“The Supreme Court’s liberal justices dominated discussion Tuesday about the prolonged detention of immigrants facing deportation, expressing concern about the government holding noncitizens indefinitely without a hearing.

At issue for the court is whether immigrants slated for deportation have the right to a bail hearing and possible release after six months if they are not a flight risk and pose no danger to the public.

The conservative justices were less vocal but expressed skepticism about whether the court should be setting firm deadlines for hearings in immigration cases.

A lawyer for the Justice Department told the high court that noncitizens — whether documented or undocumented immigrants — have no constitutional right to be in the United States.

The justices were taking a second look at the issue after an evenly divided court could not reach a decision last term and scheduled the case for reargument. With Justice Neil M. Gorsuch having joined the bench since then, he could cast the deciding vote.

The case reached the high court after the U.S. Court of Appeals for the 9th Circuit ruled that immigrants fighting deportation are entitled to bond hearings if they have been held for more than six months. A lawyer for the American Civil Liberties Union, representing a group of noncitizens held for more than a year without a hearing, told the Supreme Court that the outcome of the case will affect thousands of people held in jaillike detention centers.

 

The outcome takes on heightened significance as President Trump has vowed to broadly increase immigration enforcement across the United States. Immigration arrests are up sharply since he took office in January, but deportations are down this year, in part because of a significant drop in illegal crossings on the southern border with Mexico.

The Supreme Court has previously held that undocumented immigrants are entitled to some form of due process when contesting their detention but also that “brief” detentions were allowed. Courts have interpreted those rulings in different ways, with the San Francisco-based 9th Circuit, for instance, requiring more procedural safeguards for those who would be held for months or even years.

The court’s liberals on Tuesday pressed Deputy Solicitor General Malcolm L. Stewart about why immigrants in detention centers are treated differently than criminal defendants, who automatically receive hearings to determine whether they remain locked up pending trial.

 

Justice Stephen G. Breyer noted that even a criminal suspect accused of “triple ax murders” is entitled to a bail hearing. “That to me is a little odd,” Breyer said, his voice rising.

Without time limits, Justice Sonia Sotomayor said, noncitizens languish in detention centers, sometimes for years. “That’s lawlessness,” she said.

During the previous argument last term, Justice Anthony M. Kennedy asserted that the constitutionality of the federal law was not at issue. But on Tuesday, he seemed more sympathetic to arguments in favor of a guaranteed timeline. He asked Stewart whether a lengthy delay because of a shortage of immigration judges was permissible and suggested that there should be a concretedeadline.

“Isn’t a bright line rule an easier way?” Kennedy asked.

Justice Elena Kagan followed up and asked whether a five-year backlog, for instance, was allowed. In response, Stewart said, an immigrant fighting deportation could always choose to return to his or her home country.

The six-month deadline that the 9th Circuit set applies to a wide range of immigrants, from people detained after entering the United States for the first time to longtime legal residents. The case was brought by Alejandro Rodriguez, a lawful permanent resident who came to the country as an infant. The Department of Homeland Security started removal proceedings because of a conviction for drug possession and an earlier conviction for joyriding.

It can be done by Congress or by regulation, Alito said. But, he asked, “Where does it say six months in the Constitution?”

The case is Jennings v. Rodriguez.

OK, let’s get to the heart of the disingenuous argument by the Solicitor General in behalf of DHS. A respondent is entitled to due process hearing before he or she can be removed from the United States. But, according to the Government, the respondent has no Constitutional right to be in the United States for that Constitutionally-required hearing. And, as we know, Immigration Courts have backlogs of over 600,000 cases, with hearings often taking four or more years to schedule.

The SG’s position doesn’t even pass then”straight face” test. But, that doesn’t necessarily mean that the majority of Justices won’t agree with it!

WHY IT’S IMPORTANT

With an estimated 10 to 11 million “undocumented migrants” currently in the U.S., hundreds of thousands of cases annually being added to the U.S. Immigration Courts’ already out of control docket of 630,000 cases, and the Trump Administration’s “gonzo” enforcement policy where line agents often arbitrarily decide which migrants to place in Immigration Court (presumably somewhat driven by the need to show “numbers” for budget and performance purposes), one thing is obvious: The system would collapse immediately if everyone apprehended by the DHS at the border and in the interior simply insisted on a full due process “Individual Merits” hearing. Thus, the migrants’s exercise of the Constitutional right to due process and a meaningful opportunity to be heard is the enemy of DHS’s out of control, “gonzo” enforcement.

So, what is DHS to do to suppress this dangerous exercise of constitutional rights? Here are DHS’s “strategies:”

  1. Avoid the hearing process entirely by using some form of “expedited removal” which avoids Immigration Court altogether;
  2. In absentia orders, often based on incomplete address information and inadequate warnings being given to migrants by DHS and/or on sloppy address recording and hearing notice procedures by DHS and EOIR resulting in individuals being clueless about their so-called “final orders” and therefore ill-equipped to exercise their statutory right to move for reopening;
  3. Coercive detention, used to demoralize, discourage, and duress migrants into “waiving” their due process rights and agreeing to depart without a merits hearing either by so-called “voluntary departure” or an uncontested final order.

Obviously, setting reasonable bonds that allow-income migrants can actually pay interferes with the full coerciveness of detention. Once released, migrants have a better chance of locating an attorney, filing a plausible application for relief, and ultimately being granted permission to stay. Therefore, resisting and “monkey wrenching” reasonable release on bonds is a key element of the current DHS “gonzo” enforcement strategy.

One of the ways that most fair U.S. Immigration Judges combat this is by using various “arbitration and mediation skills” to encourage DHS to accept reasonable bonds and waive appeal. But, as previously reported, counsel across the country report that DHS is refusing to negotiate bonds and appealing many of those set by the IJ. In other words, DHS is hoping that the coercive effect of detention will force folks to leave without a hearing before they run out of detention space in the New American Gulag.

Thus, U.S. Immigration Judges have become somewhat feckless in the bond process. DHS simply “blows off” the IJs’ entreaties to negotiate because DHS knows that they can unilaterally block release pending appeal anyway. And, as I previously pointed out, the BIA routinely holds bond appeals pending the completion of detained  merits hearings and then simply dismisses the bond appeal as “moot.” As one (now former) Assistant Chief Counsel in Arlington undiplomatically informed me during a bond hearing shortly after I took the bench in 2003: “You can enter any order you want Judge, but the Detention Officer is going to decide whether or not this respondent gets released.” That’s the point at which I became an “Article I convert.”

Consequently, an Article III (a/k/a “Real”) Court enforcing due process and also requiring the DHS to negotiate some reasonable criteria and procedures for release on bond is both essential to our Constitutional system of due process and justice and also is a direct threat to unbridled DHS “gonzo enforcement.” As you can see from “FN 29” above, DHS has absolutely no interest in settling this case on a reasonable basis, although urged to do so by both the US District Court and the Court of Appeals. They expect and want the Article III Courts to “just roll over” like the “captive” Immigration Courts do.

Consequently, we can expect the Administration to fight tooth and nail against all efforts to put meaning in the currently largely false promise of Due Process in Immigration Court! Expect a DHS appeal to the Supremes! Stay tuned!

THE HILL: N. Rappaport Says DHS Search Of Social Media Is Likely Legal

“Homeland Security searching some social media doesn’t violate privacy

The Department of Homeland Security (DHS) has posted a new rule on the Federal Register which authorizes adding information from an alien’s social media sites to the files that are kept in his/her official immigration records, such as “social media handles, aliases, associated identifiable information, and search results.”

The official immigration records are known as “A-Files.”

The social media sites will be searched for information which pertains to granting aliens a visa or some other type of immigration benefit, and this almost certainly will lead to social media searches of the American citizens and lawful permanent residents who sponsor them.

For instance, if a citizen files a visa petition to accord immediate relative status to his alien spouse, and information on the spouse’s Facebook site indicates that the marriage is a sham, DHS will search the citizen petitioner’s Facebook site for additional information to assist in determining whether the marriage really is a sham.
But the most important reason is to identify terrorists, and this is the reason that prompted 26 senators to ask DHS to search social media sites after the San Bernardino terrorist attack.

The Electronic Frontier Foundation and the ACLU have filed a lawsuit to stop DHS from searching mobile electronic devices at the border in violation of the Fourth Amendment to the U.S. Constitution. I expect them to challenge social media checks on the same basis.

The Fourth Amendment states that “the right of the people to be secure in their persons, houses, papers, and effects, against unreasonable searches and seizures, shall not be violated.” But this only applies to situations where an individual has “a reasonable expectation of privacy,” which is not an easy concept to apply to social media information.

In any case, there is no expectation of privacy in immigration processes. Most, and perhaps all, of the persons involved in immigration processes have to authorize DHS to investigate them and the information they provide.

For instance, an American citizen or lawful permanent resident who files a visa petition for a relative has to fill out a Form I-130 Petition for Alien Relative, which requires extensive information about the petitioner, his/her spouse, and his/her parents. It requires similar information about the alien who is the beneficiary of the petition.

The petitioner also has to authorize the release of information that is needed for the adjudication of the petition, or that is “necessary for the administration and enforcement of U.S. immigration laws.”

The Form DS-160 Application for a Nonimmigrant Visa requires even more information, and it should be apparent to aliens applying for a visa that they are subject to background investigations.

I am not convinced, therefore, that social media searches violate privacy rights, and the San Bernardino terrorist attack has shown that information on social media sites can help DHS to identify terrorists before they strike.

ACLU WILL CHALLENGE TRAVEL BAN 3.0 IN MD FEDERAL COURT!

“The American Civil Liberties Union announced Friday it is suing President Donald Trump’s administration over its new travel ban.
The group is bringing its challenge in the U.S. District Court in Maryland. Multiple organizations, including the National Immigration Law Center, are joining the complaint.
“President Trump’s newest travel ban is still a Muslim ban at its core, and it certainly engages in discrimination based on national origin, which is unlawful,” ACLU executive director Anthony D. Romero said in a statement. “Adding a few North Koreans and a tiny group of Venezuelan officials doesn’t paper over the original sin of the Muslim ban. We’ll see President Trump in court — again.”
The latest iteration of the ban, announced earlier this week, is set to place new restrictions on travel to the U.S. from eight countries starting on Oct. 18. The updated ban removed earlier restrictions on Sudan, while adding North Korea, Venezuela and Chad to the list. Restrictions remain in place for Iran, Libya, Syria, Yemen and Somalia.
It’s Trump’s third attempt to restrict travel from a small group of countries.
The ACLU and other groups have decried the new version of the ban as just as xenophobic as its earlier versions, which faced legal challenges as to whether the policies unconstitutionally discriminated against Muslims.
“This is still a Muslim ban ― they simply added three additional countries,” said Becca Heller of the International Refugee Assistance Project earlier this week. “Of those countries, Chad is majority Muslim, travel from North Korea is already basically frozen and the restrictions on Venezuela only affect government officials on certain visas. You can’t get any more transparent than that.”

“WASHINGTON — The Trump administration is stepping up its pursuit of parents who paid to have their children illegally brought into the United States, according to people familiar with the matter. The effort, part of a widening crackdown on illegal immigration, is aimed at discouraging families from paying human smuggling organizations.
As part of a new round of immigration sweeps, officials are targeting parents or other relatives who were deported, re-entered the United States and then had their children smuggled across the border. Legal experts say cases of illegal re-entry are faster and easier to prove than a smuggling charge.
Immigration and Customs Enforcement officials said it was common for parents or family members in the United States to make illegal payments to smugglers to arrange for children to be brought to the border, where they turn themselves in and are often eventually handed over to their relatives. Tens of thousands of women and children have arrived at the border in the last three years, beginning with a surge of arrivals in the summer of 2014, many seeking refuge from gang violence and extreme poverty in Central America.
It was not clear how many people would be affected by the effort to arrest and prosecute family members for illegal re-entry, but officials familiar with the plan said it would serve as a deterrent to stop other parents and relatives from paying to have children brought to the United States as unaccompanied minors. The officials spoke on the condition of anonymity because they were not authorized to discuss enforcement policies publicly.
ICE officials said they had arrested hundreds of people for smuggling children and referred dozens of cases to the Justice Department for prosecution, including many for illegally re-entering the country and then paying to have children smuggled across the border.
“The risks associated with smuggling children into the U.S. present a constant humanitarian threat,” ICE officials said in a statement. “The sponsors who have placed children directly into harm’s way by entrusting them to violent criminal organizations will be held accountable for their role in these conspiracies.”
Some children reported being raped or held hostage by smugglers for more money. Others have been abandoned by smugglers as they try to cross the border.
Immigration advocates called the new enforcement policy a heartless way to try to reduce smuggling.
“It’s extremely cruel when you started shutting down refugee applicants and rescinding protections for children brought to the country at a young age, to send this kind of message to parents trying to get their kids to safety,” said Chris Rickerd, policy counsel with the American Civil Liberties Union in Washington.
Smuggling cases are among the most challenging to prove, and the biggest hurdle is identifying witnesses, who are likely to be undocumented and unwilling to help, according to Michael J. Wynne, who spent 12 years as an assistant United States attorney in the Rio Grande Valley in South Texas. Targeting parents for re-entering the country illegally, rather than trying to go after them for smuggling, presents prosecutors with a higher likelihood of success.
“It’s a throwdown case,” he said. “You’re going to prosecute the crime where you get the biggest bang for your buck.”
Officials in ICE’s Homeland Security Investigations division have been told to look for cases that can be brought to United States attorneys for possible prosecution, according to people familiar with the enforcement effort. Because prosecutions for illegal re-entry carry a five-year statute of limitations, ICE special agents are also looking to see if they can prosecute relatives of unaccompanied children for other immigration-related crimes, such as giving false statements, according to people familiar with the effort.
Convictions for illegal re-entry are politically popular among immigration restrictionists.
According to Justice Department data analyzed by the Transactional Records Access Clearinghouse, a nonprofit research group at Syracuse University, illegal re-entry made up the bulk of prosecutions for illegal immigration for the last five years.
The Trump administration has made no secret of its plans to go after parents living in the country illegally who bring in their children.
Earlier this year, administration officials said that the thousands of children who arrived each year as unaccompanied minors would no longer be protected against deportation, reversing an Obama administration policy. John F. Kelly, then the Homeland Security secretary and now the White House chief of staff, wrote a memo in February saying parents would be subject to criminal prosecution if they had paid human traffickers to bring children across the border.
The children, who turn themselves in to the Border Patrol, are handed over to the Department of Health and Human Services’ Office of Refugee Resettlement. The office will either place the children in a shelter or release them to a family member. Immigration officials said most of the unaccompanied children apprehended at the border were eventually turned over to a family member, most often a parent, already living in the United States.
Homeland Security officials acknowledge that many of the children are fleeing violence in their home country, but they say that paying smugglers to transport them to the border endangers the children.”

NBC’S PETE WILLIAMS REPORTS: “Trump to Replace Travel Ban With Revised Requirements”

“WASHINGTON — The White House could issue new requirements this weekend for travelers entering the United States, replacing President Donald Trump’s controversial ban on visitors from six Muslim countries, administration officials tell NBC News.

The announcement, expected by Sunday, will supersede the 90-day travel ban on issuing visas to visitors from Iran, Libya, Somalia, Sudan, Syria, and Yemen, which expires Sunday.

The new restrictions will be based on a Homeland Security and State Department review of the kinds of information that must be provided about visitors and immigrants hoping to enter the U.S. The new guidelines are aimed at preventing terrorists and other security threats from entering the country, officials said.

Following the review, the State Department asked U.S. diplomats around the world to gather the information from foreign governments, warning that visitors will be eligible to enter the country only after the requests are fulfilled.

Once those responses came back, Homeland Security and State Departments reported to the White House on which countries agreed to provide the required information and conform to US requirements, and which did not.

Based on that report, the White House is expected to announce the new restrictions, probably in the form of a presidential proclamation, administration officials said. For many countries on the list, visas will be restricted, meaning that only specified categories of travelers can get them.

Any country that flunks the test can get itself off the list by agreeing to conform to the US requirements, which include issuing electronic passports with a photo, regularly reporting passport thefts, and notifying the US of suspected terrorists. Plus countries must also “take measures to ensure that they are not and do not have the potential to become a terrorist safe haven.”

The original White House order, imposed in January, caused chaos in some of the nation’s airports as customs officials were left to interpret the meaning of the surprise order. After it was struck down in court, a revised order was issued in March.

The executive orders have faced a litany of legal challenges. The Supreme Court ruled in June that parts of the current travel ban could be enforced until the court hears argument, on October 10, about whether the president had authority to impose it in the first place.

Lawyers tell NBC News they are unsure what this latest move could mean for the case.”

DESTROYING JUSTICE: Community Policing Has Never Been More Important — So Why Is Gonzo Apocalypto Dismantling The Program That Supports It?

The program wasn’t federal intrusion. Local police asked for it to improve relations with the communities they serve.
As St. Louis and the rest of the country reacted to the acquittal of the police officer who killed Anthony Lamar Smith last Friday, the Justice Department had its focus on something else. While we expressed outrage at continued state violence and another fatal police shooting of a Black man with no accountability, Attorney General Jeff Sessions did just the opposite.
On Friday, DOJ announced the end of a community policing program as we know it. The program, which once helped St. Louis County police address racial profiling and other localities address issues like excessive use of force, is no more. Instead, DOJ will now assist local agencies in “fight[ing] violent crime,” aka, Session’s failed drug war agenda.
The Collaborative Reform Initiative for Technical Assistance, or “collaborative reform” for short, was started in 2011 at the request of local law enforcement. The DOJ program provided resources to law enforcement agencies that were experiencing serious policing failures and reached out to the agency for help. These police departments were plagued by excessive force, biased policing, and failed police-community relations.
As the former head of the COPS office, Ron Davis, described, “[collaborative] reform worked because it was driven by local police, elected [and] community leaders who wanted stronger relationships [and] safer cities.” This effort was far from the “federal intrusion” that Sessions uses to describe the previous administration’s oversight of local policing. Police departments and local communities sought out and volunteered for this federal program. And they were right to do so.
The police departments benefiting from collaborative reform were often responsible for fatal police shootings that garnered national attention. We are talking about departments in Milwaukee, Wisconsin, where Dontre Hamilton was fatally shot by police; Saint Anthony, Minnesota, where Philando Castile met the same fate; and North Charleston, South Carolina, where Walter Scott was also fatally gunned down by a police offer.
The collaborative reform cities that were waiting on DOJ’s recommendations, like Milwaukee, have been told to stop holding their breath. The reports are not coming. A draft of the Milwaukee report shows just what is at stake with the loss of these federal resources. The report revealed that “MPD members generally do not understand their roles in community policing.” The report also found that “MPD’s traffic enforcement practices have a disparate impact on the African-American community” and the department “does not have specific guidelines for conducting use of force investigations.”
For DOJ to now deny critical policing resources to troubled agencies and communities is appalling. Police departments and local officials asked for federal help so they could attempt to “strengthen and build the mutual trust” between law enforcement and communities in the midst of tragedy, often a fatal police shooting. And for Sessions to say he now wants the program to “fight violent crime” is ridiculous. Fatal police shootings can be violent crimes; they just tend to happen without consequence as we saw most recently in St. Louis.
So what can be done with police practices and a justice system that continues to fail this country? Let’s keep organizing, advocating, and litigating, making sure our voices are heard. Let’s tell our local police departments that we will work with them to ensure constitutional policing practices; that we will hold them accountable even if this Justice Department will not.

”The Supreme Court will hear four oral argument in four cases in the first two weeks of the 2017 Term. And the cases raise challenging constitutional law issues that could forecever change immigration law. Watch this blog for previews of the oral arguments in the cases.

Sessions v. Dimaya, Oral Argument October 2. The U.S. Court of Appeals for the Ninth Circuit, in an opinion by the liberal lion Judge Stephen Reinhardt, held that a criminal removal provision, including the phrase “crime of violence,” was void for vagueness.

Jennings v. Rodriguez, Oral Argument, October 3. The Ninth Circuit, in an opinion by Judge Kim McLane Wardlaw, found that the indefinite detention of immigrants violated the U.S. Constitution.

Dimaya and Jennings are being re-argued, both having originally been argued before Justice Scalia. One can assume that the eight Justice Court was divided and that Justice Gorsuch may well be the tiebreaker.

The final two immigration cases are the “travel ban” cases arising out of President Trump’s March Executive Order:

USDC IN TEX BLOCKS PORTIONS OF ANTI-MIGRANT LAW! — Abbott, Paxton, Trump, Sessions & White Nationalist Agenda Take Another Hit For Violating The US Constitution!

“AUSTIN, Texas ― A federal judge on Wednesday blocked most of a state immigration crackdown two days before it was set to go into effect on Sept. 1, offering a major victory for opponents as a tropical storm ravages the state and local officials struggle to assure immigrants it’s safe to seek help.
U.S. District Judge Orlando Garcia issued an injunction that prevents Texas Senate Bill 4 from being implemented while a lawsuit challenging the law winds its way through the federal courts. The ruling marks a victory for immigrant rights groups and several local governments ― including those of Austin, Houston, San Antonio and El Cenizo ― that argued the law unconstitutionally requires police to do the work of federal authorities and would lead to racial profiling.
“There is overwhelming evidence by local officials, including local law enforcement, that SB 4 will erode public trust and make many communities and neighborhoods less safe,” Garcia wrote in his order. “There is also ample evidence that localities will suffer adverse economic consequences which, in turn, harm the State of Texas.”
The judge added that the legislature “is free to ignore the pleas of city and county officials, along with local police departments, who are in the trenches and neighborhoods enforcing the law on a daily and continuing basis” and can disregard their “reservoir of knowledge and experience.”
“The Court cannot and does not second guess the Legislature,” Garcia wrote. “However, the State may not exercise its authority in a manner that violates the United States Constitution.”
The injunction isn’t a total victory for SB 4 opponents. The ruling allows a provision of the law to take effect authorizing police to ask about the immigration status of those they stop, which Garcia said could in theory be applied in a way that does not violate the Constitution.
Texas Attorney General Ken Paxton, a Republican, said in a statement he was confident federal courts will ultimately find the law constitutional and allow the state to implement it in full, despite the injunction.
“Senate Bill 4 was passed by the Texas Legislature to set a statewide policy of cooperation with federal immigration authorities enforcing our nation’s immigration laws,” Paxton said. “Texas has the sovereign authority and responsibility to protect the safety and welfare of its citizens.”

“WASHINGTON ― President Donald Trump on Friday pardoned a notorious former Arizona sheriff who willfully violated a federal judge’s order by unlawfully detaining individuals his officers claimed might be in the country illegally.
Former Maricopa County Sheriff Joe Arpaio, who had previously proclaimed himself “America’s toughest sheriff,” was convicted of criminal contempt last month for violating a 2011 order that barred Arpaio and his office from detaining individuals solely based on suspicions about their legal status. Arpaio, 85, was scheduled to be sentenced on Oct. 5.
“Throughout his time as Sheriff, Arpaio continued his life’s work of protecting the public from the scourges of crime and illegal immigration,” the White House said in a statement late Friday. “Sheriff Joe Arpaio is now eighty-five years old, and after more than fifty years of admirable service to our Nation, he is a worthy candidate for a Presidential pardon.”
Trump’s pardon of Arpaio, the first of his presidency, amounts to a tacit endorsement of Arpaio’s discriminatory tactics and reads as a favor to a political ally. The media-savvy former sheriff, known for parading inmates around in pink underwear, supported the former reality TV star’s presidential campaign and spoke at the Republican National Convention last summer. Both men were prominent promoters of the racist conspiracy theory that former President Barack Obama wasn’t born in the United States.
Arpaio, who served as sheriff from 1993 through 2016, had long been accused of discriminatory practices against Latinos. A 2011 report by the U.S. Department of Justice’s Civil Rights Division concluded there was reasonable cause to believe that Arpaio and his office engaged in a pattern or practice of unlawful policing and racial profiling. Arpaio’s officers called Latinos “wetbacks,” “Mexican bitches,” “fucking Mexicans” and “stupid Mexicans,” the Justice Department found, and Latino drivers were four to nine times as likely to be stopped by his officers as non-Latino drivers were. A lawsuit filed by the Justice Department was settled in 2015.
“With his pardon of Arpaio, Trump has chosen lawlessness over justice, division over unity, hurt over healing,” Cecillia Wang, deputy legal director of the American Civil Liberties Union, said in a statement Friday. “Once again, the president has acted in support of illegal, failed immigration enforcement practices that target people of color and have been struck down by the courts. His pardon of Arpaio is a presidential endorsement of racism.”

ACLU Class Action Suit Charges that Efforts to Detain and Deport Children are Based on Unfounded Gang Allegations

Attorneys representing immigrant children and their families sued Attorney General Jeff Sessions, Immigration and Customs Enforcement (ICE), and the U.S. Department of Health and Human Services’ Office of Refugee Resettlement (ORR) today for using unsubstantiated claims of gang affiliation to illegally detain teenagers in jail-like facilities in California.

 

National Conference of State Legislatures Issues Report on Increase in State Immigration Legislation

Enacted legislation related to immigration increased in the first half of 2017 by 90 percent to 133 laws compared with 70 laws in 2016. The number of resolutions increased by 22 percent to 195 from 159. Lawmakers in 47 states enacted 133 laws and 195 resolutions related to immigration, for a total of 328. An additional nine bills were vetoed by governors and 18 are pending signatures. Trends 2017: Sanctuary policies, Refugees, Education/civics, Education/in-state tuition.

ICE Investigating Families

Catholic Charities: It seems that ICE and HSI are getting contact information for families from minors at the border and are going on a fishing expedition to get evidence of immigration and criminal violations.  The first wave is taking action against people with immigration violations–arresting and detaining household members with outstanding removal orders, issuing NTA (but also sometimes detaining) those who are undocumented. There will likely be a second wave of using smuggling inadmissibility charges to limit the relief that these immigrants can receive.  The third wave will be criminally prosecuting people on federal charges of alien smuggling (which is a crime and carries 5 years of jail time). CLINIC and NYIC  and others are tracking these encounters. You may want to report to them. This is what we are telling people contacted by HSI and ICE:

  1. Talking to them is completely voluntary.  They have not issued a subpoena and you are not obligated to go to a meeting or answer your door. They may show up at your house; you do not have to let them in.
  2. You have a right to consult with a lawyer before you talk to them. You have a right to have a lawyer present during any conversations with them.
  3. 5th Amendment.  If you talk to them, what you say can and will be used against you in a deportation case and a criminal case. They are looking for evidence to use against you.

4.      Smuggling is a crime. (We usually walk then through the statute). It includes paying for but also just arranging and planning for someone to enter the U.S.  It doesn’t matter why you did this or how sympathetic the story is. If you admit to this crime, you can be prosecuted and put in jail. It is also an immigration violation which can be used against you.”

“The Justice Department has reversed its position in a high-profile voting case in Ohio, siding with the state in its effort to purge thousands of people from its rolls for not voting in recent elections.

The move is part of a broader campaign by the Trump administration to support restrictions on who is eligible to vote, a radical change in philosophy from the previous Justice Department, which sued a number of states over voting laws that it deemed discriminatory against minorities.

In a court filing late Monday, Justice Department attorneys took the opposite position from the Obama administration in a case that involves Ohio’s removal last year of tens of thousands of inactive voters from its voting rolls.

In their brief, government lawyers say they reconsidered the Ohio vote-purging issue after the “change in Administrations,” and they argue that the state’s actions are legal under federal law. The case is headed next to the Supreme Court.

Ohio’s procedure allows the state to purge voters who meet certain criteria for being inactive. If a voter has not cast a ballot in two years, the person is sent a notice asking them to confirm their registration. If the voter does not respond and does not cast a ballot over the next four years, the person is removed from the rolls.

The Trump administration has signaled in other ways that it intends to back added requirements for voters as part of a crackdown on alleged fraud.

President Trump in May created an advisory commission on election integrity that has been tasked with determining the extent of illegal voting. The president earlier made the baseless allegation that illegal voting cost him the popular vote against Democrat Hillary Clinton in the 2016 presidential election.

The commission’s only notable act so far has been to request massive amounts of voter data from the states, a move that has provoked lawsuits accusing the panel of breaching Americans’ privacy.

The case in Ohio is not the first time the Justice Department has reversed course in a major legal battle over voting rights. In February, shortly after Jeff Sessions became attorney general, the department dropped its position in a long-running case that argued Texas intended to discriminate against minorities when it passed a strict voter-ID law.

The Texas law, passed in 2011, required that voters present certain forms of identification, such as a driver’s license or a weapons permit, but the state did not allow other forms, including IDs issued by colleges. Critics said these restrictions targeted voters, such as young people and minorities, who are more likely to vote Democratic. A number of courts found the Texas law to be unconstitutional, and a federal court in April found that the Texas legislature intentionally discriminated against black and Hispanic voters.

Voting rights advocates said the Justice Department’s action on Ohio represented a major change in direction for the U.S. government’s stance on access to the polls.

The move “signals the broader agenda of the administration to roll back voter rights in this country,” said Vanita Gupta, former head of the Justice Department’s civil rights division under President Barack Obama and now president of the Leadership Conference on Civil and Human Rights.”

During Sessions’s Senate Confirmation, Senator Liz Warren, Senator Corey Booker, Members of the Congressional Black Caucus, and my friend and former DOJ Civil Rights Attorney Jerry Hebert, among others, tried to tell the Committee and the Senators that Sessions was the same White Nationalist/racially challenged individual he had been back when he was properly rejected for a U.S. District Judge position. They were “tuned out.”

Sessions took umbrage, and then lied under oath to the Committee when he claimed to be a staunch defender of civil rights and someone who would separate his political positions as a Republican Senator from Alabama (a state with a disgraceful history of racial bias) from his new responsibilities as Attorney General for all Americans. That would include people of color, LGBT Individuals, immigrants, both legal and undocumented, women, and even Democrats. But, he’s the “same ol’ Jeff” just like his critics said he would be. And the carnage to the American justice system that he is creating probably won’t be repaired any time soon.

“President Donald Trump on Friday encouraged authorities to rough up undocumented immigrants suspected of committing crimes as part of a speech to highlight his administration’s efforts to crack down on gang members and illegal immigration.

“When you see these towns and when you see these thugs being thrown into the back of a paddy wagon, you just see them thrown in, rough, I said, ‘Please don’t be too nice,'” Trump said to cheers and applause. “Like when you guys put somebody in the car and you’re protecting their head — you know, the way you put their hand over — like, ‘Don’t hit their head’ and they’ve just killed somebody. ‘Don’t hit their head.’ I said, ‘You can take the hand away, OK?'”

Trump made the comments while speaking in Long Island to law enforcement officials. He and his administration have been pointing to a streak of violence at the hands of MS-13 gang members as justification for cracking down on illegal immigration — even though federal data show the link is tenuous, at best.

In a tweet the Suffolk County Police Department, which covers the area where Trump gave his speech, also said they do not tolerate “roughing up of prisoners.”

Jeffery Robinson, the ACLU’s deputy legal director, said Trump sent police officers the wrong message by telling them he will back them 100% if they gratuitously hurt suspected criminals.

“By encouraging police to dole out extra pain at will, the president is urging a kind of lawlessness that already imperils the health and lives of people of color at shameful rates,” Robinson said in a statement. “We know what happened to Freddie Gray, Eric Garner, and too many others who lost their lives only because they were under suspicion. We must increase the trust between police and civilians, not decimate it.”

Janai Nelson, associate director-counsel at the NAACP Legal Defense and Educational Fund, said the remarks rise to a new level of danger.

“No person, especially those who have only been accused of a crime, should be abused by those entrusted to uphold the law,” Nelson said in a statement. “The President’s mocking of the treatment of arrestees as they are escorted into a police vehicle is particularly reprehensible in light of the police in-custody death of Freddie Gray in Baltimore.”

He also made a connection between unaccompanied minors from Central America and MS-13, saying the increase in the kids coming to the US lead to an increase in the gang’s ranks.

“New arrivals came in, and they were all made recruits of each other. And they fought with each other. And then they fought outside of each other, and it got worse and worse,” Trump said. “In the three years before I took office, more than 150,000 unaccompanied alien minors arrived at the border and were released all throughout our country into United States communities.”

However, an analysis by the Washington Office on Latin America found that MS-13’s membership makes up less than 1% of all criminally active gang members in the US and Puerto Rico. The organization also said that Attorney General Jeff Sessions’ claim that MS-13 gang membership has increased to 10,000 members is the same estimate the FBI has been using since 2006.”

Trump is taking full advantage of the fact that as President, he can’t be held legally or personally responsible for the consequences of his actions. But, moral responsibility is another thing. And, all of his inappropriate behavior is being well-documented for the historians.

Also, we should remember that while Trump disingenuously claims concern about the folks being harmed by gangs, every day his Administration sends innocent women and children back to countries of the Northern Triangle to be preyed upon by gangs, most without receiving anything resembling due process. Trump has never had any genuine concern for anyone in life except himself.

AILA’s board just voted to change our position on the funding of immigration judges: in brief, AILA will no longer be supporting increased funding for IJs.  The change in position was motivated by two principal concerns: 1) additional funding for judges will enable this administration to deport more people more rapidly; and 2) increased judges will not necessarily promote due process and fairness for those appearing in proceedings, esp under the current administration.

We will convey this to key friends on the Hill, but we haven’t decided how actively we plan to push this.

Here’s what the House FY18 CJS bill includes, according to the summary posted by House approps:

Executive Office for Immigration Review (EOIR) – Funding for the EOIR is increased by $64.5 million, for a total of $505 million. This increase will provide for 65 additional immigration judge teams to process immigration reviews more quickly, and reduce the backlog of pending cases.

I can understand the sentiment that brought this about. I’m not sure, however, that this isn’t an exercise in “kicking the cat.” The real problem here is lack of independence and the highly inappropriate, facially unethical, role of the DOJ, which Congress created, allowed to fester, and failed to date to fix. And the type of misguided GOP agenda behind an atrocity like H.R. 391 also doesn’t help.

Interesting that the last several Administrations have mismanaged the Immigration Courts to the point where they appear to be doing exactly the opposite of their single mission: guaranteeing fairness and due process for all!

With this particular Congress and Administration, AILA’s change in position probably won’t mean much. Only White Nationalist and restrictionist groups seem to have any influence.

Sadly, years of hard-won progress in establishing due process in the Immigration Court system have now been squandered. EOIR and the Immigration Courts have returned to the mess that they were before EOIR was created.

U.S. District Judge Mark Goldsmith Halts Iraqi Removals

“A federal judge in Detroit has temporarily halted the deportations of more than 1,400 Iraqi immigrants, ruling that they deserve to have their cases play out in court because of the risk that they could be targeted for persecution in Iraq.

In a ruling Monday, U.S. District Judge Mark Goldsmith said the immigrants faced a “compelling confluence of extraordinary circumstances” and that the government’s attempt to rush their deportations was a violation of their rights.

Many of the Iraqis arrived in the U.S. as children as far back as the 1980s and have few ties to their native country. The majority are members of religious or ethnic minorities such as Chaldean Christians or Kurds, who have been subjected to torture and other forms of repression in Iraq.

They face deportation because they had overstayed visas or committed crimes, typically misdemeanors such as driving under the influence of alcohol.

They had been allowed to stay in the U.S. because for decades Iraq had refused to take them back. But in March, the Trump administration reached a deal with the Iraqi government to accept them and in June began rounding them up in immigration raids.

As of July 1, 234 had been arrested and detained around the country, including large numbers in Detroit, home to thousands of Chaldean Christians.

Returning the immigrants to Iraq would in some cases be akin to issuing a death sentence, according to civil rights and immigrant rights groups that filed a lawsuit in Detroit federal court in late June to block deportations of those immigrants who had been living in Detroit.

Many had been transferred multiple times to various detention facilities, making it harder for them to get legal representation and prepare their cases, advocates said.”
