WASHINGTON — Government investigators have identified poor conditions in another sector of the southern border, publishing graphic photos showing extreme overcrowding in Rio Grande Valley migrant facilities and finding that children there did not have access to showers and had to sleep on concrete floors.

Investigators for the Department of Homeland Security who visited border stations in the El Paso, Texas, sector in May found similar conditions: Migrants being held in temporary facilities for weeks rather than days, single adults living in standing room-only cells with no space to lie down, and concerns about serious health risks.

The investigators for the DHS Office of the Inspector General toured five Border Patrol facilities and two ports of entry in the Rio Grande Valley sector during the week of June 10 and published their report as a “management alert” to the department on Tuesday.

The Rio Grande valley of Texas has the highest volume of immigrants along the United States-Mexico border. At the time of the visits by investigators, Border Patrol was holding 8,000 detainees in custody, with 3,400 being held longer than the 72-hour limit.

One senior manager at a facility called the situation a “ticking time bomb,” according to the report. When immigrants detained in the facilities saw investigators walking through, they banged on the cell windows and pressed notes against the plexiglass to show the length of time they had spent in custody. One said “Help 40 Day Here.”

On Monday, NBC News published findings by the inspector general that detailed poor conditions for migrants in border stations in El Paso as far back as May 7. Acting DHS Secretary Kevin McAleenan said at a press conference Friday that reports of poor conditions for children in border stations were “unsubstantiated.” McAleenan said children were given showers as soon as they could be made available.

“Most single adults had not had a shower in CBP custody despite several being held for as long as a month,” according to the latest report on conditions in the Rio Grande Valley.

The report also detailed what it called “security incidents” in which immigrants have tried to escape and once refused to return to their cells after being removed during maintenance. To address the problem, Border Patrol called in its special operations force to “demonstrate it was prepared to use force if necessary,” the report said.

COURTSIDE HAS BEEN SAYING IT FOR YEARS; THE NY TIMES FINALLY PICKS UP: Trump & Co’s White Nationalist Racist Immigration Policies Are Corrupting America!

Last year, as part of an effort to carry out President Trump’s promise of “extreme vetting” of visitors to the United States, the Department of Homeland Security began collecting social media account information from millions of people seeking to cross the border.

After all, a radical online could be a radical offline.

That’s why the stream of posts ricocheting around a 9,500-member Facebook group, comprising current and former Border Patrol agents as well as some people with no apparent connection to the Border Patrol, is so troubling. Members of the group, as documented by ProPublica this week, “joked about the deaths of migrants, discussed throwing burritos at Latino members of Congress visiting a detention facility in Texas on Monday and posted a vulgar illustration depicting Rep. Alexandria Ocasio-Cortez engaged in oral sex with a detained migrant, according to screenshots of their postings.”

Of a 16-year-old migrant from Guatemala who died while in Border Patrol custody in May, a member of the group wrote, “If he dies, he dies.”

Customs and Border Protection said on Monday that it had informed the Department of Homeland Security’s inspector general about the posts and had started its own investigation. The National Border Patrol union decried the posts as “inappropriate and unprofessional.”

A reckoning from their superiors is due for any border agents who dishonored their uniform by spreading vileness on social media. In June, when the Plain View Project, a nonprofit research effort, released documentation on dozens of police officers from eight departments across the country posting racist, misogynist and Islamophobic material, 72 police officers in Philadelphia were pulled off the streets and the top prosecutor in St. Louis said she would no longer accept cases from 22 officers.

In a larger sense, the Border Patrol Facebook posts reveal a worrying mind-set among some of those charged with administering the harshest crackdown on migrants and asylum-seekers in decades. “These are clearly agents who are desensitized to the point of being dangerous to migrants and their co-workers,” Representative Joaquin Castro, who heads the Congressional Hispanic Caucus, told ProPublica.

The realities of that crackdown have created conditions that Americans would condemn if they were in another country.

While lawmakers refuse to compromise on emergency aid for the humanitarian needs at the border, “children are held for weeks in deplorable conditions, without access to soap, clean water, showers, clean clothing, toilets, toothbrushes, adequate nutrition or adequate sleep,” groups supporting the children wrote in a recent court filing. A judge on Friday ordered Customs and Border Protection to allow health workers into facilities where children are being held to ensure that conditions are “safe and sanitary.”

On Monday, Ms. Ocasio-Cortez toured facilities where migrants and asylum-seekers are being held. “Officers were keeping women in cells w/ no water & had told them to drink out of the toilets,” she tweeted.

As the congressional delegation arrived at one detention facility, they were heckled and cursed at by demonstrators, including one man wearing a Make America Great Again hat. (Another heckler hurled ethnic slurs at Representative Rashida Tlaib.)

Only a callous person could find mirth in the misery at the border. And only a desensitized nation could continue to permit the separation of children from their parents — and detaining all of them in atrocious conditions — as a morally acceptable form of deterrence.

The constant lies, false narratives, intentional inhumanity, and “deterrence only” of Trump’s self-created “border crisis” are merely the latest example of how White Nationalism demeans our nation. This Administration has all of the legal tools necessary to process arriving asylum seekers in a fair, timely, and orderly manner. They just refuse to use them as they were intended to solve, rather than intentionally create and aggravate, migration problems.

Contrary to Trump/GOP false narratives, that includes the present ability to establish a legitimate refugee application program in or near the Northern Triangle and to use it as an incentive for refugees to apply outside the United States rather than coming to the border to apply for asylum. However, to work as an incentive, rather than a failed deterrent, the refugee program must be administered in a fair and generous manner that would allow those who have legitimate fears of persecution on the basis of gender, actual or political opposition to gangs, ethnicity, or religious activities to be properly classified as refugees and resettled here or in some other truly safe location as determined in conjunction with the UNHCR and signatory countries outside the Northern Triangle who can actually provide at least a reasonable chance of safety.

That likely means a goal of admitting at least 50,000 to 100,000 refugees to the U.S. from Central America over the next year. That, along with robust aid to address the problems creating the refugee flow would be the legal and effective approach to the forced migration issue.

Additionally, the Administration has the ability to reauthorize and extend “Temporary Protected Status” (“TPS”) to qualified individuals from the Northern Triangle already present in the U.S. until such time as the conditions in their home countries can be stabilized. This would also have the advantage of tracking the presence of such individuals in the United States while reducing the pressure on the already backlogged U.S. Immigration Court system.

Of course, the Administration has no intention of using any of these tools to solve the problem. That would be inconsistent with their racist, restrictionist, White Nationalist agenda aimed primarily at keeping non-white individuals out of the United States and reducing the rights and political power of those who are already citizens. The purpose of refugee protection laws is actually to protect refugees, not, as this Administration posits, to kill as many of them as possible outside the U.S. or at our border to “deter” other refugees from coming.

Indeed, the Administration’s absurdly inhuman and unlawful proposal to keep refugees from leaving the very countries where they are being persecuted, without addressing the conditions there, is basically that having them die, be tortured, or abused there is just fine with us. Whether folks like to face it or not, that is indeed a neo-Nazi philosophy. And, every day that Trump remains in the office for which he is so supremely unqualified further corrupts our nation.

AMERICA’S “MASS ATROCITY” — Professor Kate Cronin-Furman Says Don’t Kid Yourself About What The Trump Administration Is Doing In Your Name & How “Ordinary Civil Servants” Carry Out The Unthinkable & Unacceptable!

The debate over whether “concentration camps” is the right term for migrant detention centers on the southern border has drawn long-overdue attention to the American government’s dehumanizing treatment of defenseless children. A pediatrician who visited in June said the centers could be compared to “torture facilities.” Having studied mass atrocities for over a decade, I agree.

At least seven migrant children have died in United States custody since last year. The details reported by lawyers who visited a Customs and Border Protection facility in Clint, Tex., in June were shocking: children who had not bathed in weeks, toddlers without diapers, sick babies being cared for by other children. As a human rights lawyer and then as a political scientist, I have spoken to the victims of some of the worst things that human beings have ever done to each other, in places ranging from Cambodia to the Democratic Republic of the Congo to Sri Lanka. What’s happening at the border doesn’t match the scale of these horrors, but if, as appears to be the case, these harsh conditions have been intentionally inflicted on children as part a broader plan to deter others from migrating, then it meets the definition of a mass atrocity: a deliberate, systematic attack on civilians. And like past atrocities, it is being committed by a complex organizational structure made up of people at all different levels of involvement.

Thinking of what’s happening in this way gives us a repertoire of tools with which to fight the abuses, beyond the usual exhortations to call our representatives and donate to border charities.

Those of us who want to stop what’s happening need to think about all the different individuals playing a role in the systematic mistreatment of migrant children and how we can get them to stop participating. We should focus most on those who have less of a personal commitment to the abusive policies that are being carried out.

Testimony from trials and truth commissions has revealed that many atrocity perpetrators think of what they’re doing as they would think of any other day job. While the leaders who order atrocities may be acting out of strongly held ideological beliefs or political survival concerns, the so-called “foot soldiers” and the middle men and women are often just there for the paycheck.

This lack of personal investment means that these participants in atrocities can be much more susceptible to pressure than national leaders. Specifically, they are sensitive to social pressure, which has been shown to have played a huge role in atrocity commission and desistance in the Holocaust, Rwanda and elsewhere. The campaign to stop the abuses at the border should exploit this sensitivity and put social pressure on those involved in enforcing the Trump administration’s immigration policies.

Here is what that might look like:

The identities of the individual Customs and Border Protection agents who are physically separating children from their families and staffing the detention centers are not undiscoverable. Immigration lawyers have agent names; journalists reporting at the border have names, photos and even videos. These agents’ actions should be publicized, particularly in their home communities.

This is not an argument for doxxing — it’s about exposure of their participation in atrocities to audiences whose opinion they care about. The knowledge, for instance, that when you go to church on Sunday, your entire congregation will have seen you on TV ripping a child out of her father’s arms is a serious social cost to bear. The desire to avoid this kind of social shame may be enough to persuade some agents to quit and may hinder the recruitment of replacements. For those who won’t (or can’t) quit, it may induce them to treat the vulnerable individuals under their control more humanely. In Denmark during World War II, for instance, strong social pressure, including from the churches, contributed to the refusal of the country to comply with Nazi orders to deport its Jewish citizens.

The midlevel functionaries who make the system run are not as visibly involved in the “dirty work,” but there are still clear potential reputational consequences that could change their incentives. The lawyer who stood up in court to try to parse the meaning of “safe and sanitary” conditions — suggesting that this requirement might not include toothbrushes and soap for the children in border patrol custody if they were there for a “shorter term” stay — passed an ethics exam to be admitted to the bar. Similar to the way the American Medical Association has made it clear that its members must not participate in torture, the American Bar Association should signal that anyone who defends the border patrol’s mistreatment of children will not be considered a member in good standing of the legal profession. This will deter the participation of some, if only out of concern over their future career prospects.

The individuals running detention centers are arguably directly responsible for torture, which could trigger a number of consequences at the international level. Activists should partner with human rights organizations to bring these abuses before international bodies like the United Nations Human Rights Council. They should lobby for human rights investigations, for other governments to deny entry visas to those involved in the abuses, or even for the initiation of torture prosecutions in foreign courts. For someone who is “just following orders,” the prospect of being internationally shamed as a rights abuser and being unable to travel freely may be significant enough to persuade them to stop participating.

When those directly involved in atrocities can’t be swayed, their enablers are often more responsive. For-profit companies are supplying food and other material goods to the detention centers. Boycotts against them and their parent entities may persuade them to stop doing so. Employees of these companies can follow the example of Wayfair workers, who organized a walkout on Wednesday in protest of their company’s sale of furniture to the contractor outfitting the detention centers. Finally, anyone can support existing divestment campaigns to pressure financial institutions to end their support of immigration abuses.

Many Americans have been asking each other “But what can we DO?” The answer is that we call these abuses mass atrocities and use the tool kit this label offers us to fight them. So far, mobilization against what’s happening on the border has mostly followed standard political activism scripts: raising public awareness, organizing protests, phoning our congressional representatives. These efforts are critical, but they aren’t enough. Children are suffering and dying. The fastest way to stop it is to make sure everyone who is responsible faces consequences.

FOUR TODDLERS RESCUED BY PRO BONO LAWYERS FROM DEADLY SITUATION IN CBP CUSTODY — Putrid, Unsanitary, Repressive Conditions Causing Lifetime Harm To Other Traumatized Kids — But, Border Patrol Chief Carla Provost Wants You To Know That She’s Not Taking Responsibility For The Humanitarian Disaster Intentionally Engineered On Her Watch!

Four toddlers were so severely ill and neglected at a U.S. Border Patrol facility in McAllen, Texas, that lawyers forced the government to hospitalize them last week.

The children, all under age 3 with teenage mothers or guardians, were feverish, coughing, vomiting and had diarrhea, immigration attorneys told HuffPost on Friday. Some of the toddlers and infants were refusing to eat or drink. One 2-year-old’s eyes were rolled back in her head, and she was “completely unresponsive” and limp, according to Toby Gialluca, a Florida-based attorney.

She described seeing terror in the children’s eyes.

“It’s just a cold, fearful look that you should never see in a child of that age,” Gialluca said. “You look at them and you think, ‘What have you seen?’”

Another mother at the same facility had a premature baby, who was “listless” and wrapped in a dirty towel, as HuffPost previously reported.

The lawyers feared that if they had not shown up at the facility, the sick kids would have received zero medical attention and potentially died. The Trump administration has come under fire for its treatment ― and its alleged neglect ― of migrants who have been crossing the southern border in record numbers. The result is overcrowded facilities, slow medical care and in some instances, deaths.

Immigration authorities say they’re overwhelmed; activists say they’re not trying hard enough.

“It’s intentional disregard for the well-being of children,” Gialluca said. “The guards continue to dehumanize these people and treat them worse than we would treat animals.”

U.S. Customs and Border Protection declined to respond to HuffPost’s request for comment.

The Associated Press reported this week that children in border facilities don’t have adequate access to food, water, soap or showers. On Tuesday, a Justice Department attorney argued in court that the government should not have to provide detained children with soap, toothbrushes or beds.

The AP report is based on interviews a group of lawyers conducted with hundreds of children in three Texas-based Border Patrol stations last week as part of the Flores settlement ― an agreement that outlines conditions for detained children. The lawyers say children are also being held in these facilities for longer than the 72-hour limit the settlement specifies, and in some cases up to three weeks.

Lawyers are particularly concerned about the spread of illness inside Border Patrol facilities, which can sometimes turn fatal. Five children have died in Border Patrol custody since December, some of whom were initially diagnosed with a common cold or the flu. The processing center in McAllen, known as Ursula, recently quarantined three dozen migrants who were sick after a 16-year-old died of the flu at the same facility.

Children and their parents told lawyers that in some cases they didn’t have any access to medical treatment in Border Patrol facilities despite being visibly ill. Gialluca spoke with one 16-year-old mother whose toddler had the flu, but was told by a guard the child “wasn’t sick enough to see a doctor.” She said others also reported being denied medical attention despite having critically sick babies.

Medical experts say that because children have less developed immune and respiratory systems, their symptoms can escalate quickly if they aren’t properly treated.

Dr. Julie Linton, the co-chair of the American Academy of Pediatrics, previously told HuffPost that children can’t recover from illnesses in Border Patrol facilities. These centers are described as “hieleras” ― Spanish for iceboxes ― because of their freezing temperatures, and migrants describe sleeping on floors under bright lights that shine 24/7, with nothing but Mylar blankets to keep warm.

Gialluca met one 16-year-old mother whose 8-month-old baby was sick with the flu and forced to sleep outside for four days at the McAllen Border Patrol station. The mother said the guards took the clothing off the baby’s back, leaving her in a diaper, and forced them to sleep on concrete without a blanket.

A sick 2-year-old girl was shivering in a T-shirt and had shallow breathing, according to Mike Fassio, a Seattle-based immigration attorney who visited Ursula.

“I was very, very concerned,” he said, adding lawyers spoke with immigrants in a room outside of the facility. “When she left us, I knew she was going back to a place that was cold, crowded and unsanitary.” Fassio noted that guards referred to the children as “bodies.”

Some children were so exhausted they fell asleep during the interviews, said Clara Long, a senior researcher at Human Rights Watch who spoke with kids at a facility in Clint, Texas. Long met a 3-year-old boy who was dirty with matted hair and was being taken care of by his 11-year-old brother. She said that more than 10 sick children were being quarantined in cells.

While the group of roughly eight lawyers and interpreters at Ursula were supposed to be interviewing children about conditions in the facilities, they also ended up asking guards and government officials to bring kids to the hospital because they were so worried about their state. Gialluca added that she and her colleagues interviewed only a small portion of migrants in the facility, which is the largest processing center in the U.S. and can hold up to 1,000 people. She believes the number of migrants in need of hospitalization is likely much higher.

Government officials have blamed horrific conditions at detention facilities on the fact that Congress has not yet passed an emergency funding package that would include almost $3 billion to help care for unaccompanied migrant children. But Gialluca says border officials shouldn’t need more resources to treat immigrants like human beings.

“Money isn’t keeping guards from allowing people to access toilets,” she said. “Money isn’t causing guards to take clothing and medicine away from children.”

8-YEAR-OLD MIGRANTS BEING FORCED TO CARE FOR TODDLERS IN DETENTION CAMPS

A team of lawyers conducted 60 interviews with migrant children being held in an El Paso, Texas, detention camp and found conditions to be dismal.

Fifteen of those in the holding center had the flu and 10 more are quarantined with illness, according to the lawyers, who first gave the data to the Associated Press. Three infants are being detained alongside their teenage mothers, and many children are under the age of 12.

“A Border Patrol agent came in our room with a 2-year-old boy and asked us, ‘Who wants to take care of this little boy?’ Another girl said she would take care of him, but she lost interest after a few hours and so I started taking care of him yesterday,” one teenaged girl told the lawyers in an interview. The boy was not wearing a diaper and his shirt was covered in mucus, she said.

Law professor Warren Binford, who aided in the interviews, said she witnessed an 8-year-old girl caring for a 4-year-old child who was very dirty, the girl was unable to get the boy to take a shower. She also described the children she interviewed as sleep-deprived, often falling asleep while speaking with her.

“In my 22 years of doing visits with children in detention, I have never heard of this level of inhumanity,” said Holly Cooper, co-director of the University of California, Davis’ Immigration Law Clinic, to the AP.

The lawyers were inspecting the facility as part of the Flores agreement, which resulted from a landmark 1985 case that established that facilities where minor migrants are held must be kept “safe and sanitary.”

A representative of the Trump administration, the Justice Department’s Sarah Fabian, argued Tuesday that safe and sanitary conditions don’t necessarily have to include toothbrushes, soap or towels for children.

TRUMP ADMINISTRATION PLANS MAJOR ICE RAIDS FOR SUNDAY

U.S. immigration authorities plan to raid Miami, Houston, Chicago and Los Angeles and other cities. They intend to arrest up to 2,000 families, three U.S. officials with knowledge of the plans told The Washington Post. The orders reportedly come directly from President Donald Trump.

On Monday, the president tweeted: “Next week ICE will begin the process of removing the millions of illegal aliens who have illicitly found their way into the United States. They will be removed as fast as they come in.”

Officials told The Washington Post that the Department of Homeland Security agency plans to hold families in hotel rooms until they are deported. Acting DHS Secretary Kevin McAleenan is allegedly targeting families that have completely dropped out of the court process, but has warned that the operation could lead to further cases of families being separated.

Los Angeles Police Department Chief Michel Moore confirmed the raids on Friday, saying that about 140 families in southern California will be targeted in pre-dawn raids early next week. The chief also made clear that the raids are done on a federal level and that the police department will not be involved.

On Thursday, Carla Provost, chief of the United States Border Patrol argued that the Department of Homeland Security was not receiving enough money to properly care for migrants on the southern border, and that was leading to terrible conditions in detention centers. On Wednesday, the Senate Appropriations Committee agreed to $4.6 billion in emergency funds for what the Trump administration has referred to as a “border crisis.”

Texas Congressman Joaquin Castro questioned how the agency could afford mass raids while asking for more money Friday. “The Trump Administration says it needs more money (supplemental bill) for the situation at the border yet they may be starting massive immigration raids next week. So how do you have the money for that if you’re running out of money ICE?” he tweeted.

“These potential raids are a disgusting political ploy to stoke fear and rile up Trump’s base for 2020,” wrote Sandra Cordero, Director of Families Belong Together, an immigration advocacy group, in a statement. “Past raids have left children alone and afraid in empty homes, praying they won’t be left to care for younger siblings by themselves, with no idea if they’ll see their parents again. This is yet another flagrant disregard for the welfare of children on behalf of a cruel administration bent on fomenting fear and creating chaos.”

Come on, Carla, cut the BS and butt covering. The “mix” of arrivals at the Southern Border began to shift to refugee families from the Northern Triangle back in the summer of 2014. So, CBP and DHS have had five years to prepare for this “change” which is actually “old news.”

More “old news” is the increased flow of asylum seekers with kids which began back before Thanksgiving. Plenty of time for CBP and DHS to bring back retired asylum officers and adjudicators and reassign other adjudicative personnel to the border to insure prompt, orderly, safe, and efficient processing of asylum applicants at ports of entry, thus eliminating the incentive (or necessity) for folks to turn themselves in after crossing the border between ports.

Also, plenty of time to work with NGOs, pro bono groups, states, and communities to insure representation and proper placement of family groups in various locations throughout the country without panic or “dumping.”

Another bogus claim spread by Trump, Provost, and the rest of the sycophants: that the prevalence of kids among new asylum arrivals is somehow totally a response to the Flores settlement (which actually has been in effect for decades).

Undoubtedly, with the Trump Administration’s active assistance, unscrupulous smugglers and coyotes are encouraging some folks to bring children as the only way to have a shot at fair processing under the tilted U.S. asylum system promoted by Trump. Undoubtedly, some of these unscrupulous individuals are telling families to travel with kids. But, the truth is that according to the UNHCR, over one-half of today’s refugees are children. https://www.unhcr.org/children-49c3646c1e8.html.

So, the prevalence of children among new arrivals should properly been seen as part of a sad worldwide trend that Trump and his cronies disgustingly have done everything possible to encourage, exploit, and aggravate. It most certainly is not primarily caused by the Flores settlement or by giving soap, toothbrushes, blankets, or medical care to children being abused in the “DHS Gulag” administered in part by disingenuous folks like Provost.

Any honest observer of what’s going on knows that the majority of the asylum applications that passed credible fear probably could have been granted (or given protection under the Convention Against Torture — “CAT”) by the Asylum Office without even going to Immigration Court under the proper generous interpretation of our asylum laws, an honest interpretation of CAT that reflects the true conditions in the Northern Triangle, and a very “doable” change in procedures.

Only dishonest fools in the Trump Administration (and a few from the Obama Administration) would maintain that gender isn’t a social group subject to widespread persecution in the Northern Triangle, deny that gangs have assumed the role of quasi-governmental entities thus making most of the harm they inflict on resisters “political persecution,” and make the beyond ludicrous claim that the corrupt failed states of the Northern Triangle have either the ability or much real interest in protecting those subject to persecution.

And, Carla, why aren’t you out there today registering a public protest of the waste of time and funds in ICE going after families with ridiculously inappropriate “raids” when every resource could and should be focused instead on providing humanitarian assistance to asylum seekers arriving at the Southern Border?

This racist-inspired “Sunday Morning Reign of Terror” directed at U.S. ethnic communities is specifically designed to return helpless families to the very dangerous countries from which they originally fled! Thus, Trump and his phony DHS are intentionally feeding “fresh meat” to gangs and cartels and insuring that the cycle of northward migration, no matter how dangerous, will continue until everyone who needs to leave its either gone or dead (the latter apparently the “solution” favored by Provost, Trump, Morgan, McAleenan, Miller, and others).

Provost, McAleenan, Morgan, and their co-conspirators are all participants in a cynical scheme to intentionally “crash” the asylum system, rather than competently administering it. They are intentionally endangering the lives of children and other vulnerable asylum seekers, many entitled to legal protections, to promote, along with GOP restrictionists, totally bogus, dishonest, and completely unnecessary and unwarranted restrictions of the precious, life-saving right of refugees to seek asylum in the U.S.

It’s an unbelievably dishonest and cowardly scheme, and a complete breach of both oaths of office and public trust. It might be that those who long ago abandoned American values will lap up this insult to human values and human dignity.

But, there are plenty of us out here who know and understand exactly what you are doing. We will not only resist it, but will be historical witnesses to your cruel, inhuman, and unlawful schemes and gimmicks to “abuse and kill the innocent.” And, we’ll be keeping count.

Donald Trump Cracked a ‘Joke’ After His Supporter Yelled About Shooting Immigrants at the Border. This Isn’t a Joke.

Not when armed militias are roaming the border and one member mused about doing the same thing. Not when the president has relentlessly dehumanized migrants and advocated for political violence from the podium.

Why are they laughing and clapping? Because they know it’s not a joke.

The President of the United States committed multiple felonies and hired a pet toad as attorney general to try to shove it under the rug. He is now asserting that Congress is not a co-equal branch of government with oversight powers as laid out in the Constitution, and so has no authority to subpoena documents or witnesses he doesn’t like. He and his apparatchiks have decided they can just flout the law-that they are above it. He has relentlessly attacked the free press as an enemy of the state, attempting to undermine any source of information independent from his government. He has called for his political opponents to be investigated and imprisoned. He has repeatedly embraced political violence from the rally podium. He has “joked” about extending his term and, Wednesday night, about serving more than the two he’s limited to by the Constitution.

Sadly, that last part wasn’t the most frightening “joke” of the evening at the Trump rally in Panama City Beach, Florida, last night.

When Trump talked about stopping asylum-seekers and other undocumented immigrants, a person in the crowd yelled, “Shoot them!” and everybody laughed and cheered and clapped. In response, the president laughed that this was all some charming regional quirk of the Florida Panhandle, where you can “get away with” this kind of joke.

Another ABC News reporter, Will Steakin, also backed this account.

This is not a joke. Over and over again, Trump has made comments his aides later dismissed as “jokes,” or gone out of his way to say he would never do something, all with the intent of putting these ideas out there. Perhaps they might take on a life of their own. He once said he “hates these people”-referring to reporters-but “would never kill them.” Why does that need to be said, unless you want to get people thinking about it? At a rally in February, a supporter worked into a frenzy physically attacked a BBC reporter while Trump spoke.

The intent last night was clear: float the idea by suggesting we could never allow border agents to use weapons against migrants, even though other countries do. And then, when a guy in the crowd jumps to the next step, let it slide into the public imagination under the guise of a “joke.” It’s a trial balloon. Will there be pushback? Where will the message land, and how?

After all, there are already people roaming the border who are musing about murdering immigrants. Various “militias” have taken it upon themselves to patrol the border as a vigilante-or paramilitary-force. As reporter Ken Klippenstein found just this week thanks to a police report obtained through FOIA, some of them are quite interested in what the president’s joking about.

They’re already “detaining” large groups of migrants at gunpoint based on no legal authority. That’s also known as “kidnapping.” (The leader of the group, United Constitutional Patriots, was arrested. Now the group want to change its name to escape accountability.) At least one member, it appears, is already musing about lining people they capture up against a wall and shooting them. Perhaps they are looking for some kind of…permission. Or signal. From someone in a position of authority. Who communicates it’s not a big deal-normal, even. We’re all laughing, after all.

Elsewhere in the speech, Trump once again echoed conspiracy theories about an “invasion” of immigrants at the southern border.

This is the theory that drove the Tree of Life synagogue shooter-who believed Jews were helping to organize the “invasion” of nonwhite people through The Caravan-to kill 11 Jewish worshippers. (After the shooting, Trump said he “wouldn’t be surprised” if someone was funding The Caravan when asked by a reporter, echoing anti-Semitic tropes. In response to a reporter’s further question, he even alluded to George Soros, a Jewish billionaire and frequent target for right-wing conspiracies. He also doubled down on his “invasion” language.) In reality, most people coming to the southern border are seeking asylum based on claims they are fleeing domestic or gang violence in the chaotic Northern Triangle countries of Honduras, Guatemala, and El Salvador. In another time, we might call them refugees. They travel in “caravans” up through Mexico because the journey is dangerous and there’s safety in numbers.

No matter: they are convenient villains in the president’s dark and venal vision of the American Experiment, where this is a country for and by white people and everybody else ought to be thankful for whatever they get. The demonization of The Other is a tale as old as America, but Donald Trump has returned the nation to dangerous places in 2019, questioning not just the Americanness, but the very humanity, of Hispanic immigrants and Muslims. He does so by attacking these groups’ violent outliers-the drug dealers and coyotes and ISIS-but these are the only examples of these groups he has ever discussed. There has never been one word about the Guatemalan mother who flees here with her child and works for decades cleaning somebody’s house. It’s only ever the murderers and rapists, and if they’re “invading” your country, any response is justified.

His followers get the message. Note that the woman in the clip above-who confirmed someone else in the crowd yelled “shoot ’em”-did not say the supporter and the president were talking about “illegal immigrants.” She said “immigrants.” Because that’s who Trump is always talking about. It’s not about the law. Donald Trump has no regard for the law. It’s about Us and Them. There is no reason to believe this will get anything other than worse while this grotesque and incurable man continues to wield more power than any other human being on Earth. He is a danger to the most marginalized in our society now, but that’s how it always begins. If he can get away with this, who will be next?

What kind of country are we becoming?

What kind of folks cheer and encourage “jokes” about shooting the most vulnerable among us? Trump has certainly brought out all the worst in America.

There are no “jokes” in Trump’s world — he’s a sick and cruel coward without values, human empathy, or any sense of humor. As American historian Professor Heather Cox Richardson pointed out recently on Facebook “Trump has a pattern of floating ideas as ‘jokes’ to normalize them.”

At one point in our recent past, a politician who “joked” about shooting unarmed people would have been censured by both parties and forced to resign. Trump has “normalized” the vile and unspeakable and brought out the absolute worst in his supporters and the hollow toadies with whom he surrounds himself. It’s destroying America. The rest of us who still believe in humanity and the values to which our country historically has aspired, without fully achieving, need to stand up to this redux of Germany in 1939 and Birmingham in 1963.

In early 1921, an article in Good Housekeeping signaled the coming of a law that makes President Trump’s campaign for immigration restriction seem mild by comparison. “Biological laws tell us that certain divergent people will not mix or blend,” it read. “The dead weight of alien accretion stifles national progress.” The author was Calvin Coolidge, about to be sworn in as vice president of the United States. Three years later, the most severe immigration law in American history entered the statute books, shepherded by believers in those “biological laws.”

The anti-immigrant fervor at the heart of current White House policymaking is not a new phenomenon, nor is the xenophobia that has infected the political mainstream. In fact, race-based nativism comes with an exalted pedigree — and that pedigree is something we all should remember as the Trump administration continues its assault on immigrants of specific nationalities. The scientific arguments Coolidge invoked were advanced by men bearing imposing credentials. Some were highly regarded scholars from Harvard, Princeton, Yale and Stanford. One ran the nation’s foremost genetics laboratory. Another was America’s leading environmentalist at the time. Yet another was the director of the country’s most respected natural history museum.

Together, they popularized “racial eugenics,” a junk science that made ethnically based racism respectable. “The day of the sociologist is passing,” said the Harvard professor Robert DeCourcy Ward, “and the day of the biologist has come.” The biologists and their publicists achieved what their political allies had failed to accomplish for 30 years: enactment of a law stemming the influx of Jews, Italians, Greeks and other eastern and southern Europeans. “The need of restriction is manifest,” The New York Times declared in an editorial, for “American institutions are menaced” by “swarms of aliens.”

Keeping people out of the country because of their nationality was hardly a novel idea. The Chinese Exclusion Act of 1882 was avowedly racist. In 1923 a unanimous Supreme Court declared that immigrants from India could be barred from citizenship strictly on racial grounds.

What was different about the new, putatively scientific campaign was that even whiteness was no ticket to entry.

Writing about Slavic immigrants, the sociologist Edward A. Ross of the University of Wisconsin — later the national chairman of the American Civil Liberties Union — declared, they “are immune to certain kinds of dirt. They can stand what would kill a white man.” The president of Massachusetts Institute of Technology said newcomers from eastern and southern Europe were “vast masses of filth” who were “living like swine.”

The Washington Post editorialized that 90 percent of Italians coming to the United States were “the degenerate spawn” of “Asiatic hordes.” A Boston philanthropist, Joseph Lee, his city’s leading supporter of progressive causes, explained to friends why he became the single largest financial backer of the anti-immigrant campaign: His concern, he wrote, was that without a restriction law, Europe would be “drained of Jews — to its benefit no doubt but not to ours.”

The “biological” justifications for this nativism were first developed in Cold Spring Harbor, on Long Island, in laboratories financed by the widow of the railroad baron E.H. Harriman. (One of her goals, Mary Harriman said, was preventing “the decay of the American race.”) The laboratory’s head, the zoologist Charles B. Davenport, took the ideas of the British gentleman scientist Francis Galton — who had coined the word “eugenics” in 1883 — welded them to a gross misunderstanding of the genetic discoveries of Gregor Mendel, and concluded that the makeup of the nation’s population could be improved by the careful control of human breeding. One of the first steps, he believed, was to impose new controls on open immigration.

At first, Davenport wished to bar the immigration only of people afflicted by specific disorders — epileptics, the “feebleminded” and others of similarly troublesome (to Davenport) disability. But soon he was caught up in a racialist whirlwind initiated by “The Passing of the Great Race,” a book by Madison Grant, the founder of the Bronx Zoo and the era’s most prominent conservationist. A bilious stew of dubious history, bogus anthropology and completely unfounded genetic theory, Grant’s work persuaded Davenport and others that the American bloodstream was threatened not by suspect individuals, but by entire ethnic groups.

First published in 1916 and reissued in a series of revisions over the next eight years — all of them brought into print by Maxwell Perkins, the celebrated editor of F. Scott Fitzgerald and Ernest Hemingway — “The Passing of the Great Race” savagely denigrated the peoples of eastern and southern Europe while exalting the “Nordics” of northwestern Europe. With the presumed authority of scholarship, he summarized the essential argument of racial eugenics.

“Whether we like to admit it or not,” Grant wrote, “the result of the mixture of two races, in the long run, gives us a race reverting” to the “lower type.” Lower than Nordics were the questionable “Alpines.” Lower than the “Alpines” were the woeful “Mediterraneans.” And, he concluded, “the cross between any of the three European races and a Jew is a Jew.”

Grant was not an actual scientist. But Henry Fairfield Osborn, a world-famous paleontologist and his closest friend, definitely was. Osborn, who once expressed his opposition to the extension of the Westchester Parkway near his country estate because it would bring thousands of “East Side Jews” to the area, presided over the American Museum of Natural History for 25 years, and made that institution the beating heart of the combined eugenics and anti-immigration movement. “I am convinced,” said Osborn, that the “spiritual, physical, moral and intellectual structure” of individuals is “based on racial characteristics.” It wasn’t a matter of ethnic bias, he said — it was “cold-blooded” science.

Other scholars rallied to the cause. Robert M. Yerkes — his name immortalized today at the Yerkes National Primate Research Center in Atlanta — conducted a severely flawed series of tests of American servicemen purporting to establish the intellectual inferiority of eastern and southern Europeans. Charles W. Gould, a lawyer in New York, sponsored “A Study of American Intelligence,” by Carl C. Brigham, a young Princeton psychologist (and later the inventor of the SAT). Brigham’s conclusion: “There can be no doubt that recent history has shown a movement of inferior peoples or inferior representatives of peoples to this country.”

At the same time, Perkins and his colleagues at Charles Scribner’s Sons published a raft of books promoting racialized eugenics. Scribner publicists wrote in one promotion piece: “The inrush of lower races is threatening the very blood of our country.” Perkins’s authors were echoed in the country’s leading magazine, The Saturday Evening Post. “Race character is as fixed a fact as race color,” the Post declared. “Thirty years ago,” the magazine insisted in another article, “science had not perhaps sufficiently advanced to make us fully aware” of the danger of open immigration. When the 1924 Immigration Act reached the floor of Congress, passage was assured. Albert Johnson, chairman of the House Immigration and Naturalization Committee, declared that “the fundamental reason” for immigration restriction was “biological.” During the floor debate, one congressman said the law was provoked by “the necessity for purifying and keeping pure the blood of America.” Given the arguments presented by so many of the nation’s leading scientific figures, who could disagree?

The resulting law established quotas by nation; they cut like a scythe. In the last year before their introduction, more than 220,000 Italians entered the United States. The quota slashed that number to less than 4,000. Reductions nearly as harsh were imposed on other eastern and southern European groups, while tens of thousands of slots reserved for Britons, Scandinavians and other “Nordics” went unfilled.

The 1924 quotas remained in force for more than 40 years — while the economic devastation of a worldwide depression hit southern Europe especially hard; while a 1939 measure that would have allowed 20,000 German Jewish children into the United States died in Congress, and the savagery of the Holocaust began; while the Nazis and their allies starved 350,000 Greeks and slaughtered 200,000 Serbs; and while displaced-persons camps stretched across the ruins of postwar Europe.

In 1920, Charles Davenport had asked Madison Grant, “Can we build a wall high enough around this country” to keep out the unwanted? They could, and they did.

The race-based ”Aryan Nationalism” of 1920’s America helped pave the way for the Nazi atrocities of World War II.

Out of the failure of the West to save lives when it was possible before the start of World War II and the horrible human exterminations that followed came the 1951 U.N. Convention on Refugees. It is that Convention which Trump and other nationalist leaders throughout the Western World are committed to destroying.

At the recent Louisiana State Bar Immigration Conference, held on April 26, 2019, Attorney R. Andrew Free of Nashville, TN, who had been to the border and observed firsthand the lawless, counterproductive, and inhumane behavior of both the Mexican and U.S. authorities toward asylum seekers, particularly women and children, made an excellent “historical perspective” presentation.

Free traced the origins of today’s xenophobic and racist-inspired restrictionist immigration policies policies to two historic events: 1) the Eisenhower Administration’s 1954 “Operation Wetback” directed against Mexicans which resulted in some Mexican-American citizens and lawful residents being swept up in the indiscriminate “dragnet,” without any hint of due process, directed against Hispanic appearing and Spanish speaking individuals along the Southern Border; and 2) the highly racist Immigration Act of 1924, praised by such “modern day Jim Crows” as Jeff Sessions and his acolyte White House Advisor Stephen Miller.

Do we as a people REALLY want to be remembered the way Coolidge, Albert Johnson, and the host of racist “pseudo-scientists” are described in this article? Or, are we willing to take a stand against the White Nationalist restrictionist agenda being pushed by Trump and his many enablers?

How can we forget our own immigrant heritages and the nasty racist stereotypes thrown at almost every group of new immigrants, including of course enslaved African Americans and other “involuntary forced migrants,” who built America into a great nation!

Most people have consistently underestimated Donald Trump. When he came down the escalator at Trump Tower to announce his candidacy by attacking and demonizing non-white immigrants, people should have understood that Trump would likely win the Republican nomination and possibly the election.

Why? Because Donald Trump appeals to the worst of America. His promotion of fear, division, hate, racism, xenophobia, rallying of white nationalism, mistreatment of women, purposeful denial of truth, and consummate love of money, power, and fame are, of course, nothing new in America. Neither are his desire to destroy democracy, love for authoritarian rulers or desire to be one. Indeed, there is nothing new about Donald Trump, but he almost perfectly exemplifies the worst of America — the ugliest things in our history and the greatest dangers to our future.

Now let’s move from the political and moral to the theological and spiritual: These traits and actions also represent the worst of humanity. To seek money and power over all else, to consistently put yourself over all others, to make private self-interest the only the goal of life and overturn any sense of the common good, to create conflict to win and make all others into losers, to constantly lie and try to kill the truth, to make exploitation and abuse the definition of sexuality, to be as violent in word and deed as you can get away with, to never answer to God or seek forgiveness — there are examples of these sins throughout the Bible and human history. They are also, unfortunately, what our country’s leader seems to stand for, what he promotes in our culture, and what he models for our children.

Given all of this, we are in great danger. Strongmen are rising all over the world, and Donald Trump supports them — and even wants to be one of them. Trump started out the New Year tweeting the country’s support to Jair Bolsonaro, Brazil’s new right-wing nationalist leader. Just this week, he articulated an ahistorical understanding of the 1979 Soviet invasion of Afghanistan that seemed to condone or even endorse the Soviet action. His version of that chapter in world history is one that sounds much closer to what Moscow propaganda might say rather than what an American president or relatively neutral historians would describe. Among the current global strongmen, Trump is certainly not the most intelligent, but he may be the most dangerous because of his political position.

Strongmen, autocrats, and dictators don’t all do the same things. They do whatever they can to maximize their own wealth, power, and fame. The only thing that prevents them from going as far as they can is the resiliency of a society’s institutions and social sectors — like the media, the judiciary, political parties, law enforcement, civil society, and places of vocational or historical moral authority like faith communities.

So how are we faring on those fronts?

Press: In our current political situation, a new generation of young reporters are showing great resiliency in the new Trump era, revealing the facts that undermine official lies and offering analysis that seeks to hold power accountable.

Judiciary: Trump appointments at the Supreme Court and Circuit Court levels are gradually politicizing the judiciary to rule in favor of his interests, white interests, and corporate interests.

Political Parties: After winning the midterm elections, the Democratic Party has retaken the House of Representatives. For the first time, we have 100 women in the Congress and the most diverse House in our history. With Speaker Nancy Pelosi retaking the gavel, we will now see what kind of checks and balances to the executive branch that can provide. But the Republican Party has been taken over by the president’s base and retained a Senate majority that has been unwilling to oppose him — or ever vote to remove him from office, which only the Senate can do with a 2/3 majority vote, even if the House were to impeach him.

Law Enforcement: Trump has continued to attack the Justice Department and relentlessly seeks to undermine the Special Counsel’s investigation into his campaign’s involvement with Russia. Trump’s behavior in response to the investigation of him and his campaign puts the rule of law into jeopardy, depending on how his administration reacts to the results and reports of the Robert Mueller-led investigation.

Civil Society: Will the civil society seek to hold the government responsible for civility in the way that it governs? So far, nonprofit organizations focused on good government, exposing corruption, and protecting the vulnerable have done important work in galvanizing massive protests at key moments of danger or significance, as well as leading or joining key court cases that have sought to rein in some of the worst travesties of the administration, like the monstrous policy of family separation at the border.

Faith Communities: On the religion side, white evangelicals have been the most supportive of Trump as their Religious Right has entered a transactional, Faustian bargain with his administration, agreeing to look away from Trump’s immoral behavior and brutal treatment of those Jesus called “the least of these” in exchange for the judicial appointments and conservative economic policies they support. Others, like the Reclaiming Jesus movement, with Sojourners involvement, have proclaimed that the gospel itself is at stake in the faith community’s response to Trump. This year will be “an hour of decision,” to use Billy Graham’s old language, for the faith community’s testimony in the face of Donald Trump’s corrupt and cruel practices and policies, which are antithetical to the teachings of Jesus.

WATCH: Reclaiming Jesus in a Time of Crisis

In 2019, I believe things are going to get worse in America before they get better. We now face grave dangers to democracy itself, and to societal moral decency. But that danger also provides us an opportunity: to go deeper into our faith and into our relationships to each other, especially across racial lines, and into relationship with the most vulnerable people in our society — a practice our faith says will change us. If we do go deeper, this moment could become a movement for all the things that many of us have consistently lived and fought for all our lives. If we don’t go deeper, but just continue to react or ultimately retreat into frustration and cynicism, we will indeed be in great danger.

Many of us faith leaders believe a constitutional crisis is coming in 2019, which will also create a crisis of faith to which we will be called to respond. A dangerous overreach of presidential power could come in response to the ultimate results of the Special Counsel’s report and potential further indictments of Trump’s associates, potentially his family members, or even himself for criminal behavior. Attempts to cover up or obscure the results could be a serious obstruction of justice that undermines the very rule of law in this country. We could also see other executive overreaches like choosing to shut down the government over vanity projects, the prosecution of dangerous wars, the censorship of the press, attacks on opponents, more assaults on migrants and the most vulnerable, and, most frighteningly, the threat or use of nuclear weapons.

If we start to see that executive overreach as distraction, there must be a moral response. And the response of faith communities could be a game changer. I believe it is time to prepare for that response from the followers of Jesus. Stay tuned and prayerfully get ready.

WHY NIELSEN’S LATEST ATTACK ON REFUGEES COULD BACKFIRE

“The Devil is in the Details.” Typical for this group of incompetents, nobody at DHS or in the Mexican Government actually appears to be ready to implement this “historic change.”
Expect chaos. After all, the ink wasn’t even dry on Judge Sullivan’s order in Grace v. Whitaker for USCIS to rewrite its credible fear “Policy Memorandum” to comply with law. Want to bet on whether the “credible fear” interviews in Mexico or at the border will be lawful? How about the reaction of Judge Sullivan if they ignore his order? (Nielsen and her fellow scofflaws might want to consult with Gen. Flynn on that one. This is one judge with limited patience for high level Government officials who run roughshod over the law, are in contempt of court, or perjure themselves.)
By screwing around with procedures, the Administration opens itself up for systemic challenges in more U.S. District Courts instead of being able to limit litigation to Courts of Appeals on petitions to review individual removal orders.
Every “panic attack” by this Administration on the rule of law and the most vulnerable energizes more legal opposition. And, it’s not just within the immigration bar and NGOs any more. “Big Law” and many of the brightest recent graduates of top law schools across the country are getting involved in the “New Due Process Army.”
By concentrating asylum applicants at a limited number of ports of entry, pro bono legal groups could actually find it easier to represent almost all applicants.
Representation of asylum seekers generally improves results, sometimes by as much as 5X.
It could be easier for individuals who are free and authorized to work in Mexico to obtain counsel and prepare their cases than it is for individuals detained in substandard conditions in obscure locations in the U.S.
Freed of the intentionally coercive and demoralizing effects of DHS detention, more applicants will be willing to fully litigate their claims, including taking available administrative and judicial appeals.
As more cases reach the Courts of Appeals (primarily in the 5th & 9th Circuits) more “real” Article III Judges will “have their eyes opened” to the absolute travesty that passes for “justice” and “due process” in the Immigration Courts under Trump.
Shoddily reasoned “precedents” from the BIA and the AG are already failing in the Article III Courts on a regular basis. Three “bit the dust” just within the last week. Expect this trend to accelerate.
The 5th and 9th Circuits will find their dockets overwhelmed with Not Quite Ready For Prime Time (“NQRFPT”) cases “dumped” on them by DOJ and EOIR and are likely to react accordingly.
The last massive assault on Due Process in Immigration Court by the DOJ under Ashcroft basically caused a “mini-rebellion” in the Article III Courts. There were numerous “remands for redos” and Circuit Court rulings harshly reversing and publicly criticizing overly restrictive treatment of asylum cases by Immigration Judges and the BIA, particularly in the area of credibility determinations. Expect the Circuit Courts to “reverse and revise” many of the current anti-asylum precedents from the BIA and the AG.
With almost universal representation, a level playing field supervised by Article III Courts, and all Immigration Judges actually forced to fairly apply the generous standards for asylum enunciated by the Supremes in INS v. Cardoza-Fonseca, and by the BIA in the (oft cited but seldom actually applied) Matter of Mogharrabi, I wouldn’t be surprised to see grant rates for Northern Triangle applicants exceed 50% (where most experts believe they belong).
Overall, there’s a respectable chance that the end result of this ill-conceived policy will be an exposure of the rampant fraud, intellectual dishonesty, and disregard for the true rule of law in this Administration’s treatment of bona fide asylum seekers.
Inevitably, however, asylum seekers will continue to die in Mexico while awaiting hearings. DHS politicos probably will find themselves on a regular basis before enraged House Committees attempting to justify their deadly, cruel, and incompetent policies. This will be a “culture shock” for those used to the “hear no evil, see no evil” attitude of the GOP House.
The Administration appears to have “designed” another of their “built to fail” systems. If they shift the necessary Immigration Judges to the border, the 1.1 million backlog elsewhere will continue to mushroom. If they work on the backlog, the “border waiting line” will grow, causing extreme pressure from the Mexican Government, Congress, and perhaps the Article III Courts. Every death of an asylum seeker (there were three just within the last week or so) will be laid at DHS’s feet.

NOTE TO THE NDPA:

The outstanding historical analysis by Judge Emmet Sullivan in Grace v. Whitaker illustrates what we already know: For years, the Executive Branch through EOIR has been intentionally applying “unduly restrictive standards” to asylum seekers to artificially reduce the number of grants in violation of both the Refugee Act of 1980 and our international obligations. This disingenuous treatment has particularly targeted bona fide asylum seekers from the Northern Triangle, those asserting claims based on a “particular social group,” unrepresented individuals, women, and children.

Worse yet, this totally cynical and disingenuous Administration is using the intentionally and unlawfully “skewed system” and “illegal denials” as well as just downright fabricated statistics and knowingly false narratives to paint a bogus picture of asylum seekers and their lawyers as the “abusers” and the Government as the “defenders of the rule of law.” What poppycock, when we all know the exact opposite is the real truth! Only courageous (mostly pro bono) lawyers and some conscientious judges at both the Immigration Court and Article III levels are standing up for the real rule of law against a scofflaw Administration and its outrageous plan to send genuine refugees back into harm’s way.

Nowhere in the racially charged xenophobic actions and rhetoric of Trump, Sessions, and Whitaker, nor in the intentionally derogatory and demonstrably dishonest rhetoric of Nielsen, nor in the crabbed, intentionally overly restrictive interpretations of asylum law by today’s BIA is there even a hint of the generous humanitarian letter and spirit of the Refugee Act of 1980 and the 1951 UN Convention on Refugees or the “non-narrow” interpretation of “particular social group” so well described and documented by Judge Sullivan. On the contrary, we can well imagine folks like this gleefully and self-righteously pushing the refugee vessel St. Louis out to sea or happily slamming the door in the face of desperate Jewish refugees from Europe who would later die in the Holocaust.

Now is the time to force the Article III Courts and Congress to confront this Administration’s daily violations of law and human rights. We can develop favorable case precedents in the Article III Courts, block unethical and intentionally illegal interference by the Attorney General with Due Process in Immigration Court, and advocate changes in the law and procedures that will finally require the Executive Branch and the Immigration Courts to live up to the abandoned but still valid promise of “becoming the world’s best tribunals, guaranteeing fairness and Due Process for all.” And, the “all” certainly includes the most vulnerable among us: refugees claiming asylum!

In the end, through a combination of the ballot box, Congress, the Article III Courts, and informed public opinion we will be able to thwart the rancid White Nationalist immigration agenda of this Administration and return honest, reasonable Government that works within the Constitution and governs in the overall best interests of our country to the United States.

President Donald Trump falsely claimed that his policy of separating migrant children from their parents at the southern U.S. border was the “exact same” as the one implemented during the Obama administration.

In complaining about a “60 Minutes” segment that aired Sunday, Trump tried to deflect criticism of his “zero tolerance” immigration policy by arguing that former presidents Barack Obama and George W. Bush also separated immigrant families.

“I tried to keep them together but the problem is, when you do that, vast numbers of additional people storm the Border,” Trump tweeted Sunday. “So with Obama seperation [sic] is fine, but with Trump it’s not.”

Obama deported a record number of immigrants during his time in office which earned him the nickname of “deporter-in-chief.” Prioritizing the removal of people with criminal histories, Immigration and Customs Enforcement deported more than 2.7 million people between fiscal years 2009 and 2016.

The administration worked to quickly detain and deport migrants for several months in 2014, in response to a surge in migrant arrivals. Yet children who had come into the country with their parents didn’t get separated from them, and if families got deported, they were deported together.

The Ninth Circuit ruled that the Flores agreement ― a 1997 federal court decision requiring children to remain in custody for as little time as possible ― also applied to both accompanied and unaccompanied children. They could only be held in detention for a maximum of 20 days.

But Trump administration has gone far beyond his predecessor, separating almost 2,000 immigrant children from their parents in the spring. Many were held in caged detention centers and exposed to severe health consequences. Trump has also tried to withdraw from the Flores settlement and put forth new rules to replace it, which could lead to children being detained indefinitely.

As for deportations, the Trump administration opted to prosecute every single migrant who crossed the border illegally, expanding the Obama-era strategy of focusing on criminals.

The notion that Trump is merely carrying out Obama’s legacy is “preposterous,” Denise Gilman, director of the Immigration Clinic at the University of Texas Law School, told NBC News. “There were occasionally instances where you would find a separated family — maybe like one every six months to a year — and that was usually because there had been some actual individualized concern that there was a trafficking situation or that the parent wasn’t actually the parent.”

“The agencies were surfacing every possible idea,” a top Obama domestic policy advisor, Cecilia Muñoz, told The New York Times. “I do remember looking at each other like, ‘We’re not going to do this, are we?’ We spent five minutes thinking it through and concluded that it was a bad idea. The morality of it was clear — that’s not who we are.”

I resigned from the Department of Justice because of Trump’s campaign against immigration judges

One of the proudest days of my life was Dec. 16, 2015, when I became a naturalized citizen of the United States.

I shed tears of joy as I swore allegiance to the United States at the Los Angeles Convention Center, along with more than 3,000 other new Americans. I was celebrating a country that had welcomed me with open arms, treated me as one of its own and opened doors I hadn’t known existed. Just a few years before, in the remote village in southern Italy where I grew up, this would have been unimaginable.

Another of my proudest moments came just a year later, when I was awarded a coveted position in the U.S. Department of Justice. This happened in late November 2016, a few weeks after President Trump was elected.

Like many, I harbored reservations about Trump. But I did not waver in my enthusiasm for the job. In law school, l had learned about the role of civil servants as nonpolitical government employees who work across administrations — faithfully, loyally and diligently serving the United States under both Republicans and Democrats.

I was designated an attorney-advisor and assigned to the Los Angeles immigration court. There, I assisted immigration judges with legal research, weighed in on the strengths and weaknesses of parties’ arguments and often wrote the first drafts of judges’ opinions.

Soon enough, however, the work changed. In March 2018, James McHenry, the Justice Department official who oversees the immigration courts as head of the Executive Office for Immigration Review, announced a mandate imposing individual quotas on all the judges. Each judge would be required to decide 700 cases per year, he said.

With these new quotas, which went into effect on Oct. 1, immigration judges must now decide between three and four cases a day — while also reviewing dozens of motions daily and keeping up with all their administrative duties — or their jobs will be at risk.

The announcement of the quotas in March was the first in a series of demoralizing attacks on immigration judges this year. In May, Atty. Gen. Jeff Sessions, since fired by Trump, personally issued a decision that placed limits on the ability of immigration judges to use a practice known as administrative closure, which allows judges to put cases on indefinite hold, and which, in immigration cases, can be a tool for delaying deportation orders.

The Justice Department enforced the decision in July by stripping an immigration judge in Philadelphia of his authority in scores of cases for continuing to use administrative closure.

All this was in addition to a barrage of disparaging comments made directly by the president. In June, Trump tweeted that there is no reason to provide judges to immigrants. He also rejected calls to hire more immigration judges, saying that “we have to have a real border, not judges” and asking rhetorically, “Who are these people?”

The demoralizing effect on immigration judges was palpable. Morale was at an all-time low. I was new to civil service, but these judges, some of whom have served continuously since the Reagan administration, made clear that this was an unprecedented attack on the justice system.

I’ve long admired the independence and legitimacy that the judiciary enjoys in the United States, so I found the attacks on judges deeply disturbing and troubling. They reminded me of Trump’s Italian alter-ego, Silvio Berlusconi, who spent most of his tenure as Italy’s prime minister fighting off lawsuits by delegitimizing and attacking the judiciary, calling it “a cancer of democracy” and accusing judges of being communist.

I voiced my concerns to my supervisors and directly to Director McHenry in a letter. Seeing no opportunity to make a positive difference and unwilling to continue to lend credence to this compromised system, I submitted my resignation in July, explaining my reasons in a letter.

This was not how I wanted to end my career in government. I had hoped to serve this country for the long haul. But I couldn’t stand by, or be complicit in, a mean-spirited and unscrupulous campaign to undermine the everyday work of the Justice Department and the judges who serve in our immigration courts — a campaign that hurts many of my fellow immigrants in the process.

Thanks for speaking out Gianfranco! I published an earlier, at that time “anonymous,” letter from Gianfranco at the time of his resignation. I’m sure there are many others at EOIR who feel the same way. But, they are “gagged” by the DOJ — threatened with job loss if they “tell the truth” about the ongoing legal farce and parody of justice within our Immigration Courts.

It’s a “closed system” at war with the public it serves, the dedicated attorneys who represent migrants, the essential NGOs who are propping up what’s left of justice in this system, and the very civil servants who are supposed to be carrying out the courts’ mission. What a horrible way to “(not) run the railroad.”

Someday, historians will dig out the whole truth about the “Sessions Era” at the DOJ and his perversion of justice in the U.S. Immigration Courts. I’m sure it will be even worse than we can imagine. But, for now, thanks to Gianfranco for shedding at least some light on one of the darkest and most dysfunctional corners of our Government!

UPDATE: On Friday, President Trump signed a presidential proclamation denying asylum for immigrants who request it after crossing the border illegally rather than at a port of entry.

In a pre-midterms television ad deemed too racist for CNN, NBC and even Fox News, the White House described members of the large group of Central American migrants making their way through Mexico as “dangerous illegal criminals.” Ominous music played in the background of the ad as images of a convicted Mexican criminal were spliced with footage of the caravan.

This description was inaccurate, not to mention illogical ― aren’t hardened criminals and narco-traffickers wily enough to avoid such an arduous and physically taxing journey, and one that has captured such public attention and scrutiny?

The truth about these migrants comes down to the most basic of human needs: survival. Those who have joined the caravan have done so because their reality is simple. In the Northern Triangle countries of El Salvador, Guatemala and Honduras, where violence is endemic and justice is illusory, it’s a question of life or death.

Trump, in his roiling pre-midterm elections hate-speech tour, painted the caravan as an “invasion,” even though it’s a common occurrence that hasn’t disrupted the peace before. Traveling in a large group is far safer than traveling alone, with a human smuggler or in a small group, and migrant advocacy groups have organized large caravans for at least a decade. But beyond the president and his party’s racist rhetoric, there’s a broad assumption that such an influx of immigrants will both threaten American values and weigh heavily on the American taxpayer.

Like previous waves of immigrants, this group of new arrivals may need help to acclimate to this complex country of ours. Some will need medical care, thanks to years of living in countries with limited medical infrastructure. Others will need counseling to heal from layers of traumatic experiences against the backdrop of horrible violence ― which, lest we forget, the United States played a significant role in creating.

But they won’t need much. If I’ve learned one thing during my tenure as a trauma-focused clinician, it is this: Central American immigrants are resilient. They are driven and strong. They persevere. Despite the staggering hardships and suffering they have endured, they are defined by their ability to “seguir adelante” ― to move forward.

It’s a phrase that I’ve heard hundreds of times ― perhaps thousands ― in my therapy office. Nearly all my young clients have voiced their desire to “seguir adelante.” The 17-year-old boy who witnessed his father’s murder, finding himself alone and in grave danger; the 15-year-old girl who was kidnapped by the Zetas cartel in Mexico and held for ransom for weeks; the 18-year-old boy who served as a lookout for the MS-13 gang in exchange for his sister’s life before fleeing his country.

“Tengo que seguir adelante,” they tell me. I must continue moving forward.

The 13-year-old indigenous child who recounted months of eating “grass soup” when tortillas became too expensive. The 16-year-old who mourns the loss of her brothers ― all three of them, murdered while crossing gang-controlled territory. The 20-year-old working through the night at a bakery, then coming to school filled with energy and endless questions about the workings of American bicameral government.

Tengo que seguir adelante.

While their experiences are varied and diverse, my clients have two things in common. They have been exposed to multiple horrifying traumatic events, and they have an indefatigable desire to heal, grow stronger and move forward.

Trauma is never a desirable experience, or a deserved one. Many Central Americans have seen, experienced and survived more suffering and loss than any human should be asked to bear. But part of the “seguir adelante” mentality is the idea of being a metaphorical phoenix. Instead of allowing repeated traumatic events to crush them, many of the Central American clients with whom I work rise again as stronger, more resilient versions of themselves. While they may suffer from trauma-related symptoms like flashbacks, many are simultaneously able to devote their energy to finding a new sense of purpose in ways that I have not observed as universally in my work with American-born clients.

This phenomenon is illustrative of the positive psychology concept of post-traumatic growth, which posits that those who are exposed to trauma discover or develop new capabilities: closer social and familial bonds, increased resilience, stronger motivation and deepened spirituality.

So if the resilience of the “adelante” mentality drives these immigrants forward in spirit, what compels them to move forward physically? Perhaps they were unable to pay last month’s “impuestos de guerra,” or war taxes, to the local gang as rent for their space in the market. Maybe they refused to join the controlling gang in their neighborhood, despite the near-certainty of death if they stayed. Instead of remaining in Guatemala City, or Santa Tecla, or Tegucigalpa, they wagered it all, picked up and left.

They leave behind their families, their friends, their rich cultures, their language, their homeland. They understand the risks of the journey. They have heard the horror stories of kidnapping, rape, extortion and abandonment in the desert. Despite all this, they have decided to “seguir adelante,” fueled by hope for a brighter, safer future, to be achieved through hard work, determination and unwavering courage. Don’t those values sound reminiscent of those upon which our patchwork nation was founded?

In the end, all the migrant caravan really wants is to move forward. And as a democratic country founded on ideals of egalitarianism, isn’t it time for us to move forward, too?

The real scandal here is that although the vast majority of arrivals pass “credible fear” screening, so few them ever receive asylum. That strongly suggests that there are real problems in the “intentionally overly restrictive unduly legalistic” approach and the often dishonest ways that “in absentia orders” are used at EOIR. A better approach would probably be to allow those who have already been determined by the Asylum Office to have a “credible fear” present their initial asylum applications to those offices, rather than being forced immediately into the Immigration Courts, particularly given the current court backlogs.

The system has become far too restrictive and legalistic. Nobody has any realistic chance of winning a case without a lawyer. But, under Trump and Sessions, EOIR has abandoned efforts to insure that individuals are given reasonable access to pro bono lawyers before their cases are heard on the merits. Indeed, Sessions conducted a remarkably unethical, inappropriate, false, and vicious campaign against lawyers — right now about the only folks actually trying to make the system work and insure that our Constitution is complied with.

Of course, not every migrant from the Northern Triangle is a refugee as our law defines that term. But, we should recognize that almost all of them are decent people with good reasons for coming, even when those reasons don’t fit within our legal system. Even when they are not entitled to protection or to remain here, they deserve to be treated humanely, fairly, respectfully, and impartially, and have a full opportunity to present their claims.

The intentional demonization and dehumanization of asylum applicants, advanced by immoral and unethical folks like Trump, Sessions, Miller, and Nielsen, has now been picked up by lower level bureaucrats, who are spreading lies, promoting knowingly false narratives, and generally “taking a dive” to preserve their jobs (or, in a few cases, to gratify their own biases which match those of the Trump Administration.)

If we don’t figure out a way to stop their assault on humanity and human decency, eventually all of us will be splattered with the slime that is the Trump Administration’s approach to immigration! History will not judge us kindly for our subservience to evil.

Attorney General Jeff Sessions resigned on Wednesday at the request of Donald Trump. He served a little less than two years as the head of the Department of Justice. During that time, Sessions used his immense power to make America a crueler, more brutal place. He was one of the most sadistic and unscrupulous attorneys general in American history.

At the Department of Justice, Sessions enforced the law in a manner that harmed racial minorities, immigrants, and LGBTQ people. He rolled backObama-era drug sentencing reforms in an effort to keep nonviolent offenders locked away for longer. He reversed a policy that limited the DOJ’s use of private prisons. He undermined consent decrees with law enforcement agencies that had a history of misconduct and killed a program that helped local agencies bring their policing in line with constitutional requirements. And he lobbied against bipartisan sentencing reform, falsely claiming that such legislation would benefit “a highly dangerous cohort of criminals.”

Sessions’ attack on immigrants was equally ruthless. He compelled immigration judges to order the deportation of more unauthorized immigrants and punished them when they did not. He barred most victims of domestic violence from seeking asylum in the United States, deporting survivors back to their persecutors. He attempted to rescind the Deferred Action for Childhood Arrivals program, subjecting hundreds of thousands of young immigrants to deportation but was too inept to do so lawfully. He tried to prevent states and cities from protecting immigrants within their borders. And he implemented the “zero tolerance” family separation policy, imprisoning thousands of individuals at the border for the misdemeanor of unlawful entry, then seizing their children and locking them in cages. (Hundreds of these kids are still separatedfrom their parents.)

Meanwhile, Sessions mobilized the DOJ’s attorneys to torture immigrant minors in other ways. He fought in court to keep undocumented teenagers pregnant against their will, defending the Trump administration’s decision to block their access to abortion. His Justice Department made the astonishing claim that the federal government could decide that forced birth was in the “best interest” of children. It also revealed these minors’ pregnancies to family members who threatened to abuse them. And when the American Civil Liberties Union defeated this position in court, his DOJ launched a failed legal assault on individual ACLU lawyers for daring to defend their clients.

As he oversaw family separation, forced birth, and mass incarceration, Sessions found time to degrade LGBTQ Americans and their families. He issued a memo alleging that federal civil rights laws do not protect transgender employees, a position the Justice Department recently reiterated to the Supreme Court. He also argued that these civil rights laws do not protect gay people. His DOJ defended Trump’s ban on open transgender military service by claiming that trans people are disordered deviants. Under his leadership, the DOJ also asked the Supreme Court to rule that many businesses have a First Amendment right to turn away same-sex couples. (Sessions gave a speech to the anti-LGBTQ group that brought that case to SCOTUS, thanking them for their “important work” on behalf of religious liberty.)

The guiding principle of Sessions’ career is animus toward people who are unlike him. While serving in the Senate, he voted against the reauthorization of the Violence Against Women Act because it expressly protected LGBTQ women. He opposed immigration reform, including relief for young people brought to America by their parents as children. He voted against the repeal of Don’t Ask, Don’t Tell. He voted against a federal hate crime bill protecting gay people. Before that, as Alabama attorney general, he tried to prevent LGBTQ students from meeting at a public university. But as U.S. attorney general, he positioned himself as an impassioned defender of campus free speech.

While Sessions doesn’t identify as a white nationalist, his agenda as attorney general abetted the cause of white nationalism. His policies were designed to make the country more white by keeping out Hispanics and locking up blacks. His tenure will remain a permanent stain on the Department of Justice. Thousands of people were brutalized by his bigotry, and our country will not soon recover from the malice he unleashed.

His successor could be even worse.

Re “Who’s really an American?” editorial, Oct. 31

Questions over who ought to be considered American are complicated for those who do not look white. Ethnically and culturally, I am numerous things, which is a huge bonus because it helps me understand others. Because I have a significant amount of indigenous American heritage, I can honestly state that some of my people have been in North America for thousands of years.

However, within the last year, I have been told to go back where I came from. Since I don’t speak Spanish, being dumped in Mexico, presumably where these people want me to go, would be a challenge. Regardless, not one of my ancestors arrived here any later than the early 1800s.

On the other hand, President Trump’s mother, both of his paternal grandparents and two of his wives were not born in the United States. Trump’s present wife, who is our first lady, speaks English well enough to hold a casual conversation. In other words, the president’s family is a family of immigrants, and they have been welcomed here.

However, Trump’s rhetoric has people expressing hatred toward Americans like me, whose ancestors have been here for generations, and now he preaches against migrants who want to come here now. Perhaps Trump should learn more about the customs of his family’s adopted homeland so he can become a leader rather than a divider of people.

LONDON — President Trump’s promise to stop a caravan of Central American migrants from reaching the United States border, if necessary through military force, might seem like just another effort by the president to unilaterally dismantle international laws and accepted practices.

But there is one important difference between this and Mr. Trump’s go-it-alone defiance of climate change agreements, trade deals or arms control treaties. In attacking the long accepted means of protecting refugees and upholding stability in times of mass displacement, he’s got company. Lots and lots of company.

There is no shortage of countries that also skirt, and therefore undermine, global refugee rules. The European Union and Australia are two of the biggest offenders. Peru and Ecuador are restricting Venezuelan refugees, while Tanzania is working to push out Burundians.

In 2015, as Rohingya refugees fled Myanmar on overcrowded boats, the governments of Indonesia, Malaysia and Thailand — in a move that might make even Mr. Trump blush — pushed the boats out to sea, stranding them, to prevent them from reaching safe shores.

Still, countries tend to hide their violations by presenting themselves as following the letter of the law, or by dressing up anti-refugee measures in humanitarian terms. But Mr. Trump is selling his harsh treatment of asylum-seekers as deliberate. And even if he is not the first to breach the rules, he is contributing to their breakdown in ways that could have global consequences.

“The more brazen you get, like Trump, and the more frequent you get, you can easily imagine a norm being completely torn down,” said Stephanie Schwartz, a migration expert at the University of Pennsylvania, who added that Mr. Trump was “taking an ax” to “one of the strongest norms we’ve got in international law” — the right of a refugee to seek asylum.

To consider how that would happen and what it would mean, it helps to understand the basics of asylum and how Mr. Trump fits into its erosion.

The resurgence of populist and nationalist politics also bodes poorly. Us-vs-them movements, skeptical of international agreements and immigration, have little interest in asylum’s foundational concepts of global burden-sharing or universal rights.

If asylum rights were declining even in the era of sunny 1990s global liberalism, it is hard to imagine their doing much better in the era of Donald J. Trump, Viktor Orban and Vladimir V. Putin.

“It takes a really, really long time to build these norms, especially when they restrict government actions in some way,” Ms. Schwartz said. “It’s so much easier to take them down.”

If that happens, the consequences will be most felt far away from the United States-Mexico border, in places like Honduras, Myanmar, Jordan or Burundi, where millions of people displaced by war or persecution will have to go without the protections once promised by a world that had agreed “never again.”

COLUMBIA, Mo. — President Trump, joined by many Republican candidates, is dramatically escalating his efforts to take advantage of racial divisions and cultural fears in the final days of the midterm campaign, part of an overt attempt to rally white supporters to the polls and preserve the GOP’s congressional majorities.

On Thursday, Trump ratcheted up the anti-immigrant rhetoric that has been the centerpiece of his midterm push by portraying a slow-moving migrant caravan, consisting mostly of families traveling on foot through Mexico, as a dangerous “invasion” and suggesting that if any migrants throw rocks they could be shot by the troops that he has deployed at the border. The president also vowed to take action next week to construct “massive tent cities” aimed at holding migrants indefinitely and making it more difficult for them to remain in the country.

“If you don’t want America to be overrun by masses of illegal aliens and giant caravans, you better vote Republican,” Trump said at a rally here Thursday evening.

The remarks capped weeks of incendiary rhetoric from Trump, and they come just five days after a gunman reportedly steeped in anti-Jewish conspiracy theories about the migrant caravan slaughtered 11 people at a Pittsburgh synagogue in what is believed to be the worst anti-Semitic attack in U.S. history.

Trump has repeatedly cast the migrants as “bad thugs” and criminals while asserting without evidence that the caravan contains “unknown Middle Easterners” — apparently meant to suggest there are terrorists mixed in with the families fleeing violence in Honduras and other Central American nations and seeking asylum in the United States. The president also said Wednesday that he “wouldn’t be surprised” if liberal donor George Soros had funded the migrant groups — echoing the conspiracy theory that is thought to have influenced the accused Pittsburgh shooter.

Trump questioned again at Thursday night’s rally whether it was really “just by accident” that the caravans were forming.

“Somebody was involved, not on our side of the ledger,” Trump told the crowd. “Somebody was involved, and then somebody else told him, ‘You made a big mistake.’ ”

He also called birthright citizenship a “crazy, lunatic policy,” warning that it could allow people such as “a dictator who we hate and who’s against us” to have a baby on American soil, and “congratulations, your son or daughter is now an American citizen.”

Many of Trump’s Republican acolytes, from Connecticut to California, have followed his lead in the use of inflammatory messages, including an ad branding a minority Democratic candidate as a national security threat and a mailer visually depicting a Jewish Democrat as a crazed person with a wad of money in his hand.

Trump and his supporters argue that the media and the president’s political opponents call racism or anti-Semitism where none exists as a way to demean him and divide Americans. At a campaign rally Wednesday night in Estero, Fla., Trump sought to link his supporters to the accusations.

“We have forcefully condemned hatred, bigotry, racism and prejudice in all of its ugly forms, but the media doesn’t want you to hear your story,” Trump said. “It’s not my story. It’s your story. And that’s why 33 percent of the people in this country believe the fake news is, in fact — and I hate to say this — in fact, the enemy of the people.”

Meanwhile, an online campaign video personally promoted by Trump this week was denounced by Democrats and some Republicans on Thursday as toxic or even racist.

The footage focuses on Luis Bracamontes, a twice-deported Mexican immigrant who was given a death sentence in April for killing two California law enforcement officers in 2014. The recording portrays him as the face of the current migrant caravan, when in fact he has been in prison for four years.

The 53-second video is filled with audible expletives and shows Bracamontes smiling as he declares, “I killed f—— cops.” With a shaved head, a mustache and long chin hair, Bracamontes shows no remorse for his crimes and vows, “I’m going to kill more cops soon.”

Trump shared the video Wednesday afternoon with his 55.5 million followers on Twitter, and it remained pinned atop his Twitter page the next day. As of late Thursday afternoon, the video had been viewed 3.5 million times.

Ohio Gov. John Kasich (R), a potential 2020 challenger to the president, said Trump crossed a new Rubicon by posting the video.

“We all go through periods where we’re in a tough race and we’ve got to figure out what we should do, but at some point there’s just an ethical line that you should not cross, and I think it’s been crossed here,” Kasich said in an interview. “This latest ad is an all-time low. It’s a terrible ad, it’s designed to frighten people and it’s wrong.”

Rep. Bennie Thompson (D-Miss.) sounded a similar note, saying in a statement Thursday that Trump and Republicans “are so desperate to distract voters from their failures on everything from health care to foreign policy, they have sunk to new lows with hateful rhetoric and racist campaign ads.”

Five days from Election Day, the video underscored the dilemma facing Democrats as they work to calibrate their response to the president’s increasingly incendiary language on race and immigration.

Democratic strategist Donna Brazile said leaders of her party have two schools of thought about Trump’s video and his caravan rhetoric in general. She said they fear that reacting to it only allows the president to dictate the terms of the debate and “spread the toxins into the bloodstream of the electorate,” but that the tone is so appalling — especially coming from the president himself — that they feel compelled to speak out.

“Trump has opened up a whole new playbook to sow discord and to weaponize hate,” Brazile said. “Everyone has seen low politics. We’ve all done low politics. But Lee Atwater would be shocked at the vitriol we’re seeing today — and, man, Lee was scrappy. This is virulent. It’s bone-chilling. It’s like a toxin.”

Atwater, who died in 1991, was a Republican consultant who was known for crafting culturally divisive messages.

Rep. David N. Cicilline (D-R.I.) described the video as a “horribly racist” attempt by Trump to “prey on people’s fears and lack of information about how the immigration system works.”

Some conservatives, meanwhile, cheered the president for ramping up his focus on an issue that helped push him to victory in 2016. “The clip of convicted cop murderer Luis Bracamontes laughing in a Calif. court is something every American should see,” Fox News host Laura Ingraham wrote in a tweet.

Republican strategists say Trump’s immigration push is helping the party here in Missouri, where state Attorney General Josh Hawley is trying to unseat Democratic Sen. Claire McCaskill. Race has been a sensitive issue in the state, which was rocked by unrest in 2014 after an unarmed 18-year-old African American man was fatally shot by a white police officer in Ferguson, Mo.

Ahead of his rally here Thursday in Columbia, the speakers blared “We Are The World,” Michael Jackson’s ode to peace and inclusiveness. Several white supporters interviewed at the event rejected the notion that the president is racially divisive — and they said they resented the very suggestion.

“He’s not a racist president and I’m not a racist,” said Meredith Leon, 65, a retired small-business owner from Columbia. “We want law and order and justice for all people. I’m fed up with everything being race, race, race. Fed up!”

David Ewing, 59, a farmer in Tebbetts, Mo., said he supports Trump’s immigration agenda “100 percent.”

“I don’t think he’s racist,” Ewing said. “It’s just the far left trying to do anything they can to stop him. I ignore them, really.”

As Trump has intensified his rhetoric, a growing number of Republican candidates across the country have followed suit. Some feature graphic anti-immigrant messages and images in their campaign ads, while others have been accused of inciting anti- Semitic or anti-Muslim sentiment.

In Tennessee, a recent ad for Republican Senate nominee Marsha Blackburn features footage of the caravan and warns that it includes “gang members, known criminals, people from the Middle East, possibly even terrorists.” The ad also slams Blackburn’s Democratic opponent, Phil Bredesen, for stating that the caravan is “not a threat to our security.”

An ad released Thursday by Pennsylvania Republican gubernatorial nominee Scott Wagner features ominous music along with footage of the caravan. “A dangerous caravan of illegals careens to the border, two more behind it, and liberal Tom Wolf is laying out the welcome mat,” the ad declares, referring to the state’s Democratic governor.

A Facebook ad being run by the campaign of Rep. Rob Woodall (R-Ga.) features a photo of three heavily tattooed Latino men with the message, “I will protect Georgia from violent criminal gangs.”

And in California, the campaign of Rep. Duncan D. Hunter (R-Calif.), who has been indicted on charges of alleged misuse of campaign funds, has called his opponent, Ammar Campa-Najjar, a “national security threat” with “close family connections” to Islamist militant groups. The 29-year-old Democrat’s grandfather, who died 16 years before he was born, was a key planner of the 1972 attack on Israeli athletes at the Munich Olympics. Campa-Najjar has condemned the attack.

“Instead of making an affirmative case for his own record, he’s trying to disparage the character of a fellow American,” Campa- Najjar said in an interview. “I think that speaks volumes about his policy record.”

The messaging has filtered down to local races as well. In Connecticut, a mailer recently sent out by Republican state Senate nominee Ed Charamut’s campaign depicts Democrat Matthew Lesser as holding a wad of money with a crazed look in his eyes. Lesser is Jewish, and the ad has been denounced for promoting anti-Semitic stereotypes.

After first defending the ad, Charamut’s campaign later issued an apology to Lesser, acknowledging that “the imagery could be interpreted as anti-Semitic.”

Some candidates who have long made inflammatory remarks on immigration and race have found themselves facing a backlash in recent days. Rep. Steve King (R-Iowa), who met in August with representatives of a far-right Austrian party and declared that “Western civilization is on the decline,” was publicly rebuked Tuesday by Rep. Steve Stivers (R-Ohio), the head of the National Republican Congressional Committee. King, who previously retweeted a self-described “Nazi sympathizer” and endorsed a Toronto mayoral candidate who appeared on a neo-Nazi podcast, has also seen companies such as Land O’Lakes withdraw their support for his campaign.

Trump’s rhetoric also has prompted outrage from a handful of lawmakers from his party, particularly those who are departing Congress or are in Democratic-leaning districts. Republican leadership has largely remained silent.

Sen. Jeff Flake (R-Ariz.), a frequent critic of Trump who is retiring at the end of his current term, said in a tweet Thursday that the ad featuring Bracamontes was “sickening” and that “Republicans everywhere should denounce it.”

Rep. Carlos Curbelo (R-Fla.), whose district was won by Hillary Clinton by 16 points in 2016, said on CNN that while he hadn’t seen the ad, it was “definitely part of a divide-and-conquer strategy that a lot of politicians, including the president, have used successfully in the past.”

“I hope this doesn’t work,” Curbelo said. “I hope that type of strategy starts failing in our country, but that’s up to the American people.”

I always find it interesting when individuals who support, promote, and enable racist agendas “bristle” when confronted with the truth about their actions. Jeff Sessions is one great example of that phenomenon. But, it is what it is. Trump and his brand of GOP are running on an overtly racist platform; support for Trump simply can’t be detached from the reality of what he promotes and stands for — hate, dishonesty, intolerance, and frankly, a very grim future for a country that can’t get its act together and celebrate and use the skills, creativity, dedication, and humanity of all of its inhabitants. Whether you are conservative or liberal, the Trump platform of racism and hate can’t possibly be the keys to success as a nation. We need responsible moral leadership in American. It certainly can’t come from Trump or the GOP at this time in our history.

Get out the vote! Start the long, methodical, democratic process for regime change and restoration of true American values! Before it’s too late for all of us!
