New Legal Filing Links High-level Trump Officials to Asylum “Turnback Policy” – Al Otro Lado, Inc. v. Nielsen

American Immigration Council, Oct. 16, 2018 – “In a new court filing, asylum seekers and an immigrant rights group are challenging the Trump administration’s policy and practice of turning back asylum seekers at ports of entry along the U.S.-Mexico border. Friday’s filing directly links high-level Trump administration officials to an official “Turnback Policy,” ordering U.S. Customs and Border Protection (CBP) officials to restrict the number of asylum seekers who can access the asylum process at ports of entry. The Turnback Policy compounds other longstanding border-wide tactics CBP has implemented to prevent migrants from applying for asylum in the U.S., including lies, intimidation, coercion, verbal abuse, physical force, outright denials of access, unreasonable delay, and threats—including family separation.

The new filing was brought by the Los Angeles and Tijuana-based organization Al Otro Lado, Inc. and individual asylum seekers who are collectively represented by the Center for Constitutional Rights, the Southern Poverty Law Center, and the American Immigration Council. The attorneys allege that the Trump administration policy and practice violate U.S. and international law and subject vulnerable asylum seekers to imminent danger, deportation, or death.

“Every day we work with survivors of horrific physical and sexual violence, doing our best to provide the necessary resources to extremely vulnerable individuals. They come to our border to seek safety for themselves and their children. The United States, in implementing the Turnback Policy, cavalierly rejects thousands of these individuals, retraumatizing them and stranding them alone and destitute. It is hard to overstate the cruelty with which CBP operates,” said Nicole Ramos, Border Rights Project director at Al Otro Lado.

Attorneys say practices under the Turnback Policy are directly attributable to high-level Trump administration officials, including Attorney General Jeff Sessions and Department of Homeland Security Secretary Kirstjen Nielsen. The filing cites Sessions’ characterization of asylum seekers as deliberately attempting to “undermine our laws and overwhelm our system,” and Nielsen’s reference to the legally required process of receiving and processing asylum seekers at the border as a “loophole.” The filing also quotes U.S. Customs and Border Protection officers as stating, “We have orders not to let anybody in.”

“Internal CBP documents released in this case reveal that high-level CBP officials authorized a Turnback Policy as early as 2016 to restrict the flow of asylum seekers to the U.S-Mexico border,” said Melissa Crow, senior supervising attorney with the Southern Poverty Law Center’s Immigrant Justice Project. “The Turnback Policy has escalated under the Trump administration and has been buttressed by a wide range of unlawful tactics that CBP uses to deny asylum seekers access to the protection they deserve.”

Said Baher Azmy, legal director of the Center for Constitutional Rights, “Ever since the horrors of World War II, the world’s nations have committed to giving asylum seekers the opportunity to seek safe haven. The Trump administration has turned its back on this most elementary humanitarian principle, in violation of U.S. and international law, and is subjecting vulnerable men, women and children who are fleeing horrific conditions at home to continued terror, violence and in some cases, death.”

Asylum seekers are fleeing persecution in their home countries, and suffer unspeakable harm en route to the United States at the hands of Mexican government officials, cartels, and gangs. When they are turned away at ports of entry, the lawsuit alleges, they are compelled to either enter the U.S. illegally and be prosecuted, stay trapped in Mexico where they are targeted by criminal groups, or return home to face persecution and death. The filing recounts an extensive array of inaccurate information and abusive treatment those seeking asylum have faced at the hands of U.S. border officials, including that the U.S. is no longer providing asylum or that people from specific countries are not eligible; yelling at, harassing, and assaulting asylum seekers and their children; threatening to take children away from their parents; and setting up “pre-checkpoints” that prevent asylum seekers from reaching the U.S. border. Over four consecutive days in March, CBP officials turned away Guatemalan asylum seekers, saying “Guatemalans make us sick.”

The filing amends a previous filing challenging CBP’s turnbacks of asylum seekers at ports of entry. The challenged practices were initially implemented in 2016 and greatly exacerbated by the Trump administration.

It’s a strange system where the victims of law violations are punished while the “perps” — folks like Sessions, Nielsen, Miller, etc — walk free and are allowed to continue their lawless behavior.

Even stranger: A guy like Sessions — a scofflaw “Jim Crow Throwback” if there ever was one — has the absolute audacity to whine, complain, and even threaten when occasionally Federal Judges intervene in relatively limited ways to force him and even Trump to comply with our country’s laws and our Constitution. But, I suppose that’s what free speech is all about. Nevertheless, Sessions’s freedom to express his opinions that mock, distort, and mischaracterize our laws doesn’t necessarily entitle him to act on those opinions in a manner inconsistent with those law.

HOW THE TRUMP ADMINISTRATION’S LIES AND MISCONDUCT HAVE CREATED THE VERY “FAKE BORDER CRISIS” THAT THEY CLAIM TO DECRY (& Use To Attempt To Justify Even More Draconian Measures To Mask Their Illegal & Immoral Conduct)

Elsa, a Guatemalan living in Southern Mexico, knew something was wrong. Her husband began traveling a lot without explanation, and physically abusing her and their two kids. When she eventually figured out that he’d gone to work for a cartel, she left him. But in 2016, the gang came after her to collect on debts the ex-husband had skipped out on. She fled to other Mexican towns, but the cartel men tracked her down. Then she went back to Guatemala, but they found her there, too. Finally, in September, Elsa decided to gamble on Uncle Sam — but the foot of the Reynosa-Hidalgo bridge was as far as she would get.

The Trump administration has repeatedly insisted that asylum-seekers should follow the rules by turning themselves in at ports of entry. Elsa tried to do just that. As a legal Mexican resident, she even had proper documentation for herself and her two children. Still, a Mexican customs agent stopped her at the turnstile and told her she couldn’t pass. He yelled at her that they were abusing their Mexican status by seeking asylum in the United States, and he threatened to tear their papers to shreds. Scared, the family slunk back into narco-ravaged Reynosa, and into total uncertainty.

The story of Elsa, whose name the Observer has changed for her protection, was included in a petition filed last week with the Inter-American Commission on Human Rights, a 59-year-old organization based in Washington, D.C., that investigates abuses in the Americas and issues recommendations to offending nations. The petition, filed by immigration attorneys working in the Rio Grande Valley, describes a systematic conspiracy between U.S. and Mexican customs agents to prevent asylum-seekers from requesting protection. The attorneys are asking the commission to tell both nations to stop stonewalling the law-abiding migrants.

Since June, the lawyers allege, Mexican customs officials along the Texas-Mexico border have been doing something virtually unprecedented: stopping asylum-seekers from entering the bridge, and if the migrants lack proper Mexican travel documents, the Mexican agents detain and even deport them. If an asylum-seeker makes it onto the bridge, U.S. customs officials call their Mexican counterparts to retrieve them; the Observerdocumented this phenomenon in a June story cited in the petition. In Nuevo Laredo, according to sworn affidavits from two Central American asylum-seekers, Mexican agents have demanded bribes of $500 per person to get onto the bridge. And in September, in Reynosa, they also started rejecting people, like Elsa, with Mexican papers.

“This petition highlights the reality of the U.S. working hand in glove with the Mexicans to completely shut down bridges, in violation of a number of human rights prohibitions,” said Jennifer Harbury, a longtime Rio Grande Valley attorney. Harbury has spent months documenting problems at the bridges and provided the majority of the information in the filing. According to Harbury and an affidavit from longtime Brownsville activist Mike Seifert, the international collaboration began after public outcry over long lines of asylum-seekers baking in the sun for weeks on the U.S. side of the bridges.

Harbury says in the filings that numerous Mexican agents at the Reynosa bridge have privately told her that the two governments are working together, and they’ve expressed frustration at doing the United States’ “dirty work.” Two other witnesses — a journalist and an activist — wrote similar affidavits. But U.S. customs agents have told Harbury that the Mexicans are acting alone, and a September letter she sent to Homeland Security Secretary Kirstjen Nielsen has gone unanswered. The United States began pressuring Mexico to stop migration at its southern border in 2014, and last month, Trump signaled he would redirect $20 million in foreign aid to beef up Mexico’s deportations. Neither U.S. nor Mexican immigration officials responded to Observer requests for comment.

The United States is unlikely, Harbury said, to heed the eventual request from the human rights commission. For one, the U.S. government rejects the authority of the commission’s enforcement arm, the Inter-American Court of Human Rights in San José, Costa Rica. (The same court recently ruled that many Latin American countries must recognize same-sex marriage.) But Harbury has higher hopes for Mexico, which is subject to the court and has an incoming leftist president in Andrés Manuel López Obrador. “I think the new president of Mexico is not going to want the commission saying they’re running dogs for Uncle Sam,” she said.

If Mexico stops its collaboration, then the United States would have to do its own “dirty work” of stopping asylum-seekers, and hold all liability for the potentially illegal actions. In California, a lawsuit was filed last year after border agents briefly turned away asylum-seekers all along the U.S.-Mexico border on the false premise that Trump’s inauguration had abolished asylum. That suit continues to play out.

In turning the bridges into hostile territory for asylum-seekers, the Trump administration has made a mockery of its own stated immigration goals. According to Attorney General Jeff Sessions, the point of the “zero tolerance” policy was to force families to use official ports of entry instead of crossing illegally. But U.S. customs agents started stonewalling asylum-seekers at the bridges. Now, with the threat of separation gone and the bridges still a dicey proposition, families have responded accordingly: More are crossing the river illegally to turn themselves in to Border Patrol. Immigration officials, in turn, are using this apparent spike to sound the alarm about another border crisis.

Meanwhile, many asylum-seekers from Central America, Africa and the Caribbean remain stranded, paralyzed by uncertainty in dangerous Mexican border towns where gangsters prey on refugees. In an affidavit, one would-be asylum-seeker wrote that she hears “shooting day and night” in Reynosa; another simply wrote, “many people die here.” As Harbury, the attorney, put it, “they’re like a snowball in Hell down there.”

Jeff Sessions is a key part of this legal charade and scofflaw behavior.  He disingenuously asserts that individuals should be using the legal system while doing everything in his power to make it impossible for individuals to present their asylum claims at ports of entry and have them fairly heard by fair and unbiased judges in Immigration Court.

The results of these shortsighted, cruel, illegal, and ultimately ineffective policies are to: 1) enrich smugglers, 2) make the trip more dangerous for asylum seekers, virtually insuring that more will die or be abused during the journey, and 3) to enlarge and promote the already robust “extralegal system” for immigrants and refugees. When orderly processing and the legal system for immigration are shut down or made less “user friendly,” the result is unlikely to be less overall immigration; just less immigration through legal channels and more “extralegal immigration” driven by Trump, Sessions, and their fellow White Nationalists.

Remember, we can diminish ourselves as a nation (and are doing so under Trump, Sessions, Nielsen, & Miller), but that won’t stop human migration!

The Trump administration’s “zero tolerance” crackdown at the border this spring was troubled from the outset by planning shortfalls, widespread communication failures and administrative indifference to the separation of small children from their parents, according to an unpublished report by the Department of Homeland Security’s internal watchdog.

The report, a copy of which was obtained by The Washington Post, is the government’s first attempt to autopsy the chaos produced between May 5 and June 20, when President Trump abruptly halted the separations under mounting pressure from his party and members of his family.

The DHS Office of Inspector General’s review found at least 860 migrant children were left in Border Patrol holding cells longer than the 72-hour limit mandated by U.S. courts, with one minor confined for 12 days and another for 25.

Many of those children were put in chain-link holding pens in the Rio Grande Valley of southern Texas. The facilities were designed as short-term way stations, lacking beds and showers, while the children awaited transfer to shelters run by the Department of Health and Human Services.

U.S. border officials in the Rio Grande Valley sector, the busiest for illegal crossings along the nearly 2,000-mile U.S.-Mexico border, held at least 564 children longer than they were supposed to, according to the report. Officials in the El Paso sector held 297 children over the legal limit.

The investigators describe a poorly coordinated interagency process that left distraught parents with little or no knowledge of their children’s whereabouts. In other instances, U.S. officials were forced to share minors’ files on Microsoft Word documents sent as email attachments because the government’s internal systems couldn’t communicate.

“Each step of this manual process is vulnerable to human error, increasing the risk that a child could become lost in the system,” the report found.

Based on observations conducted by DHS inspectors at multiple facilities along the border in late June, agents separated children too young to talk from their parents in a way that courted disaster, the report says.

“Border Patrol does not provide pre-verbal children with wrist bracelets or other means of identification, nor does Border Patrol fingerprint or photograph most children during processing to ensure that they can be easily linked with the proper file,” the report said.

“It is a priority of our agency to process and transfer all individuals in our custody to the appropriate longer-term detention agency as soon as possible,” U.S. Customs and Border Protection, which includes Border Patrol, said in a statement. “The safety and well-being of unaccompanied alien children . . . is our highest responsibility, and we work closely with the Department of Health and Human Services (HHS) Office of Refugee Resettlement to ensure the timely and secure transfer of all unaccompanied minors in our custody as soon as placement is available from HHS.”

In its Sept. 14 response to the inspector general’s report, DHS acknowledged the “lack of information technology integration” across the key immigration systems and “sometimes” holding children beyond the 72-hour limit.

Jim Crumpacker, the DHS official who responded to the report, said the agency held children longer mainly because HHS shelter space was unavailable. But he said transferring children to less-restrictive settings is a priority.

On June 23, three days after the executive order halting the separations, DHS announced it had developed a “central database” with HHS containing location information for separated parents and minors that both departments could access to reunite families. The inspector general found no evidence of such a database, the report said.

“The OIG team asked several [Immigration and Customs Enforcement] employees, including those involved with DHS’ reunification efforts at ICE Headquarters, if they knew of such a database, and they did not,” it states. “DHS has since acknowledged to the OIG that there is no ‘direct electronic interface’ between DHS and HHS tracking systems.”

Inspectors said they continue to have doubts about the accuracy and reliability of information provided by DHS about the scope of the family separations.

In late June, a federal judge ordered the government to reunite more than 2,500 children taken from their parents, but three months later, more than 100 of those minors remain in federal custody.

The inspector general’s report also found that U.S. Customs and Border Protection (CBP) restricted the flow of asylum seekers at legal ports of entry and may have inadvertently prompted them to cross illegally. One woman said an officer had turned her away three times, so she crossed illegally.

At one border crossing, the inspection team saw CBP attempt to increase its detention space by “converting former offices into makeshift hold rooms.”

The observations were made by teams of lawyers, inspectors and criminal investigators sent to the border amid concerns raised by members of Congress and the public. They made unannounced visits to CBP and ICE facilities in the border cities of El Paso and McAllen, Tex.

Three months after Donald Trump gave in to global opprobrium and discontinued his administration’s policy of separating children from their parents at the Mexican border, the stark impact of his zero-tolerance directive continues to unfold, with reports emerging that, in the space of a year, the number of migrant children detained by the U.S. government has spiked from 2,400 to over 13,000—despite the number of monthly border crossings remaining relatively unchanged. The increase, along with the fact that the average detainment period has jumped from 34 to 59 days, has resulted in an accommodation crisis. As a result, hundreds of children—some wearing belts inscribed with their emergency-contact information—have been packed onto buses, transported for hours, and deposited at a tented city in a stretch of desert in Tornillo, West Texas. According to The New York Times, these journeys typically occur in the middle of the night and on short notice, to prevent children from fleeing.

The optics of the child-separation crisis have been some of the worst in history for the Trump administration, and the tent city in Tornillo is no exception. The facility is reportedly run according to “guidelines” provided by the Department of Health and Human Services, but access to legal aid is limited, and children—who sleep in bunks divided by gender into blocks of 20—are given academic workbooks, but no formal teaching. In theory, the hundreds of children being sent to Tornillo every week should be held for just a short period of time; the center first opened in June as a temporary space for about 400. Since then, however, it has been expanded to accommodate 3,800 occupants for an indefinite period.

Again, the lag time is largely thanks to the White House. Typically, children labeled “unaccompanied minors” are held in federal custody until they can be paired with sponsors, who house them as their immigration case filters through the courts. But thanks to the harsh rhetoric embraced by the White House, such sponsors are now in short supply. They’re often undocumented immigrants themselves, which means that in this environment, claiming a child would put them at risk for deportation. In June, that risk became even more acute when authorities announced that potential sponsors would have to submit their fingerprints, as well as those of any adults living in their household: data that would then be passed to immigration authorities. Matthew Albence, who works for Immigration and Customs Enforcement, unwittingly illustrated the problem when he testified before Congress last week that I.C.E. had arrested multiple people who had applied to sponsor unaccompanied minors. Almost three-quarters had no criminal record.

Over time, the number of detained children is only expected to increase. According to The Washington Post, the flood of Central American immigrants moving north, driven by “hunger, joblessness, and the gravitational pull of the American economy,” shows no sign of abating. The number of men who cross the border with children has reportedly risen from 7,896 in 2016 to 16,667 this year, while instances of migrants falsely claiming children as their own have reportedly increased “threefold.” “Economic opportunity and governance play much larger roles in affecting the decision for migrants to take the trip north to the United States,” Kevin McAleenan, a border-security official, told the Post, adding that “a sustained campaign that addresses both push and pull factors” is “the only solution to this crisis.”

Given the attitude of the current administration, such a campaign seems unlikely to materialize. With Congress poorly positioned to pass comprehensive immigration reform, and a suddenly swamped detention system draining money and resources and damaging the mental health of thousands of children, the escalating crisis seems poised to become an ever more serious self-inflicted thorn in the president’s side. Although the White House is confident that, as hard-liner Stephen Miller boasts, it can’t lose on immigration, it will at some point be forced to acknowledge that its draconian strategy has morphed into chaos.

Wonder if any of these evil dudes who along with Sessions helped plan and  implement the “Kiddie Gulag” knowing that it was likely in violation of the Constitution (in Federal court, DOJ lawyers didn’t even contest that a policy of intentional child separation would be unconstitutional) took out the “Bivens Insurance” offered to USG employees at relatively low-cost (I sure did!).

The only good news is that they are likely to be tied up in law suits seeking damages against them in their personal capacities for the rest of their lives!

So, perhaps there will eventually be some justice! But, that’s still won’t help traumatized kids whose lives have been screwed up forever as an illegal, immoral, and bogus, “deterrent” by a racist White Nationalist regime.

Proposed regulation

On Sept. 7, the Trump administration filed a proposed rule to establish final regulations that would replace the Settlement Agreement.

According to DHS, the proposed regulations would implement the relevant, substantive terms of the Settlement Agreement with minor revisions to accommodate changed circumstances, and to implement closely-related provisions in the Homeland Security Act of 2002, and the William Wilberforce Trafficking Victims Protection Reauthorization Act of 2008.

The main benefit would be the creation of a federal licensing scheme for additional Family Residential Centers that would provide care for alien minors and their parents.

According to the American Immigration Council, “shifting the licensing and oversight of facilities that hold children to DHS is profoundly problematic, given the lack of expertise the department has in child welfare and its poor track record on oversight of adult facilities.”

Maybe, but if a challenge to the regulation goes to court, the main issue is likely to be whether administration officials can bypass an explicit statutory provision requiring mandatory detention in expedited removal proceedings with a settlement agreement.

He said his team submitted evidence showing that, during the interviews, the parents were “out of their minds with trauma, focused solely on the well-being and the whereabouts of their kids.”

In one piece of evidence included in the case, a recording of an immigration judge questioning a mother about her asylum claim, the mother can be heard crying too hard to answer the judge’s questions and says that she feels sick, Mr. Sandoval-Moshenberg said. After a few minutes, he said, the judge affirms an asylum officer’s finding that the woman’s fear of returning to her home country is not credible and asks that she be taken to see a doctor.

As many as 1,000 parents separated from their children are getting a second chance to stay in the US

In a huge reversal, the Trump administration is giving families another chance to claim asylum — and even some parents who’ve already been deported might be eligible.

The Trump administration has just agreed to give parents who were separated from their children at the US-Mexico border earlier this year a second chance to make asylum claims in the US.

The Department of Justice has negotiated an agreement that covers three lawsuits filed against the government over the family-separation policy. Parents in the US who’d been ordered deported would get another chance to pass an interview demonstrating a “credible fear” of persecution — the first step in the asylum process.

If either the parent or the child passes the screening interview, families will be allowed to apply for asylum together. Some parents who don’t pass will be allowed to remain with their children in the US while the children’s cases are adjudicated.

And in some cases, the government is even willing to consider reopening cases for parents who were already deported from the US.

The agreement covers three lawsuits: Ms. L v. ICE, which forced the government to reunite separated families this summer; M- M- M- v. ICE, brought on behalf of children separated from parents; and Dora v. Sessions, a lawsuit from parents who had failed their initial asylum screenings because they were distraught after weeks of separation from their children.

If the agreement is approved by the federal judges overseeing the three lawsuits, it will result in a second chance for hundreds of parents. Muslim Advocates and the Legal Aid Justice Center, who represented the plaintiffs in Dora v. Sessions, believe it could give “well over 1,000” parents another chance at an asylum claim. And for many families, it will eliminate (or at least defer) the impossible choice between giving up a child’s legal case, and separating the family again by keeping the child in the US while the parent is deported.

Separating families made it much harder for parents to seek asylum

Under the Trump administration’s family separation policy, a parent who wanted to seek asylum in the US had one chance: to pass a “credible fear” screening interview with an asylum office.

If a parent passed the credible fear screening, he or she was given a chance to seek asylum before an immigration judge; if the parent failed, he or she could appeal the decision to an immigration judge, with much worse odds. Losing the appeal, or agreeing to drop the case, led to an order of deportation.

Generally, most asylum seekers pass their credible fear screenings. But evidence suggests that parents who were separated from their children often failed their interviews. Parents were often so consumed by grief over their separation from their children that they weren’t able to answer asylum officers’ questions fully and effectively, according to the lawsuit filed in Dora v. Sessions.

“Explaining the basis for an asylum claim is very difficult under the best of circumstances,” said one source familiar with the interview process but not professionally authorized to speak on the record. “When someone is a) detained, b) almost certainly unrepresented, and c) beside herself with fear and desperation because of having had her child taken from her,” the source continued, “it is almost impossible.”

By the time nearly 2,000 parents and children were reunited in July (thanks to Judge Dana Sabraw’s rulings in the Ms. L case ordering family reunification), the overwhelming majority of parents had already lost their cases and been ordered deported. But their children — who’d been placed on a separate legal track as “unaccompanied alien children” after being separated from their parents — often still had ongoing cases and a real chance of winning some form of legal status in the US.

So upon being reunited, hundreds of families were faced with the choice between returning to their home country together (and facing possible peril or persecution), and keeping the child in the US in hopes of winning asylum or another form of legal status — and separating the family anew. (Some parents alleged they weren’t even given this chance, and were coerced into withdrawing their children’s legal claims — and forcibly reseparated without warning if they refused to comply.)

None of this would have happened if families hadn’t been separated to begin with. Under normal circumstances, if either a parent or a child passed an asylum interview, the government would allow them both to file asylum claims. And obviously, parents who weren’t traumatized by family separation might have had a better chance with their interviews. But simply reuniting the family didn’t solve the problem.

The government is agreeing to give reunited families the same chance they’d had if they’d never been separated

Here is what the agreement proposed by the government would actually do, if approved:

  • Parents who passed their initial “credible fear” interviews for asylum will be allowed to continue; this agreement doesn’t change those cases.
  • Parents who had lost their cases and been ordered deported will be given a full review to reassess whether or not they have a credible fear of persecution. This review will include a second interview for “additional fact-gathering” — during which a lawyer can be present (or can dial in by phone). Parents will be allowed to do this even if they didn’t ask for a credible fear interview when they were first arrested.
  • Parents who fail their credible fear screenings will be allowed to remain in the US and apply for asylum if their child passes his or her credible fear screening. The reverse is also true: If a child fails her asylum screening but the parent passes his, both parent and child will be allowed to apply for asylum. This is the way things normally work when families are apprehended together; by instituting it now, the government is essentially wiping away the legal side effects of family separation.
  • Parents who aren’t eligible for a credible fear interview because they had been deported before and were returning will still be allowed to avoid deportation if they meet a higher standard (“reasonable fear”) and qualify for something called “withholding of removal.” Even if they fail that standard, they will be allowed to stay in the US while their children are going through their asylum cases.
  • Parents who have already been deported will not have their cases automatically reviewed by the government. However, the plaintiffs in these lawsuits will have 30 days to present evidence to the government that particular parents should be allowed to return, and the government will consider those requests. (The agreement doesn’t make it clear whether deported parents will have their own cases reopened, or whether they will solely be allowed to return to stay with their children while the children’s legal cases are ongoing.)

If the agreement is approved, it will officially send the legal fight over family separation into its endgame phase. While hundreds of parents and children remain separated, the legal fight over reunification is largely about who’s responsible for carrying out various parts of the government’s reunification plan; the new agreement would set a similar plan up for the legal due process of parents and children making claims to stay in the US.

It would almost certainly run into similar implementation obstacles to the reunification plan, but it would set expectations that the government would provide this process by default, rather than moving forward with deportation.

The Trump administration is never going to wholly be able to erase the consequences of its decision to separate families as a matter of course. But it is now agreeing to give up the legal advantages that it accrued by separating parents’ and children’s cases — and forcing parents to go through interviews with life-or-death stakes without knowing when or whether they’d ever see their children again.

I’ve been saying it over and over again. Why not just do it right, provide full Due Process, and follow the law?

Not only are the policies being promoted by Sessions, Trump, and the rest of the GOP White Nationalists unconstitutional, illegal, vile, and immoral, they are totally wasteful of limited Government resources (particularly in a time of GOP-fueled budget deficits) and unnecessarily tie up the Federal Courts. Contrary to Jeff Sessions’s false narratives, no court system anywhere has unlimited time for all the nonsense that the Government could potentially pursue. When common sense and sane prosecutorial discretion lose out, they whole system suffers.

Think what might have happened if, instead of wasting time and money on illegal family separation, unnecessary criminal prosecutions, and bending protection law out of shape, the Government had done the right thing and spent the money:

  • Working with NGOs and legal aid groups to release folks in locations where they could get legal assistance, virtually guaranteeing their appearance in Immigration Court;
  • Agreeing to grant the many domestic violence and other types of gang-related cases that could have been granted after proper preparation and documentation under a proper application of the law (before Sessions messed it up);
  • Taking all of the cases of long-term law-abiding residents off overloaded Immigration Court dockets so that the real contested asylum cases could be given priority without denying anyone Due Process or moving everything else back through “Aimless Docket Reshuffling” (“ADR”).
  • Any “bad guys,” or “true economic migrants” could have been given full hearings, denied, and removed. But, totally contrary to Sessions’s racist blather, most of the folks arriving are actually legitimate refugees. They could have been granted status and allowed to go out and work and study to make America better. I’ve found few individuals (including many native-born US citizens) more grateful and willing to work hard and contribute than those granted asylum.
  • The money spent on wasteful litigation and needless, cruel and inhuman, detention could instead have been used;
    • to establish a viable overseas refugee screening program in the Northern Triangle;
    • working with other countries to share resettlement responsibilities;
    • and trying to correct the situations in the Northern Triangle which gave rise to the refugee flows in the first place.

Sadly, this is hardly the first, and probably by no means the last, time that the US Government has been forced to reprocess large numbers of asylum seekers because of a failure to follow Due Process and do the right thing in the first place. Just check out the history of the ABC v. Thornburgh litigation and settlement (a case I was involved in during my time in the “Legacy INS” General Counsel’s Office).

Indeed, the Trump scofflaws are “doubling down” on every failed policy fo the past. They actually are at it again with their bone-headed proposal to thumb their collective noses at Judge Dolly Gee and withdraw from the Flores settlement and set up a “Kiddie Gulag” by regulation. Good luck with that. The Trump Scofflaws are already wasting your taxpayer money on more “tent cities in the Kiddie Gulag” that they almost certainly will be enjoined from using at some point. Then, cooler heads will prevail and we’ll undoubtedly have a “Flores II” settlement.

Also, compare the real role of immigration lawyers in enforcing the law and holding Goverment scofflaws like Sessions and Nielsen accountable with the totally bogus picture painted by Sessions in his false, unethical, and highly inappropriate speech to US Immigration Judges this week. Truth is exactly the opposite of nearly everything that Jeff Sessions says.

Our country can’t afford the scofflaw conduct, inhumanity,  immorality, and wastefulness of Trump, Sessions, Miller and their racist White Nationalist cabal. Vote for regime change this Fall!

Over the course of four days in June, Keylin says, U.S. Border Patrol guards would kick her body to keep her awake throughout the night. The 16-year-old, whose last name was redacted from court documents, told a lawyer that she would lie in fear on the cement floor of the Border Patrol station in Texas, surrounded by chain-link fence. She was separated from her mother, who had been held at gunpoint three times in Honduras, after they crossed the U.S. border.

According to a court filing, Keylin says the female guards also made girls “strip naked” in front of them before taking a shower, so they could leer at their bodies (her mother, Daise, corroborated her daughter’s account in a statement she gave to a lawyer). She adds that guards called the group of migrants “filthy” and “made fun of us.”

Keylin barely ate because she says the food was frozen, and she wasn’t given a toothbrush or toothpaste. Though she says the cells were so cold that she shivered and developed pain in her leg, the teen kept quiet. The guards said that anyone with an injury would be detained longer, and she couldn’t take that chance.

“I was very frightened and depressed the entire time,” Keylin told a lawyer on June 29, after she had been transferred to a family detention center and reunited with her mother. “I am still depressed. I also have nightmares and a lot of anxiety because of the separation.” At the time of their June 29 declaration, there was no plan for Keylin and her mother’s release.

HuffPost learned that the Center for Human Rights and Constitutional Law filed a report in a federal court in Los Angeles on Monday with more than 200 accounts from migrant children and their parents, detailing the horrific conditions they face in Border Patrol stations, Immigration and Customs Enforcement facilities and detention centers. The allegations, which HuffPost reviewed, include physical and verbal assault, untenable sleeping conditions and unsanitary drinking water.

Peter Schey, the executive director of the law center’s foundation, wrote in the case filing that roughly 90 percent of the testimony he and a team of about 100 lawyers collected is “shocking and atrocious” and that the children they’ve spoken to were “crying, trembling, hungry, thirsty, sleepless, sick, and terrified.”

“The treatment of these children amounts to torture,” Schey told HuffPost, adding that the situation has become worse under the Trump administration. “We see a policy of enforced hunger, enforced dehydration and enforced sleeplessness coupled with routine insults and physical assaults.”

ICE and U.S. Customs and Border Protection (CPB) did not return HuffPost’s requests for comment.

Over the past two months, Schey and other lawyers have conducted interviews with migrant parents and children, some of whom were separated from one another under Trump’s zero tolerance policy, which stepped up the use of criminal prosecutions. The court filing does not include the current status of each child, and most said they were not told of their legal rights, including the right to be speedily released to a legal guardian or relative.

On July 27, the attorney will argue in federal court that the stations and facilities housing children are failing to meet the basic standards for hygiene, food, sleeping conditions and medical care, which are outlined in a 1997 court case called the Flores settlement.

Once migrants cross the border, they are put in short-term Border Patrol stations for a few days before being transferred to detention centers or shelters. While some kids have reported good conditions in longer-term shelters ― friendly staff, movie nights and field trips ― advocates and immigration experts have long considered Border Patrol facilities to be inhumane.

In May, Dixiana, whose last name is edited out along with those of all the other migrants interviewed in the court filing, says she was separated from her mother and taken to a Border Patrol station known as a “hielera” ― Spanish for “ice box” in reference to the cold temperature. The 10-year-old from Honduras told a lawyer her cell was so crowded that she and other girls had to sleep on the floor or while sitting up under bright lights.

She cried at the thought of never seeing her mother again, as did others in her cell.

For breakfast, Dixiana says a guard gave her a frozen ham sandwich but failed to bring her and her cellmates water. “The ham was black,” she told a lawyer. “I took one bite, but did not eat the rest because of the taste.” (One mother from Honduras said, “You could feel the ice when you bit into the sandwich.”)

After 12 hours, Dixiana was transferred to what she calls the “perrera”―Spanish for “dog house,” a reference to the chain-link fencing ― where she could see her mom in another cell. At one point when she was half asleep, Dixiana says a male officer kicked her awake while looking for a girl with a similar name to hers. Over the course of the next few days, she sat in a windowless cell with no idea if it was day or night, crying because she missed her mother.

How will Trump’s administration impact you?

The statements collected by lawyers clearly show that Border Patrol stations are no place for children. One mother, Floridalma, described how she and her 3-year-old were put in a 10-by-10-foot room with three other mothers and their children. Since they had only two mattresses, the group slept with their heads on the padding and their bodies on the cement floor.

Ruth, the mother of a 7-year-old boy, says the Border Patrol station was so cold that children were crying and getting sick. While she was separated from her son, she watched other women’s children get fevers, vomit and cough, while the guards refused to provide medicine.

The Border Patrol stations also fail to meet basic hygiene standards, according to the court filing. Many of the children describe the guards giving them water that tasted like chlorine. “I only drank it twice because I didn’t trust it,” said Justin, a 13-year-old from El Salvador. “It made me feel funny in my stomach the times I drank it.“ One mother, named Yojana, said, “We had to drink water from the toilet to keep hydrated.”

Children described going more than five days without bathing and having limited access to soap, toothbrushes and toothpaste. Fatima says that her 8-year-old daughter had to wear soiled underwear for two days because the guards wouldn’t allow her to use the shower.

Children also spoke to lawyers about issues in family detention centers and Office of Refugee Resettlement shelters, where they are detained for longer periods of time. Since June 8, 15-year-old Elmer has been staying in Casa Padre, America’s largest migrant children’s shelter, which MSNBC’s Jacob Soboroff described as resembling a “prison or jail.”

Elmer says that he is always hungry because there’s not enough food and that he wasn’t allowed to see a doctor when he felt sick. The 16-year-old says he told a lawyer that, although the boys, ages 10 to 17, are allowed outside for two hours a day, it is “unbearable” because there is nothing to protect them from the scorching sun. Elmer says that the guards don’t allow him to go to church and that he is rarely given any alone time in his room to process his feelings of loneliness and anxiety.

In addition to the horrible conditions within stations and shelters, children complained about the staff. The case filing contains multiple accounts of kids who say they were kicked by guards while sleeping, as well as instances of verbal abuse. Sixteen-year-old Erick says the guards in a California Border Patrol station call him and the other Guatemalan boys “burros,” the Spanish word for “donkey” or “stupid.” Another youth, whose name was completely blacked out in the court filing, said to a lawyer: “When I told the CPB officer that my mother was killed they made fun of me and said that I was ‘weak.’ I did not feel comfortable after that sharing my fear.”

While pediatricians and counselors have spoken about the long-term trauma that will result from family separation, children say in the court filing that their guards are less sympathetic.

Since Sergio was separated from his father and taken to Casa Padre in early June, he’s become so consumed with worry he can’t sleep. The 16-year-old has only been able to speak with his dad for 20 minutes in the last 45 days, and he told a lawyer that his father is getting deported. When a guard found him crying in the bathroom one night, Sergio said the man accused him of being a “crybaby,” an insult he followed with an English phrase that another boy translated as “swear words.” “The way I have been treated makes me feel like I don’t matter,” he said, “like I am trash.”

Schey, who conducted interviews with children in Casa Padre last week, said the separated kids he spoke with are “traumatized.” “They are not getting mental health services. They are experiencing depression and anxiety… and nightmares and sleeplessness.”

The law center’s court filing, which is more than 1,500 pages long, paints a dark picture of the cruel conditions many migrant children suffer through. On July 27, Schey will present their declarations in federal court and ask U.S. District Judge Dolly Gee to appoint an independent monitor who has the power to make sure facilities are meeting the standards outlined in the Flores settlement.

“This story is more than just separating children from their parents,” he told HuffPost. “The bigger picture is forced starvation and sleeplessness and terrorizing these children.”

So, get this! Gonzo, for no particular reason, reverses a well-established, working precedent — agreed upon by all parties, sponsored by DHS, and the product of 15 years of painstaking work by attorneys on both sides — that protected abused women under our refugee laws. This precedent, Matter of A-R-C-G-, actually saved lives and helped some of the most deserving and long-suffering refugees I dealt with in my decades long career enter and contribute to U.S. society. It was a perfect example of how asylum law could and should work to protect the most vulnerable! A “win – win” for the refugees and for our country!

Then, Sessions intentionally creates a system where these already abused refugees are detained and further abused and persecuted in the United States. Then, he returns them (without fair consideration of their claims for protection) to the countries in which they were persecuted to face further abuse, torture, or death.

The problems faced by women in detention were well-known in the Obama Administration. In fact, the Trump Administration immediately abolished the office within DHS that had been established to deal with allegations of sexual abuse. So, this isn’t “mere negligence.” It’s knowing and intentional misconduct! Usually, that results in criminal prosecution or civil liability!

(CNN)A federal judge on Monday ordered the US government to temporarily pause deportations of reunited families to allow attorneys time to debate whether he should more permanently extend that order.

San Diego-based US District Court Judge Dana Sabraw addressed the issue at the top of a status hearing in a continuing family separations case filed by the American Civil Liberties Union.
Sabraw ordered the pause to allow for a full written argument on the ACLU’s request to pause deportations of parents for a week after reunification.
The ACLU argued that the week would be necessary for parents to have time to fully consider the decision whether to have their children deported along with them.
The ACLU’s filing was made earlier Monday morning, and Sabraw gave the Department of Justice a week to respond.
But in the meantime, he ordered a “stay” of deportations until that issue can be litigated.

Lawyers for the ACLU said their motion was due to “the persistent and increasing rumors — which Defendants have refused to deny — that mass deportations may be carried out imminently and immediately upon reunification.” They argue this issue is “directly related to effectuating the Court’s ruling that parents make an informed, non-coerced decision if they are going to leave their children behind.”

“A one-week stay is a reasonable and appropriate remedy to ensure that the unimaginable trauma these families have suffered does not turn even worse because parents made an uninformed decision about the fate of their child,” the ACLU’s lawyers added.

Sounds like in the end, the “No-Due-Process Deportation Machine” will be allowed to resume. But, at least this gives the Judge a little time to pin the Government down on exactly what they are doing and to see for himself how Due Process is being compromised on a large-scale basis. In the end, permanently halting the “Deportation Railroad” might be beyond the scope of this particular suit.  Stay tuned for the result. However it comes out, it’s always good to make a complete record of the Government’s misconduct and revolting disrespect for laws, human life, fundamental fairness, and human dignity for the history books and future generations.

Do not misbehave. Do not sit on the floor. Do not share your food. Do not use nicknames. Also, it is best not to cry. Doing so might hurt your case.

Lights out by 9 p.m. and lights on at dawn, after which make your bed according to the step-by-step instructions posted on the wall. Wash and mop the bathroom, scrubbing the sinks and toilets. Then it is time to form a line for the walk to breakfast.

“You had to get in line for everything,” recalled Leticia, a girl from Guatemala.

Small, slight and with long black hair, Leticia was separated from her mother after they illegally crossed the border in late May. She was sent to a shelter in South Texas — one of more than 100 government-contracted detention facilities for migrant children around the country that are a rough blend of boarding school, day care center and medium security lockup. They are reserved for the likes of Leticia, 12, and her brother, Walter, 10.

The facility’s list of no-no’s also included this: Do not touch another child, even if that child is your hermanito or hermanita — your little brother or sister.

Leticia had hoped to give her little brother a reassuring hug. But “they told me I couldn’t touch him,” she recalled.

In response to an international outcry, President Trump recently issued an executive order to end his administration’s practice, first widely put into effect in May, of forcibly removing children from migrant parents who had entered the country illegally. Under that “zero-tolerance” policy for border enforcement, thousands of children were sent to holding facilities, sometimes hundreds or thousands of miles from where their parents were being held for criminal prosecution.

Last week, in trying to comply with a court order, the government returned slightly more than half of the 103 children under the age of 5 to their migrant parents.

But more than 2,800 children — some of them separated from their parents, some of them classified at the border as “unaccompanied minors” — remain in these facilities, where the environments range from impersonally austere to nearly bucolic, save for the fact that the children are formidably discouraged from leaving and their parents or guardians are nowhere in sight.

Depending on several variables, including happenstance, a child might be sent to a 33-acre youth shelter in Yonkers that features picnic tables, sports fields and even an outdoor pool. “Like summer camp,” said Representative Eliot L. Engel, a Democrat of New York who recently visited the campus.

Or that child could wind up at a converted motel along a tired Tucson strip of discount stores, gas stations and budget motels. Recreation takes place in a grassless compound, and the old motel’s damaged swimming pool is covered up.

Still, some elements of these detention centers seem universally shared, whether they are in northern Illinois or South Texas. The multiple rules. The wake-up calls and the lights-out calls. The several hours of schooling every day, which might include a civics class in American history and laws, though not necessarily the ones that led to their incarceration.

Most of all, these facilities are united by a collective sense of aching uncertainty — scores of children gathered under a roof who have no idea when they will see their parents again.

Leticia wrote letters from the shelter in South Texas to her mother, who was being held in Arizona, to tell her how much she missed her. She would quickly write these notes after she had finished her math worksheets, she said, so as not to violate yet another rule: No writing in your dorm room. No mail.

She kept the letters safe in a folder for the day when she and her mother would be reunited, though that still hasn’t happened. “I have a stack of them,” she said.

Another child asked her lawyer to post a letter to her detained mother, since she had not heard from her in the three weeks since they had been separated.

“Mommy, I love you and adore you and miss you so much,” the girl wrote in curvy block letters. And then she implored: “Please, Mom, communicate. Please, Mom. I hope that you’re OK and remember, you are the best thing in my life.”

The complicated matters of immigration reform and border enforcement have vexed American presidents for at least two generations. The Trump administration entered the White House in 2017 with a pledge to end the problems, and for several months, it chose one of the harshest deterrents ever employed by a modern president: the separation of migrant children from their parents.

This is what a few of those children will remember.

No Touching, No Running

Diego Magalhães, a Brazilian boy with a mop of curly brown hair, spent 43 days in a Chicago facility after being separated from his mother, Sirley Paixao, when they crossed the border in late May. He did not cry, just as he had promised her when they parted. He was proud of this. He is 10.

He spent the first night on the floor of a processing center with other children, then boarded an airplane the next day. “I thought they were taking me to see my mother,” he said. He was wrong.

Once in Chicago, he was handed new clothes that he likened to a uniform: shirts, two pairs of shorts, a sweatsuit, boxers and some items for hygiene. He was then assigned to a room with three other boys, including Diogo, 9, and Leonardo, 10, both from Brazil.

The three became fast friends, going to class together, playing lots of soccer and earning “big brother” status for being good role models for younger children. They were rewarded the privilege of playing video games.

There were rules. You couldn’t touch others. You couldn’t run. You had to wake up at 6:30 on weekdays, with the staff making banging noises until you got out of bed.

“You had to clean the bathroom,” Diego said. “I scrubbed the bathroom. We had to remove the trash bag full of dirty toilet paper. Everyone had to do it.”

Diego and the 15 other boys in their unit ate together. They had rice and beans, salami, some vegetables, the occasional pizza, and sometimes cake and ice cream. The burritos, he said, were bad.

Apart from worrying about when he would see his mother again, Diego said that he was not afraid, because he always behaved. He knew to watch for a staff member “who was not a good guy.” He had seen what happened to Adonias, a small boy from Guatemala who had fits and threw things around.

“They applied injections because he was very agitated,” Diego said. “He would destroy things.”

A person he described as “the doctor” injected Adonias in the middle of a class, Diego said. “He would fall asleep.”

Diego managed to stay calm, in part because he had promised his mother he would. Last week, a federal judge in Chicago ordered that Diego be reunited with his family. Before he left, he made time to say goodbye to Leonardo.

“We said ‘Ciao, good luck,” Diego recalled. “Have a good life.”

But because of the rules, the two boys did not hug.

After a month of outrage at the cruelty of President Trump’s “zero tolerance” policy, last week we saw a stream of confounding and divergent statements on immigration: The president suggested depriving undocumented migrants of due process; Attorney General Jeff Sessions insisted that every adult who crossed illegally would be prosecuted; and the commissioner of Customs and Border Protection announced that families would once again be released together to await trial. Meanwhile, thousands of separated children and their parents remain trapped in a web of shelters and detention facilities run by nonprofit groups and private prison, security and defense companies.

It is important to understand that the crisis of separation manufactured by the Trump administration is only the most visibly abhorrent manifestation of a decades-long project to create a “state of exception” along our southern border.

This concept was used by the Italian philosopher Giorgio Agamben in the aftermath of Sept. 11 to describe the states of emergency declared by governments to suspend or diminish rights and protections. In April, when the president deployed National Guard troops to the border (an action also taken by his two predecessors), he declared that “the situation at the border has now reached a point of crisis.” In fact, despite recent upticks, border crossings remained at historic lows and the border was more secure than ever — though we might ask, secure for whom?

For most Americans, what happens on the border remains out of sight and out of mind. But in the immigration enforcement community, the militarization of the border has given rise to a culture imbued with the language and tactics of war.

Border agents refer to migrants as “criminals,” “aliens,” “illegals,” “bodies” or “toncs” (possibly an acronym for “temporarily out of native country” or “territory of origin not known” — or a reference to the sound of a Maglite hitting a migrant’s skull). They are equipped with drones, helicopters, infrared cameras, radar, ground sensors and explosion-resistant vehicles. But their most deadly tool is geographic — the desert itself.

“Prevention Through Deterrence” came to define border enforcement in the 1990s, when the Border Patrol cracked down on migrant crossings in cities like El Paso. Walls were built, budgets ballooned and scores of new agents were hired to patrol border towns. Everywhere else, it was assumed, the hostile desert would do the dirty work of deterring crossers, away from the public eye.

Such defenses also gloss over the patrol’s casual brutality: I have witnessed agents scattering migrant groups in remote areas and destroying their water supplies, acts that have also been extensively documented by humanitarian groups.

The principle of deterrence is behind the current administration’s zero-tolerance policy. In an interview with Laura Ingraham on Fox News, Mr. Sessions, pressed on whether children were being separated from parents to deter crossers, conceded, “Yes, hopefully people will get the message.”

Administration officials have claimed that even this policy is “humanitarian,” in part because it may dissuade future migrants from bringing their children on the dangerous journey.

This ignores decades of proof that no matter what version of hell migrants are made to pass through at the border, they will endure it to escape far more tangible threats of violence in their home countries, to reunite with family or to secure some semblance of economic stability.

Policymakers also ignore that new enforcement measures almost always strengthen cartel-aligned human trafficking networks, giving them cause to increase their smuggling fees and push vulnerable migrants to make riskier crossings to avoid detection.

Jason De León, the director of the Undocumented Migration Project, argues that the government sees undocumented migrants as people “whose lives have no political or social value” and “whose deaths are of little consequence.”

This devaluation of migrant life is not just rhetorical: CNN recently revealed that the Border Patrol has been undercounting migrant deaths, failing to include more than 500 in its official tally of more than 6,000 deaths over 16 years — a literal erasure of lives.

The logic of deterrence is not unlike that of war: It has transformed the border into a state of exception where some of the most vulnerable people on earth face death and disappearance and where children are torn from their parents to send the message You are not safe here. In this sense, the situation at the border has reached a point of crisis — not one of criminality but of disregard for human life.

We cannot return to indifference. In the aftermath of our nation’s outcry against family separation, it is vital that we direct our outrage toward the violent policies that enabled it.

How They Defend the Indefensible

The Trump administration is playing a game of choose your own facts, but every single version of this story ends with screaming children in cages.

You can call it a “policy” (Jeff Sessions) or you can call it a not-policy (Kirstjen Nielsen) or you can call it a “law” (Sarah Huckabee Sanders). You can say that yes it’s a policy but nobody likes it (Kellyanne Conway) or you can say it’s a “zero-tolerance” enforcement of a Democratic law (Donald Trump) or a zero-tolerance enforcement of an amalgam of various congressional laws (Nielsen) or a zero-tolerance enforcement of the Department of Justice’s own preferences with respect to enforcing prior laws (Sessions).

You can say the purpose of the Justice Department’s family separation policy is deterrence (Stephen Miller, John Kelly) or you can claim that asking if the purpose of the policy is deterrence is “offensive” (Nielsen). You can claim in your legal pleadings that the family separation policy is wholly “discretionary” and thus unreviewable by any court, meaning that only the president can change it (Justice Department in Ms. L v. ICE). Or you can claim that only Congress can “fix loopholes” (Nielsen) or you can say that Congress as a whole can’t fix anything because congressional Democrats are entirely to blame (Trump, Mike Huckabee).

You can blame all this newfound “loophole” action on a consent decree from 1997 in a case called Flores (Sessions, Paul Ryan, Chuck Grassley) or on a 9th U.S. Circuit Court of Appeals decision that interpreted Flores (Nielsen) or on a 2008 law called the Trafficking Victims Protection Reauthorization Act (Nielsen). Better yet, you can fault some magical mashup of “the law” that forces you to defend every statute to its most absurd extreme (Sanders). By this logic, you can also claim that Korematsu—the case authorizing the removal and detention of Japanese Americans during World War II—is still on the books and thus needs to be enforced because it’s also “the law,” but that would be insane. Oh, but wait. Trump proxies made that very claim during the campaign (Carl Higbie).

You can pretend that by turning every adult who crosses the border into a presumptive criminal your hands are tied, so you need to jail children to avoid jailing children (Nielsen). You can insist that the vast majority of children who cross the border are being smuggled in by gang members (Nielsen) or that all asylum-seekers are per se criminals (which they are not) or that lawful asylum-seekers should just come back at a better time (Nielsen). You can claim you never intended your policy (if it is in fact a policy) to have any impact on asylum-seekers at all (Nielsen) but of course it would turn out you were lying and this has been the plan all along (John Lafferty, Department of Homeland Security asylum division chief).

You can say the Bible wants you to separate children from parents (Sessions). You can say again, incredibly, that the Bible wants you to separate children from parents (Sanders). But that would be pathetic (Stephen Colbert).

You can blame the press for the photographs they take (Nielsen) and for the photographs they don’t take (Nielsen). You can suggest that the children in cages are not real children (not linking to Ann Coulter) or that the cages are not in fact cages (Steve Doocy) even though government officials admit that they are cages. You can claim that the detention facilities are “summer camps” or “boarding schools” (Laura Ingraham). You can take umbrage that the good people of DHS and CBP and ICE are being maligned (Nielsen).

You can say that separating children from their parents is a strategic move to force an agreement on Trump’s wall, which would make the children purely instrumental (Trump). Or you could say that this is a way to protect children by deterring their parents, which would also make the children purely instrumental (Kelly). Or you can instead say you are protecting the children from all the harm that happens to children transported over borders by doing untold permanent damage to them as they scream in trauma (Nielsen). Because the best way to deter child abuse is through child abuse.

You can fight to the death about comparisons to Nazis or you can celebrate a candidate (Corey Stewart) who is a hero to Nazis or you can merely show a staggering lack of comprehension about what Nazis actually did (Sessions).

You can fact check and fact check and fact check these claims and it won’t matter that they are false. And the fact that nobody in this administration even bothers to coordinate their cover stories at this point reflects just how pointless it is to fact check them anyhow. It’s an interactive game of choose your own logic, law, facts, and victims, but every single version of this story ends with screaming children in cages, sleeping under foil blankets as strangers change their diapers. The trick is twisting and dodging and weaving until you get to that final page.

It is very sad (Melania Trump). Something should be done (Ted Cruz). If only there were some mechanism to stop torturing children. If only there were some way to stop litigating why we’re doing it and who is doing it and just stop doing it.

False claim: Family separations are Democrats’ fault

Trump said the family separations at the border are “a result of Democrat-supported loopholes in our federal laws” that he said could be easily changed.
“These are crippling loopholes that cause family separation, which we don’t want,” Trump said.
The reality: Trump’s administration made a decision to prosecute 100% of adults caught crossing the border illegally even if they came with children, and thus are separating parents from their kids at the border with no clear plan to reunite them after the parents return from jail and court proceedings.
The administration has long wanted to roll back a law unanimously passed under President George W. Bush and a court settlement dating back decades but most recently affirmed under the Obama administration — citing those two provisions as “loopholes.” Both were designed to protect immigrant children from dangers like human trafficking and to provide minimum standards for their care, including turning them over to the Department of Health and Human Services for resettlement within three days of arrest, as opposed to being held in lengthy detention, and dictating that children with their families also cannot be held in detention or jail-like conditions longer than three weeks.
The administration has complained the laws make it harder to immediately deport or reject immigrants at the border, and that they are not able to detain families indefinitely.

Trump said his administration was hiring “thousands and thousands” of immigration judges, that the US already has “thousands” of immigration judges and that other countries don’t have immigration judges.

In reality, there the Justice Department’s immigration courts division has 335 judges nationwide, with more than 100 more judges budgeted for, according to a DOJ spokesman.
Because of a massive backlog in the immigration courts, it can take years for those cases to work their way to completion, and many immigrants are allowed to work and live in the US in the meantime, putting down roots. The funding for immigration courts and judges has increased only modestly over the years as funding and resources for enforcement have increased dramatically. A proposal from Sen. Ted Cruz, R-Texas, to address the family separation issue would double the number of judges to 750.
Trump’s comments Tuesday echoed remarks he made last month. In a May Fox News interview, he claimed the United States was “essentially the only country that has judges” to handle immigration cases. But that is incorrect.
A number of other countries have immigration court systems or a part of the judiciary reserved for immigration and asylum cases, including Sweden, the United Kingdom and Canada.

False claim: Virtually all immigrants disappear

Trump also claimed falsely that when immigrants are let into the country to have their cases heard by a court, they virtually all go into hiding.
“And by the way, when we release the people, they never come back to the judge, anyway. They’re gone,” Trump said. “Do you know if a person comes in and puts one foot on our ground, it’s essentially, ‘Welcome to America, welcome to our country.’ You never get them out because they take their name, they bring the name down, they file it, then they let the person go. … Like 3% come back.”
In reality, the number of immigrants who don’t show up to court proceedings is far lower. And many of the immigrants released from detention are given monitoring devices such as ankle bracelets to ensure they return.

According to the annual Justice Department yearbook of immigration statistics from fiscal year 2016, the most recent year for which data is available, 25% of immigration court cases were decided “in absentia” — meaning the immigrant wasn’t present in court. In that year, there were 137,875 cases. The number of cases decided “in absentia” between fiscal year 2012 and fiscal year 2016 was between 11% and 28%.
When White House legislative chief Marc Short made a similarly inaccurate claim on Monday, the White House pointed to a statistic about the high percentage of deportation orders for undocumented children that were delivered in absentia, but amid total case completions for minors, the number of in absentia orders has ranged from 40% to 50% in recent years.
Advocates for immigrants attribute some of the missed hearings to often not receiving a court notice mailed to an old address or not having an attorney who can adequately explain the process to the child. Studies have shown that with legal advice and guidance, immigrants are far more likely to show up for hearings and have their claims ultimately be successful.

False claim: Countries are sending bad eggs to the US

Trump said that countries deserve to be punished for illegal immigration, and that they “send” bad eggs to the US.
“They send these people up, and they’re not sending their finest,” Trump said.
He continued: ‘When countries abuse us by sending people up — not their best — we’re not going to give any more aid to those countries.”
In fact, there is no evidence that countries “send” anyone in particular to the US — rather analyses of recent immigration flows have shown that in recent years, a much higher number of Central Americans have come to the US fleeing rampant gang violence and instability in especially the countries of El Salvador, Honduras and Guatemala. Experts who study the countries agree that cutting aid would only further destabilize the region, likely making illegal immigration worse, not better.
Though gang members do cross the border illegally alongside those fleeing violence, the administration has never been able to provide numbers showing that those are a large percentage of the cases. Only a handful of such prosecutions occur a year, while more than 300,000 people were apprehended trying to cross the border illegally last fiscal year. Nearly 120,000 defensive asylum applications were filed last year, according to government data, meaning those individuals believed they were fleeing violent situations back home.

As for Mexico’s contribution, experts say the country’s crackdown on immigrants within its borders has been a major help to the US in recent years. According to statistics from the US and Mexican governments compiled by the nonpartisan Migration Policy Institute and shared with CNN, over the past three years, Mexico has deported tens of thousands more migrants back to the primary countries in Central America that drive immigration north. Each of the last three years, Mexican removals exceeded US removals to those countries.
Mexico is also apprehending tens of thousands of Central Americans before they reach the US. According to the data, Mexico intercepted 173,000 Central Americans in fiscal year 2015, 151,000 in fiscal year 2016 and just under 100,000 in fiscal year 2017.
In the past two years, Mexico has lagged behind the US in apprehensions, but Migration Policy Institute President Andrew Selee, an expert on Mexican policy, said that could be due to a number of factors including smugglers successfully changing their routes to avoid detection or relations with Trump.

The events occurring now on our border with Mexico, where children are being removed from the arms of their mothers and fathers and sent to foster families or “shelters”, make me weep and gnash my teeth with sadness and rage. I know what they are going through. When we were children, my two siblings and I were also taken from our parents. And the problems we’ve experienced since then portend the terrible things that many of these children are bound to suffer.

My family was Jewish, living in 1942 in the Netherlands when the country was occupied by the Nazis. We children were sent into hiding, with foster families who risked arrest and death by taking us in. They protected us, they loved us, and we were extremely lucky to have survived the war and been well cared for.

Yet the lasting damage inflicted by that separation reverberates to this day, decades hence.

Have you heard the screams and seen the panic of a three-year-old when it has lost sight of its mother in a supermarket? That scream subsides when mother reappears around the end of the aisle.

This is my brother writing in recent years. He tries to deal with his lasting pain through memoir. It’s been 76 years, yet he revisits the separation obsessively. He still writes about it in the present tense:

In the first home I scream for six weeks. Then I am moved to another family, and I stop screaming. I give up. Nothing around me is known to me. All those around me are strangers. I have no past. I have no future. I have no identity. I am nowhere. I am frozen in fear. It is the only emotion I possess now. As a three-year-old child, I believe that I must have made some terrible mistake to have caused my known world to disappear. I spend the rest of my life trying desperately not to make another mistake.

My brother’s second foster family cared deeply about him and has kept in touch with him all these years. Even so, he is almost 80 years old now and is still trying to understand what made him the anxious and dysfunctional person he turned into as a child and has remained for the rest of his life: a man with charm and intelligence, yet who could never keep a job because of his inability to complete tasks. After all, if he persisted he might make a mistake again, and that would bring his world to another end.

My younger sister was separated from our parents at five. She had no understanding of what was going on and why she suddenly had to live with a strange set of adults. She suffered thereafter from lifelong, profound depression.

I was older: seven. I was more able than my siblings to understand what was happening and why. I spent most of the war with Dick and Ella Rijnders. Dick was mayor of a small, rural village, and he and Ella lived in a beautiful house next to a wide waterway. Ella had a warm smile and Dick referred to me as his “oldest daughter”. I was able to go to school normally, make friends, and became part of village life. I was extraordinarily lucky, but I was not with my own parents, sister, and brother. And, eventually, I also had to leave the Rijnders, my loving second “family”. I was returning to my own family, but this meant another separation.

In later life, I was never able to really settle down. I lived in different countries and was successful in work, but never able to form lasting relationships with partners. I never married. I almost forgot to mention my own anxiety and depression, and my many years in psychotherapy.

My grief and anger about today’s southern border come not just from my personal life. As a retired psychotherapist who has worked extensively with victims of childhood trauma, I know all too well what awaits many of the thousands of children, taken by our government at the border, who are now in “processing centers” and foster homes – no matter how decent and caring those places might be. We can expect thousands of lives to be damaged, for many years or for ever, by “zero tolerance”. We can expect old men and women, decades from now, still suffering, still remembering, still writing in the present tense.

What is happening in our own backyard today is as evil and criminal as what happened to me and my siblings as children in Nazi Europe. It needs to be stopped immediately.

In fairness to Dershowitz he has asked President Trump to end the cruel and inhuman policy of child abusez/child separation. http://www.foxnews.com/opinion/2018/06/18/alan-dershowitz-mr-president-please-end-policy-separating-children-from-parents.html But, his “put down” of the parallels with Nazism is highly disingenuous for the following reasons:

  • This about race.  It is no accident that virtually all of the separated parents and kids are Hispanic and the few others affected are almost all “of color.”  We wouldn’t be having all this ruckus if the arrivals were White. Trump, Sessions, and Miller are White Nationalists in the “Bannon Mode.” Kelly and Nielsen have decided to come out of the closet and reveal their racist sympathies.
  • The harm is permanent. All experts say that the harm intentionally inflicted in these kids will be permanently disabling.  More blogging on that later.
  • We’re sending these families to concentration camps masquerading as countries. Make no mistake about it, most of these folks are refugees fleeing persecution and torture at the hands of gangs and cartels that basically are the government in much of the Northern  Triangle. Sessions & Trump have intentionally misconstrued the law, misrepresented facts, and violated Constitutional Due Process to artificially deny most of these individuals legal protections they deserve. Their return is likely to mean death, torture, a lifetime of abuse, extortion, rape, sexual enslavement, forced drug trafficking, or prostitution.  Others will be forcibly impressed into a life of serving the gangs because we have turned our collective backs on them. Inhumanity is inhumanity; it’s only a matter of degree. And, that the Nazis were even worse in no way makes any difference to those we are sentencing to death, torture, or a lifetime of abuse. Dead is dead. Tortured is tortured. Decapitated is functionally the same as shot or gassed.
  • Sessions keeps parroting that misdemeanor unlawful entry “isn’t a victimless crime.” Perhaps he’s right. The “victims” here are the migrants and their families seeking to exercise legal rights to apply for asylum. The “criminals” are Sessions, Trump, Nielsen, Miller, Kelly and other Administration hard liners who engage in child abuse rather than protection. And, they lie about what and why they are doing it.  Who will eventually bring the real criminals to justice?

TRUMP TREATS KIDS AS HUMAN PAWNS IN UGLY POLITICAL CHESS GAME – Administration’s Continued Spreading Of False Narrative On Migration Makes Continuing Migration Outside of Legal System Inevitable!

President Trump has calculated that he will gain political leverage in congressional negotiations by continuing to enforce a policy he claims to hate — separating immigrant parents from their young children at the southern border, according to White House officials.

On Friday, Trump suggested he would not change the policy unless Democrats agreed to his other immigration demands, which include funding a border wall, tightening the rules for border enforcement and curbing legal entry. He also is intent on pushing members of his party to vote for a compromise measure that would achieve those long-standing priorities.

Trump’s public acknowledgment that he was willing to let the policy continue as he pursued his political goals came as the president once again blamed Democrats for a policy enacted and touted by his own administration.

“The Democrats are forcing the breakup of families at the Border with their horrible and cruel legislative agenda,” he tweeted. After listing his demands in any immigration bill, he added, “Go for it! WIN!”

The attempt to gain advantage from a practice the American Academy of Pediatrics describes as causing children “irreparable harm” sets up a high-stakes gambit for Trump, whose political career has long benefited from harsh rhetoric on immigration.

Democrats have latched onto the issue and vowed to fight in the court of public opinion, with leaders planning trips to the border to highlight the stories of separated families, already the focus of news media attention. Democratic candidates running for vulnerable Republican seats also have begun to make the harsh treatment of children a centerpiece of their campaigns.

The policy has cracked Trump’s usually united conservative base, with a wide array of religious leaders and groups denouncing it. The U.S. Conference of Catholic Bishops and the Southern Baptist Convention issued statements critical of the practice.

The Rev. Samuel Rodriguez, who delivered a prayer at Trump’s inauguration, signed a letter calling the practice “horrible.” Pastor Franklin Graham of Samaritan’s Purse, a vocal supporter of the president’s who has brushed aside past Trump controversies, called it “terrible” and “disgraceful.”

Besides increasing the odds of a broader immigration bill, senior Trump strategists believe that the child separation policy will deter the flow of migrant families across the border. Nearly 2,000 immigrant children were separated from parents during six weeks in April and May, according to the Department of Homeland Security. The figure is the only one released by the goverment.

“The president has told folks that in lieu of the laws being fixed, he wants to use the enforcement mechanisms that we have,” a White House official said. “The thinking in the building is to force people to the table.”

Trump reinforced that notion Friday morning at the White House when he suggested Democrats alone had the power to alter the policy.

“I hate the children being taken away,” Trump said.

The president used a similar strategy last year as he sought to gain approval for his immigration demands by using the lure of protection for young immigrants brought to the United States as children. That effort, which ran counter to Trump’s earlier promise to sign a bipartisan bill protecting the young immigrants, foundered in Congress.

The current policy resulted from a decision made in April by Attorney General Jeff Sessions to prosecute all migrants who cross the border, including those with young children. Those migrants had avoided detention during the administrations of George W. Bush and Barack Obama. Because of a 1997 court settlement that bars children from being imprisoned with parents, Justice Department officials now say they have no choice but to isolate the children.

Sessions and White House press secretary Sarah Huckabee Sanders have defended the policy as a sound, and biblical, decision to enforce the law.

“The previous administration wouldn’t prosecute illegal aliens who entered the country with children,” Sessions said Thursday in Fort Wayne, Ind., citing biblical advice to follow laws. “It was de facto open borders.”

The biblical underpinnings have been challenged by religious leaders.

“There’s definitely a groundswell of opposition from virtually every corner of the Christian community,” said Russell Moore, president of the Ethics and Religious Liberty Commission of the Southern Baptist Convention. “People are able to understand immediately the drive of parents to protect their child and to understand the horror of splitting up vulnerable children from their parents.”

Yet several key Trump administration officials support the family separation policy, including Chief of Staff John F. Kelly, Homeland Security Secretary Kirstjen Nielsen and senior adviser Stephen Miller, a vocal supporter of stricter immigration laws.

Some senior officials think Democrats will be pressured by the policy to cut an immigration deal.

“If they aren’t going to cooperate, we are going to look to utilize the laws as hard as we can,” said a second White House official.

Others have argued that the main benefit of the policy is deterrence. Miller has said internally that the child separations will bring the numbers down at the border, a goal that Trump wants to achieve. Miller and Marc Short, the White House director of legislative affairs, have argued that immigration legislation is unlikely to pass this summer, officials said.

“The side effect of zero tolerance is that fewer people will come up illegally, and fewer minors would be put in danger,” said a third senior administration official. “What is more dangerous to a minor, the 4,000-mile journey to America or the short-term detention of their parents?”

So, the choice is ““What is more dangerous to a minor, the 4,000-mile journey to America or the short-term detention of their parents?” Not really!

The real choices are 1) a dangerous 4,000 mile journey to a place where you might be able to save your life and that of your loved ones; or 2) the much more dangerous option of remaining in a place where you will likely be beaten, raped, extorted, tortured, impressed against your will, or killed by gangs, who are not just “street criminals” (as falsely portrayed by Sessions and other restrictionists) but who exercise quasi-governmental authority with the knowing acquiescence of the recognized governments. 

Realistically, folks are going to opt for #1. We could recognize them as refugees; screen them abroad to weed out gang members and criminals and to take the danger out of the 4,000 mile journey; work with the UNHCR and other countries to distribute the flow; open more paths to legal immigration for those who want to leave but might not fit easily within the refugee definition; and encourage those who still arrive at our borders without documents seeking protection to go to a port of entry where they will be treated respectfully, humanely, and be given a prompt but full opportunity to present their cases for protection with access to counsel in a system that satisfies all the requirements of Constitutional Due Process, with the additional understanding that if they lose they will have to return to their home country.

Alternatively, we could double down on our current failed policies of detention, deterrence, and lawless and immoral Governmental behavior; send the message that folks shouldn’t bother using our legal system because it’s a fraud that has intentionally been fixed against them; encourage the use of smugglers who will charge ever higher fees for developing new and more dangerous means of entry; and send the message that if folks rally want to survive, they should pay a smuggler to get them into the interior of our country where they have at least a fighting chance of blending in, hiding out from immigration enforcement, behaving themselves, and working hard until they are caught and removed, die, conditions improve and they leave voluntarily for their country of origin, or we finally give them some type of legal recognition.

My first alternative could likely be established and operated for a fraction of what we are now spending on failed immigration enforcement, useless and unnecessarily cruel detention, unnecessary criminal prosecutions, and a broken Immigration Court system.

Plus, at a time of low birth rate and low unemployment, it would give us a significant economic boost by bringing a highly motivated, hard-working, family oriented, and appreciative workforce into our society. It might also inspire other stable democratic nations to join us in an effort to save lives (which also happens to fit in well with religious values), resettle individuals, and, over time, address the horrible situation in the Northern Triangle that is creating this flow.

Alternative two, which is basically a variation on what we already are doing, will guarantee a continuing “black market flow”of migrants, some of whom will be apprehended and removed at significant financial and societal costs, while most will continue to live in an underground society, subject to exploitation by unscrupulous employers and law enforcement, underutilizing their skills, and not being given the opportunity to integrate fully into our society.

The thing we will not be able to do is to halt human migration solely by law enforcement actions taken at “our end” of the chain. That is, unless we wish to establish a “Stalinist type state” that is so grim and repressive that nobody wants to come any more. 

Kids as human pawns. Child abuse as policy. Dreamers as hostages. Jesus told us to do it. It’s the Democrats fault. I really hate to let Jeff abuse children, but I have no choice. Refugee women fleeing gang controlled states reduced to human scum who should just accept their beatings and rape and get in the non-existent line for legal immigration that we want to eliminate. That is, if they actually live long enough to get in the non-existent line, which is unlikely. Biased judges cheering the chance to sign death warrants for the most vulnerable among us. Courts clogged with refugees being prosecuted for seeking refuge while being pressured by seizure of their children into giving up rights.

Once again, I’ve been proved right: We are actively diminishing ourselves as a nation every day; but, it isn’t stopping, and won’t in the long run stop, human migration. Sure, there is a natural ebb and flow that responds in some minor ways to our futile attempts to stop it. Sort of like throwing up man-made sand bars to stop beach erosion. Works for a few months or even years, but eventually the inevitable forces of nature win out. It sure seems to me that it would be smarter to work with the flow of the river and turn it to our advantage, rather than trying to make it reverse course — an exercise in futility that only serves to diminish the humanity of each of us.
