a system that will make you recoil in disbelief. … Yet we are doing almost nothing to encourage these people to go home or even to deter them from coming here in the first place.”
  • In 1994, Senator Dianne Feinstein (D-Calif.) ran a political ad showing illegal immigrants crossing the border and promised to get tough on illegal immigration with more “agents, fencing, lighting, and other equipment.” 
  • In 2006, then-Senator Barack Obama (D-Ill.) said “Better fences and better security along our borders” would “help stem some of the tide of illegal immigration in this country.”
  • In 2009, during a speech at Georgetown Law, Senator Chuck Schumer(D-N.Y.) said, “When we use phrases like ‘undocumented workers,’ we convey a message to the American people that their government is not serious about combating illegal immigration, which the American people overwhelmingly oppose.”

The blog also provides video clip links, including one that shows Clinton receiving a standing ovation for his remarks about Americans being disturbed by the large numbers of illegal aliens entering the country.

recent report from the Economic Policy Institute (EPI) on the labor laws California has enacted to protect unauthorized immigrant workers indicates that many of the immigrants who have been attracted to California by its sanctuary policies are being exploited by unscrupulous employers.

In fact, the main beneficiaries of California’s sanctuary policies are the employers who exploit undocumented immigrant workers and deportable immigrants in police custody who otherwise would be turned over to ICE when they are released.

California has had to enact seven laws to protect undocumented workers from being exploited by their employers.

EPI found that the ability of U.S. employers to exploit unauthorized workers undercuts the bargaining power of U.S. workers who work side by side with them. When the wages and labor standards of unauthorized immigrants are degraded, it has a negative impact on the wages and labor standards of U.S. workers in similar jobs.

In reality, we could meet all of our immigration needs with legal immigration. We do not need nor ultimately benefit from uncontrolled illegal immigration.

I’m all for replacing the uncontrolled flow of undocumented migrants with legal migrants. That’s why I favor a “smart” immigration policy that would:

  • Legalize the vast majority of those currently here without documentation who are working in needed jobs, law-abiding, and contributing to our society. Legalization would allow them to be screened, brought into the tax system (if they aren’t already), and protected by U.S. labor laws.
  • Expand legal immigration opportunities, particularly for  so-called “non-professional,” manual labor skills and jobs that are badly needed in the U.S. and which now often are filled by undocumented labor. That would allow screening of visa applicants abroad, a controlled entry process, and protections under the labor laws. To the extent that undocumented migration is being driven by unfilled market forces, it would decrease the flow of undocumented individuals, thus saving us from expensive, unneeded, inhumane, and ineffective “enforcement overkill.” Immigration enforcement would be freed to concentrate on those who might actually be a threat to the U.S.
  • Create more robust, realistic refugee laws that would bring many more refugees through the legal system, particularly from the Northern Triangle. This, along with cooperation with the UNHCR and other nations would reduce the need for individuals to make they way to our borders to apply for asylum. Asylum processing could be improved by allowing the Asylum Office to review and grant “defensive” as well as affirmative applications, thus lessening the burden on the Immigration Courts.
  • More investment in Wage and Hour, NLRB, and OSHA enforcement to prevent unscrupulous employers from taking advantage of workers of all types.
  • We have full employment, surplus jobs, a declining birth rate, and we’re losing the “STEM edge” to the PRC, Canada, Mexico, the EU and other nations that are becoming more welcoming and attractive to “high skill” immigrants. We’re going to need all of the legal immigration we can get across the board to remain viable and dynamic in a changing world.
