A Timeline of the Trump Administration’s Efforts to End Asylum

United States law enshrines the protections of the international Refugee Convention, drafted in the wake of the horrors of World War II. The law provides that any person “physically present in the United States or who arrives in the United States … irrespective of such alien’s status, may apply for asylum….”1 Since President Trump’s inauguration, the federal government has unleashed relentless attacks on the United States asylum system and those who seek safety on our shores. Internal memos have revealed these efforts to be concerted, organized, and implemented toward the goal of ending asylum in the United States as we know it.2 This timeline highlights the major events comprising the administration’s assault on asylum seekers.

Date and Event Policy Description and Status

July 2019

Asylum Ban 2.03 (barring migrants who cross through another country prior to arriving at the U.S. border from asylum eligibility)

√ The administration published an Interim Final Rule banning all people, including children, who have traveled through another country to reach the United States from applying for asylum.

√ Status: The rule is partially in effect and partially blocked. A federal district court judge in California issued a Temporary Restraining Order on July 16, 2019 in California in East Bay Sanctuary Covenant et al. v Trump, finding the ban to likely violate the asylum provisions of U.S. federal law and raising concerns regarding the administration’s failure to allow for notice-and- comment rulemaking.4 The government appealed to the U.S. Circuit Court of Appeals for the Ninth Circuit, which kept the injunction in place only with regard to the geographic region covered by the Ninth Circuit (California and Arizona) and allowed the government to implement the rule across the rest of the southern border. On August 26th, the government

petitioned the Supreme Court to intervene and allow implementation of the rule nationwide during the remainder of the litigation. That petition remains pending.5

All undocumented immigrants in the interior become targets for arrests and deportation through new Interim Final Rule expanding procedures that expedite deportation6

√ Pursuant to another major regulatory change implemented as an Interim Final Rule, any undocumented individual who cannot prove to have been continuously present in the U.S. for at least two years can be placed in a fast-track deportation process, without the opportunity to plead their case in front of an immigration judge or get the help of an attorney.7 Expedited removal proceedings do allow individuals to seek referral to an immigration court proceeding to seek asylum, but the program has been consistently criticized for officers’ failure to identify legitimate asylum seekers, resulting in the return of many to harm.8

√ Status: Because of its issuance as an Interim Final Rule, the expansion of expedited removal is already in place. A lawsuit challenging this inhumane rule was filed on August 6, 2019.9

Attorney General Barr certifies yet another case to himself and further diminishes grounds of asylum – Matter of L-E-A-10

√ Attorney General Barr reversed yet another BIA decision, this time strictly limiting asylum eligibility for individuals targeted and harmed due to their family membership.11

√ Status: This ruling effectively limits, or in some cases eliminates, the possibility of even presenting a claim for asylum for individuals who are fleeing harm on the basis of their membership in a particular family.

New pilot program gives border patrol officers the authority to conduct credible fear interviews12

√ Stephen Miller has been promoting the implementation and expansion of a pilot program that would allow CBP officers, rather than trained asylum officer working under USCIS supervision, to conduct credible fear interviews. Requiring asylum seekers, recently arrived and fleeing fresh trauma, to articulate their fear of return to uniformed CBP officers will certainly mean that many asylum seekers will be forcibly returned to harm and death.

√ Status: Unclear when this proposal will be formally implemented. Mark Morgan, Acting Chief of CBP, testified to Congress in July 2019 that CBP officers are currently undergoing training in order to conduct these types of interviews.13

The administration √ announces it has reached a deal with Guatemala to

halt the flow of Central American migrants to the U.S.14

In July the U.S. government announced it had reached an agreement with the government of Guatemala. Although the details are uncertain, the administration seems to consider the agreement to set the stage for a “safe third country” agreement that would require all asylum seekers arriving at the southern border who passed through Guatemala, other than Guatemalans, to be transferred to Guatemala to present an asylum claim there. The announcement of the agreement has prompted widespread condemnation in both countries, as it appears to constitute a back-door sealing of the southern border to asylum in the U.S. and would likely prompt an unmitigated political and humanitarian crisis in Guatemala, one of the most dangerous countries in the world.15

√ Status: Unclear whether or when the regulations and agreements necessary to implement the agreement will be finalized.

May 2019

USCIS issues a memo16 √ attempting to undercut protections provided to unaccompanied children during the asylum process

The memo undermines the few but essential protections provided to unaccompanied children in their asylum proceedings, including exemption from the one-year filing deadline and non-adversarial asylum interviews with an asylum officer, by requiring immigration adjudicators to continually re-adjudicate a child’s designation as unaccompanied.17 These new procedures undoubtedly impact children’s ability to effectively access their right to asylum by stripping away protections specifically designed to reflect the vulnerability of children who arrive at a border alone.

√ Status: The memo became effective June 30, 2019. In August 2019, a federal district court issued a Temporary Restraining Order prohibiting USCIS’s implementation of the memo.18

√ Such regulations would include adding fees to the asylum application and work permit application, precluding asylum seekers from working lawfully during their asylum proceedings, and placing a 180 day limit for cases to be completely adjudicated with an immigration court, among others.20

The Mexican government is finally pushing back against the controversial Trump policy of forcing some asylum-seekers to wait in Mexico while their immigration cases play out in court, according to an internal Department of Homeland Security Briefing obtained by BuzzFeed News.

More than 35,000 migrants have been returned to Mexico under the Migrant Protection Protocols, colloquially referred to as the Remain in Mexico policy, since its start in January, according to the DHS document. That’s put migrants in danger and strained resources in Mexican Border Communities. Now, Mexican officials have reportedly begun limiting the days and times U.S. immigration agencies can send asylum-seekers back to Mexico and have cracked down on which migrants can be returned.

Mexican officials in El Paso, for example, have stopped accepting migrants after 1 p.m., even though some migrants have to return to Mexico after crossing into the U.S. for court hearings, according to the memo. As a result, Customs and Border Protection has had to detain more than half of the migrants who came to the city for hearings in August. The Mexican government has also occasionally refused to accept migrants who have been issued deportation orders but are fighting their cases, the memo says..

The policy has led to overcrowding at migrant shelters along the border, many of which are operated by nonprofits and religious organizations. At cities along the border, migrants have become easy prey for cartels and gangs. The people helping them have become targets, too: In Nuevo Laredo, members of an organized crime group kidnapped the director of a migrant shelter earlier this month. The violence against migrants is so pervasive that advocates refer to the MPP as the Migrant Persecution Protocols.

The Mexican government has attempted to alleviate the strain by busing migrants to cities further from the border, like Monterrey and Tapachula, the later of which is close to the country’s border with Guatemala. That has only complicated things further, since migrants have to return to the U.S. for their court hearings.

Being forced to wait in Mexico has also had legal consequences for migrants, many of whom struggle to find lawyers. A recent report by the Transactional Records Access Clearinghouse at Syracuse University found that less than 1% of migrants who have been forced to wait in Mexico as part of the MPP have lawyers.

As I’ve been saying all along, the bogus “Migrant Protection Protocols” (a/k/a “Return to Mexico,” a/k/a “Let “em Die In Mexico”) are nothing more than a very transparent scheme to deprive asylum applicants who have passed “credible fear” of their statutory, regulatory, and Due Process Constitutional right to be represented by counsel of their choice.

DHS has intentionally made it functionally impossible for U.S. pro bono groups to effectively represent those asylum seekers returned to Mexico.  As we all know, without counsel, applicants have little, if any, realistic chance of succeeding on asylum claims, particularly under Trump’s restrictionist, openly anti-asylum regime.

For some reason, a complicit 9th Circuit Court of Appeals is allowing this legal travesty to proceed. Vulnerable asylum applicants are being abused by Trump on the 9th Circuit’s watch with impunity.

AG William Barr promotes immigration judges with high asylum denial rates

WASHINGTON — The Trump administration has promoted six judges to the immigration appeals court that sets binding policy for deportation cases — all whom have high rates of denying immigrants’ asylum claims.

The six come from courts that have higher asylum-denial rates than the national average, including two from a court that has drawn complaints of unfair proceedings from immigration attorneys and advocates. A third has a long history of denying asylum to domestic violence victims, something the Justice Department has also sought to do.

The new appeals judges, who will now make up more than a quarter of the appellate board, were appointed as the administration works to speed up the immigration courts and narrow migrants’ use of asylum cases to come to the U.S. The six new appointees were sworn in Friday.

The hires are in a new role, in which judges will be allowed to continue serving at any immigration court in the country rather than having to move to suburban Falls Church, Va., where the appeals board’s headquarters are. The new appeals judges will also be allowed to serve as fill-in lower court immigration judges. Critics had suspected the Justice Department, which oversees the immigration courts, created the new positions to pack the board with judges from courts with high rates of denying immigrants’ claims, who may otherwise not have wanted to move to D.C.

The board serves as the appellate body for the immigration court system, an entity separate from the federal courts.

As in the federal system, the immigration board has the power to overrule lower court decisions with three-judge panels. By a majority vote of all its 21 members, it can make those rulings binding on the nation’s nearly 400 immigration judges. Recently, Barr published a new regulation giving himself the power to make any appellate decision binding as well.

By law, the Justice Department is barred from considering political leanings when hiring judges. Agency officials say judges are selected based only on their qualifications for the job, and that their history of rulings is not taken into account.

According to data tracked by Syracuse University from 2013 through 2018, all the judges promoted Friday have records of denying asylum at much higher rates than immigration judges nationally. The Justice Department has in the past questioned Syracuse’s methodology, but does not provide statistics of its own.

Two of the new appeals judges were promoted by Barr from the Atlanta immigration court, which has one of the highest rates of asylum claim denials in the country. The court rejected 95.3% of claims from 2013 to 2018, compared with a national average of 57.6%, Syracuse found.

One of the two new appeals judges from Atlanta, William Cassidy, had a rejection rate of 95.8%, 22nd highest in the country.

Cassidy was also the subject of 11 complaints from immigration attorneys from 2010-2013, according to material obtained by the American Immigration Lawyers Association through a Freedom of Information Act lawsuit. That number of complaints was more than roughly 95% of all other immigration judges in that period, according to information from the lawsuit. Five of the 11 resulted in Cassidy being counseled by a superior on proper judicial behavior.

Also promoted by Barr from the Atlanta court was Earle Wilson, who denied 98.1% of asylum claims from 2013 to 2018, according to Syracuse. That was more than all but five immigration judges in the U.S.

Wilson and Cassidy were also named in two complaints filed by the Southern Poverty Law Center, a civil rights group, in 2017 and 2018 that argued the Atlanta court was treating immigrants unfairly. The complaints said Wilson and Cassidy behaved in an intimidating fashion toward immigrants and their advocates.

It is not clear whether the Justice Department has responded to those complaints. The department said Friday it does not discuss personnel matters.

The other new appellate judges are:

• Keith Hunsucker, who has spent most of his time on the bench at the immigration court at the Port Isabel Detention Center in Texas. While there, he denied 81.6% of asylum cases, consistent with his court’s 81.1% average. Hunsucker is now in Cleveland.

• Deborah Goodwin, appointed from the Miami immigration court. She began hearing cases in 2017, and through last year had a denial rate of 89.4%, above her court’s average of 79.6% in the 2013 to 2018 time frame measured by Syracuse.

• Stephanie Gorman, promoted from the Houston immigration court. She began hearing cases in 2017 and has an 86.9% asylum denial rate, slightly below her court’s 89.3% average.

• Stuart Couch, who was appointed from Charlotte, N.C., denied 92.1% of asylum claims from 2013 to 2018. That was above his court’s average of 88.2%.

Couch also authored a 2017 ruling denying asylum to a Salvadoran woman who was physically and emotionally abused and raped by her ex-husband, a decision that the Board of Immigration Appeals reversed. It was that appellate decision that Sessions overturned to align the law more closely with Couch’s interpretation, saying domestic violence was largely not grounds for asylum. A federal judge has blocked that ruling for now.

Couch’s original decision was one of 10 domestic violence-related cases in 2017 in which the Board of Immigration Appeals found his rulings were “clearly erroneous.” In all 10, Couch rejected the claims of Central American women who had been beaten, raped and otherwise abused by their husbands or partners. The cases were made public as part of a Freedom of Information Act request by immigration attorney Bryan Johnson.

The Justice Department stood behind all the judges.

“DOJ doesn’t track asylum approval and denial rates for individual immigration judges, and (Syracuse) uses its own methodologies in interpreting the data it receives, resulting in conclusions that we cannot verify,” a spokesperson said in a statement. “Collectively these judges combined, have nearly 120 years of immigration law combined, through multiple administrations. Advocates that attack their integrity and professionalism only undermine the entire system.”

Immigration attorneys fear the hires are part of an effort by the Trump administration to skew the courts against immigrants, who face deportation if their claims are denied.

“The board’s primary function is to ensure rule of law and impartiality, yet the department cherry-picked judges from the harshest jurisdictions with the lowest asylum grant rates in the nation,” said Laura Lynch, senior policy counsel for the American Immigration Lawyers Association. “When we’re talking about asylum cases, these decisions are life or death for those seeking protection.”

Lynch’s group, along with the American Bar Association and national union for immigration judges, have called for the immigration courts to be removed from the Justice Department and made independent. Rep. Zoe Lofgren, D-San Jose, has pledged to pursue legislation that would do so through the Judiciary subcommittee on immigration she chairs in the House.

How many refugees will die or be subjected to additional torture and persecution because of thoroughly biased judges and a corrupt “judicial” system controlled by political hacks like Barr. Will Congress and the Article IIIs ever step in and restore some semblance of Due Process? Unless and until they do, the “blood of the innocents” will be on their hands.

Meanwhile, the complicit/complacent Article IIIs who have let this situation get out of control can look forward to being flooded with petitions for review, because the New Due Process Army will continue to fight this unconstitutional, fundamentally unfair, and evil perversion of American justice! 

The idea that six Judges with asylum denial rates astronomically above the national average of 57.1% were the “best qualified” for these appellate jobs is simply absurd. Indeed, probably all of us in the Roundtable of Former Judges know of much better judicial candidates who were passed over so that Barr could install his “Death Squad.” 

As Tal points out, unless piling up bar complaints, being cited by the public for rudeness, being reversed by their BIA, and denying an usually high number of asylum claims are among the “quality ranking factors” for these jobs, it’s hard to see how several of these judges would be considered even minimally qualified for promotion, let alone “best qualified.” It seems that a Congressional investigation into the selection process would be well warranted, including a look at the qualifications of candidates who were passed over.

Human lives are being trivialized by this White Nationalist regime and its enablers.

An Overview and Critique of US Immigration and Asylum Policies in the Trump Era

This paper critiques US immigration and asylum policies from perspective of the author’s 46 years as a public servant. It also offers a taxonomy of the US immigration system by positing different categories of membership: full members of the “club” (US citizens); “associate members” (lawful permanent residents, refugees and asylees); “friends” (non-immigrants and holders of temporary status); and, persons outside the club (the undocumented). It describes the legal framework that applies to these distinct populations, as well as recent developments in federal law and policy that relate to them. It also identifies a series of cross-cutting issues that affect these populations, including immigrant detention, immigration court backlogs, state and local immigration policies, and Constitutional rights that extend to non-citizens. It makes the following asylum reform proposals, relying (mostly) on existing laws designed to address situations of larger-scale migration:

  • The Department of Homeland Security (DHS) and, in particular, US Citizenship and Immigration Services (USCIS) should send far more Asylum Officers to conduct credible fear interviews at the border.
  • Law firms, pro bono attorneys, and charitable legal agencies should attempt to represent all arriving migrants before both the Asylum Office and the Immigration Courts.
  • USCIS Asylum Officers should be permitted to grant temporary withholding of removal under the Convention Against Torture (CAT) to applicants likely to face torture if returned to their countries of origin.
  • Immigration Judges should put the asylum claims of those granted CAT withholding on the “back burner” — thus keeping these cases from clogging the Immigration Courts — while working with the UNHCR and other counties in the Hemisphere on more durable solutions for those fleeing the Northern Triangle states of Central America.
  • Individuals found to have a “credible fear” should be released on minimal bonds and be allowed to move to locations where they will be represented by pro bono lawyers.
  • Asylum Officers should be vested with the authority to grant asylum in the first instance, thus keeping more asylum cases out of Immigration Court.
  • If the Administration wants to prioritize the cases of recent arrivals, it should do so without creating more docket reshuffling, inefficiencies, and longer backlogs

Talk about someone who has spent his entire career increasing human understanding and making the world a better place! Don is a great role model and example for newer members of the NDPA, proving that one can make a difference, as well as a living, in our world by doing great things and good works! Not surprisingly, Don’s career achievements and contributions bear great resemblance to those of our mutual friend, the late Juan Osuna.

 

So, when Don asked me to consider turning some of my past speeches about our immigration system and how it should work into an article to honor Juan, I couldn’t say no. But, I never would have gotten it “across the finish line” without Don’s inspiration, encouragement, editing, and significant substantive suggestions for improvement, as well as that of the talented peer reviewers and editorial staff of JMHS. Like most achievements in life, it truly was a “team effort” for which I thank all involved.

 

Those of you who might have attended my Boynton Society Lecture last Saturday, August 10, at the beautiful and inspiring Bjorklunden Campus of Lawrence University on the shores of Lake Michigan at Bailey’s Harbor, WI, will see that portions of this article were “reconverted” and incorporated into that speech.

 

Also, those who might have taken the class “American Immigration, a Cultural, Legal, and Anthropological Approach” at the Bjorklunden Seminar Series the previous week, co-taught by my friend Professor Jenn Esperanza of The Beloit College Anthropology Department, and me had the then-unpublished manuscript in their course materials, and will no doubt recognize many of the themes that Jenn and I stressed during that week.

CIUDAD JUAREZ, Mexico — For the two dozen migrant children living inside a small church on the outskirts of Ciudad Juarez, most days go like this: breakfast at 8 a.m., dinner at 6 p.m. and hours of nothing in between.

There is no school, and except for a handful of worn Bibles, there are no books. Dangers abound in the surrounding hills, so most haven’t left the razor-wire-ringed compound in weeks or even months.

“I feel imprisoned,” said 16-year-old Alison Mendoza.

She left Nicaragua with her parents and two younger sisters in March after her father received death threats for demonstrating against President Daniel Ortega, whose government has jailed and killed thousands of dissenters.

The family has been waiting here in Juarez for nearly two months for their chance to request political asylum in the United States. A Trump administration policy allows only a handful of asylum seekers to pass through ports of entry at the U.S. border each day.

Mendoza and her sisters, Sol, 6, and Michele, 11, are among the thousands of migrant children languishing along the border as a result of changing migration trends and White House policies that seek to deter asylum seekers.

They left friends and relatives behind and endured the trials of the migrant trail only to end up stuck in camps, cheap hotels and shelters such as Buen Pastor, which is now home to children and their families from as far away as Ghana and Congo. Pawns in an adult’s dispute, their future is entirely uncertain.

Two recent Trump administration mandates are almost certain to result in even larger numbers of migrant children being stranded here.

One calls for asylum seekers to wait in Mexico while their cases are adjudicated. About 3,000 migrant children and their families have been returned to Juarez under that program since April, according to Chihuahua state officials.

A mandate announced this week calls for asylum to be denied to migrants who did not apply for protection in at least one country they passed through while trying to reach the United States.

The rules mean that there is a very strong likelihood that if the Mendozas finally do cross the border to plead their case, they will be sent right back to Juarez.

“What will we do?” said Donald Mendoza, 37, who left behind a good job at a Managua university that would have allowed him to pay for all three girls’ college educations.

The Mexican government has committed to providing schooling to migrants who are returned from the U.S., but Mendoza doesn’t want to raise his girls in notoriously dangerous Juarez, where 10 people were slain on Sunday alone.

“This is not the life I planned for my children,” he said.

Buen Pastor opened its doors about 20 years ago to migrants — back then almost always single men — who passed through Juarez before seeking to sneak across the border.

“They would come, rest for a night or two, and then cross,” said Pastor Juan Fierro Garcia.

But over the last two years, entire families began trudging up the dirt road that leads to the church.

Many had heard that U.S. authorities were releasing migrants as long as they requested asylum and were traveling with children.

“We didn’t know much about the situation, just that families were passing,” said Joseph Venegas, 26, who left Honduras last month with his wife and their two sons.

After crossing into the U.S. illegally last week, and turning themselves in to border authorities, Venegas and his family were held for two days and then released back into Juarez with an order to appear at an asylum hearing in October. A Mexican official told them how to get to Buen Pastor.

Ten-year-old Jose sobbed on the way there. “I want to go back to Honduras,” he wailed.

“We had bad luck,” his father explained. “The law is the law and we have to respect it.”

“We are doing all of this for you,” Venegas added.

Venegas said the family decided to leave because a teachers’ strike meant Jose hadn’t been able to go to school for months.

But now, as he watched Jose sit morosely in one corner of the shelter and his wife nurse their coughing 4-month-old baby on a nearby bench, he wondered whether leaving had been in the best interest of his kids.

“What kind of childhood is this?” he asked.

The experience is a little easier on the younger children, many of whom don’t understand exactly what is happening, and who run around the shelter in a tight pack. The youngsters from Africa speak only a small amount of Spanish, but they still manage to make friends.

The lack of toys means the children entertain themselves around a big table, beating it like a drum until their parents complain or turning it into a fort under which they hide and whisper.

There are several small buildings clustered around the compound — a men’s dormitory, a women’s dormitory and the church sanctuary where families camp out each night on mattresses squeezed between the pews.

The crowded conditions and a constant stream of visitors — nongovernmental organization workers, pro bono lawyers and journalists all asking the same tired questions — mean there is zero privacy. Young women groom themselves and change clothes under the cover of blankets.

A psychologist from the state comes once a week. On a recent morning, she gathered the children around a big round table and led them in breathing exercises.

She asked them to go one by one, saying their names and where they were from.

“I’m Natalia from Honduras,” one girl said.

“I’m Akasia from Congo,” said another.

A thin child from Guatemala declined to speak, burying her head in her arms.

“She is sad,” the 7-year-old boy next to her explained.

“It’s OK,” the psychologist said. “It’s okay to be sad.”

This kind of preventable harm inflicted by an Administration that has declared war on humanity and the rule of law is directly at the feet of three irresponsible Federal Judges of the Ninth Circuit who tanked by vacating the injunction against such gross abuses properly put in place by the U.S. District Judge in Innovation Law Labs v. McAleenan, ostensibly so that their colleagues could “deliberate” (actually “dither”) over a decision that would take responsible judges about 60 minutes to reach!  How do guys like this sleep at night?

The issue in Innovation Law Labs involves the bogus “Migrant Protection Protocols,” more accurately described as “Remain in Mexico” or “Die in Mexico” that intentionally violates both Fifth Amendment Due Process and numerous provisions of the INA, including the rights to access to counsel of one’s own choosing, fair notice of hearings, adequate time to prepare and present a case, and the right to assert withholding of removal to a country where one fears persecution or torture.

Failure of privileged Article III Judges to protect the most vulnerable among us from Executive overreach and abuse, in this case clearly racially motivated, has real life adverse consequences, beyond the “judicial ivory tower,” that in many cases are irreversible.

All of us who believe in justice should be outraged by the Ninth Circuit’s dilatory performance in this case! It’s nothing short of child abuse sanctioned by the Federal Judiciary.  It must stop!

The US will end asylum protections for Central Americans and others who cross through Mexico to reach the southern border, the Trump administration announced Monday, a sweeping, unprecedented move that will quickly be challenged in court.

The new move, which bars asylum for any individual who crosses through a third country but does not apply there for protection before reaching the US southern border, takes effect Tuesday in the form of a regulatory change.

It becomes the latest in a series of attempts by the Trump administration to actively deter asylum seekers from reaching the border. The details of the plan and efforts to implement it were first reported by BuzzFeed News in May, and experts say it would keep hundreds of thousands of people fleeing violence from entering the US.

“With one regulation the US is nearly entirely turning its back on this asylum flow,” Sarah Pierce, an analyst at the Migration Policy Institute, told BuzzFeed News.

Multiple Department of Homeland Security officials who spoke with BuzzFeed News voiced concerns about the administration’s move.

“It’s fucked up,” one official said. “There’s a reason people apply for asylum in the US — we have a robust asylum system. Other countries on the route to the southern border don’t.”

Another said it would be blocked in court.

“Flatly inconsistent with our treaty obligations. Flies in the face of decades of case law. Destined to be enjoined and or struck down immediately,” the official said.

Another DHS official said the move was not only mistaken, but it would backfire on the administration.

“This administration continues to pervert the 1980 Refugee Act and its later amendments by passing regulations that burden its own employees with overly cumbersome, ill-conceived new ‘standards,'” the official said. “This rule will effect all those who reach our southern land border but may have fled from anywhere in the world. It does nothing to fix our broken immigration system, which is at its breaking point because the administration’s mismanagement.”

Administration officials have been working on the plan for weeks, considering it a potential solution to the high rate of families crossing the border.

“Until Congress can act, this interim rule will help reduce a major ‘pull’ factor driving irregular migration to the United States and enable DHS and [the Department of Justice] to more quickly and efficiently process cases originating from the southern border, leading to fewer individuals transiting through Mexico on a dangerous journey,” said acting DHS Secretary Kevin McAleenan.

Advocates said they would move to sue immediately.

Lee Gelernt, deputy director of the Immigrants’ Rights Project of the American Civil Liberties Union, said the group would immediately sue.

“The Trump administration is trying to unilaterally reverse our country’s legal and moral commitment to protect those fleeing danger. This new rule is patently unlawful and we will sue swiftly,” he said.

The ACLU previously filed a lawsuit over the administration’s attempt to ban asylum for those who crossed the border without authorization. The policy was later blocked in federal court and has since not been implemented.

The new regulation would make anyone traveling through Mexico by land to the southern border ineligible for asylum if they did not first seek protection before reaching the US. Immigrants could attempt to receive protection through a process that would be much more difficult.

The ban would apply not just to Central Americans but other non-Mexican nationalities, including Cubans, Haitians, and Venezuelans who in recent months have applied for asylum at the southern border in higher numbers.

The new rule allows for a few exceptions, including if an immigrant was a victim of severe human trafficking or if they traveled through a third country that did not have adequate asylum protections. The person could also avoid the new ban if they can prove that they applied for protection in a third country and later were ordered a final denial. It’s unclear how many people could fit these categories.

“This latest regulation is an attempt to close down one of the few remaining avenues for people in need of protection,” said Ur Jaddou, former chief counsel for the US Citizenship and Immigration Services. “The only ray of light for those seeking safety is that Congress was clear when it enacted the asylum law and this attempt to circumvent it by regulation will likely see the same fate of other Trump administration attacks on the law and result in a federal court injunction.”

WASHINGTON (AP) — The Trump administration on Monday moved to end asylum protections for most Central American migrants in a major escalation of the president’s battle to tamp down the number of people crossing the U.S.-Mexico border.

According to a new rule published in the Federal Register , asylum seekers who pass through another country first will be ineligible for asylum at the U.S. southern border. The rule, expected to go into effect Tuesday, also applies to children who have crossed the border alone.

There are some exceptions: If someone has been trafficked, if the country the migrant passed through did not sign one of the major international treaties that govern how refugees are managed (though most Western countries have signed them) or if an asylum-seeker sought protection in a country but was denied, then a migrant could still apply for U.S. asylum.

But the move by President Donald Trump’s administration was meant to essentially end asylum protections as they now are on the southern border.

The policy is almost certain to face a legal challenge. U.S. law allows refugees to request asylum when they arrive at the U.S. regardless of how they did so, but there is an exception for those who have come through a country considered to be “safe.” But the Immigration and Nationality Act, which governs asylum law, is vague on how a country is determined “safe”; it says “pursuant to a bilateral or multilateral agreement.”

Right now, the U.S. has such an agreement, known as a “safe third country,” only with Canada. Under a recent agreement with Mexico, Central American countries were considering a regional compact on the issue, but nothing has been decided. Guatemalan officials were expected in Washington on Monday, but apparently a meeting between Trump and Guatemalan President Jimmy Morales was canceled amid a court challenge in Guatemala over whether the country could agree to a safe third with the U.S.

The new rule also will apply to the initial asylum screening, known as a “credible fear” interview, at which migrants must prove they have credible fears of returning to their home country. It applies to migrants who are arriving to the U.S., not those who are already in the country.

Trump administration officials say the changes are meant to close the gap between the initial asylum screening that most people pass and the final decision on asylum that most people do not win. But immigrant rights groups, religious leaders and humanitarian groups have said the Republican administration’s policies amount to a cruel and calloused effort to keep immigrants out of the country. Guatemala, Honduras and El Salvador are poor countries suffering from violence .

Along with the administration’s recent effort to send asylum seekers back over the border , Trump has tried to deny asylum to anyone crossing the border illegally and restrict who can claim asylum, and Attorney General William Barr recently tried to keep thousands of asylum seekers detained while their cases play out.

Nearly all of those efforts have been blocked by courts.

Meanwhile, conditions have worsened for migrants who make it over the border seeking better lives. Tens of thousands of Central American migrant families cross the border each month, many claiming asylum. The numbers have increased despite Trump’s derisive rhetoric and hard-line immigration policies. Border facilities have been dangerously cramped and crowded well beyond capacity. The Department of Homeland Security’s watchdog found fetid, filthy conditions for many children. And lawmakers who traveled there recently decried conditions .

Immigration courts are backlogged by more than 800,000 cases, meaning many people won’t have their asylum claims heard for years despite move judges being hired.

People are generally eligible for asylum in the U.S. if they feared return to their home country because they would be persecuted based on race, religion, nationality or membership in a particular social group.

During the budget year for 2009, there were 35,811 asylum claims, and 8,384 were granted. During 2018 budget year, there were 162,060 claims filed, and 13,168 were granted.

The Trump Administration launches its most brazen attack yet on the rule of law, our Constitution, and American Democracy.  But, ultimately it’s likely to fail for the following reasons:

  • As usual, the Trump Administration fails to comply with the Administrative Procedures Act (“APA”) in publishing a major policy change without advance opportunity for notice and comment;
  • The regulation violates the Immigration and Nationality Act’s (“INA’s”) guarantee of a right to apply for asylum except in very limited circumstances not applicable here;
  • A similar regulation purporting to end asylum rights for those applying between ports of entry was immediately halted by the Federal Courts; 
  • Even under the regulation, refugees arriving in the U.S. retain the right to apply for mandatory “withholding of removal” under the INA and the Convention Against Torture (“CAT”) — although the standard is higher, those showing “past persecution” are entitled to a regulatory presumption of future persecution for purposes of withholding of removal under the INA;
  • Smugglers eventually can develop (more dangerous and expensive) water routes to the U.S. which do not require passing through any other “signatory country” on the way;
  • Smugglers could eventually shift their “business model” to higher risk more expensive schemes designed to avoid the U.S. asylum system completely and deposit individuals in the interior of the U.S. where most of them will be able to “lose themselves” among the millions of other foreign nationals residing and working in the U.S. without documentation.

We are diminishing ourselves as a nation, but that won’t stop human migration.

And, remember, YOUR legal and Constitutional rights might be the next casualty of Trump and his out of control band of scofflaws.

WASHINGTON, DC – On July 2, 2019, Attorney General (AG) Barr published a final rule, further expanding his authority to reshape immigration law. The rule was issued in a highly unusual manner by resurrecting an old proposed regulation from 11 years ago and making it final within 60 days without any opportunity for public comment.

AILA President Marketa Lindt said, “This regulation exemplifies why the immigration courts should not be housed under the Department of Justice (DOJ). Under this administration, the AG has already utilized the certification power in an unprecedented manner to unilaterally strip immigration judges of basic operational authorities, interfere with judicial independence, and even attempt to rewrite asylum and detention laws. The American legal system is designed with fundamental procedural protections, such as briefing by the parties, to ensure the decision maker-here the AG-hears all points of view before deciding an important case. This new rule, however, authorizes the AG to singlehandedly designate Board of Immigration Appeals (Board) decisions as precedent – and do so literally overnight bypassing the necessary legal procedures and without any checks and balances.”

Every Court of Appeals Judge who signs off on one of these constitutionally defective removal orders produced by EOIR, an illegitimate “court” that functions without either fundamental fairness or impartiality under procedures that no such judge would accept if applied to them or their loved ones, should hang his or her head in shame.

Once the Trump nightmare is over, courage and integrity to stand up against Government overreach should be the touchstone for all future Article III judicial appointments. No more “go along to get along” Federal Judges at any level of the system! The Judicial Branch was actually conceived and established as a protector of liberty and justice against tyranny, not as an enabler of, and apologist for, “abuses by the Crown” (or in this case, “the Clown”).

AMERICA’S “MASS ATROCITY” — Professor Kate Cronin-Furman Says Don’t Kid Yourself About What The Trump Administration Is Doing In Your Name & How “Ordinary Civil Servants” Carry Out The Unthinkable & Unacceptable!

The debate over whether “concentration camps” is the right term for migrant detention centers on the southern border has drawn long-overdue attention to the American government’s dehumanizing treatment of defenseless children. A pediatrician who visited in June said the centers could be compared to “torture facilities.” Having studied mass atrocities for over a decade, I agree.

At least seven migrant children have died in United States custody since last year. The details reported by lawyers who visited a Customs and Border Protection facility in Clint, Tex., in June were shocking: children who had not bathed in weeks, toddlers without diapers, sick babies being cared for by other children. As a human rights lawyer and then as a political scientist, I have spoken to the victims of some of the worst things that human beings have ever done to each other, in places ranging from Cambodia to the Democratic Republic of the Congo to Sri Lanka. What’s happening at the border doesn’t match the scale of these horrors, but if, as appears to be the case, these harsh conditions have been intentionally inflicted on children as part a broader plan to deter others from migrating, then it meets the definition of a mass atrocity: a deliberate, systematic attack on civilians. And like past atrocities, it is being committed by a complex organizational structure made up of people at all different levels of involvement.

Thinking of what’s happening in this way gives us a repertoire of tools with which to fight the abuses, beyond the usual exhortations to call our representatives and donate to border charities.

Those of us who want to stop what’s happening need to think about all the different individuals playing a role in the systematic mistreatment of migrant children and how we can get them to stop participating. We should focus most on those who have less of a personal commitment to the abusive policies that are being carried out.

Testimony from trials and truth commissions has revealed that many atrocity perpetrators think of what they’re doing as they would think of any other day job. While the leaders who order atrocities may be acting out of strongly held ideological beliefs or political survival concerns, the so-called “foot soldiers” and the middle men and women are often just there for the paycheck.

This lack of personal investment means that these participants in atrocities can be much more susceptible to pressure than national leaders. Specifically, they are sensitive to social pressure, which has been shown to have played a huge role in atrocity commission and desistance in the Holocaust, Rwanda and elsewhere. The campaign to stop the abuses at the border should exploit this sensitivity and put social pressure on those involved in enforcing the Trump administration’s immigration policies.

Here is what that might look like:

The identities of the individual Customs and Border Protection agents who are physically separating children from their families and staffing the detention centers are not undiscoverable. Immigration lawyers have agent names; journalists reporting at the border have names, photos and even videos. These agents’ actions should be publicized, particularly in their home communities.

This is not an argument for doxxing — it’s about exposure of their participation in atrocities to audiences whose opinion they care about. The knowledge, for instance, that when you go to church on Sunday, your entire congregation will have seen you on TV ripping a child out of her father’s arms is a serious social cost to bear. The desire to avoid this kind of social shame may be enough to persuade some agents to quit and may hinder the recruitment of replacements. For those who won’t (or can’t) quit, it may induce them to treat the vulnerable individuals under their control more humanely. In Denmark during World War II, for instance, strong social pressure, including from the churches, contributed to the refusal of the country to comply with Nazi orders to deport its Jewish citizens.

The midlevel functionaries who make the system run are not as visibly involved in the “dirty work,” but there are still clear potential reputational consequences that could change their incentives. The lawyer who stood up in court to try to parse the meaning of “safe and sanitary” conditions — suggesting that this requirement might not include toothbrushes and soap for the children in border patrol custody if they were there for a “shorter term” stay — passed an ethics exam to be admitted to the bar. Similar to the way the American Medical Association has made it clear that its members must not participate in torture, the American Bar Association should signal that anyone who defends the border patrol’s mistreatment of children will not be considered a member in good standing of the legal profession. This will deter the participation of some, if only out of concern over their future career prospects.

The individuals running detention centers are arguably directly responsible for torture, which could trigger a number of consequences at the international level. Activists should partner with human rights organizations to bring these abuses before international bodies like the United Nations Human Rights Council. They should lobby for human rights investigations, for other governments to deny entry visas to those involved in the abuses, or even for the initiation of torture prosecutions in foreign courts. For someone who is “just following orders,” the prospect of being internationally shamed as a rights abuser and being unable to travel freely may be significant enough to persuade them to stop participating.

When those directly involved in atrocities can’t be swayed, their enablers are often more responsive. For-profit companies are supplying food and other material goods to the detention centers. Boycotts against them and their parent entities may persuade them to stop doing so. Employees of these companies can follow the example of Wayfair workers, who organized a walkout on Wednesday in protest of their company’s sale of furniture to the contractor outfitting the detention centers. Finally, anyone can support existing divestment campaigns to pressure financial institutions to end their support of immigration abuses.

Many Americans have been asking each other “But what can we DO?” The answer is that we call these abuses mass atrocities and use the tool kit this label offers us to fight them. So far, mobilization against what’s happening on the border has mostly followed standard political activism scripts: raising public awareness, organizing protests, phoning our congressional representatives. These efforts are critical, but they aren’t enough. Children are suffering and dying. The fastest way to stop it is to make sure everyone who is responsible faces consequences.

Four toddlers were so severely ill and neglected at a U.S. Border Patrol facility in McAllen, Texas, that lawyers forced the government to hospitalize them last week.

The children, all under age 3 with teenage mothers or guardians, were feverish, coughing, vomiting and had diarrhea, immigration attorneys told HuffPost on Friday. Some of the toddlers and infants were refusing to eat or drink. One 2-year-old’s eyes were rolled back in her head, and she was “completely unresponsive” and limp, according to Toby Gialluca, a Florida-based attorney.

She described seeing terror in the children’s eyes.

“It’s just a cold, fearful look that you should never see in a child of that age,” Gialluca said. “You look at them and you think, ‘What have you seen?’”

Another mother at the same facility had a premature baby, who was “listless” and wrapped in a dirty towel, as HuffPost previously reported.

The lawyers feared that if they had not shown up at the facility, the sick kids would have received zero medical attention and potentially died. The Trump administration has come under fire for its treatment ― and its alleged neglect ― of migrants who have been crossing the southern border in record numbers. The result is overcrowded facilities, slow medical care and in some instances, deaths.

Immigration authorities say they’re overwhelmed; activists say they’re not trying hard enough.

“It’s intentional disregard for the well-being of children,” Gialluca said. “The guards continue to dehumanize these people and treat them worse than we would treat animals.”

U.S. Customs and Border Protection declined to respond to HuffPost’s request for comment.

The Associated Press reported this week that children in border facilities don’t have adequate access to food, water, soap or showers. On Tuesday, a Justice Department attorney argued in court that the government should not have to provide detained children with soap, toothbrushes or beds.

The AP report is based on interviews a group of lawyers conducted with hundreds of children in three Texas-based Border Patrol stations last week as part of the Flores settlement ― an agreement that outlines conditions for detained children. The lawyers say children are also being held in these facilities for longer than the 72-hour limit the settlement specifies, and in some cases up to three weeks.

Lawyers are particularly concerned about the spread of illness inside Border Patrol facilities, which can sometimes turn fatal. Five children have died in Border Patrol custody since December, some of whom were initially diagnosed with a common cold or the flu. The processing center in McAllen, known as Ursula, recently quarantined three dozen migrants who were sick after a 16-year-old died of the flu at the same facility.

Children and their parents told lawyers that in some cases they didn’t have any access to medical treatment in Border Patrol facilities despite being visibly ill. Gialluca spoke with one 16-year-old mother whose toddler had the flu, but was told by a guard the child “wasn’t sick enough to see a doctor.” She said others also reported being denied medical attention despite having critically sick babies.

Medical experts say that because children have less developed immune and respiratory systems, their symptoms can escalate quickly if they aren’t properly treated.

Dr. Julie Linton, the co-chair of the American Academy of Pediatrics, previously told HuffPost that children can’t recover from illnesses in Border Patrol facilities. These centers are described as “hieleras” ― Spanish for iceboxes ― because of their freezing temperatures, and migrants describe sleeping on floors under bright lights that shine 24/7, with nothing but Mylar blankets to keep warm.

Gialluca met one 16-year-old mother whose 8-month-old baby was sick with the flu and forced to sleep outside for four days at the McAllen Border Patrol station. The mother said the guards took the clothing off the baby’s back, leaving her in a diaper, and forced them to sleep on concrete without a blanket.

A sick 2-year-old girl was shivering in a T-shirt and had shallow breathing, according to Mike Fassio, a Seattle-based immigration attorney who visited Ursula.

“I was very, very concerned,” he said, adding lawyers spoke with immigrants in a room outside of the facility. “When she left us, I knew she was going back to a place that was cold, crowded and unsanitary.” Fassio noted that guards referred to the children as “bodies.”

Some children were so exhausted they fell asleep during the interviews, said Clara Long, a senior researcher at Human Rights Watch who spoke with kids at a facility in Clint, Texas. Long met a 3-year-old boy who was dirty with matted hair and was being taken care of by his 11-year-old brother. She said that more than 10 sick children were being quarantined in cells.

While the group of roughly eight lawyers and interpreters at Ursula were supposed to be interviewing children about conditions in the facilities, they also ended up asking guards and government officials to bring kids to the hospital because they were so worried about their state. Gialluca added that she and her colleagues interviewed only a small portion of migrants in the facility, which is the largest processing center in the U.S. and can hold up to 1,000 people. She believes the number of migrants in need of hospitalization is likely much higher.

Government officials have blamed horrific conditions at detention facilities on the fact that Congress has not yet passed an emergency funding package that would include almost $3 billion to help care for unaccompanied migrant children. But Gialluca says border officials shouldn’t need more resources to treat immigrants like human beings.

“Money isn’t keeping guards from allowing people to access toilets,” she said. “Money isn’t causing guards to take clothing and medicine away from children.”

8-YEAR-OLD MIGRANTS BEING FORCED TO CARE FOR TODDLERS IN DETENTION CAMPS

 

A team of lawyers conducted 60 interviews with migrant children being held in an El Paso, Texas, detention camp and found conditions to be dismal.

Fifteen of those in the holding center had the flu and 10 more are quarantined with illness, according to the lawyers, who first gave the data to the Associated Press. Three infants are being detained alongside their teenage mothers, and many children are under the age of 12.

“A Border Patrol agent came in our room with a 2-year-old boy and asked us, ‘Who wants to take care of this little boy?’ Another girl said she would take care of him, but she lost interest after a few hours and so I started taking care of him yesterday,” one teenaged girl told the lawyers in an interview. The boy was not wearing a diaper and his shirt was covered in mucus, she said.

Law professor Warren Binford, who aided in the interviews, said she witnessed an 8-year-old girl caring for a 4-year-old child who was very dirty, the girl was unable to get the boy to take a shower. She also described the children she interviewed as sleep-deprived, often falling asleep while speaking with her.

“In my 22 years of doing visits with children in detention, I have never heard of this level of inhumanity,” said Holly Cooper, co-director of the University of California, Davis’ Immigration Law Clinic, to the AP.

The lawyers were inspecting the facility as part of the Flores agreement, which resulted from a landmark 1985 case that established that facilities where minor migrants are held must be kept “safe and sanitary.”

A representative of the Trump administration, the Justice Department’s Sarah Fabian, argued Tuesday that safe and sanitary conditions don’t necessarily have to include toothbrushes, soap or towels for children.

TRUMP ADMINISTRATION PLANS MAJOR ICE RAIDS FOR SUNDAY
U.S. immigration authorities plan to raid Miami, Houston, Chicago and Los Angeles and other cities. They intend to arrest up to 2,000 families, three U.S. officials with knowledge of the plans told The Washington Post. The orders reportedly come directly from President Donald Trump.

On Monday, the president tweeted: “Next week ICE will begin the process of removing the millions of illegal aliens who have illicitly found their way into the United States. They will be removed as fast as they come in.”

Officials told The Washington Post that the Department of Homeland Security agency plans to hold families in hotel rooms until they are deported. Acting DHS Secretary Kevin McAleenan is allegedly targeting families that have completely dropped out of the court process, but has warned that the operation could lead to further cases of families being separated.

Los Angeles Police Department Chief Michel Moore confirmed the raids on Friday, saying that about 140 families in southern California will be targeted in pre-dawn raids early next week. The chief also made clear that the raids are done on a federal level and that the police department will not be involved.

On Thursday, Carla Provost, chief of the United States Border Patrol argued that the Department of Homeland Security was not receiving enough money to properly care for migrants on the southern border, and that was leading to terrible conditions in detention centers. On Wednesday, the Senate Appropriations Committee agreed to $4.6 billion in emergency funds for what the Trump administration has referred to as a “border crisis.”

Texas Congressman Joaquin Castro questioned how the agency could afford mass raids while asking for more money Friday. “The Trump Administration says it needs more money (supplemental bill) for the situation at the border yet they may be starting massive immigration raids next week. So how do you have the money for that if you’re running out of money ICE?” he tweeted.

“These potential raids are a disgusting political ploy to stoke fear and rile up Trump’s base for 2020,” wrote Sandra Cordero, Director of Families Belong Together, an immigration advocacy group, in a statement. “Past raids have left children alone and afraid in empty homes, praying they won’t be left to care for younger siblings by themselves, with no idea if they’ll see their parents again. This is yet another flagrant disregard for the welfare of children on behalf of a cruel administration bent on fomenting fear and creating chaos.”

Come on, Carla, cut the BS and butt covering. The “mix” of arrivals at the Southern Border began to shift to refugee families from the Northern Triangle back in the summer of 2014. So, CBP and DHS have had five years to prepare for this “change” which is actually “old news.” 

More “old news” is the increased flow of asylum seekers with kids which began back before Thanksgiving. Plenty of time for CBP and DHS to bring back retired asylum officers and adjudicators and reassign other adjudicative personnel to the border to insure prompt, orderly, safe, and efficient processing of asylum applicants at ports of entry, thus eliminating the incentive (or necessity) for folks to turn themselves in after crossing the border between ports.

Also, plenty of time to work with NGOs, pro bono groups, states, and communities to insure representation and proper placement of family groups in various locations throughout the country without panic or “dumping.” 

Another bogus claim spread by Trump, Provost, and the rest of the sycophants: that the prevalence of kids among new asylum arrivals is somehow totally a response to the Flores settlement (which actually has been in effect for decades).

Undoubtedly, with the Trump Administration’s active assistance, unscrupulous smugglers and coyotes are encouraging some folks to bring children as the only way to have a shot at fair processing under the tilted U.S. asylum system promoted by Trump. Indeed, as I have observed before, the Trump Administrations has consistently been a “best friend” to gangs, smugglers, traffickers, cartels, and druggies seeking to “jack up” profits by further exploiting the human misery caused by the Trump Administration’s “maliciously incompetent “ approach to immigration, effective law enforcement, and humanity generally. https://apple.news/AFQw_eqcHSZCYxUznmP0wpQ

Undoubtedly, some of these unscrupulous individuals are telling families to travel with kids. But, the truth is that according to the UNHCR, over one-half of today’s refugees are children. https://www.unhcr.org/children-49c3646c1e8.html.

So, the prevalence of children among new arrivals should properly been seen as part of a sad worldwide trend that Trump and his cronies disgustingly have done everything possible to encourage, exploit, and aggravate. It most certainly is not primarily caused by the Flores settlement or by giving soap, toothbrushes, blankets, or medical care to children being abused in the “DHS Gulag” administered in part by disingenuous folks like Provost.

Any honest observer of what’s going on knows that the majority of the asylum applications that passed credible fear probably could have been granted (or given protection under the Convention Against Torture — “CAT”) by the Asylum Office without even going to Immigration Court under the proper generous interpretation of our asylum laws, an honest interpretation of CAT that reflects the true conditions in the Northern Triangle, and a very “doable” change in procedures. 

Only dishonest fools in the Trump Administration (and a few from the Obama Administration) would maintain that gender isn’t a social group subject to widespread persecution in the Northern Triangle, deny that gangs have assumed the role of quasi-governmental entities thus making most of the harm they inflict on resisters “political persecution,” and make the beyond ludicrous claim that the corrupt failed states of the Northern Triangle have either the ability or much real interest in protecting those subject to persecution.

And, Carla, why aren’t you out there today registering a public protest of the waste of time and funds in ICE going after families with ridiculously inappropriate “raids” when every  resource could and should be focused instead on providing humanitarian assistance to asylum seekers arriving at the Southern Border?

This racist-inspired  “Sunday Morning Reign of Terror” directed at U.S. ethnic communities is specifically designed to return helpless families to the very dangerous countries from which they originally fled! Thus, Trump and his phony DHS are intentionally feeding “fresh meat” to gangs and cartels and insuring that the cycle of northward migration, no matter how dangerous, will continue until everyone who needs to leave its either gone or dead (the latter apparently the “solution” favored by Provost, Trump, Morgan, McAleenan, Miller, and others).

Provost, McAleenan, Morgan, and their co-conspirators are all participants in a cynical scheme to intentionally “crash” the asylum system, rather than competently administering it. They are intentionally endangering the lives of children and other vulnerable asylum seekers, many entitled to legal protections, to promote, along with GOP restrictionists, totally bogus, dishonest, and completely unnecessary and unwarranted restrictions of the precious, life-saving right of refugees to seek asylum in the U.S. 

It’s an unbelievably dishonest and cowardly scheme, and a complete breach of both oaths of office and public trust. It might be that those who long ago abandoned American values will lap up this insult to human values and human dignity.

But, there are plenty of us out here who know and understand exactly what you are doing. We will not only resist it, but will be historical witnesses to your cruel, inhuman, and unlawful schemes and gimmicks to “abuse and kill the innocent.” And, we’ll be keeping count.

GUATEMALA CITY (Reuters) – A U.S. plan to make asylum seekers from Honduras and El Salvador seek refuge in Guatemala instead of the United States would endanger, not protect, refugees, a prominent rights group said on Friday as U.S. negotiators met Guatemalan officials.

U.S. rights group Human Rights First said it was “simply ludicrous” for the United States to assert that Guatemala was capable of protecting refugees, when its own citizens are fleeing violence. 

“The Trump administration is doubling down on its efforts to block, bar and punish refugees for attempting to seek asylum in the United States,” said Eleanor Acer, senior director for refugee protection at Human Rights First.

“These policies put the lives of refugees in great danger.”

Guatemala, like its neighbors Honduras and El Salvador, suffers high levels of violence, driven largely by transnational street gangs including MS-13, which operate across borders in all three countries. Many asylum seekers cite gang threats as the reason they come to the United States for refuge.

Tens of thousands of people have left Guatemala to seek U.S. asylum this year. Nearly 150,000 undocumented Guatemalan families have reached the U.S. border since October, according to U.S. Customs and Border Protection, many of them citing fear of violence in their home country for seeking asylum.

U.S. Vice President Mike Pence said this week the two nations had a deal under which Guatemala would take asylum seekers from neighbors. “They ought to be willing to apply for asylum in the first safe country in which they arrive,” he said.

Details of the plan have not been made public, and Guatemala has not publicly confirmed talks that the U.S. State Department said were taking place in Guatemala on Friday.

The talks were about a range of initiatives aimed at reducing illegal immigration, including “improved asylum processing,” a State Department spokeswoman said on Friday in response to a Reuters question about the Guatemala asylum plan.

The emerging plans flow from a U.S.-Mexican deal struck to avert tariffs threatened by U.S. President Donald Trump to push Mexico to do more to stem immigration through its territory.

That deal included sending 6,000 members of Mexico’s National Guard to the border and expanding a separate asylum program under which U.S. asylum seekers are sent back to Mexico to await U.S. court hearings.

If those measures fail, Mexico has agreed to consider becoming a “safe third country” where all asylum seekers passing through the country would have to apply for refuge, instead of the United States

Mexico’s Foreign Minister Marcelo Ebrard said other countries should share the load, including Guatemala.

Guatemala, one of the poorest countries in the Americas, has little experience receiving large numbers of asylum seekers and a large wave of refugees would strain limited resources. Just 262 people applied for refugee status in Guatemala between January and November 2018, according to data from the U.N. rights agency UNHCR.

By comparison, nearly 155,000 families from El Salvador and Honduras have been apprehended at the U.S. border since October, with many of them requesting asylum.

Guatemala holds presidential elections on Sunday, after a campaign that has highlighted the lack of rule of law in the country, including the influence of drug traffickers on politics in the country.

As pointed out in the article, Guatemala is one of the most dangerous countries in the world for its own citizens.  It doesn’t even have a functioning asylum system. So, how could it provide access to a “full and fair” asylum adjudications to non-citizens as required by our law.  The answer is simple – it can’t, by any stretch of the imagination. After all, living long enough to apply, even if there were a functional asylum adjudication system, would be a prerequisite to a legitimate “Safe Third Country” process.

Seems like clear abuses of authority like this by Trump and Pence that should be enough to remove both of them from office forthwith in a functioning democracy. But, that’s not going to happen before 2021, if then.

In the meantime, Dems should make a note that when responsible Government returns at some point in the future, the law should be amended to require at least Senate ratification of any future “Safe Third Country Agreement” to prevent future Executive abuses like this. Indeed, the failure of this Congress to revoke Trump’s authority to enter into these clearly bogus and ill-intended “Safe Third Country” agreements is an indelible stain upon its reputation.

“Safe Third Country” was intended to be about refugee burden sharing among countries with substantially comparable due process systems for adjudicating claims under the Refugee Convention. It was never intended to allow the U.S. to “outsource” asylum adjudication to dangerous, major human rights violators with dysfunctional asylum adjudication systems. What Trump and Pence are proposing is little more than outright murder and human rights abuses inflicted on asylum seekers in violation of both international and U.S. laws.

Sindy Marilu Alvarez Lagos testified credibly that she and her then-seven-year-old daughter, natives and citizens of Honduras, were threatened with gang rape, genital mutilation, and death if they did not comply with the extortionate demands of a Barrio 18 gang member. Unable to meet those demands and fearing for their lives, Alvarez Lagos and her daughter fled to the United States, where they sought asylum, withholding of removal, and protection under the Convention Against Torture.

Now, almost five years later, an immigration judge and the Board of Immigration Appeals have issued a total of three separate decisions denying Alvarez Lagos’s claims. The government defends none of those decisions, including the most recent, which came after we agreed, at the government’s request, to remand the case for reconsideration. Instead, the government admits that errors remain, but argues that we should leave them unaddressed and simply remand once again so that the agency may have a fourth opportunity to analyze Alvarez Lagos’s claims correctly.

We decline that request. A remand is required here on certain questions that have yet to be answered, or answered fully, by the agency. But we take this opportunity to review the agency’s disposition of other elements of Alvarez Lagos’s claims. For the reasons given below, we reverse the agency’s determination with respect to the “nexus” requirement for asylum and withholding of removal. And so that they will not recur on remand, we identify additional errors in the agency’s analysis of the “protected ground” requirement for the same forms of relief, and in the agency’s treatment of Alvarez Lagos’s claim under the Convention Against Torture.

It’s partially on the Article IIIs. Great decision in many ways. But, this type of injustice occurs daily in our unconstitutional U.S. Immigration Courts. How many Central American asylum applicants get this type of representation—Steve Shulman of Akin Gump for a pro bono lawyer, Tom Boerman as an expert? Not very many.

How many can be this persistent, particularly if detained or sent to Mexico to wait? Almost none! I think that if these respondents were in “Return to Mexico” they would have long ago been forced to give up and accept “Death Upon Return.”

This case should have been a “no brainer grant” five years ago. Could have been done at an Asylum Office (under a more rational system) or by DHS stipulation. THIS abuse of the legal system and gross waste of public resources by DHS and DOJ is the reason why we have unmanageable Immigration Court backlogs, not because asylum applicants and their representatives assert their legal rights.

The Office of Immigration Litigation (“OIL”) didn’t even bother to defend any of the EOIR actions here!  So, after five years why is it “Due Process” for the Fourth Circuit to give the BIA yet another opportunity to come up with bogus reasons to deny asylum.

An Article III Court fulfilling its oath to uphold the laws and Constitution could have ordered this case to be granted and either exercised contempt authority against those at DOJ responsible for this mess or ordered an independent investigation into the judicial incompetence and bias evident here. At the least, the court should have removed any judge having had a role in this abomination from any future proceedings involving these respondents.

Cases such good as this also illustrate the continuing dereliction of duty by Article III Courts who continue to “go along top get along” with the absurdly unconstitutional position that unrepresented asylum applicants can receive “Due Process” in today’s overtly unfair and biased Immigration Courts. The Due Process clause applies to all persons in the U.S., and the right to a fair asylum hearing exceeds the rights at stake in 98% of the civil litigation and most of the criminal litigation in the Federal Courts. If the Article III Courts actually viewed asylum applicants as “persons,” that is “fellow human beings,” rather than dehumanized “aliens,” this farce would have ended decades ago! Folks represented by Steve Schulman and Akin Gump can’t get a “fair shake” from EOIR; what chance does any unrepresented applicant have?

You reap what you sow, and what goes around comes around! If Article III Courts want to be taken seriously and respected, they must step up to the plate and stop the systematic bias against asylum applicants (particularly women and children from Central America) and the abuses like this occurring every day in our unconstitutional U.S. Immigration Courts!

History is watching and making a record, even if those wronged by the Article IIIs all too often don’t survive or aren’t in a position to confront them with their dereliction of legal duties and the obligations human beings owe to each other.

Before I introduce the Dream Teamsitting to my right, a bit of asylum history.

In 1987, the Supreme Court established in INS v. Cardoza-Fonseca that a well founded fear of persecution for asylum was to be interpreted generously in favor of asylum applicants. So generously, in fact, that someone with only a 10% chance of persecution qualifies.

Shortly thereafter, the BIA followed suit with Matter of Mogharrabi, holding that asylum should be granted even in cases where persecution was significantly less than probable. To illustrate, the BIA granted asylum to an Iranian who suffered threats at the Iranian Interests Section in Washington, DC. Imagine what would happen to a similar case under todays regime!

In the 1990s, the Legacy INSenacted regulations establishing that those who had suffered past persecutionwould be presumed to have a well-founded fear of future persecution, unless the Government could show materially changed circumstances or a reasonably available internal relocation alternative that would eliminate that well-founded fear. In my experience as a judge, that was a burden that the Government seldom could meet.  

But the regulations went further and said that even where the presumption of a well founded fear had been rebutted, asylum could still be granted because of egregious past persecutionor other serious harm.

In 1996, the BIA decided the landmark case of Matter of Kasinga, recognizing that abuses directed at women by a male dominated society, such as female genital mutilation(FGM), could be a basis for granting asylum based on a particular social group.Some of us, including my good friend and colleague Judge Lory Rosenberg, staked our careers on extending that much-need protection to women who had suffered domestic violence. Although it took an unnecessarily long time, that protection eventually was realized in the 2014 precedent Matter of A-R-C-G-, long after our forced departurefrom the BIA.

And, as might be expected, over the years the asylum grant rate in Immigration Court rose steadily, from a measly 11% in the early 1980s, when EOIR was created, to 56% in 2012, in an apparent long overdue fulfillment of the generous legal promise of Cardoza-Fonseca. Added to those receiving withholding of removal and/or relief under the Convention Against Torture (CAT), approximately two-thirds of asylum applicants were receiving well-deserved, often life-saving legal protection in Immigration Court.

Indeed, by that time, asylum grant rates in some of the more due-process oriented courts with asylum expertise like New York and Arlington exceeded 70%, and could have been models for the future. In other words, after a quarter of a century of struggles, the generous promise of Cardoza-Fonseca was finally on the way to being fulfilled. Similarly, the vision of the Immigration Courts as through teamwork and innovation being the worlds best administrative tribunals guaranteeing fairness and due process for allwas at least coming into focus, even if not a reality in some Immigration Courts that continued to treat asylum applicants with hostility.

And, that doesnt count those offered prosecutorial discretion or PDby the DHS counsel. Sometimes, this was a humanitarian act to save those who were in danger if returned but didnt squarely fit the somewhat convoluted refugeedefinition as interpreted by the BIA. Other times, it appeared to be a strategic move by DHS to head off possible precedents granting asylum in close casesor in emerging circumstances.

In 2014, there was a so-called surgein asylum applicants, mostly scared women, children, and families from the Northern Triangle of Central America seeking protection from worsening conditions involving gangs, cartels, and corrupt governments.There was a well-established record of femicide and other widespread and largely unmitigated gender-based violence directed against women and gays, sometimes by the Northern Triangle governments and their agents, other times by gangs and cartels operating with the knowledge and acquiescence of the governments concerned.

Also, given the breakdown of governmental authority and massive corruption, gangs and cartels assumed quasi-governmental status, controlling territories, negotiating treaties,exacting involuntary taxes,and severely punishing those who publicly opposed their political policies by refusing to join, declining to pay, or attempting to report them to authorities. Indeed, MS-13 eventually became the largest employer in El Salvador. Sometimes, whole family groups, occupational groups, or villages were targeted for their public acts of resistance.

Not surprisingly in this context, the vast majority of those who arrived during the so-called surgepassed credible fearscreening by the DHS and were referred to the Immigration Courts, or in the case of unaccompanied minors,to the Asylum Offices, to pursue their asylum claims.

The practical legal solution to this humanitarian flow was obvious help folks find lawyers to assist in documenting and presenting their cases, screen out the non-meritorious claims and those who had prior gang or criminal associations, and grant the rest asylum. Even those not qualifying for asylum because of the arcane nexusrequirements appeared to fit squarely within the CAT protection based on likelihood of torture with government acquiescence upon return to the Northern Triangle. Some decent BIA precedents, a robust refugee program in the Northern Triangle, along with continued efforts to improve the conditions there would have sealed the deal.In other words, the Obama Administration had all of the legal tools necessary to deal effectively and humanely with the misnamed surgeas what it really was a humanitarian situation and an opportunity for our country to show human rights leadership!

But, then things took a strange and ominous turn. After years of setting records for deportations and removals, and being disingenuously called soft on enforcementby the GOP, the Obama Administration began believing the GOP myths that they were wimps. They panicked! Their collective manhooddepended on showing that they could quickly return refugees to the Northern Triangle to deterothers from coming. Thus began the weaponizationof our Immigration Court system that has continued unabated until today.

They began imprisoning families and children in horrible conditions and establishing so-called courtsin those often for profit prisons in obscure locations where attorneys generally were not readily available. They absurdly claimed that everyone should be held without bond because as a group they were a national security risk.They argued in favor of indefinite detention without bond and making children and toddlers represent themselvesin Immigration Court.

The Attorney General also sent strong messages to EOIR that hurrying folks through the system by prioritizingthem, denying their claims, stuffingtheir appeals, and returning them to the Northern Triangle with a mere veneer of due process was an essential part of the Administrations get toughenforcement program. EOIR was there to send a messageto those who might be considering fleeing for their lives dont come, you wont get in, no matter how strong your claim might be.

They took judges off of their established dockets and sent them to the Southern Border to expeditiously remove folks before they could get legal help. They insisted on jamming unprepared cases of recently arrived juveniles and adults with childrenin front of previously docketed cases, thereby generating total chaos and huge backlogs through what is known as aimless docket reshuffling(ADR).

Hurry up scheduling and ADR also resulted in more in absentiaorders because of carelessly prepared and often inadequate or wrongly addressed noticessent out by overwhelmed DHS and EOIR court staff. Sometimes DHS could remove those with in absentia orders before they got a chance to reopen their cases. Other times, folks didnt even realize a removal order had been entered until they were on their way back.

They empowered judges with unusually high asylum denial rates. By a ratio of nine to one they hired new judges from prosecutorial backgrounds, rather than from the large body of qualified candidates with experience in representing asylum applicants who might actually have been capable of working within the system to fairly and efficiently recognize meritorious cases, promote fair access to pro bono counsel, and insure that doubtful cases or those needing more attention did not get lostin the artificial backlogs being created in an absurdly mismanaged system. In other words, due process took a back seat to expedienceand fulfilling inappropriate Administration enforcement goals.

Asylum grant rates began to drop, even as conditions on the ground for refugees worldwide continued to deteriorate. Predictably, however, detention, denial, inhumane treatment, harsh rhetoric, and unfair removals failed to stop refugees from fleeing the Northern Triangle.

But, just when many of us thought things couldnt get worse, they did. The Trump Administration arrived on the scene. They put lifelong White Nationalist xenophobe nativists Jeff Sessions and Stephen Miller in charge of eradicating the asylum process. Sessions decided that even artificially suppressed asylum grant rates werent providing enough deterrence; asylum seekers were still winning too many cases. So he did away with A-R-C-G- and made it harder for Immigration Judges to control their dockets.

He tried to blame asylum seekers and their largely pro bono attorneys, whom he called dirty lawyers,for having created a population of 11 million undocumented individuals in the U.S. He promoted bogus claims and false narratives about immigrants and crime. Perhaps most disgustingly, he was the mastermindbehind the policy of child separationwhich inflicted lifetime damage upon the most vulnerable and has resulted in some children still not being reunited with their families.

He urged judgesto summarily deny asylum claims of women based on domestic violence or because of fear of persecution by gangs. He blamed the judges for the backlogs he was dramatically increasing with more ADR and told them to meet new quotas for churning out final orders or be fired. He made it clear that denials of asylum, not grants, were to be the new normfor final orders.

His sycophantic successor, Bill Barr, an immigration hard-liner, immediately picked up the thread by eliminating bond for most individuals who had passed credible fear. Under Barr, the EOIR has boldly and publicly abandoned any semblance of due process, fairness, or unbiased decision making in favor of becoming an Administration anti-asylum propaganda factory. Just last week they put out a bogus fact sheetof lies about the asylum process and the dedicated lawyers trying to help asylum seekers. The gist was that the public should believe that almost all asylum seekers from the Northern Triangle are mala fide and that getting them attorneys and explaining their rights are a waste of time and money.

In the meantime, the Administration has refused to promptly process asylum applicants at ports of entry; made those who have passed credible fear wait in Mexicoin dangerous and sometimes life-threatening conditions; unsuccessfully tried to suspend the law allowing those who enter the U.S. between ports of entry to apply for asylum; expanded the New American Gulagwith tent cities and more inhumane prisons dehumanizingly referred to as bedsas if they existed without reference to those humans confined to them;  illegally reprogrammed money that could have gone for additional humanitarian assistance to a stupid and unnecessary wall;and threatened to dumpasylum seekers to punishso-called sanctuary cities.Perhaps most outrageously, in violation of clear statutory mandates, they have replaced trained Asylum Officers in the credible fearprocess with totally unqualified Border Patrol Agents whose job is to make the system adversarialand to insure that fewer individuals pass credible fear.

The Administration says the fact that the credible fearpass rate is much higher than the asylum grant rate is evidence that the system is being gamed.Thats nativist BS! The, reality is just the opposite: that so many of those who pass credible fear are eventually rejected by Immigration Judges shows that something is fundamentally wrong with the Immigration Court system. Under pressure to produce and with too many biased, untrained, and otherwise unqualified judges,many claims that should be granted are being wrongfully denied.

Today, the Immigration Courts have become an openly hostile environment for asylum seekers and their representatives. Sadly, the Article III Courts arent much better, having largely swallowed the whistleon a system that every day blatantly mocks due process, the rule of law, and fair and unbiased treatment of asylum seekers. Many Article IIIs continue to deferto decisions produced not by expert tribunals,but by a fraudulent court system that has replaced due process with expediency and enforcement.

But, all is not lost. Even in this toxic environment, there are pockets of judges at both the administrative and Article III level who still care about their oaths of office and are continuing to grant asylum to battered women and other refugees from the Northern Triangle. Indeed, I have been told that more than 60 gender-based cases from Northern Triangle countries have been  granted by Immigration Judges across the country even after Sessionss blatant attempt to snuff out protection for battered women in Matter of A-B-. Along with dependent family members, that means hundreds of human lives of refugees saved, even in the current age.

Also significantly, by continuing to insist that asylum seekers from the Northern Triangle be treated fairly in accordance with due process and the applicable laws, we are making a record of the current legal and constitutional travesty for future generations. We are building a case for an independent Article I Immigration Court, for resisting nativist calls for further legislative restrictions on the rights of asylum seekers, and for eventually holding the modern day Jim Crowswho have abused the rule of law and human values, at all levels of our system, accountable, before the court of historyif nothing else!

Eventually, we will return to the evolving protection of asylum seekers in the pre-2014 era and eradicate the damage to our fundamental values and the rule of law being done by this Administrations nativist, White Nationalist policies.Thats what the New Due Process Armyis all about.

Shootouts, armed raids and last-minute pleas to stop the bloodshed formed the central threads of their stories. MS-13 wanted the neighborhood to sell drugs. The other gangs wanted it to extort and steal. But the members of Casa Blanca had promised never to let their neighborhood fall prey to that again. And they would die for it, if they had to.

Almost no one was trying to stop the coming war — not the police, not the government, not even the young men themselves. The only person working to prevent it was a part-time pastor who had no church of his own and bounced around the neighborhood in a beat-up yellow hatchback, risking his life to calm the warring factions.

“I’m not in favor of any gang,” said the pastor, Daniel Pacheco, rushing to the Casa Blanca members after the shooting. “I’m in favor of life.”

The struggle to protect the neighborhood — roughly four blocks of single-story houses, overgrown lots and a few stores selling chips and soda — encapsulates the inescapable violence that entraps and expels millions of people across Latin America.

Since the turn of this century, more than 2.5 million people have been killed in the homicide crisis gripping Latin America and the Caribbean, according to the Igarapé Institute, a research group that tracks violence worldwide.

The region accounts for just 8 percent of the global population, yet 38 percent of the world’s murders. It has 17 of the 20 deadliest nations on earth.

And in just seven Latin American countries — Brazil, Colombia, Honduras, El Salvador, Guatemala, Mexico and Venezuela — violence has killed more people than the wars in Afghanistan, Iraq, Syria and Yemen combined.

The violence is all the more striking because the civil wars and military dictatorships that once seized Latin America have almost all ended — decades ago, in many cases. Most of the region has trudged, often very successfully, along the prescribed path to democracy. Yet the killings continue at a staggering rate.

They come in many forms: state-sanctioned deaths by overzealous armed forces; the murder of women in domestic disputes, a consequence of pervasive gender inequality; the ceaseless exchange of drugs and guns with the United States.

Underpinning nearly every killing is a climate of impunity that, in some countries, leaves more than 95 percent of homicides unsolved. And the state is a guarantor of the phenomenon — governments hollowed out by corruption are either incapable or unwilling to apply the rule of law, enabling criminal networks to dictate the lives of millions.

For the masses fleeing violence and poverty in Central America, the United States is both a cause and solution — the author of countless woes and a chance to escape them.

Frustrated with the stream of migrants treading north, President Trump has vowed to cut aid to the most violent Central American nations, threatening hundreds of millions of dollars meant to address the roots of the exodus.

But the surviving members of Casa Blanca, who once numbered in the dozens, do not want to flee, like tens of thousands of their countrymen have. They say they have jobs to keep, children to feed, families, neighbors and loved ones to protect.

“There is only one way for this to end,” said Reinaldo. “Either they kill us or we kill them.”

Trump’s complete lack of humanity, empathy, and his constant racist-inspired lies and misrepresentations about refugees and asylum seekers are truly reprehensible.

But, he and his henchmen like Stephen Miller are by no means the entire problem.

Every day in U.S. Immigration Court, DHS attorneys make demonstrably false representations minimizing the truly horrible conditions in the Northern Triangle, particularly for women. Every day, some U.S. Immigration Judges betray their oaths of office by accepting those false representations and using them, along with an unfairly skewed anti-asylum view of the law, to deny asylum cases that should be granted.

And, perhaps worst of all, every day some life-tenured Article III Circuit Judges turn a blind eye to the legal travesty and due process disaster taking place throughout our corrupted Immigration Courts by rubber stamping results that would be totally unacceptable in any other type of litigation and which don’t even pass the “straight face test.” I guess “out of sight is out of mind,” and the wrongfully deported are “out of sight” (or maybe dead, in hiding, or duressed into joining or cooperating with gangs after the U.S. failed to protect them)

But, there are folks our there resisting this malfeasance and dereliction of duty. Among other things, they are memorializing what is happening and making a record of where the “modern day Jim Crows” and their enablers stand and what they have done to their fellow human beings in the name of “expedience” and an “Alfred E. Neuman (“What Me Worry”)” view of the law and our legal system.

Donald Trump is horrible. But, his racism and infliction of lasting damage on our country and on humanity depend on too many judges and other supposedly responsible public officials supporting, acquiescing, enabling, or minimizing his inhumane, dishonest, counterproductive, and often illegal actions.

An appropriate response by an honest, competent Administration with integrity would be:

  • Establish legal precedents recognizing those fleeing politicized gang violence, domestic violence, and violence directed at famnilies as refugees;
  • Establish precedents incorporating the Article III decisions emphasizing the concept of “mixed motive” in determining “nexus” under asylum and withholding of removal laws;
  • Establish precedents granting temporary withholding of removal under the Convention Against Torture (“CAT”) to those who face torture at the hands of the gangs or Northern Triangle governments (or both), but who can’t establish the convoluted “nexus” for asylum, with a rebuttable presumption that the countries of the Northern Triangle will “acquiesce” in the torture;
  • Liberally use Temporary Protected Status (“TPS”) for nationals from Northern Triangle countries which perhaps would make large-scale asylum adjudication less of a priority and allow most cases to be dealt with in due course through the Asylum Offices rather than clogging Immigration Court dockets;
  • Work to insure that applicants for protection have assistance of counsel in developing and presenting their claims (which would also dramatically increase fairness and efficiency).
