Mexico Border Deal to Avoid Tariffs Would Endanger Lives

New York City—In response to reports that the Mexican government is planning to make a deal with the United States to avoid tariffs threatened by President Trump, Human Rights First’s Eleanor Acer issued the following statement:

President Trump is trying to bully another country into endangering the lives of vulnerable men, women, and children, who want nothing more than to live in freedom and safety. Mexico and Guatemala are not—in a legal or practical sense—safe countries for many refugees. In Mexico too many refugees face kidnapping, assault, and murder.

People seeking refuge are not required to seek asylum in the first country they set foot in. In fact, many face grave dangers in neighboring countries, as well as serious risks that they will be returned to their country of persecution.

Such a plan would not only makes a mockery of U.S. law and treaty commitments, but would also return refugees to places where their lives are in danger. It is yet another abdication of leadership, setting an abysmal example for other countries around the world.

Instead of more attempts to block and punish people seeking refuge, the United States needs real solutions that restore order and uphold America’s refugee laws and treaty commitments, including:

  1. Tackle the root causes pushing people to flee the Northern Triangle countries through a targeted strategy that leverages both diplomacy and aid, focusing on effective programs that reduce violence, combat corruption, strengthen rule of law, protect vulnerable populations and promote sustainable economic development.
  2. Launch a major initiative to enhance the capacity of Mexico and other countries—which are already hosting growing numbers of refugees—to provide asylum, host, protect, and integrate refugees, along with a robust regional resettlement initiative that provides orderly routes to the United States and other countries while safeguarding asylum.
  3. Immediately end the dysfunction at the border, and instead launch a public-private humanitarian initiative and a long overdue case management system to actually manage asylum cases.
  4. Fix the asylum and immigration court adjudication systems to provide fair, non-politicized and timely decisions.

As usual, Trump’s outrageously illegal and immoral proposal relies on:

  • Bullying weaker countries;
  • A gullible public;
  • A cowardly GOP Congress;
  • Complicit courts.

A simple perusal of the country condition materials publicly available on the EOIR and Department of State websites shows that the idea that either Mexico or Guatemala are “safe” countries where refugees “would have access to a full and fair procedure for determining a claim to asylum or equivalent temporary protection,” as required by U.S. law, is preposterous.

Mexico’s asylum adjudication system is plagued by bribery, corruption, and incompetence. It adjudicated only about 10, 000 cases in the last reported period, denying the overwhelming majority. Moreover, gangs and cartels operate freely throughout the Northern Triangle countries and Mexico. Our State Department Report acknowledges that the same organized gangs who force people to leave the Northern Triangle can also harm them in Mexico.

Guatemala is a highly corrupt country basically without a functioning asylum adjudication system.  It is a major sender of asylum applicants to other countries. The Guatemalan Government is unable to maintain order and protect its own citizens, let alone refugees from nearby countries.

Also, we are encouraging Mexico and Guatemala to use troops and military force against asylum seekers — something our own laws do not permit.

Essentially, the Trump Administration seeks to “get away with murder.” In two years they have turned the U.S. from a leading defender of human rights to a major international human rights violator. So, why are we allowing our Government to get away with such dishonest, morally bankrupt, and illegal proposals?

Even if these corrupt proposals go into effect, it seems doubtful that they will stem the follow of refugees in the long run. While there might be a short term downturn, eventually smugglers will adjust to the new policies and desperate individuals will find different routes to the United States. They will be more dangerous, so more will die.

Perhaps we will see  “Central American Boat People” and more deaths at sea. Maybe there will be more “Golden Ventures.” More deaths at the border will be inevitable as smugglers seek to evade the Border Patrol and get to the interior. Perhaps the human smuggling action will switch to the even longer U.S. Canada border. How about a “Northern Wall”  from the Atlantic to the Pacific?

As long as the U.S. stubbornly refuses to acknowledge and address the causes of migration it will continue, in extralegal channels as necessary and as the market “push pull factors” determine. More focus on barring refugees means less focus on drug smugglers and others who present a real threat to our safety and security.

Also, smugglers will be able to change a premium — so those who are willing to take the risk and outsmart the new system will reap even higher profits than the increased ones Trump has already conferred upon them with his maliciously incompetent policies to date.  Finally, walls, jails, cages, abuses, family separations, prosecutions, racist rhetoric, armed violence, tariffs, exploitation, massive violations of our Constitution and international laws, or whatever won’t stop desperate refugees from coming. But we will eventually convince refugees to give up on the U.S. legal system and just find ways to get beyond the border and lose themselves in the interior. No enforcement system, no matter how cruel, repressive, expensive, and lawless will be able to get rid of more than a fraction of those who don’t want to be found after reaching the interior.

Moreover, if Trump’s actions succeed in destabilizing Mexico, then Mexican migration, which has actually been a negative flow recently, will resume in large numbers, also adding to the pressure on our borders. The worse things get in Mexico, the less likely that the Mexican Government will stop their citizens from heading north. So, there is every reason to believe that Trump’s “malicious incompetence” will make things even worse for everyone  — but particularly for those who are most vulnerable — desperate asylum seekers!

Another future possibility to ponder:  Tired of being publicly bullied, humiliated, and dealing with a dishonest unreliable idiot and his incompetent sycophants, Mexico and Canada will “wise up” and cut a trade deal with China that really gives them leverage and puts the squeeze on the U.S. And, why wouldn’t China love a chance to establish factories just across our Northern and Southern borders that could also serve as “listening posts” and repositories for hijacked U.S. technology? Maybe the EU and India could also be cut into the deal.

We are diminishing ourselves as a nation, but it won’t stop human migration!

Homeland Security Regional Compact Plan Won’t Address Root Causes of Refugee Crisis

New York City—In response to today’s announcement that Department of Homeland Security Secretary Kirstjen Nielsen is discussing the development of a regional compact plan with Central American countries in the northern triangle, Human Rights First’s Eleanor Acer issued the following statement:

The so-called compact announced today sounds like a short-sighted and heavy-handed attempt to stop people in desperate need of safety from finding it in the United States, rather than an actual commitment to address underlying human rights violations in the region. It is yet another move from an administration that has spent the past two years dismantling the systems put in place to protect the world’s most vulnerable people.

This announcement does not reflect any commitment to address the actual root causes pushing people to seek protection—political repression, gender-based persecution, brutal murders, and other human rights violations.

The Trump Administration is enlisting the very countries that people are fleeing to prevent the escape of individuals plagued by this persecution and violence. The United States should certainly work with countries in the region to counter and prosecute smugglers and traffickers who prey on migrants and asylum seekers. This plan, however, aims to stop asylum seekers who do not employ smugglers but travel with other people for safety through dangerous territories.

Human Rights First urges the Trump Administration to implement regional strategies that strengthen the rule of law and human rights conditions in Central America, strengthen refugee protection in Mexico and other countries, and stop its efforts to block refugees from asylum in the United States.

It’s “Kakistocracy in Action” — malicious incompetence institutionalized. Certainly, Nielsen has to be the worst excuse ever for a DHS Secretary. Indeed, those who actually might threaten our security must be “licking their chops” at her continuous display of idiotic Trump sycophancy and White Nationalist lies and obsessions with bedraggled families seeking refuge while smugglers, drug traffickers, cartels, and gangs reap profits from her failed policies and take delight in her inability and unwillingness to address the real security problems.

While real human rights crises are unfolding, and real human lives are in danger, the Trump Administration dawdles away time and resources on endless “designed to fail” White Nationalist gimmicks that appear intended to enable and encourage persecution rather than addressing the problems that cause forced migration.

The Obama Administration did a genuinely lousy job of addressing the refugee and human rights issues in the Northern Triangle. But, Trump, Nielsen, and McAleenan are making to Obama group look like humanitarian geniuses by comparison.

As the great Casey Stengel once said while attempting to manage the 1962 NY Mets: “Can’t anybody here play this game?” Sadly, in the case of the Trump Administration, the answer is a resounding “No.”

Bad things happen to countries that allow themselves to be run by malicious incompetents (that is, a Kakistocracy).

As I have said before, “We Are diminishing ourselves as a nation, but that won’t stop human migration.”

The fate of tens of thousands of immigrants’ court cases could rest in the hands of Attorney General Jeff Sessions.

That’s not a metaphor. Sessions has stepped into the immigration system in an unprecedented manner: giving himself and his office the ability to review, and rewrite, cases that could set precedents for a large share of the hundreds of thousands of immigrants with pending immigration court cases, not to mention all those who are arrested and put into the deportation process in future.

He’s doing this by taking cases from the Board of Immigration Appeals — the Justice Department agency that serves as a quasi-appellate body for immigration court cases — and referring them to himself to issue a decision instead.

Sessions isn’t giving lawyers much information about what he’s planning. But he’s set himself up, if he wants, to make it radically harder for immigration judges to push cases off their docket to be resolved elsewhere or paused indefinitely — and to close the best opportunity that tens of thousands of asylum seekers, including most Central Americans, have to stay in the United States. And he might be gearing up to extend his involvement even further, by giving himself the authority to review a much bigger swath of rulings issued in the immigration court system.

The attorney general has the power to set immigration precedents. But attorneys general rarely used that power — until now.

Most immigrants who are apprehended in the US without papers have a right to a hearing in immigration court to determine whether they can be deported and whether they qualify for some form of legal status or other relief from deportation. The same process exists for people who are caught crossing into the US but who claim to be eligible for some sort of relief, like asylum, and pass an initial screening. In both cases, only after the judge issues a final order of removal can the immigrant be deported.

Immigration courts aren’t part of the judicial branch; they’re under the authority of the Department of Justice. Their judges are supposed to have some degree of independence, and some judges are certainly harsher on immigrants and asylum seekers than others. But their decisions are guided by precedent from the Board of Immigration Appeals, which is basically the appellate court of the immigration system and which also answers to the DOJ and the attorney general.

If the attorney general doesn’t like that precedent, he has the power to change it — by referring a case to himself after the Board of Immigration Appeals has reviewed it, issuing a new ruling, and telling the immigration courts to abide by the precedent that ruling sets in future.

Attorneys general rarely ever use that power. Sessions has used it three times since the beginning of 2018; all three cases are still under review. “I can’t remember this many decisions being certified in the past five to 10 years,” says Kate Voigt of the American Immigration Lawyers Association.

In theory, Sessions’s office is supposed to make its decision based on amicus briefs from outside parties, as well as the immigrant’s lawyer and the Immigration and Customs Enforcement (ICE) prosecutor. But advocates and lawyers’ groups say they can’t file a good brief if they don’t know what, exactly, the cases Sessions is getting involved in actually are — and Sessions is withholding that information.

In one of the cases Sessions has referred to himself, the DOJ refused to provide a copy of the decision that Sessions is reviewing or any information about where the case came from and who the immigrant’s lawyer was. In another case, congressional staff happened to find the decision under review on a DOJ website days before the deadline for amicus briefs.

That opacity makes it basically impossible to know whether Sessions is planning to issue relatively narrow rulings or very broad ones. In the case in which the decision under review was discovered by congressional staffers, both the immigrant’s lawyer and the Department of Homeland Security (serving as the prosecution) asked Sessions’s office to clarify the specific legal question at hand in the review — in other words, to give them a hint of the scope of the potential precedent being set. They were denied.

“We have no idea how broad he’s going,” said Eleanor Acer of the advocacy group Human Rights First. “The way it was framed was totally inscrutable.”

Sessions’s self-referrals could affect a large portion of immigration court cases

To Acer and other lawyers and advocates, that uncertainty is worrisome. All three of the cases Sessions has referred to himself center on questions that, depending on how they’re answered, could result in rulings that tip the balance of tens of thousands of immigration court cases.

Can judges remove cases from the docket? In the case Sessions referred to himself in January, Matter of Castro-Tum, he asked the question of whether judges are allowed to use something called “administrative closure” — to remove a case from the docket, essentially hitting the pause button on it indefinitely.

Administrative closures were common under the Obama administration, as ICE prosecutors used it to stop the deportation process for “low-priority” unauthorized immigrants. They’re already much less common under Trump — a Reuters analysis found that closures dropped from 56,000 in Obama’s last year in office to 20,000 in Trump’s first year — but that’s still 20,000 immigrants whose deportation cases were halted, and 20,000 cases cleared out of an ever-growing immigration court backlog.

If it’s written broadly enough, the forthcoming Sessions decision could prevent administrative closure from being even a possibility.

Are victims of “private violence” eligible for asylum? In a March self-referral, Sessions asked whether a judge should be allowed to grant asylum to a domestic violence survivor because she was a victim of “private violence” — violence that wasn’t state-based. Theoretically, asylum is supposed to be available only for victims of certain types of persecution, but some judges have found that women in some countries who experience domestic violence are being persecuted for membership in the “social group” of being women.

The self-referral has raised red flags for a lot of domestic violence groups, which are worried that Sessions is about to cut off an important path to relief for some immigrant survivors. But it could be even broader — gang violence is also “private” violence, and the “social group” clause has also been used to give asylum to people fleeing gang violence in Honduras and El Salvador.

“There is no dispute under US law that asylum claims may be based on persecution conducted by nongovernmental actors,” Human Rights First’s Acer told Vox, as long as the asylum seeker shows her government was unwilling or unable to protect her. But Sessions appears to be “directly attacking, essentially, whether a nonstate actor” can ever qualify as a persecutor.

For many of the thousands of Central Americans who’ve entered the US in recent years, that provision has been their best chance to stay here rather than being sent home. And it could be taken away with a stroke of Sessions’s pen.

Can an immigration judge wait for an application to be approved? In his other March self-referral, Sessions appears to be taking aim at “continuances” — a practice of judges kicking the can down the road in a case by scheduling it for the next available court date sometime in the future (often several months) in order for something else to be prepared or resolved.

Sometimes, continuances are requested because the immigrant in question is also involved in another legal proceeding that’s relevant to the case. One example: An immigrant put into deportation proceedings by ICE, in an immigration court run by the DOJ, may still be eligible to apply for legal status from US Citizenship and Immigration Services while waiting for their application to be processed. Sessions is now asking himself whether it’s legally valid to grant a continuance so the parallel legal proceeding can get resolved.

This could affect tens of thousands of cases. A 2012 DOJ Office of the Inspector General report found that more than half of cases examined involved continuances — and one-quarter of all continuances involved requests from the immigrant to delay a case while an application was filed or processed (or a background check was completed).

At the end of April, lawyers’ concern that Sessions is gearing up to issue a broad ruling in this case was amplified when a DOJ notification in the case mentioned two other immigrants whose cases were being combined with this one — indicating to some lawyers that the facts in the original case didn’t lend themselves to the ruling Sessions had already decided to give.

Furthermore, lawyers and advocates worry that Sessions is gearing up to restrict continuances in other circumstances — like allowing immigrants time to find a lawyer or prepare a case.

Sessions’s meddling might not make courts more efficient, but it will make them more brutal

Sessions and the Trump administration claim they’re trying to restore efficiency to a backlogged court system that poses the biggest obstacle to the large-scale swift deportation of border-crossing families and to unauthorized immigrants living in the US. But lawyers are convinced that Sessions’s diktats, if they’re as broad as feared, would just gum up the works further.

“If the attorney general were seriously concerned about the backlog, as opposed to a desire for quick deportations, he would be focused on transferring as many cases away from” immigration judges as possible, attorney Jeremy McKinney told Vox — not forcing them to keep cases on their docket that they would rather close, or that could be rendered moot by other decisions. It’s “not smart docket control.”

And Sessions isn’t simply planning to issue these rulings and walk away. His office is planning to give itself even wider power over the immigration court system. A notice published as part of the department’s spring 2018 regulatory agenda says, “The Department of Justice (DOJ) proposes to change the circumstances in which the Attorney General may refer cases to himself for review. Such case types will include those pending before the Board of Immigration Appeals (BIA) but not yet decided and certain immigration judge decisions regardless of whether those decisions have been appealed to the BIA.”

In other words, even when a DOJ judge makes a ruling in an immigrant’s favor and ICE prosecutors don’t try to appeal the ruling, the attorney general’s office could sweep in and overrule the judge.

Sessions’s decrees would probably result in more immigration judge decisions getting appealed to the Board of Immigration Appeals (further gumming up the works) as judges try to interpret precedents Sessions has set, and from there to federal courts of appeals. Many federal judges aren’t keen on the immigration court system, especially when its appeals gum up their own dockets, and they might step in to push back against Sessions’s changes.

In the meantime, though, immigration judges will have fewer ways to move cases off their docket and fewer avenues for asylum seekers to qualify for relief, as they’re simultaneously facing serious pressure to make quick decisions in as many cases as possible. The more pressure is put on immigration judges from above, and the more Sessions moves to block their safety valves, the less likely they are to give immigrants a chance to fully make their cases before they bang the gavel on their deportations.

All too true. The real question: Will he be able to get away with this farce of “judicial justice” by probably the most clearly and strongly biased public official short of Trump himself.

An unbiased, impartial decision-maker is a key requirement for Due Process under the Constitution. Having Sessions sit  as a the “ultimate judge” in Immigration Court clearly violates that cardinal principle.

For many years, the inherent conflict of interest in having supposedly “fair hearings” run by an enforcement agency in the Executive Branch has basically been swept under the table by Congress and the Article IIIs. As with many things, Sessions’s dogged determination to do away with even the pretense of fairness and Due Process in immigration hearings might eventually force the Article IIIs to confront an issue they have been avoiding since the beginning of immigration laws.

Whether and how they face up to it might well determine the future of our republic and our current Constitutional form of government!

GONZO’S WORLD: SESSIONS GREETS MELANIA’S “BE NICE TO KIDS” INITIATIVE WITH ATTACK ON MIGRANT CHILDREN AND THEIR FAMILIES – Also Plans “Aimless Docket Reshuffling” Initiative To Fill U.S. District Courts With Minor, Non–Violent Misdemeanants Diverting Resources From More Serious Criminals

In a sweeping enforcement change, Donald Trump’s administration will increasingly prosecute members of immigrant families who cross the border illegally, even if that means splitting children from their parents and regardless of whether they’re seeking safety in the U.S., Attorney General Jeff Sessions said Monday.

It’s already happening. On April 27, Border Patrol officers picked up a 30-year-old Salvadoran woman, Morena Mendoza Romaldo, with one of her children after she crossed into the U.S. near San Diego. She fled El Salvador because of sexual violence, according to court filings. She clearly told Border Patrol that she was afraid to return there; an arrest narrative filed in court has “credible fear claim” written on it.

Crossing the border illegally is a misdemeanor punishable by up to six months in jail. But previously the Justice Department rarely targeted family units — as the Border Patrol describes parents who cross with their children — for prosecution. Instead, authorities typically routed migrant families to immigration courts, and they were often released from detention after three weeks because of a court order limiting how long undocumented children may remain locked up. People with credible fear of being returned to their native countries were likewise often sent to immigration court instead of being criminally prosecuted.

But now, with the Trump administration looking for ways to crack down on policies its officials deride as “catch and release,” the response has gotten harsher.

Mendoza’s case was one of 11 immigration prosecutions filed against alleged members of a caravan of asylum-seeking Central Americans. At least two others were also separated from their children after facing prosecution for illegal entry.

Sessions and Immigration and Customs Enforcement’s acting Director Thomas Homan said during a press conference in San Diego that the Department of Homeland Security would refer for prosecution all cases of people crossing illegally, as part of a zero-tolerance policy — regardless of whether they’re fleeing persecution or traveling with children.

“People are not going to caravan or otherwise stampede our border,” Sessions insisted. He later said, “We don’t want to separate families, but we don’t want families to come to the border illegally.”

It will be up to individual U.S. attorneys to decide how many of the migrants will face criminal charges. In the past, limits on the number of government attorneys or courtroom capacity led authorities to instead route most people caught at the border through the traditional deportation process without convicting them of a crime first. Last week Sessions announced that the Justice Department hired 35 more assistant U.S. attorneys to help prosecute immigration crimes in the five federal districts that touch the U.S.-Mexico border. Immigration prosecutions have taken up roughly half the federal criminal docket since 2008, after policy changes pioneered by George W. Bush, institutionalized under Barack Obama and now enthusiastically embraced by Trump.

The zero-tolerance policy won’t apply to those who seek asylum at ports of entry, which is not illegal, although the Trump administration has publicly urged migrants to stay in Mexico instead. At least two of the 11 alleged caravan members facing prosecution for illegal entry — Olga Esmeralda George and Marbel Yaneth Ramirez-Raudales — said they tried to initiate asylum claims at a nearby port of entry but were turned away, according to court filings.

Sessions’ plans are already facing opposition from the San Diego Federal Public Defenders’ Office. Illegal entry prosecutions are often open and shut cases. But attorney Eric Fish has asked the court to dismiss three of the 11 alleged caravan members’ cases, arguing that his clients, including Mendoza, were targeted for political reasons that amount to unconstitutional discrimination.

In court filings littered with Trump’s tweets excoriating the caravan, Fish contended that Border Patrol agents arrested the three defendants at the same time as a group of Indian nationals. But the Indians were never prosecuted.

“The government cannot choose its defendants based on their alleged country of citizenship, but that’s exactly what it did here,” he wrote in a court filing. “The Court should not stand for such invidious discrimination, and should dismiss the complaint.”

Fish is also disputing the $10,000 bonds set by the court, arguing that his clients present no flight risk and could be instead monitored by GPS and released on their own recognizance.

The cases highlight how much energy Sessions is devoting to some of the pettiest crimes possible. Until he announced his zero-tolerance policy, illegal-entry prosecutions were all but unheard of in San Diego. And in the three contested cases, the government offered to free the defendants on time served if they pleaded guilty.

At least two of the defendants said they intend to seek asylum, which generally exempts people from criminal prosecution for illegally crossing the border. One of them, Yaneth, attempted to turn herself in at a legal port of entry but was turned away, according to court filings. Under U.S. law and international treaty obligations, Customs and Border Protection is required to let in migrants who say they fear persecution in their country of origin. But CBP faces a lawsuit in the Southern District of California alleging that the agency often flouts those rules.

Organizers with the caravan disputed that the migrants facing prosecution were affiliated with their group, though they said it’s possible that some had joined the caravan and later left it. At its peak, the number of migrants traveling with the caravan topped 1,000, but its numbers dwindled to fewer than 300 as some decided to remain in Mexico, were counseled that their asylum claims would be hard to press in U.S. courts or were repelled by the open hostility of top Trump administration officials.

“It’s pretty obvious that they don’t know who is part of the caravan or not,” said Alex Mensing — an organizer with Pueblos Sin Fronteras, which coordinated the caravan — noting that one of the defendants, Eric Alberto López Robles, is a Mexican national and that the caravan did not work with any Mexican adults. “It just doesn’t add up.”

Those crossing with the caravan were instructed to go through a legal port of entry to make their claims and were advised against crossing illegally, according to Nicole Ramos, the director of Al Otro Lado, a nonprofit group that is offering legal services to the caravan’s members. Ramos, who once worked as a federal public defender, said that in legal workshops, she warned about the threat of prosecution.

“After people were given transit visas, perhaps some of them went in other directions, but they were not integrated into the caravan,” she said. “The goal of the caravan was to get to Tijuana and present themselves legally. And as part of the legal orientation we gave, we specifically advised people about criminal prosecutions.”

Prosecuting people who are seeking asylum could violate international law, according to human rights advocates. Border Patrol was warned about this at least once, when the DHS Office of the Inspector General issued a report in 2015 saying the agency risked violating U.S. treaties by referring people for prosecution even though they expressed fear of persecution in their native country.

Immigrant rights advocates have been hearing for months from parents who were separated from their children and in some cases aren’t sure how to get in touch with them. The practice “is simply barbaric,” said Eleanor Acer, who leads the refugee protection program at Human Rights First.

“If other countries treated people seeking refugee protection in this way,” she said, “the United States would be appalled.”

“During a public appearance at the Department of Justice on Thursday, Attorney General Jeff Sessions called on Congress to curb due process for immigrants by making it more difficult for an individual to seek asylum and to increase fast-track deportations.

In his speech, Sessions focused heavily on America’s long-standing system that provides asylum to those seeking safety and protection, claiming it is “subject to rampant abuse and fraud.” He argued that increased claims of “credible fear”—where an individual apprehended at the border expresses fear of persecution if returned to their home country—are an indicator of asylum seekers abusing loopholes in the immigration system.

The fact is that the uptick in protection claims has corresponded with the dramatic increase in violence in Central America during that same period. In particular, in the spring and summer of 2014, when many thousands of women and unaccompanied children from Central America journeyed to the United States seeking asylum, they were fleeing unprecedented violence in Honduras, Guatemala, and El Salvador, then the murder capital of the world.

Thursday’s call for cracking down on children and asylum seekers at the border is illogical given the dramatic drop in border crossings this past year, which Sessions himself admitted at the beginning of his speech.

The Attorney General also focused his attention on the growing backlog of immigration court cases and called for an expansion of expedited removal, initially proposed in President Trump’s January immigration executive orders. Expedited removal is a process by which immigration officers can quickly deport certain noncitizens who are undocumented without bringing them before an immigration judge.

This rapid process, which is currently only applied to individuals apprehended within two weeks of arrival and 100 miles of the Canadian or Mexican border, increases the possibility that people are being erroneously deported from the United States, potentially to imminent harm or death. Expansion of this process would further curtail due process by preventing more individuals from having their day in immigration court.

Since many, but not all, of these changes require legislative action, Sessions urged Congress to pass laws in order to effectuate these changes. Many of these ideas came directly from the White House “principles” released last week.

Thursday’s attack on children and asylum seekers, coupled with calls to curtail due process for those seeking protection, struck a new low. Sessions’ speech was just more of the same from an administration that has continuously shown it is determined to make America a less welcoming nation.“

In his speech to the EOIR — obviously intended to impede the fair and impartial adjudication of asylum claims by judges who work for him by instilling bias against asylum seekers — Sessions cited a 2015 GAO Report on Asylum Fraud. That report did not cite any increase in Southern Border asylum fraud by individuals fleeing the Northern Triangle of Central America.  The anecdotal incidents noted in the report related to Chinese asylum fraud. That fraud was actually detected and successfully prosecuted by DHS.

Additionally, the GAO Report not recommend any changes in the procedures for adjudicatiing asylum claims in Immigration Court. It did recommend improvements in fraud detection techniques by DHS and EOIR.

To my knowledge, Sessions has never adjudicated any asylum claim. I’ve adjudicated lots of Central American asylum claims. Almost all of them involved individuals with credible evidence that they would face harm upon return. Some were able to fit that harm within the protection laws, and others were turned down, many because our laws have been skewed against granting protection to Central Americans. But few, if any, involved apparent fraud.

Gonzo attacked individuals who are merely seeking fair and impartial due process and decent humane  treatment (not unjustified detention) with respect to their claims for protection under U.S. and international law. I agree with Bliesblatt that Gonzo “struck a new low” in a career filled with “cheap shots” on the most vulnerable among us.

“When people arrive at the border seeking asylum from persecution, the United States gives them the benefit of the doubt. As long as they can show there’s a “significant possibility” that they deserve protection, they’re allowed to stay and make their case to an immigration judge. President Donald Trump and Republicans in Congress want to change that.

On Sunday, the Trump administration demanded that Congress overhaul the US asylum system as part of any legislation to protect the nearly 700,000 undocumented immigrants known as Dreamers from deportation. The White House’s asylum proposal, laid out in nine bullet-pointed items as part of the broader immigration plan, appears to be modeled on the Asylum Reform and Border Protection Act, a bill that Republicans on the House Judiciary Committee approved in July. The bill, which has not been passed by the full House, would make it easier for the Department of Homeland Security to quickly reject asylum claims and force most asylum seekers to remain in detention while their cases are decided. The overall effect would be to transform a system for protecting persecuted people, created in the wake of World War II, into a much more adversarial process.  

At a hearing in July, Rep. Zoe Lofgren (D-Calif.) warned that the GOP proposal would “all but destroy the US asylum system.” Now Trump is trying to fold those changes into a deal to protect the Dreamers—undocumented immigrants who came to the country as children—who were previously covered by Barack Obama’s Deferred Action for Childhood Arrivals program.

Eleanor Acer, an expert on refugees at the advocacy group Human Rights First, saidin a statement Monday that Trump’s demands will “block those fleeing persecution and violence from even applying for asylum, and punish those who seek protection by preventing their release from immigration detention facilities and jails.”

But Republicans like Rep. Bob Goodlatte (R-Va.) argue that asylum reform is needed to address “pervasive” fraud, such as false claims of persecution. Asylum claims from the “Northern Triangle” countries of Guatemala, El Salvador, and Honduras have been a major focus for Republicans. Between 2013 and 2015, there were more asylum claims from the Northern Triangle, which has been terrorized by MS-13 and other gangs, than in the previous 15 years combined. A 2015 report from the Government Accountability Office found that the United States has “limited capabilities to detect asylum fraud.” But the scope of the problem is not known. Leah Chavla, a program officer at the Women’s Refugee Commission, says going after fraud is misguided in light of the many checks and balances that are already in place. 

The real “fraudsters” here are the GOP restrictionists, led by folks like Goodlatte, Miller, and Sessions, trying to fob off their knowingly false and contrived narrative on America. Shame!

Second, the current system intentionally denies lawyers to the respondents in detention in obscure locations along the Southern Border, specifically selected to make it difficult for individuals to exercise their rights. Raising the standards would virtually guarantee rejection of all such asylum seekers without any hearing at all. The standard for having asylum granted is supposed to be a generous “well-founded fear” (in other words, a 10% chance or a “reasonable chance”). In fact, however, DHS and EOIR often fail to honor the existing legal standards. Forcing unrepresented individuals in detention with no chance to gather evidence to establish that it is “more likely than not” that they would be granted asylum is a ridiculous travesty of justice.

Third, access to lawyers, not detention, is the most cost-effective way to secure appearance at Immigration Court hearings. Individuals who are able to obtain lawyers, in other words those who actually understand what is happening, have a relatively low rate of “failure to appear.” In fact, a long-term study by the American Immigration Council shows that 95% of minors represented by counsel appear for their hearings as opposed to approximately 67% for those who are unrepresented. Rather than curtailment of rights or expensive and inhumane detention, the best way of insure that all asylum applicants appear for their scheduled hearings and receive full due process would be to insure that the hearings take place in areas with adequate supplies of pro bono and “low bono” counsel and that hearings are scheduled in a predictable manner that does not intentionally outstrip the capabilities of the pro bono bar.

Fourth, a rational response to fraud concerns would be building better fraud detection programs within DHS, rather than denying vulnerable individuals their statutory and constitutional rights. What would a better system look like:  more traditional law enforcement tools, like undercover operations, use of informants to infiltrate smuggling operations, and much better intelligence on the operations of human trafficking rings. And, there’s plenty of resources to do it. DHS just lacks the ability and/or the motivation. Many of the resources now wasted on “gonzo” interior enforcement and mindless detention — sacking up janitors and maids for deportation and detaining rape victims applying for asylum — could be “redeployed” to meaningful, although more challenging, law enforcement activities aimed at rationally addressing the fraud problem rather than using it as a bogus excuse to harm the vulnerable.

Fifth, Goodlatte’s whole premise of fraud among Southern Border asylum applications is highly illogical. Most of the Southern Border asylum claims involve some variant of so-called “particular social groups” or “PSGs,” But, the entire immigration adjudication system at all levels has traditionally been biased against just such claims. and, it is particularly biased against such claims from Central America. PSG claims from Central America receive “strict scrutiny’ at every level of the asylum system! No fraudster in his or her right mind would go to the trouble of “dummying up” a PSG claim which will likely be rejected. No, if you’re going to the trouble of committing fraud, you’d fabricate a “political or religious activist or supporter claim”  of the type that are much more routinely granted across the board.

Don’t let Trump, Miller, Sessions, Goodlatte, and their band of shameless GOP xenophobes get away with destroying our precious asylum system! Resist now! Resist forever! Stand up for Due Process, or eventually YOU won’t any at all! Some Dude once said “as you did it to one of the least of these my brothers, you did it to me.” While arrogant folks like the restrictionists obviously don’t believe that, it’s still good advice.

Washington, D.C.—Human Rights First today urged members of the House Judiciary Committee to reject the Asylum Reform and Border Protection Act when it marks up the legislation today. The bill would severely undermine access to protection for genuine refugees.

“The proposed legislation does nothing to enhance the integrity of our asylum system, but instead puts individuals, particularly women and children, at grave risk of return to persecution, trafficking, and death in their home or third countries,” said Human Rights First’s Eleanor Acer. “Instead, this bill is a disgraceful attempt to evade U.S. refugee protection responsibilities and foist them on to other countries. Not only would this effort undermine U.S. global leadership, but it would set a poor example for the countries hosting the vast majority of the world’s refugees. The bill would make it even more difficult for refugees to receive asylum in our already rigorous asylum system and leave vulnerable children, families, and other individuals at risk of severe harm or death.”

The bill seeks to make it harder for those fleeing persecution and torture to file for asylum in the United States, a process already fraught with obstacles. Several groups of particularly vulnerable individuals—including children, women, and LGBTQ asylum seekers—would be disproportionately impacted by certain provisions, which essentially eliminate protection for refugees who have been victims of crimes in their home countries. The bill attempts to eliminate the statutory basis for release on parole, which would leave asylum seekers detained in violation of U.S. treaty obligations, and held in jails and facilities with conditions similar to jails despite the existence of more cost-effective and humane alternative measures that result in compliance and appearance at hearings. The bill also seeks to ban federal government-funded counsel, including for unaccompanied children, some of whom are toddlers or even younger.

Human Rights First, along with 73 other rights and immigration groups, sent a letter to members of the committee today urging them to reject the legislation. Among many changes to law, the Asylum Reform and Border Protection Act of 2017 would:

Raise the expedited removal screening standard to an unduly high level. The bill would require that an asylum seeker—in order to even be allowed to apply for asylum—not only show a “significant possibility of establishing eligibility for asylum” but also prove it is more likely than not that his or her statements are true—the standard for a full adjudication, not a summary screening interview.
Appear to prevent arriving asylum seekers who have passed the credible fear screening process from being paroled from immigration detention, instead leaving them in jails and jail-like facilities for months or longer, even though there are more fiscally-prudent and humane alternatives that have been proven effective.
Deny asylum to large numbers of refugees based on transit or stays in countries where they had no legal status, or no lasting legal status, and to which they cannot be returned in most cases. This provision would seek to deny asylum to many refugees who have passed through Mexico, despite the risks and severe protection deficiencies there. In addition, refugees—who may have languished in a refugee camp for decades without the ability to legally work, access education or secure legal permanency—with valid claims would be left in a state of uncertainty, with no prospects for a durable solution and no secure future for themselves and their children.
Allow asylum applicants and unaccompanied children to be bounced to third countries (such as Mexico) despite the dangers and lack of protection from return to persecution there, and in the absence of any agreement between the United States and the countries in question for the reception of asylum seekers.
Categorically deny asylum and withholding of removal to refugees targeted for criminal harm—including rape and killing—based on their membership in a particular social group in their countries of origin. This extraordinarily broad provision would deny protection to asylum seekers who have been beaten for being gay, who have suffered horrific domestic abuse, or who have been treated as property by virtue of their status as women, to name but a few examples. It would also effectively eliminate asylum eligibility or withholding of removal for asylum seekers who have been victims of or who fear persecution related to gang violence in their home country.
State that the government not bear expense for counsel. The bill also states that in no instance will the federal government bear expense for counsel for anyone in removal or appellate proceedings. Children – including toddlers – the mentally disabled, and other vulnerable people cannot represent themselves in our complex immigration system.
Last week Human Rights First released a new report assessing the dangers facing refugees in Mexico in the wake of proposals from the Trump Administration and Congress to block refugees passing through Mexico from seeking protection in the United States. The analysis, “Dangerous Territory: Mexico Still Not Safe for Refugees” finds that migrants and refugees in Mexico face risks of kidnapping, disappearance, sexual assault, and trafficking, and that Mexican authorities routinely deport individuals to their home countries regardless of whether they fear return to persecution and the country’s human rights obligations.

Human Rights First notes that when Congress—with strong bipartisan support—passed the Refugee Act of 1980, the United States codified its commitment to the 1951 Refugee Convention and its Protocol. Under those treaties, states can’t return refugees to places where their lives or freedom would be threatened or reject potential refugees at the border. The United States is also a party to the Convention Against Torture, which prohibits governments from sending people to places where they would be in danger of being tortured, and to the International Covenant on Civil and Political Rights which prohibits the arbitrary detention of asylum seekers and migrants. Instead of turning away those seeking protection, the United States should be doing more to ensure their protection claims are properly assessed and due process is safeguarded.

“At a time when the world faces the largest refugee crisis in history, this bill sends a dangerous message to other nations, including those who host the overwhelming majority refugees: that the United States intends to shirk its responsibility to those fleeing violence and persecution,” added Acer.

The Asylum Reform and Border Protection Act (H.R. 391) would undermine the individual rights of people fleeing persecution and violence to seek asylum in the United States. The bill would obliterate the current asylum standards and now require asylum seekers to prove their claims to an impossible degree immediately upon their arrival at the border—without access to the documents or witnesses that they would need to do so. The government would then promptly deport without a hearing before an immigration judge those who fail this unattainable requirement, possibly to endure violence or persecution. The authors claim that this radical change is necessary due to an unprecedented surge of asylum applicants. In the 1990s, however, a similar surge of asylum seekers arrived in the United States, and Congress adopted much less severe reforms than those proposed in this bill. Even assuming that the applicants are submitting asylum applications for the sole purpose of gaining entrance to the United States, the bill does nothing to address the underlying cause of the problem: the lack of a legal alternative to migrate. As long as legal immigration remains impossible for lesser- skilled workers and their family members, unauthorized immigration of various kinds will continue to present a challenge. Asylum rule change will result in denials of legitimate claims Current law requires that asylum seekers at the border assert a “credible fear” of persecution.1 Asylum officers determine credibility based on whether there is a “significant possibility” that, if they allow the person to apply, an immigration judge would find that the fear is “well-founded,” a higher standard of proof. The credible fear interview screens out only the claims that obviously have “no possibility, or only a minimal or mere possibility, of success,” as U.S. Citizenship and Immigration Services (USCIS) puts it.2 If the USCIS asylum officer rejects the claim as not credible, the applicant may ask an immigration judge to review the determination the next day but is not granted a full hearing. Customs and Border Protection removes those who fail to assert or fail to articulate a credible fear. H.R. 391 would impose a much higher standard simply to apply for asylum in the United States. In addition to demonstrating that they had significant possibility of successfully proving their claim to an immigration judge, it would require applicants to prove that it is “more probable than

not” that their claims are true—a preponderance of the evidence standard.3 This standard eviscerates the lower bar that Congress established. The committee simply cannot expect that asylum seekers who may have had to sneak out of their country of origin in the dead of night or swim across rivers to escape persecution will have sufficient evidence the moment they arrive in the United States to meet this burden. In 2016, a group of Syrian Christians who traveled thousands of miles across multiple continents and then up through Mexico to get to the United States arrived at the border to apply for asylum.4 Thankfully, they met the credible fear standard and were not deported, which enabled them to hire an attorney to help them lay out their claim, but this new standard could endanger anyone who follows their path. An inability to provide sufficient evidence of their religion, nationality, residence, or fear would result in deportation immediately after presenting themselves at the border. The authors imply that requiring them to prove their statements are true is not the same as requiring them to prove their entire asylum case, but this is a distinction without a difference.5 Asylum applicants must state a “credible fear” of persecution. Those statements would then be subject to the much more stringent standard. Of course the government should demand the truth from all applicants, but this is a question of the standard by which asylum officers should use to weed truth from falsehood. It is virtually impossible that, by words alone, asylum seekers could prove that it is “more probable than not” that their statements are true. The committee should consider this fact: in 2016, immigration judges reversed nearly 30 percent of all denials of credible fear that came to them on appeal.6 This means that even under the current law, asylum officers make errors that would reject people with credible claims of persecution. If Congress requires an even greater burden, many more such errors will occur, but faced with the higher evidentiary requirement, immigration judges will have little choice but to ratify them. Here is another sign that the truth is not enough: asylum applicants with attorneys were half as likely to have their asylum denied by immigration judges in 2016 as those without attorneys. Indeed, 90 percent of all applicants without counsel lose their case, while a majority with counsel win theirs.7 This demonstrates that people need more than just honesty—they also need to understand what evidence is relevant to their case and need help to gather documents, witnesses, and other evidence to support their claim. For these reasons, Congress never intended the credible fear interview as a rigorous adversarial process because it wanted to give people who could credibly articulate a fear of persecution an opportunity to apply. It knew that while some people without legitimate claims would be able to apply, the lower standard of proof would protect vulnerable people from exclusion. As Senator Alan Simpson, the sponsor of the 1996 bill that created the credible fear process, “it is a significantly lesser fear standard than we use for any other provision.”8 Indeed, during the debate over the compromise version of the bill, proponents of the legislation touted that the fact that they had dropped “the more probable than not” language in the original version.9

Asylum surge is not unprecedented People can either apply for asylum “affirmatively” to USCIS on their own or they can apply “defensively” after they come into the custody of the U.S. government somehow, such as at the border or airport, to an immigration judge, which would include the credible fear process. If USCIS denies an “affirmative” applicant who is in the country illegally, the government places them in removal proceedings before an immigration judge where they can present their claim again. Reviewing the data on asylum claims, two facts become clear: total asylum claims peaked in the 1990s, and a substantial majority of claims are affirmative—that is, done voluntarily, not through the credible fear process or through removal proceedings. Although credible fear claims—a process that was first created in 1997—have increased dramatically, the overall number of asylum claims has still not reached the highs of the early 1990s. Unfortunately, the immigration courts have not published the number of cases that they received before 1996, but as Figure 1 shows, the United States has experienced similar surges of asylum seekers to 2016.10

The authors of the legislation, however, argue that the Obama administration turned the credible fear process into a rubber stamp, allowing applicants to enter regardless of the credibility of their claims. But again a look at the numbers undermines this

narrative. As Figure 2 highlights, the Obama administration denied an average of about 25 percent of all asylum seekers from 2009 to 2016.11

Despite fluctuations of up to 35 percentage points during this time, there is simply no relationship at all between the rate of approval and the number of claims being made. Factors other than the approval rate must be driving the number of applications. Some of these claims are undoubtedly invalid or even fraudulent, but given that a majority of claims by individuals with representation in immigration court win their asylum claims, it is obvious that the credible fear process has protected many people from deportation to persecution abroad.12 If fraudulent claims are a concern, Congress can best address it in the same way that it has successfully addressed other aspects of illegal immigration from Mexico: through an expansion of legal immigration. During the 1950s and again recently in the 2000s, Congress expanded the availability of low-skilled guest worker visas, which led to a great reduction in the rate of illegal immigration. Figure 3 presents the number of guest workers entering each year and the number of people each border agent apprehended each year—the best available measure of illegal immigration. It shows that the period of high illegal immigration occurred almost exclusively during the period of restrictive immigration.13 Most guest workers today are Mexicans.14 This is largely due to the fact that the current guest worker programs are limited to seasonal temporary jobs and Mexico is closer to the United

States, which makes trips to and from the United States easier. By comparison, most asylum seekers are from Central America. Assuming that a significant portion of these asylum seekers are either reuniting with illegal residents already in the United States or are seeking illegal residence themselves, these seasonal programs are unavailable to them.

Congress should create a temporary work visa program for low-skilled workers in year-round jobs, similar to the H-1B visa for high-skilled workers.15 This would cut down on asylum fraud and illegal immigration without the downsides that this bill presents.

Bier’s report notes that U.S. Immigration Judges overruled approximately 30% of credible fear denials by the DHS Asylum Office. Although I did a modest number of credible/fear reasonable fear reviews, including some in temporary assignments to “detained courts” on the Southern Border, I found the number of erroneous credible/reasonable fear denials to be in the 80% to 90% range, including a number of cases that were “clear grants” under Fourth Circuit case law. The idea that Border Patrol Officer could fairly make these determinations is beyond preposterous!

Chairman Goodlatte and his GOP buddies seek nothing less than the end of a fair asylum adjudication system that fulfills our international mandates. H.R. 391 also makes a mockery of due process. In other words, the Goodlatte GOP crowd seeks to turn the U.S. into a “Third World” imitation of a democracy. These types of legislative tactics are exactly what I saw for 21 years of adjuducating claims from countries where the rule of law had broken down.

Whether immigration/refugee advocates or not, every American Citizen who cares about our Constitution and the rule of law should be fighting measures like this tooth and nail. If Goodlatte & Co. win, we all lose, and America will be well on its way to becoming just another third world facade of a democratic republic.

Rather than the totally bogus restrictionist agenda being pushed by Goodlatte and the GOP, here’s what REALLY should concern us as a nation, taken from one of my recent speeches:

“Our Government is going to remove those who lose their cases to countries where some of them undoubtedly will suffer extortion, rape, torture, forced induction into gangs, and even death. Before we return individuals to such possible fates, it is critical that they have a chance to be fully and fairly heard on their claims for protection and that they fully understand and have explained to them the reasons why our country is unwilling and unable to protect them. Neither of those things is going to happen without effective representation.

We should always keep in mind that contrary to the false impression given by some pundits and immigration “hard liners,” losing an asylum case means neither that the person is committing fraud nor that he or she does not have a legitimate fear of return. In most cases, it merely means that the dangers the person will face upon return do not fall within our somewhat convoluted asylum system. And, as a country, we have chosen not to exercise our discretion to grant temporary shelter to such individuals through Temporary Protected Status, Deferred Enforced Departure, or prosecutorial discretion (“PD”). In other words, we are returning them knowing that the effect might well be life threatening or even fatal in many cases.”

Picking on the already vulnerable, disposed, and endangered is what the Goodlatte/GOP restrictionist program is really about.
