As the Tru. mp administration continues to strip away due process in immigration courts, the recent creation of two “Immigration Adjudication Centers” is cause for concern. The two new facilities are called “Centers,” not “courts,” despite being places where judges decide whether to issue orders of deportation.

The Centers came out of a “Caseload Reduction Plan” devised by the Executive Office for Immigration Review (EOIR) as one of several mechanisms designed to reduce the number of cases pending before the immigration courts. This initiative first surfaced in December 2017 ostensibly as one of a series of ways to address the record-high backlog within the immigration court system. In fact, EOIR’s caseload has almost tripled since 2011, from fewer than 300,000 pending cases to 810,000 as of November 2018. This is likely to worsen given the current government shutdown.

A total of fifteen Immigration Judges currently sit in the two Centers—four in Falls Church, Virginia, and 11 in Fort Worth, Texas.

It is unclear whether the Centers are open to the public, despite laws stating such hearings must be. All the cases heard by immigration judges in the Centers will be conducted exclusively by video-teleconference (VTC), with immigrants, their lawyers, and prosecutors in different locations.

According to one source, it’s likely that “thousands of immigration cases will be heard with respondents never seeing a judge face-to-face.”

The utter lack of transparency around these Centers is alarming, given the documented concerns with the use of video teleconferencing and the current administration’s commitment to speed up immigration court hearings, even at the risk of diminished due process.

Speeding up cases could benefit detained individuals who often languish for months or even years behind bars before their release or deportation. However, the impact of these Centers overall could be much more ominous.

The Centers raise serious questions about whether detained immigrants will be disadvantaged by the arrangement. These questions include:

  • How will an individual who is unrepresented and detained in a facility three time zones away from the judge submit critical evidence to the court during a hearing?
  • How can an immigration judge adequately observe an asylum seeker’s demeanor for credibility without being in the same room?
  • Will the immigration judges be required to postpone hearings if there are issues with the telephonic interpreters, and could this lead to prolonged detention?

Further, only 14 percent of detained immigrants have attorneys and many may not have the ability to adequately prepare for their cases on an expedited timeframe. A very real outcome of speeding up cases in this manner is that many immigrants are deported even though they may have valid claims to stay in the United States.

Until the government is more transparent with these Centers, there is simply no way of knowing how many detained individuals—including children—have been deported without the opportunity to obtain counsel, and without appropriate safeguards preventing their removal to imminent harm.

The degrading “de-judicilization” of the Immigration Courts under the Trump DOJ politicos and their EOIR subordinates continues. I suppose next Immigration Judges will be retitled as “Special Inquiry Officers” or “Removal Adjudicators.”

Hopefully, EOIR will get some much needed oversight and accountability from the House.

IMMIGRATION IMPACT: Katie Shepard Explains How New USCIS Lesson Plans Are Likely To Harm Asylum Seekers!

“Effective February 27, 2017, new changes to the asylum screening process could lead to an increased number of deportations of asylum-seekers who fear persecution upon return to their home country.

On February 13, 2017, U.S. Citizenship and Immigration Services (USCIS) revised its Asylum Division Officer Training Course (ADOTC) lesson plans on how to assess an asylum seeker’s credible and reasonable fear of persecution or torture. The lesson plans were revised to be consistent with the January 25, 2017 Executive Order on border security and immigration enforcement and provide guidelines to the asylum officers when conducting credible fear interviews (for those at the border or port of entry who were never previously deported) and reasonable fear interviews (for those who were previously order deported but who later seek asylum).

The changes to the lesson plans are significant and may cause the denial rate to skyrocket, in which case thousands of asylum seekers would be wrongfully denied a meaningful day in court . Not only does the new guidance provide asylum officers with greater discretion to deny an applicant for reasons which may be out of the applicant’s control, but the applicant will essentially be forced to undergo a full asylum hearing with none of the safeguards in place to ensure a meaningful opportunity to present a claim for relief.”

If this carries over into Immigration Court where unsuccessful applicants can seek “expedited review,” it would mean that “credible fear reviews” could become more time consuming.

I was usually able to complete them in a few minutes using the Asylum Officer’s notes and asking a few questions. I found that the overwhelming number of those denied had “credible fear,” and probably at least half of those cases eventually resulted in relief. However, over the last year of my career I was primarily on the non-detained docket, so I only did “credible fears” when I was on detail to a detention center or the system was backed up.

As an Immigration Judge, I did not use the USCIS lesson plans. But, I did rely on the Asylum Officer’s notes for a basic understanding of the claim. I then usually asked a few questions to verify that the notes accurately reflected the claim and that nothing relevant had been omitted.

A Christmas Wish — Protect Children Seeking Refuge — Let Them Out of Jail — Get Them Lawyers — Treat Them As If They Were Ours — Because They Are

In this article which I found on Immigration Impact, Katie Shepard says:

“The 19 children who will likely be spending the holidays in detention range in age from three to fifteen-years-old. In fact, just last week, the youngest child being held in the Berks detention facility turned three. This little boy fled Honduras with his mother after being targeted by the gangs and threatened with kidnapping and violence. He has spent more than half his life in detention.

Imagine going through such a harrowing journey to then have those you’ve asked to protect you, fail you. I don’t believe this nation can or should allow the most vulnerable among us to be held for prolonged periods, robbed of their access to a fair and just process, and left without protection. We can and must do better.

My wish this holiday season is that we find a way to do right by these families. My wish is that they, like me and many of you, will be able to live safe and happy lives with the people they love.”

I had similar thoughts.  During the Christmas Eve service at our church, we offered the following prayer:  “Tonight we give thanks for every child among us.  Each new birth — regardless of circumstances — reminds us of the preciousness of life, the potential of tomorrow, the promise of God.”

We say these words, but our country is falling short in its humanitarian and human obligation to protect vulnerable children.  We treat them as statistics, a “border surge,” an “enforcement problem,” a plague that should be deterred and discouraged.  In plain terms, we seek to dehumanize the most vulnerable and needy humans among us.  We detain them, expedite their cases, and tell Federal Courts that they can represent themselves in complicated, life determining, legal proceedings that baffle many smart attorneys, judges, and scholars.  Where is the mercy, compassion, kindness, humility, and championship of the downtrodden shown by Christ?

As I have previously said in my own op-ed:

“Children are the future of our world. History deals harshly with societies that mistreat and fail to protect children and other vulnerable individuals. Sadly, our great country is betraying its values in its rush to ‘stem the tide.’ It is time to demand an immigrant justice system that lives up to its vision of ‘guaranteeing due process and fairness for all.’ Anything less is a continuing disgrace that will haunt us forever.”
