A top health official told lawmakers Tuesday that the Trump administration was warned about instituting “any policy” resulting in family separations because of the effects such separations could have on the wellbeing of immigrant children.

The official’s response came after Sen. Richard Blumenthal (D-Conn.) asked every federal immigration official at Tuesday’s hearing over family separations to answer a particular question: “Did anyone on this panel say, maybe [separating families] wasn’t such a good idea?”

After a pause, Blumenthal directed his question first to Commander Jonathan White of the U.S. Public Health Service Commissioned Corps, who said he and the Office of Refugee Resettlement raised a number of concerns in the previous year about “any policy which would result in family separation due to concerns we had about the best interest of the child as well about whether that would be operationally supportable with the bed capacity we had.”

The Democratic senator asked the commander to further explain his response in layman’s terms, asking if he told the administration that children would “suffer” as a result of its “zero tolerance” policy.

“Separation of children from their parents entails significant harm to children,” White said in response. “There’s no question that separation of children from parents entails significant potential for traumatic psychological injury to the child,” he added, shortly after.

White also said that the administration’s response was that family separation was not a policy. As stated before, there is no current law that mandates the separation of migrant children from their parents at the U.S. border.

The Trump administration implemented its “zero-tolerance” policy this spring. President Donald Trump signed an executive order in June to halt the separations.

In recent weeks, lawsuits filed against the separation policy have produced testimonies from lawyers and the separated families they represent, alleging that the government’s actions resulted in trauma to their children.

In one personal declaration presented earlier this month in court, one mother said her son “is not the same since we were reunited.”

“I thought that, because he is so young he would not be traumatized by this experience, but he does not separate from me. He cries when he does not see me,” Olivia Caceres said of her 1-year-old son. “That behavior is not normal. In El Salvador he would stay with his dad or my sister and not cry. Now he cries for fear of being alone,” she wrote.

The greater the truth, the worse the lie; the corruption of the best is the worst of all. People mislead one another all the time about temporary and venial things, which constitutes its own category of error, but rarely — even in the moral wasteland of American politics — do they get around to prevaricating about the eternal and cosmic. Lying about the capital-t, transcendent Truth is a category of error all on its own, whether you spend most of your time fooling others or just yourself.

Attorney General Jeff Sessions and White House press secretary Sarah Huckabee Sanders perhaps indulged in a bit of both Thursday, when asked about the moral reasoning behind separating migrant parents from their children at the U.S. border.

Sessions argued that, as criminals, immigrants have put themselves beyond the protection of God’s care. “I would cite you to the Apostle Paul and his clear and wise command in Romans 13, to obey the laws of the government because God has ordained them for the purpose of order,” Sessions explained by way of scriptural warrant. He added that “orderly and lawful processes are good in themselves . . . [and protect] the weak and lawful.” Sanders later offered an artful gloss in defense of Sessions: “It is very biblical to enforce the law,” she said.

Here, whether deliberately or unknowingly, Sessions and Sanders radically depart from the Christian religion, inventing a faith that makes order itself the highest good and authorizes secular governments to achieve it. In Christianity as billions of faithful have known it, order and lawful procedures are not “good in themselves” and it is not “very biblical” to “enforce the law” whatever it might be. Rather, there is a natural order inscribed into nature. Human governance can comport with it or contradict it, meaning Christians are sometimes morally obligated to follow civil laws and are sometimes morally obligated not to.

Conservatives seize on this approach when it suits them; this is why they’re so keen on carving out legal protections for matters of religious conscience. Because religious obligations precede and generate civic ones, laws must accommodate religious practice, not the other way around.

As Sessions himself observed quoting James Madison in a lengthy October 2017 memorandum on federal protections concerning religious liberty, “the duty owed to one’s Creator is ‘precedent, both in order of time and in degree of obligation, to the claims of Civil Society.’” Sessions can either believe that or believe what he and Sanders said Thursday, but he can’t believe both. To put a finer point on it: God’s law can’t only precede — and top — civil law when a pharmacist would prefer not to sell the Plan B contraceptive, but not when it would appear a ruler is duty-bound to show compassion to strangers.

But there are worse things than confusion, or even than hypocrisy. One of them is self-deception. When Sessions invoked Romans 13 — a verse infamous for earlier bad-faith invocations to justify slavery — he shifted the subject of the question from himself and his own department to those under his control. He was summoned to defend his choices, his judgment, his own moral reasoning — but instead offered a condemnation of the decisions and morality of migrants. He wanted to talk about what, in his view, the Bible demands of the ruled. But he omitted the more important question: What does it demand of rulers?

Any number of scriptural passages aavailable here, though less useful for Sessions’s purposes. From Deuteronomy 10 : “For the Lord your God . . . loves the strangers, providing them food and clothing. You shall also love the stranger, for you were strangers in the land of Egypt.” Or from Jeremiah 7: “If you really change your ways and your actions and deal with each other justly, if you do not oppress the foreigner, the fatherless or the widow and do not shed innocent blood in this place . . . then I will let you live in this place, in the land I gave your ancestors for ever and ever.” Dealing compassionately with strangers seems to be a minimal requirement for just leadership in the model set forth by God, a theme that carries into the New Testament, where Christ’s followers are taught to view themselves as wanderers on earth, and to treat others with appropriate empathetic mercy.

But some Christians aren’t strangers in the world at all. Some are very much at home here, or believe that they are, and that there is no tension between the desire of God and the desire of man. People can believe any number of things, especially given the right incentives.

If you had all the power in the world, maybe you would also hear a serpent dipping its smooth body down from some shadowy bough to say: God wants you to do whatever you like with your power, and whatever you do with it is good.

“It’s becoming a cultish thing, isn’t it?” Sen. Bob Corker (R-Tenn.) mused this week about his Republican Party under President Trump.

As if to prove Corker’s point, the Trump administration the very next day claimed that it had the divine right to rip children from their parents’ arms at the border.

Officials justified the unique form of barbarism — taking infants from parents and warehousing children in tent cities and an abandoned Walmart — by saying they are doing God’s will.

“I would cite you to the Apostle Paul and his clear and wise command in Romans 13, to obey the laws of the government because God has ordained them for the purpose of order,” Attorney General Jeff Sessions said Thursday. “I am not going to apologize for carrying out our laws.”

White House press secretary Sarah Huckabee Sanders, asked about Sessions’s remarks, said: “It is very biblical to enforce the law.”

This isn’t religion. It’s perversion. It is not the creed of a democratic government or political party but of an authoritarian cult.

The attorney general’s tortured reading of Romans is exactly the strained interpretation that others have used before to justify slavery, segregation, apartheid and Nazism. The same interpretation could be used to justify Joseph Stalin, or Kim Jong Un.

Romans 13 does indeed say to “submit to the authorities,” because they “are God’s servants, agents of wrath to bring punishment on the wrongdoer.” But this is in the context of what comes before it(“share with the Lord’s people who are in need. Practice hospitality”) and after (“owe no one anything, except to love each other, for the one who loves another has fulfilled the law”) – and, indeed, admonitions to care for the poor and the oppressed that come from Isaiah, Leviticus, Matthew and many more.

Evangelical leaders who looked the other way when Stormy Daniels and the “Access Hollywood” tape surfaced this time have denounced Trump’s recent “zero-tolerance” policy that, as the National Association of Evangelicals, the Southern Baptist Convention and others wrote to Trump this month, has the “effect of removing even small children from their parents.”

“God has established the family as the fundamental building block of society,” they wrote. The leaders urged Trump to end zero tolerance and use “discretion” as previous administrations did.

But a cult, by definition, is not about mainstream theology. I looked up characteristics of cults in the sociological literature to see how Trump’s stacks up.

□ “Presents a distinct alternative to dominant patterns within the society in fundamental areas of religious life.” Grab ’em by the p—y!

□ “Possessing strong authoritarian and charismatic leadership.” I alone can fix it!

□ “Oriented toward ‘inducing powerful subjective experiences.’ ” Alternative facts. Fake news!

□ “Requiring a high degree of conformity.” See: Flake, Jeff and Sanford, Mark.

□ A tendency “to see itself as legitimated by a long tradition of wisdom or practice.” It is very biblical to enforce the law.

Check, check, check, check and check.

And members of the Cult of Trump, formerly known as the GOP, follow him over the cliff and onto the spaceship. They swallowed their heretofore pro-life, pro-family and pro-faith views to embrace Trump’s travel ban on several Muslim-majority countries (“Such blatant religious discrimination is repugnant,” said the U.S. Conference of Catholic Bishops) and applaud him tossing paper towels at Puerto Ricans as they died by the thousands because they didn’t get adequate hurricane relief.

They’ve joined his efforts to shred food, income and health programs that help the least among us while giving tax cuts to the wealthiest. They’ve accepted his abandonment of human rights abroad. They’ve joined his attempt to end family-based immigration and to threaten deportation of “dreamers,” immigrants brought here as children.

It appeared, briefly, that things might be different this time. House Republicans drafted legislation allowing children to be detained with their parents. But Trump on Friday signaled that he would veto the bill, and, as House Speaker Paul D. Ryan (R-Wis.) said this week, the “last thing I want to do is bring a bill out of here that I know the president won’t support.”

This is the way of the cult.

Will the vivid cruelty of taking babies from parents, coupled with the obscene use of Scripture to justify it, finally lead some Trump supporters to abandon the compound? God knows.

But the rest of us don’t need to drink the Kool-Aid. Give to groups such as the Florence Project, which provides legal aid and social services to immigrant families in Arizona, and Catholic Charities USA, which provides crucial help to immigrant families in the Rio Grande Valley.

You don’t have to be a theologian to see the difference between people who do God’s work on earth and those who pervert God’s word to justify inhumanity.

Since 2002, the US Department of Justice’s WEB Du Bois program has sponsored research fellowships on issues of race and criminal justice. During Republican and Democratic administrations, a diverse group of academics have carried the spirit of the noted sociologist and civil rights leader to the race challenges of the 21st century. Given the racial disparity endemic at every stage of the justice system the DoJ’s investigation of these issues has been praiseworthy.

But with Jeff Sessions as attorney general exploring the roots of this injustice may now be compromised. In the recently released solicitation for the Du Bois fellowships the DoJ invited scholars to engage in research on five issues arising out of the “tough on crime” era that would make a student of the Du Bois legacy shudder.

Whereas Du Bois is widely known for promoting the idea that “the problem of the 20th century is the problem of the color line”, the DoJ solicitation displays no interest in such high-profile issues as police killings of unarmed black men or the impact of mass incarceration on the African American community. Instead, “protecting police officers” is the only area of law enforcement prioritized by the DoJ.

Another research priority, “enhancing immigration enforcement”, coming at a moment when barely disguised racist imagery accompanies those policies, seems particularly jarring when upheld in the name of a civil rights legend.

The DoJ approach to research is unfortunately consistent with the misconstrued “law and order” agenda that Jeff Sessions has brought to his leadership. Within a month of taking office Sessions had rescinded the Obama-era decision to phase out federal contracting with private prisons. That initiative had been based in part on an inspector general’s finding that such prisons had higher levels of assault and safety concerns than public prisons.

Sessions overturned a policy adopted by his predecessor Eric Holder that urged federal prosecutors to use their discretion to avoid bringing drug charges that would carry a mandatory minimum sentence if the facts of the case suggested that the defendant had little criminal history and was not a major player in the drug trade. A year after its implementation the number of such sentences had declined by 25%, with no adverse effects on drug law enforcement.

In contrast, Sessions now requires that federal prosecutors seek the most serious charge they can bring in every case. This policy is faulty on two counts. First, it fails to recognize that no two crimes or defendants are exactly alike, and that sentencing needs to be individualized. Second, the directive conflicts with the ethical standard for prosecutors to seek justice, not vengeance. In some cases, justice may represent a prison term, in others it may be placement in residential drug treatment.

Sessions also has emerged as the primary political obstacle to the bipartisan sentencing reform movement on Capitol Hill, and joined with President Trump’s barbaric call for the death penalty for drug sellers. At a moment when Americans increasingly recognize that treatment is more effective than punishment for addressing addiction, such a dehumanizing message will only inflame the public debate in unproductive ways.

Perhaps most unsettling about the Du Bois initiative and the thrust of current policy is its disconnect from evidence and the current realities of crime and justice. Certainly law enforcement officers need to be protected as they do their jobs, but so do communities of color when they are harmed by racist policing. Suggesting that we need to enhance immigration enforcement at a time when this is already at record levels fails to engage in the vitally needed conversation about how to develop immigration policy that offers refuge to those fleeing violence and enhances cross-border economic opportunity and family stability.

It is often said that elections have consequences. Distorting history, though, and the contributions of past scholars is not a political consequence but rather degrades our intellectual tradition.

Sessions is and always has been a racist. That he has now shifted most of his intellectual dishonesty, intentionally racially inflammatory rhetoric, and false narratives to attacking Hispanics, immigrants, and gays, rather than concentrating on demeaning African-Americans, doesn’t change anything.

About the best that can be said for “Gonzo” is that he’s an “equal opportunity racist.” That he has risen to the position of Attorney General while espousing his White Nationalist views is a continuing stain on America and our national values. It’s also something for which the GOP must be held accountable once they finally lose their ultimately doomed quest to “Keep America White.”

Sen. Elizabeth Warren and others were right about Sessions. That they were ignored and rudely “tuned out” by their GOP colleagues is an ongoing national disgrace.

Scientists Baffled by McConnell and Ryan’s Ability to Stand Upright Without Spines

WASHINGTON (The Borowitz Report)—Calling it a “medical mystery of the first order,” scientists are baffled by the ability of Senate Majority Leader Mitch McConnell and House Speaker Paul Ryan to stand upright without the benefit of spines.

Doctors at the University of Minnesota Medical School, who have been studying the skeletal structures of both Republicans for months, believe that their ability to stand, walk, and even break into a brisk trot when confronted by reporters’ questions is “virtually inexplicable.”

“The fact that they can do these things without the aid of spines makes McConnell and Ryan anomalies in the animal kingdom,” said Dr. Davis Logsdon. “According to everything medical science teaches us, their bodies should be collapsing to the ground in two heaps.”

As the Minnesota scientists have struggled to solve the medical conundrum presented by the two invertebrate leaders, one theory that has gained traction is what Logsdon calls “the startled-deer hypothesis.”

“Just as a deer freezes in the headlights of a car and briefly appears statue-like, we believe that Ryan and McConnell’s bodies may retain their rigid structure out of terror alone,” he said. “In other words, fear is performing the function that a spine performs in other people.”

Calling it “just a theory,” Logsdon said that the anatomies of McConnell and Ryan require further study, and that there was growing public support for both men to be dissected.

“Attorney General Jeff Sessions’ decision to fire former FBI deputy director Andrew McCabe appears to directly violate the promise Sessions made, under oath, to recuse himself from such matters.

Some might contend that Sessions’ recusal covered only the Clinton and Trump campaigns, and that McCabe’s firing involved the Clinton Foundation investigation as a separate matter. But Sessions unequivocally assured senators of his intentions during his January 2017 confirmation hearings in response to a clear and specific question from the chair of the Senate Judiciary Committee, Sen. Chuck Grassley. Sen. Grassley asked a follow-up question that went right to the point. In response, Sessions very clearly said his recusal would cover any matters involving the Clinton Foundation.

Here is the full exchange:

Grassley: During the course of the presidential campaign, you made a number of statements about the investigation of former Secretary of State Hillary Clinton, relating to her handling of sensitive emails and regarding certain actions of the Clinton Foundation. You weren’t alone in that criticism. I was certainly critical in the same way as were millions of Americans on those matters, but now, you’ve been nominated to serve as attorney general. In light of those comments that you made, some have expressed concerns about whether you can approach the Clinton matter impartially in both fact and appearance. How do you plan to address those concerns?

Sessions: Mr. Chairman, it was a highly contentious campaign. I, like a lot of people, made comments about the issues in that campaign. With regard to Secretary Clinton and some of the comments I made, I do believe that that could place my objectivity in question. I’ve given that thought.

I believe the proper thing for me to do, would be to recuse myself from any questions involving those kind of investigations that involve Secretary Clinton and that were raised during the campaign or to be otherwise connected to it.

Grassley: OK. I think, that’s—let me emphasize then with a follow-up question. To be very clear, you intend to recuse yourself from both the Clinton email investigation and any matters involving the Clinton Foundation, if there are any?

Sessions: Yes.

This exchange has two implications for how one understands the scope of Sessions’ recusal. First, it goes to defining the scope of the recusal that Sessions made on March 2, 2017. If it is a close call whether the Clinton Foundation matter is sufficiently connected to the Clinton campaign for the purpose of understanding Sessions’ recusal, it should be deemed to be sufficiently connected. After all, that’s essentially what Sessions told Sen. Grassley. Second, if the Clinton Foundation matter is deemed outside the scope of the recusal statement that Sessions made back in March last year, then his decision to fire McCabe shows that he failed to honor the promise for a broader recusal which he clearly made to the Senate in its decision to confirm him as attorney general. The same goes for Hillary Clinton’s emails. Sen. Grassley’s questions and Sessions’ answers specifically covered any matters involving that investigation as well.”

Meanwhile, over at Reuters, Karen Freifeld, Sarah N. Lynch, Mark Hosenball have uncovered some evidence that contradicts Gonzo’s “revised account” of his meeting at which George Papadopoulos’s proposed “Russia contacts” were discussed with Trump campaign officials including Gonzo. It now appears that Gonzo’s story that he immediately and strongly denounced them could be a fabrication. Or just another “memory lapse.”

“WASHINGTON (Reuters) – U.S. Attorney General Jeff Sessions’ testimony that he opposed a proposal for President Donald Trump’s 2016 campaign team to meet with Russians has been contradicted by three people who told Reuters they have spoken about the matter to investigators with Special Counsel Robert Mueller or congressional committees.

Sessions testified before Congress in November 2017 that he “pushed back” against the proposal made by former campaign adviser George Papadopoulos at a March 31, 2016 campaign meeting. Then a senator from Alabama, Sessions chaired the meeting as head of the Trump campaign’s foreign policy team.

“Yes, I pushed back,” Sessions told the House Judiciary Committee on Nov. 14, when asked whether he shut down Papadopoulos’ proposed outreach to Russia.

Sessions has since also been interviewed by Mueller.

Three people who attended the March campaign meeting told Reuters they gave their version of events to FBI agents or congressional investigators probing Russian interference in the 2016 election. Although the accounts they provided to Reuters differed in certain respects, all three, who declined to be identified, said Sessions had expressed no objections to Papadopoulos’ idea.

One person said Sessions was courteous to Papadopoulos and said something to the effect of “okay, interesting.”

The other two recalled a similar response.

“It was almost like, ‘Well, thank you and let’s move on to the next person,’” one said.

However, another meeting attendee, J.D. Gordon, who was the Trump campaign’s director of national security, told media outlets including Reuters in November that Sessions strongly opposed Papadopoulos’ proposal and said no one should speak of it again. In response to a request for comment, Gordon said on Saturday that he stood by his statement.

Sessions, through Justice Department spokeswoman Sarah Isgur Flores, declined to comment beyond his prior testimony. The special counsel’s office also declined to comment. Spokeswomen for the Democrats and Republicans on the House Judiciary Committee did not comment.

Reuters was unable to determine whether Mueller is probing discrepancies in accounts of the March 2016 meeting.

The three accounts, which have not been reported, raise new questions about Sessions’ testimony regarding contacts with Russia during the campaign.

Sessions previously failed to disclose to Congress meetings he had with former Russian Ambassador Sergey Kislyak, and testified in October that he was not aware of any campaign representatives communicating with Russians.

Some Democrats have seized on discrepancies in Sessions’ testimony to suggest the attorney general may have committed perjury. A criminal charge would require showing Sessions intended to deceive. Sessions told the House Judiciary Committee that he had always told the truth and testified to the best of his recollection.

Legal experts expressed mixed views about the significance of the contradictions cited by the three sources.

Sessions could argue he misremembered events or perceived his response in a different way, making any contradictions unintentional, some experts said.

Jonathan Turley, a law professor at George Washington University, said Sessions’ words might be too vague to form the basis of a perjury case because there could be different interpretations of what he meant.

“If you’re talking about false statements, prosecutors look for something that is concrete and clear,” he said.

Other legal experts said, however, that repeated misstatements by Sessions could enable prosecutors to build a perjury case against him.

“Proving there was intent to lie is a heavy burden for the prosecution. But now you have multiple places where Sessions has arguably made false statements,” said Bennett Gershman, a Pace University law professor.

The March 2016 campaign meeting in Washington was memorialized in a photo Trump posted on Instagram of roughly a dozen men sitting around a table, including Trump, Sessions and Papadopoulos.

Papadopoulos, who pleaded guilty in October to lying to the Federal Bureau of Investigation about his Russia contacts, is now cooperating with Mueller.

According to court documents released after his guilty plea, Papadopoulos said at the campaign meeting that he had connections who could help arrange a meeting between Trump and Russian President Vladimir Putin.

Papadopoulos continued to pursue Russian contacts after the March 2016 meeting and communicated with some campaign officials about his efforts, according to the court documents.

Trump has said that he does not remember much of what happened at the “very unimportant” campaign meeting. Trump has said he did not meet Putin before becoming president.

Moscow has denied meddling in the election and Trump has denied his campaign colluded with Russia.

“Take away a deadline, and Congress will simply lose its focus on any issue — even the heated debate around immigration.

At Tuesday morning’s House Republican briefing, just one of the five GOP leaders made a reference to the issue, and it was a passing one — a proposal meant mostly to placate conservatives, not a real solution that could get signed into law.

Across the Capitol, a few hours later, Senate Majority Leader Mitch McConnell (R-Ky.) and four senior Republicans did their weekly briefing. Topics ranged from gun background checks to the Winter Olympics. There was no immigration talk at all.

The four Senate Democrats who followed McConnell also made no mention of the looming Monday deadline to resolve the fate of 800,000 undocumented immigrants who have been shielded from the threat of deportation under an expiring executive order.

It’s understandable that most of the attention has shifted toward the fallout of the Valentine’s Day massacre of 17 students and faculty at a Florida high school, with the media intensely focused on gun laws and school violence.

All but one of the 17 questions fielded by House Speaker Paul D. Ryan (R-Wis.) and Senate Minority Leader Charles E. Schumer (D-N.Y.), at their separate press briefings, related in some way to the Parkland, Fla., shootings. The lone outlier focused on the memorial service for the Rev. Billy Graham.

This was supposed to be the week when Congress would force itself to resolve the dispute over the Obama administration’s Deferred Action for Childhood Arrivals (DACA) executive order, which President Trump announced in September he would revoke on March 5, giving Congress a six-month window to resolve the issue.

It was, in some ways, a masterful idea by the Trump West Wing, living up to his tough talk on immigration during the presidential campaign in 2016 but also foisting the issue into the laps of lawmakers.

But now, amid legislative and judicial gridlock, lawmakers and the media have moved on to other topics. First, the Senate failed two weeks ago to approve any compromise. Then, the Supreme Court declared it would not wade into the legal challenges to the DACA program until it plays out in lower federal court rulings — a legal process with no obvious end date in sight.

“We would be well advised to continue our work on it, but it seems to me that a lot of the air is out of the balloon here in the Capitol, and people don’t sense its urgency,” said Sen. John Cornyn (Tex.), the Republican whip who had been leading bipartisan talks.

Cornyn’s lead negotiating partner, Sen. Richard J. Durbin (Ill.), the Democratic whip, has declared helping the “dreamers,” as the undocumented immigrants who were brought here as children are known, an urgent, moral mandate. But even he understands why the issue has fallen off the radar.

“Along comes this tragedy, in the high school in Parkland, Florida, and the response of the young people and the national response of the subject, it blows away all other conversations about DACA and the Dream Act, North Korean nuclear threats,” Durbin said.

He and Cornyn have not held any serious immigration talks in weeks, he said — and he added that the same is true for a separate bipartisan group of centrist senators. And none are on tap.

“We talk but at this point we don’t have a plan,” he said.

Just like that, in the span of a few days — Senate gridlock, a madman’s bullets killing children and a judicial ruling — and the issue that consumed Washington for most of December, January and February is no longer worth a mention at a leadership news conference.

That’s not to say the issue has subsided from the political debate. Activists are trying to keep the pressure on Trump and Congress, with a rally planned for Sunday in Washington to draw attention to Monday’s DACA deadline that is set to pass without much fanfare.

In southwestern Pennsylvania, Republicans are furiously trying to stave off an embarrassing loss in a special election to fill a vacant House seat. The district tilted toward Trump by nearly 20 percentage points in 2016, a year in which Democrats did not even field a candidate against the longtime Republican incumbent, Tim Murphy, who resigned amid a scandal late last year.

Now, to halt the momentum for Democrat Conor Lamb, a GOP super PAC called the Congressional Leadership Fund has unleashed a new adthat ties Lamb to House Minority Leader Nancy Pelosi (D-Calif.) and her hometown San Francisco’s status as a “sanctuary city” for people in the country illegally.

“Conor Lamb wants to help Nancy Pelosi give amnesty to millions of illegal immigrants,” the narrator says. “Sanctuary cities and amnesty for illegals. Conor Lamb is a Pelosi liberal.”

Lamb, 33, a former assistant U.S. attorney, does support a path to citizenship for DACA recipients, but he has stated that he will not vote for Pelosi as speaker. That position was highlighted in a new ad he is running that calls for new leadership in both parties.

Clearly, Republicans believe the issue still has resonance with their conservative base voters, especially if it is mixed in with images of Pelosi. And Lamb seems to be aware of the threat.

But Republicans could face their own political dilemma if the federal courts rule that DACA was illegal, which would effectively reinstate Trump’s order and revoke protections from those 800,000 people. Deportations could begin quickly.

“I don’t believe that Senator McConnell and the Republicans want to see too many people deported out of Nevada and Arizona in the weeks and months ahead,” Durbin said.

He named two southwestern states with large dreamer populations where Republicans are trying to defend two Senate seats that could flip control of the Senate in the November midterm elections.

Republicans are well aware of the potential for a court ruling at any time.

“I’ve been working in and around courts long enough to know things can turn on a dime,” said Cornyn, who served as Texas attorney general, and on the state Supreme Court, before winning his Senate seat 15 years ago.

That said, Cornyn remains less than optimistic about congressional action until that court order arrives and forces action. Stating the obvious, he said: “We don’t do things around here unless there is a deadline.”

Given the ugliness surrounding the farcical “debate” about Dreamers in the Senate and pressure exerted by the White Nationalists/Bakuninists in the House, perhaps it’s just as well that Dreamers are “forgotten” for now.

My prediction: It will take “regime change” — however long that might take — to solve the “Dreamers’ dilemma” on a long-term basis. In the meantime, I think that their status and fate will be tied up in the courts for a long, long time — wasteful, but an unfortunate fact of life when we have “Gonzo Government” elected by a minority of voters.

ETHICS HOT SEAT: TRUMP LAWYERS’ DILEMMA: How Do You Prepare A Congenital Liar To Testify Under Oath?

“The most difficult decision a lawyer has to make is whether to allow his client to speak to the prosecutor—or in this case, the special counsel,” Robert Bennett told me, referring to the unfolding chess match between Donald Trump and Robert Mueller. Bennett, the Brooklyn-born Washington superlawyer, would know, having represented President Bill Clinton in the Kenneth Starr investigation. For a fabulist like Trump, however, the danger is tenfold: Mueller has already charged four former members of the Trump campaign with making false or misleading statements to the F.B.I. “I think there are tremendous risks in this case, because the easiest case for the government to prove would be a false statement given to the F.B.I. or the independent counsel,” Bennett added. “That’s a very easy one to prove.”

While the president initially said he is “100 percent” willing to meet with Mueller under oath, his legal team has cautioned that any interview could be a perjury trap. “He’ll be guided by the advice of his personal counsel,” Ty Cobb, the White House lawyer on the Russia inquiry, told The New York Times. For months, Trump’s lawyers have been engaged in discussions with Mueller’s team, weighing options that could mitigate the president’s legal risk. Though the format of the potential interview remains an open question, Mueller, wielding the power of subpoena, has the upper hand in shaping the negotiations. “What matters is how much leverage you have on either side,” said Renato Mariotti, a former Chicago prosecutor. “Mueller has most of the leverage . . . in the end, Mueller is going to get most, if not the vast majority, of what he wants.”

The challenge for Trump’s legal team, led by Cobb and John Dowd, is to protect the president from himself under conditions acceptable to Mueller. “It’s a very bad sign for the president that his own lawyers are so worried about whether he’s going to tell the truth that they’re trying to negotiate all of these conditions ahead of time,” Neal Katyal, a former acting solicitor general under President Barack Obama, told me. “Ordinarily, when you’re representing a high-ranking government official, you’re not worried about your client being forthcoming because that goes with the nature of government service. But here, I think the lawyers are wise to worry, just given Donald Trump’s track record of him confabulating in any number of ways.”

I don’t have much doubt that Trump will perjure himself. I don’t think he could tell the truth if his life depended on it. And, it’s likely that Mueller will be able to build a convincing case for obstruction against the Liar-In-Chief.

But, Trump relies heavily on the complicity of  the sleazy GOP he has come to dominate and the indifference of his voters to moral values or honest government. Trump is used to at least figuratively “getting away with murder” (remember his all too true boast that he could shoot someone in broad daylight in Times Square and his voters wouldn’t care). So, the chances of Trump being held accountable are probably minimal until 2024.

A few weeks ago, the contours of an immigration compromise looked clear: Republicans would let the “dreamers” stay. Democrats would let Trump build his wall. Both sides would swallow something their bases found distasteful in order to get the thing their bases cared about most.Since then, Trump has blown up the deal. He announced on Wednesday that he would legalize the “dreamers,” undocumented immigrants brought to the U.S. as children, only if Democrats funded his wall and  ended the visa lottery and “chain migration.” He would support a path to citizenship for undocumented immigrants only if Congress brought the number of legal immigrants down.

There’s an irony here, which was pointed out to me by CATO Institute immigration analyst David Bier. Until recently, Republican politicians drew a bright line between illegal immigration, which they claimed to hate, and legal immigration, which they claimed to love. Florida Senator Marco Rubio launched his presidential campaign at the Freedom Tower, Miami’s Ellis Island. Texas senator Ted Cruz, who in 2013 proposed a five-fold increase in the number of H1B visas for highly skilled immigrants, declared in April 2015 that, “There is no stronger advocate for legal immigration in the U.S. Senate than I am.” Mitt Romney promised in 2007 that, “We’re going to end illegal immigration to protect legal immigration.”

Trump has turned that distinction on its head. He’s willing to legalize the “dreamers”—who came to the United States illegally—so long as the number of legal immigrants goes down. He has not only blurred the GOP’s long-held moral distinction between legal and illegal immigration. In some ways, he’s actually flipped it—taking a harder line on people who enter the U.S. with documentation than those who don’t.

What explains this? Trump’s great hidden advantage during the 2016 Republican presidential primary was his lack of support from the GOP political and donor class. This allowed him to jettison positions—in support of free trade, in support of the Iraq War, in support of cutting Medicare and Social Security—that enjoyed support among Republican elites but little support among Republican voters. He did the same on immigration, where the “legal good, illegal bad” distinction turned out to be much more popular among the party’s leaders than among its grassroots. Cribbing from Ann Coulter’s book, Adios America, Trump replaced the legal-illegal distinction with one that turned out to have more resonance on the activist right: The distinction between white Christian immigrants and non-white, and non-Christian ones.The words “illegal immigration” do not appear in Trump’s presidential announcement speech. Instead, Trump focused on immigrants’ country of origin. “When Mexico sends its people,” he declared, “they’re not sending their best … They’re sending people that have lots of problems, and they’re bringing those problems with us. They’re bringing drugs. They’re bringing crime. They’re rapists … It’s coming from more than Mexico. It’s coming from all over South and Latin America, and it’s coming probably—probably—from the Middle East.”

Trump, who often says bluntly what other Republicans say in code, probably realized that “illegal immigrant” was, for many voters, already a euphemism for Latino or Mexican-immigrants. In their book White Backlash, the political scientists Marisa Abrajano and Zoltan Hajnal cite a poll showing that 61 percent of Americans believe that most Latino immigrants are undocumented even though only about a quarter are. “When Americans talk about undocumented immigrants, Latinos or immigrants in general,” they note, “the images in their heads are likely to be the same.”

What really drove Republican opinion about immigration, Trump realized, was not primarily the fear that the United States was becoming a country of law-breakers. (Republicans, after all, were not outraged about the lack of prosecution of tax cheats.) It was the fear that the United States—which was becoming less white and had just elected a president of Kenyan descent—was becoming a third world country.When the Public Religion Research Institute and Brookings Institution asked Americans in 2016 their views of immigration from different parts of the world, it found that Republicans were only three points more likely than Democrats to want to reduce immigration from “predominantly Christian countries” and only seven points more likely to want to reduce immigration from Europe. By contrast, they were 33 points more likely to support reducing immigration from Mexico and Central America and 41 points more likely to support reducing immigration from “predominantly Muslim countries.” What really drives Republican views about immigrants, in other words, is less their legal status than their nation of origin, their religion, and their race.

Trump grasped that during the campaign, and in coalition with a bevy of current and former Southern Senators—Jeff Sessions, David Perdue and Tom Cotton—he has used it to turn the GOP into a party devoted to slashing legal immigration. On Thursday, when presented with a bill that traded the legalization of dreamers for more border security but did not reduce legal immigration, only eight Republican Senators voted yes. However, 37 voted for a bill that legalized the “dreamers,” added more border security and substantially reduced legal immigration.

But there’s another reason Trump has succeeded in erasing the “legal good, illegal bad” distinction that for years governed GOP immigration debate. He’s made Republicans less concerned with legality in general. In 2012, the GOP—which was then-outraged by executive orders that supposedly displayed President Barack Obama’s contempt for the constitutional limits of his office—titled the immigration section of its platform, “The Rule of Law: Legal Immigration.” The seven paragraph-section used variations of the word “law” fourteen times.That emphasis is harder now. In his ongoing battles with the FBI, Justice Department, judiciary and Special Counsel Robert Mueller, Trump has convinced many Republicans that the “rule of law” is often a cloak for the partisan biases of the “deep state.” As a result, Republicans are now 22 pointsless likely to hold a positive opinion of the FBI than they were in 2015.

What really matters for many Republicans in Trump’s standoff with Mueller and the FBI is not who has the law on their side, since the bureaucracy can twist the law to its own advantage. What really matters is who enjoys the backing of “the people,” the authentic America that resides outside the swamp, a construct that definitely does not include the imagined beneficiaries of “chain migration” and the “visa lottery.”

In the Trump era, Republicans now justify their immigration views less by reference to law than by reference to tribe. Which, not coincidentally, is how they justify Trump’s presidency itself.”

Marco Rubio has already seen the downside of trying to become a national force in the GOP by advocating a moderate, pro-business, pro-immigrant, not overtly anti-Hispanic policy. I suspect if and when Ambassador Nikki Haley tries to make a bid for national office in the GOP she’ll find out that the Miller-Sessions-Cotton-Perdue-King group and Trump supporters will treat her with the same disrespect, bias, and disdain that they usually reserve for smart, capable Latinas, children fleeing for their lives from the Northern Triangle, and “Dreamers.”

And folks like Sen. Tim Scott will find that even consistent support for a right-wing GOP that regularly disses African-Americans and Hispanics won’t give him “White Guy” status in the larger GOP world. A useful vote in the Senate. That’s about it. Reportedly, Scott once talked to Trump about the latter’s “tone” on race. How did that work out, Tim? But, hey, as long as you vote for big tax breaks for the wealthy, cuts in health care, and are happy to threaten the benefits, remaining dignity, and lives of the poor, you can at least retain your status a “club member at the retail level.”

“PRESIDENT TRUMP has often spoken and tweeted of the soft spot in his “great heart” for “dreamers,” the hundreds of thousands of young immigrants brought to this country as children. This supposed concern has now been revealed as a con.

Offered bipartisan legislation in the Senate that would have protected 1.8 million dreamers from deportation, in return for a down payment on the $25 billion wall Mr. Trump assured voters that Mexico would finance, the president showed his cards. The deal was a “total catastrophe,” the president said, punctuating a day in which the White House mustered all its political firepower in an effort to bury the last best chance to protect an absolutely blameless cohort of young people, raised and educated as Americans.

Despite the withering scorn heaped on the bipartisan plan by Mr. Trump, with a hearty second by Senate Majority Leader Mitch McConnell (R-Ky.), eight Republican senators backed it, giving it a total of 54 votes — six shy of the 60 required for passage. Had Mr. Trump stayed silent, or suggested he could accept a modified version, the bill may very well have passed. But he turns out to be far less interested helping the dreamers — helping anyone, really — than in maintaining his anti-immigrant political base.

His own blueprint, an obvious nonstarter that included sharp cuts to legal immigration, mustered just 39 votes in the Senate, nearly all Republicans. That’s a telling total, one that mirrors the percentage of Americans who still support him. Of the four immigration measures voted on in the Senate last week, the Trump bill had the least support.

The White House wasn’t surprised. By yoking its proposal for protecting dreamers to a hard-line wish list, the president guaranteed its defeat — and maintained the president’s own bona fides as a resolute champion of the nation’s xenophobes.

The president, along with Mr. McConnell, is intent on a blame game, not a solution. He suggested no compromises and engaged in no negotiations, preferring to stick with maximalist demands. Despite barely mentioning it as a candidate, Mr. Trump has not budged from insisting on a plan to reduce annual legal immigrants to the United States by hundreds of thousands, to the lowest level in decades.

That’s bad policy for a country with an aging population and an unemployment rate that ranks among the lowest in the industrialized world. More to the point, even if you favor lower levels, it was guaranteed in the context of this debate to doom the dreamers — especially after Democrats had already compromised substantially on the border security that Mr. Trump initially set as his price.

And what of the dreamers, whom Mr. Trump addressed repeatedly in calming tones, telling them not to worry? For the time being, federal courts have preserved their work permits and protections from deportation. Meanwhile, though, his administration is pressing ahead, asking the Supreme Court to uphold the president’s effort to end Deferred Action for Childhood Arrivals, the Obama-era program that has shielded dreamers since 2012.

If the administration is successful, as many legal experts expect, the lives, hopes and futures of nearly 2 million young immigrants will be upended. They will lose jobs and, in many cases, driver’s licenses, tuition subsidies and health insurance. They will slip into the shadows in the only country they know. This will be Mr. Trump’s legacy and the true reflection of his “great heart.”

As pointed out in this editorial, the best chance for a compromise, basically “Dreamers for Wall,” likely would have passed both Houses had Trump put himself fully behind it and pressured McConnell and Ryan to make it happen. But, that was never in the cards. The whole charade was always about Trump looking for a way to avoid taking responsibility for the Dreamer fiasco and proving to his “base” that he never really lost sight of their racist views.

About the only good thing was that the Administration’s “Miller-drafted” “Advancing White Supremacy and Xenophobic Racism Act of 2018” was defeated by the biggest margin of any of the proposals. But, that’s not much solace to the Dreamers, although it does help our country by staving off an insane cut in legal immigration that would have been “bad policy for a country with an aging population and an unemployment rate that ranks among the lowest in the industrialized world.”

Martin Luther King Jr. said “the arc of the moral universe is long, but it bends toward justice.”

He could have added: “eventually, and after plenty of detours.”

In 1872 and 1873, two laws were passed in Washington that forbade racial discrimination in the city’s restaurants. Then, somehow, the laws vanished.

Just imagine the reaction when they were “rediscovered” in the 1940s. It must have been as if someone had opened a vault sealed when Ulysses Grant was president and found an airplane inside, a television, penicillin … .

Could Washingtonians from 70 years ago really have been so advanced? What had happened to those people?

What amazed me when I looked into the events of the 1870s and 1880s was how similar things were to the Jim Crow era. Restaurateurs used some of the same excuses for refusing to serve African Americans: Black customers were “boisterous,” white patrons would stay away, the government shouldn’t meddle.

To fight discrimination, black activists used methods that are familiar to us now. Lawyer E.M. Hewlett deliberately visited restaurants to see if he would be served. Hewlett looked to see if owners had posted price lists, as required by law to prevent black customers from being gouged. When he spotted a violation, he took the establishment to court.

In the end, none of it did any good. Why?

“During Reconstruction, D.C. was really on the leading edge of racial change in America,” said Chris Myers Asch, co-author, with George Derek Musgrove, of “Chocolate City: A History of Race and Democracy in the Nation’s Capital.”

Said Asch: “D.C. was a very progressive city. You had remarkable progress being made toward racial equality in a very brief space of time. Black men in D.C. were the first black men in the country to be granted the right to vote after the Civil War.”

Such efforts, Asch said, were a priority for radical Republicans in Congress.

“The backlash from white conservatives is really substantial,” Asch said. “First you eliminate self government all together in 1874. Then you slowly roll back those Reconstruction-era gains. This is part of a regionwide effort to enforce white supremacy. By 1901, when city commissioners decide to compile the D.C. Code, they simply don’t include those Reconstruction-era statutes.”

They didn’t include them, but they didn’t repeal them. The Lost Laws were not dead. They were like a long-dormant seed, ready to spring to life after a refreshing rain.

I don’t know who found them. Asch thinks it was A. Mercer Daniel, who oversaw the library at Howard University’s law school. They gained fame in 1948 with the publication of “Segregation in Washington,” a scathing report that mentioned the laws.

Civil rights activists wondered: Could the laws be used to fight segregation?

Annie Stein, a white woman from Southwest D.C. who was a member of the Progressive Party, invited Mary Church Terrell to chair the Coordinating Committee for the Enforcement of the D.C. Anti-Discrimination Laws of 1872 and 1873. When Terrell, the octogenarian co-founder of the NAACP, was denied service at a downtown cafeteria called Thompson’s in 1950, it set the stage for a test case.

District of Columbia vs. John R. Thompson Co. went first to the old Municipal Court, where Judge Frank Myers ruled that the Lost Laws had “been repealed by implication” and, thus, could no longer be enforced.

Terrell and company appealed. In May of 1951, the Municipal Court of Appeals ruled 2-to-1 that the anti-bias laws were still valid. Among the points raised by Judge Nathan Cayton was that another so-called lost law had been enforced in 1908, even though it, too, had been omitted from the 1901 D.C. Code.

It was an animal cruelty law. Animals, it seemed, had more rights than black Washingtonians.

The game of legal ping-pong continued. The next stop was the U.S. Court of Appeals. In a 5-to-4 decision, it ruled that the laws of 1872 and 1873 could not be enforced.

One judge, Barrett Prettyman, wrote the statutes were “neither mentioned again nor enforced for a period of 75 years.” Thus the laws “must be deemed by the courts to have been abandoned.”

If you’ve been reading my columns this week, you know that wasn’t true. African Americans did mention them and did try to get them enforced.

In April of 1953, the case finally reached the U.S. Supreme Court. Chester H. Gray of the District’s corporation counsel’s office asked the court not to blame his staff. They hadn’t known of the laws until someone found them in the corporation counsel’s safe.

“You mean you have to go to a locked safe to find laws of the District of Columbia?” Chief Justice Fred M. Vinson joked.

In June, the court ruled unanimously that the laws were still in effect. Laws passed by long-dead Washingtonians had helped their descendants.

Five days after the Supreme Court ruling, Terrell went to eat at Thompson’s with the mixed-race group who had been denied a meal three years earlier. They were treated, Terrell said, with courtesy.”

Sound all too familiar? It should! The claptrap coming from yesterday’s racists is pretty much the same as the garbage coming out of the mouths of some GOP pols these days. Here’s my “rewrite” of a paragraph of Kelly’s account in “today’s context.”

The backlash from Sessions, Bannon, Kobach, Miller and their White Nationalist pals to the diversification of America and growing political power of African-Americans, Hispanics and other non-Whites was substantial. First, they used gerrymandering and intentional mis-constructions of Civil Rights and Voting Rights statutes intended to protect minorities to instead suppress and minimize the minority vote. This is part to a nationwide effort by the far right to restore White Supremacy and prevent African-Americans and Hispanics from eventually obtaining political power commensurate with their demographics and overwhelming contributions to America. Then, when supposedly in charge of administering the laws equally, they simply refuse to recognize the rights of African-Americans to be free from police violence and the rights of Hispanics and asylum seekers in the United States to be treated with respect and dignity and to be given full Due Process under our Constitution. They even invent false narratives, bogus statistics, and demonize hard-working law-abiding citizens, residents, and great and deserving young people known as “Dreamers” in a desperate effort to restore exclusive White (preferably “pseudo-Christian”) power. To add insult to injury, they carry out this anti-American, anti-Constitutional campaign under the boldly false rubric of “Restoring the Rule of Law.”

Now let’s move over to the Post’s Sports Section. Here’s an account of what happened to courageous African-American athletes who stood up for their rights and the rights of others during the “glory days” of White Supremacy that Trump, Sessions, & Co. so cherish and honor.

Remembering the Orangeburg massacre, and the athlete-activists who took a stand

Robert Lee Davis found himself lying in blood next to his teammate Sam Hammond. At least one bullet had struck Davis in the back. Another went in Hammond’s neck.

Davis recalled in an oral history that Hammond, a running back at South Carolina State, asked him, “Do you think I’m going to live?” Davis, a linebacker, said he answered, “Sam, you are going to be all right, buddy.”

Hammond was the first of three young black men to die that night 50 years ago in Orangeburg, S.C. Davis was one of several football players at historically black South Carolina State to survive a hail of police fire with injuries.

What brought them together that Feb. 8, 1968, evening was not a team meeting or the training table. Instead, it was a call to confront a wrong, an affront, an act of overt racial discrimination in Orangeburg at a bowling alley that refused would-be black bowlers just like the state was denying black citizens their human rights.

As a result, Davis and Hammond became athlete-activists long before we created the suddenly ubiquitous, if not trite, alliterative phrase these days to describe football and basketball players, almost all of color, who have, by comparison, merely sported sloganeering T-shirts, or employed histrionics, to demonstrate against racial injustice.

It is a noble and laudable effort, of course. But what we’ve come to champion of athletes today pales juxtaposed to what so many did in the cauldron of the late ’60s civil rights movement. Davis and Hammond, for example, dared to physically confront the very embodiment of the South’s recalcitrant racists — scores of carbine rifle-toting, all-white state troopers — for which Hammond forfeited not just his career but his life.

They were among at least 30 victims of what became known as the Orangeburg massacre.

I was reminded of it three years ago as a presenter at the annual Media and Civil Rights symposium at the University of South Carolina. It included a mesmerizing panel featuring a demonstrator that night, civil rights icon and scholar Cleveland Sellers, and a reporter who became legendary for his fearless coverage of the massacre and other civil rights movement era violence, Jack Bass. With Jack Nelson, awarded a Pulitzer Prize for his reporting on the civil rights movement, Bass authored “The Orangeburg Massacre” in 1970.

And I took note that the panelists, particularly Oliver Francis, a one-time baseball player at Voorhees, another historically black South Carolina college, pointed out that black male athletes in particular stepped to the fore in Orangeburg’s deadly confrontation with white supremacy, and in others. Francis wound up convicted and sentenced to prison for 18 to 24 months as an organizer in an armed black student takeover in 1969 of the Voorhees administration building.

It all reminded that black athletes played not just pivotal roles in the civil rights movement, like the muscle North Carolina A&T football players provided for their classmates engaged in sit-ins to desegregate the Greensboro, N.C., Woolworth’s lunch counter. Or in Rock Hill, S.C., where 10 black Friendship College students were detained by police for trying to desegregate a town lunch counter in 1961 but became known as the Rock Hill Nine after one among them wasn’t booked so he could maintain his athletic scholarship. Chicago Bears running back Willie Galimore was the test black registrant at the Ponce de Leon Motor Lodge in St. Augustine, Fla., that became a flash point for desegregation fights in 1964.

And as was evidenced in Orangeburg, black athletes sometimes were even in the vanguard of protests. Samuel Freedman underscored as much in recounting the Orangeburg massacre in his 2014 book, “Breaking the Line: The Season in Black College Football That Transformed the Sport and Changed the Course of Civil Rights.”

Freedman wrote: “Shortly after the 1967 football season ended, many of the politically engaged members of the South Carolina State team joined in protests against a segregated bowling alley near the campus in Orangeburg.” On Feb. 6, 1968, Freedman reported, Davis and several of his teammates went on their own to the bowling alley and not only were denied admittance but were threatened with arrest by city police for disturbing the peace. Other students eventually joined the football players, objected to the police threats and wound up defending themselves from swinging billy clubs.

Two nights later, Freedman stated, “an all-white force of state troopers opened fire on the student demonstrators, killing three and wounding twenty-eight. Among the dead was one football player . . . Hammond. Several other players were injured by gunfire, one of them temporarily paralyzed.”

Davis was that temporarily paralyzed victim.

The student survivors of the massacre refused, however, to be deterred and allow the killings of Hammond, fellow student Henry Smith and high school football player Delano Middleton to be in vain. They organized a march from campus to the state capital 42 miles away to demand justice. Athletes decided to lead the march by running the distance.

“The four young men who approached me about the run were all track and field distance runners,” Willis Ham, a South Carolina State baseball player at the time, told the (Orangeburg, S.C.) Times and Democrat five years ago. “Three of the young men were not of American descent, and they simply wanted to express their disgust for the way Americans ‘treat their own,’ with the one tool that they had to their credit [the ability to run].

“We wanted our fellow students to know how deeply we felt about their determination to go to Columbia [S.C.], and express to state officials how they really felt about the lack of support in the days leading to the massacre.”

“It gave us a chance to say that our spirits and drive for freedom from depression would never be destroyed,” Ham explained.

The white troopers who fired on the students were exonerated in a trial a year later. The lone conviction from the incident was of Sellers for incitement. He spent seven months in prison. He was pardoned in 1993.

But what Hammond, the football player, first fell for is forever remembered on South Carolina State’s campus. Its basketball arena that opened that fateful day, Feb. 8, 1968, was renamed the Smith-Hammond-Middleton Memorial Center.

“White House goes all out to stop bipartisan immigration deal

The Trump administration is working Thursday to kill a bipartisan deal on immigration that could be the best chance to get a bill through the Senate.

The White House is “actively considering issuing a veto threat” against the bipartisan immigration bill Thursday morning, a senior administration official said.

Attorney General Jeff Sessions derided the legislation in remarks to a national sheriff’s association.

“This is open borders and mass amnesty and the opposite of what the American people support,” Sessions claimed about the bill, according to prepared remarks. “This amendment — plain as day — will invite a mad rush of illegality across our borders.”

Department of Homeland Security Secretary Kirstjen Nielsen is also making calls to lawmakers to urge them to reject the bill, or potentially even revoke their sponsorship of it, according to an administration official.

And in a statement released late Wednesday night, the Department of Homeland Security had tough words for the plan, calling it “the end of immigration enforcement in America.”

The legislation from a group of 16 bipartisan senators would offer nearly 2 million young undocumented immigrants who came to the US as children before 2012 a path to citizenship over 10 to 12 years.

The plan would also place $25 billion in a guarded trust for border security, would cut a small number of green cards each year for adult children of current green card holders, and would prevent parents from being sponsored for citizenship by their US citizen children if that child gained citizenship through the pathway created in the bill or if they brought the child to the US illegally.

The administration statements riled up co-sponsors of the bill, who said the White House and allies have “lost credibility” by criticizing a bipartisan agreement.

“With their press release this morning, it seems as if DHS is intent on acting less like a partner and more like an adversary,” said Sen. Lindsey Graham, R-South Carolina. “Instead of offering thoughts and advice — or even constructive criticism — they are acting more like a political organization intent on poisoning the well. From the tone of this morning’s document, it appears as if DHS hopes all border security proposals fail. That would be the worst outcome of all.”

One provision the Department of Homeland Security particularly objected to would direct it to focus its arrests and deportations on criminals and newly arrived immigrants. The Trump administration has virtually removed all prioritization of arresting and deporting immigrants. It has targeted individuals with final deportation orders, some years and decades old, drawing criticism for deporting longtime members of communities with US citizen families.

“The Schumer-Rounds-Collins proposal destroys the ability of the men and women from the Department of Homeland Security (DHS) to remove millions of illegal aliens,” DHS said in a statement. “It would be the end of immigration enforcement in America and only serve to draw millions more illegal aliens with no way to remove them.

“The changes proposed by Senators Schumer-Rounds-Collins would effectively make the United States a Sanctuary Nation where ignoring the rule of law is encouraged,” the agency added.

President Donald Trump has backed a plan to give 1.8 million undocumented people who came to the US as children citizenship with $25 billion in border security, host of hardline enforcement power requests, substantially cutting family-based migration and ending the diversity visa lottery.

DHS called the bipartisan proposal an “egregious violation” of what the President has wanted.

The White House proposal has been introduced by Republican senators and is expected to be well below the 60 votes needed to advance.

Both proposals are expected to get a vote in the Senate on Thursday.”

Grassley rips Sessions for opposing criminal justice bill

‘When the president was going to fire him, I went to his defense,’ Grassley said in an interview.

Senate Judiciary Committee Chairman Chuck Grassley hit back hard at Attorney General Jeff Sessions on Wednesday after his former Senate colleague launched a preemptive strike on his criminal justice bill.

The legislation, which Grassley has worked on for more than two years, is expected to win committee approval Thursday. But it faces a tough climb to the Senate floor amid reluctance from GOP leaders and conservative resistance. Sessions, who opposed the reform effort during his time on the Judiciary panel, piled on Wednesday with a letter warning that the bipartisan proposal “risks putting the very worst criminals back into our communities.”

Grassley responded with a powerful brushback pitch to the attorney general.

“It’s Senator Sessions talking, not a person whose job it is to execute law, and quite frankly I’m very incensed,” he told POLITICO.

What Sessions’ letter “doesn’t recognize here,” Grassley added, “and why I’m incensed about it is, look at how hard it was for me to get him through committee in the United States Senate. And look at, when the president was going to fire him, I went to his defense.”

The Iowa Republican said “all kinds of” potentially polarizing Justice Department nominees who have proven “very difficult to get through the United States Senate” have also landed in his lap as chief of the influential Judiciary Committee.

“If he wanted to do this,” Grassley said of Sessions, “he should have done what people suggested to him before: resign from attorney general and run for the Senate in Alabama again. We’d have a Republican senator.”

Grassley was referring to the special election for the Senate seat Sessions vacated to become President Donald Trump’s attorney general. Sen. Doug Jones (D-Ala.) ultimately won after multiple allegations of sexual misconduct with minors against GOP nominee Roy Moore. Republican leaders considered asking Sessions to join the race as a write-in candidate in a bid to save the seat for their party. Sessions has also had a tumultuous time in the Trump administration, at one point reportedly offering his resignation.

The criminal justice bill, which Grassley negotiated alongside Minority Whip Dick Durbin (D-Ill.), counts co-sponsorship from 18 other senators, evenly distributed between the parties. Senate Majority Whip John Cornyn (R-Texas), who supported the broader reform effort in the previous Congress, has shifted his focus this year to a narrower prison reform measure that he has said has a better chance of Trump signing into law.

But Grassley hasn’t abandoned the push to win floor time for the legislation, which would ease mandatory minimum sentences for certain non-violent offenders and end the required life sentence for some repeat drug offenders. Other elements of the proposal would create new mandatory minimum sentences for other categories of offense and bolster punishment for those convicted of trafficking in drugs containing the opioid fentanyl.

Grassley disputed Sessions’ characterization of the criminal justice reform bill in his Wednesday letter as bringing “potentially dire consequences” for efforts to fight the nationwide opioid epidemic.

“I agree with Sessions that mandatory minimums are important, and we don’t touch that,” the Iowan said.

Sessions’ critique of the legislation “makes it sound like these guys are going to be out on the streets as soon as the judge makes the decision,” Grassley added. “So he can have his strong position, and I can have my position that brings a little bit of fairness to it.”

Grassley also tweeted his frustration with Sessions Wednesday. Asked for a comment, a Justice Department spokeswoman said the letter from the attorney general would suffice.”

The chickens come home to roost, Chuckles! Implied, if not actually stated by Grassley, is that Gonzo lied under oath about more than his Russian connections during his confirmation hearings.

Gonzo falsely claimed that he would leave the partisan role of the extreme rightist Senator from Alabama behind and recognize that the role of U.S. Attorney General involved fairly and impartially representing the diverse interests of all Americans. I actually gave him the “benefit of the doubt” on that one.

But, Gonzo quickly established beyond any reasonable doubt that he could not leave behind a lifetime of racism, xenophobia, White Nationalism, and lies. He continues to be the same “shill” for racist restrictionist hate groups that he always has been.

Yup, Chuckles! Gonzo’s disdain for bipartisanship, reasonable compromise, equal treatment, and sane delivery of justice runs deep. Perhaps you should have “done the right thing” during the confirmation process!

The good news: by the time Mueller gets through, Gonzo might well wish that he had eased off a little on Chuckles’s proposal to revise sentencing for “nonviolent” offenses — like perjury, obstruction of justice, or providing false or misleading information. He’ll have to hope that his mouthpiece  “Chuckie” Cooper can help him beat the rap for his “bad memory.”

THE BIG IDEA: Democrats are so eager to shield young foreign-born “dreamers” from deportation that they’re now offering to make compromises that would have been hard to imagine a year ago. Republicans, who feel like they have them over the barrel, are demanding more.

Showing his pragmatic side, for instance, Bernie Sanders says he’s willing to pony up big for border security if that’s what it takes. “I would go much further than I think is right,” the Vermont senator said in an interview Tuesday afternoon. “Unwillingly. Unhappily. I think it’s a stupid thing to do. But we have to protect the dreamers. … I’m willing to make some painful concessions.”

Sanders said a wall is still a “totally absurd idea” and that there are better ways to secure the border with Mexico, but he also emphasized that there will be “a horrible moral stain” on the country if President Trump goes through with his order to end the Deferred Action for Childhood Arrivals (DACA) program next month.

— Anti-immigration hardliners are staking out a firm position because most of them are not actually concerned about the plight of the dreamers. They have never thought these young people, whose undocumented parents brought them to the United States as children, should be here anyway. They agitated for Trump to end the program.

This means they’ll be fine if no bill passes, and they know that gives them way more leverage to demand wholesale changes to the entire legal immigration system. “The president’s framework bill is not an opening bid for negotiations. It’s a best and final offer,” said Sen. Tom Cotton (R-Ark.), who has emerged as the leader of this group in the Senate. He made this comment yesterday on “Fox and Friends,” knowing the president watches. Sure enough, Trump echoed the same talking point on Twitter, calling this the “last chance” for action.

— Mitch McConnell wants to use this week’s immigration debate to force show votes that can be used to embarrass vulnerable Democratic senators from red states. For example, the majority leader introduced a measure yesterday that would penalize so-called sanctuary cities for not cooperating with federal immigration laws. This issue tests well in polls and focus groups in most of the 10 states Trump carried in 2016 where a Democrat is now up for reelection. GOP insiders on the Hill say that McConnell is mainly focused on doing whatever it takes to protect his majority now that 2018 has arrived, and he has a narrower majority after the loss in Alabama.

— Democrats stuck together to block the Senate from taking up the poison pill on sanctuary cities, but the fact that the debate has so quickly devolved into a fight over process offered another data point – if for some reason you needed one – of how dysfunctional the Senate has become.

Trump urges senators to back his immigration proposal

— “Most Republicans on Tuesday appeared to be rallying behind a proposal by Senate Judiciary Committee Chairman Charles E. Grassley (R-Iowa) and six other GOP senators that fulfills Trump’s calls to legalize 1.8 million dreamers, immediately authorizes spending at least $25 billion to bolster defenses along the U.S.-Mexico border, makes changes to family-based legal immigration programs and ends a diversity lottery system used by immigrants from smaller countries,” Ed O’Keefe reports. Senate Minority Leader Chuck “Schumer said the Grassley plan unfairly targets family-based immigration and that making such broad changes as part of a plan to legalize just a few million people ‘makes no sense.’

In a bid to soften Trump’s proposals and win over Democrats, Sen. Jeff Flake (R-Ariz.) unveiled a watered-down version of the GOP proposal — but had not won support from members of either party by late Tuesday. Sen. Lindsey O. Graham (R-S.C.), a longtime proponent of comprehensive immigration changes, said the Grassley proposal should be the focus of the Senate’s debate. … Schumer and other Democrats, meanwhile, voiced support for a plan by Sens. Christopher A. Coons (D-Del.) and John McCain (R-Ariz.) that would grant legal status to dreamers in the country since 2013 but would not immediately authorize money to build out southern border walls and fencing.”

— Democrats would like to pass a narrow bill that only protects DACA recipients, but they know that’s not possible with Republicans in control of Congress and the presidency. To get the 60 votes needed to break a filibuster, they’re conceding on at least some of Trump’s demands related to security. Sanders said there are between 55 to 57 votes for a compromise that would save the dreamers and fund border protections. “We are scrambling now for three to five more votes,” he said.

— The Senate will convene at 10 a.m. to continue debate, as negotiations behind the scenes continue. Somewhat counterintuitively, conservative hardliners believe that Latinos will be less likely to turn out this November if nothing passes in Congress because activists will blame Democrats for not delivering.

— Despite concerted efforts by Trump and McConnell to drive a wedge through the Democratic caucus, there remains a remarkable degree of unity. This highlights how much the terms of the immigration debate have shifted over the past decade. Every Democrat in Congress now wants to protect DACA recipients. It wasn’t always this way. The House passed a Dream Act in 2010 that would have allowed undocumented immigrants to apply for citizenship if they entered the United States as children, graduated from high school or got an equivalent degree, and had been in the United States for at least five years. Five moderate Democrats in the Senate voted no. If each of them had supported it, the bill would have become law, and DACA would have been unnecessary. Sen. Jon Tester (D-Mont.) is the only one of those five Democrats still left. (The others retired or lost.) Now Tester speaks out against the president’s decision to end DACA. (I explored this dynamic in-depth last September.)

Sanders marveled during our interview at how much the polling has shifted in recent years toward protecting dreamers, with some public surveys showing that as many 90 percent of Americans don’t think they should be deported. The share who think they should also have a pathway to become U.S. citizens has also risen. “If we talked a year or two ago, I’m not sure I would have thought that would be possible,” he said.

Hillary Clinton relentlessly attacked Bernie during the debates in 2016 for voting to kill comprehensive immigration reform in 2007. Sanders – working closely with some of the leading unions – expressed concern back then that the bill would drive down wages for native-born workers by flooding the labor market with cheap foreign workers. This position caused him problems with Hispanics during his presidential bid.

Sanders rejects the idea that his views have changed since 2007, and he still defends his 11-year-old vote. He noted that the League of United Latin American Citizens (LULAC) opposed that bill, as did the Southern Poverty Law Center, because it included a guest worker program that was “akin to slavery.” He said he remains just as concerned about guest worker programs as he was back then, but that he’s always favored a comprehensive solution that includes legal protections for the more than 11 million undocumented immigrants who live here. “You can say you support immigration reform, but obviously the devil is in the details on what that means,” the senator explained. “I stood with progressive organizations who said you don’t want to bring indentured servitude.”

Sanders criticized a guest worker program in his home state that allows resorts to hire ski instructors from Europe instead of native Vermonters. “Now do you not think we can find young people in Vermont who know how to ski and snowboard? But if you go to some of the resorts, that’s what you would find,” he said. “When I was a kid, we worked at summer jobs to help pay for college. … So I think we want to take a hard look at guest worker programs. Some of them remain very unfair.”

— After coming surprisingly close to toppling Clinton and winning the Democratic nomination two years ago, Sanders is at or near the top of the pack in every poll of potential 2020 primary match-ups. He’s going to Des Moines next Friday for a rally with congressional candidate Pete D’Alessandro, his first visit to Iowa this year. Sanders will also go to Wisconsin for Randy Bryce, who is running against Speaker Paul Ryan, and Illinois, where he’ll boost Chuy Garcia’s bid for retiring Rep. Luis Gutierrez’s open seat. A few weeks after that, he plans a tour of the Southwest. “I’m going to do everything I can to help people in 2018,” Sanders said.

Lobbying for their lives

— Republicans have gone the other direction. Before Trump came on the scene, the party was divided but GOP elites agreed that, for the long-term survival of the party, they needed to embrace more inclusive policies. Losses in 2012 prompted many Senate Republicans to endorse a comprehensive bill the next year (Sanders voted for it too), but the legislation was doomed in the House after Majority Leader Eric Cantor went down in a Virginia primary partly because of his perceived softness on the issue.

Elected Republicans used to insist adamantly that they were not anti-immigration but anti-illegal immigration. That’s changed. At the behest of Trump and Attorney General Jeff Sessions, Republicans are rallying around the idea of dramatic reductions in legal immigration. Two years ago, this was an extreme idea that most GOP senators would have quickly distanced themselves from. Now it’s considered mainstream and the centerpiece of the bill that McConnell has rallied his members behind.

To put it in perspective: By cutting the rate of legal immigration, Trump’s proposal – codified in Grassley’s bill — would delay the date that white Americans become a minority of the population by as many as five additional years, according to expert analysis.

“What’s very sad, but not unusual given the moment we’re living in, is that Republicans are more concerned about their right-wing, extremist, xenophobic base,” said Sanders. “You would think that, with 85 to 90 percent of people supporting protections for the dreamers, that it would not take a profile in courage to pass legislation to protect them.”

Kelly: ‘Dreamers’ who didn’t sign up for DACA were ‘too afraid’ or ‘too lazy’

— A dual-track fight over DACA is playing out in the courts. A federal judge in New York issued a preliminary injunction last night that keeps the program alive beyond Trump’s March 5 deadline so that legal challenges can play out. “A federal judge in California has issued a similar injunction, and the Supreme Court is expected this week to consider whether it will take up the fight over DACA,” Matt Zapotosky reports.

U.S. District Judge Nicholas Garaufis recognized that Trump “indisputably” has the authority to end the program put in place by Barack Obama, but he also called the administration’s arguments that DACA was unconstitutional and illegal under federal law flimsy. “Because that conclusion was erroneous, the decision to end the DACA program cannot stand,” he wrote.

Contrary to most of the “chatter,” I think that the Dreamers and the Democrats have the upper hand in this one. I’ll tell you why below!

A “border security package,” could involve the Wall, technology and much needed management improvements at DHS (but certainly no additional detention money — stop the “New American Gulag” — or personnel for the Border Patrol until they full current vacancies and account for how they are currently are deploying agents).

Beyond that, the Dems probably could agree to a reallocation of diversity and some preference visas while maintaining current legal immigration levels. Cutting legal immigration levels, eliminating family immigration, or authorizing further denials of due process (the totally bogus and essentially evil claim that the current already inadequate protections for children and other vulnerable migrant’s are “loopholes”) should be “non-starters.”

If they can’t get the deal they want, the Dems can walk away and still win for the Dreamers in the long run. Here is why:

  • I doubt that Trump would actually veto a compromise bill passed by both Houses that protected Dreamers without his full “Four Pillars of White Nationalism” program.
    • If he does, any Democrat who can’t make Trump and the GOP pay for such a dumb move in the next election cycle doesn’t deserve to be a Democrat.
    • The “full Dreamer protection” trade for border security with no other changes should be a “no brainer.” If Trump or the GOP “tank” it over the restrictionist agenda, the Democrats should be able to make them pay at the polls.
  • Right now, the Administration is under two injunctions halting the repeal of the “core DACA” program.
    • If the Supremes don’t intervene, that issue could be tied up in the lower Federal Courts for years.
      • It’s very clear that the Administration’s current position is ultimately a loser before the lower Federal Courts.
      • If the Administration tries to “short-circuit” the process by going through APA to promulgate a regulation to terminate DACA, that process also is likely to be successfully challenged in the Federal Courts.
        • The so-called “legal rationale” that Sessions has invoked for ending DACA has literally been “laughed out of court.”
        • Trump himself has said that there is really no reason to remove Dreamers from the U.S.
        • So, on  the merits, an attempt to terminate DACA by regulation probably would be held “without any legal or rational basis” by the lower Federal Courts.
  • Even if the Supremes give the “green light” to terminate DACA, most “Dreamers” by now have plausible cases for other forms of relief.
    • Many DACA recipients have never been in removal proceedings. If they have been here for at least 10 years, have clean criminal backgrounds, and have spouses or children who are U.S. citizens they can apply for “cancellation of removal.”
    • “Former DACA” recipients appear to be a “particular social group” for asylum and withholding of removal purposes. They are “particularized,  the characteristic of having DACA revoked is “immutable,” and they are highly “socially distinct.”  Many of them come from countries with abysmal human rights records and ongoing, directed violence. They therefore would have plausible asylum or withholding claims, or claims under the Convention Against Torture (“CAT”).
    • If ICE tries to use information voluntarily given by the Dreamers during the application process to establish removability or for any other adverse reason, that is likely to provoke a challenge that will be successful in at least some lower Federal Courts.
  • Safety in numbers.
    • There is nothing that Trump, Sessions, and the DHS can actually do to remove 700,000+ Dreamers.
    • The U.S. Immigration Courts are backed up for years, with nearly 700,000 already pending cases! Sessions is doing everything he can to make the backlog even worse. Dreamers will go to the “end of the line.”
    • Sure Sessions would like to speed up the deportation “assembly line” (a/k/a “The Deportation Railway”).
      • But, his boneheaded and transparently unfair attempts to do that are highly likely to cause “big time” pushback from the Federal Courts and actually “tie up” the entire system — not just “Dreamers.”
      • The last time the DOJ tied to mindlessly accelerate the process, under AG John Ashcroft, the Courts of Appeals remanded defective deportation orders by the basket-load for various due process and legal violations — many with stinging published opinions.
        • Finally, even former Attorney General Alberto Gonzalez (“Gonzo I”), hardly a “Due Process Junkie” had enough and slowed down the train. It took years for the “haste makes waste” Circuit Court remands to work their way back through the system. Some might still be hanging around.
      • Because the GOP White Nationalists and Trump read off of “restrictionist cue cards” that don’t take account of the law, facts, or history, the Dems should have a huge advantage here if and when individual “Dreamer” removal cases get to the Federal Courts.
    • Each “Dreamer removal case” should present the Democrats with excellent example of the cruelty, stupidity, and total wastefulness of the Trump/Sessions/DHS enforcement policies. Wasting money to “Make America Worse.” Come on, man!
    • Bottom Line: Trump and Sessions have created a “false Dreamer emergency” that they can’t escape without some help from the Democrats. If the Democrats see an opportunity to make a “good deal” for the Dreamers, they should take it. But, they shouldn’t trade the Dreamers for the harmful White Nationalist restrictionist agenda! Eventually, the problem will be solved in a way that is favorable for most Dreamers, regardless of what the White Nationalists threaten right now. The Dreamers might just have to hang on longer until we get at least some degree of “regime change.”

“Open-ended immigration debate to grip Senate

The Senate is set to begin debating immigration Monday evening, and in a rare occurrence for the upper chamber of Congress, no one is quite sure how that will go.

Late Sunday, a group of Republicans introduced a version of President Donald Trump’s proposal on how to handle the future of the Deferred Action for Childhood Arrivals program, which protected young undocumented immigrants who came to the US as children from deportation before Trump decided to terminate it. That is expected to be one of the amendments that will compete for votes this week.

Some things are known: McConnell teed up the debate early Friday morning, as he had pledged, immediately after the Senate voted to end a government shutdown. The bill McConnell chose was entirely unrelated to immigration, which he said he planned to do to allow a blank slate for proposals to compete for votes.

Let the debate begin

At 5:30 p.m. Monday, senators will vote on whether to open debate on the bill, a vote that is largely expected to succeed.

From there, a lot will be up to senators. Both sides will be able to offer amendments that will compete for 60 votes — the threshold to advance legislation in the Senate. It’s expected that amendments will be subject to that threshold and will require consent agreements from senators for votes, opening up the process to negotiations.

If a proposal can garner 60 votes, it will likely pass the Senate, but it will still face an uncertain fate. The House Republican leadership has made no commitment to consider the Senate bill or hold a debate of its own, and House Speaker Paul Ryan has pledged repeatedly to consider a bill only if President Donald Trump will sign it.

Different groups have been working to prepare legislation for the immigration effort, including the conservatives who worked off the White House framework and a group of bipartisan senators who have been meeting nearly daily to try to reach agreement on the issue. Trump has proposed giving 1.8 million young undocumented immigrants a pathway to citizenship in exchange for $25 billion for his long-promised border wall and a host of other strict immigration reforms.

The bill from GOP senators largely sticks to those bullet points, including sharp cuts to family-based migration, ending the diversity lottery and giving federal authorities enhanced deportation and detention powers.

Meanwhile, a bipartisan group of about 20 senators was drafting legislation over the weekend to offer perhaps multiple amendments and potentially keep the debate focused on a narrow DACA-border security bill. Multiple members of the group have expressed confidence that only such a narrow approach could pass the Senate — and hope that a strong vote could move Trump to endorse the approach and pave the way for passage in the House.

Advocates on the left may offer a clean DACA fix, like the DREAM Act, as well as the conservative White House proposal — though neither is expected to have 60 votes.

The move to hold an unpredictable Senate debate next week fulfills the promise McConnell made on the Senate floor to end the last government shutdown in mid-January, when he pledged to hold a neutral debate on the immigration issue that was “fair to all sides.”

Even Sunday, leadership aides weren’t able to say entirely how the week would go. The debate could easily go beyond one week, and with a scheduled recess coming next week, it could stretch on through February or even longer.

One Democratic aide said there will likely be an effort to reach an agreement between Republicans and Democrats on timing so that amendments can be dealt with efficiently, and, absent that, alternating proposals may be considered under time-consuming procedural steps.

“We just have to see how the week goes and how high the level of cooperation is,” the aide said.

Many Democrats and moderate Republicans were placing hope in the bipartisan group’s progress.

“We’re waiting for the moderates to see if they can produce a bill,” said the Senate’s No. 2 Democrat, Dick Durbin, on Thursday. “And considering options, there are lots of them, on the Democratic side. There’s no understanding now about the first Democratic amendment.”

Durbin said traditionally both sides have shared a few amendments with each other to begin to figure out the process’ structure. He also said the bipartisan group could be an influential voting bloc, if they can work together.

“They could be the deciding factor, and I’ve been hopeful that they would be, because I’ve had friends in those Common Sense (Coalition), whatever they call themselves, and reported back the conversations, and I think they’re on the right track.”

As she was leaving the Senate floor Friday night after the Senate voted to pass a budget deal and fund government into March, Maine Republican Sen. Susan Collins was optimistic about the preparedness of the bipartisan group she has been leading for the all-Senate debate.

“We’ll be ready,” she told reporters.

Oklahoma Republican Sen. James Lankford, who has been working both with the group introducing the White House proposal and the bipartisan group, said late Friday night that his plan is “to get things done.”

“It’s no grand secret that I have no problem with the President’s proposal; the challenge is going to be trying to get 60 votes,” Lankford said. “So I would have no issue with what (Sens. John) Cornyn and (Chuck) Grassley are working on and with the President supporting that, but I also want to continue to try finding out and see, if that doesn’t get 60 votes, what could.”

He said everyone is waiting to find out what happens next.

“Everybody’s trying to figure out the chaos of next week, and I’m with you,” Lankford said. “I don’t know yet how open the process is going to be. I hope it’s very open.”
