‘Suicide,’ ‘catastrophe’: Nicaraguans in US terrified of looming end of protections

Cassandra has lived and worked in the US over 20 years. Threats to her life have been made to her family and friends back in Nicaragua. It would be “suicide” to move back, she says.

But the Trump administration says she and thousands of other immigrants like her must do so by January.

On Jan. 5, roughly 5,300 Nicaraguans who have lived in the US since at least that date in 1999 will lose their protected status. If they have no other immigration status in the US, they will be forced to either return to the country or risk living in the US illegally.

The decision to end temporary protected status for Nicaraguans last November was overshadowed by similar Trump administration decisions to end such protections for hundreds of thousands more immigrants from neighbors Honduras and El Salvador. Nationals of Nicaragua received the shortest time frame of any of those TPS recipients to get their affairs together: 12 months.

But since that decision was made, Nicaragua has plunged into violence and political unrest, with at least 322 people dying there since mid-April, according to the Inter-American Commission on Human Rights, part of the Organization of American States. By the White House’s own count, the toll is more than 350. The UN Refugee Agency has put out guidance to its member countries asking them to allow Nicaraguans to enter and to apply for asylum once there.

The situation is bad enough that the Trump administration sanctioned three Nicaraguan officials in July for human rights abuses, saying President Daniel Ortega and his vice president “are ultimately responsible for the pro-government parapolice that have brutalized their own people.”

In light of the violence, a bipartisan group of seven bipartisan lawmakers wrote to President Donald Trump, Homeland Security Secretary Kirstjen Nielsen and Secretary of State Mike Pompeo in late July asking the President to either reconsider ending temporary protected status for Nicaraguans or to designate a new status for them.

“It would be, frankly, I think, unacceptable to then send folks back to that same place that we’re sanctioning,” Republican Rep. Mario Diaz-Balart of Florida, one of those who signed the letter, told CNN. “It’s a barbaric regime that’s literally murdering people in the streets. … It would be a catastrophe, and it’s one that can be avoided.”

Diaz-Balart said he has not gotten a response from the administration to the letter, though he remains hopeful it will reverse course.

The Department of Homeland Security ignored repeated requests for comment from CNN about whether it’s considering extending further protections to Nicaraguans.

Hundreds of immigrant kids remain separated from parents

Hundreds of children separated from their parents at the US-Mexico border remain separated from their parents, including 497 in government custody, according to a new court filing Thursday.

The figure includes 22 children under the age of five still in government care. Six of those are 4 years old or younger whose parents were deported without them.

A total of 1,937 children have been reunified with parents, up only 14 from last week.

The numbers have changed only slightly from last week, as the court filing from the Justice Department and the American Civil Liberties Union case describes a slow and laborious process to try to connect the families that have been separated.

It remains unclear exactly how many parents were deported without their children, though it’s in the hundreds. By the government’s latest count, there are 322 deported parents who have children still in custody.

But the ACLU, which filed the lawsuit on behalf of separated parents, says the administration has previously given it a list of deported parents that includes 70 additional cases. The administration said, according to the ACLU, that some of the discrepancy is due to kids being released from care. It’s not clear what will happen to those families.

US District Judge Dana Sabraw will hold a status hearing on the case Friday.

‘It IS bad there’: Emails reveal Trump officials pushing for TPS terminations

“The basic problem is that it IS bad there,” the official wrote.
Nevertheless, he agreed to go back and see what he could do to better bolster the administration’s decision to end the protections regardless.
The revelation comes in a collection of internal emails and documents made public Friday as part of an ongoing lawsuit over the decision to end temporary protected status for hundreds of thousands of immigrants who live in the US, most of whom have been here for well over a decade.
Friday’s document dump come as backup for the attorneys’ request that the judge immediately block the government’s decision to end these protections as the case is fully heard. A hearing is scheduled for late September.
In the emails, Trump administration political officials repeatedly pushed for the termination of TPS for vulnerable countries, even as they faced pushback from internal assessments by career staffers and other parts of the administration.
In one exchange, the now-director of US Citizenship and Immigration Services, Francis Cissna, remarks that a document recommending that TPS for Sudan be terminated reads like it was going to recommend the opposite until someone was “clubbed … over the head.”
“The memo reads like one person who strongly supports extending TPS for Sudan wrote everything up to the recommendation section and then someone who opposes extension snuck up behind the first guy, clubbed him over the head, pushed his senseless body of out of the way, and finished the memo. Am I missing something?” he wrote to key DHS staffers. Another high-ranking official then asks for the memo to be “revised.”
In a similar exchange, policy adviser Kathy Nuebel Kovarik asks her staff to address what she perceives as inconsistencies in the justification documents for ending TPS for El Salvador, Honduras and Nicaragua.
“The problem is that it reads as though we’d recommend an extension b/c we talk so much about how bad it is, but there’s not enough in there about positive steps that have been taken since its designation,” she wrote.
Staffer Brandon Prelogar responded that “it IS bad there.”
“We can comb through the country conditions to try to see what else there might be, but the basic problem is that it IS bad there (with regards to) all of the standard metrics,” Prelogar wrote. “Our strongest argument for termination, we thought, is just that it is not bad in a way clearly linked to the initial disasters prompting the designations. We can work with RU to try to get more, and/or comb through the country conditions we have again looking for positive gems, but the conditions are what they are.”
DHS did end protections for all three countries, despite dire predictions previously reported by CNN from career analysts about the consequences including potentially strengthening the vicious gang MS-13.
Immigrants are suing over the ending of TPS for these countries, alleging the protections were terminated due to a prebaked agenda that violated the law, as well as a racist agenda. The judge has previously allowed the lawsuit to proceed and forced the production of these internal documents, over the objection of the government.
The program covers migrants in the US from countries that have been hit by dire conditions, such as epidemics, civil war or natural disasters. Previous administrations, spanning both parties, had opted to extend the protections for most of the countries involved every few years when they came up for review.
The Trump administration says the conditions in each country have improved from the original disasters to the point that the protected status had to end. DHS has maintained that under its reading of the law, decisions to extend may be based only on conditions from the original disaster — not any that have arisen since. That breaks with the reading of the law from all prior administrations, attorneys argue — citing a deposition of a former USCIS director also submitted Friday.
The documents show a gradual process of the front offices of DHS taking more control of the TPS decision making. Early in the administration, career staffers drafted a document that would have justified extending TPS for Haiti. Officials asked that it be changed, and it was initially extended just six months ahead of being terminated completely.
For later decisions, the documents show the State Department complaining that it was marginalized from the process. In fact, a Federal Register Notice for the termination for Sudan had to be pulled back and edited after the State Department complained that it had been changed from a version it had approved at the last minute to something inconsistent with current US policy toward the country.
The emails show that Gene Hamilton, a close ally of Attorney General Jeff Sessions who was a senior counselor at DHS before moving to the Justice Department, made some of those last-minute revisions, attempting to remove references to human rights violations, among other changes.
When presented with Hamilton’s changes to some language already agreed to with the State Department, Prelogar wrote that “we’d just say that this could be read as taking another step toward providing an incomplete and lopsided country conditions presentation to support termination, which may increase the likelihood of criticism from external stakeholders to that effect.”
The trail also shows the State Department had recommended TPS for Sudan be extended, although it did so late in the game, and that it was caught off-guard by the changes.
In a last-minute email, the State Department’s Christopher Ashe wrote to the acting director of USCIS that there were problems.
“The Department has identified some significant mischaracterizations that are at odds with the Department’s understanding of circumstances on the ground. We believe that lacking correction, the (Federal Register Notice) could be out of step with the Administration’s broader engagement on Sudan — much of which DHS is not engaged on and is likely unaware of the nuances that USCIS’s changes in the language could have,” Ashe wrote.
He continued that State was “caught off guard” by a decision to make the announcement.
“We literally were forced to dispatch our Foreign Affairs Officers by taxi to the Embassies with virtually no notice to inform the host governments of the imminent announcements. We had thought we had obtained a commitment for sufficient notice to make such notifications,” Ashe wrote.
Nuebel Kovarik responds on the email chain that DHS would reject the suggested change by State that would imply not “all” nationals of Sudan could return, saying it would contradict the decision to terminate. She agrees to change the notice to acknowledge that some regions of Sudan may remain too dangerous for return.
State had asked for that, noting that otherwise it could “encourage the Government of Sudan to believe they have the greenlight from US (government) to force the return of displaced persons … to return to deadly conflict-affected areas. These areas are places where even well-armed UN peacekeeping forces decline to engage for fear of violence and recent killings of peacekeepers.”
But Nuebel Kovarik declines to hold off publishing the official announcement to accommodate the change, saying it’s “minor” enough to be done later on as a revision.
“We don’t say the country is perfect,” she concluded.

Documents reveal DHS knew ending protections could cause more, not less, illegal immigration

The Trump administration was warned by intelligence analysts that ending protections for hundreds of thousands of Central Americans living in the US would likely drive a spike in illegal immigration. They did it anyway.

That intelligence assessment was made public late Tuesday as part of an ongoing lawsuit against the Department of Homeland Security over the termination of Temporary Protected Status for citizens of multiple countries, many of whom have lived in the US upwards of two decades.

Questions have swirled since the administration began systematically terminating the majority of TPS designations on the books, impacting more than 400,000 immigrants who have lived in the US for years. The administration justified the moves by citing the law, saying that the Department of Homeland Security was compelled to end the protections because conditions from the original disasters that precipitated the protected status had improved.

But the intelligence report and another email from the acting secretary last year to White House chief of staff John Kelly add to other uncovered documents that raise serious questions about whether the Trump administration ignored its own experts’ analysis and recommendations to fulfill a pre-ordained objective.

The email explains that the administration was intending to “send a clear signal that TPS in general is coming to a close.”

The analysts’ report and email were revealed as part of a dispute in the lawsuit over the production of the internal documents that were used to come to the decision. Attorneys representing the immigrants suing in the case argue the government has been too slow to produce the documents.

MEXICO CITY — Two out of three people making their way through Mexico as part of a “caravan” that drew President Donald J. Trump’s ire this week have fled Honduras — part of a recent trend that has seen growing numbers of people escape the country’s exorbitant homicide rates, crippling corruption, increasing political persecution, and a floundering economy.

That is a sharp, recent rise — the number of Hondurans apprehended by US Customs and Border Control increased by 66% from Dec. 2017 to March, according to the Washington Office on Latin America, a human rights group. In February, Mexican authorities detained and deported 4,128 Hondurans, up from 2,780 the previous month. It was the highest number since November 2016.

This exodus comes at a time of extraordinary tensions even for Honduras, a country still reeling from the effects of a coup d’état in 2009. A highly contested presidential election in November drew thousands of demonstrators to the streets, where at least 22 protesters and bystanders were killed, most of them by security forces.

“Honduras is a pressure cooker in every single aspect,” said Bertha Oliva, director of the Committee for Families of the Disappeared and Detainees in Honduras. “We are seeing an unprecedented violation of human rights.”

Repression by the state has continued even months after the election, analysts say. According to Annie Bird, director of the Guatemala Human Rights Commission, government forces have been intimidating protest leaders — people have reported receiving threatening phone calls and being followed by unmarked cars.

Some in the caravan brought their politics with them, shouting slogans against Honduran President Juan Orlando Hernández, who narrowly won a second term last year and is often referred to by his initials, JOH. He has received support from former Secretary of State Hillary Clinton, former President Barack Obama, and Trump, but Hernández’s popularity at home is suffering: Many in the caravan yelled “Out with JOH!” as they set off.

The large number of Hondurans caught Trump’s attention.

“The big Caravan of People from Honduras, now coming across Mexico and heading to our “Weak Laws” Border, had better be stopped before it gets there,” Trump tweeted on Tuesday. In subsequent tweets, Trump renewed calls for his border wall and tougher immigration laws, warning about a “massive inflow of drugs and people” across the border.

Conditions in Honduras were dire even before the election, with 43.6 murders per 100,000 inhabitants, 55% of the workforce underemployed, extortions to small businesses reportedly on the rise, and endemic corruption.

The Central American nation has one of the highest homicide rates in the world and was called the most dangerous country for environmental activists last year. The government’s efforts to clean up the police force were dealt a severe blow earlier this year, after the Associated Press revealed that the head of the national police had helped a cartel leader deliver nearly a ton of cocaine in 2013. And corruption is widespread: the former first lady was arrested in connection to a graft case in February.

Even the anti-corruption mission backed by the Organization of American States, known for its Spanish initials as Maccih, is languishing without a director after Juan Jiménez Mayor resigned in February, citing a lack of support by the head of the OAS.

In the meantime, Hernández has quietly cemented his power, taking control of most of the country’s institutions, including the Supreme Court, which in 2015 struck down a law forbidding presidents from seeking a second term. His administration continues to receive a portion of the $644 million appropriated by the US Congress to assist Central American governments.

Hondurans went to the polls on November 26 in a tense and highly polarized environment. Already distrustful, many voters were incensed after the Honduran electoral commission mysteriously stopped releasing results for 36 hours just as the opposition candidate, Salvador Nasralla, took a 5 point lead over Hernández. When it resumed, Hernández quickly overtook Nasralla.

Violent protests ensued, with people defying a 10-day curfew declared by the government, which deployed the military and police to the streets. According to the United Nations High Commissioner for Human Rights in Honduras, at least 23 people were killed and at least 60 were injured during the following weeks.

Two days after the election, the State Department certified that the Honduran government had been combating corruption and supporting human rights, a requirement for the US to continue sending it millions of dollars worth of aid.

But a report by the United Nations’ office said that the use of live bullets by security forces “raise serious concerns about the use of excessive lethal force and may amount to extra-judicial killings.”

“The level of desperation has risen since the election,” said Dana Frank, professor of history at the University of California, Santa Cruz. “All signs indicate that the situation is only going to worsen politically, economically, on the human rights front.”

It is unclear whether the post-electoral crisis will push more Hondurans than usual to emigrate this spring, when migrants usually undertake the trek. But despite a clampdown on immigration, Honduran migrants’ are increasingly looking to settle in Mexico, rather than continue on to the US. Last year, 4,272 Hondurans requested asylum in Mexico, up from 1,560 in 2015.

In July, about 86,000 Hondurans living in the US could be forced to leave if their Temporary Protected Status is not renewed. (In January, the Trump administration announced it was ending the program for 200,000 Salvadorans in the country.)

Honduras would struggle to absorb the return of thousands of people and the economy would suffer from the decrease in remittances likely to follow — possibly pushing another wave of Honduras toward the US.

“I call it a self-inflicted wound,” said Eric Olson, deputy director of the Latin America program at the Woodrow Wilson International Center for Scholars in Washington.

“You could create further instability, which leads to further migration.”

We can diminish ourselves as a nation, but that won’t stop human migration.

BOSTON — The two women have been together since 2011, a 96-year-old originally from Italy and a Haitian immigrant who has helped her remain in her home — giving her showers, changing her clothes, taking her to her favorite parks and discount grocery stores.

“Hello, bella,” Nirva greets Isolina Dicenso, using the Italian word for “beautiful.”

“Hi, baby,” Dicenso replies.

But changes to federal immigration policy are putting both at risk. Haitian caregivers like Nirva, who got temporary permission to stay in the United States after the 2010 earthquake destroyed much of their homeland, now face a July 22, 2019 deadline for returning. If they and tens of thousands of other immigrants with similar jobs and tenuous legal status are forced to leave the country, Americans living with disabilities, serious illness or, like Dicenso, the frailties of old age could find themselves with few options besides nursing homes.

And many of those facilities could themselves be caught short of staff, at a time when more of the country’s aging baby boom generation could need care.

The situation reflects the crosscurrents that often roil immigration debates, with a central question being how many Americans are willing to fill the arduous, low-pay positions that immigrants often work. The expected fallout offers a glimpse into how such policy changes under President Trump will affect older Americans nationwide, especially those in large cities.

Some 59,000 Haitians live in the United States under temporary protected status (TPS), a humanitarian program that has given them permission to live and work in this country since the earthquake. Many are nursing assistants, home health aides and personal care attendants — the trio of jobs that often defines direct-care workers.

The Trump administration decided last November to curtail that protection, saying the island no longer faced the same adverse conditions and giving the immigrants until mid-2019 to leave or face deportation. In Boston, the city with the nation’s third-highest Haitian population, the action has prompted panic from TPS holders and pleas from health-care agencies that rely on their labor.

The decision “will have a devastating impact on the ability of skilled nursing facilities to provide quality care to frail and disabled residents,” Tara Gregorio, president of the Massachusetts Senior Care Association, warned in a letter published late last year in the Boston Globe. Nursing facilities in the state, which already are grappling with a shortage of several thousand workers, employ about 4,300 Haitians, according to Gregorio.

Nationwide, 1 in 4 direct-care workers are immigrants, said Robert Espinoza, vice president of policy at the New York-based Paraprofessional Healthcare Institute.

It’s not clear how many of those workers rely on the TPS program, but the Institute calculates that there are 34,600 who are non-U.S. citizens from Haiti, Nicaragua (for which TPS will end in January), El Salvador (in September 2019) and Honduras (in July, unless the Trump administration decides to renew protected status for individuals from this country). TPS decisions cannot legally take economic considerations into account, a Department of Homeland Security official said.

In addition, another 11,000 workers come from countries affected by Trump’s travel ban, primarily from Somalia and Iran, and about 69,800 are non-U.S. citizens from Mexico, according to the Institute.

Even immigrants with secure legal status may be affected when family members are deported, Espinoza noted: Under Trump, noncriminal immigration arrests have doubled. The “totality of the anti-immigrant climate” threatens the stability of the workforce — and “the ability of older people and people with disabilities to access home health care,” he said.

The Federation for American Immigration Reform, which supports more restrictive immigration policies, disputes such dire scenarios. Since three-quarters of direct-care workers are U.S. citizens, spokesman David Ray argues, then “these are clearly not ‘jobs that Americans won’t do.’ ” He does the math this way: The country has 6.7 million unemployed people, and if the health-care industry can’t find enough workers to replace those who lose TPS and other protected statuses, “then it needs to take a hard look at its recruiting practices and compensation packages.”

Yet nursing homes in Massachusetts are already losing immigrant workers who have left the country in fear, because of the White House’s immigration proposals and public remarks , according to Gregorio. Nationally, thousands of Haitians have fled to Canada.

“What people don’t seem to understand is that people from other countries really are the backbone of long-term care,” said Sister Jacquelyn McCarthy, chief executive of Bethany Health Care Center in Framingham, Mass., which runs a nursing home with 170 patients. She has eight Haitian and Salvadoran workers with TPS, mostly certified nursing assistants, who show up reliably for 4:30 a.m. shifts and never call out sick, she said. She already has six CNA vacancies and can’t afford to lose more, she said.

“There aren’t people to replace them if they should all be deported,” McCarthy said.

Nirva, who asked that she be identified only by her first name, works 70 hours a week taking care of senior citizens, sick and disabled patients. She started working as a CNA shortly after she arrived in Boston in March 2010 with her two sons.

She said she chose this work because of her harrowing experience in the earthquake, which destroyed her home and killed hundreds of thousands, including her cousin and nephew. After the disaster, she walked 15 miles with her sister, a nurse, to a Red Cross station to try to help survivors. When she got there, she recounted, the guards wouldn’t let her in because she wasn’t a nurse.

“So, when I came here — I feel, people’s life is very important,” she said. But at first, caring for elderly patients was difficult. “At the beginning, it was very tough for me,” she acknowledged, especially “when I have to clean their incontinence. . . . Some of them, they have dementia, they are fighting. They insult you. You have to be very compassionate to do this job.”

Nirva, 46, works with a soft voice, a bubbling laugh and disarming modesty. She says her faith in God — and a need to pay the bills to support her sons, now in high school and college — help her get through each week.

She started caring for Dicenso in her Boston home as the older woman recovered from surgery in 2011. With support from Nirva, another in-home aide and her daughter, Dicenso has been able to continue living alone. She now sees Nirva once a week for walks, lunch outings and shopping runs. The two have grown close, bonding in part over their Catholic faith. At home, Dicenso proudly displays a bedspread that Nirva gave her, emblazoned with the word LOVE.

Nirva also fills three shifts a week at a chiropractor’s office as a medical assistant. Five nights a week, she does an overnight shift at a Boston rehabilitation center.

The Trump administration’s immigration restrictions may exacerbate a serious shortage of direct-care workers, warns Paul Osterman, a professor at the Massachusetts Institute of Technology’s Sloan School of Management. He forecasts a national shortfall of 151,000 workers by 2030 and of 355,000 workers by 2040. If immigrants lose their work permits, the gap would widen further.

“People aren’t going to be able to have quality care,” he said. “They’re not going to be able to stay at home.”

Angelina Di Pietro, Dicenso’s daughter, worries about who could help her mother if Nirva can’t. “There’s not a lot of people in this country who would take care of the elderly,” she said. “Taking care of the elderly is a hard job.”

“Nirva, pray to God they let you stay,” said Dicenso, sitting in her living-room armchair after a long walk and ravioli lunch. “What would I do without you?”

The Trump administration is expected to extend protections for roughly 6,000 Syrian nationals in the US due to the ongoing civil war in the country, according to a source familiar with the agency’s current thinking.

But Syrians who arrived in the US after August 2016 will not be eligible under the new policy.

The protections for Syria were first enacted in 2012 and shield recipients from deportation while authorizing them to work in the US. The roughly 6,000 Syrians covered under temporary protected status program will have their protections for another 18 months.

This will be the first time since the protections were created for Syria that the Department of Homeland Security will not allow new immigrants to apply.

The decision by the Department of Homeland Security is due Wednesday, which is 60 days before the current round of protections run out, though an announcement has not yet been made. As of Tuesday, an official decision had yet to be made, a spokesman told CNN.

The Associated Press was first to report the news.

After the 18 month extension, the homeland security secretary will make a fresh decision about whether conditions in Syria, which has been embroiled in violent conflict for years, warrant another extension.

The temporary protected status, or TPS, protections are designed to prevent people already in the US when a disaster occurs from being sent back to a country suffering various forms of devastation, including conflict, natural disaster and epidemics. It was not created to be a blanket allowance for nationals of that country to come to the US, though programs like refugee and asylum protections could be applicable on a case-by-case basis. It is also common for TPS protections in general to be extended without allowing new immigrants to apply.

The extension for Syria runs counter to several terminations of TPS protections in the past few months, including for hundreds of thousands of Central Americans who have lived in the US roughly two decades. In those cases, DHS said the conditions in the country had improved enough from the original disaster that triggered the protected status, but immigration advocates and bipartisan members of Congress have called the decisions unnecessarily harsh.

The Trump administration has also moved to substantially reduce the number of refugees who are allowed to enter the US each year and has placed additional screening on all refugees, with additional vetting for those coming from high-risk countries.”

Extending the program makes perfect sense. Leaving the handful of post-August-2016 Syrian arrivals out of the program makes no sense. Just more stupid and unnecessary cruelty. DHS makes the rounds on immigration, but senators frustrated with administration

The Homeland Security secretary made the rounds Tuesday on Capitol Hill as she continues to press the agency’s priorities in immigration talks — but she’s facing skepticism from senators about the administration’s reliability on the issue.

The conversations on the Hill come as the Department of Homeland Security is working on a new list of items it wants to see in an immigration deal, according to multiple sources familiar with the discussions in Congress and the administration.

Sen. Claire McCaskill of Missouri, who was one of a handful of red-state Democrats to meet with Secretary Kirstjen Nielsen on Tuesday, said she had told Nielsen plainly that without a promise from President Donald Trump, it was impossible to negotiate on immigration with her.

Senate-House divide on immigration in spotlight after shutdown fight

“There’s things she wanted to talk about in terms of the priorities of the department in border security as we work on a bill, and I said, ‘Listen: Here’s the thing. I can’t commit to anything until you tell me you have the support of the President,'” McCaskill said. “Because, you know, I think somebody’s made the analogy of Lucy and the football. We’ve got to know if we’re going to compromise, we’ve got to know that compromise will in fact have the support of the President.”

McCaskill told reporters that Nielsen didn’t commit that she spoke for the President but didn’t say she wasn’t able to, either.

“She didn’t say she couldn’t,” McCaskill said. “She said, ‘I understand what you’re saying.’ ”

In addition to McCaskill, Nielsen met Tuesday with Sens. Jon Tester, D-Montana, Heidi Heitkamp, D-North Dakota, Lamar Alexander, R-Tennessee, and Chuck Grassley, R-Iowa, according to an official.

DHS is working off a document that was given to some negotiators in December and was passed out in the room when two dozen lawmakers met with Trump on the issue in a partially televised meeting earlier this month, according to two senior administration officials. However, after the cameras left that meeting, the President told lawmakers he hadn’t signed off on the document and instructed them to disregard it, Sen. Lindsey Graham, R-South Carolina, told reporters.

McCaskill wasn’t alone in her frustration with the President’s equivocation. Asked Tuesday about the White House press secretary publicly trashing a bipartisan proposal he had put together, Graham hit back.

“One thing I would say to the White House: You better start telling us what you’re for rather than what you’re against,” the South Carolina senator said. “To my friends at the White House, you’ve been all over the board, you haven’t been a reliable partner and the Senate’s going to move.”

DHS working on new guidance

Based on multiple conversations with members of Congress and their feedback and questions on various pieces of the proposals, one administration official said, the hope with the new written guidance is to clarify further what DHS thinks is necessary in a deal and why. The document is focused on the four areas that the President laid out publicly in that meeting: a solution on the expiring Deferred Action for Childhood Arrivals policy, border security, curtailing family-based migration and ending the diversity visa lottery.

Within the border security category, Nielsen has spoken publicly about a desire for more than just infrastructure and resources at the border — and that the agency is pursuing legal overhauls to immigration enforcement that would give it greater power to remove undocumented immigrants from the country. Increasing enforcement authority has been a tough sell among Democrats.

DHS is also looking to add more depth on what the administration wants to replace DACA, which protected young undocumented immigrants who came to the US as children but which the administration is ending. The official said that would be the “next big thing” for the administration to work through.

The official also noted DHS was “the only people who’ve put pen to paper so far” and was happy to clarify further but wasn’t interested in “negotiating against ourselves.”

And the official acknowledged lawmakers’ desire for greater clarity, especially from the President.

“We understand that some of these members are going to have to get out there, and we want to give them a bill that they can support and they’re not going to get their legs cut out from under them,” the official said. “We understand that. We’re working to get there.”

McCaskill argued, though, that Trump has put Nielsen in a tough spot.

“It puts her in a very difficult position to lobby for something when she can’t tell me the President supports what she’s lobbying for,” McCaskill said, adding that Nielsen told her the secretary “clearly supported the DACA protections,” but the senator reiterated her concern about where the President stood.

“Then she listed things she wanted to see in the bill,” McCaskill said, “and I said, ‘Some of those things I think I could work with you on. But not until I know the President will stand strong for this and make sure he lobbies the House of Representatives to pass whatever it is we end up with on a bipartisan basis in the Senate.'”

“Washington is the kind of city where you can learn a lot by listening to the conversations over dinner. At my restaurants, I have been lucky to join the conversation with presidents and first ladies, senators and ambassadors.

But right now, you can hear the most important conversations if you walk past the tables out front and into my kitchens. There — amid the din of knives chopping, plates clattering and chefs calling out a staccato stream of food orders — you’ll hear from people who look and sound a lot like America. English predominates, but you’ll also catch Haitian Creole, French and Spanish. Natural-born citizens and naturalized citizens like me work alongside those on temporary visas. I believe that all these voices make us stronger, more creative and courageous, less complacent and fearful.

Manuel is one of those people in the kitchen who prepare food for the powerful. (I am using only his first name here, to protect him from the threats many immigrants are now facing.) He was born in El Salvador, in a small town called Santa Rosa de Lima. He came to the United States in 1997 and, after a massive earthquake in his native country, was granted temporary protected status (TPS) in 2001. When immigration officials asked how he came into the United States, he didn’t lie about his walk across the border. “Matamoros,” he said.

It was also in 2001 that Manuel started as a cook at my Spanish restaurant, Jaleo. I have come to know him as someone who works hard, pays his taxes and is raising his children — a son with Deferred Action for Childhood Arrivals (DACA) status and two American-born children — to respect the country that gave him so much. But now, his family’s future is in doubt. “I just want to work to be able to send my two American-born children to university; I want them to have a better life than mine,” he told me.

The Trump administration’s decision to revoke protective status for Salvadorans (affecting 200,000 immigrants living in the United States, including 32,000 in the Washington area), Haitians (59,000 immigrants) and possibly Hondurans (86,000 immigrants) has thrown families across the country into chaos. This policy shift also has the potential to devastate my industry and hurt the overall economy.

Congress created TPS in 1990 to provide legal status to foreigners who could not safely return home because of war, natural disasters or other extreme conditions. Republican and Democratic administrations alike have extended those protections, six to 18 months at a time, recognizing that conditions remain dangerous. El Salvador, for example, is in such a state of turmoil that the State Department advisesU.S. citizens to reconsider traveling there. An influx of tens of thousands of returning citizens would only make things worse.

In the meantime, people like Manuel have built lives in the United States, buying homes (nearly a third have mortgages) and becoming active in their communities. Like Manuel, many TPS recipients are married and have children who are U.S. citizens — immigrants from El Salvador, Haiti and Honduras are raising about 273,200 U.S.-born children, according to the Center for American Progress.

Understandably, few parents would want to uproot their spouses and children to travel to a country with little opportunity and widespread violence. So, instead, these individuals face an agonizing choice: to leave without their families, or to remain in the United States without the legal means to work and in constant fear of deportation. No doubt, many will disappear from their jobs, obtain fake documents and become ghosts in a country where they used to belong.

As Americans, we also have much to lose if hundreds of thousands of industrious migrants are expelled. The Center for American Progress estimates that removing TPS workers from the economy would generate a $164 billion hole in gross domestic product over the next decade.

Because restaurants are among the main employers of these immigrants (along with construction companies, landscape businesses and child-care services), the restaurant industry stands to be particularly hard hit. Immigrants, including Salvadorans and other Central Americans, make up more than half of the staff at my restaurants, and we simply could not run our businesses without them. With national unemployment at 4 percent, there aren’t enough U.S.-born workers to take their places — or cover the employment needs of a growing economy.

Let me be frank: The administration is throwing families and communities into crisis for no good reason. This is not what people of faith do. It’s not what pragmatic people do. It’s not what America was built on.

I came to the United States from Spain in 1991 with an E-2 visa and big ambitions. I wanted to introduce America to the food of my heritage while at the same time reimagining it. I wanted to become a chef and start my own restaurant.

Despite the many hardships of being a new immigrant, life was relatively easy for me — in no small part because of my fair skin and blue eyes. America isn’t the only place where this happens; it is a human sickness. We have a hard time welcoming those who are different from us.

With the help of many friends and mentors, I worked hard to realize my ambitions. And I made sure to bring as many people as I could along with me. That is the American Dream: to live your own dream while helping others achieve theirs.

As an employer and friend of Salvadorans, Haitians and incredible people of many other nationalities, I hope Congress can work with the administration to change course on immigration policy.

TPS recipients, who have contributed for so long to the U.S. economy and our communities, should be able to apply for green cards and start on the path to citizenship. And DACA recipients, like Manuel’s son, should be able to apply for permanent status so they can truly belong to the country they have long thought of as their own.

Let’s also create a revolving-door visa, allowing people from Mexico, El Salvador and other countries to work for a few months and then return home, bringing their earnings back with them. Revolving-door visas would help the U.S. economy continue to grow and help grow the economies of our allies, too.

President Trump knows full well the value of temporary visas. From his family’s winery in Virginia to his construction projects in New York, he has hired many foreign workers to build his businesses.

President Trump, if you are reading this: Back in 2016 you told me in a phone conversation that you wanted to hear more about my views on immigration. We haven’t spoken in a while. So let me say this here: Walls will not make America safer or greater. But the money our immigrants send back home most certainly does, because economic stability contributes to political stability and international security. Allowing immigrants to work without fear of deportation or exploitation would help, too, because it would sustain American businesses and support American families. It’s the right thing to do. It’s the American way to transform what might seem a problem into an opportunity.”

“Trump administration officials announced this past week that the government would terminate provisional residency permits for about 200,000 Salvadorans next year. The decision is part of President Trump’s “America first” agenda, restricting the rights of immigrants in order to protect U.S. workers. But, as previous immigration experiments demonstrate, the policy will not aid American workers. And it certainly won’t make Salvadorans pack their bags. Trump’s order is likely to have the opposite effects.

President George W. Bush granted Salvadorans temporary protected status (TPS) after devastating earthquakes hit El Salvador in 2001. He and President Barack Obama repeatedly extended the status. Beyond its humanitarian impact, TPS provides significant economic benefits. It doesn’t give applicants access to any federal welfare — so there are few costs — but it does grant the legal right to work. And Salvadorans with TPS work at very high rates: Eighty-eight percent participate in the labor force, compared with 63 percent of all Americans.

Legal employment has helped Salvadorans achieve a relatively high standard of living. The median household income for Salvadorans with TPS is $50,000, higher than the roughly $36,000 for unauthorized immigrants. Their higher wages, combined with the lack of public benefits, has been a big win for U.S. taxpayers.

Canceling TPS will make it illegal for these Salvadorans to work, but it’s unlikely to force them home. In 1990, President George H.W. Bush granted TPS to some 185,000 Salvadorans during the country’s civil war, and when President Bill Clinton canceled their status in 1996, few returned. Deportations rose only slightly, and many Salvadorans just worked illegally until 2001.

At this point, 28 years since the original TPS designation and 17 years since the subsequent one, the incentives to stay will be too large for any mass migration back to El Salvador. Trump can try to drive them out with immigration raids and increased deportations, as other presidents have tried, but the highest percentage of unauthorized immigrants deported in a given year is 2.1 percent — three times the amount this administration deported in 2017.

Losing the legal right to work doesn’t prevent immigrants from finding jobs. They can use fake or borrowed documents from U.S. citizen family members, or employers can pay them off the books. Illegal employment, however, pays less than legal employment — employers compensate for taking the risk of hiring someone who may be here illegally.”

I can make a strong argument that Salvadoran, Haitian, and Honduran TPS are some of the most successful and humane Immigration programs in US history. In contrast to asylum adjudication, TPS adjudications cost the Government peanuts. And, the processing fees for periodic renewals of work authorization actually make money for the Government.

TPSers are overwhelmingly law-abiding, industrious, and because of their legal work authorization they pay taxes. Many TPSers work in essential industries like construction where there are not equally qualified “native born American workers” readily available to replace them. Many have US Citizen children and they have integrated into their communities. In my experience, while the majority would like to have a “path to citizenship” they aren’t aggressively agitating for one. Almost all are grateful just for the chance TPS gives them to remain with their families in the communities they call home and to work legally to support their families.

Thus, TPSers contribute much to the US and ask little in return. Their continuing presence here is in no way a “problem.”

In a rational political climate, extending TPS while offering some type of permanent status to TPSers through legislation would be a “no brainer.”  Indeed, a generation or so ago, US enacted a great program called NACARA, which offered Nicaraguans, Salvadorans, and Guatemalan a way of staying permanently and eventually becoming citizens. The program was immensely successful at a minimal administrative cost to the Government.

But, today we have a White Nationalist Administration and an increasingly White Nationalist restrictionist GOP interested more in dumping on Hispanics and Blacks through a bogus “merit based” immigration agenda than they are in doing what’s best for America.

Bier’s right. the Salvadorans aren’t going anywhere. But the Administration and the GOP restrictionists appears fixed on driving them “underground” at great cost to the TPSers and to America. They are likely to remain underground until we have “regime change” and saner heads eventually prevail.

“Immigration has become one of the most polarizing issues of our day. But it is worth remembering that this century opened with a tale of family and migration that was as contentious as many of the stories that punctuate our current debate: the case of Elián González.

In November 1999, when Elián was 6, he left Cuba in a small boat with his mother, who was seeking a better life in Florida. She and 10 others died when the boat sank in a storm. Elián survived by clinging to an inner tube. Courts eventually ruled that he must return to his father in Cuba rather than stay with relatives in Florida. He remains there to this day.

Regardless of your views of the underlying legal arguments in the case, the image of a small, frightened boy being pulled from the arms of a sheltering adult by a team of heavily armed federal agents remains seared in the minds of many people as a low point in the immigration debate.

Brace yourself for the possibility of seeing this kind of scene again.

As Republicans, whose party has consistently and rightly advanced policies to support the essential role of families in America, we are deeply troubled by the harm that is about to be done to hundreds of thousands of families that have legally called America home for more than two decades.

In the wake of the 2001 earthquake in El Salvador that claimed more than 1,000 lives and destroyed 100,000 homes, the United States allowed hard-hit families to live and work in America. This merciful act was one of many that America took to relieve the suffering of a natural disaster in one of the hemisphere’s most troubled, impoverished nations.

Now, after almost two decades, the nation that showed that kindness is poised to revoke it and force approximately 200,000 Salvadorans to leave the United States, even those whose children are American citizens. (Together, they have about 190,000 American-born children.)

 It is wrong to potentially break up so many families that have for so long made the United States their home — legally and at our invitation.

When prioritizing the immigration problems we face, the case of 200,000 Salvadorans who accepted our invitation to live and work here legally would not even make a top-10 list. The biggest challenge is, of course, securing the border. It must be done. Continued illegal migration across the southern border and the often-related criminal activity involving drugs, human trafficking and undocumented, unregulated labor is unacceptable.

Second, of course, is what to do with the 10 million to 15 million undocumented immigrants who arrived over the past several decades and who have become part of American life — and who, let’s be honest, will not and should not be forcibly removed. Congress and the president can and must act now to resolve these problems.

As our leaders try to devise durable, humane solutions to the most urgent immigration issues, it is a mistake to think the right approach is to look backward, relitigate nearly 20-year-old decisions and break up families. In fact, the action against Salvadoran families is so problematic that it is hard to see how it will not hinder efforts in Washington to find common ground on immigration.

Another of our challenges is how to deal with the 800,000 undocumented immigrants who were brought to the United States with their families when they were children. The uncertain status of these “Dreamers” is not of their own making. Though they were not born here, they know no other home than America. They grew up, studied and work here. They are largely models of the assimilation we seek for all immigrants. Congress can and should move quickly to send President Trump legislation providing a common-sense resolution to their situation so that they can continue to thrive here as part of the American dream.

One of our party’s, and the world’s, greatest leaders, Ronald Reagan, was also a passionate and articulate advocate of strong families. He once said: “The family has always been the cornerstone of American society. Our families nurture, preserve and pass on to each succeeding generation the values we share and cherish, values that are the foundation for our freedoms.”

Singling out Salvadoran families for separation is simply a bad idea that should be dropped. If we believe America is made stronger by families, then let’s do everything we can to strengthen all the families who choose to call America home. At the very least, the federal government should not become the instrument for attacking them.

We must instead take up the actual immigration challenges we face in a humane, responsible way that protects American interests and jobs.

STRIKING A blow for making America small again — plus petty, callous and self-defeating — the Trump administration on Monday stripped about 200,000 Salvadorans of their work authorizations and protection from deportation, effective 20 months from now.

The move will create tens of thousands of new undocumented immigrants in the United States; aggravate labor shortages in some American cities; saddle one of the hemisphere’s most beleaguered countries with problems it is ill-equipped to manage; and embitter tens of thousands of U.S.-born citizens whose parents are suddenly thrust into a life in the shadows or forced to return to a country where they have no future.

At this point, it’s naive to wonder what has become of America’s humanitarian impulse; in the Age of Trump, it’s null and void. Before the decision Monday by Homeland Security Secretary Kirstjen Nielsen to send packing Salvadorans who have lived in this country since a pair of earthquakes crippled their homeland in 2001, the administration took identical action last year against citizens of the hemisphere’s two poorest countries, Haiti and Nicaragua, who have also lived in this country since natural disasters ravaged their own, and announced its intention to end protections for young undocumented immigrants known as “dreamers” effective beginning in March.

As with the dreamers, the administration has seized on a narrow, legalistic interpretation as a pretext for turning against immigrants who have lived in the United States for years. In the case of the Salvadorans, officials insisted that the humanitarian program that shielded them, known as Temporary Protected Status, should lapse because their country had surmounted the original calamity that triggered TPS in the first place. The argument was the same last year for ending TPS for immigrants from Haiti, knocked senseless by a 2010 earthquake, and those from Nicaragua, leveled by a hurricane in 1998.

The administration insists it is giving meaning to the “temporary” in Temporary Protected Status. That’s fine as theory; as a policy, it fails by ignoring reality. Both the George W. Bush and Obama administrations grasped that it was unwise, not to mention cruel, to impose additional burdens on already desperate neighbors. El Salvador — wracked by brutal gang warfare, one of the world’s highest murder rates and an anemic economy — has gross domestic product per capita one-seventh that of the United States. Deporting tens of thousands of Salvadorans, and, in the process, depriving their country of the remittances they send home, will only deepen that country’s unfolding disaster. How is that in the United States’ interest?

The fact is that the Salvadorans have nearly 200,000 children who are U.S. citizens, born in this country, with no knowledge of their parents’ homeland. Nearly a quarter of those who will lose their status have mortgages, many have businesses, and a large majority have been gainfully employed for many years, paying taxes and contributing to communities.

The costs of the administration’s policy are clear. But what has been gained?”

In the end, “Gonzo” enforcement and policy making will cost the United States dearly in many, many ways. But, that’s what happens when folks elect an Administration made up of “unqualifieds” and a Congress controlled by a minority Party that doesn’t take seriously its responsibility to legislate or goven in the overall public interest.

The only real solution here is likely to be a longer term one at the ballot box.

New Homeland Security Secretary Kirstjen Nielsen faces her first major test on immigration policy next week with a decision that could force upwards of 250,000 Central Americans to leave the United States or scramble to find a way to stay.

Monday is the deadline for deciding the future of a protected status for nationals of El Salvador, and the Department of Homeland Security is widely expected to announce an end to the program, which has offered work permits and the right to live in the United States.

More than 260,000 Salvadorans are covered by the program, according to US Citizenship and Immigration Services, but some experts estimate roughly 200,000 of them could be left without the protected status, based on previous department estimates. Salvadorans make up the largest share of immigrants protected by the program, and all of them have lived in the United States since at least 2001.

While the Homeland Security Department has not yet announced its decision, its actions this year have signaled a tougher approach to the program, which allows individuals from countries affected by crises like natural disasters, war and epidemics to stay in the US and work without being deported. The “temporary protected status,” as it is known, lasts for about two years before needing to be renewed. El Salvador’s status has been continually renewed since 2001, when it was granted after a series of earthquakes.

The pending deadline marks the first major immigration decision that will fall to Nielsen, who has thus far pledged to carry on the legacy of her predecessor and former boss, John Kelly, who is now White House chief of staff.

This fall, her department ended temporary protected designations for thousands of immigrants, including more than 50,000 from Haiti and thousands more from Nicaragua and Sudan, which critics say needlessly uproots contributing immigrants to send them back to unstable countries.

Acting Secretary Elaine Duke, however, extended protections for more than 80,000 Hondurans for six months because she said she was unable to reach a decision about whether conditions in that country had improved enough to terminate the protected status. That decision prompted heavy pressure from the White House to end the protections, sources said, though Duke later denied accounts that said she felt distressed and disappointed by the interference from Kelly.

Nielsen has the ultimate decision on whether to extend El Salvador’s status, but advocates on the issue from both sides of the aisle anticipate a similar decision to that on Haiti, a struggling country as well, but one the department says has recovered from its devastating earthquake in 2010. If Nielsen opts to end the Salvadorans’ protections, it likely would give them 12 to 18 months to apply for some other visa to stay in the United States or prepare to leave.

When the protections end, recipients revert to the status they have otherwise, which would likely leave a number of Salvadorans undocumented after nearly two decades of legally working and living in the United States.

Groups on the right that advocate for restricting immigration are pressing the Homeland Security Department to end the status for El Salvador, and were concerned during Nielsen’s confirmation that she would be adequately hard-line in implementing President Donald Trump’s immigration agenda.

“(Monday’s decision) is a test of whether she properly reflects the Trump campaign’s commitment to the people on these issues,” said Dan Stein, president of the Federation for American Immigration Reform. “We’d be very disappointed to see TPS extended yet again — with no credible justification.”

“Allowing them to stay longer only undermines the integrity of the program and essentially makes the ‘temporary’ protected status a front operation for backdoor permanent immigration,” added Roy Beck, president of NumbersUSA.

There is one area of agreement between the groups on the right like FAIR and NumbersUSA and advocates on the left who say ending temporary protected status for El Salvador would be an unnecessary and cruel move — Nielsen’s decision will toss a political hot potato to Congress.

In ending the protections for other groups, the Homeland Security Department has urged outraged lawmakers to enact legislation rather than continue to force the secretary to make the decisions.

“It will be couched in nice terms, but it actually will be a dramatic move,” Frank Sharry, executive director of America’s Voice Education Fund, a pro-immigration reform group, said of his expectation that DHS will urge Congress to act. “These are Salvadorans who have been living in the United States with work permission for almost 20 years. These are people who are American in all but their paperwork. And the idea that we’re going to try to drive them back to a country that is engulfed in weak governance and corruption and violence is unthinkable.”

How dumb is it to terminate TPS for El Salvador. I ran into a respected local immigration attorney over the Holidays. While she decried the stupidity and wastefulness of the anticipated decision to terminate Salvadoran TPS, she said that it would have little practical effect on most of her Salvadoran TPS clients.

By now, she related, they all have strong prima facie claims for what is known as “Non-Lawful Permanent Resident Cancellation of Removal” based on “exceptional and extremely unusual hardship” to U.S. citizen spouses or children. Once TPS runs out and these cases are placed on the already dysfunctional Immigration Court docket, she will file the Form EOIR-43 Application for Cancellation of Removal and seek work authorization while the cases are pending before the Immigration Courts. She anticipates that given the current and anticipated backlogs in the local U.S. Immigration Courts, those cases will receive “Individual (Merits) Hearings” about five or six years from now.

Some, she thinks most, will succeed. Those that fail will exercise their appellate rights, thus further extending the process. By that time, the already feeble rationale for actually removing them for the U.S. will be even weaker. And, by then, we likely will have a different Administration and Congress that hopefully will take a more realistic, humane, and pro-American approach to the plight of the TPSers.

How dumb is terminating TPS? I’d hazard to guess that Salvadorans with “permits’ — work authorizations granted under TPS — form the backbone of the booming Northern Virginia construction and remodeling industry. If they were removed tomorrow, everyone in the region would suffer an immediate, and not easily reversible, economic downturn.

Similar problems will occur throughout the nation, not to mention the likely destabilization of El Salvador from the return of so many individuals who had long resided in the U.S to a country already in serious turmoil. In  other words, the Trump Administration appears to be in the process of engineering a human rights, foreign policy, and economic disaster on multiple levels.

“The Trump administration will announce Monday that it intends to cancel the provisional residency permits of about 200,000 Salvadorans who have lived in the country since at least 2001, leaving them vulnerable to deportation, according to mulitple people on Capitol Hill who’ve been apprised of the plan.

The administration will notify the Salvadorans they have until Sept. 9, 2019 to leave the United States or find a new way to obtain legal residency, according to a copy of the announcement prepared by the Department of Homeland Security that will be published Monday morning.

The Salvadorans were granted what is known as Temporary Protected Status, or TPS, after a series of earthquakes devastated the country in 2001.

DHS is preparing to announce that Secretary Kirstjen Nielsen has decided the conditions in El Salvador have improved significantly since then, ending the original justification for the Salvadorans’ deportation protection, these people said.”

Haitians with what is known as temporary protected status will be expected to leave the United States by July 2019 or face deportation.
The decision, while not a complete surprise, set off immediate dismay among Haitian communities in South Florida, New York and beyond. Haiti, the poorest country in the Western Hemisphere, is still struggling to rebuild from the earthquake and relies heavily on money its expatriates send to relatives back home.
The Haitian government had asked the Trump administration to extend the protected status.”

“LET THE HAITIANS STAY” — IT’S THE RIGHT THING TO DO!

“The Temporary Protected Status program provides the sort of assistance the United States should be proud to extend to foreigners fleeing civil unrest, violence or natural disasters. Enacted by Congress in 1990, it currently offers safe and legal harbor to 437,000 people from 10 countries. Many stay for a long time, their status regularly extended because of continued turmoil in their homelands.

That, alas, is a far cry from the spirit of the Trump administration. But even President Trump’s bombastic pledges to throw up a Mexican border wall, expel illegal immigrants and bar entry to Muslims are different from expelling people who, though they may have entered the United States illegally, have been allowed to stay legally, often for many years, with solid jobs and large families, while their homelands remain unsettled or dangerous.

On Thanksgiving, of all days, the Department of Homeland Security is to announce whether it will extend the temporary protected status that was granted to about 50,000 Haitians when their country was devastated by an earthquake in 2010. Their stay has been regularly extended, but in May, John Kelly, then secretary of homeland security and now the White House chief of staff, gave them only six more months, explicitly to get ready to go home. Unless their status is extended this week, they must leave by Jan. 22.

By any reasonable measure, Haiti is not ready to take them back. The destitute country has never fully recovered from the 2010 earthquake or the cholera epidemic that followed. Last year, Hurricane Matthew added even more suffering. The country does not have the resources to absorb 50,000 people, and the money they have sent back is a critical source of income for their relatives and homeland.

Every member of Congress who represents South Florida, where most of these Haitians live, is in favor of extending their status. One of them, Representative Ileana Ros-Lehtinen, a Republican from Miami, is among the congressional members of both parties who have proposed legislation that would allow these immigrants to eventually apply for permanent residency, which is not possible under current rules.”

Haitians seem to have gotten the “short end” of US immigration, refugee, and humanitarian policies over the years.

Let’s take a look at the latest Country Report on Human Rights issued by the US State Department:

“The most serious impediments to human rights involved weak democratic governance in the country worsened by the lack of an elected and functioning government; insufficient respect for the rule of law, exacerbated by a deficient judicial system; and chronic widespread corruption. Other human rights problems included significant but isolated allegations of arbitrary and unlawful killings by government officials; allegations of use of force against suspects and protesters; severe overcrowding and poor sanitation in prisons; chronic prolonged pretrial detention; an inefficient, unreliable, and inconsistent judiciary; governmental confiscation of private property without due process. There was also rape, violence, and societal discrimination against women; child abuse; allegations of social marginalization of vulnerable populations; and trafficking in persons. Violence, including gender-based violence, and crime within the remaining internally displaced persons (IDP) camps remained a problem. Although the government took steps to prosecute or punish government and law enforcement officials accused of committing abuses, credible reports persisted of officials engaging in corrupt practices, and civil society groups alleged there was widespread impunity.”

Sound like a place where 50,000 additional refugees can be safely returned and reintegrated? Preposterous!

No, the only thing that has changed here is the political motivation of the Administration; TPS — some of the most successful, efficient, and cost effective migration programs the US has ever run — has become a target of the xenophobic, White Nationalist, restrictionist wing of the GOP.

Allowing 50,000 Haitians already residing here to remain costs the US nothing — in fact their continued presence is good for the US economy and our international image. Not to mention that many of the Haitian TPS holders have relatives with legal status in the US.

On the other hand, pulling TPS and removing these individuals could have catastrophic consequences for the individuals involved, their families, and their US communities. And, it’s likely to overwhelm Haiti, a country that has already proved unable to take care of its existing population.

Anywhere but the Trump Administration, extending TPS for Haitians and others while looking for a long-term solution that would give them some type of permanent status in the US would be a “no brainer.” But, in the Trump Administration immigration and refugee policies appear to be driven largely by a policy of “no brains” — just unnecessary cruelty, wasting resources, diminishing our international humanitarian standing, and playing to the xenophobia, racism, and hate of the White Nationalists.
