MATAMOROS, Mexico — In the middle of the largest refugee camp on the U.S. border — close enough to Texas that migrants can see an American flag hovering across the Rio Grande — Marili’s children had fallen ill.

Josue was 5. Madeline was 3. The small family was huddled together in a nylon camping tent with two blankets last week when the temperature sank to 37 degrees. The children started coughing, Marili said. Then their fingers and toes turned bright red. The camp’s doctor had begun to see cases of frostbite.

Like most of the roughly 1,600 asylum seekers at the informal camp, Marili and her children had crossed the border into the United States this summer only to be sent back to Mexico to await their asylum cases — part of a year-old U.S. policy called the Migrant Protection Protocols.

In recent weeks, dozens of parents have watched as their children, sleeping outside in the cold, have become sick or despondent. Many decided to get them help the only way they knew how — sending them across the border alone. As Josue and Madeline grew sicker, it was Marili’s turn to make a decision.

These cases illustrate the human toll of the Trump administration’s policy and suggest the United States, Mexico and the United Nations were unprepared to handle many of the unforeseen consequences.

Marili, fleeing gang violence in Honduras, knew that unaccompanied children were admitted into the United States without enduring the MPP bureaucracy and the months-long wait. The 29-year-old mother — who, like others here, asked not to be identified by her last name, for fear it could affect her asylum case — believed that returning home would be suicide. So she bundled up her children in all of their donated winter clothes and scrawled a letter to U.S. immigration officials on a torn piece of paper.

“My children are very sick and exposed to many risks in Mexico,” she wrote. “I don’t have any other way to get them to safety.”

She pressed the letter into Josue’s hand, she said, and pointed the children to three U.S. Customs and Border Protection agents in the middle of the Gateway International Bridge, the span across the Rio Grande that connects Matamoros to Brownsville, Tex.

“Josue told me, ‘Please don’t send us,’ ” Marili said, crying at the memory. “But as a mother, I knew it was the best decision for them.”

Then she sprinted to the bottom of the bridge and watched through the fence as her children turned themselves in, weeping and wondering when she would see them again, hoping they would find their way to her husband. He had entered the United States and applied for asylum before MPP was implemented. He was allowed to stay.

When they filed their asylum claim, they were told to wait in Mexico. There, they say, they were kidnapped.

In the past three weeks, migrants and aid workers say, at least 50 children have made the same crossing. The Washington Post interviewed the parents of 20 of them. On Tuesday morning, three more children were sent over. On Wednesday, another three. From tent to tent, families now talk openly about whether and when they will send their children.

More than 47,000 migrants have been sent back to Mexico since MPP started in January. Through September, 9,974 cases had been completed; only 11 migrants, or 0.1 percent, had received asylum, according to the Transactional Records Access Clearinghouse, or TRAC, a research center at Syracuse University.

“It’s becoming clear to us that this whole thing is a lie,” said Reyna, 38, who sent her 15-year-old daughter, Yoisie, across the border last week. “They tell us to wait and wait and wait, but no one here gets asylum.”

The Department of Homeland Security did not return calls seeking comment.

Asylum seekers began sleeping out in the wooded field here at the base of the international bridge in August. They receive no assistance from the United States or the United Nations. They rely instead on tents, clothing and food donated by a group of American retirees and medical attention from a nonprofit group whose one doctor sits under a blue tarp.

U.N. officials say they were told months ago that the migrants would be moved by the Mexican government to better conditions. It hasn’t happened.

“We started hearing about the situation, but we just didn’t have enough capacity to help,” said Dora Giusti, the head of child protection at UNICEF in Mexico. “And the Mexican government kept saying [the migrants] would be moved out of the state, so we were waiting to see if we could respond there.”

The U.N. refu­gee agency says border cities in Tamaulipas state, where Matamoros is located, “are among the most insecure and dangerous in the country, which has limited our actions on the ground.”

A 19-year-old Salvadoran woman wanted to reunite with her father in California. She was shot dead in Mexico.

The municipal government opened a shelter at an indoor basketball court last month. With a capacity of 300, it’s already full. It’s also miles from the bridge, making it more difficult for migrants to reach the border for their court dates, or to meet with pro-bono lawyers. Every day, the U.S. government sends dozens of migrants to Matamoros under MPP. They are taken directly to the encampment and often sleep outside until they find a tent.

The camp consists of hundreds of tents clustered together on a spit of sidewalk and a stretch of scrubland along the Rio Grande. There are only a few showers, so many people bathe and wash their clothes in the river. Once a dead cow floated by and became lodged next to the camp. Another time, the headless corpse of a man washed ashore.

A cold front settled here for three days last week. Immediately, children started getting sick.

Gabrielle, 15 — from San Pedro Sula, Honduras — started coughing. Sarai, 12 — also from Honduras, from Santa Rosa de Copan — was vomiting. Valeria, 5 — from the Honduran capital, Tegucigalpa — developed a fever and became despondent.

Global Response Management, the Florida-based nonprofit that runs the small medical clinic under the blue tarp, saw a surge in patients, most of them children. The most common cases were respiratory illnesses, said Megan Algeo, the doctor on call at the time. In one case, Algeo said, she persuaded U.S. immigration agents to admit a child for emergency care.

Parents in different parts of the camp decided it wasn’t fair to keep their children here. Some joined a Facebook group called Mothers in Search of Asylum to discuss their options and what would happen if their children crossed the border alone.

“I kept thinking, my daughter is going to die here,” said Blanca, Valeria’s mother.

They all had relatives in the United States. Their idea was to send their children to live with spouses, siblings, cousins while they waited in Matamoros to complete the asylum process. They worried about another cold front, or another flood (there was one in September), or cartel-sponsored kidnappings.

Gabrielle walked across the bridge alone, carrying a plastic bag with her asylum papers. Sarai went with a friend. Valeria and her sister, Anahi, 7, crossed together, holding hands.

All are now in shelters in different parts of the United States. Under U.S. policy, children who enter the country unaccompanied are taken into government custody until authorities can connect them with relatives to whom they can be released.

Glady Cañas, who runs Helping Them Triumph, one of the few humanitarian organizations at the camp, tries to persuade parents not to send their children alone.

“Why did you send your child?” she demanded of Israel, Gabrielle’s father.

Israel, 40, stared at the ground. They were standing in front of his blue tent.

“She was sick,” he said. “We were desperate. A child can’t wait here for a year like this.”

Cañas hugged him.

“I personally don’t agree with what they are doing,” she said later. “A child needs their parents. But when you look around here, you understand the desperation.”

Falling coffee prices drive Guatemalan migration to the United States

For many families here, the children — and the threats against them — were the reason they fled their countries in the first place.

Victor, 28, left El Salvador with his daughter, Arleth, now 10, after she was sexually assaulted by a man affiliated with a local gang. Victor pressed charges. He carries court documents and hospital records that substantiate the case in alarming detail. The man was sentenced to 12 years in prison for “sexual aggression of a minor,” one court transcript says.

As soon as he was sentenced, Victor said, gang members came after the family. In August, they fled.

Victor and Arleth were sent back to Matamoros on Aug. 28, before tents were available. They spent 15 days sleeping outside. Eventually, he found a job in a Chinese restaurant earning $7 per day. He saved up and bought a camping tent.

But after two months, Arleth was sick, vomiting all the time. Their tent had flooded twice in the rain. After her assault, she struggled to remain calm in large groups of people, and she hated walking across the camp to use one of the portable toilets.

Victor took her several times to the Doctors Without Borders nurse who came to the camp twice a week. But she never improved.

Their ancestors fled U.S. slavery for Mexico. Now they’re looking north again.

In late September, on Arleth’s 10th birthday, Victor bought her a cake and five candles. He asked someone in a neighboring tent to take a picture of them smiling.

When her health did not improve, Victor asked her what she thought of crossing alone.

“She told me: ‘Dad, I just want to be out of this place. I want to be in the United States,’ ” he said.

Lawyers working in the camp have recently become aware of the many parents choosing to send their children alone.

“These parents have been forced to consider an unthinkable choice — to save their children by sending them into the U.S. alone or to keep them in northern Mexico, where they will be exposed to severe illness, kidnapping, torture and rape,” said Rochelle Garza of the American Civil Liberties Union of Texas.

During the last week of October, Victor walked Arleth to the edge of the international bridge and watched her shuffle toward U.S. immigration agents.

“We had never been apart,” he said later, crying. “Her entire life, we had always been together. . . .

“People might hear what I did and think I’m a bad parent. But it’s the opposite. I did this for my daughter because we had no other choice to save her.”

For a week he didn’t hear from her. Then she called his mother back in El Salvador. She was at a government shelter somewhere in Texas. The details were hazy.

His mother recorded a message from daughter to father.

“Don’t worry, Dad. I’m okay,” she said. “I hope that soon you’ll be with me.”

He played the message over and over and cried.

“The truth is I don’t have much confidence that my case is going to work out,” he said. “I’m fighting it for her. But I don’t know.”

Alexandra, VA. Nov. 21, 2019. It’s one of the most elementary principles in law: a court has jurisdiction to determine its own jurisdiction. But, in the so-called U.S. Immigration Courts, where individuals are often essentially on trial for their lives, sometimes without the benefit of legal counsel or time to prepare, Department of Justice politicos and DHS prosecutors tell the Immigration Judges what jurisdiction, if any, they possess. 

Thus, in a memorandum issued on November 19, 2019, the Director of EOIR, a non-judicial “mouthpiece” for DOJ politicos that run these unconstitutional administrative “courts,” instructed Immigration Judges on the requirements of clearly fraudulent “Safe Third Country Agreements” put in place by the Administration to deter, punish, and in some cases likely kill asylum applicants in dangerous, non-statutorily-qualifying countries, without credible asylum systems. He told them how and when they could exercise jurisdiction over certain cases and when they only had jurisdiction if DHS prosecutors determined in their sole discretion that it was “in the public interest.”

Remarkably, in the face of a statute that clearly gives individuals a right to apply for asylum in the U.S. “regardless of status,” the DHS now will determine whether in the exercise of their prosecutorial discretion an individual will actually be allowed to apply for asylum before an Immigration Judge. And, that clearly won’t happen often, if at all. 

Otherwise, under blatantly fraudulent “Safe Third Country” agreements, newly arriving asylum seekers will be “orbited” to three of the most dangerous countries in the world — Guatemala, Honduras, & El Salvador — that don’t even have functioning asylum systems. Indeed, these failed states, overrun by gangs and cartels, are among the world’s most notorious “sending counties” for asylum seekers! How would countries that can’t even provide minimal protection for their own citizens and without functional asylum systems possibly provide a safe opportunity for individuals to apply for asylum? Clearly, they won’t.

Of course, the Administration has put out a litany of outrageous lies in support of its fraud. One of the most patently absurd claims is that this illegal scheme will offer asylum applicants “protection in the area” without making the “dangerous journey.” 

But, there is no chance that some of the most corrupt and inept governments in the world, unable to protect their own citizens, would be able to offer reasonable protection to asylum seekers from third countries. Some of the victims of the Trump Administration’s racist malfeasance probably won’t survive long enough to even make their claims. And, there isn’t any credible process for them to apply anyway. It took the U.S. decades to develop the asylum system that Trump has now dismantled. The idea that poor countries with no expertise and resources to devote to the process will be able to adjudicate asylum claims under a comparable “fair” system doesn’t pass the “straight face test.” 

Beyond that 1) the hapless individuals being returned (with no access to counsel) have already made the “dangerous journey;” and 2) the gangs and cartels operate with government acquiescence, cooperation, and/or impunity throughout the small area of the Northern Triangle. Therefore, individuals are likely to be in danger and targeted for harm, kidnapping, extortion, or all three, the minute they set foot in any of these failed states. 

That’s certainly been the experience of those returned to Mexico under the dishonestly named “Migrant Protection Protocols,” more accurately known as the “Let ‘Em Die in Mexico Program.” So outrageously unlawful has this program been that some Asylum Officers and Immigration Judges have resisted or actually quit over being required to engage in illegal acts and human rights violations. 

Yet, a complicit Ninth Circuit Court of Appeals has allowed these deadly attacks on our system of justice and human dignity to continue. Perhaps the “lowlight” of that court’s judicial malfeasance has been the well documented cases of DHS officials issuing fake hearing notices to their victims. Just imagine if those abuses happened to the spouse, son, or daughter of one of the these feckless judges! Judges who place themselves above justice to the humanity they serve are a systemic problem.

There’s also the matter of no transparent procedures being in place to determine what will happen to these individuals and where they will be where housed once “orbited.” Finally, even if against the odds someone actually got asylum in a Northern Triangle country, they clearly would not be “protected” by countries incapable of offering protection to most of their citizens.

By comparison, the one pre-existing “Safe Third Country” agreement with Canada, a country that actually appears to qualify under the statute, bears no resemblance whatsoever to the broadly worded fraudulent agreements with the Northern Triangle countries. The Canadian agreement is carefully circumscribed with many protections and qualifications and applies to only a small number of individuals annually. 

By contrast, the fraudulent agreements with the Northern Triangle potentially apply broadly to individuals from countries like Cuba and Haiti who have never passed through the Northern Triangle and have no connection whatsoever with those countries. That’s because Canada is a real country that negotiated at arm’s length with the U.S. By contrast, the failed states of the Northern Triangle had these bogus agreements shoved down their throats with threats to cut off aid and assistance by corrupt officials like “Big Mac With Lies” McAleenan acting on Trump’s and Miller’s instructions.

But, complying with statutory requirements and protecting asylum seekers under the law never has been an objective of the Trump Administration. Killing and mistreating asylum seekers as a “deterrent” and then feeding the results to a White Nationalist base as “success” is the sole objective of these corrupt programs.

Nobody, and I mean nobody, who understands and cares about honest implementation of U.S. refugee and asylum law could have contemplated in their worst nightmares that we would be discussing the Northern Triangle countries as “Safe Third Countries.” Yet, here we are.

But, perhaps the most amazing and discouraging fact is that in the face of such blatant public fraud and illegal behavior, over and over in disregarding asylum laws and Constitutional requirements, the Article III Federal Appellate Courts, all the way up to the Supremes, have failed to consistently stand up to the dishonest thugs in the Trump Administration who are running roughshod over our asylum laws and our Constitution. They daily ignore the clear unconstitutionality of an Immigration “Court” system that denies individuals the “fair and impartial” adjudicators to which the are entitled under the Fifth Amendment. In the process they are dehumanizing all of us.

The statute purports to bar judicial review of individual claims denied under the “Safe Third Country” exception. But, surely some smart member of the New Due Process Army can come up with a theory to challenge the Constitutionality of such blatantly dishonest and overtly fraudulent agreements that subvert the statute and clearly deny Due Process to individuals within the jurisdiction of the U.S.

And, let’s not forget the Congress where all constructive immigration reforms are blocked by a GOP Senate. In a rational world, Congress would have acted by veto-proof margins to withdraw the Executive’s authority to enter into “Safe Third Country Agreements” in light of the Administration’s well-publicized plans to clearly ignore and abuse the Congressionally-mandated standards. They also would have created independent Article I Immigration Courts outside of the Executive Branch. But, that would be a Congress other than one beholden to today’s GOP and their slavish devotion to Trumpism.

Those involved in negotiating, implementing, enabling, and defending these fraudulent agreements are committing major human rights violations. While there might currently be no ways of holding them legally and personally accountable, the the truth eventually will come out. History will be their judge. And, when all the ugliness, dishonesty, racism, cowardice, and dereliction of legal duties are finally exposed, I wouldn’t want to be in their shoes or the shoes of their descendants who will have to live with the eternal shame of those who abuse and deny the humanity and legal rights of the most vulnerable among us.

MATAMOROS, Mexico — The stench is overpowering. During the day, it seems to bake on the squalid concrete. At dawn, it seeps into the cool air — a suffocating mix of human waste and campfires.

Just steps from Brownsville, Texas, a makeshift tent city is growing next to the international bridge. More than 1,200 migrants — many from Mexico and Central America, others from Cuba — are waiting.

This year, the Trump administration enacted what it calls Migrant Protection Protocols, or MPP. Also known as the “Remain in Mexico” policy, it requires U.S. asylum-seekers to stay in that country while their claims are processed. Before MPP, families would be allowed to wait for their court hearings in the United States.

More than 55,000 migrants have been returned to Mexico under this policy, U.S. Customs and Border Protection officials said — and it’s become a bottleneck at the border.

“This is 100 percent a humanitarian crisis,” Jodi Goodwin, a Texas immigration attorney, said. “These policies are not implemented in a vacuum and there are very real human consequences.”

Carlos, from Honduras was among the migrants who spoke with NBC News and asked not to have his last name used for fear of reprisals. The 27-year-old said he’d been at the makeshift camp for four months with his 2-year-old epileptic son — and he’s struggled to find medical care.

“The most difficult part is when my son has convulsions and I’m alone in the tent,” he said. “It’s happened twice at night and I can’t do anything.”

“We’re sending a message”

According to CBP, apprehensions at the Southwest border have plummeted from 144,116 in May to 45,250 in October. That’s a 68 percent drop.

“Migrants can no longer expect to be allowed into the interior of the United States based on fraudulent asylum claims,” Mark Morgan, the acting commissioner of CBP, said at a White House briefing last week. “We’re sending a message to their criminal organizations to stop exploiting these migrants.”

The Trump administration has argued the change is working because in essence, the Remain in Mexico policy has served as a deterrent for migrants as well as human smugglers.

But immigrants advocates argue that claim is dubious and has merely increased desperation and fear on the Mexican side of the border.

In Matamoros, the Mexican government recently opened a shelter about a 30 minute walk from the international bridge in response to the influx of migrants. But many of the families refuse to stay there because they fear a growing threat from the cartels.

One man, Josué, told NBC News his two young daughters were sexually assaulted by a man he believes was a cartel operative. The girls had been washing themselves in the Rio Grande when he touched them, Josué said. He showed NBC News a police report he’d filed.

“Matamoros is controlled by the cartels and the bad people,” he said. “When I got here, I was really scared.”

So volunteers are taking action. Every day, a group called “Team Brownsville” is among those who bring food and supplies across the border.

As the sun begins to set, migrant families line up for a meal.

“It breaks my heart to see the need here,” said Mary Vanderhoof, a volunteer from New Jersey. “There’s no reason that people should be living like this.”

Sergio Córdova, one of Team Brownsville’s organizers, said he’s been coming here since the summer of 2018. What started as just a few migrants with donated cots has exploded into a full-blown tent city.

“How can you look away?” he asked. “Are we going to be a country that says ‘We looked away?’ Or did we do something?”

Many, in fact, don’t even receive proper notice or timely access to their hearings, a fact patently obvious but ignored by the Ninth Circuit panel. Others shouldn’t even be in the program or receive knowingly “fake hearing notices” from a lawless DHS unleashed by feckless Federal Appellate Judges who won’t do their jobs.

Several U.S. Immigration Judges and a whole bunch of Asylum Officers have put their careers on the line to “just say no” to these outrages! What’s the excuse for the cowardly performance from those given the privilege of life tenure?

The grotesque derelictions of duty by the Supremes and the Ninth Circuit not only enable individual human rights abuses like these every day, but also their failure to require adherence to the Constitution, the Refugee Act, and our international obligations has emboldened the Administration to enter into totally fraudulent “Safe Third Country” agreements that will “orbit” asylum seekers to some of the most UNSAFE countries in the world, without credible asylum systems and without any procedures in place to guarantee their safety and fair treatment.

In the final days before launching a controversial plan to send asylum-seekers arriving at the US border to Guatemala, Department of Homeland Security officials were still scrambling to figure out critical details, including how those seeking protection would obtain shelter, food, and access to orientation services, according to government briefing materials obtained by BuzzFeed News.

Despite the questions, the documents indicate that DHS planned to send 12 asylum-seekers on the first flight to Guatemala, a Central American country that has struggled with violent crime, and was tentatively scheduled to depart on Tuesday.

The materials, drawn up last week for newly appointed acting DHS Secretary Chad Wolf, suggest that department officials were trying to finalize key details regarding the implementation of a complicated proposal to send asylum-seekers arriving at the US border to Guatemala as part of a deal similar to a safe third country agreement.

The plan has been highlighted by the Trump administration as a key element in its strategy to deter migration at the border and another method to restrict asylum-seekers from entering the US.

“There is uncertainty as to who will provide orientation services for migrants as well as who will provide shelter, food, transportation, and other care,” read the DHS brief, drafted for Wolf in the run-up to a meeting Friday with Guatemala’s Interior Minister Enrique Degenhart. The implementation plan spelled out that Guatemala would provide the services but recently there had been “confusion” as to whether that would happen, according to the materials.

Wolf was urged to raise the issues with Degenhart in their meeting and clarify the outstanding issues.

“The U.S. needs confirmation from the [Government of Guatemala] that they will provide shelter, transportation, and food,” the briefing materials read. “If not, the U.S. and [Government of Guatemala] need to brainstorm other avenues of assistance.”

It is unclear if the planned flight is still scheduled to take off.

Trump administration officials have said that partnering with countries in Central America ultimately benefits the US by cutting down on the number of asylum-seekers attempting to make the journey to the US. Advocates counter that such agreements place vulnerable populations in countries that lack systems for adequate asylum processing and have high murder rates and rampant crime.

Guatemala is one of the poorest countries in the Western Hemisphere and has the sixth-highest rate of malnutrition in the world. Nearly half of the country suffers from chronic malnutrition, with the prevalence reaching about 70% in some indigenous areas of Guatemala, according to a 2018 report from USAID.

The country has struggled with violence but has seen a drop in murders in recent years, with a homicide rate of 22.4 per 100,000 people. By comparison, the US had a homicide rate of 5.3 per 100,000.

A recent United Nations report also found that about 98% of crimes in Guatemala went unpunished in 2018.

The government posted regulations on Monday that clear the way for asylum officers to begin screening asylum-seekers under the plan. The interim final rule, which takes effect Tuesday, creates a process for asylum-officers to screen migrants thrust into the plan. In short, unless an asylum-seeker can prove it is “more likely than not” that they will be persecuted or tortured in Guatemala, they will be removed to the country to obtain protections there.

Administration officials have previously told congressional staffers that more than 200 individuals had applied for asylum in Guatemala, but only 18 had been processed.

While DHS officials have in the past heralded the involvement of the United Nations High Commissioner for Refugees in helping build up Guatemala’s nascent asylum system, the briefing materials suggest that those efforts have been rocky, at best.

“It is our understanding that for some time now there has been friction between the [Government of Guatemala] and UNHCR regarding UNHCR’s role in the implementation” of the plan, according to the briefs. The UN has told US government officials it would provide orientation services for asylum-seekers who have been sent back to Guatemala.

But Guatemalan officials have told the US that UNHCR would not have access to their “reception centers and asylum programs.”

On Saturday, Reuters reported that US officials said asylum-seekers forced into the plan would not be flown to remote areas of Guatemala, an option the Central American country had proposed.

“All airports are being analyzed,” Degenhart told Reuters. “There are some that’ll qualify but others that won’t.”

The agreement could be one way for the Trump administration to attempt to safeguard a potential court overturn of its policy banning asylum for those who cross through a third country.

While the Supreme Court allowed for the policy to continue while the case continues in a federal appeals court challenge, it’s unclear whether the justices or the federal appellate court will ultimately side with the Trump administration.

So, the Supremes and the 9th Circuit are “ruminating” about these issues while folks are dying or being sent off to oblivion by an Administration notorious for its operational incompetence and its bad faith approach to immigration and asylum laws. How is that a “Safe Third Country” or a “right to apply for asylum regardless of status?” How is that performing the judicial duties for which they supposedly are being paid?

Meanwhile, corrupt immoral Administration officials are out there touting these programs as “deterrents” — not a means of fair adjudication or actual protection under our laws and international Conventions. So, why are Federal Appellate Judges and Supreme Court Justices so oblivious to truth? 

Hopefully, law schools are bringing up a new generation of lawyers that pay more attention to ethics, take the time to understand the human side of the law, and who will be courageous enough to stand up for individuals’ human rights against Government overreach. Obviously, too many of the preceding generations of “lawyers turned appellate judges” flunked on all counts.

Maybe a period of time representing migrants pro bono should be an absolute requirement for future Federal Judicial appointments. No matter how you look at it, we’re experiencing an institutional meltdown in the Federal Appellate Judiciary that, when combined with a lawless authoritarian Administration run wild, is endangering both our country and humanity.

El Salvador is one of the world’s most violent and deadly places, similar to those of active war zones. The high level of violence is largely due to organized crime and rampant gang activity — and it’s what drives people to flee for their lives. Here are some startling facts:

  • There were more than 9.2 homicides per day.
  • Approximately 10 people each day disappear.

So why are we not only returning vulnerable women, children, and families to El Salvador, but, outrageously, also trying to send asylum applicants from other countries there, even though the Administration knows full well:

 

  • It isn’t “safe,” by any definition;
  • It’s a hellhole where gangs, narcos, and corrupt government officials aligned with them are in control of much of the country;
  • It doesn’t even have a functioning asylum system; and
  • It can’t protect and support its own population, let alone tens of thousands of refugees from other countries that the U.S. intends to “outsource” there.

These outrageous shams are some of the “proud legacy” that folks like “Big Mac With Lies” leave behind. And the new DHS honchos, Wolf and “Cooch Cooch,” have promised to be even more cruel, racist, and scofflaw.

Remember the truth and the facts the next time you hear a dishonest Trump official falsely claim that the only reason folks are fleeing for their lives is to take advantage of “loopholes” in US. law.

When thousands of migrant children ended up stranded in U.S. Border Patrol stations last spring, President Trump’s administration characterized the crisis as a spontaneous result of the record crush of migrants overwhelming the U.S. immigration system. But the backup also was a result of policy decisions that officials knew would ensnare unaccompanied minors in bureaucratic tangles and leave them in squalid conditions, according to dozens of interviews and internal documents viewed by The Washington Post.The policies, which administration officials began pursuing soon after Trump took office in January 2017, made it harder for adult relatives of unaccompanied minors to secure the children’s release from U.S. custody. Enhanced vetting of sponsors — including fingerprints and other paperwork — and the sharing of that information between child welfare and immigration authorities slowed down the release of children and exposed the sponsors to deportation.

The government knew the moves would strain child shelters, according to documents and current and former officials, but it was aimed at sending a message to Central American migrants: Coming to the United States illegally has consequences.

Administration officials said the policy was designed to protect children from potential abusers or criminals, but they also wanted to create a broad deterrent effect; they reasoned that undocumented migrants might hesitate to claim their children for fear of being deported. Authorities weighed deterrence — a central aspect of U.S. immigration policy under both President Barack Obama and Trump — against the possibility of children crowding into border stations. And they chose to push forward, knowing what would result.

“This will strain bed capacity,” authorities wrote in a discussion paper in February 2018.

The approach caused thousands of unaccompanied minors to be stranded in U.S. custody and exacerbated the appearance of a crisis on the southern border — a major element underlying the administration’s public request for billions of dollars in additional funding from Congress.

Lawyers were allowed to visit children in the border stations, and Democratic lawmakers were invited to tour the facilities when they were at their worst. They witnessed — and shared with the public — scenes of desperate children held in crowded cells without basic necessities.

According to current and former government officials, and emails and memos detailing the Trump administration’s strategy, it is clear they knew that without enough beds in government shelters, children would languish in Border Patrol stations not equipped to care for them, making the government a target of lawsuits and public criticism — both of which occurred.

One of the key figures in that strategizing, Chad Wolf, is set to take the helm at the Department of Homeland Security. Senators on Tuesday are expected to first vote on Wolf’s confirmation to his current job as undersecretary for strategy, policy and plans. Wolf is Trump’s favored pick to then take over as acting head of the agency, just as officials brace for what could be another increase in migrant crossings.

Top DHS officials have warned that the reprieve from the record influx of migrants in recent months is probably temporary. Acting Customs and Border Protection commissioner Mark Morgan said last month that the number of people crossing the border is still higher than at the same time last year and remains a “crisis.” Migration also typically increases in the spring, and the U.S. government is preparing for another surge of families and unaccompanied minors.

Such a potential wave of children is what inspired the early discussions about policy changes within the Trump administration in 2017 — along with debate about the policy’s effects.

‘Safety’ vs. ‘anguish’

Staff at the Department of Health and Human Services’ Office of Refugee Resettlement, which is in charge of caring for unaccompanied migrant children, argued against the policy in weekly memos during the summer of 2017. Jonathan White, then deputy director of the ORR’s children’s program, warned in a July 2017 memo that the administration’s plan to separate children from their families and to alter the process of handing children over to sponsors would “result in significant increases” in how long children would be held.

White wrote that children would spend an average of 95 days in federal custody and that the department would need at least 6,500 additional beds in just three months. White declined to comment for this story.

Documents reviewed by The Post show that officials also estimated that HHS would need an additional $686 million in funding — more than 50 percent above its planned budget — to accommodate the policy and create additional bed space.

But the administration did not formally request extra money for that purpose at the time, according to senior Democratic and Republican congressional aides who spoke on the condition of anonymity to discuss private negotiations.

Mark Weber, an HHS spokesman, did not dispute those details but maintained that the border backups resulted from a historic influx of unaccompanied children. In May alone, 9,000 children were referred to the government’s care, he said.

Administration officials also thought the backlog would be short-lived.

“At some point in FY19, the deterrent effect of the new policy should stop families and unscrupulous adult aliens from using the reunification process, normalizing and reversing the volume trend” of unaccompanied minors arriving at the border, authorities wrote in a discussion paper that the National Security Council shared with senior administration officials. The paper was shared with an interagency group that met regularly in the White House Situation Room to discuss immigration and border security.

Some senior officials acknowledged in interviews that they expected some children to remain in custody for longer periods of time, but they said the policy was developed with child safety in mind; they did not want children to be released to smugglers or criminals.

“My number one concern on this was making sure that kids were safe,” Tom Homan, former acting director of U.S. Immigration and Customs Enforcement, said in an interview. “I know it’s a tough decision. It was never easy. You have to weigh the operational concerns, and the humanitarian concerns, and how long they’re going to stay in detention. . . . Yeah, it was going to increase the bed stay, but it wouldn’t be like twofold, threefold, fourfold. We thought it was worth a try, and it if doesn’t work, we can always pedal back and change gears.”

Acting ICE director Matthew Albence said the policy was part of the “deterrent effect” the government was seeking: “The goal was to prevent these children from coming on this dangerous journey.”

Albence, Homan and other Trump administration officials say the backlog arose because of Washington politics, blaming Democrats in Congress for being too slow to authorize funding for more shelter beds at facilities designed to care for children.

“No one who values child welfare and safety would argue smuggled, exploited and unaccompanied children at the southern border should be handed over to illegal alien ‘sponsors’ without reliable identity confirmation and background checks,” said deputy White House press secretary Hogan Gidley. “The only ones responsible for crowded shelters are Democrats who want to preserve and expand loopholes used by child smugglers for purely political purposes.”

A few months after the policy was implemented, HHS officials determined that it was not improving child safety. They concluded that the added vetting was redundant and needlessly extended the time children remained in custody, according to internal documents that ORR Deputy Director Jallyn Sualog presented to Congress, and to testimony on Capitol Hill.

Advocates saw a darker motive in policies that they say were “intentionally developed to inflict maximum anguish on children,” said Heidi Altman, of the National Immigrant Justice Center. She said officials knew that their plans “would trigger a chain of events that left children hungry, abused and sick in overcrowded CBP facilities.”

Democrats likewise have argued that the White House set up the crisis. Rep. Rosa L. DeLauro (D-Conn.), presiding over a House Oversight subcommittee hearing last month, noted that it had always been possible for the government to ease conditions but that officials chose not to.

“We did not have to have a backlog. We did not,” DeLauro said. “That was created.”

Tightening the rules

The Department of Homeland Security did a test run of the policy in the summer of 2017, instructing border agents to interview young migrants about the relatives they wanted to live with in the United States. They then created “target folders” for those adults that could be used to take action against them, according to internal emails that the American Immigration Council obtained via the Freedom of Information Act and made available online.

 

At the ORR, then-director Scott Lloyd was thinking about the administration’s “moral imperative” to protect children from smugglers and to ensure that gangs were not exploiting the child shelter system to enter the country.

“Our legal responsibilities are child welfare,” Lloyd said in an interview. “But even from a child welfare perspective, it’s desirable to deter people from taking that risk, putting their kids in that type of harm.”

Lloyd said he and his staff agreed that better communication between his agency and DHS was the best way to address those concerns.

“We needed to know if a kid had any gang ties or gang ties in their family — we needed to make sure that DHS had that information and that we had that information,” Lloyd said.

The partnership was formalized in an agreement that mandated significantly stricter fingerprinting and screening requirements for all adults who hoped to sponsor a migrant child or who lived in a house where a migrant child might stay.

“If this could get finalized and implemented soon, it would have a tremendous deterrent effect,” Gene Hamilton, counsel to then-attorney general Jeff Sessions, wrote in notes he sent by email in December 2017 to Wolf, the senior DHS official who is now in line to take over as acting secretary. The existence of the notes — but not the identity of the authors or the recipients — was first reported by NBC News.

Wolf declined to comment.

Alexei Woltornist, a Justice Department spokesman, said the agreement was just one of “numerous steps” to prevent the victimization of children: “Ending the trauma these children can face requires taking action against all parties who entrust criminals and cartels to transport their children across the border.”

HHS Secretary Alex Azar and then-DHS secretary Kirstjen Nielsen — the two department heads tasked with carrying out the policy — voiced serious concerns, according to two officials familiar with the discussions. They worried that the agreement would be impossible to implement, could lead to longer detention times for children and would be viewed publicly as unnecessarily harsh, said the officials, who spoke on the condition of anonymity to discuss internal policy deliberations.

Caitlin Oakley, an HHS spokeswoman, did not dispute that account, but she said in a statement that Azar “supports the Trump administration’s goal of enforcing immigration laws and securing the border.”

“The backup at the border of minors witnessed this summer was the consequence of a broken immigration system,” Oakley added.

Nielsen declined to comment.

One HHS employee who spoke on the condition of anonymity to discuss internal matters recalled Lloyd telling staffers that the White House wanted them “to do everything you can to prevent backups into border stations. But it is better that there be a backup in a border station than that we not enforce immigration laws and that we not deter migration.”

Lloyd denied that account.

“I don’t ever recall holding, even temporarily, the idea that backups at border stations was a remotely acceptable scenario,” Lloyd said.

Internal memos show that for months before implementing the policy, government lawyers worried about lawsuits and discussed ways to claim that the policy would make children safer. In a January 2018 draft memo, viewed by The Post, Justice Department lawyers proposed defending the plan to conduct enhanced background checks and share them with enforcement agents as a means of protecting migrant children from witnessing the eventual deportation of their parents or relatives.

“We can argue that whether a proposed sponsor is subject to removal is a key factor in determining suitability, given the impact that immigration enforcement against, or detention of, a sponsor would have on the circumstances faced by” unaccompanied minors living with the sponsor, Justice Department lawyers wrote in January 2018 correspondence with DHS and HHS officials as part of an “analysis of litigation risk” associated with the agreement.

Federal judge blocks Trump administration from detaining migrant children for indefinite periods

The administration also developed and rolled out its family separation policy in the spring of 2018, part of its “zero tolerance” approach at the border. The months-long initiative, which separated thousands of children from their parents, compounded the need for shelter space. After a public outcry, the administration ended the policy.

By the fall of 2018, most of the families had been reunited, and the number of unaccompanied children crossing the border had fallen, but the population of children in the shelters continued to grow, according to HHS data. By October 2018, migrant children were spending an average of more than 90 days in federal custody — exactly as White had predicted — more than twice the length of stays two years earlier.

While some adult migrants were afraid to come forward to claim their children, the contractors tasked with carrying out the background checks and fingerprinting were overwhelmed, according to current and former HHS officials. The American Civil Liberties Union and other advocates filed lawsuits challenging the policy, arguing that parents waited months for fingerprinting results.

Time in custody grows

Kevin Dinnin, the head of the nonprofit that operated a shelter for migrant children in Tornillo, Tex., said the crush of minors became increasingly severe through late 2018, and he told the agency he could not continue. Images of teenagers behind chain-link fences shuffling single-file from tent to tent had drawn public outrage, and Dinnin could not understand why children continued arriving at the shelter even though migrant crossings had slowed and family separations had ended.

“The problem was, kids were coming and not being discharged,” Dinnin said. “The average length of stay just kept increasing.”

An HHS official who spoke on the condition of anonymity to discuss sensitive policy decisions said the agency would never have opened the Tornillo shelter had it not been for the agreement with DHS.

“It was the increase in average length of care that created a need for thousands of beds,” the official said.

U.S. returns 100 migrant children to overcrowded border facility as HHS says it is out of space

HHS career staff members decided that the agency had no choice but to eliminate some aspects of the background checks to relieve the pressure on the system. To avoid roiling the White House, they slowly rolled back the policy through several “operational directives” over a period of months, according to current and former HHS officials.

The agency announced that it would stop fingerprinting all adult members of a sponsor’s household in December 2018, and the government then quickly released thousands of children from custody. The Tornillo shelter closed a few weeks later.

But with the agency still fingerprinting sponsors, some children continued to languish in custody for months, especially when migrant crossings surged again in the spring. Children apprehended at the border were left in Border Patrol stations as a result.

Democratic lawmakers, lawyers and advocates toured Border Patrol stations in late spring and early summer and delivered scathing descriptions of the suffering they witnessed. DHS and HHS officials pleaded with Congress for more money, saying they had been blindsided by the numbers. HHS canceled English classes, soccer and legal aid for migrant children, citing inadequate funds.

In June, Congress approved a $4.6 billion emergency border spending package, shortly after hearing the government’s pleas about what they described as a humanitarian crisis at the border.

Officials credited the subsequent release of hundreds more children to the aid package. But in court documents and congressional testimony, they acknowledged that moves to scale back the enhanced background checks had made the difference. Those included a final directive in June to stop fingerprinting aunts, uncles and grandparents seeking custody of migrant children, speeding up the release of more than 1,000 children in a matter of weeks and allowing the emergency shelter in Homestead, Fla., to close.

“I do support the four operational directives in order to expedite the release of children to properly vetted sponsors,” ORR Director Jonathan Hayes said at a congressional hearing in July. “I want to see the children back with their families.”

Officials have argued that shortening the time that children are held in federal custody will boost the incentive for migrant families to seek entry into the United States.

“The shorter the stay, the more likely they’re willing to take it on,” Homan said. “If I think I’ll be detained for a year, I might not come. But if I’ll be detained for a week and be released, that may convince me to make that trip.”

The Trump Administration continues to intentionally misrepresent the conditions in the Northern Triangle that are sending families and children in flight to the U.S., notwithstanding their knowledge of the dangers and the overt cruelty and racism of the Trump Administration directed against them.

While the Trump Administration keeps on putting forth the knowingly false narrative that this “crisis” is caused by “loopholes” in U.S. law, that’s demonstrably untrue. Obviously, the increasing number of child refugees is part of a tragic worldwide phenomenon having no causal relationship to U.S. laws or court decisions. It’s a result of conditions in the sending countries and won’t be stopped or prevented by unilateral actions on the part of receiving countries, even extreme cruelty.  The phenomenon might, however, be increased by the overtly anti-refugee policies and statements of the Trump Administration and the actions of the Trump Administration in coddling dictators and tyrants, which actually produces more child refugees.

Also, what about the criminals over at HHS who have abandoned their Congressionally-assigned duty to protect and look out for the best interests of children for a White Nationalist, racist, nativist enforcement policy that targets kids. When folks like Alex Azar & company are sent packing from Government some day, remember for what they really stand!

Roberto the coyote can see a stretch of border fence from his ranch in Ciudad Juarez, Mexico, about a mile south of El Paso. Smuggling drugs and people to “el otro lado,” the other side, has been his life’s work.

There’s always a way, he says, no matter how hard U.S. President Donald Trump tries to stop the flow. But this year’s crackdown has made it a tougher proposition. A deadlier one, too—especially for women and children, who are increasingly dying in the attempt.

Not much surprises Roberto, who asks not to be identified by his surname because he engages in illegal activity. Sitting on a creaky metal chair, shaded by quince trees and speaking above the din from a gaggle of fighting roosters, the 65-year-old grabs a twig and scratches lines in the sand to show how he stays a step ahead of U.S. and Mexican security forces.

Here’s a gap in the fence that migrants can dash through—onto land owned by American ranchers in his pay. There’s a spot U.S. patrols often pass, so he’s hiring more people to keep watch and cover any footprints with leaf-blowers.

Roberto says he was taken aback in July this year, when he was approached for the first time by parents with young children. For coyotes, as the people-smugglers are known in Mexico, that wasn’t the typical customer profile. Roberto asked around among his peers. “They were also receiving a lot of families,” he says. “Many, many families are crossing over.”

That helps explain one of the grimmer statistics to emerge from all the turmoil on the U.S.-Mexican border.

Even more than usual, the 2,000-mile frontier has turned into a kind of tectonic fault line this year. Poverty and violence—and the pull of the world’s richest economy—are driving people north. At the border, they’re met by a new regime of tightened security and laws, imposed by Trump in tandem with his Mexican counterpart, Andres Manuel Lopez Obrador, also known as AMLO.

Some give up and go home; some wait and hope—and some try evermore dangerous ways to get through.

Nineteen children died during attempted crossings in the first nine months of 2019, by drowning, dehydration or illness, according to the UN’s “Missing Migrants” research project. That’s up from four reported through September 2018 and by far the most since the project began gathering data in 2014, when two died that entire year. Women are dying in greater numbers, too—44 in the year through September, versus 14 last year.

Many of those families are fleeing crime epidemics in Central America, as well as economic shocks. Prices of coffee—a key export—in the region plunged this year to the lowest in more than a decade, crushing farmers.

Making matters worse, climate change will produce more frequent crop failures for those growers that will, in turn, drive more migration, said Eleanor Paynter, a fellow at Ohio State University. “Asylum law does not currently recognize climate refugees,” she said, “but in the coming years we will see more and more.”

The demand side is equally fluid. When the Great Recession hit in 2007, a slumping U.S. economy led to a sharp drop in arrivals from Mexico and Central America. Today, the reverse is true: Record-low unemployment in the U.S. is attracting huge numbers from Central America.

But none of those factors fully explains why so many families are now willing to take such great risks. To understand that, it’s necessary to go back to the birth of the “Remain in Mexico” policy in January, when new U.S. rules made it much harder to seek asylum on arrival—and its escalation in June, when Trump threatened to slap tariffs on Mexican goods, and AMLO agreed to deploy 26,000 National Guard troops to the border.

The crackdown was aimed at Central Americans—mostly from such poor, violent countries as El Salvador and Honduras—who’d been entering the U.S. through Mexico in growing numbers. Many would cross the border, turn themselves in and apply for asylum, then wait in the U.S. for a court hearing. That route was especially favored by migrants with young children, who were likely to be released from detention faster.

Under the new policy, they were sent back to Mexico by the tens of thousands and required to wait in dangerous border towns for a court date. They might wait in shelters for months for their number to be called, with only 10 or 20 families being interviewed each day. Word was getting back that applications weren’t being approved, anyway.

That pushed thousands of families into making a tough decision. Juan Fierro, who runs the El Buen Pastor shelter for migrants in Ciudad Juarez, reckons that about 10% of the Central Americans who’ve stayed with him ended up going back home. In Tijuana, a border town hundreds of miles west, Jose Maria Garcia Lara—who also runs a shelter—says some 30% of families instead headed for the mountains outside the city on their way to the U.S. “They’re trying to cross,” he says, “in order to disappear.”

The family that approached Roberto in Ciudad Juarez wanted to take a less physically dangerous route: across the bridge into El Paso.

Roberto has infrastructure in place for both options. He says his people can run a pole across the Rio Grande when the river’s too high, and they have cameras on the bridge to spot when a guard’s back is turned. He has a sliding price scale, charging $7,500 for children and an extra $1,000 for Central Americans—fresh proof of studies that have shown smugglers’ prices rise with tighter border controls. “They pay a bundle to get their kids across,” he says. “Why don’t they just open a small grocery with that money?”

Typically, migrants don’t come from the very poorest communities in their home countries, where people struggle to cover such coyote costs, or from the middle class. Rather, they represent a range from $5,000 to $10,000 per capita in 2009 dollars, according to Michael Clemens, an economist at the Center for Global Development in Washington. This happens to be the level that the economies of El Salvador, Honduras and Guatemala have reached.

For the family going across the bridge into El Paso, Roberto wanted to send the parents and children separately, to attract less attention. Ideally, the kids would be asleep, making the guards less likely to stop the car and ask questions. But that raised another problem. He resolved it by arranging for a woman on his team to visit the family and spend three days playing with the children. That way, they’d be used to her and wouldn’t cry out if they woke up while she was taking them across.

Roberto says the family made it safely into the U.S. with their false IDs, a claim that couldn’t be confirmed. He earned about $35,000 from the family, and soon after had another three children with their parents seek passage. “They want to cross, no matter what,” he says. “I don’t know where the idea comes from that you can stop this.”

But people are being stopped and turned back, and the number of migrants caught crossing the U.S. border has plunged from its peak in May. That has allowed Trump to portray the new policy as a success. (Mexican officials tend to agree, though the Foreign Ministry didn’t respond to a request for comment.) Yet it’s not that simple. Andrew Selee, president of the Migration Policy Institute, said the flow northward initially surged because Trump threatened to close the border, setting off a wave of migrant caravans and smuggling activity. Arrests rose 90% through September from a year earlier, but they’re now at the same levels they were before the surge.

Enrique Garcia was one of those arrested. A 36-year-old from Suchitepequez in Guatemala, he was struggling to feed his three children on the $150 a month he earned as a janitor. So he pawned a $17,000 plot of land to a coyote in exchange for passage to the U.S. for him and his son.

They slipped into Mexico in August on a boarded-up cattle truck, with eight other adults and children, and drove the length of the country, to Juarez. The coyotes dropped them by car at the nearby crossing point called Palomas, where they literally ran for it.

After 45 minutes in the summer heat, Garcia was getting worried about his son, who was falling behind and calling out for water. But they made it past the Mexican National Guard and gave themselves up to a U.S. border patrol, pleading to be allowed to stay. Instead, they were sent back to Mexico and given a January court date.

Garcia, who recounted the story from a bunk bed in a Juarez shelter, said he was devastated. He couldn’t figure out what to do for five months in Mexico, with no prospect of work. His coyotes had managed to reestablish contact with the group, and most of them—with children in tow—had decided to try again. This time, they wouldn’t be relying on the asylum process. They’d try to make it past the border patrols and vanish into the U.S.

But Garcia decided he’d already put his son’s life at risk once, and wouldn’t do it again. He scrounged $250 to take the boy home to Guatemala. Then, he said, he’d head back up to the border alone. He wouldn’t need to pay the coyotes again. They’d given him a special offer when he signed away his land rights—two crossing attempts for the price of one.

Researchers say there’s a more effective deterrent to such schemes: opening more lawful channels. Clemens, at the Center for Global Development, noted that illegal immigration from Mexico dropped in recent years after U.S. authorities increased the supply of H-2 visas for temporary work, almost all of them going to Mexicans—a trend that’s continued under Trump.

The current debate in Washington assumes that “hardcore enforcement and security assistance in Central America will be enough, without any kind of expansion of lawful channels,” Clemens said. “That flies in the face of the lessons of history.”

A hard-security-only approach deters some migrants, while channeling others into riskier routes where they’re more likely to die. That’s what happened after Europe’s crackdown on migration from across the Mediterranean, according to Paynter at Ohio State, who’s studied data from the UN’s “Missing Migrants” project. In 2019, “even though the total number of attempted crossings is lower, the rate of death is three times what it was,” she said.

As for Roberto, he expresses sadness at the children who’ve died trying to cross the U.S.-Mexico border. He claims he would’ve tried to help them, even if they couldn’t pay.

Most of all, he sees no end to the ways he can make profits off the border crackdown. He makes a joke out of it.

“I’m hearing Trump wants to throw crocodiles in the river,” he says. “Guess what will happen? We’ll eat them.” And then: “Their skin is expensive. We’ll start a whole new business. It’ll bring in money, because we’ll make boots, belts and wallets. We’ll look real handsome.”

At detention facilities, legal rights ‘in name only’

Whether we call them ‘concentration camps’ or detention centers, the lack of justice for those seeking refuge must end.

As President Donald Trump prepares to pick a new secretary for the Department of Homeland Security, Rep. Alexandria Ocasio-Cortez, D-N.Y., is preparing to appear in a Brooklyn court. She is being sued for blocking a man on Twitter who criticized her for calling immigration detention sites “concentration camps.” Her opponents seized on the comment. One of their talking points: America’s hardworking immigration officers should not be equated with Nazis.

To some extent, I can understand their perspective.

I recently visited four Immigration and Customs Enforcement (ICE) detention sites across the country. I met many of their workers. They carried clear plastic backpacks and lunchboxes as they filed through security in the morning, looking weary and bored. As I left each site, some asked me whether I had had a “nice visit” and wished me safe travels.

These workers don’t bring to mind cinematic villains. Yet they are part of a system that, no matter its appearances, is inflicting the horror of trapping people inside.

I saw it in the eyes of the people I interviewed in detention. A 28-year-old Cuban woman told me about spending five days sleeping on the ground in an outdoor cage run by Border Patrol, the “perrera” — a place for dogs. That was followed by 17 days in the “hielera,” a frigid room. She had been denied a shower the entire time.

She recounted this months later, when I met her at an ICE detention site in Adams County, Mississippi. She had not seen or talked to her husband for months, since U.S. authorities separated and detained them. She said that last summer, an asylum officer interviewed her and determined that her fear of persecution if she returned to Cuba was credible — the first step in an asylum case. But she said she had never seen a judge, had no court date, no lawyer, no ICE officer assigned to her. She was alone and trapped: She had no idea of what would happen to her next, how to move her asylum case forward and whether she would ever be released.

Adams County is part of the immigration detention boom. Detention levels have skyrocketed to a record high of about 50,000 people a day, at an annual cost of more than $2 billion. Counties are grabbing at detention contracts that provide jobs, although many will be filled by out-of-town residents. New detention sites are opening in the Deep South — hours from urban areas with networks of pro bono or low-cost attorneys. Even in big cities, the number of people detained far outpaces the number of attorneys available to help them. The result is that these immigration jails are effectively legal black holes, where legal rights often exist in name only.

“You come to this place and you can never win,” another woman told me. She had spent three months in an ICE detention center near Miami, separated from her then 5-month-old baby. Her husband, a U.S. citizen, was driving her to Walmart when local police questioned them during a random traffic stop. She was not accused of a crime, and she was in the process of petitioning for residency based on her marriage to a citizen. But police took her to a local jail and held her for ICE.

“I haven’t seen my baby in three months,” she said, and asked me what would happen to her.

Without a lawyer, she is likely to remain in detention for months or years — and ultimately be deported away from her husband and child. Just 3% of detained individuals without a lawyer succeeded in their cases, compared with 74% of nondetained and represented individuals who won in theirs, according to a study that focused on New York immigration cases. For asylum-seekers, the stakes are often life or death.

Yet immigrants have been denied the right to a government-appointed lawyer in their deportation proceedings. I met many who didn’t have enough money to make a phone call from prison, let alone pay a lawyer. Even those who could afford it struggled to find one, since they are stuck on the inside without access to Google, email or a cellphone.

POLICING THE USA: A look at race, justice, media

Our immigration system is set up for them to fail, with Kafka-esque limits on their ability to apply for legal relief and appeal to federal courts. Navigating this complex and unforgiving set of legal rules is hard for lawyers, let alone for detained individuals. Some are offered release on bond, but in unaffordable amounts like $25,000.

Many people I met had never seen a judge, several months into their detention. They had no idea how or when they might ever be free. They were confused, scared and, in some cases, suicidal. A woman from Cameroon who fled its ongoing civil war after her father was murdered told me she prayed that God would provide her a way out.

We have an obligation to respond.

Local governments should end ICE detention contracts, if they exist, and prohibit new ones. Cities and states should robustly fund free legal service providers and bond funds. Major law firms should send their lawyers to the Deep South to work with local pro bono providers to address the drastic shortfalls in legal services. Community groups should lobby Congress to cut funding for detention and pass comprehensive reform legislation like the Dignity For Detained Immigrants Act.

Trump’s new Homeland Security secretary is likely to ramp up immigration detention to even higher levels, using the specter of prison to deter people from coming here and the reality of it to punish those who do. We cannot afford to be divided by semantics.

Whatever we call them, America’s immigration prisons are antithetical to the free society we claim to be. We must do all we can to dismantle this system.

A private prison guard physically assaulted a five-year-old boy at an immigration detention center in Texas, according to a complaint filed with the Department of Homeland Security (DHS).

She raised her niece like a daughter. Then the US government separated them at the border

Advocates for the boy and his mother expect the family to be deported on Friday and asked the US government to halt the deportation to investigate the alleged assault. The advocates also said the family, who are anonymous for safety reasons, face imminent harm or death in their home country of Honduras.

The alleged assault occurred in late September, when the boy was playing with a guard employed by the private prison company CoreCivic who had played with the boy before.

The five-year-old tried to give the guard a high-five, but accidentally hit him instead, angering the guard, according to a complaint seen by the Guardian. The guard then allegedly grabbed the boy’s wrist “very hard” and would not let go.

“The boy’s mother told the guard to let go and tried to pull her son’s hand away, but the guard kept holding on,” according to the complaint. “He finally released the boy and threatened to punish him if he hit him again.”

The complaint said the boy’s hand was swollen and bruised and he was treated with pain medication and ice at the South Texas family residential center in Dilley, in a remote part of the state about 100 miles from the US-Mexico border.

The Dilley detention center has been controversial since it opened in 2014. Dilley can hold 2,400 people, the most of any family detention center in the country, and in March 2019 held at least 15 babies under one year old.

“Since the assault, the boy is afraid of male officials at the jail, goes to the bathroom in his pants, bites his nails until they bleed, and does not want to play, sleep, eat, or bathe,” the complaint said.

The Guardian contacted US Immigration and Customs Enforcement (Ice), the homeland security agency which oversees immigration detention, and CoreCivic for comment, but they had not provided a response at the time of publication.

Katy Murdza, advocacy manager for the Dilley Pro Bono Project, which sends volunteers into the Dilley detention center to help families, met with the mother on Wednesday.

Murdza said the mother is fearful of her imminent deportation and is upset about what happened to her son because she had little power to protect him.

“She was unable to prevent someone from hurting her child and while she has tried to report it, she hasn’t received any information on what the results are, so she still does not have control of whether the detention center let that staff member back in,” Murdza said.

“When people are detained and it’s hidden from the public, these sorts of things happen and there are probably many other cases that we have never learned about that could be similar to this,” Murdza added.

The American Academy of Pediatrics said in March 2017 that no migrant child in the custody of their parent should ever be detained because the conditions could harm or retraumatize them.

The US government can release asylum-seeking families in the US while they wait for their cases to be heard in court, but Donald Trump’s administration favors expanding detention and has tried to extend how long children can be held in detention centers.

Katie Shepherd, national advocacy counsel with the American Immigration Council’s Immigration Justice Campaign, filed the complaint on Thursday with the DHS watchdog, the office of the inspector general, and with its office for civil rights and civil liberties.

“The government has a long history demonstrating it’s not capable of holding people in their custody responsibly and certainly not children who require special protections and safeguards,” Shepherd said. “They require a different environment, not one where guards are going to be physically abusing them.”

Despicable John Kelly – Profits from Detention of Children

I was recently reminded of how John Kelly, former DHS Secretary and former White House Chief of Staff, is now on the board of Caliburn International: the conglomerate that runs detention facilities for migrant children. He is despicable. This was reported in May:

Former White House Chief of Staff John Kelly can now count on a second line of income.

In addition to his attempt at scoring paid speaking gigs, Kelly has now joined the board of Caliburn International, the company has confirmed to CBS News. Caliburn is the parent company of Comprehensive Health Services, which operates four massive for-profit shelters that have government contracts to house unaccompanied migrant children.

Kelly’s new job first became apparent when protesters gathered outside Comprehensive Health Services’ Homestead, Florida facility last month — it’s the biggest unaccompanied migrant child detention center in the country. They, along with a local TV station, spotted Kelly enter the facility, and CBS News later confirmed his affiliation. Read more..

Apparently, Kelly’s USG pension as a retired 4-star General wasn’t enough to support him in the style to which he aspired (perhaps after rubbing shoulders with the Trump family and its circle of grifters). So, he found it necessary to supplement his income off the misery of families and children in the “New American Gulag” he helped establish.

I had accurately predicted that Kelly wouldn’t leave his “service” to Trump with his reputation intact. Nobody does, except those with no reputation to start with.

 

Trump runs a kakistocracy. The private sector should treat the steady stream of spineless senior officials fleeing the Trump Circus accordingly.

Or compare the “achievements” of horrible frauds like these guys, who abused their time in the service of Trump by betraying our country’s most fundamental values, with that of a real American hero like the late Congressman Elijah Cummings (D-MD) who was eulogized today. DHS actually has a duty to insure that refugee laws are fairly and generously applied, as intended, to protect those fleeing persecution and torture. And, it was all part of a blatantly racist, White Nationalist, restrictionist Trump agenda that Big Mac fully understood and willfully advanced. He presided over a highly corrupt, unprofessional, politicized, weaponization of DHS. By this time, the damage appears to be irreparable.

Oct. 11, 2019. Acting Homeland Secretary Kevin McAleenan’s resignation was announced by Trump this evening. It contained the minimal “faint praise” for his efforts and the standard disingenuous bureaucratic BS about wanting to spend more time with the family and pursuing interests in the private sector. At least Big Mac has a family left, unlike those asylum seekers who died seeking legal protection, illegally separated children, abused asylum applicants living on streets in Mexico, and mindlessly deported long-time residents who suffered under his corrupt, yet inept, leadership at DHS. 

Some news reports claim it was Big Mac’s decision. But, that seems unlikely, since he never was on the “Trump/Miller A Team.” It’s more likely that Big Mac actually was forced out by the White Nationalist Cabal lead by neo-Nazi Miller.

While cruel, corrupt, and complicit, Big Mac didn’t appear sufficiently ideologically committed to Miller’s racist restrictionist hate agenda. He certainly willingly abused human rights, but he didn’t do it with the obscene glee and delight in unnecessary human suffering consistently exhibited by Trump, Miller, and “Cooch Cooch.”

The DHS Secretary position has been a parade of horrors for the American Constitution, the Rule of Law, human rights, and human decency. McAleenan, like his predecessors General John Kelly and Kristjen Nielsen, came to the job with an undeserved reputation for professionalism and bipartisanship. In practice, he followed in the footsteps of his predecessors by performing like a typical political hack and Trump sycophant.

Illegal child separations, deaths in substandard detention conditions, misappropriation of funding for the Wall, totally absurd and dishonest “Safe Third Country” agreements with some of the most dangerous and “asylum free” countries in the world, abuse of legal asylum seekers under the “Let ‘em Die In Mexico” program, disrespect for and hindrance of attorney representation, bogus claims about failures to appear, expansion of the “New American Gulag,” illegal regulations aimed at indefinite detention of families and children, trashing the U.S. Refugee Program, illegal attempts to impose discriminatory “public change” requirements, illegal use of unreliable information to apprehend individuals, false imprisonment of U.S. citizens, mindless deportation of long-term residents who were actually benefitting America, tremendous backlogs of applications for legal stratus, overloading the Immigration Courts with improvidently commenced cases, schemes to discourage legal immigrants, insults to Federal Judges, lack of candor in dealing with Congress, and disrespect for Congressional Representatives are just some of the abominations that took place on Big Mac’s watch.

Indeed, in the past month lower Federal Courts have slammed as illegal at least five of the racist gimmicks that Big Mac and the DHS have tried to foist on the migrant community at the urging of Miller, “Cooch Cooch,” and the other White Nationalists. Some of Big Mac’s most egregious actions came in connection with the “in your face” regulations that DHS & DOJ presented to Judge Dolly Gee in the Flores litigation. Those regulations proposed unlimited abuses to be inflicted on detained children in unregulated facilities during indefinite detention, which was just the opposite of what Judge Gee had ordered. The DOJ’s unethical arguments in support of Big Mac’s indefensible position left Judge Gee incredulous.

Undoubtedly, he will be replaced by someone with a more overt ideology of racism and hate. Neo-Nazis like Ken “Cooch Cooch” Cuccinelli, now illegally serving as head of USCIS, or some of the DHS underlings who have been competing for Miller’s attention with public statements of cruelty, anti-immigrant sentiment, and disrespect for the law are strong possibilities. Trump has a penchant for finding and selecting the worst that humanity has to offer to serve him. 

Indeed, it’s quite likely that Trump’s next choice will be so spectacularly unqualified and unpalatable, even to some in the GOP (see, “Cooch Cooch”), that “Moscow Mitch” might balk at pushing the nomination through. But, since Trump prefers to flaunt the Constitution and to operate with “acting toadies” anyway, that probably won’t make any difference. 

The Trump Administration is a kakistocracy. So, expect the worst, but be prepared for something far more grotesque and absurd. In the meantime, Big Mac should be remembered for the laws he broke, his attacks on human rights and human decency, his intellectual dishonesty, his immorality, his cowardice in the face of tyranny, the cruel and unnecessary pain he inflicted on legal asylum seekers invoking our laws, and the many lives that he needlessly ruined in service to the worst and most unqualified President in U.S. history.

The Darkening City on the Hill: The Trump Administration Heightens Its Assault on Refugee Protection

In 2018, the global population of forcibly displaced persons reached a record 70.8 million, including 25.9 million refugees and 3.5 million asylum-seekers. The United States led the response to past refugee crises of a similar magnitude, as, for example, in the aftermath of World War II and the Vietnam conflict. Yet although the United States remains the largest donor to the United Nations High Commissioner for Refugees,[1] the Trump administration has sought to steer the country in a different direction. The United States now seems poised to become the global leader in refugee responsibility shunning and of exclusionary nationalist states, whose leaders the president regularly praises, fetes and seems to emulate.  The administration’s recent actions have been particularly damaging to the nation’s identity, to the millions of forcibly displaced in search of safety and a permanent home, and to the ethic of responsibility sharing set forth in the Global Compact on Refugees, which was adopted by the UN General Assembly last December.

On September 26, 2019, the White House released two long-anticipated decrees. Its Executive Order on Enhancing State and Local Involvement in Refugee Resettlement requires that both states and localities consent to the resettlement of refugees in a particular locality.  If either refuses to consent, the Order provides that “refugees should not be resettled within that State or locality,” except in very narrow circumstances that include prior notification of the president. States could bar refugee resettlement, for example, in cities that have been renewed by refugees and that badly want and need them. The Order purports to ensure that “refugees are resettled in communities that are eager and equipped to support their successful integration into American society and the labor force.”  Yet significant coordination already occurs, and it can be strengthened without creating a state and local veto that would hamstring the federal government’s administration of this program. For many years, media sources and politicians, including the president, have railed against the refugee program’s putative insecurity and the burdens it imposes on communities. If implemented, the Order would further politicize refugee protection and diminish resettlement opportunities. Evisceration of the refugee program (not integration) seems to be the Order’s purpose, and would certainly be its result.

In addition, the Order seems to require states and localities to take an affirmative step – as part of a yet-determined process – to consent to refugee placement.  In other words, they must “opt in” to the program. If they do not, then the federal government would deem the jurisdiction unacceptable for resettlement. In these circumstances, the enhanced federal consultation with states and localities and their “greater involvement in the process” of refugee placement would consist of nothing at all.

Also on September 26, the administration released the President’s annual Report to Congress on Proposed Refugee Admissions for Fiscal Year (FY) 2020. This document announced the administration’s decision to limit refugee admissions to 18,000 in FY 2020, the lowest number in the 40-year history of the US Refugee Admissions Program (USRAP), lower even that the two years following the 9/11 attacks.[2]  The Refugee Council USA explained the implications of this decision as follows:

This decision is unprecedented, cruel, and contrary to American humanitarian values and strategic interests. Historically, the United States has been the global leader on refugee resettlement, setting an average refugee admissions goal of 95,000 people annually. To slam the door on persecuted people while the number of refugees displaced globally continues to rise to historic levels upends decades of bipartisan tradition. It also abandons thousands of refugees in need of resettlement, leaving them in precarious, often life-threatening situations.

The Refugee Council USA also pointed out that the forthcoming Presidential Determination on Refugee Admissions for FY 2020 – which constitutes formal notice of the refugee ceiling – will further dismantle “the community-based infrastructure in the US, which has long welcomed the most in-need refugees and provided them the opportunity to rebuild their lives in safety.”  This infrastructure – which has been decades in the making – will take years to rebuild.

The administration’s rationale for historically low admissions are specious. The Report to Congress makes the obvious point that it would be more impactful to “resolve” refugee-producing conditions, than to resettle large numbers of refugees. Yet there is no reason why the United States cannot administer a robust resettlement program and address the causes of displacement through diplomacy. These two strategies complement each other. Resettlement is typically available for a relatively small number of particularly vulnerable refugees. UNHCR reports that 68 percent of its refugee submissions for 2018 “were for survivors of violence and torture, those with legal and physical protection needs, and particularly vulnerable women and girls. Just over half of all resettlement submissions concerned children.”

Moreover, the Trump administration has failed to wield US “[d]iplomatic tools – for example, foreign assistance, economic and political engagement, and alliance-building” to resolve refugee-producing conditions or to create the conditions that would allow refugees to return home safely and voluntarily. To the contrary, it has been consistently dismissive of these tools and has failed to create any new legal avenues for desperate persons to migrate. Instead, it has cut foreign aid to states that have generated the largest numbers of asylum-seekers in recent years, and it terminated the Obama-era Central American Minors program, which allowed qualifying children from Central America’s Northern Triangle states to enter the United States legally as refugees or parolees in order to join their legally present parents.

The Report to Congress also lauds the US commitment to asylum and to other protection programs, which it argues make the United States “the most compassionate and generous nation in history.”  Yet the administration has systematically sought to weaken the US asylum system and its “temporary and permanent protection” programs for “victims of trafficking, humanitarian parole, temporary protected status, and special immigrant juvenile status.”

In particular, it has sought to rescind Temporary Protected Status for the overwhelming majority of its beneficiaries. It has used the cruelty of family separation and detention to deter asylum-seekers from coming. It has reduced due process protections by expanding the expedited removal process. It has also corrupted the expedited removal process by allowing Border Patrol agents – who lack sufficient training in refugee protection and who tend to be deeply suspicious of asylum claims – to assume the role of Asylum Officers and to determine whether asylum-seekers possess a “credible fear” and thus can pursue their claims. It has adopted numerous strategies to prevent and deter asylum-seekers from reaching US territory such as criminally prosecuting and detaining them, and limiting access to the system, including through interception in transit, crude turn-backs at the border, and metering (scheduling) requirements in Mexico for insufficient interview slots in the United States.

Other administrative initiatives will force asylum-seekers to abandon their claims. Under the Return to Mexico program (misnamed the “Migrant Protection Protocols”), for example, US asylum seekers need to wait in dangerous Mexican border communities, while their cases slowly wind through the US immigration system. Early reports indicate that the United States has returned some asylum-seekers to Southern Mexico, making it impossible for them to pursue their claims. The Trump-era Attorneys General have also tried to reject, by fiat, certain common asylum claims (such as those based on gang violence) and have sought to diminish the independence and rigor of the immigration court system. The administration has also sought to weaken protections based on child welfare principles – which it sees as enforcement “loopholes” – for unaccompanied refugee and migrant minors, and for other vulnerable groups.

As it did in announcing its (then) record low admission ceiling for FY 2019, the Report to Congress for FY 2020 argues that the “current burdens on the U.S. immigration system must be alleviated before it is again possible to resettle large number of refugees.”  It is true that asylum applications to the United States have spiked in recent years. Yet as Susan Martin has argued, the United States has historically been able to meet significant demands on its asylum system and to resettle substantial numbers of refugees. In the early 1980s, for example, it received and settled 125,000 Cubans and many thousands of Haitians who had reached Florida’s shores.  It also resettled more than 207,000 refugees in 1980 and nearly 160,000 in 1981. By FY 1994, it faced a backlog of more than 425,000 pending asylum applications, but it still resettled 113,000 refugees in 1994 and nearly 100,000 in 1995. Martin concludes that the Trump administration either is “far less competent than its predecessors in managing complex movements of people so it must make a tradeoff between resettlement and asylum” or, more likely, “it is using asylum as a thinly veiled excuse to reduce overall immigration admissions.”

Finally, the Report to Congress claims that the president “is taking new steps to make sure that the refugees that the United States welcomes are set up to succeed.” In support of this claim, it references the Executive Order on Enhancing State and Local Involvement in Refugee Resettlement, which (as discussed) effectively bars resettlement in states and localities that object or do not affirmatively consent to it.  This measure, combined with the administration’s pitifully low admissions ceiling, will deny the possibility of admission and, thus, integration to countless refugees. The Order allows for the resettlement of “spouses and children” following to join refugees.  However, the admissions cap will keep many resettled refugees indefinitely separated from their families and, in this way, will impede their integration.

As it stands, refugees have been remarkably successful in the United States without the administration’s “reforms.”  A 2018 study by the Center for Migration Studies (CMS) compared 1.1 million resettled refugees who arrived between 1987 and 2016, with non-refugees, the foreign born, and the total US population.  It found that the labor force participation (68 percent) and employment rates (64 percent) of the 1.1 million refugees exceeded those of the total US population (63 and 60 percent), which consists mostly of US citizens.  Refugees with the longest tenure (who arrived between 1987 and 1996) had integrated more fully than recent arrivals (from 2007-2016), as measured by: households with mortgages (41 to 19 percent); English language proficiency (75 to 55 percent); naturalization rates (89 to 24 percent); college education (66 to 32 percent); labor force participation (68 to 61 percent); employment (66 to 55 percent); and, self-employment (14 to 4 percent). Finally, the study found that refugees who arrived between 1987 and 1996 exceeded the total US population in median personal income ($28,000 to $23,000), homeownership (41 to 37 percent) and many other metrics.

To cap off the worst month in the 40-year history of the US refugee protection system, the US Supreme granted a stay on September 11, 2019 that ensured that the United States would, at least temporarily, reject most asylum claims from migrants who have passed through a third country (not their own) on their way to the US-Mexico border. It stayed a lower court order that enjoined the implementation of an interim final rule that will allow claims from such asylum-seekers to proceed only if they can show that they first sought and failed to receive asylum or Torture Convention protection in a third country.[3]

In the best of circumstances, the US asylum process is arduous and uncertain, and many persons who have fled violence and other dangerous conditions ultimately do not prevail in their claims. However, the rule would make it far more difficult even to access this system.  It would bar most asylum claims to the United States, including almost all from Central America and other nations that have been the source of most US asylum applications in recent years. Although described as a “safe third country” measure, the rule evinces no concern for the safety of asylum-seekers, for their aspirations, or for the ability of refugee-producing states such as Guatemala or El Salvador to accommodate additional asylum requests. It also violates international law. The stay means that the rule will now go into effect, while the underlying legal challenges to it run their course. If upheld, the rule would eviscerate the US asylum system.  In fact, this seems to be its purpose.

The administration’s policies raise the question: Why does the United States offer protection to refugees and asylum-seekers at all?  In passing the Refugee Act of 1980, which established USRAP and harmonized US asylum standards with international law, Congress recognized “the historic policy of the United States to respond to the urgent needs of persons subject to persecution in their homelands,” and it encouraged “all nations to provide assistance and resettlement opportunities to refugees to the fullest extent possible.”  For decades, there has been a bipartisan consensus that saving lives – as the US refugee program undeniably does – reflects and projects US ideals to the world. Moreover, refugees do not threaten or burden the nation: They renew it by exemplifying core US values, such as courage, endurance, and a love of freedom.  Most refugees passionately identify with the United States, having found in it the security, opportunity and freedom denied them elsewhere. Robust refugee protection policies, the consensus held, serves the nation’s interests in global stability, diminished irregular migration, and increased cooperation on US diplomatic, military and security priorities.  The program has also saved countless persons who risked their lives to work for and on behalf of the US government.

In his July 30, 1981 statement on US immigration and refugee policy, President Ronald Reagan committed to continuing “America’s tradition as a land that welcomes peoples from other countries” and that shares “the responsibility of welcoming and resettling those who flee oppression.”  He also acknowledged the importance of these policies to the nation’s interests. In his January 11, 1989 farewell address to the nation, Reagan spoke of the United States as a nation that had always stood as a beacon of freedom to the world’s refugees, but that this identity needed to be “rediscovered.”  It needs to be rediscovered now as well, and before the Trump administration succeeds in fully dismantling one of the nation’s defining and proudest programs.

[2] As is its wont, the administration skirted the law in setting the refugee ceiling prior to its statutorily mandated consultation with Congress on admissions. It insists that it still plans to consult with Congress, but to what substantive end is not clear.

[3] The administration misused the previously rare procedure of issuing an “interim final rule” to allow the asylum rule to go into effect prior to formal notice and comment rulemaking, as required by the Administrative Procedure Act.

President Trump’s latest assault on immigration, cutting the number of refugees accepted to a mere 18,000 from 30,000 last year, is better than the complete ban that some of his aides were seeking. But looking at mere numbers misses the point.

This is the administration’s latest message to anyone dreaming of a freer life in America: that they should just stay away. The Trump administration has systematically acted to bar as many refugees and asylum seekers as possible, virtually from its first day, supplanting America’s traditional welcome to the world’s desperate people with a spirit of xenophobia and bigotry.

Led by Stephen Miller, a zealot who has planted lieutenants throughout the government, the Trump White House has made its anti-immigration campaign something akin to a crusade, with “the wall” along the Mexican border as its symbol.

The administration has tried to scare away Central Americans by separating children from their parents when families arrive at the border seeking asylum; it threatened to end “temporary protected status” for people escaping natural and other disasters in a number of countries, including Haiti, Nicaragua and Sudan; it suspended the Deferred Action for Childhood Arrivals program, which let undocumented immigrants who arrived here as children stay and work; it has dramatically deported immigrants without regard for their ties to family and community; and it has enacted a system that would prevent migrants from seeking asylum if they passed through another country without first seeking asylum there.

Any question about the mind-set guiding the administration should have been put to rest by President Trump’s icy explanation to reporters earlier this month for why he was barring residents of the hurricane-battered Bahamas from taking refuge in the United States.

“I don’t want to allow people that weren’t supposed to be in the Bahamas to come into the United States, including some very bad people and some very bad gang members, and some very, very bad drug dealers,” he said. He offered not a shred of proof of any such danger, while the shattering evidence of Bahamians’ needs still lies everywhere.

The limit announced by the State Department on Thursday is far below the 110,000 refugees a year that President Barack Obama said in 2016 should be let in. Most of the 18,000 slots, moreover, are already filled by Iraqis who worked with the American military, victims of religious persecution and some Central Americans. That would leave only 7,500 slots for families seeking unification, like parents of Rohingya children who have already been admitted.

The proffered reason for the cut was the huge backlog in immigration courts as the number of people seeking asylum is expected to reach 350,000. Most refugees trying to enter the United States, though, have already been cleared. So it’s not immediately clear how lowering the annual limit will help ease the backlog.

There are enormous backlogs, and the United States cannot let in everyone who wants to come. But the severity of the cutbacks makes clear that the administration’s rationale hides its real motive: to score political points with a base of voters fearful of immigration by seeming to keep out as many people as possible.

This shortsighted politicking denies a fundamental virtue — and key advantage — of America’s democracy: that it is a land of immigrants and refugees. It ignores the contributions of immigrants to the greatness of the United States.

There is no sensible argument for opening the borders to everyone. Any refugee or asylum program needs a solid vetting process. But Mr. Trump’s approach is not the answer. Congress should have stepped in long ago with serious immigration reform. But that failure is no reason for Americans to be taken in by Mr. Trump’s fear-mongering and evasive explanations.

The Cost of Outsourcing Refugees

It seems perversely appropriate that it was on 9/11 that the Supreme Court removed the legal barrier to the Trump Administration’s most recent deadly attack on the right to asylum in this country.  I continue to believe that eventually, justice will prevail through the courts or, more likely, through a change in administration. But in the meantime, what we are witnessing is an all-out assault by the Trump Administration on the law of asylum.  The tactics include gaming the system through regulations and binding decisions making it more difficult for asylum seekers to prevail on their claims. But far uglier is the tactic of degrading those fleeing persecution and seeking safety here. Such refugees, many of whom are women and children, are repeatedly and falsely portrayed by this administration and its enablers as criminals and terrorists.  Upon arrival, mothers are separated from their spouses and children from their parents; all are detained under dehumanizing, soul-crushing conditions certain to inflict permanent psychological damage on its victims. In response to those protesting such policies, Trump tweeted on July 3: “If illegal immigrants are unhappy with the conditions in the quickly built or refitted detention centers, just tell them not to come.  All problems solved!”

How innocent women and children resigning themselves to being severely beaten, raped, and killed in their home countries constitutes all problems being solved is beyond comprehension.

Those in Trump’s administration who have given more thought to the matter don’t seek to solve the problem, but rather to make it someone else’s problem to solve.  By disqualifying from asylum refugees who passed through any other country on their way to our southern border or who entered the country without inspection; by forcing thousands to remain exposed to abuse in Mexico while their asylum claims are adjudicated, and by falsely designating countries with serious gang and domestic violence problems as “safe third countries” to which asylum seekers can be sent, this administration is simply outsourcing refugee processing to countries that are not fit for the job in any measurable way.  Based on my thirty-plus years of experience in this field, I submit that contrary to Trump’s claim, such policies create very large, long-term problems.

I began my career in immigration law in the late 1980s representing asylum seekers from Afghanistan, many of whom were detained by our government upon their arrival.  In the late 1980s and early 1990s, Afghans constituted the largest group of refugees in the world. At one point, there were more than 6 million refugees from Afghanistan alone, most of whom were living in camps in Pakistan.  Afghan children there received education focused on fundamentalist religious indoctrination that was vehemently anti-western. The Taliban (which literally means “students”) emerged from these schools. The Taliban, of course, brought a reign of terror to Afghanistan, and further provided a haven for Al-Qaeda to launch the 9/11 terrorist attacks.  The outsourcing of Afghan refugees to Pakistan was the exact opposite of “all problems solved,” with the Taliban continuing to thwart peace in Afghanistan up to the present.

Contrast this experience with the following: shortly before I left the government, I went to dinner with a lawyer who had mentioned my name to a colleague of his earlier that day.  The colleague had been an Afghan refugee in Pakistan who managed to reach this country as a teen in the early 1990s, and was placed into deportation proceedings by the U.S. government.  By chance, I had been his lawyer, and had succeeded in obtaining a grant of asylum for him. Although I hadn’t heard from him in some 25 years, I learned from his friend that evening that I had apparently influenced my young client when I emphasized to him all those years ago the importance of pursuing higher education in this country, as he credited me with his becoming a lawyer.  Between the experiences of my former client and that which led to the formation to the Taliban, there is no question as to which achieved the better outcome, and it wasn’t the one in which refugees remained abroad.

In 1938, at a conference held in Evian, France, 31 countries, including the U.S. and Canada, stated their refusal to accept Jewish refugees trapped in Nazi Germany.  The conference sent the message to the Nazis on the eve of the Holocaust that no country of concern cared at all about the fate of Germany’s Jewish population. The Trump administration is sending the same message today to MS-13 and other brutal crime syndicates in Central America.  Our government is closing the escape route to thousands of youths (some as young as 7 years old) being targeted for recruitment, extortion, and rape by groups such as MS-13, while simultaneously stoking anti-American hatred among those same youths through its shockingly cruel treatment of arriving refugees.  This is a dangerous combination, and this time, it is occurring much closer to home than Pakistan. Based on historic examples, it seems virtually assured that no one will look back on Trump’s refugee policies as having solved any problems; to the contrary, we will likely be paying the price for his cruel and short-sighted actions for decades to come.

Former IJs File Amicus Brief in Padilla v. ICE

The late Maury Roberts, a legendary immigration lawyer and former BIA Chair, wrote in 1991: “It has always seemed significant to me that, among all the members of the animal kingdom, man is the only one who captures and imprisons his fellows.  In all the rest of creation, freedom is the natural order.”1  Roberts expressed his strong belief in the importance of liberty, which caused him consternation at “governmental attempts to imprison persons who are not criminals or dangerous to society, on the grounds that their detention serves some other societal purpose,”  including noncitizens “innocent of any wrongdoing other than being in the United States without documents.”2

The wrongness of indefinitely detaining non-criminals greatly increases when those being detained are asylum-seekers fleeing serious harm in their home countries, often after undertaking dangerous journeys to lawfully seek protection in this country.  The detention of those seeking asylum is at odds with our obligations under the 1951 Refugee Convention, which at Article 31 forbids states from penalizing refugees from neighboring states on account of their illegal entry or presence, or from restricting the movements of refugees except where necessary; and the International Covenant on Civil and Political Rights, which guarantees at Article 9, para. 4 the right of detainees to have a court “without delay” determine the lawfulness of the detention order release if it is not.

In 1996, in response to an increase in asylum seekers at ports of entry, Congress enacted a policy known as expedited removal, which allows border patrol officers to enter deportation orders against those noncitizens arriving at airports or the border whom are not deemed admissible.  A noncitizen expressing a fear of returning to their country is detained and referred for a credible fear interview. Only those whom a DHS asylum officer determines to have a “significant possibility” of being granted asylum pass such interview and are allowed a hearing before an immigration judge to pursue their asylum claim.

In 2005, the Board of Immigration Appeals issued a precedent decision stating that detained asylum seekers who have passed such credible fear interview are entitled to a bond hearing.  It should be noted that the author of this decision, Ed Grant, is a former Republican congressional staffer and supporter of a draconian immigration enforcement bill enacted in 1996, who has been one of the more conservative members of the BIA.  He was joined on the panel issuing such decision by fellow conservative Roger Pauley. The panel decision was further approved by the majority of the full BIA two years after it had been purged of its liberal members by then-Attorney General John Ashcroft.  In other words, the right to bond hearings was the legal conclusion of a tribunal of conservatives who, although they did not hold pro-immigrant beliefs, found that the law dictated the result it reached.

14 years later, the present administration issued a precedent decision in the name of Attorney General Barr vacating the BIA’s decision as “wrongly decided,” and revoking the right to such bond hearings.  The decision was immediately challenged in the courts by the ACLU, the Seattle-based Northwest Immigrant Rights Project, and the American Immigration Council. Finding Barr’s prohibition on bond hearings unconstitutional, U.S. District Judge Marsha Pechman issued a preliminary injunction blocking the decision from taking effect, and requiring bond hearings for class members within 7 days of their detention.  The injunction additionally places the burden on the government to demonstrate why the asylum-seeker should not be released on bond, parole, or other condition; requires the government to provide a recording or verbatim transcript of the bond hearing on appeal; and further requires the government to produce a written decision with particularized determinations of individualized findings at the end of the bond hearing.

The Administration has appealed from that decision to the U.S. Court of Appeals for the Ninth Circuit.  On September 4, an amicus brief on behalf of 29 former immigration judges (including myself) and appellate judges of the BIA was filed in support of the plaintiffs.  Our brief notes the necessity of bond hearings to due process in a heavily overburdened court system dealing with highly complex legal issues. Our group advised that detained asylum seekers are less likely to retain counsel.  Based on our collective experience on the bench, this is important, as it is counsel who guides an asylum seeker through the complexities of the immigration court system. Furthermore, the arguments of unrepresented applicants are likely to be less concise and organized both before the immigration judge and on appeal than if such arguments had been prepared by counsel.  Where an applicant is unrepresented, their ongoing detention hampers their ability to gather evidence in support of their claim, while those lucky enough to retain counsel are hampered in their ability to communicate and cooperate with their attorney.

These problems are compounded by two other recent Attorney General decisions, Matter of A-B- and Matter of L-E-A-, which impact a large number of asylum claimants covered by the lawsuit who are fleeing domestic or gang violence.  Subsequent to those decisions, stating the facts giving rise to the applicant’s fear can be less important than how those facts are then framed by counsel.  Immigration Judges who are still navigating these decisions often request legal memoranda explaining the continued viability of such claims. And such arguments often require both a legal knowledge of the nuances of applicable case law and support from experts in detailed reports beyond the capability of most detained, unrepresented, newly-arrived asylum seekers to obtain.

Our brief also argues that the injunction’s placement of the burden of proof on DHS “prevents noncitizens from being detained simply because they cannot articulate why they should be released, and takes into account the government’s institutional advantages.”  This is extremely important when one realizes that, under international law, an individual becomes a refugee upon fulfilling the criteria contained in the definition of that term (i.e. upon leaving their country and being unable or unwilling to return on account of a protected ground).  Therefore, one does not become a refugee due to being recognized as one by a grant of asylum. Rather, a grant of asylum provides legal recognition of the existing fact that one is a refugee. 3 Class members have, after a lengthy screening interview, been found by a trained DHS official to have a significant possibility of already being a refugee.  To deny bond to a member of such a class because, unlike the ICE attorney opposing their release, they are unaware of the cases to cite or arguments to state greatly increases the chance that genuine refugees deserving of this country’s protection will be deported to face persecution

Mexico’s Capitulation to Trump Has Put Thousands of Lives in Danger

The Mexican foreign minister says his government has nothing to be ashamed of. He’s wrong.

In recent months, at least 3,000 immigrants have been sent back to towns along the Mexican border between Tamaulipas and Texas, one of the country’s most dangerous areas. What they have faced there defies the imagination. The city of Nuevo Laredo is a well-known hotbed of extortion and kidnapping. Immigrants make easy targets. “These people have been thrown into the lion’s den,” local journalist Daniel Rosas told me recently.

According to Rosas, President Donald Trump’s “Remain in Mexico” program has been particularly harmful, placing thousands of immigrants in imminent danger. “If even us locals are going through a very difficult time dealing with violence here, just imagine what life is like for an immigrant who doesn’t have a home and doesn’t know anyone. This place is completely unsafe,” Rosas told me. In the city of Nuevo Laredo, Rosas described a Dantean scene in which people working for cartels are tasked with identifying and abducting immigrants, who are then taken away to safehouses where they are held for ransom.

“In Tamaulipas, migrants are the most vulnerable. They suffer every kind of abuse imaginable,” he told me. Rosas seemed particularly worried for women and children in Tamaulipas. “They are completely defenseless,” Rosas told me. “When they were waiting and trying to rest under the bridge, there were kids sleeping on cardboard, without any help. They live through sheer horror,” he said.

This nightmare is the predictable result of recent actions by governments on both sides of the border. Three months ago, faced with Trump’s tariff blackmail, Mexico’s government capitulated and agreed to a series of unprecedented measures to reduce the flow of Central American immigrants reaching the United States. Terrified by the possibility of a trade war, President Andres Manuel López Obrador’s administration deployed thousands of troops along Mexico’s southern border, gave control of the country’s immigration authority to an expert in incarceration and enforcement, and pledged full cooperation with some of Trump’s more controversial immigration policies. As part of the deal, Mexican government officials agreed to return to Washington every few months with evidence of results, a recurrent humiliating pilgrimage in search of Trump’s approval and a renewed deferral of the looming tariff threat.

Ten days ago, after his first assessment in Washington with Trump’s inner circle—and, briefly, the president himself—Mexican Foreign Minister Marcelo Ebrard gave a victorious but ultimately unfortunate news conference. Ebrard claimedthat the much-touted downward trend in the number of immigrants reaching the United States would likely be “permanent,” although historical trends suggest the flow of immigrants will likely increase during the fall. Ebrard then said the Mexican government had demanded new and strict gun control measures in the United States. The goal, Ebrard boasted, was to “freeze” gun trafficking along the border. This is disingenuous. Ebrard knows any sort of significant reduction in gun smuggling from the United States would require legislative measures that the Trump administration and the Republican Party will not pursue.

Ebrard then concluded by saying the López Obrador administration had nothing to apologize for on immigration. “We do not regret anything of what’s been implemented,” Ebrard said. “We haven’t done anything we should be ashamed of.”

He is wrong.

The Mexican government’s cooperation with Donald Trump’s punitive immigration strategy has created a calamity along the country’s northern border. Of the many complications, none is more potentially catastrophic than the broad implementation of Trump’s Migrant Protection Protocols program, better known as the “Remain in Mexico” policy. The measure forces potential refugees to wait for months (or years) in Mexico for a slim chance at asylum in the United States. It has opened the door to the creation of a massive community of rootless and marginalized immigrants living in perilous limbo in some of Mexico’s most dangerous areas. There are now close to 38,000 immigrants waitingin Mexico because of MPP. After meeting with Ebrard, the White House announcedthe program would be expanded “to the fullest extent possible,” dramatically increasing the number of potential refugees returned to Mexico, many to regions of the country where they face almost certain peril.

No place seems safe, not even shelters run by religious organizations, one of the few reliable options in other border towns like Tijuana. In Nuevo Laredo, organized crime knows no bounds. Just last month, local pastor Aarón Méndez, who runs the “Casa del Migrante AMAR” shelter in the city, reportedly tried to protect a group of Cuban migrants from a group of abductors. They kidnapped Méndezinstead. No one has heard from him since.

Things aren’t much better in Matamoros, across from Brownsville, Texas. In recent years, the city has seen “open warfare” between rival cartels. American attorneyKristin Clarens, who has been traveling to the region over the past few months to assist potential refugees and make sense of the dire situation in the region, told me she has never met an asylum-seeking immigrant who felt safe in Mexico. “To the contrary,” Clarens said, “most of the people I’ve met described routine and regular acts of violence, such as kidnapping, assault, and extortion.” According to Clarens, migrants in Matamoros, like those in Nuevo Laredo, are facing a full-blown humanitarian crisis. “The heat is intense and unrelenting, and they lack access to sanitation, water, shade, food, and basic shelter,” she told me. “People hike down to the river and use the river to clean themselves, wash their clothes, and occasionally drink. Children and adults are sick and covered with bug bites and lesions.”

Like Rosas, Clarens believes “Remain in Mexico” has complicated the already formidable immigration challenge in the region. “The MPP sends people back to Mexico, where many have been repeatedly victimized by organized criminals or other dangerous groups,” Clarens said. “Their access to the legal system in the U.S.—which had already been severely reduced by the Trump administration—is effectively cut off. MPP will force people to remain for a significant period of time in one of the most vulnerable and dangerous living situations they’ve ever imagined experiencing.” Clarens thinks the crisis will likely worsen. “I know that Mexico can be a safe and stable place for many people, but impoverished and incredibly vulnerable Central Americans who are desperate for security and are leaving their countries of origin for the first time are not able to stay safe,” she told me.

If Mexico continues to quietly go along with the radical expansion of the MPP program, the number of immigrants waiting for asylum in the country could reach the hundreds of thousands. With Mexico’s official refugee agency operating on a ridiculous $1.3 million yearly budget, the López Obrador administration is not remotely ready for such an undertaking. The consequences could be severe. If that happens, Ebrard should be asked again if Mexico really has nothing to be ashamed of.

Those who should really be ashamed are the cowardly life-tenured judges of the Supremes, the Ninth Circuit, and the Fifth Circuit who as a group have utterly failed to protect migrants’ statutory, Constitutional, and Human Rights from lawless, invidious, and very intentional abuse by Trump’s White Nationalist regime and his DHS and DOJ sycophants.

 

Article III Federal Judges are absolutely immune from liability for their wrongdoing and abuses. But, they shouldn’t be immune from shame and the judgment of history for abandoning our system of justice and the most vulnerable it is supposed to protect at their greatest time of need. That’s basically the definition of legal incompetence and moral cowardice.
