On April 4, 1968, I was a senior in high school when Dr. Martin Luther King Jr. was murdered in Memphis, Tennessee. That weekend I had been attending a planning meeting in Richmond, Virginia, for mobilizing white teens from suburban churches to serve in inner-city projects in the District of Columbia and Baltimore.

Irv Williams is a native of Baltimore, with family roots in the Northern Neck of Virginia. He moved to Maine in 1973 and is a resident of Peaks Island.

Driving home on Sunday afternoon I arrived at the Baltimore city line, about five miles from my house, to find National Guard troops and tanks blocking off access to the city. I was allowed to pass only on the condition that I drive directly home.

Today I know the real reason I was allowed to pass by those armed soldiers was that my face was white, not Black. Dr. King was only 39 years old when he was murdered.

William Page was only 25 years of age when he was lynched in August 1917 in Lilian, Virginia. My mother would have been a toddler sleeping in her crib at home, just a mile away from the schoolyard in which he was hanged. Newspaper reports state that a mob of about 500 men assembled to commit the murder.

William Page would be the last Black man to be lynched in my mother’s home county of Northumberland, but the lynchings would continue on for another seven years, claiming the lives of nine additional Black men across Virginia.

I am now just a bit older than my mother was when she died. At 72, I look back over a lifetime of witnessing racial injustice through the segregation of schools and other public and private facilities. The false doctrine of “separate but equal” was then in full force throughout Virginia, where both of my parents were born and raised.

I carry childhood memories of seeing “White” and “Colored” water fountains in the county courthouse. Of visiting the family doctor whose small brick office behind his house had separate waiting rooms. Hearing my grandmother talk about “the colored” schools that a neighboring county closed for five full years rather than integrate, meanwhile taking public funds to open white academies. Knowing that nearby was a “colored beach” that was a small sliver of sand allotted to Black children. And knowing that there would never be any Black worshippers or preachers at the church revival meetings where my grandmother played piano.

Looking back at all of those memories, I know full well that the privilege to pass by those National Guard tanks in 1968 had come at the expense of others, sometimes in deadly ways.

In his 1964 book “Why We Can’t Wait,” Dr. King wrote: “Armies of officials are clothed in uniform, invested with authority, armed with the instruments of violence and death and conditioned to believe that they can intimidate, maim or kill Negroes with the same recklessness that once motivated the slaveowner.”

Now, nearly 60 years later, we see that Dr. King is still being proven right with the brutal beating death of Tyre Nichols in Memphis. It wasn’t a rope like they used on William Page, or a bullet like the one that felled Dr. King, but the stun gun, pepper spray, fists and boots of police officers who have been charged with murder in an incident that equals the terror of the August night when 500 men watched William Page die.

Must we wait for another hundred years to pass for this senseless killing to stop? The simple answer is, no, we can’t wait.

Justice Clarence Thomas has openly flouted the federal law that requires all federal judges, including Supreme Court justices, to recuse themselves from cases in which they cannot be impartial: He has participated in a case in which his wife, Ginni, undeniably has an interest. For a long time, it has felt like there is nothing to be done about this—conventional wisdom says that short of impeachment, Supreme Court justices are immune from penalties for their misconduct. But that is wrong.

Thomas’ eight colleagues have the tools to protect the court’s integrity: They can publicly censure him, bar him from being the decisive vote in cases in which he should have recused, and take away his power to author majority opinions. Whether they will take action is a different story, which may explain why the court’s reputation is at a historic low.

But Thomas, who has long played fast and loose with recusal laws, has finally gone too far. The issue came to a head last month, when the Supreme Court refused to block the House committee investigating the Jan. 6 attack on the Capitol from obtaining Arizona GOP Chair Kelli Ward’s phone records. In January 2021, Ward had orchestrated an alternative slate of electors (which included herself) in an effort to subvert the election of Joe Biden as president. Thomas participated in the court’s decision, casting a dissenting vote, even though his wife was intimately involved in these events.

Chances are you heard nothing about this. That’s because the decision was part of the court’s “shadow docket”—orders issued without hearing or written decision—and so it garnered little public attention.

But it should have, because Thomas’ participation in the case was a flagrant violation of the federal law requiring recusal from cases in which it is “known by the judge” that his spouse “ha[s] an interest that could be substantially affected by the outcome.” His vote also transgressed that statute’s broader provision requiring disqualification in “any proceeding in which [a judge’s] impartiality might reasonably be questioned.”

Ginni Thomas’ connection to the case is not in question. She has actively tried to overturn Biden’s election in Arizona and other states. In December 2020, Ginni Thomas sent letters to 29 Arizona lawmakers urging them to “fight back against fraud” and select a “clean slate of Electors” after Biden won the election. She also sent numerous text messages to President Trump’s chief of staff demanding he overturn the election, and attended the rally on the Ellipse on Jan. 6, though she left before the attack on the Capitol. This past September, the Jan. 6 committee subpoenaed and interviewed Ginni Thomas, and she repeated then her unfounded belief that the 2020 presidential election was stolen.

Without question, Ginni Thomas has an “interest that could be substantially affected by the outcome” of the Jan. 6 committee’s subpoena of Ward’s phone records. Also, without question, Justice Thomas knew it when he cast his dissenting vote to bar disclosure.

The eight other justices know it, too. Yet so far, they have done nothing about a fellow justice’s blatant violation of a federal law designed to protect the integrity of the court on which they serve. Understandably, the justices are reluctant to police their colleagues. But Justice Thomas’ extraordinary conduct calls for an extraordinary response.

Democrats were projected to retain control of the Senate on Saturday, clinching a narrow majority as they showed strength in battleground races in a daunting midterm year that handed President Biden a major victory as he looks to his next two years in office.

The final blow to Republican hopes of retaking the chamber came in Nevada, where on Saturday Sen. Catherine Cortez Masto (D) was projected to win reelection, edging past Adam Laxalt (R), a former state attorney general. Cortez Masto’s projected win ensures Democrats a 50th seat, with a runoff election still to come in Georgia on Dec. 6. Vice President Harris is empowered to cast tiebreaking votes in the Senate.

Control of the House was still up in the air on Saturday, as vote counting continued days after an election in which Democrats overperformed expectations in many contested areas across the country. Democratic control of the Senate dashes GOP hopes of a full takeover on Capitol Hill.

That’s welcome news for Biden, who was staring down the possibility of humbling defeats as the election neared. Now, the Senate, which oversees the confirmation of executive branch personnel and federal judges, will stay in his party’s corner. A Senate majority will also give the president and his party more say over legislative debates on domestic and foreign spending and other major issues.

Senate Majority Leader Charles E. Schumer (D-N.Y.) called the results a “vindication” for Democrats and their agenda, and said Republicans had turned off voters with extremism and “negativity,” including some candidates’ false insistence that the 2020 election had been stolen. “America showed that we believed in our democracy,” he told reporters in New York, while praising the quality of Democratic incumbents.

Cortez Masto announced she would deliver a victory speech on Sunday.

In Nevada, Cortez Masto’s win was part of a perfect record so far by incumbent senators seeking reelection in the midterms, as voters tilted strongly against upending the established order in the chamber. It was part of a strong showing by Democrats in battleground areas where Republicans fell short after emphasizing rising prices and concerns about crime during an era of one-party control in Washington.

Importantly, Biden & Sen. Chuck Schumer will retain authority to appoint better qualified, progressive, Federal Judges from diverse backgrounds, schools, and experiences to counteract the toxic influx of poorly qualified far-right jurists, many ideologues hand-picked by the Federalist Society and the Heritage Foundation for their extremist, anti-democracy, far right views that threaten the credibility and the legitimacy of the Federal Judiciary. 

Biden’s & Schumer’s attention and success at timely appointing and advancing exceptionally well-qualified Article III judges whose views support and advance the rule of law, equal justice for all, and reasonable legal interpretations has been one of the “under the radar” success stories of his first two years. For once, if perhaps a little late in the game, the Dems have treated Federal Judicial appointments with the same urgency, strategic thinking, and determination to fundamentally reshape the judiciary as the GOP!

If only Garland had paid the same attention to reforming, improving, and reshaping the Immigration Judiciary to make expertise, due process, fundamental fairness, and best judicial practices paramount after four years of highly questionable judicial appointments and “packing” of the BIA  by Sessions and Barr in support of their nativist, anti-immigrant agenda!

Senator Cortez Masto’s victory also saves America from another round of Sen. Mitch McConnell (R-TN) as majority leader. Additionally, it’s a well-deserved setback for arrogant GOP Senate campaign honcho Rick Scott (R-FL) — a guy whose idea of America is to block all progress, steal from the poor, give to the rich, and never give an honest answer.

All and all, it’s a good night for American democracy, although the narrowness of Dem victories despite the obvious superiority of Dem candidates should serve as a warning sign that our nation is not out of the “far-right woods” by any means. Next, it remains critically important for the Dems to re-elect Sen. Raphael Warnock (D-GA, an outstanding and articulate spokesperson for democratic values over the spectacularly incoherent and unqualified Trump-backed GOP challenger Herschel Walker in December’s Georgia runoff. A one-vote “cushion” is critical in the event of death or incapacity of any of the Dem Senators.

Importantly, voters across America rejected every corrupt Trump election denier running on the GOP ticket for positions that would have given them control over state elections.

As MAGA thugs are wont to do, their reaction to the lawful search at former president Donald Trump’s Mar-a-Lago home, which we now know might have been related to nuclear secrets (which Trump has denied), amounted to an stream of insults and threats designed to whip up unhinged, violent characters.

While the exact motives of the person who attacked FBI offices in Cincinnati on Thursday remain unknown, reports indicate he was in D.C. in the days leading up the Jan. 6 insurrection and might have been at the U.S. Capitol that day. The GOP’s cycle of incitement and violence continues.

FBI Director Christopher A. Wray was properly outraged. “Unfounded attacks on the integrity of the FBI erode respect for the rule of law and are a grave disservice to the men and women who sacrifice so much to protect others,” he said in a written statement on Thursday. “Violence and threats against law enforcement, including the FBI, are dangerous and should be deeply concerning to all Americans. Every day I see the men and women of the FBI doing their jobs professionally and with rigor, objectivity, and a fierce commitment to our mission of protecting the American people and upholding the Constitution. I am proud to serve alongside them.”

Much has been made of the ensuing polarization in our politics, and it’s true that moderates are a vanishing breed. But the problem isn’t primarily polarization. The problem is that one of our two major political parties has ceased good-faith participation in the democratic process. Of course, there are instances of violence, disinformation, racism and corruption among Democrats and the political left, but the scale isn’t at all comparable. Only one party fomented a bloody insurrection and even after that voted in large numbers (139 House Republicans, a two-thirds majority) to overturn the will of the voters in the 2020 election. Only one party promotes a web of conspiracy theories in place of facts. Only one party is trying to restrict voting and discredit elections. Only one party is stoking fear of minorities and immigrants.

Admittedly, I’m partisan — not for Democrats but for democrats. Republicans have become an authoritarian faction fighting democracy — and there’s a perfectly logical reason for this: Democracy is working against Republicans. In the eight presidential contests since 1988, the GOP candidate has won a majority of the popular vote only once, in 2004. As the United States approaches majority-minority status (the White population, 76 percent of the country in 1990, is now 58 percent and will drop below 50 percent around 2045), Republicans have become the voice of White people, particularly those without college degrees, who fear the loss of their way of life in a multicultural America. White grievance and White fear drive Republican identity more than any other factor — and in turn drive the tribalism and dysfunction in the U.S. political system.

Other factors sped the party’s turn toward nihilism: Concurrent with the rise of Gingrich was the ascent of conservative talk radio, followed by the triumph of Fox News, followed by the advent of social media. Combined, they created a media environment that allows Republican politicians and their voters to seal themselves in an echo chamber of “alternative facts.” Globally, south-to-north migration has ignited nationalist movements around the world and created a new era of autocrats. The disappearance of the Greatest Generation, tempered by war, brought to power a new generation of culture warriors.

But the biggest cause is race. The parties re-sorted themselves after the epochal changes of the 1960s, which expanded civil rights, voting rights and immigration. Richard Nixon’s “Southern Strategy” began an appeal to White voters alienated by racial progress, and, in the years that followed, a new generation of Republicans took that racist undertone and made it the melody.

It is crucial to understand that Donald Trump didn’t create this noxious environment. He isn’t some hideous, orange Venus emerging from the half-shell. Rather, he is a brilliant opportunist; he saw the direction the Republican Party was taking and the appetites it was stoking. The onetime pro-choice advocate of universal health care reinvented himself to give Republicans what they wanted. Because Trump is merely a reflection of the sickness in the GOP, the problem won’t go away when he does.

The question I get asked the most as someone who went from being a Republican to a Democrat is: “What’s the biggest difference between the two parties?”

The answer: Every impulse Democrats have is defensive and every impulse Republicans have is offensive.

A report in the Washington Post this week showed these dynamics at play perfectly between Democrats and Republicans on the House Jan. 6 select committee. As the Post described, Democratic Rep. Stephanie Murphy (Fla.) insisted that the committee focus less on former President Trump and more on the security and intelligence failures that allowed the attack on the Capitol. In response, Republican Vice Chair Liz Cheney (Wyo.) argued that the committee should keep its focus on the former president.

This is the best illustration I have come across that demonstrates how different Republicans and Democrats approach things on a tactical and, I’d say, cellular level.

When Republicans have the reins of power, they do not hesitate to go after the very top. From Barack Obama’s birth certificate to Hillary Clinton’s emails and potentially Hunter Biden’s laptop, the GOP is unapologetic about pursuing witch hunts for political gain.

Democrats, on the other hand, are always pursuing lines of legitimate oversight reluctantly. At times, it feels like they are apologizing for doing the right thing.

I think back to Trump’s first impeachment and the hesitant posture displayed by the Democrats during those proceedings. It was almost as if they were forced into it, regretted that it came to this, and moved as fast as possible to get it over with.

Democrats controlled the House majority but never forced Trump administration officials with firsthand knowledge of the events that were at the center of the impeachment inquiry to testify, such as John Bolton, Mick Mulvaney or Rick Perry, and the Republican-controlled Senate predictably torpedoed any effort to compel them to testify.

History repeated itself during Trump’s second impeachment as firsthand witnesses like Mike Pence, Mark Meadows, Jared Kushner, Ivanka Trump, Rudolph W. Giuliani, etc., were never called to testify. Hillary Clinton, of course, was grilled by the Republican-led Benghazi committee for more than 11 hours.

It’s almost as if Democrats believe there is some prize awaiting them for showing what they would characterize as restraint. There isn’t.

This has been obvious in the Dems’ feckless approach to Immigration, and particularly the Immigration Courts, over the years. 

Without enacting any significant legislation, the GOP instituted an overtly racist/nativist/restrictionist program. They negated existing laws, scorned the Constitution, abrogated log-standing international agreements, and aggressively and blatantly stacked the Federal Judiciary at all levels with far-right zealots. And they have gotten away with it!

Yet, even after successfully running on programs promising a restoration of the rule of law and the Constitution in immigration and human rights, Dems have been from feckless, to timid, to complicit in the GOP’s vile programs. 

The GOP did not hesitate to “stack” the Immigration Court system at all levels with questionably qualified judges who lacked perspective, expertise, and a commitment to due process. The result was a dramatic plunge in the grant rates for asylum seekers, even though conditions in the primary sending countries have continued to worsen dramatically over the years. 

No justification for what the GOP did, and no hesitation or self-doubts about doing it! Amid tons of criticism, they just plowed ahead and did it! They “played to the most extreme elements of their base” — nobody else! They weren’t scared to take extreme actions that most polls showed the majority of American’s didn’t favor!

By contrast, the Dems approach to immigration and human rights policy is a complete mess. And, worst of all, the Immigration Courts and EOIR remain largely as the Trump regime left them. Indeed, the backlog is growing at an astounding rate, as Garland flails and fails to bring on board the “best and brightest” judges and intellectual leaders to reform EOIR into the due-process oriented “model judiciary” that it was once intended to be!

Our View: ‘Great replacement’ lie runs deep in Republican politics

Party leaders tolerate radical anti-immigrant ideology, even as it motivates racist massacres like last weekend’s mass shooting in Buffalo.

After other racist massacres, we have asked Republican leaders to repudiate this false and dangerous ideology that is taking root in their party and shun anyone who traffics in it. But they never have, and we don’t expect them to do so now. The state party has attempted to appear more friendly to immigrants this year, opening a “Multicultural Center” in Portland. But the party showed no sign of separating itself from anti-immigration figures like Lockman at the recent party convention.

Apparently, the party needs the white-power extremists, just as it needs anti-immigrant, anti-transgender, anti-vaccination and QAnon elements, who may make up only a minority of the electorate but who provide the party with its energy and enthusiasm at election time.

We expect that Republican Party leaders, candidates and officeholders– who know that there is no such thing as a “great replacement” – will continue to keep their mouths shut about the extremists in their party so that they can ride their enthusiasm to control of Congress, the Blaine House and the state Legislature in November.

They are playing with fire, and we are all at risk.

“We are all at risk.” Certainly, that has been my message on “Courtside” since its inception in 2016!  

That’s why it was, and continues to be, such a tragedy for our democracy that Democrats, once in power, have failed to aggressively stand up for “immigrants’ rights, due process for all, and drastic, meaningful, Immigration Court reform.”

Immigrant justice = racial justice = equal justice for all. And, the path to equal justice for all begins in the now disgracefully dysfunctional (but potentially due-process-enhancing) U.S. Immigration Courts where aggressive reforms and progressive judges in positions to “make a difference” are long overdue.

Often, the view is “clearer” from up here in Maine!

Critics were stunned Saturday after Supreme Court Justice Clarence Thomas scolded Americans for not accepting controversial rulings — after his own wife battled against the results of a legitimate presidential election.

Thomas chided a distraught public in comments Friday at a judicial conference in Atlanta following the leak of a draft Supreme Court opinion that would gut Roe v. Wade and a half-century of the right to an abortion.

He complained that Americans are “addicted” to results they want — while “not living with” rulings they oppose. He warned that the court will not be “bullied” in the face of protest. Declining respect for the law and institutions, Thomas warned, “bodes ill for a free society.”

Thomas detractors were agog. Not only has his wife, Virginia “Ginni” Thomas, refused to “live with” the presidential election, he was the sole Supreme Court justice to vote that former President Donald Trump should not have to release his White House documents to the House committee investigating last year’s insurrection.

Thomas has also repeatedly attempted to rip up legal precedence set by the court.

“The irony is so thick you wonder if it’s maybe a Clarence Thomas impersonator,” former U.S. Attorney Harry Litman said on MSNBC Saturday.

“Among other things, this is a guy who has spent a lifetime trying to take a battering ram to all the Supreme Court major precedents” of law, Litman added. “He’s now saying people don’t respect the law enough. That’s even leaving aside all the controversies he has engendered, as has his wife. It’s just … remarkable.”

The issue is whether an in absentia removal order can be based on a statutorily defective notice. The panel followed the Supreme’s decision in Niz-Chavez and rejected the BIA’s conflicting decision in Matter of Laparra. In other words, the panel required the Government to follow the statute, a process known as “complying with the law.” This sent some of this most conservative circuit’s most far-right judges over the edge.   • Credit Dan Kowalski over at LexisNexis for the “food fight” characterization.
  • The scofflaw GOP dissenters cited “deference” to the Executive, something they have pointedly refused to apply to Biden Administration precedents and policies favoring migrants. 
  • The majority says: “[The BIA] flies in the face of the Supreme Court’s Pereira decision, which Laparra ignored.” 
  • Incredibly, Garland is on the “wrong side” of this controversy, defending the legally incorrect misinterpretation of his “Trump holdover” BIA!
  • The statutory requirement at issue: That a “Notice to Appear” before the Immigration Court inform the individual of the time and place of the hearing. How difficult does that sound? Not very, unless you are bumbling bureaucrat at DHS and EOIR who chose, even after the Supremes’ initial decision, to  violate that decision and the statute in almost 100% of the cases instituted before the Immigration Courts! 
  • Kudos to the 3 Trump appointees and one Bush II appointee who joined 3 Obama appointees and 2 Clinton appointees to uphold the rule of law and thwart their GOP scofflaw colleagues.
  • Interestingly, and perhaps mildly encouraging, the “Trump appointees” split 3-3 on this one.
  • Apparently nothing drives a wedge between conservative judges like the scary prospect of following the law when it gives immigrants a win!
  • Future ambitious academic study: How much of the current out of control backlog can be traced to the Government’s, and particularly the BIA’s, inept handling of straightforward notice requirements set forth in the statute?
  • There’s a reason why I keep referring to Garland’s out of control EOIR backlogs as “largely self-created,” albeit in fairness not exclusively by him. The Trump Administration, and to a lesser extent the Obama Administration, also “excelled” at “Aimless Docket Reshuffling” driven by “prioritizing” improper political goals over due process, fundamental fairness, quality, and practical scholarship in the Immigration Courts.

EAD Rules Fully Vacated

NIJC: On Friday (4/8) we learned from the government that it would not file an appeal in AsylumWorks v. Mayorkas.  This means, happily, that the EAD Rules that delayed and in some cases denied access to EADs for asylum seekers are fully vacated.  The vacatur applies to both the 30-day adjudication rule and the larger rule that had more than a dozen changes to EAD eligibility for asylum seekers.

 

NY EOIR Asks ICE to Submit PD Stance 3 Days Before Hearings

EOIR: In an effort to reduce our interpreter non-usage and our continuance rates, the New York – Federal Plaza Immigration Court has asked DHS that PD positions be provided to the court on matters scheduled for a hearing at least three days before the hearing. This would allow cancellation of the interpreter order without cost to the court, and would permit another previously scheduled case to be advanced into the open hearing slot. In addition, the court is endeavoring to identify cases already scheduled which are likely to be granted PD based upon DHS guidelines. We have requested DHS’s assistance in this endeavor. [It is unclear whether other courts will request the same.]

NYT: The C.D.C. finally announced at the beginning of April that it would lift its public health border restrictions on May 23, around the time of the year when migration typically increases. But this past week, the issue of Title 42 flared up again as Senate Republicans and some Democrats in Congress held up Covid funding in an effort to protest the administration’s decision to lift the health rule and tensions over the issue flared in both parties. Senators to restart bipartisan immigration reform talks

Hill: Sens. Thom Tillis (R-N.C.) and Dick Durbin (D-Ill.) told The Hill that they want to bring together a group of senators interested in trying to revive immigration discussions — a perennial policy white whale for Congress — after a two-week recess.

 

Immigrant rights groups say ICE’s no visitation policy taking toll on detainees’ mental health

NPR: Visitations at federal and state prisons have largely resumed. Last year, for example, the Washington state Department of Corrections determined it was safe to reinstate visitations. But those who want to talk to loved ones in ICE detention must still rely on old-fashioned phone calls or video.

 

As Haitian migration routes change, compassion is tested in Florida Keys

WaPo: Although the Florida Keys have been an entry point for refugees fleeing communist Cuba since the 1960s, officials say the increase in arrivals of migrants by boat represents a shift in migration patterns. Since the start of the year, more than 800 Haitians have landed in the 113-mile-long Florida Keys, made up 1,700 small islands. Two of the landings occurred in Ocean Reef, an exclusive gated community near Key Largo that is home to some of nation’s wealthiest residents, officials said.

CA2 blocks disclosure of docs on immigrant terrorist screenings

Reuters: U.S. appeals court on Wednesday said federal agencies properly withheld documents related to how they vet applicants for immigration benefits with the aim of uncovering possible terrorist ties, reversing a judge who ordered their disclosure.

 

3rd Circ. Says India Native’s Persecution Claims Inconsistent

Law360: The Third Circuit declined to halt the deportation of a man from India claiming he suffered political persecution there, reasoning that the immigration judge was correctly skeptical of his inconsistent accounts of the violence he claimed to have experienced.

 

CA5 on Unable or Unwilling to Control Persecutors

CA5: [W]hether an applicant’s subjective belief that authorities would be unwilling or unable to help them is sufficient for asylum eligibility when paired with country condition evidence supporting that belief, notwithstanding that the underlying events do not support that conclusion. We think not… When  she checked in, the police informed her “that the process would take at least two weeks.” She fled before those two weeks expired, and there is no evidence of  what  happened  with  the  claim.  Thus,  the  evidence  supports  the  BIA’s  finding  that  Sanchez-Amador  “successfully  reported  one  incident  with  the  gang member to the police, but did not pursue the issue.”

 

CA5 Equitable Tolling Remand: Boch-Saban V. Garland

LexisNexis: “Petitioner Jose Santos Boch-Saban, a citizen of Guatemala, seeks review of a Board of Immigration Appeals decision dismissing, as untimely, his appeal of an immigration judge’s order denying, as time and number barred, his motion to reopen and dismiss. We VACATE the Board’s decision and REMAND the case for consideration in the first instance of the issue of equitable tolling.”

 

Al Otro Lado Class Action Notice of Preliminary Injunction

DHS: Al Otro Lado v. Mayorkas is a lawsuit that relates to the U.S. government’s use of “metering” at land  ports  of  entry  on  the  U.S.-Mexico  border.    The  Court  in  this  lawsuit  issued a Preliminary Injunction(PI) prohibiting the U.S. government from applying a rule known as the “third-country transit rule”(TCT)to certain people who were subject to “metering” before the rule took effect on July 16, 2019.

 

Pennsylvania State Police settle profiling, immigration suit

AP: Pennsylvania State Police settled a federal lawsuit alleging troopers routinely and improperly tried to enforce federal immigration law by pulling over Hispanic motorists on the basis of how they looked and detaining those suspected of being in the U.S. illegally, officials announced Wednesday.

 

11 Set Up Hundreds of Sham Marriages for Green Card Seekers, U.S. Says

NYT: Clients paid fees up to $30,000 as part of the yearslong scheme, an affidavit said. Some applications falsely claimed the clients had been abused by their spouses, prosecutors said.

 

San Antonio To Pay Texas $300K To End ‘Sanctuary City’ Fight

Law360: The city of San Antonio, Texas, has agreed to pay the state $300,000 to settle both allegations lodged by the state’s attorney general that it was violating the state’s “anti-sanctuary city law,” and a subsequent lawsuit seeking to remove the police chief from office for the alleged violations.

 

Banned Travelers Ask Judge To Revisit Dead Visa Applications

Law360: People who were banned from the U.S. under now-defunct Trump-era travel restrictions urged a California federal judge to order the Biden administration to revisit their denied visa applications, saying the administration’s attempts to redress the harm don’t go far enough.

 

Feds Keep Diversity Visa Order Paused, But Must Update Tech

Law360: A D.C. federal judge extended the stay of his order directing the State Department to issue more than 9,000 diversity visas while the Biden administration appeals to the D.C. Circuit, but he unfroze his directive for the department to update the technology for processing the visas.

 

House Committee Advances Bill Slashing Visa Country Caps

CDC Provides Public Health Determination and Order on Termination of Title 42

AILA: On 4/1/22, CDC released an order to terminate its Title 42 public health order on 5/23/22. The document assesses the current state of the COVID-19 pandemic, provides legal considerations, and describes plans for DHS to mitigate COVID-19 and resume use of Title 8. (87 FR 19941, 4/6/22)

 

CBP Issues Memo on Title 42 Exceptions for Ukrainian Nationals

AILA: On 3/11/22, CBP issued a memo to its Office of Field Operations stating that noncitizens in possession of a valid Ukrainian passport or other valid Ukrainian identity document, and absent national security or public safety risk factors, may be considered for exception from Title 42.

 

USCIS Extends EADs for Certain TPS Syria Beneficiaries

AILA: USCIS is issuing individual notices to certain TPS Syria beneficiaries whose applications to renew Form I-766 are pending. The notices extend the validity of their EADs until September 24, 2022. Guidance on filing Form I-9 is available.

 

DHS/CBP/PIA-072 Unified Immigration Portal (UIP)

DHS: The U.S. Customs and Border Protection (CBP) Unified Immigration Portal (UIP) provides agencies involved in the immigration process a means to view and access certain information from each of the respective agencies from a single portal in near real time (as the information is entered into the source systems). CBP is publishing this Privacy Impact Assessment (PIA) to provide notice of implementation of the UIP and assess the privacy risks and mitigations for the UIP.

 

USCIS Implements Risk-Based Approach for Conditional Permanent Resident Interviews

USCIS: U.S. Citizenship and Immigration Services (USCIS) today announced a policy update to adopt a risk-based approach when waiving interviews for conditional permanent residents (CPR) who have filed a petition to remove the conditions on their permanent resident status.

Sanchez-Amador v. Garland — The 5th Circuit Goes Off The Rails Again To Threaten Refugee Women of Color!

The issue in Sanchez-Amador is whether a reasonable person in her position would believe that the Government of Honduras is “unwilling or unable” to protect her. On the facts set forth in the court’s decision, any reasonable person in her position would hold such a objectively reasonable view. Therefore asylum should have been granted.

For some context, Honduras has one of the highest femicide rates in the world. Indeed, it is “one of the most dangerous places in the world to be a woman.” See, e.g., https://news.sky.com/story/the-most-dangerous-place-in-the-world-to-be-a-woman-11950981

The Honduran Government is so totally corrupt, inept, and disinterested in protecting its citizens, particularly women, that recent past “President Juan Orlando Hernandez [is] on the United States’ Corrupt and Undemocratic Actors list, under Section 353 of the United States–Northern Triangle Enhanced Engagement Act.” https://www.state.gov/u-s-actions-against-former-honduran-president-juan-orlando-hernandez-for-corruption/

Ricardo Zuniga, the U.S. Special Envoy to Central America recently said: “‘All we’re trying to do now is halt the slide’ of democracy and accountability, Zúniga said in an interview with The [L.A.] Times, ‘so that we can have some place to build from.’” https://apple.news/A9FpzsjRAQ2OoAyQZzHZm1A. 

In other words, any a semblance of the rule of law and honest, minimally effective government in the Northern Triangle has long disappeared. Conditions are rapidly getting worse, rather than better. Conditions are so bad, that a better Administration or a better BIA could probably establish a “rebuttable presumption of failure of state protection in the Northern Triangle,” thus properly shifting to the DHS the burden of establishing, against all odds, that “state protection” against gangs and other basically uncontrolled third-party actors would actually be effective in a particular case.

This common sense action would also facilitate rapid, efficient, consistent, and correct approval of many credible, valid asylum claims now stuck in the endless, largely self-inflicted, backlogs at the Asylum Office and in Garland’s dysfunctional courts, not to mention at the border following two years of illegal suspension of our asylum laws. That’s as opposed to the unseemly “Institutionalized Refugee Roulette” now being played by Garland and his subordinates.

According to the Supremes in Cardoza-Fonseca and the BIA itself in Matter of Mogharrabi, asylum law is supposed to be generously applied to grant protection even where persecution, although reasonably possible, is significantly less than likely. But, in Garland’s dysfunctional “courts,” the current reality for vulnerable asylum seekers has moved far, far away from those supposed “norms.”

Although most asylum applicants come from nations with well-established records of serious endemic human rights abuses, “asylum denial rates” at EOIR range from 10% or less to a beyond outrageous 98% or more denials! Cases with basically the same facts might be routinely granted in one courtroom while being uniformly denied, usually for specious reasons, in the next.

Moreover, while the overall nationwide grant rate of around 37% appears unreasonably low but perhaps still within the outer bounds of “plausibility,” most of those grants are “concentrated” in a relatively small number of Immigration Courts, basically in the Northeast and in California. A disturbing number of IJs and courts are allowed, perhaps even encouraged, by Garland and his denial-oriented, Trump-holdover BIA to establish “asylum free zones.” In other words, Garland has looked the other way while some of “his courts” have basically become de facto “asylum death squads.”

Back to Ms. Sanchez-Amador. Under the circumstances shown by Ms. Sanchez-Amador, a “reasonable woman” would not expect any effective protection from the Honduran Government. The respondent has shown that her “expectation of no protection” was “fulfilled” in this case.

The respondent credibly testified that a gang member said she had a week to either pay him money or become “his woman,” join the gang, and have involuntary sex with him, that is, he threatened to rape her. When she dutifully reported this to the police (despite their well-deserved reputation for indifference to attacks on women), she was told that they would investigate but that it would take two weeks, and offered her no other protection or options in the interim.

In other words, in response to an imminent, credible threat of harm, the police told the respondent that they would do nothing to stop the harm that would be inflicted upon her in a week. By the time the police “investigated,” assuming they ever did which seems doubtful in light of conditions in Honduras, the respondent would be either extorted or raped and forced to join a gang against her will. While police in Honduras might have a well-deserved reputation for corruption and ineffectiveness, gangs, on the other hand, have a reputation for being ready, willing, and able to carry out their threats against women, usually with impunity.

Elementary asylum law tells us that it is neither reasonable nor required that a refugee wait to actually be persecuted before fleeing to safety. That’s exactly what a “well-founded fear” is!

Yet a panel of male, right-wing judges of the Fifth Circuit nonsensically and disingenuously concludes that “one would be hard-pressed to find that the authorities were unable or unwilling to help her [because] she never gave them the opportunity to do so.” Poppycock! 

The police failed to offer the respondent any semblance of effective protection. Given the conditions in Honduras, and the credible threats the respondent had received, a reasonable woman in the respondent’s position would flee to safety at the first opportunity rather than waiting for the gang to carry out its credible threat of harm and for the police to, perhaps, but likely not, investigate after the fact!

Indeed, it’s no stretch to say that under the facts of this case, NO reasonable woman would have remained in Honduras if able to escape.  Moreover, NO reasonable factfinder would conclude that she lacked a reasonable possibility of persecution there!

The panel judges have perverted, perhaps intentionally, the criteria for asylum, the standard for review, and misconstrued the record to deny legal protection to this refugee woman. But, there is an even deeper problem here. And, it goes to Attorney General Garland and his mismanagement of the entire, broken Immigration Court system.

I daresay that NO asylum expert would have handled this potentially perfectly grantable case the way this Immigration Judge and the BIA did. This whole process documents an ongoing, biased, unprofessional, designed-to-deny asylum system that unfairly attacks and threatens “the most vulnerable among us” — targeting women of color in a particularly racist-misogynistic way!

I hope that this particular example of injustice, inhumanity, and unprofessionalism at all levels of the judiciary isn’t what awaits long suffering asylum seekers if and when the Administration finally lifts the illegal “Title 42 Blockade/Charade” on May 23. But, I have little reason for optimism. 

Beyond long overdue reversals of several Sessions/Barr bogus anti-asylum, anti-immigrant “precedents,” neither Garland or Mayorkas has shown much inclination to actually get asylum law right. Nor have they empowered or employed the human rights and due process experts who could lead them out of the wilderness in which their entire “denial and deterrence-oriented” system now wanders.

Perhaps ironically, the all-too-often lawless Fifth Circuit refuses to acknowledge even those modest actions by Garland to correct the law, notwithstanding the supposed “great deference” they claim to show the Executive in the area of immigration. Like much that the Fifth Circuit does these days, that “deference” appears reserved for White men and is not applied to vindicate the rights of “persons” who happen to be migrants, women, or people of color.

“Dred Scottification” of “the other” is NOT a legitimate legal theory. No, it’s part of the “anti-democracy activism” that threatens to destroy our legal system and take our nation down with it! ☠️

In real time, Barr jettisoned Justice Department norms and authorized the department to open election-fraud investigations before the tallies were certified. Barr, who had falsely asserted that mail-in voting was vulnerable to counterfeit foreign ballots, did allow at one point that the Justice Department hadn’t found enough fraud to change the election outcome — “to date.” But his sycophantic departure letter (“you built the strongest and most resilient economy in American history”) said “these allegations will continue to be pursued.”

Had Barr spoken out publicly about Trump’s “clown show,” perhaps he could have punctured the “big lie” before it resulted in the Jan. 6 insurrection. Barr didn’t even speak out during Trump’s impeachment, instead offering his self-serving view 14 months later while hawking his book — after Trump managed to get the bulk of the Republican electorate to accept the “big lie” as an article of faith.

Barr is just the latest in the parade of former Trump officials to wash their hands of him long after their public condemnation would have done any good: John Bolton, John F. Kelly, Rex Tillerson, Jim Mattis, Reince Priebus, Nikki Haley, Gary Cohn, Omarosa Manigault Newman, Michael Cohen, Anthony Scaramucci, H.R. McMaster and many more.

But nobody in the administration did more to enable Trump’s deceptions and assaults on democracy than Barr. He buried the Mueller report while issuing a public summary that misrepresented it; he alleged the Obama administration “spied” on the Trump campaign, and he appointed a prosecutor who is, years later, still trying to prove true Trump’s paranoid fantasy; he scoured the world for evidence to discredit the Trump-Russia probe; his Justice Department gave credibility to Rudy Giuliani’s ravings about the Bidens in Ukraine; he tried to give favorable treatment to Trump cronies Michael Flynn and Roger Stone; he justified the violent assault on peaceful demonstrators in Lafayette Square; he made unfounded allegations against “antifa” and assembled a militia-like force of often-unidentified federal police in D.C. And on, and on.

Now Barr wants to be remembered as the brave figure who spoke truth to power? Talk about a clown show.

There were plenty of folks @ DOJ who “went along to get along” with the Sessions/Barr radical right-wing scheme to deconstruct justice with a series of lies, racially charged false narratives, questionable, arguably frivolous, presentations to Federal Courts, use of pretexts, discrediting of civil rights and free and fair elections, and undermining or outright violations of both domestic laws and international conventions protecting the human rights of migrants.

Others were installed or promoted within Justice because of their actual or perceived willingness to run over the law, truth, and often human dignity, to further the far-right agenda. In other words, they would elevate loyalty to the Trump agenda over their duty to the U.S.  Constitution!

What, exactly, has AG Garland done to “clean house”🧹 and restore the rule of law, Government ethics, fundamental fairness, and due process for migrants? Good question!🤨

In the meantime, notwithstanding his pathetic, outrageous, disingenuous, attempt at rehabilitation “BTB” Barr should go down in history as exactly the divisive, dishonest, neo-fascist, theocrat sleaze-ball that he is!🤮

And, Garland will be judged by what he does to reject and reform the mess @ Justice left by his predecessors. In that respect, “Miller Lite” won’t do it.

Every year, on the third Monday in January, America hosts a Sadie Hawkins-style role-reversal where the entire country pretends to celebrate a man whose achievements and values they spent the previous 364 days ignoring, demonizing and trying to dismantle. Today, your favorite vote suppressors will take a brief respite from disenfranchising Black voters, denying history and increasing inequality to celebrate a real American hero.

That’s right, it’s MLK Day!

You might think it’s a little disrespectful to refer to a great American hero by his initials but, in this specific case, it’s perfectly fine. The actual Martin Luther King Jr who lived and breathed is not the man most people will be honoring today because that Martin Luther King is dead and gone. No, the man upon whom they will heap their performative praise with social media virtue-signaling is MLK, a caricature of a man whose likeness has been made palatable for white consumption. Like BLM, CRT and USA, the people who King fought against have now managed to flatten a three-dimensional symbol to a three-letter, chant-worthy phrase worthy of demonization or deification.

Although, in death, he became one of the most revered figures in US history, for the entirety of the 39 years that King lived and breathed, there wasn’t a single day when the majority of white Americans approved of him. In 1966, Gallup measured his approval rating at 32% positive and 63% negative. That same year, a December Harris poll found that 50% of whites felt King was “hurting the negro cause of civil rights” while only 36% felt he was helping. By the time he died in 1968, three out of four white Americans disapproved of him. In the wake of his assassination, 31% of the country felt that he “brought it on himself”.

One does not have to reach back into the historical archives to explain why King was so despised. The sentiments that made him a villain are still prevalent in America today. When he was alive, King was a walking, talking example of everything this country despises about the quest for Black liberation. He railed against police brutality. He reminded the country of its racist past. He scolded the powers that be for income inequality and systemic racism. Not only did he condemn the openly racist opponents of equality, he reminded the legions of whites who were willing to sit idly by while their fellow countrymen were oppressed that they were also oppressors. “He who passively accepts evil is as much involved in it as he who helps to perpetrate it,” King said. “He who accepts evil without protesting against it is really cooperating with it.”

“The first thing I would like to mention is that there must be a recognition on the part of everybody in this nation that America is still a racist country,” said King days before a white supremacist put a bullet in his face. “Now however unpleasant that sounds, it is the truth. And we will never solve the problem of racism until there is a recognition of the fact that racism still stands at the center of so much of our nation and we must see racism for what it is.”

See how many times someone mentions that quote today.

Oh, wait … King made that speech at Grosse Pointe High School, where Michigan’s Republican-controlled House of Representatives recently passed an anti-CRT bill making it illegal to teach that the “United States is a fundamentally racist country”.

Never mind.

When the Trump administration wrenched migrant babies, toddlers and tweens from their parents as a means of frightening away prospective asylum seekers, it was guilty of emotionally torturing innocent children. Americans of every political leaning expressed revulsion toward the policy implemented in 2018, especially when it became clear that the government had kept no clear records linking parents with their children — in other words, no ready means to reunite the families.

President Biden, as a candidate and also once in office, made clear his own disgust at the so-called zero-tolerance policy, calling it “criminal.” He said, correctly, that it “violates every notion of who we are as a nation.”

Now the president, having explicitly endorsed government compensation that would address the suffering of separated migrant family members, has apparently had a change of heart — or political calculation. In mid-December, the Justice Department abruptly broke off negotiations aimed at a financial settlement with hundreds of affected families. Having condemned a policy that traumatized children and their parents, Mr. Biden now leads an administration fighting in court to deny recompense to those same families.

The government has no means of alleviating the trauma inflicted by the previous president’s egregious treatment of those families. That is particularly true as regards the children, whose torment has been described and documented by medical professionals, advocates and journalists. The babies and toddlers who didn’t recognize their own mothers when they were finally reunited; the depression; the fear of further separations, even brief ones — the human aftershocks of Donald Trump’s heartlessness will linger for years, and for lifetimes in some cases.

The administration compounds the hurt by breaking off negotiations on compensating victims. The government must be held accountable; compensation is the most potent and credible vehicle for achieving that.

Granted, there may be a political price to pay. Republicans had a field day blasting the White House after media reports this fall suggested the government might pay $450,000 to separated family members — a settlement that could amount to $1 billion if applied to the several thousand affected migrants. Mr. Biden, apparently unaware of the status of negotiations at that time, said the reports, first published in the Wall Street Journal, were “garbage.” He later backed away from that remark, saying he did not know how much money would be suitable but that some amount was certainly due.

Now, it seems, all bets are off. In the absence of a negotiated settlement, the government would enter into what would likely be years of costly litigation, in which Mr. Biden’s Justice Department would be in the awkward position of defending a policy that Mr. Biden himself — and most Americans — have condemned as evil. There is no predicting how individual judges or juries might react to documented accounts of harm done to children. No one should be surprised if some were to award enormous damages — conceivably in amounts that exceed the $450,000 contemplated in the now-stalled negotiations.

By walking away from the bargaining table, Mr. Biden has broken an explicit, repeated promise. Whatever the political calculus behind that decision, it is morally indefensible.

Garland fails to stand up for the rights of families of color — again. At the same time, he ties up resources on a frivolous DOJ defense of the indefensible!

“Replacement theory,” White Nationalism, and racism always have been and remain at the core of the GOP’s anti-democracy insurrection. It’s no coincidence that Trump’s plans to de-stabilize American democracy began with cowardly attacks on vulnerable migrants (enabled by a failed Supremes) and culminated in open insurrection.

The dots aren’t that hard to connect. But, Garland doesn’t seem to be able to do it!

If Garland can’t handle the “low hanging fruit” — like settling these cases and creating a progressive judiciary at EOIR who will stand up  for the rights of all persons while using expertise and “practical scholarship” to replace dysfunction with efficiency, his pledge to hold the January insurrectionists and their leaders accountable rings hollow!

For those who read the LA Times, there was a “spot on” letter to the editors today accurately characterizing Garland as the “Attorney General for different era.”

As I’ve noted before, this is NOT Ed Levi’s, Griffin Bell’s, or Ben Civiletti’s DOJ. It isn’t even Janet Reno’s DOJ. (I ought to  know, as I worked under each of the foregoing.)

It’s an organization that has become increasingly politicized over the last two decades (as it was during Watergate), and that allowed itself to be weaponized by Trump’s White Nationalist regime. EOIR, Executive Orders, and immigration litigation were perhaps the most obvious, but by no means the only, examples.

The government is finally taking the threat of far-right militia groups seriously. But the larger threat are the Republican legislators who continue to recklessly undermine democracy

One year ago, he was frantically barricading the doors to the House gallery to keep out the violent mob. Today, he calls the insurrection a “bold-faced lie” and likens the event to “a normal tourist visit”. The story of Andrew Clyde, who represents part of my – heavily gerrymandered – liberal college town in the House of Representatives, is the story of the Republican party in 2021. It shows a party that had the opportunity to break with the anti-democratic course under Donald Trump, but was too weak in ideology and leadership to do so, thereby presenting a fundamental threat to US democracy in 2022 and beyond.

Clyde is illustrative of another ongoing development, the slow but steady takeover of the Republican party by new, and often relatively young, Trump supporters. In 2015, when his massive gun store on the outskirts of town was still flying the old flag of Georgia, which includes the Confederate flag, he was a lone, open supporter of then-presidential candidate Trump, with several large pro-Trump and anti-“fake news” signs adorning his gun store. Five years later, Clyde was elected to the House of Representatives as part of a wave of Trump-supporting novices, mostly replacing Republicans who had supported President Trump more strategically than ideologically.

With his 180-degree turn about the 6 January insurrection, Clyde is back in line with the majority of the Republican base, as a recent UMass poll shows. After initial shock, and broad condemnation, Republicans have embraced the people who stormed the Capitol last year, primarily referring to the event as a “protest” (80%) and to the insurrectionists as “protesters” (62%), while blaming the Democratic party (30%), the Capitol police (23%), and the inevitable antifa (20%) for what happened. Unsurprisingly, the vast majority of Republicans (75%) believe the country should “move on” from 6 January, rather than learn from it. And although most don’t care either way, one-third of Republicans say they are more likely to vote for a candidate who refuses to denounce the insurrection.

The increased anti-democratic threat of the Republican party can also be seen in the tidal wave of voting restrictions proposed and passed in 2021. The Brennan Center for Justice counted a stunning 440 bills “with provisions that restrict voting access” introduced across all but one of the 50 US states, the highest number since the Center started tracking them 10 years ago. A total of 34 such laws were passed in 19 different states last year, and 88 bills in nine states are being carried over to the 2022 legislative term. Worryingly, Trump-backed Republicans who claim the 2020 election was stolen are running for secretary of state in various places where Trump unsuccessfully challenged the results.

At the same time, the Republican party has become increasingly united and naked in its extremism, which denies both the anti-democratic character of the 6 January attack and the legitimacy of Biden’s presidency, and is passing an unprecedented number of voter restriction bills in preparation for the 2022 midterms and 2024 presidential elections. As long as the White House mainly focuses on fighting “domestic violent extremism”, and largely ignores or minimizes the much more lethal threat to US democracy posed by non-violent extremists, the US will continue to move closer and closer to an authoritarian future.

If you are counting on AG Merrick Garland to “lead the charge” on establishing accountability, your optimism might be tempered by his own failure to “clean house” at DOJ and in particular by his failure to reform his wholly-owned Immigration Court system that was front and center in assisting and carrying out the Trump/Miller White Nationalist assault on the rule of law, primarily targeting individuals of color and the “world’s most vulnerable” seeking justice in our system.
