Immigration has always been a controversial topic in the United States. In the late 19th century, over 2 million Irish immigrated to the U.S. Most were Catholic and that created conflict with the largely Protestant U.S. population. The first comprehensive immigration law, the U.S. Immigration Act of 1882, contained provisions specifically designed to discourage European immigrants.

“This is not the first time the country has had anti-immigration policies, but the scapegoat group has changed over time,” said Gabriela León-Pérez, Ph.D., an assistant professor of sociology at Virginia Commonwealth University who studies immigration policy.

León-Pérez wanted to give her students an understanding of the current immigration debate so she developed a course called Immigration and American Society, which covers the history of immigration and immigration policy and examines where the current debate fits into the past.

“It presents students with a context on the state of immigration today,” León-Pérez said. “A lot of people have opinions about immigration but most of them are not based on facts.”

A class to cut through the noise

When designing the course, León-Pérez wanted to be able to address current events in the news. The course uses some textbooks, but it also incorporates podcasts and blogs. The goal is to have the discussion revolve around the current state of the immigration debate.

“It definitely evolves based on current events,” León-Pérez said. “The first time I taught it was 2018, and there have been a lot of changes since then.”

John Lees, a psychology major, believes the class has given him a better understanding of immigration history. The class specifically looks at the immigration policies of presidents Barack Obama and Donald Trump. Lees believes he now has a well-rounded perspective on the subject.

Yessica Flores, who is majoring in psychology and sociology, signed up for the class because she hears a lot of information about the subject and knew a class would help her cut through the noise.

“We are living in a world where the media is everywhere; where false news is frequent news,” Flores said. “I enrolled in the course with hopes of becoming educated in this area to help educate, inform and encourage others to better understand the reality of immigration within American society.”

“I try to present both sides of the debate,” León-Pérez said. “I want the students to have a well-rounded understanding of immigration and the debate. I don’t want them to shut down a side of the debate.”

Many students, she has observed, only understand the immigration debate from a particular vantage point. The class is a “light bulb” moment for them, and they realize that immigration is a complicated and nuanced topic. In general, immigration often comes down to economics, León-Pérez said. People against immigration are worried that new residents will take jobs, but people who support immigration say immigrants will do the type of work that many residents will not. Immigrants are looking for opportunity.

“Immigrants tend to complement American workers,” León-Pérez said. “Immigrants tend to work at lower-skilled jobs.”

Protecting due process

León-Pérez brings in guest speakers to enhance the curriculum. In February, she invited retired immigration judge Paul Schmidt. In previous semesters, León-Pérez has invited an immigration attorney as a guest speaker. This time, she wanted students to get the perspective of the person on the other side of the bench.

Schmidt served as an immigration judge from 2003 until he retired in 2016. Before that, he served on the U.S. Board of Immigration Appeals. Since retiring, he has been talking about the state of the immigration courts and the lack of due process given to asylum seekers.

“The immigration courts are going through an existential crisis,” Schmidt told the class.

He understands that people have different opinions about immigration, but the courts must follow a process that protects the due process rights of asylum seekers, he said. The court functions as a division of the Department of Justice and Schmidt believes it is not given the resources to function properly. Everyone within the justice system should share a common interest in seeing the courts functioning in a fair and equitable way, Schmidt said.

“The immigration court now is structured in such a way that it is nothing more than a whistle stop on the road to deportation,” he said.

Schmidt offered several suggestions to the students on ways to help people who are going through the immigration courts. Immigrants, unlike citizens, are not required to have an attorney. Many do not understand the immigration process. Schmidt said students could volunteer and help them navigate the complex immigration system in the United States.

“You can join the new due process army,” Schmidt said.

Flores said she has found the class to be informative, and has enjoyed the guest lecturers. The class has not necessarily changed her views about the subject but has motivated her to become more involved.

“I have always disliked the way the immigration cases have been handled, especially the ones involving immigrant children,” Flores said. “I must say that my feelings toward being more involved in promoting change and awareness have changed in the sense that I have developed a much greater interest in getting more involved in the form of a future career.”

Biography

Gabriela León-Pérez is an Assistant Professor in the Department of Sociology at Virginia Commonwealth University. ​Her research focuses on Mexican internal and international migration, the experiences of immigrants in the United States, and health disparities.

The underlying goal of her research agenda is to clarify the role of social, structural, and contextual factors in creating health and social inequalities, as well as to identify resources that improve the outcomes of immigrants and other marginalized populations. In her most recent project, she investigated the health trajectories of return US migrants, internal migrants, and indigenous migrants from Mexico. Other on-going projects focus on Mexican skilled migration to the US and the effects of stress, legal status, and state immigrant policies on the health and well-being of immigrants. I’ll lay it on the line. If more Americans, and particularly more potential younger voters, had understood the true role of immigration and refugees in building America’s past and propelling us into an even greater future, and the dangers to them, their classmates, communities, friends, families, and colleagues posed by Trump’s race baiting “Build That Wall” and “Lock Her Up” chants – certainly pages out of the Third Reich and Jim Crow “playbooks,” – then the modest number of additional votes might well have been there to save lives (perhaps those of loved ones) and to preserve our democratic instiutions and justice system from the vicious and corrupt attacks being waged by the Trump regime, its allies, and its enablers.

We could be working together to build a better future for everyone in America, rather than engaged in a desperate struggle to save our nation and our world from authoritarianism, ignorance, wanton cruelty, and environmental and societal degradation. And, unfortunately, the “enablers” include those who don’t agree with Trump but failed to cast a vote for Clinton in the last election. Simple as that. Every vote counts. Elections have consequence. And, defeating Trump and his GOP in November could be our last clear chance to preserve America as a democratic republic!

Björklunden enjoys a loyal following among Door County residents and visitors, as well as Lawrence University alumni, parents and friends. The Boynton Society was formed to celebrate Björklunden and to secure financial backing for its programs. Those who support the mission of Björklunden make the Lawrence University Student Seminar programs possible for over 650 students each year as well as provide opportunities for the Lawrence University Conservatory of Music to perform in Door County.

Many Boynton Society members have attended summer seminars or spent time at the lodge during their years at Lawrence. Anyone who has been to Björklunden would agree that the experience can be life changing. Boynton Society members help to make sure that visitors of all ages will be able to enjoy the treasure that awaits as they venture into the “birch forest by the water” for years to come.

Who were the Boyntons and how did they relate to Lawrence University:

The Björklunden Tradition

Björklunden* vid Sjön, Swedish for “Birch Grove by the Lake” is a 425-acre estate on the Lake Michigan shore just south of Baileys Harbor in picturesque Door County. A place of great beauty and serenity, the property includes meadows, woods, and more than a mile of unspoiled waterfront.

Björklunden was bequeathed to Lawrence University in 1963 by Donald and Winifred Boynton of Highland Park, Illinois. The Boyntons made the gift with the understanding that Björklunden would be preserved in a way that would ensure its legacy as a place of peace and contemplation. Winifred Boynton captured the enduring spirit of Björklunden when she said of her beloved summer home: “Far removed from confusion and aggression, it offers a sanctuary for all.”

Since 1980, Lawrence has sponsored a series of adult continuing-education seminars at Björklunden, interrupted only by a 1993 fire that destroyed the estate’s main lodge. In 1996, construction was completed on a new and larger facility, and the Björklunden Seminars resumed. The magnificent lodge and idyllic setting create a peaceful learning environment. Seminars address topics in the arts, music, religion, history, drama, nature, and more. Seminar participants may enjoy a relaxing week’s stay at the lodge or are welcome to commute from the area.

Throughout the academic year, groups of Lawrence students and faculty come to Björklunden for weekend seminars and retreats. Each student at Lawrence has the opportunity to attend a student seminar at Björklunden at least once during their studies. Student seminars provide the opportunity to explore exciting themes and issues and the time and the environment in which to embrace those ideas and their consequences. The magic of a Björklunden weekend is in the connection between thought and reflection. Making that connection fulfills one ideal of a liberal education.

The two-story Björklunden lodge is a magnificent 37,000 square-foot structure containing a great room, muti-purpose and seminar rooms, dining room and kitchen, as well as 22 guest rooms. The lodge accommodates a wide variety of seminars, meetings, conferences, receptions, family gatherings, musical programs and other special events and is available for use throughout the year. In addition to the main building, the Björklunden estate also includes a small wooden chapel built in a late 12-century Norwegian stave church (stavkirke) style, handcrafted by the Boyntons between 1939 and 1947.

Greetings, and thank you so much for coming out to listen this beautiful afternoon on a topic that has consumed my post-Lawrence professional life: American Immigration.

 

Whether you realize it or not, immigration shapes the lives of each of us in this room. It will also determine the future of our children, grandchildren, and following generations.  Will they continue to be part of a vibrant democratic republic, valuing human dignity and the rule of law?  Or, will they be swept into the maelstrom as our beloved nation disintegrates into a cruel, selfish, White Nationalist kleptocracy, mocking and trampling most of the principles that we as “liberal artists” grew up holding dear.

Many of you have thought about this before in some form or another. Indeed, that might be why you are here this afternoon, rather than outside frolicking in the sunlight. But, for any who don’t recognize the cosmic importance of migration in today’s society, in the words of noted scholar and country music superstar Toby Keith, “It’s me, baby, with your wake-up call.”

For, make no mistake about it, civilization is undergoing an existential crisis. Western liberal democracy, the rule of law, scientific truth, humanism, and our Constitutional guarantees of Due Process of law for all are under vicious attack. Evil leaders who revel in their anti-intellectualism and pseudo-science have shrewdly harnessed and channeled the powerful cross currents of hate, bias, xenophobia, fear, resentment, greed, selfishness, anti-intellectualism, racism, and knowingly false narratives to advance their vitriolic program of White Nationalist authoritarianism, targeting directly our cherished democratic institutions. And, their jaundiced and untruthful view of American immigration is leading the way toward their dark and perverted view of America’s future.

 

As fellow members of the Boynton society, I assume that all of you are familiar with our beautiful chapel, painstakingly hand-constructed by Winifred Boynton and her husband Donald – a true labor of love, optimism, humanitarianism, and respect for future generations. Executive Summary

I will provide an overview and critique of US immigration and asylum policies from the perspective of my 46 years as a lawyer, in both the public and private sectors, public servant, senior executive, trial and appellate judge, educator, and most recently, unapologetic “rabble rouser” defending Due Process and judicial independence.

I will offer a description of the US immigration system by positing different categories of membership: full members of the “club” (US citizens); “associate members” (lawful permanent residents, refugees and asylees); “friends” (non-immigrants and holders of temporary status); and, persons outside the club (the undocumented). I will describe the legal framework that applies to these distinct populations and recent developments in federal law and policy that relate to them. I will also mention some cross-cutting issues that affect these populations, including immigrant detention, immigration court backlogs, state and local immigration policies, and Constitutional rights that extend to non-citizens.

Professor Esperanza and Judge Schmidt have successfully used their unique “legal/cultural anthropological approach” in undergraduate teaching and will now offer it in a post-graduate seminar.

Paul Wickham Schmidt ’70, retired in 2016 after 13 years as a U.S. Immigration Judge at the Arlington (VA) Immigration Court. Prior to that, he was an Appellate Immigration Judge on the Board of Immigration Appeals, U.S. Department of Justice, serving as the Chairman for six years. He also practiced business immigration law as a partner at Jones Day and managing partner of the D.C. Office of Fragomen. He was Senior Executive in the “Legacy INS” under administrations of both parties. Following graduation from Lawrence, he received a J.D from the University of Wisconsin Law School. He also received the 2010 Lucia Briggs Distinguished Achievement Award from Lawrence. Currently, he is an Adjunct Professor at Georgetown Law, writes the blog immigrationcourtside.com, and is a frequent speaker, radio, and tv commentator on current immigration issues.

Jennifer Esperanza received her Ph.D. in Anthropology from UCLA. She also holds a M.A. from UCLA and a B.A. from USC. She has been a Professor of Anthropology at Beloit College since 2008. As one of two socio-cultural anthropologists in the Department of Anthropology, her primary areas of expertise include political economy, Southeast Asia (Indonesia and the Philippines), tourism and handicrafts, language and identity, consumerism and immigration and refugee resettlement in the United States. She believes students must learn that culture cannot be properly understood without examining its economic and political contexts. In addition to authoring a number of scholarly publications, she received a Marvin Weisberg Foundation for Human Rights Faculty Research Grant in 2015, and a Mellon Foundation research grant in 2018-19.

I have a question for you. If you learned that the attached quote was functioning as someone’s daily mantra or motivation, what job or endeavor would you imagine that person to be connected to? Perhaps an investigative journalist exposing some hard truths. Maybe a civil rights lawyer. Maybe someone speaking up about an abusive relationship. Perhaps, even, someone gearing up for battle. With that in mind, what does it mean that on a Wednesday morning last week, I came into my classroom and saw this quote on my daily feminism calendar and connected with it so deeply that I had to tape it next to my desk? I am a teacher, people. I work with children. What does that say to you about the conditions that public school teachers are working under? I came in this morning to a quiet classroom, empty of students for the weekend, and only then did I have the rare clarity of mind to see the quote taped there and recognize something: it isn’t right that I need this here; it isn’t normal and it most certainly is not acceptable. Sometimes I feel like I AM gearing up for battle. There are days, weeks, or even months in this profession that are so hard that I question whether I’m going to make it another 25 years. I think I can. I know I want to. But sometimes when I think about my emotional and physical well-being, I wonder if I should keep going. I don’t blame my administrators: they are just finding temporary loopholes in a broken system. I don’t blame parents: teachers are an easy scapegoat when life is hard and unfair. I don’t even blame the students: we raised them, after all. The morale of teachers is a pretty good gauge for the future of our nation. No one will escape the ramifications of deprioritizing public education. And yet, I AM still here. I AM sticking around. Silence from me is only an indication that I have thoughts brewing.

(Disclaimer: It’s sad that I feel a need to point this out alongside every post I make about education, but please do not file this post as reason number 472 why you aren’t going to send your kid to public school. You might have come to that decision for different reasons that I hope have nothing to do with me. I don’t think it’s right to sugarcoat or hide the hard truths about public education just because I’m scared someone will read them and bolt. At the end of the day, I don’t just send my kids to the public school around the corner and teach in another because I think I should- I actually feel fortunate to do so.)

Scott Walker Dismayed That Wisconsin Apparently Smarter Despite Cuts in Education

MADISON (The Borowitz Report)—Scott Walker, the governor of Wisconsin, said on Wednesday that he was “dismayed and alarmed” that people in his state had somehow become smarter despite substantial cuts in education.

“Ever since I took office, I have slashed education with the goal of making the voters of this state markedly dumber and incapable of critical thinking,” he told reporters. “Instead, what I am looking at is a doomsday scenario.”

Walker said that his cuts were based on a theory known as “trickle-up stupidity,” in which students in Wisconsin’s schools would become less informed and their ignorance would eventually infect their voting-age parents.

“Clearly, what looked like a can’t-miss plan on paper has not panned out,” he said.

Although Walker said that “it’s not time yet to press the panic button,” he warned that a so-called Smart Wave could be coming in his state.

“If Wisconsin voters continue to get smarter, that will be the end of me,” he said.

Man, any time I wake up in Wisconsin, flip on the TV news, and see a whining Scott Walker, I know that something great has just happened for Wisconsin and the nation. In this case, Wisconsin voters defied Walker and had the good sense to overwhelmingly elect the best qualified candidate to the State Supreme Court by an overwhelming margin, thus depriving Walker of another “toady in robes.” Under the toxic, highly partisan leadership of the GOP, the Wisconsin Supremes have become the laughing-stock of the legal world for their pettiness and internecine squabbles generated by the current Walkerite sycophant majority. One can only hope that the next time Old Scotty whines away, he will be doing it as a private citizen removed from office by the voters.

“The Education Department has told BuzzFeed News it won’t investigate or take action on any complaints filed by transgender students who are banned from restrooms that match their gender identity, charting new ground in the Trump administration’s year-long broadside against LGBT rights.

It’s the first time officials have asserted this position publicly as an interpretation of law. No formal announcement has been made.

For nearly a year, the Trump administration took a less clear stance, with officials saying they were studying the issue. When the Education Department and Justice Department withdrew Obama-era guidance on transgender restroom access in February 2017, Trump’s officials said in a memo and court filings that they would “consider the legal issues involved.” Then last June, the Education Department issued another memo saying it was “permissible” for its civil rights division to dismiss a trans student’s restroom case. However, in those statements, officials never cemented their intent to reject all restroom complaints issued by trans students.

For the past three weeks, BuzzFeed News called and emailed Education Department officials attempting to pinpoint the agency’s position.

Finally on Thursday, Liz Hill, a spokesperson for the agency, responded “yes, that’s what the law says” when asked again if the Education Department holds a current position that restroom complaints from transgender students are not covered by a 1972 federal civil rights law called Title IX.

Asked for further explanation on the department’s position, Hill said Friday, “Title IX prohibits discrimination on the basis of sex, not gender identity.”

She added that certain types of transgender complaints may be investigated — but not bathroom complaints.

“Where students, including transgender students, are penalized or harassed for failing to conform to sex-based stereotypes, that is sex discrimination prohibited by Title IX,” Hill said. “In the case of bathrooms, however, long-standing regulations provide that separating facilities on the basis of sex is not a form of discrimination prohibited by Title IX.”

The bathroom rule is the Trump administration’s latest step to rescind and undermine LGBT protections. Attorney General Jeff Sessions withdrew a policy protecting transgender workers, while he took the unusual step of jumping into a private lawsuit arguing that anti-gay discrimination was permissible in employment under federal law. Sessions has also argued religious business owners can refuse service to gay customers, even when anti-gay discrimination is banned by state law, and Trump has attempted to ban transgender people from all military service.”

“Lots of the news from sub-Saharan Africa is about war, famine, poverty or political upheaval. So it’s understandable if many Americans think most Africans who immigrate to the United States are poorly educated and desperate.

That’s the impression that President Trump left with his comments to members of Congress opposing admission of immigrants from “shithole countries” in Africa and elsewhere.

But research tells another story.

While many are refugees, large numbers are beneficiaries of the “diversity visa program” aimed at boosting immigration from underrepresented nations. And on average, African immigrants are better educated that people born in the U.S. or the immigrant population as a whole.

“It’s a population that’s very diverse in its educational, economic and English proficiency profile,” said Jeanne Batalova, a senior policy analyst at the Migration Policy Institute think tank in Washington and coauthor of a report last year on sub-Saharan African immigrants in the U.S. “People came for a variety of reasons and at various times.”

Overall, their numbers are small compared with other immigrant groups but have risen significantly in recent years. The U.S. immigrant population from sub-Saharan Africa (49 countries with a total population of more than 1.1 billion) grew from 723,000 to more than 1.7 million between 2010 and 2015, according to a new report by New American Economy, a Washington-based research and advocacy group. Still, they make up just half a percent of the U.S. population.

Drawing from U.S. surveys and Census Bureau data, the report found that the majority come from five countries: Nigeria, Ghana, Kenya, Ethiopia and South Africa.

The Pew Research Center reported that African immigrants are most likely to settle in the South or Northeast, and that the largest numbers — at least 100,000 — are found in Texas, New York, California, Maryland, New Jersey, Massachusetts and Virginia. Many African refugees have also relocated to or have been resettled in states such as Minnesota and South Dakota.

The Refugee Act of 1980 made it easier for people fleeing war zones to resettle in the U.S., and today there are tens of thousand of refugees from Somalia, Sudan and Congo. About 22% of African immigrants are refugees, according to Andrew Lim, associate director of research at New American Economy.

At the same time, the diversity visa program — also known as the visa lottery — has opened the door to immigrants from more peaceful places. Of the sub-Saharan immigrants who have become legal permanent residents, 17% came through the program, compared with 5% of the total U.S. immigrant population, according to Batalova.

Applicants to the program must have completed the equivalent of a U.S. high school education or have at least two years of recent experience in any number of occupations, including accountant, computer support specialist, orthodontist and dancer.

As a result, the influx includes many immigrants from sub-Saharan Africa who are highly skilled professionals.

Batalova’s research found that of the 1.4 million who are 25 and older, 41% have a bachelor’s degree, compared with 30% of all immigrants and 32% of the U.S.-born population. Of the 19,000 U.S. immigrants from Norway — a country Trump reportedly told lawmakers is a good source of immigrants — 38% have college educations.

The New American Economy study found that 1 in 3 of these undergraduate degrees were focused on science, technology, engineering and math — “training heavily in demand by today’s employers.”

That report also found that African immigrants were significantly more likely to have graduate degrees. A total of 16% had a master’s degree, medical degree, law degree or a doctorate, compared with 11% of the U.S.-born population, Lim said.

African immigrants were more than twice as likely than the U.S. population overall to work in healthcare, Lim said. There are more than 32,500 nursing, psychiatric or home health aides, more than 46,000 registered nurses and more than 15,700 doctors and surgeons.

“Overwhelmingly the evidence shows that [African immigrants] make a significant, positive economic contribution to the U.S. economy,” both at a national level and in districts where they are concentrated, Lim said. “They contribute more than $10.1 billion in federal taxes, $4.7 billion in state and local taxes, and most importantly, they have significant economic clout to the point of $40.3 billion in spending power.”

That $40.3 billion pays for housing, transportation, consumer goods and education for their children — “things that actually stimulate the economy around them,” Lim said.

The biggest beneficiary is Texas, where their spending power is $4.7 billion, followed by California, Maryland, New York and Georgia.

“It’s a population that leverages its human resources and contributes to the U.S. economy by revitalizing communities, starting businesses, but also by working in a variety of professional fields,” Batalova said.

Even those with less education who arrive as refugees often fill certain lower-skill niches in healthcare, such as home health aides, researchers said.

“In the communities they were resettled in, they have made significant contributions,” Lim said.

In many towns and cities in the Great Lakes area of the Midwest, for example, they have started new businesses, infused local labor forces with younger workers, and expanded local tax bases, Lim said.

A report last year by the National Academies of Sciences, Engineering, and Medicine found that immigrants in general had little to no negative effect on overall wages or employment levels for U.S.-born workers, and higher-skilled immigrants in fields such as technology and science had a positive influence on the U.S. labor force.

Still, supporters of stricter immigration policy back the Trump administration’s calls to end the visa lottery as well as programs that allow certain immigrants to sponsor family members to settle in the U.S. They believe that a merit system that selects immigrants based on individual skills should replace the current system.”

Trump’s racist remarks this week (which Perdue, Cotton, and Nielsen are rather disingenuously trying to claim never happened) and the GOP’s basic defense of the idea of drawing immigrants from White European countries rather than Haiti, Africa, or Central America has basically “blown the cover” off of so-called “merit based” immigration being pushed by some in the GOP. Trump was just articulating the hateful White Nationalist immigration agenda that he ran on and many (not all) in the GOP have now adopted under the code word “merit based.” That doesn’t bode well for bipartisan immigration reform of any type or, for that matter, for the future of a diverse “nation of immigrants.”

Ten years ago, a family arrived in the Bronx from Yaoundé, Cameroon, not speaking a word of English. This Christmas, they are celebrating a feat that would be impressive for any family: Three of the family’s five daughters have been accepted to Ivy League universities.

In a year in which our nativist president would have you believe that immigrants are, at best, a job-stealing drain and at worst, criminals, rapists and people with AIDS, these three remarkable sisters are worth paying attention to. Not just because they are inspiring — they are — but because they are far better ambassadors for this country and exponents of its ideals than the 45th president.

“We brought the girls to this country because there are better opportunities here,” says Flore Kengmeni, their mother, who works as a nurse. “I don’t know of another country where you can try hard, work hard and get somewhere. Where you are given the opportunity to fulfill your potential.”

“This country is built on immigrants,” Francois de Paul Silatchom, their father, a professor of economics at SUNY, starts to say, before his middle daughter, Ella, a sophomore at Yale, interjects: “Our experience as a family is what America is.”

That experience is marked by hard work, optimism, resilience and a persistent sense of gratitude even to have the opportunity.

All three girls admit it wasn’t easy. They recall sitting in class during their first year in America and not understanding what their teachers and classmates were saying. They remember being made fun of, but not really knowing why.

“Everyone spoke so fast and I guess we speak that fast now, too,” says Xaviera, the youngest of the three, who was accepted to Harvard earlier this month.

They turned to books for guidance. Their parents got the girls library cards and made reading mandatory — “Education is the most valuable asset,” the parents say repeatedly when we meet. The sisters were encouraged to read broadly, from “The Magic School Bus” to “Harry Potter,” and they practiced English as a family in their two-bedroom apartment in the Bronx’s Pelham Parkway neighborhood.

By the end of their first year at their local public schools, the girls had learned enough English to take the state exams, and were excelling in their classes. But their parents were alarmed that they were finishing their homework during the school day and coming home bored. They asked teachers to assign their daughters more homework. But even that wasn’t enough.

“Something was wrong,” Mr. de Paul Silatchom says. “I started looking for schools that would challenge them and keep them busy. At a school fair, we learned about Democracy Prep.”

At Democracy Prep, a public charter school in Harlem where I met them one recent afternoon, the day begins at 7:45 a.m. and ends at 5 p.m. Longer school days, many argue, allow teachers to spend more time on subjects other than math and English, and keep students out of trouble.

Through the school’s Korean language program, the sisters were exposed to a culture completely different from their own, which sparked an interest in global affairs for all of them. Civics is a core part of the school’s curriculum, which Xaviera says showed her that, “Regardless of how disadvantaged you are in society, you have an advantage if you understand how our system of government works.”

“I learned so much here,” Ella says of the school. “And between that and our parents, my work ethic — our work ethic — really developed. Our parents required us to do an extracurricular, so sports or choir or whatever and that was for after 5 o’clock. That was normal for us.”

When the oldest, Chris, now a junior at Dartmouth, got into the college in 2014, friends and family were elated, but her parents made it clear that the work wasn’t over.

“The night I got into Dartmouth, Mom asked me, ‘Have you done the dishes?’ Getting in was exciting and I knew she was proud, but it was just a regular day,” Chris says.

“They haven’t ‘arrived,’ as people like to say, just because they are into Ivy League schools,” Mr. de Paul Silatchom says. “It’s a good start and a platform of opportunity.”

When speaking, the sisters transition seamlessly between New York-accented English and French, their first language. The irony that they landed at a school called Democracy Prep after immigrating from one of the world’s least democratic countries is not lost on them.

It’s something they’ve spent a lot of time thinking about as President Trump has rolled out various cruel immigration policies, from his proposed travel ban to, in September, rescinding the Deferred Action for Childhood Arrivals, or DACA — an Obama-era program that protected the country’s approximately 800,000 undocumented youth raised in the country from being deported.

“It’s scary to see because this is not the country we know,” says Chris, who along with her sisters, became an American citizen in 2016. “America at its core is principled on immigrants. We came to this country to improve our futures and I feel as American as anyone born here.”

“These girls are more American than Cameroonian,” their mother says. “Can you imagine being undocumented? We were very lucky,” Xaviera adds.

Watching videos of immigration agents separating families in recent months has been particularly difficult for Ms. Kengmeni and Mr. de Paul Silatchom. “I can’t imagine what it’s been like for these children who go to school in the morning knowing they might come home at the end of the day to no parents,” Ms. Kengmeni says.

This year, Christmas break involves running around to pack for Chris’s semester abroad and attending three Christmas Masses, but the family is grateful to be all together, even if it’s for just a few days. They know they are the lucky ones.

Forty percent of Fortune 500 companies were founded or co-founded by immigrants or the children of immigrants. Watching Ella, Chris and Xaviera, I’d bet good money that they will join those ranks of these world-class leaders. But the question I find myself asking as I leave their school: Who are the young women the Trump administration is currently keeping out?

CIVIL RIGHTS: Sessions Discovers America’s REAL Civil Rights Crisis — Insufficient White Privilege — Every White Kid Should Have Have Preferred Admission (How Else Do You Think Trump & Some Of His Cronies Got Into Good Schools?) — Gonzo Wants To Use Taxpayer $$$ To Turn Civil Rights Laws Against Blacks & Other Minorities!

Charlie Savage reports for the NY Times:

“WASHINGTON — The Trump administration is preparing to redirect resources of the Justice Department’s civil rights division toward investigating and suing universities over affirmative action admissions policies deemed to discriminate against white applicants, according to a document obtained by The New York Times.

The document, an internal announcement to the civil rights division, seeks current lawyers interested in working for a new project on “investigations and possible litigation related to intentional race-based discrimination in college and university admissions.”

The announcement suggests that the project will be run out of the division’s front office, where the Trump administration’s political appointees work, rather than its Educational Opportunities Section, which is run by career civil servants and normally handles work involving schools and universities.

The document does not explicitly identify whom the Justice Department considers at risk of discrimination because of affirmative action admissions policies. But the phrasing it uses, “intentional race-based discrimination,” cuts to the heart of programs designed to bring more minority students to university campuses.

Supporters and critics of the project said it was clearly targeting admissions programs that can give members of generally disadvantaged groups, like black and Latino students, an edge over other applicants with comparable or higher test scores.

The project is another sign that the civil rights division is taking on a conservative tilt under President Trump and Attorney General Jeff Sessions. It follows other changes in Justice Department policy on voting rights, gay rights and police reforms.

The pending start of the affirmative action project — division lawyers who want to work on it must submit their résumés by Aug. 9, the announcement said — joins a series of changes involving civil rights law since Mr. Trump’s inauguration.

In a lawsuit challenging Texas’ strict voter identification law, the Justice Department switched its position, dropping the claim that the law was intentionally discriminatory and later declaring that the law had been fixed. Mr. Sessions has also made clear he is not interested in using consent decrees to impose reforms on troubled police departments and has initiated a sweeping review of existing agreements.

Last week, the Justice Department, without being asked, filed a brief in a private employment discrimination lawsuit. It urged an appeals court not to interpret the ban on sex-based discrimination in the Civil Rights Act of 1964 as covering sexual orientation. The Obama administration had shied from taking a stand on that question.

Vanita Gupta, who ran the civil rights division in the Obama administration’s second term and is now president of the liberal Leadership Conference on Civil and Human Rights, noted that the briefs in the Texas voter identification and gay-rights cases were signed only by Trump administration political appointees, not career officials, just as the affirmative action project will apparently be run directly by the division’s front office.

“The fact that the position is in the political front office, and not in the career section that enforces antidiscrimination laws for education, suggests that this person will be carrying out an agenda aimed at undermining diversity in higher education without needing to say it,” Ms. Gupta said.

The civil rights division has been a recurring culture-war battleground as it passed between Democratic and Republican administrations.”

“Philosophy majors spend their college years pondering deep questions, such as: What is the meaning of life? Do we have free will? And what job am I going to get with this degree after graduation?

It turns out the last question isn’t hard to answer: Just about anything.

The idea that philosophy majors aren’t prepared for professional careers “is a little bit of a myth, to be honest,” said Thomas Holden, chair of the philosophy department at the University of California at Santa Barbara. “Philosophy is not about sages sitting on mountaintops speculating about the cosmos.”

Graduates in philosophy inhabit Wall Street corner offices, roam the oak-paneled halls of the Supreme Court and reign over boardrooms in Silicon Valley.

Interest in the major has risen steadily in the past three decades. Although totals have dipped slightly in recent years, federal education data shows the number of students who received bachelor’s degrees in philosophy has doubled since 1987, peaking at 7,926 graduates in 2013.”

Gee whiz! Who would ever have thought that teaching sound reasoning, critical analysis, effective argument, skillful defense of ideas, and creative problem solving skills could be useful in the “real” world? Certainly not the many politicos and supposed educational and business wonks who trash the liberal arts and glorify “trade school” education for everyone.

The world is a rapidly changing place.  And, folks who learn how to think, solve problems, and maintain a big picture perspective usually have the flexibility to “reinvent” themselves as necessary, even as their technical knowledge and skills become outdated or obsolete. And, intellectual curiosity and engagement are things that help outside the workplace or when things at work get rough. Critical thinking and creative problem solving are just as important for good mechanics, carpenters, plumbers, and brick masons as they are for chief execs, scientists, doctors, and lawyers.

Yesterday, I dropped by to see my good friend and colleague (and contributor to immigrationcourtside.com, http://immigrationcourtside.com/2017/06/19/the-hill-professor-andy-schoenholtz-of-georgetown-law-on-why-americans-should-be-grateful-to-the-9th-circuit-for-upholding-the-rule-of-law-against-executive-overreach/)  at Georgetown Law, Professor Andy Schoenholtz. I caught him “red-handed” perusing a tome of Immanuel Kant. He tried to cover up by claiming that he was just “cleaning out his bookcase.” But, of course, we know the truth (to the extent, of course, that absolute truth can ever be “known’).

No wonder Schoenholtz has accomplished so much in the real world as well as the academic world!

DC Superintendent Of Education Understands Students’ Immigration Fears — She Was Undocumented Herself!

D.C. Superintendent Hanseul Kang writes in the Washington Post:

“The mother was serious as she approached the principal of her daughter’s D.C. school. Would the principal consider becoming her child’s legal guardian in the event she was deported, so her daughter, a U.S. citizen, could stay in the country?

It was a surreal question but one rooted in real fear.

The political rhetoric about immigration, along with high-profile enforcement actions by Immigration and Customs Enforcement, has instilled palpable anxiety in immigrant families across the country, elevating a background level of uncertainty to an urgent concern. In the days after an ICE raid in Las Cruces, N.M., in February, more than 2,000 students were kept home from school. A Los Angeles community is reeling after ICE agents arrested a father moments after he dropped off his 12-year-old daughter at school.

Confusion is exacerbating fear, especially in young children, who may not fully understand the concepts of countries, borders and citizenship. During a class discussion at that same D.C. school, a student worried aloud that he’d be forced to move back to where he came from. When asked where he was from, he said Florida.

We haven’t seen any spikes in absences in the District, where Mayor Muriel Bowser has affirmed her commitment to being a sanctuary city and protecting the rights of immigrant residents. But ICE arrested 82 people in the region in a five-day sweep last month. Our schools have hosted “know your rights” workshops and fielded questions from panicked parents. At one meeting I attended, teachers pledged to parents that they would be arrested themselves before allowing ICE officials into the building. Still, it’s hard for families to know whom to trust.

I have some sense of what that’s like.

I was born in South Korea and came to the United States when I was 7 months old, on Christmas Eve, 1982. When I was 16 — excited to get a driver’s license and apply to college — I learned that I was undocumented.

In one afternoon, my world turned upside down. With all the trappings of a high school overachiever, I had assumed I could attend pretty much any college or university. But without access to federal financial aid, I might not be able to go at all. I couldn’t work, couldn’t drive, couldn’t travel outside the country. Even worse was the terrifying possibility that my family might be discovered and deported.

That is my concern about the impact of this latest shift in rhetoric and policy on immigrants: that as a country we will convey, especially to our students, that we question their value and their abilities. Not only is that message dehumanizing, but it discourages the talent and leadership we need to continue to thrive as a nation. Even as many have spoken out in support of preserving Deferred Action for Childhood Arrivals, I worry that in advocating for a small exception to U.S. immigration policy — albeit for young people in a uniquely vulnerable position, those who came to the United States without legal documentation, or who fell out of legal status, as children — we miss the broader value of immigrants to our country.

Educators can be an important source of support for students and their families. They were for me. But it should not fall on an individual principal or teacher to protect a child or a family from immigration enforcement, and no parent should have to ask them to. We have to do better for our students and for our nation.”

Superintendent Kang is a wonderful example of why Jeff Sessions and his white nationalist cohorts are wrong in failing to value the contributions of all types of migrants to the prosperity and success of the US. What kind of nation, with what kind of national values, intentionally creates a climate of fear among its youth who are the hope for the future?

WashPost EDUCATION: Alexandria, VA School PTA Helps Families Deal With ICE Fears — Alexandrians Stand With Their Immigrant Community Neighbors!

“In a school cafeteria adorned with whimsical children’s artwork, the men and women hunched over thick packets of paper one recent night, fiddling with pen caps and rubbing their foreheads as they confronted a challenge: preparing for what happens if immigration agents show up at the door.

Some at this clinic in Northern Virginia were undocumented, and others had relatives in that situation. Some had legal status but were not permanent residents, and they wondered what shifts in federal immigration policy would mean for them and their relatives.

Juan Torres, a carpenter from Honduras and father of four, has temporary protected status, but he has family members who are undocumented.

“Of course, I was very worried, because the majority of my family doesn’t have documents, and at any moment they could be arrested or detained,” Torres said.

He was one of about two dozen people who came to William Ramsay Elementary School in Alexandria to learn about their rights while President Trump moves to tighten immigration enforcement and speed up deportations.

Recent arrests in Alexandria and elsewhere have heightened stress. A U.S. Immigration and Customs Enforcement “sensitive location” policy restricts enforcement actions at schools and churches. But agents last month arrested homeless men who had just left a church warming shelter in nearby Fairfax County and a father in Los Angeles who had just dropped his daughter off at school.

With anxiety rising in immigrant communities, educators and parents are taking steps to allay fears. The PTA at Ramsay Elementary sponsored the March 22 clinic, supplying pizza and providing volunteers to care for children of those who came to hear from immigration lawyers and other experts.

About a quarter of Alexandria’s residents in 2010 were foreign-born, census data shows. Hundreds of unaccompanied minors, many of whom fled violence in Central America, have entered the United States in recent years without parents and landed in the city’s schools. Students in Alexandria hail from more than 130 countries. Hallways at Ramsay Elementary display dozens of flags to show international spirit.”

Try as they might, The Trump Administration is not going to be able to dislodge migrants from communities throughout the US. They will, however, succeed in generating massive resistance to their unrealistic, unneeded, and xenophobic policies. Sooner or later, either Congress must pass needed reforms giving some status and protection to migrants, or the resistance will eventually tie the already dysfunctional system into knots.

Yemeni Students In Limbo

They left their families in Yemen nearly three years ago through an exchange program that aimed to introduce Muslim high school students from overseas to America. But when civil war broke out at home, they couldn’t return, and what was supposed to be a 10-month visit turned into an indefinite stay.

Now the State Department — which sponsored the program and has supported these two dozen students since they arrived in 2014 — has notified them that they’ll be on their own in a few months.

For these Yemeni students, most of them thousands of miles away from their nearest relatives, that means no more housing or living stipends, and no more community-college tuition aid. Perhaps most important, it also means no more student visas. That will leave many of them facing the prospect of losing their legal status as visitors at a time when President Trump has pledged heightened immigration enforcement.

“I don’t only have to look for a place to stay and a way to pay for myself and a way to pay for my education, but now I also have to worry about racism and legal status,” said Taima Aliriani, 17, who graduated from high school in Indiana and is now at Northern Virginia Community College. “I applied for asylum, but right now I feel like I’m probably not going to get it.”

Aliriani is one of six Yemeni exchange students who were trapped here by their country’s civil war and are now at NOVA. Six others are at community colleges in Wisconsin, and a dozen are studying in Washington state.

Last month, a week after he took office, Trump signed an executive order that barred refugees and people from seven Muslim-majority countries from entering the United States. Yemen was one of them.

The U.S. Court of Appeals for the 9th Circuit has temporarily blocked enforcement of the order, but the new administration’s push to bar citizens of those nations has terrified many Muslims, including the Yemeni exchange students who wonder what is next for them.”
