“Refugees have been at the center of a political maelstrom, accused of everything from terrorism to being a drain on taxpayers — prompting President Trump, in one of his first official acts, to suspend the country’s four-decade old refugee resettlement program.

But a new study shows that refugees end up paying more in taxes than they receive in welfare benefits after just eight years of living in this country.

By the time refugees who entered the U.S. as adults have been here for 20 years, they will have paid, on average, $21,000 more in taxes to all levels of government than they received in benefits over that time span, according to a working paper released Monday by the National Bureau of Economic Research that examined the economic and social outcomes of refugees in the U.S.

“There was a lot of rhetoric saying these people cost too much, but we didn’t actually know what that number was,” said William N. Evans, an economist at the University of Notre Dame who co-authored the paper.

Trump, in his January executive order temporarily barring refugees from entering the country, had directed the State Department to study the long-term costs of the refugee admissions program to federal, state and local governments.”

NEW FROM NOLAN: GOP Senators’ Bill Would Give States Visa Authority!

Nolan Rappaport writes in The Hill:

“Sens. Ron Johnson (R-Wis.) and John McCain (R-Ariz.) recently introduced the State Sponsored Visa Pilot Program Act of 2017, which would allow the states to establish and manage their own guest worker programs for nonimmigrant workers, investors, and entrepreneurs.

According to Johnson, “We need to recognize that a one-size-fits-all federal model for visas or guest workers doesn’t work.  Let the states manage the visas, allocate them to the industries that need the workers, set prevailing wage rates.”

This program would blur the distinction between federal and state immigration responsibilities and require information sharing to an unprecedented extent, which would eliminate the justification for sanctuary cities. The states could no longer claim that enforcement was a solely federal responsibility.

How many visas?

The bill would allocate 5,000 renewable three-year visas for each state and give them a share of 245,000 additional visas which would be distributed on a population basis.  Also, the guest workers would be allowed to bring their spouses and children, and there would not be a limit on the visas for family members.  Thus, the program could bring more than a million aliens to the country each year.

The guest workers would have to work and reside in the state sponsoring them, but the states would be allowed to enter into compacts with other states to share the workers.

The states would be required to notify the DHS Secretary when guest workers fail to comply with the terms of their status “when the State is made aware of such failure.”

The AILA Annual Conference takes place over the course of three and a half days and is the largest yearly gathering of immigration lawyers and legal professionals in the United States.

In the end, our Board decided it could not ask AILA members, and in many cases their families, to attend a conference in the state which has passed SB-4 into law. SB-4 serves no legitimate purpose and undermines our country’s principles of fairness, due process, and equal treatment under the law. By championing this bill and signing it into law, Governor Abbott has continued the scapegoating of immigrants and the communities that welcome them, rather than acknowledging the immense benefits that immigrants bring to our nation and the shared prosperity which follows.”

“President Trump’s proposal to shift towards a “merit-based” immigration system would upend an approach that has existed for half a century.

Since the 1960s, the United States’ immigration system has largely based entry on family ties, giving preference to those with relatives who are citizens. But in his first address to a joint session of Congress in February, Donald Trump proposed moving away from that policy, focusing instead on an immigration system that would prioritize high-skilled immigrants.

Trump and his advisors have argued that the current levels of immigration harm American workers by lowering wages and preventing assimilation. A merit-based system, restrictionist advocates believe, would help lower immigration rates and ensure that the immigrants who do come are high-skilled workers who never need public assistance. “The current, outdated system depresses wages for our poorest workers, and puts great pressure on taxpayers,” Trump said in his speech to Congress.

While the president has yet to offer details, a merit-based system would pose its own challenges to economic prosperity. Critics believe that  a merit-based system that prioritizes high-skilled workers could hurt the economy by harming industries that rely on low-skill immigrant labor, and that fears that immigrants are not assimilating or are overly reliant on the social safety net are overblown.

The first example of the U.S. establishing qualifications for new immigrants was in 1917, when the government imposed a literacy test on those seeking to enter the country. In the 1960s, Congress lifted restrictions that heavily curtailed immigration from non-European nations, and reshaped the immigration system toward prioritizing admission of close relatives of immigrants already living in the United States. The overwhelming majority of immigrants are now admitted through that family-preference system, which significantly changed the ethnic composition of U.S. immigrant population by admitting more Latin American and Asian immigrants.

In 2015, for example, of the more than one million legal permanent residents admitted, “44 percent were immediate relatives of U.S. citizens, [and] 20 percent entered through a family-sponsored preference,” according to the Migration Policy Institute, a nonpartisan think tank. Only 14 percent of those admitted came through a job-based preference. The “merit-based” immigration system, in theory, would increase the latter figure, as it would prioritize those who are highly educated and therefore considered more employable.

Such a policy would likely limit the supply of low-skilled workers, and might allow the administration to filter which immigrants it chooses to admit. And a merit-based immigration system could also help realize a longtime conservative policy goal—a reduction in the number of immigrants admitted overall.

Some Republican lawmakers have already pushed for legislation that would limit legal immigration. Last month, Republican Senators Tom Cotton and David Perdue introduced legislation that would cut the number of immigrants legally admitted to the United States in half. It would do so in part by limiting the number of family members immigrants can sponsor for citizenship, a policy long sought by immigration restrictionist groups.

Dan Stein, the president of the Federation for American Immigration Reform, which supports curtailing immigration, said a merit-based approach could reduce the flow of immigrants coming into the United States. “The merit-system is also a surrogate for moving away from a system that the country doesn’t really get to control and regulate how many come in every year and who they are because of chain migration, the family-preference system,” Stein said, adding that a points system would be one part of the whole.

Nevertheless, assessing “merit” is difficult. A system that deliberately excluded low-skilled workers might raise labor costs in industries that rely on those workers, increasing prices for consumers but boosting wages for workers.”

H-2B Nonimmigrant Visa Dispute Hits US Seasonal Industries!

“Mackinac Island has a permanent population of about 500 people and just as many horses, but no cars. From May to October, the picturesque Michigan getaway relies on about 3,000 workers to power its economic engine: summer tourism.

Historically, up to a third of those workers are foreigners, including Mexicans, Filipinos, Canadians and Jamaicans, who are hired on seasonal visas. But when many of the island’s business owners applied for those visas this year, they heard from the government that none were left.

So at the Iroquois Hotel, a Victorian property on the waterfront where rooms command up to $1,200 a night, the owner is trying to figure out how to maintain its high standards without 30 Jamaican housekeepers. Other hotels are contemplating closing off whole sections. Even those who own the ubiquitous horses are wondering if they will have enough workers.

“It’s urgent for us to get more visas to save the season,” Brad Chambers, who operates horse tours and taxis, said.

The island whose selling point is being stuck in time is now suffering because it is stuck in the middle of a modern-day struggle over jobs and who should be doing them. So, too, are a number of the regional industries that define the American summer but have increasingly relied on non-American workers, from vacation spots in Maine and Minnesota to Gulf Coast shrimpers and the salmon fisheries of Alaska.”

So, how does having unused hotel rooms and unprocessed fish help U.S. Workers? An employer has to show unsuccessful efforts to recruit US workers to get a petition approved in the first place.

Exploitation of foreign workers is another question. That requires more vigorous inspection and investigation by the USDOL. But, these are exactly the kinds of regulatory inspection and enforcement jobs that the Trump Administration seeks to eliminate under the guise of  “”lessening the buurden” on US employers!

H-1B NONIMMIGRANTS: A Needed Visa In Need Of Reform — It’s Essential For Our Economy, But It’s Wrong When US Workers Are Displaced & Degraded — A Plea For Reform By One Who Has Benefitted From The System But Sees The Abuses!

They say US companies must be required to document their searches to fill positions with American workers. Employers must pay prevailing wages and be prevented from subcontracting or outsourcing H-1B jobs.
Reform advocates are pushing for a system of government enforcement and oversight of the H-1B regulations, not one that is reliant on whistleblowers to expose abuse.
Technology is here to stay. And it is changing at warp speed. The demand for smart talent is not going away. That’s why even the biggest critics of H-1B are the most ardent backers of reform, not elimination.
What I hear them saying is the system ought to work the way it used to, when my father obtained an H-1 visa. He was hired for a job he was uniquely qualified for, and he was compensated with a decent wage.
No one wants to see Americans lose their jobs unfairly, and if my father were still alive, I know he’d be troubled by what I learned about the current H-1B program.
I also know he would be heartened to see that some of the most ardent backers of visa reform are Indian Americans. After all, we are the ones who have most reaped the rewards of H-1B.”

Several thoughts. I was very critical, and still am, of House Immigration Subcommittee GOP Members for starting off with controversial, “in your face,” and unneeded enforcement-only bills. See http://wp.me/p8eeJm-Qw
Why not instead start with something bipartisan that would be good for America, like H-1B reform. Chairman Grassley in the Senate has expressed strong interest in reforming the H-1B category to eliminate abuses. And, it appears that most major U.S. employers who use H-1Bs also see the need for reform to preserve and improve the program.
Additionally, things like investment visa “EB-5” reform also appear likely to attract support from both sides of the aisle in both houses.
A second thought, why don’t U.S. companies, particularly those started or run by immigrants, which use H-1Bs start the reforms now. “Reverse” the process. Use highly talented H-1B workers to train U.S. workers, particularly in places where the economic rebound has not yet reached, for whatever reason.
For example, in a recent blog dealt with the situation in the small city of Gillette, WY. http://wp.me/p8eeJm-UY  The folks seemed nice, optimistic, and interested in a brighter future for their community. But, with or without Trump and his environment-busting policies, coal mining as a way of life is on the way out. I can’t imagine that too many of the younger generation are hanging around places like Gillette.
Why not go in and establish some tech centers using H-1Bs as trainers. Sure, working on a computer in an office isn’t everyone’s cup of tea. I get that. But, it is something that can be done from anywhere.
And, the costs of doing business, at least initially, are likely to be less in a place like Gillette. Increased economic activity brings with it other needs: buildings, houses, markets, auto dealers, repair shops, HVAC technicians, public servants, schools, teachers, etc. So, there could be something for everyone, even those who don’t want to work at a desk all day.
Maybe, it’s time for those who want immigration reform to stop talking and whining and start doing. Things that demonstrably work and help folks out build their own bases of support. That’s better than trying to convince folks with statistics and pie charts!

America’s Parallel Universe: Out There In Wyoming, Coal Is Back, Trump Is King, & The Skies Are Not Cloudy All Day (Or, More Accurately, “My Sky Is Blue And My Water Is Clean”) — As For The Rest Of The World Who Might Like To Live Above Water Or Breathe Clean Air? — Just Not On The Radar Screen!

“In Gillette and surrounding Campbell County, people were beginning to feel the comeback they voted for. Unemployment has dropped by more than a third since March 2016, from 8.9 percent to 5.1 percent. Coal companies are rehiring workers, if only on contract or for temporary jobs. More people are splurging for birthday parties at the Prime Rib and buying a second scoop at the Ice Cream Cafe.

Maybe it was President Trump. Much was surely because of the market, after a colder winter led to increases in coal use and production. But in times when corporate profits are mixed with politics, it was difficult for people here to see the difference.

“I’m back to work,” Gorton said. “It’s real. Did Trump do it all? I don’t think so. But America voted in a man who was for our jobs.”

In a divided nation, optimism had bloomed here in a part of the country united in purpose and in support of the president. Close to 90 percent voted for the same presidential candidate, and 94 percent of the population is the same race. And everyone has some connection to the same industry. They felt optimistic about the tangible effects of the Trump economy, which favors fossil fuels, and the theoretical ones, which favor how they see themselves. Once on the fringes, their jobs had become the centerpiece of Trump’s American mythology.

“We once powered the nation,” Gorton said. “But you got the feeling that things are not quite the same and that political forces are encroaching on your livelihood. It’s like they are willing to take away your town.”

Now the fear of what might be taken away was carried by someone else. There was another side of this American story, a tenser and more terrifying one, where immigrant families worried about deportation raids and ­liberals marched with witty ­placards to protest the “war on science.”

Far beyond the borders of this isolated town, many Americans were gripped by the latest evidence of the president’s coziness with the Russians, and wondered why the white working and middle classes hadn’t abandoned their increasingly unpopular president. In that America, the early optimism about Trump was fading. A Quinnipiac poll released last month said that 52 percent of Americans were pessimistic about the country’s direction, 20 percent higher than when Trump was inaugurated. And Friday’s anemic employment report, showing the country gained only 138,000 jobs in May, provided little consolation.

Gorton found it difficult to reconcile those two polarized feelings; it seemed that either you had to believe in the country’s pending prosperity or its impending doom.

“I know there are people who are scared about where the country is headed, but before I was scared,” Gorton said. “Either they’re dreaming, or I’m dreaming.”

The question is, once Trump and his cronies are done with their policies of hate, disrespect, and divisiveness, will anyone ever be able to put the pieces of America together again?

Seems like folks on both sides of the aisle should have been able to get together and solve the problems of the nice people of Gillette without reigniting an essentially dying industry that, in the long run, is neither economically viable nor environmentally desirable. When the world fries, I doubt that God will exempt Wyoming from the consequences. Those skies could get cloudy some day. And, by that time, the Trump crowd will be long gone.

FOOD & DRINK: Making America Great — Mexican Immigrants Go From Field Workers To Winery Owners — Learning The Business From The Ground Up (Literally) — With A Great Glass Of Wine To Boot!

“Outside Robledo Family Winery, south of Sonoma, on a cool April Sunday, the U.S. and Mexican flags whipped a stiff salute in the wind blowing off the San Pablo Bay. A third banner bore the winery logo. The flags represent three themes central to the lives of Reynaldo Robledo and many other Mexican migrant workers who have helped shape California’s wine industry: heritage, opportunity and family.

Robledo is part of a small but growing community of Mexican American families who started as migrant workers and now have their own wineries. They have emerged from the invisible workforce of laborers who prune the vines in bitter winter cold and tend them under searing summer sun. We read about them when they collapse from heat exhaustion in California’s Central Valley or perish in a winery accident. But they rarely appear in the glossy magazines that extol the luxury wine lifestyle, except as cheerful extras in harvest photos.

Amelia Morán Ceja worked in vineyards after school in the early 1970s. Now she owns Ceja Vineyards. The Cejas are one of five Mexican American families recognized by the Smithsonian for their work in California’s wine industry. (Ceja Vineyards; Sarah Deragon/Ceja Vineyards)
Five Mexican American families are helping craft the next chapter in the story. They started as migrant workers and now have their own wineries.

They came from Michoacan or Jalisco, two agricultural provinces near Mexico City. Their fathers left for El Norte as migrant workers — some under the Bracero guest-worker program, others crossing the border illegally but gaining legal status in a time when papers were easier to come by. They worked in California’s burgeoning agricultural industry before settling in wine country. They encountered some of Napa Valley’s most celebrated winemakers and contributed to California’s wine revolution in the 1970s and 1980s, a period that saw dramatic changes in viticulture and food culture as the United States became a wine-loving nation.

“Their story is the journey,” says Steve Velasquez, associate curator at the Smithsonian Institution’s National Museum of American History, which honored the families during its annual winemakers’ fundraising dinner in May. “A journey from Mexico to the U.S. to work in agriculture, from a handful of families to a thriving community of Mexican Americans, from vineyard workers to winery owners. . . . These families represent Mexican Americans who once just supported an industry but now help shape it.”

I observed similar success stories in many of the families that came before me in court. Laborers became supervisors. Cooks became chefs. Waiters became restaurant managers. Drywallers started construction companies. Truck drivers started trucking companies. Mechanics bought auto repair businesses. Gardeners started lawn services and landscaping companies. Folks took care of their own family members; but, they also created jobs and opportunities for other American workers. They were all about quality service, hard work, skills, family, and a certain amount of risk taking. Just what America needs for a great future!

WashPost: Courtland Milloy Lays Bare Sessions’s White Nationalist Agenda!

“Here’s what white supremacy really looks like:

Attorney General Jeff Sessions gearing up for another “war on crime.” But first, he has to manufacture enough fear of people of color. He recently tried by declaring, falsely, that New York “continues to see gang murder after gang murder, the predictable consequence of the city’s ‘soft on crime’ stance.”

Sessions threatened to withhold millions of dollars in federal grants from the city’s police department if the city didn’t start turning in undocumented immigrants to federal authorities.

[Sessions issues sweeping new criminal charging policy ]

In other words, if New York doesn’t have a crime problem now, Sessions would cut police funding until it did have one.

New York Mayor Bill de Blasio, citing the city’s low crime rate, called Sessions’s remarks “outrageous” and “pitiful.” Sessions later conceded that New York police had created “some of the best” techniques for fighting crime.

But that’s not the end of it.

Under the Trump administration, local police departments are slated to get more powerful weaponry and expanded powers to use them. Corporate prison complexes could see an increase in profits if Sessions’s push to bring back mandatory minimum sentences moves forward. Rural communities in majority white areas will get new prisons — along with jobs overseeing a veritable plantation of mostly black and Hispanic inmates.
The judiciary is a key component in the maintenance of this system. Police are rarely charged for fatally shooting someone while on duty. According to an analysis by The Washington Post and researchers at Bowling Green State University, 54 officers faced charges for such shootings between 2005 and 2015, a fraction of the fatal police shootings that occurred across the country in that time. The majority of the officers whose cases have been resolved have not been convicted, The Post found.

The Post also reported: “Among the officers charged since 2005 for fatal shootings, more than three-quarters were white. Two-thirds of their victims were minorities, all but two of them black.”

It is as if the vision of Rep. Steve King (R-Iowa), who recently declared that white “culture and demographics are our destiny,” are coming true. In effect, black and brown lives do not matter.

And with voting rights under attack, the chances of getting elected officials who might take a stronger stance for justice becomes slimmer by the year.

On Monday, the U.S. Supreme Court upheld a lower court’s ruling that North Carolina legislators had acted “with almost surgical precision” to blunt the influence of black voters. But Chief Justice John G. Roberts Jr. made clear in a separate opinion that the ruling did not mean that court was taking a stand for or against the actions. Encouraged by the high court’s statement, the legislators have vowed to keep at their obstructionist ways.

President Trump, having fomented fears of “Mexican rapists” during his campaign, announced Monday that he was cracking down on a Mexican gang. “MS-13 is going to be gone from our streets very soon, believe me,” he said, during a ceremony for slain police officers. “When policing is reduced, it’s often the poorest and most vulnerable Americans who are the first to suffer. We have all seen the tragic rise in violence and crimes in many of our disadvantaged communities.”
But Trump offered no plan for dealing with that disadvantage. Nothing about more jobs or affordable housing. Not better health care — just more police officers with bigger guns.

No need for the white protesters to wave Confederate flags and chant “white power.” Trump and Sessions know how to placate them by attacking black freedoms.

“In short, the standard innovation theory of American exceptionalism is all about qualities that make each worker more productive. Today, nearly all the economic discussion about how to make America great again focuses on ways — like cutting red tape and taxes — to revive flagging productivity growth.

Though this discussion remains critically important, it plays down a big shift in the story. The underlying growth potential of any economy is shaped not only by productivity, or output per worker, but also by the number of workers entering the labor force. The growth of the labor force is in turn determined mainly by the number of native-born and immigrant working-age people. Over the last two decades, the United States’ advantage in productivity growth has narrowed sharply, while its population advantages, compared with both Europe and Japan, have essentially held steady.

What makes America great is, therefore, less about productivity than about population, less about Google and Stanford than about babies and immigrants.

The growing importance of the population race will be very hard for any political leader to fully digest. Every nation prefers to think of itself as productive in the sense of hard-working and smart, not just fertile. But population is where the real action is.

Comparing six of the leading developed countries — the United States, Germany, Japan, Canada, Australia and Britain — I found that not only has productivity growth been slowing across the board in recent decades, but also that the gaps in productivity growth among these rich nations are narrowing sharply. For example, in the 1990s and 2000s, productivity was growing much faster in the United States than in Germany or Japan, but that advantage has largely disappeared in this decade.

The reasons for this convergence are complex, possibly having to do with the way production technology now spreads quickly across borders. But this trend spans the developed world, and it basically holds regardless of which two countries you compare, which should raise doubts about how any one country, including the United States, can regain a distinct economic advantage by focusing only on reviving productivity.

Which brings us back to babies and immigrants. Like productivity, population growth has been slowing worldwide in recent decades, the big difference being that the gaps among the rich nations are increasingly significant. In the 1960s the United States population growth rate averaged 1.2 percent, or 50 percent higher than Europe’s and about the same as Japan’s. By the late 1960s, population growth peaked worldwide because of the spread of birth control and other cultural shifts, but it has slowed much more gradually in the United States than in its rivals.

Since 2005, per capita gross domestic product has grown on average by 0.6 percent a year in the United States, exactly the same rate as in Japan and virtually the same rate as in the 19 nations of the eurozone. In other words, if it weren’t for the boost from babies and immigrants, the United States economy would look much like those supposed laggards, Europe and Japan.

Indeed, if the United States population had been growing as slowly as Japan’s over the last two decades, its share of the global economy would be just 15 percent, not the 25 percent it holds today.

Moreover, immigrants make a surprisingly big contribution to population growth. In the United States, immigrants have accounted for a third to nearly a half of population growth for decades. In other countries with Anglo-Saxon roots — Canada, Australia and Britain — immigrants have accounted for more than half of population growth over the past decade. Those economies have also been growing faster than their counterparts in the rest of Europe or Japan. But much of that advantage would have disappeared without their population advantage.

Politically, the irony of this moment is stark. Population growth is increasingly important as an economic force and is increasingly driven by immigration. Yet now along comes a new breed of nationalists, rising on the strength of their promises to limit immigration. And they have been especially successful in countries where anti-immigrant sentiment has run strong, including the United States and Britain.

It would be unrealistic to imagine that hard economic logic will turn the anti-global, anti-foreign tide any time soon. So the likely result is that the United States and Britain will go ahead and limit immigration. To the extent they do — and their rivals do not — they will undermine their key economic edge, and cede much of the growth advantage they have enjoyed over Europe and Japan.”

The “other people’s babies” crowd is driven by xenophobia and racism, not by any real desire for a great future for all Americans.

Meanwhile, tone-deaf Republicans, including Jeff Sessions, are calling for limits on legal immigration, without any credible factual or statistical basis to support their restrictionist agenda. Same goes for those who would limit family-based immigration in favor of some type of “point system” favoring highly skilled migrants.

The U.S. needs (and uses) migrant labor in all parts of the economy. If anything, migration, both legal and undocumented, at the “worker bee level” — farmworkers, construction  workers, food processors, child care workers, hospitality industry workers, janitors, and other service occupations — has been just as important to our growth and prosperity as a nation as have been scientists, researchers, professors, executives, star athletes, entertainers, and capitalists.

We need a comprehensive immigration reform package that not only legalizes those law-abiding immigrants already in  the workforce, but provides opportunities for significantly expanded legal immigration. Not only would this more realistic approach address our economic needs, but it also would be a better way to solve immigration enforcement issues than money spent on walls, detention, and more enforcement bureaucracy.

As the system more reasonably matches supply and demand, the pressure for migration outside the system decreases and the incentive for “getting in line” increases. Just good old capitalist theory applied to the oldest human phenomenon: migration.

“President Trump plans to sign an executive order in Wisconsin on Tuesday that the White House says will make it harder for tech companies to replace American workers with cheaper foreign labor, and will strengthen rules barring foreign contractors from bidding on government projects, according to senior administration officials.

The officials, in a background call with reporters, said Trump will direct the Departments of Labor, Justice, State and Homeland Security to crack down on fraud and abuse in guest-worker programs by issuing new immigration rules.

The president will also direct the Department of Commerce to review federal procurement rules and trade agreements with a view to putting American firms at an advantage when it comes to winning contracts.

The officials pitched the twin directives as benefiting working- and middle-class Americans who have suffered for too long under unfair trade and immigration rules.

“This is the policy that ensures no one gets left behind in America anymore — that we protect our industry from unfair competition, favor the products produced by our fellow citizens and make certain that when jobs open those jobs are given to American workers first,” the White House said in a statement.

It was not immediately clear how much the administration could accomplish without cooperation from Congress.

“Sweeping changes are going to require congressional action,” said Lynden Melmed, an immigration attorney who had served as U.S. Citizenship and Immigration Services chief counsel within the Department of Homeland Security under President George W. Bush.

However, industry experts said Trump’s executive order was a good first step to protecting the U.S. defense industrial base, and U.S. firms that do business with the federal government.

“It’s one of the few presidential exertions in recent time, that holds out the hope of saving U.S. industrial jobs,” said Loren Thompson, a defense industry consultant and the chief operating officer of the Lexington Institute in Arlington.”

THE HILL: N. Rappaport Says Time For Congress To Pull The Plug On Troubled EB-5 Investor Program

“So, should the EB-5 program be terminated?

Yes, Congress has had more than 25 years to fix the EB-5 program. There is not going to be a legislative “fix.” The only viable alternative is to terminate it and start over.

I have a few suggestions for the new investment program. It should:

  • Raise the investment amounts;
  • Establish more detailed statutory requirements for regional centers;
  • Require Chinese investors to establish that they have permission from the Chinese government to remove enough money from China to meet the investment requirement;
  • Provide for input from the states on designating Targeted Employment Areas but have the designations made by the federal government;
  • Establish guidelines for making the “Targeted Employment Area” designations which eliminate the current gerrymandering process and ensure that the investment money goes where it is supposed to go; and
  • Include measures to eliminate fraud from the program.

Some lawmakers have given up already. Rep. Steve King (R-Iowa) and Sen. Dianne Feinstein (D-Calif.) introduced bills to terminate the EB-5 program. These members have the right idea. It is time to put an end to a failing, faulty program and implement immigration policies that actually yield the intended result.”

WashPost: Administration Warns Employers Not To Use H-1B Program To “Dis” U.S. Workers!

“WASHINGTON — The Trump administration has issued a stern warning to U.S. companies as they begin applying for coveted skilled-worker visas, cautioning that it would investigate and prosecute those who overlook qualified American workers for jobs.

The message came on the opening day of applications for American employers seeking visas known as H-1B, which are used mostly by technology companies to bring in programmers and other specialized workers from other countries.

“U.S. workers should not be placed in a disfavored status, and the department is wholeheartedly committed to investigating and vigorously prosecuting these claims,” Tom Wheeler, acting head of the Justice Department’s Civil Rights Division, said in a statement.

The Obama administration sued companies for violating the Immigration and Nationality Act’s anti-discrimination provisions, including businesses that favored foreigners over U.S. workers. But Monday’s warning in a news release at the start of the visa process appeared to be a first-of-its kind signal to employers not to put American workers at a disadvantage.

U.S. Citizenship and Immigration Services also announced that it would step up its reviews of employers that use H-1B visas, saying “too many American workers who are qualified, willing and deserving to work in these fields have been ignored or unfairly disadvantaged.”

The statements were the latest indication that even legal immigration will be scrutinized under the Trump administration.”

Interesting that Jeff Sessions and the DOJ’s Civil Rights Division are getting so involved in the H-1B program. Normally, H-1B enforcement would be a matter for the DHS, the U.S. Department of Labor, and the Office of Special Counsel for Unfair Immigration-Related Employment Practices at the DOJ. But, I suppose without any voting rights or police abuse cases to investigate, the Civil Rights Division will have some time on its hands for taking on some new immigration enforcement responsibilities.

Another thought.  Rather than battling the Administration over the H-1B program and threatening to move tech operations to Canada and elsewhere if their demands are not met, why don’t U.S. tech companies and Democrats “think outside the box.”

Why not make areas of the “Rust Belt” with willing workers and high unemployment the new “Silicon Valley East?” Use H-1Bs to re-train U.S. workers for permanent jobs in technology. Build new offices or refurbish abandoned plants. Establish training programs with local community colleges and technical colleges. Fund some opioid addiction treatment programs to get capable workers off of drugs and into jobs where they have some future. Support regional airports in “the hinterlands” that Trump is trying to shut down.

Trump seems only vaguely interested in addressing the real problems of unemployed and underemployed workers. If he actually does succeed in so-called “health care reform,” (that is transferring money from the needy to the rich) their situation will become immeasurably worse. Futile grandstanding like relaxing environmental controls for an “ain’t gonna happen” revival of the coal industry, appointing Gov. Chris “The Bridge” Christie to a form a new governmental committee on opioid addiction, or having Jeff Sessions divert the Civil Rights Division into H-1B investigations aren’t serious attempts to address the issues.

But, so far, the Dems and the leaders of the tech industry have been largely MIA on practical solutions to these problems that Trump seems unlikely to address in any realistic manner. So, while the Dems are tilting at the “Gorsuch Windmill,” which I can guarantee you isn’t a concern for most “Dems turned Trump voters” in the Rust Belt, the opportunity for real leadership, genuine concern for U.S. workers, and demonstrated problem solving is going by the boards. Maybe that’s how Donald Trump became President with 46.4% of the vote.

Just proving once again the Trump might not have to act presidential or accomplish much of positive value to be a two-term President. And, as he has already shown, he can do that relatively easily even if he never attains the approval of the majority of Americans.

NY TIMES: Idaho Town In Trump Country Owes Economic Revival To Foreign-Born Workers!

“Labor issues also show the tenuousness of the situation.

Much of southern Idaho’s growth since the recession has been linked to dairy products. And most of the workers in the dairies that supply that raw material are foreign-born, mostly from Mexico.

“You can’t talk about success in Idaho without talking about foreign-born labor,” said Bob Naerebout, the executive director of the Idaho Dairymen’s Association.

Chobani’s founder, Hamdi Ulukaya, said his company had worked with Idaho colleges to provide technical training for workers to solve its own labor shortage as its factory was going up. He said he saw a huge opportunity for Idaho to build on food technology and safety as a larger industry cluster if partnerships and training could continue.

“Our biggest challenge is that we have to find a way to keep the young in Idaho,” Mr. Ulukaya said.

Shawn Barigar, the mayor of Twin Falls, said his community could not afford to lose any workers. The battle for survival, he said, whether rural or urban, will allow for only the strong and determined to survive and prevail.

“Whatever might be in the future, I think there are ways to adapt and not go away,” he said.”

HISTORY: Matthew Yglesias In VOX Shows How Immigration Made America Great, Right From Our Beginning — It Wasn’t Always About Generosity To Others; It Was Mostly About What Made Us More Successful & Prosperous!

“George Washington set in motion a strategy so radical that it made this country the wealthiest and strongest on Earth — it made America great.

Immigration.

He embraced a vision for an open America that could almost be read today as a form of deep idealism or altruism. “America is open to receive not only the opulent and respectable stranger, but the oppressed and persecuted of all nations and religions,” he told newly arrived Irishmen in 1783. He assured them they’d be “welcome to a participation of all our rights and privileges, if by decency and propriety of conduct they appear to merit the enjoyment.”

But Washington’s vision wasn’t primarily about charity or helping others. It was about building the kind of country that he wanted the United States to become. Greatness would require great people. America would need more than it had.

The contemporary debate around immigration is often framed around an axis of selfishness versus generosity, with Donald Trump talking about the need to put “America first” while opponents tell heartbreaking stories of deportations and communities torn apart. A debate about how to enforce the existing law tends to supersede discussion of what the law ought to say.

All of this misses the core point. Immigration to the United States has not, historically, been an act of kindness toward strangers. It’s been a strategy for national growth and national greatness.

Last but by no means least, while it’s certainly true that Americans care about the average well-being of American citizens, we also care about something else — greatness, for lack of a better word.

In per capita income terms, the United States has, by most measures, been overtaken by Switzerland. The Netherlands is relatively close behind, and when you consider inequality and quality of public services, the typical Dutch person may well enjoy a higher standard of living than the typical American. This kind of thing matters. But at the same time, there is a reason that when Americans feel anxiety about national decline, they tend to think of China and not Switzerland. The Netherlands is a great place to live, but it hasn’t been a great nation since the early 17th century.

Aggregates matter, in other words.

If Americans had listened to the counsel of the Know-Nothing movement in the 1850s and drastically curtailed immigration from outside of Protestant Europe, it would probably still be a rich country today. But it would be a very different kind of rich country from the one we know — one with fewer, smaller cities mainly focused on exporting agricultural goods and other natural resources to the wider world. A place more like Canada or a supersize version of New Zealand, rather than an industrial and technological powerhouse that intervened decisively in two world wars and anchored a coalition of liberal states to defeat communism.

Going forward, demographers forecast that immigration — both the people it provides directly and the children that immigrants bear and raise — is the only reason America’s working-age population isn’t declining. This is doubly true when you consider that immigrants’ work in the household and child care sectors likely serves to increase native-born Americans’ childbearing as well.
A declining working-age population, seen already in Japan and some southern European countries, poses some serious challenges to a national economy. It tends to push interest rates down to an incredibly low level, making it difficult for central banks to respond to a recession. It also makes it more difficult to sustain public sector retirement programs and elder care more generally.

There are some offsetting upsides (less strain on transportation infrastructure, for example), and, like anything else, the problems are solvable. Fundamentally, however, an America that is shrinking is a country that is going to be a lesser force in the world than an America that is growing. It’s true, of course, that an America that continues to be open to immigrants will be a progressively less white and less Christian country over time. That’s a threatening prospect to many white Christian Americans, who implicitly identify the country in ethnic and sectarian terms. But America’s formal self-definition has never been in those terms.

And for those who believe in the principles of the Declaration of Independence and the value of America’s ideals, accepting a future of decline and retreat in the name of ethnic purity should be unacceptable. That the more homogeneous America will be not just smaller and weaker but also poorer on a per capita basis only underscores what folly it would be to embrace the narrow vision. That hundreds of millions of people around the world would like to move to our shores — and that America has a long tradition of assimilating foreigners and a political mythos and civil culture that is conducive to doing so — is an enormous source of national strength.

It’s time we started to see it that way.”

I had these same feelings about many of the “happy cases” that came through my courtroom in Arlington over the years. I was constantly impressed with the courage, dedication, determination, and under-appreciated skills of the folks who came before me. And, I felt inspired and optimistic that they had chosen, notwithstanding hardship and obstacles, to join our national community and help make America even greater. Building America, one case at a time.
