“President Donald Trump’s administration announced on Wednesday that it will no longer bar schools from discriminating against transgender students, rescinding a policy put in place by the previous administration.

“The prior guidance documents did not contain sufficient legal analysis or explain how the interpretation was consistent with the language of Title IX. The Department of Education and the Department of Justice therefore have withdrawn the guidance,” Attorney General Jeff Sessions said in a statement. “Congress, state legislatures, and local governments are in a position to adopt appropriate policies or laws addressing this issue. The Department of Justice remains committed to the proper interpretation and enforcement of Title IX and to its protections for all students, including LGBTQ students, from discrimination, bullying, and harassment.”

In May, under President Barack Obama, the departments of Education and Justice issued guidance mandating that any school that receives federal money must treat a student’s gender identity as his or her sex. Schools, for example, would therefore have to allow transgender individuals to use the restroom that corresponds to their gender identity, rather than the sex assigned to them at birth.

The federal government said at the time that transgender students were covered under Title IX, the statute that prohibits discrimination on the basis of sex. This interpretation had been on hold, however, after more than a dozen states sued the Obama administration and a judge issued an injunction in August.

Education Secretary Betsy DeVos was reportedly against rescinding the order and initially resisted signing off on it, but Sessions pushed her to do so because both departments had to agree in order to move forward.

In a statement Wednesday, DeVos said she considered protecting all students, including lesbian, gay, bisexual, transgender and queer students, “not only a key priority for the Department, but for every school in America.”

“This is an issue best solved at the state and local level. Schools, communities, and families can find ― and in many cases have found ― solutions that protect all students,” she added.

White House press secretary Sean Spicer argued during his press briefing earlier Wednesday that Title IX does not apply to transgender issues because there was no discussion of gender identity when the statute was passed in 1972. Judges and justices, however, often interpret laws and the Constitution to apply to new issues that arise.”

Sure didn’t take Jeff Sessions long to prove his critics correct — that he is totally unqualified to hold the job of the nation ‘s chief lawyer and protector of “equal justice for all.” And, as someone from Alabama, with its sordid history of misuse of the rule of law against African Americans, Sessions knows exactly what the code term “States’ Rights” means. At least he made Betsy DeVos look almost, but not quite, good by comparison.

President Trump Might find That Mexico Has More Leverage Than He Anticipated — Beating Up On Your Friends & Neighbors To Score Political Points At Home Is Likely To Backfire!

“PRESIDENT TRUMP has a good idea of the power the United States wields over Mexico, and the pain it may inflict — the construction of a wall Mexico fiercely opposes; taxes that could be slapped on Mexican imports, wreaking havoc on its economy; deportations of undocumented Mexican immigrants living in the United States, who would be thrust back into a country that would struggle to absorb them. Mr. Trump might have a fuzzier idea of the pain Mexico, its people furious and its pride wounded by his taunts and contempt, might inflict on the United States.

Start with those deportations. At least half of America’s 11 million unauthorized immigrants are Mexican, but many have no documents proving their nationality. For the Trump administration to deport them, it would need cooperation from Mexico, which cannot be forced to accept deportees without certifying that they are Mexicans. As former Mexican foreign minister Jorge G. Castañeda has already warned, Mr. Trump can round up hundreds of thousands or millions of migrants, but without Mexico’s cooperation, they could clog U.S. detention centers and immigration courts — at enormous cost and, conceivably, for years.

Consider, too, the effect on America’s southern border if Mexico were to loosen immigration controls on its own southern border — the one over which Central American refugees are already streaming north in near-record numbers. Even with what U.S. officials say are aggressive interdiction efforts by Mexican authorities, the Border Patrol detained more than 220,000 mainly Guatemalans, Hondurans and Salvadorans crossing from Mexico into the United States in the fiscal year ending last fall, exceeding the number of Mexicans apprehended, which has fallen to a 45-year low. If you think the Border Patrol is swamped now, as Homeland Security Secretary John F. Kelly insists, imagine if Mexico, which last year sent home more than 140,000 Central Americans, simply stepped aside.”

NYT Editorial Blasts Trump Administration’s Anti-Immigrant Fear Mongering!

In an Editorial that first appeared on Feb. 18, 2017, the NY Times wrote:

“Another DACA recipient, Daniela Vargas of Jackson, Miss., barricades herself in her home after agents detain her father and brother. A mother of four, Jeanette Vizguerra, seeks refuge, alone, in a Denver church basement. A group of Latino men leaving a church-run homeless shelter near Alexandria, Va., are surrounded by a dozen immigration agents who question them, scan their fingerprints and arrest at least two of them. [Emphasis Added.]

President Trump’s defenders say the arrest numbers from Immigration and Customs Enforcement are comparable to those under President Barack Obama, an energetic deporter-in-chief. That may be true, for the moment, but the context is vastly different. Mr. Trump’s campaign pledges, his flurry of immigration-related executive orders, including his ban on certain travelers from Muslim countries, have a common thread. They reflect his abandonment of discretion, of common sense, his rejection of sound law-enforcement priorities that stress public safety and respect for the Constitution.

They prioritize fear instead.

ICE and the Border Patrol under Mr. Obama were ordered to focus on arresting serious criminals and national-security risks. Mr. Trump has removed those restraints in the name of bolstering his “deportation force.” He wants to triple the number of ICE agents. He wants to revive federal agreements to deputize state and local police officers as immigration officers. He wants to increase the number of detention beds and spur the boom in private prisons.

This vision is the one Donald Trump began outlining at the start of his campaign, when he slandered an entire country, Mexico, as an exporter of rapists and drug criminals, and an entire faith, Islam, as a global nest of murderers. This is the currency of the Trump aides Stephen Bannon and Stephen Miller, who have brought the world of the alt-right, with its white nationalist strain, into the White House.

Where could the demonizing and dehumanizing of the foreign born lead but to a whiter America? You have heard the lies from Mr. Trump: that immigrants pose a threat, when they are a boon. That murders are up, when they are down. That refugees flow unimpeded into the country, when they are the most meticulously vetted people to cross our borders. That immigrants and refugees are terrorists, when they are the ones being terrorized.

For those who would resist the administration, there is much to do, and not a lot of time. Congress is not a check. Democrats there are outnumbered, speaking out but waging symbolic resistance for now. Republicans are mostly split between avoiding the subject and cheering on Mr. Trump.”

On a personal note, the “church shelter incident” involved the Rising Hope Mission Church in the Alexandria area of Fairfax, Co., VA. This church is devoted to meeting the needs of the most vulnerable in our community and is a mission outreach project funded by local United Methodist Churches, including the Beverley Hills Community United Methodist Church to which my wife and I belong. Among other things, Rising Hope serves as a hypothermia shelter, and actions like this by ICE serve to discourage individuals from seeking potentially life-saving assistance.

“This plenary power narrative stifles our ability to think rationally about immigration law policy and to build consensus. The narrative should not be that of a zero-sum game. The choice is not between absolute, unchecked authority and no government power over immigration. There is middle ground. The plenary power doctrine has been weakened over the last 128 years, and many immigrants are subject to constitutional protection today. In terms of facts, immigration is not inherently a threat. Immigration has done wonderful things for our country and immigrants have contributed in a variety of important ways.

We need a new immigration narrative that more accurately reflects law and fact. This narrative acknowledges that there is space for both government interests and individual rights in immigration law. To make progress, we need to disrupt the mindset that does not allow immigration and security to comfortably occupy the same space. It is possible to be secure and to welcome immigrants while promoting individual rights. This new narrative promotes the idea that the sovereignty of the United States incorporates our exceptional dedication to individual rights. It recognizes that allowing for powers not supervised by the Constitution is its own threat to our sovereignty.

The new narrative recognizes that both individual rights and government interests are important in immigration law. The government has an important role to play in fashioning immigration law policy for the country. Security is an important consideration. But so is protecting individual rights. Preserving the United States includes uplifting its most fundamental values, including the principle that absolute government power is not desirable. Allowing for individual rights to be considered in immigration law does not weaken sovereignty; it strengthens our sovereignty by helping to define who we are. It also sends even unsuccessful immigrants home with an experience to relay that reflects American values.”

The Administration neither satisfactorily justified nor specifically explained the need for the “Travel Ban Executive Order.” The Obama Administration thoroughly vetted refugees. I have no doubt that they also carefully vetted visa applicants from all countries in the Middle East, North Africa, or any country in the world where terrorist movements are known to flourish. That’s probably why there were no known deaths from terrorist attacks by refugees in the U.S. for the past eight years.

There is no actual emergency to explain the type of “extraordinary measures” the Administration wants to put in place. That’s why most Federal Courts have been skeptical of the Administration’s motives.

The controversial Executive Order is also unnecessary. To date, no court has questioned the President’s authority to reduce FY 2017 refugee admissions to 50,000 (although arguably changes in the number of refugee admissions, either increases or decreases, should have been accompanied by statutory advance “consultation” with Congress, and it certainly would be possible to question the wisdom, necessity, and humanity of such a reduction). According to some sources, those reduced refugee admission numbers will soon be exhausted, perhaps as early as March.

Consequently, unless the President takes action to raise the number again, the refugee admission program will effectively be “suspended” until the beginning of the next fiscal year, Oct. 1, 2017, without any further action on the Administration’s part.

Additionally, the Administration has never explained exactly what type of additional “vetting” they would add to that already in place. There is certainly nothing stopping Secretary of State Tillerson from improving visa screening in any way that he deems necessary, provided that the “improvements” are not just a ruse for discrimination. Additional questioning of refugees both abroad and at the border hardly requires an Executive Order. As long as the inquiry legitimately aims at discovering possible grounds of inadmissibility, it’s well within the existing authority of the Secretary of State and the Secretary of Homeland Security.

The use of questionable terms like “extreme vetting” and singling out particular Muslim majority countries for a complete ban is unnecessarily inflammatory. It antagonizes the Muslim world (without making us any safer), while sending a highly inappropriate message about the Muslim religion to the American public, thereby encouraging hate, discrimination, and separation.

While the majority of Americans appear wise enough to emphatically reject the Administration’s false message, there is a significant minority who have adopted or been convinced by the Administration’s largely “fact free” attack on refugees and the Muslim religion.

We as a nation could well be in for some difficult times over the next four years. To persevere and prosper, the vast majority of Americans will need to pull together toward common goals. The Administration could help achieve that end by ditching the unnecessary and inappropriately divisive rhetoric about refugees, Muslims, and immigrants.

“WASHINGTON — Republican Sen. John McCain delivered a withering critique of President Donald Trump in a speech Friday that highlighted fractures within the GOP as the new administration struggles to overcome a chaotic start.

Speaking in Germany at the Munich Security Conference, McCain didn’t mention the president’s name, according to the prepared text, while he lamented a shift in the United States and Europe away from the “universal values” that forged the Western alliance seven decades ago. McCain is the chairman of the Armed Services Committee.

Trump has repeatedly questioned the value of NATO, calling the military pact obsolete, and sought instead to stoke a relationship with Russian President Vladimir Putin. However, Trump’s defense secretary, Jim Mattis, has accused Putin of wanting to break NATO.

McCain, who has openly quarreled with the president, said “more and more of our fellow citizens seem to be flirting with authoritarianism and romanticizing it as our moral equivalent.”

The senator lamented the “hardening resentment we see toward immigrants, and refugees, and minority groups, especially Muslims.” During the presidential campaign, Trump promised to stop Muslims from entering the U.S. and shortly after taking office issued an executive order banning travelers from seven predominantly Muslim nations.”

“The Trump administration’s attempts to translate the president’s hard-line campaign rhetoric on immigration into reality have run into two major roadblocks: the complexity of reshaping a sprawling immigration system and a president who has not been clear about how he wants to change it.

In his first four weeks in office, President Trump has sought to use his executive powers to punch through Washington’s legislative and bureaucratic hurdles and make quick progress on pledges to crack down on illegal immigrants and tighten border control.

But Trump has been vague about his goals and how to achieve them and his aides have struggled to interpret his orders.

The resulting turmoil has included a successful legal challenge halting his immigration travel ban, fears among congressional Republicans over the White House’s more extreme measures and widespread anxiety among immigrant communities across the country.

The latest flash point erupted Friday over reports that the Department of Homeland Security was considering mobilizing 100,000 National Guard troops to help round up millions of unauthorized immigrants in 11 states, including some such as Colorado and Oregon far from the southern border.

It’s not difficult for anyone who understands the complex field of immigration to see that when you surround yourself with tone-deaf advisors like Jeff Sessions, Steve Bannon, Stephen Miller, Kris Kobach, and Rep. Steve King your immigration policies are headed straight onto the rocks, where they likely will remain aground for the rest of the Administration.

So, you’re President Donald Trump. You want to make an impact in immigration, and also have everybody love what you’re doing to “make America great.”

Then, why not sit down with some Republicans who have thought carefully about the issue, like, for example: House Speaker Paul Ryan, Senator John McCain, Senator Lindsey Graham, Senator Jeff Flake, Congresswoman Illeana Ros-Lehtinen, Senator Marco Rubio, the Koch Brothers, former U.S. Solicitor General Ted Olson, and Ohio Governor John Kasich? Also, it would be a good idea to reach across the aisle and speak with folks like Senate Minority Leader Chuck Schumer, Senator Dick Durban, Senator Bernie Sanders, House Minority Leader Nancy Pelosi, and Representative Henry Cuellar who have worked thoughtfully on immigration issues. And, why not invite DHS Secretary John Kelly, Secretary of State Rex Tillerson, Defense Secretary James Mattis, Labor Secretary Alex Acosta (assuming confirmation), and, of course, Vice President Mike Pence to the table too?

Think about how refugees, legal immigrants, and those who are already here and in our workforce can be melded in the best way possible to tap America’s full potential, create meaningful opportunities for all Americans, increase productivity and innovation, and combat the looming problem of future labor shortages. Also, consider how a more realistic, expanded legal immigration system could be a critical tool for discouraging illegal migration, maintaining control of our borders, and insuring national security without over-investing in the (usually ineffective and always expensive) quasi-militarization of our borders.

As one of my colleagues used to tell me when I got going too fast, “Relax, it’s a marathon not a sprint.” There is still plenty of time for President Trump to get the immigration issue right for America. But, it’s not going to happen unless he expands his circle of advisers to include those with a more positive and realistic view of immigration’s essential role in making America great.

BREAKING: Judge Brinkema (EDVA) Issues Preliminary Injunction Against Parts Of Trump Travel Ban — Finds “National Security” A Pretext For Unconstitutional Religious Discrimination! (Updated With A Copy Of Judge Brinkema’s 22-Page Order, Courtesy Of Politico)

“The executive order, Judge Leonie M. Brinkema concluded, probably violates the First Amendment’s protections for freedom of religion.

Brinkema’s order applies only to Virginia residents and students, or employees of Virginia schools. A nationwide freeze has been in place for several days, having been issued in Washington state and upheld by a three-judge panel of the U.S. Court of Appeals for the 9th Circuit.

In her opinion, Brinkema wrote that the Commonwealth of Virginia “has produced unrebutted evidence” that the order “was not motivated by rational national security concerns” but “religious prejudice” toward Muslims. She cited Trump’s statements before taking office, as well as an interview in which former New York City mayor Rudolph W. Giuliani (R) said that the president wanted a “Muslim ban.”

“The ‘Muslim Ban’ was a centerpiece of the president’s campaign for months, and the press release calling for it was still available on his website as of the day this Memorandum Opinion is being entered,” Brinkema wrote.

The case against the order in Virginia is being litigated by the state’s attorney general, Mark R. Herring (D). It was originally brought by lawyers for the Legal Aid Justice Center who were representing two Yemeni brothers turned away after landing at Dulles International Airport. The brothers have since been allowed into the country.

“I saw this unlawful, unconstitutional and unAmerican ban for what it is, and I’m glad the court did too,” Herring said Monday night. He said the decision “lays out in stunning detail the extent to which the Court finds this order to likely violate the First Amendment of the U.S. Constitution.”

Simon Sandoval-Moshenberg, an attorney for the brothers, Tareq and Ammar Aziz, said the judge was “calling out the ban for what it really is, a Muslim ban.”

The decision is significant, he noted, because a preliminary injunction requires a higher burden of proof than the temporary restraining order issued in Washington.

Brinkema rejected that [the Government’s] argument. “Maximum power does not mean absolute power,” she wrote. “Every presidential action must still comply with the limits set by Congress’ delegation of power and the constraints of the Constitution, including the Bill of Rights.”

She also dismissed the idea that a halt on the ban would cause any harm. On the other hand, she said, the Commonwealth produced evidence that the ban is having a negative impact on students and faculty who can no longer leave the country for fear of losing their visas or who are no longer sure they can study in the state.

“Ironically, the only evidence in this record concerning national security indicates that the [order] may actually make the country less safe,” Brinkema wrote, a reference to a letter from a bipartisan group of national security professionals decrying the impact of the ban abroad.”

“Joe Scarborough is trying to use whatever influence he has over Donald Trump to change the president’s mind about Stephen Miller. It hasn’t worked so far.

The MSNBC host previously blamed Miller for mishandling the rollout of the travel ban and on Monday resumed his campaign against Trump’s senior policy adviser, who made a series of breathtakingly forceful statements on the Sunday political talk shows, including:

“Our opponents, the media and the whole world will soon see, as we begin to take further actions, that the powers of the president to protect our country are very substantial and will not be questioned.”
“Sean Spicer, as always, is a hundred percent correct.”
“It is a fact, and you will not deny it, that there are massive numbers of noncitizens in this country who are registered to vote.”

The video clips on this one (see link) are truly amazing. Miller is the “Perfect Storm” of arrogance, ignorance, and intolerance all wrapped into a package of smart-ass, off-putting demeanor, lack of gravitas, and robotic delivery. Hopefully, they never let this guy into a courtroom. Or, perhaps they should . . . .

Come to think of it, I’d love to see him go “toe to toe” with Judge Richard Posner of the Seventh Circuit. Nothing Judge P loves better than being told “who’s in charge.” And, as for the “I’m from the White House come to tell you about your authority, you robed boob” tone, let’s just say it wouldn’t be pretty. On the other hand, couldn’t happen to a more deserving guy.

“White House policy director Stephen Miller on Sunday expanded the goals of President Donald Trump’s controversial immigration executive order, saying it would “prevent crime before it happens” by deporting undocumented immigrants deemed to “pose a threat to public safety.”

The statement was reminiscent of the plot of “Minority Report,” a film set in a dystopian future where people are arrested before they actually commit crimes.

A series of immigration raids authorized by the Trump administration in recent days were purportedly intended to arrest and deport criminals. Instead, many of the people being arrested have no criminal records.”

“There’s a theory under which some people operate which holds that presidential advisers appear in the news media to provide insight into what the president is doing for the American people. Governance broadly, and the White House specifically, can be inscrutable to outsiders, but since our democracy depends on an informed populace, it has historically been important to shed as much light as possible on what’s happening. Politicians and their allies don’t always like to shed that light, but they’ve generally acquiesced to participating in the effort.

On ABC’s “This Week” on Sunday, President Trump’s adviser Stephen Miller wasn’t interested in shedding light on reality. If anything, he was running around turning lights off. Inadvertently, though, he did offer one bit of insight into what’s happening at the White House.

Three claims here. First, that there are millions of people who are registered in multiple states. Second, that dead people are still registered. Both of those things are true. (Among those registered to vote in two places, by the way, are Trump’s son-in-law, treasury nominee, daughter and press secretary.) But that’s not voter fraud. It’s a sloppy registration system — and indifference from people whose first instincts when relatives die is not to ensure that the registrar of voters is informed.

The third claim is that 14 percent of noncitizens are registered to vote, which is based on an academic analysis released several years ago. It has been subsequently shown to be problematic. Kobach is the secretary of state in Kansas, in charge of the state’s electoral process. He has held that position since 2011, the year the state passed new restrictions on voting in the name of preventing fraud.

Young people, newly registered voters and black people. Populations that tend to vote more heavily Democratic.

That’s almost certainly the point. Miller was trying to mislead people with his false arguments about voter fraud. But he ended up offering some insight after all.”

Getting It Right: How a Small Town In Virginia’s Shenandoah Valley Makes Migration Work — For Everyone In The Community!

Andrew D. Perrine writes in the Local Opinions section of today’s Washington Post:

“Who would guess that a city tucked in the Shenandoah Valley of western Virginia, with a population of 53,000 and a hard-working rural history, is a model of international coexistence?

Yet, only 55 percent of the students attending Harrisonburg City Public Schools were born in the United States. The second-largest segment of the population by country of origin is Iraqi. Then there are the Hondurans, Puerto Ricans, Salvadorans and Mexicans. The Congolese, Ethiopians, Jordanians, Ukrainians and Syrians are representd, too. As of January 2016, Harrisonburg City Public Schools are attended by students from 46 countries.

One might guess that so many people from so many places around the world never could get along in such a small town given the unnerving level of social discord represented in the media regarding immigration and the fear of terrorism. Yet they do. Crime is mostly petty. Only four police officers have died in the line of duty since the first in 1959. What on earth is happening in Harrisonburg?

Known since the 1930s as “The Friendly City,” Harrisonburg is an official Church World Service refugee resettlement community. It’s home to James Madison University and Eastern Mennonite University, which brings a lot of foreign nationals to town through its missionary work around the world. And the city lies in the path of Interstate 81. So, even though Harrisonburg is no bustling port city or cosmopolitan metropolis, its high level of diversity is not so hard to believe.

But what is so hard to believe is the level of concord among all the various walks of life. Listening to the current American national dialogue, or observing the rise of nationalist political candidates around the world, one would assume that mixing nationalities, religions and ethnic groups in such close quarters would produce enough emotional tinder to fuel a blaze of angry divisions and open fighting in the streets. Yet it does not.

In fact, less than a week after the White House issued an executive order banning refugees from seven majority-Muslim countries, 30 volunteers from churches of various faiths in Harrisonburg and the surrounding Rockingham County collected food donated to the Islamic Center of the Shenandoah Valley. According to the Daily News-Record, the food was set out after the Islamic Center’s 1 p.m. service, and 300 attendees grabbed lunch to go or sat down to a meal. One attendee reportedly said, “This support shows us the community is standing with us. This makes us feel like we are all Americans.”

Maybe everyone gets along well in Harrisonburg because the town is small and the community actively interacts. It is a lot easier to think badly of some group — or even hate them — if its members are an abstraction to you. If you don’t know or see the people you’re told to fear, it’s much easier to fear them. In Harrisonburg, we plainly see that our Mexican and Muslim neighbors are not as they are portrayed by some in elected office or in the media.

Maybe the answer is not a wall or a moratorium on immigration. Maybe the answer is exactly the opposite. Just ask the good people in the Friendly City of Harrisonburg.”

Maybe guys like Stephen Miller, Jeff Sessions, and even President Trump need to spend a little less time in “the swamp” of Washington, D.C., and a little more time breathing the fresh air out in the Valley.

WashPost: Marginalizing Muslim Youth Gives Terrorists A Potent Recruiting Tool

“In the face of terrorist attacks, freedom of religion is being tested in Germany — with even the progressive Chancellor Angela Merkel now calling for an election year ban on the full Muslim covering known as the burqa. A German soccer club recently canceled the contract of one of its Muslim players — Anis Ben-Hatira — after a media uproar over his involvement in a legal Islamic charity that promotes a conservative brand of the faith.

The heightened sense of insulation and persecution among young Muslims, experts said, is only fostering more radicalization.

“Religious extremist propaganda, Salafist propaganda, can only work if it is addressed to an audience that is already marginalized and feeling uncomfortable in society,” said Goetz Nordbruch, co-director of Horizon, a German group offering counseling and workshops on Islamophobia in German schools.”

NYT: Japan Finds Out (The Hard Way) How Limiting Immigration Limits Future Economic Growth

“Japan, on the other hand, long ago achieved what Mr. Trump has promised: It has very little illegal immigration and is officially closed to people seeking blue-collar work.

Now, though, its tough stance on immigration — legal and illegal — is causing problems. Many Japanese industries are suffering from severe labor shortages, which has helped put a brake on economic growth.

That is prompting Japan to question some fundamental assumptions about its labor needs. The debate is politically delicate, but changing realities on the ground — in Japan’s factories and fields — are forcing politicians to catch up. Japan’s total foreign-born labor force topped one million for the first time last year, according to the government, lifted in part by people entering the country on visas reserved for technical trainees.

That growth has also led to an increase in cases of worker abuse and fraud, labor activists say.”

Yup. When my parents went into a very “high end” retirement home in this area, I noticed that virtually all of the dedicated staff, from doctors and nurses down to the janitors, were recent immigrants. I never ran into a high school kid, when our kids were at that stage or later, who said he or she aspired to be an orderly, a janitor, or even a Certified Nursing Assistant. But, I don’t think most of our kids and grandkids want to take care of us to that degree, either. So, those of us who plan to live to a ripe old age had better hope that Trump’s upcoming “war on immigrant workers (legal and undocumented)” is less than fully successful. Or else, we’ll be emptying our own bedpans.

“Duh” Articles Of The Week: Rural Trump Supporters Discover They Are Likely To Feel The Brunt Of His Trade & Immigration Policies!

“Global competition has forced U.S. farmers to become efficient and productive, but the reality is that other countries have arable land and willing labor. They can replace U.S. agriculture in a tariff war. Australia has a trade deal with Japan, and exports Down Under will have an advantage over American beef and wheat. U.S. beef imports to Japan will face high tariffs that the Trans-Pacific deal would have phased out or reduced. Mexico has bilateral trade deals with Chile, the European Union and others, and may buy more from Canada.

The bigger political picture for the Trump White House is that U.S. agriculture is already struggling amid a strong dollar and declining export volumes. Net farm income dropped 15% to about $68 billion last year, the lowest since 2009, according to the Agriculture Department. Unless Mr. Trump wants to compensate with more taxpayer subsidies, the best way to boost incomes is to let farmers sell in more markets, not fewer.

One reason the U.S. benefits from free-trade deals is that America has among the lowest import barriers on earth (5% average for agriculture), so new agreements tear down levies abroad and open new markets. President Trump should consider that reality before escalating on trade—and betraying the Farm Belt voters who are relying on him to bring growth and opportunity.”

“They are hopeful Mr. Trump will not make good on most of his threats. “Quien más habla, menos hace,” they tell each other — the more you talk, the less you do. There are too many of them, they reason, to throw them all out.

“We’re just waiting and praying, hoping that somebody can convince them that we are not hurting anyone by being here,” said Isabel Rios, 49, who has been picking grapes for the last two decades. Like most women in the fields, she covers her face with a bandanna to protect against the blaring sun, dust and pesticides. Her two children, 9 and 18, are American-born citizens and she worries what will happen to them if she is sent back to Mexico. “Who will benefit if we are not here?”

Mr. Marchini, the radicchio farmer, said he felt similarly after seeing generations of workers on his family farm send their children to college and join the middle class. Mr. Marchini’s family has farmed in the valley for four generations and he grew up working side by side with Mexican immigrants.

He said that no feasible increase in wages or change in conditions would be enough to draw native-born Americans back into the fields.

It was the other conservatives, Mr. Marchini said, who were out of touch about how to deal with foreign workers. “If you find a way to get in here,” he said, “there’s a need for what you do.”

I think it will be hard for the Administration to prevail at this stage. I’d be surprised if either the full (“en banc”) 9th Circuit or the Supreme Court want to get involved at the TRO stage.

President Trump Tweets “See You In Court.” (Hasn’t that line been used before?) But, as indicated above, I’m not sure that the Supreme Court (particularly with only 8 Justices) will want to intervene at this point. The Supremes did take the Obama Immigration Executive Order case at a preliminary stage; but they were unable to resolve it on the merits, affirming the lower court’s injunction by an evenly divided Court. Not clear why the Court would be in a better position to resolve this one. But, we’ll find out shortly.
