If there were any lingering doubt that Donald Trump’s latest plan to curb asylum is flatly unlawful, Judge Jay Bybee quashed it on Friday.

In a meticulous 65-page opinion, Bybee—a conservative George W. Bush appointee—explained that the president cannot rewrite a federal statute to deny asylum to immigrants who enter the country without authorization. His decision for the 9th U.S. Circuit Court of Appeals is a twofold rebuke to Trump, halting the president’s legal assault on asylum-seekers and undermining his claim that any judge who blocked the order is a Democratic hack. The reality is that anyone who understands the English language should recognize that Trump’s new rule is illegal. Like so many of Trump’s attention-grabbing proposals, this doomed policy should never have been treated as legitimate in the first place.

Friday’s ruling involves a proclamation that Trump signed on Nov. 9, ostensibly to address the “continuing and threatened mass migration of aliens with no basis for admission into the United States through our southern border.” The order alluded darkly to the caravan of asylum-seekers then approaching the border, which Trump tried and failed to exploit as a campaign issue. To remedy this “crisis” and protect “the integrity of our borders,” he directed the federal government to deny asylum to any immigrant who enters the United States unlawfully.

Ten days later, U.S. District Judge Jon S. Tigar halted the new rule, holding that it likely exceeded the president’s authority. Trump responded by dismissing Tigar, a Barack Obama appointee, as an “Obama judge.” The comment led to a rare rebuke from Chief Justice John Roberts, who told the AP: “We do not have Obama judges or Trump judges, Bush judges or Clinton judges. What we have is an extraordinary group of dedicated judges doing their level best to do equal right to those appearing before them.”

As Trump escalated his feud with Roberts, his Department of Justice appealed Tigar’s ruling to the 9th Circuit. It faced a seemingly propitious panel: Bybee, Judge Edward Leavy, and Judge Andrew D. Hurwitz. Bybee is a very conservative jurist who authored the original “torture memo,” justifying the Bush administration’s brutal interrogation of detainees. Leavy is a staunchly conservative Reagan appointee; only Hurwitz, an Obama appointee, leans to the left. Under Trump’s partisan vision of the judiciary, the DOJ would seem to have a good shot at reviving the asylum rule.

But Bybee didn’t bite. In a crisp and rigorous opinion for the court, he wrote that Tigar was correct to conclude that the policy almost certainly violates the law. The problem, Bybee explained, is that Congress expressly provided asylum-seekers with the right that Trump now seeks to revoke: an ability to apply for asylum regardless of how they came into the country. The Immigration and Nationality Act states that “[a]ny alien who is physically present in the United States or who arrives in the United States (whether or not at a designated port of arrival …), irrespective of such alien’s status, may apply for asylum in accordance with this section.” This provision implements the 1951 Convention Relating to the Status of Refugees, which the United States has ratified. It directs signatories not to “impose penalties [on refugees] on account of their illegal entry or presence.”

The plain text of the law couldn’t be clearer: Immigrants in the U.S. are eligible for asylum whether they arrived legally (through a “designated port of arrival”) or illegally. If the president wants to change that fact, he’ll have to convince Congress to break its treaty obligations and alter the law.

In light of the proclamation’s fundamental illegality, Bybee, joined by Hurwitz, affirmed Tigar’s nationwide restraining order. Leavy dissented in a curious five-page opinion insisting that the INA grants the executive branch power “to bring safety and fairness to the conditions at the southern border.” His anemic analysis is no match for Bybee’s thorough demolition of the DOJ’s illogical position. It seems quite likely that a lopsided majority of the Supreme Court will eventually agree with Bybee’s majority opinion.

It is satisfying to see a “Bush judge” (in Trumpian parlance) hand the president such a stinging legal defeat. Roberts overstated the case in totally dismissing the role of partisanship in the judiciary; of course some judges are political. But for now, a majority of the federal judiciary remains willing to stand up to the president, at least when he issues blatantly illegal orders. Judges like Roberts and Bybee may let Trump manipulate ambiguous laws to do some very bad things to immigrants. But they are not willing to let the president ignore a clear and constitutional directive from Congress.

Stern points out that contrary to Trump’s belief that he can bully, co-opt, and control the judicial system, in the way that other authoritarian fascists have done in the past, even so-called “conservative” judges have lines beyond which they won’t be pushed.   And, lifetime tenure protects them from retaliation by Trump and his corrupt White Nationalist cronies.

Few things can be more important than having judges across the board, regardless of judicial philosophy, stand up to Trump and his lawless abuses of Executive Power as well as “pushing back” on a Department of Justice that has, with a few exceptions, lost its professionalism, moral compass, and courage, along with any semblance of independence.

Good evening, and thanks so much for inviting me.  In the “old days,” I would have started with my comprehensive disclaimer. But, now that I’m retired, I’m just going to hold the Bar Association, my fellow panelists, and anyone else of any importance whatsoever “harmless” for my remarks tonight.  They are solely my views, for which I take full responsibility. No sugar-coating, no bureaucratic doublespeak, no “party line,” no BS – just the unvarnished truth, as I see it!

“We’ve had situations in which a person comes to the United States and says they are a victim of domestic violence; therefore, they are entitled to enter the United States. Well, that’s obviously false but some judges have gone along with that.” “Good lawyers, using all of their talents and skill, work every day—like water seeping through an earthen dam—to get around the plain words of the INA to advance their clients’ interests. Theirs is not the duty to uphold the integrity of the act. That is our most serious duty.”

 

Those, my friends, are obviously not my words. They are the words of former Attorney General Jeff Sessions. Incredibly, this totally biased, xenophobic, misinformed, and glaringly unqualified individual was in charge of our U.S. Immigration Court system which helps explains why it is such a total mess today. And Acting Attorney General Whitaker’s certification of two cases yesterday promises a continuation of improper political interference with the Immigration Courts in derogation of Due Process.

 

One of Sessions’s most cowardly and reprehensible actions was his atrocious distortion of asylum law, the reality of life in the Northern Triangle, and Due Process for migrants in Matter of A-B-. There, he overruled the BIA’s important precedent in Matter of A-R-C-G-, a decision actually endorsed by the DHSat the time, and which gave much need protection to women fleeing persecution in the form of domestic violence. Take it from me, Matter of A-R-C-G-was one of the few parts of our dysfunctional Immigration Court system that actually worked and provided a way of consistently granting much needed protection to some of the most vulnerable and most deserving refugees in the world.

 

Sessions is gone. But, his ugly legacy of bias and unfairness remains. Fortunately, because he was a lousy lawyer on top of everything else, he failed to actually accomplish what he thought he was doing: wiping out protection for refugee women, largely from Central America. That’s why it’s critically important for you, as members of the “New Due Process Army” to fight every inch of the way, for as long as it takes, to restore justice and to force our U.S Immigration Courts to live up to their unfulfilled, and now mocked, promise of “guaranteeing fairness and Due Process for all!”

 

I’m going to give you seven very basic tips for overcoming Matter of A-B-.  I’m sure that my colleagues, who are much more involved in the day to day litigation going on in the courts than I am, can give you lots of additional information about addressing specific issues.

 

First, recognize that Matter of A-B- really doesn’t change the fundamental meaning of asylum.It just rejected the way in which the BIA reached its precedent in A-R-C-G-— by stipulation without specific fact-findings based on the administrative record. Most of it is mere dicta. On a case by case basis, domestic violence can still be a proper basis for granting asylum in many cases. Indeed, such cases still are being granted by those Immigration Judges committed to following the rule of law and upholding their oaths of office, rather than accepting Sessions’s invitation to “take a dive.”

 

Just make sure you properly and succinctly state your basis, establish nexus, and paper the record with the overwhelming amount of reliable country condition information and expert opinion that directly contradicts the bogus picture painted by Sessions.

 

Second, resist with all your might those lawless judges in some Immigration Courts who are using, or threatening to use, Sessions’s dictum in Matter of A-B- to deny fair hearings or truncate the hearing process for those claiming asylum through domestic violence.If anything, following the overruling of A-R-C-G-,leaving no definitive precedent on the subject, full, fair case-by-case hearings are more important than ever. Under Due Process, asylum applicants are entitled to a full and fair opportunity to present their claims in Immigration Court. Don’t let wayward, biased, or misinformed Immigration Judges deny your clients’ constitutional and statutory rights.  

 

Third, keep it simple. Even before A-B-, I always said that any proposed “particular social group” (“PSG”) longer than 25 words or containing “circular” elements is D.O.A. I think that it’s time to get down to the basics; the real PSG here is gender! “Women in X country” is clearly a cognizable PSG.  It’s undoubtedly immutable or fundamental to identity; particularized, and socially distinct. So, it meets the BIA’s three-part test.

 

And, “gender” clearly is one of the biggest drivers of persecution in the world. There is no doubt that it is “at least one central reason” for the persecution of women and LGBT individuals throughout the world.

 

Fourth, think political. There is plenty of recent information available on the internet showing the close relationship between gangs and the governments of the Northern Triangle. In some cases, gangs are the “de facto government” in significant areas of the country. In others, gangs and local authorities cooperate in extorting money and inflicting torture and other serious harm on honest individuals who resist them and threaten to expose their activities. In many cases, claiming political or religious persecution will be a stronger alternative ground than PSG.

 

Fifth, develop your record.  The idea that domestic violence and gang-based violence is just “common crime” advanced by Sessions in A-B-is simply preposterous with regard to the Northern Triangle. Establish records that no reasonable factfinder can refute or overlook! Use expert testimony or expert affidavits to show the real country conditions and to discredit the watered down and sometimes downright false scenarios set forth in Department of State Country Reports, particularly under this Administration where integrity, expertise, and independence have been thrown out the window.

 

Sixth, raise the bias issue. As set forth in a number of the Amicus Briefs filed in Matter of A-B-, Sessions clearly was a biased decision maker. Not only had he publicly dismissed the claims of female refugees suffering from domestic violence, but his outlandish comments spreading false narratives about immigrants, dissing asylum seekers and their “dirty lawyers,” and supporting DHS enforcement clearly aligned with him with one party to litigation before the Immigration Courts. By the rules governing judicial conduct there was more than an “appearance of bias” here – there was actual bias. We should keep making the record on the gross violation of Due Process caused by giving a biased enforcement official like Sessions a quasi-judicial role.

 

Seventh, and finally, appeal to the “real” Article III Courts. What’s happening in Immigration Court today is a parody of justice and a mockery of legitimate court proceedings. It’s important to “open the eyes” of the Article III Judges to this travesty which is threatening the lives of legitimate refugees and other migrants.

 

Either the Article III’s do their jobs, step in, and put an end to this travesty, or they become complicitin it. There’s only one “right side of the law and history” in this fight. Those who are complicit must know that their actions are being placed in the historical record – for all time and for their descendants to know – just like the historical reckoning that finally is happening for so- called “Confederate heroes” and those public officials who supported racism and “Jim Crow.”

 

Now is the time to take a stand for fundamental fairness and decency! Join the New Due Process Army and fight to vindicate the rights of asylum seekers under our laws against the forces of darkness and xenophobic bias! Due process forever!

DEATH THREATS ARE A WELL-ESTABLISHED FORM OF PERSECUTION, EXCEPT @ THE BIA — 4th Cir. Tells BIA To Follow Precedent — Tairou v. Whitaker

Mocktar Tairou (“Tairou”) petitions this Court to review a final removal order by the Board of Immigration Appeals (“BIA”) denying his asylum and withholding of removal application and ordering his removal to Benin. Tairou contends that the BIA erred in finding that he was not subjected to past persecution and that he lacked a well- founded fear of persecution were he to return to Benin. Our binding precedent explicitly holds that a threat of death constitutes persecution. Because Tairou experienced multiple death threats in Benin, we hold Tairou established that he was subjected to past persecution. We therefore grant the petition for review and remand to allow the BIA to consider whether, in light of Tairou’s demonstrated past persecution, he has a well- founded fear of future persecution.

As I’ve pointed out before, beneath the hoopla and commotion caused by the direct assault on Due Process in Immigration Court conducted by the Trump Administration and Jeff Sessions, there is a deeper much more fundamental lingering problem. The BIA, a supposedly “expert tribunal,” consistently errors in the application of some of the most basic precepts of immigration law, particularly when it comes to recognizing and protecting the rights of asylum seekers. 

Also, even without a finding of past persecution, the threats shown in this case clearly should have been more than enough to show a “reasonable likelihood” (10% chance) of future persecution that fulfills the (supposedly) generous “well founded fear” standard for asylum enunciated by the Supremes in INS v. Cardoza-Fonseca and endorsed by the BIA in Matter of Mogharrabi.

In other words, the BIA’s analysis in this case contravenes what we used to teach in basic training of Immigration Judges and Judicial Law Clerks and would have earned a student “minimal credit” on my “Refugee Law and Policy” final exam at Georgetown Law. This clearly is a system where quality and fairness are not only “Not Job 1” but aren’t even on the charts! Astoundingly, we have Appellate Judges serving on the “highest immigration tribunal” who are less competent and knowledgeable than most second year law students!

Even before Sessions, many asylum seekers were wrongfully denied by intentionally skewed interpretations and careless work by a tribunal that had long ago lost sight of its supposed vision of “being the world’s best administrative tribunal, guaranteeing fairness and due process for all.” Folks with good lawyers, the wherewithal to appeal, and the luck of the “right panel in the right circuit” might eventually obtain justice. Others had their lives ruined or even ended by a system operating in contravention of normal judicial precepts and Constitutional Due Process. Sessions “doubled down” on bias and “worst practices.”

How many must suffer and die before this system is brought into even  minimal compliance with our laws, international conventions, and Constitution (let alone fulfilling its now mocked promise of becoming the “world’s best administrative tribunal guaranteeing fairness and Due Process for all”)?

Shame on those in Congress, the Executive Branch, and the Article III Judiciary who have either promoted or enabled this travesty of justice. And, shame on America for not holding all of these public officials accountable.

Join the New Due Process Army and fight to force all public officials to live up to their oaths of office!

ICE DETENTION ABUSES INDIVIDUALS – IS THERE A COVER UP? – “The problem with these places is that they dehumanize you so much. They hinder everything. They screw your life.” – Time For Some Oversight & Accountability!

During his detention in Gadsden, Alabama, Alex Matheus started losing his hair.

It wasn’t just that he was getting older, his hair was falling out in clumps from the stress and frustration of long-term detention in the custody of Immigration and Customs Enforcement (Ice).

“That’s very common in Etowah,” the 44-year-old Venezuelan said by telephone from his new, temporary home in Italy, where he is living as he seeks to return to the US.

Housed in the Gadsden county jail since the late 1990s, the gray slab of concrete that is the Etowah Detention Center, is routinely identified by lawyers, advocates and detainees as one of the worst Ice facilities in the United States. It has one of the longest detention times of all Ice facilities.

The all-male facility, housing on average 300 detainees according to Ice data, ranks sixth in the highest number of calls made to the Ice Detention Reporting and Information Line related to sexual and/or physical abuse incidents, according to a study from Freedom for Immigrants. Human Rights Watch documented the “spotty access to healthcare” at Etowah. There is a campaign run by civil, immigrant, and human rights organizations to shut down Etowah.

Sitting next to the sheriff’s office in Gadsden, the detention facility stands out because of the barbed wire wrapped around the wall. There’s not much else around. The average income in town is just under $19,000 and more than a quarter of the community lives in poverty. This decade alone, the population has decreased 4%. So it makes sense the county would like to keep a multimillion dollar endeavor going.

Matheus spent 17 months in Etowah enduring the bare bones facilities. “They don’t have a yard. They don’t have recreational facilities. They don’t have libraries. They don’t have big common areas to hold people.” He wasn’t allowed outside its concrete walls, even for a short walk, for more than 500 days – until his deportation.

A Venezuelan asylum seeker, who had lived in the United States since 2000, Matheus broke commercial laws by shipping gas masks to the government opposition in his home country. He spent time in federal prison and on the day of his release, was taken straight to Ice custody, first at Stewart Detention Center in Lumpkin, Georgia, and then to Etowah.

Kenyan asylum seeker Sylvester Owino arrived at Etowah in 2013, after being in Ice custody for more than seven years in California and Arizona. As a “prolonged detainee”, little should have surprised the Kenyan asylum seeker about his latest detention center.

But things were done differently in rural Alabama.

In his first weeks, he noticed officers manning the detention facility were selling contraband to detainees. Vodka in plastic water bottles for $50. Weed in letter-sized white envelopes for $400. Cell phones went for $300. Officers sold a pack of cigarettes for $100.

Then there were the bribes.

One day, an officer approached Owino, telling him he didn’t have lunch and asking Owino to make him something to eat. So the detainee used the ramen noodles he had bought through the commissary, and mixed it with tuna for the officer.

“You share the food so they gave you privileges. So instead of being locked down, they let you out. You give him honey buns, you make him coffee,” he said.

With his budget noodle offering, Owino said he was able to watch a soccer game.

The Guardian spoke with a number of detainees – and reviewed a number of lawsuits – who had spent recent months and years in the facility. All complained about the standard of nutrition. In March, Alabama’s al.com reported now-outgoing sheriff Todd Entrekin legally – through a loophole in state law – pocketed nearly $750,000 allocated for food provisions in the jail.

Months later, after national coverage and backlash, Governor Kay Ivey sent a memorandum to the state comptroller rescinding the validity of the law, no longer allowing food services allowances to be made to sheriff’s accounts directly.

A 2016 report from the Department of Homeland Security Office of Detention Oversight Compliance Inspection logged similar instances they called “deficiencies” in food and medical standards.

Ice said Etowah operates in accordance with its standards. “As far as facility conditions, all Ice facilities are subject to regular inspections, both announced and unannounced, and those inspections have repeatedly found the Etowah County Detention Center to operate in compliance with Ice’s rigorous national detention standards. The facility was most-recently inspected in July,” Ice spokesman Bryan Cox told the Guardian in an email.

The almost two years Owino spent in Etowah were the worst years of his detention, Owino said.

Matheus agreed. “When you are anyone in the US, you start to fight your case hard and they send you to Alabama to wear you out,” he said. “I spoke to one [officer] and the guy said, my job is basically to make your life miserable. He told me that straight to my face”

The Etowah County Sheriff’s Office would probably like to change that perception. On a recent Guardian visit to the facility, Captain Mike O’Bryant introduced Jose Alfredo Reyes, 40, who has been in the facility for more than 18 months and had already agreed to an interview.

Reyes had nothing bad to say about the facility, except the lack of sunlight and mediocre food. “I told the captain, don’t worry, I won’t say nothing bad about you!” he said.

According to Christina Mansfield, the co-executive director of Freedom for Immigrants, “Etowah County Detention Center is one of the worst immigrant jails in the country. For years we have been documenting and drawing attention to abuses – such as physical assault and medical neglect – at the hands of the sheriff’s office and Ice. Several detained individuals and our volunteers have even been retaliated against for speaking out against these intolerable conditions. It’s time for Etowah to be shut down.”

Cox, in response to the allegations outlined in this story, said: “The allegations you’ve received are contradicted by the inspection findings of numerous entities that include independent third-party inspectors.”

Etowah sheriff’s office did not respond to the Guardian’s request for comments on the allegations put forth by former detainees and activists.

Matheus never had his wife visit from Florida because he said it didn’t make sense for her to visit for 20 minutes and still only talk through a video link.

He was deported in May 2017, back to Venezuela, where he was immediately detained. “They knew everything about me. They had a full folder against me. The US government provided everything to them. I had to pay [a bribe of] thousands of dollars to be released.”

Owino had the same experience as Kenyan authorities have also received his asylum application and related documents. He is out on bond in California, with a hearing coming up in the coming months for his asylum case.

Matheus left Venezuela in early October to seek citizenship in Italy, the home of his grandparents. Now he lives alone, holding onto receding hope he may be able to return to the United States as his case is fought in court. He lives alone, in a small apartment in Calabria, away from his wife in Florida – whom he hasn’t seen in nearly a year. The impact of his time in Etowah remains with him.

“People forget you were a real person, a family guy, a regular person. Basically, you are going back to society and you are supposed to function as a normal person again. The problem with these places is that they dehumanize you so much. They hinder everything. They screw your life,” he said.

These are the kinds of abuses that happen when we enable the DHS/ICE “New American Gulag.” It’s time for some oversight and a major reduction in the funds allocated for unnecessary and inhumane immigration detention.  It’s also past time for Congress to repeal so-called “mandatory indefinite detention” (before it is held to be unconstitutional).

The House GOP’s near-total abdication of any oversight role has done more than just shield President Trump on matters involving his finances and Russian collusion. It has also resulted in almost no serious scrutiny of the true depths of cruelty, inhumanity and bad-faith rationalization driving important aspects of Trump’s policyagenda — in particular, on his signature issue of immigration.

That’s about to change.

In an interview with me, the incoming chairman of the House Homeland Security Committee vowed that when Democrats take over in January, they will undertake thorough and wide-ranging scrutiny of the justifications behind — and executions of — the top items in Trump’s immigration agenda, from the family separations, to the thinly veiled Muslim ban, to the handling of the current turmoil involving migrants at the border.

“We will visit the border,” Rep. Bennie Thompson (D-Miss.), who is expected to chair the committee, which has jurisdiction over the Department of Homeland Security, told me. “We will hold hearings in committee on any and all aspects of DHS. … We will not back off of this issue.”

This oversight — which could result in calling for testimony from Stephen Miller, the architect of Trump’s immigration agenda — will include scrutiny of the administration’s justifications for its policies. Importantly, Thompson tells me Democrats will seek to grill officials on what went into Trump’s public statements on various aspects of the issue, many of which are falsehoods.

On asylum seekers, for instance, Trump’s public rationale for his various efforts to restrict their ability to apply (which is their legal right), is based on lies about the criminal threat they supposedly pose and absurd exaggerations about the rates at which they don’t show up for hearings.

Migrant caravan crisis escalates with tear gas at border fence

U.S. authorities fired tear gas at members of a Central American migrant caravan who had rushed the fencing along the U.S. border with Mexico on Nov. 25.

To be clear, Trump has used these rationales to justify actual policies with real-world impact, such as the effort to cruelly restrict asylum-applications to only official points of entry. Trump has also threatened a total border shutdown. Hearings could reveal that the justifications are nonsense, and spotlight their true arbitrary and cruel nature (putting aside for now that their real motive is ethno-nationalism).

“All this innuendo we hear about criminals coming in the caravan, we just want to know, how did you validate this?” Thompson told me, adding that DHS officials would be called on in hearings to account for Trump’s claims. “Policy has to be backed up with evidence. So we will do rigorous oversight.”

This will also include a look at the recent tear-gassing of migrants, and the administration’s public statements about it and justifications, Thompson said. Homeland Security Secretary Kirstjen Nielsen has defended the fact that tear gas appears to have impacted children by claiming they were used as “human shields.”

The use of the military as a prop

Thompson said such scrutiny could dovetail with an examination of Trump’s use of the military at the border as campaign propaganda, though that might involve the House Armed Services Committee. “We have to get full disclosure in a public setting or a classified setting,” Thompson said. “Under no circumstances will we not get information.”

By the way: Even if you take some of Trump’s complaints about asylum seeking seriously — there are serious issues with backlogs that have real consequences — you should want this oversight. If done well, it could shed light on actual problems, such as the role of the administration’s deliberate delays in processing asylum seekers in creating the current border mess, to the real need to reorganize the bureaucracy to relieve backlogs and to pursue regional solutions to the root causes of migration surges.

The overall goal, Thompson said, will be this: “As a nation of immigrants ourselves, we want to make sure that our process of immigration that includes asylum-seekers is constitutional and represents American values.”

Family separations and the travel ban

Thompson told me the committee would also look at the process leading up to the travel ban, which proceeded despite the fact that two internal Homeland Security analyses undercut its national security rationale.

Democrats can demand that DHS officials justify that policy. “What did you use to come up with this travel ban? How did you select these countries?” Thompson said, previewing the inquiry and vowing subpoenas if necessary. “We will ask for any written documentation that went towards putting the ban in place, what individuals were consulted, and what the process consisted of.”

Thompson also said the run-up to the implementation of the family separation policy and its rationale would receive similar scrutiny, as well as at the conditions under which children have been held, such as the reported Texas “tent city.” “Somebody is going to have to come in and tell us, ‘Is this the most efficient way to manage the situation?’” Thompson said. But also: “How did we get here in the first place?”

What can Democrats do?

One big question: What will House Democrats do legislatively against such policies? Thompson told me the goal is to secure cooperation with DHS, but in cases where the agency continues policies that Democrats deem terribly misguided or serious abuses, they can try to legislate against them. That would run headlong into Trump and the GOP-controlled Senate, at which point one could see discussion of targeted defunding of certain policies, though whether that will happen or what that might look like remains to be seen.

“As far as I’m concerned, no option is off the table,” Thompson said. Some more moderate House Democrats who won tougher districts might balk at such a stance, but Thompson said: “Every committee has responsibilities, and we have to carry them out.”

The big story here is that Trump has relied on the outright dismissal of his own administration’s factual determinations to justify many policies, not just on immigration, but also with his drive to weaken efforts to combat global warming despite the big report warning of the dire threats it poses.

The administration will strenuously resist Democratic oversight, and I don’t want to overstate what it can accomplish. But House Democrats must at least try to get into the fight against Trump’s war on facts and empiricism wherever possible. And when it comes to the humanitarian crises Trump has wrought on immigration, this is particularly urgent.

Finally, some much-needed, long-overdue accountability, fact-finding, and truth about Trump’s intentionally cruel and usually lawless immigration policies and those sycophants and toadies who implement them and egg him on. No, it won’t necessarily change things overnight. But, having some “pushback” and setting the factual record straight for further action is an important first step. And, I hope that the absolutely avoidable politically created mess in the U.S. Immigration Courts, and their disgraceful abandonment of Due Process as their sole focus, is high on the oversight list!

11TH CIR: BIA GETS IT WRONG IN DENYING JOURNALIST’S MTR — CONCURRING OPINION HINTS THAT MAJORITY OF “SESSIONS LEGACY BACKLOG” MIGHT HAVE BEEN ILLEGALLY INSTITUTED!

Here’s the opinion in Duran-Ortega v. U.S. Attorney General, including the lengthy concurring opinion by Judge Martin:

11th Cir. Stay of Removal in Duran-Ortega, Pereria-based

Here’s the “key quote” from Judge Martin:

Although one meritorious argument is enough to satisfy the first Nken factor, Mr. Duran- Ortega’s emergency motion for a stay presents a second, equally compelling argument that the agency’s in abstentia removal order must be rescinded in light of Pereira v. Sessions, 138 S. Ct. 2105 (2018). The governing statute, 8 U.S.C. § 1229(a)(1)(G)(i), requires that a notice to appear (“NTA”) “specify[] . . . [t]he time and place at which the proceedings will be held.” Once a charging document, such as an NTA, is filed with the immigration court, the court may then exercise jurisdiction over a petitioner’s removal proceedings. See 8 C.F.R. § 1003.14 (“Jurisdiction vests, and proceedings before an Immigration Judge commence, when a charging document is filed with the Immigration Court by the Service.” (emphasis added)). The Supreme Court’s recent decision in Pereira appears to suggest, as Duran-Ortega argues, that self-described “notice to appears” issued without a time and place are not, in fact, notice to appears within the meaning of § 1229. 138 S. Ct. at 2113–14. In particular, Pereira emphasized that § 1229 “does not say a ‘notice to appear’ is ‘complete’ when it specifies the time and place of the removal proceedings.” Id. at 2116. “Rather,” the Supreme Court explained, § 1229 “defines a ‘notice to appear’ as a ‘written notice’ that ‘specifies,’ at a minimum, the time and place of the removal proceedings.” Id. (alteration omitted) (emphases added). In other words, just as a block of wood is not a pencil if it lacks some kind of pigmented core to write with, a piece of paper is not a notice to appear absent notification of the time and place of a petitioner’s removal proceedings.
Pereira’s reasoning has led some district courts to conclude that a self-styled “notice to appear” lacking the requisite time and place of the hearing is legally insufficient to vest an immigration court with jurisdiction. See, e.g., United States v. Zapata-Cortinas, 2018 WL 4770868, at *2–3 (W.D. Tex. 2018); United States v. Virgen-Ponce, 320 F.Supp.3d 1164, 1166 (E.D. Wash. 2018). Other district courts have disagreed. See, e.g., United States v. Romero- Colindres, 2018 WL 5084877, at *2 (N.D. Ohio 2018). Most recently, the BIA issued a published decision holding that a defective NTA is sufficient to vest jurisdiction in an immigration court “so long as a notice of hearing specifying this information [on time and date] is later sent to the alien.” Matter of Bermudez-Cota, 27 I. & N. Dec. 441, 447 (BIA 2018). This Court, however, need not defer to Bermudez-Cota if the agency’s holding is based on an unreasonable interpretation of the statutes and regulations involved, or if its holding is unambiguously foreclosed by the law. See Chevron, U.S.A., Inc. v. Natural Res. Def. Council, Inc., 467 U.S. 837, 843–45, 104 S. Ct. 2778, 2782–83 (1984); see also Auer v. Robbins, 519 U.S. 452, 461, 117 S. Ct. 905, 911 (1997). In light of Pereira and the various regulations and statutes at issue here, it may well be the case that deference is unwarranted.
As a result, it is clear to me that Mr. Duran-Ortega has presented “a substantial case on the merits” sufficient to satisfy the first Nken factor, given the other three factors “weigh[] heavily in favor of granting the stay.” Ruiz v. Estelle, 650 F.2d 555, 565–66 (5th Cir. Unit A 1981).2

The 11th U.S. Circuit Court of Appeals granted a stay of removal today for Spanish-language journalist Manuel Duran.

Without the stay, Duran – who was unlawfully arrested and detained in retaliation for reporting on controversial issues related to law enforcement in Tennessee – could have been deported at any time.

Earlier this month, the court granted a temporary, two-week stay that expired today. The stay that the court issued today will remain in place until Duran’s appeal has concluded.

“We are grateful and pleased that the court acted to stay Mr. Duran’s deportation so that his appeal may be fully heard,” said Kristi Graunke, senior supervising attorney for the SPLC. “As a journalist who has dedicated his career to reporting on government misconduct, Mr. Duran faces serious danger if he is deported to El Salvador. We will continue to fight for his freedom and to ensure he receives a fair hearing on his asylum claims.”

Duran has been detained for over seven months at LaSalle Detention Facility in Jena, Louisiana, after working as a reporter in Memphis, Tennessee, for more than 10 years. The SPLC took his case after he was placed in Immigration and Customs Enforcement (ICE) custody following his arrest by Memphis police in April.

Duran is a respected reporter who wrote for the Spanish-language publication he founded: Memphis Noticias. He was known for his investigative journalism. His work frequently highlighted issues of importance to Memphis’ Spanish-speaking community, including local law enforcement’s collaboration with ICE.

On April 3, Duran was covering a Memphis event relating to the 50th anniversary of Martin Luther King Jr.’s assassination. The demonstration included a protest of local law enforcement’s practice of detaining suspected immigrants and handing them over to ICE.

During the event, Duran wore his yellow press badge and did not engage in the protest. He was following police orders to step away from the protesters when an officer pointed to him and yelled, “Get him, guys.”

Because his reporting exposed ties between local police and ICE in detaining immigrants, Duran was singled out and arrested amid a pool of other journalists covering the protest. He was falsely accused of disorderly conduct and obstructing traffic.

Duran is like thousands of other immigrants facing deportation, who face lengthy detention even if they have meritorious claims. Held captive in detention centers for months and sometimes years, they are forced to endure terrible conditions and separation from loved ones and their communities.

As Attorney General, Jeff “Gonzo Apocalypto” Sessions used every tool at his disposal to destroy Due Process in the U.S. Immigration Courts, discriminate against asylum seekers and their (often pro bono) hard-working lawyers, and artificially “jack up” the court backlog to increase pressure on Immigration Judges to cut corners and ultimately to collapse the system entirely (thus, presumably, leading to calls for an unconstitutional “summary removal system” without any court hearings). I estimate that 75% to 80% of the cases in the current 1.1 million “backlog” (largely the result of management interference by DOJ politicos over the past three Administrations leading to “Aimless Docket Reshuffling”) were probably commenced in violation of the Supremes’ “Pereira reading” of required statutory notice.

Ironically, Sessions’s “gonzo-like” fixation on ruining the system and punishing migrants, rather than taking the reasonable steps necessary to improve Due Process and efficiency, could have the effect of drastically cutting the backlog by removing the vast majority of “backlogged” cases from the docket without compromising anyone’s Due Process. And, once off the docket, most of those cases, which represent long-time residents with good character and substantial equities, should properly remain off-docket pending a Congressional legalization program. That would actually rationalize the system and enable the enlarged Immigration Court to “keep current” on a more realistic and appropriate docket of 200,000 to 300,000 new cases per year (provided the Immigration Court is removed from the DOJ and put under independent, professional, apolitical court management stemming from the judges themselves).

Another notable point — by allowing itself to make decisions based on politically preferred outcomes, typically anti-immigrant, rather than sound and fair legal reasoning, the BIA is rapidly depriving its decisions of so-called “Chevron deference” from the Article III (“real”) Courts.

WASHINGTON — Homeland Security and Justice Department officials are feuding over a controversial plan that would force asylum-seekers at the southwestern border to remain in Mexico until their cases are decided, according to sources close the administration.

Department of Justice officials have been pushing for asylum-seekers at the border to be immediately returned to Mexico as they arrive at the border, instead of first undergoing screening for fear of persecution or torture if they are not allowed in.

Department of Homeland Security officials want asylum-seekers screened for persecution, torture, and fear before being immediately returned to Mexico, to ensure that there are no serious concerns for their safety in Mexico.

The dispute highlights the fact that key details regarding the plan are still up in the air.

A Justice Department official said there was no dispute over the screening process but that the matter was under consideration between both agencies. The official said the discussion between the two US departments were “a normal part of the process.” DHS declined to comment.

Jeffrey Chase, a former immigration judge, said the dispute goes to the very heart of asylum law, which grants foreigners who otherwise would not be admissible the right to enter the country if they can show that they have a “credible fear” of persecution if they are returned to the country they came from.

“‘Credible fear’ was created over 20 years ago to be the standard for those arriving and not deemed admissible. BuzzFeed News reported earlier this month that the administration had been considering such a plan and that discussions with Mexico had been ongoing. The Washington Post reported last week that a deal had been agreed upon with Mexico and that asylum-seekers would remain in that country while their cases were being adjudicated. But that story was later denied by Mexican officials, and the status of any talks is uncertain. A new administration takes office in Mexico on Saturday.

The proposal was first focused on individuals who come to a port of entry to request asylum but has since been extended to include those apprehended between border crossings as well, sources said.

The discussions appear to be a renewed effort to implement a directive first raised in an executive order that President Donald Trump signed in the early days of his administration in 2017. The Mexican government publicly rejected that plan, and the Trump administration made no effort to implement the president’s instructions.

In the executive order, Trump had directed the Department of Homeland Security Secretary to pursue the option. In a memo written by then-DHS chief John Kelly, officials were told to return individuals at the border “to the extent appropriate and reasonably practicable.” Kelly cited a statute that states that certain individuals can be sent back to the contiguous country they arrived from.

Advocates have said that implementation of such a measure would put families and migrants in danger and would be quickly challenged in court.

Well said, Jeffrey! There was a day, obviously in the past, when DOJ lawyers were concerned with assuring compliance with the law and applicable court decisions, rather than thinking of various ways to “push the envelope” by engaging in facially illegal, and certainly immoral, conduct. Hopefully, such evasion of both their oaths of office and ethical standards will be considered by future employers in the private sector.

The irony here is that with a different Administration in place, cooperation among the U.S., Mexico, and the UNHCR in ways that strengthened the Mexican asylum system, improved conditions for refugees and asylees in Mexico, encouraged regular refugee processing by both countries in or near the Northern Triangle, improved reception and processing for those at the U.S. border, and most important, constructively addressed the problems in the Northern Triangle forcing folks to flee would be a win-win-win-win for all involved.

The flow of refugees from the Northern Triangle is primarily a humanitarian, not a law enforcement situation.  Among other things, a humanitarian approach would promote advantages of applying in Mexico and reasons why it could be a rational choice for some asylum seekers; it would eschew illegal threats, cynically and intentionally created inhumane, even life-threatening, conditions, and improper sanctions to “deter” individuals from asserting their legal rights to apply for asylum in the U.S. under both our law and international law. Sadly, all of the latter are exactly what the Trump Administration is engaged in at present, with the assistance of their ethically-challenged Government “legal” team.

I resigned from the Department of Justice because of Trump’s campaign against immigration judges

One of the proudest days of my life was Dec. 16, 2015, when I became a naturalized citizen of the United States.

I shed tears of joy as I swore allegiance to the United States at the Los Angeles Convention Center, along with more than 3,000 other new Americans. I was celebrating a country that had welcomed me with open arms, treated me as one of its own and opened doors I hadn’t known existed. Just a few years before, in the remote village in southern Italy where I grew up, this would have been unimaginable.

Another of my proudest moments came just a year later, when I was awarded a coveted position in the U.S. Department of Justice. This happened in late November 2016, a few weeks after President Trump was elected.

Like many, I harbored reservations about Trump. But I did not waver in my enthusiasm for the job. In law school, l had learned about the role of civil servants as nonpolitical government employees who work across administrations — faithfully, loyally and diligently serving the United States under both Republicans and Democrats.

I was designated an attorney-advisor and assigned to the Los Angeles immigration court. There, I assisted immigration judges with legal research, weighed in on the strengths and weaknesses of parties’ arguments and often wrote the first drafts of judges’ opinions.

Soon enough, however, the work changed. In March 2018, James McHenry, the Justice Department official who oversees the immigration courts as head of the Executive Office for Immigration Review, announced a mandate imposing individual quotas on all the judges. Each judge would be required to decide 700 cases per year, he said.

With these new quotas, which went into effect on Oct. 1, immigration judges must now decide between three and four cases a day — while also reviewing dozens of motions daily and keeping up with all their administrative duties — or their jobs will be at risk.

The announcement of the quotas in March was the first in a series of demoralizing attacks on immigration judges this year. In May, Atty. Gen. Jeff Sessions, since fired by Trump, personally issued a decision that placed limits on the ability of immigration judges to use a practice known as administrative closure, which allows judges to put cases on indefinite hold, and which, in immigration cases, can be a tool for delaying deportation orders.

The Justice Department enforced the decision in July by stripping an immigration judge in Philadelphia of his authority in scores of cases for continuing to use administrative closure.

All this was in addition to a barrage of disparaging comments made directly by the president. In June, Trump tweeted that there is no reason to provide judges to immigrants. He also rejected calls to hire more immigration judges, saying that “we have to have a real border, not judges” and asking rhetorically, “Who are these people?”

The demoralizing effect on immigration judges was palpable. Morale was at an all-time low. I was new to civil service, but these judges, some of whom have served continuously since the Reagan administration, made clear that this was an unprecedented attack on the justice system.

I’ve long admired the independence and legitimacy that the judiciary enjoys in the United States, so I found the attacks on judges deeply disturbing and troubling. They reminded me of Trump’s Italian alter-ego, Silvio Berlusconi, who spent most of his tenure as Italy’s prime minister fighting off lawsuits by delegitimizing and attacking the judiciary, calling it “a cancer of democracy” and accusing judges of being communist.

I voiced my concerns to my supervisors and directly to Director McHenry in a letter. Seeing no opportunity to make a positive difference and unwilling to continue to lend credence to this compromised system, I submitted my resignation in July, explaining my reasons in a letter.

This was not how I wanted to end my career in government. I had hoped to serve this country for the long haul. But I couldn’t stand by, or be complicit in, a mean-spirited and unscrupulous campaign to undermine the everyday work of the Justice Department and the judges who serve in our immigration courts — a campaign that hurts many of my fellow immigrants in the process.

Thanks for speaking out Gianfranco! I published an earlier, at that time “anonymous,” letter from Gianfranco at the time of his resignation. I’m sure there are many others at EOIR who feel the same way.  But, they are “gagged” by the DOJ — threatened with job loss if they “tell the truth” about the ongoing legal farce and parody of justice within our Immigration Courts.

It’s a “closed system” at war with the public it serves, the dedicated attorneys who represent migrants, the essential NGOs who are propping up what’s left of justice in this system, and the very civil servants who are supposed to be carrying out the courts’ mission. What a horrible way to “(not) run the railroad.”

Someday, historians will dig out the whole truth about the “Sessions Era” at the DOJ and his perversion of justice in the U.S. Immigration Courts. I’m sure it will be even worse than we can imagine. But, for now, thanks to Gianfranco for shedding at least some light on one of the darkest and most dysfunctional corners of our Government!

TIJUANA, Mexico — For Trump administration officials, an unprecedented confrontation at the US-Mexico border on Sunday invited an assessment that their policies have only exacerbated the problems of an overwhelmed immigration system whose court backlog has grown larger since Trump’s inauguration 22 months ago.

León Rodriguez, who headed the US Citizenship and Immigration Services agency from 2014 to 2016, didn’t want to comment on the events on the ground, but said what happened at the border seemed to be “a foreseeable result of the US policy of placing every conceivable obstacle in the way of orderly legal migration and of not having a policy that [recognizes] the desperate circumstances driving migration.”

Mexican officials shared that negative assessment. Héctor Gandini, who will take over as spokesperson for Mexico’s Interior Ministry when Mexico swears in a new president on Saturday, said that the US use of tear gas on migrants attempting to cross illegally into the country was “not correct. We don’t want them to hound migrants.”

“You have to respect migrants’ human rights,” Gandini added.

For Josué Rosales, one of the migrants who took part in the ill-fated march to the border, what began as a journey of hope had turned into one of despair, one that promised weeks of more nights inside the tent he’s now sharing with his girlfriend on the grounds of the Benito Juarez stadium, where the caravan has been camped for days. He said he’s not ready to give up.

“I’m waiting to see if Trump comes to some type of agreement that allows us to cross,” Rosales said. “If he says no we’ll figure out another way to cross.”

The Trump administration faces a situation its best efforts have failed to control.

Administration officials have imposed a number of policies to discourage migrants from seeking to enter the United States. Then Attorney General Jeff Sessions personally rewrote key immigration court decisions to eliminate domestic violence and fear of gang violence as reasons for asylum to be granted. The administration imposed a controversial family separation policy that was intended to discourage parents from crossing the border with their children. Trump dispatched 5,800 US active-duty soldiers to the border in a show of force that many critics also claim was a blatant political ploy ahead of the midterm elections earlier this month.

And yet border apprehensions are at the highest level yet of the Trump administration (though still at historically low levels), family detentions are at record levels, and the number of people granted asylum actually rose in the fiscal year that just ended, to the highest level in two decades.

In Tijuana, where the number of would-be asylum seekers is growing by the day, immigration attorneys and advocates describe a bottleneck system that makes asylum seekers wait weeks before they can seek to enter the US for refuge. That’s created an enormous backlog.

And the situation promises only to get worse as more people seeking to reach the US arrive in Baja California, the Mexican state that abuts California. Mexico’s interior ministry said there are 8,247 people now in Mexico who are traveling as part of so-called caravans from Central America. The vast majority of migrants — 7,417 — are in the cities of Mexicali and Tijuana. The other 424 are in a Mexico City shelter, 253 are in the Mexican state of Sinaloa, and another 153 are making their way north on their own. It’s unclear how many of them will ask for asylum.

Caring for the migrants is costing about $27,000 daily — money Tijuana’s mayor says the city does not have.

Sunday’s march to the border was intended to be peaceful, but it devolved into a frantic rush toward the border fence after the group, which numbered about 500, according to the Mexican interior ministry, was blocked from reaching the San Ysidro port of entry by a line of Mexican federal police.

Then after being blocked on the street in front of the Chaparral border crossing by metal barriers and another line of federal police with shields, a group walked to a train border crossing a few minutes away.

Several members of the group told BuzzFeed News they wanted to negotiate some type of agreement with the Trump administration that would let them enter the United States. Others said they hoped to be able to cross into the US as a group.

Instead, US border officers met them with tear gas and pepper balls, according to a statement from Customs and Border Protection, the agency responsible for border law enforcement.

CBP said its officers deployed the tear gas and pepper balls after some members of the group threw objects, including rocks, at agents while others tried to enter the United States illegally, some through a gap in the metal barrier along the railroad tracks.

But not all immigration officers were willing to defend the US actions. One US asylum officer, who could not talk about policy publicly, said the confrontation likely was the result of the US’s inability or unwillingness to process asylum claims at the border daily. The officer said USCIS recently had told staff to be on standby to be sent to San Diego to help hear asylum claims.

“I’m just glad nothing worse happened,” the officer said. “I think it’s illegal that they closed the border. We cannot decide when we can close the border if there’s no state of emergency. For a couple dozen asylum seekers? That was not an emergency that should justify closing the border. I’m just relieved it wasn’t worse.”

Another government official, who works on the issue but does not make policy, blamed the Trump administration for the tensions at the border.

“Trump has broken the law by not having people at the border processed for months and months and creating a bottleneck there,” the official said. “Tear gassing children because maybe they’ll get into the US? Heaven forbid.”

Mexican authorities late Sunday were contemplating what to do next. In a press release, the interior ministry said Mexican police had retaken control of the area leading to the San Ysidro port of entry and that Mexican troops would not be deployed “despite the magnitude of the situation.”

A government official who requested anonymity because they were not allowed to talk to reporters told BuzzFeed News that 30 migrants had breached the border and were promptly detained by CBP. The National Migration Institute said that it planned to deport as many as 500 others who attempted to cross into the US illegally but were unsuccessful. Since the first caravan entered Mexico on October 19, 11,000 migrants from Honduras, Guatemala, El Salvador and Nicaragua have been deported.

The escalation at the border comes at a complicated time — the country’s embattled president, Enrique Peña Nieto, will conclude his mandate in less than a week.

BuzzFeed News revealed earlier this month that the Trump administration was attempting to broker a deal that would force people to wait in Mexico while their asylum cases were processed. The Washington Post reported that incoming Mexican president Andres Manuel López Obrador’s transition team had agreed to this plan, but that report was disputed by the same officials it cited; they pointed out that López Obrador’s government would not take office for several more days. “There is no agreement of any sort between the future government of Mexico and the US government,” said a press release from López Obrador’s transition team.

Immigration promises to be a major challenge for López Obrador, who has pledged to give work permits and offer jobs to Central American migrants in Mexico. Detentions and deportations of migrants have increased steadily since 2014, when the government launched the Southern Border Program, shortly after a large wave of unaccompanied minors surged across the US-Mexico border.

Sunday’s events were much different from the results of a spring caravan that arrived in Tijuana in late April with hundreds of asylum seekers. The group camped out on the grounds of the Chaparral border crossing for days after being turned away by CBP agents because the port of entry was at capacity. Over several days, small groups of asylum seekers were allowed into the US to make their claim, 93% of whom passed what’s known as a credible fear interview, a crucial first step in the asylum application process.

But that caravan was much smaller, at most 1,500 at its start in southern Mexico, than the thousands now waiting in Tijuana, and its members had been vetted by the NGO that led it, Pueblo Sin Fronteras, to weed out those whose asylum claims were likely to be found without merit by the time it reached the border. In the end, only 228 people sought asylum in a process that took just five days. Separately, other members of the caravan asked for asylum before and after those five days, putting the total number of asylum seekers at 401.

This time around, asylum seekers have been told they would likely have to wait weeks in Tijuana before they could ask the US for refuge because of a backlog at the border. The current expected wait to begin the process is now up to six weeks.

Delay at the border for requesting asylum is nothing new, but it’s been getting worse under Trump. The Department of Homeland Security’s inspector general found recently that US immigration authorities’ inability to handle the number of people seeking asylum at ports of entry had forced migrants to cross illegally. But there’s little sign that US officials are planning to take steps to improve the wait times.

And the likelihood is great that those who must wait in Tijuana will find only that their frustration will grow in the coming months.

“It’s difficult because we came as one peaceful caravan and now we’re just waiting here without any results,” Rosales, the march participant, told BuzzFeed News. “We’re sitting in the sun, thirsty, hungry, with no resolution to our situation.”

The Trump Administration created this artificial mess. The solution is hardly “rocket science:”
  • More USCIS Asylum Officers;
  • More pro bono private attorneys;
  • More U.S. Immigration Judges and staff;
  • Restoring authority to Immigration Judges to work with both parties before their courts to close and remove hundreds of thousands of “low priority” cases from the courts’ dockets, thus freeing up judicial time to work on asylum cases of more recent arrivals;
  • Restoring precedents that would allow refugees with documented cases of persecution on the basis for domestic violence and family relationships to be expeditiously granted, thus freeing up docket space for other types of cases.

No chance that the Trump Administration will do this voluntarily. But, there might be an opening for House Democrats to condition further immigration enforcement funding on improvements in the foregoing areas and an end to the Trump-created “border backups.”

MEXICO CITY — Mexico’s incoming leadership is denying a published report that it had agreed to a Trump administration proposal requiring asylum seekers arriving at the southwest border to wait in Mexico as U.S. authorities consider their claims for safe haven.

The Washington Post reported Saturday that Washington had won the support of the government of Mexican President-elect Andres Manuel Lopez Obrador — who takes office on Dec. 1 — for a plan mandating that asylum seekers at the border remain in Mexico as their claims move through the U.S. immigration system.

The Trump administration has long sought such an accord with Mexico as a means of resolving what it has termed a “crisis” of an escalating number of Central American asylum applicants — and limited detention space in which to hold them on U.S. territory as their petitions are considered.

Critics on both sides of the border have long assailed the notion of Mexico serving as a way station or detention grounds for Central Americans and others applying for asylum in the United States.

The administration of Mexico’s current president, Enrique Peña Nieto, rejected a similar Trump administration proposal last year.

But the Post quoted Olga Sanchez Cordero, Mexico’s interior minister-designate, as saying Mexico’s new government had accepted the policy as a “short-term solution” to the issue of Central American migration — which has been dramatized in recent weeks as thousands of U.S.-bound Central Americans have made their way north through Mexico in caravans.

Later Saturday, however, she denied that Mexico had agreed to host people seeking U.S. asylum as their cases awaited judgment.

“There is no agreement of any sort between the future Mexican federal government and the U.S.,” the incoming interior minister said in a statement.

Moreover, she said Mexico’s new government had rejected any deal in which Mexico would be considered “a safe third country” for U.S. asylum applicants.

In a Twitter message on Saturday, President Trump reiterated threats to close the southern border — threats that have alarmed many in Mexico, since cross-border trade is a mainstay of the Mexican economy.

In his tweet, Trump also said migrants would not be allowed into the United States “until their claims are individually approved in court.”

Others, he said, would “stay in Mexico,” he added, without elaboration.

The Twitter message did not specify whether Washington had reached any kind of agreement with Mexico on the matter.

Only a small minority of Central American applicants are ultimately granted political asylum in the United States, but the decision-making progress can take months or years — during which time many are released and gain footholds in the United States.

Trump has vowed to end what he calls the “catch and release” system. “Our very strong policy is Catch and Detain,” he tweeted Saturday. “No ‘Releasing’ into the U.S.”

The White House has also pushed an alternative “safe third country” approach in talks with Mexican officials. Under such a plan, Central Americans seeking asylum would generally have to file for protection in Mexico, not in the United States.

The proposal is a variant of the Trump administration’s “remain in Mexico” plan, under which asylum seekers would wait in Mexico until their cases were adjudicated in the United States.

With a “safe third country” designation, the United States would consider Mexico a secure nation for receiving asylum applicants. In practice, that would bar most asylum seekers who entered Mexico from filing asylum claims in the United States. The United States already has such an understanding with Canada.

But immigrant advocates have long opposed such a designation for Mexico for a number of reasons — principal among them the country’s widespread and rising violence, which often targets Central American migrants. Mexico cannot be considered safe for asylum seekers, many argue.

Critics also say Mexico’s system for processing refugee requests is already overwhelmed and ill-prepared to handle a huge new influx.

In her statement, Mexico’s incoming interior secretary echoed the vows of leftist President-elect Lopez Obrador to protect the human rights of caravan travelers and other Central American migrants while providing them with food, healthcare and shelter. Lopez Obrador has also vowed to help Central Americans acquire work papers if they opt to remain in Mexico.

More than 6,000 caravan members, mostly Hondurans, have arrived this month in the Mexican border cities of Tijuana and Mexicali, posing a humanitarian, logistical and political challenge for the two cities on the border. The migrants say they are fleeing poverty and violence in their homelands.

Tijuana’s mayor declared a “humanitarian crisis” Friday as the border city sought additional federal and state aid to help house the migrants, most of whom are crowded into a sports complex a block from the U.S.-Mexico border fence.

Tijuana officials anticipate that as many as 10,000 Central American migrants could eventually converge on the city and be stuck there for months as they seek to file asylum claims in the United States, a time-consuming process. U.S. officials at the San Ysidro crossing generally accept no more than 100 asylum applications a day.

President Donald Trump suggested on Saturday that asylum seekers would be allowed to wait in Mexico while their claims are processed through the U.S. immigration system — but Mexico’s incoming government has denied making any such deal.

“There is no agreement of any sort between the incoming Mexican government and the U.S. government,” future Interior Minister Olga Sanchez told Reuters on Saturday, contradicting Trump and an earlier Washington Post report that said a deal ― albeit an informal one ― had been struck between the two governments.

The Post had quoted Sanchez as saying the administration of Mexico’s President-elect Andrés Manuel López Obrador, who will take office on Dec. 1, had “for now” agreed to the so-called “Remain in Mexico” plan.

Sanchez was quoted by the paper as saying that Mexico would allow asylum seekers to stay in the country as a “short-term solution.”

Following the publication of the Post’s report, however, Sanchez back-pedaled on those remarks. She told Reuters that Obrador’s administration was “in talks” with the U.S., but stressed officials who weren’t yet in office couldn’t formally make any agreements.

Reuters reported that Sanchez “did not explicitly rule out” that Mexico could allow Central American caravan migrants ― thousands of whom have arrived in Tijuana, just south of California ― to wait in the country while their claims are processed in the U.S.

Sanchez did, however, say that plans for Mexico to assume “safe third country” status had been “ruled out.” Under a “safe third” agreement, the U.S. could force migrants to seek asylum in Mexico.

Trump said in a pair of Saturday evening tweets that migrants at the U.S.-Mexico border “will not be allowed into the United States until their claims are individually approved in court.”

“No ‘Releasing’ into the U.S. … All will stay in Mexico,” the president wrote.

His tweets were interpreted as possible confirmation of the posible deal between the U.S. and Obrador’s administration.

Tijuana Mayor Juan Manuel Gastélum declared a humanitarian crisis last week as approximately 5,000 Central American migrants fleeing violence and poverty arrived in the city ― to the chagrin of many locals.

Gastélum said on Friday that he’d asked the United Nations for aid to help with the influx of asylum seekers.

WASHINGTON — The incoming chairman of a key oversight committee in the House of Representatives said Sunday that any attempt by President Donald Trump to keep migrants from claiming asylum in the U.S. would be unlawful.

“That’s not the law,” Rep. Elijah Cummings, D-Md., said in an exclusive interview on “Meet the Press,” indicating that Congress will act if the president moves ahead with that policy. “They should be allowed to come in, seek asylum, that’s the law.”

President Donald Trump has said he’s reached a deal with the government of Mexico to keep migrants traveling in large caravans from Central America in Mexico until their court date to plead asylum. But a spokesman for incoming Mexican President Andrés Manuel López Obrador has said talk of such a deal is premature and U.S. officials told NBC News that the details are still being worked out.

Cummings said he supports the law as it stands. “I think we have a system that has worked for a long time. This president’s come in, wants to change it, that’s up to him. But now the Congress has got to stand up and hopefully they will,” Cummings said.

Family detention at the border and the separation of children from their parents after crossing the border was already on Cummings’ list of potential investigations as chair of the House Oversight and Government Reform Committee when Democrats take control of Congress in January.

Cummings has a list of 64 subpoenas it is ready to send to the Trump administration on a variety of issues ranging from immigration to voting rights act, drug prices and the opioid epidemic.

“I think the American people have said that they want checks and balances,” Cummings said. “And subpoenas, by the way, that may involve, say, private industries like the pharmaceutical companies” over “these skyrocketing drug prices.”

When asked about the priorities he is setting for areas of investigation, Cummings said he will focus on issues that “go to the very heart of our democracy and protecting that democracy.”

Cummings also said Sunday that his committee will “probably” look into Trump’s financial ties, especially to Saudi Arabia, and if it violates the emoluments clause, which is aimed at preventing a president from profiting on the office.

Cummings said he wanted to determine “whether the president is acting in his best interest or those of the American people,” adding, “I think this would be appropriate and there are other committees that will be looking at this too.”

Sen. Mike Lee, R-Utah, also criticized Trump over his support for Saudi Crown Prince Mohammed bin Salman despite reports that a CIA assessment concluded that the Saudi ruler ordered the murder of journalist Jamal Khashoggi. Lee said that Trump’s assessment is “inconsistent” with the intelligence he’s seen. “Intelligence I’ve seen suggests this was ordered by the crown prince,” he said.

Lee says that Khashoggi’s murder and Trump’s response provides “an opportunity” for Congress to weigh in to the U.S.-backed Saudi role in Yemen that has created a worsening humanitarian disaster.

“I think Congress has to take some ownership of U.S. foreign policy, especially as it relates to our intervention in this war,” Less said. “Our unconstitutional fighting of a civil war in Yemen that has never been declared by the U.S. Congress as a problem. And that’s on us.”

In 1994, President Bill Clinton established a prevention through deterrence border security strategy for the Border Patrol that concentrated enforcement resources on major entry corridors.

This made it more difficult for migrants to make illegal entries at those locations. Consequently, many of them went around those areas to make their entries at remote locations that were not patrolled so heavily, such as the Arizona desert.

This resulted in a humanitarian crisis.

According to U.S. Border Patrol data, 7,216 people died while illegally crossing the southwest border at remote locations in the 20-year period from FY 1998 to FY 2017. Most of them perished in the desert from dehydration, hypothermia or heatstroke.

The actual number of deaths is much higher. According to CNN, the Border Patrol usually just counts dead bodies they discover while patrolling the border. In FY 2017, for instance, the Border Patrol reported 294 deaths, but CNN identified at least 102 more, not including scores of other likely crossing deaths in which officials were not able determine whether the remains were migrants.

Clinton’s plan was to make some of the resources available for other locations when the Border Patrol had control over the major corridors. The Border Patrol would then monitor the flow of illegal entries and shift resources to areas that had a lot of activity.

The instructions on implementing the strategy acknowledged, however, that although the Border Patrol knew where apprehensions were made, it did not have a reliable way to determine where aliens who eluded them were crossing. This made it difficult to know where to place additional resources.

Go on over to The Hill to read the rest of Nolan’s article. It’s a timely historical reminder that failed border policies have a long and unhappy history in the U.S.

I was in private practice in 1994. However, I will admit to being involved in a number of such failed efforts over the past 45 years. That’s why I’m convinced that the issues driving migration to and across our Southern Border won’t be solved unilaterally by draconian enforcement strategies on this end. They have all been tried to some degree or another and ultimately failed.

An effective answer must involve a cooperative international effort to address the “sending” or “push” factors so that the vast majority of folks in Latin America will be able to live safely, peacefully, and relatively prosperously in their native countries.

Of course there will always be those who want to emigrate. More power to them and to us for finding ways to accept, integrate, and benefit from their skills. But, an orderly, predictable, legal migration system would be in everyone’s best interests. Sadly, we’re heading in the opposite direction at present.

Central Americans who arrive at U.S. border crossings seeking asylum in the United States will have to wait in Mexico while their claims are processed under sweeping new measures the Trump administration is preparing to implement, according to internal planning documents and three Department of Homeland Security officials familiar with the initiative.

According to DHS memos obtained by The Washington Post on Wednesday, Central American asylum seekers who cannot establish a “reasonable fear” of persecution in Mexico will not be allowed to enter the United States and would be turned around at the border.

The plan, called “Remain in Mexico,” amounts to a major break with current screening procedures, which generally allow those who establish a fear of return to their home countries to avoid immediate deportation and remain in the United States until they can get a hearing with an immigration judge. Trump despises this system, which he calls “catch and release,” and has vowed to end it.

Among the thousands of Central American migrants traveling by caravan across Mexico, many hope to apply for asylum due to threats of gang violence or other persecution in their home countries. They had expected to be able to stay in the United States while their claims move through immigration court. The new rules would disrupt those plans, and the hopes of other Central Americans who seek asylum in the United States each year.

Trump remains furious about the caravan and the legal setbacks his administration has suffered in federal court, demanding hard-line policy ideas from aides. Senior adviser Stephen Miller has pushed to implement the Remain in Mexico plan immediately, though other senior officials have expressed concern about implementing it amid sensitive negotiations with the Mexican government, according to two DHS officials and a White House adviser with knowledge of the plan, which was discussed at the White House on Tuesday, people familiar with the matter said.

The White House did not immediately respond to a request for comment.

According to the administration’s new plan, if a migrant does not specifically fear persecution in Mexico, that is where they will stay. U.S. Citizenship and Immigration Services is sending teams of asylum officers from field offices in San Francisco, Washington, and Los Angeles to the ports of entry in the San Diego area to implement the new screening procedures, according to a USCIS official.

To cross into the United States, asylum seekers would have to meet a relatively higher bar in the screening procedure to establish that their fears of being in Mexico are enough to require immediate admission, the documents say.

“If you are determined to have a reasonable fear of remaining in Mexico, you will be permitted to remain in the United States while you await your hearing before an immigration judge,” the asylum officers will now tell those who arrive seeking humanitarian refuge, according to the DHS memos. “If you are not determined to have a reasonable fear of remaining in Mexico, you will remain in Mexico.”

Mexican border cities are among the most violent in the country, as drug cartels battle over access to smuggling routes into the United States. In the state of Baja California, which includes Tijuana, the State Department warns that “criminal activity and violence, including homicide, remain a primary concern throughout the state.”

The new rules will take effect as soon as Friday, according to two DHS officials familiar with the plans.

Katie Waldman, a spokeswoman for DHS, issued a statement late Wednesday saying there are no immediate plans to implement these new measures.

“The President has made clear — every single legal option is on the table to secure our nation and to deal with the flood of illegal immigrants at our borders,” the statement says. “DHS is not implementing such a new enforcement program this week. Reporting on policies that do not exist creates uncertainty and confusion along our borders and has a negative real world impact. We will ensure — as always — that any new program or policy will comply with humanitarian obligations, uphold our national security and sovereignty, and is implemented with notice to the public and well coordinated with partners.”

A Mexican official, speaking on the condition of anonymity, said that current Mexican immigration law does not allow those seeking asylum in another country to stay in Mexico.

On Dec. 1, a new Mexican president, Andrés Manuel López Obrador, will be sworn in, and it’s also unclear whether his transition team was consulted on the new asylum screening procedures.

The possibility that thousands of U.S.-bound asylum seekers would have to wait in Mexico for months, even years, could produce a significant financial burden for the government there, especially if the migrants remain in camps and shelters on a long-term basis.

There are currently 6,000 migrants in the Tijuana area, many of them camped at a baseball field along the border, seeking to enter the United States. Several thousand more are en route to the city as part of caravan groups, according to Homeland Security estimates.

U.S. border officials have allowed about 60 to 100 asylum seekers to approach the San Ysidro port of entry each day for processing.

Last week, BuzzFeed News reported that U.S. and Mexican officials were discussing such a plan.

Mexico also appears to be taking a less-permissive attitude toward the new migrant caravans now entering the country.

Authorities detained more than 200 people, or nearly all of the latest caravan, who recently crossed Mexico’s southern border on their way to the United States. This is at least the fourth large group of migrants to cross into Mexico and attempt to walk to the U.S. border. They were picked up not long after crossing. The vast majority of the migrants were from El Salvador, according to Mexico’s National Immigration Institute.

After the first caravan this fall entered Mexico, President Enrique Peña Nieto’s administration offered migrants the chance to live and work in Mexico as long as they stayed in the southern states of Chiapas and Oaxaca. Most chose not to accept this deal, because they wanted to travel to the United States.

But, when it comes to bullying, demonizing, and beating up on harmless but extremely vulnerable and desperate refugees, many of them women, children, and families fleeing for their lives, he excels. What does that tell us about the lack of character of the “man,” and the total lack of judgement and regard for American values of those in the minority who put him in office and continue to prop him up?
This appears to be a reaction to: 1) Federal Courts requiring Trump to follow the  law; 2) Mexico’s refusal to be bullied into signing an absurdly inappropriate and totally one-sided “safe third country” agreement; 3) Congresses failure to fund the wasteful “Wall;” and 4) the near total, yet highly predictable, failure of Trump’s racist, White Nationalist inspired “get tough” immigration enforcement policies.
The Federal Courts are likely to permanently enjoin Trump from ignoring the law that specifically allows anyone in the U.S., legally or not, to apply for asylum. Additionally, Trump encourages violence against refugees and creates unsafe, inhumane conditions on the Mexican side of the border.  Consequently, the end result of Trump’s intentional “making folks wait in Mexico” policy is likely to be encouraging individuals seeking asylum to enter illegally and then turn themselves in to the authorities to apply for asylum in the U.S.
Meanwhile, the better options of working with the UNHCR and Mexico to promote a multinational approach to protection and to solve the problems in the Northern Triangle causing this humanitarian flow remain unaddressed by the Trumpsters.
Also, when will the “Face of Evil,” Stephen Miller, finally be held accountable for his consistently cowardly and racist attacks on the law and the American legal system?

LOS ANGELES — A federal judge on Monday ordered the Trump administration to resume accepting asylum claims from migrants no matter where or how they entered the United States, dealing at least a temporary setback to the president’s attempt to clamp down on a huge wave of Central Americans crossing the border.

Judge Jon S. Tigar of the United States District Court in San Francisco issued a temporary restraining order that blocks the government from carrying out a new rule that denies protections to people who enter the country illegally. The order, which suspends the rule until the case is decided by the court, applies nationally.

“Whatever the scope of the president’s authority, he may not rewrite the immigration laws to impose a condition that Congress has expressly forbidden,” Mr. Tigar wrote in his order.

As a caravan of several thousand people journeyed toward the Southwest border, President Trump signed a proclamation on Nov. 9 that banned migrants from applying for asylum if they failed to make the request at a legal checkpoint. Only those who entered the country through a port of entry would be eligible, he said, invoking national security powers to protect the integrity of the United States borders.

Within days, the administration submitted a rule to the federal registry, letting it go into effect immediately and without the customary period for public comment.

But the rule overhauled longstanding asylum laws that ensure people fleeing persecution can seek safety in the United States, regardless of how they entered the country. Advocacy groups, including the Southern Poverty Law Center and the American Civil Liberties Union, swiftly sued the administration for effectively introducing what they deemed an asylum ban.

The advocacy groups accused the government of “violating Congress’s clear command that manner of entry cannot constitute a categorical asylum bar” in their complaint. They also said the administration had violated federal guidelines by not allowing public comment on the rule.

But Trump administration officials defended the regulatory change, arguing that the president was responding to a surge in migrants seeking asylum based on frivolous claims, which ultimately lead their cases to be denied by an immigration judge. The migrants then ignore any orders to leave, and remain unlawfully in the country.

”The president has sought to halt this dangerous and illegal practice and regain control of the border,” government lawyers said in court filings.

Mr. Trump, who had made stanching illegal immigration a top priority since his days on the campaign trail, has made no secret of his frustration over the swelling number of migrants heading to the United States. The president ordered more than 5,000 active-duty troops to the border to prevent the migrants from entering.

The new rule was widely regarded as an effort to deter Central Americans, many of whom request asylum once they reach the United States, often without inspection, from making the journey over land from their countries to the border.

United States immigration laws stipulate that foreigners who touch American soil are eligible to apply for asylum. They cannot be deported immediately. They are eligible to have a so-called credible fear interview with an asylum officer, a cursory screening that the overwhelming majority of applicants pass. As result, most of the migrants are released with a date to appear in court.

In recent years, more and more migrants have availed of the asylum process, often after entering the United States illegally. A record 23,121 migrants traveling as families were detained at the border in October. Many of the families turn themselves in to the Border Patrol rather than queue up to request asylum at a port of entry.

The Trump administration believes the migrants are exploiting asylum laws to immigrate illegally to the United States. Soaring arrivals have exacerbated a huge backlog of pending cases in the immigration courts, which recently broke the one-million mark. Many migrants skip their court dates, only to remain illegally in the country, which Mr. Trump derides as “catch and release.”

But advocates argue that many migrants are victims of violence or persecution and are entitled to seek sanctuary. Gangs are ubiquitous across El Salvador, Honduras and Guatemala, where lawlessness and corruption enable them to kill with impunity.

Why aren’t ethical requirements being enforced on Government lawyers who present and defend these clearly frivolous positions in court?  Knowingly and intentionally depriving individuals of statutory, civil, and constitutional rights, while tying up Federal Judges and other “officers of the court” on frivolous political stunts directed at harming individuals on the basis of race and nationality must, at some point, be deterred!

These are not criminal proceedings, and the Administration is not entitled to a “presumption of innocence” for its lawless actions. At some point, ethical lawyers have an obligation “not to serve” a lawless Administration and to publicly disclose and oppose the Administration’s intentionally illegal actions and intentional wrongdoing aimed at migrants and communities of color in the U.S.  “Job security” doesn’t entitle Government employees, let alone those who also are members of the bar, to violate their oaths to uphold the Constitution.

And no, no matter how much the GOP appointees might want to do so, the Supremes can’t authorize the President to rewrite the clear terms of the law at his whim.

That day, the mothers scoured the site outside El Fuerte, a town in Sinaloa state, on Mexico’s northern Pacific Coast, looking for one of two men presumably kidnapped by cartel gunmen in recent weeks. One body had already been found in a field. The women believed the other may be nearby. In the end, they came up empty.

“This is my life,” said Mirna Medina, a forceful woman who holds the group together. “Digging up holes.”

Her son, who sold CDs by a gas station, was kidnapped in 2014. Three years later to the day, she and the other mothers of the search group dug up his remains. “I felt his presence,” she said, remembering the day and breaking out in tears. “I wanted to find him alive, but at least I found him.”

Some 37,000 people in Mexico are categorized as “missing” by the government. The vast majority are believed to be dead, victims of the country’s spiraling violence that has claimed more than 250,000 lives since 2006. The country’s murder rate has more than doubled to 26 per 100,000 residents, five times the U.S. figure.

Because the missing aren’t counted as part of the country’s official murder tally, it is likely Mexico’s rate itself is higher.

The killing and the number of missing grow each year. Last year, 5,500 people disappeared, up from 3,400 in 2015. Mexico’s murders are up another 18% through September this year.

Victims’ families, mostly mothers, organize search parties, climbing down ravines or scouring trash dumps. Their technique is crude. Sometimes they hire laborers to hammer steel rods into the soil and haul them up to see if they smell like decomposition. Other times, they simply look for an exposed body part or shallow grave.

The sheer numbers of the disappeared now rival more famous cases of missing people in Latin American history.

The Disappeared, or Desaparecidos, became a chilling part of Latin America’s vocabulary during the Cold War, when security forces kidnapped, killed and disposed of the bodies of tens of thousands of leftist guerrillas as well as civilian sympathizers. The most infamous case is Argentina’s “Dirty War,” where at least 10,000 people vanished from 1976 to 1983. In Buenos Aires, mothers of the missing organized weekly vigils in front of Argentina’s presidential palace, gaining world-wide prominence.

Mexico fought its own far-smaller war against Marxist guerrillas during the 1970s. According to the government human-rights commission, 532 people went missing, and at least 275 people were summarily executed by security forces.

This time around, the horror in Mexico is bigger and its causes more complex. Many of the disappeared in recent years are believed to be the victims of violence unleashed by criminal gangs fighting to control drug routes and other lucrative businesses such as extortion, kidnapping and the theft of gasoline from pipelines, often with the complicity of police forces, government officials say.

“It’s a crisis of civilization in Mexico,” said Javier Sicilia, a poet and victims’ advocate whose son was murdered in 2011. “It’s diabolical—an unprecedented perversity to disappear human beings and erase any trace of them from the world.”

The trauma of Mexico’s missing is an open wound in the nation’s psyche. Families who can’t grieve for their loved ones spend the day alternating between doubt and despair, praying for, and dreading, the blessing of certainty.

“We don’t sleep nights, we have nightmares wondering what happened, where can he be,” said Maria Lugo, 62, whose son disappeared in 2015.

Obviously, by no stretch of the imagination is Mexico a “Safe Third Country” for purposes of U.S. asylum law. The brazen attempt by the Trump Administration and GOP Senators led by Chuck Grassley and Mike Lee to force such an agreement down the throat of Mexico is as disingenuous as it is immoral.

It also is appalling the number of Trump Administration senior immigration officials who parrot the bogus claim that “refugees from Central America are required to apply for asylum in Mexico.” Neither international law nor U.S. law imposes such a requirement, for good reasons. Actually, the single “Safe Third Country Agreement” that we have negotiated with Canada in compliance with our immigration laws is quite circumscribed and very limited in scope. And, there are ongoing efforts in Canada to force Canada to withdraw from this agreement because of the Trump Administration’s mistreatment of asylum applicants.

Nevertheless, as I have previously pointed out, given conditions in the Northern Triangle, while Mexico isn’t a “Safe Third Country” for purposes of our law, it might well be a “safer third country,” in practical terms, for many Central American refugees and their families. It’s bigger than the Northern Triangle countries, somewhat better governed than the “failed states” of the Northern Triangle, easier and less dangerous to reach, has more economic opportunities and resettlement options, and is generally (although, sadly, not always) not as overtly hostile to refugees as is the U.S. under Trump.

To encourage (rather than attempt to force) more individuals to apply for asylum in Mexico, our Government should:

  •  Publicly acknowledge and treat the migration from Central America as a “humanitarian situation,” rather than a law enforcement issue;
  • Work with the UNHCR and Mexican authorities to improve asylum processing, adjudication, and resettlement in Mexico;
  • Provide financial aid and incentives for Mexico to improve its asylum system (rather than law enforcement money or threats to cut off funding);
  • Emphasize to Central American refugees the possible benefits of applying for asylum in Mexico (or elsewhere), rather than threatening them and trying to intimidate them from coming to the U.S.
  • Finally, and most important, the U.S. should be taking a leadership role with the UNHCR and other countries in our hemisphere to address the endemic problems in the Northern Triangle that are creating these refugee flows.

Refugee situations are complex, on a number of levels. They won’t be solved by the simplistic approaches (a/k/a political stunts) currently being taken by the Trump Administration, including the ridiculous “Wall.” Indeed, they can’t be solved by any single country. It takes the countries of the world working together to resolve them. That’s exactly what the mechanisms set up under the U.N. Convention on Refugees were intended to do. It’s beyond foolish for our Government to ignore them.

President Trump’s recent action to limit asylum claims at the U.S.-Mexico border is just his latest attempt to scare Americans about asylum seekers, undercutting long-standing principles of decency and humanity.

And like most of what Trump says about immigrants, the rationale the administration is using to keep out asylum seekers is based on myths and deliberate obfuscations.

Trump may not like it, but seeking asylum from persecution is a core human right. This right was recognized by the world and enshrined in Article 14 of the Universal Declaration of Human Rights. It has also been recognized by the United States and enshrined in our own domestic laws. Specifically, anyone “who is physically present in the United States or who arrives in the United States (whether or not at a designated port of arrival . . .), irrespective of [their] status, may apply for asylum.” The Trump administration’s order will curtail this fundamental right and inevitably prompt strong legal challenges and protracted, resource-intensive litigation in our courts.

Immigration lawyers like us know the truth about the people whom Trump calls an “invasion.” These asylum-seeking families, most fleeing horrific violence in Central America, where their own governments cannot protect them, are doing what is most human — trying to survive and protect their children.

We are asylum attorneys, but like many of our asylum-seeking clients, we are also mothers — of children ages 1 and 4, and one of us is nine months pregnant. Like most parents, we would do anything to keep our children safe. This is, indeed, the primary reason mothers decide to flee, sometimes pregnant, sometimes with small children, and take what they know and understand is the dangerous journey north — because they determine that is their best option for safety. This very human act of seeking protection for one’s children should be met with humanity, not hate-driven policies.

And the idea of an invasion isn’t the only false claim the administration is making to justify its new policy.

The administration alleges that most individuals who file asylum claims don’t return to court to adjudicate them. In his Nov. 1 speech, Trump himself claimed that only 3 percent of asylum seekers show up in court. In reality, the Justice Department’s own statistics recognize that 60 percent to 75 percent of non-detained individuals show up to court, while a recent study showed that 96 percent of families with legal representation seeking asylum showed up to court.

The administration seems to assume that those seeking asylum between ports of entry are less worthy, genuine or credible than those who seek entry at the border. In reality, there are totally valid reasons people enter between ports of entry — first and foremost, the U.S. government has a track record of unlawfully turning away asylum seekers from ports of entry.

The administration assumes that asylum seekers from Central America will be safe in Mexico. Trump said in his speech earlier this month that Mexico had offered asylum to members of a large refugee caravan traveling from Central America, and that if they did not accept it, they must not be genuine asylum seekers.

Trump gets two facts wrong here. First, the United States does not have a “safe third country agreement” with Mexico (as we do have in place with Canada), which would make it a requirement for any asylum seeker who set foot on Mexican soil to seek asylum in Mexico first or be barred from pursuing asylum in the United States.

And second, the reason we don’t have such an agreement with Mexico is because Mexico is not capable of providing adequate protection for many migrants. For example, last year, the University of the District of Columbia law school’s immigration clinic handled the case of a Honduran woman who fled severe harm and targeting by a powerful transnational gang and was then attacked by Los Zetas in Mexico as she traveled with her two young children to the United States. She dutifully sought asylum in Mexico, only to be told by Mexican officials that they could not protect her from the Zetas or the gang who had targeted her in Honduras. They advised her to continue to the United States to seek meaningful protection. She was granted asylum.

The Trump administration’s rule and proclamation are grounded in rhetoric about the need to cut down on government resources devoted to asylum seekers at the southern border. However, the changes are unlikely to save government resources; while they will bar individuals who enter between ports of entry from gaining asylum, making them eligible only for withholding of removal or relief under the Convention Against Torture (CAT), withholding and CAT still require a court hearing, which will continue to be delayed given the backlog of now more than 1 million cases in our immigration courts.

Moreover, granting withholding or CAT relief, as opposed to asylum, will add to the creation of a permanent underclass of refugees. These refugees will be barred from a path to permanent residence, family reunification and full inclusion as members of our society. Instead, they will live in limbo.

For example, take one of the UDC law school clinic’s clients from last year. Her persecutor kidnapped her at age 17 and then kept her in a hut for six months, raping her repeatedly. After six months, he said she was his wife and warned that if she left him, he would kill her younger siblings. For the next 20 years, she endured horrific abuse at his hands, eventually escaping and making it to the United States on her third attempt. She was barred from asylum because of her unsuccessful prior attempts to enter but eventually granted withholding of removal. While she works hard legally as a nanny in the D.C. metro area, she has no right to ever sponsor her children for immigration; nor can she leave the United States without losing her status. She will live in permanent limbo and never see her children again. This rule will create the same situation for many more people like her.

This move is just the latest in a string of efforts by the Trump administration to dehumanize asylum seekers, to create an “us vs. them” mentality. The fearmongering has already contributed to the massacre of 11 Jewish Americans at a synagogue in Pittsburgh because the suspect allegedly believed the Hebrew Immigrant Aid Society and all Jews were assisting the “invasion” of America.

But it is not “us vs. them.” We are all human. We all breathe the same air. We all want to be free. And above all else, we want our children to be safe. We implore the Trump administration and our fellow Americans to recognize our common humanity and start treating asylum seekers like fellow human beings, rather than demons to blame, criminals to punish and monsters to detain and fear. It is our common humanity that should guide our policy. Only then can the United States begin to return to its position of moral leadership.

The problem is that the Trump Administration doesn’t recognize a “common humanity.” Only its own, self-interested, White Nationalist, exclusive agenda. So, there’s no “core of decency” to which one might appeal.

What if we had a different “leader?” One who paid attention to facts, respected experts, sought different views, possessed values and human compassion, and, most of all, sought to solve problems rather than using lies, slander, and slurs to dehumanize individuals and promote an essentially racist agenda!
