“A federal judge on Friday ordered the Department of Homeland Security (DHS) to rescind its delay of a rule that allows some foreign entrepreneurs to stay in the United States to grow their companies, court documents show.
Judge James Boasberg of U.S. District Court for the District of Columbia ruled in favor of a lawsuit filed by a U.S. venture capitalist group in September challenging a delay by DHS of the International Entrepreneur Rule.
In the lawsuit, the National Venture Capital Association argued that the Trump administration bypassed proper procedures when it delayed the International Entrepreneur Rule, which had been due to go into effect in July 2017.
The trade group was later joined by several tech start-ups active in the United States that were founded by foreign entrepreneurs who wanted to stay in the country and work with their businesses through the entrepreneur rule but are now unable to.
The rule, proposed by the administration of President Barack Obama, would allow some foreign start-up founders to stay in the United States for up to five years to develop their businesses.
Instead, in July the administration of President Donald Trump pushed back implementation to March 2018, and said it was “highly likely” to ultimately rescind the rule.
Boasberg, in his ruling issued on Friday, agreed with the lawsuit’s claim that the government’s actions violated the Administrative Procedure Act, which requires advance notice of new rules.
“This decision is an important reminder that this administration must comply with the law and allow the public to have a voice during the agency rule-making process,” Leslie Dellon, an attorney at the American Immigration Council, said in a statement.”

“Economists and tax experts are overwhelmingly skeptical that the bills in the House and Senate can generate meaningful job growth and economic expansion. Many view the legislation not as a product of genuine deliberation, but as a transfer of wealth to corporations and affluent individuals — both generous purveyors of campaign contributions. By 2027, people making $40,000 to $50,000 would pay a combined $5.3 billion more in taxes, while the group earning $1 million or more would get a $5.8 billion cut, according to the Joint Committee on Taxation and the Congressional Budget Office.
“When you put all these pieces together, what you’re left with is we are squandering a giant sum of money,” said Edward D. Kleinbard, a former chief of staff at the Congressional Joint Committee on Taxation who teaches law at the University of Southern California. “It’s not aimed at growth. It is not aimed at the middle class. It is at every turn carefully engineered to deliver a kiss to the donor class.”
In a recent University of Chicago survey of 38 prominent economistsacross the ideological spectrum, only one said the proposed tax cuts would yield substantial economic growth. Unanimously, the economists said the tax cuts would add to the long-term federal debt burden, now estimated at more than $20 trillion.
If the package does have a guiding philosophy, it is a return to trickle-down economics, an enduring story line in which the wealthy are supposed to spend and invest their tax breaks, creating jobs and commercial opportunities for everyone else.
As President Ronald Reagan slashed taxes in the 1980s, he argued that citizens, not bureaucrats, should decide how to spend their money. President George W. Bush bestowed enormous tax cuts on the affluent.
But the trickle-down story has yet to achieve its promised happy ending. Only the beginning reliably transpires, the part where wealthy people get relief. The spoils of resulting economic growth have largely been monopolized by those with the highest incomes. Pay for most American workers has been stagnant since the mid-1970s, after the rising costs of housing, health care and other basics are factored in.
Nonetheless, Republicans are staging a trickle-down revival.
“Either it’s a religious belief, a belief where no amount of evidence would change that, or they are using the argument cynically and they just want more money for themselves,” the economist Joseph E. Stiglitz, a Nobel laureate, said.
Mr. Stiglitz has long warned of the perils of growing inequality while deriding tax-cutting inclinations. Yet even those who have favored lighter tax burdens are critical of the current proposals.
In the late 1970s, Bruce Bartlett developed what would become the locus of the Reagan tax cuts while working for Representative Jack Kemp, a conservative Republican from New York. Those cuts helped cushion the pain from sharp increases in interest rates by the Federal Reserve, Mr. Bartlett maintains. But Reagan was lowering the highest tax rate on individuals from 70 percent down to 28 percent by 1986.
“What they have here is a big tax cut for the rich paid for with random increases in taxes for various constituencies,” Mr. Bartlett said. “It’s ridiculous. And it’s telling that they are ramming this through without any debate. All of the empirical evidence goes against the tax cut.”
The meat of the package is a permanent lowering of the corporate tax rate, to 20 percent from 35 percent, which business leaders have long wanted. Proponents assert that this would prompt multinational companies to expand operations in the United States.
“We’ve been bleeding corporate headquarters and production for a long time,” said Douglas Holtz-Eakin, a former director of the Congressional Budget Office and now president of the American Action Forum, a nonprofit that promotes smaller government.
But recent history suggests that when corporations get tax relief, they find abundant uses for money that do not involve paying higher wages. They give dividends to shareholders and stock options to executives. They stash earnings in tax havens.
In 2004, Congress invited American corporations to bring home overseas earnings at a sharply reduced rate, pitching it as a means of bolstering investment. But the corporations spent as much as 90 percent of their windfall buying back their shares, according to Bureau of Economic Analysis research.
If Congress bestows fresh relief on major businesses, signs suggest a similar result. Many companies are enjoying record profits. Those in the Fortune 500 had $2.6 trillion salted away overseas as of last year.
“In our boardroom, the number-one thing we’re talking about is not taxes,” said Jeremy Stoppelman, chief executive of Yelp, the online review platform. “Having a strong middle class out there spending money is what’s most important for our business.”
If the tax bill widens inequality, local communities will likely find themselves with fewer resources to aim at helping struggling people.
A key feature of the Senate bill is the elimination of a federal deduction for state and local taxes. Conservative groups like the Heritage Foundation and American Legislative Exchange Council have sought to end the deduction as a means of reining in government spending.
In high-tax states like California, New York, New Jersey and Connecticut — where electorates have historically shown a willingness to finance ample safety-net programs — the measure could change the political calculus. It would magnify the costs to taxpayers, pressuring states to stay lean or risk the wrath of voters.
Some see in this tilt a reworking of basic principles that have prevailed in American life for generations.

Roosevelt created Social Security, unemployment benefits and other pillars of the safety net to combat the Great Depression, crises have been tempered by some measure of government support. Recent decades have brought cuts to social services, but the impact of the current bill could be especially consequential.
“This is a repudiation of the social contract that Franklin Roosevelt announced at the New Deal,” Joseph J. Ellis, a Pulitzer Prize-winning American historian, said of trimming benefits for lower- and middle-income families to finance bigger rewards for the wealthy. Health coverage would shrink under the Republican plan while multimillion-dollar estates would not have to pay a penny in taxes.
The tax cut package, for instance, could trigger rules mandating cuts to Medicare, the government health care program for seniors, the Congressional Budget Office warned. Some 13 million people could lose health care via the elimination of a key plank of Obamacare. Insurance premiums are also expected to rise by 10 percent.
“This tax bill is a grand deception,” said Arnold Hiatt, the former chief executive of Stride Rite, which makes children’s shoes. “It hurts the most vulnerable, and hurts health care and education, which are essential for a healthy economy.”
The proposals break from seven decades’ worth of federal efforts to broaden access to higher education.
Since World War II, the guiding sense has been that “it is government’s responsibility to provide higher education for all those who can benefit from it,” said David Nasaw, a historian at the Graduate Center of the City University of New York. That idea was behind the G.I. Bill, which helped generations of veterans pay for college and training.
The House bill includes provisions that would end the deductibility of tuition waivers for graduate students and repeal the deduction for interest paid on student loans. Both chambers’ bills would tax investment earnings from university endowments.
The endowment tax, in particular, threatens the ability of low-income students to pursue college and graduate studies, said Ron Haskins, a senior fellow at the Brookings Institution. Proceeds from endowments subsidize students from lower-income families, while allowing students across the board to graduate with less debt.
“When the time of reckoning comes to fix huge deficits, social safety-net programs will be first on the chopping block,” Julian E. Zelizer, a professor of history and public affairs at Princeton University, said.
“It’s very far-reaching,” he added, “but there hasn’t been much of a debate.”

There’s an eerie sense in today’s world that China is racing to capture the commanding heights of technology and trade. Meanwhile, under the banner of “America first,” the Trump administration is protecting coal-mining jobs and questioning climate science.

This is what a “Government of Fools” looks and acts like! “Six months ago I won the lottery — the H-1B visa processing lottery for skilled foreign workers. I called my thrilled parents and celebrated with friends. I’m from northeastern China and have an M.B.A. from Stanford, and was planning to stay in Silicon Valley to help start a company based on a promising new technology to improve the use of data. I was overjoyed because, historically, being selected in the lottery was a near guarantee that an applicant could remain in this country at least three more years.
But at the end of July, I received the dreaded Request for Further Evidence from immigration authorities. I provided the extra information that United States Citizenship and Immigration Services asked for. In September, I got another request. I complied again. Finally, on Oct. 11, half a year after my celebration, I learned I had been denied a visa.
After earning law degrees in China and at Oxford, after having worked in Hong Kong as a lawyer at a top international firm, after coming to United States three years ago for an M.B.A. and graduating and joining a start-up, I was given just 60 days to leave the country. I have 17 days left.
In the past, it was fairly safe to assume that once you were selected in the lottery, your H-1B petition would be accepted by immigration officials. In 2016, this happened about 87 percent of the time. But things began to change in April when the Department of Homeland Security and the Department of Justice announced measures to increase scrutiny of the highly skilled applicants who use the H-1B program, and President Trump signed an executive order calling for federal agencies to suggest reforms to the program.
While it’s unclear exactly what percentage of petitions have been approved so far in 2017, requests for evidence like the ones I received have increased by 44 percent compared with last year, according to immigration statistics, strongly suggesting that more people are being denied than before Mr. Trump took office.
Many of my fellow international students are in situations similar to mine. Some had job offers from companies like Google, Apple and PwC when they learned that their applications had been denied or did not even make it into the lottery. For those whose employers have only United States offices, losing the lottery meant losing jobs and going home, with no real way to use the skills they were on the verge of contributing to the American economy.
And some classmates who, like me, were picked in the H-1B lottery last spring are still waiting for an answer. The Trump administration on April 3 announced that it would suspend the “premium processing” service that, for a fee, guaranteed applicants responses to their petitions within 15 days. This has caused problems for students who needed a quick decision because their work authorization expired over the summer or because they wanted to plan overseas trips that they couldn’t make while their status was in limbo. My mom had surgery for cancer in July, but I simply couldn’t go back to China to be with her and risk being denied at the border upon my return because I didn’t have H-1B approval.
My two requests for evidence asked me to prove my job was a “specialty occupation” — that is, work that only someone with a bachelor’s degree or higher can do. My work involves artificial intelligence and big data, and my letters of support came from an authority in my industry and veteran start-up investor, and a Nobel Prize winner. But it wasn’t enough to convince the government that my job requires advanced skills.
While I gave up my law job and used my savings and my parents’ to pay my Stanford graduate school tuition, in the grand scheme of things, I know my situation is much better than that of many immigrants who are forced to leave this country: Just this week, thousands of Haitians in the United States learned that they may have to return to Haiti as a result of the administration’s decision to strip them of the Temporary Protected Status they were granted while their country recovered from disasters.
It’s true that I’m brokenhearted about missing the chance to return to China to care for my mother (she insisted that I stay and pursue the visa that was her dream for me), but I’m not looking for sympathy. As much as I hate to leave, I know I will be fine.
Rather, I’m frustrated, because I know I’m part of a pattern: America is losing many very skilled workers because of its anti-immigrant sentiment, and while this is a disappointing blow to me and my classmates, it will also be a blow to the United States’ competitiveness in the global economy. Tech giants such as Google and Tesla were founded by immigrants.
I can’t make sense of why an administration that claims to want this country to be strong would be so eager to get rid of us. We are losing our dreams, and America is losing the value we bring.
As I make plans to go back to China, I find myself wondering: If I am not qualified to stay in the United States, then who is?

“President Trump’s vision of a “big, beautiful” wall along the Mexican border may never be realized, and almost certainly not as a 2,000-mile physical structure spanning sea to sea.
But in a systematic and less visible way, his administration is following a blueprint to reduce the number of foreigners living in the United States — those who are undocumented and those here legally — and overhaul the U.S. immigration system for generations to come.
Across agencies and programs, federal officials are wielding executive authority to assemble a bureaucratic wall that could be more effective than any concrete and metal one. While some actions have drawn widespread attention, others have been put in place more quietly.
The administration has moved to slash the number of refugees, accelerate deportations and terminate the provisional residency of more than a million people, among other measures. On Monday, the Department of Homeland Security said nearly 60,000 Haitians allowed to stay in the United States after a devastating 2010 earthquake have until July 2019 to leave or obtain another form of legal status.

Even as they fight court orders seeking to halt parts of Trump’s immigration agenda, Sessions, White House senior adviser Stephen Miller and other key players are finding ways to shrink the immigration system. Miller was an aide to Sessions before both men joined the administration; in less than a year, their immigration policy prescriptions have moved from the realm of think-tank wish lists to White House executive orders.
In October, the White House — in a plan led by Miller — said it had conducted a “bottom-up review of all immigration policies” and found “dangerous loopholes, outdated laws, and easily exploited vulnerabilities in our immigration system — current policies that are harming our country and our communities.”

Trump’s tough talk alone appears to be one of the administration’s best bulwarks: Illegal crossings along the border with Mexico have plunged to their lowest level in 45 years, and U.S. agents are catching a far greater share of those attempting to sneak in. Applications for H-1B skilled visas and new foreign-student enrollment have also declined.
William Frey, a demographer at the Brookings Institution, said that until now U.S. immigration rates have largely spared the country from the challenges facing advanced industrial nations such as Japan and Germany that can’t replace aging workers fast enough. By slashing immigration, Frey said, the country could end up with labor shortages and other workforce issues.
But although some of Trump’s most fervent supporters see curbing immigration as a way to turn back the United States’ rapid racial and ethnic transformation, Frey said it is an unrealistic goal. By 2020, census projections show minorities will account for more than half of the under-18 U.S. population, because of higher birthrates in nonwhite populations. And by 2026, the number of whites is projected to begin declining in absolute numbers, he said, as deaths exceed births.
“You can slow the rate of Latino and Asian immigration, but it won’t make the population whiter,” Frey said. “It will just become less white at a slower pace.”
Trump continues to insist his administration will build a border wall, despite exorbitant cost projections and senior DHS officials saying a 2,000-mile structure is impractical. His supporters say they admire the president for plowing ahead in his overhaul efforts and see a historic, generational shift underway.
“There is more than one way to get to the goal,” Dane said. “Legislative solutions are all great, but clearly the administration has done things behind the scenes. . . . The results have been dramatic.”

Really, hard to see how guys like this with retrograde ideas that come right from the “Jim Crow era” of American history get into positions of power for which they are so totally unqualified, both by background and temperament. But, then again, look at whom we have elected our President to represent us on the international scene.
The good news for the majority of Americans is that the “turn back the clock” plan is ultimately likely to fail. We will eventually move forward again as a diverse, productive, “country of immigrants,” and restore humane and humanitarian values to our national and international profile.
“Despite the Trump administration’s repeated attempts to frame illegal immigration as a threat to public safety, the poll also found an overwhelming majority believe that people without legal residency help revitalize cities as opposed to increasing crime.
The survey results, poll analysts and policy experts said, reflect ongoing trends in California, where through the decades the public has tended to support immigrants in the country illegally, even when federal or state political leaders have stoked anti-immigrant sentiment to rally their bases.
“We have seen this in California forever,” said Jill Darling, the survey director for the Center for Economic and Social Research at USC. “People, including Republicans, have been more supportive of immigrants and reform, even to the point of supporting a path to citizenship, more so than Republican leadership.”
Most poll participants also expressed positive perceptions of people without legal residency in the country.
Nearly 63% of people surveyed said they believed immigrants without legal status strengthened the economy, as opposed to roughly 38% who said they took away jobs. Sixty-six percent said immigrants in the country illegally helped revitalize cities, and about 34% — including more than 72% of Republicans — believed they increased crime.
Policy experts said the poll results reflect the explosive growth of Latinos, Asians and other minority communities that tend to lean Democratic. California’s families are so diverse, they said, that nearly everyone knows someone who came to the country as an immigrant — legally or illegally.
It also reflects a shift away from the “us-versus-them” rhetoric that damaged the Republican brand in the 1990s, political consultants and immigration policy experts said. During that time, Gov. Pete Wilson was criticized for using footage of people running across the border to dramatize the problem of illegal immigration, and voters passed propositions to bar immigrants in the country illegally from public benefits, outlaw affirmative action programs and teach only English in schools.
That “no longer reflects our reality,” said Mindy Romero, director of the California Civic Engagement Project. “In a state like California, immigrants are us.”
Andrew Medina, state policy manager for Asian Americans Advancing Justice, said he wasn’t surprised by the results of the poll — or by the approval among California residents for the sanctuary state law. A study released in February by the Public Policy Institute of California found that a solid majority of Californians believe the state and local governments should make their own policies and take action to protect the rights of immigrants who are here illegally.
The final language of the sanctuary state law was the result of months of tough negotiations among Gov. Jerry Brown, Senate leader and bill author Kevin de León (D-Los Angeles), and law enforcement officials.
It will largely prohibit state and local law enforcement agencies from holding or sharing information about people with federal immigration agents unless those individuals have been convicted of one or more offenses from a list of 800 crimes outlined in a 2013 state law.
Federal immigration authorities still will be able to work with state corrections officials — a key concession Brown had demanded — and will be able to enter county jails to question immigrants. But the state attorney general’s office will be required to publish guidelines and training recommendations to limit immigration agents’ access to personal information.
“It is positive that these polls show that there is support for immigrant communities, and it is especially positive in this era,” Medina said.
Still, Romero advised caution.
“Discrimination against immigrants is very real and a danger,” she said, pointing to anti-immigrant rhetoric at the national level. “I think we can’t rest on a changing landscape in California and just assume that things will continue to be more receptive and open.”

White House chief of staff John Kelly pressured acting Homeland Security Secretary Elaine Duke to terminate protections for tens of thousands of Honduran immigrants currently living in the US, sources tell CNN.
Duke received multiple calls from Kelly pressuring her, in Duke’s perception, to end Temporary Protected Status for Honduran immigrants on Monday’s decision day, leaving Duke “distraught and disappointed” and ready to leave the department, according to a source familiar with Duke’s thinking.
The Trump administration characterized the call as Kelly weighing in through a normal process and said Duke was committed to remaining at her post.
The Washington Post first reported on the call.
TPS is an immigration status allowed by law for certain countries experiencing dire conditions, such as a natural disaster, epidemic or war, and protects individuals from deportation and authorizes them to work in the US.
Monday was the deadline for a decision on the protected status for the roughly 86,000 Hondurans. DHS instead announced that Duke had not found there was enough information to make a formal decision, a move that triggered a six-month extension of the protected status. The administration did terminate protections for Nicaraguans, about 5,300 of which live in the US. Both populations have lived in the US for nearly two decades.
According to the source familiar with Duke’s thinking, Kelly and the administration wanted Homeland Security secretary nominee Kirstjen Nielsen to avoid questions about the issue at her Senate confirmation hearing on Wednesday, and wanted to her confirmed quickly enough that she would be the one to make a decision on temporary protected status for Haitians, which is due at the end of the month and which will likely be ended.
According to the source familiar, Duke had decided over the weekend that she did not have enough information to end the protections for the Hondurans, which is what the department announced late Monday evening.
“I think she’s very distraught and disappointed at Kelly and the whole apparatus,” the source said. “She’s out there alone, you know? It’s like, ‘Why do I keep doing this if you guys are just going to beat me up?'”
The source confirmed that she made reference to resigning during the back-and-forth and is inclined to leave the job.
The source described the back-and-forth as a “forceful, directive conversation.”
“It was a loud conversation, it wasn’t a quiet conversation,” the source said.”

Kelly sinks deeper into “The Swamp” every day with each new revelation of his sleazy conduct and reactionary views. I suspect that Duke’s DHS career will come to an end shortly. And, there is some reason to suspect that her permanent replacement, Kirstjen Nielsen, is being put over at DHS to be a “yes-woman” for the Trump, Sessions, Kelly, Miller, Bannon (in absentia) White Nationalist crew operating out of the White House and the DOJ. Whether she will live up to their “low expectations,” however, is another matter entirely.

Then came the July arrest of Mario Rodriguez by U.S. Immigration and Customs Enforcement (ICE).
“I was kind of in shock, to be blunt with you,” Wright said.
Rodriguez, whose visa had expired, had lived in the area for more than a dozen years. He had worked in bilingual education and periodically tipped police to trouble spots.

“He was real pro-law enforcement,” the police chief said. “Shoot, anybody would like to have him as a neighbor.”
Trump, on the campaign, had talked about kicking out Mexican “drug dealers, criminals, rapists.” And that’s the kind of immigration crackdown a lot of people here were expecting.
“Yeah, we don’t want that element,” Wright said. But Rodriguez? The police chief couldn’t believe sending him back to Mexico would do anybody any good.
That kind of shock is reverberating throughout the county as Trump’s toughened immigration policy hits home. ICE has arrested at least 28 people in the county this year, according to numbers provided to the Sheriff’s Office.
While that’s just a small share of the roughly 3,100 ICE arrests overseen by its regional office in Seattle — which covers Washington, Oregon and Alaska — it represents a pronounced upward trajectory. Last year, ICE reported eight Pacific County arrests to the sheriff and for a long stretch of years before that, zero.
In a county of small, close-knit communities — Long Beach, population 1,400, is one of the largest — it’s noticed when someone goes missing. The number is magnified by those who have moved, gone into hiding or followed family after a deportation. People have lost neighbors, schools have lost students and businesses have lost employees.

“One minute they’re here. Another minute they’re not,” Sheldon said. “It’s not like there’s any warning.”
She and other employers say they get required paperwork for every worker — though documents might be fake — and don’t know who is illegally here.
“It’s been a huge impact,” said Kathleen Nisbet-Moncy, vice president of the Willapa-Grays Harbor Oyster Growers Association, of ICE’s arrests. Many of the area’s two dozen companies are small businesses. Losing key employees is a big deal. One, she said, lost a worker of 25 years.
And the industry already faced a labor shortage.
Workers need to have an understanding of tides; they carry tide tables like Bibles, arranging their days accordingly. Some operate boats. Others shuck oysters or process fish, not easy when done quickly.
Paid by volume, they sometimes work seven day weeks, or days that take in both early-morning and late-night tides cycles.
“Don’t you want people to work?” Sheldon asked. “Why don’t we say you can’t sell cigarettes to illegal immigrants?”
She was joking. But things didn’t make sense to her.
It was hurting her business. So many people have been arrested or moved that she can no longer fill empty positions. She has had scale back orders and turn away customers.
“Tell him I say hi”
In Long Beach Culbertson Park, as after-school football practice got started, 10-year-old Danner Walters broke into tears.
He was on the sidelines talking about his friend Joel. A week before, Joel left for Mexico with his mom and siblings to rejoin his dad, who had been deported months before.
“We’ve been best friends since kindergarten,” Danner said.

Too bad folks don’t think through all of the implications before they pull the lever for immoral and irrational candidates like Trump and the GOP restrictionists. Truth is what the restrictionists don’t want you to hear or think about: the vast majority of the allegedly 11 million undocumented individuals here are law-abiding, productive members of the American community, doing jobs that help, rather than hurt, American workers, doing them exceptionally well, and raising or being part of part of “mixed families” with citizens, immigrants, and undocumented individuals all mixed together.
Removing them is a senseless and cruel waste of time and money. The only reasons for doing it have to do with racial and cultural bias — that’s why guys like Trump, Sessions, Bannon, and Miller have to come up with bogus economic and law enforcement rationales in an attempt to “rationalize” basically irrational policies.
Actually, the number of undocumented individuals in the United States is a boon to our country, our economy, and our culture. It shows that we remain a vibrant nation, and that we should have been admitting hundreds of thousands of additional legal immigrants annually. That’s why GOP proposals to restrict legal immigration are so wrong-headed.
Because we failed to do what we should have, the system basically “self corrected” largely by the operation of free market forces, but with some adverse effects like the use of smugglers, the exploitation of the undocumented, and the colossal amount of money wasted by “dumb” immigration enforcement and detention over many Administrations and Congresses.
But, it’s not too late to get it right by legalizing the productive, law-abiding individuals already here and expanding our legal immigration system to realistic levels that are more consistent with our needs as a nation. That will reduce or eliminate the “job magnet” and cut the business for smugglers without vast expenditures of law enforcement funds.
“IN LOWER MANHATTAN on Tuesday, not far from the memorial to the 9/11 attack on the World Trade Center, eight people were killed and 12 injured when a man espousing fidelity to the Islamic State drove a rented pickup down a busy bike path along the Hudson River. “It was gruesome. It was grisly. It was surreal,” one witness said of bicyclists and pedestrians being mowed down. The attack on innocent people enjoying a fine autumn day was a chilling reminder of the persistent threat posed to the United States by Islamist extremists — and their ingenuity in finding ways to commit murder.
Some small comfort can be taken in the fact that in the 16 years since the fall of the twin towers, improvements in protecting the homeland and fighting terrorism abroad have lessened the terrorists’ strength to strike and improved our ability to respond. The quick actions of police and other first responders during Tuesday’s tragedy should be applauded. So must the resilience and strength of the people of New York City, who made clear they will not be cowed by fear.
Far less inspiring — indeed, downright dispiriting — was the reaction of President Trump. In a series of tweets that apparently were informed (a word we use loosely) by his viewing of “Fox & Friends,” Mr. Trump went on a harangue about immigration and attacked Senate Minority Leader Charles E. Schumer (D-N.Y.). On Wednesday, Mr. Trump signaled he might upend the judicial process by declaring the suspected attacker an enemy combatant to be shipped off to the Guantanamo Bay prison; federal terrorism charges filed against him later in the day likely would foreclose that from happening. Note that the White House wouldn’t discuss gun control after last month’s mass shooting in Las Vegas, on the grounds that it would politicize a tragedy, but it had no problem launching partisan attacks following a terrorist strike that ought to unify all Americans. Note also, as The Post’s Philip Bump pointed out, that Mr. Trump is quick to jump to conclusions when there are incidents involving immigrants but is far more circumspect when nonimmigrants are involved.
What’s really needed from the Trump administration is not blame-shifting but a serious attempt to investigate and learn from this latest attack. Were others involved or aware of the alleged plans dating back a year that went into the attack? Are authorities right in their initial assessment that the suspect became “radicalized domestically” while living in the United States? Were signals missed when he appeared on the radar of law enforcement in connection with the investigations of other suspects? The 29-year-old, authorities said, allegedly “followed almost exactly to a T” instructions that the Islamic State has put out on its social-media channels on how to carry out attacks. So what can be done to detect and deter other would-be followers?
Among those killed Tuesday were five Argentines who were part of a group of school friends who traveled to New York to celebrate the 30th anniversary of their high school graduation. It was their dream trip to a city known for being open and generous and diverse. Those are the traits that make America great; to undermine them in response to Tuesday’s attack only plays into the hands of terrorists.”

Second, the Editorial Board responds to Trump’s attempt to blame Senator Chuck Schumer of New York for the attack:
“PRESIDENT TRUMP, ever prone to seek out scapegoats, fastened on a new target in the wake of the terrorist attack in New York: the state’s senior Democratic senator, along with a 27-year-old visa program that offers applicants from dozens of countries a shot at immigrating to the United States.
Mr. Trump singled out Sen. Charles E. Schumer, who, in 1990, sponsored the diversity visa program, through which the alleged attacker in New York, Sayfullo Saipov, is reported to have immigrated to the United States from his native Uzbekistan. In a tweet, the president derided the program as “a Chuck Schumer beauty.”
Never mind that Mr. Schumer’s legislation establishing the program attracted bipartisan support; or that it was signed into law by President George H.W. Bush, a Republican; or even that Mr. Schumer himself unsuccessfully bargained to end the program, in 2013, in return for a bill granting legal residence to millions of undocumented immigrants already in the United States. Neither the facts nor the normal political imperative to avoid partisanship in the wake of a terrorist attack appeared to move Mr. Trump.
His tweet made it appear that his overriding interest in an assault allegedly backed by the Islamic State is to use it to assail immigration — in this instance, a legal program whose beneficiaries represent a speck in the overall number of immigrants. Managed by the State Department since 1995, the program now grants up to 50,000 visas annually, via a random lottery, to citizens of dozens of countries who would otherwise be mostly overlooked in the annual influx of green-card recipients. In recent years, many of the winners have been from Africa and Eastern Europe.
Having reaped political advantage as a candidate in vilifying illegal immigrants, Mr. Trump has set his sights in office on legal migrants, including refugees, from a handful of mostly Muslim countries, whom he’d like Americans to see as an undifferentiated mass of potentially violent interlopers. Gradually, he is chipping away at what was once a national consensus that immigrants are a critical source of vitality, invention and international appeal.
Like almost any immigration program, the diversity visa lottery is imperfect and susceptible to abuse. The fortunate winners, who represent less than 1 percent of those who have applied annually in recent years, are not uniformly equipped to thrive in this country; many lack an education beyond high school. As Mr. Saipov may turn out to prove, even the extensive vetting required of all who immigrate through the program does not provide an ironclad guarantee that it is impervious to applicants who might seek to harm the United States.
The lottery program might be improved. Still, the fact that more than 11 million people applied for it in fiscal 2016 reflects the magnetic appeal the United States continues to exert around the world. Satisfying a small fraction of that demand, through the lottery or some other legal means, is a powerful tool of public diplomacy in countries whose citizens might otherwise have no hope of coming here.”
Third, Jennifer Rubin (“JRUBE”) comments on Trump’s “mindless,” totally inappropriate, attack on our justice system (in other words, on our Constitution):
“Asked about the suspect Wednesday, President Trump called him an “animal.” Prompted to say whether he thought Saipov should be sent to the detention facility at Guantanamo Bay, Cuba, Trump said, sure, he’d consider it. Later, at Wednesday’s White House press briefing, Sarah Huckabee Sanders said flatly that the White House considered the suspect an “enemy combatant.”
The president also said yesterday that the American justice system (presumably including his own Justice Department) is a “joke” and a “laughingstock.”He further opined, “We also have to come up with punishment that’s far quicker and far greater than the punishment these animals are getting right now,” Trump said. (Terrorists are subject to the death penalty, so it’s unclear what he had in mind.) “They’ll go through court for years … We need quick justice, and we need strong justice,” he said.
Thankfully, the Justice Department, like the Pentagon, has learned when to ignore Trump. On Wednesday, Saipov was charged in federal court.By Thursday morning, Trump was backing off his support for sending Saipov to Guantanamo. Once again, the ignorant president shot from the hip and had to creep back to reality.
Just how harmful were Trump’s statements? It is reprehensible for the president to defame our justice system, which is not a “joke” nor a “laughingstock” but the envy of the world. Moreover, in the terrorist context, it has proved remarkably efficient in trying and convicting terrorists, and then handing out maximum punishments. The surviving Boston Marathon bombing defendant was convicted in just this way and sentenced to death.

Based on today’s tweet, we were right to assume that neither Trump nor Sanders had any idea what he/she was talking about (always a good assumption). We will watch with pride as American justice takes its course — and with horror as Trump continues to wreck havoc from the Oval Office.”

Having spent a professional lifetime working on immigration and refugee issues, I can confirm that Trump and his GOP “restrictionist cronies” like Sessions, Miller, and Bannon have managed to transform what used to be “a national consensus that immigrants [and particularly refugees] are a critical source of vitality, invention and international appeal” into a highly partisan and racially-charged attack on the national origins and futures of some of our most productive citizens and residents — those who far more than Trump or his cronies are likely to help us in building a better, safer future for all Americans.
Having worked on all sides of our U.S. Justice System, served as an administrative judge on the trial and appellate levels for more than 21 years, listened to and/or read thousands of accounts of what made people leave their “home countries,” and studied in detail the reasons why some failing countries are “senders” of talented migrants and others, like the U.S., are fortunate enough to be on the “receiving” end, I can say unequivocally that the fairness of our justice systemand the overall honsety and integrity of civil servants in the U.S. Government are the primary differences between the “sending” and “receiving” countries, like ours.
As I have observed before, Trump and his cronies are launching what is basically a “Third-World autocratic attack” on our Constitution and our democratic institutions. If they succeed, the immigration “problem” might eventually be “solved” because nobody will want to come here any more. How many people risked their lives trying to get into the former Soviet Union?
Donald Trump, his cronies, and his enablers are and will remain a much greater threat to our safety and Constitutional institutions than any foreign terrorist could ever be. We ignore his dangerous and fundamentally un-American rants at our own peril!
“Few American industries are as invested in the decades-long political battle over immigration as agriculture. Paying low wages for backbreaking work, growers large and small have historically relied on immigrants from south of the Rio Grande. These days, over one-quarter of the farmhands in the United States are immigrants working here illegally.
This is how the growers will respond to President Trump’s threatened crackdown on immigration: They will lobby, asking Congress to provide some legal option to hang on to their foreign work force. They will switch to crops like tree nuts, which are less labor-intensive to produce than perishable fruits and vegetables. They will look for technology to mechanize the harvest of strawberries and other crops. And they will rent land in Mexico.
There is one thing they won’t do. Even if the Trump administration were to deploy the 10,000 immigration agents it plans to hire across the nation’s fields to detain and deport farmhands working illegally, farmers are very unlikely to raise wages and improve working conditions to attract American workers instead.
“Foreign workers will always be harvesting our crops,” Tom Nassif, who heads the Western Growers Association, told me. The only question for policymakers in Washington is whether “they want them to be harvesting in our economy or in another country.” If they choose the latter, he warned, they might consider that each farmworker sustains two to three jobs outside the fields.”

When policy is driven by ignorance, bias, and political pandering, rather than by facts, common sense, and economic reality, the results are always going to be ugly. So far, our country and our economy have been saved primarily by the overall incompetence of guys like Trump, Sessions, and their minions. But, it’s an expensive and divisive way to (not) “run the railroad.” We’re actually paying scarce taxpayer dollars for misguided policies that if actually successful would threaten our economic well-being and make our country a worse place to live.
The United States has been created by successive waves of immigration over the course of centuries. Each wave of immigrants from different parts of the world has helped to build the U.S. economy and enrich U.S. society. And each wave of immigrants has provoked a chorus of dire warnings from nativists worried that the presence of too many immigrants will somehow dilute the American sense of identity.
The Center for Immigration Studies (CIS) is one of the groups that routinely issue such warnings. One of the more subtle ways in which they do this is to present immigration statistics in as dramatic a way as possible, with the implication being that native-born Americans are in danger of being over-run by foreigners. In a recent report, for instance, CIS takes advantage of newly released Census data to sound the alarm over the size of the immigrant population in the United States.
Of course, CIS offers no context for this data; no discussion of the historical, economic, political, and social environment within which immigration occurs. Just panicked pronouncements that the immigrant population hit a “record” 43.7 million in 2016—or one out of every eight people in the country.
In fact, immigrants now make up 13.5 percent of the U.S. population, which is less than the 14.7 percent share in 1910. For good measure, CIS also throws in an estimate of how large the foreign-born population might be by 2060 (at which point 78 million immigrants may account for 18.8 percent of the population).
However, the real story is not the number of immigrants; it’s what immigrants do once they’re here. Specifically, the contributions they make to the U.S. economy and the degree to which they integrate into U.S. society.
For instance, based on data from 2015 and 2014, we know that nearly half of all immigrants are naturalized U.S. citizens and that seven out of ten speak English reasonably well. More than one-quarter have a college degree.
And immigrant business owners generate tens of billions of dollars in business income.
This is the kind of context that CIS fails to offer in its run-down of Census numbers. The not-so-subtle implication of the CIS report is that native-born Americans are drowning is a sea of foreigners.
But when you actually start to enumerate the many ways that immigrants (and their children) add value to the U.S. economy as workers, entrepreneurs, consumers, and taxpayers—and integrate into U.S. society while enriching U.S. culture—the numbers represent good news.

You can bet that the CIS false narrative about the “Alien Invasion” and the threat to our culture and our society will be picked up in speeches by Trump, Sessions, Miller, Bannon, and other restrictionists to justify cuts in legal immigration, reducing family immigration, removing undocumented Latino and African workers, cutting rights of asylum seekers (particularly those from Central America and predominantly Muslim countries), and “shutting out” so-called “unskilled immigrants” in favor of guys with college degrees who show up speaking English.
The whole “Immigration Is A Threat To America” that therefore must be reduced, artificially limited, and punished is bogus! It stands in the way of serious discussions of how to reform and re-design our legal immigration system to channel more of the historical flow of needed workers and refugees into legal channels, prevent exploitation of immigrant workers by unscrupulous employers, and thereby reduce the incentives and the flow of “extralegal” migration to levels that can be controlled by non-draconian immigration enforcement working with market forces rather than in opposition to them.

Nolan is definitely a “player” in the immigration dialogue! (And, frankly, by going over to The Hill, Nolan gets a few more “hits” which give him a few more “hard-earned nickels” in his pockets. I can agree with Nolan’s bottom line:
“It would be better to help undocumented aliens by working on comprehensive immigration reform legislation that meets essential political needs of both parties.”
The challenge will be figuring out what those points might be. So far, the GOP “Wish List” is basically an “incendiary White Nationalist screed” drafted by notorious racist xenophobe Stephen Miller (probably with backing from Sessions and certainly incorporating parts of Steve Bannon’s alt-right White Nationalist world view) that contains virtually nothing that any Democrat, or indeed any decent person, could agree with. Indeed, the very involvement of Miller in the legislative process is a “gut punch” to Democrats and whatever “moderate GOP” legislators remain.
What are some “smart enforcement” moves that Democrats could agree with: more funding for DHS/ICE technology; improvements in hiring and training for DHS enforcement personnel; U.S. Immigration Court reforms; more attorneys and support (including paralegal support) for the ICE Legal Program; more funding for “Know Your Rights” presentations in Detention Centers.
But more agents for “gonzo enforcement,” more money for immigration prisons (a/k/a the “American Gulag”), and, most disgustingly, picking on and targeting scared, vulnerable kids seeking protection from harm in Central America by stripping them of their already meager due process protections: NO WAY!
Although “The Wall” is a money wasting folly with lots of negative racial and foreign policy implications, it probably comes down to a “victory” that Democrats could give to Trump and the GOP without actually hurting any human beings, violating any overriding principles of human rights law, or diminishing Constitutional Due process. It also inflicts less long-term damage on America than a racially-oriented “point system” or a totally disastrous and wrong-headed decrease in legal immigration when the country needs the total opposite, a significant increase in legal immigration opportunities, including those for so-called “unskilled labor.”
While this GOP Congress will never agree to such an increase — and therefore workable “Immigration Reform” will continue to elude them — the Democrats need to “hold the line” at current levels until such time as Americans can use the ballot box to achieve a Congress more cognizant of the actual long-term needs of the majority of Americans.
“Homeland Security searching some social media doesn’t violate privacy
The Department of Homeland Security (DHS) has posted a new rule on the Federal Register which authorizes adding information from an alien’s social media sites to the files that are kept in his/her official immigration records, such as “social media handles, aliases, associated identifiable information, and search results.”
The official immigration records are known as “A-Files.”
The social media sites will be searched for information which pertains to granting aliens a visa or some other type of immigration benefit, and this almost certainly will lead to social media searches of the American citizens and lawful permanent residents who sponsor them.
For instance, if a citizen files a visa petition to accord immediate relative status to his alien spouse, and information on the spouse’s Facebook site indicates that the marriage is a sham, DHS will search the citizen petitioner’s Facebook site for additional information to assist in determining whether the marriage really is a sham.
But the most important reason is to identify terrorists, and this is the reason that prompted 26 senators to ask DHS to search social media sites after the San Bernardino terrorist attack.

The Electronic Frontier Foundation and the ACLU have filed a lawsuit to stop DHS from searching mobile electronic devices at the border in violation of the Fourth Amendment to the U.S. Constitution. I expect them to challenge social media checks on the same basis.
The Fourth Amendment states that “the right of the people to be secure in their persons, houses, papers, and effects, against unreasonable searches and seizures, shall not be violated.” But this only applies to situations where an individual has “a reasonable expectation of privacy,” which is not an easy concept to apply to social media information.
In any case, there is no expectation of privacy in immigration processes. Most, and perhaps all, of the persons involved in immigration processes have to authorize DHS to investigate them and the information they provide.
For instance, an American citizen or lawful permanent resident who files a visa petition for a relative has to fill out a Form I-130 Petition for Alien Relative, which requires extensive information about the petitioner, his/her spouse, and his/her parents. It requires similar information about the alien who is the beneficiary of the petition.
The petitioner also has to authorize the release of information that is needed for the adjudication of the petition, or that is “necessary for the administration and enforcement of U.S. immigration laws.”
The Form DS-160 Application for a Nonimmigrant Visa requires even more information, and it should be apparent to aliens applying for a visa that they are subject to background investigations.
I am not convinced, therefore, that social media searches violate privacy rights, and the San Bernardino terrorist attack has shown that information on social media sites can help DHS to identify terrorists before they strike.

“Immigration reform has been a hot-button issue long before President Trump pledged to build a wall along our border. And while there’s certainly an argument to be made that we need to do a better job of controlling illegal immigration, there’s also a strong case to be made that immigrants are a big driving force behind America’s growth — past, present, and future.
Warren Buffett has been very outspoken in recent years about America and its amazing economic story. Not only does Buffett feel that immigrants have led us to where we are today, but he also thinks that immigrants are an essential component of our country’s future success.
Here’s what Warren Buffett thinks of immigrants
In a nutshell, Buffett feels that immigrants (including undocumented ones) have been and continue to be a key part of our prosperity — not a part of the problem. “This country has been blessed by immigrants,” Buffett said in February at Columbia University. “You can take them from any country you want, and they’ve come here and they found something that unleashed the potential that the place that they left did not, and we’re the product of it.”
Referring to Albert Einstein and Leo Szilard, both of whom were immigrants themselves, Buffett said, “If it hadn’t been for those two immigrants, who knows whether we’d be sitting in this room.”
In his most recent letter to Berkshire Hathaway’s (NYSE:BRK-A) (NYSE:BRK-B) shareholders, Buffett specifically mentioned immigrants as one of the major components of America’s success story. “From a standing start 240 years ago — a span of time less than triple my days on earth — Americans have combined human ingenuity, a market system, a tide of talented and ambitious immigrants, and the rule of law to deliver abundance beyond any dreams of our forefathers.”
On a pathway to citizenship
Buffett is an outspoken Democrat who actively campaigned for Hillary Clinton during the 2016 presidential race. So it shouldn’t come as too much of a surprise that Buffett doesn’t want to deport millions of illegal immigrants who are currently in the United States.
In a 2015 interview with Fox Business, Buffett said
People should be able to earn citizenship who are here. You know, I do not think we should deport millions of people. So, I think we should have a real path to citizenship.
Buffett was then asked specifically about the DREAM Act and its 800,000 minors who are in the country illegally and now face an uncertain future after the end of DACA, from the perspective of a successful American businessman. Buffett replied:
It is a question of being a human being not really a businessman. Immigrants came, our forefathers came as immigrants, they got here anyway they could. And who knows what I would have done if I were in some terrible situation in a country and wanted to come here…a great percentage of them are good citizens. I would have a path to citizenship for them, I would not send them back.
On immigration policy and reform
As we all know, the immigration debate has been going on for a long time. And Buffett’s stance hasn’t changed much over the past several years. In a 2013 interview with ABC’s This Week, Buffett said:
I think we should have a more logical immigration policy. It would mean we would attract a lot of people, but we would attract the people we want to attract in particular — in terms of education, tens or hundreds of thousands of people. We enhance their talents and have them stick around here.
Buffett went on to say that any reform package should “certainly offer [undocumented immigrants] the chance to become citizens,” and one main reason for doing so would be to deepen the talent pool of the labor force.
Buffett’s stance on immigration in a nutshell
Warren Buffett believes that allowing immigrants who are already in the country to stay and pursue citizenship is not only the right thing to do, but is essential to America’s continued economic prosperity. Buffett certainly sees the need for immigration reform, as most Americans of all political affiliations do, but wants to encourage and simplify the legal pathways to immigration.”

Buffet speaks simple truth: Immigrants, both documented and undocumented are not threats, but rather are a necessary ingredient for America’s greatness. We need to bring law-abiding undocumented individuals into our society in some type of legal, work authorized status. We also need substantial across the board increases in legal immigration, so that in the future the immigrants we need can come through the legal system (or wait in a realistic line) rather than coming through an underground system and working and living in the shadows.
The lies, misrepresentations, and false narratives being peddled by Trump, Sessions, Bannon, Miller, Kobach, Cotton, Perdue, King, Goodlatte, Labrador, the so called “Freedom” Caucus, and the rest of their White Nationalist restrictionist cronies are a path to national disaster. Removing existing non-criminal migrants who happen to be working here in undocumented status is a colossal waste of limited Government resources that actually hurts our country in numerous ways.
Time to stand up against the restrictionist, White Nationalist, xenophobic, anti-American blather. Demand that your Congressional representatives back sane, humane immigration reform that takes care of those already here and recognizes their great contributions while appropriately and significantly expanding future legal immigration opportunities so that we don’t keep repreating our mistakes over and over.
Let’s be honest about it. If the time, money, and resources that the U.S. Government is currently spending on the counterproductive aspects of immigration enforcement and inhumane immigration detention were shifted into constructive areas, there would be no “disaster relief crisis” in Puerto Rico and the Virgin Islands right now, and we’d have more money to spend on heath care, job training and retraining, infrastructure, addressing the opioid crisis, and many more legitimate national priorities!
“Amid the world’s worst migrant crisis on record, the Trump administration is cutting back on refugee resettlement. As part of his travel ban, President Trump capped the number of refugees to be admitted in 2017 at 50,000, the lowest number in decades. Now the administration has proposed lowering the goal even further, to 45,000, next year.
Over the years, the United States has lived up to its ideals and brought millions of refugees to safety and freedom. It didn’t become a resettlement leader out of pure altruism. By welcoming refugees, the United States revitalizes its democracy and its economy, helps preserve or restore stability in volatile regions of the world, and builds respect.
In slashing resettlement, the president is taking a recklessly narrow view of how best to put America first. Shutting out refugees would not only increase human suffering; it would also weaken the country and undermine its foreign policy.
There are more than 22 million refugees in the world, the highest number since World War II. Even before the Trump presidency, the United States response to this crisis was relatively modest. In fiscal year 2016, the United States resettled about 84,000 refugees, the most of any year under President Barack Obama. For comparison’s sake, the country took in roughly 200,000 refugees a year in the early 1980s under President Ronald Reagan.
Nonetheless, the resettlement effort under President Obama served American interests. For one thing, it helped the states that host the vast majority of Syrian refugees: Jordan, Turkey and Lebanon. (In fiscal year 2016, 12,500 of the refugees resettled by the United States came from Jordan, a key American ally in a strategically crucial region.) The huge influx of refugees into these nations has strained their resources and infrastructure, becoming a potential source of instability and even conflict. By resettling refugees, the United States helps preserve stability and sends a message of support to countries whose cooperation it needs on a range of issues.
The Trump administration’s cuts to resettlement send the exact opposite message. It is a message heard across the region, by enemies as well as friends of the United States. Restricting resettlement, especially in the context of the travel ban, appears to validate the propaganda of the Islamic State and other extremist groups, which claims that the United States is hostile to Muslims. The battle against violent extremism must be fought with guns, but also with ideas. Slamming the door on refugees is a significant strategic blunder.
Opponents of refugee resettlement would have you believe that the country’s enemies are exploiting the program. There is no factual basis for this claim. In fact, of all the people who enter the United States, refugees are the most thoroughly vetted. The screening process is exhaustive and lengthy, and involves numerous agencies. Our intelligence and national security professionals can both vet refugees and protect Americans. Indeed, they’ve done just that for years.
Refugees are victims of extremist groups and brutal governments. They become patriotic, hard-working Americans. Refugees are us. They are teachers, police officers, doctors, factory workers and soldiers. There are thousands of former refugees and children of refugees in the United States military. I served alongside many who were eager and proud to give back to the country that helped them in their time of need.
It’s no wonder that numerous studies have found that refugees are a net benefit to the American economy. The administration’s own study — which the president solicited from the Department of Health and Human Resources — concluded that refugees added $63 billion to the economy between 2005 and 2014.
Support for refugees creates another form of currency for the United States. Call it respect or admiration or credibility, this currency accrues when the United States leads by example and champions human rights on the world stage. It’s an invaluable and fungible resource, amassed over many decades. It enables the United States to forge ties with democratic movements. It also helps Washington persuade allies to do difficult things and pressure foes to stop their bad behavior. It is crucial to forging trade pacts, military coalitions and peace deals.
More than any other resource — including military and economic might — this accounts for American greatness. We sacrifice it at our peril.

The greatest threat to America’s national security is Donald Trump and his enablers. And, it doesn’t take any type of “extreme vetting” to figure this out. Just common sense and human decency. Thanks, Admiral Mullen for “telling it like it is,” and continuing to support real American values and national interests in this time of darkness brought upon us by the Trump Administration.
