The events occurring now on our border with Mexico, where children are being removed from the arms of their mothers and fathers and sent to foster families or “shelters”, make me weep and gnash my teeth with sadness and rage. I know what they are going through. When we were children, my two siblings and I were also taken from our parents. And the problems we’ve experienced since then portend the terrible things that many of these children are bound to suffer.

My family was Jewish, living in 1942 in the Netherlands when the country was occupied by the Nazis. We children were sent into hiding, with foster families who risked arrest and death by taking us in. They protected us, they loved us, and we were extremely lucky to have survived the war and been well cared for.

Yet the lasting damage inflicted by that separation reverberates to this day, decades hence.

Have you heard the screams and seen the panic of a three-year-old when it has lost sight of its mother in a supermarket? That scream subsides when mother reappears around the end of the aisle.

This is my brother writing in recent years. He tries to deal with his lasting pain through memoir. It’s been 76 years, yet he revisits the separation obsessively. He still writes about it in the present tense:

In the first home I scream for six weeks. Then I am moved to another family, and I stop screaming. I give up. Nothing around me is known to me. All those around me are strangers. I have no past. I have no future. I have no identity. I am nowhere. I am frozen in fear. It is the only emotion I possess now. As a three-year-old child, I believe that I must have made some terrible mistake to have caused my known world to disappear. I spend the rest of my life trying desperately not to make another mistake.

My brother’s second foster family cared deeply about him and has kept in touch with him all these years. Even so, he is almost 80 years old now and is still trying to understand what made him the anxious and dysfunctional person he turned into as a child and has remained for the rest of his life: a man with charm and intelligence, yet who could never keep a job because of his inability to complete tasks. After all, if he persisted he might make a mistake again, and that would bring his world to another end.

My younger sister was separated from our parents at five. She had no understanding of what was going on and why she suddenly had to live with a strange set of adults. She suffered thereafter from lifelong, profound depression.

I was older: seven. I was more able than my siblings to understand what was happening and why. I spent most of the war with Dick and Ella Rijnders. Dick was mayor of a small, rural village, and he and Ella lived in a beautiful house next to a wide waterway. Ella had a warm smile and Dick referred to me as his “oldest daughter”. I was able to go to school normally, make friends, and became part of village life. I was extraordinarily lucky, but I was not with my own parents, sister, and brother. And, eventually, I also had to leave the Rijnders, my loving second “family”. I was returning to my own family, but this meant another separation.

In later life, I was never able to really settle down. I lived in different countries and was successful in work, but never able to form lasting relationships with partners. I never married. I almost forgot to mention my own anxiety and depression, and my many years in psychotherapy.

My grief and anger about today’s southern border come not just from my personal life. As a retired psychotherapist who has worked extensively with victims of childhood trauma, I know all too well what awaits many of the thousands of children, taken by our government at the border, who are now in “processing centers” and foster homes – no matter how decent and caring those places might be. We can expect thousands of lives to be damaged, for many years or for ever, by “zero tolerance”. We can expect old men and women, decades from now, still suffering, still remembering, still writing in the present tense.

What is happening in our own backyard today is as evil and criminal as what happened to me and my siblings as children in Nazi Europe. It needs to be stopped immediately.

In fairness to Dershowitz he has asked President Trump to end the cruel and inhuman policy of child abusez/child separation. http://www.foxnews.com/opinion/2018/06/18/alan-dershowitz-mr-president-please-end-policy-separating-children-from-parents.html But, his “put down” of the parallels with Nazism is highly disingenuous for the following reasons:

  • This about race.  It is no accident that virtually all of the separated parents and kids are Hispanic and the few others affected are almost all “of color.”  We wouldn’t be having all this ruckus if the arrivals were White. Trump, Sessions, and Miller are White Nationalists in the “Bannon Mode.” Kelly and Nielsen have decided to come out of the closet and reveal their racist sympathies.
  • The harm is permanent. All experts say that the harm intentionally inflicted in these kids will be permanently disabling.  More blogging on that later.
  • We’re sending these families to concentration camps masquerading as countries. Make no mistake about it, most of these folks are refugees fleeing persecution and torture at the hands of gangs and cartels that basically are the government in much of the Northern  Triangle. Sessions & Trump have intentionally misconstrued the law, misrepresented facts, and violated Constitutional Due Process to artificially deny most of these individuals legal protections they deserve. Their return is likely to mean death, torture, a lifetime of abuse, extortion, rape, sexual enslavement, forced drug trafficking, or prostitution.  Others will be forcibly impressed into a life of serving the gangs because we have turned our collective backs on them. Inhumanity is inhumanity; it’s only a matter of degree. And, that the Nazis were even worse in no way makes any difference to those we are sentencing to death, torture, or a lifetime of abuse. Dead is dead. Tortured is tortured. Decapitated is functionally the same as shot or gassed.
  • Sessions keeps parroting that misdemeanor unlawful entry “isn’t a victimless crime.” Perhaps he’s right. The “victims” here are the migrants and their families seeking to exercise legal rights to apply for asylum. The “criminals” are Sessions, Trump, Nielsen, Miller, Kelly and other Administration hard liners who engage in child abuse rather than protection. And, they lie about what and why they are doing it.  Who will eventually bring the real criminals to justice?

THE HILL: Nolan Says Sessions Got It Right In Matter of A-B- — Not Me!

This isn’t the first time The Board of Immigration Appeals has considered domestic violence and rejected victims of domestic violence as a particular social group. The Board did it in “Matter of R-A-” in 1999.

The Board held that R-A- was not eligible for asylum for two reasons. First, her claimed social group — “Guatemalan women who have been involved intimately with Guatemalan male companions, who believe that women are to live under male domination” — did not qualify as a “particular social group” for asylum purposes.

And second, that she has not established that her husband abused her because he perceived her to be a member of this group.

Attorney General Janet Reno intervened and vacated that decision — rendered it void — so it could be reconsidered in light of a proposed regulation that would clarify some of these concepts, but no final rule was ever promulgated.

The case was resolved without further consideration by the Board when R-A- and DHS jointly stipulated that she was eligible for asylum. Nevertheless, the Board and the federal courts continued to treat the R-A- analysis as persuasive.

In a later case, “Matter of A-R-C-G-”, the Board abandoned the reasoning from the R-A- analysis and held that depending on the facts and evidence in an individual case, “married women in Guatemala who are unable to leave their relationship” can constitute a particular social group for asylum purposes. But the finding was based primarily on government concessions, as opposed to basing it on an application of Board precedent.

Sessions found that the Board decided A-R-C-G-’s case without performing the rigorous analysis required by Board precedents by basing its decision on concessions from the DHS attorney that the respondent had suffered past persecution, that she was a member of a qualifying particular social group, and that her membership in that group was a central reason for her persecution instead of adjudicating these issues.

Sessions concluded therefore that A-R-C-G-’s case was wrongly decided and should not have been issued as a precedential decision. Accordingly, he overruled it.

Having overruled A-R-C-G-’s case, he had to vacate the Board’s decision in the A-B- case too. The Board’s cursory analysis of the respondent’s “particular social group” in that case consisted mainly of a general citation to A-R-C-G-’s case and country condition reports.

He remanded the case to the immigration judge for further proceedings consistent with this opinion, reiterating that an applicant for asylum on account of membership in a particular social group must demonstrate:

  1. Membership in a particular social group that is composed of members who share a common immutable characteristic, is defined with particularity, and is socially distinct;
  2. That membership in that group is a central reason for the alleged persecution; and
  3. That the alleged harm is inflicted by the government of her home country or by persons that the government is unwilling or unable to control.

The Board decisions applying asylum to domestic abuse victims may be morally correct, but they are legally indefensible.

I respectfully dissent. See Matter of R-A-, 22 I&N Dec. 906, 922 (BIA 1999) (Judge Guendelsberger, dissenting, joined by Schmidt, Chairman, and Judges Rosenberg, Villageliu, Moscato). The “Gang of Five” had it right then and continue to be right today.

I’ve been one of those fighting the battle for a correct interpretation of asylum law, particularly as it applies to abused women and other vulnerable groups, for two decades. It’s discouraging to have to re-fight a war we already won once. But, we’re all going to hang in there until justice and the humane, protective values behind the 1952 Convention and the Refugee Act of 1980 prevail. And, after we’re gone, members of the New Due Process Army will continue the fight until justice for the most vulnerable among us prevails.

Laura Bush: Separating children from their parents at the border ‘breaks my heart’

Laura Bush is a former first lady of the United States.

On Sunday, a day we as a nation set aside to honor fathers and the bonds of family, I was among the millions of Americans who watched images of children who have been torn from their parents. In the six weeks between April 19 and May 31, the Department of Homeland Security has sent nearly 2,000 children to mass detention centers or foster care. More than 100 of these children are younger than 4 years old. The reason for these separations is a zero-tolerance policy for their parents, who are accused of illegally crossing our borders.

I live in a border state. I appreciate the need to enforce and protect our international boundaries, but this zero-tolerance policy is cruel. It is immoral. And it breaks my heart.

Our government should not be in the business of warehousing children in converted box stores or making plans to place them in tent cities in the desert outside of El Paso. These images are eerily reminiscent of the Japanese American internment camps of World War II, now considered to have been one of the most shameful episodes in U.S. history. We also know that this treatment inflicts trauma; interned Japanese have been two times as likely to suffer cardiovascular disease or die prematurely than those who were not interned.

Americans pride ourselves on being a moral nation, on being the nation that sends humanitarian relief to places devastated by natural disasters or famine or war. We pride ourselves on believing that people should be seen for the content of their character, not the color of their skin. We pride ourselves on acceptance. If we are truly that country, then it is our obligation to reunite these detained children with their parents — and to stop separating parents and children in the first place.

People on all sides agree that our immigration system isn’t working, but the injustice of zero tolerance is not the answer. I moved away from Washington almost a decade ago, but I know there are good people at all levels of government who can do better to fix this.

People mislead one another all the time about temporary and venial things, which constitutes its own category of error, but rarely — even in the moral wasteland of American politics — do they get around to prevaricating about the eternal and cosmic. Lying about the capital-t, transcendent Truth is a category of error all on its own, whether you spend most of your time fooling others or just yourself.

Attorney General Jeff Sessions and White House press secretary Sarah Huckabee Sanders perhaps indulged in a bit of both Thursday, when asked about the moral reasoning behind separating migrant parents from their children at the U.S. border.

Sessions argued that, as criminals, immigrants have put themselves beyond the protection of God’s care. “I would cite you to the Apostle Paul and his clear and wise command in Romans 13, to obey the laws of the government because God has ordained them for the purpose of order,” Sessions explained by way of scriptural warrant. He added that “orderly and lawful processes are good in themselves . . . [and protect] the weak and lawful.” Sanders later offered an artful gloss in defense of Sessions: “It is very biblical to enforce the law,” she said.

Here, whether deliberately or unknowingly, Sessions and Sanders radically depart from the Christian religion, inventing a faith that makes order itself the highest good and authorizes secular governments to achieve it. In Christianity as billions of faithful have known it, order and lawful procedures are not “good in themselves” and it is not “very biblical” to “enforce the law” whatever it might be. Rather, there is a natural order inscribed into nature. Human governance can comport with it or contradict it, meaning Christians are sometimes morally obligated to follow civil laws and are sometimes morally obligated not to.

Conservatives seize on this approach when it suits them; this is why they’re so keen on carving out legal protections for matters of religious conscience. Because religious obligations precede and generate civic ones, laws must accommodate religious practice, not the other way around.

As Sessions himself observed quoting James Madison in a lengthy October 2017 memorandum on federal protections concerning religious liberty, “the duty owed to one’s Creator is ‘precedent, both in order of time and in degree of obligation, to the claims of Civil Society.’” Sessions can either believe that or believe what he and Sanders said Thursday, but he can’t believe both. To put a finer point on it: God’s law can’t only precede — and top — civil law when a pharmacist would prefer not to sell the Plan B contraceptive, but not when it would appear a ruler is duty-bound to show compassion to strangers.

But there are worse things than confusion, or even than hypocrisy. One of them is self-deception. When Sessions invoked Romans 13 — a verse infamous for earlier bad-faith invocations to justify slavery — he shifted the subject of the question from himself and his own department to those under his control. He was summoned to defend his choices, his judgment, his own moral reasoning — but instead offered a condemnation of the decisions and morality of migrants. He wanted to talk about what, in his view, the Bible demands of the ruled. But he omitted the more important question: What does it demand of rulers?

Any number of scriptural passages aavailable here, though less useful for Sessions’s purposes. From Deuteronomy 10 : “For the Lord your God . . . loves the strangers, providing them food and clothing. You shall also love the stranger, for you were strangers in the land of Egypt.” Or from Jeremiah 7: “If you really change your ways and your actions and deal with each other justly, if you do not oppress the foreigner, the fatherless or the widow and do not shed innocent blood in this place . . . then I will let you live in this place, in the land I gave your ancestors for ever and ever.” Dealing compassionately with strangers seems to be a minimal requirement for just leadership in the model set forth by God, a theme that carries into the New Testament, where Christ’s followers are taught to view themselves as wanderers on earth, and to treat others with appropriate empathetic mercy.

But some Christians aren’t strangers in the world at all. Some are very much at home here, or believe that they are, and that there is no tension between the desire of God and the desire of man. People can believe any number of things, especially given the right incentives.

If you had all the power in the world, maybe you would also hear a serpent dipping its smooth body down from some shadowy bough to say: God wants you to do whatever you like with your power, and whatever you do with it is good.

“It’s becoming a cultish thing, isn’t it?” Sen. Bob Corker (R-Tenn.) mused this week about his Republican Party under President Trump.

As if to prove Corker’s point, the Trump administration the very next day claimed that it had the divine right to rip children from their parents’ arms at the border.

Officials justified the unique form of barbarism — taking infants from parents and warehousing children in tent cities and an abandoned Walmart — by saying they are doing God’s will.

“I would cite you to the Apostle Paul and his clear and wise command in Romans 13, to obey the laws of the government because God has ordained them for the purpose of order,” Attorney General Jeff Sessions said Thursday. “I am not going to apologize for carrying out our laws.”

This isn’t religion. It’s perversion. It is not the creed of a democratic government or political party but of an authoritarian cult.

The attorney general’s tortured reading of Romans is exactly the strained interpretation that others have used before to justify slavery, segregation, apartheid and Nazism. The same interpretation could be used to justify Joseph Stalin, or Kim Jong Un.

Romans 13 does indeed say to “submit to the authorities,” because they “are God’s servants, agents of wrath to bring punishment on the wrongdoer.” But this is in the context of what comes before it(“share with the Lord’s people who are in need. Practice hospitality”) and after (“owe no one anything, except to love each other, for the one who loves another has fulfilled the law”) – and, indeed, admonitions to care for the poor and the oppressed that come from Isaiah, Leviticus, Matthew and many more.

Evangelical leaders who looked the other way when Stormy Daniels and the “Access Hollywood” tape surfaced this time have denounced Trump’s recent “zero-tolerance” policy that, as the National Association of Evangelicals, the Southern Baptist Convention and others wrote to Trump this month, has the “effect of removing even small children from their parents.”

“God has established the family as the fundamental building block of society,” they wrote. The leaders urged Trump to end zero tolerance and use “discretion” as previous administrations did.

But a cult, by definition, is not about mainstream theology. I looked up characteristics of cults in the sociological literature to see how Trump’s stacks up.

□ “Presents a distinct alternative to dominant patterns within the society in fundamental areas of religious life.” Grab ’em by the p—y!

□ “Possessing strong authoritarian and charismatic leadership.” I alone can fix it!

□ “Oriented toward ‘inducing powerful subjective experiences.’ ” Alternative facts. Fake news!

□ “Requiring a high degree of conformity.” See: Flake, Jeff and Sanford, Mark.

□ A tendency “to see itself as legitimated by a long tradition of wisdom or practice.” It is very biblical to enforce the law.

Check, check, check, check and check.

And members of the Cult of Trump, formerly known as the GOP, follow him over the cliff and onto the spaceship. They swallowed their heretofore pro-life, pro-family and pro-faith views to embrace Trump’s travel ban on several Muslim-majority countries (“Such blatant religious discrimination is repugnant,” said the U.S. Conference of Catholic Bishops) and applaud him tossing paper towels at Puerto Ricans as they died by the thousands because they didn’t get adequate hurricane relief.

They’ve joined his efforts to shred food, income and health programs that help the least among us while giving tax cuts to the wealthiest. They’ve accepted his abandonment of human rights abroad. They’ve joined his attempt to end family-based immigration and to threaten deportation of “dreamers,” immigrants brought here as children.

It appeared, briefly, that things might be different this time. House Republicans drafted legislation allowing children to be detained with their parents. But Trump on Friday signaled that he would veto the bill, and, as House Speaker Paul D. Ryan (R-Wis.) said this week, the “last thing I want to do is bring a bill out of here that I know the president won’t support.”

This is the way of the cult.

Will the vivid cruelty of taking babies from parents, coupled with the obscene use of Scripture to justify it, finally lead some Trump supporters to abandon the compound? God knows.

But the rest of us don’t need to drink the Kool-Aid. Give to groups such as the Florence Project, which provides legal aid and social services to immigrant families in Arizona, and Catholic Charities USA, which provides crucial help to immigrant families in the Rio Grande Valley.

You don’t have to be a theologian to see the difference between people who do God’s work on earth and those who pervert God’s word to justify inhumanity.

President Trump has calculated that he will gain political leverage in congressional negotiations by continuing to enforce a policy he claims to hate — separating immigrant parents from their young children at the southern border, according to White House officials.

On Friday, Trump suggested he would not change the policy unless Democrats agreed to his other immigration demands, which include funding a border wall, tightening the rules for border enforcement and curbing legal entry. He also is intent on pushing members of his party to vote for a compromise measure that would achieve those long-standing priorities.

Trump’s public acknowledgment that he was willing to let the policy continue as he pursued his political goals came as the president once again blamed Democrats for a policy enacted and touted by his own administration.

“The Democrats are forcing the breakup of families at the Border with their horrible and cruel legislative agenda,” he tweeted. After listing his demands in any immigration bill, he added, “Go for it! WIN!”

The attempt to gain advantage from a practice the American Academy of Pediatrics describes as causing children “irreparable harm” sets up a high-stakes gambit for Trump, whose political career has long benefited from harsh rhetoric on immigration.

Democrats have latched onto the issue and vowed to fight in the court of public opinion, with leaders planning trips to the border to highlight the stories of separated families, already the focus of news media attention. Democratic candidates running for vulnerable Republican seats also have begun to make the harsh treatment of children a centerpiece of their campaigns.

The policy has cracked Trump’s usually united conservative base, with a wide array of religious leaders and groups denouncing it. The U.S. Conference of Catholic Bishops and the Southern Baptist Convention issued statements critical of the practice.

The Rev. Samuel Rodriguez, who delivered a prayer at Trump’s inauguration, signed a letter calling the practice “horrible.” Pastor Franklin Graham of Samaritan’s Purse, a vocal supporter of the president’s who has brushed aside past Trump controversies, called it “terrible” and “disgraceful.”

Besides increasing the odds of a broader immigration bill, senior Trump strategists believe that the child separation policy will deter the flow of migrant families across the border. Nearly 2,000 immigrant children were separated from parents during six weeks in April and May, according to the Department of Homeland Security. The figure is the only one released by the goverment.

“The president has told folks that in lieu of the laws being fixed, he wants to use the enforcement mechanisms that we have,” a White House official said. “The thinking in the building is to force people to the table.”

Trump reinforced that notion Friday morning at the White House when he suggested Democrats alone had the power to alter the policy.

“I hate the children being taken away,” Trump said.

The president used a similar strategy last year as he sought to gain approval for his immigration demands by using the lure of protection for young immigrants brought to the United States as children. That effort, which ran counter to Trump’s earlier promise to sign a bipartisan bill protecting the young immigrants, foundered in Congress.

The current policy resulted from a decision made in April by Attorney General Jeff Sessions to prosecute all migrants who cross the border, including those with young children. Those migrants had avoided detention during the administrations of George W. Bush and Barack Obama. Because of a 1997 court settlement that bars children from being imprisoned with parents, Justice Department officials now say they have no choice but to isolate the children.

Sessions and White House press secretary Sarah Huckabee Sanders have defended the policy as a sound, and biblical, decision to enforce the law.

“The previous administration wouldn’t prosecute illegal aliens who entered the country with children,” Sessions said Thursday in Fort Wayne, Ind., citing biblical advice to follow laws. “It was de facto open borders.”

The biblical underpinnings have been challenged by religious leaders.

“There’s definitely a groundswell of opposition from virtually every corner of the Christian community,” said Russell Moore, president of the Ethics and Religious Liberty Commission of the Southern Baptist Convention. “People are able to understand immediately the drive of parents to protect their child and to understand the horror of splitting up vulnerable children from their parents.”

Yet several key Trump administration officials support the family separation policy, including Chief of Staff John F. Kelly, Homeland Security Secretary Kirstjen Nielsen and senior adviser Stephen Miller, a vocal supporter of stricter immigration laws.

Some senior officials think Democrats will be pressured by the policy to cut an immigration deal.

“If they aren’t going to cooperate, we are going to look to utilize the laws as hard as we can,” said a second White House official.

Others have argued that the main benefit of the policy is deterrence. Miller has said internally that the child separations will bring the numbers down at the border, a goal that Trump wants to achieve. Miller and Marc Short, the White House director of legislative affairs, have argued that immigration legislation is unlikely to pass this summer, officials said.

“The side effect of zero tolerance is that fewer people will come up illegally, and fewer minors would be put in danger,” said a third senior administration official. “What is more dangerous to a minor, the 4,000-mile journey to America or the short-term detention of their parents?”

So, the choice is ““What is more dangerous to a minor, the 4,000-mile journey to America or the short-term detention of their parents?” Not really!

The real choices are 1) a dangerous 4,000 mile journey to a place where you might be able to save your life and that of your loved ones; or 2) the much more dangerous option of remaining in a place where you will likely be beaten, raped, extorted, tortured, impressed against your will, or killed by gangs, who are not just “street criminals” (as falsely portrayed by Sessions and other restrictionists) but who exercise quasi-governmental authority with the knowing acquiescence of the recognized governments. 

Realistically, folks are going to opt for #1. We could recognize them as refugees; screen them abroad to weed out gang members and criminals and to take the danger out of the 4,000 mile journey; work with the UNHCR and other countries to distribute the flow; open more paths to legal immigration for those who want to leave but might not fit easily within the refugee definition; and encourage those who still arrive at our borders without documents seeking protection to go to a port of entry where they will be treated respectfully, humanely, and be given a prompt but full opportunity to present their cases for protection with access to counsel in a system that satisfies all the requirements of Constitutional Due Process, with the additional understanding that if they lose they will have to return to their home country.

Alternatively, we could double down on our current failed policies of detention, deterrence, and lawless and immoral Governmental behavior; send the message that folks shouldn’t bother using our legal system because it’s a fraud that has intentionally been fixed against them; encourage the use of smugglers who will charge ever higher fees for developing new and more dangerous means of entry; and send the message that if folks rally want to survive, they should pay a smuggler to get them into the interior of our country where they have at least a fighting chance of blending in, hiding out from immigration enforcement, behaving themselves, and working hard until they are caught and removed, die, conditions improve and they leave voluntarily for their country of origin, or we finally give them some type of legal recognition.

My first alternative could likely be established and operated for a fraction of what we are now spending on failed immigration enforcement, useless and unnecessarily cruel detention, unnecessary criminal prosecutions, and a broken Immigration Court system.

Plus, at a time of low birth rate and low unemployment, it would give us a significant economic boost by bringing a highly motivated, hard-working, family oriented, and appreciative workforce into our society. It might also inspire other stable democratic nations to join us in an effort to save lives (which also happens to fit in well with religious values), resettle individuals, and, over time, address the horrible situation in the Northern Triangle that is creating this flow.

Alternative two, which is basically a variation on what we already are doing, will guarantee a continuing “black market flow”of migrants, some of whom will be apprehended and removed at significant financial and societal costs, while most will continue to live in an underground society, subject to exploitation by unscrupulous employers and law enforcement, underutilizing their skills, and not being given the opportunity to integrate fully into our society.

The thing we will not be able to do is to halt human migration solely by law enforcement actions taken at “our end” of the chain. That is, unless we wish to establish a “Stalinist type state” that is so grim and repressive that nobody wants to come any more. 

Kids as human pawns. Child abuse as policy. Dreamers as hostages. Jesus told us to do it. It’s the Democrats fault. I really hate to let Jeff abuse children, but I have no choice. Refugee women fleeing gang controlled states reduced to human scum who should just accept their beatings and rape and get in the non-existent line for legal immigration that we want to eliminate. That is, if they actually live long enough to get in the non-existent line, which is unlikely. Biased judges cheering the chance to sign death warrants for the most vulnerable among us. Courts clogged with refugees being prosecuted for seeking refuge while being pressured by seizure of their children into giving up rights.

Once again, I’ve been proved right: We are actively diminishing ourselves as a nation every day; but, it isn’t stopping, and won’t in the long run stop, human migration. Sure, there is a natural ebb and flow that responds in some minor ways to our futile attempts to stop it. Sort of like throwing up man-made sand bars to stop beach erosion. Works for a few months or even years, but eventually the inevitable forces of nature win out. It sure seems to me that it would be smarter to work with the flow of the river and turn it to our advantage, rather than trying to make it reverse course — an exercise in futility that only serves to diminish the humanity of each of us.

The “Christian” B.S. Litmus Test

To my amazing friends who are atheist, agnostic, or non-Christian. To the good-willed and the pissed-off. To the people who are genuinely confused as to how Jefferson Sessions and Sarah Huckabee Sanders can use the Bible as a justification for abhorrent policies such as the separation of immigrant children from their parents at the border or the persecution of vulnerable asylum seekers, I am a Jesus-follower with a Bible degree from a Christian college and I GIVE YOU PERMISSION TO CALL B.S.

Please join me in calling B.S. whenever you hear people use the Bible to justify the oppression of others. Especially when they misuse and cite Romans 13 to justify their mistreatment. While Romans 13:4 calls us to submit to government authorities because “the one in authority is God’s servant for your good” it does not require us to submit to an unjust law. If the government authority is not acting in a way that reflects God’s law, which is the loving treatment of others, Jesus invites us to participate in civil disobedience. Remember when Jesus healed a man’s hand on the Sabbath in violation of the Jewish law (Mark 3:1-6) and says, “Which is lawful on the Sabbath: to do good or to do evil, to save life or to kill?” Matthew 3:4. Then he goes ahead and heals the man. There are numerous other examples in the Bible of civil disobedience that I would be happy to analyze with you at a different time (like the story of Shadrach, Meshach, and Abednego).

We must look first and foremost to Jesus Himself and His words when deciding whether a law is just and therefore should be followed. Jesus gave us a “Greatest Commandment” litmus test for determining which actions are really done in his name: “So in everything, do to others what you would have them do to you, for this sums up the Law and the Prophets.” Luke 6:31. And Jesus provided us a pretty simple “B.S. Litmus Test” (my words, not Jesus’!) to determine whether an action or law reflects His heart. The B.S. Litmus Test is this: “is this law/action/policy treating others as I would like to be treated?” (Matthew 7:12). And a second question would be, “does this law reflect love or fear?” If the latter, it is not from God. Because “perfect love casts out fear.” 1 John 4:18.

Regarding Jesus’ exact instructions on the treatment of immigrants, read Matthew 25: 34-46. Jesus refers to the immigrant/refugee/foreigner as “the stranger” and says, “Then the King will say to those on his right, ‘Come, you who are blessed by my Father; take your inheritance, the kingdom prepared for you since the creation of the world. For I was hungry and you gave me something to eat, I was thirsty and you gave me something to drink, I was a stranger (refugee/immigrant/foreigner) and you invited me in, I needed clothes and you clothed me, I was sick and you looked after me, I was in prison and you came to visit me.’ “Then the righteous will answer him, ‘Lord, when did we see you hungry and feed you, or thirsty and give you something to drink?When did we see you a stranger and invite you in, or needing clothes and clothe you? When did we see you sick or in prison and go to visit you?’

“The King will reply, ‘Truly I tell you, whatever you did for one of the least of these brothers and sisters of mine, you did for me.’

“Then he will say to those on his left, ‘Depart from me, you who are cursed, into the eternal fire prepared for the devil and his angels. For I was hungry and you gave me nothing to eat, I was thirsty and you gave me nothing to drink, I was a stranger and you did not invite me in, I needed clothes and you did not clothe me, I was sick and in prison and you did not look after me.’
“They also will answer, ‘Lord, when did we see you hungry or thirsty or a stranger or needing clothes or sick or in prison, and did not help you?’ “He will reply, ‘Truly I tell you, whatever you did not do for one of the least of these, you did not do for me.’ “Then they will go away to eternal punishment, but the righteous to eternal life.” -JESUS

PLEASE BE ON GUARD: when you hear a government official use a passage like Romans 13 to try to justify actions that contradict the commandments of Jesus Himself, it is akin to a lawyer trying to convince a judge that a policy or regulation should be followed even though a statute or the Constitution of the United States itself prohibits it. Oh wait, that is exactly what is happening in the Jeff Sessions video above. The United States has ratified international refugee treaties legally obliging our nation to consider the claims of each asylum-seeker on its own merit and the Attorney General has now created his own self-indulging policy persecuting asylum seekers as a “deterrent” to seeking the protection they are legally entitled to. Laws trump policies in the hierarchy of authority, and Jesus’ words trump unjust government action in the spiritual context.

So please join me in calling BS on policies that oppress the immigrant, the refugee, and the foreigner. No citation to Romans 13 can ever trump Jesus’ calling to love the immigrant in Matthew 25. I stand with Jesus-followers and non-Christians alike in the disgusted renunciation of any attempt to cite Holy Scripture as a justification to oppress the weak or the vulnerable. I proudly stand with Jesus and will continue to defend the “stranger” in my law practice as an act of worship to my Jesus who I know loves and cares for them even more than I do.

Attorney General Jeff Sessions displayed an appalling lack of appreciation for the religious establishment clause, not to mention simple human dignity. Speaking to a meeting of the U.S. Conference of Catholic Bishops, and in the wake of the Church’s condemnation of the barbaric policy of separating children from their parents at the border, Sessions proclaimed: “Persons who violate the law of our nation are subject to prosecution. I would cite you to the Apostle Paul and his clear and wise command in Romans 13 to obey the laws of the government, because God has ordained them for the purpose of order. Orderly and lawful processes are good in themselves and protect the weak and lawful.” Later in the day, White House press secretary Sarah Huckabee Sanders repeated his religious admonition to obey the law.

This is horrifically objectionable on multiple grounds. First, he is a public employee and must uphold the First Amendment’s establishment clause. If Sessions wants to justify a policy, he is obligated to give a secular policy justification. (Citing the Bible — inaptly — to Catholic bishops who exercise their religious conscience in speaking out against family separation may be the quintessential example of chutzpah.) Second, he is a policymaker, in a position tochange a position that is inconsistent with our deepest values, traditions and respect for human rights. Third, the bishops were not advocating civil disobedience; they were objecting to an unjust law. Sessions is trying to use the Bible to squelch dissent.

We should point out that invoking this Biblical passage has a long and sordid history in Sessions’s native South. It was oft-quoted by slave-owners and later segregationists to insist on following existing law institutionalizing slavery (“read as an unequivocal order for Christians to obey state authority, a reading that not only justified southern slavery but authoritarian rule in Nazi Germany and South African apartheid”).

I’m no expert in Christianity, but the Rev. Martin Luther King Jr. was when he drafted his letter from the Birmingham jail:

Since we so diligently urge people to obey the Supreme Court’s decision of 1954 outlawing segregation in the public schools, at first glance it may seem rather paradoxical for us consciously to break laws. One may well ask: “How can you advocate breaking some laws and obeying others?” The answer lies in the fact that there are two types of laws: just and unjust. I would be the first to advocate obeying just laws. One has not only a legal but a moral responsibility to obey just laws. Conversely, one has a moral responsibility to disobey unjust laws. I would agree with St. Augustine that “an unjust law is no law at all.”

Now, what is the difference between the two? How does one determine whether a law is just or unjust? A just law is a man made code that squares with the moral law or the law of God. An unjust law is a code that is out of harmony with the moral law. To put it in the terms of St. Thomas Aquinas: An unjust law is a human law that is not rooted in eternal law and natural law. Any law that uplifts human personality is just. Any law that degrades human personality is unjust.

Sessions perfectly exemplifies how religion should not be used. Pulling out a Bible or any other religious text to say it supports one’s view on a matter of public policy is rarely going to be effective, for it defines political opponents as heretics.

The bishops and other religious figures are speaking out as their religious conscience dictates, which they are morally obligated to do and are constitutionally protected in doing. A statement from the conference of bishops, to which Sessions objected, read in part:

At its core, asylum is an instrument to preserve the right to life. The Attorney General’s recent decision elicits deep concern because it potentially strips asylum from many women who lack adequate protection. These vulnerable women will now face return to the extreme dangers of domestic violence in their home country. This decision negates decades of precedents that have provided protection to women fleeing domestic violence.

Reminding the administration of the meaning of family values, the bishops continued, “Families are the foundational element of our society and they must be able to stay together. While protecting our borders is important, we can and must do better as a government, and as a society, to find other ways to ensure that safety. Separating babies from their mothers is not the answer and is immoral.”

The Catholics are not alone. The administration’s vile policy has alarmed a wide array of faith leaders. The Southern Baptist Convention issued their own statement. It is quoted at length because it is so powerful:

WHEREAS, Every man, woman, and child from every language, race, and nation is a special creation of God, made in His own image (Genesis 1:26–27); and

WHEREAS, Longings to protect one’s family from warfare, violence, disease, extreme poverty, and other destitute conditions are universal, driving millions of people to leave their homelands to seek a better life for themselves, their children, and their grandchildren; and

WHEREAS, God commands His people to treat immigrants with the same respect and dignity as those native born (Leviticus 19:33–34Jeremiah 7:5–7Ezekiel 47:22Zechariah 7:9–10); and

WHEREAS, Scripture is clear on the believer’s hospitality towards immigrants, stating that meeting the material needs of “strangers” is tantamount to serving the Lord Jesus Himself (Matthew 25:35–40Hebrews 13:2); and

WHEREAS, Southern Baptists affirm the value of the family, stating in The Baptist Faith and Message that “God has ordained the family as the foundational institution of human society” (Article XVIII), and Scripture makes clear that parents are uniquely responsible to raise their children “in the training and instruction of the Lord” (Ephesians 6:4).  . . .

RESOLVED, That the messengers to the Southern Baptist Convention meeting in Dallas, Texas, June 12–13, 2018, affirm the value and dignity of immigrants, regardless of their race, religion, ethnicity, culture, national origin, or legal status; and be it further

RESOLVED, That we desire to see immigration reform include an emphasis on securing our borders and providing a pathway to legal status with appropriate restitutionary measures, maintaining the priority of family unity, resulting in an efficient immigration system that honors the value and dignity of those seeking a better life for themselves and their families; and be it further

RESOLVED, That we declare that any form of nativism, mistreatment, or exploitation is inconsistent with the gospel of Jesus Christ; and be it further

RESOLVED, That we encourage all elected officials, especially those who are members of Southern Baptist churches, to do everything in their power to advocate for a just and equitable immigration system, those in the professional community to seek ways to administer just and compassionate care for the immigrants in their community, and our Southern Baptist entities to provide resources that will equip and empower churches and church members to reach and serve immigrant communities. . . .

Rabbi David Wolpe dryly observed that “until 2018, I don’t believe any reader of the Bible has argued that separating families is rooted in the Bible, and if the Bible is about obeying the government, it is hard to understand what all those prophets were yelling at the kings about.” (Meanwhile, 26 Jewish organizations sent a letter condemning the policy to Sessions.)

Peter Wehner of the Ethics and Public Policy Center has written extensively on the role of religion in politics. “I would say that this is just the most recent, but also one of the most egregious, ways that those who call themselves Christians are disfiguring and discrediting their faith. They are living in an inverted moral world, where the Bible is being invoked to advance cruelty,” he said. “Rather than owning up to what they are doing, they are trying to sacralize their inhumane policies. They are attempting to harm children and then dress it up as Christian ethics.”

He added: “This shows you the terrible damage that can be done to the Christian witness when the wrong people attain positions of power. They subordinate every good thing to their ideology, twisting and distorting everything they must to advance their political cause. In this case, it’s not simply that an authentic Christian ethic is subordinate to their inhumane politics; it is that it is being thoroughly corrupted, to the point that they are using the Bible to justify what is unjustifiable.”

If the administration is embarrassed by a policy they are trying to insist is required by law (that is untrue, and I know the prohibition against lying is very biblical) they should change it. Trump and his aides need to stop shifting blame to other politicians, and stop telling Christians what their obligations are. Frankly, the lack of outrage from Trump’s clique of evangelical supporters on this issue is not simply unusual given the near-universal outrage in faith-based communities, but is a reminder that leaders of  “values voters” traded faith for the political game of power and access. As Wehner put it, “To watch the Christian faith be stained in this way by people like Jeff Sessions and Sarah Huckabee Sanders is painful and quite a disturbing thing to watch. I don’t know whether they realize the defilement they’re engaging in, but that’s somewhat beside the point. The defilement is happening, and they are leading the effort. It’s shameful, and it’s heretical.”

Remarkably, Sessions claims to be a Christian and a Methodist (although I can’t for the life of me find a speck of the actual kind, merciful, forgiving, teachings of Jesus Christ in any aspect of Sessions’s life, career, or actions). He’s one of the most “unChristian” people I’ve ever witnessed in American public life. And, I’ve seen some pretty bad actors, going all the way back to infamous Wisconsin GOP Senator Joe McCarthy! In his own way, Sessions is just as far removed from the true meaning of Christ’s teaching as his pagan, idolatrous boss, Trump.

At any rate, the Methodist Council of Bishops has joined other religious denominations in condemning Sessions’s policies of cruelty and child abuse.

WASHINGTON, D.C. — The Council of Bishops of The United Methodist Church is joining other faith organizations in a statement urging the U.S. government to stop its policy of separating immigrant families.

Below is the full statement signed by dozens of faith organizations. Bishop Kenneth H.  Carter, president of the Council of Bishops, signed on behalf of the Council.

FAITH LEADERS’ STATEMENT ON FAMILY SEPARATION 

Recently, the U.S. Administration announced that it will begin separating families and criminally prosecuting all people who enter the U.S. without previous authorization. As religious leaders representing diverse faith perspectives, united in our concern for the well-being of vulnerable migrants who cross our borders fleeing from danger and threats to their lives, we are deeply disappointed and pained to hear this news.

We affirm the family as a foundational societal structure to support human community and understand the household as an estate blessed by God. The security of the family provides critical mental, physical and emotional support to the development and wellbeing of children. Our congregations and agencies serve many migrant families that have recently arrived in the United States. Leaving their communities is often the only option they have to provide safety for their children and protect them from harm. Tearing children away from parents who have made a dangerous journey to provide a safe and sufficient life for them is unnecessarily cruel and detrimental to the well-being of parents and children.

As we continue to serve and love our neighbor, we pray for the children and families that will suffer due to this policy and urge the Administration to stop their policy of separating families.

No, Jeff Sessions, Separating Kids From Their Parents Isn’t ‘Biblical’

When he spoke to a law enforcement group in Indiana today, the attorney general of the United States was clearly angry about religious objections to his administration’s immigration policies. He may have had in mind incidents like this very important one this week (as notedby the National Catholic Reporter):

The U.S. bishops began their annual spring assembly by condemning recent immigration policies from the Trump administration that have separated families at the U.S.-Mexico border and threatened to deny asylum for people fleeing violence.

The morning session here began with a statement, but by its end escalated to numerous bishops endorsing the idea of sending a delegation to the border to inspect the detention facilities where children are being kept and even floating the possibility of “canonical penalties” for those involved in carrying out the policies.

Being a Protestant and all, Sessions has no fear of the kind of “canonical penalties” Catholic bishops might levy. But perhaps he is aware of an official resolution passed by his own United Methodist Church in 2008 (and reaffirmed in 2016), which reads in part:

The fear and anguish so many migrants in the United States live under are due to federal raids, indefinite detention, and deportations which tear apart families and create an atmosphere of panic. Millions of immigrants are denied legal entry to the US due to quotas and race and class barriers, even as employers seek their labor. US policies, as well as economic and political conditions in their home countries, often force migrants to leave their homes. With the legal avenues closed, immigrants who come in order to support their families must live in the shadows and in intense exploitation and fear. In the face of these unjust laws and the systematic deportation of migrants instituted by the Department of Homeland Security, God’s people must stand in solidarity with the migrants in our midst.

So Sessions decided he’d smite all these ninny-faced liberal clerics with his own interpretation of the intersection of Christianity and immigration:

In his remarks, Sessions hit back at the “concerns raised by our church friends about separating families,” calling the criticism “not fair or logical” and quoting scripture in his defense of the administration’s tough policies.

“Persons who violate the law of our nation are subject to prosecution. I would cite you to the Apostle Paul and his clear and wise command in Romans 13 to obey the laws of the government because God has ordained them for the purpose of order,” Sessions said. “Orderly and lawful processes are good in themselves and protect the weak and lawful.”

Those who are unacquainted with the Bible should be aware that the brief seven-verse portion of St. Paul’s Epistle to the Romans has been throughout the ages cited to oppose resistance to just about every unjust law or regime you can imagine. As the Atlantic’s Yoni Appelbaum quickly pointed out, it was especially popular among those opposing resistance to the Fugitive Slave Act in the run-up to the Civil War. It was reportedly Adolf Hitler’s favorite biblical passage. And it was used by defenders of South African Apartheid and of our own Jim Crow.

Sessions’s suggestion that Romans 13 represents some sort of absolute, inflexible rule for the universe has been refuted by religious authorities again and again, most quoting St. Augustine in saying that “an unjust law is no law at all,” and many drawing attention to the overall context of Paul’s epistle, which was in many respects the great charter of Christian liberty and the great rebuke to legalism in every form. Paul was pretty clearly rejecting a significant sentiment among Christians of his day: that civil authorities deserved no obedience in any circumstance.

Beyond that, even if taken literally, in Romans 13 Paul is the shepherd telling the sheep that just as they must love their enemies, they must also recognize that the wolf is part of a divinely established order. In today’s context, Jeff Sessions is the wolf, and no matter what you think of his policies, he is not entitled to quote the shepherd on his own behalf. Maybe those desperate women and men at the border should suck it up and accept their terrible lot in life and defer to Jeff Sessions’s idolatry toward those portions of secular immigration law that he and his president actually support. But for the sake of all that’s holy, don’t quote the Bible to make the Trump administration’s policies towards immigrant families sound godly. And keep St. Paul out of it.

Stephen Colbert Tells Jeff Sessions to Go Reread the Bible Before He Defends Trump’s Child Separation Policy

There’s nothing funny about the Trump administration’s policy of separating children from their parents at the border, which doesn’t make it an ideal topic for late night hosts. Stephen Colbert acknowledged that difficulty directly on The Late Show on Thursday night, explaining that he usually only addresses tragic stories on the show if everyone is already talking about them. But he’s willing to make an exception:

That’s my job: to give you my take on the conversation everyone’s already having. With any luck, my take is funnier than yours, or I would be watching you. But this story is different, because this is the conversation everybody should be having. Attorney General and man dreaming of legally changing his name to “Jim Crow” Jeff Sessions has instituted a new policy to separate immigrant kids from their parents at the border.

An estimated 1,358 children have been taken from their families so far, with some officials reportedly telling their parents that the children were being taken away for a bath, only to never return them. “Clearly, no decent human being could defend that,” said Colbert. “So Jeff Sessions did.”

Colbert, who is devoutly Catholic, especially took issue with Sessions quoting the bible—specifically, Romans 13, the same passage used to defend slavery in the 1840s—to justify the policy as morally acceptable. Colbert suggested that Sessions might want to go back and reread that bible, and quoted Romans 13:10 to him. “Love your neighbor as yourself. Love does no harm to a neighbor. Therefore love is the fulfillment of the law,” he recited, before ripping into Sessions’s use of the bible as a smokescreen: “I’m not surprised Sessions didn’t read the whole thing. After all, Jesus said, ‘Suffer the children to come unto me’ but I’m pretty sure all Sessions saw was the words children and suffer and said ‘I’m on it.’”

Colbert concluded the segment by borrowing a phrase from Samantha Bee: “If we let this happen in our name, we are a feckless … country.”

I am very concerned about our relationship, Jeff.

For I was hungry Jeff, and you gave me nothing to eat.

I was thirsty, Jeff, and you gave me nothing to drink.

I needed clothes, Jeff, and you clothed me only in the orange jumpsuit of a prisoner.

I was sick and in a foul prison you called “detention,” Jeff, and you mocked me and did not look after me.

I said “suffer the children to come unto me,” Jeff, and you made my children suffer.

In your arrogant ignorance, Jeff, you might ask when did I see you hungry or thirsty or a stranger or needing clothes or sick or in prison, and did not help you?’

But, Jeff, I was right there before you, in a caravan with my poor sisters, brothers, and children, having traveled far, seeking shelter and refuge from mistreatment and expecting mercy and justice under your laws. But, in your prejudice and ignorance, Jeff, you did not see me because I did not look like one of you. For you see, Jeff, as you did not show love, mercy, forgiveness, kindness, and human compassion for the least of my children, you did not do for me.

And so, Jeff, unless you repent of your wasted life of sins, selfishness, meanness, taking my name and teachings in vain, and mistaking your often flawed view of man’s laws for my Father’s will, you must go away to eternal punishment. But, the poor, the vulnerable, the abused, and the children who travel with me and those who give us aid, compassion, justice, and mercy will accompany me to eternal life.

For in truth, Jeff, although you yourself might be immoral, none of God’s children is ever “illegal” to  Him. Each time you spout such nonsense, you once again mock me and my Father by taking our names, teachings, and values in vain.

Wise up, Jeff, before it’s too late.

HON. JEFFREY CHASE: Speaking Out Against The “Notable Minority” Of U.S. Immigration Judges Who Demonstrated Bias Against Women & Asylum Seekers – “Think about that: some federally appointed immigration judges cheered the fact that women who had been violently raped and beaten in their country can no longer find refuge here, and will be sent back to face more violence, and possibly death. Will there be any consequences for their actions? Were the many outstanding immigration judges who have been proud to grant such cases in the past, who were saddened and sickened by this decision, able to openly jeer or weep or curse this decision? Or would that have been viewed as dangerous?”

Women Need Not Apply

Those looking for legal analysis should read no further.  The following is a cry from the heart.

The respondent’s personal nightmare began the year after her marriage.  For the next 15 years, she was subjected to relentless physical, sexual, and emotional abuse.

It is most apt that Donald Trump became president by beating a woman.  His campaign historically provoked millions to march in angry protest of his denigration of women on his first full day in office.

“The violence inflicted on [her] took many forms.  Her husband beat her repeatedly, bashing her against the wall and kicking her, including while she was pregnant.  He raped her on countless occasions.”

On Monday, Trump’s Attorney General announced that women who are victims of domestic violence should no longer be deemed to merit protection from our government in the form of political asylum.

Sessions’ action was shockingly tone deaf.  As the wonderful Rebecca Solnit wrote in her 2013 essay “The Longest War:” “We have an abundance of rape and violence against women in this country and on this Earth, though it’s almost never treated as a civil rights or human rights issue, or a crisis, or even a pattern.  Violence doesn’t have a race, a class, a religion, or a nationality, but it does have a gender.”  The year after Solnit wrote those words, our Department of Justice took a step in the right direction.  In recognizing domestic violence as a basis for asylum, our government was finally recognizing such gender-based abuse as a human rights issue, at least in the limited forum of immigration law.

“He also frequently threatened to kill her, at times holding a knife to her neck, and at other times brandishing a gun or, while she was pregnant, threatening to hang her from the ceiling by a rope.”  The above were supported by sworn statements provided by the respondents’ neighbors.

It is only very recently that our society has begun to hold accountable those who commit gender-based abuses against women.  #MeToo is a true civil rights movement, one that is so very long overdue.  In opposing such movement, Jeff Sessions is casting himself as a modern day George Wallace.  It bears repeating that no one, no one, was challenging the settled precedent that victims of domestic violence may be granted asylum as members of a particular social group.  When the precedent case was before the Board of Immigration Appeals, the Department of Homeland Security, i.e. the enforcement agency prosecuting the case, filed a brief in which it conceded that the group consisting of “married women in Guatemala who are unable to leave their relationship” satisfied all of the legal criteria, and was therefore a proper particular social group under the law.  No one has appealed or challenged that determination in the four years since.  Who is Jeff Sessions, who has never practiced immigration law in his life, to just toss out such determination because he and only he disagrees?

The respondent’s “husband controlled, humiliated, and isolated her from others.  He insulted her ‘constantly,’ calling her a ‘slut’ or ‘dog.’  He did not want her to work outside the house and believed ‘a woman’s place was in the home like a servant.’  When he came home in the middle of the night, he forced her out of bed to serve him food, saying things like ‘Bitch, feed me.”

Like Wallace before him, who in 1963 stood in front of the door of the University of Alabama trying in vain to block the entry of four black students, Sessions is trying to block a national movement whose time has come.  As with Wallace and the Civil Rights Movement, justice will eventually prevail.  But now as then, people deserving of his protection will die in the interim.

The AG’s decision was intentionally released during the first day of the Immigration Judges’ Training Conference.  There have been ideological-based appointments of immigration judges under both the Trump and Bush administrations.  Several persons present at the conference reported that when the decision was announced, some immigration judges cheered. It was definitely a minority; the majority of immigration judges are very decent, caring people.  But it was more than a few; one of my sources described it as “many,” another as “a noteworthy minority.”

Think about that: some federally appointed immigration judges cheered the fact that women who had been violently raped and beaten in their country can no longer find refuge here, and will be sent back to face more violence, and possibly death.  Will there be any consequences for their actions?  Were the many outstanding immigration judges who have been proud to grant such cases in the past, who were saddened and sickened by this decision, able to openly jeer or weep or curse this decision?  Or would that have been viewed as dangerous?

The respondent “believes her life will be in danger” if returned to her country, “where her ex-husband, supported by his police officer brother, has vowed to kill her.  She does not believe there is anywhere” in her country “she could find safety.

Victims of domestic violence will continue to file applications for asylum.  They will argue before immigration judges that their claims meet the legal criteria even under the AG’s recent decision.  Unfortunately, some of those applicants will have their cases heard by immigration judges who, when they heard that the woman whose claim was described in the italicized sections was denied asylum by Jeff Sessions, and will now likely be deported to suffer more such abuse or death, cheered.

The sections in italics are the facts of the asylum-seeker in Matter of A-B-, (including quotes from her appeal brief) who was denied asylum on Monday by Jeff Sessions.

Look no further to understand why the U.S. Immigration Courts have been struggling for years with issues of quality control, bias, prejudice, and un-judicial conduct. That’s notwithstanding that the vast majority of us were working hard to be “honest referees,” set good examples, and treat those coming before us with dignity, respect, fairness, and humanity. A few colleagues who “don’t get the message” or who operate in a “parallel universe” actually bring the whole system into disrepute and undermine the efforts of those functioning as fair and independent judges.
And, make no mistake about it, Jeff Sessions aims to institutionalize bias, disrepute, and “worst judicial practices.” He’s designing a system that will reward scofflaws like him while punishing and forcing out judges who conscientiously adhere to their oath to put Due Process first! Look at what’s happening in the rest of the DOJ under Sessions, as talented and conscientious career attorneys are being displaced by political hacks with law degrees.
Following A-R-C-G-, the BIA, an inherently conservative tribunal if ever there was one, had made some modest progress in reigning in the minority of Immigration Judges who historically had anti-asylum attitudes, particularly toward women from the Northern Triangle. Sessions intentionally derailed such efforts and gave ugly encouragement to judges to “do whatever is necessary” to deny virtually all PSG claims that have provided refuge for Central Americans.
An independent U.S. Immigration Court with a strong and diverse Appellate Division and a merit selection system for judges supervised by the Article III Courts would be a necessary initial step in correcting these defects while establishing a system that will fairly and efficiently decide cases — without “bogus gimmicks” like trying to block access to entire groups of migrants, intentionally blocking access to counsel, using the court system as a “deterrent,” or using cruel, inhuman, and degrading detention practices to duress migrants into surrendering their already limited rights.
Eventually, as Jeffrey says, Sessions’s White Nationalist program of “turning back the clock” for women of color and other asylum seekers will fail. The current “Rogue State,” will be replaced by a Government re-committed to Due Process for all, regardless of status, and to re-establishing the U.S. as a leader in promoting and respecting international standards for refugee protection.
Inevitably, many, including defenseless women and children, will die unnecessarily, be tortured, and suffer other unspeakable human rights abuses during our struggle to end the “Trumpist Rogue State” and re-establsh the principles of liberal democracy and humanitarian international leadership in the United States. While such deaths and human rights abuses might be an inevitable result of the abusive reign of Trump and Sessions, nobody, particularly those claiming to be fair and impartial judges, should cheer or glory in that obscene result!

On Monday, President Donald Trump made it clear: He was not answerable to any law, constitutional or otherwise. “I have the absolute right to PARDON myself,” he tweeted. His attorney, Rudy Giuliani, even said that Trump could shoot former FBI Director James Comey in the Oval Office and, legally, be in the clear.

Many were stunned. They shouldn’t have been.

The rule of law has been under siege for a long time. Most Americans haven’t noticed because it appeared that they weren’t directly affected, and that the system worked. But African Americans have lived with the reality of abuse of power and contempt for the law for generations. For more than a century, each lynching, each murder, each ethnic cleansing, each wink, wink, nod, nod “not guilty,” especially in the face of overwhelming evidence, loosened and discredited the norms of a law-abiding society and put American democracy in Trump’s crosshairs.

That is what should stun so many who are now apoplectic about his threat. The destruction of the rule of law has actually been going on for a long, long time.

In 1918, Walter White, the associate secretary of the National Association for the Advancement of Colored People, futilely demanded that Georgia’s governor bring to justice the known killers of Mary Turner, who had lived near Valdosta. Turner, eight-months pregnant at the time of her murder, was stripped naked, hanged upside down and burned to death; her stomach was cut open to let her baby fall to the ground and its head was stomped into the red Georgia dirt. Her murderers never spent a day in jail.

In 1921, whites burned and bombed black Tulsa, Oklahoma, to the ground, destroying a thriving, vibrant community and killing up to 300 African Americans. One photo of the destruction happily proclaimed “running the Negro out of Tulsa.” Pleas from Walter White went unheeded. As did the 21st-century work of Harvard law professor Charles Ogletree, who attempted to wrench from the warped system some semblance of justice for the surviving victims. Over the span of more than 80 years, though, despite the carnage and the destruction, the lawyers, the politicians and the courts couldn’t fathom that any law had been broken.

In 1951, Florida Sheriff Willis McCall, who saw himself as the alpha and omega of the law in citrus-growing Lake County, was determined to stem the tide of liberalism that appeared to be encroaching on his world. He loved running slave labor camps for the growers. He loved having interracial couples taken into the woods and savagely beaten by his deputies. And he loved putting “uppity” Negroes in their place. When a white woman falsely accused several black men of rape, he was ready for their execution, until the U.S. Supreme Court ordered a new trial. An angry McCall then drove two of the men into the woods and gunned them down. One survived to tell the grisly story of murder and attempted murder. McCall, however, as I previously wrote in LitHub, “kept his job for twenty-one additional years until he finally lost a re-election bid (but was found ‘not guilty’) after bludgeoning yet another black man to death.”

As the deaths in Valdosta, Tulsa, and Florida make clear, the rule of law, one of the bedrocks of American democracy, was brutally and willfully trampled on, then dismissed. The justice system looked at the killers ― sheriffs, deputies, store owners, salesmen, and farmers ― and saw nothing untoward, nothing villainous, nothing murderous. Nothing except white respectability.

Even the incredible power of the Civil Rights Movement and the seismic transformation of American society couldn’t shake that reality and make the rule of law viable.

In 1969, the Chicago Police Department, aided by the FBI, raided the apartment headquarters of Black Panther Fred Hampton, killing him and fellow Panther Mark Clark, and seriously wounding four others. The next day the Cook County state’s attorney, Edward V. Hanrahan, told the tale of a massive gun battle in which the Panthers opened fire, their shotguns blasting through the door. In this retelling, the police had no choice but to defend themselves with deadly force. Hanrahan pointed to pictures of bullet holes that riddled the small apartment, leaving plaster and wood looking like dirty Swiss cheese.

There was just one problem: It was all a lie. He and 13 other members of law enforcement made it all up to obstruct an investigation into the killings. Forensic specialists proved that the first shot was in fact fired by police, followed by an errant bullet from Mark Clark, and then a volley of nearly 100 police shots raining into the small first-floor apartment. Yet, for blatantly lying about a double murder, Hanrahan and other members of law enforcement were found “not guilty,” and walked away.

This isn’t ancient history or living in the past. This is the condition of justice and the rule of law right now. It was apparent when four NYPD officers fired 41 shots at unarmed Amadou Diallo in 1999 and were found “not guilty” of any wrongdoing. And when George Zimmerman walked out of court a free man, although the unarmed teenager, Trayvon Martin, whom he had stalked through the neighborhood with a loaded 9 mm in 2013, lay dead with a bullet in his heart. And when 12-year-old Tamir Rice… when 7-year old Aiyana Stanley Jones… when Jonathan Ferrell… when Philando Castile

This willingness on the part of court systems, law enforcement and the respectable folk in society to ignore or explain away egregious violations of the law has consequences beyond the black lives it ruins. Eventually, rampant but selective disregard for the rule of law taints and corrupts the entire system ― it leads to a culture of impunity. Trump’s recent boast makes clear that lawlessness can’t be contained to cops on the ground killing black people.

Nevertheless, many whites believed for so long that they were safe; that this contempt didn’t and couldn’t affect them. They were wrong. A culture of impunity is dangerous and seductive. It creates a heady sense of immunity ― so heady that a presidential candidate can brag that he could shoot someone on Fifth Avenue in New York and not lose a single vote. Trump is already in the habit of circumventing procedures without consequence, having pardoned Joe Arpaio, a known torturer who defied a federal court order. He also pardoned I. Lewis ”Scooter” Libby, who was convicted of outing a CIA agent and lying to federal authorities about it. Just last week, he pardoned Dinesh D’Souza, a blatant racist and anti-Semite who used straw donors to make illegal campaign contributions.

Trump now insists that he has more pardons in his pocket, including one for himself, for whatever crimes he may or may not have committed. The president of the United States, a man long accustomed to circumventing the rules that apply to most other people, looks around and sees a system that hasn’t deigned to hold the powerful accountable.

And so, he declares that he might make himself president for life, and appears to exchange U.S. national security for some Chinese trademarks for his daughter, and rails against “fake news” and calls the media “the enemies of the American people,” and attacks the Department of Justice and special counsel Robert Mueller because they won’t do his bidding. When he does those stunning-to-some things, remember that this unrelenting assault on the rule of law is just another version of the same contempt for the nation’s statutes and American democracy that left Mary Turner hanging upside down, disemboweled and burning.

The canary in the American mine is once again gasping for breath. The air is toxic and the poison of lawlessness is likely to take us all down. Maybe this time America will listen.

The White Nationalist approach to the Constitution and law has been with us since the founding of our republic (by a group that contained many slaveholders, smart enough to know that slavery was wrong but too corrupted by it to do the right thing).

But, Trump is more than a “garden variety” racist/White Nationalist (that’s Jeff Sessions, Tom Cotton, Stephen Miller, etc.). He is a dangerous, lawless, “populist” authoritarian in the Mussolini mold. Although many of Trump’s supporters don’t recognize it, they and their rights will be “expendable” at his pleasure.

That leaves it to the rest of us (who actually are the majority of Americans) to save folks from Trump and, in far too many cases, from themselves and their short-sighted prejudices and selfishness. It’s a tall order; but the  alternative is the end of our republic and a descent into the worst type of authoritarian dystopia.

FACED WITH PREDICTABLE FAILURES OF “GONZO” IMMIGRATION POLICIES, TRUMP DOUBLES DOWN ON RACISM — “Browning Of America,” Hispanic Americans, Real Targets Of The “New Jim Crow!”

Leaving aside Trump’s rather Germanic approach to capitalization, that tweet is an occasion to paraphrase Mary McCarthy’s famous quip about Lillian Hellman: Virtually every word is a lie, including “and” and “the.” Democrats repeatedly offered to deal on DACA, as did Trump. No newcomers could possibly “get onto the DACA bandwagon,” because only immigrants who were brought here before 2007 were eligible. And immigrants are less likely to commit crimes than native-born citizens.

Why such a frenzy of untruth? Because Trump apparently sees anger building among his most fervent supporters over his utter failure to deliver on what they understood as his central campaign promise: to halt or reverse the flow of Latino immigration and the “browning” of America.

That’s what this is really about. On the emotional level, Trump appealed to white Anglo chauvinism. He skillfully stoked the anger and resentment of those who are annoyed when they phone the electric company to straighten out a bill and are told to press 1 for English, press 2 for Spanish. When he writes things like “our country is being stolen,” it’s crystal-clear who’s supposed to be stealing it.

What I didn’t realize during the campaign was that Trump’s base realized he could never fulfill his absurd pledge to deport all of the estimated 11 million people who are here without papers. But his supporters did expect him to do something to stem what they see as an invasion — something concrete and unambiguous. Like the promised wall.

White nationalism, racism, voter suppression, environmental destruction, rewarding fat cats, punishing ordinary folks and “enemies,” unnecessary trade wars, loss of international standing and leverage, destruction of honest government, war on public education, lies, immorality, greed, unethical behavior, those are what Trump and today’s sick GOP stand for. Kareem Abdul-Jabbar is known as one of the greatest basketball players in history. During his 20-year professional career with the Milwaukee Bucks and Los Angeles Lakers, he appeared in 19 All-Star Games, won six championships and collected six MVP awards. In retirement, he has become a prominent cultural commentator and writer, a leading voice on the intersection between sports and politics. Recently, he published a memoir about his collegiate career at UCLA, Coach Wooden and Me: Our 50-Year Friendship On and Off the Court.

Fifty years ago he was the most dominant college basketball player America had ever seen. Between 1967 and 1969, he led UCLA to three consecutive national titles and an 88-2 record. Yet, his legacy transcends the game; in the age of Black Power, he redefined the political role of black college athletes. In 1968, when black collegians debated boycotting the Olympics, Lew Alcindor, as he was then still known, emerged as the most prominent face in the revolt on campus.

Why did Alcindor refuse to play in the Olympics? To answer that question we have to return to Harlem, New York, in July 1964, the first of many long, hot summers.

The death of James Powell, a 15-year-old black youth from the Bronx, outraged Alcindor. On a sweltering July day in 1964, outside an apartment building on Manhattan’s Upper East Side, Lt. Thomas Gilligan, a white off-duty cop, shot and killed James, piercing the ninth-grader’s chest with a bullet from a .38 revolver. Conflicting accounts grayed a story that many saw in black and white. Gilligan, a 37-year-old war veteran, claimed that James charged at him with a knife, but bystanders insisted that James was unarmed.

Two nights later, on July 18, in the heart of Harlem, a peaceful rally organized by the Congress of Racial Equality (CORE) turned into a march against police brutality. Demanding justice for Powell, hundreds of demonstrators surrounded the 123rd Street precinct, some threatening to tear the building apart “brick by brick.” Incensed by decades of racial profiling and violent policing, the angry crowd began hurling rocks and bottles at officers. Suddenly, a scuffle broke out and the cops rushed the protesters, cracking their nightsticks against a swarm of black bodies. In a matter of minutes, violence spread through Harlem like a grease fire in a packed tenement kitchen.

That same night, Alcindor, an extremely tall, rail-thin 17-year-old, emerged from the 125th Street subway station, planning to investigate the CORE rally. Climbing up the steps toward the street, he could smell smoke coming from burning buildings. Angry young black men took to the streets and tossed bricks and Molotov cocktails through store windows. Looters grabbed radios, jewelry, food and guns. The sound of gunshots rang like firecrackers. Trembling with fear, Alcindor worried that his size and skin color made him an easy target for an angry cop with an itchy trigger finger. Sprinting home, all he could think about was that at any moment a stray bullet could strike him down.

“Right then and there, I knew who I was, who I had to be. I was going to be black rage personified, Black Power in the flesh.”

For six days, Harlem and Bedford-Stuyvesant burned. The “Harlem race riots” resulted in 465 arrests, hundreds of injuries and one death. When the smoke cleared, Martin Luther King Jr. visited New York and encouraged black residents to demonstrate peacefully. But Alcindor, like many black youths, had grown impatient with King’s pleas for nonviolence and began questioning the direction of the civil rights movement. That summer, writing for the Harlem Youth Action Project newspaper, he interviewed black citizens who were tired of segregated schools, dilapidated housing, employment discrimination and wanton police violence.

The Harlem uprising fueled his anger toward white America and convinced him more than ever that he had to turn his rage into action. “Right then and there, I knew who I was, who I had to be,” he said a few years later. “I was going to be black rage personified, Black Power in the flesh.” Silence was no longer an option. In the future, he vowed, he would speak his mind.

A few days after UCLA beat Dayton for the national title, the NCAA’s National Basketball Committee banned the dunk. The committee argued that too many players got injured stuffing the ball through the hoop or trying to block a player attacking the basket. Coaches were concerned, too, about players breaking backboards and bending rims. Curiously, the committee also claimed, “There is no defense against the dunk, which upsets the balance between offense and defense.” But the truth was that Alcindor threatened the sport’s competitive balance. He upset the balance between offense and defense.

Immediately, critics deemed the dunk ban the “Alcindor rule.” In a time of white backlash against black advancement, the UCLA star interpreted the rule through the lens of race. He could not help but feel like the lily-white committee had targeted him. “To me the new ‘no-dunk’ rule smacks a little of discrimination,” he told the Chicago Defender. “When you look at it … most of the people who dunk are black athletes.

Not even the dunk ban could stop Alcindor from dominating the game. In fact, the new restriction made him even better. It forced him to expand his offensive arsenal and develop a devastating signature move: the “skyhook.”

He made it look so easy. With the cool confidence of Miles Davis, Alcindor transformed his game. The skyhook became an innovative expression of individuality and empowerment, a reflection of his intelligence and creativity, an active mind that could see the ball falling through the net like a raindrop the moment the leather sphere touched his fingertips. Over and over again, he pivoted toward the basket, extended his arm toward the sky and gracefully flipped the ball over the outstretched arms of any player who dared to guard him. “Of all the weapons in sports,” Sports Illustrated’s Gary Smith wrote of his skyhook, “none has ever been more dependable or unstoppable, less vulnerable to time, than that little stride, turn, hop and flick from far above his head.”

Alcindor refused to let the white world define him as a basketball player and as a man. He no longer considered himself a “Negro.” He was black and proud. As he became more politically self-aware, he identified with the most successful, outspoken black professional athletes in America: Muhammad Ali, Bill Russell and Jim Brown. He admired their political activism and their courage to confront white supremacy.

Alcindor suddenly found himself at the center of a national controversy. Critics called him a disgrace, unpatriotic and much worse. If he did not play for the U.S. Olympic team, then UCLA should revoke his scholarship, they charged. Many white Americans opposed the boycott because they believed that sports were meritocratic and immune to racism. But their objections also revealed discomfort with assertive black athletes who challenged the power structure of American sports, a plantation culture that valued black bodies more than black minds. New York Times columnist Arthur Daley couldn’t imagine Alcindor thinking for himself and suggested that Edwards was exploiting the UCLA star’s fame for personal gain. “I think that charge is sheer idiocy,” Edwards told the San Jose Mercury News. “How can you manipulate anybody like Lew Alcindor?”

But Alcindor was his own man, and his revolt emanated from the deep history of African-American activism and the burgeoning Black Power movement on campus. What the sports establishment failed to recognize was that his experience in Harlem, his identification with Malcolm X and his connection to Ali had transformed the way he viewed protest, patriotism and American sports. How could he stay silent while police brutality, poverty and prejudice afflicted the black community? How could anyone expect him to represent the United States when the moment he confronted the nation’s racism bigots deluged him with hate mail and death threats? How could they expect him to love America when America didn’t love him back?

Alcindor had made up his mind. He wouldn’t play for the USA. Although the boycott movement lacked widespread support and ultimately stalled, he and his UCLA teammates Mike Warren and Lucius Allen refused to attend the Olympic trials. His explanation, however, complicated his image as a Black Power hero. Alcindor said that if he participated, then he would miss class and delay his graduation, which was true, but only part of his rationale. He also told a reporter from Life magazine that he and his UCLA teammates “don’t want to get caught in the middle of anything.” He had principles, but discussing them publicly only brought more stress. It was much easier to distance himself from Edwards and the OPHR.

“Yeah, I live here, but it’s not really my country.”

In the summer of 1968, he worked for Operation Sports Rescue, a youth program in New York City. Leading basketball clinics, Alcindor mentored African-American and Puerto Rican youths, encouraging them to get an education. In July, he appeared on NBC’s Today show to promote the program. Co-host Joe Garagiola, a former professional baseball player, began the interview by asking Alcindor why he refused to play in the Olympics. During a heated exchange, Alcindor said, “Yeah, I live here, but it’s not really my country.” Then Garagiola retorted, “Well, then, there’s only one solution, maybe you should move.” It was a common reply among white Americans who demanded accommodation and gratitude from black athletes — a refrain that still exists today.

Alcindor’s comments echoed Malcolm X, who said, “Being born here in America doesn’t make you an American.” If black people were Americans, he argued, then they wouldn’t need civil rights legislation or constitutional amendments for protection. Alcindor recognized that while he was fortunate because of his basketball ability, he couldn’t celebrate his privileged status as long as racial inequality persisted. Only when black citizens enjoyed true freedom could he call America his country.

Although we remember the 1968 Olympics for John Carlos and Tommie Smith’s demonstration on the victory stand, Alcindor was the most famous athlete who avoided the games. More than any other college basketball player, he defined his times, proving also that black athletes could speak their minds and win. No one could tell him to shut up and dribble.

Professor is the Julius C. “Bud” Shaw Professor of Sports, Society, and Technology and an Assistant Professor of History at Georgia Tech. His research focuses on the history of sports and American culture. He is an author whose books include “The Sons of Westwood: John Wooden, UCLA, and the Dynasty That Changed College Basketball,” which explores the emergence of college basketball as a national pastime and the political conflicts in college athletics during the 1960s and 1970s.

But, Cathy and I once were fortunate enough to see him “live” as a contestant on “Celebrity Jeopardy” at DAR Constitution Hall in Washington DC, ironically a venue where he once would not have been welcome.

CHRIS HAYES @ NYT: “RULE OF LAW” IS A RACIST CODE USED BY TRUMP, SESSIONS, & THE GOP!

Donald Trump is not subtle. While normal political language functions through implication and indirection, Mr. Trump luxuriates in saying the quiet part loud. But in doing so, Mr. Trump exposes what drives the politics of the movement he commands. That is most evident in the way he talks about crime and punishment.
No president since Richard Nixon has embraced the weaponized rhetoric of “law and order” as avidly as Mr. Trump. “When I take the oath of office next year, I will restore law and order to our country,” he said during his acceptance speech at the Republican National Convention in 2016. “I will work with, and appoint, the best prosecutors and law enforcement officials in the country to get the job properly done. In this race for the White House, I am the law and order candidate.”
Time and again, the president denounces “illegals” and “criminals” and the “American carnage” they wreak on law-abiding Americans. He even advised an audience of police officers to rough up suspects they were arresting.
Yet this tough-guy stance disappears when the accused are in the president’s inner circle. In defending Rob Porter, the White House senior aide accused of abuse by both of his ex-wives, the president wondered whatever happened to due process while praising a man accused of giving his wife a black eye. (Mr. Porter denies the abuse.)
It’s no surprise that Mr. Trump’s critics pounced. Where was this concern for due process, they asked, when the president and his supporters chanted “Lock her up” about Hillary Clinton, who hadn’t even been formally accused of a crime? Where was his devotion to due process when he called for the Central Park Five to be executed, and then, after their exoneration, still maintained that they were guilty?
As tempting as it is to hammer Mr. Trump for his epic hypocrisy, it is a mistake. The president’s boundless benefit of the doubt for the Rob Porters and Roy Moores of the world, combined with off-with-their-heads capriciousness for immigrants accused of even minor crimes, is not a contradiction. It is the expression of a consistent worldview that he campaigned on and has pursued in office.
In this view, crime is not defined by a specific offense. Crime is defined by who commits it. If a young black man grabs a white woman by the crotch, he’s a thug and deserves to be roughed up by police officers. But if Donald Trump grabs a white woman by the crotch in a nightclub (as he’s accused of doing, and denies), it’s locker-room high jinks.
This view is also expressed by many of the president’s staff members, supporters and prominent allies. During the same week that the White House chief of staff, John Kelly, repeatedly vouched for Rob Porter’s integrity, Mr. Kelly also mused that hundreds of thousands of unauthorized immigrants who did not fill out the paperwork for DACA protections had refused to “get off their asses.”
A political movement that rails against “immigrant crime” while defending alleged abusers and child molesters is one that has stopped pretending to have any universalist aspirations.
This is the opposite of what we like to tell ourselves is the traditional American civic creed: one symbolized by a blindfolded Lady Justice who applies the law without fear or favor to whoever may come before her. It is one of Mr. Trump’s most insidious victories that he has given his supporters permission to drop any pretense of insisting that their actions and views should conform to this principle.
If all that matters when it comes to “law and order” is who is a friend and who is an enemy, and if friends are white and enemies are black or Latino or in the wrong party, then the rhetoric around crime and punishment stops being about justice and is merely about power and corruption.
And this is what “law and order” means: the preservation of a certain social order, not the rule of law. It shouldn’t have taken this long to see what has always been staring us in the face. After all, the last president to focus so intensely on law and order, Richard Nixon, the man who helped usher in mass incarceration, was also the most infamous criminal to occupy the Oval Office. The history of the United States is the story of a struggle between the desire to establish certain universal rights and the countervailing desire to preserve a particular social order.
We are now witnessing a president who wholly embraces the latter. America can have that kind of social order, or it can have justice for all. But it can’t have both.

Yup. Probably the most lawless Administration in history, certainly in my lifetime, disingenuously throws around the term “Rule of Law” all the time.

“The president’s moral framework springs from an American tradition of cultivating fear and contempt among its white citizens against immigrants, indigenous people and people of color, who are placed on the other side of “the law.” It’s a practice that has taken on new strength at a time when many white people fear they may be outnumbered, outvoted and out of time.”

But, the good news is that those of us who actually believe in the “REAL Rule of Law” can unite and stand up to Trump, Sessions, Miller and the racist, White Nationalist movement. When we succeed, the “REAL Rule of Law” will actually be available to Trump and his followers on an equal basis with everyone else. And, for many of them, the fair application of the law to everyone in America, as required by the Due Process clause of our Constitution, could be bad news! Let the chips fall where they may.

Professors Linda R. Tropp and Dina G. Okamoto write in The Guardian:

“For more than a century, the identity of the United States has been grounded in the notion that we are a “nation of immigrants.” Immigrants have made innumerable contributions to our economy, infrastructure, and culture – building our railroads and bridges, bringing innovation and new ideas, and settling in communities that thrive throughout our country today. But now, the United States Citizenship and Immigration Services (USCIS), a federal agency charged with immigrant affairs, has turned its back on this rich legacy.

As of last week, the mission statement of the USCIS has changed. No longer does its mission speak to “America’s promise as a nation of immigrants” that promotes “an awareness and understanding of citizenship” along with “ensuring the integrity of our immigration system.” Now, the new version focuses on “adjudicating requests for immigrant benefits” while “protecting Americans” and “securing the homeland”.

Why do changes to the USCIS’s mission statement matter? It may seem like just a few words, but this new language is happening within the context of other alarming changes to our national immigration policies and practices.

Refugee admissions have been curbed to a historic low, and people with “temporary protected status” who fled their homelands due to natural disasters or civil wars are being sent back.

Several crucial programs are at risk of being terminated, including programs that allow 50,000 people from countries underrepresented in current immigration streams to come to the US, pathways for those who arrived in the US as children without legal documents to remain in the US to work and attend school, and the family-based system of immigration – a cornerstone of US immigration policy – which allows US citizens to reunite with family members by sponsoring their migration to the US.

All of these changes have been presented under the guise of protecting against threats to our national security. But these policies stand in stark contrast to the will of the American people. Despite increased attention on anti-immigrant sentiments, Americans across the country largely embrace immigrants of all faiths and cultures and want our government to do the same.

Most Americans believe the numbers of immigrants coming to the United States should be kept at its present level or increased. And 60% percent of Americans oppose building a wall on our border with Mexico. Nearly three-quarters of Americans now supportgranting legal status to immigrants originally brought to the US without papers as children, driven by the same moral imperative that has guided family reunification efforts over the last 50 years.

These levels of endorsement in national polls are bolstered by the actions of US citizens from many walks of life who have taken to the streets in protest, boldly stating that “immigrants are welcome here”.

Indeed, across the country, people and communities have been sending the clear message that immigrants are not only welcomed, but valued. Hundreds of local governments have advocated for their cities and towns to be recognized as “welcoming cities” for immigrants.

Spanning from the industrial rust-belt of the midwest to our nation’s borders, civic leaders have gone to great lengths to welcome immigrants, because they open up new businesses, populate local schools, revitalize housing markets, and infuse new life into local communities. And while the majority of immigrants in the US are here legally, nearly 500 US cities have chosen to become “sanctuary cities” to protect immigrants without legal status from deportation, even at the risk of losing federal funding.

These actions by everyday Americans uphold our nation’s values and reflect the best of who we are as a country, while our federal immigration policies are seeking to close doors and build walls. One of the best ways to honor our values as a nation is not to close opportunities to immigrants, but to successfully integrate them into the fabric of our society. As researchers who have been studying immigration and race relations for 20 years, our research shows that one of the best ways to integrate immigrants into the fabric of society is to interact with and welcome them.

Such encouraging effects of contact between US citizens and immigrants are not limited to big cities or liberal-leaning areas. Recent immigrants have established themselves both in diverse urban areas and new destinations across the United States.

According to recent poll data, more than 75% of US adults report that there are immigrants living in their community, with about a quarter (27%) reporting many recent immigrants in the community where they live. Our surveys of US citizens, including both white and black Americans, show that the more they encounter and interact with immigrants, the more inclined they are to welcome them into their communities.

This significance of welcoming does not simply serve to express our national values or concern about immigrants and their wellbeing. Welcoming immigrants is also important for creating a shared sense of identity and community within our nation. Parallel surveys we have conducted with immigrants show that the more they feel welcome by Americans, the more they come to identify as American themselves and to seek to become US citizens – factors that can fuel greater civic participation and contributions to our society.

The recent barrage of exclusionary immigration policy proposals are attempts to sow the seeds of fear, anxiety, and distrust. Rather than pursue policies that set immigrants apart, we should seek to integrate immigrants and highlight the assets they bring to communities across our nation.

PROFESSOR DANIEL PENA — Supremes Anti-Latino Decision In Jennings v. Rodriguez Threatens The Due Process Rights of All Americans — When The Thugs Come for YOU, Who Will Stand Up For YOUR Rights If YOU Stand By While Others’ Rights Are Trashed?

“The U.S. Supreme Court ruling in Jennings v. Rodriguez on Tuesday is a bizarre and dark new development in the American experiment. Not only because it’s a breakdown of the court’s ability to properly interpret the constitution (as they formally institutionalize a de facto second class of citizens), but because it’s a dereliction of the court’s duty as a part of a system of checks and balances designed to protect the constitutional rights of people in this country, regardless of country of origin, from a tyrannical government that would subvert our founding document for political or racist ends.

This ruling only formalizes what many of us in the Latinx community have known for generations: that the perpetuation of systems and laws that instill fear in immigrants (detained or not) is a form of state-sponsored terror. Now the court is complicit and part of that terror. And as pathways to legal status for immigrants come under attack by the current administration, this kind of terror is increasingly designed to incarcerate people for no other reason than for their inability to access pathways toward legal status — which is how this ruling will likely be used by this current administration.

The court ruled in Jennings v. Rodriguez that all immigrants, even those with protected legal status or asylum seekers, do not have a right to periodic bond hearing after detention, which makes it possible for them to be detained indefinitely. The defendant, Alejandro Rodriguez, who was brought to the United States from Mexico as an infant and became a permanent legal resident, was detained for three years for joy riding and possession of a controlled substance; the ACLU was fighting for his right to a hearing.

It comes a day after another Supreme Court decision not to rule on the Obama-era Deferred Action for Childhood Arrivals program, which in effect leaves that program safe for at least another year. But while the ruling on DACA might give the impression of an impartial system of courts, the latter development undermines that illusion by giving this discriminatory Trump administration its seal of approval in the name of the law.

All three branches are now in sync with their consensus to terrorize detained immigrants, documented and undocumented alike. And the explicit message of this ruling against Rodriguez is that, no matter your legal status, the constitution does not work for you if you’re an immigrant. You can be extracted from the American fabric for seemingly arbitrary reasons, by virtue of that now-institutionalized second class status.

What we’ve seen is the majority of this court, our last branch of un-bought government, actively buying out of the idea of America as a melting pot, as a nation of immigrants who deserve certain unalienable rights, not unlike life, liberty and the pursuit of happiness.

This should be a wake-up call to anyone who thought (maybe still thinks) that they have nothing to fear because they are documented, or that they have nothing to fear because they’re not Latinx, or that they have nothing to fear because they are another type of immigrant, or they have nothing to fear because they’ve done nothing wrong. The ruling makes it possible to target, criminalize and then indefinitely detain someone for no other offense than being systematically denied a pathway toward legal status in the first place — or even if they did.”

I’ve pointed out before that it’s still not clear on what side of history this version of the Supremes stand. So far, as a group, they have shown little backbone or desire to stand up to the Trump Administrations’s all-out assaults on the Constitution, the “rule of law,” and human rights. That could be a big mistake, since the Trumpsters, to a man (not many women in the “land of misogyny”) have shown total disrespect and disdain for judges at all levels, particularly Federal Judges.

Latinos must get to the polls in larger numbers and “un-elect” at all levels a GOP that has largely gone over to a White Nationalist, anti-Latino racist agenda. Votes are power! That’s why the GOP cherishes voter suppression and gerrymandering so much.

A few weeks ago, the contours of an immigration compromise looked clear: Republicans would let the “dreamers” stay. Democrats would let Trump build his wall. Both sides would swallow something their bases found distasteful in order to get the thing their bases cared about most.Since then, Trump has blown up the deal. He announced on Wednesday that he would legalize the “dreamers,” undocumented immigrants brought to the U.S. as children, only if Democrats funded his wall and  ended the visa lottery and “chain migration.” He would support a path to citizenship for undocumented immigrants only if Congress brought the number of legal immigrants down.

There’s an irony here, which was pointed out to me by CATO Institute immigration analyst David Bier. Until recently, Republican politicians drew a bright line between illegal immigration, which they claimed to hate, and legal immigration, which they claimed to love. Florida Senator Marco Rubio launched his presidential campaign at the Freedom Tower, Miami’s Ellis Island. Texas senator Ted Cruz, who in 2013 proposed a five-fold increase in the number of H1B visas for highly skilled immigrants, declared in April 2015 that, “There is no stronger advocate for legal immigration in the U.S. Senate than I am.” Mitt Romney promised in 2007 that, “We’re going to end illegal immigration to protect legal immigration.”

Trump has turned that distinction on its head. He’s willing to legalize the “dreamers”—who came to the United States illegally—so long as the number of legal immigrants goes down. He has not only blurred the GOP’s long-held moral distinction between legal and illegal immigration. In some ways, he’s actually flipped it—taking a harder line on people who enter the U.S. with documentation than those who don’t.

What explains this? Trump’s great hidden advantage during the 2016 Republican presidential primary was his lack of support from the GOP political and donor class. This allowed him to jettison positions—in support of free trade, in support of the Iraq War, in support of cutting Medicare and Social Security—that enjoyed support among Republican elites but little support among Republican voters. He did the same on immigration, where the “legal good, illegal bad” distinction turned out to be much more popular among the party’s leaders than among its grassroots. Cribbing from Ann Coulter’s book, Adios America, Trump replaced the legal-illegal distinction with one that turned out to have more resonance on the activist right: The distinction between white Christian immigrants and non-white, and non-Christian ones.The words “illegal immigration” do not appear in Trump’s presidential announcement speech. Instead, Trump focused on immigrants’ country of origin. “When Mexico sends its people,” he declared, “they’re not sending their best … They’re sending people that have lots of problems, and they’re bringing those problems with us. They’re bringing drugs. They’re bringing crime. They’re rapists … It’s coming from more than Mexico. It’s coming from all over South and Latin America, and it’s coming probably—probably—from the Middle East.”

Trump, who often says bluntly what other Republicans say in code, probably realized that “illegal immigrant” was, for many voters, already a euphemism for Latino or Mexican-immigrants. In their book White Backlash, the political scientists Marisa Abrajano and Zoltan Hajnal cite a poll showing that 61 percent of Americans believe that most Latino immigrants are undocumented even though only about a quarter are. “When Americans talk about undocumented immigrants, Latinos or immigrants in general,” they note, “the images in their heads are likely to be the same.”

What really drove Republican opinion about immigration, Trump realized, was not primarily the fear that the United States was becoming a country of law-breakers. (Republicans, after all, were not outraged about the lack of prosecution of tax cheats.) It was the fear that the United States—which was becoming less white and had just elected a president of Kenyan descent—was becoming a third world country.When the Public Religion Research Institute and Brookings Institution asked Americans in 2016 their views of immigration from different parts of the world, it found that Republicans were only three points more likely than Democrats to want to reduce immigration from “predominantly Christian countries” and only seven points more likely to want to reduce immigration from Europe. By contrast, they were 33 points more likely to support reducing immigration from Mexico and Central America and 41 points more likely to support reducing immigration from “predominantly Muslim countries.” What really drives Republican views about immigrants, in other words, is less their legal status than their nation of origin, their religion, and their race.

Trump grasped that during the campaign, and in coalition with a bevy of current and former Southern Senators—Jeff Sessions, David Perdue and Tom Cotton—he has used it to turn the GOP into a party devoted to slashing legal immigration. On Thursday, when presented with a bill that traded the legalization of dreamers for more border security but did not reduce legal immigration, only eight Republican Senators voted yes. However, 37 voted for a bill that legalized the “dreamers,” added more border security and substantially reduced legal immigration.

But there’s another reason Trump has succeeded in erasing the “legal good, illegal bad” distinction that for years governed GOP immigration debate. He’s made Republicans less concerned with legality in general. In 2012, the GOP—which was then-outraged by executive orders that supposedly displayed President Barack Obama’s contempt for the constitutional limits of his office—titled the immigration section of its platform, “The Rule of Law: Legal Immigration.” The seven paragraph-section used variations of the word “law” fourteen times.That emphasis is harder now. In his ongoing battles with the FBI, Justice Department, judiciary and Special Counsel Robert Mueller, Trump has convinced many Republicans that the “rule of law” is often a cloak for the partisan biases of the “deep state.” As a result, Republicans are now 22 pointsless likely to hold a positive opinion of the FBI than they were in 2015.

What really matters for many Republicans in Trump’s standoff with Mueller and the FBI is not who has the law on their side, since the bureaucracy can twist the law to its own advantage. What really matters is who enjoys the backing of “the people,” the authentic America that resides outside the swamp, a construct that definitely does not include the imagined beneficiaries of “chain migration” and the “visa lottery.”

In the Trump era, Republicans now justify their immigration views less by reference to law than by reference to tribe. Which, not coincidentally, is how they justify Trump’s presidency itself.”

Marco Rubio has already seen the downside of trying to become a national force in the GOP by advocating a moderate, pro-business, pro-immigrant, not overtly anti-Hispanic policy. I suspect if and when Ambassador Nikki Haley tries to make a bid for national office in the GOP she’ll find out that the Miller-Sessions-Cotton-Perdue-King group and Trump supporters will treat her with the same disrespect, bias, and disdain that they usually reserve for smart, capable Latinas, children fleeing for their lives from the Northern Triangle, and “Dreamers.”

And folks like Sen. Tim Scott will find that even consistent support for a right-wing GOP that regularly disses African-Americans and Hispanics won’t give him “White Guy” status in the larger GOP world. A useful vote in the Senate. That’s about it. Reportedly, Scott once talked to Trump about the latter’s “tone” on race. How did that work out, Tim? But, hey, as long as you vote for big tax breaks for the wealthy, cuts in health care, and are happy to threaten the benefits, remaining dignity, and lives of the poor, you can at least retain your status a “club member at the retail level.”

Stuck on a shelf or locked in a safe, D.C.’s ‘Lost Laws’ still packed a punch

Martin Luther King Jr. said “the arc of the moral universe is long, but it bends toward justice.”

He could have added: “eventually, and after plenty of detours.”

In 1872 and 1873, two laws were passed in Washington that forbade racial discrimination in the city’s restaurants. Then, somehow, the laws vanished.

Just imagine the reaction when they were “rediscovered” in the 1940s. It must have been as if someone had opened a vault sealed when Ulysses Grant was president and found an airplane inside, a television, penicillin … .

Could Washingtonians from 70 years ago really have been so advanced? What had happened to those people?

What amazed me when I looked into the events of the 1870s and 1880s was how similar things were to the Jim Crow era. Restaurateurs used some of the same excuses for refusing to serve African Americans: Black customers were “boisterous,” white patrons would stay away, the government shouldn’t meddle.

To fight discrimination, black activists used methods that are familiar to us now. Lawyer E.M. Hewlett deliberately visited restaurants to see if he would be served. Hewlett looked to see if owners had posted price lists, as required by law to prevent black customers from being gouged. When he spotted a violation, he took the establishment to court.

In the end, none of it did any good. Why?

“During Reconstruction, D.C. was really on the leading edge of racial change in America,” said Chris Myers Asch, co-author, with George Derek Musgrove, of “Chocolate City: A History of Race and Democracy in the Nation’s Capital.”

Said Asch: “D.C. was a very progressive city. You had remarkable progress being made toward racial equality in a very brief space of time. Black men in D.C. were the first black men in the country to be granted the right to vote after the Civil War.”

Such efforts, Asch said, were a priority for radical Republicans in Congress.

“The backlash from white conservatives is really substantial,” Asch said. “First you eliminate self government all together in 1874. Then you slowly roll back those Reconstruction-era gains. This is part of a regionwide effort to enforce white supremacy. By 1901, when city commissioners decide to compile the D.C. Code, they simply don’t include those Reconstruction-era statutes.”

They didn’t include them, but they didn’t repeal them. The Lost Laws were not dead. They were like a long-dormant seed, ready to spring to life after a refreshing rain.

I don’t know who found them. Asch thinks it was A. Mercer Daniel, who oversaw the library at Howard University’s law school. They gained fame in 1948 with the publication of “Segregation in Washington,” a scathing report that mentioned the laws.

Civil rights activists wondered: Could the laws be used to fight segregation?

Annie Stein, a white woman from Southwest D.C. who was a member of the Progressive Party, invited Mary Church Terrell to chair the Coordinating Committee for the Enforcement of the D.C. Anti-Discrimination Laws of 1872 and 1873. When Terrell, the octogenarian co-founder of the NAACP, was denied service at a downtown cafeteria called Thompson’s in 1950, it set the stage for a test case.

District of Columbia vs. John R. Thompson Co. went first to the old Municipal Court, where Judge Frank Myers ruled that the Lost Laws had “been repealed by implication” and, thus, could no longer be enforced.

Terrell and company appealed. In May of 1951, the Municipal Court of Appeals ruled 2-to-1 that the anti-bias laws were still valid. Among the points raised by Judge Nathan Cayton was that another so-called lost law had been enforced in 1908, even though it, too, had been omitted from the 1901 D.C. Code.

It was an animal cruelty law. Animals, it seemed, had more rights than black Washingtonians.

The game of legal ping-pong continued. The next stop was the U.S. Court of Appeals. In a 5-to-4 decision, it ruled that the laws of 1872 and 1873 could not be enforced.

One judge, Barrett Prettyman, wrote the statutes were “neither mentioned again nor enforced for a period of 75 years.” Thus the laws “must be deemed by the courts to have been abandoned.”

If you’ve been reading my columns this week, you know that wasn’t true. African Americans did mention them and did try to get them enforced.

In April of 1953, the case finally reached the U.S. Supreme Court. Chester H. Gray of the District’s corporation counsel’s office asked the court not to blame his staff. They hadn’t known of the laws until someone found them in the corporation counsel’s safe.

“You mean you have to go to a locked safe to find laws of the District of Columbia?” Chief Justice Fred M. Vinson joked.

In June, the court ruled unanimously that the laws were still in effect. Laws passed by long-dead Washingtonians had helped their descendants.

Five days after the Supreme Court ruling, Terrell went to eat at Thompson’s with the mixed-race group who had been denied a meal three years earlier. They were treated, Terrell said, with courtesy.”

Sound all too familiar? It should! The claptrap coming from yesterday’s racists is pretty much the same as the garbage coming out of the mouths of some GOP pols these days. Here’s my “rewrite” of a paragraph of Kelly’s account in “today’s context.”

The backlash from Sessions, Bannon, Kobach, Miller and their White Nationalist pals to the diversification of America and growing political power of African-Americans, Hispanics and other non-Whites was substantial. First, they used gerrymandering and intentional mis-constructions of Civil Rights and Voting Rights statutes intended to protect minorities to instead suppress and minimize the minority vote. This is part to a nationwide effort by the far right to restore White Supremacy and prevent African-Americans and Hispanics from eventually obtaining political power commensurate with their demographics and overwhelming contributions to America. Then, when supposedly in charge of administering the laws equally, they simply refuse to recognize the rights of African-Americans to be free from police violence and the rights of Hispanics and asylum seekers in the United States to be treated with respect and dignity and to be given full Due Process under our Constitution. They even invent false narratives, bogus statistics, and demonize hard-working law-abiding citizens, residents, and great and deserving young people known as “Dreamers” in a desperate effort to restore exclusive White (preferably “pseudo-Christian”) power. To add insult to injury, they carry out this anti-American, anti-Constitutional campaign under the boldly false rubric of “Restoring the Rule of Law.”

Now let’s move over to the Post’s Sports Section. Here’s an account of what happened to courageous African-American athletes who stood up for their rights and the rights of others during the “glory days” of White Supremacy that Trump, Sessions, & Co. so cherish and honor.

Remembering the Orangeburg massacre, and the athlete-activists who took a stand

Robert Lee Davis found himself lying in blood next to his teammate Sam Hammond. At least one bullet had struck Davis in the back. Another went in Hammond’s neck.

Davis recalled in an oral history that Hammond, a running back at South Carolina State, asked him, “Do you think I’m going to live?” Davis, a linebacker, said he answered, “Sam, you are going to be all right, buddy.”

Hammond was the first of three young black men to die that night 50 years ago in Orangeburg, S.C. Davis was one of several football players at historically black South Carolina State to survive a hail of police fire with injuries.

What brought them together that Feb. 8, 1968, evening was not a team meeting or the training table. Instead, it was a call to confront a wrong, an affront, an act of overt racial discrimination in Orangeburg at a bowling alley that refused would-be black bowlers just like the state was denying black citizens their human rights.

As a result, Davis and Hammond became athlete-activists long before we created the suddenly ubiquitous, if not trite, alliterative phrase these days to describe football and basketball players, almost all of color, who have, by comparison, merely sported sloganeering T-shirts, or employed histrionics, to demonstrate against racial injustice.

It is a noble and laudable effort, of course. But what we’ve come to champion of athletes today pales juxtaposed to what so many did in the cauldron of the late ’60s civil rights movement. Davis and Hammond, for example, dared to physically confront the very embodiment of the South’s recalcitrant racists — scores of carbine rifle-toting, all-white state troopers — for which Hammond forfeited not just his career but his life.

They were among at least 30 victims of what became known as the Orangeburg massacre.

I was reminded of it three years ago as a presenter at the annual Media and Civil Rights symposium at the University of South Carolina. It included a mesmerizing panel featuring a demonstrator that night, civil rights icon and scholar Cleveland Sellers, and a reporter who became legendary for his fearless coverage of the massacre and other civil rights movement era violence, Jack Bass. With Jack Nelson, awarded a Pulitzer Prize for his reporting on the civil rights movement, Bass authored “The Orangeburg Massacre” in 1970.

And I took note that the panelists, particularly Oliver Francis, a one-time baseball player at Voorhees, another historically black South Carolina college, pointed out that black male athletes in particular stepped to the fore in Orangeburg’s deadly confrontation with white supremacy, and in others. Francis wound up convicted and sentenced to prison for 18 to 24 months as an organizer in an armed black student takeover in 1969 of the Voorhees administration building.

It all reminded that black athletes played not just pivotal roles in the civil rights movement, like the muscle North Carolina A&T football players provided for their classmates engaged in sit-ins to desegregate the Greensboro, N.C., Woolworth’s lunch counter. Or in Rock Hill, S.C., where 10 black Friendship College students were detained by police for trying to desegregate a town lunch counter in 1961 but became known as the Rock Hill Nine after one among them wasn’t booked so he could maintain his athletic scholarship. Chicago Bears running back Willie Galimore was the test black registrant at the Ponce de Leon Motor Lodge in St. Augustine, Fla., that became a flash point for desegregation fights in 1964.

And as was evidenced in Orangeburg, black athletes sometimes were even in the vanguard of protests. Samuel Freedman underscored as much in recounting the Orangeburg massacre in his 2014 book, “Breaking the Line: The Season in Black College Football That Transformed the Sport and Changed the Course of Civil Rights.”

Freedman wrote: “Shortly after the 1967 football season ended, many of the politically engaged members of the South Carolina State team joined in protests against a segregated bowling alley near the campus in Orangeburg.” On Feb. 6, 1968, Freedman reported, Davis and several of his teammates went on their own to the bowling alley and not only were denied admittance but were threatened with arrest by city police for disturbing the peace. Other students eventually joined the football players, objected to the police threats and wound up defending themselves from swinging billy clubs.

Two nights later, Freedman stated, “an all-white force of state troopers opened fire on the student demonstrators, killing three and wounding twenty-eight. Among the dead was one football player . . . Hammond. Several other players were injured by gunfire, one of them temporarily paralyzed.”

Davis was that temporarily paralyzed victim.

The student survivors of the massacre refused, however, to be deterred and allow the killings of Hammond, fellow student Henry Smith and high school football player Delano Middleton to be in vain. They organized a march from campus to the state capital 42 miles away to demand justice. Athletes decided to lead the march by running the distance.

“The four young men who approached me about the run were all track and field distance runners,” Willis Ham, a South Carolina State baseball player at the time, told the (Orangeburg, S.C.) Times and Democrat five years ago. “Three of the young men were not of American descent, and they simply wanted to express their disgust for the way Americans ‘treat their own,’ with the one tool that they had to their credit [the ability to run].

“We wanted our fellow students to know how deeply we felt about their determination to go to Columbia [S.C.], and express to state officials how they really felt about the lack of support in the days leading to the massacre.”

“It gave us a chance to say that our spirits and drive for freedom from depression would never be destroyed,” Ham explained.

The white troopers who fired on the students were exonerated in a trial a year later. The lone conviction from the incident was of Sellers for incitement. He spent seven months in prison. He was pardoned in 1993.

But what Hammond, the football player, first fell for is forever remembered on South Carolina State’s campus. Its basketball arena that opened that fateful day, Feb. 8, 1968, was renamed the Smith-Hammond-Middleton Memorial Center.

We should all be appalled that in the 21st Century, folks like Trump, Sessions, Miller, Cotton, and others who think that it’s “OK” and “permissible” to whip up false anti-Hispanic fervor with bogus narratives about rampant crime, imaginary “stolen” jobs, and phantom “adverse effects” of legal immigration have weaseled their way into positions of national power and prominence.

They seek to take America backwards to a bygone era of racial injustice and manufactured hate. Don’t let them get away with it! Ballot boxes were made to “retire” the Trumps, Sessions, and Cottons of the world and send them off to try to make an honest living.
