Federal judge approves settlement barring migrant family separations

A federal judge approved a settlement that prohibits U.S. officials from separating migrant families for crossing the U.S.-Mexico border illegally.

The settlement involves a 2018 lawsuit filed by the American Civil Liberties Union to block the Trump administration’s “zero tolerance” policy, which called for separating parents from their children to prosecute the adults for crossing the border illegally. Officials sent parents to detention centers and children to shelters, without a plan to reunite them, under the policy. Some were apart for months, some for years.

“It does represent, in my view, one of the most shameful chapters in the history of our country,” U.S. District Judge Dana M. Sabraw said before he approved the settlement in a hearing that recalled the shock and disbelief surrounding the policy in 2018.

Under the settlement approved Friday, crossing the border illegally will no longer be a reason to separate a family, at least for the next eight years, which is how long that provision will last, lawyers said. The Justice Department has said the government will not prosecute parents for crossing the border without permission, a misdemeanor, or for the felony crime of reentering after being deported.

The settlement also offers aid to once-separated families so that they may apply to stay in the United States permanently. Those who were deported may apply to come back. Their immigration records will be cleared, giving them a fresh start on applying for humanitarian protection such as asylum.

Once they are in the United States, formerly separated families may apply for three-year work permits, six months of housing assistance and one year of medical care, according to the settlement. The families also are eligible for three years of counseling under the settlement.

Sabraw, a Republican nominee, declared the separations unlawful and ordered the families reunited in June 2018, after President Donald Trump halted the policy amid widespread condemnation.

Trump’s zero-tolerance policy ran from May to June 2018. Later, investigations determined that officials separated migrant families throughout Trump’s four-year term, which ended in January 2021.

Biden administration officials said the Trump administration separated more than 4,000 children from their parents, though past estimates have put that figure as high as 5,500. Lawyers for the ACLU, which represented the migrant families in court, estimated that as many as 1,000 children may still be separated from their parents. Advocates are trying to track them down.

The ACLU has called the case the most significant settlement in the organization’s 103-year history.

“This settlement brings much needed help to these brutalized children but there remains significant work to ensure that every family is now reunited and to monitor that no future administration tries to circumvent the agreement and reenact the same horrific policy,” Lee Gelernt, an ACLU lawyer and the lead counsel in the case, said in a statement.

Since Amy Coney Barrett was nominated to the Supreme Court, Republicans have suggested that one of the reasons she should be given a lifetime appointment on the highest court of the land is that she has seven kids. Barrett is “a remarkable mother” with “seven beautiful children,” Senator Thom Tillis said during the first day of her confirmation hearing. She’s a “tireless mother of seven,” Senator Chuck Grassley told the room. “She and her husband have seven children,” Senator Lindsey Graham said in his opening remarks, in case anyone hadn’t heard, before giving her two more. “She and her husband have seven children. Two adopted. Nine seems to be a good number,” he said. Obviously, constantly bringing up this part of Barrett’s biography is part of an attempt on Republicans’ part to (1) draw a distinction between Barrett and what they view as childless heathen Democrats, (2) claim that any opposition to her confirmation is anti-mom, and (3) suggest that since she’s a mother, she must be a good person who couldn’t possibly issue rulings that would hurt millions of people.

But, surprise! Despite being a mother, Barrett is expected to help overturn the Affordable Care Act. (After she was asked about this possibility, which would strip health insurance from millions, Grassley raged at his Democratic colleagues that “As a mother of seven, Judge Barrett clearly understands the importance of health care.”) She will also very likely go after Roe v. Wade, if given the chance, which some mothers would point out prevents their daughters—or even women they didn’t give birth to!— from being forced into back alley abortions. And even though she’s a mom of seven children, she apparently thinks the jury is still out on whether or not it’s bad to separate small children from their parents, if they happen to be from another country: . . . .

Just for the record, the Trump DOJ conceded before U.S. District Judge Dana Sabraw (a GOP appointee) that intentional child separation is a violation of Fifth Amendment Due Process.

They also declined to appeal Judge Sabraw’s order to that effect – unusual for a regime that usually pushes the most frivolous, clearly illegal, and unethical positions for as long as possible to the highest levels of the judiciary (knowing that the “Roberts” Five” believes that ethical requirements and disciplinary procedures don’t apply to the Trump legal team assembled on your taxpayer dollars).

Wonder what would happen if we had a more honest and realistic confirmation system that allowed nominees to actually answer truthfully, rather than disingenuously claiming under oath that after a lifetime of intense public involvement in the law, politics, and public policy, they had no real views on anything of any importance whatsoever?

I actually doubt that an honest answer to this question, either way, would have cost Coney Barrett her politically-assured confirmation, nor would it have required recusal in any litigation likely to reach the Supremes’ merits docket.  So, Coney Barrett thinks we’re dumb enough to believe that after several days of her GOP sponsors touting the wonderfulness of her bold embrace of their far-right agenda — the first overtly “pro-life woman Justice” — that they are badly mistaken and, in fact, she has no views or opinions on anything.

 

It kind of reminds me of the “super-disclaimer” I used to give on those occasions when my “EOIR handlers” let me speak in public: “Nothing that I say today represents my view on any case that I decided in the past, is pending before me, or might come before me in the future.”

 

On the bright side, Coney Barrett was able to (sort of) answer the question of Sen. John “I’m Not JFK” Kennedy (R-LA) about who does the laundry at her home (supposed to be her kids, but apparently they haven’t completely gotten the message. Now, if ACB were before me in Immigration Court, this is the point when I would have turned to the kids and said “Come on kids, Mom’s doing it all for you and others, I want you to give her and your Dad a hand.”)

 

Seriously, though, Dems, here’s the definition of Justice Amy Coney Barrett: “It’s what you get when lose elections for the White House and the Senate.” If you really want the next woman Justice to be a worthy progressive successor to the legacy of RBG and a “soul mate” for Justice Sonia Sotomayor, then go out and win the elections necessary to make that happen!

 

Another huge plus: If we Dems could figure out how to translate our national political majority into control of all three political arms, we could shore up health care, address COVID in a rational way, help Americans who have lost livelihoods and confidence because of COVID, and create educational opportunities and jobs that will be durable and serve us well in the Post-COVID world. We could also address the deficit by undoing the revenue shortage resulting from unwarranted tax giveaways to the wealthy, and get “more bang for our tax dollars” by running government wisely, prudently, and efficiently, for the overall public good rather than for the benefit of grifters and their selfish, anti-democracy far-right agenda.

 

Then, we could see whether Justice Barrett will stick to her word and urge her colleagues to “let the political branches of Government make policy.” That’s something that has been a challenge for past right-wing jurists, including the late Justice Scalia. But, if it actually happened, it would make the issue of “enhancing” the Supremes with progressive Justices largely moot.

 

Which is probably why Joe & Kamala have wisely refused to “take the GOP bait” on how they might specifically solve a problem that might or might not exist in the future. I do know one thing, however. As reflective, reasonable, and thoughtful public officials who listen to expert advice, they will promote the best possible solution for all Americans under the circumstances. That’s certainly a “quantum leap” over where we are today!

New questions raised on Trump’s family separations as 14 children discovered

WASHINGTON — The Trump administration failed to recognize that 14 children in its care for months had been separated from their families at the Mexican border, officials conceded in a court filing late Thursday.

The disclosure raises fresh questions about whether the administration neglected to account for additional children after separating them from their parents under its “zero tolerance” immigration policy this spring. Two recent government reports faulted the administration’s tracking efforts, and one said officials feel no obligation to find children who were released to other homes before a judge ordered an accounting of the youths, suggesting the total separated under the policy may never be known.

Seven of the 14 children’s parents have criminal histories that disqualify them from reunification, officials with the Health and Human Services Department told a federal judge in San Diego. The judge demanded in June that the administration account for every child separated under the enforcement strategy ordered by Attorney General Jeff Sessions.

All of the newly discovered children are 5 years old or older.

Mr. Sandoval-Moshenberg, who represented the plaintiffs, said that many parents were evaluated for “credible fear” after having their children removed, but before they were told where the children had been taken. He said his team submitted evidence showing that, during the interviews, the parents were “out of their minds with trauma, focused solely on the well-being and the whereabouts of their kids.”

In one piece of evidence included in the case, a recording of an immigration judge questioning a mother about her asylum claim, the mother can be heard crying too hard to answer the judge’s questions and says that she feels sick, Mr. Sandoval-Moshenberg said. After a few minutes, he said, the judge affirms an asylum officer’s finding that the woman’s fear of returning to her home country is not credible and asks that she be taken to see a doctor.

TAL @ CNN – JUDGE “VERY ENCOURAGED” WITH PROGRESS ON REUNITING CHILDREN WITH FAMILIES!

Only 54 children to be reunited by court deadline, but judges praises ‘progress’

Roughly half of the children under 5 years old who were separated from their parents at the border will be back with their moms and dads by a court-imposed deadline Tuesday, but the Trump administration is still not sure when the rest will be reunified.

Still, at a court hearing on Monday, the federal judge who set the deadline for reunifications said he was “very encouraged” thus far.

“There’s no question that the parties are meeting and conferring,” District  said. “This is real progress and I’m optimistic that many of these families will be reunited tomorrow, and then we’ll have a very clear understanding as to who has not been reunited, why not, and what time-frame will be in place.”

The hearing only covered the roughly 100 children under the age of 5 who were separated from their parents under the administration’s “zero tolerance” border prosecution policy. That group must be reunited by Tuesday under a deadline Sabraw set two weeks ago, when he first ordered the government to put the families back together.

The government still has thousands more children aged 5 and older in its custody that it will have to reunite by July 26 — but the hearing did not cover that group.

Attorneys for the government and the American Civil Liberties Union, which filed the original lawsuit challenging family separations, said they worked together intensely over the weekend to identify the families affected by the deadline and to work out how to move forward.

Justice Department attorney Sarah Fabian provided the court with the most detailed data thus far on the 102 children under age 5 whom it identified as separated from their parents at the border.

The aim of President Donald Trump’s new policy of splitting kids from their mothers at the border is, in a word, deterrence: The White House wants to discourage more immigrants from trying to enter the United States.

Kirstjen Nielsen, Trump’s secretary of homeland security, is careful not to say this outright — she dodged a direct question on the subject from Sen. Kamala Harris (D-Calif.) at a hearing last month.

There’s a reason Nielsen and other administration officials shy away from attaching the word “deterrence” to the new policy: Changing immigrant detention policy as a way to deter undocumented people from coming to the U.S. is illegal, federal courts have repeatedly ruled. So now she and other Trump administration officials find themselves struggling to defend a family separation policy whose clear ambition is deterrence.

A growing number of mothers have crossed into the United States since 2014, often from Central America and often requesting asylum. Other administration officials were blunter in the past when discussing a policy that would split the families up to scare them away from coming.

The Department of Homeland Security was considering separating children from their parents “in order to deter” undocumented immigration, White House chief of staff John Kelly told CNN while serving as Nielsen’s predecessor last year. And Gene Hamilton, a former aide to Attorney General Jeff Sessions, asked participants at a meeting last August on the policy to “generate paperwork laying out everything we could do to deter immigrants from coming to the U.S. illegally,” according to The New Yorker.

Whether or not the deterrence goal is spelled out, the strategy is likely to backfire. Former President Barack Obama learned that lesson in 2015, when a federal judge in Washington blocked his plans to lock up Central American immigrant mothers and their kids without bond to deter others from trying to cross the border.

U.S. District Judge James Boasberg ruled that the federal government can’t detain immigrants indefinitely for the sake of deterrence alone. Instead, the decision to detain needed to be based on whether the immigrant posed a threat to the community or a flight risk.

The Obama administration was forced to provide bond hearings to the migrants in family detention. A separate ruling that year ordered the Obama administration to start releasing people from family detention after three weeks in order to comply with the Flores settlement, a 1997 deal that bars the government from locking up children in detention centers.

The Trump administration hopes to skirt the rulings that got Obama officials into trouble by prosecuting immigrant parents at the border. The federal government can’t jail children while their mothers await trial, so immigration authorities transfer them to the Office of Refugee Resettlement to find a sponsor or to non-secured facility to hold them, as if they arrived by themselves.

But this legal maneuver stands on the same shaky ground.

“Whether the deterrence to seeking protection is being done by detaining families or separating families doesn’t make a whole lot of difference,” said Michelle Brané, the director of the Migrant Rights and Justice Program at the Women’s Refugee Commission. “They’re both punishing families for seeking protection, and protection to which they have the right under U.S. law.”

The Trump administration is already running into legal trouble over its policy. The American Civil Liberties Union filed a lawsuit in federal court in Southern California to overturn Trump’s family separation policy, asking U.S. District Judge Dana Sabraw for a nationwide injunction to halt the practice. At a hearing on May 4, Sabraw repeatedly asked whether the Trump administration had adopted the family separation policy to deter others.

“If there were a blanket policy to separate for deterrence value, would that be legal?” Sabraw asked, according to a transcript of the hearing. “Would that pass muster under the Fifth Amendment?”

The judge did not receive a straight answer. The government’s lawyer, Sarah Fabian, instead argued that the government wasn’t separating mothers from their kids systematically, and only following existing immigration law to do so.

Attorney General Jeff Sessions undermined her argument three days later, when he announced that the Justice Department’s “zero tolerance” policy for prosecuting border-crossers included mothers who cross with their children.

Lee Gelernt, the lawyer leading the ACLU lawsuit, called the government lawyer’s unwillingness or inability to defend family separation on the merits without resorting to the legally fraught term “deterrence” significant.

“The government still needs a persuasive justification for separating children,” Gelernt wrote in an email. “And the government has not provided one.”

On Wednesday, Sabraw ordered that the case against family separation can move forward, over the Trump administration’s objections. Although he has yet to rule on the case’s merits, his order did not augur well for the federal government.

Implementing a family separation policy to deter other migrants “arbitrarily tears at the sacred bond between parent and child,” Sabraw wrote. “Such conduct, if true, as it is assumed to be on the present motion, is brutal, offensive, and fails to comport with traditional notions of fair play and decency.”

Ah, the never-ending legal, moral, and intellectual corruption and dishonesty of the Trumpsters!

Take depositions — force them to lie under oath or admit they have been lying publicly. And, as I recently pointed out, most Article III Federal Judges, who actually have contempt of court authority, take a dim view of perjury by Cabinet Officers in their court proceedings.

I also think that even under the Supreme’s restrictive standards, there is an ever increasing possibility of actually imposing monetary damages on Nielsen, Sessions, and others for their intentional denial of Constitutional rights and their dishonest schemes to conceal their true intent. I actually think that when the full truth some day comes out, we will find not only illegal deterrence, but rather clear evidence of racial animus underlying Sessions’s policies. To be honest, Sessions has turned the entire U.S. Immigration Court system into a tool for enforcement deterrence — a huge violation of Due Process, as well as an astounding conflict of interest and violation of ethics.

Also, not surprisingly, the name of Sessions’s restrictionist crony Gene Hamilton has surfaced in connection with this scheme.

Judge rules that challenge to family separation at border can proceed

A federal judge in California ruled Wednesday that a challenge to the practice of separating parents seeking asylum from children at the border can proceed.

The ACLU brought the case against the Trump administration.

In her opinion, the  said “at a minimum, the facts alleged are sufficient to show the government conduct at issue ‘shocks the conscience’ and violates Plaintiffs’ constitutional right to family integrity. Accordingly, Defendants’ motion to dismiss Plaintiffs’ due process claim is denied.”

The ruling is a victory for critics of the administration’s separation of families — though plenty of hurdles remain before the practice is outlawed.

The ruling does not mean the challenge will ultimately succeed — but it is a substantial step for critics of any separating families who say the practice is abhorrent enough that it should be unconstitutional in any case. The judge’s ruling Wednesday keeps that argument alive.

Interestingly, although the statement of the law of Due Process was basically uncontested by the DOJ attorneys on the case, it conflicts in both tone and substance from most, if not all, of the statements about foreign nationals made by Trump, Sessions, Nielsen, Miller, Cotton, Goodlatte, and the rest of the GOP “White Nationalist gang” who seldom acknowledge that migrants coming to our Southern Border are human beings, let alone that they are actually protected by our Constitution!

I hope that the ACLU will depose Sessions in connection with this case. He has “spun” and lied about what’s really happening to asylum applicants, including those who appear at the border and apply for asylum without making an unlawful entry. Indeed, the “named plaintiff Ms L” is just such an individual who was, for no apparent reason other than cruelty and “deterrence,” separated from her young daughter for 4 months. She was only released when the ACLU filed this case.

Sessions has a history of bias, lawless behavior, and being a less than credible witness under oath. And, a U.S. District Judge might take misrepresentations or perjury more seriously than did the GOP Senators (Sessions’s former colleagues) on the Judiciary Committee.

Although the ultimate resolution of this case might be years down the line, it also raises an interesting question of whether Sessions, Nielsen, and other DHS officials can be held personally liable for a “Bivens Constitutional Tort” if they knowingly and intentionally violated the established Due Process rights of the plaintiffs. If the plaintiffs are correct in their allegations, it certainly seems that this is exactly what happened. Sessions is quickly establishing himself as one of the worst, probably the very worst, “Constitutional Scofflaws” in recent memory.

How bad is Sessions’s lack of respect for the Constitution? While the scared asylum applicants and their children that Sessions and his cronies seek to persecute present no real threat to our security as a nation, Jeff Sessions and his continuing war on equal justice for all, human decency, the law, ethics, and our Constitution is an existential threat to our national security and future as a democracy. He must be thwarted and eventually removed from office through our Constitutional system before it’s too late for everyone!
