DHS Outlines Strategy to Address Increase in Migrants in Del Rio

The Department of Homeland Security (DHS) is immediately implementing a new, comprehensive strategy to address the increase in migrant encounters in the Del Rio sector of South Texas.  It has six key components.

First, within the next 24-48 hours, U.S. Customs and Border Protection will have surged 400 agents and officers to the Del Rio sector to improve control of the area.  If additional staff is needed, more will be sent. The Del Rio Port of Entry has temporarily closed, and traffic is being re-routed from Del Rio to Eagle Pass to more effectively manage resources and ensure uninterrupted flow of trade and travel.

Second, U.S. Border Patrol (USBP) is coordinating with Immigration and Customs Enforcement and the U.S. Coast Guard to move individuals from Del Rio to other processing locations, including approximately 2,000 yesterday, in order to ensure that irregular migrants are swiftly taken into custody, processed, and removed from the United States consistent with our laws and policy.

Third, DHS will secure additional transportation to accelerate the pace and increase the capacity of removal flights to Haiti and other destinations in the hemisphere within the next 72 hours.

Fourth, the Administration is working with source and transit countries in the region to accept individuals who previously resided in those countries.

Fifth, DHS is undertaking urgent humanitarian actions with other relevant federal, state, and local partners to reduce crowding and improve conditions for migrants on U.S. soil.  DHS has already taken a number of steps to ensure the safety and security of individuals as they await processing, including having Border Patrol emergency medical technicians on hand and providing water, towels, and portable toilets.

Finally, the White House has directed appropriate U.S. agencies to work with the Haitian and other regional governments to provide assistance and support to returnees.

The majority of migrants continue to be expelled under CDC’s Title 42 authority.  Those who cannot be expelled under Title 42 and do not have a legal basis to remain will be placed in expedited removal proceedings.  DHS is conducting regular expulsion and removal flights to Haiti, Mexico, Ecuador, and Northern Triangle countries.

Beyond the six steps outlined above, the Biden Administration has reiterated that our borders are not open, and people should not make the dangerous journey.  Individuals and families are subject to border restrictions, including expulsion.  Irregular migration poses a significant threat to the health and welfare of border communities and to the lives of migrants themselves, and should not be attempted.

DEL RIO, Texas (AP) — Haitian migrants seeking to escape poverty, hunger and a feeling of hopelessness in their home country said they will not be deterred by U.S. plans to speedily send them back, as thousands of people remained encamped on the Texas border Saturday after crossing from Mexico.

Scores of people waded back and forth across the Rio Grande on Saturday afternoon, re-entering Mexico to purchase water, food and diapers in Ciudad Acuña before returning to the Texas encampment under and near a bridge in the border city of Del Rio.

Junior Jean, a 32-year-old man from Haiti, watched as people cautiously carried cases of water or bags of food through the knee-high river water. Jean said he lived on the streets in Chile the past four years, resigned to searching for food in garbage cans.

“We are all looking for a better life,” he said.

The Department of Homeland Security said Saturday that it moved about 2,000 of the migrants from the camp to other locations Friday for processing and possible removal from the U.S. Its statement also said it would have 400 agents and officers in the area by Monday morning and would send more if necessary.

The announcement marked a swift response to the sudden arrival of Haitians in Del Rio, a Texas city of about 35,000 people roughly 145 miles (230 kilometers) west of San Antonio. It sits on a relatively remote stretch of border that lacks capacity to hold and process such large numbers of people.

The U.S. government on Wednesday ended two Trump administration policies that made it harder for immigrants fleeing violence to qualify for asylum, especially Central Americans.

Atty. Gen. Merrick Garland issued a new policy saying immigration judges should cease following the Trump-era rules that made it tough for immigrants who faced domestic or gang violence to win asylum in the United States. The move could make it easier for them to win their cases for humanitarian protection and was widely celebrated by immigrant advocates.

“The significance of this cannot be overstated,” said Kate Melloy Goettel, legal director of litigation at the American Immigration Council. “This was one of the worst anti-asylum decisions under the Trump era, and this is a really important first step in undoing that.”

Garland said he was making the changes after President Biden ordered his office and the Department of Homeland Security to draft rules addressing complex issues in immigration law about groups of people who should qualify for asylum.

Gene Hamilton, a key architect of many of then-President Trump’s immigration policies who served in the Justice Department, said in a statement that he believed the change would lead to more immigrants filing asylum claims based on crime and that it should not be a reason for the humanitarian protection.

In the current fiscal year, people from countries such as Russia and Cameroon have seen higher asylum grant rates in the immigration courts than those from El Salvador, Guatemala and Honduras, the data show.

One of the Trump administration policies was aimed at migrants who were fleeing violence from nonstate actors, such as gangs, while the other affected those who felt they were being targeted in their countries because of their family ties, said Jason Dzubow, an immigration attorney in Washington who focuses on asylum.

Dzubow said he recently represented a Salvadoran family in which the husband was killed and gang members started coming after his children. While Dzubow argued they were in danger because of their family ties, he said the immigration judge rejected the case, citing the Trump-era decision among the reasons.

Dzubow welcomed the change but said he doesn’t expect to suddenly see large numbers of Central Americans winning their asylum cases, which remain difficult under U.S. law.

“I don’t expect it is going to open the floodgates, and all of a sudden everyone from Central America can win their cases. Those cases are very burdensome and difficult,” he said. “We need to make a decision: Do we want to protect these people?”

You know for sure you’re doing the right thing when anti-asylum shill and Stephen Miller crony Gene Hamilton criticizes it!

I tend to agree with my friend Jason that under present conditions, asylum cases for women refugees from Central America are likely to continue to be a “tough slog” at EOIR. The intentionally-created anti-asylum, misogynist, anti-Latino, anti-scholarship, anti-quality, anti-due-process culture at EOIR that emerged under Sessions and Barr isn’t going to disappear overnight, particularly the way Judge Garland is approaching it. He needs to “get out the broom,🧹 sweep out the current BIA and the bad, anti-asylum judges, get rid of ineffective administration, and bring in human rights and due process professionals to get this system operating again! 

Jason, for one, would be an outstanding judicial choice for building a functioning, fair, efficient Immigration Court; one that would fulfill the long-abandoned vision of “through teamwork and innovation, being the world’s best tribunals guaranteeing fairness and due process for all.” Under the Trump regime, EOIR was the antithesis of that noble vision!

Cases such as that described by Jason (incorrectly decided by the Immigration Judge) utilizing A-R-C-G- and “family friendly” precedents from the Fourth Circuit were usually well-represented and well-prepared by attorneys like Jason, Clinics, and NGOs like CLINIC, CAIR Coalition, Human Rights First, and Law School Clinics. After review by ICE Counsel, many were candidates for my “short docket” in Arlington where asylum could easily be granted based on the documentation and short confirming testimony. 

To their credit, even before the BIA finally issued A-R-C-G-, the Arlington Chief Counsel’s Office was not opposing well-documented asylum grants based on domestic violence under what was known as the “Martin Brief” after former DHS/INS Senior Official, renowned immigration scholar, and internationally recognized asylum expert, now emeritus Professor David A. Martin of UVA Law. I remember telling David after one such case that his brief was still “saving lives” even after his departure from DHS and return to academia.

Rather than building on that real potential for efficiency, cooperation, quality, and due process, under Sessions those things that were working at EOIR and represented hope and potential for future progress were maliciously and idiotically dismantled. From the outside, throughout the country, I saw DV cases that once would have been “easy short docket grants” in Arlington require lengthy hearings and often be incorrectly decided in Immigration Court and the BIA. Sometimes the Circuits corrected the errors, sometimes not.

At best, what had been a growing census around recognizing asylum claims based on DV became a “crap shoot” with the result almost totally dependent on what judges were assigned, what Circuit the hearing was held in, and even the composition of the Circuit panel! And, of course, unrepresented claimants were DOA regardless of the merits of their cases. What a way to run a system where torture or death could be the result of a wrong decision!

But, it doesn’t have to be that away! Experts like Jason and others could get this system functioning fairly and efficiently in less time than it took Sessions and Barr to destroy it. 

However, it can’t be done with the personnel now at DOJ and EOIR Headquarters. If Judge Garland wants this to function like a real court system (not always clear to me that he does), he needs to recruit and bring in the outside progressive experts absolutely necessary to make it happen. At long last, it’s time for “Amateur Night at the Bijou” to end its long, disgraceful, debilitating “run” @ EOIR!

SAN MIGUEL, El Salvador — Rejected by her family, Zashy Zuley del Cid Velásquez fled her coastal village in 2014, the first of a series of forced displacements across El Salvador. She had hoped that in the larger city of San Miguel she could live as a transgender woman without discrimination and violence, but there she was threatened by a gang.

She moved away from San Miguel, then back again in a series of forced moves until the 27-year-old was shot to death April 25, sending shock waves through the close-knit LGBTQ community in San Miguel, the largest city in eastern El Salvador.

“Zashy was desperate; her family didn’t want her … and the gangsters had threatened her,” said Venus Nolasco, director of the San Miguel LGBTQ collective Pearls of the East. “She knew they were going to kill her. She wanted to flee the country, go to the United States, but they killed her with a shot through her lung.”

One day after Del Cid’s slaying, U.S. Vice President Kamala Harris identified anti-LGBTQ violence in Central America as one of the root causes of migration in the region during a virtual meeting with the president of neighboring Guatemala, Alejandro Giammattei. She is visiting Guatemala and Mexico this week.

Transgender migrants were present in the Central American caravans that attempted to reach the United States border in recent years, fleeing harassment, gang extortion, violence and police indifference to crimes against them. Even in those large migrant movements, they say they faced harassment.

Things had been rough during Del Cid’s first stint in San Miguel. She had been living in a neighborhood where, as in many parts of the country, the MS-13 gang was the ultimate local authority. Gang members began to harass her, then brutally beat her, breaking her arm in 2015, Nolasco said.

“They warned her to leave, but she didn’t listen,” Nolasco said.

Del Cid moved in with Nolasco in the same neighborhood. One day, the gang grabbed Del Cid again.

“They took her, they wanted to kill her,” Nolasco said. “I begged them not to kill her, to let her go and she would leave the neighborhood.”

Del Cid moved back to her hometown, but her family rejected her again. She tried to please them, but she couldn’t, Nolasco said. Del Cid joined a church, got a girlfriend and had a baby girl, but could not maintain that life, she said.

She returned to San Miguel, where initially things seemed to go better. In 2020, Del Cid received humanitarian and housing support from COMCAVIS TRANS, a national LGBTQ rights organization, and the United Nations High Commissioner for Refugees.

Del Cid rented a home and opened a beauty salon there. She hired another woman to help her and was participating in an entrepreneurship program. She was preparing a business proposal to move the salon into its own space.

But Del Cid was shot in the back walking alone at night down the street. Passersby tried to help her and took her to a hospital, where she died. So far, police have made no arrests, and Nolasco believes that like other hate crimes in the country, “it will be forgotten; they’re not interested in what happens to us.”

Laura Almirall, UNHCR representative in El Salvador, said Del Cid’s killing frightened her community and saddened everyone who knew her.

“She was excited about her new plans and her new life. And unfortunately and tragically, everything came to an end,” she said.

Nolasco said that in San Miguel, some 70 miles east of the capital, the transgender community endures constant harassment from intolerant residents and gangs. They have rocks thrown at them, are beaten and are victims of extortion. If they go to police to make a report, they are insulted and demeaned. “Don’t come here to claim rights, because there are no rights for you,” police tell them, Nolasco said.

Despite some legal nonsense from EOIR and sometimes from uninformed Circuit Judges who have never represented asylum seekers and know little of actual conditions in the Northern Triangle, neither El Salvador nor the other Northern Triangle governments are “willing and able” to protect most individuals suffering gender-based and other forms of persecution. Decisions claiming otherwise are, in most cases, legally wrong and disingenuous to boot.

The U.S. asylum system needs expert Asylum Officers at DHS and progressive expert Immigration Judges at EOIR. Babbling (misleadingly) about “sealed borders” won’t take the place of telling Garland and Mayorkas to stop screwing around, bring in progressive experts, and fix the U.S. asylum system before more die! V.P. Harris could have taken the first necessary step toward “fixing the Southern Border” without even leaving DC.

How are we going to promote the rule of law in other nations when we ourselves are unwilling to exhibit honesty and follow the law with respect to the most vulnerable in the world seeking legal refuge at our borders?

SAN DIEGO (AP) — The Biden administration has quietly tasked six humanitarian groups with recommending which migrants should be allowed to stay in the U.S. instead of being rapidly expelled from the country under federal pandemic-related powers that block people from seeking asylum.

The groups will determine who is most vulnerable in Mexico, and their criteria has not been made public. It comes as large numbers of people are crossing the southern border and as the government faces intensifying pressure to lift the public health powers instituted by former President Donald Trump and kept in place by President Joe Biden during the coronavirus pandemic.

Several members of the consortium spoke to The Associated Press about the criteria and provided details of the system that have not been previously reported. The government is aiming to admit to the country up to 250 asylum-seekers a day who are referred by the groups and is agreeing to that system only until July 31. By then, the consortium hopes the Biden administration will have lifted the public health rules, though the government has not committed to that.

So far, a total of nearly 800 asylum-seekers have been let in since May 3, and members of the consortium say there is already more demand than they can meet.

The groups have not been publicly identified except for the International Rescue Committee, a global relief organization. The others are London-based Save the Children; two U.S.-based organizations, HIAS and Kids in Need of Defense; and two Mexico-based organizations, Asylum Access and the Institute for Women in Migration, according to two people with direct knowledge who spoke on condition of anonymity because the information was not intended for public release.

Asylum Access, which provides services to people seeing asylum in Mexico, characterized its role as minimal.

The effort started in El Paso, Texas, and is expanding to Nogales, Arizona.

A similar but separate mechanism led by the American Civil Liberties Union began in late March and allows 35 families a day into the United States at places along the border. It has no end date.

The twin tracks are described by participating organizations as an imperfect transition from so-called Title 42 authority, named for a section of an obscure 1944 public health law that Trump used in March 2020 to effectively end asylum at the Mexican border. With COVID-19 vaccination rates rising, Biden is finding it increasingly difficult to justify the expulsions on public health grounds and faces demands to end it from the U.N. refugee agency and members of his own party and administration.

Well, I’ll give them this. “Farming out” the asylum system to these NGO experts is better than the Trump approach. The Trump regime “outsourced” the American asylum system to Mexico, El Salvador, Honduras, and Guatemala. 

The common denominators among those countries is that the are all notorious for human rights abuses, corrupt government, dysfunctional legal systems, and lack of any semblance of a fair, functioning asylum adjudication system. Additionally, all are major senders of asylum seekers to America.

But, the Biden Administration’s “under the counter” approach is still fundamentally wrong! It’s yet another “haste makes waste gimmick” that lacks transparency, clear standards, accountability, and most of all, operates outside of any legal framework! 

That’s a recipe for arbitrariness, abuse, and unfairness. Even if the system were to produce decent results, the lack of transparency robs it of credibility. It’s therefore likely to be attacked by both advocates and restrictionists while being panned in the press — a self-created  “worst case” scenario of the type Dem Administrations seem to specialize in when it comes to immigration and human rights!

The solution here is to do what many of us have been recommending since the day the election results became final. That is, bring in outside experts to USCIS to lead and revitalize the Asylum Officer screening program and bring in real judges, largely from the outside, — progressive practical experts in asylum law committed to human rights and due process — to EOIR to establish legitimate precedents and insure fair, humane, and uniform treatment of asylum seekers.

It’s possible, indeed probable, that the U.S. representatives of some of the NGOs involved would be among the best experts to do this — leading human rights authorities  like Mark Hatfield at HIAS, Wendy Young at KIND, and Wendy Wylegala, also of KIND are obvious choices. 

So, put them and other practical experts like Professor Karen Musalo (Center for Gender & Refugee Studies), Eleanor Acer (Human Rights First), Professor Stephen Legomsky (former USCIS Chief Counsel), Associate Dean Jaya Ramji Nogales (Temple Law), Judge Ilyce Shugall (Round Table), Dean Kevin Johnson (UC Davis), Michelle Mendez (CLINIC), Professor Lenni Benson (Safe Passage Project), Professor Ingrid Eagly (UCLA Law), Laura Lynch (NILC), Professor Stephen Yale Loehr (Cornell Law), Jason Dzubow (The Asylumist), Professor Debi Anker (Harvard Law), Professor Michele Pistone (VIISTA/Villanova Law), and others like them on the payroll at USCIS and EOIR and let them fix the asylum system!

Experts like this could, if properly empowered, in relatively short order, establish a system that is legal, constitutional, fair, generous, humane, practical, efficient, and that complies with all of our international obligations. In other words, a “model system” that would serve the best interests of humanity and our nation!

The Biden administration has agreed to let about 250 people a day through border crossings with Mexico to seek refuge in the United States, part of negotiations to settle a lawsuit over pandemic-related powers that deny migrants a right to apply for asylum, an attorney said Monday.

The government also said it would stop flying migrant families from Texas’ Rio Grande Valley to El Paso, Texas, and San Diego to then be expelled to Mexico under pandemic powers, said Lee Gelernt, an attorney for the American Civil Liberties Union, which has sued in federal court in Washington, D.C. The government has reserved rights to resume flights “if it deems the circumstances warrant.”

The government concessions would dramatically reshape exercise of powers known as Title 42, named for a section of an obscure 1944 law that former President Donald Trump used to let the U.S. Centers for Disease Control and Prevention effectively end asylum at the border while it sought to prevent the coronavirus from spreading.

Biden has exempted unaccompanied children from Title 42 but kept it for single adults and many families. He has come under criticism from progressives for keeping asylum off-limits to many and for encouraging some parents to send children across the border alone. Enforcement-minded critics say exempting children traveling alone led to record numbers crossing and that lifting restrictions more will invite many more people to come.

The government and the ACLU agreed to “a streamlined process for assessing and addressing exemption requests brought by particular vulnerable families and other individuals,” Gelernt said. Once fully up and running, an estimated 250 particularly vulnerable individuals will be allowed in daily to seek humanitarian protection through a consortium of nongovernmental organizations. They must test for COVID-19 before entering the country.

About 2,000 people have already been allowed to enter the country, exempted from the pandemic-related powers to pursue asylum or other forms of protection while in the United States, Gelernt said.

“While these concessions will hopefully save lives, they are not a substitute for eliminating Title 42 and restoring asylum processing fully,” Gelernt said.

The Department of Homeland Security did not immediately respond to a request for comment Monday night.

9th Circuit on Jim Route v. Merrick Garland– Elaborating on the term “Date of Admission” Regarding Removability Due to Crimes of Moral Turpitude

On May 6, 2021 the Ninth Circuit Court of Appeals denied a petition to review the BIA’s decision in Jim Route v. Merrick Garland. The case had been argued and submitted on April 13, 2021.

The 9th Circuit Court affirmed the decision by the Board of Immigration Appeals, which had concluded that Jim Route, the petitioner, had been:

“removable for having been convicted of a crime of moral turpitude (CIMT) within five years after the date of admission, 8 U.S.C. § 1227(a)(2)(A)(i)”

At issue was the interpretation of Route’s “date of admission.” Namely, if a noncitizen has multiple dates of admission, which one shall apply for purposes of deciding the date of admission when analyzing removability for committing a CIMT? The BIA had relied on its prior decision under Matter of Alyazji, 25 I. & N. Dec. 397 (BIA 2011) which stated that “date of admission,” in the context of § 1227(a)(2)(A)(i), refers to the “date of the admission by virtue of which the alien was present in the United States when he committed his crime.”

The Circuit Court had concluded that the Route case was eligible for
deference under Chevron, and had determined that under a Chevron analysis, that the BIA’s interpretation through Alyazji was a reasonable interpretation of the statute.

The petitioner’s argument rested primarily on the fact that the BIA’s reliance of the Alyazji interpretation ignored the Compact of Free Association governing the relationship between the United States and the Federated States of Micronesia (FSM). The panel rejected Route’s contention, explaining that the text of the Compact clearly subjects Micronesian citizens to the removability grounds of
§ 1227(a).

Jim Route, the petitioner, is a citizen of the Federated States of Micronesia. Route entered the United States in November 2005 as a nonimmigrant. He lived and worked in Hawai‘i. In 2015, Route returned to Micronesia for a vacation with his children; they stayed for less than two months. In June 2015, Route returned to the United States and was again admitted as a nonimmigrant. In June 2018, Route was convicted of unlawful imprisonment in the first degree, a class C felony in Hawai’i. Route was sentenced to 68 days’ imprisonment and four years’ probation.

For cultural context, the noncitizens from Micronesia make up a significant portion of the labor force in Hawai’i.  According to local advocates in Hawai’i, “There are an estimated 15,000 to 20,000 Micronesians in Hawaii, who began migrating here in bigger numbers in the 1990s in search of economic and educational opportunities.” (Crux)

Part of the Petitioner’s argument rested on the unique international agreement called the Compact of Free Association, which “allows citizens from the Federated States of Micronesia, the Republic of the Marshall Islands and the Republic of Palau to live and work freely in the United States in exchange for allowing the U.S. military to control strategic land and water areas in the region.” (Crux)

According to many people living in Hawai’i, Micronesians often face hardship being treated as outsiders and targeted by locals as being unwanted laborers who allegedly take away economic opportunities from them. Some Micronesians in Hawai’i have even expressed that they experience high incidences of violence and are more targeted by police. Two days after the Ninth Circuit published its opinion declining to review the BIA’s opinion, a 16-year old Micronesian boy was shot by police in Hawai’i after allegedly committing a spree of crimes in Honolulu. Hawai’ian social media was flooded with comments that touted anti-Micronesian sentiment, illuminated a microcosm of xenophobia that is similar to sentiments carried by many on the mainland. The anti-Micronesian sentiment in Hawai’i can be compared to the treatment of Latin-American noncitizens in the contiguous territories of the United States, or even the sentiments many Europeans carry against African or Middle-Eastern migrants. The sentiment that noncitizens who arrive for economic opportunity contribute to blight, crime, and siphon opportunity from others is an oft-told narrative no matter the region.

President Biden is formally lifting the nation’s refugee cap to 62,500 this year, weeks after facing bipartisan blowback for his delay in removing former President Trump’s limit of 15,000.

Biden last month moved to expand the eligibility criteria for resettlements, removing one roadblock to refugees entering the U.S. put in place by Trump, but he had initially stopped short of lifting the annual cap, with aides saying they did not believe it was necessary. But Biden faced sharp pushback for not at least taking the symbolic step of authorizing more refugees to enter the U.S. this year and swiftly reversed course.

Biden, in a statement, said the new limit “erases the historically low number set by the previous administration,” adding that Trump’s cap “did not reflect America’s values as a nation that welcomes and supports refugees.”

“It is important to take this action today to remove any lingering doubt in the minds of refugees around the world who have suffered so much, and who are anxiously waiting for their new lives to begin,” Biden added.

At one point in the hearing, he held back tears when speaking about his grandparents, who fled Russia for the U.S. amid antisemitism and persecution.

“The country took us in, and protected us, and I feel an obligation to the country to pay back, and this is the highest, best use of my own set of skills to pay back,” Garland said. “So I very much want to be the kind of attorney general that you’re saying I could become, and I’ll do my best to become that kind of attorney general.”

SAN DIEGO (AP) — The Biden administration on Friday announced plans for tens of thousands of asylum-seekers waiting in Mexico for their next immigration court hearings to be allowed into the United States while their cases proceed.

The first of an estimated 25,000 asylum-seekers in Mexico with active cases will be allowed in the United States on Feb. 19, authorities said. They plan to start slowly with two border crossings each processing up to 300 people a day and a third crossing taking fewer. Administration officials declined to name them out of fear they may encourage a rush of people to those locations.

The move is a major step toward dismantling one of former President Donald Trump’s most consequential policies to deter asylum-seekers from coming to the U.S. About 70,000 asylum-seekers were enrolled in “Remain in Mexico,” officially called “Migrant Protection Protocols,” since it was introduced in January 2019.

On Biden’s first day in office, the Homeland Security Department suspended the policy for new arrivals. Since then, some asylum-seekers picked up at the border have been released in the U.S. with notices to appear in court.

Additionally, many of  the Immigration Judges assigned to the “Remain in Mexico” Program have notoriously high asylum denial rates, some approaching 100% denials.

I sure hope that the Pro Bono Bar is working with USCIS and EOIR to insure that all of these individuals are represented. As we know, that’s the key not only to insuring court appearances, but also to increasing the chances for success on the asylum application.

HOUSTON (AP) — A federal judge on Wednesday ordered the Trump administration to stop expelling immigrant children who cross the southern border alone, halting a policy that has resulted in thousands of rapid deportations of minors during the coronavirus pandemic.

U.S. District Judge Emmet Sullivan issued a preliminary injunction sought by legal groups suing on behalf of children whom the government sought to expel before they could request asylum or other protections under federal law.

The Trump administration has expelled at least 8,800 unaccompanied children since March, when it issued an emergency declaration citing the coronavirus as grounds for barring most people crossing the border from remaining in the United States.

Border agents have forced many people to return to Mexico right away, while detaining others in holding facilities or hotels, sometimes for days or weeks. Meanwhile, government-funded facilities meant to hold children while they are placed with sponsors have thousands of unused beds.

Sullivan’s order bars only the expulsion of children who cross the border unaccompanied by a parent. The government has expelled nearly 200,000 people since March, including adults, and parents and children traveling together.

“This policy was sending thousands of young children back to danger without any hearing,” said Lee Gelernt, a lawyer for the American Civil Liberties Union. “Like so many other Trump administration policies, it was gratuitously cruel and unlawful.”

The Justice Department did not immediately say whether it would appeal. It has appealed another federal judge’s order barring the use of hotels to detain children.

The incoming administration of President-elect Joe Biden has not directly said whether it will keep trying to expel immigrants under public-health authority. Biden is expected to roll back several Trump administration policies restricting asylum as part of a broader shift on immigration.

Herb Adderley, a Hall of Fame cornerback who was a part of a record six championship teams with the Green Packers and Dallas Cowboys, has died. He was 81.

His death was confirmed by the Packers, but details on the date, place and cause of death were not disclosed.

Mr. Adderley played in four of the first six Super Bowls and won five NFL championships with Green Bay and one with Dallas during his 12-year career. But he was always a Packer at heart.

“I’m the only man with a Dallas Cowboys Super Bowl ring who doesn’t wear it. I’m a Green Bay Packer,” he said in the book “Distant Replay,” a memoir by former Packers teammate Jerry Kramer.

Along with former Packer teammates Fuzzy Thurston and Forrest Gregg, Mr. Adderley was one of four players in pro football history to play on six championship teams. Former New England Patriots quarterback Tom Brady is the other. Mr. Adderley was enshrined in the Pro Football Hall of Fame in 1980.

Bart Starr, the Hall of Fame quarterback and a former Packers teammate, once called Mr. Adderley the “greatest cornerback to ever play the game.”

Federal Judge Orders U.S. To Release Migrant Children During Pandemic

Children held for more than 20 days at certain ICE-run detention centers should be released, decided a U.S. District Judge.

 

HOUSTON (AP) — A federal judge on Friday ordered the release of children held with their parents in U.S. immigration jails and denounced the Trump administration’s prolonged detention of families during the coronavirus pandemic.

U.S. District Judge Dolly Gee’s order applies to children held for more than 20 days at three family detention centers in Texas and Pennsylvania operated by U.S. Immigration and Customs Enforcement. Some have been detained since last year.

Citing the recent spread of the virus in two of the three facilities, Gee set a deadline of July 17 for children to either be released with their parents or sent to family sponsors.

The family detention centers “are ‘on fire’ and there is no more time for half measures,” she wrote.

In May, ICE said it was detaining 184 children at the three detention centers, which are separate from U.S. Department of Health and Human Services facilities for unaccompanied children that were holding around 1,000 children in early June. The numbers in both systems have fallen significantly since earlier in the Trump administration because the U.S. is expelling most people trying to cross the border or requiring them to wait for their immigration cases in Mexico.

Gee oversees a long-running court settlement governing the U.S. government’s treatment of immigrant children known as the Flores agreement. Her order does not directly apply to the parents detained with their children.

But most parents last month refused to designate a sponsor when ICE officials unexpectedly asked them who could take their children if the adults remained detained, according to lawyers for the families. Undeterred by this week’s Supreme Court ruling, President Donald Trump said Friday he will renew his effort to end legal protections for hundreds of thousands of immigrants brought to the United States as children.

Trump denounced the high court’s ruling that the administration improperly ended the Deferred Action for Childhood Arrivals program in 2017. Splitting with Trump and judicial conservatives, Chief Justice John Roberts joined the four liberal justices in the 5-4 vote Thursday.

Through executive action, Trump could still take away the ability for 650,000 young immigrants to live and work legally in the United States. But with no legislative answer in Congress in sight, uncertainty continues for many immigrants who know of no other home except America.

In a tweet Friday morning, Trump said, “The Supreme Court asked us to resubmit on DACA, nothing was lost or won. They “punted”, much like in a football game (where hopefully they would stand for our great American Flag). We will be submitting enhanced papers shortly.”

Ken Cuccinelli, acting head of U.S. Citizenship and Immigration Services, said Friday that the administration was starting over. “We’re going to move as quickly as we can to put options in front of the president,” but those are executive branch options, he told “Fox & Friends.”

“That still leaves open the appropriate solution which the Supreme Court mentioned and that is that Congress step up to the plate,” he said.

Cuccinelli said Sen. Dick Durbin, D-Ill., made some positive comments in that direction on Thursday so the administration thinks it’s possible for a constructive conversation with Congress. But experts say there isn’t enough time to knock down the 8-year-old program before the November election and doubt the government would try because DACA is popular with voters.

Trump’s tweet on Friday was less confrontational than the one on Thursday when he slammed the high court ruling. “These horrible & politically charged decisions coming out of the Supreme Court are shotgun blasts into the face of people that are proud to call themselves Republicans or Conservatives.” He apparently was referring to DACA and an earlier ruling this week where the court said it’s illegal to fire people because they are gay or transgender.

Activists are vowing to keep fighting for a long-term solution for young immigrants whose parents brought them to the United States when they were children. They not only face a White House that’s prioritized immigration restrictions but a divided Congress that is not expected to pass legislation giving them a path to citizenship anytime soon.

The court decision still elicited surprise, joy and some apprehension from immigrants and advocates who know it’s only a temporary solution.

“This is a huge victory for us,” Diana Rodriguez, a 22-year-old DACA recipient, said through tears.

Rodriguez, who works with the New York Immigration Coalition, said she hasn’t been to Mexico since she was brought to the U.S. at age 2. The ruling means young immigrantscan keep working, providing for their families and making “a difference in this country,” she said.

But the work isn’t over, Rodriguez said: “We can’t stop right now, we have to continue fighting.”

Congressional Democrats, meanwhile, appeared satisfied to let the court’s decision stand as the law of the land for now.

While Republicans protested that now, if ever, was the time for Congress to clarify the immigration system, House Speaker Nancy Pelosi made it clear that Democrats were done with their legislation before the summer break and had little interest in meeting GOP demands to fund Trump’s long-promised border wall as part of any comprehensive immigration overhaul.

“There isn’t anybody in the immigration community that wants us to trade a wall for immigration,” she said.

Pelosi was reminded that Trump has said he wants immigration reform. “We’ll see,” she said, noting how few days remain on the legislative calendar. “I don’t know what the president meant — maybe he doesn’t either.”

Democratic presidential contender Joe Biden said that if elected, he would send lawmakers proposed legislation on his first day in office to make DACA protections permanent.
