More than two-thirds of the migrants fleeing Central America’s northern triangle countries – Guatemala, Honduras and El Salvador – experienced the murder, disappearance or kidnapping of a relative before their departure, according to a new study by the medical charity Doctors Without Borders (MSF).

The MSF study said 42.5% of interviewees reported the violent death of a relative over the previous two years, while 16.2% had a relative forcibly disappeared and 9.2% had a loved one kidnapped.

The study – based on interviews with migrants and refugees at MSF medical facilities in Central America and Mexico – once again showed the despair driving migrants to abandon some the hemisphere’s poorest, most violent and most corrupt countries.

“We’re speaking of human beings, not numbers,” Sergio Martín, MSF general coordinator in Mexico, said at the study’s presentation on Tuesday. “In many cases, it’s clear that migration is the only possible way out. Staying put is not an option.”

In 45.8% of the interviews, migrants said that “exposure to violent situations” was a key reason for leaving their home country. Of those fleeing due to violence, 36.4% had become internally displaced in their countries of origin, but were eventually forced to flee.

The research was published at a time when the US border is becoming increasingly difficult to reach.

Mexico has been launched a crackdown against people trying to cross its southern frontier and deployed its newly created national guard to dismantle large groups of migrants, while the Trump administration has made the asylum process practically impossible for most applicants.

US officials are returning asylum seekers to dangerous Mexican border cities – where MSF has found many are kidnapped and preyed upon by drug cartels – under scheme known as migrant protection protocols to await their court cases. Some migrants are now being flown to Guatemala to apply for asylum in the impoverished Central American country.

“The aggressive migration policies adopted by the US and Mexico mean that more and more people are trapped in a vicious circle,” the MSF report stated. “Patients describe an increase in the predatory violence perpetuated by criminal organisations operating along the migrant route.”

Meanwhile, violence against migrants transit Mexico is escalating, the study found: 39.2% of interviewees were assaulted in the country, while 27.3% were threatened or extorted – with the actual figures likely higher than the official statistics as victims tend not to report crimes committed against them.

Nearly 6% of migrants reported witnessing a death during their time in Mexico, according to MSF. In 17.9% of those cases, it was a murder.

Members of MSF teams have themselves witnessed kidnappings outside migrant shelters.

“The physical obstacles to entering the United States are taken for granted. But what surprises [migrants] … is the violence that they experience in Mexico,” the report said.

“Coming from a country where violence is endemic, they decide to make the journey because they have no other option.”

Violence is just of a range of factors driving migration, and motives vary from region to region and country to country.

A 2019 survey from Creative Associates International found violence was the main driver of migration for 38% of Salvadorans, 18% of Hondurans and 14% of Guatemalans. In Guatemala – the main source of migrants detained at the US border with Mexico – 71% of respondents cited “economic concerns” as their main motive.

Climate change is increasingly being recognized as a driver of migration – especially from areas in Central America’s “Dry Corridor” – as is political corruption.

“Over the last 20 years in Honduras, the poverty rate hasn’t fallen beneath 60%,” said Father Germán Calix, Honduras director of the Catholic Church’s charitable arm Caritas.

“The lack of policies and actions in favor of the poor has been such that people have lost confidence that this situation can ever be reversed from Honduras.”

WASHINGTON — The number of apprehensions at the U.S.-Mexico border declined for the eighth month in a row in January, but Acting Customs and Border Protection Commissioner Mark Morgan said during a briefing with reporters on Tuesday that in recent weeks the number of average daily apprehensions has risen.

In four of the past five years, apprehensions have begun to increase in February, according to CBP statistics. Morgan said he thinks there might be a spring surge in migrants from Mexico motivated in part by the country’s stagnant economy. The recent uptick is occurring despite tough limitations on asylum opportunities and more aggressive deportation policies.

Morgan noted that the majority of people crossing the border are now individual adults from Mexico, and said that the Trump administration was having success in dissuading Central American families from coming north.

Total apprehensions at the border were lower in January than in recent months, but during the month daily apprehensions began increasing. U.S. Border Patrol apprehended 29,200 individuals crossing at the Southwest border between ports of entry during January, CBP said Tuesday morning, a decrease from the 32,858 people apprehended in December and 33,511 in November.

Morgan touted the agency’s January successes, including the discovery of the longest cross-border tunnel used for smuggling in history and the seizure of more than 50,000 pounds of drugs on the Southwest border.

“We continue to see positive results because of the steps taken by the Trump Administration to control the border and uphold the rule of law,” said Morgan. “We’ve seen eight straight months of decline, but as we see from the seizure of the longest-ever tunnel between the U.S. and Mexico and significant drug seizures, much work remains.”

Migrants from El Salvador, Guatemala and Honduras have decreased, said Morgan. He hailed the administration’s success in reducing numbers of apprehensions from these three countries, crediting security agreements with their governments. He noted that CBP has been promoting the message that if citizens from those countries come to the U.S., “They will be promptly removed and returned.”

The Trump administration has long sought to deter migrants, many of whom were Central American families, from making the journey to the U.S. southern border. Some of the administration’s policies at the border have stoked outrage over the treatment of migrants, such as the 2018 family separation policy that removed children as young as a few months old from their parents and kept them in separate detention facilities.

Last year, the administration implemented a policy to send many asylum-seekers to wait in Mexico while their cases play out. It recently began sending some asylum-seekers to Guatemala.

Critics of the Trump administration’s immigration policies have said such policies violate migrants’ rights and further endanger them by making them wait in dangerous border towns or in one of the most violent countries in the world, which lacks a robust asylum system. A Human Rights Watch report released earlier this month highlighted the potentially deadly risks to Salvadorans in particular — many of whom are fleeing gang violence — when they are sent to wait in Mexico or deported to El Salvador.

Morgan was also asked about the detention of Iranian Americans on the Northern border in Washington state after the U.S. killed Iranian general Qassem Soleimani in January. CBP denied there was any directive to agents in a tweet, but a memo surfaced weeks later showing the CBP Seattle Field Office had told much of the Northern border to conduct additional screenings of anyone with ties to Iran or Lebanon. He noted that while there was no national directive, the Seattle Field Office got “overzealous” in screening Iranian-Americans and headquarters immediately corrected the action.

Rep. Pramila Jayapal, D-Wash., who represents Seattle, said, “It’s deeply disturbing that it took my inquiries, a leaked memo and press reports for CBP to finally acknowledge that it inappropriately targeted Iranian Americans at the Washington State-Canada border.”

“We need to know how far-reaching the order was, who it came from and why it took so long for CBP to come clean.”

In an era where the “truly courageous heroes of public service” are punished by Trump while his GOP sycophants cheer, Morgan is a shining example of the very worst and most disgraceful characteristics of those who falsely claim to be serving our national interests!

Obviously, in the age of extreme regime unaccountability, Congressional fecklessness, and Article III Judicial complicity, folks like Morgan literally can “get with murder.” How grotesque, and arrogantly immoral to tout the deadly results of dehumanization and degradation of some of the most vulnerable and needy human beings!

Also worth noting that until hard evidence to the contrary emerged, under Morgan CBP initially lied about detentions of U.S. citizens of Iranian descent at the border. All of this flagrant dishonesty, racism, and impunity was originally enabled and encouraged by the “head in the sand” approach to the regime’s dishonesty and gross violations of the Constitution in the “Travel Ban Cases” by the Supremes led by the “J.R. Five.” Remember that the next time J.R. fecklessly and disingenuously pontificates on the “loss of civility” in legal discourse. What about the loss of human lives due to your complicit performance, J.R.?

A note to future historians:  Don’t forget the role played by Morgan and other regime toadies in what properly will be viewed as intentional “crimes against humanity” and attendant cover-ups and minimization of intentionally inflicted human misery and unnecessary suffering. And, certainly J.R. and his other GOP judicial enablers should be “outed” and held accountable for their role in destroying our democratic institutions, encouraging evil, and promoting injustice and dehumanization. They are enablers and knowing participants in “America’s Jim Crow Revival!”

I’ll leave a full analysis of this anti-asylum monstrosity to others more scholarly and patient. Here are a few “off the cuff” observations:

  • The BIA basically “blows off” contrary Circuit Court precedents. See, e.g., Córdoba v. Holder, 476 F. 3d 1106 (9th Cir. 2013) (wealthy educated landowners and businesspeople); N.L.A. v. Holder, 743 F.3d 425 (7th Cir. 2014) (landowners in. Colombia);
  • The BIA’s assertion that “landowners” must have “similar circumstances” conflates the requirements of a “particular social group” with “nexus.” Obviously, in some circumstances it won’t make any difference whether one is a big or small landowner, urban or rural. In other situations it might. If only certain landowners are persecuted, that is an issue of causation or “nexus,” not an element of the particular social group;
  • While “landownership” might not be “immutable,” it certainly is “fundamental to identity” in most situations. The BIA’s assertion to the contrary is absurd. Indeed, “landownership” was one of the keys to suffrage when our country was founded and has been one of the most clearly recognized and dearly held distinctions in human history. Even today, most individuals in the world who are fortunate enough to own land identify with it and are not likely to surrender it lightly;
  • The idea that a landowner should reasonably be expected to surrender his or her land is equally absurd, particularly in the context of surrendering it to drug cartels for their use. What truly perverted policy extremes the BIA engages in to avoid their responsibility to grant life-saving legal protection to the persecuted;
  • As pointed out in my “screaming headline,” throughout history, only religion or ethnicity might equal landownership as a basis for class identification, political standing, and persecution. The BIA’s obviously result-oriented decision in this case is both inane and ahistorical;
  • Don’t kid yourself! Notwithstanding some disingenuous suggestions to the contrary, no landowner will ever be recognized as within a “particular social group” and granted asylum under this decision. The BIA is encouraging Immigration Judges to “find any reason to deny” all such cases. And if the judge doesn’t deny it, the BIA will.  
  • Will the Article IIIs continue to allow and facilitate these life-threatening perversions of the law, logic, facts, and history by the BIA and the Trump regime? Maybe. Maybe not. Only time will tell. But, history will record and “out” the twisted logic and intellectual dishonesty employed by the regime and the BIA to unlawfully deny protection to those in need.

Stop Deporting Salvadorans Who Would Face Risks to Their Safety, Lives

The US government has deported people to face abuse and even death in El Salvador. The US is not solely responsible—Salvadoran gangs who prey on deportees and Salvadoran authorities who harm deportees or who do little or nothing to protect them bear direct responsibility—but in many cases the US is putting Salvadorans in harm’s way in circumstances where it knows or should know that harm is likely.

Of the estimated 1.2 million Salvadorans living in the United States who are not US citizens, just under one-quarter are lawful permanent residents, with the remaining three-quarters lacking papers or holding a temporary or precarious legal status. While Salvadorans have asylum recognition rates as high as 75 percent in other Central American nations, and 36.5 percent in Mexico, the US recognized just 18.2 percent of Salvadorans as qualifying for asylum from 2014 to 2018. Between 2014-2018, the US and Mexico have deported about 213,000 Salvadorans (102,000 from Mexico and 111,000 from the United States).

No government, UN agency, or nongovernmental organization has systematically monitored what happens to deported persons once back in El Salvador. This report begins to fill that gap. It shows that, as asylum and immigration policies tighten in the United States and dire security problems continue in El Salvador, the US is repeatedly violating its obligations to protect Salvadorans from return to serious risk of harm.

Some deportees are killed following their return to El Salvador. In researching this report, we identified or investigated 138 cases of Salvadorans killed since 2013 after deportation from the US. We found these cases by combing through press accounts and court files, and by interviewing surviving family members, community members, and officials. There is no official tally, however, and our research suggests that the number of those killed is likely greater.

Though much harder to identify because they are almost never reported by the press or to authorities, we also identified or investigated over 70 instances in which deportees were subjected to sexual violence, torture, and other harm, usually at the hands of gangs, or who went missing following their return.

In many of these more than 200 cases, we found a clear link between the killing or harm to the deportee upon return and the reasons they had fled El Salvador in the first place. In other cases, we lacked sufficient evidence to establish such a link. Even the latter cases, however, show the risks to which Salvadorans can be exposed upon return and the importance of US authorities giving them a meaningful opportunity to explain why they need protection before they are deported.

The following three cases illustrate the range of harms:

  • In 2010, when he was 17, Javier B. fled gang recruitment and his particularly violent neighborhood for the United States, where his mother, Jennifer B., had already fled. Javier was denied asylum and was deported in approximately March 2017, when he was 23 years old. Jennifer said Javier was killed four months later while living with his grandmother: “That’s actually where they [the gang, MS-13 (or Mara Salvatrucha-13)] killed him.… It’s terrible. They got him from the house at 11:00 a.m. They saw his tattoos. I knew they’d kill him for his tattoos. That is exactly what happened.… The problem was with [the gang] MS [-13], not with the police.” (According to Human Rights Watch’s research, having tattoos may be a source of concern, even if the tattoo is not gang-related).

 

  • In 2013, cousins Walter T. and Gaspar T. also fled gang recruitment when they were 16 and 17 years old, respectively. They were denied asylum and deported by the United States to El Salvador in 2019. Gaspar explained that in April or May 2019 when he and Walter were sleeping at their respective homes in El Salvador, a police patrol arrived “and took me and Walter and three others from our homes, without a warrant and without a reason. They began beating us until we arrived at the police barracks. There, they held us for three days, claiming we’d be charged with illicit association (agrupaciones ilícitas). We were beaten [repeatedly] during those three days.”

 

  • In 2014, when she was 20, Angelina N. fled abuse at the hands of Jaime M., the father of her 4-year-old daughter, and of Mateo O., a male gang member who harassed her repeatedly. US authorities apprehended her at the border trying to enter the US and deported her that same year. Once back in El Salvador, she was at home in October 2014, when Mateo resumed pursuing and threatening her. Angelina recounted: “[He] came inside and forced me to have sex with him for the first time. He took out his gun.… I was so scared that I obeyed … when he left, I started crying. I didn’t say anything at the time or even file a complaint to the police. I thought it would be worse if I did because I thought someone from the police would likely tell [Mateo].… He told me he was going to kill my father and my daughter if I reported the [original and three subsequent] rapes, because I was ‘his woman.’ [He] hit me and told me that he wanted me all to himself.”

As in these three cases, some people deported from the United States back to El Salvador face the same abusers, often in the same neighborhoods, they originally fled: gang members, police officers, state security forces, and perpetrators of domestic violence. Others worked in law enforcement in El Salvador and now fear persecution by gangs or corrupt officials.

Deportees also include former long-term US residents, who with their families are singled out as easy and lucrative targets for extortion or abuse. Former long-term residents of the US who are deported may also readily run afoul of the many unspoken rules Salvadorans must follow in their daily lives in order to avoid being harmed.

Nearly 900,000 Salvadorans living in the US without papers or only a temporary status together with the thousands leaving El Salvador each month to seek safety in the US are increasingly at risk of deportation. The threat of deportation is on the rise due to various Trump administration policy changes affecting US immigration enforcement inside its borders and beyond, changes that exacerbated the many hurdles that already existed for individuals seeking protection and relief from deportation.

Increasingly, the United States is pursuing policies that shift responsibility for immigration enforcement to countries like Mexico in an effort to avoid any obligation for the safety and well-being of migrants and protection of asylum-seekers. As ever-more restrictive asylum and immigration policies take hold in the US, this situation—for Salvadorans, and for others—will only worsen. Throughout, US authorities are turning a blind eye to the abuse Salvadorans face upon return.

Some people from El Salvador living in the United States have had a temporary legal status known as “Temporary Protected Status” or “TPS,” which has allowed those present in the United States since February 2001 (around 195,000 people) to build their lives in the country with limited fear of deportation. Similarly, in 2012, the Obama administration provided some 26,000 Salvadorans with “Deferred Action for Childhood Arrivals” or “DACA” status, which afforded some who had arrived as children with a temporary legal status. The Trump administration had decided to end TPS in January 2020, but to comply with a court order extended work authorization to January 2021. It remains committed to ending DACA.

While challenges to both policies wend their way through the courts, people live in a precarious situation in which deportation may occur as soon as those court cases are resolved (at the time of writing the DACA issue was before the US Supreme Court; and the TPS work authorization extension to January 2021 could collapse if a federal appellate court decides to reverse an injunction on the earlier attempt to terminate TPS).

Salvadoran asylum seekers are also increasingly at risk of deportation and return. The Trump administration has pursued a series of policy initiatives aimed at making it harder for people fleeing their countries to seek asylum in the United States by separating children from their parents, limiting the number of people processed daily at official border crossings, prolonging administrative detention, imposing fees on the right to seek asylum, extending from 180 days to one year the bar on work authorization after filing an asylum claim, barring asylum for those who transited another country before entering the United States, requiring asylum seekers to await their hearings in Mexico, where many face dangers, and attempting to narrow asylum.

These changes aggravated pre-existing flaws in US implementation of its protection responsibilities and came as significant numbers of people sought protection outside of El Salvador. In the decade from 2009 to 2019, according to government data, Mexican and United States officials made at least 732,000 migration-related apprehensions of Salvadoran migrants crossing their territory (175,000 were made by Mexican authorities and just over 557,000 by US authorities).

According to the United Nations’ refugee agency, the number of Salvadorans expressing fear of being seriously harmed if returned to El Salvador has skyrocketed. Between 2012 and 2017, the number of Salvadoran annual asylum applicants in the US grew by nearly 1,000 percent, from about 5,600 to over 60,000. By 2018, Salvadorans had the largest number (101,000) of any nationality of pending asylum applications in the United States. At the same time, approximately 129,500 more Salvadorans had pending asylum applications in numerous other countries throughout the world. People are fleeing El Salvador in large numbers due to the violence and serious human rights abuses they face at home, including one of the highest murder rates in the world and very high rates of sexual violence and disappearance.

Despite clear prohibitions in international law on returning people to risk of persecution or torture, Salvadorans often cannot avoid deportation from the US. Unauthorized immigrants, those with temporary status, and asylum seekers all face long odds. They are subjected to deportation in a system that is harsh and punitive—plagued with court backlogs, lack of access to effective legal advice and assistance, prolonged and inhumane detention, and increasingly restrictive legal definitions of who merits protection. The US has enlisted Mexico—which has a protection system that its own human rights commission has called “broken”—to stop asylum seekers before they reach the US and host thousands returned to wait for their US proceedings to unfold. The result is that people who need protection may be returned to El Salvador and harmed, even killed.

Instead of deterring and deporting people, the US should focus on receiving those who cross its border with dignity and providing them a fair chance to explain why they need protection. Before deporting Salvadorans living in the United States, either with TPS or in some other immigration status, US authorities should take into account the extraordinary risks former long-term residents of the US may face if sent back to the country of their birth. The US should address due process failures in asylum adjudications and adopt a new legal and policy framework for protection that embraces the current global realities prompting people to flee their homes by providing “complementary protection” to anyone who faces real risk of serious harm.

As immediate and first steps, the United States government should adopt the following six recommendations to begin to address the problems identified in this report. Additional medium- and long-term legal and policy recommendations appear in the final section of this report.

  • The Trump administration should repeal the Migration Protection Protocols (MPP); the two Asylum Bans; and the Asylum Cooperation Agreements.
  • The Attorney General of the United States should reverse his decisions that restrict gender-based, gang-related, and family-based grounds for asylum.
  • Congress and the Executive Branch should ensure that US funding for Mexican migration enforcement activities does not erode the right to seek and receive asylum in Mexico.
  • Congress should immediately exercise its appropriation power by: 1) Refraining from providing additional funding to the Department of Homeland Security (DHS) for Immigration and Customs Enforcement (ICE) and US Customs and Border Protection (CBP) unless and until abusive policies and practices that separate families, employ unnecessary detention, violate due process rights, and violate the right to seek asylum are stopped; 2) Prohibiting the use of funds to implement the Migrant Protection Protocols, the “Asylum Bans,” or the Asylum Cooperation Agreements, or any subsequent revisions to those protocols and agreements that block access to the right to seek asylum in the United States.
  • Congress should exercise its oversight authority by requiring the Government Accountability Office and the Office of Inspector General to produce reports on the United States’ fulfilment of its asylum and protection responsibilities, including by collecting and releasing accurate data on the procedural experiences of asylum seekers (access to counsel, wait times, staff capacity to assess claims, humanitarian and protection resources available) and on harms experienced by people deported from the United States to their countries of origin.
  • Congress should enact, and the President should sign, legislation that would broadly protect individuals with Temporary Protected Status (including Salvadorans) and DACA recipients, such as the Dream and Promise Act of 2019, but without the overly broad restrictions based on juvenile conduct or information from flawed gang databases.

History will neither forget nor forgive the many Article III Judges who have betrayed their oaths of office and abandoned humanity by allowing the Trump regime to run roughshod over our Constitution, the rule of law, and simple human decency.

Future generations must inject integrity, courage, and human decency into the process for appointing and confirming Article III Judges. Obviously, there is something essential missing in the legal scholarship, ethical training, and moral integrity of many of our current batch of  shallow “go along to get along” jurists!  Human lives matter!

Refugees fleeing the effects of the climate crisis cannot be forced to return home by their adoptive countries, a United Nations panel has ruled, in a landmark decision that could open the door to a flood of legal claims by displaced people around the world.

The UN’s Human Rights Committee was making a judgment on the case of Ioane Teitiota, who applied for protection from New Zealand after claiming his life was at risk in his home country of Kiribati. The Pacific island is at risk of becoming the first country to disappear under rising sea levels.

The committee ruled against Teitiota on the basis that his life was not at imminent risk — but it also outlined that countries could violate people’s international rights if they force them back to countries where climate change poses an immediate threat.

“Without robust national and international efforts, the effects of climate change in receiving states may expose individuals to a violation of their rights,” its ruling said.

It’s unlikely the ruling will have an immediate impact on citizens of other countries, given that even Kiribati’s dire situation did not meet the threshold for Teitiota’s claim to succeed. But the decision could have a significant impact on future claims, as the number of people forced from their homes from the intensifying climate emergency grows.

Droughts, crop failure and rising seas are expected to forcetens of millions to move to other areas in the coming years. A 2018 study by the World Bank found that 143 million people across South Asia, sub-Saharan Africa and Latin America are at risk of becoming climate migrants.

In its ruling, the committee cited articles 6 and 7 of the International Covenant on Civil and Political Rights, which ensure an individual’s inherent right to life.

“Given that the risk of an entire country becoming submerged under water is such an extreme risk, the conditions of life in such a country may become incompatible with the right to life with dignity before the risk is realized,” its decision added.

The Intergovernmental Panel on Climate Change has identified Teitiota’s home nation of Kiribati as one of the six Pacific Island countries most threatened by rising sea levels. The report claims that, due to coastal erosion and freshwater contamination, Kiribati could become uninhabitable as early as 2050.

It has been among a group of Pacific nations sounding the alarm over climate change in recent years but has run up against resistance from nearby Australia.

What’s going to happen when Bangladesh sinks below sea level? Seems like it would be prudent to have elected leaders who acknowledge the problem and at least think about solutions, rather than just pretending like it doesn’t exist.

Two late-breaking January 10 news stories show that Trump and his Republican allies are ramping up the hate against legal non-European immigrants in preparation for this November’s election.

The Washington Post reports that Texas has become the first state to bar resettlement of refugees under Trump’s executive order giving them the authority to do so. Admission to the UIS of legal refugees this year is already at an historic low under the agenda of Trump and Miller. Miller reportedly didn’t want to any refugees at all to be admitted this year.

On the same day, The Guardian reports that Trump is planning to add unspecified additional countries to his infamous Muslim ban order.

Both of these developments, which involve barring legal immigrants whose ethnicity or religion doesn’t happen to fit in with Trump’s avowed goal of admitting only immigrants from “Countries like Norway” and with Miller’s goal (expressed in almost 1,000 recent emails) of taking America’s immigration system back to the openly racist 1924 regime (which Adolf Hitler expressed so much admiration for in Mein Kampf) show that exploiting and stirring up more hate against nonwhite immigrants, including those eligible to come to the US legally, will be the order of the day for Trump’s re-election campaign.

My earlier comment follows below:

While the media remain focused on Donald Trump’s apparently now-abandoned threat to commit a war crime by blowing up cultural heritage sites in Iran, as an end result of his dehumanizing 2017 Muslim Ban order; or on the travesty that Senate Republicans are planning in order to “acquit” Trump of cravenly timid Democratic impeachment charges which entirely ignore his High Crimes and Misdemeanors against the basic human rights of nonwhite immigrants, what could very arguably be considered a Crime Against Humanity that the Trump administration is carrying out against desperate asylum seekers at the Mexican border in service of Stephen Miller’s white supremacist agenda is growing worse and worse.

The Guardian reports on January 9 that an obviously desperate Mexican asylum-seeker killed himself on the international bridge after being refused entry to the United States.

This horrendous display of inhumanity by the Trump administration as led to a protest by a leading Jewish religious leader, Arnold Eisen, Chancellor of the Jewish Theological Seminary (in New York City) America’s leading institution for the Conservative branch of Judaism against what he calls America’s failure to carry out its moral obligation toward desperate asylum seekers and immigrants and other immigrants. After visiting overcrowded immigrant border shelters , an ICE detention center and an asylum hearing courtroom along with other Jewish clergy, Eisen writes:

“What we saw was profoundly sobering. The predicament of those trapped at the Mexican border looks increasingly bleak as the federal government enacts more restrictive policies in the name of protecting Americans from the alleged invasion.”

Eisen then explains what motivated him to write:

“When people asked me why I was making this journey, my answer was simple: ‘Because I am a Jew.’ My grandparents arrived in this country seeking a better life, in some cases fleeing pogroms and persecutions, and the Torah’s command to care for the stranger summons me in a voice I dare not ignore. The Bible tells us that Jews are not permitted to stand by in the face of suffering and injustice.”

He then explains that this is not only a Jewish issue.:

“But the crisis at the border is a non-denominational issue and it should be non-partisan.” 

Unfortunately, in today’s America, the crisis caused by the Trumps administration’s egregious violations of essential human rights of nonwhite immigrants is anything but non-partisan. One party is blindly following its Leader into making hatred of non-European immigrants, both legal and “irregular”, as the centerpiece of its agenda, while the other party’s leaders are too cowardly to mount an effective defense of immigrants’ human rights which are being trampled on.

Ironically, the driving force of this agenda of anti-immigrant persecution, Stephen Miller, is also the grandchild of a Jewish immigrant. What kind of understanding of the Jewish heritage of care and compassion for the suffering of the stranger in our midst is he showing?

And how much understanding of this tradition of essential humanity does Miller’s boss Donald Trump, who claims to be a great friend of Israel and the Jewish people, show in his immigration policy, which includes drastic measures against even the most highly skilled and educated legal immigrants, not only asylum seekers and unauthorized immigrants?

Unfortunately, for America and the world, Roger has it pegged exactly right. Humanity, compassion, decency, and equal justice for all have disappeared from U.S. foreign and domestic policy under Trump. That’s the essence of a White Nationalist kakistocracy. And, as Roger also recognizes, there is more than a little anti-semitism and racism mixed in and driving these policies. It just so happens that Hispanics and folks with brown skins are the current “target of the day.”  

But, actually, nobody is safe in the “Age of Trump” as his sycophants and supporters have found out (see., e.g., Jeff “Gonzo Apocalypto” Sessions, Kristjen Nielsen, Steve Bannon, John Bolton, Michael Cohen, et al.). The only thing or person that Donald Trump has ever cared about is (surprise): Donald Trump. Everybody else, including our nation, the environment, and world civilization, is expendable.

I also appreciate Roger’s “outing” of bigoted Texas Gov. Greg Abbott for his ridiculous and disingenuous attempt to “bar” refugee resettlement in Texas. Judge halts Trump’s insurance mandate for immigrants

A federal judge in Oregon blocked President Donald Trump’s bid to deny immigrants visas unless they buy health insurance within 30 days of entering the country or otherwise show they can cover their medical costs.

U.S. District Court Judge Michael Simon issued an order on Tuesday to stop the State Department from enforcing a policy that officials unveiled in late October under a mandate from President Donald Trump, and which could drastically curtail the ability of people to legally migrate to the United States.

Simon noted that the requirement that immigrants buy unsubsidized insurance — meaning they couldn’t get financial assistance through Obamacare — barred poor people from entering the country, which he said clearly infringed on the law.

“The proclamation is anticipated to affect approximately 60 percent of all immigrant visa applicants,” the judge wrote. “The president offers no national security or foreign relations justification for this sweeping change in immigration law.”

Simon agreed with plaintiffs, including U.S. citizens and their overseas family members as well as the non-profit Latino Network, that the rule violated the Constitution’s separation of powers. His decision applies nationwide.

Immigration officials could have begun enforcing the requirement on Dec. 1. The administration is expected to appeal.

Simon, a Barack Obama appointee, had already temporarily blocked the policy from taking effect early this month, saying there was sufficient concern about the legality of the new requirements to merit a delay, particularly since the administration didn’t use a standard public comment period for the new rules.

The plaintiffs argued the sweeping nature of the executive action showed an attempt “to rewrite our country’s immigration laws and fundamentally shift the balance of power between the branches of government.”

The policy originated with a proclamation Trump issued on Oct. 4 that cast confusion and uncertainty onto the immigrant community and raised immediate concerns it could be unworkable. In the original order, Trump laid out the parameters for the types of health insurance legal immigrants could buy as a condition for getting a visa.

They wouldn’t be able to use federal subsidies to buy coverage on Obamacare exchanges, but could buy short-term insurance plans the administration has promoted that are cheaper but only offer barebone coverage.

That latter option layered Trump’s tough immigration policies on top of the fight over short-term plans. Democrat-led states including New York and California — which happen to draw a large share of immigrants — have banned the sale of such plans.

The plaintiffs also argued that since short-term plans leave people underinsured, the directive is undermining its own stated goal of cutting some of the uncompensated care costs from the U.S. health care system.

They also estimated the State Department through the policy would bar up to 375,000 people who could otherwise legally enter the country, shrinking the annual number of legal immigrants by nearly two-thirds.

The administration contends the criticisms are overblown and that the policy wouldn’t affect all legal immigrants, such as parents coming to the country to reunite with their children or vice versa.

Of course Trump’s intent was to invidiously discriminate against immigrants of color and the poor. Of course, that’s unconstitutional. It’s not rocket science! It’s not even very complicated constitutional law.

But, then again, Trump’s “Muslim Ban,” his rewriting of asylum statutes, and his misappropriation of funds for his border wall stunt were also clearly unconstitutional. That didn’t seem to bother the Supreme’s GOP majority a bit in their “race to roll over for the Trump Regime.” After all, as Trump and his chump Solicitor General Noel Francisco keep not too subtly reminding the “Gang of Five,” they are “bought and paid for” and expected to perform as Regime toadies. Most of the time, they get the message.

So far, the Supremes and many Circuit Courts have lacked the guts and integrity to stand up consistently and powerfully to the Trump Regime’s attacks on our Constitution and humanity.

They apparently think that they are above the fray, particularly when the rights of the most vulnerable and defenseless are involved. But, maybe they are wrong. Perhaps, when Trump has finished eradicating constitutional norms and imposed his unique form of authoritarian dysfunction on our nation, these “robed wondermen” will be refugees along with the rest of us.

Nobody that I’ve ever met expects or wants to be a refugee. It can happen to anyone, at any time, no matter how fat, content, above the fray, and complicit you might be in your current position. Disturbingly, a majority of our very highest judges appear to lack the human perspective, historical knowledge, decency, courage, and empathy to see themselves in the position of those whose legal rights they abuse in Trump’s behalf. They certainly try hard not to understand the situation of refugees and migrants.

Yes, we want fair and impartial judges (something the Supremes have conveniently overlooked in dealing with the Immigration Courts). But, we don’t want or need judges who are detached from or indifferent to humanity and human suffering. After all, our laws are made by humans to regulate human conduct. When detached from its human roots and consequences, it becomes a tool for disorder and tyranny.

The threat to women and girls is real. It is frightening. And it must not go unnoticed any longer.

In the States, we often don’t hear much about El Salvador aside from it being the country of origin for many asylum seekers at the border. We don’t hear that what’s happening at the border is a symptom of the real crisis in El Salvador and other countries in the Northern Triangle of Central America.

El Salvador is one of the world’s most violent and deadly places, similar to those of active war zones. The high level of violence is largely due to organized crime and rampant gang activity — and it’s what drives people to flee for their lives. Here are some startling facts:

 

  • In 2018, one woman was murdered every 20 hours.
  • There were more than 9.2 homicides per day.
  • Approximately 10 people each day disappear.

 

My teams on the ground are seeing that it’s teenage girls who are particularly vulnerable to sexual violence from state, civilian and criminal entities. They are also being forced into becoming “gang girlfriends,” which is essentially sex slavery so they can protect their families.

So why are we not only returning vulnerable women, children, and families to El Salvador, but, outrageously, also trying to send asylum applicants from other countries there, even though the Administration knows full well:

 

  • It isn’t “safe,” by any definition;
  • It’s a hellhole where gangs, narcos, and corrupt government officials aligned with them are in control of much of the country;
  • It doesn’t even have a functioning asylum system; and
  • It can’t protect and support its own population, let alone tens of thousands of refugees from other countries that the U.S. intends to “outsource” there.

These outrageous shams are some of the “proud legacy” that folks like “Big Mac With Lies” leave behind. And the new DHS honchos, Wolf and “Cooch Cooch,” have promised to be even more cruel, racist, and scofflaw.

Remember the truth and the facts the next time you hear a dishonest Trump official falsely claim that the only reason folks are fleeing for their lives is to take advantage of “loopholes” in US. law.

Nikki Haley used to be known as the other member of President Trump’s Cabinet who left with an intact reputation (in addition to former defense secretary Jim Mattis). In an administration more influenced by Recep Tayyip Erdogan than Ronald Reagan, the former U.S. ambassador to the United Nations often provided a more traditional rhetorical take on American foreign policy. Haley seemed genuinely to care about human rights and democracy, and to somehow get away with displaying such caring in public. Her confidence in national principles marked her as such a freakish exception that some speculated she might be the rogue, anti-Trump Trump official who wrote an anonymous op-ed in the New York Times.

But Trump’s corruption still pulls at a distance. Clearly convinced that Trumpism is here to stay, Haley has publicly turned against other officials in the administration who saw the president as a dangerous fool. She recounts an hour-long meeting with then-Chief of Staff John F. Kelly and then-Secretary of State Rex Tillerson, who “confided in me that when they resisted the president, they weren’t being insubordinate, they were trying to save the country.” The conspirators (in Haley’s telling) considered it a life-and-death matter. “This was how high the stakes were, he and Kelly told me. We are doing the best we can do to save the country, they said. We need you to work with us and help us do it.”

Haley, by her own account, refused to help. “Instead of saying that to me, they should’ve been saying that to the president, not asking me to join them on their sidebar plan,” she now explains. “It should’ve been, ‘Go tell the president what your differences are, and quit if you don’t like what he’s doing.’ But to undermine a president is really a very dangerous thing.”

Here Haley is confusing two categories. If a Cabinet member has a policy objection of sufficient seriousness, he or she should take that concern to the president. If the president then chooses against their position — and if implementing the decision would amount to a violation of conscience — an official should resign. Staying in office to undermine, say, a law or war you disapprove of would be a disturbing arrogation of presidential authority.

But there is an equally important moral priority to consider: If you are a national security official working for a malignant, infantile, impulsive, authoritarian wannabe, you need to stay in your job as long as you can to mitigate whatever damage you can — before the mad king tires of your sanity and fires you.

This paradox is one tragic outcome of Trumpism. It is generally a bad and dangerous idea for appointed officials to put their judgment above an elected official’s. And yet it would have been irresponsible for Mattis, Kelly, Tillerson and others not to follow their own judgments in cases where an incompetent, delusional or corrupt president was threatening the national interest.

Consider the case of former White House counsel Donald McGahn. According to the Mueller report, McGahn complained to then-Chief of Staff Reince Priebus that Trump was trying to get him to “do crazy s–t.” McGahn (thankfully) told investigators he ignored presidential orders he took to be illegal.

Or consider a negative illustration. When it came to pressuring Ukraine to investigate Joe Biden, the only morally mature adults in the room (and on the phone) were quite junior in rank. They expressed their concerns upward. But those above them — Secretary of State Mike Pompeo and acting chief of staff Mick Mulvaney — had learned the lesson about officials fired for an excess of conscience. They apparently looked the other way as a friendly country was squeezed for political reasons.

On the whole, I’m glad that responsible officials such as Kelly and Mattis stayed as long as they did to prevent damage to the country. But I also think they have a moral obligation to come out before the 2020 election and say what they know about Trump’s unfitness. If Biden is the nominee, they might even get together and endorse him. But, in any case, if they believe Trump is a danger to the national interest, they eventually have a duty to say something. Saving the country requires no less.

As for Haley, she has now signaled to Trump Republicans that she was not a part of the “deep state,” thus clearing away a barrier to ambition. All she had to do was to ignore her conscience, betray her colleagues and injure her country. A small price to pay for such a brilliant political future.

Haley’s ridiculously disingenuous performance on Today when grilled by Savannah Guthrie about the facts was worthy of her new role model, “Don the Con.”

Although you wouldn’t know it from the sycophantic Haley, political appointees, including Cabinet Members, actually take an oath to uphold the Constitution of the U.S., not the President. They are also first and foremost public servants paid by the People, not personal retainers of Trump as Haley, Barr, Pompeo, and others have functioned. I’d actually put Kelly and Tillerson in that category too; they certainly made a mess out of things at DHS and State, respectively, by putting the President’s xenophobic political policies before the law and the public interest. 

And, if they in fact thought the President was endangering the U.S., they have kept it a secret after leaving. Compare these tawdry performances with those of the career public servants who have spoken out about Trump’s misdeeds even at the likely cost of their careers. And, unlike the stream of political appointees who have left in various stages of disgrace, they probably don’t have lucrative private sector jobs and/or fat book contracts awaiting them.

Expect Haley to “repackage herself” as a “powerful woman” and eventually as a Presidential candidate. She should be met with the same contempt as Kirstjen Nielsen and the few other GOP women who penetrated the Trump GOP’s “White Men Only Club” only to choose pandering to its corrupt leader over the welfare of our nation and advancement of humanity.

Sen. John Cornyn (R-Texas) defended President Donald Trump’s widely condemned decision to withdraw American troops from northern Syria, claiming it was an appropriate move if Turkey was “trying to ethnically cleanse” U.S.-allied Kurdish forces in the region.

“If Turkey was planning on coming into northern Syria and trying to ethnically cleanse the Kurds, and U.S. troops were caught in the middle, I am not completely convinced that it was a bad idea to get them out of harm’s way,” Cornyn told reporters Wednesday, reported The Dallas Morning News.

He added, however, that he wishes there had been “more consultation with Congress and others and our allies in the region.”

The Republican lawmaker’s comments came just hours after Trump announced he was lifting sanctions against Turkey, which agreed to a cease-fire against the Kurds in northeast Syria. Trump took credit for the deal, though Democrats and some Republicans say his decision to upend American foreign policy in the region enabled Turkey to launch a military offensive against the Kurds earlier this month.

Fighting between Turkey and the Kurdish-led Syrian Democratic Forces, the main U.S. ally in the fight against the self-declared Islamic State in Syria, has resulted in the deaths of dozens of people and the displacement of thousands more.

During the fighting, Turkish-backed Arab fighters killed Hevrin Khalaf, the head of a Kurdish political party. A militant group posted a gruesome video of her execution online.

Foreign policy experts warned Trump’s decision to essentially abandon the Kurds could lead to their genocide by Turkey, which considers them to be terrorist insurgents. The House overwhelmingly passed a resolution last week to condemn the president’s move.

But Trump patted himself on the back Wednesday, claiming the U.S. and “nobody else” was responsible for avoiding all-out war in northern Syria.

“We have done them a great service and we’ve done a great job for all of them,” Trump said of Turkey, Syria and the Kurds. “And now, we’re getting out. … Let someone else fight over this long-bloodstained sand.”

Cornyn told reporters Wednesday that things need to “play out a little bit” before he could say whether he felt Trump’s decision to lift sanctions was the right move.

Asked Thursday about his “ethnically cleanse” remark, Cornyn appeared to walk it back some.

“I wasn’t very clear,” he told HuffPost. “If the U.S. isn’t committed to stay in Syria, getting our troops out of harm’s way where they might be injured or killed during the inevitable conflict between the Turks and the Kurds was something I was concerned about.”

House Democrats are calling for investigations into two temporary immigration courts that opened along the southern border last month where migrants who have been waiting in Mexico are fighting to obtain asylum in the US, according to a letter sent Thursday.

The courts — located in tent complexes near US Customs and Border Protection ports in Laredo and Brownsville, Texas — were built to hear cases from migrants who have been sent back to Mexico under President Donald Trump’s “Remain in Mexico” policy, officially known as the Migrant Protection Protocols.

Unveiled in January, the policy has affected over 50,000 migrants found to have credible asylum claims, including those who present themselves at ports of entry on the southern border and those who are apprehended while trying to cross the border without authorization.

The tent courts, which opened in early September with no advance notice to the public, have the capacity to hold as many as 420 hearings per day in Laredo and 720 in Brownsville conducted exclusively by video. Immigrants and their attorneys video conference with judges and DHS attorneys appearing virtually, streamed from brick-and-mortar immigration courts hundreds of miles away.

Democratic leaders, led by Congressional Hispanic Caucus chair Joaquin Castro, raised concerns Thursday that the tent facilities have led to violations of migrants’ due process rights by restricting their access to attorneys and relying on teleconferencing. They also expressed alarm that asylum seekers processed in the facilities are being returned to Mexico even though they are in danger there and that the public has largely been barred from entering the tent facilities, shrouding their operations in secrecy.

“Given the lack of access to counsel and the limitations of

, we are concerned these tent courts do not provide full and fair consideration of their asylum claims, as required by law,” the lawmakers wrote, urging the Department of Homeland Security and Department of Justice’s inspectors general to investigate. “The opening and operations of these secretive tent courts are extremely problematic.”

Few have been allowed to enter the courts

Acting Department of Homeland Security Secretary Kevin McAleenan had assured that members of the public and the press would be permitted to access to the facilities so long as they do not “disrupt proceedings or individuals’ privacy.”

In practice, however, that’s not how they have operated, and as House Democrats pointed out Thursday, preventing the public from viewing immigration court proceedings violates federal regulations.

“We are concerned that the administration has intentionally built these tent court at Customs and Border Protection ports of entry to justify limited public access to these facilities, and that this lack of transparency may allow DHS to hid abuse and due process violations that may occur in the tents,” their letter said.

Laura Lynch and Leidy Perez-Davis, attorneys with the American Immigration Lawyers Association who visited the port courts shortly after they opened in September, said they and other lawyers from the National Immigrant Justice Center, Amnesty International, and the Women’s Refugee Commission were barred from observing proceedings in the courts absent a document showing that they were representing one of the migrants on site.

The few attorneys that had such agreements were allowed to enter the facility a little more than an hour before their clients’ hearings to help them prepare — insufficient time given that, for many, it is their first opportunity to meet in person, Perez-Davis said.

In the first few days that the courts were open, the only people allowed in the hearing rooms were immigrants and their attorneys — but critically, not their translators, Lynch said. There were few attorneys representing asylum seekers in proceedings at the port courts, and even fewer spoke fluent Spanish and could have conversations with their clients.

Officials have since allowed translators into the hearing rooms, Lynch said, but neither DHS nor the DOJ have issued any formal clarification of their policy.

Attorneys are also not allowed to attend “non-refoulement interviews” at the tent facilities, in which an asylum officer determines, usually over the phone, whether a migrant should be sent back to Mexico or qualifies for an exemption allowing them to go to a detention facility in the US.

Limiting access to the port courts also inhibits legal aid groups’ ability to conduct presentations for migrants informing them of their rights in immigration proceedings, as they typically do in immigration courts.

Perez-Davis said that she observed one hearing from San Antonio — where some of the remote immigration judges handling cases in the ports courts are based — in which a young migrant woman was confused about what “asylum” means. That kind of knowledge would have previously been provided in presentations by legal aid groups.

Videoconferencing doesn’t facilitate a fair proceeding

The use of video conferencing in immigration court proceedings has long been a subject of controversy. In theory, teleconferencing would seem to make proceedings more efficient and increase access to justice, allowing attorneys and judges to partake even though they may be hundreds of miles away.

But in practice, advocates argue that teleconferencing has inhibited full and fair proceedings, with some even filing a lawsuit in New York federal court in January claiming that it violates immigrants’ constitutional rights.

Immigrants who appear in court via teleconference are more likely to be unrepresented and be deported, a 2015 Northwestern Law Review study found. Reports by the Government Accountability Office and the Executive Office of Immigration Review have also raised concerns about how technical difficulties, remote translation services, and the inability to read nonverbal communication over teleconference may adversely affect outcomes for immigrants.

Yet despite such research, the immigration courts have increasingly used video as a stand-in for in-person interaction.

In the port courts in Laredo and Brownsville, video substitutes for that kind of interaction entirely — but it has not been without hiccups so far.

Lynch, Perez-Davis, and Yael Schacher, a senior US advocate at Refugees International, said they all observed connectivity issues. For migrants who must recount some of the most traumatic experiences of their lives to support their asylum claims, video conferencing makes their task harder, Perez-Davis said.

“I have been asking myself what happens if you’re in the middle of the worst story you’ve ever had to tell, and the video cuts out?” she said.

These courts are sending immigrants back to danger in Mexico

Migrants are required to travel in the dark and show up for processing before their hearings at the port courts early as 4:30 in the morning.

That puts them at increased risk, with recent reports of violence and kidnappings in Nuevo Laredo, which is directly across the border from Laredo, and Matamoros, which is adjacent to Brownsville. The State Department has consequently issued a level four “Do Not Travel”warning in both Nuevo Laredo and Matamoros.

Lynch and Perez-Davis said that attorneys are also increasingly afraid of crossing the border into Mexico in light of those safety concerns. Where they used to cross over the border to deliver presentations informing migrants of their rights and the US legal process in Mexican shelters, that is no longer happening to the same degree.

“It has chilled any sort of ability to provide legal representation,” Perez-Davis said.

DHS purports to exempt “vulnerable populations” from the Remain in Mexico policy and allow them to remain in the US, but in practice, few migrants have been able to obtain such exemptions in non-refoulement interviews.

The advocacy group Human Rights First issued a report earlier this month documenting dozens of cases in which inherently vulnerable immigrants — including those with serious health issues and pregnant women — and immigrants who were already victims of kidnapping, rape and assault in Mexico were sent back under MPP after their interviews.

With attorneys barred from advocating for migrants in these interviews, migrants will likely continue to be sent back to Mexico even if they should qualify for an exemption under DHS’s own guidelines.

“These interviews are a basic human rights protection to ensure that no one is returned to a country where they would face inhumane treatment, persecution or other harm,” Democrats wrote Thursday. “We are concerned that DHS is returning asylum seekers to harm in Mexico.”

MAX BOOT @ WASHPOST: Trump’s Not the Only Grossly Corrupt Public Official – The “Sleazy Three,” Pence, Pompeo, & Barr, Have Also Betrayed Our Nation & Should Go Down!

President Trump has no one but himself to blame for the fact that he is on the verge of being impeached. He recognizes no legal or moral limits on his “absolute right” to do whatever he pleases — including pressuring a foreign country to intervene in U.S. politics on his behalf. But his most senior aides have done him no favors by acting as accelerators rather than brakes on his unconscionable conduct.

Three senior officials, in particular, could have tried to dissuade the president from misusing his office for personal gain, but there is no evidence that they ever attempted to do so. History will record their names along with Trump’s in the annals of ignominy. The president’s principal accomplices in his brazen assault on the rule of law are Vice President Pence, Secretary of State Mike Pompeo, and Attorney General William P. Barr.

Pence has been Trump’s most prominent proxy in his attempts to pressure Ukrainian President Volodymyr Zelensky to cough up dirt on Democratic presidential candidate Joe Biden and to absolve Russia of hacking the 2016 election. Trump told Pence not to attend Zelensky’s inauguration in May so as to turn the screws on the Ukrainian president. When they finally met in Warsaw on Sept. 1, Pence again pressured Zelensky to take action on “corruption,” a code word for investigating Biden and the former vice president’s son Hunter.

Pence has adopted the Sergeant Schultz defense: I know nothing! His protestations of innocence are unconvincing, given that the president’s lawyer, Rudolph W. Giuliani, publicly proclaimed his desire to get dirt on the Bidens from Ukraine. Moreover, Pence’s national security adviser listened in on the now-infamous July 25 call between Trump and Zelensky that another participant described as “crazy” and “frightening.” Pence himself was given a readout of the call, yet he claims to have seen nothing wrong and is still sticking to the discredited cover story that Trump was pursuing a legitimate investigation of corruption. Pence will be saved from being remembered as the worst vice president in history only because Spiro Agnew had to resign after being charged with tax evasion and bribery.

Pompeo is now officially the worst secretary of state in history — wresting that uncoveted title from his predecessor, Rex Tillerson. As former secretary of state Colin Powell notes, “Our foreign policy is a shambles right now,” and Pompeo bears part of the blame for failing to stand up to Trump. He did not offer his resignation when the president proclaimed himself “in love” with the dictator of North Korea or when he abandoned the United States’ Kurdish allies. Pompeo subordinates the United States’ national interest to his own political interests; he is said to be interested in succeeding Trump.

Pompeo was fully aware of how unlawful Trump was acting — he was also on the July 25 call, though he pretended during interviews that he had no idea what had transpired. There is no evidence he did anything to stop Trump. Instead, he has endorsed the crazy conspiracy theory that it was the Ukrainians, not the Russians, who interfered in the 2016 election. Pompeo is now leading Trump’s coverup: He has refused to allow State Department employees to testify to Congress, denouncing Congress’s request as “an attempt to intimidate” and “bully” the career professionals. If anyone is bullying Foreign Service officers, it is Trump; witness the president’s firing of a respected ambassador in Ukraine because she wouldn’t help Giuliani frame Biden. Pompeo stood by as this happened.

No wonder State Department employees are so disgusted and demoralized. “The mood is low and getting lower,” Thomas Pickering, a distinguished former ambassador, told the New York Times.

But wait. If you think that’s bad, Barr says “hold my beer.” The attorney general has already misled the country about the findings of special counsel Robert S. Mueller III’s investigation by falsely claiming that the president had been absolved of collusion and obstruction of justice. Barr then refused to investigate complaints that a crime had been committed during Trump’s call with Zelensky. Now, he is flying around the world to pressure allies to cooperate with his politically motivated probe designed to show that the investigation of Trump’s ties to Russia was actually a “witch hunt” by the so-called deep state — just as Trump claims. Barr’s highly improper requests have stirred a backlash in Italy, Australia and Britain — close allies that have no desire to be thrust into U.S. domestic politics.

By waging war on the dedicated professionals in his own department at the behest of a law-breaking president, Barr is ensuring that he will be remembered as the worst attorney general ever. He has even eclipsed in awfulness his immediate predecessor, acting attorney general Matthew Whitaker, a political hack who was previously a hawker of toilets for “well-endowed” men.

Impeaching Pence, Pompeo and Barr would be an unneeded distraction from the necessary impeachment of their boss but, on the merits, all three richly deserve to join Trump in the dock. They have betrayed the country and their oaths of office. They have even failed Trump by not acting to save the worst person ever to occupy the White House from his worst instincts.

Allow notorious Turkish strongman Erdogan, who happened to show up at a Trump Hotel opening in Turkey, to annihilate our loyal allies against ISIS (and before that Saddam), the Kurds. Then, destroy the Turkish economy because they annihilated the Kurds like they said they would do. That way, we wipe out two of our dwindling number of allies in the Middle East and insure the re-emergence of ISIS. We also should be able to guarantee the death of many refugees in Syria and cruel and inhuman abuse of others. What could possibly go wrong?

As for GOP bottom-feeder Graham, Trump’s betrayal of American institutions, illegal attacks on his American political opponents, insult to the memory of John McCain, taunting of Congress, dehumanization of immigrants and asylum seekers, his overt racism, and his 10,000+ documented lies, “No problemo.”

But, betray an ally halfway around the world, that’s “crossing the line.”

They Fled Gang Violence And Domestic Abuse. An NYC Immigration Judge Denied Them Asylum

Seventeen year-old Josue and his mom, Esperanza, were visibly drained. They had just spent more than four hours at their asylum trial inside an immigration court at 26 Federal Plaza in Lower Manhattan, answering questions from their attorney and a government lawyer. We are withholding their full names to protect their identities because they’re afraid.

“It was exhausting,” said Josue, whose angular haircut was neatly combed for the occasion. In Spanish, he told us the judge seemed nice but, “you feel bad if you don’t know if you are going to be allowed to stay or if you have to go.”

The teen and his mother crossed the U.S. border in California in the summer of 2018. At the time, a rising number of families were entering the country, and the Trump administration wanted to send a message to them by swiftly deporting those who don’t qualify for asylum. But immigration judges are so busy, they can take up to four years to rule on a case. In November, judges in New York and nine other cities were ordered to fast track family cases and complete them within a year.

This is how Esperanza and Josue wound up going to trial just 10 months after they arrived in the U.S. and moved to Brooklyn. They were lucky to find attorneys with Central American Legal Assistance, a nonprofit in Williamsburg that’s been representing people fleeing the troubled region since 1985.

Winning asylum was never easy. But in 2018, former Attorney General Jeff Sessions made it tougher for people like Josue and Esperanza when he issued his own ruling on an immigration case involving a woman from El Salvador who was a victim of domestic violence. He wrote: “The mere fact that a country may have problems effectively policing certain crimes—such as domestic violence or gang violence—or that certain populations are more likely to be victims of crime, cannot itself establish an asylum claim.”

Immigration judges were bound to give heavy weight to that ruling. Their courts are run by the Department of Justice, whose boss is the Attorney General. And the AG’s boss, President Trump, frequently asserts that too many migrants lie about being threatened by gangs when they’re just coming for jobs. “It’s a big fat con job, folks,” he said at a Michigan rally this year.

Esperanza and Josue went to court soon after Sessions’ decision. She was fighting for asylum as a victim of domestic abuse; Josue claimed a gang threatened his life. Both would eventually lose their cases.

Josue’s case

Esperanza and Josue are typical of the Central American families seeking asylum these days, who say they’re escaping vicious drug gangs, violence and grinding poverty. The two of them came from a town outside San Pedro Sula, one of the most dangerous cities in the world.

During their trial, Josue testified under oath about how gang members repeatedly approached him outside his high school, asking him to sell drugs to the other students. He tried to ignore them, and gave different excuses for resisting, until one day when they spotted him playing soccer and became more aggressive. That’s when he said the gang leader put a gun in his face.

“He told me that if I didn’t accept what he wanted he was going to kill my whole family, my mother and sister,” he said, through a Spanish interpreter.

“I was in shock,” he said. “I had no other choice to accept and said yes.”

He told his mother and they left Honduras the next day. When Josue’s lawyer, Katherine Madison, asked if he ever reported the threat to the police he said no. “That was practically a suicide,” he said, explaining that the police are tied to the gang, because it has so much power.

Josue said his older sister later moved to Mexico because she was so afraid of the gang.

Winning asylum is a two-step process. You have to prove that you were persecuted, and that this persecution was on account of your race, religion, nationality, social group or political opinion. Madison, Josue’s attorney, argued that in Honduras, defying gangs is a risky political statement.

“They function in many ways as the de facto government of the areas where people like Josue lived,” she told WNYC/Gothamist, summing up the arguments she submitted to the judge. “They make rules. They charge basically taxes, they say who can live there and who can’t.”

And they’re known to kill people who don’t obey.

In her ruling, issued in August, Immigration Judge Oshea Spencer found Josue did experience persecution. But she denied his application for asylum. She said much of what he described “were threats and harm that exist as part of the larger criminal enterprise of the gangs in Honduras and not on the basis of any actual or perceived opposition to the gangs.”

Esperanza’s case

Esperanza’s attorney argued that her life was at risk because the gang member threatened Josue’s family. But Spencer didn’t find that specific enough. She wrote that the gang members “were motivated by their efforts to expand their drug trade, not the family relationship.” Among other cases, she referred to a recent decision by the current Attorney General, William Barr, that makes it harder for the relatives of someone who’s been threatened to win asylum.

Esperanza also lost on a separate claim that she deserved asylum because she was repeatedly beaten by Josue’s father. In court, she testified about years of abuse culminating in an incident in which he chased her with a machete. She said she couldn’t get the police to issue a restraining order, and said he kept threatening her after she moved to another town to stay with relatives.

Madison argued that women like Esperanza belong to a persecuted social group: they can’t get help from the authorities in Honduras because they’re viewed as a man’s property. The country is one of the deadliest places to be a woman; police are known to ignore complaints; and it’s extremely hard for women to get justice.

But Spencer ruled that there is no persecuted social group made up of “Honduran women who are viewed as property” for being in a domestic relationship.

Echoing the Sessions’ ruling, the judge said these categories “all lack sufficient particularity,” and called them “amorphous” because they could be made up of a “potentially large and diffuse segment of society.”

She also cited evidence submitted by the government that showed conditions in Honduras are improving for women. This evidence came from a 2018 State Department report on human rights in Honduras. Immigration advocates claim it’s been watered down from the much harsher conditions described in the last report from 2016. It’s also much shorter in length.

Jeffrey Chase, an immigration lawyer and former New York immigration judge, said it’s not surprising that Esperanza and Josue would each lose asylum. Judge Spencer only started last fall and is on probation for her first two years in the job.

“This was decided by a brand new judge who didn’t have any immigration experience prior to becoming an immigration judge,” he said, referring to the fact that Spencer was previously an attorney with the Public Utility Commission of Texas. He said she went through training which, “These days, includes being told that we don’t consider these to be really good cases.”

Sitting judges don’t talk to the media but Chase noted that they must consider the facts of each individual case, meaning the former Attorney General’s ruling doesn’t apply to all cases. He noted that some women who were victims of abuse are still winning asylum. He pointed to a case involving a Guatemalan woman who was raped by her boss. A Texas immigration judge found she did fit into a particular social group as a woman who defied gender norms, by taking a job normally held by a man.

During Josue and Esperanza’s trial, there was a lot of back and forth over their individual claims. A trial attorney from Immigration and Customs Enforcement questioned why Esperanza didn’t contact the police again after moving to another town, where she said her former partner continued to threaten her. Esperanza said it was because her brother chased him away and the police “don’t pay attention to you.”

The ICE attorney also asked Josue if his father was physically violent with anyone besides Esperanza. Josue said he did fight with other men. San Diego immigration lawyer Anna Hysell, who was previously an ICE trial attorney, said that could have hurt Esperanza’s case.

“The government was able to make the arguments that he didn’t target her because of being a woman that was in his relationship,” she explained. “He just was probably a terrible person and targeted many people.”

Hysell added that this was just her analysis and she wasn’t agreeing with the decision.

Attorney Anne Pilsbury said she believes Esperanza would have won her case, prior to the asylum ruling by Sessions, because she suffered years of abuse. But she said Josue would have had a more difficult time because gang cases were always tough. And like a lot of migrants, Josue had no evidence — he was too afraid to go to the cops. Pilsbury said immigration judges are even more skeptical now of gang cases.

“They’re getting so that they won’t even think about them,” she said. “They aren’t wrestling with the facts. They’re hearing gang violence and that’s it.”

She said Judge Spencer does sometimes grant asylum, and isn’t as harsh as other new judges. New York City’s immigration court used to be one of the most favorable places for asylum seekers. In 2016, 84 percent of asylum cases were granted. Today, that figure has fallen to 57 percent, according to TRAC at Syracuse University. Meanwhile, the government is forcing migrants to wait in Mexico for their immigration court cases or seek asylum in other countries before applying in the U.S., as the national backlog of cases exceeds one million.

Pilsbury, who founded Central American Legal Assistance in 1985, said immigration courts are now dealing with the result of a regional crisis south of the border that’s never been properly addressed since the wars of the 1980s.

“The anti-immigrant people feel it’s broken because people get to come here and ask for asylum and we feel it’s broken because people’s asylum applications aren’t seriously considered,” she explained. “We should be doing more to understand what’s going on in those countries and what we can do to help them address the chronic problems.”

Esperanza and Josue’s cases will now be appealed. Madison said she believes the judge ignored some of her evidence about gangs. She’s now turning to the Board of Immigration Appeals. However, it’s also controlled by the Justice Department — meaning the odds of getting a reversal are slim. If they lose again, the family can go to a federal circuit court which may have a broader definition of who’s eligible for asylum.

But Esperanza and Josue won’t be deported as long as their case is being appealed. On a late summer day, they seemed relaxed while sitting in a Brooklyn park. Esperanza talked about how happy she is that Josue is safe at his public high school, and can even ride a bike at night with his friends.

“He goes out and I’m always trusting the Father that just as he goes out, he comes back,” she said.

Even if they knew they would lose their asylum case, both said they still would have come to the U.S. because the risk of staying in Honduras was too great. Josue said the gang would definitely find him if he ever returned because their networks are so deep throughout the country. He’s now taking the long view. He knows there will be a Presidential election next year.

“It’s like a game of chess,” Josue said. “Any mindset can change at any moment. Maybe Trump changes his mind or maybe not. But I would have always made the decision to come.”

It’s not “rocket science.” Better, fairer outcomes were available that would have fulfilled, rather than mocked, our obligation to provide Due Process and protection under our own laws and international treaties.

Here’s how:

  • Esperanza’s claim is a clear asylum grant for “Honduran women” which is both a “particular social group” (“PSG”) and a persecuted group in Honduras that the government is unwilling or unable to protect.
  • Although the last two Administrations have intentionally twisted the law against Central American asylum seekers, Josue has a clear case for asylum as somebody for whom opposition to gang violence was an “imputed political opinion” that was “at least one central reason” for the persecution.   • In any event, on this record, Josue clearly showed that he faced a probability of torture by gangs with the acquiescence of the Honduran government, and therefore should have been granted mandatory protection by the Immigration Judge under the Convention against Torture (“CAT”).
  • The Immigration Judge’s assertion that things are getting better for women in Honduras, one of the world’s most dangerous countries for women where femicide is rampant, not only badly misapplies the legal standard (“fundamentally changed conditions that would eliminate any well founded fear”) but is also totally disingenuous as a factual matter. See, e.g., https://www.nytimes.com/interactive/2019/04/05/opinion/honduras-women-murders.html.
  • Additionally, Honduras remains in a state of armed conflict. See, e.g., https://www.tandfonline.com/doi/full/10.1080/23740973.2019.1603972?needAccess=true. Under an honest Government, granting TPS to Hondurans (as well as Salvadorans and Guatemalans affected by environmental disasters heightened by climate change) would be more than justified.
  • Under honest Government following the rule of law, well-documented cases like this one could be quickly granted by the USCIS Asylum Officer or granted on stipulation in short hearings in Immigration Court. Many more Central Americans could be granted CAT relief, TPS, or screened and approved for asylum abroad. They could thereby be kept off of Immigraton Court dockets altogether or dealt with promptly on “short dockets” without compromising anybody’s statutory or constitutional rights (compromising individual rights is a “specialty” of all the mostly ineffective “enforcement gimmicks” advanced by the Trump Administration).
  • Over time, the overwhelming self-inflicted Immigration Court backlogs caused by the Trump Administration’s “maliciously incompetent” administration of immigration laws (e.g., “Aimless Docket Reshuffling”) would be greatly reduced.
    • That, in turn, would allow the Immigration Courts to deal with cases on a more realistic timeline that would both aid rational, non-White-Nationalist immigration enforcement and provide real justice for those seeking protection under our legal system.
  • As I’ve said before, it’s not “rocket science.” All it would take is more honest and enlightened Government committed to Due Process, good court management, and an appropriate legal application of laws relating to refugees and other forms of protection. I doubt that it would cost as much as all of the bogus “enforcement only gimmicks” now being pursued by Trump as part of his racist, anti-migrant, anti-Hispanic agenda.
  • Poor judicial decision making, as well illustrated by this unfortunate wrongly decided case, not only threatens the lives of deserving applicants for our protection, but also bogs down an already grossly overloaded system with unnecessarily protracted litigation and appeals of cases  that should be “clear grants.”
  • Contrary to the intentionally false “party line” spread by “Big Mac With Lies” and other corrupt Trump sycophants at the DHS and the DOJ, a much, much higher percentage, probably a majority, of asylum applicants from the Northern Triangle who apply at our Southern Border should properly be granted some type of legal protection under our laws if the system operated in the fair and impartial manner that is Constitutionally required. The Trump Administration aided by their sycophants and enablers, all the way up to the feckless Supremes, are literally “getting away with murder” in far, far too many instances. 
  • Consequently, quickly identifying and granting relief to the many deserving applicants would be a more efficient, humane, and lawful alternative to the “Kill ‘Em Before They Get Here” deterrence  programs being pursued by Trump, with the complicity of the Supremes, the Ninth Circuit, and some of the other Federal Circuit Courts who have been afraid to put a stop to the extralegal nonsense going on in our Immigraton Courts, detention centers (the “New American Gulag”), our Southern Border, and countries like Mexico, El Salvador, Guatemala, and El Salvador where we are basically encouraging extralegal abuses and gross human right violations against migrants. It will eventually come back to haunt our nation, or whatever is left of our nation after Trump and his gang of White Nationalist thugs, supporters, appeasers, apologists, and enablers, are done looting and destroying it.

A UN commission that spent the last 12 years investigating graft in Guatemala has described the country as “captured” by corruption in its final report, days before it is set to wrap up operations after President Jimmy Morales refused to renew its mandate.

The commission, known as Cicig for its initials in Spanish, said in its final report that there is a “mafia coalition” among members of government, the business community and private individuals that is “willing to sacrifice Guatemala’s present and future to guarantee impunity and preserve the status quo”.

The commission chief Iván Velásquez, a Colombian lawyer who has been barred by Morales’ government from entering Guatemala, said via video conference from Colombia that the report would be the commission’s last public act.

“We almost got to the nucleus of the structures that have captured the state,” Velásquez said. “This cannot be solved without a profound restructuring of the state.”

The commission began its work in Guatemala in 2007 at the request of then-president Óscar Berger and was given responsibility for dismantling illegality in the wake of the country’s 1960-1996 civil war.

Morales accused the body of overreaching its authority last year, after the commission brought investigations against him, some of his relatives and his inner circle. He was protected from prosecution as a sitting president and has denied wrongdoing.

While many observers praised the commission for its work, which resulted in the prosecution of more than 400 people, including the former president Otto Pérez Molina, his vice-president and much of his cabinet, Morales decided that Cicig had run its course, setting up its impending departure on 3 September.

Critics saw Morales’ refusal to renew the commission’s mandate as an attempt to protect himself and those close to him.

The report said the “impunity of power” in Guatemala dates to colonial times.

One of the reasons why corruption networks persist today, it said, is that “they have distorted democratic institutionality in their favor and they have molded the political system and designed mechanisms that allow them to occupy positions of power, manipulating legislation.”

“Between 2012 and 2015, an illicit, political-economic network took over the executive (branch), subordinated the legislative, manipulated and interfered in the election of judges to high courts and, in addition to looting the state, promoted laws and policies favoring private companies to the detriment of competition and the citizenry,” the report continued.

All that benefited drug trafficking networks, it added.

Together with Guatemalan prosecutors, the commission took down 70 organized crime networks. Those targeted for prosecution have included public officials, lawmakers, judges, businesspeople and other civilians.

It also investigated Morales’ National Convergence Front for alleged illegal political financing.

The report said illicit political money is “present in the majority of campaigns and parties” and comes from criminal organizations including drug traffickers seeking territorial control and political protection, as well as businesspeople seeking influence.

(Reuters) – More than 2,000 Central American migrants seeking to settle in the United States have given up and accepted free rides home under a 10-month-old program funded by the U.S. government and run by a United Nations agency, according to a U.N. official.

The “Assisted Voluntary Return” program has paid for buses or flights for 2,170 migrants who either never reached the United States or were detained after crossing the border and then sent to Mexico to await U.S. immigration hearings, according to Christopher Gascon, an official with the U.N.’s International Organization for Migration (IOM).

The $1.65 million program, funded by the U.S. State Department, is raising concerns among immigration advocates who say it could violate a principle under international law against returning asylum seekers to countries where they could face persecution.

The returned migrants have not been interviewed by U.S. asylum officers. But Gascon said his agency screens all participants to ensure they are not seeking U.S. asylum and want to go back.

Gascon, head of the IOM’s Mexico mission, said the program provides a safer and more humane means of return than the migrants could arrange on their own.

The effort here, whose scope and controversial aspects have not been previously reported, is the first by the State Department and UN to target Central American migrants in Mexico on such a large scale. The State Department would not comment on the record about its role.

Gascon said the State Department reached out to the IOM last year as caravans of thousands of Central American migrants traveled through Mexico toward the U.S. border.

U.S. President Donald Trump called the caravans an “invasion” and has made stemming immigration a centerpiece of his administration and 2020 re-election campaign.

Migrant advocates are particularly concerned about 347 people returned by the IOM who had been stuck in Mexico under a controversial Trump administration policy known as the Migrant Protection Protocols (MPP).

Under that policy, which began Jan. 29, some migrants who make it across the U.S.-Mexico border are given a notice to appear in U.S. immigration court, then are then turned back to Mexico to wait the months it can take for their court cases to be resolved. In the past seven months, more than 30,000 migrants have been sent back under MPP, according to U.S. Customs and Border Protection.

Advocates say that the migrants often face danger and destitution in Mexican border towns, leaving them no good options.

“How can it be a voluntary decision (to return home) given the conditions they face in Mexico? It’s a choice between two hells,” said Nicolas Palazzo, an attorney with El Paso-based Las Americas Immigrant Advocacy Center.

Besides any danger they might face back home, there is another significant downside to leaving: If migrants do not show up for a U.S. court hearing, they can be ordered deported “in absentia,” reducing their odds of ever being granted refuge in the United States.

AFRAID TO GO, AFRAID TO STAY

Denia Carranza, a 24-year-old Honduran returned to Mexico to await a court hearing set for October, decided instead to board a bus back home last week.

She said she and her 7-year-old son had fled her hometown and a good job at a shrimp packing company after gang members threatened to kill her if she did not deal drugs to fellow employees. She had hoped to apply for U.S. asylum.

But she said she was frightened in Ciudad Juarez – a battleground for drug cartels where the bulk of migrants await their hearings. Also, she had no job and no way to provide for her son.

“I am scared of going back to Honduras. But I am more afraid to stay,” she said.

The U.S.-based nonprofit Human Rights First said it had documented more than 100 violent incidents perpetrated against migrants waiting in Mexico for U.S. court hearings this year, including rape, kidnapping, robbery, assault and police extortion.

The IOM documented 247 deaths of migrants near the US-Mexico border this year through Aug. 15.

In a July 30 letter to the IOM’s Director General, 30 U.S. and international advocacy organizations said they feared the U.N. organization was returning migrants to countries they had fled “out of desperation, not choice, and where they may not fully understand the consequences of failing to appear whenever summoned by a U.S. immigration court.”

There is no way of knowing how many of the migrants who opt to go home with IOM help might have been able to present a successful asylum claim. U.S. courts ultimately deny most such claims brought by Central Americans and the Trump administration has said many are fraudulent.

Migrants who are sent to Mexico under MPP may or may not be seeking U.S. asylum, but they generally have no opportunity to initiate such claims before being sent back across the border. The policy cuts out a traditional asylum screening step in which migrants are interviewed to establish whether they have a “credible fear” of returning home.

SEEING ‘REALITY’

When the U.S. State Department approached IOM last fall, Gascon said, part of the goal was to counter what is saw as misinformation about how easy it was to get into the United States.

IOM set up kiosks at a stadium in Mexico City, which was along the caravan route, and on the U.S.-Mexico border. It also helped spread the word about free rides back in migrant shelters.

“When they saw the reality, some decided to go home,” he said of migrants.

Three quarters of the migrants in the voluntary return program went back to Honduras, a fifth to El Salvador and the rest to Guatemala and Nicaragua, according to IOM figures through July 26 of this year. More than half were “family units” and about 100 were unaccompanied minors. Most of the migrants have been sent back from Mexico, and a small fraction from Guatemala.

The IOM screens all migrants who ask to go home, but those awaiting U.S. hearings in Mexico also undergo an orientation program with Grupo Beta, an arm of Mexico’s National Migration Institute, to ensure migrants understand their options, Gascon said.

So far, Gascon said, two people awaiting U.S. court hearings in Mexico who wanted a ride back were instead referred to the Mexican government to gauge their eligibility for asylum in Mexico.

But advocates said they worried that Grupo Beta is not the best partner for IOM to ensure migrants’ safety.

“Many organizations have documented time and again that Mexican migration officials don’t refer people to (the national refugee office), they don’t register fears of return, and they have even pressured people to withdraw (asylum) claims,” said Kennji Kizuka, a researcher at the nonprofit Human Rights First.

Mexican migration officials did not respond to a request for comment.

More than a dozen migrants awaiting U.S. hearings at the Casa de Migrante shelter in Ciudad Juarez told Reuters the weekly south-bound bus rides held some appeal. Though reluctant to give up on their American dreams, many didn’t have lawyers and saw little prospect for success.

“All that effort we made to get here from Honduras and now we’re going back,” said Angel Estrada, who had hoped to get care in the United States for his 9-year-old son, who has hemophilia. “It’s really sad.”
