Newly obtained case-by-case court records show that depending upon the community in which the immigrant resides, the odds of obtaining representation in Immigration Court deportation proceedings vary widely. If you happen to live in Honolulu, Hawaii, the odds are over 90 percent that you will be able to find an attorney to represent you. The odds are also high if you live in Manteca, California or in Pontiac. Michigan.
However these odds drop to less than 30 percent if you reside in Roma-Los Saenz or Huntsville, Texas, or in Coral Springs-Margate, Florida, or even in Atlanta-Decatur, Georgia.
Residents of Hawaii, New Hampshire, and Mississippi head the list of states where residents are most likely to obtain representation. West Virginia is in fourth place. Kansas, South Dakota, and Georgia had the worst composite records for their residents finding representation.
But even within these states the odds differ by location. The 25 communities that ranked the highest on the odds of finding an attorney were spread across seventeen states. Three states had communities that ranked both in the top 25 as well as in the bottom 25 places in the U.S.
Few dispute the importance of having an attorney to effectively argue one’s case. Representation can also lead to a number of efficiencies in the handling of court proceedings. Now for the very first time, the public can determine the odds of obtaining representation for individuals residing in each state, county, and local community within a county, who as of the end of May 2017 had pending cases before the Immigration Court.

TRAC: 75% Of US Counties Now Affected By Disaster In U.S. Immigration Courts!

Greetings. The Transactional Records Access Clearinghouse (TRAC) at Syracuse University has just released a brand new web mapping application that allows the public to examine for the very first time the number of individuals residing in each state, county, and local community within a county, who have pending cases before the Immigration Court.
The level of geographic detail now available reveals some surprising facts. There are a very large number of communities across the country that now have residents with cases before the Immigration Court. Currently pending court cases directly involve residents in 11,894 communities across the country. Indeed, a startling 2,507 separate counties in the United States – more than three out of every four counties (78%) – have residents with cases currently pending before the Immigration Court. And a total of 39 out of the 50 states have 1,000 or more residents now before the Immigration Court.
Twenty-two states have communities on the list of the top 100 places with the largest number of pending court cases. A total of 30 out of these top 100 communities are located in California. New York has twelve. Texas and Florida each have ten. Virginia has eight.
Leading the list is Houston, Texas with a total of 33,360 pending cases, following by Queens and Brooklyn New York with 25,420 and 14,960 cases respectively. Los Angeles, California with 14,287 pending cases and San Fernando Valley, California with 9,311 pending cases were in fourth and fifth place.

Greetings. The latest available case-by-case data indicate that Immigration Court dispositions have dropped by 9.3 percent since President Trump assumed office. While a larger proportion of this declining total consist of removal orders, cases closed during the past five months (February 2017-June 2017) totaled only 77,084 cases as compared with 84,956 for the same five-month period during 2016.
Under President Trump discretion to defer deporting individuals – irrespective of their circumstances — has largely been abolished. During the first five months of the Trump Administration prosecutorial discretion closures precipitously dropped to fewer than 100 per month from an average of around 2,400 per month during the same five month period in 2016. This decline has contributed to the court’s growing backlog of cases. The backlog reached a record 610,524 cases as of June 30, 2017. This is up from 598,943 at the end of May.
These findings are based upon the very latest case-by-case court records-current through the end of June 2017-that were obtained under the Freedom of information Act and analyzed by the Transactional Records Access Clearinghouse (TRAC) at Syracuse University.

THE NEW YORKER: Bureaucratic Delays Impede Due Process In U.S. Immigration Court!
Jonathan Blitzer writes in The New Yorker:
“In April, Attorney General Jeff Sessions travelled to Nogales, Arizona, to make an announcement. “This is the Trump era,” he said. “The lawlessness, the abdication of the duty to enforce our immigrations laws, and the catch-and-release practices of old are over.” While his tone was harsh, and many of the proposals he outlined were hostile to immigrants, he detailed one idea that even some of his critics support: the hiring of more immigration judges.
U.S. immigration courts are facing a backlog of over half a million cases—and each one, on average, takes almost two years to close. These delays mean that everyone from asylum seekers to green-card holders faces extended stays in detention while awaiting rulings. Speaking about the problem, one immigration judge recently told the Times, “The courts as a whole lose credibility.”
Much of the backlog can be traced back to the Obama Administration, when spending on immigration enforcement went up, while Congress dramatically limited funds for hiring more judges. The number of pending cases grew from a hundred and sixty-seven thousand, in 2008, to five hundred and sixty thousand, in 2017, according to the Transactional Records Access Clearinghouse. The broader trend, though, goes back farther. Since the creation of the Department of Homeland Security, in 2002, the increase in resources allocated for border security and immigration policing has always significantly outpaced funding for the courts. (Immigration courts are part of the Department of Justice.) As more and more people have been arrested, detained, and ordered deported, the courts have remained understaffed and underfunded. “We’ve always been an afterthought,” Dana Leigh Marks, the president of the National Association of Immigration Judges, told me.
Roughly three hundred judges nationwide are responsible for the entire immigration caseload, and hiring is slow—filling a vacancy typically tak
es about two years, according to the Government Accountability Office. In Nogales, Sessions said that he would try to streamline the hiring process. But until that happens the Administration has been relocating judges to areas where they’re deemed most necessary. “We have already surged twenty-five immigration judges to detention centers along the border,” Sessions said, as if talking about military troop levels.”

To state the obvious, a court should be run as an independent court system, not a bureaucratic agency within a highly politicized Executive Department like the DOJ. (If you ever wondered whether the DOJ was politicized, recent events should make it clear that it is.)
And, Jeff, these are judges, not troops; and the individuals are not an “invading army,” just mostly ordinary folks seeking refuge, due process, and fair treatment under our laws and the Constitution. Remember, it’s not an immigration crisis; it’s a crisis involving the steady degradation of due process within the U.S. Immigration Court system.

Greetings. During the past 18 months, a total of 79 new judges have been appointed to the Immigration Court. Despite this spurt in hiring, it has not made a dent in the court’s mountainous backlog. Instead, the backlog along with wait times have steadily increased.
As of the end of April 2017, the number of cases waiting for a decision had reached an all-time high of 585,930. Nine courts that account for a quarter of this backlog currently require some individuals to wait for more than four additional years before a hearing is scheduled. The Immigration Court in San Francisco with nearly 42,000 backlogged cases has some cases waiting for more than five additional years – as much as 1,908 days longer – for their July 21, 2022 hearing date.
These extraordinary wait times imply that some individuals are not scheduled to have their day in court until after President Trump’s current four-year term in office has ended. And we are only a little more than 100 days into his four-year term.
How quickly a case can be heard varies by court location, and the priority assigned to the case. Individuals detained by ICE are generally given priority and their cases are heard more quickly. Thus, there is tremendous variation in scheduled wait times from an average of 22 days for the Immigration Court hearing cases in the Cibola County Correctional Center in Minnesota, to 1,820 average days for individuals heard by the Immigration Court sitting in Chicago, Illinois.

Wow! The Trump Administration has proved to be incompetent at just about everything except offending allies, paving the way for dirtier air and water, undermining civil rights, busting more vulnerable individuals, most of whom are doing the US no particular harm (actually most are “plusses” for America), and keeping judges, lawyers, and reporters busy.
Can this Congress, even this GOP-controlled version, just stand by and let an incompetent Executive Branch run an important judicial system into the ground? Stay tuned.

TRAC Starts Analyzing “Trump Enforcement Data” — Initial Results Are Inconclusive

“Because of these filing and recording delays, it is too soon to determine overall trends. However, some large shifts in the composition of post-Trump cases are suggestive:
The court is now seeing many more cases where the individual was detained at the time the case is filed, and fewer non-detained cases. See Figure 1.
California, as compared to Texas and New York, are seeing larger numbers proportionately than previously.
The court is receiving fewer cases from individuals who entered the country within the last year, including fewer unaccompanied juveniles and women with children seeking refuge in the U.S.”

Read the complete report, with charts, at the above link. These results do appear consistent with the Trump initiatives — more detention, fewer cases being referred from the border, more action in major urban areas such as California.
But, as a “rank amateur,” I found the stats too small a sample, too early in the Administration to draw any valid conclusions. In other words, our expectations as set by the Executive Orders might be affecting how we interpret the data.

DHS Stonewalls TRAC Request For Detainer Data — Releases Own Reports With Arguably Useless/Misleading Data — Is “Amateur Night At The DHS” Underway?

Greetings. Today Immigration and Customs Enforcement issued its first weekly report on detainers that it said had been refused by non-federal law enforcement agencies. Unfortunately, the information ICE released is very limited and selective.
At the same time ICE released its report, the agency has started withholding other more comprehensive detainer-by-detainer information that ICE previously released to the Transactional Records Access Clearinghouse (TRAC) at Syracuse University in response to Freedom of Information Act (FOIA) requests. ICE does not claim the withheld information is exempt from disclosure, it simply claims past releases were discretionary and it is no longer willing to make many of these details available to the public.
Unfortunately, because of these ICE refusals, TRAC is unable to update its online free web query tool that allows the public to view all detainers as well as notices issued to each local law enforcement agency, month-by-month, during both the Bush and Obama Administrations, and then track what happened. TRAC’s apps cover not simply whether a detainer was refused, but whether ICE actually took the person into custody. They also show how often deportation ultimately occurred following the use of a detainer. To view these TRAC online tools see:

In contrast, the limited information in ICE’s new weekly report makes meaningful comparisons difficult. ICE’s report does not provide any information on how many detainers the local law enforcement agency may have received in total, listing only those that ICE recorded as refused. The public also does not know, for example, how often ICE issued a detainer but then decided not to take the person into custody. Or having taken individuals into custody, found it did not have a legal basis to deport them.
ICE’s report does not provide any information about the content of the detainer itself, or even whether the original detainer request met legal requirements that were outlined in the Department of Homeland Security’s November 2014 memorandum regarding limits on its legal authority to issue detainers.
