“WASHINGTON — A bill to dismantle the Affordable Care Act that narrowly passed the House this month would leave 14 million more people uninsured next year than under President Barack Obama’s health law — and 23 million more in 2026, the Congressional Budget Office said Wednesday. Some of the nation’s sickest would pay much more for health care.

Under the House bill, the number of uninsured would be slightly lower, but deficits would be somewhat higher, than the budget office estimated before Republican leaders made a series of changes to win enough votes for passage. Beneath the headline-grabbing numbers, those legislative tweaks would bring huge changes to the American health care system.

In many states, insurance costs could soar for consumers who are sick or have pre-existing conditions, while premiums would fall for the healthy, the new estimate concludes.

The forecast by the nonpartisan Congressional Budget Office, Capitol Hill’s official scorekeeper, is another potential blow to efforts to undo Mr. Obama’s signature domestic achievement. Republican senators have said they will make substantial changes to the measure passed by the House, but even Senator Mitch McConnell of Kentucky, the majority leader, sounds uncertain about his chances of finding a majority to repeal and replace the health law.”

POLITICS: GOP Senate’s “Stealth Plan” To Strip Health Care From Millions While Enriching Fat Cats Exposed!

“While the rest of the country has been transfixed by Trumpian chaos, members of the Senate have spent the last two weeks talking about taking health insurance from millions of Americans.

There is an alarmingly large chance that they’ll decide to do so. But if they do, they will almost certainly rely on a political sleight of hand to disguise their bill’s damage. Understanding that sleight of hand — and calling attention to it — offers the best hope for defeating the bill.

The effort to take health insurance from the middle class and poor and funnel the savings into tax cuts for the rich is a little like mold. It grows best in the dark.

That’s why Republican leaders in the House handled their bill as they did. They did not hold a single hearing, because they knew that attention would have been devastating.

Just imagine a hearing featuring the leaders of these groups, every one of which opposes the House bill: the American Medical Association, American Nurses Association, American Hospital Association, American Academy of Pediatrics, American Cancer Society, American Heart Association, American Diabetes Association, American Lung Association, March of Dimes and AARP.
The House also passed its final bill without waiting for the Congressional Budget Office to estimate how many Americans would lose insurance. The C.B.O. will release that analysis tomorrow afternoon. There is no precedent, outside of wartime, for passing a bill this important in such haste.

After the House did, many observers assumed the bill was too flawed to have much chance in the Senate. Republican senators, aware of the bill’s unpopularity, were careful to say publicly that they would start fresh. But the early signs suggest that Mitch McConnell and his Republican caucus are actually mimicking the House approach.

Think of it as the Upton strategy, and I’ll explain the name in a minute.”

Yet, the voters keep putting these guys in office. Unless you are part of the tiny percentage of over-privileged, rich elite in America, you’re voting against not only our country’s best interests, but your own!

Amazingly, however, the Democrats have failed to come up with an effective strategy to capitalize on this. And, to date, I’m not sure I’ve heard any compelling arguments as to how and why Democrats will do better in the next election.

Yeah, Trump and his cohorts have problems galore. But, highlighting/relying on that was Hillary’s primary strategy in 2016. And, it failed! Big time! What positive plan do Democrats have for making America better for everyone (including most Trump supporters)?

State & Local Prosecutors “Just Say No” To Gonzo-Apocalypto’s Retrograde Agenda!

“A week after U.S. Attorney General Jeff Sessions told federal prosecutors to “charge and pursue the most serious, readily provable offense” and follow mandatory minimum sentencing guidelines, a bipartisan group of prosecutors at the state and local level is expressing concern.

Thirty current and former state and local prosecutors have signed an open letter, which was released Friday by the nonprofit Fair and Just Prosecution, a national network working with newly elected prosecutors. The prosecutors say that even though they do not have to answer Sessions’s call, the U.S. Attorney General’s directive “marks an unnecessary and unfortunate return to past ‘tough on crime’ practices” that will do more harm than good in their communities.

“What you’re seeing in this letter is a different wind of change that’s blowing through the criminal justice field,” said Miriam Krinsky, a former federal prosecutor and executive director of Fair and Just Prosecution.

“There does seem at the federal level to be a return to the tough-on-crime, seek-the-maximum-sentence, charge-and-pursue-whatever-you-can-prove approach,” Krinsky said. But, she added, at a local level, some believe “there are costs that flow from prosecuting and sentencing and incarcerating anyone and everyone who crosses the line of the law, and we need to be more selective and smarter in how we promote both the safety and the health of our communities.”

Signers of the letter include Los Angeles City Attorney Mike Feuer, Manhattan District Attorney Cyrus R. Vance Jr., and Karl Racine, attorney general of the District of Columbia.

The prosecutors say that there are no real benefits to Sessions’s May 10 directive, but they noted “significant costs.”

The letter states:

The increased use of mandatory minimum sentences will necessarily expand the federal prison population and inflate federal spending on incarceration. There is a human cost as well. Instead of providing people who commit low-level drug offenses or who are struggling with mental illness with treatment, support and rehabilitation programs, the policy will subject them to decades of incarceration. In essence, the Attorney General has reinvigorated the failed “war on drugs,” which is why groups ranging from the American Civil Liberties Union to the Cato Institute to Right on Crime have all criticized the newly announced policy.”

Sen. Rand Paul (R-KY) Slams Sessions On Sentencing!

“The attorney general on Friday made an unfortunate announcement that will impact the lives of millions of Americans: he issued new instructions for prosecutors to charge suspects with the most serious provable offenses, “those that carry the most substantial guidelines sentence, including mandatory minimum sentences.”

Mandatory minimum sentences have unfairly and disproportionately incarcerated a generation of minorities. Eric Holder, the attorney general under President Obama, issued guidelines to U.S. Attorneys that they should refrain from seeking long sentences for nonviolent drug offenders.
I agreed with him then and still do. In fact, I’m the author of a bipartisan bill with Senator Leahy to change the law on this matter. Until we pass that bill, though, the discretion on enforcement — and the lives of many young drug offenders — lies with the current attorney general
The attorney general’s new guidelines, a reversal of a policy that was working, will accentuate the injustice in our criminal justice system. We should be treating our nation’s drug epidemic for what it is — a public health crisis, not an excuse to send people to prison and turn a mistake into a tragedy.
And make no mistake, the lives of many drug offenders are ruined the day they receive that long sentence the attorney general wants them to have.
If I told you that one out of three African-American males is forbidden by law from voting, you might think I was talking about Jim Crow 50 years ago.
Yet today, a third of African-American males are still prevented from voting, primarily because of the War on Drugs.
The War on Drugs has disproportionately affected young black males.
The ACLU reports that blacks are four to five times likelier to be convicted for drug possession, although surveys indicate that blacks and whites use drugs at similar rates. The majority of illegal drug users and dealers nationwide are white, but three-fourths of all people in prison for drug offenses are African American or Latino.
Why are the arrest rates so lopsided? Because it is easier to go into urban areas and make arrests than suburban areas. Arrest statistics matter when cities apply for federal grants. It doesn’t take much imagination to understand that it’s easier to round up, arrest, and convict poor kids than it is to convict rich kids.

Each case should be judged on its own merits. Mandatory minimums prevent this from happening.
Mandatory minimum sentencing has done little to address the very real problem of drug abuse while also doing great damage by destroying so many lives, and most Americans now realize it.
Proposition 47 recently passed in California, and it has spurred a cultural change in the way nonviolent drug offenders are treated, resulting in more than 13,000 fewer prisoners and a savings of $150 million, according to a Stanford Law School study.
Pew Research found that 67% of Americans want drug offenders to get treatment, not prison, and over 60% want an end to mandatory minimum sentences.
I urge the attorney general to reconsider his recent action. But even more importantly, I urge my colleagues to consider bipartisan legislation to fix this problem in the law where it should be handled. Congress can end this injustice, and I look forward to leading this fight for justice.”

“It, uh, doesn’t sound like the Trump-Sessions Justice Department is going to prevail in its argument to the U.S. Supreme Court that citizenship can be revoked over any misstatement or failure to disclose at all, however minor, that a person included (or didn’t include) on their citizenship application. Yes, Justices Sonia Sotomayor, Elena Kagan, and Ruth Bader Ginsburg were all vocally skeptical. But there was also this, from Chief Justice John Roberts:

“Some time ago, outside the statute of limitations, I drove 60 miles an hour in a 55-mile-an-hour zone,” the chief justice said, adding that he had not been caught.

The form that people seeking American citizenship must complete, he added, asks whether the applicant had ever committed a criminal offense, however minor, even if there was no arrest.

“If I answer that question no, 20 years after I was naturalized as a citizen, you can knock on my door and say, ‘Guess what, you’re not an American citizen after all’?” Chief Justice Roberts asked.

Robert A. Parker, a Justice Department lawyer, said the offense had to be disclosed. Chief Justice Roberts seemed shocked. “Oh, come on,” he said.

It sounds an awful lot like the Trump regime is looking for the right to revoke any naturalized person’s citizenship at any time, while creating an enormous new hoop for people seeking citizenship to jump through. Can you remember every single thing you’ve ever done?

Divna Maslenjak, the woman whose case prompted this exchange, could still face legal problems, since she had claimed that her husband had avoided military conscription in Bosnia when really he served in a unit that committed war crimes. But whatever the specific result for Maslenjak, it doesn’t seem likely that the Trump regime is going to get the far-ranging power it was effectively seeking:

Roberts added that it might not be a constitutional problem, but “it is certainly a problem of prosecutorial abuse.” Given the wide range of questions on the naturalization form, he observed,  the government’s position would mean that government officials would have “the opportunity to denaturalize anyone they want, because everybody is going to have a situation where they didn’t put in something like that.” “And then the government can decide,” Roberts warned, “we are going to denaturalize you for reasons other than what might appear on your naturalization form, or we’re not.” For Roberts, giving that “extraordinary power, which essentially is unlimited power,” to the government would be “troublesome.”

Welcome to the Donald Trump presidency, Mr. Chief Justice.”

For many years (at least as long as I’ve been in DC — since 1973) the DOJ, and in particular the Solicitor General’s Office, has occupied a position of unusual respect and credibility with the Supremes. Indeed, the Solicitor General is sometimes referred to as the “10th Justice” because the Supremes often defer to his or her judgment on whether a case merits certiorari.

But, with Jeff “Gonzo Apocalypto” Sessions at the helm, I wouldn’t be surprised to see the DOJ lose its vaunted reputation and be treated with the same degree of skepticism that other litigants face from the Supremes.

To be fair, however, the DOJ’s “boneheaded” position in Maslenjak originated in the Obama Administration which also, thanks in no small way to its tone deaf handling of many immigration cases (particularly those involving crimes) also “wore out its welcome,” so to speak, with the Supremes.

Perhaps, it’s just the general arrogance with which the Executive Branch and the DOJ have functioned over the last several Administrations of both parties. And, Congress, largely as a result of the GOP and its Tea Party wing, turning into “Bakuninists”– promoting anarchy and achieving almost nothing of value since the enactment of Obamacare, has not helped stem the tide of Executive overreach.

“VATICAN CITY — As politicians around the world including President Trump take an increasingly hard line on immigration, a powerful force is rallying to the side of migrants: the Roman Catholic Church led by Pope Francis.

Catholic cardinals, bishops and priests are emerging as some of the most influential opponents of immigration crackdowns backed by right-wing populists in the United States and Europe. The moves come as Francis, who has put migrants at the top of his agenda, appears to be leading by example, emphasizing his support for their rights in sermons, speeches and deeds.

The pro-migrant drive risks dividing Catholics — many of whom in the United States voted for Trump. Some observers say it is also inserting the church into politics in a manner recalling the heady days of Pope John Paul II, who stared down communism and declared his opposition to the 1991 Persian Gulf War. The Vatican is standing in open opposition to politicians like Trump not just on immigration but also on other issues, including climate-change policy.

But the focal point is clearly migrant rights.
In the United States, individual bishops, especially those appointed by Francis, have sharply criticized Trump’s migrant policies since his election. They include Newark Cardinal Joseph W. Tobin, who last month co-led a rally in support of a Mexican man fighting deportation. Tobin has decried Trump’s executive orders on immigration, calling them the “opposite of what it means to be an American.”

In Los Angeles, Archbishop José H. Gomez, the first Mexican American vice president of the United States Conference of Catholic Bishops, which leads the U.S. church, described migrant rights as the bishops’ most important issue. He has delivered blistering critiques of Trump’s policies, and instructed his clerics to distribute cards in English, Spanish, Korean and Vietnamese informing migrants of their rights in 300 parishes .
Chicago Cardinal Blase J. Cupich, one of Francis’s closest allies in the U.S. church, has issued orders that if federal immigration authorities should attempt to enter churches without a warrant in search of migrants, priests should turn them away and call the archdiocese’s lawyers. Catholic school principals were given the same instructions by the archdiocese, which Cupich said was an attempt to respond in a way that was firm “but not extreme.”

He said Francis has helped bishops shape their response.

“The pope makes it a lot easier for me to be a bishop because he’s very clear in his teaching, and [on] this one in particular, he’s trying to awaken the conscience of the citizens of the world,” Cupich said.

Francis has long been an advocate of migrants — kicking off his papacy in 2013 with a trip to an Italian island used as a waypoint for migrants desperate to enter Europe. In a highly public spat early last year, Francis and Trump exchanged barbs — with Francis declaring that anyone who wants to build walls “is not Christian.”

Those who have the pope’s ear say Francis is seeking to counter anti-migrant policies by appealing directly to voters.

“I don’t think the pope is challenging [the politicians]. I think he is challenging their supporters, both those who actively support them and those who passively allow their policies to happen,” said the Rev. Michael Czerny, undersecretary of the Vatican’s new Section for Refugees and Migrants, which opened in January, just before Trump took office. Czerny reports directly to the pope — a sign of the importance of the new office.

“Mr. Trump or Ms. Le Pen are not the root of the problem,” Czerny continued. “The root of the problem is the fear, selfishness and shortsightedness that motivate people to support them.”

He [William E. Lori, Archbishop of Baltimore] added that previous popes have taken similar positions as Francis on immigration. But, Lori added, Francis is “perhaps more dramatic.” His trips, such as his 2016 visit to the U.S.-Mexico border, also connected his stance on migrants to politics.
“The poor is the hallmark of his papacy,” Lori said. “It will affect our priorities and it should.”

Meanwhile, Carla Gardina Pestana writes about “Arrogant Christians in the White House” in HuffPost:

“Mike Pence, the fundamentalist Christian whose views are so extreme that he cannot be alone with a woman other than his wife, and Donald Trump, who brags about sexually assaulting women and famously stumbled over an attempt to quote a biblical passage while on the campaign trail, seem to hold wildly divergent religious views. Yet both adhere to variations of Christianity inflected with arrogance. Together they represent two troubling trends in American Christianity, trends which appear to prove all the complaints secular liberals ever leveled against Christians.

Pence adheres to biblical literalism. Put simply, this view asserts that the Bible is a transparent document, one that prescribes specific behavioral guidelines. Glossing over the fact that the Bible is a complex text built of ancient fragments brought together by human hands, that it does not speak directly to many modern issues, and that even on its own terms it encompasses numerous contradictions, these Christians confidently declare that the Bible provides clear guidance for every Christian. Literalists arrived at this position only relatively late in Christian history, in response to various challenges from many quarters, including biblical scholarship, advances in science, and a rise in unbelief. Cutting through the complexities and the need to make choices, literalists declared all choice to be false and all discussion to be error. It was a comforting if simplistic and authoritarian solution to the problem of uncertainty.

Its arrogance lies in the hubris of those who believe that only their chosen answers are correct. Its potential to harm others comes when adherents gain political power and force their mandates on nonbelievers. One of the many dangers emanating out of the Trump White House is the power of Pence to impose not his religion but the behaviors his religion dictates onto the rest of us. Women’s rights and gender equality are on Pence’s hit list.

Trump’s religion, although very different, is similarly alarming. Unsurprisingly Trump accepts a religious viewpoint that tells him he is uniquely awesome. Whatever he has—however he acquired it—God wants him to enjoy to the fullest. Although traditional Christian social practice mandates that believers exercise humility, charity and other virtues that put others before self, Trump’s faith rejects all curbs on self-indulgence and self-aggrandizement. This religious position, known as Prosperity Theology, is newer than Pence’s literalism. It preaches that God wants the rich to be not only rich but selfish. Its attraction to a man like Trump—born to wealth, selfishly guided by his own desires, endlessly demanding that others adore him but never judge him—is transparent.

Pence’s arrogance leads him to believe that he knows exactly what God wants us all to do and that he ought to force that on us if he has the power to do so. Trump’s faith simply endorses his own self-regard, elevating his personal whims to God’s desires. The political marriage of the two men is obviously one of expedience, given the great disparities in their beliefs and goals. Yet between them, they can do a great deal of damage. Arrogant self-righteousness and egotistical self-regard together wield power over the rest of us.

Little wonder that the pope has been modeling Christian humility and singing the praises of Christian charity, or that the supporters of these two find his lessons in what it means to be a Christian so infuriating.”

Also, Allen Clifton writing in Forward Progressives quotes the views of Pastor John Pavlovitz taking Trump and the GOP to task for hypocricy on Syrian refugees, a point that has been noted several times previously in this blog: 

“There are many things concerning Donald Trump that completely baffle me, but the fact that he’s strongly and enthusiastically supported by a party that comically portrays itself as representatives for “the Christian moral majority” is right near the top of my list. Of all the major candidates who ran for president from either party, Trump was, without a doubt, the least Christian of any of them. I haven’t viewed Republicans as actual Christians for years, but Trump’s rise to the top of the GOP cemented the fact that there’s nothing Christian about the Republican Party.
A great example of what I’m talking about is Trump and the GOP’s take on refusing to accept Syrian refugees. Innocent, desperate people, many of whom are women and children, fleeing a war-torn country hoping to escape a brutal dictator who, once again, just used chemical weapons against his own people. Not only have Trump and his fellow Republicans blatantly vilified these poor people as a means of pandering to the bigotry that fuels their party, but they continually lied about the process refugees must endure before ever stepping foot on U.S. soil.
If you listen to Trump talk about the vetting process, he essentially said we never had one — which is an outright lie. Every refugee allowed into the United States endures a rigorous process that usually takes between 18-24 months to complete and these refugees never know where they’re actually going to end up. So it’s not as if some “undercover terrorist” can pose as a refugee, say they want to go to America, and they’re here in two weeks.
Nevertheless, it’s undeniable that Trump and the GOP have gone out of their way to demonize these poor people for political purposes.

That made it rather nauseating to watch Trump claim that the images of the victims of the most recent chemical weapons attack launched by Assad are what “moved” him to take action by ordering last week’s airstrike. Nothing like selling yourself as the party of “Christian values,” while vilifying and rejecting refugees, then claiming that the images of victims of a horrific chemical attack “moved you” — not to do everything you can to help people who need it — but to fire 59 Tomahawk missiles at an airbase that was up-and-running within a few hours of the attack.

I’m sorry, but you can’t claim you’re “moved” by the sickening images of what’s going on in Syria when your administration’s policy is to reject helping thousands of refugees desperately trying to flee the carnage that’s plagued that nation for over six years now.

That’s also along the lines of what North Carolina Pastor John Pavlovitz said in a recent blog post:
‘This is the human collateral damage of what Donald Trump’s been selling for 16 months now. It is the cost in actual vibrant, beautiful lives, of the kind of incendiary rhetoric and alternative facts and Fox News truths that you’ve been fine with up until now. This is what you bought and paid for. Maybe not something this sadistic or explicitly grotesque, but the heart is the same: contempt for life that looks different and a desire to rid yourself of it.
I want to believe that you’re truly outraged, but honestly your resume is less than convincing.
Honestly, you didn’t seem all that broken up when Muslim families were handcuffed in airports a couple of months ago, or when mosques were being defaced, or when many of us were pleading the case for families fleeing exactlythe kind of monstrous atrocities you were apparently so moved by this week—and getting told to eat our bleeding hearts out by MAGA hat-wearing trolls. You weren’t all that concerned when your President told terrified, exhausted refugees to leave and go home—twice.'”

“Attorney General Jeff Sessions directed federal prosecutors to pursue harsher charges against undocumented immigrants who commit crimes, or repeatedly cross into the U.S. illegally, and promised to add 125 immigration judges in the next two years to address a backlog of immigration cases.

The moves are part of the administration’s efforts to deter illegal immigration and is meant to target gangs and smugglers, though non-violent migrants could also face more severe prosecutions.

In a memo issued Tuesday, Mr. Sessions instructed prosecutors to make a series of immigration offenses “higher priorities,” including transporting or harboring illegal immigrants, illegally entering or reentering the country, or assaulting immigration enforcement agents.

In remarks to border patrol agents at the U.S.-Mexico border in Nogales, Arizona on Tuesday, Mr. Sessions spoke in stark terms about the threat he said illegal immigration poses.

“We mean criminal organizations that turn cities and suburbs into warzones, that rape and kill innocent citizens,” Mr. Sessions said, according to the text of his prepared remarks. “It is here, on this sliver of land, where we first take our stand against this filth.”

“This is a new era. This is the Trump era,” Mr. Sessions said.

Former prosecutors said they didn’t expect the memo to dramatically impact U.S. attorneys offices along the southern border, which already bring thousands of such cases each year. They said it could impact those further inland, which haven’t historically focused on immigration violations.

In the fiscal year that ended in September 2016, 52% of all federal criminal prosecutions involved immigration-related offenses, according to Justice Department data analyzed by Transactional Records Access Clearinghouse at Syracuse University.

Immigration advocates said they worried that the memo and tone set by the administration was describing a closer link between criminal behavior and immigration than statistics show.

“We are seeing an over-emphasis on prosecuting, at the federal level, immigration, illegal entry and reentry cases, and far less paid to criminal violations that implicate public safety,” said Gregory Chen, director of advocacy for the American Immigration Lawyers Association.”

On April 8, 2017, Sari Horowitz reported in the Washington Post on how Sessions’s enthusiastic plans to reinstitute the largely discredited “war on drugs” is likely to “jack up” Federal Prison populations:

“Crime is near historic lows in the United States, but Sessions says that the spike in homicides in several cities, including Chicago, is a harbinger of a “dangerous new trend” in America that requires a tough response.
“Our nation needs to say clearly once again that using drugs is bad,” Sessions said to law enforcement officials in a speech in Richmond last month. “It will destroy your life.”

Advocates of criminal justice reform argue that Sessions and Cook are going in the wrong direction — back to a strategy that tore apart families and sent low-level drug offenders, disproportionately minority citizens, to prison for long sentences.

“They are throwing decades of improved techniques and technologies out the window in favor of a failed approach,” said Kevin Ring, president of Families Against Mandatory Minimums (FAMM).”

Cook and Sessions have also fought the winds of change on Capitol Hill, where a bipartisan group of lawmakers recently tried but failed to pass the first significant bill on criminal justice reform in decades.

The legislation, which had 37 sponsors in the Senate, including Sen. Charles E. Grassley (R-Iowa) and Mike Lee (R-Utah), and 79 members of the House, would have reduced some of the long mandatory minimum sentences for gun and drug crimes. It also would have given judges more flexibility in drug sentencing and made retroactive the law that reduced the large disparity between sentencing for crack cocaine and powder cocaine.

The bill, introduced in 2015, had support from outside groups as diverse as the Koch brothers and the NAACP. House Speaker Paul D. Ryan (R-Wis.) supported it, as well.

But then people such as Sessions and Cook spoke up. The longtime Republican senator from Alabama became a leading opponent, citing the spike in crime in several cities.

“Violent crime and murders have increased across the country at almost alarming rates in some areas. Drug use and overdoses are occurring and dramatically increasing,” said Sessions, one of five members of the Senate Judiciary Committee who voted against the legislation. “It is against this backdrop that we are considering a bill . . . to cut prison sentences for drug traffickers and even other violent criminals, including those currently in federal prison.”
Cook testified that it was the “wrong time to weaken the last tools available to federal prosecutors and law enforcement agents.”

After GOP lawmakers became nervous about passing legislation that might seem soft on crime, Senate Majority Leader Mitch McConnell (R-Ky.) declined to bring the bill to the floor for a vote.

“Sessions was the main reason that bill didn’t pass,” said Inimai M. Chettiar, the director of the Justice Program at the Brennan Center for Justice. “He came in at the last minute and really torpedoed the bipartisan effort.”

Now that he is attorney general, Sessions has signaled a new direction. As his first step, Sessions told his prosecutors in a memo last month to begin using “every tool we have” — language that evoked the strategy from the drug war of loading up charges to lengthen sentences.

And he quickly appointed Cook to be a senior official on the attorney general’s task force on crime reduction and public safety, which was created following a Trump executive order to address what the president has called “American carnage.”

“If there was a flickering candle of hope that remained for sentencing reform, Cook’s appointment was a fire hose,” said Ring, of FAMM. “There simply aren’t enough backhoes to build all the prisons it would take to realize Steve Cook’s vision for America.”

Sessions’s aides stress that the attorney general does not want to completely upend every aspect of criminal justice policy.

“We are not just sweeping away everything that has come before us.” said Robyn Thiemann, the deputy assistant attorney general in the Office of Legal Policy, who is working with Cook and has been at the Justice Department for nearly 20 years. “The attorney general recognizes that there is good work out there.”

Still, Sessions’s remarks on the road reveal his continued fascination with an earlier era of crime fighting.

In the speech in Richmond, he said, “Psychologically, politically, morally, we need to say — as Nancy Reagan said — ‘Just say no.’ ”

Not surprisingly, Sessions’s actions prompted a spate of critical commentary, the theme of which was the failure of the past “war on drugs” and “Just say no to Jeff Sessions.” You can search them on the internet, but here is a representative example, an excerpt from a posting by Rebecca Bergenstein Joseph in “Health Care Musings:”

Three decades ago, Nancy Reagan launched her famous anti-drug campaign when she told American citizens, “Say yes to your life. And when it comes to alcohol and drugs, just say no.” 1 Last month, Attorney General Jeff Sessions invoked the former First Lady’s legacy in a speech to Virginia law enforcement when he said, “ I think we have too much tolerance for drug use– psychologically, politically, morally. We need to say, as Nancy Reagan said, ‘Just say no.’”2 As our nation is confronted on a daily basis with the tragic effects of the opioid epidemic, it is important that we understand just how dangerous it is to suggest that we return to the ‘just say no’ approach.

In the 1980s and 1990s, the ‘just say no’ curriculum became the dominant drug education program nationwide in the form of DARE.3 The DARE program– Drug Abuse Resistance Education– was developed in 1983 by the Los Angeles police chief in collaboration with a physician, Dr. Ruth Rich. The pair adapted a drug education curriculum that was in the development process at University of Southern California in order to create a program that would be taught by police officers and would teach students to resist the peer pressure to use alcohol and drugs. With the backdrop of the War on Drugs that had continued from the Nixon presidency into the Reagan era, DARE grew quickly. Communities understandably wanted to prevent their children from using alcohol and drugs. The program was soon being used in 75% of schools nationwide and had a multimillion dollar budget.3 In fact, I would bet that many of you reading this are DARE graduates. I certainly am.

It did not take long for there to be research showing that the ‘just say no’ approach used in DARE was not working. By the early 1990s there were multiple studies showing that DARE had no effect on its graduates choices regarding alcohol and drug use.4 The decision to ignore the research about DARE culminated when the National Institute of Justice evaluated the program in 1994, concluded that it was ineffective, and proceeded to not publish this finding. In the 10 years that followed, DARE was subjected to evaluation by the Department of Education, the U.S Surgeon General’s Office, and the Government Accountability Office.4 The combined effect of these evaluations was the eventual transformation of DARE into an evidence-based curriculum, Keepin’ It REAL, which was released in 2011.5 But this only happened after billions of dollars were spent on a program that did not work and millions of students received inadequate drug education.

And yet, here we are again. The top law enforcement officer in our nation is suggesting that we go back to the days where elementary and middle school students were told that all they needed to do was ‘just say no.’”

Finally, just yesterday, on April 10, 2017, Spenser S. Hsu reported in the Washington Post that Sessions was “canning” the “National Commission on Forensic Science, a roughly 30-member advisory panel of scientists, judges, crime lab leaders, prosecutors and defense lawyers chartered by the Obama administration in 2013” as a consultant to the DOJ on proper forensic standards.

In plain terms, in Session’s haste to rack up more criminal convictions and appear “tough on crime,” the quality of the evidence or the actual guilt or innocence of those charged becomes merely “collateral damage” in the “war on crime.”

Here’s a portion of what Hsu had to say:

“Several commission members who have worked in criminal courts and supported the input of independent scientists said the department risks retreating into insularity and repeating past mistakes, saying that no matter how well-intentioned, prosecutors lack scientists’ objectivity and training.

U.S. District Judge Jed S. Rakoff of New York, the only federal judge on the commission, said, “It is unrealistic to expect that truly objective, scientifically sound standards for the use of forensic science . . . can be arrived at by entities centered solely within the Department of Justice.”

In suspending reviews of past testimony and the development of standards for future reporting, “the department has literally decided to suspend the search for the truth,” said Peter S. Neufeld, co-founder of the Innocence Project, which has reported that nearly half of 349 DNA exonerations involved misapplications of forensic science. “As a consequence innocent people will languish in prison or, God forbid, could be executed,” he said.

However, the National District Attorneys Association, which represents prosecutors, applauded the end of the commission and called for it to be replaced by an Office of Forensic Science inside the Justice Department. Disagreements between crime lab practitioners and defense community representatives on the commission had reduced it to “a think tank,” yielding few accomplishments and wasted tax dollars, the association said.

The commission was created after critical reports by the National Academy of Sciences about a dearth of standards and funding for crime labs, examiners and researchers, problems it partly traced to law enforcement control over the system.

Although examiners had long claimed to be able to match pattern evidence — such as with firearms or bite marks — to a source with “absolute” or “scientific” certainty, only DNA analysis had been validated through statistical research, scientists reported.

In one case, the FBI lab in 2005 abandoned its four-decade-long practice of tracing bullets to a specific manufacturer’s batch through chemical analyses after its method were scientifically debunked. In 2015, the department and bureau reported that nearly every examiner in an elite hair-analysis unit gave scientifically flawed or overstated testimony in 90 percent of cases for two decades before 2000.

The cases include 32 defendants sentenced to death. Of those, 14 have been executed or died in prison.”

I “get” that some of the advocacy groups quoted in these articles could be considered “interested parties” and/or “soft on crime” in the world of hard-core prosecutors. But, Senate Judiciary Committee Chairman Chuck Grassley (R-IA), Sen. Mike Lee (R-UT), Speaker Paul Ryan (R-WI), and the Koch brothers “soft on crime?” Come on, man!

Capitalist theory says that as long as there is a nearly insatiable “market” in the United States for illegal drugs, and a nearly inexhaustible “supply” abroad, there is going to be drug-related crime. Harsher sentences might increase risks and therefore “jack up market prices” for “consumers” of “product,” while creating “new job opportunities” for “middlemen” who will have to take (and be compensated for) more risks and invest in more expensive business practices (such as bribery, or manipulation of the legal system) to get the product “to market.”

But, you can bet that until we deal with the “end causes” in a constructive manner, neither drug trafficking nor trafficking in undocumented individuals is likely to change much in the long run.

Indeed, authorities have been cutting off heads, hands, feet, and other appendages, drawing and quartering, hanging, crucifying, shooting, gassing, injecting, racking, mutilating, imprisoning in dungeons, transporting, banishing, and working to death those who have committed crimes, both serious and not so serious, for centuries. But, strangely, such harsh practices, while certainly diminishing the humanity of those who inflict them, have had little historical effect on crime. The most obvious effects have been more dead and damaged individuals, overcrowded prisons, and angry disaffected families.

125 new U.S. Immigration Judges should be good news for the beleaguered U.S. Immigration Courts. But, even assuming that Congress goes along, at the glacial pace the DOJ and EOIR have been hiring Immigration Judges over the past two Administrations, it could take all four years of Trump’s current term to get them on board and actually deciding cases.

More bad news: Added to the approximately 375 Immigration Judges currently authorized (but, only about 319 actually on the bench), that would bring the total to 500 Immigration Judges. Working at the current 750 completions/year (50% above the “optimum” of 500 completions/year) the currently authorized 375 Immigration Judges could complete fewer than 300,000 cases/year consistent with due process — barely enough to keep up with historic receipts, let alone the “enhanced enforcement” promised by the Trump Administration. They would not have to capacity to address the current “backlog” of approximately 550,000 cases.

If receipts remained “flat,” the 125 “new” Immigration Judges contemplated by AG Sessions could go to work on on the backlog. But, it would take them about 6 years to wipe out the 550,000 case existing backlog.

Judge Neil Gorsuch Confirmed By Senate On 54-45 Vote — Will Be Sworn In As Associate Justice On Monday, Replacing The Late Justice Antonin Scalia!

“WASHINGTON—The Senate on Friday confirmed Neil Gorsuch to the Supreme Court, ending a 14-month vacancy on the high court that spanned two presidential administrations and sparked one of the most bitter political fights in Washington in recent memory.

In a vote that fell largely upon partisan lines, Judge Gorsuch was approved as the next associate justice of the Supreme Court by 54-45. Three Democrats crossed the aisle to support Judge Gorsuch’s nomination, while he drew unanimous support from Senate Republicans.

“This brilliant, honest, humble man is a judge’s judge. And he will make a superb justice,” said Sen. Chuck Grassley, an Iowa Republican and chairman of the Senate Judiciary Committee.

Senate Minority Leader Chuck Schumer (D., N.Y.), who had opposed Judge Gorsuch as an out-of-the-mainstream conservative, acknowledged defeat but said he hoped the new justice wouldn’t be bound by the conservative groups that advised President Donald Trump on the choice.

“We are charging Judge Gorsuch to be the independent and fair-minded justice that America badly needs,” Mr. Schumer said. “If he is instead a justice for the Federalist Society and the Heritage Foundation, that will spell trouble for America.”

The only senator not voting was Johnny Isakson (R., Ga.), who is recovering from surgery.

The new justice will be sworn in Monday morning during a private ceremony at the Supreme Court, followed later in the day by a public ceremony at the White House. He will join his new colleagues on the bench on April 17, filling the seat held for three decades by the late Justice Antonin Scalia.”

I continue to think that the Democrats made a mistake in picking the Gorsuch nomination to make a “stand.”  A stand on what? That a GOP President doesn’t have a right to appoint a well-qualified conservative jurist to the Court? How does that follow? Doesn’t a Democrat have a right to appoint a well-qualified more liberal jurist?

Yes, the GOP and Senate Majority Leader Mitch McConnell (R-KY) treated an outstanding, moderately liberal jurist, Chief Judge Merrick Garland with total shabbiness and disrespect. But, hey, we’re talking about Mitch McConnell here; perhaps one of the wiliest and shrewdest legislators ever to walk the halls of the Senate, but hardly anyone’s choice for the classiest or most decent.

And none of this was Judge Gorsuch’s fault. He respects Chief Judge Garland and made it clear that he did not agree with the way he was treated.

The political problem was that the Democrats had lost control of the Senate, and notwithstanding making control of the Supremes a major campaign issue, they lost both the Presidency and the Senate in 2016. Winners have leverage, losers don’t.

The real solution here is for the Dems to get out there and win some elections, at all levels. And, if anything, the ill-advised Gorsuch battle made them look no more like the “party of adults” than the  GOP.

I think Justice Gorsuch will be engaged, scholarly, collegial, and fair within his own very conservative philosophical framework. And, all of us who are or have been judges are, to some extent, prisoners of our own backgrounds, philosophies, and life experiences.

But, being on a collegial court with those holding other views forces a judge to listen to other views, consider other possible outcomes, and to reexamine carefully the legal and intellectual justifications for one’s own positions. That’s about all you can ask of a jurist. And, I’m relatively certain that somewhere down the line, Judge Gorsuch will cast some votes, write, and join some opinions that will surprise both his supporters and detractors.  And, that will be a good thing for the U.S. justice system. It’s what judicial independence and separation of powers is all about.

“BALTIMORE — A Justice Department attorney expressed “grave concerns” Thursday about moving forward with a federal plan to make changes to this city’s police department, telling a federal judge that the Trump administration prefers that revisions be made and overseen by local government.

The hearing to gather public input on the proposed consent decree became a clash over the future of police departments, as Baltimore residents affected by police shootings and beatings forcefully pushed back against any delays.

The hearing came just days after U.S. Attorney General Jeff Sessions announced that he would have top deputies review such agreements with departments nationwide.

Sessions said he wanted to ensure the agreements align with administration priorities of promoting officer safety and morale while fighting violent crime, but advocates say the move could stymie much-needed changes to departments in the wake of high-profile police shootings of minorities in recent years.

The tension was on display Thursday, as well as an unusual role reversal — the Justice Department distanced itself from its plan negotiated by President Barack Obama’s administration, while Baltimore officials, residents and activists openly embraced it.

“Please do not delay this decree,” implored Greta Carter-Willis, whose 14-year-old son was fatally shot by a police officer several years ago. “We need to turn this police department around.”

She later broke down crying.

The consent decree follows a blistering Justice Department report that found widespread constitutional violations and discrimination in the Baltimore Police Department. The report was prompted by the 2015 death of Freddie Gray, who was fatally injured in police custody.

John Gore, the acting assistant attorney general for the civil rights division of Justice, said in court Thursday that the department wanted a 30-day delay on a decision to implement the plan “so new leadership can reanalyze and engage with the city as necessary.

Ultimately, “it is up to local communities to try and work with police to try and ensure reforms are implemented fully,” Gore said. “We have grave concerns that this consent decree is what is needed” as the means to change the police force and help fight crime.”

Jonathan Smith, executive director of the Washington Lawyers’ Committee for Civil Rights and Urban Affairs, called the situation in Baltimore “unprecedented and extraordinary.” He said there is no precedent for a lead party to pull out after a consent decree is signed and the matter is before the court. “We are in uncharted territory.”

Smith, was in the Justice Department’s civil rights division under the Obama administration from 2010 through 2015 and negotiated a consent decree with the New Orleans Police Department.”

The grotesque spectacle of Jeff Sessions in charge of the U.S. Department of Justice continues to get more jaw-dropping every day.

It wasn’t long ago that Senate Majority Leader Mitch “Nuke Em” McConnell (R-KY) shut down Sen. Elizabeth Warren (D-MA) while she was trying to “complete the record” on Sessions’s total unsuitability to be in charge of overseeing the delivery of justice in America and protecting the constitutional rights of all Americans (which actually includes immigrants who are entitled to constitutional due process protections). Everybody who doubted the truth of her message owes Sen. Warren a huge apology. And, those Senators who voted to confirm Sessions as AG should be ashamed.

Ever wonder how much damage one man can do the the U.S. justice system? Well, we’re finding out. And, it isn’t pretty.

“I don’t know that America has ever seen a political party so divested of care. Since Trump took office, Republicans have proposed legislation to destroy unions, the healthcare system, the education system and the Environmental Protection Agency; to defund the reproductive health charity Planned Parenthood and restrict abortion; to stifle public protest and decimate arts funding; to increase the risk of violence against trans people and roll back anti-discrimination laws; and to funnel more and more wealth from the poorest to the richest. Every executive order and piece of GOP legislation is destructive, aimed at dismantling something else, never creating anything new, never in the service of improving the care of the nation.

Contemporary American conservatism is not a political philosophy so much as the roiling negative space around Barack Obama’s legacy. Can you imagine being that insecure? Can you imagine not wanting children to have healthcare because you’re embarrassed a black guy was your boss? It would be sad if it wasn’t so dangerous.

That void at the heart of the party, that loss of any tether to humanity, is breeding anxiety on both sides of the political divide. According to the Atlantic, Florida Republican Tom Rooney recently turned on his cohort with surprising lucidity: “I’ve been in this job eight years and I’m racking my brain to think of one thing our party has done that’s been something positive, that’s been something other than stopping something else from happening. We need to start having victories as a party. And if we can’t, then it’s hard to justify why we should be back here.”

Vindictive obstructionism, it seems, is not particularly nourishing for the soul.”

— Trump plans to unveil a new White House office today with sweeping authority to overhaul the federal bureaucracy and, potentially, privatize some government functions. “The Office of American Innovation, to be led by Jared Kushner, the president’s son-in-law and senior adviser, will operate as its own nimble power center within the West Wing and will report directly to Trump,” Ashley Parker and Philip Rucker report. “Viewed internally as a SWAT team of strategic consultants, the office will be staffed by former business executives and is designed to … create a lasting legacy for a president still searching for signature achievements. … Kushner’s team is being formalized just as the Trump administration is proposing sweeping budget cuts across many departments, and members said they would help find efficiencies.”

Kushner’s ambitions are grand: “At least to start, the team plans to focus its attention on re-imagining Veterans Affairs; modernizing the technology and data infrastructure of every federal department and agency; remodeling workforce-training programs; and developing ‘transformative projects’ under the banner of Trump’s $1 trillion infrastructure plan, such as providing broadband Internet service to every American. In some cases, the office could direct that government functions be privatized, or that existing contracts be awarded to new bidders.”

On Gorsuch, Deference, & The Administrative State

Hohmann’s points make quite a bit of sense to me — until he gets down to his rather remarkable conclusion that progressives should have invested more in a fight against Gorsuch. What? Just how would they have done that?  The GOP has the votes to confirm, as they will do, and there is nothing the Dems can do to stop it, except to look feeble, petty, and out of touch in the attempt.

The confirmation hearings revealed nothing that was not already known. Gorsuch should be a reliable conservative vote on the Court, perhaps, but not necessarily, even more than Justice Scalia. Surprise!

We just had an election during which McConnell’s scheme to block the nomination of Chief Judge Merrick Garland to the Supremes, the control of the Senate, and the ability of the next President to appoint a liberal (Hillary) or a conservative (Trump) as Scalia’s replacement were big issues. And, guess what? Whether Dems like it or not, the GOP won both the Presidency and the Senate and thereby the ability to appoint their man (in this case) as the next Justice.

What’s remarkable about that? It would have only been remarkable if President Trump had nominated someone less conservative than Judge Gorsuch. And, certainly, if Hillary had won and the Democrats won the Senate she could legitimately have chosen to resubmit Judge Garland or chosen an even more liberal candidate who would have duly been confirmed by the Democrats over the GOP’s objections. Elections have consequences, particularly when your party loses control of both of the political branches of Government.

I continue to suspect that while Justice Gorsuch will be very conservative, at some point in the future he will be persuaded to side with the so-called “liberal Justices” against some position that is key to the GOP — perhaps, the scope of Executive authority. At that point, the same GOP Senators who gushed on about his “judicial independence” will be screaming “betrayal,” while the Democrats will be congratulating him on “conscientiously following the law.”

Look at how Chief Justice Roberts went from poster boy for judicial conservatism to “dupe of the left” just by failing to veto Obamacare as the GOP had been counting on. All politicians want judges who exercise their “judicial independence” in a predictable way consistent with the political philosophy of the party that appointed them. Once on the bench, however, with lifetime tenure and only their judicial colleagues to answer to, few actually live up to all of the exceptions of their political appointers.

Moreover, I don’t agree with the supposedly “liberal” position that Executive Branch administrative judges (like I was) and bureaucrats (which I also was) should have the power to impose their views on legal issues, even if not particularly sound ones, on the Article III Judiciary. Chief Justice John Marshall must be turning over in his grave, while Thomas Jefferson dances on top of it, at this bizarre voluntary surrender of judicial authority known as “Chevron.”

There is always pressure on Executive Branch officials, be they administrative judges or just “regular agency bureaucrats,” to construe the law in ways that favor Executive policies and Executive power over the power and prerogatives of the other two branches of Government and often over the rights of individuals in the U.S.

Deciding difficult questions of law, where the answers are not clear, is what Article III Judges are paid to do, and what they are supposed to do under the Constitution! At one time, this is what they actually did! The pre-ChevronSkidmore doctrine” already gave the Article III Judiciary adequate latitude to recognize the expertise of certain Executive Branch officials and to defer to their interpretation when it appeared to be the best one, or at least as good as any of the alternatives.

But, Chevron basically substituted the concept of “any plausible interpretation” for the “best interpretation.”  That’s simply not the way an independent judiciary should function under the separation of powers established in our Constitution.

I say all of this as someone who spent the bulk of my professional career as a public servant within the “administrative state” and who, unlike the Bannons of the world, believes in the power of the Federal Government to do good things for the general population. But, I have also seen first-hand the weaknesses and biases of the Executive when it comes to interpreting the law.

Meaningful independent judicial oversight over the “administrative state,” which includes “de novo” (basically unrestricted) review of Executive legal decisions by the Article III Judiciary, is a requirement  for fairness and due process under our Constitution.

Finally, the Dems should abandon Schumer’s ill-conceived idea of a “Gorsuch filibuster.”  Of the minority of Americans who actually care about the Gorsuch confirmation, only a minority of those are opposed. In other words, the Dems are about to proceed on a futile parliamentary maneuver that really only speaks to a small number of voting Americans, who are already in their “base.” Absolutely no need to do that.

What is needed if the Dems don’t want another Gorsuch appointment is to start winning more elections, particularly in the U.S. Senate and for the Presidency the next time around. That will require more than feeble posturing, tilting at windmills, and some additional “Trump fails.”

The Democrats need some dynamic leadership (which currently is conspicuously absent) and some real, down to earth programs and proposals to solve America’s problems (something which I haven’t heard to date). What can the Dems do that the GOP can’t, and why should folks care?

Otherwise, the next nominee for the Supremes could be along the lines of Judge Jeannie or Judge Napolitano. And, the Dems will continue to be powerless to stop it.

WALTER PINCUS IN THE NEW YORK REVIEW OF BOOKS: The Coming Immigration Court Disaster!

“One thing however is clear. Trump’s recent efforts to use blunt executive power to close our borders and prepare the way for deporting large numbers of undocumented immigrants are confronting far-reaching problems. Not only is there opposition from federal judges, the business sector, civil liberties groups, and others. There is also a major roadblock from another quarter: our already broken system of immigration laws and immigration courts.

The nation’s immigration laws needed repair long before Trump came to office. Even without the measures taken by the new administration, immigration courts face a backlog of hundreds of thousands of cases, while the existing detention system is plagued, not just by arbitrary arrests, but also by deep problems in the way immigrant detainees are handled by our courts, one aspect of which is the subject of a Supreme Court challenge.

But will the potential Trump excesses—driven by the president’s fear mongering about immigrant crimes and the alleged potential for terrorists to pose as refugees—be enough to light a fire under a Republican-led Congress that has for years balked at immigration reform?

For better or worse—and it may turn out to be worse if Congress continues to refuse to act—the Trump administration’s determination to enforce current laws has pushed long-standing inequities in immigration justice onto the front pages.

Take the matter of those immigration judges, who now number some three hundred and are scheduled to grow substantially under the Trump administration. In April 2013, the National Association of Immigration Judges issued a scathing report pleading for omnibus immigration reform. Describing the morale of the immigration judge corps as “plummeting,” the report found that “the Immigration Courts’ caseload is spiraling out of control, dramatically outpacing the judicial resources available and making a complete gridlock of the current system a disturbing and foreseeable probability.”

The judges also noted that, “as a component of the DOJ [Department of Justice], the Immigration Courts remain housed in an executive agency with a prosecutorial mission that is frequently at odds with the goal of impartial adjudication.” For example, the judges are appointed by the Attorney General and “subject to non-transparent performance review and disciplinary processes as DOJ employees.” As a result, “they can be subjected to personal discipline for not meeting the administrative priorities of their supervisors and are frequently placed in the untenable position of having to choose between risking their livelihood and exercising their independent decision-making authority when deciding continuances”—the postponement of a hearing or trial.

The immigration judges writing this complaint were working under the Obama administration Justice Department, with Eric Holder as attorney general. What will their situation be like with Attorney General Jeff Sessions, a believer in tighter immigration controls, as their boss?

As it is now, an immigration judge’s job is exhausting. They carry an average load of 1,500 cases, but have minimal staff support. In the 2013 report, the immigration judges noted that they have no bailiffs, no court reporters, and only one quarter of the time of a single judicial law clerk. The backlog of immigration cases in the United States now stands at roughly 542,000. Most important, the immigration judges claim some 85 percent of detained immigrants appearing before them are unrepresented by counsel.

Meanwhile, another pending lawsuit highlights a different long-running problem concerning our nation’s immigration judges. In June 2013, the American Immigration Lawyers Association, along with Public Citizen and the American Immigration Council (AIC) filed a case in federal district court in Washington, D.C., seeking documents that would disclose whether the federal government adequately investigated and resolved misconduct complaints against immigration judges.

Such complaints have been widespread enough that the Justice Department reports annually on the number. In fiscal 2014, the latest figures published, there were 115 complaints lodged against 66 immigration judges. Although 77 were listed as resolved, the outcomes are not described.”

This timely article was brought to my attention by my good friend and former colleague retired U.s. Immigration Judge (NY) Sarah Burr. Walter Pincus is a highly respected national security reporter. He’s not by any means an “immigration guru.”

As I have pointed out in previous blogs and articles, this problem is real! In the absence of sensible, bipartisan immigration reform by Congress, which must include establishing an independent immigration judiciary, our entire Federal Justice System is at risk of massive failure.

Why? Because even now, immigration review cases are one of the largest, if not the largest, components of the civil dockets of the U.S. Courts of Appeals. As due process in the Immigration Courts and the BIA (the “Appellate Division” of the U.S. Immigration Courts) deteriorates under excruciating pressure from the Administration, more and more of those ordered removed will take their cases to the U.S. Courts of Appeals. That’s potentially hundreds of thousands of additional cases. It won’t be long before the Courts of Appeals won’t have time for anything else but immigration review.

In my view, that’s likely to provoke two responses from the Article III Courts. First, the Circuits will start imposing their own minimum due process and legal sufficiency requirements on the Immigration Courts. But, since there are eleven different Circuits now reviewing immigration petitions, that’s likely to result in a hodgepodge of different criteria applicable in different parts of the country. And, the Supremes have neither the time nor ability to quickly resolve all Circuit conflicts.

Second, many, if not all Courts of Appeals, are likely to return the problem to the DOJ by remanding thousands of cases to the Immigration Courts for “re-dos” under fundamentally fair procedures. Obviously, that will be a massive waste of time and resources for both the Article III Courts and the Immigration Courts. It’s much better to do it right in the first place. “Haste makes waste.”

No matter where one stands in the immigration debate, due process and independent decision making in the U.S. Immigration Courts should be a matter of bipartisan concern and cooperation. After all, we are a constitutional republic, and due process is one of the key concepts of our constitutional system.

President Trump Takes Very Nuanced Approach To DACA Retention — See The Video Clip From CNN

In the above video clip, President Trump takes a (perhaps surprisingly) very nuanced approach to the DACA kids. He realizes that most of them are wonderful and will do great things for America. He also sees the parallel with his own children and grandchildren.

I was encouraged that he appears to be listening to his own “better angels” here, rather than just to some of the “immigration hard-liners” surrounding him at the White House.  And, he very correctly points out that one of the things he must do is sell his solution to Congress, including many members of his own party who might be skeptics.

Don’t know how this eventually will play out. But, overall, this shows a reflective side of the President that we don’t often see showcased or tweeted. Well worth the couple of minutes it takes to view.

“As judges on the 9th Circuit Court of Appeals weigh the legality of President Trump’s immigration executive order, a Republican push to split up the controversial court — and shrink its clout — is gaining steam on Capitol Hill.

Republican Sens. Jeff Flake and John McCain of Arizona introduced legislation last month to carve six states out of the San Francisco-based court circuit and create a brand new 12th Circuit.

They argue that the 9th is too big, too liberal and too slow resolving cases. If they succeed, only California, Oregon, Hawaii and two island districts would remain in the 9th’s judicial fiefdom.

Right now, Flake said, the circuit is far too sprawling.

“It represents 20 percent of the population — and 40 percent of the land mass is in that jurisdiction. It’s just too big,” Flake told Fox News on Wednesday. “We have a bedrock principle of swift justice and if you live in Arizona or anywhere in the 9th Circuit, you just don’t have it.”

Flake says it typically takes the court 15 months to hand down a decision.

“It’s far too long,” he added.

Conservatives have mocked the 9th Circuit for years, often calling it the “Nutty 9th” or the “9th Circus,” in part because so many of its rulings have been overturned by the U.S. Supreme Court.”

Under the GOP proposal a new 12th Circuit would be formed consisting of Arizona, Nevada, Idaho, Montana, Washington, and Alaska. California, Oregon, Hawaii, and several island territories would remain in the new “Diet-Sized 9th.”

HuffPost: GOP Senators Seek To Halve Legal Immigration — Mount Attack On American Families, Refugees, Africans, Asian Americans, Latinos!

“WASHINGTON ― For decades, a central tenet of U.S. immigration policy has been that American citizens should be able to reunite with their siblings, parents and grown children who live abroad. The government doesn’t make this easy. But now, emboldened by President Donald Trump’s anti-immigrant stance, two Republican senators want to make it almost impossible.

Sens. Tom Cotton (R-Ark.) and David Perdue (R-Ga.) introduced a bill on Tuesday that would bar immigrants from bringing almost anyone but their spouses and minor children to the U.S. Latino and Asian Americans, who are more likely to be recent immigrants with family living abroad, would be disproportionately affected by this change.

The bill would also eliminate diversity visas, which many recent African immigrants rely on to get to the U.S., and cap refugee resettlement at 50,000 people per year. The bill doesn’t affect the millions of Irish, German and Italian Americans whose families came to the U.S. in earlier waves of immigration and no longer have close relatives abroad.

The senators predict the bill would cut legal immigration per year by half. They also think it stands a chance of passing.

“Once you get here, you have a green card and you can open up immigration not just to your immediate family, but your extended family, your village, your clan, your tribe,” Cotton said of ending the diversity lottery. “I don’t think it works for American workers.”

The new GOP “family values?” Would we even be having this discussion if most recent immigrants were “white guys” from Canada, Australia, and the UK? My guess is no. It’s not about protecting American workers. The GOP doesn’t give a hoot about them. That’s why they are anti-union, anti-minimum wage, anti-universal health care, anti-safety net, anti-Medicare, anti-consumer protection, anti-financial regulation, anti-pension, anti-equal pay for equal work, anti-environment, anti-science, anti-public workers, anti-education and anti just about everything that doesn’t directly or indirectly help their fat cat friends get fatter and their business buddies get bigger — more profits, more money for upper management, more tax breaks for the rich, less money, fewer benefits, and no chance at a comfortable retirement for workers. No, something else is at work here.
