Nolan writes in a recent op-ed from The Hill:

“The absence of due process protections is permissible because IIRIA “clarified” that aliens who are in the United States without inspection are deemed to be “arriving.” In other words, they are not entitled to the rights enjoyed by aliens who have been admitted to the United States because, technically, they are not in the United States. This legal fiction has been accepted now for more than 20 years.

Previous administrations arbitrarily have limited expedited removal proceedings to aliens at the border and aliens who entered without inspection and were apprehended no more than 100 miles from the border after spending less than 14 days in the country.

But Section 235(b)(1)(A)(iii)(ll) of the Immigration and Nationality Act (INA) authorizes expedited removal proceedings for any alien “who has not been admitted or paroled into the United States, and who has not affirmatively shown, to the satisfaction of an immigration officer, that the alien has been physically present in the United States continuously for the 2-year period immediately prior to the date of the determination of inadmissibility.”

President Trump can use expedited removal proceedings to deport millions of noncriminal aliens without hearings before an immigration judge or the right to appeal removal orders to the Board of Immigration Appeals.

The only way to stop him is to find a way to work with him on a comprehensive immigration reform bill that includes a legalization program. And time is running out.

The Trump administration is quickly identifying ways to assemble the nationwide deportation force that President Trump promised on the campaign trail.

Preparations are being made for U.S. Customs and Border Protection (CBP) to hire 5,000 new officers and for U.S. Immigration and Customs Enforcement (ICE) to hire an additional 10,000. Also, ICE has identified 27 potential locations that could increase its detention space by 21,000 beds, and CBP plans to expand its detention capacity by 12,500 spaces.

But it is not too late to work on a deal that would meet the essential political needs of both parties … yet.”

I agree with Nolan that given the huge backlogs in the U.S. Immigration Courts, the Administration will use every device at its disposal to avoid the Immigration Courts and completely eliminate due process protections for as many individuals as possible. Moreover, as I have pointed out in a recent blog, to date the Article III Courts have been willing to turn a blind eye to the rather obvious due process and statutory issues involved in expedited removal. To state the obvious: “Any alien who is physically present in the United States or who arrives in the United States (whether or not at a designated port of arrival and including an alien who is brought to the United States after having been interdicted in international or United States waters), irrespective of such alien’s status, may apply for asylum” is meaningless without a fair opportunity to be heard on the asylum application before an impartial adjudicator, with a meaningful opportunity to present evidence, and represented by counsel of one’s choice. And, the idea that individuals who have spent months in detention in the U.S. aren’t entitled to “due process” in connection with their asylum applications (which are “life or death” applications) is facially absurd.

Yeah, I know that the Third Circuit in Castro v. DHS spent the whole decision on a turgidly opaque discussion of jurisdiction and and “suspension of habeas.” Surprising how folks living in the “ivory tower” with lifetime job security can sometimes drain all of the humanity out of “real life” tragedies.

But, frankly, in four decades of being a “highly interested observer” of immigration litigation, I’ve never seen an Article III Court, including the Supremes, be deterred from running over supposed statutory limitations on judicial review when motivated to do so. Perhaps it will take some Federal Judge’s nanny, maid, gardener, driver, handyman, neighbor, fellow church member, student, or in-law being swept up in the new “DHS dragnet” to “motivate” the courts here.

In the meantime, as pointed out to me by Nolan in a different conversation, there is some hope for due process in the Third Circuit’s dictum in Castro. In “footnote 13,” the court actually indicates that there might be a “constitutional break point” for review of expedited removal:

“Of course, even though our construction of § 1252 means that courts in the future will almost certainly lack statutory jurisdiction to review claims that the government has committed even more egregious violations of the expedited removal statute than those alleged by Petitioners, this does not necessarily mean that all aliens wishing to raise such claims will be without a remedy. For instance, consider the case of an alien who has been living continuously for several years in the United States before being ordered removed under § 1225(b)(1). Even though the statute would prevent him from seeking judicial review of a claim, say, that he was never granted a credible fear interview, under our analysis of the Suspension Clause below, the statute could very well be unconstitutional as applied to him (though we by no means undertake to so hold in this opinion). Suffice it to say, at least some of the arguably troubling implications of our reading of § 1252 may be tempered by the Constitution’s requirement that habeas review be available in some circumstances and for some people.”

I suspect that the Administration eventually will push expedited removal and credible fear denials to the point where there will be some meaningful judicial review. But, lots of folks rights are likely to be trampled upon before we reach that point.

Nolan’s suggestion for a bipartisan legislative solution certainly seems reasonable and highly appropriate from the viewpoint of both sides. The Administration is about to invest lots of resources and credibility in a “war to deport or intimidate just about everybody” that it is likely to lose in the long run. But, advocates are likely to be bleeding resources and losing individual battles for some time before the tide eventually turns, if it ever does. Anything that depends on litigation as the solution has many risks and unpredictable outcomes that might leave both sides unsatisfied with the results.

Sadly, nobody in the Administration seems interested in solving this issue. The policy appears to be driven by Attorney General Jeff Sessions, a lifelong opponent of immigration reform who seldom if ever has a kind word to say about any immigrant, legal or undocumented.

Secretary Kelly has become “Sessions’s Parrot,” apparently devoid of any original or constructive thoughts on the subject of immigration. In particular, his recent “put up or shut up” outburst directed at Congressional Democrats who sought some meaningful oversight and clarification of his enforcement policies did not seem to be an entree for better dialogue.

Although there almost certainly is a majority of Democrats and Republicans in favor of reasonable immigration reform, which the majority of the country would also like to see, leadership of both parties seems fairly discombobulated. There seems to be “zero interest” in putting together a legislative coalition consisting of Democrats and a minority of Republicans to get anything done. And, even if such a coalition were to coalesce, President Trump likely would veto any constructive result in the area of immigration.

As I’ve pointed out before, there are a number of reasons why folks don’t always act in their best interests or the best interests of the country. But, I appreciate Nolan’s efforts to promote “thinking beyond conflict.” I want to think that it can come to fruition.

“President Trump plans to sign an executive order in Wisconsin on Tuesday that the White House says will make it harder for tech companies to replace American workers with cheaper foreign labor, and will strengthen rules barring foreign contractors from bidding on government projects, according to senior administration officials.

The officials, in a background call with reporters, said Trump will direct the Departments of Labor, Justice, State and Homeland Security to crack down on fraud and abuse in guest-worker programs by issuing new immigration rules.

The president will also direct the Department of Commerce to review federal procurement rules and trade agreements with a view to putting American firms at an advantage when it comes to winning contracts.

The officials pitched the twin directives as benefiting working- and middle-class Americans who have suffered for too long under unfair trade and immigration rules.

“This is the policy that ensures no one gets left behind in America anymore — that we protect our industry from unfair competition, favor the products produced by our fellow citizens and make certain that when jobs open those jobs are given to American workers first,” the White House said in a statement.

It was not immediately clear how much the administration could accomplish without cooperation from Congress.

“Sweeping changes are going to require congressional action,” said Lynden Melmed, an immigration attorney who had served as U.S. Citizenship and Immigration Services chief counsel within the Department of Homeland Security under President George W. Bush.

However, industry experts said Trump’s executive order was a good first step to protecting the U.S. defense industrial base, and U.S. firms that do business with the federal government.

“It’s one of the few presidential exertions in recent time, that holds out the hope of saving U.S. industrial jobs,” said Loren Thompson, a defense industry consultant and the chief operating officer of the Lexington Institute in Arlington.”

A Miami immigration lawyer wrestles with new federal rules that could wind up deporting clients who, just a few weeks ago, appeared eligible to stay.

Judges and attorneys in Los Angeles struggle with Mandarin translators and an ever-growing caseload.

Coast to coast, immigration judges, prosecutors and defense attorneys are straining to decipher how the federal immigration rules released in February by the Trump administration will impact the system — amid an already burgeoning backlog of existing cases.

 

The new guidelines, part of President Trump’s campaign promise to crack down on illegal immigration,  give enforcement agents greater rein to deport immigrants without hearings and detain those who entered the country without permission.

But that ambitious policy shift faces a tough hurdle: an immigration court system already juggling more than a half-million cases and ill-equipped to take on thousands more.

“We’re at critical mass,” said Linda Brandmiller, a San Antonio immigration attorney who works with juveniles. “There isn’t an empty courtroom. We don’t have enough judges. You can say you’re going to prosecute more people, but from a practical perspective, how do you make that happen?”

Today, 301 judges hear immigration cases in 58 courts across the United States. The backlogged cases have soared in recent years, from 236,415 in 2010 to 508,036 this year — or nearly 1,700 outstanding cases per judge, according to the Transactional Records Access Clearinghouse, a data research group at Syracuse University.

Some judges and attorneys say it’s too early to see any effects from the new guidelines. Others say they noticed a difference and fear that people with legitimate claims for asylum or visas may be deported along with those who are criminals.

“GONZO-APOCALYPTO:” The Ominous Cloud Hanging Over American Justice — In Good Friday Editorials, Both NYT & WashPost Blast Sessions’s Dark, Distorted, “Gonzo-Apocalypto” Vision Of America!

First, the Washington Post ripped Sessions’s “embarrassing” withdrawal of support from African Americans and other minorities challenging the State of Texas’s scheme to disenfranchise them. A Federal Judge has twice found in favor of the plaintiffs — once with the DOJ’s support and once without!

“BLASTING “A PATTERN of conduct unexplainable on nonracial grounds, to suppress minority voting,” U.S. District Court Judge Nelva Gonzales Ramos on Monday repudiated Texas’s voter-ID law, the strictest in the country. Asked by appeals court judges to reconsider her expansive 2014 ruling against the law using slightly different evidence, Ms. Ramos reaffirmed her previous determination that “the law places a substantial burden on the right to vote, which is hardly offset by Texas’s claimed benefits to voting integrity.” She found that racial discrimination was at least a partial motivation for the law, a step toward reestablishing federal supervision over Texas’s voting procedures, per the Voting Rights Act.

Given the ruling and the mountain of evidence, it is embarrassing that the Trump Justice Department dropped its support for the contention that the Texas voter law is purposely discriminatory.

The legal question is not close. “There has been a clear and disturbing pattern of discrimination in the name of combating voter fraud,” Ms. Ramos wrote in 2014. The only type of fraud the law could combat — voter impersonation — hardly ever happens. Meanwhile, the law’s backers knew it would disproportionately impact minority voters; in fact, they designed it so. “The Texas Legislature accepted amendments that would broaden Anglo voting and rejected amendments that would broaden minority voting,” Ms. Ramos found in her 2014 examination. Texas accepts relatively few forms of identification at the polls, and those it does accept, such as gun licenses, are those white Texans tend to hold. Unlike many voter-ID states, Texas does not relax ID rules much for the elderly or the indigent, though obtaining an accepted ID can be surprisingly time-consuming and expensive.”

Meanwhile, A NY Times editorial slammed Session’s disingenuous plan to make immigrants the “#1 target” of law enforcement in the “Trump era.” The emphasis is mine.

Here’s the full editorial:

Attorney General Jeff Sessions went to the border in Arizona on Tuesday and declared it a hellscape, a “ground zero” of death and violence where Americans must “take our stand” against a tide of evil flooding up from Mexico.

It was familiar Sessions-speak, about drug cartels and “transnational gangs” poisoning and raping and chopping off heads, things he said for years on the Senate floor as the gentleman from Alabama. But with a big difference:  Now he controls the machinery of federal law enforcement, and his gonzo-apocalypto vision of immigration suddenly has force and weight behind it, from the officers and prosecutors and judges who answer to him.

When Mr. Sessions got to the part about the “criminal aliens and the coyotes and the document forgers” overthrowing our immigration system, the American flag behind him had clearly heard enough — it leaned back and fell over as if in a stupor. An agent rushed to rescue it, and stood there for the rest of the speech: a human flag stand and metaphor. A guy with a uniform and gun, wrapped in Old Glory, helping to give the Trump administration’s nativist policies a patriotic sheen.

It was in the details of Mr. Sessions’s oratory that his game was exposed. He talked of cities and suburbs as immigrant-afflicted “war zones,” but the crackdown he seeks focuses overwhelmingly on nonviolent offenses, the document fraud and unauthorized entry and other misdeeds that implicate many people who fit no sane definition of brutal criminal or threat to the homeland.

The problem with Mr. Sessions’s turbocharging of the Justice Department’s efforts against what he paints as machete-wielding “depravity” is how grossly it distorts the bigger picture. It reflects his long fixation — shared by his boss, President Trump — on immigration not as an often unruly, essentially salutary force in American history, but as a dire threat. It denies the existence of millions of people who are a force for good, economic mainstays and community assets, less prone to crime than the native-born — workers, parents, children, neighbors and, above all, human beings deserving of dignity and fair treatment under the law.

Mr. Sessions is ordering his prosecutors to make immigration a priority, to consider prosecution in any case involving “transportation and harboring of aliens” and to consider felony charges for an extended menu of offenses, like trying to re-enter after deportation, “aggravated identity theft” and fraudulent marriage.

He said the government was now detaining every adult stopped at the border, and vowed to “surge” the supply of immigration judges, to increase the flow of unauthorized immigrants through the courts and out of the country. He has ordered all 94 United States attorney’s offices to designate “border security coordinators,” no matter how far from “ground zero” they are.

Mr. Sessions and the administration are being led by their bleak vision to the dark side of the law. The pieces are falling into place for the indiscriminate “deportation force” that the president promised. Mr. Sessions and the homeland security secretary, John Kelly, have attacked cities and states that decline to participate in the crackdown. Mr. Sessions has threatened these “sanctuary” locales with loss of criminal-justice funding, on the false assertion that they are defying the law. (In fact, “sanctuary” cities are upholding law and order. They recognize that enlisting state and local law enforcement for deportation undermines community trust, local policing and public safety.)

Mr. Kelly recently told a Senate committee that all unauthorized immigrants are now potential targets for arrest and deportation. And so an administration that talks about machete-waving narco killers is also busily trying to deport people like Maribel Trujillo-Diaz, of Fairfield, Ohio, the mother of four citizen children, who has no criminal record.

“Be forewarned,” Mr. Sessions said in Arizona. “This is a new era. This is the Trump era.”

Let’s talk about this era. It’s an era when the illegal border flow, particularly from Mexico, has been falling for 20 years. When many of those arriving from Central America immediately surrender to border agents — having fled to the United States to find safety, not to do it harm. When American border cities enjoy safety and vitality, thanks to immigrants. When a large portion of the unauthorized population has lived here for years, if not decades, with clean records and strong roots. When polls show that Americans back reasonable and humane immigration policies giving millions a chance to get right with the law.

President Trump has shown his mind to be a place where ideas and principles can morph without warning or explanation. It is a vacuum that allows ideologues like Mr. Sessions — who know their minds — to do their worst. On immigration, that is a frightening thing to contemplate.

“Gonzo-Apocalypto” has to be the “word of the day.” What a perfect term to describe Jeff Sessions.

In a grotesque display of disingenuous hypocrisy, Sessions referred to “drug cartels and ‘transnational gangs’ poisoning and raping and chopping off heads.” These are exactly the things causing scared, defenseless women and children to flee for their lives from the Northern Triangle and seek refuge in the U.S. But, instead of refuge they find: well, Jeff Sessions, Donald Trump, Steve Bannon, Stephen Miller, Gen. John Kelly and others anxious to stomp out their humanity in the false name of “law enforcement.”

Turning to civil rights, I watched on the TV news last night two clips of brutal beatings and stompings of African Americans by white police officers. One victim was accused of “jaywalking”  — that’s right, “jaywalking.” The other was “driving without a license plate.” I was wondering how, after all the recent publicity, those officers could have engaged in such conduct, “on camera” no less.

Unfortunately, the answer is pretty simple “Black Lives Don’t Matter,” an attitude that obviously has just become instinctive for too many U.S. police officers. I couldn’t imagine a white pedestrian or a white motorist being treated that way in our multi-racial but predominantly white neighborhood.

Yes, the officers involved were disciplined. I believe that most or all of them were either fired, prosecuted, or both. But, that’s not the point!

The object is to prevent misuse of force by police, not to fire, prosecute, or otherwise discipline more policemen. And, prevention without compromising effectiveness of policing is exactly what the carefully crafted “consent decrees” with some problematic cities developed by the Civil Rights Division under AGs Loretta Lynch and Eric Holder achieved.

Those are the very decrees that Sessions immediately announced an intent to “review” with an obvious eye toward withdrawing or undermining them. Look at the childish behavior in the U.S. District Court in Baltimore, MD, when DOJ attorneys, acting on Sessions’s behalf, withdrew their support from the consent decree and basically refused to participate in a long-scheduled public hearing. Fortunately, the judge has the good sense to go ahead and approve and finalize the consent decree without any participation by DOJ, leading to even more childish whining from Sessions about the horrors of infringing on local law enforcement in the name of African American citizen’s constitutional rights.

The very public “green light” that Sessions has given to law enforcement to run over citizen’s rights as they please, without any fear of DOJ intervention, so long as they are “enforcing the law” — like busting jaywalkers, license plate violators, and presumably undocumented aliens — no doubt plays a role in the continuing anti-minority policing being conducted by some law enforcement agencies.

Sessions “bristles” when anyone uses the term “racist” to describe him. Sessions was given a chance to make good on his (obviously false) promise during his confirmation hearings to turn over a new leaf and look at the responsibilities of being Attorney General for all Americans differently from representing Alabama in the U.S. Senate.

Unfortunately,  his actions have proved that all of the charges his detractors made against him are as true now as they were when he was, quite properly, denied a U.S. judgeship many decades ago. If the shoe fits, wear it. And, sadly, this “shoe” fits Sessions “like a glove.” Liz was “right on.”

Finally, DHS Secretary John Kelly will see his distinguished career in public service end in ignomany if he continues “toadying up” to the ethno-nationalist views of the Sessions-Bannon-Miller crowd on immigration enforcement. Most of the arrests, deportations, detentions, denials of asylum, and removals Sessions is touting in his haste to become the new “Immigration Czar,” actually are within the jurisdiction of DHS. But, these days, you’d hardly know that Sessions isn’t in charge of DHS enforcement as well as Justice. If Kelly isn’t careful, he’s going to develop a neck injury from constantly nodding his head to every absurd “gonzo-apocalypto” immigration enforcement initiative announced by Sessions.

HUFFPOST POLITICS: Despite Bannon’s Apparently Waning Influence, “Turbocharged” Sessions Will Keep “Ethno-Nationalist Agenda” Rolling At Full Speed At DOJ! Bad News For Immigrants, African-Americans, Refugees, Muslims, LBGT Individuals, Forensic Science, Innocent Defendants, Minor Offenders, Taxpayers, The U.S. Constitution, Many Women, & Social Justice In America!

“No matter what Bannon’s fate, however, his strand of ethno-nationalism will live on in the Trump Justice Department under Attorney General Jeff Sessions. The 70-year-old former Alabama senator has already set the Justice Department on a new path by targeting immigrants, reining in police department reform efforts and curtailing efforts to protect voting rights.

“While many are focused on how Bannon is losing influence in the White House, those concerned with immigrant justice ― and I suspect those concerned with racial justice, police reform and voting rights, too ― are focused on the rise of a turbocharged Sessions,” Frank Sharry, executive director of the pro-immigration reform group America’s Voice, said in an email to HuffPost.

Bannon and Sessions share a long history of mutual support and policy agreement. They spent months together with Stephen Miller, a former Sessions aide who now works in the White House, plotting strategy on how to enact their shared agenda of limiting immigration to the U.S. in order to maintain a European and Christian identity. In 2016, Bannon declared Sessions “one of the intellectual, moral leaders of this populist, nationalist movement in this country.” After both moved to Trump’s administration, Bannon called Sessions the White House “clearinghouse for policy and philosophy.” Like Bannon, Sessions declares his policy objective as defeating “soulless globalism.”

In another appearance on Bannon’s radio show, Sessions endorsed the Immigration Act of 1924, which specifically limited immigration based on race and religion, in the context of current immigration trends. “In seven years, we’ll have the highest percentage of Americans, non-native born, since the founding of the Republic,” Sessions said, while praising the 1924 law that was used to prevent Jewish immigration before and during the Holocaust.

Like Bannon, Sessions believes immigration from Middle Eastern countries poses a national security risk. He agrees that Western leaders have failed to protect their Judeo-Christian heritage by opening the door to refugees.

In one radio interview, after Bannon compared the migration of Syrian refugees to an infamous racist French book, he asked Sessions.: “Do you believe the elites in this country have the backbone, have the belief in the underlying principles of the Judeo-Christian West to actually win this war?”

“I’m worried about that,” Sessions replied.

The two nationalist Trump supporters share more than immigration policy preferences. The reversal of police reform efforts and reinvigoration of the War on Drugs pushed by Sessions as attorney general fits with Bannon’s efforts at Breitbart to label Black Lives Matter protesters as racists, while perpetuating racist stereotypes of African Americans through the site’s Black Crime section.”

For those who hoped that President Trump’s sudden shift to more “centrist” positions on trade and foreign policy might carry over into immigration policy, dream on! Bannon might be “on the ropes,” but Sessions and Stephen Miller still have the President’s ear on their restrictionist, nationalist positions on immigration.

While badly needed, reasonable bipartisan immigration reform would be within Trump’s reach, that’s not going to happen. Buoyed by the immediate decrease in Southern Border apprehensions, Trump, Sessions, and MIller (Gen. Kelly appears to gone AWOL on immigration policy — he just parrots what Sessions and the nationalist restrictionists tell him — his stature as former General with integrity shrinks every day) intend to arrest, detain, deport, and threaten unless and until the Article III Courts stop them. And whether that will happen is still an open question.

“President Donald Trump has won the first major battle in his war on illegal immigration, and he did it without building his wall.

The victory was announced last week by the Department of Homeland Security (DHS), which released figures showing a 93 percent drop since December of parents and children caught trying to cross the Mexico border illegally.

In December, 16,000 parents and children were apprehended; in March, a month in which immigration typically increases because of temperate weather, the number was just over 1,100.

It was a remarkable decline – steeper than the 72 percent drop in overall apprehensions – but for eight DHS officials interviewed by Reuters it was not surprising.

Trump has spoken about the need to crack down broadly on all illegal immigrants. But, internally, according to the DHS officials familiar with the department’s strategy, his administration has focused on one immigrant group more than others: women with children, the fastest growing demographic of illegal immigrants. This planning has not been previously reported.

In the months since Trump’s inauguration, DHS has rolled out a range of policies aimed at discouraging women from attempting to cross the border, including tougher initial hurdles for asylum claims and the threat of prosecuting parents if they hire smugglers to get their families across the border.

The department has also floated proposals such as separating women and children at the border.

DHS Secretary John Kelly told a Senate hearing on April 5 that the sharp drop in illegal immigration, especially among women and children, was due to Trump’s tough policies.

To date, it has been the threat of new policies rather than their implementation that has suppressed family migration.

Mothers and children aren’t being separated – and DHS has shelved the plan; parents haven’t been prosecuted, and there is no wall along most of the border. Yet the number of migrants trying to cross – especially women and children – has dropped drastically.

Asked to comment on the policy of targeting women with children, DHS spokesman Jonathan Hoffman referenced the March drop, saying, “Those were 15,000 women and children who did not put themselves at risk of death and assault from smugglers to make the trip north.”

The White House declined to comment and referred Reuters to DHS.

For months, Central Americans had heard about Trump’s get-tough policies. And public service announcements on radio and television presented bleak pictures of what awaited those who traveled north. Some of the ads were funded by the United States, others by United Nations agencies and regional governments.

One radio ad in Honduras featured a mother, saying, “It’s been a year and I don’t know if she is alive or dead. I’d do anything to have her here with me. Curse the day I sent her north.”

The possibility that mothers and children might be separated at the border caused particular alarm, Honduran Deputy Foreign Minister Maria Andrea Matamoros told Reuters

“That worries any mother that wants to go to the United States with their kid, and being separated drastically changes their plans,” she said.

After Kelly’s confirmation as Homeland Security chief in late January, several members of the original working group stepped into key roles at DHS. Gene Hamilton, who had worked for then Republican Senator Jeff Sessions, became senior counselor to Kelly, and Dimple Shah, who had been staff director of the House National Security Subcommittee, became deputy general counsel.

Kathy Nuebel-Kovarik, formerly a staffer for Republican Senator Chuck Grassley, became policy chief at U.S. Citizenship and Immigration Services. Julie Kirchner left her position as executive director of the conservative Federation for American Immigration Reform to become a top policy adviser at U.S. Customs and Border Protection.

None of the group’s members agreed to be interviewed by Reuters. Several DHS officials said that in their new roles they continued to focus on the issue of women and child migrants. Soon, they had the bare bones of a plan: Since the court ruling on children was an obstacle to prolonged detention, why not separate them from their mothers, sending children into foster care or protective federal custody while their mothers remained in detention centers, the two DHS officials and congressional aide said.

The group also advocated two other policies directly affecting mothers and children: raising the bar for asylum and prosecuting parents as human traffickers if they hired human smugglers.

The thinking was that “if they can just implement tough policies for eight weeks – or even threaten to do that – they would see the numbers of families crossing just plummet,” said one DHS official familiar with the planning.

When Kelly and his advisers saw the numbers dropping, they announced they were shelving the idea of separating women and children – at least for now.

Asked whether it may be revived, DHS spokeswoman Jenny Burke said, “Families caught crossing the border illegally, generally will not be separated unless the situation at the time requires it.”

Time will tell if this really solves the “Southern Border Problem.” It would be interesting to see a study of the fate of the individuals who stayed in the Northern Triangle after hearing the “stay home, we don’t want you” message.

This “gang of eight” working group sounds like they have the “right stuff” to go far in the Trump-Sessions regime. And, their solution was probably cheaper than the “high seas interdiction” program developed and used by prior Administrations to prevent asylum seekers from reaching the United States and asserting their legal rights under U.S. and international law.

I wake up every morning thankful that 1) I woke up, and 2) I’m not a refugee. Wonder if any of the “gang of eight” have ever thought of what it would be like to be a refugee in the world they are creating? But, I suppose that at a certain level of intellectual arrogance, folks don’t think that they will ever have to rely on the the humanity and decency of others to survive. The bad news: that’s not always a correct assumption, and sometimes folks reap what they sow.

IT’S TRUE! — DOJ Eliminates U.S. Immigration Judges’ Only Annual Training! — Quality & Professionalism “De-Prioritized” In Trump Era — Billions For Enforcement & Incarceration — Crumbs For Due Process — When Is Congress Going To “Just Say No?”

Reliable sources have now confirmed what I reported in this blog earlier this week (http://wp.me/p8eeJm-Ge): the DOJ has eliminated the U.S. Immigration Court’s only formal annual training. U.S. Immigration Judges have been ordered to schedule cases during the week normally reserved for advanced training, continuing judicial education, and professional development.

This news couldn’t come at a worse time for the beleaguered U.S. Immigration Courts. Dozens of new U.S. Immigration Judges have been appointed in the last year, most of whom have never met their judicial colleagues across the nation.

Moreover, this would be their only opportunity beyond some brief “basic training” to pursue continuing judicial education in this complex, controversial, and ever-changing field. It’s also an opportunity to “catch jump” on what all the Circuit Courts of Appeals are doing, as well as to hear from BIA Appellate Immigration Judges about developments at the Board. Additionally, it is a key opportunity to address the disturbing, continuing problem of inexplicable discrepancies in asylum adjudication (84% grant rate in one Immigration Court; 2% grant rate in another) within the Immigration Court system.

Some of the training at the Annual Conference is statutorily required, such as updates under the International Religious Freedom Act, which, perhaps ironically, often highlights the persecution faced by Christian groups in China and the Middle East, a subject on which the Administration has expressed concern. Other sessions cover ethics training required by DOJ regulations.

In addition, the DOJ considers U.S. Immigration Judges to be “DOJ attorneys.” As a consequence, judges are required to maintain “active” status in at least one state bar, even though they perform only quasi-judicial duties and therefore would be eligible for “active judicial status” in many states.

The Annual Conference usually meets the “mandatory CLE” requirements of various state bars. But, when there is no Annual Conference, individual judges must take leave from the bench to complete the coursework required by their respective state bars. Therefore, Immigration Judges are off the bench learning about state real estate transactions and changes in tort law, when they could instead be advancing their knowledge in immigration and refugee law as well as “best judicial practices” in Federal Courts.

I get frequent reports of cratering morale among Immigration Judges and court staff, increases in the already extraordinary levels of stress, and impending retirements of some of the best and most experienced judges. Some Immigration Judges returning from details to hastily thrown together so-called “Immigration Courts” in DHS detention centers were shocked, upset, and angered to see with their own eyes that individuals with viable claims for relief, most of them asylum or related protection, were being “duressed” by the coercive conditions and atmosphere in DHS detention to abandon their claims and take “final orders of removal,” just to be out of detention. And, the Administration is just getting started on its plans for “Incarceration Nation.”

Lawyers report that they show up at Immigration Court with clients and witness in tow prepared for merits cases which have been pending for years, only to find out that the cases have been rescheduled to a dates several more years in the future, without advance notice, so that the Immigration Judges can be detailed to a detention centers in other parts of the country.

When is Congress finally going to step in and provide some meaningful oversight of the unfolding due process disaster in U.S. Immigration Courts? Regardless of where one stands on the philosophical issues surrounding immigration enforcement, providing due process and complying with constitutional, statutory, and international treaty obligations, including reasonable access to counsel (which is not available in most DHS detention center locations), should be a bipartisan priority.

Isn’t it time for a bipartisan group of GOP legislators concerned about the billions of dollars being mindlessly poured into immigration enforcement and Democrats who are concerned about due process getting together and holding the Trump Administration accountable for what’s really happening in our Immigration Courts?

“So, should the EB-5 program be terminated?

Yes, Congress has had more than 25 years to fix the EB-5 program. There is not going to be a legislative “fix.” The only viable alternative is to terminate it and start over.

I have a few suggestions for the new investment program. It should:

  • Raise the investment amounts;
  • Establish more detailed statutory requirements for regional centers;
  • Require Chinese investors to establish that they have permission from the Chinese government to remove enough money from China to meet the investment requirement;
  • Provide for input from the states on designating Targeted Employment Areas but have the designations made by the federal government;
  • Establish guidelines for making the “Targeted Employment Area” designations which eliminate the current gerrymandering process and ensure that the investment money goes where it is supposed to go; and
  • Include measures to eliminate fraud from the program.

Some lawmakers have given up already. Rep. Steve King (R-Iowa) and Sen. Dianne Feinstein (D-Calif.) introduced bills to terminate the EB-5 program. These members have the right idea. It is time to put an end to a failing, faulty program and implement immigration policies that actually yield the intended result.”

“VATICAN CITY — As politicians around the world including President Trump take an increasingly hard line on immigration, a powerful force is rallying to the side of migrants: the Roman Catholic Church led by Pope Francis.

Catholic cardinals, bishops and priests are emerging as some of the most influential opponents of immigration crackdowns backed by right-wing populists in the United States and Europe. The moves come as Francis, who has put migrants at the top of his agenda, appears to be leading by example, emphasizing his support for their rights in sermons, speeches and deeds.

The pro-migrant drive risks dividing Catholics — many of whom in the United States voted for Trump. Some observers say it is also inserting the church into politics in a manner recalling the heady days of Pope John Paul II, who stared down communism and declared his opposition to the 1991 Persian Gulf War. The Vatican is standing in open opposition to politicians like Trump not just on immigration but also on other issues, including climate-change policy.

But the focal point is clearly migrant rights.
In the United States, individual bishops, especially those appointed by Francis, have sharply criticized Trump’s migrant policies since his election. They include Newark Cardinal Joseph W. Tobin, who last month co-led a rally in support of a Mexican man fighting deportation. Tobin has decried Trump’s executive orders on immigration, calling them the “opposite of what it means to be an American.”

In Los Angeles, Archbishop José H. Gomez, the first Mexican American vice president of the United States Conference of Catholic Bishops, which leads the U.S. church, described migrant rights as the bishops’ most important issue. He has delivered blistering critiques of Trump’s policies, and instructed his clerics to distribute cards in English, Spanish, Korean and Vietnamese informing migrants of their rights in 300 parishes .
Chicago Cardinal Blase J. Cupich, one of Francis’s closest allies in the U.S. church, has issued orders that if federal immigration authorities should attempt to enter churches without a warrant in search of migrants, priests should turn them away and call the archdiocese’s lawyers. Catholic school principals were given the same instructions by the archdiocese, which Cupich said was an attempt to respond in a way that was firm “but not extreme.”

He said Francis has helped bishops shape their response.

“The pope makes it a lot easier for me to be a bishop because he’s very clear in his teaching, and [on] this one in particular, he’s trying to awaken the conscience of the citizens of the world,” Cupich said.

Francis has long been an advocate of migrants — kicking off his papacy in 2013 with a trip to an Italian island used as a waypoint for migrants desperate to enter Europe. In a highly public spat early last year, Francis and Trump exchanged barbs — with Francis declaring that anyone who wants to build walls “is not Christian.”

Those who have the pope’s ear say Francis is seeking to counter anti-migrant policies by appealing directly to voters.

“I don’t think the pope is challenging [the politicians]. I think he is challenging their supporters, both those who actively support them and those who passively allow their policies to happen,” said the Rev. Michael Czerny, undersecretary of the Vatican’s new Section for Refugees and Migrants, which opened in January, just before Trump took office. Czerny reports directly to the pope — a sign of the importance of the new office.

“Mr. Trump or Ms. Le Pen are not the root of the problem,” Czerny continued. “The root of the problem is the fear, selfishness and shortsightedness that motivate people to support them.”

He [William E. Lori, Archbishop of Baltimore] added that previous popes have taken similar positions as Francis on immigration. But, Lori added, Francis is “perhaps more dramatic.” His trips, such as his 2016 visit to the U.S.-Mexico border, also connected his stance on migrants to politics.
“The poor is the hallmark of his papacy,” Lori said. “It will affect our priorities and it should.”

“Mike Pence, the fundamentalist Christian whose views are so extreme that he cannot be alone with a woman other than his wife, and Donald Trump, who brags about sexually assaulting women and famously stumbled over an attempt to quote a biblical passage while on the campaign trail, seem to hold wildly divergent religious views. Yet both adhere to variations of Christianity inflected with arrogance. Together they represent two troubling trends in American Christianity, trends which appear to prove all the complaints secular liberals ever leveled against Christians.

Pence adheres to biblical literalism. Put simply, this view asserts that the Bible is a transparent document, one that prescribes specific behavioral guidelines. Glossing over the fact that the Bible is a complex text built of ancient fragments brought together by human hands, that it does not speak directly to many modern issues, and that even on its own terms it encompasses numerous contradictions, these Christians confidently declare that the Bible provides clear guidance for every Christian. Literalists arrived at this position only relatively late in Christian history, in response to various challenges from many quarters, including biblical scholarship, advances in science, and a rise in unbelief. Cutting through the complexities and the need to make choices, literalists declared all choice to be false and all discussion to be error. It was a comforting if simplistic and authoritarian solution to the problem of uncertainty.

Its arrogance lies in the hubris of those who believe that only their chosen answers are correct. Its potential to harm others comes when adherents gain political power and force their mandates on nonbelievers. One of the many dangers emanating out of the Trump White House is the power of Pence to impose not his religion but the behaviors his religion dictates onto the rest of us. Women’s rights and gender equality are on Pence’s hit list.

Trump’s religion, although very different, is similarly alarming. Unsurprisingly Trump accepts a religious viewpoint that tells him he is uniquely awesome. Whatever he has—however he acquired it—God wants him to enjoy to the fullest. Although traditional Christian social practice mandates that believers exercise humility, charity and other virtues that put others before self, Trump’s faith rejects all curbs on self-indulgence and self-aggrandizement. This religious position, known as Prosperity Theology, is newer than Pence’s literalism. It preaches that God wants the rich to be not only rich but selfish. Its attraction to a man like Trump—born to wealth, selfishly guided by his own desires, endlessly demanding that others adore him but never judge him—is transparent.

Pence’s arrogance leads him to believe that he knows exactly what God wants us all to do and that he ought to force that on us if he has the power to do so. Trump’s faith simply endorses his own self-regard, elevating his personal whims to God’s desires. The political marriage of the two men is obviously one of expedience, given the great disparities in their beliefs and goals. Yet between them, they can do a great deal of damage. Arrogant self-righteousness and egotistical self-regard together wield power over the rest of us.

Little wonder that the pope has been modeling Christian humility and singing the praises of Christian charity, or that the supporters of these two find his lessons in what it means to be a Christian so infuriating.”

Also, Allen Clifton writing in Forward Progressives quotes the views of Pastor John Pavlovitz taking Trump and the GOP to task for hypocricy on Syrian refugees, a point that has been noted several times previously in this blog: 

“There are many things concerning Donald Trump that completely baffle me, but the fact that he’s strongly and enthusiastically supported by a party that comically portrays itself as representatives for “the Christian moral majority” is right near the top of my list. Of all the major candidates who ran for president from either party, Trump was, without a doubt, the least Christian of any of them. I haven’t viewed Republicans as actual Christians for years, but Trump’s rise to the top of the GOP cemented the fact that there’s nothing Christian about the Republican Party.
A great example of what I’m talking about is Trump and the GOP’s take on refusing to accept Syrian refugees. Innocent, desperate people, many of whom are women and children, fleeing a war-torn country hoping to escape a brutal dictator who, once again, just used chemical weapons against his own people. Not only have Trump and his fellow Republicans blatantly vilified these poor people as a means of pandering to the bigotry that fuels their party, but they continually lied about the process refugees must endure before ever stepping foot on U.S. soil.
If you listen to Trump talk about the vetting process, he essentially said we never had one — which is an outright lie. Every refugee allowed into the United States endures a rigorous process that usually takes between 18-24 months to complete and these refugees never know where they’re actually going to end up. So it’s not as if some “undercover terrorist” can pose as a refugee, say they want to go to America, and they’re here in two weeks.
Nevertheless, it’s undeniable that Trump and the GOP have gone out of their way to demonize these poor people for political purposes.

That made it rather nauseating to watch Trump claim that the images of the victims of the most recent chemical weapons attack launched by Assad are what “moved” him to take action by ordering last week’s airstrike. Nothing like selling yourself as the party of “Christian values,” while vilifying and rejecting refugees, then claiming that the images of victims of a horrific chemical attack “moved you” — not to do everything you can to help people who need it — but to fire 59 Tomahawk missiles at an airbase that was up-and-running within a few hours of the attack.

I’m sorry, but you can’t claim you’re “moved” by the sickening images of what’s going on in Syria when your administration’s policy is to reject helping thousands of refugees desperately trying to flee the carnage that’s plagued that nation for over six years now.

That’s also along the lines of what North Carolina Pastor John Pavlovitz said in a recent blog post:
‘This is the human collateral damage of what Donald Trump’s been selling for 16 months now. It is the cost in actual vibrant, beautiful lives, of the kind of incendiary rhetoric and alternative facts and Fox News truths that you’ve been fine with up until now. This is what you bought and paid for. Maybe not something this sadistic or explicitly grotesque, but the heart is the same: contempt for life that looks different and a desire to rid yourself of it.
I want to believe that you’re truly outraged, but honestly your resume is less than convincing.
Honestly, you didn’t seem all that broken up when Muslim families were handcuffed in airports a couple of months ago, or when mosques were being defaced, or when many of us were pleading the case for families fleeing exactlythe kind of monstrous atrocities you were apparently so moved by this week—and getting told to eat our bleeding hearts out by MAGA hat-wearing trolls. You weren’t all that concerned when your President told terrified, exhausted refugees to leave and go home—twice.'”

“Attorney General Jeff Sessions directed federal prosecutors to pursue harsher charges against undocumented immigrants who commit crimes, or repeatedly cross into the U.S. illegally, and promised to add 125 immigration judges in the next two years to address a backlog of immigration cases.

The moves are part of the administration’s efforts to deter illegal immigration and is meant to target gangs and smugglers, though non-violent migrants could also face more severe prosecutions.

In a memo issued Tuesday, Mr. Sessions instructed prosecutors to make a series of immigration offenses “higher priorities,” including transporting or harboring illegal immigrants, illegally entering or reentering the country, or assaulting immigration enforcement agents.

In remarks to border patrol agents at the U.S.-Mexico border in Nogales, Arizona on Tuesday, Mr. Sessions spoke in stark terms about the threat he said illegal immigration poses.

“We mean criminal organizations that turn cities and suburbs into warzones, that rape and kill innocent citizens,” Mr. Sessions said, according to the text of his prepared remarks. “It is here, on this sliver of land, where we first take our stand against this filth.”

“This is a new era. This is the Trump era,” Mr. Sessions said.

Former prosecutors said they didn’t expect the memo to dramatically impact U.S. attorneys offices along the southern border, which already bring thousands of such cases each year. They said it could impact those further inland, which haven’t historically focused on immigration violations.

In the fiscal year that ended in September 2016, 52% of all federal criminal prosecutions involved immigration-related offenses, according to Justice Department data analyzed by Transactional Records Access Clearinghouse at Syracuse University.

Immigration advocates said they worried that the memo and tone set by the administration was describing a closer link between criminal behavior and immigration than statistics show.

“We are seeing an over-emphasis on prosecuting, at the federal level, immigration, illegal entry and reentry cases, and far less paid to criminal violations that implicate public safety,” said Gregory Chen, director of advocacy for the American Immigration Lawyers Association.”

On April 8, 2017, Sari Horowitz reported in the Washington Post on how Sessions’s enthusiastic plans to reinstitute the largely discredited “war on drugs” is likely to “jack up” Federal Prison populations:

“Crime is near historic lows in the United States, but Sessions says that the spike in homicides in several cities, including Chicago, is a harbinger of a “dangerous new trend” in America that requires a tough response.
“Our nation needs to say clearly once again that using drugs is bad,” Sessions said to law enforcement officials in a speech in Richmond last month. “It will destroy your life.”

Advocates of criminal justice reform argue that Sessions and Cook are going in the wrong direction — back to a strategy that tore apart families and sent low-level drug offenders, disproportionately minority citizens, to prison for long sentences.

“They are throwing decades of improved techniques and technologies out the window in favor of a failed approach,” said Kevin Ring, president of Families Against Mandatory Minimums (FAMM).”

Cook and Sessions have also fought the winds of change on Capitol Hill, where a bipartisan group of lawmakers recently tried but failed to pass the first significant bill on criminal justice reform in decades.

The legislation, which had 37 sponsors in the Senate, including Sen. Charles E. Grassley (R-Iowa) and Mike Lee (R-Utah), and 79 members of the House, would have reduced some of the long mandatory minimum sentences for gun and drug crimes. It also would have given judges more flexibility in drug sentencing and made retroactive the law that reduced the large disparity between sentencing for crack cocaine and powder cocaine.

The bill, introduced in 2015, had support from outside groups as diverse as the Koch brothers and the NAACP. House Speaker Paul D. Ryan (R-Wis.) supported it, as well.

But then people such as Sessions and Cook spoke up. The longtime Republican senator from Alabama became a leading opponent, citing the spike in crime in several cities.

“Violent crime and murders have increased across the country at almost alarming rates in some areas. Drug use and overdoses are occurring and dramatically increasing,” said Sessions, one of five members of the Senate Judiciary Committee who voted against the legislation. “It is against this backdrop that we are considering a bill . . . to cut prison sentences for drug traffickers and even other violent criminals, including those currently in federal prison.”
Cook testified that it was the “wrong time to weaken the last tools available to federal prosecutors and law enforcement agents.”

After GOP lawmakers became nervous about passing legislation that might seem soft on crime, Senate Majority Leader Mitch McConnell (R-Ky.) declined to bring the bill to the floor for a vote.

“Sessions was the main reason that bill didn’t pass,” said Inimai M. Chettiar, the director of the Justice Program at the Brennan Center for Justice. “He came in at the last minute and really torpedoed the bipartisan effort.”

Now that he is attorney general, Sessions has signaled a new direction. As his first step, Sessions told his prosecutors in a memo last month to begin using “every tool we have” — language that evoked the strategy from the drug war of loading up charges to lengthen sentences.

And he quickly appointed Cook to be a senior official on the attorney general’s task force on crime reduction and public safety, which was created following a Trump executive order to address what the president has called “American carnage.”

“If there was a flickering candle of hope that remained for sentencing reform, Cook’s appointment was a fire hose,” said Ring, of FAMM. “There simply aren’t enough backhoes to build all the prisons it would take to realize Steve Cook’s vision for America.”

Sessions’s aides stress that the attorney general does not want to completely upend every aspect of criminal justice policy.

“We are not just sweeping away everything that has come before us.” said Robyn Thiemann, the deputy assistant attorney general in the Office of Legal Policy, who is working with Cook and has been at the Justice Department for nearly 20 years. “The attorney general recognizes that there is good work out there.”

Still, Sessions’s remarks on the road reveal his continued fascination with an earlier era of crime fighting.

In the speech in Richmond, he said, “Psychologically, politically, morally, we need to say — as Nancy Reagan said — ‘Just say no.’ ”

Not surprisingly, Sessions’s actions prompted a spate of critical commentary, the theme of which was the failure of the past “war on drugs” and “Just say no to Jeff Sessions.” You can search them on the internet, but here is a representative example, an excerpt from a posting by Rebecca Bergenstein Joseph in “Health Care Musings:”

Three decades ago, Nancy Reagan launched her famous anti-drug campaign when she told American citizens, “Say yes to your life. And when it comes to alcohol and drugs, just say no.” 1 Last month, Attorney General Jeff Sessions invoked the former First Lady’s legacy in a speech to Virginia law enforcement when he said, “ I think we have too much tolerance for drug use– psychologically, politically, morally. We need to say, as Nancy Reagan said, ‘Just say no.’”2 As our nation is confronted on a daily basis with the tragic effects of the opioid epidemic, it is important that we understand just how dangerous it is to suggest that we return to the ‘just say no’ approach.

In the 1980s and 1990s, the ‘just say no’ curriculum became the dominant drug education program nationwide in the form of DARE.3 The DARE program– Drug Abuse Resistance Education– was developed in 1983 by the Los Angeles police chief in collaboration with a physician, Dr. Ruth Rich. The pair adapted a drug education curriculum that was in the development process at University of Southern California in order to create a program that would be taught by police officers and would teach students to resist the peer pressure to use alcohol and drugs. With the backdrop of the War on Drugs that had continued from the Nixon presidency into the Reagan era, DARE grew quickly. Communities understandably wanted to prevent their children from using alcohol and drugs. The program was soon being used in 75% of schools nationwide and had a multimillion dollar budget.3 In fact, I would bet that many of you reading this are DARE graduates. I certainly am.

It did not take long for there to be research showing that the ‘just say no’ approach used in DARE was not working. By the early 1990s there were multiple studies showing that DARE had no effect on its graduates choices regarding alcohol and drug use.4 The decision to ignore the research about DARE culminated when the National Institute of Justice evaluated the program in 1994, concluded that it was ineffective, and proceeded to not publish this finding. In the 10 years that followed, DARE was subjected to evaluation by the Department of Education, the U.S Surgeon General’s Office, and the Government Accountability Office.4 The combined effect of these evaluations was the eventual transformation of DARE into an evidence-based curriculum, Keepin’ It REAL, which was released in 2011.5 But this only happened after billions of dollars were spent on a program that did not work and millions of students received inadequate drug education.

And yet, here we are again. The top law enforcement officer in our nation is suggesting that we go back to the days where elementary and middle school students were told that all they needed to do was ‘just say no.’”

Finally, just yesterday, on April 10, 2017, Spenser S. Hsu reported in the Washington Post that Sessions was “canning” the “National Commission on Forensic Science, a roughly 30-member advisory panel of scientists, judges, crime lab leaders, prosecutors and defense lawyers chartered by the Obama administration in 2013” as a consultant to the DOJ on proper forensic standards.

In plain terms, in Session’s haste to rack up more criminal convictions and appear “tough on crime,” the quality of the evidence or the actual guilt or innocence of those charged becomes merely “collateral damage” in the “war on crime.”

Here’s a portion of what Hsu had to say:

“Several commission members who have worked in criminal courts and supported the input of independent scientists said the department risks retreating into insularity and repeating past mistakes, saying that no matter how well-intentioned, prosecutors lack scientists’ objectivity and training.

U.S. District Judge Jed S. Rakoff of New York, the only federal judge on the commission, said, “It is unrealistic to expect that truly objective, scientifically sound standards for the use of forensic science . . . can be arrived at by entities centered solely within the Department of Justice.”

In suspending reviews of past testimony and the development of standards for future reporting, “the department has literally decided to suspend the search for the truth,” said Peter S. Neufeld, co-founder of the Innocence Project, which has reported that nearly half of 349 DNA exonerations involved misapplications of forensic science. “As a consequence innocent people will languish in prison or, God forbid, could be executed,” he said.

However, the National District Attorneys Association, which represents prosecutors, applauded the end of the commission and called for it to be replaced by an Office of Forensic Science inside the Justice Department. Disagreements between crime lab practitioners and defense community representatives on the commission had reduced it to “a think tank,” yielding few accomplishments and wasted tax dollars, the association said.

The commission was created after critical reports by the National Academy of Sciences about a dearth of standards and funding for crime labs, examiners and researchers, problems it partly traced to law enforcement control over the system.

Although examiners had long claimed to be able to match pattern evidence — such as with firearms or bite marks — to a source with “absolute” or “scientific” certainty, only DNA analysis had been validated through statistical research, scientists reported.

In one case, the FBI lab in 2005 abandoned its four-decade-long practice of tracing bullets to a specific manufacturer’s batch through chemical analyses after its method were scientifically debunked. In 2015, the department and bureau reported that nearly every examiner in an elite hair-analysis unit gave scientifically flawed or overstated testimony in 90 percent of cases for two decades before 2000.

The cases include 32 defendants sentenced to death. Of those, 14 have been executed or died in prison.”

I “get” that some of the advocacy groups quoted in these articles could be considered “interested parties” and/or “soft on crime” in the world of hard-core prosecutors. But, Senate Judiciary Committee Chairman Chuck Grassley (R-IA), Sen. Mike Lee (R-UT), Speaker Paul Ryan (R-WI), and the Koch brothers “soft on crime?” Come on, man!

Capitalist theory says that as long as there is a nearly insatiable “market” in the United States for illegal drugs, and a nearly inexhaustible “supply” abroad, there is going to be drug-related crime. Harsher sentences might increase risks and therefore “jack up market prices” for “consumers” of “product,” while creating “new job opportunities” for “middlemen” who will have to take (and be compensated for) more risks and invest in more expensive business practices (such as bribery, or manipulation of the legal system) to get the product “to market.”

But, you can bet that until we deal with the “end causes” in a constructive manner, neither drug trafficking nor trafficking in undocumented individuals is likely to change much in the long run.

Indeed, authorities have been cutting off heads, hands, feet, and other appendages, drawing and quartering, hanging, crucifying, shooting, gassing, injecting, racking, mutilating, imprisoning in dungeons, transporting, banishing, and working to death those who have committed crimes, both serious and not so serious, for centuries. But, strangely, such harsh practices, while certainly diminishing the humanity of those who inflict them, have had little historical effect on crime. The most obvious effects have been more dead and damaged individuals, overcrowded prisons, and angry disaffected families.

125 new U.S. Immigration Judges should be good news for the beleaguered U.S. Immigration Courts. But, even assuming that Congress goes along, at the glacial pace the DOJ and EOIR have been hiring Immigration Judges over the past two Administrations, it could take all four years of Trump’s current term to get them on board and actually deciding cases.

More bad news: Added to the approximately 375 Immigration Judges currently authorized (but, only about 319 actually on the bench), that would bring the total to 500 Immigration Judges. Working at the current 750 completions/year (50% above the “optimum” of 500 completions/year) the currently authorized 375 Immigration Judges could complete fewer than 300,000 cases/year consistent with due process — barely enough to keep up with historic receipts, let alone the “enhanced enforcement” promised by the Trump Administration. They would not have to capacity to address the current “backlog” of approximately 550,000 cases.

If receipts remained “flat,” the 125 “new” Immigration Judges contemplated by AG Sessions could go to work on on the backlog. But, it would take them about 6 years to wipe out the 550,000 case existing backlog.

Judge Neil Gorsuch Confirmed By Senate On 54-45 Vote — Will Be Sworn In As Associate Justice On Monday, Replacing The Late Justice Antonin Scalia!

“WASHINGTON—The Senate on Friday confirmed Neil Gorsuch to the Supreme Court, ending a 14-month vacancy on the high court that spanned two presidential administrations and sparked one of the most bitter political fights in Washington in recent memory.

In a vote that fell largely upon partisan lines, Judge Gorsuch was approved as the next associate justice of the Supreme Court by 54-45. Three Democrats crossed the aisle to support Judge Gorsuch’s nomination, while he drew unanimous support from Senate Republicans.

“This brilliant, honest, humble man is a judge’s judge. And he will make a superb justice,” said Sen. Chuck Grassley, an Iowa Republican and chairman of the Senate Judiciary Committee.

Senate Minority Leader Chuck Schumer (D., N.Y.), who had opposed Judge Gorsuch as an out-of-the-mainstream conservative, acknowledged defeat but said he hoped the new justice wouldn’t be bound by the conservative groups that advised President Donald Trump on the choice.

“We are charging Judge Gorsuch to be the independent and fair-minded justice that America badly needs,” Mr. Schumer said. “If he is instead a justice for the Federalist Society and the Heritage Foundation, that will spell trouble for America.”

The only senator not voting was Johnny Isakson (R., Ga.), who is recovering from surgery.

The new justice will be sworn in Monday morning during a private ceremony at the Supreme Court, followed later in the day by a public ceremony at the White House. He will join his new colleagues on the bench on April 17, filling the seat held for three decades by the late Justice Antonin Scalia.”

I continue to think that the Democrats made a mistake in picking the Gorsuch nomination to make a “stand.”  A stand on what? That a GOP President doesn’t have a right to appoint a well-qualified conservative jurist to the Court? How does that follow? Doesn’t a Democrat have a right to appoint a well-qualified more liberal jurist?

Yes, the GOP and Senate Majority Leader Mitch McConnell (R-KY) treated an outstanding, moderately liberal jurist, Chief Judge Merrick Garland with total shabbiness and disrespect. But, hey, we’re talking about Mitch McConnell here; perhaps one of the wiliest and shrewdest legislators ever to walk the halls of the Senate, but hardly anyone’s choice for the classiest or most decent.

And none of this was Judge Gorsuch’s fault. He respects Chief Judge Garland and made it clear that he did not agree with the way he was treated.

The political problem was that the Democrats had lost control of the Senate, and notwithstanding making control of the Supremes a major campaign issue, they lost both the Presidency and the Senate in 2016. Winners have leverage, losers don’t.

The real solution here is for the Dems to get out there and win some elections, at all levels. And, if anything, the ill-advised Gorsuch battle made them look no more like the “party of adults” than the  GOP.

I think Justice Gorsuch will be engaged, scholarly, collegial, and fair within his own very conservative philosophical framework. And, all of us who are or have been judges are, to some extent, prisoners of our own backgrounds, philosophies, and life experiences.

But, being on a collegial court with those holding other views forces a judge to listen to other views, consider other possible outcomes, and to reexamine carefully the legal and intellectual justifications for one’s own positions. That’s about all you can ask of a jurist. And, I’m relatively certain that somewhere down the line, Judge Gorsuch will cast some votes, write, and join some opinions that will surprise both his supporters and detractors.  And, that will be a good thing for the U.S. justice system. It’s what judicial independence and separation of powers is all about.

“BALTIMORE — A Justice Department attorney expressed “grave concerns” Thursday about moving forward with a federal plan to make changes to this city’s police department, telling a federal judge that the Trump administration prefers that revisions be made and overseen by local government.

The hearing to gather public input on the proposed consent decree became a clash over the future of police departments, as Baltimore residents affected by police shootings and beatings forcefully pushed back against any delays.

The hearing came just days after U.S. Attorney General Jeff Sessions announced that he would have top deputies review such agreements with departments nationwide.

Sessions said he wanted to ensure the agreements align with administration priorities of promoting officer safety and morale while fighting violent crime, but advocates say the move could stymie much-needed changes to departments in the wake of high-profile police shootings of minorities in recent years.

The tension was on display Thursday, as well as an unusual role reversal — the Justice Department distanced itself from its plan negotiated by President Barack Obama’s administration, while Baltimore officials, residents and activists openly embraced it.

“Please do not delay this decree,” implored Greta Carter-Willis, whose 14-year-old son was fatally shot by a police officer several years ago. “We need to turn this police department around.”

She later broke down crying.

The consent decree follows a blistering Justice Department report that found widespread constitutional violations and discrimination in the Baltimore Police Department. The report was prompted by the 2015 death of Freddie Gray, who was fatally injured in police custody.

John Gore, the acting assistant attorney general for the civil rights division of Justice, said in court Thursday that the department wanted a 30-day delay on a decision to implement the plan “so new leadership can reanalyze and engage with the city as necessary.

Ultimately, “it is up to local communities to try and work with police to try and ensure reforms are implemented fully,” Gore said. “We have grave concerns that this consent decree is what is needed” as the means to change the police force and help fight crime.”

Jonathan Smith, executive director of the Washington Lawyers’ Committee for Civil Rights and Urban Affairs, called the situation in Baltimore “unprecedented and extraordinary.” He said there is no precedent for a lead party to pull out after a consent decree is signed and the matter is before the court. “We are in uncharted territory.”

Smith, was in the Justice Department’s civil rights division under the Obama administration from 2010 through 2015 and negotiated a consent decree with the New Orleans Police Department.”

The grotesque spectacle of Jeff Sessions in charge of the U.S. Department of Justice continues to get more jaw-dropping every day.

It wasn’t long ago that Senate Majority Leader Mitch “Nuke Em” McConnell (R-KY) shut down Sen. Elizabeth Warren (D-MA) while she was trying to “complete the record” on Sessions’s total unsuitability to be in charge of overseeing the delivery of justice in America and protecting the constitutional rights of all Americans (which actually includes immigrants who are entitled to constitutional due process protections). Everybody who doubted the truth of her message owes Sen. Warren a huge apology. And, those Senators who voted to confirm Sessions as AG should be ashamed.

Ever wonder how much damage one man can do the the U.S. justice system? Well, we’re finding out. And, it isn’t pretty.

His announcement was made on the same morning that the House Committee on Ethics said Mr. Nunes was under investigation because of public reports that he “may have made unauthorized disclosures of classified information.”

“Extreme Vetting” Proposal Draws Fire From Sen. McCaskill!

“The senior Democrat on the Senate Homeland Security Committee said Wednesday the “extreme vetting” procedures contemplated by the Trump administration would alienate U.S. allies, deter legitimate travelers and fail to keep out security threats.

“It seems to me we are signaling something that is very un-American to the rest of the world,” Sen. Claire McCaskill (D., Mo.) told Homeland Security Secretary John Kelly at a hearing of the Senate panel.

The Wall Street Journal reported Tuesday that the Trump administration was considering new vetting rules that would ask visa applicants to provide cell phone contacts and social media passwords as well as answer probing questions about their ideology. A senior Homeland Security official said the changes could apply to close U.S. allies as well as visitors from other countries.

“If they know we’re going to look at their phones and we know we’re going to ask them questions about their ideology, they’re going to get rid of their phones and guess what they’re going to do on ideology? They’re going to lie,” she said.

Mr. Kelly did not respond directly to her criticism or to the Journal story. Rather, he spoke about current procedures at ports of entry and said that visitors’ phones are examined only in rare cases during secondary screenings.

“This is not routine,” he said. “It is done in a very small number of cases. It won’t be done routinely for people who are coming here from anywhere.”

You have to wonder about any Administration dumb enough to call a proposal “extreme vetting.” The campaign is over (at least for now). While intentionally inflammatory language might play well with the base, in the real world of governing it’s better to choose more “bureaucratically neutral” terms.

The pledge to move ahead came hours after the Justice Department had asked a federal judge Monday night to postpone the department’s tentative police reform agreement with the city — part of a wider review of pacts nationwide ordered by U.S. Attorney General Jeff Sessions.

The Baltimore consent agreement was announced days before President Trump took office and awaits a federal judge’s approval.

The request for a delay, which a judge has yet to rule on, left some Baltimore leaders and residents worried that momentum will wane and leave the city stuck in a familiar loop of unfulfilled promises.

Interim city solicitor David Ralph would not comment Tuesday on whether the city would file a response to the requested delay.

“It seemed clear that Justice was going ahead with these reforms, and now all of a sudden they don’t want to do it,” said Rebecca Nagle, co-director of the No Boundaries Coalition, a ­resident-led advocacy group.

The coalition helped organize residents to relay their experiences with city police to the Justice Department team that produced the August report, which concluded that the police department engaged in unconstitutional policing that discriminated against black residents in poor communities through illegal searches, arrests and stops for minor offenses.
“Residents invested two years doing this, and not going forward will destroy the trust that has built up,” Nagle said.

In Sessions’s two-page memo ordering the review of open and pending consent decrees, he said the department wants to guarantee the pacts are in line with Trump administration goals of promoting officer safety and morale while fighting violent crime.

“The Federal government alone cannot successfully address rising crime rates, secure public safety, protect and respect the civil rights of all members of the public, or implement best practices in policing,” the memo stated. “These are, first and foremost, tasks for state, local and tribal law enforcement.”

Now, I might only be a retired Immigration Judge, not a civil rights expert. But, even I can tell that if “state and local law enforcement” could solve this problem, it would have been solved long ago.

In fact, until former Attorney General Lynch and the DOJ’s Civil Rights Division intervened, state and local authorities had done their best to cover up the problems and avoid solving them. (And, I’m by no means a fan of Lynch. She was appropriately very interested in vindicating the civil rights of African Americans. But, she wasn’t interested in the human rights of mostly Hispanic women and children fleeing Central America. She aided and abetted a system of detention of such asylum applicants under deplorable conditions and hustling their cases through the U.S. Immigration Courts, in too many cases without full due process or even an opportunity for a fair hearing.)

No, what Sessions really means is that he has no interest whatsoever in helping the African American community vindicate their civil rights if it means clamping down on police abuses. After all, look at the “bang up” job that Session’s home state, Alabama, did on protecting its African American citizens from police abuses for most of the 20th Century. Who could ask for more? Or, perhaps we should get a “second opinion” from Congressman John Lewis (D-GA) who had his head split open by one of Sessions’s “police heroes,” an Alabama State Trooper.

That’s what often happens when the Feds rely on states and localities to vindicate citizen’s constitutional rights against the state’s own abuses. Classic “fox guarding the chicken coop.” Sort of like having Jeff Sessions protecting the rights of minorities and migrants. Yeah, the Birmingham Bridge incident was in 1965. But, Sessions and his gang have every intention of turning the clock back to those “glory days” of state’s rights.

Remember, it wasn’t that long ago that Senator Elizabeth Warren (D-MA) was “silenced” on the Senate floor for “disparaging” a colleague, Senator Sessions, by putting the truth about his tone-deaf record on civil and human rights “in the record.” But, silenced or not, Warren spoke truth about Session’s unsuitability to serve as Attorney General. Sadly, African Americans, Hispanics, members of the LGBT community, and migrants are likely to find out first hand that “he’s still the same ol’ Jeff.”
