‘Remain in Mexico’ policy will continue for several weeks, Mayorkas says

Politico: “We need to wait until the Supreme Court’s decision is actually communicated to the lower court, to the federal District Court and the Northern District of Texas, and, once that occurs, the District Court should lift its injunction that is preventing us from ending the program,” Mayorkas told ABC’s Martha Raddatz.

 

4 people have been charged in the Texas semitruck smuggling operation that left 53 migrants dead

CNN: Four people have been arrested and charged after 53 migrants died in what one Homeland Security Investigations agent called the deadliest human smuggling incident in US history. The migrants were found in sweltering conditions inside a semitruck in San Antonio on Monday after an employee at a nearby building heard cries for help. Ending a Decade-Long Decline, More Mexicans Are Migrating to U.S.

NYT: After declining for more than a decade, the number of Mexicans seeking to migrate to the United States is surging. Since 2020, a combination of growing violence across Mexico and a worsening economy has led to the first jump in Mexican migration in a decade.

 

Growing Numbers of Children Try To Enter the U.S.

TRAC: New data obtained by TRAC from U.S. Border Patrol (BP) reveals a detailed portrait of the enormous growth in children encountered by BP officers at the US-Mexico border over the past fifteen years. Since FY 2008 there has been a seventeen-fold rise in the numbers of BP apprehensions who are unaccompanied children. White House Reviewing Immigration Fee Changes

Law360: The White House is reviewing upcoming changes to the fees U.S. Citizenship and Immigration Services charges immigrants seeking citizenship and other immigration benefits, with an eye to releasing the proposal in September for public feedback.

Politico: The nomination of Ed Gonzalez, the sheriff of Harris County, Texas, has long been doomed, as multiple Democrats remained undecided.

 

Immigration judge hired during Trump era accuses Biden admin of ousting conservative appointees

Fox: Matthew O’Brien, who was appointed in 2020 as an immigration judge, is a former research director at the Federation for American Immigration Reform (FAIR), a group that calls for lower levels of immigration overall and stricter border policies.

 

Ellis Island immigrants weren’t special — today’s newcomers succeed just as quickly

WaPo: Armed with the genealogists’ data, Boustan and Abramitzky have methodically dismantled the myths that have grown up around past generations and revealed some surprising truths. On the whole, immigrants struggle, fail, succeed and assimilate at similar rates. And the ones who assimilate fastest and whose children improve their lot the most are often the ones who faced the most contempt upon arrival.

 

California first to cover health care for all immigrants

AP: California on Thursday became the first state to guarantee free health care for all low-income immigrants living in the country illegally, a move that will provide coverage for an additional 764,000 people at an eventual cost of about $2.7 billion a year.

Biden v. Texas on MPP

SCOTUSblog: The government’s rescission of Migrant Protection Protocols did not violate Section 1225 of the Immigration and Nationality Act, and the then-Secretary of Homeland Security’s Oct. 29 memoranda constituted valid final agency action.

 

Rescission of Matter of Z-R-Z-C- as an Adopted Decision; agency interpretation of authorized travel by TPS beneficiaries

USCIS: TPS beneficiaries whom DHS has inspected and admitted into TPS under MTINA, subsequent to that inspection and admission, will have been “inspected and admitted” and are “present in the United States pursuant to a lawful admission,” including for purposes of adjustment of status under INA 245. This is true even if the TPS beneficiary was present without admission or parole when initially granted TPS.

 

Matter of E-F-N-, Impeachment Evidence

BIA: An  Immigration  Judge  may  rely  on  impeachment  evidence  as  part  of  a  credibility  determination  where  the  evidence  is  probative  and  its  admission  is  not  fundamentally  unfair,  and  the  witness  is  given  an  opportunity  to  respond  to  that  evidence  during  the  proceedings.

 

2nd Circ. Reverses BIA On Dual Citizen Refugee Question

Law360: The Second Circuit held on Tuesday that a dual national asylum-seeker can qualify as a refugee by showing persecution in just one of their countries of nationality, reversing a lower tribunal’s decision.

 

CA3 on Expedited Removal

CA3: For the reasons that follow, we hold that we have jurisdiction to review Barradas-Jacome’s legal argument in the first instance because DHS’s expedited removal procedures do not allow aliens to challenge the legal basis for their removal. We  also  hold  that  Barradas-Jacome’s  state  conviction [for receiving stolen property]  is  an  aggravated felony under the Immigration and Nationality Act(INA), 8 U.S.C. § 1101(a)(43)(G). So we will deny his petition for review.

 

CA4 on Venue: Herrera-Alcala v. Garland

LexisNexis: During the video conference hearing, Herrera-Alcala was in the Fifth Circuit (Louisiana) and the Immigration Judge was in the Fourth Circuit (Virginia). … Venue under § 1252(b)(2) depends on the location of the Immigration Judge. And the Immigration Judge was in Falls Church, Virginia, making venue proper in the Fourth Circuit.”

 

Unpub. CA5 Niz-Chavez VacRem: Tamayo-Lara v. Garland

LexisNexis: We have recently concluded, however, that the BIA’s reading of Section 1229(a) in Matter of Pena-Mejia is “directly contrary to the Supreme Court’s interpretation of § 1229(a) in Niz-Chavez [v. Garland, 141 S. Ct. 1474 (2021),] which made clear that subsequent notices may not cure defects in an initial notice to appeal.” Rodriguez, 15 F.4th at 355. Thus, we conclude the NTA served on Tamayo-Lara failed to meet the notice requirements of Section 1229(a), and the BIA abused its discretion by failing to reopen Tamayo-Lara’s proceedings. We GRANT Tamayo-Lara’s petition, VACATE the BIA’s decision, and REMAND for further proceedings.”

 

CA6 on Stay of Removal: Rondon Antonio v. Garland

LexisNexis: Whether these issues satisfy the standard to grant Rondon Antonio’s petition is a question that goes to the ultimate merits which we do not address at this juncture. But his claim is far from frivolous and, in light of his strong showing of irreparable harm, his arguments present a sufficient likelihood of success to weigh in favor of granting a stay pending an appeal on the merits.

 

9th Circ. Says TPS Isn’t ‘Admission’ To US For Removal Relief

Law360: The Ninth Circuit ruled that an ex-temporary protected status holder does not qualify for deportation relief available to long-term residents, saying his receipt of the protected status wasn’t an “admission” to the U.S. that allowed him to begin accruing residency.

 

9th Circ. Says Salvadoran Ineligible For 2nd Deportation Relief

Law360: The Ninth Circuit affirmed a Board of Immigration Appeals decision rejecting a Salvadoran man’s second request for deportation relief, saying he was granted a cancellation of a removal order that rendered him ineligible for a second grant under another law.

 

Documents Relating to Flores v. Reno Settlement Agreement on Minors in Immigration Custody

AILA: The parties reached a settlement to resolve plaintiffs’ motion to enforce, agreeing on standards for medical and physical care as well as legal and educational services the government must provide children held in emergency intake sites (EISs). (Flores, et al. v. Garland, et al., 6/22/22)

 

Judge says NYC can’t let noncitizens vote in city elections

AP: Immigrant rights advocates decried the ruling and were looking ahead to a potential appeal…More than a dozen communities across the United States allow noncitizens to cast ballots in local elections, including 11 towns in Maryland and two in Vermont. In San Francisco, noncitizens can vote in school board races; New York City allowed the same for three decades, until its school board was disbanded in 2002. Meanwhile, Alabama, Colorado and Florida have in recent years adopted rules that would preempt any attempts to pass laws like the one in New York City. Arizona and North Dakota already had prohibitions on the books.

 

White House Releases Memo Extending and Expanding Eligibility for DED for Liberians

AILA: The White House announced the grant of DED and employment authorization through 6/30/24 for Liberian DED beneficiaries as of 6/30/22, and Liberian nationals who have been continuously present in the U.S. since 5/20/17. (87 FR 38871, 6/29/22)

GREG SARGENT @ WASHPOST: “Good Guys” Apparently Gaining Legislative Traction Against The Trump-Miller White Nationalist Cabal!

Sargent writes:

At President Trump’s big rally in El Paso on Monday night, you could see signs everywhere that proclaimed: Finish the wall.

Thats some amusingly dishonest sleight of hand — it’s meant to create the impression that the wall is already being built, which is a lie Trump tells regularly. Thus, it substitutes an imaginary Trump win for a real one, since apparently support for Trump among his voters on such an important symbolic matter is too delicate to withstand the unbearable prospect of him losing without withering or shattering.

Now that negotiators have reached an agreement in principle for six months of spendingon the border, however, its once again clear that Trumps win on the wall will remain firmly in the category of the imaginary.

It includes only $1.375 billion for new bollard fencing in targeted areas. Thats nothing like Trumps wall — it’slimitedto the kind of fencing that has already been built for years— and its substantially short of the $5.7 billion Trump wants. Its nothing remotely close to the wall that haunts the imagination of the president and his rally crowds. The $1.375 billion is slightly lessthan what Democrats had previously offered him. It cant even be credibly sold as a down paymenton the wall.

 Trump’s political and media allies are already in a rageover this point. And Trump may not accept the deal, or perhaps hell agree to it and try to find the wall money through executive action.

The compromise, to be clear, is a mixed bag for progressives. But on balance, based on what we are learning now, its plainly more of a victory than not.

 The deal will include substantialhumanitarian spending

A House Democratic aide tells me that negotiators also agreed that the deal would include “substantial” expenditures to address the humanitarian plight of migrants arriving at the border.

Such money would go toward medical care, more efficient transportation, food and other consumables,” to “upgrade conditions and services for migrants,as the original Democratic proposalat the start of conference committee talks put it.Democrats had called for $500 millionfor this purpose. It’s not yet clear how much the final deal will include, as negotiations are ongoing, but it is likely to be in the hundreds of millions.

The details on this spending will matter greatly. But if structured well, it could be significant. The goal would be to upgrade current facilities where migrants are held before entering the system, which were not designed to cope with a new type of immigration: the arrival of asylum-seeking families and children, which has spikedeven as adults looking to sneak across illegally — the type Trump mostly rages about — is at historic lows.

Such an upgrade could address some terrible things weve seen: migrant families herded into tight conditions, and migrant children stacked up on concrete floorsand at medical riskdue to a lack of transportation out of remote areas, or proper screening and treatment.

Here’s the bad news

Unfortunately, Democrats backed down on a core demand: a cap on Immigration and Customs Enforcement detention beds. Democrats hoped this would force ICE to focusresources on dangerous undocumented immigrants, thus picking up fewer longtime noncriminal residents.

But Democrats instead agreed to fund 45,000 detention beds. To understand this, note that ICE is currently overspending against last years budget, by funding around 49,000 beds. So relative to that, Democrats are cutting the number of beds. But as Heidi Altman notes, what Democrats agreed to is higher than the actual number of beds legitimatelyfunded last year. So thats a hike. And if there is no hard statutory cap on beds, ICE can find money elsewhere to fund extra beds, detaining more people than funding levels suggest. As one advocate told me, the deal contains no new controls on ICE overspending.

 Thats a very serious problem. But overall, if the humanitarian money turns out to be real, the emerging agreement could prove to be a far-from-perfect but nonetheless decent one.

Some of Trumps worst designs are getting frustrated

The larger context here is that Trump and top adviser Stephen Miller have pushed on many fronts to make our immigration system as cruel as possible. Theyd hoped to use the first government shutdown to force Democrats to agree to changes in the law that would make it harder for migrant children to apply for asylum, and easier to deport migrant children and to detain migrant families indefinitely.

The overriding goal behind such changes is to reduce the numbers of immigrants in the United States — not just through deportations, but also through deterring people from trying to migrate and/or apply for asylum. That was the goal of Trumps family separations, and after those were halted last year, he renewed the push for those other changes.

 Trump’s first surrender three weeks ago temporarily conceded that he would not be able to make those things happen. Now the new compromise suggests Republicans want him to agree to reopen the government for far longer, without getting those legal changes orthe wall.

We have yet to see the details in writing, but based on news reports, Id say this deal is a huge loss for Donald Trump and Stephen Miller,Frank Sharry, the executive director of the pro-immigrant Americas Voice, told me.

This deal has no money for his concrete wall and less money for barriers than was on offer last December,Sharry added. Trump tried to use a shutdown to force through radical policy changes, and at this point, Republicans are saying, ‘Let’s keep the government open and move on.’”

Sharry conceded that the failure to get detention bed caps is a real setback.But he also noted that in six months, Democrats can renew the battle for caps, now that a lot of lawmakers understand that ICE is detaining many more people than Congress funds. We live to fight another day.

Trump and Republicans suffered an electoral wipeout in an election that Trump turned into a referendum on his xenophobic nativist nationalism. He then used a shutdown to try to force the new Democratic House to accept both his wall and radical legal changes that would have made our immigration system far more inhumane. He isnt getting his wall or those changes, and it looks as though a lot of humanitarian money will be channeled to the border to address the actual crisis there.

 

In other words, the fake crisis that Trump invented — and with it, his broader immigration vision — is getting repudiated. The only question is whether Trump will agree to the surrender Republicans are trying to negotiate for him.

Bad news for Trump on immigration is great news for America!

And, don’t forget how Trump’s devotion to himself, first, foremost, and always, as opposed to our country or even his White Nationalist restrictionist supporters played out at the DOJ. Trump’s concern for his own skin caused him to unceremoniously dump loyal White Nationalist acolyte former AG Jeff “Gonzo Apocalypto” Sessions, the “role model” for Stephen Miller.

In fewer than two years on the job, Sessions managed to push for the White Nationalist restrictionist immigration agenda in every possible way. In a sea of ethically questionable behavior during his tenure at the DOJ, the “original sin,” in Trump’s eyes, was Sessions’s following DOJ ethical advice to recuse himself from the Mueller investigation. Ethics is a dirty word in the Trump world.

Mary Meg McCarthy, Executive Director, National Immigrant Justice Center Speaks Out On Gonzo’s Attack On The Legal Orientation Program & America’s Most Vulnerable

Department of Justice Program Defunds Legal Orientation and Help Desk Programs for 53,000 Immigrants Per Year, Violating Congressional Requirements and Undermining Efforts to Reduce Immigration Court Backlogs

Statement of Mary Meg McCarthy, Executive Director, National Immigrant Justice Center

Today the National Immigrant Justice Center (NIJC) and immigration legal service providers across the country received the alarming news that the Department of Justice (DOJ) plans to  terminate the Legal Orientation Program (LOP) and the Immigration Court Helpdesk program. LOP is a life line for the more than 40,000 immigrants who face complex deportation proceedings from remote detention facilities every day. Through LOP, legal service organizations provide basic information to men and women in immigration jails about the detention and deportation process. The goals of the bipartisan program  are to improve judicial efficiency and help immigrants in detention without attorneys navigate the immigration court process. Today, LOP services reach 40 detention facilities and over 50,000 detained people in desperate need of legal services.

Terminating the LOP and help desk programs is an affront to Congress. The report language accompanying the 2018 omnibus spending bill explicitly required the Executive Office for Immigration Review to “continue ongoing programs,” adopted language in the House Report providing that funding “sustains the current legal orientation program and related assistance, such as the information desk pilot,” and adopted language in the Senate Report noting the need for expanded LOP services in remote immigration facilities.

Terminating the LOP and help desk program is a deliberate attempt to eliminate due process from the deportation process. News of the legal orientation program termination comes when the administration is forcing unreasonable quotas on immigration judges to accelerate adjudications in the massively backlogged court system, and also pursuing a policy of mass prolonged detention at the border. This is a blatant attempt by the administration to strip detained immigrants of even the pretense of due process rights. Because more than four out of every five detained immigrants are unable to access legal representation, LOP staff are quite literally the last and only line of defense for detained individuals trying to understand how to represent themselves in their claims to asylum and other forms of protection in immigration court.

Terminating the LOP program is an act of flagrant fiscal irresponsibility. A 2012 DOJ study found that detained immigrants who received legal orientation completed their court proceedings more quickly and remained detained for an average of six fewer days, yielding the government a net savings of more than $17.8 million per year.

NIJC calls on Congress to oppose the administration’s affront to due process  by taking any and all steps possible to ensure that DOJ complies with its congressional directives and maintains the LOP and help desk programs as they currently exist.

This is no real surprise, given the overt White Nationalist restrictionist agenda of Trump, Sessions, and their cronies. This isn’t driven by false “fiscal economy.” It’s driven by an agenda biased against immigrants, Latinos, and asylum seekers. Facts and truth are irrelevant when dealing with folks like Trump and Gonzo.

Scott Pruitt wastes taxpayer money left and right, as does Trump. Meanwhile, worthy, essential Government programs like the LOP are being “zero funded.” It’s totally outrageous!

While Gonzo hasn’t achieved the degree of personal greed-based corruption that some other Administration officials have, he makes up for it by grossly misusing the resources of the Department of Justice to decrease justice, fairness, and Due Process in America. It’s mind-boggling how we could end up with an anti-American, xenophobic, racist as Attorney General nearly two decades into the 21st Century. But, it’s happened. Yet, Sessions is for real and he’s recreating the “Jim Crow of his youth” in today’s America.

ANOTHER AMICUS OPPORTUNITY FOR RETIRED IMMIGRATION JUDGES AND BIA APPELLATE JUDGES – Join My Friend & Colleague Judge Eliza Klein, Pro Bono Counsel Sidley Austin, The Heartland Alliance, & Me In A 10th Circuit Case Involving Access To Counsel In Immigration Detention (There Isn’t Any, For All Practical Purposes)

I hope you’re well.  Allow me to introduce you to a team of lawyers from the firm Sidley Austin who are working on an amicus brief on behalf of immigration judges in the 10th Circuit case that I mentioned to you.  As we discussed, the case involves an arriving asylum seeker who was detained in a remote facility with no LOP, and with no realistic access to counsel. And, to complicate matters, at the time of his hearing, there was not meaningful phone access to the jail.  The goal of the brief will be to address, from a judge’s perspective, the challenges of adjudicating such cases where there’s no real option for counsel and also to hopefully address some of the ways in which IJs have had to work around the absence of counsel to develop an adequate record in such cases.

The team from Sidley will get going on drafting, but in the meantime, I think it would be very helpful if you could work with them to reach out to other IJs who you certainly know better than any of us.  We’ve provided Sidley a list of former IJs who have been willing to sign amicus briefs in other contexts, so hopefully that list (and your inside info) will help with the outreach.
