(Reuters) – On a rainy September day in 2018, Jeff Sessions, then U.S. attorney general, addressed one of the largest classes of newly hired immigration judges in American history.

“The vast majority of asylum claims are not valid,” he said during a swearing-in ceremony in Falls Church, Virginia, according to his prepared remarks. If judges do their job, he said, “the number of illegal aliens and the number of baseless claims will fall.”

It was a clear message to the incoming class: Most of the immigrants who appear in court do not deserve to remain in the United States.

As U.S. President Joe Biden works to undo many of the restrictive immigration policies enacted by former President Donald Trump, he will confront one of his predecessor’s indelible legacies: the legion of immigration judges Trump’s administration hired.

The administration filled two-thirds of the immigration courts’ 520 lifetime positions with judges who, as a whole, have disproportionately ordered deportation, according to a Reuters analysis of more than 800,000 immigration cases decided over the past 20 years.

Judges hired under Trump ordered immigrants deported in 69% of cases, compared to 58% for judges hired as far back as the administration of President Ronald Reagan. Because hundreds of thousands of immigrants have cases before the court each year, that 11 percentage-point difference translates to tens of thousands more people ordered deported each year. Appeals are rarely successful.

Biden has promised to dramatically expand the courts by doubling the number of immigration judges and other staff. That’s a worthwhile effort, said Stephen Legomsky, a former chief counsel of the U.S. Citizenship and Immigration Services who is now a professor emeritus at Washington University School of Law in St. Louis. “But the challenge is going to be tremendous.”

Although there are no statutory limits on the number of judges who can be hired, expanding the court would be costly and could take years, immigration law experts said.

“The fact that these (Trump-era) judges are already in place inhibits him a great deal,” Legomsky said of Biden.

Stephen Miller, the key architect of Trump’s immigration agenda, told Reuters that the administration had aimed to hire more immigration judges as part of an effort to “create more integrity in the asylum process” and quickly resolve what he termed meritless claims to cut down on a massive backlog.

“Most of the people that are coming unlawfully between ports of entry on the southwest border are not eligible for any recognized form of asylum,” Miller said in an interview. “There should be a very high rejection rate.”

Under U.S. law, immigrants are eligible for asylum only if they can prove they were being persecuted in their home countries on the basis of race, religion, nationality, membership in a particular social group or their political opinions. Miller said many migrants arriving at the border are coming for economic reasons and present fraudulent asylum claims.

Sessions, who as attorney general had the final say in hiring immigration judges, told Reuters that “the problem is not with the Trump judges. The problem was with some of the other judges that seemed to not be able to manage their dockets, or, in many cases, rendered rulings that were not consistent with the law.

The Trump administration’s successors to Sessions, who was forced out in 2018, did not respond to requests for comment.

“There has been a significant lack of basic understanding of immigration law and policy with many – not all – but many of the new hires under the Trump administration,” said Susan Roy, an attorney and former immigration judge appointed during the administration of President George W. Bush who has represented immigrants before some new judges.

Reuters spoke with eight other former immigration judges, five of whom served under Trump, who generally echoed her view. Sitting immigration judges are not permitted to speak to the media.

Even for judges with immigration backgrounds, the type of experience they have has been controversial. In 2017, a report commissioned by the Justice Department found a lack of diversity of experience among judges hired, due to an excess of former prosecutors here from Immigration and Customs Enforcement.

Stephen Legomsky is a former USCIS Senior Executive and esteemed retired Professor who generally is acknowledged as one of American’s leading scholar-experts on immigration and human rights.

Judge Dana Leigh Marks, quoted elsewhere in the article, is a former President of the National Association of Immigration Judges who also successfully argued the landmark  Supreme Court  case INS v. Cardoza-Fonseca, which established the generous well-founded fear standard for asylum.

Sessions and Miller are notorious White Nationalist xenophobes who have neither represented asylum seekers nor been Immigration Judges. Their efforts to eradicate international norms and legal protections for vulnerable asylum seekers, and their particular bias against female asylum seekers, have been widely criticized and panned by human rights experts throughout the world, as well as enjoined or overruled by some U.S. Courts. They were architects of the widely condemned child separation policy and the New American Gulag (“NAG”).

EOIR is the failed DOJ agency that houses the dysfunctional Immigration Courts.

Immigration and Customs Enforcement officials have created a new appeals process that will allow immigrants and their advocates to challenge arrests, detentions, and deportations as the Biden administration continues to focus enforcement actions on certain populations, officials said Friday.

Shows that somebody in charge in the Biden Administration understands the scope of the problems they face in bringing ICE under control.

Compliance with agency policies has always been an issue at ICE, going all the way back to the days of the “Legacy INS.” Both on and off the bench, I observed that most policies applied only to the extent that local directors and agents chose to follow them. 

I can remember essentially being told “We don’t follow that policy here,” or words to that effect. Or the time that an ICE Assistant Chief Counsel cheerfully told me in court: “Judge, you can enter any order you want. But, our deportation officer will decide whether this respondent actually gets released from custody.”

No wonder that ACC didn’t feel it necessary to appeal my custody decision after I had ruled against him. Of course, DOJ regulations (actually enacted by the Clinton Administration) give ICE Counsel unilateral authority (“The Clamper”) to stay compliance with IJ release and bond orders pending appeal.  So, ICE always holds the “trump card” in bond proceedings.

Fortunately, represented respondents can threaten to go to U.S. District Court to force ICE compliance with an administrative order, if necessary. (The respondent in my case was represented.) But, for unrepresented individuals facing ICE intransigence, not so much.
That’s probably why a culture of disdain for immigrants’ rights and dislike of lawyers has grown up in so many ICE operations.

I also recollect that even in the Obama Administration, under pressure from ICE Enforcement, EOIR Management pushed Immigration Judges to “keep out of” the manner in which ICE complied with things like the “Morton Memo” or “PD” that should have been keeping certain cases out of court. And the BIA has traditionally stayed away from commenting on or reviewing prosecutorial policies, even when they directly affect court workloads or individual outcomes. 

There were creative ways of skirting many of these bureaucratically-imposed blinders and pushing ICE, at least in court, to act in accordance with their own policies. But, it had to be done subtilely. EOIR was usually eager officially to announce its own fecklessness when it came to getting compliance from ICE.

I often marveled at the BIA’s ability to explain why it didn’t have authority to solve problems or do justice. In some instances, the Article III Courts actually had to instruct the BIA that they had authority to do things that they had claimed to be powerless to do.

In addition to the ICE policy described in Hamed’s article, there are other obvious ways in which compliance could be strengthened. Judge Garland could create a “New EOIR” dedicated to the original vision of due process, fundamental fairness, and best practices. He could also empower Immigration Judges to hold ICE accountable for following its own policies. As part of this, he could confer the long-existing but never implemented authority of EOIR judges to hold attorneys on both sides in contempt of court.

An independent Immigration Judiciary could be an important part of enforcing the rule of law and holding DHS accountable for its actions. But, that’s not possible with the current structural, personnel, and cultural defects that have corrupted EOIR and prevented it from being a progressive force for due process, equal justice under law, and best practices.

Indeed, under the departed regime, lack of accountability, irrationality, open bias, scofflaw behavior, and “worst practices” were institutionalized and celebrated from top to bottom! This was in a “system” already heavily weighted in favor of ICE Enforcement and against individual rights.

It will require “radical due process reforms @ EOIR” from Judge Garland and his team. We’ll soon see whether or not that will be forthcoming. 

Folks who have been happily assisting in abusing and dehumanizing asylum seekers, other migrants, and their lawyers for the past four years are not lightly going to be able to “switch over” to insuring due process and fundamentally fair adjudications under the best interpretations and practices — which actually favor the granting of relief in a timely and efficient manner in many cases. Indeed, in some cases, those serving as “judges” at EOIR appear to lack the capacity, expertise, and will to treat those coming before them fairly, impartially, and humanely, even these requirements are at the heart of constitutionally required due process!

The Department of Homeland Security (DHS) is reportedly drafting plans to transform family migrant detention centers in South Texas into screening hubs as the Biden administration faces a growing number of migrants at the southern border.

The Washington Post, which obtained internal DHS draft documents outlining the plans, reported Thursday that senior ICE official Russell Hott informed staff in an email this week that the number of unaccompanied minors and families arriving in the U.S. in 2021 is “expected to be the highest” recorded “in over 20 years.”

According to the Post, Hott added that with more than 500 family members arriving per day, the shift from detention to Ellis Island-style processing centers “may not be sufficient to keep pace with apprehensions,” with the potential for some migrants to be housed in hotels.

DHS officials, who spoke to the Post on the condition of anonymity because they were not authorized to speak publicly, said the transition to rapid processing and release centers has already begun.

The reported change comes as the latest move in President Biden’s efforts to reform the U.S. immigration system and keep up with the rising number of migrants crossing into the country amid shortages of bed space and personnel at detention centers.

The reported plans also mark a shift from policies under the Obama and Trump administrations, when most migrant families were quickly released or deported upon arriving in the U.S., with some being held in dormitory-style centers for extended periods of time as they awaited immigration proceedings.

The Biden administration has publicly said it is reviewing how family detention facilities are used, though the Post noted that the administration last week told a federal judge that the policies had not yet changed.

The government ordered her removed to Honduras, and an immigration judge (“IJ”) denied her subsequent application for withholding of removal (“Application”). Molina appealed to the Board of Immigration Appeals (“BIA”), which affirmed the IJ’s order and denied Molina’s motion to reopen and remand. Molina now petitions this court to review the BIA’s decision. Because we agree that the IJ and BIA made legal errors, we grant the petition, vacate the removal order, and remand for further proceedings.

Folks, we’re not talking about obtuse principles of international law, complex statutory interpretation, or “cutting edge” legal concepts. No, this is about credibility, corroboration, following your own precedents (even when they might produce a result favorable to the respondent), and adjudicating a CAT claim. 

These are the “bread and butter” of basic asylum and withholding adjudication that is the staple of most Immigration Court dockets. Not rocket science! Yet, once they got below the “caption line,” the BIA, a supposedly “expert tribunal,” got pretty much everything else wrong. With human life at stake, no less!

This isn’t just an “outlier.” It reveals deep systemic problems in a dysfunctional system that has been programmed to cut corners and deny relief. After 21 years as an EOIR Judge at every level, I know an “autopilot denial” when I see one. 

This is clearly the product of a judge and a BIA panel that approached the case with a “we deny almost all Hondurans, it’s just a question of how” attitude. Because “the bottom line got to no,” obviously nobody paid much, if any, attention to what was above it. I suspect that if the staff attorney had drafted this as a grant or a remand, the BIA panel would have given it a more thorough and searching review. 

Following your own precedents isn’t a matter that requires profound knowledge or amazing analytical skills. It just requires some level of basic expertise and an open mind — things that appear to be sorely lacking throughout today’s broken EOIR.

The flawed EOIR approach to claims for asylum and withholding, particularly those involving the Northern Triangle and women, is very costly, not only to the humans involved, but also to our justice system. This respondent reentered the U.S. in 2009, and her merits hearing before the IJ took place in 2012. A careful, proper analysis could well have resulted in a grant at that time. 

Instead, this “plethora of errors,” created by EOIR’s corner cutting and obsession with denying claims, bounced around the system for nearly a decade before being “outed” by the Circuit Court — obviously the only judges involved who took the time to actually analyze the case in accordance with the law, the facts, and the arguments made by counsel. So, after nearly a decade, at three different levels of review, we’re basically back to “square one” with this case.

The case will be returned to the BIA who inevitably will return it to to the IJ for a new hearing that actually complies with the law and due process. Given the total dysfunction in the EOIR system, it’s could easily be around for another decade. 

Getting it right at the first level is critically important in a high volume, yet life determining, system like the Immigration Courts! That’s why it’s so absolutely essential that Judge Garland replace the current BIA and many of the current trial judges with “practical experts;” judges selected on a merit-basis because of their understanding of immigration and human rights laws, demonstrated analytical skills, and who by experience and reputation are overwhelmingly committed to due process, fundamental fairness, treating respondents and their lawyers with respect and dignity, and getting the right result the first time around. “The best and the brightest,” if you will! 

As this case that began well before Trump shows, the deterioration at EOIR has been underway across Administrations over the past two decades. It greatly accelerated and became more acute under Trump. That’s particularly true because “Trump AGs” drastically expanded the Immigration Courts and the BIA (while exponentially increasing the backlog), and now have appointed the majority of judges in the system — after just four years! 

Compare that with the Obama Administration’s practice of taking an mind-boggling average of two years to fill IJ vacancies! And, then filling them almost all with “government insiders and former prosecutors” rather than some of the many renowned “practical scholars,” experienced clinicians, and notable litigators in the private/academic/NGO immigration/human rights sectors. They actually left behind unfilled judicial vacancies for Sessions to “pounce on.” Says all you really need to know about the “priority” of immigrant justice in the Obama Administration. The “good enough for government work” attitude that has replaced “guaranteeing fairness and due process for all” as the “EOIR Vision” needs to go, now!

🇺🇸⚖️🗽Due Process Forever! Achieving it in the Immigration Courts will be the “litmus test” of whether Judge Garland succeeds or fails in his new role as Attorney General! You can’t improve justice for all in America while running a “court system” that denies justice, often ignores the law, mocks due process, eschews best practices and common sense, and routinely disrespects the humanity of those appearing before it! All while running up a stunning 1.3 million case backlog! As Justice Sotomayor would say: “This is not justice!”

Judge Tipton in the Southern District of Texas enjoined the 100-day removal pause. The 105-page order has something for everyone. For the history fans, there are references or citations to John Marshall, Joseph Story, and James Madison. For the federalism aficionados, there’s a description of the three branches of government and an explanation about the relationship between the federal government and the states. For the administrative law scholars and Bluebook fans, the proposition that “ICE is an agency within DHS” is supported by a footnote, a citation, and a parenthetical explanation. And for anyone interested in bilingual education, you’ll note that “regular” students cost Texas one amount and students enrolled in the state’s bilingual program cost another amount.

The case name says it all, particularly in light of the past two weeks. Indeed, “Texas v. The People” would be equally fitting. GOP misrule and the vile shenanigans of GOP politicos, like Texas AG Ken Paxton (who also fled the state during the crisis he and his party helped cause) has real life consequences. It kills and harms U.S. citizens of all political persuasions in addition to foreign nationals in our country. 

Note that the order does not purport to stop DHS or EOIR from granting stays of removal on a case by case basis. 

Notwithstanding the flaws in Judge Tipton’s reasoning, cogently pointed out by Cesar, I wouldn’t put much stock in the chances that the right-wing dominated Fifth Circuit or the Supremes will rein in Tipton and other righty jurists. I predict that GOP jurists oft-expressed grave concerns about the effect of nationwide injunctions will dissipate now that they are being used as a tool to undermine the Biden Administration’s attempts to return rationality and humanity to our justice system.

The deep problems in the Article III Judiciary, aggravated by four years of bad appointments by Trump & Mitch, reinforce the pressing need for immediate Immigration Court reform, starting with replacing the BIA. That is the most pressing task facing the Administration on the judicial front. The EOIR judiciary is one that the Biden Administration has complete authority to fix with better judges. Now, not later! 

And, with better judges at EOIR, there will be fewer bad legal decisions thrown into the Article III “lottery.” Moreover, as I continue to point out, it will give the Administration a much-needed pool of diverse, readily identifiable, talented, experienced, progressive, due-process/human rights committed jurists to draw on for Article III appointments. Additionally, it sets the stage for legislation to create an independent Article I U.S. Immigration Court.

Can advocates for racial justice, human rights, and immigrants’ rights finally get the message across to Judge Garland about the urgent need to act decisively? Or, like the Obama Administration, will this turn out to be another golden opportunity for justice squandered? 

Unfortunately, I could find little in this week’s confirmation hearings to visibly show that Judge Garland “got” the connection between the refuge that he and his family were so grateful for and the continuing unconscionable mess at EOIR. 

Indeed, if Judge Garland and his family showed up at our borders today seeking refuge from persecution, they would unceremoniously have been loaded onto a plane and “orbited” back to the persecution from which they fled without any process at all, let alone “due process of law.” Even if they had gotten a hearing, an EOIR “judge” somewhere along the line would undoubtedly have found a “reason to deny” regardless of the need for protection. 

For a good measure, they probably would have been mocked as “criminals, line jumpers, and job stealers” by GOP politicos and their toadies still stashed throughout our broken and compromised immigration bureaucracy. Their lives would have been treated as worthless; their removal to persecution, harm and possible death, just another “statistic” to tout in connection with false claims to having achieved “border security!”

Use the “overseas refugee program?” Probably not. Although Biden has pledged to restart refugee admissions, as a practical matter our once proud and highly efficient refugee processing system is currently in tatters after four years of intentional abuse inflicted by the defeated regime.

Every day that the ongoing problems at EOIR remain unresolved is another day of injustice for refugees and other migrants, as well as another day of frustration and abuse heaped on those attempting to help them achieve justice.

Assuming federal appellate judges decide, on average (and conservatively), at least several hundred cases per year, Trump’s judges will decide tens of thousands more cases than their Obama-appointed counterparts. To put it bluntly: The age of judges matters.

But Democrats still aren’t getting the message. At a Brookings Institution event in January, former attorney general Eric Holder touted racial and ethnic diversity — and diversity of professional background — but also said judges should only be appointed if they are 50 years old or older.

It would be a serious mistake for President Biden to follow that last piece of advice, and he would be repeating an error that Obama made. The Obama administration made substantial progress in diversifying the bench, but took a misguided approach when it came to age.

In an attempt to depoliticize judicial nominations, Obama mostly appointed highly experienced sitting judges and federal prosecutors during his first term as president. Senate Republicans rejected the olive branch, and in fact escalated obstruction of his nominees. Biden also wants to lower the temperature of partisan conflict, but there is no reason to think choosing older judges will have that effect.

Nominating younger judges is also crucial for developing leaders on the federal bench, including future Supreme Court justices. When presidents look for nominees to elevate to the high court, they usually select judges from the federal appellate courts. For example, Neil M. Gorsuch was a mere 38 years old when nominated (by President George W. Bush) to become an appellate judge, Brett M. Kavanaugh was 41 (also Bush), and Amy Coney Barrett was 45 (Trump). When later elevated to the Supreme Court they were 49, 53 and 48, respectively (average age: 50). Meanwhile, because Obama selected older judges, Biden will find only three Democratically appointed judges across the entire federal courts of appeals who are at that age or younger.

Younger federal judges have more time to build up a jurisprudence — a body of legal values, principles and judgments — as well as a professional network of other judges, lawyers and clerks who can develop, share and amplify their legal views. Republicans have long understood this: Many of their most famous and influential appointees were put on the appellate bench at young ages, including Frank Easterbrook (nominated at age 36), Michael Luttig (36), Kenneth Starr (37), Samuel Alito (39), Douglas Ginsburg (40), Clarence Thomas (41), Richard Posner (42), Antonin Scalia (46) and John Roberts (47).

If Democrats hope to shape the law for the next generation, they, too, need younger judges who have both the energy and a sufficiently long tenure on the bench to leave lasting legacies. Consider the example of Justice Sonia Sotomayor, who was one of President Bill Clinton’s youngest appellate nominees, at age 43; she was 54 when Obama nominated her to the Supreme Court in 2009. Over the past two decades, she has developed a distinctive and powerful voice on the bench. It’s unlikely she would have done so had she been nominated to the appellate court in her early-to-mid 50s.

The Biden administration has made an admirable commitment to diversifying the bench — signaling his intention to depart from Trump’s example. Not a single one of Trump’s 54 appointments to the appellate courts was African American. But there is no trade-off between youth and diversity. If anything, there are more women and more members of minority groups represented in the legal profession now than at any time in the past. At least when it comes to putting judges on the bench, this president can have it all. He can diversify the bench while at the same time appointing people who will be influential for decades, narrowing the partisan age gap in the judicial branch.

Absolutely right!

And, nowhere did the Obama Administration do a worse job than with the U.S. Immigration Courts which were entirely under their control at the DOJ! Can’t blame Moscow Mitch and his GOP Senate cronies for this failure!

As one of my Round Table ⚔️🛡 colleagues accurately described it:

I continue to repeat that following the Bush Administration’s terrible record for appointments based on Republican credentials and loyalty, Holder merely shuffled the deck of long-time EOIR bureaucrats, appointing as Chief IJ and BIA Chair and Vice-Chair individuals whose idea of leadership was keeping their heads down and doing what had always been done before.  There is presently a need for much more inspired appointments at the top.

Amen! I keep saying it: There needs to be an immediate “clean sweep” of EOIR so-called upper “management” and at the BIA. There are plenty of much better qualified folks out there who could “hit the ground running” on either a temporary or permanent basis.

Then, there must be a proper merit-based selection system with public participation and an active, positive recruitment effort that will attract a diverse group of “practical scholars” with actual experience representing asylum seekers and other migrants in Immigration Court. (“Posting” judicial vacancies on “USA Jobs” for a couple of weeks is both absurdly inadequate and “designed to fail” if your objective is to create a diverse expert judiciary of “the best, brightest, and most capable”).

Then, these merit-based criteria should be applied over time to “re-compete” all existing Immigration Judge jobs. These necessary steps will tie-in with the legislation to create an Article I Immigration Court. “Turn over” a top-flight “model judiciary” rather than the unmitigated disaster that now exists at EOIR.

An important consequence of the failure of Obama to build a better, progressive Immigration Judiciary is that it has deprived President Biden of a pool of younger progressive Immigration Judges with proven judicial credentials who, in turn, would have been prime candidates for filling Article III vacancies.

That’s not to say that some sitting Immigration Judges don’t have Article III credentials. Some undoubtedly have stood tall against the “Dred Scottification” of the Immigration Courts under Miller & Co. Not enough, but some.

However, had the Obama Administration acted with more wisdom, courage, and competence, the pool would be much larger — perhaps large enough to have put up a more concerted and higher profile resistance to the lawless, anti-immigrant, anti-due process agenda at all levels of EOIR over the past four years! 

Using better Immigration Judges as a source of progressive Article III Judges would also solve another glaring problem that has undermined equal justice and racial justice within the Article III Judiciary: the lack of expertise in immigration and human rights laws (which currently make up a disproportionate part of the Article III civil docket) and the human empathy and practical problem solving ability that comes from representing asylum applicants and others in Immigration Court. Nowhere is the lack of scholarship, integrity, and human understanding more obvious than with the woodenly anti-due process, anti-Constitutional, anti-rule-of-law performance of the tone-deaf and totally out of touch GOP majority on the Supremes in immigration, human rights, and civil rights cases. 

It’s no coincidence that the best-qualified of the current Supremes, Justice Sonia Sotomayor, has overtly “called out” her right wing colleagues’ inexcusable performance on cases affecting immigrants’ rights and human rights. It’s also no coincidence that in his new highly critical look at the failures of the Federal Judiciary in criminal justice, U.S. District Judge Jed S. Rakoff “would also require prosecutors to periodically represent indigent defendants so they appreciate the ‘one-sided nature . . . of the plea bargaining process.’” https://www.washingtonpost.com/outlook/2021/02/16/court-appointments-age-biden-trump-judges-age/

I guarantee that none of the current Supremes would put up with the outrageously unfair, biased, degrading, and dehumanizing practices intentionally and maliciously inflicted on vulnerable migrants and their attorneys on a daily basis at both the trial and appellate levels of our broken and dysfunctional Immigration Courts if they had personally experienced it. Nor should Judge Garland put up with the totally unacceptable status quo!

A better Immigration Court isn’t rocket science. It’s quite achievable on a realistic timeline. But, it will take both the will to act and putting the right “practical experts” (predominantly from outside the current Government) in place. Past Dem Administrations have failed on both counts, some worse than others. 

The Biden Administration can’t afford to fail on Immigration Court reform! For the sake of the vulnerable individuals whose lives are at stake! For the sake of America whose future is at stake!

Donald Trump used anti-immigrant demagoguery to launch his presidential campaign, accusing the people who hoped to make their homes here of being “rapists” and “bad hombres” and calling — nonsensically — for all of them to be sent back to their home countries, where they would “go to the back of the line” for readmission to the United States. He used them as scapegoats whom the “Make America Great Again” crowd could blame for the nation’s ills. Republican senators who once believed in reality-based immigration reform, such as Marco Rubio (Fla.) and Lindsey O. Graham (S.C.), stopped resisting the party’s xenophobia and came to embrace it.

Democrats sought political advantage by being seen as anti-anti-immigration, seeking support by opposing GOP initiatives such as Trump’s border wall. Yet they were disappointed to see Trump’s share of the Hispanic vote actually grow from 2016 to 2020 — demonstrating, in my view, that theatrical demonstrations of solidarity are no substitute for coming up with policies that voters believe would actually improve their lives.

Are we really going to continue like this indefinitely? Are we going to consign 11 million people to an extralegal existence because our politicians find it advantageous to argue about their fate?

Biden’s proposal would allow farmworkers, migrants brought here as children and those who have “temporary protected status” because of threats in their homelands to apply for citizenship in three years. The rest of the undocumented would have to wait eight years to apply to be citizens. All would have to pass background checks; and the amnesty — let’s call it what it is — would cover only those in the country before Jan. 1 of this year to prevent a new surge of people trying to cross the border.

Would Biden settle for legislation that normalized the status of only some of the undocumented, but not all of them? He has already said he doesn’t want to but might. Would he accept whatever scraps of reform that could be achieved through the Senate’s reconciliation process, which requires only 51 votes instead of 60? If it came to that, he wouldn’t have a choice.

But the Biden administration has shown a refreshing insistence on negotiating with the opposition rather than with itself. In seeking covid-19 relief, for example, Biden is asking for $1.9 trillion rather than some less eye-popping amount. When he lays out his plans for improving the nation’s infrastructure and making the transition to green energy, he is expected to request even more. Polls show that voters want bipartisanship and compromise — but the first crucial step in that process is defining the range of possibilities.

Biden is asking not for a few minimal immigration fixes but for a comprehensive solution. This is a president who wants more than a return to the old ways: He’s shooting for a truly new normal.

Over a two-decade career in the white-collar think tank world, I’ve continually wondered: Why can’t we have nice things?

By “we,” I mean America at-large. As for “nice things,” I don’t picture self-driving cars, hovercraft backpacks or laundry that does itself. Instead, I mean the basic aspects of a high-functioning society: well-funded schools, reliable infrastructure, wages that keep workers out of poverty, or a comprehensive public health system equipped to handle pandemics — things that equally developed but less wealthy nations seem to have.

In 2010, eight years into my time as an economic policy wonk at Demos, a progressive policy research group, budget deficits were on the rise. The Great Recession had decimated tax revenue, requiring more public spending to restart the economy.

But both the Tea Party and many in President Barack Obama’s inner circle were calling for a “grand bargain” to shrink the size of government by capping future public outlays and slashing Social Security, Medicaid and Medicare. Despite the still-fragile recovery and evidence that corporations were already paring back retirement benefits and ratcheting down real wages, the idea gained steam.

On a call with a group of all-white economist colleagues, we discussed how to advise leaders in Washington against this disastrous retrenchment. I cleared my throat and asked: “So where should we make the point that all these programs were created without concern for their cost when the goal was to build a white middle class, and they paid for themselves in economic growth? Now these guys are trying to fundamentally renege on the deal for a future middle class that would be majority people of color?”

Nobody answered. I checked to see if I was muted.

Finally, one of the economists breached the awkward silence. “Well, sure, Heather. We know that — and you know that — but let’s not lead with our chin here,” he said. “We are trying to be persuasive.”

The sad truth is that he was probably right. Soon, the Tea Party movement, harnessing the language of fiscal responsibility and the subtext of white grievance, would shut down the federal government, win across-the-board cuts to public programs and essentially halt the legislative function of the federal government for the next six years. The result: A jobless recovery followed by a slow, unequal economic expansion that hurt Americans of all backgrounds.

The anti-government stinginess of traditional conservatism, along with the fear of losing social status held by many white people, now broadly associated with Trumpism, have long been connected. Both have sapped American society’s strength for generations, causing a majority of white Americans to rally behind the draining of public resources and investments. Those very investments would provide white Americans — the largest group of the impoverished and uninsured — greater security, too: A new Federal Reserve Bank of San Francisco study calculated that in 2019, the country’s output would have been $2.6 trillion greater if the gap between white men and everyone else were closed. And a 2020 report from analysts at Citigroup calculated that if America had adopted policies to close the Black-white economic gap 20 years ago, U.S. G.D.P would be an estimated $16 trillion higher.

I’ll never forget Bridget, a white woman I met in Kansas City who had worked in fast food for over a decade. When a co-worker at Wendy’s first approached her about joining a local Fight for $15 group pushing for a livable minimum wage, she was skeptical. “I didn’t think that things in my life would ever change,” she told me. “They weren’t going to give $15 to a fast food worker. That was just insane to me.”

But Bridget attended the first organizing meeting anyway. And when a Latina woman rose and described her life — three children in a two-bedroom apartment with bad plumbing, the feeling of being “trapped in a life where she didn’t have any opportunity to do anything better” — Bridget, also a mother of three, said she was struck by how “I was really able to see myself in her.”

“I had been fed this whole line of, ‘These immigrant workers are coming over here and stealing our jobs — not paying taxes, committing crimes and causing problems,’” Bridget admitted. “You know, us against them.”

Soon after she began organizing, the cross-racial movement had won a convert. “In order for all of us to come up, it’s not a matter of me coming up and them staying down,” she said. “It’s the matter of: In order for me to come up, they have to come up too. Because honestly, as long as we’re divided, we’re conquered.”

Inability to think beyond racist myths and false narratives is holding America back from realizing our full potential. 

“Dividing and conquering” is the strategy of the modern GOP. If one could get behind the racist stereotypes and white resentment, rural America probably has far more in common with hard-working undocumented immigrants, African Americans, and Latinos than with elitist GOP politicos and corporate moguls — certainly more than with the notoriously lazy, dull, corrupt grifter Trump! But, the key seems to be to promote minority rule by sowing hate and distrust, thereby preventing the common good of the majority from prevailing.

While much of the “beggar thy neighbor” fear mongering comes right out of the current GOP playbook, Dems, including many in the Obama Administration, have also been guilty, as Heather points out. Just read some the alarmist stuff being put out by former Obama economic honcho Larry Summers.   

And, contrary to White Nationalist myths about “job stealing,” much of American economic growth and innovation can be traced directly to immigrants, both documented and undocumented.

Prof. Geoffrey Hoffman, Nov. 24, 2015 – “It is important, I think, to note the import but also the paradox behind the BIA’s latest precedent decision, Matter of Y-S-L-C-, 26 I&N Dec. 688 (BIA 2015) that admonishes IJ’s not to bully minors. In the decision, the Board discusses conduct by an Immigration Judge that can be construed as “bullying or hostile” behavior and says it is “never appropriate,” particularly in cases involving “minor respondents,” concluding such behavior may result in remand to a different Immigration Judge. I am glad that the Board is finally taking to task this kind of egregious IJ behavior. On the one hand, we should applaud the Board for pointing out this behavior and finally holding it up to the light of day in an important new precedent decision. On the other hand, it is a sad commentary on the behavior of some judges that the appellate body of the EOIR has to even say this publicly. Of course judges should not behave this way, and the fact that recusal is mandated by the BIA in such situations is something to congratulate the Board for now getting behind. But, one wonders whether this response is at all sufficient. Whether, as an IJ, I can now say, “Well, the worst that will happen is that I will have the case taken away from me on remand, and therefore I do not have to deal with this mess anymore.” It doesn’t seem like much of a deterrent.

In a case which I handled on appeal, the IJ denied the respondent’s attorney the opportunity to call a psychologist to testify about the respondent’s mental condition and disease (bipolar disorder), a fact which went directly to the particular social group and seemed particularly relevant to me. When the attorney respectfully requested permission to put on the expert witness, and specially whether the witness could testify about any medications the respondent had taken or was taking the IJ in response asked the attorney whether she was on any medications. Was she on any medications? I read and re-read that line again and again as I prepared the appeal thinking perhaps I had missed the joke. But this wasn’t a joke. It was simply intemperate behavior by an IJ. Thankfully, the BIA correctly and compassionately remanded the case but based on the bipolar condition, recognizing that it could form a valid PSG. No mention was made of the issue of judicial impropriety I had raised in the brief. In other appeals I have done before the Board, I have noticed that when raising issues with the Board about IJ’s missing evidence or even misconstruing the factual background, the Board does not seem to deal with these issues head-on but instead bases their decisions on some other ground, preferring to adjudicate the appeal on a legal ground rather than on the basis of judicial misconduct or judicial mistake. And there is nothing surprising here, with the Board insulating IJ’s from admonishment and not highlighting their misunderstandings of the record, but there is I think a cost which has been underreported or perhaps not even appreciated. The cost is that IJs become used to behaving in a way that can be described as intemperate at best and demeaning or demoralizing and abusive, at worst.

This said, I do have a lot of sympathy for many IJs, having worked very hard myself for a federal judge for two years after law school, and seeing and appreciating the incredible stress and responsibilities of being a judge. The IJs, it should be mentioned, have it worse: they have to juggle a case load of hundreds and hundreds of cases, while at the same time maintaining compassion and composure at all times, and at the same time providing a clear, cogent and correct legal analysis in all cases and contexts. However, and this needs to be said, I think some IJs should not be IJs and should not have been selected to be IJs. If we want to make the immigration court system work we need to do a better job in vetting these judges, choosing based on temperament and suitability to deal with the rigors of handling all these cases with compassion and professionalism.

This is the time now (at this very moment) to make this statement as loudly and boldly as possible, since EOIR right now is advertising for 50+ new judgeships across the country. Since we have approximately 250+ judges, this represents an approximate 20 percent increase. I implore EOIR to make these decisions with due regard to how the judges might act in future, not just whether they have experience deporting people, working for the government in other capacities, or experiences such as being in the military. While those are factors, let’s draw from the ranks of those with proven compassion, like the YMCA directors, legal aid attorneys, and people who will never belittle a child, never lose themselves in the power and prestige, and be resilient and persevere in one of the hardest jobs imaginable.”

Unfortunately, the Obama Administration ignored Geoffrey’s plea. Instead of creating a well-qualified, independent, progressive judiciary that could achieve the “EOIR Vision” of: “Through teamwork and innovation becoming the world’s best tribunals, guaranteeing fairness and due process for all,” the Obama Administration handed out immigration judgeships like they were service awards for DHS prosecutors, DOJ attorneys, and other government lawyers.

The Obama selections appeared designed primarily to avoid appointing anyone who might have the background, backbone, and courage to “rock the boat” and stand up for immigrants’ rights even when it meant rejecting ill-advised and legally questionable Administration enforcement policies and procedures. In other words, truly independent judging and thinking was discouraged in favor of a “go along to get along” atmosphere mischaracterized as “collegiality.” 

Sure, collegiality has its benefits. But, in the end, independent judging is about justice for the individuals coming before the courts, not about institutional survival, job preservation, making friends, achieving bureaucratic performance goals, or pleasing political “handlers” who don’t want to read about their “subordinates” in the “funny papers.” When I was ousted from the BIA as part of the so-called “Ashcroft purge,” I noticed that those those judges who were “collegial” but outspoken about immigrants’ legal rights got punished right along with those who were perceived as “less collegial” in standing up for the same rights.

Moreover, the Obama folks designed an unwieldy and astoundingly inefficient “Rube Goldberg selection system” that took more than two years to fill an average IJ vacancy — much longer than the Senate confirmation process! This was at a time when backlogs were building and the NAIJ and the “line IJs” were begging “EOIR management” for help. “Management” could have achieved comparable results simply by throwing darts at a board containing the names of government attorneys. And, it would have cut the red tape. 

Inept as the Obama Administration might have been, the Trump kakistocracy of course proved to be our worst nightmare. They “weaponized” the EOIR immigration judiciary into a tool of White Nationalist nativist enforcement, racial injustice, and misogyny. Here are some of the things Sessions and Barr did at the behest of Stephen Miller:

  • “Packed” the BIA with judges known as “asylum deniers” — some with denial rates in excess of 90%;
  • Appointed IJs from the Atlanta Immigration Court, which had generated Matter of Y-S-L-C-, to the BIA in an overt attempt to replicate the “Asylum Free Zone” as Atlanta was known throughout the private bar;  
  • “Rewarded” with BIA appointments several judges who had complaints lodged against them for their rude and unprofessional in-court behavior, open hostility to asylum seekers (particularly women), and unprofessional treatment of private attorneys; 
  • Issued bogus EOIR and BIA precedents, some on their “own motion,” that were almost 100% against respondents and in favor of DHS Enforcement while undoing long-standing rules that had promoted fairness to asylum seekers and sound docket management;
  • Appointed almost all government/prosecutorial background Immigration Judges, many without immigration qualifications, others associated with anti-immigrant or anti-gay groups;
  • “Decertified” the National Association of Immigration Judges (“NAIJ”) as punishment for speaking out against gross mismanagement at EOIR and DOJ;
  • Imposed due-process-denying unprofessional “production quotas” on IJs intended to increase deportation rates;
  • Deprived IJs of effective management control over their dockets, while engaging in endless “Aimless Docket Reshuffling;”
  • Unethically exhorted IJs to treat the DHS as their “partners” in enforcing immigration laws;
  • Gave the Director — essentially a political appointee disguised as a career executive — authority to interfere with BIA decision making in certain cases;
  • Basically reduced Immigration Judges to the status of “deportation clerks” while falsely claiming that they were “management officials” to “bust” the union;
  • “Dumbed down” immigration judge training;
  • Artificially “jacked up” the Immigration Court backlog to an astounding 1.3 million cases — even with twice the number of IJs on the bench.

As one of my esteemed Round Table colleagues said, “since [Geoffrey’s article] was written, record numbers of good IJs resigned over the past 4 years, many good candidates wouldn’t apply (or if they did, likely weren’t chosen) over the past 4 years, and then just the general drop in quality that comes with that degree of expansion [in the absence of competent planning].”        

The lack of compassion, glaring disregard for the protective purposes of refugee law, and absence of human understanding as to what it means to be a refugee seeking salvation simply screams out from the last four years of perverse AG and BIA precedents as well as from some of the elementary mistakes made by EOIR judges at all levels in the numerous cases reversed by Courts of Appeals over the past four years.  

And, this is just the “tip of the iceberg.” Many seeking protection are denied any hearings at all, railroaded out without understanding what’s happening, or simply give up without appealing wrong decisions and denials of due process — worn down by the abusive and unnecessary detention that EOIR helps promote and the intentionally “user unfriendly” procedures developed to discourage individuals from asserting their legal and human rights. 

While the broken and reeling Department of Justice presents many challenges, I predict that Judge Garland’s tenure will be remembered largely by how he deals, or doesn’t deal, with the total disaster in the U.S. Immigration Courts. The Trump regime’s attack on democracy and people of color began with immigration, and the effort to dehumanize and degrade migrants continued until the final day. 

Will Judge Garland leave behind a reformed, progressive, due-process-oriented system that is a model judiciary? One that finally fulfills the vision of — “Through Teamwork and innovation action becoming the world’s best tribunals, guaranteeing fairness and due process for all?” A court that can easily transition out of the DOJ intro an independent Article I Judiciary? Or will he leave behind another disgraceful mess and the dead bodies, broken dreams, and visible betrayals of American values to prove it?

Only time will tell! But, the NDPA will be watching. And, there isn’t much patience out here for more of the “EOIR Clown Show!”🤡🦹🏿‍♂️

After days of confusion about changes along the southern border, the Biden administration on Wednesday said immigrants should not try to enter the US because most will still be turned away under a Trump-era policy that has recently come under legal scrutiny.

Confusion about who was being allowed into the US in recent days forced the administration to issue a stronger warning. Last week, reports of some families being allowed into the US after being apprehended at the border resulted in speculation that immigrants would no longer be immediately expelled and instead be allowed to fight their immigration cases from within the United States. In the Rio Grande Valley in South Texas, immigration advocates have reported seeing about 100 people a day released by Customs and Border Protection. In other parts of Texas, shelters have also seen increasing numbers of immigrant families, but it is not clear why.

Attorneys and advocates who work with immigrants along the border have been bombarded with phone calls and texts about whether they should try their luck at getting into the US. Erika Pinheiro, policy and litigation director with the immigrant advocacy group Al Otro Lado, said it was “incredibly disappointing” that the Biden administration has continued to expel immigrants under the CDC order.

“We know now that the CDC order prohibiting asylum processing at the border did not arise from public health concerns but rather was part of Stephen Miller’s efforts to dismantle the US asylum system and was implemented despite opposition from CDC leadership,” Pinheiro said, referring to one of Trump’s former senior advisers. “US expulsions of asylum-seekers, including infants, constitute plain violations of domestic and international laws meant to protect vulnerable refugees. CBP absolutely has the resources to process asylum-seekers in a safe and humane way.”

The turnbacks, known as expulsions, are legally different from deportations, which would mean an immigrant had actually undergone the immigration process and found to not be legally allowed to stay in the US. Critics say the government is using the public health orders as an excuse to turn back immigrants at the border.

“While we recognize that the Biden administration has been saddled with a lot of bad policy and structural problems, it cannot continue the Trump administration practice of turning away people in danger based on illegal policies, such as the notorious and pretextual Title 42 policy,” said Lee Gelernt, an attorney with the ACLU.

“Go suffer and die somewhere else, out of our sight,” might not be the best message for an Administration trying to re-establish its human rights and humanitarian leadership and credentials. Ever hear of the “St. Louis Incident?” It’s always easy to find a way to “just say no” to refugees — and the consequences are seldom pretty. 

Those who won’t learn from history are destined to repeat it. Refugee and forced migration situations happen in the “here and now;” they can’t be “back burnered” — no matter how much policy officials might wish otherwise. In a forced migration situation, “doing nothing” is an action that produces consequences for both the forced migrant and those who ignore their plight.

There are many daily potentially deadly and dehumanizing consequences of continuing to ignore asylum laws and Constitutional due process for asylum seekers at our Southern Border.

One predictable one: Instead of turning themselves in at the border or to the Border Patrol shortly after entry, as had been happening until Miller & co. intervened, those seeking refuge apparently have gotten the message that our legal system is and remains a sham for them. Consequently, increasingly they are simply evading the Border Patrol and disappearing into the interior with no screening whatsoever — health, legal, or background. Also, by intentionally driving people out of the legal system, the Administration is totally blowing a chance to harness and build upon one of the most powerful known facts — represented individuals with asylum hearings scheduled show up for their hearings!

Sure, there are many aspects of this problem. But, it has been “out there” for nearly a year!

Sure seems to me that with the right experts in charge, including folks like Lee Gelernt and Erika Pinhero, this issue could and should have been addressed more constructively and with much more urgency by the Biden Administration by now. Why not harness the expertise and proven problem solving abilities of folks like Lee, Erika, and many other members of the New Due Process Army rather than fighting with and resisting them? 

Instead, it looks like time and resources will continue to be wasted on forcing policy changes through litigation. Meanwhile, vulnerable asylum seekers and their families will continue to suffer as illustrated by this recent article from HuffPost about the human consequences for those caught up in the Government’s scofflaw border policies.

NOTE TO PRESIDENTIAL PRESS SECRETARY JEN PSAKI: Sorry, Jen, but those fleeing for their lives don’t generally respond well to “don’t come right now, we don’t want you” messages, particularly from folks who have never been in that situation themselves. It’s actually pretty insulting to think that folks fleeing to the U.S. 1) aren’t smart enough to know the dangers involved; 2) don’t realize that the the U.S. Government doesn’t want them; and/or 3) have choices about their travel as Jen and her buddies might have when planning a summer vacation. 

As one of my esteemed colleagues once told me: “Desperate people do desperate things.” What about people who keep repeating the same policy mistakes over and over while expecting different results and failing to grasp either the absolute urgency or the human side of forced migration issues? It’s sort of like going to the emergency room with a burst appendix and being told, “Why don’t you just sit in the waiting room until we doctors figure out what to do? Get back to you later!”

Somewhere out there, Stephen Miller must be gloating about how he totally outsmarted and outflanked the Biden Team!

While Donald Trump failed to pass much signature legislation and largely failed to remake the federal government in ways that cannot be immediately corrected, his landmark achievement will be his lasting contributions to the federal judiciary. Breaking the records of his predecessors, Trump seated 234 judges on the federal courts in four years, including three at the Supreme Court. That means that whatever Biden and the Democrats try to do in the coming months and years, most of the efforts will ultimately be in the hands of life-tenured judges, 30 percent of whom were named by Trump. Those judges are overwhelmingly very young, very white, and very male. A preview of what’s likely to come happened just last week, when a federal judge tapped by Trump blocked Biden’s 100-day deportation “pause” with a nationwide injunction.

The question is what Biden and the Democrats can and will do in response to Trump’s enduring legacy. The new president is already making moves that indicate he understands that some of the norms and conventions that guided Barack Obama in building the judiciary are dead and gone. This week the Washington Post reported that the Biden administration is doing away with the formal American Bar Association vetting process that Democratic presidents used to abide by, because it was jettisoned by Republican presidents and because it simply lengthened the process. Biden is also hustling to put together the bipartisan commission he pledged would examine structural reforms for the Supreme Court and the federal judiciary. Former Wisconsin Sen. Russ Feingold is a leading Democrat attempting to strengthen the left’s ability to appoint judges, to match the pace the right has set. He is the president of the American Constitution Society, the left’s answer to the Federalist Society (we spoke last year when he assumed the post). Given the potential of the current moment for big changes in the judiciary, I wanted to ask him what happens next. Our conversation has been lightly edited for clarity.

The disgraceful mess that Trump and McConnell made out of our Federal Judiciary has been a constant theme here @ Courtside over the past four years!

What’s missing from this interview are these fundamental realizations that those of us in the world of immigration and human rights know well but seem to escape most of the others looking to fundamentally change and improve the Federal Judiciary:

  • There are few things that go on in the Federal Judiciary, at any level, as important to human lives and the future of our nation as what takes place in Immigration Court every day;  
  • The Immigration Courts have hit stunning new levels of dysfunction, incompetence, and intentional injustice over the past four years  — they are truly an ongoing national disgrace (“America’s Star Chambers” or “Clown Courts”🤡) and a stain on the humanity of our nation, as well as an abomination that threatens to collapse our entire justice system;
  • Immigration law and “weaponized” Immigration Courts have been the key to the Trump regime’s attack on American democracy and our Constitutional institutions culminating in the deadly Capitol insurrection;
  • The Biden Administration has complete authority to fix the Immigration Courts now — no waiting for Justices or Judges to retire, “negotiating with Mitch and the Federalist Society,” waiting for the scheduling of Senate Confirmation hearings, or humoring home state Senators;
  • Some of the lawyers and advocates who led the legal fight to preserve American democracy over the past four years would be outstanding choices for the Immigration Judiciary (as well as the Article III Judiciary — there is no shortage of diverse progressive talent with “real life retail experience” out here in the NDPA, Russ); 
  • A well-functioning, diverse, independent Immigration Judiciary would not just help advance and enforce the Administration’s progressive, humane, due-process-focused immigration and human rights policies, but also should become a model of “best practices” for the Article III Judiciary, and an extraordinary source of well-trained, experienced, progressive, “practical scholar jurists” for filling positions in the Article III Judiciary;
  • Better understanding of, and commitment to, humanely and properly administering immigration and human rights laws by Federal Judges — and the total elimination of “Dred Scottification of the other” under law — is the absolutely essential “now-missing key” to achieving racial justice and social justice in America;
  • America can’t afford the astounding absence of true immigration scholarship, human understanding of immigrants, practical decision making and problem solving, and an overriding commitment to due process for all persons, including asylum seekers and migrants, that now infects the Federal Court system at all levels;
  • Those seeking to undermine American democracy will continue to exploit the Federal Judiciary’s overall lack of understanding of immigration and human rights laws and their willing abrogation of Constitutional due process and basic concepts of fundamental fairness and human dignity for some of the most vulnerable persons among us — we must fix this problem before it destroys us!

In his first days in office, President Joe Biden has made immigration a key priority for his administration, seeking to distinguish himself from another “deporter in chief,” as activists once called President Barack Obama.

He has issued a series of executive actions aimed at dismantling the Trump administration’s nativist legacy, unveiled an ambitious legislative proposal for immigration reform, begun to roll back a program that has left asylum seekers trapped in Mexico, and sought to enact a 100-day pause on deportations.

On Tuesday, he issued another three executive orders that create a task force to reunite families separated under President Donald Trump and implement measures to remove obstacles to noncitizens seeking to naturalize, enter the US on visas, and obtain asylum or other humanitarian protections. White House press secretary Jen Psaki said to expect additional announcements, including an expansion of the US refugee program, going forward.

For immigrant communities, those changes can’t come soon enough. Democrats have long promised to create a more just immigration system, and Biden’s initial actions have built confidence among some immigrant advocates that he intends to finally deliver, though they wish he would act even more quickly on behalf of people whose lives are hanging in the balance.

The task before Biden is immense. Immigrant communities expect him not just to revert to the Obama-era approach to immigration enforcement, which involved record deportations and an expansion of family detention, but to improve on it. And while Obama failed to pass comprehensive immigration reform or even a narrow bill offering legal protections to “DREAMers” who came to the US without authorization as children, activists see immigration reform as an imperative and are counting on Biden to pass it by whatever means possible.

Though Biden has largely stood by his record as vice president, he has acknowledged that the Obama administration stumbled on immigration, particularly with regard to mass deportations.

“We took far too long to get it right,” Biden told Univision last February. “I think it was a big mistake.”

Since Obama was in office, the public has become more favorable to immigration, in part as a reaction to the shock-and-awe tactics behind the Trump administration’s high-profile travel ban and family separation policies. The Democratic Party is also more unified on immigration, a topic they once regarded as politically radioactive.

Refugee admissions fell to a historical low under President Donald Trump, with the current cap sitting at 15,000

President Joe Biden on Thursday announced his intention to massively increase the cap on annual refugee admissions to the United States, which fell to a historical low under Donald Trump.

In line with a campaign promise, Biden said he would set at 125,000 the cap on admissions as part of the country’s refugee resettlement program, against the current 15,000.

‘We offered safe havens for those fleeing violence or persecution’ in previous years, when America’s ‘moral leadership on refugee issues’ encouraged other nations to open their doors as well, Biden said.

‘So today I’m approving an executive order to begin the hard work of restoring our refugee admissions program to help meet the unprecedented global need,’ he added.

‘It’s going to take time to rebuild what has been so badly damaged, but that’s precisely what we’re going to do.’

One of the most damaging effects of the Trump regime’s cowardly and counterproductive “war on refugees” was the withering and disappearance of the premier “resettlement infrastructure” run by NGOs. It was one of many things that made our refugee program highly efficient. 

The cruelty and stupidity of a White Nationalist regime that intentionally “broke” many of the functioning parts of our society while pouring money down the drain on a far right racist agenda simply can’t be overestimated.

Refugees have been a key part our national success. Moreover, as President Biden said in his inaugural address, “leading by example” is essential to foreign policy. Tuesday’s directives mandate a review, but do not end, the Remain in Mexico policy, which Biden had said he would rescind on his first day in office. Officially termed the Migrant Protection Protocols, or MPP, it has forced roughly 70,000 asylum seekers back to Mexico to wait in some of the world’s most dangerous cities for immigration court hearings in the U.S. that have been largely suspended since the Trump administration effectively closed the border last March, citing COVID-19.

Human Rights First has recorded at least 1,134 public reports of murder, torture, rape and kidnapping against asylum seekers returned to Mexico under MPP. Thousands have given up.

On Jan. 20, the Homeland Security Department announced that no new asylum seekers would be subjected to MPP, telling some 30,000 migrants left in limbo at the border by Trump that they should “remain where they are, pending further official information from government officials.”

Tuesday’s directives, as described by the officials, provide little additional clarity as to how the Biden administration will process those already subjected to MPP, along with thousands of others waiting.

Ensuring that MPP and other cases are processed “humanely” while safeguarding public health amid a pandemic is “fairly complicated,” one senior official said.

“I can’t tell you exactly how long it will take to have an alternative to that policy,” the other senior official said. Those under MPP will “certainly be taken into account because of the length of time they’ve waited and the conditions they are waiting in.”

On Monday, the administration effectively dropped appeals by the Trump administration in lawsuits against MPP and the diversion of billions in federal funds for border barrier construction. The acting Homeland Security head asked the Supreme Court to remove both cases, scheduled for oral arguments later this month, from its docket.

The Biden administration has not yet said what it will do with the effective closure of the border by the Trump administration under Title 42, which Tuesday’s directives do not address. The officials Monday cited ongoing litigation over the policy for the lack of action.

Under Title 42, Trump officials rapidly expelled hundreds of thousands of migrants, including asylum seekers and unaccompanied children, without due process. Whistleblowers at the Centers for Disease Control and Prevention said the Trump White House pushed the order for political, not public health, reasons.

On Tuesday, Biden also will take steps to restore Obama-era pathways allowing vulnerable groups in Central American to apply for admission to the U.S. from within the region, officials said.

Five things that could be done immediately, without study:

  • Vacate all the anti-asylum precedents from the AG and the BIA since 2016;
  • Assign some Immigration Judges whose “TRAC Record” shows that they understand asylum law and aren’t afraid to grant protection to hear any scheduled MPP cases;
  • Replace the BIA (or at least create an “MPP Appeals Panel”) with judges who have demonstrated excellence and expertise in asylum law; 
  • Do not go forward with any MPP case involving an unrepresented applicant;
  • Bar the issuance of “in absentia orders” in MPP cases.

 Last week, 9000 Hondurans were beaten and tear-gassed in Guatemala as they tried to make their way to the U.S. border. More will be coming. The Biden administration just introduced the most comprehensive immigration bill since Ronald Reagan and also hopes to embark on a new strategy for the Northern Triangle of El Salvador, Honduras and Guatemala.

This is undisputedly good news for a region ravaged by two Category 5 hurricanes in 2 weeks and an economy devastated by the Covid pandemic. But, unless that aid directly addresses the rampant corruption that has taken hold in the region, it will not stop thousands of desperate people from fleeing countries that give them little hope to survive much less flourish.

Make no mistake, it is corruption that has stolen hope from the region. Elites steal from school and hospital budgets to fund political campaigns and line pockets. Politicians give family members and supporters coveted government positions that should go to those most qualified. Police are bribed and threatened to look away while drug traffickers and gangs shatter communities.

Until this staggering systemic corruption is dismantled and the education, health and security institutions strengthened, Central Americans have little reason to hope for a future in their own countries.

During his presidential campaign, Joe Biden issued just one policy position for the Western Hemisphere and it was on Central America. In it he proposed a number of worthy initiatives, but one merits special consideration– a Central American anti-corruption commission that operates outside the control of the elites who are most threatened by its existence.

To be successful, this commission must learn from past experiences in Guatemala (CICIG), Honduras (MACCIH) and El Salvador (CICIES). While the first two enjoyed significant success, as soon as U.S. and local political pressure waned even a little, the local elites joined together to expel them.

Easier said than done. Many of the corrupt governing elites in Central America have close ties to our Government. They aren’t lightly going to let foreign assistance, whether from governments, NGOs, or private agencies go anywhere but their own pockets.

Also, Republicans in Congress have shown no willingness to deal with the overt corruption, grafting, and grafting of the Trump regime. 

But the article is spot on about two things. Most Central American migration is driven by political punishment and exploitation of the people by corrupt government elites and those allied with them (gangs, in many instances). Far from being “random violence” or “common crime” as many restrictionists and border bureaucrats claim, it’s simply a variation of classic political, ethnic, and social group persecution. Those fleeing this abuse are refugees. Only by abdicating the law, intentionally skewing it, and too often just overtly violating it (sometimes with the complicity of courts, sometimes in violation of court orders) has our Government been able to avoid granting them the legal protection they deserve.

Second, desperate refugees are going to continue to come as long as they perceive it’s safer here than in their broken home countries or any of the other countries they will have to cross to get there. No walls, prisons, death at the border, violations of domestic and international law, racist rhetoric, illegal deportations, child abuse, misogyny or or other cruel, inhuman, and immoral policies will stop human migration.

We know roughly how many have been illegally returned and imprisoned. We have some “guesstimates” as to how many additional border crossers our failed policies have killed. 

But, we have little or no idea how many have taken to heart our message about the falseness of our claim to be a “nation of laws” and the readily apparent bankruptcy of our legal system. Undoubtedly, those who “get it” have or will in the future simply keep crossing the border until they die in process or get to the interior where their chances of melding in and surviving are much better than their chances of getting a asylum or other protections from an EOIR that still appears to be carrying out the Steven Miller White Nationalist agenda.

The “government policies” of actively discouraging and punishing asylum applicants who apply in an orderly way at the border is as insanely stupid as it is cruel and illegal. Actually, allowing individuals to apply for asylum at the border “regardless of status” is a hallmark of the Refugee Act of 1980!

A few thousand desperate refugees who walk here from Central America pose no realistic threat to America or our national security. They merely detract attention from the real threats: armed right wing insurrectionists launching a deadly attack on our Capitol, right wing domestic terrorists energized by Trump, and maskless “magamorons” running around spreading deadly disease. 

Process those applying at the border promptly under the appropriate generous legal criteria after giving them access to trained asylum advocates. Admit those who qualify after proper health and security screening. Work with the UNHCR and NGOs on how to handle those who don’t meet refugee criteria. Just aimlessly returning them to danger zones in the middle of a pandemic is obviously a nonstarter. So, we’re going to need smarter people, with real expertise and a humanitarian outlook, working on better solutions. We know lots about what DOESN’T work. Now, we need to come up with what WILL work.
