With an available interpretation that would have allowed regularization of status, what purpose is served by devising a way to keep these otherwise qualified Cubans in limbo? Why would the DHS appeal a decision like this? Why would the BIA reward them for pursuing a result that is 1) inhumane, 2) undesirable, and 3) entirely avoidable with a little creativity and common sense (see, IJ in this case)?

No wonder we have backlogs everywhere an a dysfunctional system that nobody in charge seems interested in fixing — even when fixes are available and basically “cost free?” Better leaders and more enlightened decision-makers would be helpful.

Nothing will harm a campaign like the wishful thinking, fearful hesitation, or sheer complacency that fails to address what voters can plainly see. Kenosha gives Biden a chance to help himself and the country. Ordinarily it’s the incumbent president’s job to show up at the scene of a national tragedy and give a unifying speech. But Trump is temperamentally incapable of doing so and, in fact, has a political interest in America’s open wounds and burning cities.

Biden, then, should go immediately to Wisconsin, the crucial state that Hillary Clinton infamously ignored. He should meet the Blake family and give them his support and comfort. He should also meet Kenoshans like the small-business owners quoted in the Times piece, who doubt that Democrats care about the wreckage of their dreams. Then, on the burned-out streets, without a script, from the heart, Biden should speak to the city and the country. He should speak for justice and for safety, for reform and against riots, for the crying need to bring the country together. If he says these things half as well as Julia Jackson did, we might not have to live with four more years of Trump.

Seems like a sound plan. Joe probably should take Kamala with him to Kenosha. Get the input of the residents and public officials living with this horrible situation every day and see what common ground they might suggest for both repairing the damage that has been done (to the extent it can be repaired — obviously, there is no restoring Mr. Blake to his pre-shooting condition) and moving forward as a united community and as a country. Assuming, as I do, that the vast majority of Americans favor both justice for all and peaceful, prosperous communities, what are some specifics about how we might get there by working together and across racial and party lines.

Threats and more force won’t solve the problem. We know that. But just that knowledge isn’t enough to solve the problem.

I think it also would be a good idea for Joe and Kamala to seek the views of individuals like LeBron James, Giannis Antetokounmpo, Steph & Ayesha Curry, George Hill, Kenny Smith, Colin Kaepernick (who was born in Milwaukee and spent the first four yers of his life in Fond du Lac, WI)and others in the African-American community. How would they solve the problem of racial injustice while building community harmony. How could they use their influence to help. Elizabeth Warren, Bernie Sanders, AOC, and Sen. Doug Jones (to name just a few) might also have some good ideas to contribute.

Donald Trump is not, and never will be, a thoughtful, unifying problem solver. It’s just not in his makeup or “skill set.” He has no coherent plan for anything.

By contrast, Joe Biden has shown himself to be thoughtful, willing to admit and move by past mistakes, and able to build on his experience and past views to address the present. Now, he needs to put it all together in “real time” and show America what a competent, caring, and listening Government could do for the common good. Without necessarily “becoming Elizabeth Warren,” he and Kamala “need a plan for that.” And listening to the “real people of Kenosha” seems like the place to start.

As cities burn, Trump’s bullhorn drowns out the voices of our better angels

AS BUILDINGS and businesses burn in many cities across America, state and local officials and community leaders are desperately and at times bravely saluting the justifiable moral outrage of peaceful protesters while seeking to ensure that looters and hooligans whose only agenda is mayhem do not irreparably sully the cause. Meanwhile, President Trump, whose words could matter most, plays his customary role as human flamethrower: exactly the wrong leader for the times.

No magic elixir could extinguish the rage overnight, nor ensure that the fury over George Floyd’s brutal killing in Minneapolis is channeled in a constructive direction. But this much is certain: Words matter, and a commitment to reform matters. Some leaders are trying to deliver both. They recognize the challenges of systemic injustice; the pattern of brutality suffered by African Americans at the hands of white officers; the racism manifested in so many ways, including unequal rates of imprisonment and, now, unequal suffering from the novel coronavirus, both medically and economically.

Meanwhile, Mr. Trump, the divider in chief, fulminates as the nation burns. He does not counsel restraint; nor issue appeals for unity, nor acknowledge the roots and reasons for the fury of black Americans who see white men in uniform as threats to their lives. To his administration, there is no systemic challenge, only “a few bad apples” among police, as Robert C. O’Brien, national security adviser, said Sunday. Even as police train their weapons on journalists doing their jobs by covering the unrest, Mr. Trump attacks the media. As the president vents — warning that “the most ominous weapons” and “the most vicious dogs” would be unleashed on protesters; threatening to deploy the active-duty military; attacking Democrats; relishing the Secret Service’s readiness for “action”; suggesting he may summon his MAGA supporters to the streets — the country’s more emollient voices are muffled.

Wanton destruction, looting and firebombing are unacceptable and unjustified no matter what the provocation, as Rep. John Lewis (D-Ga.) said on Saturday. Responsible leaders are trying to send that message. But against the president’s bullhorn, it becomes harder to hear leaders like Atlanta Mayor Keisha Lance Bottoms, whose anger at destructive rioters in her city was tempered by a heartfelt appeal. “We are better than this as a city, we are better than this as a country,” she said. “Go home. Go home!” It becomes more difficult to focus on the message of Minnesota Gov. Tim Walz (D), who tweeted, “Minnesota consistently ranks highly for our public schools, innovation and opportunity, and happiness – if you’re white. If you’re not, the opposite is true. Systemic racism must be addressed if we are to secure justice, peace, and order for all Minnesotans.”

So much depends right now on moral authority, yet so little of it can break through the chaos of events and the venomous soundtrack from Washington. The right message would combine an insistence on keeping protest peaceful with assurances that justice will be done in Mr. Floyd’s death and a recognition that righting deeper wrongs is an urgent priority. That message will not come from a White House that has used racial hatred as a wedge and repeatedly made clear its contempt for urban America. It is left to other leaders to try to break through the mayhem of the moment, and give voice to our better angels.

Trump, already the worst President in U.S. history, has been a clear and present danger to the welfare, security, and continued existence of our nation since he took office.

His malicious incompetence, corruption, ignorance, racism, meanness, and lack of humanity are now on full display. Trump and his band of grifters, White Nationalists, toadies, and incompetents are a big part of the problem, not the solution!

Indeed, we can’t even get a constructive start on solving the problems of institutional racism, inequality, and failure to take equal justice for all as a serious goal with Trump in office. For example, Trump and the GOP have it very clear that they have the intent and a variety of schemes to suppress African-American and Hispanic-American voting and voting power this November — so far, with no meaningful pushback from the Supremes.

Still, we “are where we are” today because those institutions with a responsibility and the authority to curb his abuses, hold him accountable for his racism and dishonesty, and enforce our Constitution, namely, the U.S. Senate, the Supreme Court, and the GOP have failed to do so. Beyond that, on many occasions they have actually encouraged and joined in his misdeeds.

This November, vote like your life depends on it. Because it does!

ONE POLITICAL ANALYST PREDICTED DONALD TRUMP 50 YEARS AGO: GONZO JOURNALIST HUNTER S. THOMPSON NAILED IT IN “HELL’S ANGELS!” — Those Who Don’t Take Trump Seriously Are “Liable To Get Stomped!”

“While many commentators say Trump will have to bring back jobs or vibrancy to places like the Rust Belt if he wants to continue to have the support of people who voted for him, Thompson’s account suggests otherwise. Many if not most Trump supporters long ago gave up on the idea that any politician, even someone like Trump, can change the direction the wind is blowing. Even if he fails to bring back the jobs, Trump can maintain loyalty in another way: As long as he continues to offend and irritate elites, and as long as he refuses to play by certain rules of decorum—heaven forfend, the president-elect says ill-conceived things on Twitter!—Trump will still command loyalty. It’s the ethic, not the policy, that matters most.

Even the racism that was on full display in Trump’s campaign should be understood at least in part in retaliatory terms, as directed at the political elite rather than at struggling minority groups. The Hells Angels, Thompson wrote, did things like get tattoos of swastikas mostly because it visibly scared the members of polite society. The Angels were perfectly happy to hang out at bars with men of different races, especially if those men drove motorcycles, and several insisted to Thompson that the racism was only for show. While I have no doubt (and no one should have any doubt) that there are genuine racists in Trump’s constituency—and the gleeful performance of racism is nothing to shrug off—Thompson suggests we should consider the ways in which racism might not be the core disease of Trumpism but a symptom of a deeper illness.

Thompson would also direct our attention in the early days of the Trump administration to the armed forces and the policies that will mandate what they do. For one great exception to the Angels’ ethos of total retaliation against authority was the military, just as one great exception to the Trump voters’ ethos of total irreverence is the police. Thompson explains that such institutions, which are premised on brute force rather than the more refined rules of intellectual engagement, maintain both a practical and a cultural connection to people like the Angels. The military and the police draw mostly from poor and working-class communities to fill their ranks, and their use of violence is something the motorcycle guys understand. It is one aspect of American life they can easily imagine themselves being a part of.

For his part, Thompson thought that what might prove most dangerous about the ethic of total retaliation was the way it encouraged the distrust of all authority—except for the authority of brute force. The president-elect’s enthusiasm for waterboarding and other forms of torture, his hawkish cabinet choices, and his overtures to strongmen like Vladimir Putin are grave omens. We could end up back where Thompson left off at the end of his book: the Angels, marching with the John Birch Society, on behalf of the Vietnam War.

At the end of Hell’s Angels, having spent months with the motorcycle guys, Thompson finally gets stomped by them. For some offense he doesn’t understand (and which he probably didn’t commit), Thompson gets punched, bloodied, kicked in the face and in the ribs, spat at and pissed on. He limps off to a hospital in the dead of night, alone and afraid. Only in that moment does Thompson realize that as a journalist (and therefore a member of the elite), he could not possibly be a true friend of the Angels. Wear leather and ride a motorcycle though he might, Thompson stood on the side of intellectual and cultural authority. And that finally made him, despite his months of good-timing with the Angels, subject to their retaliatory impulses. The ethic of retaliation is total, Thompson comes to realize. There is nothing partial about it. It ends with violence.

There’s no doubt about it: trouble lies ahead. That Hell’s Angels foresaw all this 50 years ago underscores the depth and seriousness of Thompson as a political thinker and of ours as a singularly dangerous time. Trumpism is about something far more serious than Trump, something that has been brewing and building for generations. Let us take Thompson’s cautions seriously, then, so that this time we Berkeley types are not naive about what we face. Otherwise, we’re all liable to get stomped.”

“BALTIMORE — A Justice Department attorney expressed “grave concerns” Thursday about moving forward with a federal plan to make changes to this city’s police department, telling a federal judge that the Trump administration prefers that revisions be made and overseen by local government.

The hearing to gather public input on the proposed consent decree became a clash over the future of police departments, as Baltimore residents affected by police shootings and beatings forcefully pushed back against any delays.

The hearing came just days after U.S. Attorney General Jeff Sessions announced that he would have top deputies review such agreements with departments nationwide.

Sessions said he wanted to ensure the agreements align with administration priorities of promoting officer safety and morale while fighting violent crime, but advocates say the move could stymie much-needed changes to departments in the wake of high-profile police shootings of minorities in recent years.

The tension was on display Thursday, as well as an unusual role reversal — the Justice Department distanced itself from its plan negotiated by President Barack Obama’s administration, while Baltimore officials, residents and activists openly embraced it.

“Please do not delay this decree,” implored Greta Carter-Willis, whose 14-year-old son was fatally shot by a police officer several years ago. “We need to turn this police department around.”

She later broke down crying.

The consent decree follows a blistering Justice Department report that found widespread constitutional violations and discrimination in the Baltimore Police Department. The report was prompted by the 2015 death of Freddie Gray, who was fatally injured in police custody.

John Gore, the acting assistant attorney general for the civil rights division of Justice, said in court Thursday that the department wanted a 30-day delay on a decision to implement the plan “so new leadership can reanalyze and engage with the city as necessary.

Ultimately, “it is up to local communities to try and work with police to try and ensure reforms are implemented fully,” Gore said. “We have grave concerns that this consent decree is what is needed” as the means to change the police force and help fight crime.”

Jonathan Smith, executive director of the Washington Lawyers’ Committee for Civil Rights and Urban Affairs, called the situation in Baltimore “unprecedented and extraordinary.” He said there is no precedent for a lead party to pull out after a consent decree is signed and the matter is before the court. “We are in uncharted territory.”

Smith, was in the Justice Department’s civil rights division under the Obama administration from 2010 through 2015 and negotiated a consent decree with the New Orleans Police Department.”

The grotesque spectacle of Jeff Sessions in charge of the U.S. Department of Justice continues to get more jaw-dropping every day.

It wasn’t long ago that Senate Majority Leader Mitch “Nuke Em” McConnell (R-KY) shut down Sen. Elizabeth Warren (D-MA) while she was trying to “complete the record” on Sessions’s total unsuitability to be in charge of overseeing the delivery of justice in America and protecting the constitutional rights of all Americans (which actually includes immigrants who are entitled to constitutional due process protections). Everybody who doubted the truth of her message owes Sen. Warren a huge apology. And, those Senators who voted to confirm Sessions as AG should be ashamed.

Ever wonder how much damage one man can do the the U.S. justice system? Well, we’re finding out. And, it isn’t pretty.

U.S. Judge Hearing Baltimore Police Case Gives Short Shrift To Sessions’s Dilatory Tactics — Moves Forward With Hearing!

“BALTIMORE — A federal judge refused Wednesday to delay a hearing on a proposed agreement to overhaul the Baltimore Police Department, calling the Trump administration’s request a “burden and inconvenience.”

The Justice Department asked for a delay earlier this week, saying it needed time to review the plan and determine whether the proposal would hinder efforts to fight violent crime. U.S. District Judge James Bredar said the hearing would go on as scheduled Thursday.

Hundreds of people are expected to testify about the court-enforceable agreement and special security measures have been put into place, the judge said.

Pushing back the hearing at the last minute would be a “burden and inconvenience to the court, other parties, and most importantly, the public,” the judge said.

Bredar noted that it was “highly unusual” that both the city and the Justice Department had requested the hearing to allow Baltimore residents to publicly comment on the proposed consent decree. To accommodate the throngs of people, other judges cleared their dockets for the day, and the hearing was widely advertised, the judge said.

“The primary purpose of this hearing is to hear from the public,” he wrote. “It would be especially inappropriate to grant this late request for a delay when it would be the public who were most adversely affected by a postponement.”

The position and participation of the U.S. Department of Justice, for better or worse, has historically been taken seriously by Federal Judges. In his brief time in office, AG Jeff Sessions might be on his way to undermining the DOJ’s credibility.

Most Federal Judges, whether conservative or liberal, operate in the “here and now.” Therefore, they might have little time for Sessions’s program of obfuscation and attempting to turn back the clock to the “Pre-Civil Rights Act Era in Alabama,” when the bogus concepts of “states rights” and “local authority” reigned supreme over an unconstitutionally unjust and overtly racially biased society.
