President Biden took office with a promise to “restore humanity and American values” to the immigration system. If he’s going to succeed, it will take more than shutting down construction on his predecessor’s border wall. The most formidable obstacle to making the U.S. immigration system more humane and functional is invisible to most Americans: the nation’s broken, overwhelmed immigration court system.

Every day, hundreds of immigration judges slog through thousands of cases, unable to keep up with a crushing backlog that has more than doubled since 2016. Many cases involve complex claims of asylum by those who fear for their safety in their home countries. Most end up in legal limbo, waiting years for even an initial hearing. Some people sit in detention centers for months or longer, despite posing no risk to the public. None have the right to a lawyer, which few could afford anyway.

“The system is failing, there is no doubt about it,” one immigration judge said in 2018. As long as the system is failing, it will be impossible to achieve any broad-based immigration reform — whether proposed by Mr. Biden or anyone else.

The problem with these courts isn’t new, but it became significantly worse under the Trump administration. When he took office in 2017, President Donald Trump inherited a backlog of about 540,000 cases, already a major crisis. The administration could have used numerous means to bring that number down. Instead, Mr. Trump’s team drove it up. By the time he left office in January, the backlog had ballooned to nearly 1.3 million pending cases.

How did that number get so high? Some of the increase was the result of ramped up enforcement of immigration laws, leading to many more arrests and detentions that required court attention. The Trump administration also reopened hundreds of thousands of low-priority cases that had been shelved under President Barack Obama. Finally, Mr. Trump starved the courts of funding and restricted how much control judges had over their own dockets, making the job nearly impossible for those judges who care about providing fair and impartial justice to immigrants.

At the same time, Mr. Trump hired hundreds of new judges, prioritizing ideology over experience, such as by tapping former Immigration and Customs Enforcement prosecutors and others who would help convert the courts into a conveyor belt of deportation. In 2018, then Attorney General Jeff Sessions imposed an annual quota of 700 cases per judge. One judge testified before a House committee last year that Mr. Trump’s system was “a widget factory management model of speed over substance.”

By some measures, the plan worked: In 2020, the immigration courts denied 72 percent of asylum claims, the highest portion ever, and far above the denial rates during the Obama and George W. Bush administrations.

If the goal was to empty the United States of all those asylum seekers, Mr. Trump clearly failed, as evidenced by the huge backlog he left Mr. Biden. But the ease with which he imposed his will on the immigration courts revealed a central structural flaw in the system: They are not actual courts, at least not in the sense that Americans are used to thinking of courts — as neutral arbiters of law, honoring due process and meting out impartial justice. Nor are immigration judges real judges. They are attorneys employed by the Executive Office for Immigration Review, which is housed in the Department of Justice. It’s hard to imagine a more glaring conflict of interest than the nation’s top law-enforcement agency running a court system in which it regularly appears as a party.

The result is that immigration courts and judges operate at the mercy of whoever is sitting in the Oval Office. How much money they get, what cases they focus on — it’s all politics. That didn’t used to be such a problem, because attorneys general rarely got involved in immigration issues. Then Mr. Trump came along and reminded everyone just how much power the head of the executive branch has when it comes to immigration.

The solution is clear: Congress needs to take immigration courts out of the Justice Department and make them independent, similar to other administrative courts that handle bankruptcy, income-tax and veterans’ cases. Immigration judges would then be freed from political influence and be able to run their dockets as they see fit, which could help reduce the backlog and improve the courts’ standing in the public eye. Reform advocates, including the Federal Bar Association, have pushed the idea of a stand-alone immigration court for years without success. The Trump administration made the case for independence that much clearer.

In the meantime, there are shorter-term fixes that could help restore a semblance of impartiality and professionalism to the immigration courts.

First, the system must be properly staffed and funded to deal with its backlog. One way to do that is by hiring more judges, and staff members to support them. Today there are about 550 immigration judges carrying an average of almost 3,000 cases each, which makes it nearly impossible to provide anything like fair and consistent justice. Earlier this week, Attorney General Merrick Garland asked Congress for a 21 percent increase in the court system’s budget. That’s a start, but it doesn’t come close to solving the problem. Even if 600 judges were able to get through 700 cases a year each — as Mr. Sessions ordered them to — it would take years to clear up the existing backlog, and that’s before taking on a single new case.

This is why another important fix is to stop a large number of those cases from being heard in the first place. The Justice Department has the power to immediately remove as many as 700,000 cases from the courts’ calendar, most of them for low-level immigration violations — people who have entered the country illegally, most from Mexico or Central America, or those who have overstayed a visa. Many of these cases are years old, or involve people who are likely to get a green card. Forcing judges to hear cases like these clutters the docket and makes it hard to focus on the small number of more serious cases, like those involving terrorism or national-security threats, or defendants facing aggravated felony charges. At the moment, barely 1 percent of all cases in the system fall into one of these categories.

A thornier problem is how to stamp out the hard-line anti-immigrant culture that spread throughout the Justice Department under Mr. Trump, Mr. Sessions and the former president’s top immigration adviser, Stephen Miller. For instance, a 2019 department newsletter sent to immigration judges included an anti-Semitic reference and a link to VDare, an anti-immigrant group that regularly publishes white nationalists.

One of Mr. Biden’s first steps in office was to reassign the head of the immigration court system, James McHenry, who played a central role in many of Mr. Trump’s initiatives. But it’s generally hard to fire career civil servants, like the many judges and other officials tapped to promote Mr. Trump’s agenda. The Biden administration can reduce their influence by reassigning them, but this is not a long-term fix. While these judges are subject to political pressures, there can be no true judicial process.

If there’s any silver lining here, it is to be found in Mr. Trump’s overreach. The egregiousness of his administration’s approach to immigration may have accelerated efforts to solve the deeper structural rot at the core of the nation’s immigration courts.

We know that they aren’t “real courts;” but, they could and should be — progressive, due process oriented, model courts to boot! It will never happen, however, with the tone-deaf way Garland has approached EOIR in his first 60 days!

As progressives, immigration, human rights, women’s rights, due process, and racial justice advocates well know, Garland’s incredibly poor, downright insulting stewardship @ DOJ has already made things worse at EOIR! Every day this “fake” court system — a massive “big middle finger” to the integrity of American justice and a shocking betrayal of those who fought to preserve justice and bring the Biden Administration into power — continues is a “bad day” for equal justice, racial justice, and gender justice in America! 

It’s also an inexcusable squandered opportunity for the Biden Administration to “recreate” the broken, biased, lacking in competence “Immigration Judiciary” as an independent progressive judiciary that was promised in rhetoric, but has been mocked in action.

Can any progressive imagine how the Heritage Foundation or the Federalist Society might have reacted if Trump, McConnell, Miller, and the DOJ had treated their recommendations for creating a reactionary far-right judiciary with the callous disregard and total disrespect that Garland has shown for the blueprint set forth by progressives for rapidly reforming the Immigration Judiciary into the model progressive judiciary needed to save American justice (not to mention save the lives of many of the most vulnerable, deserving, and needy among us)?

For Pete’s sake, Garland just gave Stephen Miller, “Billy the Bigot” Barr, and “Monty Python” “deference” on his first 17 totally inappropriate “judicial picks” while telling fighters for due process and human dignity to “go pound sand.” We weren’t even given the courtesy of being informed — Kowalski and I had to “smoke it out” with the help of “DT-21.” 

“Courtesy and deference” for Miller, Barr, and “Monty Python;” total disrespect for the NDPA and the humans (“persons” under the Constitution) we represent? Come on, man! 

The BIA has “restrictionist judges” going all the way back to the Bush II political travesty supplemented by Miller, Sessions, and Barr. Yet, there is not a single, not one, true progressive practical scholar-immigration/human rights expert among this “Gang of 23”  — a group that includes a number of “appellate judges” who distinguished themselves with their overt hostility, to immigrants’ rights, rudeness to attorneys, and denial of nearly 100% of asylum claims coming before them. These are “Garland’s Judges?” 

Worse, yet another totally inappropriate “insider appointment” to the BIA by Garland— bypassing the numerous far better qualified “practical scholars” in the private sector — is rumored to be in the offing! NO! This outrageous, tone-deaf performance and disrespect for progressive human rights experts by Garland must stop!

As the editorial correctly suggests, starting to fix EOIR, even in the absence of long overdue congressional action, is not rocket science! The incompetent senior “management” @ EOIR and the entire membership of the BIA can and should be reassigned. Tomorrow!

Experienced, highly competent, scholarly, creative, courageous, progressive judges already on the EOIR bench — like Judge (and former BIA Appellate Judge and DOJ Senior Executive) Noel Brennan (NY), Judge Dana Marks (SF), and Judge Amiena Kahn (NY) — should be detailed to Falls Church HQ to start fixing EOIR and getting the BIA functioning as a real appellate court — focused on due process, high quality scholarship, best practices, and holding ICE accountable for following the law — until more permanent appointments and necessary due process reforms can be made. 

In the meantime, competent, progressive, temporary leadership can bring in temporary appellate judges at the BIA with sound records of fair asylum adjudication to end “refugee roulette” and eradicate the disgraceful “asylum free zones” being improperly run by unqualified IJs in some Immigration Courts. Reform of this disgustingly broken system can’t “wait for Godot” any longer!

As Judge Jeffrey Chase cogently stated in Law360, further “permanent” judicial appointments @ EOIR should be frozen pending development of merit-based criteria and active recruitment aimed at creating a more diverse, progressive judiciary. All existing “probationary judges” selected by Barr should have their positions “re-competed” under these merit-based criteria, with avenues of public input built into the permanent selection system.

Progressives, colleagues, members of the Round Table, members of the NDPA, if you’ve had enough of Garland’s lousy, insulting, tone-deaf, indolent, due-process-disparaging performance at EOIR let your voices be heard with the Biden Administration! What is going on at EOIR every day under Garland is not acceptable! The life-threatening, demeaning, totally unnecessary EOIR Clown Show must go! Now!

Garland has yet to indicate whether he will rescind several decisions penned by attorneys general under the previous administration. In the last four years, Trump officials limited asylum eligibility for those fleeing violence by private actors, like gang members and domestic partners, and immigration judges’ ability to maintain their own dockets.

“There’s no reason that Attorney General Garland hasn’t done a thorough review of the attorney general certifications from the last administration,” said Susan Roy, a former immigration judge. “He should rescind any of them which he can. He has the authority to do that.”

The Biden administration has also inherited a lengthy immigration court backlog — containing roughly 1.3 million cases — that have kept immigrants facing deportation and asylum-seekers waiting years for decisions in their cases.

The Biden administration has recognized that immigration judges may be key to processing these claims quickly and efficiently. In a preview of its budget request released earlier this month, the White House proposed increasing funding for the Justice Department’s immigration court agency from $734 million to $891 million to hire 100 new immigration judges.

Immigrant advocates and former judges say freeing the immigration court system from political influences is also critical to this effort.

“Without a union, there’s no way to protect judges against political ideologies of a given administration,” Roy said.

While judicial independence has “always been a concern” with a court system housed within a federal agency, “rarely has that been as problematic as it was under the Trump administration,” she said.

Some advocates also want to see immigration courts be removed entirely from the DOJ and made an independent court system. The issue is on the agenda for the American Immigration Lawyers Association’s virtual “day of action” on April 22.

Roy, the incoming chair of AILA’s New Jersey chapter, acknowledged that Garland faces a number of competing priorities outside of the immigration courts. But she urged the administration against letting the system fall to the wayside.

“The immigration court is a subject that needs immediate attention,” she said. “Otherwise, it’s going to collapse under its own weight.”

Today’s Immigration Courts, hotbeds of inefficiency, worst practices, racial bias, misogyny, and unnecessary backlogs, undermine everything that Biden and Harris campaigned on. They also make Judge Garland’s pledge to return justice and independence  to the Department of Justice look like a farce.

You simply can’t be responsible for something as totally broken, biased, and due process denying as the current Immigration Courts and have ANY shred of credibility on racial justice, independence, and “good government!”

A longtime Nassau County, New York, district court judge and New York Supreme Court justice, Feuerstein was appointed to the federal bench by former President George W. Bush in 2003 and was serving as a judge in the Eastern District of New York in Central Islip. She and her mother, Judge Annette Elstein, who died in 2020, made history as the first mother and daughter in the United States to serve as judges as the same time.

At the time of her death, Feuerstein was presiding over a high-profile murder-for-hire case in which a former New York Police Department officer is accused of hiring a hitman to kill her estranged husband. It’s unclear how Feuerstein’s death will impact the case.

Mark Lesko, the acting U.S. attorney for the Eastern District of New York, issued a statement expressing condolences to Feuerstein’s family.

Meanwhile, government watchdog groups expressed concerns over two people whose initial conversion requests had since been approved.

One such conversion was that of Carl Risch, whose October conversion request to be the deputy director, the No. 2 job, at the Executive Office for Immigration Review within the Department of Justice (a civil service job), was approved in December. Risch had been an assistant secretary for consular affairs at the State Department, a political job. His new job came with a $10,000 raise.

His is at least the second conversion in the last year to land at the EOIR, which conducts removal and deportation proceedings in immigration courts across the country.

“It’s a red flag when there are multiple people being converted to jobs at a single entity. It really raises an even larger concern,” Stier, of the Partnership for Public Service, said. “The process is supposed to be that a political appointee in no way has a leg up on the competition for a career job, but when you see multiple go to the same agency, you really have to wonder how it can be possible that the best qualified individuals are not once, but multiple times, people who are political appointees.”

Risch did not respond to multiple requests for comment. EOIR spokeswoman Kathryn Mattingly said Risch went through the standard pre-hiring review process with the OPM and that the agency had approved his new position.

So, the folks who saved due process and stood up for the Constitution and racial justice while Judge Garland was enjoying his cushy ivory tower job at the D.C. Circuit over the past four years remain on the outside, twisting in the wind ⚰️ while their clients and colleagues suffer daily abuse in “Garland’s Star Chambers!” Nice touch!

Meanwhile, Garland hands out the big bucks and a hideout for a notoriously unqualified Trump/Miller political hack imported from the DOS. What does Risch know about immigrant justice or court management? Nothing? Oh, but why is that a problem at EOIR?

He occupies what is supposed to be a key senior management position in America’s most dysfunctional “court system” — running a simply astounding 1.3 million (known) case, largely self-created backlog, grinding out sloppy, unprofessional, biased opinions regularly rejected by even conservative Courts of Appeals, setting horrible anti-immigrant precedents and endangering the lives, health, and safety of those who are caught up in EOIR’s continuing White Nationalist cesspool of cruelty, mismanagement, and gross incompetence?

Is it any wonder that immigrant justice and racial justice remain in free-fall under Biden and Garland?

Let’s lay it on the line! By now, Garland should have cancelled all the Trump-era precedents (“day 1 stuff”), cleaned house at EOIR HQ, and transferred the entire BIA to somewhere where they can inflict no more damage on the American legal system!

That would also have sent a powerful  “signal” to the many Immigration Judges who have established “asylum free zones” in Immigration Courts throughout the U.S. over the past two Administrations that there will be a return of due process and fundamental fairness for asylum seekers and other immigrants at EOIR. 

Judges can get with the program, start granting asylum and other protection as the law requires, thereby reducing backlogs the “old fashioned way” — consistent with due process and fundamental fairness. Or, they can ship out and sign up with Stephen Miller’s “Aryian Nation Legal Team” — where it appears that many of them would be more at home.

Garland should have brought in folks already on the payroll like Judges Dana Marks, Noel Brennan, & Amiena Khan, all experts in due process, judicial management, immigration, and human rights laws, all of whom have demonstrated true leadership, consistent courage, and independence throughout their distinguished careers, on at least a temporary basis to start restoring justice, rationality, and order in the Immigration Courts. 

They would already have identified qualified sitting judges who know how to grant asylum to serve as Acting Appellate Judges at the BIA to start turning things around by enforcing due process and issuing precedents that advance, rather than retard, due process, fundamental, fairness, and judicial efficiency. 

Meanwhile, they would be developing legitimate merit selection criteria to recruit and hire as judges practical experts who will fairly and efficiently apply due process and fundamental fairness to all asylum seekers and other respondents, regardless of race, color, or creed. These criteria could be used to recruit and  hire a diverse progressive group of permanent Appellate Judges and Immigration Judges, to determine which “probationary IJs” should be retained, and eventually to re-compete all existing IJ positions to insure a real, diverse, independent, due-process focused, Immigration Judiciary comprised of the “best and brightest” American law has to offer! 

Greg Chen (AILA) and Professor Peter Moskowitz (Cardozo Law) should be on the EOIR payroll implementing their very achievable program for drastically slashing the unnecessary backlog without stomping on anyone’s rights.

IT’S NOT ROCKET SCIENCE! 🚀 — GREG CHEN & PROFESSOR PETER MARKOWITZ CAN CUT THE IMMIGRATION COURT BACKLOG IN HALF IMMEDIATELY WITH NO ADDITIONAL RESOURCES! — And, That’s Just The Beginning! — “Team Garland” Needs To Get The “A-Team” In Place @ EOIR & End The Nonsense, Injustice, & Waste Of “America’s Star Chambers!”

Garland should already have hired Professor Michele Pistone (Villanova Law, VIISTA) to develop quality, due process oriented training programs for everyone at EOIR.

Instead, Garland is bankrolling the current crew of proven incompetents, holdovers, hangers on, and Trump/Miller White Nationalists. In other words, he’s wasting our taxpayer money, destroying the lives and futures of the most vulnerable (and often most deserving) among us, undermining racial and social justice in America, and abusing and endangering the health and safety of members of the NDPA trying to bring some semblance of the rule of law and human decency into our disgustingly dysfunctional Immigration Courts.

Could it get any worse? How? 

Think about this! Neo-Nazi Stephen Miller and his fellow White Nationalists apparently were so impressed with the effective legal work done by courageous immigration/human rights/due process advocates in blocking many parts of his racist authoritarian agenda — basically the New Due Process Army (“NDPA”) and its “Senior Fighting Division” The Round Table of Former Immigration Judges — that they are forming their very own neo-Nazi legal advocacy group to help GOP AGs stymie any attempt by the Biden Administration to promote racial justice, social justice, and immigrant justice. 

Given the rather incompetent (not to mention ethically questionable) performance of many DOJ attorneys during the Trump regime, Garland is going to need all the help he can get to fend off Miller and the GOP. Rather than enlisting members of the NDPA on his team, letting them solve problems, and actively soliciting their support and alliance on litigation, he is turning them into highly motivated opponents!

How dumb and counterproductive is that! Turn your would-be friends into enemies? Sounds like something only a tone-deaf Dem politico could pull off!

I’m not a politico. But, I do understand the necessity in politics, as in almost any field, of being able to distinguish your friends from your enemies. Perhaps, Judge Garland has spent so much time in the ivory tower that he has forgotten how to play the game out here in the real world.

I’ve been hanging around the Washington legal scene for almost 50 years now. In that time, I might have witnessed a more inept start by an Attorney General of either party. But, really, I can’t remember when!

Jamie Gorelick is a partner at Wilmer Hale. Layli Miller-Muro is founder and CEO of the Tahirih Justice Center, a nonprofit that serves immigrant survivors of gender-based violence. Both were involved in Fauziya Kassindja’s asylum case in 1996: Gorelick was deputy attorney general during the Clinton administration and Miller-Muro was Kassindja’s student legal counsel, representing her in immigration court and at the Board of Immigration Appeals.

With the issue of migration in the news again, a glaring omission in U.S. asylum law should get more attention: The statute does not name gender as a possible ground for protection.

To be granted asylum in the United States, an applicant must be facing persecution by their government or someone that government cannot or will not control. The applicant must show that the persecution is on account of race, religion, nationality, political opinion or membership in “a particular social group.” Persecution on account of gender is not included.

This makes sense when considering that the global treaty that obliges state parties to protect refugees was adopted 70 years ago, in 1951, when the legal rights of women were barely recognized. The treaty — called the Refugee Convention — says that countries have an obligation to protect those who have no choice but to flee or risk death in the face of injustice.

It is unsurprising that the needs of women facing persecution were not considered in 1951. It is also not surprising — though it is disappointing — that Congress wrote this outdated framework into the Refugee Act of 1980.

In the mid-1990s, some light was shined on this problem. Fauziya Kassindja, a 17-year-old from Togo, sought protection both from forced polygamous marriage to a much older man and from female genital mutilation. She was granted asylum after proving that she was a member of a “particular social group” — and thus covered by the Refugee Act. We were both involved in this case, which helped to crack open the door for women to argue that gender-based asylum claims should be granted under the “particular social group” category in the statute.

But progress for women has been slow and painful under a statute that does not explicitly recognize gender-based persecution. It took 14 years for the United States to grant asylum to a Guatemalan woman, Rodi Alvarado, who endured unspeakable brutalization by her husband, a former soldier. Regulations proffered by then-Attorney General Janet Reno in 2000 to protect women under the social-group category were never finalized, leaving women in the lurch. So much variance exists in the likelihood of success from court to court that filing a claim can feel like playing Russian roulette.

This situation has been made much worse in recent years. Under Attorney General Jeff Sessions, decades of progress were nearly wiped out by the stroke of a pen. Because the highest immigration court is part of the Justice Department, he was able to single-handedly reverse key legal precedents favorable to women’s claims and issue guidance to judges limiting gender-based asylum. As a result of these changes, the safety of many immigrant women hangs by a thread. The Refugee Act urgently needs to be changed to clearly protect women who would otherwise meet the stringent requirements for asylum.

The Rest of the Story

I wrote the decision granting asylum in Matter of Kasinga, 21 I&N Dec. 357 (BIA 1996). Jamie Gorelick was the Deputy Attorney General during part of my tenure (1995-2001) as Chair of the BIA. Layli Miller-Muro worked for me as a BIA Attorney-Advisor for a time.

Following Kasinga, some of my colleagues and I put our careers on the line to vindicate the statutory, constitutional, and human rights of refugee women who suffered egregious persecution in the form of domestic violence. One of those cases was Rodi Alvarado (a/k/a “Ms. R-A-“), where we dissented from our majority colleagues’ misguided denial of protection to her following grotesque, clearly gender-based persecution. Matter of R-A-, 22 I&N Dec. 906, 928 (BIA 1999) (Guendelsberger,Board Member, dissenting with Schmidt, Chair, Villageliu, Rosenberg, and Moscato, Board Members). Alvarado had properly been granted asylum by an Immigration Judge, building on Kasinga, before being unjustly stripped of protection by the majority of our colleagues.

The incorrect decision in R-A- was vacated by Attorney General Reno. Finally, after a 14-year struggle, Ms. Alvarado was granted asylum in an unpublished, unappealed decision based largely on the rationale of the dissenters. In the meantime, the “gang of four” dissenters (minus Moscato) had been exiled from the BIA by Attorney General John Ashcroft, assisted by his sidekick, Kris Kobach (the infamous “Ashcroft Purge” @ the BIA).

In 2014, in Matter of A-R-C-G-, 26 I&N Dec. 388 (BIA 2014), the BIA finally recognized domestic violence based on gender as a form of persecution. They did so without acknowledging the pioneering work of the R-A- dissenters 15 years earlier. By this time, domestic violence as a basis for asylum had become so well established that it wasn’t even contested by the DHS (although, curiously, the case was remanded by the BIA for additional findings on issues that were beyond reasonable dispute)!

In the meantime, at the Arlington Immigration Court, my colleagues and I had consistently granted domestic violence asylum cases based on a DHS policy position known as the “Martin Memo,” after former INS General Counsel and later DHS Deputy General Counsel Professor David Martin (who, incidentally, argued the Kasinga case before the BIA in 1996 — famous gender-based asylum expert Professor Karen Musalo argued for Kasinga). Most of those grants were unappealed by DHS. Indeed, many were so compelling and well documented that DHS joined Respondents’ counsel in moving for asylum grants following brief testimony. These cases actually became staples on my “short docket,” promoting efficiency, fairness, and becoming one of the few “working parts” of the Immigration Courts.

Tahirih Justice Center, founded by, Layli Miller-Muro, was counsel in some of these cases and served as an essential resource and inspiration for attorneys preparing domestic violence cases. It also functioned as a training center for some of the “new all-stars” of the New Due Process Army. For a time, the progress in recognizing, documenting, and vindicating the rights and humanity of female asylum seekers, at least in the Arlington Immigration Court, was one of the few shining examples of the courts, DHS, and the private/NGO bar working cooperatively to improve the quality and efficiency of justice in Immigration Court. It should have been a model for all other courts!

Sadly, in 2018, Attorney General Jeff “Gonzo Apocalypto” Sessions, unilaterally intervened and undid two decades of progress for women refugees of color with his grossly incorrect and disingenuous decision in Matter of A-B-, 27 I&N Dec. 316 (BIA 2018), overruling Matter of A-R-C-G- on completely specious grounds while intentionally misconstruing the facts of record. Significantly, Sessions’s intervention was over the objection of DHS, which had expressed continuing agreement with the A-R-C-G- framework for deciding domestic violence cases.

“Hanging by a thread,” as stated by the op-ed, unfortunately vastly understates the war on the legal rights and humanity of asylum-seeking women, particularly targeting women at color, being carried out at EOIR today. This effort is led by a BIA that has long since lost its way, basically “weaponizing” the legal distortions and vicious, openly misogynist dicta set forth by Sessions in Matter of A-B- to dehumanize, degrade, and deport vulnerable refugee women. 

In numerous cases, the BIA actually intervenes at ICE’s request to reverse proper grants by courageous and scholarly Immigration Judges below. It’s all about churning out final orders of removal as a deterrent –  a vile, disgusting, perverted “philosophy” advanced by Sessions, Barr, and Whitaker, and not yet effectively rejected by Judge Garland.

Yeah, I’ve read about the Judge’s “difficulties” in getting his “A-Team” on board at the DOJ. https://www.washingtonpost.com/opinions/2021/04/07/us-asylum-law-must-protect-women/. So what! 

Judge Garland is in the job because he is not only an experienced DOJ senior executive, but a long-serving Federal Judge who was admired for his sense of justice. It shouldn’t take an army of “spear-carriers” and subordinates for a true leader of Judge Garland’s experience to seize control of the situation and start getting the “ship of justice” sailing in the right direction. Judge Garland’s political and bureaucratic travails are of no moment to, and pale in comparison with, the additional, unconscionable abuse and “Dred Scottification” being heaped on refugee women and their courageous representatives by his dysfunctional and unconstitutional “star chamber courts.”

Please, Pick Up The Phone & Your Pen, Judge Garland!

Not rocket science, Judge Garland! All it takes is six calls and a signature to start ending misogyny at EOIR and achieving racial justice in the America.

First three calls: Call Judge Dana Marks (SF), Judge Noel Brennan (NYC), Judge Amiena Khan (Newark) and tell them that they are detailed to the positions of Acting EOIR Director, Acting BIA Chair, and Acting Chief Immigration Judge, respectively. (The first position is vacant and the other two positions are filled by Senior Executives subject to transfer at the AG’s discretion. The current Acting Director already has an SES position to which she could return, or she could be re-installed as the
EOIR General Counsel, a job for which she is well-qualified.)

Fourth call: Call the the head of of the Justice Management Division (JMD). Ask her/him to find suitable DOJ placements for the two current incumbents mentioned above and all current members of the BIA (all of whom are either SES or “Management Officials” subject to transfer at the AG’s discretion) in other DOJ positions at the same pay level where they can do no further damage to our justice system. Ask him/her to arrange for the temporary appointment of former DOJ employees Jamie Gorelick and Layli Miller-Muro as Acting Appellate Judges at the BIA.

Calls five and six: Call Jamie Gorelick and Layli Miller-Muro. Thank them, tell them you agree with their Post op-ed, and ask (or beg) them to come to DOJ on a temporary basis to help Judges Marks, Brennan, and Khan solve the current problems with asylum adjudications and take the necessary actions to get EOIR functioning as a legitimate, independent, due-process-oriented court system. In other words, turn their cogent op-ed into a “real life action plan” for restoring due process, humanity, and common sense to the Immigration Courts, with a focus on the now totally unprofessional, wrong-headed mis-adjudication of asylum cases.

Finally, sign this order:

All precedent decisions issued to EOIR by former Attorneys General Sessions and Barr, and former Acting Attorneys General Whitaker and Wilkinson, and all their pending actions certifying cases to themselves are hereby vacated. All cases shall be returned to the Board of Immigration Appeals (“BIA”) for reconsideration. In the reconsideration process, the BIA shall, among other things, honor the letter and spirit of these binding precedents:

  1. INS v. Cardoza-Fonseca, 480 U.S. 421 (1987)
  2. Matter of Mogharrabi, 19 I&N Dec. 439 (BIA 1987)
  3. Matter of Kasinga, 21 I&N Dec. 357 (BIA 1996)

In the reconsideration process the BIA shall also be guided by the principle of “through teamwork, innovation, and best practices, become the world’s best tribunals, guaranteeing fairness and due process for all.”

See, it’s not that complicated. By the end of this year, women will get the protection to which they legally are entitled from the Immigration Courts. We all will see dramatic changes that will lead the way toward “equal justice for all’” in America and become a blueprint for the Immigration Courts to fulfill the above-stated principle. 

It would also be a far better legacy for Judge Garland to be viewed as the “father of the fair, independent, expert Immigration Courts,” than to be remembered as running the most dysfunctional, unfair, and misogynistic court system in America, his current path. And, as an extra added bonus, Judge Garland, you will have a great start on building a premier source of “battle tested,” due-process-oriented, progressive jurists for future Article III appointments!

It’s a “win-win-win” that you no longer can afford to ignore, Your Honor!

NOW HILL — Former Worcester County prosecutor and Wicomico County Deputy State’s Attorney William “Billy” McDermott has been appointed as a federal immigration judge by the U.S. Attorney General.

U.S. Attorney General Merrick B. Garland has appointed McDermott, 35, a resident of Girdletree, as a federal immigration judge assigned to the New York City Court effective March 28. McDermott, a Worcester County native who graduated from Snow Hill High School, served as deputy state’s attorney under former Worcester County State’s Attorney Beau Oglesby.

When Oglesby was appointed to the Worcester County Circuit Court bench in January 2018, McDermott, his top prosecutor, was appointed Ad Interim State’s Attorney for Worcester County. He announced he was running for the office full-time, but lost a narrow election to current Worcester County State’s Attorney Kris Heiser later in 2018.

McDermott was immediately picked up by the Wicomico County State’s Attorney’s Office, where he has served as lead prosecutor ever since before his appointment as a federal immigration judge this week. As deputy state’s attorney for Wicomico County, McDermott has prosecuted many important cases over the last few years, including the Jamel Gould homicide trial, the Brendon Fields homicide trial, the Jonathan Megee homicide trial, the Barbara Pilchard animal abuse trial and the Salisbury University hate crime graffiti case, for example.

Outside the courtroom, McDermott has assisted in the creation of the new Prosecution Integrity Unit. He has also testified in Annapolis on several pieces of important public safety-related legislation and led the first annual Wicomico County State’s Attorney Summer Camp for youth. 

“We are incredibly excited and proud of Billy’s appointment,” said Wicomico County State’s Attorney Jamie Dykes. “This may by the opportunity of a lifetime for him and his family, and we know that our country will be well-served by those qualities that will make him an excellent judge.”

Short “honeymoon!” Most disappointing from an Administration and AG who claim a commitment to justice for asylum seekers and other migrants!

Nothing personal against Judge McDermott. He sounds like a decent guy. He might be well-qualified to be a U.S. Attorney, an official in the DOJ’s Criminal Division, or for dozens of other positions in the Federal Bureaucracy. He might even prove to be better than some of the Immigration Judges now on the bench. 

But, the idea that he is the best qualified individual to be a U.S. Immigration Judge is facially absurd. Most of us could think of dozens of much better qualified candidates, just in the NY area.

As I always say, first impressions are lasting impressions. Sadly, Judge Garland has chosen to start by thumbing his nose at those of us committed to immigrant justice and a better Immigration Judiciary. I see no excuse for this tone-deaf appointment.

It looks like the only way the NDPA and the forces of equal justice will get Garland’s attention is by continuing to sue, sue, sue, resist, agitate, and win until we can force change! Sure, it’s dumb and counterproductive on the part of the Biden Administration. Sure, we expected better from Judge Garland.

But, hey, what else is new? If Democratic politicos ever took the time to understand EOIR and its potential for good or evil, we wouldn’t have the unmitigated mess we have today! And, there is no viable plan in place to fix it, nor have we seen the type of consciousness about the ongoing mockery of justice at EOIR necessary to start fixing the American justice system!

I want to share some good news: my Deportation Defense Clinic at the Hofstra Law Clinic won an asylum case on the PSG of “U.S. law enforcement labeled gang members” before Judge Poczter at 290 Broadway for a client falsely accused of gang allegations. See the redacted decision attached. We’re waiting to see if DHS appeals within these next two weeks and are prepared to continue the fight if necessary.

Quote on Page 13:

“Respondent’s social group, ‘U.S. law enforcement labeled gang members’ is cognizable, in that its members share an immutable characteristic that is socially distinct within Salvadorian society and defined with sufficient particularity.”

 

I’m willing to share the redacted TOE and brief with those interested.

So, even in the time of time of extreme White Nationalist restrictionism in Government, there are still plenty of “winnable” asylum cases out there if individuals: 1) get access to the hearing process; 2) have access to competent lawyers; 3) get time to prepare and document cases; and 4) have a fair and impartial Immigration Judge with knowledge of asylum law. A fair and reasonable INS Assistant Chief Counsel is also an important factor.

How many valid cases like this are being turned back at our borders under the regime’s “fake COVID-19” rules with no hearings at all? How many are being summarily deported without fair credible fear interviews or an opportunity for impartial judicial review as a result of the Supremes’ latest expedited removal constitutional abomination?

Interestingly, this case was so well prepared and documented that ICE and the Clinic stipulated as to the testimony and merely submitted that record to Judge Poczter for a legal analysis and decision. Shows that without political interference, judges and parties can work together to facilitate a fair and timely resolution of cases without trampling on due process. 

It’s simply a “crime against humanity” that the Immigration Court system is run by bigoted anti-asylum zealots with no interest in due process or fundamental fairness.

So, what if decisions like Judge Poczter’s (a former BIA Attorney Advisor during my tenure) were the precedents, instead of deny, deny, deny? What if “best practices” were valued? What if achieving correct results in accordance with due process were the object, rather than increasing the number of asylum denials to fit a false narrative? What if asylum law were properly applied to protect, rather than reject?

This could be a system that would do justice and make America  proud. But, it’s not going to happen without an independent, merit-based judiciary and an Administration that works to achieve equal justice for all, rather than undermining it at every step.

‘The Bizarro-World’ Immigration Courts Where the Constitution Isn’t Applied Detainees can be held for weeks or months before seeing a judge. The Justice Department gave “the word of the agency under penalty of perjury” that it would fix that—but only in NY

 

·         ICE officials acknowledged that they couldn’t handle the volume of arrests their own agents made; the major clog was in getting a legal review from the agency’s understaffed legal unit.

 

·         In 11 of the 55 venues that heard more than 500 cases last year, detainees spent six weeks or more in jail before an initial hearing. Such long waits would be unconstitutional in criminal cases; the right to due process requires authorities to not only get a case filed but also to provide an arraignment promptly, generally in no more than 48 hours.

 

·         Among the 55 venues that handled 500 or more detainee cases last year, the longest waits from arrest to initial hearing were in hearing locations at privately run lockups under contract with ICE: Winn Correctional Center in Winnifield, Louisiana, a median of 140 days; T. Don Hutto Residential Center in Taylor, Texas, 72 days; Richwood Correctional Center in Richwood, Louisiana, 64 days…

Ironically, by his own overt corruption and open disdain for our Constitution and the rule of law, Trump has exposed the deep flaws, grotesque derelictions of duty, and unethical complicity throughout our Constitutional institutions that are supposed to protect all of us, particularly the most vulnerable among us like civil immigration detainees and asylum seekers, from abuses by would-be authoritarian tyrants like Trump!

Here’s a gem:

 

“The larger question behind this mass of numbers is why DHS is detaining so many people when both its legal office and the court lack the staffing—not only judges but support staff as well—to handle them.

‘I would just say, they are the prosecuting agency and in this context, they have complete control over the timeline,’ said Aaron Hall, an immigration lawyer who practices at the court in Aurora, Colorado, which has had substantial delays. ‘If the charging document isn’t ready to go, why are they arresting them?’”

Good question! But don’t expect a straight answer from the “malicious incompetents” at DHS. Nor will today get anything except misleading nonsense from their “partners” at EOIR (“ICE Jr.”).

DOJ was forewarned of this disaster by an independent consultant back in 2017. But, rather than solving the problem, then AG Jeff “Gonzo Apocalypto” Sessions intentionally made things even worse at EOIR. You might remember “Gonzo” as the “mastermind” behind the regime’s unconstitutional child separation policy. His victims were returned to abuse, scarred for life, or imprisoned for the “crime” of asserting their Constitutional and legal rights to fair treatment.  

All of this is wrong, plain and simple! It’s part of “Dred Scotiffication” — now playing out across our nation in many ways. Finally, the systematic “dehumanization of the other” as aided, abetted, and actually encouraged by a majority of the Supremes, is getting some much-needed and long overdue “pushback.”

But the abuses of our Constitution and our values, and the unaccountability of corrupt public officials, present and former, of the Trump immigration kakistocracy, won’t cease until we get “regime change.” That requires substantial personnel and attitude changes across all three branches of our reeling Federal Government! The New Jersey State Bar Association (NJSBA) is requesting that the Newark and Elizabeth Immigration Courts be closed immediately, in the interest of the health and safety of the residents of NJ and the country. In support of this request, the NJSBA asks you to consider the following:

NEWARK IMMIGRATION COURT:

On March 6, 2020, the Newark Immigration Court, located on the 12th floor of the Rodino Building, 970 Broad Street, Newark, NJ, was temporarily closed for the afternoon because an attorney who had been exposed to COVID-19 and who was experiencing symptoms was present in court.

On March 9, 2020, the Newark Immigration Court reopened, and remained open until March 18, 2020. During that period of time, literally thousands of respondents and their family members were required to appear at master calendar and individual hearings, along with their attorneys, attorneys from the Office of Chief Counsel, Court staff, interpreters, security guards and Immigration Judges.

It was later learned that a second private attorney and an interpreter have tested positive for COVID-19 after being in court on March 11, 2020. The attorney is quite ill. Approximately 70 other cases were heard that morning before the same Immigration Judge, who is currently under self-quarantine. That is only a fraction of the people who were present at court that day. Because of the volume of individuals who must appear at the Newark Immigration Court on any given day, the majority of individuals must wait together, sometimes for hours, in an extremely small waiting room, in which all attorneys, courts staff, interpreters, security guards and judges must also pass.

It was also learned that an attorney from the DHS Office of Chief Counsel, who was present in Court on March 13, has not only tested positive for COVID-19 but is currently in a medically induced coma in ICU fighting for his life. The entire staff of the Office of Chief Counsel, which is primarily located on the 13th Floor of the Rodino Building, has been placed under required quarantine for a period of two weeks.

As a result of this, the US Department of Justice, Executive Office for Immigration Review (EOIR) issued a directive on Twitter and Facebook stating that the Newark Immigration Court would be closed from March 18-April 10, 2020, and that all court filings would be considered timely filed on April 10, when the court reopened.

Last night, March 25, at 9:30 pm, EOIR announced via Twitter and Facebook that Newark Immigration Court would reopen starting TODAY, March 26. No further information was given to the public, or, notably, the Immigration Judges or the court staff. It has been clarified that the Newark Court has reopened for court filings only, because EOIR has now stated that any filings due during the previous days of closure would now be due on March 30, 2020.

Some members of the court staff are now required to be present to accept in-person filings at the court window, as well as to handle filings that have been mailed to the court. The Office of Chief Counsel remains closed under quarantine, and therefore cannot accept filings.

The reopening of the Newark Immigration Court, even for a limited purpose, is in clear violation of Executive Order 107. The functions of the Court at this time are non-essential, because the Court does not handle detained cases. Moreover, the reopening is putting Court staff in jeopardy of not only exposure to the virus themselves, but also of spreading it to others. The City of Newark is under a shelter-in-place restriction, and, this morning, the U.S District Court for the District of New Jersey just issued an order closing the Martin Luther King and Frank R. Lautenberg courthouses because several employees have confirmed positive COVID-19 tests. The courts are closed immediately and will remain closed through April 6, 2020.

It should be noted that the courthouses are located next door to the Rodino building, and the U.S. Attorney’s Office is in the Rodino Building. Staff, attorneys, and members of the public use the same parking facilities, elevators, and even cafeterias located in the buildings.

Therefore, for all of the above reasons, the Newark Immigration Court should be closed immediately and remain closed until its scheduled reopening date of April 10, at the earliest.

ELIZABETH IMMIGRATION COURT:

The Elizabeth Immigration Court is located at 625 Evans Street, Elizabeth, NJ, and is located in the same building as, and in close proximity to, ICE detainees. The Elizabeth Court handles detained cases and is currently open.

On March 13, 2020, a medical staff person who works in the detention center was presumed to have been exposed to COVID-19; this diagnosis was later confirmed. Moreover, because attorneys for the Office of Chief Counsel travel back and forth between the Elizabeth Immigration Court and the Detention Center, where there is an auxiliary OCC office, and the Rodino Building in Newark, the OCC in Elizabeth has been included in the mandatory, two-week quarantine. Numerous private and pro bono

attorneys also routinely appear in both courts, as do interpreters and ICE personnel.

One of the Elizabeth Immigration Judges has been out on leave; an Immigration Judge from Newark, whose husband had been quarantined but tested negative for the virus, is now handling the docket in Elizabeth.

Immigration attorneys are allowed to appear telephonically if they choose; court staff, judges, security guards, interpreters, and, of course, the detainees housed in Elizabeth are there in person. The Office of Chief Counsel is still under quarantine; their attorneys have been appearing telephonically.

On March 24, 2020, at 2:30 pm, EOIR announced, via Twitter and Facebook, that the Elizabeth Immigration Court was closing for the rest of the afternoon because they had received confirmation of “the presence of an individual with a test-confirmed Coronavirus diagnosis.”

The Elizabeth Immigration Court reopened the next day and remains open.

The Elizabeth Immigration Court hears cases for individuals who are housed at Elizabeth Detention Center, as well as at Essex and Hudson County Jails. The individuals housed at those jails are usually seen via tele video. However, a detainee and a senior staff person at Essex County Jail both have positive COVID-19 diagnoses and are experiencing serious symptoms. And ICE detainees at all three locations are engaging in hunger strikes because they are afraid of contracting the virus as well.

Moreover, on March 25, EOIR issued a requirement that all attorneys dealing with inmates in ICE detention centers and courts MUST bring their own personal protective equipment (PPE) in order to be allowed to enter the facilities. Therefore, either attorneys cannot adequately represent their clients, or they must obtain PPE at the expense of health care providers and first responders who desperately need this equipment.

The NJSBA recognizes that it is more difficult to close a court that handles detained cases, as that imposes a reduction of the individuals’ constitutional rights. However, the NJSBA believes that a short- term closure of two weeks, in order to ensure that anyone who has been exposed to COVID-19 does not spread the virus, even unwittingly, is extremely important to protect the health and safety of the individuals who are housed there, who work there, and who must report there, as well as the public at large.

The NJSBA would, at the same time, ask that the State confer with ICE regarding the release of any non-criminal or low-risk immigration detainees. This would further aid in slowing the spread of the virus, as well as protecting the individuals who work at the Elizabeth Immigration Court and Detention Center and would minimize significantly the numbers of detained cases on the court docket. Should ICE forbear from placing new detainees in custody within NJ facilities would also stem the spread of the virus to vulnerable inmate populations. Alternatives to detention, such as ankle-bracelets, or mandatory video or telephonic check-ins would help ensure that ICE’s mission is not curtailed.

It should be noted that the National Association of Immigration Judges (NAIJ), the American Immigration Lawyers Association (AILA) and the American Federation of Government Employees #511 (AFGE/ICE Professionals Union) issued a joint statement on March 22, 2020, asking for the nationwide closure of all immigration courts across the country.

Immigration attorneys, immigration courts staff, and immigration prosecutors are literally having to

make life and death decisions every day because of EOIR’s callous disregard for the health and safety of its employees, immigrants, anyone who must come into contact with the courts, and the

public. Accordingly, NJSBA is asking you to close the NJ immigration courts immediately to preserve the health and safety of the residents of NJ.

To be honest, I’m not sure that a State Governor has authority to close down a Federal Office, even in times of emergency. But, this absurd, yet deadly, situation shows the arrogant disrespect for human life, common sense, and basic decency of Barr and his EOIR toadies.

Normally, you would expect cooperation, coordination, and support from the Feds in time of a health emergency. In the age of Trump and his kakistocracy, not so much. After all, you’re dealing with a regime headed by a maliciously incompetent dude who couldn’t wait to start undermining the best advice of his own doctors and nearly all health care professionals in the U.S. Bad things happen to a country that empowers a kakistocracy!

Dear Attorney General Barr and Director McHenry,

Following previous calls by the National Association of Immigration Judges (NAIJ), the American Federation of Government Employees (AFGE) Local 511 (ICE Professionals Union), and the American Immigration Lawyers Association (AILA) for the temporary closure of all immigration courts, we, the undersigned international, national, state, and local immigration, civil rights, faith- based, government accountability, and labor organizations urge the U.S. Department of Justice (DOJ) to immediately close all 68 Immigration Courts operated by the Executive Office for Immigration Review (EOIR) in adherence with current public health protocols regarding the COVID-19 virus.

On the evening of March 17, EOIR postponed all non-detained hearings and recently postponed all of the Migrant Protection Protocol hearings (MPP) scheduled through April 22, 2020. However, more aggressive action is needed. While these policies are a step in the right direction, they fall far short of the required action called for by this pandemic emergency. The detained courts must also be closed to in-person hearings in order to minimize the spread of the virus, slow the rate of new infections, and to avoid overwhelming local resources.

Given the particular vulnerability of respondents in detained settings, the use of telework, which has been advocated by the Administration, can and should be quickly put in place. Immigration Judges stand ready and able to work to ensure priority matters, including detained bond matters, are addressed using technological tools. DOJ should permit all detained respondents to immediately receive telephonic bond redetermination hearings with teleworking judges and allow supporting documents to be faxed and emailed to a designated point of contact. When possible, ICE OPLA should stipulate to bond in written motions so it is not necessary to hold hearings.

The urgency for immediate, decisive action in this matter cannot be overstated. Every link in the chain that brings individuals to the court – from the use of public transportation, to security lines, crowded elevators, cramped cubicle spaces of court staff, packed waiting room facilities in the courthouses, and inadequate sanitizing resources at the courts – place lives at risk.

 Every state and the District of Columbia have declared a state of emergency giving government leaders the opportunity to implement bold and unprecedented measures to slow and eventually

 eliminate the spread of the virus. Some officials are releasing prisoners, allowing them to shelter in place at home. Cities, county, and state governments have moved swiftly to implement stay at home orders to ensure the protection of community members from this highly communicable virus. These measures include the scaling back of mass transit conveyances to most urban centers where the immigration courts are located, creating significant logistical problems for anyone needing to access the courts. On March 21, the Department of Homeland Security (DHS) announced that it

  will now require all legal visitors to provide and wear personal protective equipment (PPE) (disposable vinyl gloves, N-95 or surgical masks, and eye protection) in order to enter any

 detention facility, despite the nationwide shortage of PPE.

 Yet EOIR continues to operate courts in a business-as-usual manner, placing court personnel,

 litigants, and all community members in harm’s way. To make matters worse, DOJ and EOIR decision-making has been opaque, with inadequate information being released, causing confusion

 and leading to litigants showing up at hearings that are cancelled without notice.

 DOJ’s current response to the COVID-19 pandemic and its spread is frighteningly disconnected from the realities of our communities, and the advice of local leaders and scientific experts. DOJ must immediately implement the temporary closure all immigration courts. Failing to take this action now will exacerbate a once-in-a-century public health crisis and lead to a greater loss

 of life.

The campaign is in the beginning stages and we know that we have a lot of educating and other ground-laying work ahead of us, but we also want to acknowledge the tremendous amount of work that it took, both in our State and nationally, to get us to a point in the conversation where drafting and introducing this bill became possible.

In a locked, guarded courtroom in a compound surrounded by razor wire, Immigration Judge Jerome Rothschild waits — and stalls.

A Spanish interpreter is running late because of a flat tire. Rothschild tells the five immigrants before him that he’ll take a break before the proceedings even start. His hope: to delay just long enough so these immigrants won’t have to sit by, uncomprehendingly, as their futures are decided.

“We are, untypically, without an interpreter,” Rothschild tells a lawyer who enters the courtroom at the Stewart Detention Center after driving down from Atlanta, about 140 miles away.

In its disorder, this is, in fact, a typical day in the chaotic, crowded and confusing U.S. immigration court system of which Rothschild’s courtroom is just one small outpost.

Shrouded in secrecy, the immigration courts run by the U.S. Department of Justice have been dysfunctional for years and have only gotten worse. A surge in the arrival of asylum seekers and the Trump administration’s crackdown on the Southwest border and illegal immigration have pushed more people into deportation proceedings, swelling the court’s docket to 1 million cases.

“It is just a cumbersome, huge system, and yet administration upon administration comes in here and tries to use the system for their own purposes,” says Immigration Judge Amiena Khan in New York City, speaking in her role as vice president of the National Association of Immigration Judges.

“And in every instance, the system doesn’t change on a dime, because you can’t turn the Titanic around.”

The Associated Press visited immigration courts in 11 different cities more than two dozen times during a 10-day period in late fall. In courts from Boston to San Diego, reporters observed scores of hearings that illustrated how crushing caseloads and shifting policies have landed the courts in unprecedented turmoil:

–Chasing efficiency, immigration judges double- and triple-book hearings that can’t possibly be completed, leading to numerous cancellations. Immigrants get new court dates, but not for years.

–Young children are everywhere and sit on the floor or stand or cry in cramped courtrooms. Many immigrants don’t know how to fill out forms, get records translated or present a case.

— Frequent changes in the law and rules for how judges manage their dockets make it impossible to know what the future holds when immigrants finally have their day in court. Paper files are often misplaced, and interpreters are often missing.

In Georgia, the interpreter assigned to Rothschild’s courtroom ends up making it to work, but the hearing sputters moments later when a lawyer for a Mexican man isn’t available when Rothschild calls her to appear by phone. Rothschild is placed on hold, and a bouncy beat overlaid with synthesizers fills the room.

He moves on to other cases — a Peruvian asylum seeker, a Cuban man seeking bond — and punts the missing lawyer’s case to the afternoon session.

This time, she’s there when he calls, and apologizes for not being available earlier, explaining through a hacking cough she’s been sick.

But by now the interpreter has moved on to another courtroom, putting Rothschild in what he describes as the “uneasy position” of holding court for someone who can’t understand what’s going on.

“I hate for a guy to leave a hearing having no idea what happened,” he says, and asks the lawyer to relay the results of the proceedings to her client in Spanish.

After some discussion, the lawyer agrees to withdraw the man’s bond petition and refile once she can show he’s been here longer than the government believes, which could help his chances.

For now, the man returns to detention.

Here’s Why the Rejection Rate for Asylum Seekers Has Exploded in America’s Largest Immigration Court in NYC

“It’s basically like the same problem with putting quotas on police officers for tickets.”

The rate of asylum petitions denied in New York City’s busy immigration court has shot up about 17 times times faster than in the rest of the country during the Trump administration’s crackdown—and still Ana was there, a round-faced Honduran woman with a black scarf wrapped turban-like over her hair, a look of fright crossing her dark eyes as the judge asked if she faced danger in her home country.

Her eyes darted over to her helper, a Manhattan lighting designer with New Sanctuary Coalition volunteers to offer moral support—she couldn’t find a lawyer to take her case for free. Then Ana turned back to the judge, or rather, to the video screen that beamed him in from Virginia, and whispered to the court interpreter in Spanish: “My spouse and my son were killed.” Tears welled in her eyes as she said a notorious transnational gang had carried out the slaying.

“Yes we were receiving threats from them,” she added. And that was why, months before her husband and son were slain, she and her 5-year-old daughter had come “through the river,” entering the United States near Piedras Negras, Mexico.

After ruling that she was deportable, the judge gave Ana—The Daily Beast is withholding her real name because of the danger she faces in Honduras—three months to submit a claim for asylum, a possible defense against her removal. “You should start working on that,” the judge told her. As she left the courtroom, Ana hugged the volunteer who’d accompanied her, Joan Racho-Jansen.

New York’s immigration court has long been the asylum capital; it has made two out of every five of the nation’s grants since 2001, while handling a quarter of the caseload. With approval of 55 percent of the petitions in the fiscal year ended Sept. 30, it still grants a greater percentage of asylum requests than any other courts except San Francisco and Guam.

But New York’s golden door is slamming shut for far more asylum seekers than in the past, especially for women like Ana.

The asylum denial rate in the New York City immigration court rose from 15 percent in fiscal year 2016, the last full year of the Obama administration, to 44 percent in fiscal year 2019, which ended Sept. 30.  The rest of the country, excluding New York, has been relatively stable, with denials going from 69 percent to 74 percent. That is, the rate of denials in the rest of the country increased by one-ninth, but in New York they almost trebled.

There are other courts where the rate of denials has shot up sharply over the same period: Newark, New Jersey (168 percent); Boston (147 percent); Philadelphia (118 percent). But because of the volume of its caseload, what’s happening in New York is driving the national trend against asylum. For now, in sheer numbers, New York judges still granted more asylum requests over the last year than those in San Francisco, Los Angeles, and Arlington, Virginia, the next three largest courts, combined.

An analysis of federal data compiled by the Transactional Records Access Clearinghouse at Syracuse University and interviews with former immigration judges, lawyers, immigrant advocates and experts finds multiple reasons for the sharp shift in the nation’s largest immigration court as compared to the rest of the country:

—Many more migrants are coming to the New York court from Mexico and the “Northern Triangle” of El Salvador, Honduras, and Guatemala, and the judges have been far more likely to deny them asylum than in the past: from two out of five cases in the 2016 fiscal year to four out of five cases in the 2019 fiscal year.

—Many veteran New York judges retired, and most of the replacements have a prosecutorial, military, or immigration enforcement background. In the past, appointments were more mixed between former prosecutors and immigrant defenders. Immigration judges are appointed by the U.S. attorney general and work for the Justice Department, not the federal court system.

—All the judges are under heavier pressure from their Justice Department superiors to process cases more quickly, which gives asylum applicants little time to gather witnesses and supporting documents such as police reports. New judges, who are on two years of probation, are under particular pressure because numerical “benchmarks” for completing cases are a critical factor in employee evaluations.

“You have a huge number of new hires in New York,” said Jeffrey Chase, a former New York immigration judge. “The new hires are mostly being chosen because they were former prosecutors. They’re normally of the background that this administration thinks will be statistically more likely to deny cases.”

Judge Jeffrey L. Menkin, who presided in Ana’s case via video hookup, began hearing cases in March. He is based in Falls Church, Virginia, the home of the Executive Office of Immigration Review, the Justice Department agency that runs the immigration courts. He’d been a Justice Department lawyer since 1991, including the previous 12 years as senior counsel for national security for the Office of Immigration Litigation.

Menkin can see only a portion of his New York courtroom on his video feed and as a result, he didn’t realize a Daily Beast reporter was present to watch him conduct an asylum hearing for a Guatemalan woman—we’ll call her Gloria—and her three young children, who were not present.

Immigration and Customs Enforcement took Gloria into custody at the Mexican border in March. Released on bond, she made her way to New York and had an initial immigration court hearing on June 26, one of many cases on a crowded master calendar. She was scheduled for an individual hearing four months later.

At the hearing scheduled three months later on the merits of her case, she decided to present an asylum defense to deportation. Her lawyer asked for a continuance—that is, a new hearing date—while his client waited to receive documentation she’d already requested from Guatemala. The papers were on the way, Gloria said.

Judges in such cases—those that the Department of Homeland Security designates as “family unit”—have been directed to complete them within a year, which is about 15 months faster than the average case resolved for the year ending Sept. 30. Down the hall, other types of cases were being scheduled for 2023. Menkin called the lawyer’s unexpected request for a continuance “nonsense” and “malarkey” and asked: “Are you and your client taking this case seriously?”

The judge then asked if Gloria was requesting a case-closing “voluntary departure,” a return to her homeland that would leave open the option she could apply again to enter the United States.

But Gloria had no intention of going back to Guatemala voluntarily.  So Menkin looked to the government’s lawyer: “DHS, do you want to jump into this cesspool?” The government lawyer objected to granting what would have been the first continuance in Gloria’s case.

And so Menkin refused to re-schedule, telling Gloria and her lawyer that they had to go ahead right then if they wanted to present an asylum defense. Gloria began testifying about threats and beatings that stretched back a decade, beginning after a failed romance with a man who was influential in local politics. Details are being withheld to protect her identity.

She finally fled, she said, when extortionists threatened to hurt her children if she didn’t make monthly payoffs that were beyond her means. When she observed that she and her children were being followed, she decided to leave. After she said she had gone to police three times, Menkin took over the questioning.

“Are you familiar with the contents of your own asylum application?” he asked, pointedly.

“No,” Gloria responded.

Menkin said her asylum application stated she had gone to police once, rather than three times, as she’d just testified. Gloria explained that she had called in the information for the application to an assistant in her lawyer’s office, and didn’t know why it was taken down wrong.

When her lawyer tried to explain, Menkin stopped him, raising his voice: “I did not ask you anything.”

Later, Menkin came back to the discrepancy he’d picked up on. “I don’t know why,” Gloria responded.

“All right, STOP,” Menkin told the woman, who cried through much of the two-hour hearing. Again, he sought to terminate the case, asking the DHS lawyer, “Do I have grounds to dismiss this now?”

“I’m trying to be fair,” she replied.

“We’re all trying to be fair,” Menkin said.

And to be fair, it should be noted that since October 2018, the Executive Office for Immigration Review (EOIR) has been evaluating judges’ performance based on the numbers for case completions, timeliness of decisions and the percent of rulings upheld on appeal. “In essence, immigration judges are in the untenable position of being both sworn to uphold judicial standards of impartiality and fairness while being subject to what appears to be politically-motivated performance standards,” according to an American Bar Association report that assailed what it said were unprecedented “production quotas”  for judges.

The pressure is especially strong on judges who, like Menkin, are new hires. They are probationary employees for two years.

Denise Slavin, a former president of the National Association of Immigration Judges who retired from the bench in April after 24 years of service, said the judges’ union had tried to talk EOIR Director James McHenry out of his quotas. “It’s basically like the same problem with putting quotas on police officers for tickets,” she said. “It suggests bias and skews the system to a certain extent.” Told of the details of Gloria’s hearing, she added, “That’s a prime example of the pressure these quotas have on cases… the pressure to get it done right away.”

Kathryn Mattingly, spokeswoman for the Executive Office of Immigration Review, said by email that she couldn’t comment on individual cases, but that all cases are handled on their individual merits. “Each asylum case is unique, with its own set of facts, evidentiary factors, and circumstances,” she wrote. “Asylum cases typically include complex legal and factual issues.”  She also said that Menkin could not comment: “Immigration judges do not give interviews.”

It’s true that each asylum case has its own complex factors. But a 2016 study by the U.S. Government Accountability Office took many of them into account—the asylum seeker’s nationality, language, legal representation, detention status, number of dependents—and determined that there are big differences in how the same “representative applicant” will be treated from one court and one judge to another.

“We saw that grant rates varies very significantly across courts and also across judges,” said Rebecca Gambler, director of the GAO’s Homeland Security and Justice team.

Some experts say that changes in the way the Justice Department has told immigration judges to interpret the law may be having an outsize effect in New York.

Starting with Jeff Sessions, the Trump administration’s attorneys general have used their authority over immigration courts to narrow the judges’ discretion to grant asylum or, in their view, to clarify existing law.

Asylum can be granted to those facing persecution because of “race, religion, nationality, membership in a particular social group, or political opinion.” In June 2018, Sessions overturned a precedent that many judges in New York had been using to find that victims of domestic assaults or gang violence could be members of a “particular social group,” especially when police were complicit or helpless. Justice’s ruling in the Matter of A-B-, a Salvadoran woman, seems to have had a particular impact in New York.

“Where there’s a question about a ‘particular social group,’ judges in other parts of the country may have taken a narrower view” already, said Lindsay Nash, a professor at Cardozo Law School in New York and co-director of the Kathryn O. Greenberg Immigration Justice Clinic.

Mauricio Noroña, a clinical teaching fellow at the same clinic, said new judges would be especially careful to follow the lead in the attorney general’s ruling.

Andrew Arthur, a fellow at the Center for Immigration Studies in Washington and a former immigration judge in York, Pennsylvania, said Sessions’ decision in the Matter of A-B- would particularly affect Central American applicants, whose numbers have increased sharply in New York’s court. Data show that just 8.5 percent of the New York asylum cases were from Central America or Mexico in 2016; in the past year, 32.6 percent were.

Arthur said a larger portion of the New York court’s asylum rulings in the past were for Chinese immigrants, whose arguments for refuge—persecution because of political dissent, religious belief, or the one-child policy—are fairly straightforward under U.S. asylum law. Although the number of Chinese applicants is still increasing, they have fallen as a portion of the New York caseload from 60 percent in 2016 to 28 percent in the past year.

Sessions’ determination against A-B- is being challenged, and lawyers have been exploring other paths to asylum in the meantime. “It’s extremely complicated to prepare cases in this climate of changing law,” said Swapna Reddy, co-executive director of the Asylum Seeker Advocacy Project. But, she said, “That’s not to say advocates and judges can’t get back to that [higher] grant rate.”

Gloria continued to cry; the DHS lawyer asked that she be given a tissue. The government lawyer’s cross-examination was comparatively gentle, but she questioned why Gloria didn’t move elsewhere within Guatemala and seek police protection.

“He would find out before I even arrived at the police station,” she said of the man she feared. And, she added, “They’re always going to investigate and as for always being on the run, that’s no life for my kids.”

In closing arguments, Gloria’s lawyer said his client had testified credibly and that she legitimately feared her tormentor’s influence. The DHS lawyer did not question Gloria’s credibility, but she said Gloria’s problem was personal, not political—that she could have moved to parts of Guatemala that were beyond the reach of the man’s political influence.

Judge Menkin then declared a 20-minute recess so that he could compose his decision. In the interim, the lawyers discovered that a man sitting in one corner of the small courtroom was a reporter and, when the judge returned to the bench to rule, so informed him.

Immigration court hearings are generally open to the public. There are special rules for asylum cases, however. The court’s practice manual says they “are open to the public unless the respondent expressly requests that they be closed.”

“Oh, Jesus Christ!” Menkin shouted at the lawyers when he learned a reporter had been present for the hearing. “Don’t you people look around the room? What’s the matter with you?”

After the judge expressed his alarm, the reporter was ejected with Gloria’s tearful assent, and so the basis for Judge Menkin’s ruling on Gloria’s asylum petition is not known. The outcome is, though: denied, 30 days to appeal.

Sound like Due Process to you? Only if it’s not your life at stake! Wonder how Judge Menkin and others like him would feel if they and their families were subjected to the same type of “judicial” procedure.

In viewing Judge Menkin’s ridiculous denial of a routine continuance, it’s important to understand that the precedent decisions binding Immigration Judges have intentionally over-emphasized the importance of documenting claims – even though documentation is often unavailable or time-consuming to obtain, have properly translated, and serve on the Immigration Judge and ICE in advance of the hearing. Therefore, denying a first continuance for needed preparation is tantamount to “giving the finger” to Due Process!

“Women in Honduras” has been found to be a valid “particular social group” by a number of Immigration Judgers elsewhere. Given the corruption of the Government of Honduras, the political influence of Ana’s tormentor, and the high rate of femicide, it’s highly unlikely that Ana would receive government protection.

The ICE attorney made an absurdist argument that Ana could “safely resettle” elsewhere in Honduras. Honduras is a small country, about the size of Virginia. It has an astronomical murder rate, highly corrupt police, snd almost no viable infrastructure, all important considerations in a legitimate inquiry into relocation. Under these conditions, there is no way that Ana had a “reasonably available internal relocation alternative” in Honduras as described in Federal Regulations. A “real” judge might have grilled ICE counsel about her legally and factually untenable position. But, not Menkin. He apparently had already made up his mind to deny regardless of the law or facts.

In short, before a “fair and impartial” judge with expertise in asylum law this could and should have been an “easy grant” of asylum, even without the additional documentation that could have been presented if the judge had granted a continuance. Instead, it was “orbited” off into a dysfunctional administrative appellate system where results are akin to “Refugee Roulette” highly dependent on the “panel” or individual “Appellate Immigration Judge” to which the case is assigned at the BIA. In this respect, it’s also noteworthy that Barr recently appointed six Immigration Judges with some of the highest asylum denial rates in the country to the BIA. Some “fair and impartial” judiciary!

It also appears that Menkin belatedly and improperly “duressed” Ana into agreeing to a “closed” hearing. Most of the time, once asylum applicants’ attorneys carefully explain to them that public observation and exposure of this “rigged” process might be the only way of getting pressure to change it, they readily agree to have the press present. Also, generally everybody tends to perform better and more professionally when the press or other observers are present (obviously, however, in this particular case, not so much).

First the Trump Regime artificially suppresses asylum grant rates with skewed hiring, improper interpretations of the law, unethical quotas, and pressure on the “judges” to crank out more removal orders. Then, they use the bogus statistics generated by the intentionally flawed and biased process to make a case that most of the asylum claims are non-meritorious.

Notably, even under this clearly biased, overtly anti-asylum procedure, the majority of asylum claims that get decided “on the merits” in New York are still granted. Imagine what the grant rate would be in a truly fair judicial system that properly applied asylum law and the Constitution: 70%, 80%, 90%? We’ll never know, because the regime fears the results of a fair asylum process that fully complies with Due Process: The “dirty little secret” the regime doesn’t want you to know! Talk about “fraud, waste, and abuse!” Something to remember the next time you hear “Cooch Cooch,” “Markie,” Albence, and other Trump sycophants at DHS and DOJ falsely claim that the overwhelming number of asylum applications are without merit.

Judges likes Menkin might want to remember that the truth will eventually “out’ even if too late to save the life of Ana and others like her. When that happens, those judges who put expediency, their jobs, and homage to the Trump Regime’s White Nationalist agenda before the law, Due Process, and human lives will find their “legacies” tarnished forever.

They Fled Gang Violence And Domestic Abuse. An NYC Immigration Judge Denied Them Asylum

Seventeen year-old Josue and his mom, Esperanza, were visibly drained. They had just spent more than four hours at their asylum trial inside an immigration court at 26 Federal Plaza in Lower Manhattan, answering questions from their attorney and a government lawyer. We are withholding their full names to protect their identities because they’re afraid.

“It was exhausting,” said Josue, whose angular haircut was neatly combed for the occasion. In Spanish, he told us the judge seemed nice but, “you feel bad if you don’t know if you are going to be allowed to stay or if you have to go.”

The teen and his mother crossed the U.S. border in California in the summer of 2018. At the time, a rising number of families were entering the country, and the Trump administration wanted to send a message to them by swiftly deporting those who don’t qualify for asylum. But immigration judges are so busy, they can take up to four years to rule on a case. In November, judges in New York and nine other cities were ordered to fast track family cases and complete them within a year.

This is how Esperanza and Josue wound up going to trial just 10 months after they arrived in the U.S. and moved to Brooklyn. They were lucky to find attorneys with Central American Legal Assistance, a nonprofit in Williamsburg that’s been representing people fleeing the troubled region since 1985.

Winning asylum was never easy. But in 2018, former Attorney General Jeff Sessions made it tougher for people like Josue and Esperanza when he issued his own ruling on an immigration case involving a woman from El Salvador who was a victim of domestic violence. He wrote: “The mere fact that a country may have problems effectively policing certain crimes—such as domestic violence or gang violence—or that certain populations are more likely to be victims of crime, cannot itself establish an asylum claim.”

Immigration judges were bound to give heavy weight to that ruling. Their courts are run by the Department of Justice, whose boss is the Attorney General. And the AG’s boss, President Trump, frequently asserts that too many migrants lie about being threatened by gangs when they’re just coming for jobs. “It’s a big fat con job, folks,” he said at a Michigan rally this year.

Esperanza and Josue went to court soon after Sessions’ decision. She was fighting for asylum as a victim of domestic abuse; Josue claimed a gang threatened his life. Both would eventually lose their cases.

Josue’s case

Esperanza and Josue are typical of the Central American families seeking asylum these days, who say they’re escaping vicious drug gangs, violence and grinding poverty. The two of them came from a town outside San Pedro Sula, one of the most dangerous cities in the world.

During their trial, Josue testified under oath about how gang members repeatedly approached him outside his high school, asking him to sell drugs to the other students. He tried to ignore them, and gave different excuses for resisting, until one day when they spotted him playing soccer and became more aggressive. That’s when he said the gang leader put a gun in his face.

“He told me that if I didn’t accept what he wanted he was going to kill my whole family, my mother and sister,” he said, through a Spanish interpreter.

“I was in shock,” he said. “I had no other choice to accept and said yes.”

He told his mother and they left Honduras the next day. When Josue’s lawyer, Katherine Madison, asked if he ever reported the threat to the police he said no. “That was practically a suicide,” he said, explaining that the police are tied to the gang, because it has so much power.

Josue said his older sister later moved to Mexico because she was so afraid of the gang.

Winning asylum is a two-step process. You have to prove that you were persecuted, and that this persecution was on account of your race, religion, nationality, social group or political opinion. Madison, Josue’s attorney, argued that in Honduras, defying gangs is a risky political statement.

“They function in many ways as the de facto government of the areas where people like Josue lived,” she told WNYC/Gothamist, summing up the arguments she submitted to the judge. “They make rules. They charge basically taxes, they say who can live there and who can’t.”

And they’re known to kill people who don’t obey.

In her ruling, issued in August, Immigration Judge Oshea Spencer found Josue did experience persecution. But she denied his application for asylum. She said much of what he described “were threats and harm that exist as part of the larger criminal enterprise of the gangs in Honduras and not on the basis of any actual or perceived opposition to the gangs.”

Esperanza’s case

Esperanza’s attorney argued that her life was at risk because the gang member threatened Josue’s family. But Spencer didn’t find that specific enough. She wrote that the gang members “were motivated by their efforts to expand their drug trade, not the family relationship.” Among other cases, she referred to a recent decision by the current Attorney General, William Barr, that makes it harder for the relatives of someone who’s been threatened to win asylum.

Esperanza also lost on a separate claim that she deserved asylum because she was repeatedly beaten by Josue’s father. In court, she testified about years of abuse culminating in an incident in which he chased her with a machete. She said she couldn’t get the police to issue a restraining order, and said he kept threatening her after she moved to another town to stay with relatives.

Madison argued that women like Esperanza belong to a persecuted social group: they can’t get help from the authorities in Honduras because they’re viewed as a man’s property. The country is one of the deadliest places to be a woman; police are known to ignore complaints; and it’s extremely hard for women to get justice.

But Spencer ruled that there is no persecuted social group made up of “Honduran women who are viewed as property” for being in a domestic relationship.

Echoing the Sessions’ ruling, the judge said these categories “all lack sufficient particularity,” and called them “amorphous” because they could be made up of a “potentially large and diffuse segment of society.”

She also cited evidence submitted by the government that showed conditions in Honduras are improving for women. This evidence came from a 2018 State Department report on human rights in Honduras. Immigration advocates claim it’s been watered down from the much harsher conditions described in the last report from 2016. It’s also much shorter in length.

Jeffrey Chase, an immigration lawyer and former New York immigration judge, said it’s not surprising that Esperanza and Josue would each lose asylum. Judge Spencer only started last fall and is on probation for her first two years in the job.

“This was decided by a brand new judge who didn’t have any immigration experience prior to becoming an immigration judge,” he said, referring to the fact that Spencer was previously an attorney with the Public Utility Commission of Texas. He said she went through training which, “These days, includes being told that we don’t consider these to be really good cases.”

Sitting judges don’t talk to the media but Chase noted that they must consider the facts of each individual case, meaning the former Attorney General’s ruling doesn’t apply to all cases. He noted that some women who were victims of abuse are still winning asylum. He pointed to a case involving a Guatemalan woman who was raped by her boss. A Texas immigration judge found she did fit into a particular social group as a woman who defied gender norms, by taking a job normally held by a man.

During Josue and Esperanza’s trial, there was a lot of back and forth over their individual claims. A trial attorney from Immigration and Customs Enforcement questioned why Esperanza didn’t contact the police again after moving to another town, where she said her former partner continued to threaten her. Esperanza said it was because her brother chased him away and the police “don’t pay attention to you.”

The ICE attorney also asked Josue if his father was physically violent with anyone besides Esperanza. Josue said he did fight with other men. San Diego immigration lawyer Anna Hysell, who was previously an ICE trial attorney, said that could have hurt Esperanza’s case.

“The government was able to make the arguments that he didn’t target her because of being a woman that was in his relationship,” she explained. “He just was probably a terrible person and targeted many people.”

Hysell added that this was just her analysis and she wasn’t agreeing with the decision.

Attorney Anne Pilsbury said she believes Esperanza would have won her case, prior to the asylum ruling by Sessions, because she suffered years of abuse. But she said Josue would have had a more difficult time because gang cases were always tough. And like a lot of migrants, Josue had no evidence — he was too afraid to go to the cops. Pilsbury said immigration judges are even more skeptical now of gang cases.

“They’re getting so that they won’t even think about them,” she said. “They aren’t wrestling with the facts. They’re hearing gang violence and that’s it.”

She said Judge Spencer does sometimes grant asylum, and isn’t as harsh as other new judges. New York City’s immigration court used to be one of the most favorable places for asylum seekers. In 2016, 84 percent of asylum cases were granted. Today, that figure has fallen to 57 percent, according to TRAC at Syracuse University. Meanwhile, the government is forcing migrants to wait in Mexico for their immigration court cases or seek asylum in other countries before applying in the U.S., as the national backlog of cases exceeds one million.

Pilsbury, who founded Central American Legal Assistance in 1985, said immigration courts are now dealing with the result of a regional crisis south of the border that’s never been properly addressed since the wars of the 1980s.

“The anti-immigrant people feel it’s broken because people get to come here and ask for asylum and we feel it’s broken because people’s asylum applications aren’t seriously considered,” she explained. “We should be doing more to understand what’s going on in those countries and what we can do to help them address the chronic problems.”

Esperanza and Josue’s cases will now be appealed. Madison said she believes the judge ignored some of her evidence about gangs. She’s now turning to the Board of Immigration Appeals. However, it’s also controlled by the Justice Department — meaning the odds of getting a reversal are slim. If they lose again, the family can go to a federal circuit court which may have a broader definition of who’s eligible for asylum.

But Esperanza and Josue won’t be deported as long as their case is being appealed. On a late summer day, they seemed relaxed while sitting in a Brooklyn park. Esperanza talked about how happy she is that Josue is safe at his public high school, and can even ride a bike at night with his friends.

“He goes out and I’m always trusting the Father that just as he goes out, he comes back,” she said.

Even if they knew they would lose their asylum case, both said they still would have come to the U.S. because the risk of staying in Honduras was too great. Josue said the gang would definitely find him if he ever returned because their networks are so deep throughout the country. He’s now taking the long view. He knows there will be a Presidential election next year.

“It’s like a game of chess,” Josue said. “Any mindset can change at any moment. Maybe Trump changes his mind or maybe not. But I would have always made the decision to come.”

It’s not “rocket science.” Better, fairer outcomes were available that would have fulfilled, rather than mocked, our obligation to provide Due Process and protection under our own laws and international treaties.

Here’s how:

  • Esperanza’s claim is a clear asylum grant for “Honduran women” which is both a “particular social group” (“PSG”) and a persecuted group in Honduras that the government is unwilling or unable to protect.
  • Although the last two Administrations have intentionally twisted the law against Central American asylum seekers, Josue has a clear case for asylum as somebody for whom opposition to gang violence was an “imputed political opinion” that was “at least one central reason” for the persecution.   • In any event, on this record, Josue clearly showed that he faced a probability of torture by gangs with the acquiescence of the Honduran government, and therefore should have been granted mandatory protection by the Immigration Judge under the Convention against Torture (“CAT”).
  • The Immigration Judge’s assertion that things are getting better for women in Honduras, one of the world’s most dangerous countries for women where femicide is rampant, not only badly misapplies the legal standard (“fundamentally changed conditions that would eliminate any well founded fear”) but is also totally disingenuous as a factual matter.   • Additionally, Honduras remains in a state of armed conflict. See, e.g., https://www.tandfonline.com/doi/full/10.1080/23740973.2019.1603972?needAccess=true. Under an honest Government, granting TPS to Hondurans (as well as Salvadorans and Guatemalans affected by environmental disasters heightened by climate change) would be more than justified.
  • Under honest Government following the rule of law, well-documented cases like this one could be quickly granted by the USCIS Asylum Officer or granted on stipulation in short hearings in Immigration Court. Many more Central Americans could be granted CAT relief, TPS, or screened and approved for asylum abroad. They could thereby be kept off of Immigraton Court dockets altogether or dealt with promptly on “short dockets” without compromising anybody’s statutory or constitutional rights (compromising individual rights is a “specialty” of all the mostly ineffective “enforcement gimmicks” advanced by the Trump Administration).
  • Over time, the overwhelming self-inflicted Immigration Court backlogs caused by the Trump Administration’s “maliciously incompetent” administration of immigration laws (e.g., “Aimless Docket Reshuffling”) would be greatly reduced.
    • That, in turn, would allow the Immigration Courts to deal with cases on a more realistic timeline that would both aid rational, non-White-Nationalist immigration enforcement and provide real justice for those seeking protection under our legal system.
  • As I’ve said before, it’s not “rocket science.” All it would take is more honest and enlightened Government committed to Due Process, good court management, and an appropriate legal application of laws relating to refugees and other forms of protection. I doubt that it would cost as much as all of the bogus “enforcement only gimmicks” now being pursued by Trump as part of his racist, anti-migrant, anti-Hispanic agenda.
  • Poor judicial decision making, as well illustrated by this unfortunate wrongly decided case, not only threatens the lives of deserving applicants for our protection, but also bogs down an already grossly overloaded system with unnecessarily protracted litigation and appeals of cases  that should be “clear grants.”
  • Contrary to the intentionally false “party line” spread by “Big Mac With Lies” and other corrupt Trump sycophants at the DHS and the DOJ, a much, much higher percentage, probably a majority, of asylum applicants from the Northern Triangle who apply at our Southern Border should properly be granted some type of legal protection under our laws if the system operated in the fair and impartial manner that is Constitutionally required. The Trump Administration aided by their sycophants and enablers, all the way up to the feckless Supremes, are literally “getting away with murder” in far, far too many instances. 
  • Consequently, quickly identifying and granting relief to the many deserving applicants would be a more efficient, humane, and lawful alternative to the “Kill ‘Em Before They Get Here” deterrence  programs being pursued by Trump, with the complicity of the Supremes, the Ninth Circuit, and some of the other Federal Circuit Courts who have been afraid to put a stop to the extralegal nonsense going on in our Immigraton Courts, detention centers (the “New American Gulag”), our Southern Border, and countries like Mexico, El Salvador, Guatemala, and El Salvador where we are basically encouraging extralegal abuses and gross human right violations against migrants. It will eventually come back to haunt our nation, or whatever is left of our nation after Trump and his gang of White Nationalist thugs, supporters, appeasers, apologists, and enablers, are done looting and destroying it.

THE GOOD NEWS: Gender-Based Asylum Claims Continue To Win In the “Post A-B- Era” — THE BAD NEWS: Applicants Subjected To “Let ‘Em Die In Mexico” & Completely Bogus “Unsafe Third Country” Procedures By Trump & His Cowardly Article III Judicial Enablers Don’t Have Access To This (Or Any Other) Type Of Justice!

First, many congrats Daniel for saving this family’s lives and for passing this along. YOU are what the “New Due Process Army” is all about!

A few thoughts:

  • Note the meticulous preparation, presentation, and critical use of detailed expert testimony by Daniel in developing this case before Judge Hom. This is “textbook,” exactly what it takes to have any chance of winning asylum in an intentionally hostile Immigration Court environment these days.
    • Yet, how would one of the “Let ‘Em Die In Mexico” refugees, or those subjected to bogus requirements to apply for asylum under barely existent Mexican procedures or virtually non-existent systems in places like El Salvador, Guatemala, and Honduras, some of the world’s most dangerous refugee SENDING countries, possibly have access to this type of life-saving representation?
    • How could any “unrepresented” applicant, particularly a child or someone with minimal formal education and a non-English speaker, possibly make such a winning presentation?
      • Yet this is exactly what is being required in today’s Immigration “Courts.”
      • How are Article III life-tenured Appellate Judges, including the Supremes, letting these absurdly unfair scenarios, clear violations of Due Process and fundamental fairness, unfold before them?
      • This is a clear dereliction of duty, that has been going on for years, by the Article IIIs. Yet, it has gotten immeasurably worse under the biased White Nationalist racist attack on migrants and asylum seekers by the Trump Administration.
      • What are these cowardly and indolent Article III Judges being paid for if they are unwilling and or unable to do their jobs of standing up for the legal and Constitutional rights of the most vulnerable in our legal system?

  • Note the equally meticulous, careful, thorough, and scholarly judicial opinion produced by Judge Hom in this case.
    • How could judges ordered to produce three or more final decisions after hearing each work day consistently provide this type of quality analysis and writing, particularly with no personally assigned law clerks or other support staff?
    • Judge Hom happened to have 42 years of judicial and immigration practice experience before his appointment. (He’d actually worked for me as a Trial Attorney when I was the Deputy GC and Acting GC of the “Legacy INS” back in the late 1970’s and early 1980’s). He is also one of a very few recently appointed Immigration Judges who had decades of private practice experience representing foreign nationals before becoming an Immigration Judge.
    • So, how would the “average” new Immigration Judge, with far less experience, no knowledge of representing asylum applicants or anyone else except the Government, no meaningful training, a wealth of misinformation like Gonzo’s decision in Matter of A-B- thrown at them as “gospel,” unethical and unrealistic production guidelines, and neither personal support nor control over their own dockets, consistently produce this type of quality work?
      • The answer: They wouldn’t.  That’s the whole intent behind the Trump Administration’s “malicious mismanagement” of the U.S. Immigration Courts: To crank out racially motivated rote denials of migrants’ rights, particularly in the asylum area. Then count on the corrupt Supremes’ majority and some complicit and cowardly U.S. Court of Appeals Judges to rubber stamp and enable this systematic and unconstitutional malfeasance.
    • Just think back to the dishonest and complicit role of the judiciary on both the Federal and State levels following Reconstruction and during the Jim Crow era. They were key participants in “weaponizing” the U.S. legal system against Black U.S. citizens and implicitly or explicitly encouraging, aiding, and abetting lynching, other extra-judicial killings, torture, other abuses, invidious discrimination, and systematic denial of legal and Constitutional rights.  
    • Go on over to the U.S. Holocaust Museum in Washington, D.C., and learn about the disgusting role of the German Judiciary in assisting, rather than resisting, Hitler and his anti-Semitic ethnic cleansing program. In many instances, the German judges actually appeared anxious to “Out Hitler” Hitler, shockingly, even when it came to persecuting their former Jewish judicial colleagues, suddenly converted to “non-person” status under Hitler’s edicts.
    • Don’t kid yourself! Led by the Supreme’s totally cowardly and disingenuous performance in Barr v. East Side Sanctuary Covenant, where even in the face of courageous dissents the majority didn’t deign to explain their extraordinary support for a bogus, White Nationalist, Anti-Hispanic program that clearly violates the law and the Constitution, the Supremes are well on their way to joining the Trump Administration’s “Dred-Scottification” Program (that is, conversion to “non-person status” of migrants). Hispanic Americans are next on the list, followed by African Americans (the “usual suspects” who never seem to have “gotten off the list”), LGBTQ citizens, women, and anybody else that doesn’t fit Trump’s announced program of minority White Nationalist rule.
    • Think it “can’t happen here?” Sorry, it already is happening — every day! And, that’s the “Bad News” for all of us and for our country!
    • “Women in X Country” is and always has been an obvious “particular social group” for which there is a well-established “nexus” to persecution in many countries that send us refugees. So, why its the U.S. Government and, to a large extent, the judiciary so disingenuously “dug in” against recognizing this very obvious, life-saving truth?
    • Now, let’s consider a brighter alternative:
      • We get better Government, including more honest, scholarly, fair, and courageous Federal Judges;
      • Matter of A-B- and other Trump-era xenophobic atrocities are withdrawn; 
      • Judge Hom’s decision and others like it, showing how asylum can be granted in deserving cases, are made binding precedents;
      • Asylum applicants are encouraged to apply in an orderly fashion at the U.S. border;
      • NGOs, pro bono groups, and Government lawyers work together cooperatively to identify asylum grants like this one and either 1) process them through the Asylum Office system, or 2) document and stipulate to the key legal and factual issues so that the cases can be efficiently moved forward and quickly granted by Immigration Judges without disrupting existing dockets;
      • Experience representing asylum seekers is given equal consideration with Government litigating experience in selecting Immigration Judges; 
      • Judicial candidates like Judge Hom, with experience on both sides of the aisle, and universal reputations for fairness and scholarship, are considered among the “best qualified” to become Immigration Judges;
      • Individuals with backgrounds like Judge Hom’s become Appellate Immigration Judges and ideally are eventually considered for Article III Judgeships;
      • Immigration Judges and Asylum Officers are given extensive training in asylum law by professors, NGO representatives, and clinicians with real expertise in determining asylum claims fairly;
      • Legitimate emergency situations are handled with the assistance of a well-trained corps of experienced volunteer retired judges from a variety of Federal and State court systems;
      • Due Process, fundamental fairness, and meticulous scholarship replace anti-immigrant bias and expediency as the goals and values of a newly independent Article I Immigration Court System;
      • It’s neither “rocket science” nor “pie in the sky.”
        • Truth is, the “better system” I just described could and should have been established under the Obama Administration if it had actually “practiced what candidate Obama preached;”
        • When it finally happens, it will be much cheaper (on a time-adjusted scale) than than the current immigration system involving failed courts, misdirected enforcement, cruel, unnecessary, expensive, and illegal “civil” detention, “show walls,” child separation, frivolous and semi-frivolous Government initiated litigation, and dozens of other “built to fail” gimmicks designed to deter migration through gross mistreatment rather than process would be migrants of all types fairly, reasonably, and efficiently. 
        • It’s now the mission and job of the “New Due Process Army” to succeed where we and past generations have so miserably failed!
        • Due Process Forever! The Trump Administration’s White Nationalism With Judicial & Congressional Enablers, Never!
