“About 28,600 more people could die every year in the US, if a proposed Senate health care bill becomes law, suggests a review of medical studies released on Monday.

“Being uninsured can be lethal,” review author Steffie Woolhandler of City University of New York told BuzzFeed News.

Congress is in the middle of efforts to pass a Republican health care plan. The House has already passed its own version of health care legislation, while the Senate released its own draft Senate bill last week and unveiled an updated version earlier today. The Congressional Budget Office released an analysis late Monday finding the Senate bill would save $321 billion over the next decade at a cost of 22 million more uninsured people than under Obamacare by 2026.

“A little negotiation, but it’s going to be very good,” President Trump said of the bill on Thursday, when it was first unveiled.

Whether removing all those people from medical coverage, and cutting their access to preventive care for diseases such as diabetes, high blood pressure or cancer, would actually lead to more deaths has emerged as a point of contention in debate over repealing Obamacare, which has enrolled about 20 million people in health insurance and Medicaid plans since 2010.

In reality, people without health insurance face odds ranging from 3% to 29% higher of dying prematurely compared to someone who has health insurance, concludes the Annals Of Internal Medicine review. Taking the midpoint of those odds as a benchmark, Woolhandler suggested that about 1,300 people a year die prematurely every year in the US for every one million people who lose health insurance.

Obamacare, which added about 20 million people to the ranks of the insured, likely preserved lives at that same rate, she said.

Worth noting, the American College of Physicians, which publishes the journal that released the review, has opposed Republican efforts to repeal Obamacare, joining the American Medical Association and the National Association of Medicaid Directors, among medical groups criticizing the Senate’s draft bill. Woolhandler and Himmelstein served as unpaid advisors to Sen. Bernie Sanders’ presidential campaign and founded a doctor’s organization that advocates for universal health care.”

Meanwhile, back at the ranch, the CBO predicts that an additional 22 million individuals would lose coverage under the GOP’s Senate Bill:

“Senate Republicans’ bill to erase major parts of the Affordable Care Act would cause an estimated 22 million more Americans to be uninsured in the coming decade — roughly a million fewer than similar legislation recently passed by the House, according to the Congressional Budget Office.

The forecast issued Monday by Congress’s nonpartisan budget scorekeepers also estimates that the Senate measure, drafted in secret mainly by Majority Leader Mitch McConnell and aides, would reduce federal spending by $321 billion by 2026 — compared with $119 billion for the House’s version.

The CBO’s analysis has been awaited as a crucial piece of evidence as McConnell (Ky.) and other Republican leaders try to hurry a vote on the bill this week. But they are navigating an expanding minefield of resistance from their own party’s moderate and conservative wings, while Democrats are united against it.

The additional deficit savings gives those leaders plenty of room to add more spending to win votes from skeptical moderate Republicans like Sens. Dean Heller (Nev.), Rob Portman (Ohio) and Bill Cassidy (La.), who want more money and a dedicated fund to help treat opioid abuse. Senate budget rules require that the final legislation save at least $133 billion, more than was saved in the House bill, giving senators $188 billion to make the bill more palatable.

Any extra spending risks alienating conservatives, however, and could threaten a delicate balance McConnell must strike to win votes from at least 50 of the 52 Senate Republicans. And some moderates have said they will decide whether they can support the Better Care Reconciliation Act based on how it will affect Americans who have gained coverage under the ACA during the past few years.”

“The “health-care bill” that Republicans are trying to pass in the Senate, like the one approved by the GOP majority in the House, isn’t really about health care at all. It’s the first step in a massive redistribution of wealth from struggling wage-earners to the rich — a theft of historic proportions.

Is the Senate version less “mean” than the House bill, to use President Trump’s description of that earlier effort? Not really. Does the new bill have the “heart” that Trump demanded? No, it doesn’t. The devil is not in the details, it’s in the big picture.

Fundamentally, what Republicans in both chambers want to do is cut nearly $1 trillion over the next decade from the Medicaid program, which serves almost 70 million people. Medicaid provides health care not just for the indigent and disabled but also for the working poor — low-wage employees who cannot afford health insurance, even the plans offered through their jobs.

Additionally, about 20 percent of Medicaid spending goes to provide nursing home care, including for middle-class seniors whose savings have been exhausted — a situation almost any of us might confront. Roughly two-thirds of those in nursing homes have their care paid by Medicaid.

 

Why would Republicans want to slash this vital program so severely? You will hear a lot of self-righteous huffing and puffing about the need for entitlement reform, but the GOP’s intention is not to use the savings to pay down the national debt. Instead, slashing Medicaid spending creates fiscal headroom for what is euphemistically being called “tax reform” — a soon-to-come package of huge tax cuts favoring the wealthy.

That’s the basic equation in both the House and Senate bills: Medicaid for tax cuts. Both bills start with various of the taxes imposed by the Affordable Care Act, but those are mere appetizers. The main course is intended to be big cuts in individual and corporate tax rates that would benefit the rich.

There is no other point to this whole exercise. All the “Obamacare is in a death spiral” talk is Republican wishful thinking, aided and abetted by active sabotage.”

But, many in the GOP base also fall within the group of poor and “lower middle class” folks who would be sentenced to death or suffering by the GOP. BREAKING: GOP SENATORS ANNOUNCE PLAN TO TRASH HEALTH CARE FOR 10S OF MILLIONS OF AMERICANS, FUND MORE TAX BREAKS FOR RICH CRONIES! — Why? — Because They CAN!

And it’s not hard to understand why the bill is so unpopular. What’s mystifying is why Republicans insist on passing it, acting as if there won’t be political consequences for a plan that promises pain for tens of millions of Americans.

At Obamacare’s least popular moment, in the fall of 2014, 56 percent of Americans held a negative view of the law, versus 37 percent who approved. Compare that with the Republican version of the AHCA that passed the House of Representatives in early May. In a recent survey from CBS News, 59 percent of Americans disapprove of the GOP proposal, versus 32 percent who approve. A Roper Center analysis shows the proposal with just 29 percent support, making it the most unpopular piece of legislation Congress has considered in decades. And its unpopularity isn’t just a function of blue states like California, New York, and Illinois—there is no state in the union where a majority of voters support the bill.

If the AHCA ends up improving outcomes for Americans—if it delivers affordable health insurance or protects families from medical bankruptcy—it might recover some popularity in the implementation, as was true with the Affordable Care Act, which now has majority support. But we know from the Congressional Budget Office’s evaluation of the House bill that it would increase the number of uninsured by an estimated 23 million people; there are no signs the Senate version will be any less damaging. What’s more, the AHCA may upend the employer health market as well; its deregulatory measures could result in lifetime limits and substantially higher out-of-pocket costs for people who receive insurance through work. The universe of people potentially left worse off by the Republican bill is close to a cross-section of the American public: salaried employees, ordinary workers who rely on the Obamacare exchanges, and the millions of low-income people, children, elderly, and disabled Americans who rely on Medicaid.

Under most circumstances, this would be the ballgame. As a general matter, lawmakers don’t pass hugely unpopular legislation that might harm constituents in such a direct way. It’s easy to say that, for House and Senate Republicans, their “constituents” are those wealthy Americans who receive huge tax cuts under the bill. Still, it’s also true that winning donors isn’t the same as winning elections. Politicians don’t need to value the public interest to reject a bill like the AHCA; a survival instinct should be enough.

Which gets to what’s mystifying about the present situation. If the health care bill becomes law, there’s every indication the Republican Party will suffer for passing it. It is already responsible for a substantial and so-far enduring decline in the president’s approval rating, and it is fueling grass-roots opposition to the already-unpopular Trump administration. If Republicans face an increasingly difficult environment for the 2018 general election, it is at least in part because of the AHCA. And yet, Republicans are intent on passing the bill. Senate Majority Leader Mitch McConnell has cannily adopted an unprecedentedlysecretive process meant to insulate the proposal from criticism and expedite its passage. There have been no hearings and no debate. The plan, as it exists, is for a one-week period of public input before Congress votes.

It’s likely that Republicans know the bill is unpopular and are doing everything they can to keep the public from seeing its contents before passing it. As we saw with the Affordable Care Act, the longer the process, the greater the odds for a major backlash. But this presupposes a pressing need to pass the American Health Care Act, which isn’t the case, outside of a “need” to slash Medicaid, thus paving the way for large-scale, permanent tax cuts. The Republican health care bill doesn’t solve any urgent problem in the health care market, nor does it represent any coherent vision for the health care system; it is a hodgepodge of cuts and compromises, designed to pass a GOP Congress more than anything. It is policy without any actual policy. At most, it exists to fulfill a promise to “repeal Obamacare” and cut taxes.

Perhaps that’s enough to explain the zeal to pass the bill. Republicans made a promise, and there are forces within the party—from hyperideological lawmakers and conservative activists to right-wing media and Republican base voters—pushing them toward this conclusion. When coupled with the broad Republican hostility to downward redistribution and the similarly broad commitment to tax cuts, it makes sense that the GOP would continue to pursue this bill despite the likely consequences.

But ultimately it’s not clear the party believes it would face those consequences. The 2018 House map still favors Republicans, and the party is defending far fewer Senate seats than Democrats. Aggressively gerrymandered districts provide another layer of defense, as does voter suppression, and the avalanche of spending from outside groups. Americans might be hurt and outraged by the effects of the AHCA, but those barriers blunt the electoral impact.

The grounds for political combat seem to have changed as well. If recent special elections are any indication—where GOP candidates refused to comment on signature GOP policies—extreme polarization means Republicans can mobilize supporters without being forced to talk about or account for their actual actions. Identity, for many voters, matters more than their pocketbooks. Republicans simply need to signal their disdain—even hatred—for their opponents, political or otherwise. Why worry about the consequences of your policies when you can preclude defeat by changing the ground rules of elections, spending vast sums, and stoking cultural resentment?

It seems, then, that we have an answer for Republicans insist on moving forward with the American Health Care Act. Because they can. And who is going to stop them?”

Here’s some analysis of the GOP Senate Bill from the Washington Post:

“The Senate proposal largely mirrors the House measure with significant differences, according to a discussion draft circulating Wednesday among aides and lobbyists. While the House legislation would peg federal insurance subsidies to age, the Senate bill would link them to income, as the ACA does.

The Senate measure would cut off expanded Medicaid funding for states more gradually than the House bill but would enact deeper long-term cuts to the health-care program for low-income Americans. It also would eliminate House language aimed at prohibiting federally subsidized health plans from covering abortions, a provision that may run afoul of complex Senate budget rules.

But McConnell faces the prospect of an open revolt from key conservative and moderate GOP senators, whose concerns he has struggled to balance in recent weeks. Republicans familiar with the effort said Senate leaders have more work to do to secure the 50 votes needed to pass the measure, with Vice President Pence set to cast the tiebreaking vote, from the pool of 52 GOP senators. No Democrats are expected to support the bill.

According to two Republicans in close contact with Senate GOP leadership granted anonymity to describe private conversations, McConnell is threatening to bring the bill to a vote next week even if he doesn’t have the votes to pass it. But some believe that message is aimed at trying to pressure Republicans to support the bill, rather than an absolute commitment. A McConnell spokeswoman declined to comment.

Republican aides stressed that their plan is likely to undergo more changes to secure the votes needed for passage, but there were major concerns Wednesday from senators on opposite ends of the GOP spectrum.

“My main concern is I promised voters that I would repeal — vote to repeal Obamacare. And everything I hear sounds like Obamacare-lite,” said Sen. Rand Paul (R-Ky.).

Sen. Shelley Moore Capito (R-W.Va.), whose state expanded Medicaid and has been pushing for a more gradual unwinding of that initiative than many conservatives prefer, said she is waiting to scrutinize what is released but has not seen anything yet that would make her drop her concerns with the proposal.

“Up to this point, I don’t have any new news — tomorrow we will see it definitively — that would cause me to change that sentiment,” she said.

Like the House bill, the Senate measure is expected to make big changes to Medicaid, the program that insures about 74 million elderly and lower-income Americans and was expanded in most states under the ACA. In effect, the revisions would reduce federal spending on the program.

The Senate measure would transform Medicaid from an open-ended entitlement to one in which federal funding would be distributed to states on a per capita basis. The Senate measure would also seek to phase out the program’s expansion — although at a more gradual rate than the House version.

Yet the Senate bill would go further than the House version in its approach to cutting Medicaid funding in the future. In 2025, the measure would tie federal spending on the program to an even slower growth index than the one used in the House bill. That move could prompt states to reduce the size of their Medicaid programs.”

Welcome To Jeff Sessions’s America — In 1957 Sessions Was 10 Years Old And His White Christian Fellow Alabamans Were Busy Perverting The “Rule Of Law” To Deny Their African American Fellow Citizens Constitutional Rights, Fundamental Justice, & Human Dignity!

“How is it possible in a country that prides itself on having a Bill of Rights, expresses reverence for due process and touts equal protection that a 17-year-old can be arrested, put on trial and sentenced to death, and then spend 13 years being shuttled among death row cellblocks in disgusting jails and prisons with his case under appeal, all for a crime he didn’t commit?

The answer contains some simple prerequisites: He had to be black, live in the Jim Crow South and be accused of committing, as one deputy sheriff put it, a “supreme offense, on the same level of a white woman being raped by a black man” — that is, the murder of a white police officer.

Teenager Caliph Washington, a native of Bessemer, Ala., was on the receiving end of all three conditions. And as such, Washington became a sure-fire candidate to suffer the kind of tyrannical law enforcement and rotten jurisprudence that Southern justice reserved for blacks of any age.

In “He Calls Me by Lightning,” S. Jonathan Bass, a professor at Alabama’s Samford University and a son of Bessemer parents, resurrects the life of Washington, who died in 2001 finally out of prison — but with charges still hanging over his head.

 

Bass, however, does more than tell Washington’s tale, as Washington’s widow, Christine, had asked him to do in a phone call. Bass dives deeply into the Bessemer society of 1957 where Washington was accused of shooting white police officer James “Cowboy” Clark on an empty dead-end street near a row of run-down houses on unpaved Exeter Alley.

Bessemer-style justice cannot be known, let alone understood, however, without learning about that neo-hardscrabble town 13 miles southwest of Birmingham.

Bessemer served as home to a sizable black majority, an entrenched white power structure and an all-white police department, consisting at the time of a “ragtag crew of poorly paid, ill-trained, and hot-tempered individuals” who earned less than Bessemer’s street and sanitation workers.

Bessemer was a town with its own quaint racial customs, such as forcing black men to “walk in the middle of the downtown streets, not on the sidewalks, after dark — presumably to keep them from any close contact with white women.”

 

Bessemer was a town where in 1944 the police forced black prisoners to participate in an Independence Day watermelon run. White citizens reportedly cheered as firefighters blasted the inmates with high-pressure hoses to make the race more challenging. Winners, it is said, received reduced sentences and the watermelons.

It was in that town that Caliph Washington was born in 1939, the same year of my birth in Washington, D.C.

Bessemer’s racial climate was no different the year Washington was accused of killing Cowboy Clark. The town’s prevailing attitude on race was captured at the time in a pamphlet distributed by a segregationist group, the Bessemer Citizens’ Council. Black Christians, the white citizens’ council said, should remain content with being “our brothers in Christ without also wanting to become our brothers-in-law.”

If ever there was a place to not get caught “driving while black” — which is what Washington was doing on that fateful night in July 1957 — it was Bessemer. And that night’s hazard appeared in the form of Clark and his partner, Thurman Avery, who were cruising the streets in their patrol car looking for whiskey bootleggers.”

So, when you hear Sessions and his White Nationalist buddies like Bannon, Miller, Kobach, and Pence extolling the virtues of a small Federal Government (except for the migrant-bashing mechanisms) state control of voting, civil rights, police conduct, gender fairness, environmental regulations, labor relations, filling the prisons with maximum sentences, a new war on drugs, etc., it’s just clever code for “let’s make sure that white-dominated state and local governments can keep blacks, hispanics, immigrants, Muslims, and other minorities from achieving power, equality, and a fair share of the pie.” After all, if you believe, as these guys do, that true democracy can be a bad thing if it means diversity and power sharing, then you’re going to abuse the legal and political systems any way you can to maintain your hold on power.

And, of course, right-wing pontificating about the “rule of law” means  nothing other than selective application of some laws to the disadvantage of minorities, immigrants, and often women. You can see how selective Sessions’s commitment to the rule of law is when he withdraws DOJ participation in voting rights cases in the face of strong evidence of racial gerrymandering, withdraws support from protections for LGBT individuals, supports imprisonment in substandard prisons, targets legal marijuana, and “green lights” troubled police departments to prioritize aggressive law enforcement over the protection of minority citizens’ rights. Ethics laws, in particular, seems to be far removed from the Sessions/Trump concept of “Rule of Law.” And, sadly, this is only the beginning of the Trump Administration’s assault on our Constitution, our fundamental values, and the “real” “Rule of Law.”

“California lawmakers on Thursday dealt a blow to the Trump administration’s plans to expand capacity for detaining undocumented immigrants in the state.

The provision, which is part of California’s $125-billion budget, stops local jurisdictions from signing new contracts or expanding existing contracts with US Immigration and Customs Enforcement (ICE) for detaining immigrants. It also requires the state attorney general to conduct reviews of all detention facilities holding immigrants. The budget plan now goes to the desk of Gov. Jerry Brown, who is expected to sign it.

California’s move comes as ICE is seeking a $1.2-billion increase in funding for the next fiscal year. The agency’s budget calls for nearly $4.9 billion to expand detention capacity to 51,379, with the ability to hold about 49,000 adults and 2,500 families.

At the same time, the Trump administration has expanded the pool of deportation priorities to include nearly all 11 million undocumented immigrants.

California state Sen. Nancy Skinner, who introduced the language into the bill, cited that expanded pool of possible deportees as a major reason for the new rule.

“That’s just an absurd expansion, which California overall rejects,” Skinner told BuzzFeed News. “We don’t support the president’s broad executive orders and we feel that any detainee should be treated humanely.”

The Golden State is home to nine immigration detention facilities, and all but Otay Mesa Detention Center in San Diego contract with local jurisdictions to hold immigrants. A recent report from Human Rights Watch estimates that 65,000 immigrants are detained in California every year, second only to Texas.

Grace Meng, senior researcher at Human Rights Watch, said it’s an unprecedented move by a state with so many immigrant detainees.

“People think of California as a liberal state that’s anti-Trump and pro-immigrant, but after Texas, it holds more immigrants than any other state,” Meng told BuzzFeed News. “This certainly can’t stop Trump’s detention plan singlehandedly, but it’s an important step for a state to take.”

However, Virginia Kice, spokeswoman for ICE, said placing limitations on the agency’s detention options in California won’t hinder their efforts.

“It will simply mean ICE will have to transfer individuals encountered in California to detention facilities outside the state, at a greater distance from their family, friends, and legal representatives,” Kice said in a statement to BuzzFeed News.”

Yeah, as if keeping folks near “family, friends, and legal representatives” was ever a factor in DHS detention decisions. What a complete crock!

No, it’s largely about money, using detention as a deterrent/demoralizer, and, occasionally, forum shopping by the DHS to gets folks into Circuits where the law is less favorable to their claims for relief. In the latter respect, DHS could actually benefit from detaining more folks outside the jurisdiction of the 9th Circuit. It also appears that lining the pockets of certain private detention contractors and state jurisdictions might be a factor in jacking up needless detention. Added to the steady stream of deaths in immigration detention, it has become a pretty unwholesome business.

It starts with a “detention-happy” Congress and goes down the line from there. To date, those who have promoted and enabled overuse of immigration detention have escaped political, legal, and moral accountability. But, history is infinitely long and has a funny way of eventually catching up with those who seek to evade its judgments, even after death.

TRUMP IMMIGRATION ENFORCEMENT POLICIES: BOON FOR DOMESTIC ABUSERS, BUST FOR VICTIMS! — Many Victims Now Fear Reporting Abuse Or Seeking Help!

Over the past several months, counselors at Laura’s House domestic violence agency in Orange County, California, have seen fewer and fewer undocumented immigrants coming in to report abuse. The agency’s legal director, Adam Dodge, does not see this as a good sign. He says undocumented domestic violence victims are facing a heightened fear that if they speak out against an abuser or take legal action, they could get deported—so they’re keeping quiet.

The trend started in February, when Dodge says the agency saw a dramatic change among the roughly 80 people who come in over the course of a typical month. “We went from 40 to 45 percent of our clients being undocumented—helping them get restraining orders for themselves and their children—to nearly zero,” he tells SELF.

Dodge says Laura’s House—which provides vital services like emergency shelter, counseling, and legal aid to survivors of domestic violence—first noticed a decrease in undocumented immigrant clients after Immigration and Customs Enforcement (ICE) agents detained an undocumented domestic violence survivor on Feb. 9, in El Paso, Texas, when she was in court filing a protective order against her alleged abuser. “That just spread like wildfire through the undocumented community across the United States and created this chilling effect where no one’s going in to seek restraining orders,” Dodge says. “People are just so scared of having their name in any system. We can’t tell them with any certainty that they won’t get picked up by ICE if they come to court.”

In the first few months following the El Paso incident, he says only one openly undocumented survivor came to their agency. Her situation was grave. “She thought she was going to die if she stayed in the relationship,” Dodge says. “She said she was willing to risk deportation to get a restraining order.” Now, the agency has seen a slight increase to one or two undocumented clients each week—but it’s still well below the norm. “The situation is still very dire,” he says.

El Paso was an early and powerful example of how ramped up ICE activity, spurred by President Trump’s aggressive and expansive new rules on immigration, can have a devastating impact on immigrants living in the U.S. without documentation. In February, the President issued new immigration policies, calling for the deportation of illegal immigrants even if they haven’t been formally convicted of a crime and an increase in ICE resources. In March, a video surfaced showing ICE officers poised to make an arrest at a Denver courthouse, a place where victims of domestic violence also appear when their cases go to court. NPR reported that after the video came out, four women dropped domestic violence cases in Denver, fearing they’d be spotted at the courthouse and deported.

When incidents like these happen, experts say the news—and fear of deportation—spreads, affecting how many survivors come forward. At the end of March, reports of sexual assault in Los Angeles had dropped 25 percent among the Latino population and reports of domestic violence had fallen 10 percent among the community compared to the previous year. Los Angeles Police Chief Charlie Beck said similar decreases in reports weren’t seen in any other ethnic groups, the Los Angeles Times reports.

Ruth Glenn, executive director of the National Coalition Against Domestic Violence, tells SELF the perception of how survivors are treated matters—and it can affect how undocumented immigrants proceed if they find themselves in an abusive situation. “If you have a case and you’re thinking about going forward, and then this environment that we’re in right now does not seem supportive, then you’re not going to follow through,” Glenn says. “It’s very disturbing.”

Critics of the administration’s treatment of undocumented survivors sounded an alarm in May, when it was discovered that the U.S. Department of Homeland Security’s new Victim Information and Notification Exchange—an online database created to track when criminals are released from or into ICE custody—publicly listed the names and detainment location of victims of domestic violence, sexual assault, and human trafficking who’ve applied to stay legally in the U.S. on special protective visas. DHS is prohibited from releasing identifying information about immigrants seeking these protections because of the dangers it poses to them. The Tahirih Justice Center, a nonprofit that serves immigrant women and girls, first contacted the DHS about the issue on May 12. As of the May 25, the organization said the names of abuse victims were still searchable in the database. In response to the uproar, an ICE spokesman told BuzzFeed News they were working to “correct” and “prevent” any non-releasable information disclosed on the site.”

While the Trump Administration has turned the VOICE Program for victims of crime committed by undocumented aliens into a big showpiece, they have basically declared an “open season” on undocumented victims of crime. Years of hard work by local police and social agencies to get the undocumented community its to report crimes, help in solving them, and seek appropriate victim assistance are going down the drain. And, I suspect that once lost, that trust will be difficult, if not impossible to regain.

At the same time, by discouraging individuals from reporting crime, I suppose the Administration can achieve fake “reduction in crime” stats resulting from its enforcement efforts.

“The death of an undocumented immigrant while in the custody of federal authorities is the latest in a series of deaths that advocates worry will continue to grow as more people living illegally in the US are detained under the Trump administration.

Vicente Caceres-Maradiaga, 46, died Wednesday night from acute coronary syndrome as he was being transferred to a hospital from a private detention center in Adelanto, California. He is the ninth person to die in the custody of US Immigration and Customs Enforcement (ICE) this fiscal year, which started Oct. 1. That compares to 10 deaths for all of fiscal year 2016.

The Daily Beast was the first to report on the trend.

Christina Fialho, executive director of Community Initiatives for Visiting Immigrants in Confinement (CIVIC), said the deaths were disturbing.

“They also point to systemic failures that are likely to grow even starker as the Trump administration carries out its crackdown on immigration,” Fialho told BuzzFeed News. “I have no doubt that the increase in immigration detention deaths is directly connected to both the increase in the number of people detained and the effective elimination of federal standards on humane treatment.”

Operating under executive orders and memos from the Trump administration that call for an increase in arrests of people living illegally in the US, data analyzed by the Transactional Records Access Clearinghouse (TRAC) at Syracuse University found that there has already been a sharp increase in the number of detainees who are waiting for their court cases to be heard.

The rise in both the number of arrests and detainees is a change from the Obama administration, which allowed many undocumented immigrants out of detention while their legal cases played out — a practice maligned by critics as “catch-and-release.” During Obama’s tenure, 27% of people with immigration cases were kept in custody, compared to 61% under Trump, according to TRAC.”

I suppose that this Administration just looks at detainee deaths as a “cost of doing business.” Or, perhaps “collateral damage” as they say in the military. As noted in prior posts, private detention facilities had been determined by the DOJ’s Inspector General to have substandard conditions. Under then Attorney General Lynch, the DOJ was in the process of phasing private detention out of the prison system. While the DHS had not taken the same action with respect to civil immigration detention, then Secretary Johnson had received a report from an Advisory Committee noting the problems with private detention and recommending that it be phased out. The Trump Administration, with Attorney General Jeff Sessions leading the way, has reversed the course and intends to maximize the use of private detention while it builds it promised “American gulag” for both civil detainees and criminals. At no time that I am aware of have Trump, Sessions, or Kelly expressed any concern about detention standards or the health and safety of detainees.

THE HUMAN TOLL OF IMMIGRATION DETENTION: Mother Attempts Suicide After 6 Months In Texas “Family Detention Centers!”

“AUSTIN, Texas ― A woman locked at a family immigrant detention center tried to take her own life this month in what legal advocates described as a desperate effort to free her two kids.

Samira Hakimi, an Afghan national, has spent the last six months detained with her two young children despite a federal ruling that dictates they should have been released within three weeks. The case reinforces the longstanding concerns of immigrant rights groups that say asylum-seeking families should not be forced into prolonged detention.

“They told us you will only be a couple of days in there,” Hakimi told HuffPost. “I never thought that I would be detained here for such a long time. That I’m detained here because I’m from Afghanistan and that’s all. But I’m human.”

In Afghanistan, the Hakimi family had established a high school and multi-branch private university that used Western curricula, taught in both English and Dari and offered more than half its scholarships to women, according to lawyers representing Hakimi and her husband.

Since 2013, the Taliban repeatedly threatened the family for its work. To avoid the danger of commuting, the family moved onto the university campus and contracted private security guards that year.

It wasn’t enough for them to feel safe. “We could not go outside,” Hakimi said. “My children could not go to school. We thought they might be kidnapped. This was always in our minds…. They have their lives to live. They should live happy and free from every small thing, going to school and enjoying their lives.”

Last year, they fled Afghanistan with Hakimi’s brother-in-law and his pregnant wife, who were facing similar threats.

In December, the two families crossed into the United States from Mexico through a legal port of entry, where they all asked for asylum. The men were separated and sent to all-male immigrant detention centers, where they remain. Hakimi and her kids, as well as her sister-in-law and her newborn baby, were sent to the South Texas Family Detention Center in the town of Dilley and later transferred to the Karnes County Residential Center outside San Antonio.

Hakimi passed her “credible fear” interview ― the first step toward applying for asylum. It’s common practice for Immigration and Customs Enforcement to free people who pass these interviews so they can pursue their cases in immigration court, but ICE declined to release her and her children. The agency did not respond to a request for comment explaining why it refuses to release them. Hakimi’s sister-in-law is also still at Karnes with her 10-month-old baby.

The Karnes County Residential Center houses mothers who enter the United States with their children. Most of them seek asylum or other forms of humanitarian exemption from deportation.
Hakimi told HuffPost she had suffered from bouts of clinical depression before being detained. Advocates with RAICES, a nonprofit that provides legal services to detained families, say she had attempted suicide in the past and told medical workers at Karnes that her condition had worsened as her case appeared to stall. Neither medicine nor therapy would alleviate the problem, she argued. Her depression stemmed from remaining locked up in the detention center with her children.

As the months dragged on, she lost hope. “Here, no one talks to us,” Hakimi said. “They don’t give us the reason why I’m detained in here. I never thought that I would be detained here for such a long time.”

Her son came to her one day asking her why other families were allowed to leave but not them. “That was really triggering her,” Amy Fisher, RAICES’s policy director, told HuffPost. “She was crying and really depressed. And she went into this thought process, when she was really low, thinking, ‘Well, if I’m no longer here, maybe my children can be free.’” Kids cannot be held without their parents or guardians in family detention.

After she made an effort to take her own life, she woke up in the medical unit of the detention center and was taken to a nearby hospital, where two members of the detention center staff sat with her continuously.

“I told them, ‘I’m just crying for my children, please,’” she said in a recording with one of her legal providers. “I’m not sick. But they gave me medicine. And they told me take this every four hours, but I didn’t take it anymore.”

Don’t think that a few (or even many) attempted suicides or preventable deaths in immigration detention are going to change the Administration’s plans to establish an “American Gulag.” After all, what better “deterrent” than death to put a dent in migration.

No, the only thing that might get in the way is if Democrats start winning elections and wielding some political power in Washington. (Not that Democrats have been particularly enlightened when it comes to immigration detention, either. After all, Dilley, Karnes, Berks County, and other “family residential prisons” were Obama initiatives. But, that’s another story.)

But, as I just pointed out in an earlier blog, Dems appear lost in the political wilderness with no path out.

POLITICS: David Leonhardt In The NYT: Don’t Get Distracted From GOP’s Dishonesty & Cruelty!

The Congressional Budget Office’s analysis of the House health care bill is a devastating indictment.
The report, released yesterday, showed that millions of Americans would lose health insurance and the quality of insurance for millions more would deteriorate. The savings from that carnage — to borrow a favorite word of President Trump’s — would pay for tax cuts for the wealthy.
And yet the immediate reaction to the C.B.O. report also shows why you should be worried that the Senate will nonetheless decide to pass a version of the House bill.
Here’s what I mean: Much of this initial reaction has missed the point. It has focused on the modest differences between the new C.B.O. report, which analyzed the final House bill, and a C.B.O. analysis from March of an earlier version of the bill. Among the differences, the final bill would deprive an estimated 23 million people of insurance, compared with the 24 million in the March analysis.
Don’t be distracted by these small differences.
Distraction is a tactic of the politicians who are trying to take away health insurance from people. These politicians can’t sell their proposals on the merits. That’s why both the House and, thus far, the Senate have refused to hold any hearings. They know that virtually every expert across the ideological spectrum — including groups representing doctors, nurses, hospitals, patients and senior citizens — opposes the bill.
Unable to win a debate on its merits, Republican leaders need to change the subject. They can’t let their proposals be judged on whether they improve the American health care system, because they don’t. They need to create a lower standard by which the plan will be judged.
The House did so in the frantic week that it passed its bill by pointing to a last-minute amendment that made a superficial improvement. House members then claimed they had fixed their bill.
Senate leaders are showing signs of following the same path — and the C.B.O. report gives them a chance to start down it. The report will encourage top Republicans to claim that their bill is already getting better and that the Senate will keep improving it in coming months.
In truth, the bill is fatally flawed. Its objective is to reduce federal spending on health insurance for the middle class, poor, sick, elderly and disabled in order to cut taxes for the wealthy. Maybe the final version, once the Senate has made its tweaks, will take insurance from 23 million people, or maybe 15 million people. But any law based on the House bill is guaranteed to worsen the health care system.
That’s the overwhelming message of the C.B.O. report.
The saddest part of this situation is that our health care system, including Obamacare, very much needs improvement. And there are solid bipartisan ideas out there, including some that would increase states’ flexibility or lower consumer expenses. The Senate has members from both parties with the savvy and the policy chops — like Lamar Alexander and Patty Murray — to turn those ideas into a bill.
Is it too much to hope that they cast aside the distractions from the House’s failed plan and start fresh?

“WASHINGTON — A bill to dismantle the Affordable Care Act that narrowly passed the House this month would leave 14 million more people uninsured next year than under President Barack Obama’s health law — and 23 million more in 2026, the Congressional Budget Office said Wednesday. Some of the nation’s sickest would pay much more for health care.

Under the House bill, the number of uninsured would be slightly lower, but deficits would be somewhat higher, than the budget office estimated before Republican leaders made a series of changes to win enough votes for passage. Beneath the headline-grabbing numbers, those legislative tweaks would bring huge changes to the American health care system.

In many states, insurance costs could soar for consumers who are sick or have pre-existing conditions, while premiums would fall for the healthy, the new estimate concludes.

The forecast by the nonpartisan Congressional Budget Office, Capitol Hill’s official scorekeeper, is another potential blow to efforts to undo Mr. Obama’s signature domestic achievement. Republican senators have said they will make substantial changes to the measure passed by the House, but even Senator Mitch McConnell of Kentucky, the majority leader, sounds uncertain about his chances of finding a majority to repeal and replace the health law.”

POLITICS: GOP Senate’s “Stealth Plan” To Strip Health Care From Millions While Enriching Fat Cats Exposed!

“While the rest of the country has been transfixed by Trumpian chaos, members of the Senate have spent the last two weeks talking about taking health insurance from millions of Americans.

There is an alarmingly large chance that they’ll decide to do so. But if they do, they will almost certainly rely on a political sleight of hand to disguise their bill’s damage. Understanding that sleight of hand — and calling attention to it — offers the best hope for defeating the bill.

The effort to take health insurance from the middle class and poor and funnel the savings into tax cuts for the rich is a little like mold. It grows best in the dark.

That’s why Republican leaders in the House handled their bill as they did. They did not hold a single hearing, because they knew that attention would have been devastating.

Just imagine a hearing featuring the leaders of these groups, every one of which opposes the House bill: the American Medical Association, American Nurses Association, American Hospital Association, American Academy of Pediatrics, American Cancer Society, American Heart Association, American Diabetes Association, American Lung Association, March of Dimes and AARP.
The House also passed its final bill without waiting for the Congressional Budget Office to estimate how many Americans would lose insurance. The C.B.O. will release that analysis tomorrow afternoon. There is no precedent, outside of wartime, for passing a bill this important in such haste.

After the House did, many observers assumed the bill was too flawed to have much chance in the Senate. Republican senators, aware of the bill’s unpopularity, were careful to say publicly that they would start fresh. But the early signs suggest that Mitch McConnell and his Republican caucus are actually mimicking the House approach.

Think of it as the Upton strategy, and I’ll explain the name in a minute.”

Yet, the voters keep putting these guys in office. Unless you are part of the tiny percentage of over-privileged, rich elite in America, you’re voting against not only our country’s best interests, but your own!

Amazingly, however, the Democrats have failed to come up with an effective strategy to capitalize on this. And, to date, I’m not sure I’ve heard any compelling arguments as to how and why Democrats will do better in the next election.

Yeah, Trump and his cohorts have problems galore. But, highlighting/relying on that was Hillary’s primary strategy in 2016. And, it failed! Big time! What positive plan do Democrats have for making America better for everyone (including most Trump supporters)?

“A week after U.S. Attorney General Jeff Sessions told federal prosecutors to “charge and pursue the most serious, readily provable offense” and follow mandatory minimum sentencing guidelines, a bipartisan group of prosecutors at the state and local level is expressing concern.

Thirty current and former state and local prosecutors have signed an open letter, which was released Friday by the nonprofit Fair and Just Prosecution, a national network working with newly elected prosecutors. The prosecutors say that even though they do not have to answer Sessions’s call, the U.S. Attorney General’s directive “marks an unnecessary and unfortunate return to past ‘tough on crime’ practices” that will do more harm than good in their communities.

“What you’re seeing in this letter is a different wind of change that’s blowing through the criminal justice field,” said Miriam Krinsky, a former federal prosecutor and executive director of Fair and Just Prosecution.

“There does seem at the federal level to be a return to the tough-on-crime, seek-the-maximum-sentence, charge-and-pursue-whatever-you-can-prove approach,” Krinsky said. But, she added, at a local level, some believe “there are costs that flow from prosecuting and sentencing and incarcerating anyone and everyone who crosses the line of the law, and we need to be more selective and smarter in how we promote both the safety and the health of our communities.”

Signers of the letter include Los Angeles City Attorney Mike Feuer, Manhattan District Attorney Cyrus R. Vance Jr., and Karl Racine, attorney general of the District of Columbia.

The prosecutors say that there are no real benefits to Sessions’s May 10 directive, but they noted “significant costs.”

The letter states:

The increased use of mandatory minimum sentences will necessarily expand the federal prison population and inflate federal spending on incarceration. There is a human cost as well. Instead of providing people who commit low-level drug offenses or who are struggling with mental illness with treatment, support and rehabilitation programs, the policy will subject them to decades of incarceration. In essence, the Attorney General has reinvigorated the failed “war on drugs,” which is why groups ranging from the American Civil Liberties Union to the Cato Institute to Right on Crime have all criticized the newly announced policy.”

Atulkumar Babubhai Patel was pronounced dead at Atlanta’s Grady Memorial Hospital on Tuesday afternoon.
The 58-year-old Indian national’s death is the second death of a detainee in ICE custody this week — and the second this week in the state of Georgia.
Officials said complications from congestive heart failure were ruled the preliminary cause of death.
Patel arrived at the Atlanta airport on May 10 on a flight from Quito, Ecuador. Authorities denied him entry into the United States because he did not have the necessary immigration documents, ICE said.
He was transferred to ICE custody in the Atlanta City Detention Center on Thursday, according to the agency. An initial medical screening at the time determined he had high blood pressure and diabetes. Two days later, Patel was transported to the hospital after a nurse checking his blood sugar noticed he had shortness of breath, ICE said. He died on Tuesday afternoon.
In its statement announcing Patel’s death, officials said fatalities in ICE custody are “exceedingly rare.”
“ICE is firmly committed to the health and welfare of all those in its custody and is undertaking a comprehensive agency-wide review of this incident, as it does in all such cases,” ICE said.

Second death this week

Patel is the eighth person to die in ICE custody this fiscal year, which began in October.
Authorities are also investigating the death of another immigrant detainee in Georgia. Jean Jimenez-Joseph, 27, was found unresponsive in his cell on Monday with a sheet around his neck. The preliminary cause of death was self-inflicted strangulation.
He’d been in solitary confinement for more than two weeks at the Stewart Detention Center in Lumpkin, Georgia.
The recent deaths have drawn sharp criticism from immigrant rights activists, who have long decried conditions in immigration detention centers and called on the government to close such facilities.
US President Donald Trump has called for increasing detention as part of his crackdown on illegal immigration. And Congress recently upped its funding for immigrant detention, approving a spending bill that pays for an average of more than 39,000 detention beds per day.

“Exceedingly rare?”  Like in two deaths in one week in ICE custody in Georgia? In addition to ruined lives, the Trump/Sessions/Kelly vision for an “American Gulag” is certain to cause more preventable deaths in DHS custody, in light of the well-documented substandard conditions in such facilities, particularly those run by private contractors and local jailers. I guess each member of the “Triumvirate of Death”  is well enough off so a few million in civil judgments wouldn’t be a problem.  But, the taxpayers are likely to be shelling out megabucks for some tort claims.
